Parmi les droits de « propriété » intellectuelle, le #droit des #marques n'est pas celui qui soulève habituellement le plus de contestations. Pourtant avec son article « Trademarks : the Good, The Bad and The Ugly », Cory Doctorow tire la sonnette d'alarme à propos d'une dérive inquiétante : le glissement progressif vers une forme d'appropriation des mots du #langage. Au rythme où vont les choses, prévient-il, le droit des marques pourrait bien finir par nous “enlever les mots de la bouche”.
On pourrait croire qu'il s'agit d'un fantasme, mais les dérapages en série des Trademark Bullies, ces firmes qui utilisent le droit des marques comme moyen d'intimidation, montrent qu'il n'en est rien : Facebook cherche ainsi à s'approprier les mots Face, Book, Wall et Mur ; Apple attaque une épicerie en ligne polonaise qui avait le malheur de s'appeler “a.pl” ; Lucasfilm fait la chasse aux applications Androïd dont le nom comporte le terme “Droïd”, déposé comme marque après Star Wars…
On pourrait citer encore de nombreux exemples, parfois terriblement cyniques, comme lorsqu'il y a quelques jours “Boston Strong”, le cri de ralliement des habitants de la ville de Boston, a fait l'objet de plusieurs dépôts de marques par des fabricants de bière ou de T-shirts juste après les attentats ayant frappé la ville ! On ne recule devant rien pour “l'or des mots”…
Ces dérives prêteraient presque à rire si elles ne nous faisaient glisser peu à peu dans un monde passablement dystopique. Ainsi lors des Jeux Olympiques à Londres en 2012, les médias qui n'avaient pas acheté les droits pour couvrir les épreuves ont préféré dire “The O-word” plutôt que de risquer des poursuites en justice de la part du CIO, lequel n'a pas hésité à invoquer le droit des marques pour museler des opposants. Nous voilà presque dans Harry Potter, avec des marques-dont-on-ne-doit-pas-prononcer-le-nom !

Si vous faites suffisamment la Une en jouant les gros-bras, alors vous pouvez créer une autre sorte de notoriété, le genre de notoriété qui parvient à créer l'association suivante : « Hmmm, cet écrivain a utilisé le terme ‘space marines' dans son livre, et je sais que Games Workshop sont d'immenses connards qui transforment votre vie en véritable enfer si vous avez le malheur de respirer les mots ‘space marines', donc ça doit être quelqu'un associé à Games Workshop. »

This past week, Dzhokhar Tsarnaev reportedly told investigators that he and his brother set off bombs near the finish line of the Boston Marathon in part because of their opposition to the U.S. wars in Iraq and Afghanistan. As a Marine who fought in Afghanistan in 2008 and 2010, the news made me wonder: Had my war brought the horrors of battle home?

I deployed to Afghanistan believing my presence in that country would help stop attacks such as Boston's from happening. But instead, my war has spilled over, striking the city where my 22-year-old brother goes to school and where my mom, until recently, felt perfectly safe eating lunch outdoors.
The Tsarnaev brothers aren't the first alleged terrorists to cite U.S. military intervention in other countries as a reason for targeting civilians, and they won't be the last. Despite our best efforts and valor, I wonder, have America's wars made the homeland less safe? Sure, we've killed and captured thousands of radicals who wanted to harm Americans. But in doing so, have we created more?

So, let's look at the big picture. The slain older brother, Tamerlan Tsarnaev, had a green card, while the surviving younger brother, Dzhokhar, is a naturalized citizen. As I said, they both arrived here fairly recently.
But then, so did Lu Lingzi, one of the three people killed in the explosions. She was from China, a graduate student at Boston University who played piano and liked dogs and blueberry pancakes.
The Tsarnaevs' 26-year-old carjacking victim was also born in China. According to a Boston Globe story on his harrowing experience “his quick-thinking escape…allowed police to swiftly track down” the brothers, “abating a possible attack” on New York City.
Guess who else was foreign born? The gas station clerk who sheltered the carjack victim and called 911. His name is Tarek Ahmed. He is 45 years old,. He told a Times reporter, Wendy Ruderman, that he is Muslim and came here from Egypt seven years ago.
Mr. Ahmed also told The Times: “I love this country. My heart goes out to everybody who is affected by this.”
The story of the Boston marathon attacks is not just about two immigrant brothers suspected of committing a horrific act of violence. It is also about the foreign residents and immigrants they victimized and those who assisted in their capture.
The “big picture” is the same as it ever was: Visa shortages and the millions of people living in the shadows, doing jobs no one else wants.

During the 1980s and into the 1990s, Islamist foreign fighters operated robust recruiting and financing networks that supported Chechen jihadists from the United States, and Boston was home to one of the most significant centers: a branch of the Al Kifah Center based in Brooklyn, which would later be rechristened CARE International.
Al Kifah sprang from the military jihad against the Soviets in Afghanistan. Through the end of the occupation, a network of centers in the United States helped support the efforts of Afghan and Arab mujahedeen, soliciting donations and recruiting fighters, including at least four from Boston who died in action (one of them a former Dunkin Donuts employee). When the war ended, those networks did not disappear; they refocused on other activities.
In Brooklyn, that network turned against the United States. The center's leaders and many of its members helped facilitate the 1993 World Trade Center bombing, and they actively planned and attempted to execute a subsequent plot that summer to blow up the Lincoln and Holland Tunnels in New York, which would have killed thousands.
When the FBI thwarted the tunnels plot, the Brooklyn Al Kifah office and most of the other satellite locations were shuttered. But in Boston, the work continued under a new name and with a new focus: supporting foreign-fighter efforts in Bosnia and Chechnya.
The following narrative is derived from interviews and thousands of pages of court exhibits, including correspondence, Al Kifah and CARE International publications, and telephone intercepts developed over a years-long series of FBI investigations into the charity that were made public as part of multiple terrorism-related prosecutions.
Established in the early 1990s, the Boston branch had emerged from the World Trade Center investigation relatively unscathed. Little more than two weeks after the bombing, the head of the Boston office, Emad Muntasser, changed his operation's name from Al Kifah to CARE International (not to be confused with the legitimate charity of the same name).
Telling the IRS it was a non-political charity, CARE applied for and received a tax exemption, but its operations continued as before — supporting jihad overseas with money and men. Although it was heavily focused on the ongoing conflicts in Bosnia and Chechnya, its interests reached around the globe to anywhere mujahideen were fighting. As one associate of the group put it in a phone call recorded by the FBI, “As long as there is slaughtering, we're with them. If there's no slaughtering, there's none, that's it. Buzz off.”
The name change deflected public scrutiny, and while law enforcement monitored the Boston operation for many years, the Justice Department made no attempt to prosecute the organization's principal leaders until after the September 11, 2001 attacks.
Jihadist propaganda and recruiting didn't begin with the Internet, as it sometimes seems today. CARE's tactics included dinner speeches and events at local mosques and universities, among them MIT, Boston College, and Boston University, usually slipping them in under the auspices of the local Muslim Students Association, sometimes as part of Friday services. They ran “phonathons” to contact potential donors at home with urgent appeals for generosity.
The charity also arranged public screenings of jihadist videos, long before the advent of YouTube. One letter to CARE supporters promised to “bring to your [mosque] the latest video tape from CHECHNYA showing how Grouznyy [sic] was recaptured by Muslims and how the CHECHENS are struggling to implement the Islamic rule in their land by help of Allah (S.W.T). It will be a fund raising event. For the Donations we have our direct contact to CHECHNYA.”
When the Internet did come along, CARE was an early adopter, using email blasts and websites to further spread its message.
Although CARE was based in Boston, the radical fundamentalists who ran the charity (a mix of American citizens and immigrants from the Middle East and North Africa) were often disappointed with local Muslims, who were not particularly interested in their cause.
“I hate Boston,” said Mohammed Chehade, a director of the Global Relief Foundation, one of the charities through which CARE laundered its money, in a phone conversation with CARE's directors that was recorded by the FBI in 2000. “Do you know why I hate it? The men are far from each other, far away, it is a trip between one and another. They are busy. I mean, Boston... if someone wants to stay in America temporarily, it is not a place to be.”
In other conversations, CARE's leaders bemoaned the fact that area Muslims refused to cough up money for the network's radical speakers, suggesting that they avoid bringing prominent speakers to the city, or at least characterize the trips as something other than fundraising, for fear of an embarrassingly low result.

In an interview with Fox News, the former governor of Alaska said that although federal investigators have yet to complete their work, the time for action is now.
“We don't know everything about these suspects yet,” Palin told Fox and Friends this morning, referring to Tamerlan and Dzhokhar Tsarnaev, who allegedly carried out the Boston Marathon attacks. "But we know they were Muslims from the Czech Republic.
"I betcha I speak for a lot of Americans when I say I want to go over there right now and start teaching those folks a lesson. And let's not stop at the Czech Republic, let's go after all Arab countries.
“The Arabians need to learn that they can't keep comin' over here and blowing stuff up. Let's set off a couple of nukes in Islamabad, burn down Prague, then bomb the heck out of Tehran. We need to show them that we mean business.”
Can't See Russia...
Although hosts Steve Doocy and Gretchen Carlson applauded Palin's jingoism, they immediately attempted to rectify her multiple geographic errors.
“Well Islamabad is the capital of Pakistan, which isn't Arab,” Carlson corrected, “and Tehran is the capital of Iran, which is predominantly Persian. But I do see your point.”
“Also Czech Republic isn't really an Arab or even Muslim country, I don't think,” Doocy added, “but otherwise what you're saying makes a lot of sense. I think most Americans wish Obama would step up and lead on this one.”
Palin, however, didn't take kindly to being corrected and defended her analysis.
“Steve, that's probably one of the most ignorant things I've ever heard. How is Czech Republic not a Muslim country? You saw those brothers, they were Islamic and they were Chechen!”
“Yes there were Muslim and they were ethnic Chechens,” Doocy started, “but they grew up mostly in Kyrgyzstan and the United States. And more importantly, Chechens don't come from the Czech Republic, they come from Chechnya, which is part of Russia.”
“What's the difference?” Palin responded. “Isn't Russia part of the Czech Republic?”
“No, the Czech Republic is a separate country. It's part of the European Union and a strong NATO ally,” Doocy noted. “But heck, why not? Let's invade. What could go wrong?”
“Yeah and while we're at it,” Carlson added, “let's call the Queen of England and see if the U.K. will join us.”
In a statement released after the interview, Palin attacked Fox News and its “pro-Islamic” and “pro-geography” bias.
“This is just another case of the politically correct liberal media refusing to tell the truth about radical Islam,” she said.
