    Le ministre de l’Information, Ramzi Joreige, a félicité la vice-présidente du conseil administratif d’Al-Jadeed, Karma Khayat, en raison de la fin de son procès devant le Tribunal spécial pour le Liban.

    « Je lui avait conseillé de se rendre à la Cour pour se défendre courageusement et prouver son innocence, » a-t-il dit.

    Il a également exprimé sa solidarité avec Mme. Khayat et avec l’ensemble du corps médiatique libanais, espérant que le verdict prononcé aujourd’hui mettra un terme à l’affaire et que le TSL se chargera désormais « de poursuivre et de châtier les criminels dans l’affaire de l’assassinat de l’ancien PM Rafic Hariri. »

    Le TSL acquitte al-Jadeed, Karma Khayat reconnue coupable

    La chaîne de télévision libanaise al-Jadeed, accusée d’avoir diffusé des informations sur des témoins protégés dans l’enquête sur l’assassinat de l’ancien Premier ministre Rafic Hariri, a été acquittée d’outrage et entrave à la justice par le juge compétent en matière d’outrage du Tribunal spécial pour le Liban (TSL), Nicola Lettieri.

    Le tribunal a certes estimé que trois témoins présumés, sur un total de onze concernés par cette affaire, pouvaient être identifiés grâce aux informations publiées par Al-Jadeed-TV. Mais, a soutenu le juge Lettieri, rien ne montre que « les individus concernés ait souffert de quoi que ce soit à cause de ces divulgations ».

    L’accusation n’a « pas prouvé au-delà de tout doute raisonnable que la divulgation (...) pouvait objectivement miner la confiance du public dans la capacité du tribunal à protéger la confidentialité de certaines informations », a-t-il ajouté lors d’une audience publique dans la banlieue de La Haye, où siège le TSL.

    La rédactrice en chef adjointe et la vice-présidente du conseil d’administration de la chaîne al-Jadeed, Karma Mohammad Tahsine Khayat, a elle aussi été acquittée pour la diffusion des reportages, mais a été reconnue coupable de ne pas les avoir retirés du site Internet de la chaîne lorsque le tribunal le lui avait demandé.

      Lebanon Tribunal Gives Mixed Verdict in Confidential Witnesses Case

      An international court on Friday found Karma Al-Khayat, an executive with Al Jadeed TV in Lebanon, guilty of contempt of court for ignoring its order to remove broadcasts about confidential witnesses from the station’s website. She was acquitted, however, of the more serious charge of obstruction of justice.

      The station’s parent company, New TV, based in Beirut, was tried on similar charges before the same Italian judge, Nicola Lettieri, but on Friday he cleared the company on all counts.

      The case against Ms. Khayat and Al Jadeed drew criticism from news organizations in Lebanon and abroad, raising questions about whether the trials amounted to an attack on the freedom of the press. Diplomats and lawyers also followed it because the charges against the company, rather than an individual, appeared to develop a novel notion of corporate liability in international criminal law.

      “I’m delighted the judge unequivocally rejected the charges against the company, because they lacked a legal base in international law,” said Karim Khan, the British lawyer representing Ms. Khayat and New TV. He said he was satisfied that Ms. Khayat had been acquitted of the most serious charge she faced, obstruction of justice. He also said that Ms. Khayat would almost certainly appeal the contempt of court conviction.

      Ms. Khayat, 32, whose family is the main owner of Al Jadeed TV, could face a prison term or fine. The prosecutor asked for a 12-month sentence or a fine of 100,000 euros, about $130,000. Ms. Khayat was scheduled to be sentenced Sept. 28.

      As for the Khayyat judgement, it is disappointing not because of her case in itself – I cant evaluate that…. but rather because of all the many many many destructive leaks etc by many new orgs and journos over the last 10 years – NONE of which have been brought before the court.

      Strange, right, that the only two cases involve vociferous critics of the STL!

      Strange and another sad mark on a process that could have been and should have been far better.

      Attentat à l’entrée de la banlieue sud de Beyrouth, un barrage de l’armée aurait été visé

      L’explosion a eu lieu au niveau de Tayounné, sur l’autoroute Hadi Nasrallah qui mène à la banlieue sud, place forte du Hezbollah. Des flammes se dégageaient de l’endroit de l’explosion au milieu d’un quartier résidentiel. Les dégâts matériels paraissaient importants.

      Il n’était pas possible dans l’immédiat de savoir si l’explosion a fait des victimes. La déflagration a secoué la banlieue sud provoquant un mouvement de panique parmi les habitants.

      Ce matin: Car bomb targets checkpoint in southern Beirut

      Security sources have told Al-Akhbar that at least one person has been killed in the explosion, which took place 30 meters away from a military checkpoint near the entrance of Hadi Nasrallah freeway, near the Shatila roundabout.

      The Red Cross confirmed that the suicide bomber was the only casualty. Medical sources estimated that between 12 and 15 people were injured.

      Rumors that the suicide bomber was a woman spread on social media, but remained unconfirmed by Lebanese authorities.

      Speaking on condition of anonymity, a security source said Hodroj and his colleague Ali Jaber, who was wounded, “were passing through the area” when they saw the Mercedes travelling against traffic.

      “Then vehicle stopped in the middle of the road, and a man got out. (Hodroj and his colleague) stopped him and questioned him. The man said his car key was broken, and he couldn’t drive any more,” the source said.

      The driver’s suspicious behavior led Jaber to go to the nearby army checkpoint to report him.

      “Hodroj remained with the suicide attacker to ensure he wouldn’t get away,” the security source said.

      Jaber was 30 metres (yards) away when “the explosion happened.”

    Piège logique : ce matin, pour pouvoir participer à son propre procès, Al Jadeed a accepté la règle rappelée avec insistance par le juge – s’interdire de diffuser les éléments du procès sans autorisation, notamment concernant les témoins, dans le cadre de sa propre mise en accusation. Or la défense d’Al Jadeed repose justement, de manière centrale, sur le principe qu’elle avait le droit en tant que média de diffuser de telles informations si elles sont dans l’intérêt du public.

    Soutien de Pierre Daher (patron de LBCi) au Akhbar et à New TV. L’article cite également Najat Charafeddine de Future News. Plus étonnant, selon l’Orient-Le Jour, le président de la République Michel Sleiman a, lui, apporté son soutien à Al Jadeed TV (concernant Al Akhbar, Sleiman est certainement moins fana de la notion de « liberté d’expression). À ma connaissance, cependant, aucun média occidental n’a évoqué l’affaire.

      Information Minister Ramzi Jreij considered on Monday that the media can criticize the Special Tribunal for Lebanon if there is a need, slamming the summons by the international court of al-Jadeed TV and al-Akhbar newspaper’s journalists on charges of “contempt and obstruction of justice.”

      “The reports published by the two media outlets are responsible and just criticism,” Jreij said in comments published in As Safir newspaper.

      He stressed that “investigations with al-Jadeed and al-Akhbar will prove their innocence.”

      The STL announced on Thursday that it has summoned Karma Mohammed Tahsin al-Khayat from al-Jadeed, as well as the station’s parent company New TV S.A.L., and Ibrahim Mohammed al-Amin from al-Akhbar, as well as the newspaper’s parent company Akhbar Beirut S.A.L. to appear before it on two counts of Contempt and Obstruction of Justice.

      “The important thing is that the two media outlets defend themselves properly by adopting all the legal means as per the tribunal’s mechanism,” the minister noted.

      He warned the two journalists of failing to appear before the STL’s hearing, saying: “This move will lead to repercussions including the issuance of arrest warrants.”

      Jreij said that he is a “staunch advocate of media freedom,” however he noted that the “STL is a legal body and its decisions are binding for Lebanon.”

      A meeting was held on Monday at noon in solidarity with the two journalists at the Press Syndicate to defend the “mere truth.”

      The gist of the message, which addressed the journalists gathered yesterday at the Press Syndicate in defense of national sovereignty and public freedoms in Lebanon and against the bulldozer of international repression and intimidation of the media, was “I am with freedoms, but... not this time!” The statement was interrupted by the boos of the audience, dealing a moral blow to the minister that Lebanon will remember for a long time.

      After a nice little introduction that emphasized his good intentions regarding freedoms, our minister advised the two journalists charged by the international court with contempt and obstruction of justice, Ibrahim al-Amin and Karma Khayat, to comply with the international tribunal “because it is the only way to prove their innocence.” How is that possible when he insists that they are not facing accusations? In other words, the minister told the journalists gathered at the syndicate, there is no need for you to be present here, go back to your homes, the Lebanese state has no sovereignty and no say in the presence of the international tribunal. This, however, is inaccurate considering Rule 178 of the Rules of Procedure and Evidence of the Special Tribunal for Lebanon (STL).

    Hier, Al Jadeed diffusait les images d’un des libanais prisonniers d’un groupe de l’Armée syrienne libre. Entouré de trois types armés, celui-ci « avouait » un certain nombre de choses (ce qui, évidemment, est aussi crédible qu’un otage français retenu par un quelconque groupuscule jihadiste et « confessant » quoi que ce soit devant la caméra). Je vous ai traduit le billet d’Angry Arab à ce sujet :

    Je viens de voir la vidéo d’un citoyen libanais kidnappé par les gangs de l’Armée syrienne libre. Ce qui est le plus honteux, c’est qu’ils l’ont forcé à tenir un langage sectaire dégoûtant et vulgaire, et à prétendre que Hassan Nasrallah (en personne, s’il vous plaît) l’avait convoqué et « leur » avait ordonné d’aller combattre pour le régime chiite contre les sunnites en Syrie. La rhétorique sectaire des gangs de l’Armée syrienne libre est frustrante pour eux : ils désespèrent d’entraîner le Hezbollah dans un affrontement sectaire, mais le Hezbollah les ignore. Alors ils en arrivent à de telles pratiques criminelles. Le clan de l’homme kidnappé a menacé hier de vengeance clanique si cet homme n’était pas libéré dans les 24 heures. Mais l’ASL essaie justement de provoquer une réaction sectaire chiite au Liban : le Hezbollah les a déçus par son absence de réaction, alors ils espèrent provoquer la réaction de familles chiites pour pouvoir prétendre qu’ils sont en train d’affronter un mouvement chiite libanais en Syrie. Je n’ai jamais vu un tel déferlement de médhodes sectaires vultaires et écœurantes depuis la mort de Zarqaoui. Mais qu’est-ce qu’on peut attendre de la part de ceux qui reçoivent l’argent et les ordres des séoudiens ? Vraiment.

    PS. De plus l’homme n’est clairement ni de Amal ni du Hezbollah : sa femme est apparue sur New TV et elle ne porte pas le voile.

    Selon MTV, LBCi et Future TV, « quelqu’un » de l’intérieur des FSI leur aurait dit :
    – le chauffeur de Michel Samaha aurait avoué qu’il y avait bien un plan pour poser des bombes au Liban,
    – Samaha lui-même aurait avoué qu’il avait transporté des bombes dans sa voiture et participé à un complot pour destabiliser le pays.

    Selon Al Jadeed (un média qui n’est pas dans les usual suspects du 14 Mars), l’arrestation aurait été motivée par une « cassette vidéo révélant son implication dans un projet d’attaques dans le nord »).

    Maintenant, tout cela a l’air drôlement tiré par les cheveux, sources anonymes, etc, après une journée qui a vu une belle collection de « fuites » et de rumeurs. Il va falloir attendre des confirmations.

      Quelques heures après son arrestation, ce matin, par les services de renseignements des Forces de sécurité intérieure (FSI), l’ancien ministre Michel Samaha serait passé aux aveux, selon plusieurs chaînes locales. 
       
      Selon la LBC, Michel Samaha aurait avoué avoir planifié des attentats terroristes prévus lors d’iftars au Liban-Nord. Toujours selon la chaîne, M. Samaha aurait précisé avoir transféré des armes, dans sa propre voiture, de Syrie au Liban. Des aveux qui seraient intervenus après ceux du chauffeur de l’ex-ministre, arrêté avec lui.
       
      La MTV a ajouté que l’ancien ministre aurait reconnu travailler sur ordre syrien.
       
      Pour sa part, la chaîne New TV a précisé que les autorités disposeraient d’une vidéo prouvant son implication dans la planification d’attentats dans le nord du pays.
       
      Un responsable des services de sécurité a également affirmé à l’AFP que Michel Samaha a été arrêté dans le cadre d’une affaire d’explosifs saisis qui devaient être notamment placés dans le nord du Liban.

    La télévision libanaise Al Jadeed a diffusé hier soir un enregistrement de Houssam Houssam, une des personnes accusées de faux témoignages dans le cadre de l’enquête sur l’attentat de l’ancien premier ministre Rafic Hariri. Cet enregistrement fait suite à d’autres enregistrements impliquant l’ancien premier ministre Saad Hariri, dans lesquels il accuse le gouvernement syrien d’être à l’origine de l’assassinat de son père. Ces témoignages auraient été – selon certaines sources – vendues à la chaine libanaise par Gehard Lehman, ancien bras droit du président de l’enquête internationale Detlev Mehlis.

    Dans cet enregistrement, Houssam Houssam, impliqué dans les réseaux de numéro de téléphones mobiles utilisés lors de l’attentat, indique avoir été torturé par les autorités libanaises de l’époque afin d’accuser les autorités syriennes d’être à l’origine du témoignage puis de la disparition d’Abou Addas. Il accuse également l’organisation terroriste internationale Al Qaida d’être à l’origine de l’assassinat de l’ancien premier ministre libanais Rafic Hariri, suite au refus de ce dernier de rembourser la somme de USD 2 millions mis en dépôt auprès de lui par Ben Laden.

    Mais attention, ça se complique : selon une vidéo de la LBC, le faux témoin serait désormais détenu par l’Armée syrienne libre, qui promettrait quelque chose comme un contre-contre-témoignage dénonçant le contre-témoignage précédent, lequel dénonçait le faux-témoignage initial.

    LBC television broadcast on Sunday a YouTube video purportedly showing Syrian rebels detaining Hussam Hussam, one of the false witnesses in the case of the assassination of former Prime Minister Rafik Hariri.

    The video showed Hussam saying that he had information regarding the 2005 Hariri assassination, adding that he wants to be taken to Beirut where he would reveal a “big surprise.”

    New TV in Beirut just aired an audio tape with mini-Hariri and his chief of intelligence, Wisam Hasan, and German Hariri investigator, Gerhard Lehmann, and... the FAMOUS FALSE WITNESS, MUHAMMAD ZUHAYR AS-SIDDIQ (the most famous of the false witness who has woven so many fabrications about who was responsible for the Hariri investigation and who has been aided by French intelligence and Dubai intelligence). The significance of the audio tape can’t be overstated: this will officially put the last nail in the coffin of the Hariri tribunal. Hariri has officially denied any knowledge of the “false witnesses” and in this meeting he seems to be receiving orders from Siddiq himself. Now we know why the Hariri camp has been fiercely opposing the demand by the opposition to refer the “false witness” matter to the Justice Council in Lebanon. Of course, the testimony of Saddiq was the only reason why the “four generals” were incarcerated. Now you see why I never bothered to take the Hariri tribunal seriously. It was a joke before it was formed by an Israeli/US decision. This is the biggest gift to Hizbullah for the new year. Expect a press conference by Nasrallah this week.

      Selon l’enregistrement, M. Siddiq affirme au Premier ministre « détenir toute la vérité » sur l’assassinat de son père, et que le rapport de l’enquête « devrait inclure le nom de neuf Syriens et quatre Libanais ».
      Surnommé le « témoin roi », cet ancien officier syrien avait affirmé devant la commission d’enquête que l’ancien président libanais Émile Lahoud et le président syrien Bachar el-Assad avaient donné l’ordre d’assassiner Rafic Hariri, devenu opposé à l’hégémonie de Damas, ancienne puissance de tutelle au Liban. Le TSL avait indiqué par la suite que M. Siddiq ne l’intéressait pas.

      Al-Jadid TV [New TV] in Lebanon just aired this taped recording of a meeting that took place between Saad al-Hariri, Information Branch chief Colonel Wissam al-Hassan, STL deputy chief investigator Gerhard Lehmann, and Muhammad Zuhair al-Siddiq, one of the false witnesses whose testimony was used by Mehlis to accuse Syria for plotting the murder of Rafiq al-Hariri. It records the four men laying out a plan for how to convince the international community of Syria’s culpability. They all believe Syria to be the instigator of the killing. They agree that they must present the world with an air-tight case and lots of proof. Saddiq explains to Hariri that he tried to warn him of May Shidiyyaq’s attempted assassination two days ahead of time, but claims Hariri refused to answer it. Hariri asks Saddiq why he didn’t text him. Hariri calls Saddiq a “diarrhea mouth” to Mehlis’s lieutenant, but goes on to explain that he should be believed and is trustworthy. This is damaging to the Tribunal and Hariri because it shows how tainted Mehlis’ reports were and how eager the European investigators were to take at face value trumped up evidence. For Hariri, it is damaging because he swore that he had not met with Saddiq or any of the false witnesses.

      The TV station said the broadcast was intended to show a link between Hariri and Siddiq, whom March 8 forces describe as a false witness and the international tribunal does not recognize.

      Al-Jadid accused the caretaker premier of “hiding the truth and playing with the bloods of February 14 martyrs” in reference to the bombing that killed the former PM and 22 others.

      The meeting was also attended by former chief investigator Detlev Mehlis’ assistant Gerhard Lehmann and police intelligence chief Col. Wissam al-Hassan, according to the tape.

      In the audiotape, Siddiq told Hariri that the report of U.N. investigators probing his father’s assassination should name six Syrians and four Lebanese.

      Al-Jadid did not give details as to how it obtained the audiotape but said that the Special Tribunal for Lebanon had a copy of it.

      BEYROUTH - Concernant le rapport relatif à l’enregistrement de conversations ayant eu lieu dans le cadre de l’enquête sur l’attentat de Rafik Hariri et diffusé samedi soir par la chaîne de télévision Al-Jadid, le bureau d’information du Premier ministre sortant Saad Hariri a diffusé un communiqué indiquant ce qui suit :

      "La dernière conversation attribuée au président Saad Hariri et au colonel Wissam Hassan avec Mohammad Zouhair Siddiq en présence de l’adjoint du procureur général Gerhard Lehman a eu lieu à la demande de la commission d’enquête internationale qui a organisé cet entretien et chargé Lehman d’y assister. « La conversation a eu lieu mais la chaîne Al-Jadid a émis des paragraphes empreints de provocation médiatique afin de l’extraire de son contexte d’origine. Cette chaîne n’ajoute d’ailleurs aucun élément susceptible d’accélérer ou de retarder le cours de l’enquête », selon le bureau de Hariri.

      La contre-attaque est assez minable :

      « Cet enregistrement attribué à des témoins devant la commission d’enquête internationale est une affaire de renseignement par excellence qui nous pousse à nous poser des questions sur les visées de sa diffusion médiatique. »
