  • Tunisia prepares to host refugees fleeing Libya

    Officials working for international organizations and institutions have visited Tunisia’s border areas with Libya to evaluate the resources available ahead of the potential arrival of refugees fleeing armed clashes in Libya.

    Representatives for the World Health Organization (WHO) and the UN Refugee Agency UNHCR and the regional directorate of the Tunisian health ministry on Thursday visited the border delegations of Dehiba and Ramada, in the governorate of Tataouine near the border with Libya. Officials visited the locations to examine the resources available ahead of the potential mass arrival of refugees fleeing armed clashes in Libya.

    Visit to prevent humanitarian crisis

    The visit was aimed at preventing a possible humanitarian crisis like the one reported in 2011, which required international aid, given a situation in Libya considered critical by humanitarian agencies. The inspection was used to identify logistical needs and intervention strategies to deal in the best way possible with the potential arrival of refugees. Concern over the situation in Libya and its consequences on Tunisia was expressed by the UN High commissioner for Refugees in Tunisia, Mazen Abu Shanab, who stressed that assistance efforts need to be intensified due to an increase in the number of Libyan migrants in Tunisia, an estimated 300 a month.

    Amnesty documents ’war crimes’ in Tripoli

    Amnesty International has gathered witness testimony and analyzed satellite imagery that documented attacks that could constitute “war crimes” in areas of Tripoli where an offensive conducted by the troops of General Khalifa Haftar has been ongoing since the beginning of April, according to a statement released by the human rights organization. These attacks could be examined by the international judiciary, Amnesty stressed, highlighting the case of three residential areas in the Abu Salim district of Tripoli that were “indiscriminately attacked with rockets during an episode of intense fighting between April 15-17” (Hay al-Intissar, Hay Salaheddin and the so-called “Kikla buildings”).

    The organization also said in the statement that it documented attacks that endangered the lives of hundreds of refugees and migrants, including an air raid on May 7 that hit an area some 100 meters from the migrant detention center of Tajoura, wounding two detainees.

    In 2015, Prime Minister Benjamin Netanyahu sparked an uproar when he claimed that Mufti Haj Amin al-Husseini was the one who’d urged Hitler to annihilate the Jews. In the wake of the criticism this elicited, Netanyahu said his intention was not to absolve Hitler of responsibility for the Holocaust, but to note that “the Mufti played an important role in the Final Solution.”

    But it turns out that there was another side to the story that also escaped mention by Netanyahu, the historian’s son: the forgotten role played by thousands of Palestinians who did not heed the Mufti of Jerusalem’s call to support the Axis countries, and went so far as to take up arms to fight the Nazis, often shoulder to shoulder with young Jews from Mandatory Palestine.

    Professor Mustafa Abbasi, a historian at Tel Hai Academic College, has spent years tracing their story. Having recently published an academic article on the subject, this week he suggested an opposite narrative to the one that Netanyahu put forward. The prime minister had sought to paint the Palestinians as supporters of the Third Reich, but Abbasi says, “The Mufti did not find a receptive audience among the Palestinians for his call to aid the Nazis. Not at all.”

    The subject of Abbasi’s research is unusual. Many studies have been published about Jewish volunteerism in the war against the Nazis, which reached a peak with the formation of the Jewish Brigade. But “the thousands of Arab volunteers are hardly mentioned and sometimes the record is often distorted,” Abbasi says.

    In an article in the latest issue of the periodical Cathedra (“Palestinians Fighting the Nazis: The Story of Palestinian Volunteers in World War II”), he explains why these Palestinian fighters have been left out of the history books.

    On the one hand, Zionist historians naturally placed an emphasis on the role played by Jewish volunteers in the fight against the Nazis. On the other hand, their Palestinian counterparts were focusing on the struggle against British rule and were not eager to glorify the names of those who cooperated with Britain not so many years after the British put down the Arab Revolt of 1936-1939, and thereby indirectly helped the Jews establish a state.

    “Neither side wished to highlight this subject,” says Professor Abbasi. “But I think it’s the historian’s job to be faithful to the sources and to try to describe history as it was, without being hostage to any national narrative that would limit him and prevent him from writing history freely.”

    One has to wonder why no organization was ever established to commemorate the actions of these Palestinian volunteers. “Many of them were killed and many others are still listed as missing. But no memorial has ever been established for them,” says Abbasi. In fact, the records of the Palestinian volunteers, along with much of their personal archives and papers, have disappeared, much of it lost in the War of Independence.

    Over the last few years, Abbasi was able to learn of their story in Palestinian newspapers from the Mandate era, in memoirs and personal journals, and through interviews he conducted with a few of the last remaining volunteers who are still alive. He also collected material from various British archives, from the Zionist Archive, and the archives of the Haganah and the IDF.

    Abbasi estimates that about 12,000 young Palestinians enlisted in the British Army in World War II. Hundreds became POWs, many others (the exact figure is unknown) were killed. “Compared to other peoples, this is not an insignificant number,” he says, and also points out that, unlike other groups, the Palestinians volunteered for the British Army from the first stage of the war.

    Initially, the Palestinian and Jewish volunteers served in mixed units. “They received training and drilled at the same bases and in many instances fought shoulder to shoulder, and were also taken prisoner together,” says Abbasi. And as reported here two years ago, the proximity of the Jewish and Palestinian fighters sometimes led to unusual outcomes, as in the case of Shehab Hadjaj, a Palestinian who enlisted in the British Army, was taken prisoner in Germany and died in 1943. To this day, he is listed at Mount Herzl as “a casualty of Israel’s wars” because someone mistakenly thought his surname indicated that he was Jewish.

    “Relations among the fighters were generally good, and if there was any friction it was mainly over service conditions, like mail and food,” Abbasi says. However, there were certain key differences between the two groups, too. For example, while the Jews were united in their goal of fighting the Nazis to promote the establishment of the Jewish state, the Palestinians “had no clear national agenda,” Abbasi writes. For this reason, unlike the Jews, they did not seek to form separate Palestinian units and there was no “Palestinian Brigade” parallel to the Jewish Brigade, in which thousands of Jews from Mandatory Palestine served.

    So who were the Palestinians who volunteered for the British Army to fight the Nazis? Abbasi says they mostly came from the Palestinian elite and that, contrary to what many think, represented “an important and central part of the Palestinian public.” A part of the public that believed it was necessary to stand by Britain at this time, and to temporarily put aside the Palestinian national aspirations – akin to the Jewish idea to “fight Hitler as if there were no White Paper, and fight the White Paper as if there were no Hitler.”

    They did this at a time when the Mufti of Jerusalem had left Palestine for exile in the Arab countries and Europe, where he met with Hitler and congratulated the Muslim volunteers of the Free Arab Legion – an Arab unit established in the army of Nazi Germany. “He left Palestine for a decade in 1937. What kind of leader abandons his people at such a time?” Abbasi wonders. “He had no influence on the public. He was detached and the public was already tired of him and his methods. They didn’t see him as a leader,” he says. “Anyone who says differently is distorting history,” he adds in a not so subtle dig at certain politicians.

    In his research, he documented pro-British propaganda conferences that were held from 1940 on in Abu Dis (next to Jerusalem), in Jenin, in villages in the Nablus area, in Tul Karm and in Lod. Among the supporters of Britain’s fight against the Nazis were the mayors of Nablus and Gaza. Radio Palestine broadcast the comments of an Egyptian writer who said, “The war is between the lofty and humane values represented by England and the forces of darkness represented by the Nazis.”

    Motivations for volunteering were varied. “Some did it for ideological reasons, out of opposition to the Nazi ideology and loyalty to the British and the values that they represented,” says Abbasi. This motivation was common among upper middle class and highly educated Palestinian volunteers from urban backgrounds. Rural Palestinians were motivated largely by financial reasons. “And there were also those who were seeking adventure and wanted a chance to travel abroad,” he says.

    Abbasi found that some Palestinian women also volunteered to fight the Nazis. Almost 120 young women did so as part of the

    Auxiliary Territorial Service, the women’s branch of the British Army, alongside Jewish women. A British recruiting poster in Arabic, published in the Falastin newspaper in January 1942, read: “She couldn’t stop thinking about contribution and sacrifice, she felt ongoing pride and exaltation of spirit – when she did what she saw as her sacred duty for her nation and its sons. When your country is crying out to you and asking for your service, when your country makes it plain that our Arab men need your love and support, and when your country reminds you of how cruel the enemy is – when your country is calling you, can you stand by and do nothing?”

    Abbasi is one of the only researchers in Palestinian society who is studying this area, which was also the subject of a 2015 article by Dalia Karpel in Haaretz Magazine. He came to it thanks to his maternal grandfather, Sa’id Abbasi, who was one of the volunteers in the British Army during the war. “The family didn’t talk about it, until one day when I asked my grandmother why there was such a big age difference between her children,” he says. “Her answer was: ‘Don’t remind me of the time your grandfather left me for so many years.’” Abbasi decided to find out more about that time, and came to see that his family story was part of his people’s history.

    In the future, he hopes, the original material he has collected will be developed into a book that, for the first time, will tell the optimistic story of a rare moment in history in which Jews and Palestinians joined forces for a lofty shared goal.

    Without the knowledge of the victims’ families, the Saudi government today circulated awful news of the execution of 37 people, including minors, protestors, and the disabled. Many of them were linked to the Arab Spring protests that took place in Saudi Arabia, particular in the governorate of Qatif beginning on 17 February 2011. Others were charged by Saudi Arabia with spying for Iran, although most of the charges did not include evidence of actual acts of espionage.

    Among the names were at least six minors: Abdullah Salman Al Sarih and Abdulkarim Mohammad al-Hawaj, whose charges go back to when they were 16 years of age, and Said Mohammad al-Sakafi, Salman Amin Al Quraysh, Mujtaba Nadir al-Sweiket, and Abdulaziz Hassan Al Sahwi, whose charges date back to when they were 17. There are also suspicions that others are likely minors, but the European Saudi Organisation for Human Rights (ESOHR) was unable to obtain further details.

    Furthermore, among the shocking executions was Haidar Mohammad Al Laif, who according to Saudi Arabia – in its reply to the UN on 13 December 2017 – was given a final sentence of eight years.

    Many of the charges leveled against the individuals whose executions were announced by the Ministry of Interior were not classified as serious or terroristic crimes. For example, there were charges related to the right to expression, peaceful protest, peaceful association, signing political statements, possessing political documents and information on political detainees. Similarly, some of them have been accused of spreading Shi’ism and practicing non-traditional religious activities involving Shiites in the governorate of Jeddah, in Saudi Arabia.

    The trials of most of the victims of today’s massacre, the details and proceedings of which the ESOHR has followed, have severely lacked the conditions for a fair trial. The trials have taken place in total secrecy and isolation from any of the victim’s relatives or in semi-secrecy, attended by only a few of the victim’s relatives – one to three at most. On the government’s part, select official media entities can attend, as well as members of executive agencies, such as the Mabahith (secret police), and members of the official human rights establishment. Meanwhile, no one from the public or members of civil society can be found at the trial.

    In a report issued in February 2019 following a field visit to Saudi Arabia, the former Special Rapporteur on the promotion and protection of human rights and fundamental freedoms while countering terrorism, Ben Emerson, called for “a prompt review of all current cases of prisoners charged and convicted of terrorist offenses who are facing the death penalty, in order to ensure that minimum international standards are met in each case.” He stressed that this means that the death penalty may not be imposed except for the most serious crimes leading to loss of life and may not be imposed on people who were minors at the time of their crimes or people with mental or cognitive disabilities. Ben Emerson’s report included a clear reference to those who were executed today, stating that when 24 people were brought to trial in June of 2016 because of pro-democracy protests in 2011, the Specialized Criminal Court sentenced 14 of them to death. This again confirms that the trials did not fulfill the required legal processes and the standards of a fair trial and that the accused were subjected to torture and were not able to have a lawyer. This case is a source of serious concern.

    The rapporteur also expressed particular concern vis-à-vis “a pattern of systematic oppression in the Eastern Province where most of the Shiite population lives,” noting that death sentences were issued against many members of the Shiite minority – who were facing imminent execution – for their participation in pro-democracy demonstrations in Eastern Province in 2011 and 2012.

    The brutal executions carried out by Saudi Arabia today blatantly ignored the many urgent appeals of the UN High Commissioner for Human Rights, UN Special Rapporteurs, and various committees. These appeals included many of the names of people who were killed by Saudi Arabia today:

    With the executions today, the number of victims of execution since 2019 to today totals 105, while at this point in 2018 there were 48 executions. The rate has more than doubled by 50% compared to last year.

    As stipulated in Saudi Arabia, executions are carried out only after the signature of the king or his deputy, which makes King Salman directly and explicitly responsible for the executions carried out today.

    The ESOHR does not have information about some of the names mentioned as executed today. This goes back to the Saudi government’s closure of all spaces for civil society and the intimidation surrounding the families of the victims. The ESOHR also emphasizes the lack of confidence in the accounts offered by the state under the justification of “terrorism.”

    The ESOHR believes that Saudi Arabia has entered into a bloody era since the ascension of King Salman and his Crown Prince and their absolute control over the country, both internally and externally. The first and most heinous manifestation of this internal control was the mass execution of 2 January 2016. This was followed by numerous crimes, culminating in today’s crime of executing 37 citizens – among them minors, the disabled, and demonstrators – on charges that fall within freedom and opinion and expression and are not classified as criminal.

    After this heinous crime, the ESOHR calls for an international investigation to be opened in order to hold accountable all those responsible for the crimes and violations that have occurred. The ESOHR believes that this is the response that may bring this bloodshed to an end. The ESOHR also calls for a review of Saudi Arabia’s membership in various UN agencies and committees.

    The ESOHR is raising profound concerns about dozens of people threatened with becoming victims of other executions in the future and advocates all legal means to save their lives.

      The following is UNHCR’s response to media following widespread allegations made against its workforce in a recent NBC press article.

      UNHCR, the UN Refugee Agency, strongly rejects the widespread allegations against its workforce in a recent press article, which risks jeopardizing the future of refugees in dire need of resettlement.

      UNHCR is one of the biggest and most operational UN agencies, working in 138 countries and serving 68.5 million people. The overwhelmingly majority of our 16,000 personnel are deeply committed professionals, many of whom are working in difficult environments, sometimes risking their own safety.

      As with other organizations, we are not immune to risk or failure on the part of individuals. This is why we have a solid safeguarding structure, which has been further strengthened in the last two years, and which we continuously seek to improve.

      We are fully committed to ensuring the integrity of our programmes. Our workforce is also systematically reminded of the obligation to abide by the highest standards of conduct and to make sure that all their actions are free of any consideration of personal gain.

      Every report or allegation of fraud, corruption or retaliation against refugees by UNHCR personnel or those working for our partners, is thoroughly assessed and, if substantiated, results in disciplinary sanctions, including summary dismissal from the organization.

      Investigations at UNHCR on possible misconduct by our workforce are carried out by the Inspector General’s Office (IGO), which is an independent oversight body. It consists of expert investigators, with a strong background in law enforcement, military, war crimes tribunals or people who occupied similar functions in private companies and other international organizations. In recent years, additional investigators were recruited and some stationed in Nairobi, Pretoria and Bangkok enabling them to deploy rapidly and to have a better understanding of local contexts and issues.

      UNHCR disciplinary measures have been reinforced, with a 60% rise in the number of disciplinary actions taken by the High Commissioner between 2017 and 2018. Referrals to national authorities are undertaken systematically in cases involving conduct that may amount to criminal conduct and waivers of immunity facilitated.

      In addition, we have significantly strengthened our risk management capacity and skills in the past two years. We now have a solid network of some 300 risk officers, focal points and managers in our field operations and at HQ to help ensure that risks are properly identified and managed, that the integrity of our programmes is further enhanced and that the risk culture is reinforced across the organization.

      The prevention of fraud, including identity fraud, is key to ensuring the integrity of our resettlement programme. This is why we use biometrics in registration, including iris scans and fingerprints, in the majority of refugee operations where we operate, including Ethiopia, Kenya and Uganda. Biometric registration makes theft of identity virtually impossible and biometric screening of refugees is done at various stages of the resettlement process, including right before departure. In other places, such as Libya and Yemen, where security conditions do not allow us to deploy such a tool, we take all possible preventive measures related to fraud.

      We are acutely aware that refugees are at times approached by people trying to defraud them. For example, reports and investigations have found multiple occasions where people pose as UNHCR officials, using fake ID cards and claiming that they can influence the resettlement process. While it is impossible for UNHCR to root out ground level imposters, we have taken renewed action to raise awareness among refugees, help them recognize and report fraudsters, reminding them that all services provided by UNHCR and its partners are free.

      Resettlement is highly sought after by refugees. UNHCR considered 1.2 million people to have resettlement needs in 2018 alone, while less than 60,000 people were resettled last year. In 2019, those needs further increased. The fact that the needs for resettlement are far greater than the places available is a factor that weighs heavily in favor of those wishing to exploit desperate refugees, many of whom have lived many years in refugee camps, with no foreseeable end to their plight in sight for themselves or their children.

      UNHCR strives to ensure that refugees have proper means to provide feedback. This is essential to ensure their protection and the very reason why we completed last year a survey across 41 countries. We are using the information on the communication systems most commonly used by our beneficiaries – such as complaint boxes, hotlines, emails, social media and face to face interaction – and existing challenges to strengthen these mechanisms. In Kenya, for instance, refugees can report misconduct of any staff member of UNHCR, a partner or a contractor by email (inspector@unhcr.org or helpline.kenya@unhcr.org), by filling in a webform (www.unhcr.org/php/complaints.php), by using complaints boxes that are available at all UNHCR offices or by calling our toll-free local Helpline (800720063).

      UNHCR recognizes its responsibility to protect refugees, particularly those who come forward and cooperate with an investigation to root out misconduct. Significant attention has been devoted to strengthening measures to protect witnesses and people of concern who cooperate with an IGO investigation and these efforts are continuing. We have put a specific protocol in place, with steps taken during the investigation phase, including in the conduct of interviews, the anonymization of testimony and redaction of investigative findings and reports.

      When it comes to our own staff being targeted, our record is clear: If a staff member is found to have retaliated against another member of our workforce for reporting wrongdoing, it leads to dismissal. We have a robust policy to protect staff members that are retaliated against. In September 2018, we issued a new policy on Protection against Retaliation, which now includes our affiliate workforce, expands the scope of the activities considered as protected and extends the timeline to report. It also provides interim measures to safeguard the interests of the complainant and strengthens corrective measures.

      We also launched a confidential independent helpline available to all colleagues who wish to report misconduct or obtain advice on what to do when in doubt. This helpline is managed by an external provider and is available 24/7 by phone, through a web form and an app. It offers the possibility to report in complete anonymity.

      We are committed to eradicating misconduct from our organization. If we receive pertinent information concerning alleged fraud, corruption or misconduct by a member of our workforce, we take action, and if the allegations are substantiated, act to end such inappropriate and unacceptable behaviour.   • UNHRC adopts resolution to strengthen UN presence in Palestine

    BETHLEHEM (Ma’an) — The United Nations Human Rights Council (UNHRC) adopted a draft resolution to strengthen the UN presence in the Israeli-occupied Palestinian territory, on Friday afternoon.

    The UNHRC requested “the United Nations High Commissioner for Human Rights to strengthen the field presence of the Office of the High Commissioner in the Occupied Palestinian Territory, particularly in the besieged Gaza Strip.”

    The Council requested the deployment of “personnel and expertise necessary to monitor and document the ongoing violations of international law” in the occupied territories.

    It condemned Israel’s “apparent intentional use of unlawful lethal and other excessive force” against civilian protesters, including children, journalists and health workers, in Gaza.

    The resolution was adopted with 23 states in favor, 8 against, and 15 abstentions.

    The votes against the resolution were given by Australia, Austria, Brazil, Bulgaria, the Czech Republic, Fiji, Hungary, and Ukraine.

    Photographer Patrick Brown won the FotoEvidence Book Award with World Press Photo for his project “No Place on Earth,” documenting the world’s fastest growing refugee crisis and one of the most rapid human exodus in recent history. Risking death at sea or on foot, more than 700,000 #Rohingya fled the destruction of their homes and persecution in the northern Rakhine State of #Myanmar. Arriving in Bangladesh at the makeshift camps, most refugees reported harrowingly consistent stories of murder and rape, all of which testify to a deliberate campaign of eradication. “No Place on Earth” provides an intimate portrait of the Rohingya survivors and their bleak conditions in overcrowded refugee camps.

      The Rohingya are a predominantly Muslim minority group in Rakhine State, western Myanmar. They number around one million people, laws passed in the 1980s effectively deprived them of Myanmar citizenship. Violence erupted in Myanmar on 25 August after a faction of Rohingya militants attacked police posts, killing 12 members of the Myanmar security forces. Myanmar authorities, in places supported by groups of Buddhists, launched a crackdown, attacking Rohingya villages and burning houses. In late August 2017, I starting hearing reports from friends and colleagues in Bangladesh that Rohingya Muslims were flooding across the border with horrific stories perpetrated by the Myanmar military and vigilantes.

      The UN High Commissioner for Human Rights has called the crackdown in Rakhine State, Burma, “a textbook example of ethnic cleansing”. There is nothing clean about Ethnic cleansing – up close and on the ground, it’s murder, it’s rape, it’s people being slaughtered in the most systematic and barbaric way. It’s people. While euphemisms and diplomatic language can obscure the true horror inflicted by oppressive regimes, photography cuts through all the cold clinical terminology. Through photographs we’re forced to confront the cruel reality of what ethnic cleansing really looks like.

      Although I’ve worked in tough environments before, nothing could have prepared me for the raw misery I saw and heard over the following months: orphan children carrying their younger siblings through flooded paddy fields; wounded men and women who had walked for 10 days with nothing more than their shirts on their backs. Soon the hundreds of desperate people became thousands, and then tens of thousands, then hundreds of thousands. Amid the crush of humanity and gathering monsoon rains, they tried to make shelters with anything that could give them some cover.

      Today, the refugee camp in Cox’s Bazar is the world’s largest - a city of nearly a million people, more densely populated than Manhattan and the size of Copenhagen. Trapped on the edge of a foreign country and rejected by their ancestral homeland, the Rohingya have nothing there but their will to survive and whatever support we provide for them. Their needs are total: for clean drinking water, schools, health care, jobs. But most of all, a safe and dignified place to call home.

  • Detainees Evacuated out of Libya but Resettlement Capacity Remains Inadequate

    According to the United Nations Refugee Agency (#UNHCR) 262 migrants detained in Libya were evacuated to Niger on November 12- the largest evacuation from Libya carried out to date. In addition to a successful airlift of 135 people in October this year, this brings the total number of people evacuated to more than 2000 since December 2017. However Amnesty International describes the resettlement process from Niger as slow and the number of pledges inadequate.

    The evacuations in October and November were the first since June when the Emergency Transit Mechanism (ETM) centre in Niger reached its full capacity of 1,536 people, which according to Amnesty was a result of a large number of people “still waiting for their permanent resettlement to a third country.”

    57,483 refugees and asylum seekers are registered by UNHCR in Libya; as of October 2018 14,349 had agreed to Voluntary Humanitarian Return. Currently 3,886 resettlement pledges have been made by 12 states, but only 1,140 have been resettled.

    14,595 people have been intercepted by the Libyan coast guard and taken back to Libya, however it has been well documented that their return is being met by detention, abuse, violence and torture. UNHCR recently declared Libya unsafe for returns amid increased violence in the capital, while Amnesty International has said that “thousands of men, women and children are trapped in Libya facing horrific abuses with no way out”.

    In this context, refugees and migrants are currently refusing to disembark in Misrata after being rescued by a cargo ship on November 12, reportedly saying “they would rather die than be returned to land”. Reuters cited one Sudanese teenager on board who stated “We agree to go to any place but not Libya.”

    UNHCR estimates that 5,413 refugees and migrants remain detained in #Directorate_for_Combatting_Illegal_Migration (#DCIM) centres and the UN Refugee Agency have repetedly called for additional resettlement opportunities for vulnerable persons of concern in Libya.

      Libya: evacuations to Niger resumed – returns from Niger begun

      After being temporarily suspended in March as the result of concerns from local authorities on the pace of resettlement out of Niger, UNHCR evacuations of vulnerable refugees and asylum seekers from Libya through the Emergency Transit Mechanism has been resumed and 132 vulnerable migrants flown to the country. At the same time the deportation of 132 Sudanese nationals from Niger to Libya has raised international concern.

      Niger is the main host for refugees and asylum seekers from Libya evacuated by UNHCR. Since the UN Refugee Agency began evacuations in cooperation with EU and Libyan authorities in November 2017, Niger has received 1,152 of the 1,474 people evacuated in total. While UNHCR has submitted 475 persons for resettlement a modest 108 in total have been resettled in Europe. According to UNHCR the government in Niger has now offered to host an additional 1,500 refugees from Libya through the Emergency Transit Mechanism and upon its revival and the first transfer of 132 refugees to Niger, UNHCR’s Special Envoy for the Central Mediterranean Situation, Vincent Cochetel stated: “We now urgently need to find resettlement solutions for these refugees in other countries.”

      UNHCR has confirmed the forced return by authorities in Niger of at least 132 of a group of 160 Sudanese nationals arrested in the migrant hub of Agadez, the majority after fleeing harsh conditions in Libya. Agadez is known as a major transit hub for refugees and asylum seekers seeking passage to Libya and Europe but the trend is reversed and 1,700 Sudanese nationals have fled from Libya to Niger since December 2017. In a mail to IRIN News, Human Rights Watch’s associate director for Europe and Central Asia, Judith Sunderland states: “It is inhuman and unlawful to send migrants and refugees back to Libya, where they face shocking levels of torture, sexual violence, and forced labour,” with reference to the principle of non-refoulement.

      According to a statement released by Amnesty International on May 16: “At least 7,000 migrants and refugees are languishing in Libyan detention centres where abuse is rife and food and water in short supply. This is a sharp increase from March when there were 4,400 detained migrants and refugees, according to Libyan officials.”

    • Libya: return operations running but slow resettlement is jeopardizing the evacuation scheme

      According to the International Organization for Migration (IOM) 15.000 migrants have been returned from Libya to their country of origin and the United Nations High Commissioner for Refugees (UNHCR) has assisted in the evacuation of more than 1,300 refugees from Libya thereby fulfilling the targets announced at the AU-EU-UN Taskforce meeting in December 2017. However, a modest 25 of the more than 1000 migrants evacuated to Niger have been resettled to Europe and the slow pace is jeopardizing further evacuations.

      More than 1000 of the 1300 migrants evacuated from Libya are hosted by Niger and Karmen Sakhr, who oversees the North Africa unit at the UNHCR states to the EU Observer that the organisation: “were advised that until more people leave Niger, we will no longer be able to evacuate additional cases from Libya.”

      During a meeting on Monday 5 March with the Civil Liberties Committee and Foreign Affairs Committee MEPs, members of the Delegation for relations with Maghreb countries, Commission and External Action Service representatives on the mistreatment of migrants and refugees in Libya, and arrangements for their resettlement or return, UNHCR confirmed that pledges have been made by France, Switzerland, Italy, Norway, Sweden and Malta as well as unspecified non-EU countries but that security approvals and interviewing process of the cases is lengthy resulting in the modest number of resettlements, while also warning that the EU member states need to put more work into resettlement of refugees, and that resettlement pledges still fall short of the needs. According to UNHCR 430 pledges has been made by European countries.

      An estimated 5000 people are in government detention and an unknown number held by private militias under well documented extreme conditions.

    • Libya: migrants and refugees out by plane and in by boat

      The joint European Union (EU), African Union (AU) and United Nations (UN) Task Force visited Tripoli last week welcoming progress made evacuating and returning migrants and refugees out of Libya. EU has announced three new programmes, for protecting migrants and refugees in Libya and along the Central Mediterranean Route, and their return and reintegration. Bundestag Research Services and NGOs raise concerns over EU and Member State support to Libyan Coast Guard.

      Representatives of the Task Force, created in November 2017, met with Libyan authorities last week and visited a detention centres for migrants and a shelter for internally displaced people in Tripoli. Whilst they commended progress on Voluntary Humanitarian Returns, they outlined a number of areas for improvement. These include: comprehensive registration of migrants at disembarkation points and detention centres; improving detention centre conditions- with a view to end the current system of arbitrary detention; decriminalizing irregular migration in Libya.

      The three new programmes announced on Monday, will be part of the European Union Emergency Trust Fund for Africa. €115 million will go towards evacuating 3,800 refugees from Libya, providing protection and voluntary humanitarian return to 15,000 migrants in Libya and will support the resettlement of 14,000 people in need of international protection from Niger, Chad, Cameroon and Burkina Faso. €20 million will be dedicated to improving access to social and protection services for vulnerable migrants in transit countries in the Sahel region and the Lake Chad basin. €15 million will go to supporting sustainable reintegration for Ethiopian citizens.

      A recent report by the Bundestag Research Services on SAR operations in the Mediterranean notes the support for the Libyan Coast Guard by EU and Member States in bringing refugees and migrants back to Libya may be violating the principle of non-refoulement as outlined in the Geneva Convention: “This cooperation must be the subject of proceedings before the European Court of Human Rights, because the people who are being forcibly returned with the assistance of the EU are being inhumanely treated, tortured or killed.” stated Andrej Hunko, European policy spokesman for the German Left Party (die Linke). A joint statement released by SAR NGO’s operating in the Mediterranean calls on the EU institutions and leaders to stop the financing and support of the Libyan Coast Guard and the readmissions to a third country which violates fundamental human rights and international law.

      According to UNHCR, there are currently 46,730 registered refugees and asylum seekers in Libya. 843 asylum seekers and refugees have been released from detention so far in 2018. According to IOM 9,379 people have been returned to their countries of origin since November 2017 and 1,211 have been evacuated to Niger since December 2017.

    • First group of refugees evacuated from new departure facility in Libya

      UNHCR, the UN Refugee Agency, in coordination with Libyan authorities, evacuated 133 refugees from Libya to Niger today after hosting them at a Gathering and Departure Facility (GDF) in Tripoli which opened on Tuesday.

      Most evacuees, including 81 women and children, were previously detained in Libya. After securing their release from five detention centres across Libya, including in Tripoli and areas as far as 180 kilometres from the capital, they were sheltered at the GDF until the arrangements for their evacuation were concluded.

      The GDF is the first centre of its kind in Libya and is intended to bring vulnerable refugees to a safe environment while solutions including refugee resettlement, family reunification, evacuation to emergency facilities in other countries, return to a country of previous asylum, and voluntary repatriation are sought for them.

      “The opening of this centre, in very difficult circumstances, has the potential to save lives. It offers immediate protection and safety for vulnerable refugees in need of urgent evacuation, and is an alternative to detention for hundreds of refugees currently trapped in Libya,” said UN High Commissioner for Refugees Filippo Grandi.

      The centre is managed by the Libyan Ministry of Interior, UNHCR and UNHCR’s partner LibAid. The initiative is one of a range of measures needed to offer viable alternatives to the dangerous boat journeys undertaken by refugees and migrants along the Central Mediterranean route.

      With an estimated 4,900 refugees and migrants held in detention centres across Libya, including 3,600 in need of international protection, the centre is a critical alternative to the detention of those most vulnerable.

      The centre, which has been supported by the EU and other donors, has a capacity to shelter up to 1,000 vulnerable refugees identified for solutions out of Libya.

      At the facility, UNHCR and partners are providing humanitarian assistance such as accommodation, food, medical care and psychosocial support. Child friendly spaces and dedicated protection staff are also available to ensure that refugees and asylum-seekers are adequately cared for.

    • Migration : à Niamey, des migrants rapatriés de Libye protestent contre leurs conditions de séjour

      Les manifestants protestent contre leur détention de vie qu’ils jugent « déplorables » et pour amplifier leurs mouvements, ils ont brandi des pancartes sur lesquelles ils ont écrit leurs doléances. Les migrants manifestant s’indignent également de leur séjour qui ne cesse de se prolonger, sans véritable alternatives ou visibilité sur leur situation. « Ils nous ont ramené de la Libye pour nous laisser à nous-mêmes ici », « on ne veut pas rester ici, laisser nous partir là où on veut », sont entre autres les slogans que les migrants ont scandés au cours de leur sit-in devant les locaux de l’agence onusienne. Plusieurs des protestataires sont venus à la manifestation avec leurs bagages et d’autres avec leurs différents papiers, qui attestent de leur situation de réfugiés ou demandeurs d’asiles.

      La situation, quoique déplorable, n’a pas manqué de susciter divers commentaires. Il faut dire que depuis le début de l’opération de rapatriement des migrants en détresse de Libye, ils sont des centaines à vivre dans la capitale mais aussi à Agadez où des centres d’accueil sont mis à leurs dispositions par les agences onusiennes (UNHCR, OIM), avec la collaboration des autorités nigériennes. Un certain temps, leur présence de plus en plus massive dans divers quartiers de la capitale où des villas sont mises à leur disposition, a commencé à inquiéter les habitants sur d’éventuels risques sécuritaires.

      Le gouvernement a signé plusieurs accords et adopté des lois pour lutter contre l’immigration clandestine. Il a aussi signé des engagements avec certains pays européens notamment la France et l’Italie, pour l’accueil temporaire des réfugiés en provenance de la Libye et en transit en attendant leur réinstallation dans leur pays ou en Europe pour ceux qui arrivent à obtenir le sésame pour l’entrée. Un geste de solidarité décrié par certaines ONG et que les autorités regrettent presque à demi-mot, du fait du non-respect des contreparties financières promises par les bailleurs et partenaires européens. Le pays fait face lui-même à un afflux de réfugiés nigérians et maliens sur son territoire, ainsi que des déplacés internes dans plusieurs régions, ce qui complique davantage la tâche dans cette affaire de difficile gestion de la problématique migratoire.

      Le Niger accueille plusieurs centres d’accueil pour les réfugiés et demandeurs d’asiles rapatriés de Libye. Le 10 décembre dernier, l’OFPRA français a par exemple annoncé avoir achevé une nouvelle mission au Niger avec l’UNHCR, et qui a concerné 200 personnes parmi lesquelles une centaine évacuée de Libye. En novembre dernier, le HCR a également annoncé avoir repris les évacuations de migrants depuis la Libye, avec un contingent de 132 réfugiés et demandeurs d’asiles vers le Niger.

      Depuis novembre 2017, le HCR a assuré avoir effectué vingt-trois (23) opérations d’évacuation au départ de la Libye et ce, « malgré d’importants problèmes de sécurité et les restrictions aux déplacements qui ont été imposées ». En tout, ce sont 2.476 réfugiés et demandeurs d’asile vulnérables qui ont pu être libérés et acheminés de la Libye vers le Niger (2.069), l’Italie (312) et la Roumanie (95).

    • Destination Europe: Evacuation. The EU has started resettling refugees from Libya, but only 174 have made it to Europe in seven months

      As the EU sets new policies and makes deals with African nations to deter hundreds of thousands of migrants from seeking new lives on the continent, what does it mean for those following dreams northwards and the countries they transit through? From returnees in Sierra Leone and refugees resettled in France to smugglers in Niger and migrants in detention centres in Libya, IRIN explores their choices and challenges in this multi-part special report, Destination Europe.

      Four years of uncontrolled migration starting in 2014 saw more than 600,000 people cross from Libya to Italy, contributing to a populist backlash that is threatening the foundations of the EU. Stopping clandestine migration has become one of Europe’s main foreign policy goals, and last July the number of refugees and migrants crossing the central Mediterranean dropped dramatically. The EU celebrated the reduced numbers as “good progress”.

      But, as critics pointed out, that was only half the story: the decline, resulting from a series of moves by the EU and Italy, meant that tens of thousands of people were stuck in Libya with no way out. They faced horrific abuse, and NGOs and human rights organisations accused the EU of complicity in the violations taking place.

      Abdu is one who got stuck. A tall, lanky teenager, he spent nearly two years in smugglers’ warehouses and official Libyan detention centres. But he’s also one of the lucky ones. In February, he boarded a flight to Niger run (with EU support) by the UN’s refugee agency, UNHCR, to help some of those stranded in Libya reach Europe. Nearly 1,600 people have been evacuated on similiar flights, but, seven months on, only 174 have been resettled to Europe.

      The evacuation programme is part of a €500-million ($620-million) effort to resettle 50,000 refugees over the next two years to the EU, which has a population of more than 500 million people. The target is an increase from previous European resettlement goals, but still only represents a tiny fraction of the need – those chosen can be Syrians in Turkey, Jordan, and Lebanon as well as refugees in Libya, Egypt, Niger, Chad, Sudan, and Ethiopia – countries that combined host more than 6.5 million refugees.

      The EU is now teetering on the edge of a fresh political crisis, with boats carrying people rescued from the sea being denied ports of disembarkation, no consensus on how to share responsibility for asylum seekers and refugees within the continent, and increasing talk of further outsourcing the management of migration to African countries.

      Against this backdrop, the evacuation and resettlement programme from Libya is perhaps the best face of European policy in the Mediterranean. But, unless EU countries offer more spots for refugees, it is a pathway to safety for no more than a small handful who get the luck of the draw. As the first evacuees adjust to their new lives in Europe, the overwhelming majority are left behind.

      Four months after arriving in Niger, Abdu is still waiting to find out if and when he will be resettled to Europe. He’s still in the same state of limbo he was in at the end of March when IRIN met him in Niamey, the capital of Niger. At the time, he’d been out of the detention centre in Libya for less than a month and his arms were skeletally thin.

      “I thought to go to Europe [and] failed. Now, I came to Niger…. What am I doing here? What will happen from here? I don’t know,” he said, sitting in the shade of a canopy in the courtyard of a UNHCR facility. “I don’t know what I will be planning for the future because everything collapsed; everything finished.”
      Abdu’s story

      Born in Eritrea – one of the most repressive countries in the world – Abdu’s mother sent him to live in neighbouring Sudan when he was only seven. She wanted him to grow up away from the political persecution and shadow of indefinite military service that stifled normal life in his homeland.

      But Sudan, where he was raised by his uncle, wasn’t much better. As an Eritrean refugee, he faced discrimination and lived in a precarious legal limbo. Abdu saw no future there. “So I decided to go,” he said.

      Like so many other young Africans fleeing conflict, political repression, and economic hardship in recent years, he wanted to try to make it to Europe. But first he had to pass through Libya.

      After crossing the border from Sudan in July 2016, Abdu, then 16 years old, was taken captive and held for 18 months. The smugglers asked for a ransom of $5,500, tortured him while his relatives were forced to listen on the phone, and rented him out for work like a piece of equipment.

      Abdu tried to escape, but only found himself under the control of another smuggler who did the same thing. He was kept in overflowing warehouses, sequestered from the sunlight with around 250 other people. The food was not enough and often spoiled; disease was rampant; people died from malaria and hunger; one woman died after giving birth; the guards drank, carried guns, and smoked hashish, and, at the smallest provocation, spun into a sadistic fury. Abdu’s skin started crawling with scabies, his cheeks sank in, and his long limbs withered to skin and bones.

      One day, the smuggler told him that, if he didn’t find a way to pay, it looked like he would soon die. As a courtesy – or to try to squeeze some money out of him instead of having to deal with a corpse – the smuggler reduced the ransom to $1,500.

      Finally, Abdu’s relatives were able to purchase his freedom and passage to Europe. It was December 2017. As he finally stood on the seashore before dawn in the freezing cold, Abdu remembered thinking: “We are going to arrive in Europe [and] get protection [and] get rights.”

      But he never made it. After nearly 24 hours at sea, the rubber dinghy he was on with around 150 other people was intercepted by the Libyan Coast Guard, which, since October 2016, has been trained and equipped by the EU and Italy.

      Abdu was brought back to the country he had just escaped and put in another detention centre.

      This one was official – run by the Libyan Directorate for Combating Irregular Migration. But it wasn’t much different from the smuggler-controlled warehouses he’d been in before. Again, it was overcrowded and dirty. People were falling sick. There was no torture or extortion, but the guards could be just as brutal. If someone tried to talk to them about the poor conditions “[they are] going to beat you until you are streaming blood,” Abdu said.

      Still, he wasn’t about to try his luck on his own again in Libya. The detention centre wasn’t suitable for human inhabitants, Abdu recalled thinking, but it was safer than anywhere he’d been in over a year. That’s where UNHCR found him and secured his release.

      The lucky few

      The small village of Thal-Marmoutier in France seems like it belongs to a different world than the teeming detention centres of Libya.

      The road to the village runs between gently rolling hills covered in grapevines and winds through small towns of half-timbered houses. About 40 minutes north of Strasbourg, the largest city in the region of Alsace, bordering Germany, it reaches a valley of hamlets that disrupt the green countryside with their red, high-peaked roofs. It’s an unassuming setting, but it’s the type of place Abdu might end up if and when he is finally resettled.

      In mid-March, when IRIN visited, the town of 800 people was hosting the first group of refugees evacuated from Libya.

      It was unseasonably cold, and the 55 people housed in a repurposed section of a Franciscan convent were bundled in winter jackets, scarves, and hats. Thirty of them had arrived from Chad, where they had been long-time residents of refugee camps after fleeing Boko Haram violence or conflict in the Sudanese region of Darfur. The remaining 25 – from Eritrea, Ethiopia, and Sudan – were the first evacuees from Libya. Before reaching France, they, like Abdu, had been flown to Niamey.

      The extra stop is necessary because most countries require refugees to be interviewed in person before offering them a resettlement spot. The process is facilitated by embassies and consulates, but, because of security concerns, only one European country (Italy) has a diplomatic presence in Libya.

      To resettle refugees stuck in detention centres, UNHCR needed to find a third country willing to host people temporarily, one where European resettlement agencies could carry out their procedures. Niger was the first – and so far only – country to volunteer.

      “For us, it is an obligation to participate,” Mohamed Bazoum, Niger’s influential interior minister, said when interviewed by IRIN in Niamey. Niger, the gateway between West Africa and Libya on the migration trail to Europe, is the top recipient of funds from the EU Trust Fund for Africa, an initiative launched in 2015 to “address the root causes of irregular migration”.

      “It costs us nothing to help,” Bazoum added, referring to the evacuation programme. “But we gain a sense of humanity in doing so.”

      ‘Time is just running from my life’

      The first evacuees landed in Niamey on 12 November. A little over a month later, on 19 December, they were on their way to France.

      By March, they had been in Thal-Marmoutier for three months and were preparing to move from the reception centre in the convent to individual apartments in different cities.

      Among them, several families with children had been living in Libya for a long time. But most of the evacuees were young women who had been imprisoned by smugglers and militias, held in official detention centres, or often both.

      “In Libya, it was difficult for me,” said Farida, a 24-year-old aspiring runner from Ethiopia. She fled her home in 2016 because of the conflict between the government and the Oromo people, an ethnic group.

      After a brief stay in Cairo, she and her husband decided to go to Libya because they heard a rumour that UNHCR was providing more support there to refugees. Shortly after crossing the border, Farida and her husband were captured by a militia and placed in a detention centre.

      “People from the other government (Libya has two rival governments) came and killed the militiamen, and some of the people in the prison also died, but we got out and were taken to another prison,” she said. “When they put me in prison, I was pregnant, and they beat me and killed the child in my belly.”

      Teyba, a 20-year-old woman also from Ethiopia, shared a similar story: “A militia put us in prison and tortured us a lot,” she said. “We stayed in prison for a little bit more than a month, and then the fighting started…. Some people died, some people escaped, and some people, I don’t know what happened to them.”

      Three months at the reception centre in Thal-Marmoutier had done little to ease the trauma of those experiences. “I haven’t seen anything that made me laugh or that made me happy,” Farida said. “Up to now, life has not been good, even after coming to France.”

      The French government placed the refugees in the reception centre to expedite their asylum procedures, and so they could begin to learn French.

      Everyone in the group had already received 10-year residency permits – something refugees who are placed directly in individual apartments or houses usually wait at least six months to receive. But many of them said they felt like their lives had been put on pause in Thal-Marmoutier. They were isolated in the small village with little access to transportation and said they had not been well prepared to begin new lives on their own in just a few weeks time.

      “I haven’t benefited from anything yet. Time is just running from my life,” said Intissar, a 35-year-old woman from Sudan.

      A stop-start process

      Despite their frustrations with the integration process in France, and the still present psychological wounds from Libya, the people in Thal-Marmoutier were fortunate to reach Europe.

      By early March, more than 1,000 people had been airlifted from Libya to Niger. But since the first group in December, no one else had left for Europe. Frustrated with the pace of resettlement, the Nigerien government told UNHCR that the programme had to be put on hold.

      “We want the flow to be balanced,” Bazoum, the interior minister, explained. “If people arrive, then we want others to leave. We don’t want people to be here on a permanent basis.”

      Since then, an additional 148 people have been resettled to France, Switzerland, Sweden and the Netherlands, and other departures are in the works. “The situation is improving,” said Louise Donovan, a UNHCR communications officer in Niger. “We need to speed up our processes as much as possible, and so do the resettlement countries.”

      A further 312 people were evacuated directly to Italy. Still, the total number resettled by the programme remains small. “What is problematic right now is the fact that European governments are not offering enough places for resettlement, despite continued requests from UNHCR,” said Matteo de Bellis, a researcher with Amnesty International.
      Less than 1 percent

      Globally, less than one percent of refugees are resettled each year, and resettlement is on a downward spiral at the moment, dropping by more than 50 percent between 2016 and 2017. The number of refugees needing resettlement is expected to reach 1.4 million next year, 17 percent higher than in 2018, while global resettlement places dropped to just 75,000 in 2017, UNHCR said on Monday.

      The Trump administration’s slashing of the US refugee admissions programme – historically the world’s leader – means this trend will likely continue.

      Due to the limited capacity, resettlement is usually reserved for people who are considered to be the most vulnerable.

      In Libya alone, there are around 19,000 refugees from Eritrea, Ethiopia, Somalia, and Sudan registered with UNHCR – a number increasing each month – as well as 430,000 migrants and potential asylum seekers from throughout sub-Saharan Africa. Many have been subjected to torture, sexual violence, and other abuses. And, because they are in Libya irregularly, resettlement is often the only legal solution to indefinite detention.

      In the unlikely scenario that all the sub-Saharan refugees in Libya were to be resettled, they would account for more than one third of the EU’s quota for the next two years. And that’s not taking into account people in Libya who may have legitimate grounds to claim asylum but are not on the official radar. Other solutions are clearly needed, but given the lack of will in the international community, it is unclear what those might be.

      “The Niger mechanism is a patch, a useful one under the circumstance, but still a patch,” de Bellis, the Amnesty researcher, said. “There are refugees… who cannot get out of the detention centres because there are no resettlement places available to them.”

      It is also uncertain what will happen to any refugees evacuated to Niger that aren’t offered a resettlement spot by European countries.

      UNHCR says it is considering all options, including the possibility of integration in Niger or return to their countries of origin – if they are deemed to be safe and people agree to go. But resettlement is the main focus. In April, the pace of people departing for Europe picked up, and evacuations from Libya resumed at the beginning of May – ironically, the same week the Nigerien government broke new and dangerous ground by deporting 132 Sudanese asylum seekers who had crossed the border on their own back to Libya.

      For the evacuees in Niger awaiting resettlement, there are still many unanswered questions.

      As Abdu was biding his time back in March, something other than the uncertainty about his own future weighed on him: the people still stuck in the detention centres in Libya.

      He had started his travels with his best friend. They had been together when they were first kidnapped and held for ransom. But Abdu’s friend was shot in the leg by a guard who accused him of stealing a cigarette. When Abdu tried to escape, he left his friend behind and hasn’t spoken to him or heard anything about him since.

      “UNHCR is saying they are going to find a solution for me; they are going to help me,” Abdu said. “It’s okay. But what about the others?”

  • #Fridtjof_Nansen, WWI, and the Beginning of the Modern Refugee Regime

    This week–on November 11–marked the 100th anniversary of the Armistice that ended World War I. In terms of refugee law, the Great War is usually eclipsed by WWII, which gave rise to the Refugee Convention (in 1951). The Convention forms the basis for our international and domestic humanitarian law up until today.

    But the First World War was also foundational to our current refugee regime, and so it’s too bad that WWI developments in refugee law get short shrift. Upwards of 10 million people were displaced by the War and the subsequent rise of the Soviet Union. Many would never return home and would permanently resettle in other countries. This mass movement of civilians led to political, cultural, and social changes, and predictably, to a backlash against refugees (as a security, economic, and health threat) that sounds all-too familiar today.

    Probably the most prominent figure in post-WWI refugee resettlement was a Norwegian wunderkind named Fridtjof Nansen. Mr. Nansen was born in 1861. He was a record-breaking skater and skier. He studied zoology in university, and went on to become a world famous artic explorer. In 1888, he led the first expedition to cross Greenland, and in 1895, he came within 4 degrees of the North Pole, the furthest north anyone had traveled to date. After his career in the Artic, he turned to science, where he made important contributions to the fields of neurology and oceanography. Mr. Nansen served as a diplomat and advocated for separation of Norway and Sweden (which had been united since 1814). Norway became independent in 1905.

    Norway was neutral during the First World War, and during those years, Mr. Nansen was involved in organizing his nation’s defense. In 1917, he was dispatched to Washington, where he negotiated a deal to help alleviate a severe food shortage in his country.

    After World War I, Mr. Nansen successfully helped advocate for Norway’s involvement in the League of Nations, and he served as a delegate to that body. He became involved in the repatriation of prisoners of war, and between 1920 and 1922, led the effort to resettle over 400,000 POWs in 30 different countries. In 1921, Mr. Nansen became the League’s High Commissioner for Refugees and helped resettle two million Russians displaced by the revolution. At the same time, he was working to relieve a massive famine in Russia, but had trouble securing international aid (due largely to suspicion of the new Marxist government). He also assisted Armenian refugees after the genocide there, and devised a controversial population exchange between Turkey and Greece, which resolved a Greek refugee crisis, but also resulted in the expulsion (with compensation) of Turks from Greece.

    Mr. Nansen created the “Nansen” passports in 1922, a document that allowed stateless people to travel legally across borders. By WWII, 52 nations recognized the passport as a legal travel document. Nansen passports were originally created to help refugees from the Russian civil war, but over 20 years, they were used by more than 450,000 individuals from various countries (including a number of well-known figures, such as Marc Chagall, Aristotle Onassis, G.I. Gurdjiieff, Rabbi Menachem Mendel Schneerson, and Igor Stravinsky). The passports served as a foundation for a clearly-defined legal status for refugees, and some scholars consider the creation of the Nansen passports as the beginning of international refugee law.

    In 1922, Mr. Nansen was awarded the Nobel Peace Prize. The Nobel Committee cited “his work for the repatriation of the prisoners of war, his work for the Russian refugees, his work to bring succour to the millions of Russians afflicted by famine, and finally his present work for the refugees in Asia Minor and Thrace.”

    Mr. Nansen continued his involvement in the League of Nations through the 1920s, and he flirted with Norwegian politics, though he seems to have no major ambitions in that direction. In 1926, Mr. Nansen came up with a legal definition for refugees from Russia and Armenia, and his definition was adopted by several dozen nations. This marked the first time that the term “refugee” was defined in international law, and it helped set the stage for later legal developments in the area of refugee protection.

    Fridtjof Nansen died on May 3, 1930. After his death, a fellow delegate from the League of Nations eulogized, “Every good cause had his support. He was a fearless peacemaker, a friend of justice, an advocate always for the weak and suffering.”

    Even after his death, Mr. Nansen’s work continued. The League of Nations established the Nansen International Office for Refugees, which helped resettle tens of thousands of refugees during the inter-War years. The Nansen Office was also instrumental in establishing the Refugee Convention of 1933 (now, largely forgotten), the first international, multilateral treaty offering legal protection to refugees and granting them certain civic and economic rights. The 1933 Convention also established the principle of “non-refoulement,” the idea that nations cannot return individuals to countries where they face persecution. To this day, non-refoulement is a key concept of international (and U.S.) refugee law. For all this work, the Nansen Office was awarded the Nobel Peace Prize in 1938.

    Fridtjof Nansen’s legacy lives on in many ways. There are geographic features named after him in the Artic, Antarctic, and various places around the globe. In space, there is a crater on the moon named in his honor, as well as an asteroid. The oldest ski club in the United States is named for Mr. Nansen, and there is a species of fish that bears his name (Nansenia). A museum in Armenia documents his scientific and humanitarian achievements. And each year, the United Nations bestows the Nansen Refugee Award on an individual or organization that has assisted refugees, displaced or stateless people. For me, though, Mr. Nansen’s most enduring achievement is his pioneering work to help establish international refugee law, a legal regime which protects us all.

  • Three million euro for the United Nations High Commissioner for Refugees

    The Farnesina has allocated a contribution of three million euro to the United Nations High Commissioner for Refugees from the Africa Fund of the Ministry of Foreign Affairs and International Cooperation. It is to strengthen the reception and protection system for refugees in Niger.
    The project, called “Strengthening reception conditions for persons in need of international protection in Agadez and in Niamey”, provides support for temporary reception and protection of refugees hosted in Niger, also in the context of the evacuation of vulnerable persons from Libya operated by the UNHCR. About 2,750 refugees and asylum seekers in Niger will benefit from the intervention.
    The High Commissioner is committed to supporting refugees in many African countries along the main migratory routes headed for Europe, and particularly in Niger. There are over 344,000 refugees and displaced persons in Niger, plus about 1,500 particularly vulnerable individuals evacuated from Libya.
    The recent Italian contribution is part of a broader Italian strategy to support the international organisations responsible for migrants and refugees. In 2017 Italy provided over 51 million dollars to the UNHCR for its activities, thus taking twelfth place among the largest donors of the Agency.

  • As the World Abandons Refugees, UNHCR’s Constraints Are Exposed

    The U.N. refugee agency lacks the funding, political clout and independence to protect refugees in the way that it is supposed to, says former UNHCR official and refugee policy expert #Jeff_Crisp.

    Over the past three years, the world has been confronted with a number of major new refugee emergencies – in Myanmar, Nigeria, South Sudan, Yemen and Venezuela, as well as the Central American region. In addition, existing crises in Afghanistan, Democratic Republic of the Congo, Somalia and Syria have gone unresolved, making it impossible for large exiled populations to return to their own country. As a result, the global refugee population has soared to more than 25 million, the highest figure ever recorded.

    This means that the role of the United Nations refugee agency, UNHCR, which is supposed to protect and find solutions for this growing population, is more important than ever. But is it up to the task? The proliferating crises have stretched it to the limit. Funding, most of which comes from a dozen key donor states, has not kept up with the rising numbers the agency is expected to support. In April, UNHCR said it had received just $2.3 billion of the $8.2 billion it needed for its annual program.

    Things look unlikely to improve. UNHCR is losing the support of the United States, traditionally the organization’s most important government partner, whether under Republican or Democrat administrations. Since Donald Trump’s election, the country has slashed the number of refugees it admits through its resettlement program. In his final years in office, Barack Obama had raised the annual quota to 110,000 refugees. That is now down to 45,000 and may yet be reduced to 25,000.

    There is also the prospect that the Trump administration will demonstrate its disdain for the U.N. and limited interest in the refugee issue by reducing its funding to the agency, as it has already done with UNRWA, a separate agency that supports Palestinian refugees. Given that the U.S. currently contributes almost 40 percent of the UNHCR budget, even a modest reduction in its support will mean serious cuts in expenditure.

    The agency therefore has little choice but to look for alternative sources of funding and diplomatic support, especially from the European Union and its member states. But that may come at a price. One of the E.U.’s top priorities is to halt the arrival of refugees and asylum seekers who have transited through nearby countries such as Libya, Morocco and Turkey. Populist political parties throughout much of the E.U. are reaping the electoral benefits of taking a hard line on the issue of refugees and migration. Several European governments have shown little hesitation in violating the international refugee laws they have signed in their desperation to seal Europe’s borders.

    The E.U. thus looks to UNHCR for two things: first, the expertise and operational capacity of an organization that has years of experience in responding to mass movements of people; and second, the legitimacy that E.U. policies can acquire by means of close association with an agency deemed by its founding statute to be “entirely non-political and humanitarian.” In this context, it should come as no surprise that E.U. foreign policy chief Federica Mogherini has been at pains to point out that the E.U. and UNHCR “work together” and have a “close partnership” – and that the E.U. remains “the strongest supporter of UNHCR.”

    But this partnership (which involved $436 million in funding from Brussels alone in 2017) also involves an important element of compromise on the part of UNHCR. In the Mediterranean, for example, the E.U. is funding the Libyan coast guard to intercept and return any refugees who try to leave the country by boat. Those people are subsequently confined to detention centers where, according to Amnesty International, they are at risk of torture, forced labor, extortion and murder at the hand of smugglers, bandits or the Libyan authorities.

    The U.N. high commissioner for human rights has publicly chastised the E.U. for its failure to improve the situation of migrants in Libya. By contrast, UNHCR has kept very quiet about the E.U.’s role in the process of interception, return and detention, despite the fact that these actions violate a fundamental principle of refugee protection: that no one should be returned to a country where their life or freedom would be threatened.

    This reveals a fundamental tension in the organization’s character. Ostensibly, UNHCR enjoys a high degree of independence and moral authority. As part of the U.N. system, it is treated with more respect by states and other actors than NGOs doing similar work. It has regular access to heads of state, government leaders, regional organizations, the U.N. security council and the secretary-general himself (who was previously UNHCR chief).

    But in practice, the autonomy enjoyed by UNHCR is at best a relative one. Almost 90 percent of the agency’s funding is provided by states, much of it earmarked for specific programs, projects and countries. UNHCR’s governing board consists entirely of states.

    The organization can operate in a country only if it has the agreement of the government, which also has the ability to shape the scope of UNHCR’s operational activities, as well as the partners it works with. In countries such as Ethiopia, Pakistan, Sudan and Syria, for example, the organization is obliged to work with government departments whose priorities may well be different from those of UNHCR.

    Almost 90 percent of the agency’s funding is provided by states, much of it earmarked for specific programs, projects and countries. UNHCR’s governing board consists entirely of states.

    The tensions at the heart of UNHCR seem unlikely to diminish. Throughout the world, governments are closing their borders to refugees and depriving them of basic rights. Exiled populations are being induced to repatriate against their will and to countries that are not safe. As epitomized by the E.U.’s deal with Turkey, asylum seekers have become bargaining chips in interstate relations, used by political leaders to extract financial, political and even military concessions from each other.

    Given the constitutional constraints imposed on the organization, UNHCR’s options are now limited. It can try (as it has done for many years) to diversify its funding base. It could assume a more assertive stance with states that violate refugee protection principles – and in doing so risk the loss of its already diminished degree of diplomatic support. And it can hope that the recently completed Global Compact on Refugees, a nonbinding declaration of principles that most U.N. member states are expected to sign, will have some effect on the way that governments actually treat refugees.

    A final option available to UNHCR is to be more transparent about its limitations, to moderate the relentless self-promotion of its branding and marketing campaign and give greater recognition to the efforts that refugees are making to improve their own lives. In that respect, UNHCR’s favourite hashtag, “We Stand #WithRefugees,” could usefully be changed to “Refugees Are #StandingUpForThemselves.”

  • Pakistan PM to Offer Citizenship to Afghans Born in #Pakistan

    Pakistani Prime Minister Imran Khan, in an unprecedented announcement Sunday, pledged to offer Pakistani citizenship to hundreds of thousands of Afghans born to refugee families his country has been hosting for decades.

    The United Nations refugee agency and local officials say there are 2.7 million Afghans, including 1.5 million registered as refugees, in Pakistan. The displaced families have fled decades of conflict, ethnic and religious persecution, poverty and economic hardships in turmoil-hit Afghanistan.

    “Afghans whose children have been raised and born in Pakistan will be granted citizenship inshallah (God willing) because this is the established practice in countries around the world. You get an American passport if you are born in America,” said Khan, who took office last month.

    “Then why can’t we do it here. We continue to subject these people to unfair treatment,” the Pakistani prime minister said at a public event in the southern port city of Karachi Sunday night.

    U.N. surveys suggest that around 60 percent of Afghan refugees were either born in Pakistan or were minors when their parents migrated to Pakistan. War-shattered Afghanistan is therefore alien to most of these young people who are already part of the local economy in different ways.

    This group of refugees, officials say, are reluctant to go back to Afghanistan where security conditions have deteriorated in the wake of the stalemated war between U.S.-backed Afghan security forces and the Taliban insurgency.

    Khan noted in his nationally televised remarks that without Pakistani national identification cards and passports, the refugees have been unable to find decent legal jobs or get a quality education in local institutions.

    These people, the prime minister said, will eventually be forced to indulge in criminal activities, posing security issues for areas like Karachi, the country’s largest city and commercial hub. Afghans are a significant portion of the nearly 20 million residents in Karachi.

    “They are humans. How come we have deprived them and have not arranged for offering them national identification card and passport for 30 years, 40 years,” Khan lamented.

    The Pakistani leader explained that since he is also directly overseeing the federal Interior Ministry, which is responsible for granting passports and identification cards, he will instruct his staff to make efforts without further delay to offer Pakistani nationality to the people “who have come from Afghanistan and whose children are raised and born in here.”

    Khan spoke a day after his Foreign Minister, Shah Mehmood Qureshi, visited Afghanistan, where he discussed among other issues the fate of the registered Afghan refugees who have until December 31, 2018, to stay in Pakistan legally.

    An official statement issued after Qureshi’s daylong trip to Kabul said that in his meetings with Afghan leaders, the foreign minister “underlined the need for dignified, sustainable repatriation of Afghan refugees to their homeland through a gradual and time-bound plan.”

    Pakistani authorities have lately complained that Taliban insurgents waging attacks inside Afghanistan have been using the refugee communities as hiding places. Both countries accuse each other of supporting militant attacks against their respective soils. The allegations are at the center of bilateral political tensions.

    In a meeting last week with visiting U.N. High Commissioner for Refugees, Filippo Grandi, Khan assured him that his government will not force Afghan refugees to leave Pakistan.

    Many believe Syria constitutes the worst crisis in a decade. Indeed, the UN Human Rights Office of the High Commissioner has stopped counting fatalities in 2014,[1] the amount of US (2017) and Russian (2016) airstrikes is unprecedented[2] and after distinct crises such as Sinjar, Khan Shaykhun new ones continue to arise (Eastern Ghouta, Afrin). How ‘bad’ is Syria in a comparative perspective?

    Syria is very bad compared to other spaces. Syria averages 70 violent reported events per day, and is currently as violent as all African conflicts plus South Asian fragile countries combined (see visual). To comprehend this number, take a combination of Kenya and Burundi’s lingering unrest, with the Congo’s emerging war, the continuing crises in CAR, Somalia, both Sudan’s, conflict in Nigeria, AQIMS increasing presence in West-Africa and Libya’s continuing problems, and still you do not equal the number of clashes and attacks in Syria’s conflict. Or consider that the number of events during one week of the Afrin offensive (the week of February 5, 2018) is similar in intensity to all violence in the Middle East (with active conflicts like Afghanistan, Yemen and Iraq) plus all protests/incidents in South-East Asia.

    While scholars will contest over competing explanations for the decades to come, ACLED conflict data suggest two key insights. First, Syria is not special because its violence profile is very different. Syria shares a similar violence profile with Iraq and Yemen, meaning that actors engage in the same type of violence but just with an incredible intensity. Second, Syria is not more violent because it gets better reported on. Our ‘overlap-scores’ suggest that the detection rate of violence in Syria is not very different from other contexts. What may instead be a fruitful avenue is the finding that conflict size and intensity seem to be distributed according to an exponential function.[3] That means that the vast majority of conflicts experience (comparatively) little violence while some conflicts at the very tail end of the distribution are incredibly violent (see visual).[4] Syria unfortunately belongs to this latter category.

    Entire villages have been burned to the ground. Women have been raped. Rohingya refugees report that soldiers shot at them as they fled. Along the border with Bangladesh, there are reports that the military has laid land mines to ensure those fleeing won’t return. Though independent observers have no access to the region, the Myanmar government now says 175 villages in the region — 30 percent of all Rohingya villages — are empty.

    “We are hearing really horrendous stories of people who have survived by the skin of their teeth,” Paolo Lubrano, an Oxfam worker in Cox’s Bazar, a town on the Myanmar-Bangladesh border, told me by Skype Friday morning. Lubrano described “dire violence” and an enormous number of very young, and very traumatized, Rohingya refugees. Among those fleeing Myanmar, he added, are many pregnant women who have been walking for three, four, or even five days to find safety.

    The military calls the campaign a “clearance” operation against an insurgent terrorist military group. They claim the crackdown is in response to a series of armed attacks on border police by Rohingya militants on August 25 that left 12 officers dead, the second such type of attacks in the past 12 months. But observers say that though armed Rohingya insurgents exist, their overall numbers are small, and they are poorly equipped. And the crackdown has affected the entire ethnic group.

    Meanwhile, in a Facebook post on Sunday, Gen. Min Aung Hlaing, the head of Myanmar’s military, was dismissive: “They have demanded recognition as Rohingya, which has never been an ethnic group in Myanmar.”

    Zeid Ra’ad al-Hussein, the United Nations high commissioner for human rights, has dubbed this crisis a “textbook example of ethnic cleansing.” Some are going further — saying the country is tipping toward crimes against humanity and even possibly genocide. On September 14, US Secretary of State Rex Tillerson spoke out about the “horrors that we are witnessing occurring in Burma.”

      The Rohingya people are a Muslim ethnic minority group in Burma. They face extraordinary persecution and violence from the Burmese military; military personnel torch villages, murder refugees, and force hundreds of thousands of people to flee their homes.

      Human rights watchdogs say the persecution has intensified in recent months, and a top UN official described a renewed offensive by the Burmese military as “a textbook example of ethnic cleansing.” Hundreds of thousands of Rohingya refugees have fled to Bangladesh. Sen. John McCain, who chairs the Senate Armed Services Committee, has called for reduced military cooperation with the Burmese government because of the violence.

      Rohingya people trying to use social media to share information about the attacks on them tell The Daily Beast they have had their posts removed and their accounts shut down, and that they hope Facebook stops silencing them.

      A Facebook representative told The Daily Beast the company would look into the situation. “We want Facebook to be a place where people can share responsibly, and we work hard to strike the right balance between enabling expression while providing a safe and respectful experience,” said Facebook spokesperson Ruchika Budhraja in a statement. “That’s why we have Community Standards, which outline what type of sharing is allowed on Facebook and what type of content may be reported to us and removed. Anyone can report content to us if they think it violates our standards. In response to the situation in Myanmar, we are carefully reviewing content against our Community Standards.”

      Facebook is currently facing substantial criticism for what appears to be an indifferent attitude toward promoting divisive material.     The humanitarian crisis unfolding in Yemen—the worst in the world—is an “entirely man-made catastrophe,” the product of a the two-and-a-half-year-old Saudi-led and US-backed war of aggression, the UN Office of High Commissioner for Human Rights stated in a report issued on Tuesday.

    The war, which has increasingly assumed near-genocidal proportions, has killed at least 14,000 civilians, maimed many thousands more, displaced 2 million and left at least 7.3 million on the brink of famine.

    Meanwhile, the country is confronting the worst cholera epidemic on record, with the World Health Organization and Yemen’s health ministry reporting 612,703 people infected and 2,048 of them dying from the disease since April. While the spread of the epidemic has slowed over the past two months, there are still 3,000 new cases reported daily.

Over 800 people are believed to have died when a migrants’ vessel sank after a mis-manoeuvre led it to collide with a cargo ship that had approached to rescue its passengers. More than 1,200 lives were thus lost in a single week. As Médecins Sans Frontiers (MSF) commented at the time, these figures eerily resemble those of a war zone.

    In an interview with British news station ITV on Thursday, David Cameron told viewers that the French port of Calais was safe and secure, despite a “#swarm” of migrants trying to gain access to Britain. Rival politicians soon rushed to criticize the British prime minister’s language: Even Nigel Farage, leader of the anti-immigration UKIP party, jumped in to say he was not “seeking to use language like that” (though he has in the past).
    Cameron clearly chose his words poorly. As Lisa Doyle, head of advocacy for the Refugee Council puts it, the use of the word swarm was “dehumanizing” – migrants are not insects. It was also badly timed, coming as France deployed riot police to Calais after a Sudanese man became the ninth person in less than two months to die while trying to enter the Channel Tunnel, an underground train line that runs from France to Britain.

    The way we talk about migrants in turn influences the way we deal with them, with sometimes worrying consequences.

    When considering the 60 million or so people currently displaced from their home around the world, certain words rankle experts more than others. “It makes no more sense to call someone an ’illegal migrant’ than an ’illegal person,’” Human Rights Watch’s Bill Frelick wrote last year. The repeated use of the word “boat people” to describe people using boats to migrate over the Mediterranean or across South East Asian waters presents similar issues.
    “We don’t call middle-class Europeans who take regular holidays abroad ’#EasyJet_people,’ or the super-rich of Monaco ’#yacht_people,’” Daniel Trilling, editor of the New Humanist, told me.

    How people are labelled has important implications. Whether people should be called economic migrants or asylum seekers matters a great deal in the country they arrive in, where it could affect their legal status as they try to stay in the country. It also matters in the countries where these people originated from. Eritrea, for example, has repeatedly denied that the thousands of people leaving the country are leaving because of political pressure, instead insisting that they have headed abroad in search of higher wages. Other countries make similar arguments: In May, Bangladesh Prime Minister Sheikh Hasina said that the migrants leaving her country were “fortune-seekers” and “mentally sick.” The message behind such a message was clear: It’s their fault, not ours.

    There are worries that even “migrant,” perhaps the broadest and most neutral term we have, could become politicized.

    Those living in the migrant camps near #Calais, nicknamed “the #jungle,” seem to understand this well themselves. “It’s easier to leave us living like this if you say we are bad people, not human," Adil, a 24-year-old from Sudan, told the Guardian.

      Words have consequences, especially in situations where strong emotions as well as social and political conflicts are endemic. Raj Bhopal’s rapid response in The BMJ, in which he objected to the use of the phrase “illegal migrant” on the grounds that only actions, not persons, can be deemed “illegal”, merits further reflection and dissection.

      Some people think that those who protest against this phrase are taking sides with migrants in conflict with the law, in a futile attempt to cover up what is going on. On the contrary: the very idea that a person can be illegal is incompatible with the rule of law, which is founded on the idea that everyone has the right to due process and is equal in the eyes of the law. Labelling a person as “illegal” insinuates that their very existence is unlawful. For this reason, bodies including the United Nations General Assembly, International Organization for Migration, Council of Europe, and European Commission have all deemed the phrase unacceptable, recommending instead the terms “irregular” or “undocumented”. It would be more than appropriate for the medical profession, given its social standing and influence, to do the same.

      While people cannot be illegal, actions can: but here too, words have to be chosen carefully. For example, the overwhelming majority of irregular migrants have not entered the country clandestinely; they have either had their asylum application turned down, or have “overstayed” a visa, or breached its conditions. Moreover, it is never correct to label someone’s actions “illegal” before the appropriate legal authority has determined that they are. Until then, the presumption of innocence should apply. Due process must have been followed, including the right to legal advice, representation, and appeal—rights that the UK government, especially where migrants are concerned, has been only too willing to sacrifice on the altar of cost-cutting.

      Even after an official determination that a person is residing unlawfully, we must have confidence in the fairness of the procedures followed before it is safe to assume that the decision was correct. This confidence has been badly shaken by the recent finding that almost half of the UK Home Office’s immigration decisions that go to appeal are overturned. In their zeal to implement the government’s policy of creating a “hostile environment” for people residing unlawfully, some Home Office officials appear to have forgotten that the rule of law still applies in Britain. People who had lived legally in the UK for decades have been suddenly branded as “illegally resident” and denied healthcare because they couldn’t provide four pieces of evidence for each year of residence since they arrived—even when some of the evidence had been destroyed by the Home Office itself. Hundreds of highly skilled migrants including doctors have been denied the right to remain in the UK because minor tax or income discrepancies were taken as evidence of their undesirability under the new Immigration Rules. A recent case in which the Home Office separated a 3-year-old girl from her only available parent, in contravention of its own policies, led to an award for damages of £50,000.

      What of the medical profession’s own involvement? The 2014 Immigration Act links a person’s healthcare entitlement to their residency status. Health professionals in the UK are now required to satisfy themselves that an individual is eligible for NHS care by virtue of being “ordinarily resident in the UK,” the definition of which has been narrowed. In practice, this has meant that people who do not fit certain stereotypes are more likely to be questioned—a potential route to an institutionally racist system. They can instantly be denied not only healthcare, but also the ability to work, hold a bank account or driver’s licence, or rent accommodation. It is unprecedented, and unacceptable, for UK health professionals to be conscripted as agents of state control in this way.

      Given the unrelenting vendetta of sections of the British press against people who may be residing unlawfully, it should also be borne in mind that such migrants cannot “sponge off the welfare state”, since there are virtually no benefits they can claim. They are routinely exposed to exploitation and abuse by employers, while “free choice” has often played a minimal role in creating their situation. (Consider, for example, migrants who lose their right of residence as a result of losing their job, or asylum seekers whose claim has been rejected but cannot return to their country because it is unsafe or refuses to accept them).

      To sum up: abolishing the dehumanising term “illegal migrant” is an important first step, but the responsibility of health professionals goes even further. In the UK they are obliged to collaborate in the implementation of current immigration policy. To be able to do this with a clear conscience, they need to know that rights to residence in the UK are administered justly and humanely. Regrettably, as can be seen from the above examples, this is not always the case.

  • UN report urges end to inhuman detention of migrants in Libya

    The breakdown in the Libyan justice system has led to a state of impunity in which migrants are subjected to serious human rights violations and abuses, according to a joint UN human rights report published today.
    “People smuggled or trafficked into Libya face torture, forced labour and sexual exploitation along the route, and many also while held in arbitrary detention,” said Martin Kobler, the Secretary General’s Special Representative for Libya and Head of the UN Support Mission in Libya (UNSMIL).

    “The list of violations and abuses faced by migrants in Libya is as long as it is horrific. This is, quite simply, a human rights crisis affecting tens of thousands of people,” UN High Commissioner for Human Rights Zeid Ra’ad Al Hussein said.

    The report, published jointly by UNSMIL and the UN Human Rights Office, is based on information gathered in Libya and from interviews with migrants who had arrived in Italy from Libya, among other sources*.

    Migrants are held in detention centres mostly run by the Department for Combatting Illegal Migration (DCIM), where there is “no formal registration, no legal process, and no access to lawyers or judicial authorities,” the report states.
    Places of detention are severely overcrowded, with insufficient food and clean water. With no access to toilets, detainees are often forced to defecate and urinate in their cells. Malnutrition, acute diarrhoea, respiratory problems and infectious diseases, including scabies and chickenpox, are common.

    Smugglers and traffickers also hold migrants in “connection houses”, on farms and in warehouses and apartments, where they are forced to work to earn money for their onward transport.

    “We are called animals and are treated as animals,” a 16-year-old boy from Eritrea told UNSMIL. “They beat us with what falls into their hands…it can be a rock, a stick, a brick,” a child migrant interviewed in Italy said.
    The report also notes that DCIM and the Libyan Coast Guard** are subject to pressure from the armed groups that have proliferated since 2011. UNSMIL has received reports that some State employees and local officials have participated in the smuggling and trafficking process.

    The report also details accounts of armed men, allegedly from the Libyan Coast Guard, intercepting migrant boats and abusing migrants. Migrants brought back to shore describe being beaten, robbed and taken to detention centres.
    “Libya must acknowledge that migrants are being abused,” said Mr. Kobler. “But addressing migration is not only Libya’s responsibility. Countries of origin and destination beyond Libya also need to play their part.” He added: “I welcome the life-saving efforts currently being made by many in the Mediterranean.”

    Among the report’s recommendations to Libya are: immediately release the most vulnerable migrants, with a view to urgently ending all arbitrary detentions; reduce the number of detention centres; ensure women are held separately from men; improve conditions of detention and protect detainees from torture and all other forms of abuse; and, in the medium-term, decriminalize irregular migration and adopt an asylum law.

    The report also recommends that countries of destination beyond Libya continue search and rescue operations in the Mediterranean. Training and support for Libyan institutions that engage with migrants, including the Libyan Coast Guard, should be accompanied by comprehensive efforts to stop arbitrary detention of migrants and improve their treatment in detention.

    “These are people who, for a range of reasons, feel compelled to leave their own countries and embark on these desperate and precarious journeys. The report lays bare the suffering endured by these migrants who have experienced unimaginable abuse and, in some cases, fallen victim to the despicable trade in human lives,” said High Commissioner Zeid. “The report serves to deepen our compassion and strengthen our resolve that the rights of migrants should be fully protected and respected, whatever their status.”

    A refusal to shrink from difficult confrontations is a recurring theme in Navi Pillay’s career. During her six years as UN High Commissioner for Human Rights she took on the then Sri Lankan president Mahinda Rajapaksa for failing to investigate the deaths of over 100,000 people in the last weeks and months of the country’s civil war, which ended in 2009 after 26 years. In response, the Sri Lankan government said that South African-born Pillay lacked objectivity because of her Tamil ancestry. An Indian diplomat told Pillay that her campaign to end caste discrimination was unfair because it humiliated India on a world stage. A Syrian ambassador called her a “lunatic”. Some western countries (including the UK) complained when she pointed out their failures to uphold certain human rights. “They said I should be focusing on distant countries where thousands of people are killed,” she said. “In other words, developing countries.”

    (Geneva) – The United Nations Human Rights Council should immediately create an international investigation into abuses in Yemen. The UN high commissioner for human rights also called for a halt to arming the parties to the conflict in a report released in Geneva on August 25, 2016. He called the impact of the conflict on Yemen’s civilians “devastating.”

    Beyond the huge death toll, what is most striking about these events is that they were not the result of the reluctance to carry out rescue operations, which has been identified as a structural cause of migrants’ deaths in the Mediterranean Sea. In these two cases, the actual loss of life has occurred during and partly through the rescue operation itself. The detailed reconstruction of these two successive tragedies provided in this report shows, however, that in all likelihood the merchant vessels involved complied with their legal obligations and did everything they possibly could to rescue the passengers in distress. While it could appear that only the ruthless smugglers who overcrowded the unseaworthy boats to the point of collapse are to blame, the report focuses on the deeper responsibilities of EU agencies and policy makers.

    “About the report

    The following report, produced by Forensic Oceanography – a research team based within the Forensic Architecture agency at Goldsmiths (University of London) that specialises in the use forensic techniques and cartography to reconstruct cases of deaths at sea – in collaboration with WatchTheMed and in the framework of the ESRC-supported “Precarious Trajectories” research project, seeks to understand the conditions that made these events possible.

    It does so by mobilising a vast array of methodologies and techniques. First, the report offers, through a series of visualizations, diagrams and figures, a detailed spatio-temporal reconstruction of various cases of shipwrecks. This work was an exercise in the culling of disparate data that was eventually recombined in an effort to assemble a coherent spatial narrative of the chain of events. The reconstructions provided by the report are in fact based on numerous sources, in particular survivors’ testimonies, distress signals, Search and Rescue (SAR) reports provided by Frontex, Automatic Information System (AIS) vessel tracking data, judicial documents obtained from public prosecutors’ offices in Sicily investigating these cases, and photographs taken during the events by rescue teams. At times, elements of information were also extracted from secondary sources such as news reports and human rights reports by international organizations such as Amnesty International.

    The policy decisions that led to these shipwrecks, however, sought precisely to keep state-operated assets at a distance from the area in which these were occurring. Focusing exclusively on the reconstruction of the events, then, would not have allowed for an accurate description of the mechanisms of this form of killing by omission. Therefore, in addition to case reconstruction, the report undertook an analysis that could be characterized as a “policy forensics”. This consisted of a comprehensive textual analysis of various technical assessments produced by Frontex, official statements by policy makers and EU officials, minutes of operational meetings between Frontex and other member states agencies, and transcripts of debates in the European Parliament and in its Civil Liberties, Justice and Home Affairs (LIBE) committee. This endeavour was necessary, first of all, in order to gain a fine-grained understanding of the successive institutional steps that led to the retreat of state-led SAR operations. Secondly, it has allowed us to assess with precision the degree of knowledge concerning the risks to migrants’ lives the actors taking these decisions possessed. On this basis, the report points to the responsibility of the various agencies and individuals that took those decisions.

    Finally, the report seeks to attend to the materialisation of these policies at sea, in terms of: the operational zones, operational logics and practices of state actors; how these policy shifts affected the practices of other actors operating at sea, such as smugglers and merchant ships; and the conditions and danger of migrants’ crossings. Here key sources were: spatial analysis of operational zones; interviews with state officials (the Italian Coast Guard, Customs Police and Frontex) concerning their operations at sea; and statistical data referring to migrant arrivals, deaths and SAR operations.

    The diversity of sources and types of data required the report to draw upon the methodologies and expertise of a variety of disciplines. The material has thus been analysed in collaboration with experts in the relevant fields of geographic information science, vessel tracking technologies, image forensics, oceanography, statistical analysis, EU policy, international law and migration studies.”

    Leoluca Orlando is one of the longest lasting and most successful political leaders in post-war Italy. He has been elected mayor of Palermo – a city that was once the stronghold of the Sicilian mafia, no less than four times since 1985 – most recently in 2012 with over 70% of the popular vote. This despite campaigning to rid his city and region of what Orlando refers to as the plague of organized crime. A plague which nevertheless maintains its tenacious hold on important areas of economic, social and political life on the island.

    The walls of the Council Chamber in Palermo are studded with plaques to the memories of public servants, priests and ordinary citizens who have been murdered by the Mafia, including several of Orlando’s closest partners. Indeed, it was the murder of Piersanti Mattarella – the then-regional president of Sicily in 1980 – that obliged the young human rights lawyer to abandon a promising university career for the highly dangerous vocation of public office. Piersanti’s brother Sergio is currently the President of the Italian Republic and remains a close friend and confidant of Palermo’s outspoken mayor.

    Now aged 68 and three years into what may well be his final mandate, Orlando is fired with a new mission – that of restoring Palermo to its historical primacy as the cradle of a cosmopolitan “Arab-Norman” Mediterranean culture. “The city of Palermo is not a Mediterranean city,” argues Orlando, “it is a Middle Eastern city in Europe” that shares as much in common with Beirut and Djibouti as with Rome or Hamburg.

    The San Bernardino District Attorney’s summary argument, contained in its application to file an amicus brief, alleges the iPhone might have been “used as a weapon to introduce a lying dormant cyber pathogen that endangers San Bernardino County’s infrastructure.” The court document contained no evidence to support the claim.

    Zeid Ra’ad Al Hussein, U.N. High Commissioner for Human Rights, urged U.S. authorities to proceed with “great caution”, warning: "A successful case against Apple in the U.S. will set a precedent that may make it impossible for Apple or any other major international IT company to safeguard their clients’ privacy anywhere in the world.

    It is potentially a gift to authoritarian regimes, as well as to criminal hackers,” he said in a statement.

    TWO BIG COALITIONS
    The tech and Internet industries largely coalesced around two filings. One includes market leaders Google, Microsoft, Facebook, Amazon.com and Cisco Systems, along with smaller, younger companies such as Mozilla, Snapchat, Slack and Dropbox.

    That group noted that Congress passed the All Writs Act more than 200 years ago, and said the Justice Department’s effort to use the law to force engineers to disable security protections relies on a “boundless” interpretation of the law that is not supported by any precedent.

    The brief also advanced constitutional arguments, saying the order violated free speech, the separation of power and due process.

    The second industry coalition, which includes Twitter, eBay Inc and LinkedIn, contended in its filing that the Communications Assistance for Law Enforcement Act (CALEA) of 1994, along with other statutes, has already made it clear what the companies could or could not be forced to do.

      The curious statement was made in reference to an unspecified threat in violation of California Penal Code Section §502 covering protections against tampering, interference, damage and unauthorized access to computer systems. Specifically, Ramos says the iPhone in question could contain evidence “that it was used as a weapon to introduce a lying dormant cyber pathogen that endangers San Bernardino County’s infrastructure.” Beyond that, no other details are offered.

      There is no mention of “cyber pathogens” in Cal. Penal Code §502, but the provision does reference a “#computer_contaminant,” described as a “_set of computer instructions that are designed to modify, damage, destroy, record, or transmit information within a computer, computer system, or computer network without the intent or permission of the owner of the information.” Ramos appears to be indicating that Farook potentially released a virus or worm onto the county’s internal network using his work-issued iPhone 5c.
