Cette politique est discriminatoire à l’encontre des citoyens palestiniens d’Israël et favorise les citoyens juifs, en restreignant fortement l’accès des résidents palestiniens à des terres qui seraient requises pour construire des logements afin de s’adapter à la croissance naturelle de la population.

  • Turkish Cypriot Authorities: Release Detained Syrian Asylum Seekers. Republic of Cyprus Should Process Their Claims

    Turkish Cypriot authorities should immediately release 175 detained Syrian asylum seekers, and Greek Cypriot authorities should allow them to cross the line into their territory and process their asylum claims, Human Rights Watch said today.

    On March 20, 2020, citing a #Covid-19 lockdown, Greek Cypriot authorities refused permission to dock to a boat carrying the asylum seekers, many of whom were trying to join family already settled in the Republic of Cyprus. The boat eventually navigated north, and Turkish Cypriot authorities rescued them from shallow waters when their vessel capsized. Turkish Cypriot authorities are now effectively detaining the asylum seekers and have indicated that they will transfer them to Turkey.

    “Turkish Cypriot authorities initially provided rescue and safety to the Syrian asylum seekers, but now appear to be holding them in indefinite detention,” said Nadia Hardman, refugee and migrant rights researcher at Human Rights Watch. “For their part, Greek Cypriot authorities should not ignore the claims for protection and family reunification that many of the asylum seekers have on its territory.”

    The 175 Syrian asylum seekers, most of whom fled Aleppo and Idlib, left Mersin in southern Turkey on a boat bound for Cyprus on March 20. They include 69 children, at least 7 of them unaccompanied. After the Greek Cypriot coast guard pushed them back, the overcrowded boat traveled north and overturned near the Northern Cyprus shore. No one was injured and the Turkish Cypriot authorities helped the Syrians reach land and gave them relief items.

    The authorities housed the asylum seekers in a sports hall for a few days, then moved them to an apartment complex for a 14-day quarantine period. That period ended in the first week of April, but the Turkish Cypriot authorities have maintained the Syrian asylum seekers under effective house arrest, confined to the apartments and under constant surveillance. The legal basis for their continued confinement is unclear, as under the law in Northern Cyprus, detention on migration grounds is authorized only for 8 days, extendable only by a court decision, which Human Rights Watch understands has not been sought in this case.

    As a matter of international law, the Republic of Cyprus refers to the entire island, but it is currently under the effective control of two states. The internationally recognized government of the Republic of Cyprus has effective control over the southern part – also referred to as Greek Cyprus. It is a European Union member. The self-declared Turkish Republic of Northern Cyprus (TRNC) governs the northern part and is deemed to be under the effective control of Turkey, the only country that recognizes the entity of TRNC. Under international law, Turkey is treated as an occupying power and assumes responsibility for upholding human rights there.

    Human Rights Watch spoke with 2 of the asylum seekers, who described their conditions as cramped, with 15 to 21 people on average to a room. “They don’t let us outside,” one said. “We are not even allowed on the balcony. We spend all day in our rooms. We don’t know anything and don’t know what will happen to us.” Human Rights Watch understands that the asylum seekers have access to a nurse but have not been tested for Covid-19.

    The TRNC issued deportation orders from the territory to Turkey for all 175 asylum seekers. Human Rights Watch understands that Turkey has refused to accept the Syrians, citing Covid-19-related concerns.

    Turkey has repeatedly violated the prohibition on refoulement – the forcible return of refugees or asylum seekers to a country where they are liable to face persecution or serious violations of their rights, Human Rights Watch said. Since July 2019, Turkey has deported hundreds of Syrians, perhaps more. Any Syrians forcibly returned to Turkey face a risk of onward refoulement to Syria.

    Human Rights Watch spoke to three Syrian asylum seekers in the Republic of Cyprus who said that on previous attempts to reach Cyprus in the past year they had been interdicted by the Turkish coast guard and ultimately returned to Syria. In all cases, they were forced to sign voluntary repatriation forms, a practice that Human Rights Watch has documented.

    The asylum seekers trapped in northern Cyprus expressed frustration and said they were afraid of being returned to Syria. Three had tried to escape by jumping from the balcony of their apartment building but were caught, uninjured, and returned to their rooms. While Turkey has refused to accept them, Human Rights Watch is concerned that this position could change once the strict restrictions on freedom of movement because of Covid-19 loosen.

    The Turkish-controlled TRNC does not operate its own asylum system. The protections that Cyprus is required to provide to asylum seekers as an EU member are inaccessible for asylum seekers in the north. Instead, nongovernmental groups in Northern Cyprus are sometimes granted access to migrants who arrive there to find out if they have international protection needs. If the groups determine that they do, the authorities have tended to allow them to stay and granted them access to basic rights such as to health care, education, and work. Human Rights Watch understands that the groups have yet to be granted access to the 175 asylum seekers.

    The Republic of Cyprus is entitled to control its borders and manage crossings into the country but is bound by the EU Charter of Fundamental Rights to respect the right to seek asylum. Failure to do so may also violate the nonrefoulement principle. Failure to assist a boat in distress could also be a breach of international law of the sea and EU obligations on search-and-rescue.

    Under international law, public health measures must be proportionate, nondiscriminatory, and based on available scientific evidence. Measures such as requiring a period of isolation or quarantine may be permitted, but the pandemic cannot justify blanket bans on allowing boats to land, which risk the rights to life and health of those on board.

    Turkish authorities, as well as the TRNC, are bound by the principle of nonrefoulement. They are also bound by international human rights law, including the European Convention on Human Rights, which prohibits arbitrary detention. While irregular migrants may be detained for limited periods, including pending lawful removal, if such removal is unable to be carried out imminently, they should be released.

    States should not detain children for immigration-related reasons and are obliged to provide appropriate care to unaccompanied children. On April 13, UNICEF said that all governments should impose a moratorium on detaining children and urgently release children where alternatives are possible, due to heightened risks of Covid-19 in detention.

    The Turkish Cypriot authorities should end the detention of the Syrian asylum seekers and ensure they are housed in accommodation where they are able to practice social distancing and proper hygiene and have access to adequate food, water, medical care, and legal assistance, Human Rights Watch said.

    “The Syrian asylum seekers are being held in cramped quarters, vulnerable to the spread of Covid-19, in constant fear they may be forcibly returned to the country they fled,” Hardman said. “Once released from detention, the Republic of Cyprus should promptly accept their claims for asylum and requests for family reunification and protect them from the risk of return to persecution or other serious violations in Syria.”

      À plusieurs reprises, le président turc Recep Tayyip Erdogan a fait part de son souhait d’établir une zone de sûreté dans le Nord-Est du pays pour y réinstaller entre un et trois million de réfugiés syriens.

      Lors de son discours à la tribune des Nations Unies, le 24 septembre 2019, le président turc Recep Tayyip Erdogan a évoqué son plan pour l’établissement d’« un corridor de paix d’une profondeur de 30 kilomètres et d’une longueur de 480 kilomètres » dans le Nord-Est de la Syrie, où il souhaite « permettre l’installation de 2 millions de Syriens avec l’appui de la communauté internationale ». L’idée d’une zone de sûreté n’est pas neuve puisqu’elle est discutée entre la Turquie et les Etats-Unis depuis le mois de janvier 2019. Les 13 et 14 janvier, le président Donald Trump avait déjà twitté qu’il souhaitait créer une « safe zone de 20 miles », soit un peu plus de 30 kilomètres. Début août, les médias turcs et américains, comme le Washington Post, rapportaient deux pays ont convenu de coopérer à la création d’une « zone sûre » dans le nord de la Syrie.

      Lors de son intervention à l’ONU (à partir de 15 minutes et 33 secondes dans la vidéo suivante, en anglais), ainsi que quelques jours plus tôt en Turquie, le président Erdogan a accentué sa volonté de mettre en place une telle zone de sécurité, en avançant qu’elle pourrait permettre la relocalisation d’un à trois millions de réfugiés syriens, selon la taille de la zone. Ainsi à New York, le chef d’État turc a exposé une carte, où l’on distingue la zone de sûreté planifiée, tout en détaillant : « Si cette zone de sûreté peut être déclarée, nous pouvons réinstaller en toute confiance entre 1 et 2 millions de réfugiés […] Les réfugiés peuvent être réinstallés en les sauvant de camps de tentes ou de camps de conteneurs. Nous pouvons prendre ensemble [avec les États-Unis, les forces de la coalition, la Russie et l’Iran] les mesures qui s’imposent pour aller de l’avant. Ce n’est pas un fardeau que nous pouvons supporter exclusivement en tant que République de Turquie. Nous devons prendre les mesures nécessaires dès que possible. Si nous pouvions étendre la profondeur de cette région jusqu’à la ligne Deir Ez-Zor, Raqqa, nous pourrions augmenter le nombre de Syriens jusqu’à 3 millions qui reviendront de Turquie, d’Europe et d’autres parties du monde vers leur patrie.       Selon les données du Haut-commissariat aux réfugiés des nations unies, plus de 3,6 millions de réfugiés syriens vivent actuellement en Turquie. Selon une étude préliminaire pour l’installation 1 million de réfugiés dans la zone tampon, qui a été partagée par Ankara avec d’autres pays lors du sommet de l’ONU en septembre et que le site américain Bloomberg a pu consulter, la Turquie souhaite construire des villages et des villes pour les réfugiés pour un coût estimé d’environ 26 milliards de dollars, qui seraient réglés par la communauté internationale.

      Cependant, la zone de sûreté souhaitée par Ankara et convenue avec Washington tarde à se concrétiser rapidement, puisqu’une telle aire nécessiterait de repousser vers le Sud les forces kurdes de l’YPG, alliées des Américains. Mercredi 2 octobre, d’Hulusi Akar, le ministre de la défense turque, faisant part de l’impatience d’Ankara, a déclaré que le « but ultime [de la Turquie] est de mettre fin à la présence terroriste du PKK, du PYD de l’YPG dans le nord de la Syrie, d’établir un corridor de paix et de faire en sorte que nos frères et sœurs syriens dans notre pays rentrent chez eux. »
      La position du Quai d’Orsay

      Contactée par CheckNews pour connaître la position de la France sur cette « zone de sûreté » souhaitée par la Turquie, une source diplomatique française au Quai d’Orsay répond que « des discussions sont en cours entre les États-Unis et la Turquie pour établir un mécanisme de sécurité frontalière. Nous souhaitons que ces discussions permettent d’apaiser les tensions sur la frontière syro-turque et d’éviter toute action unilatérale. Le retour des réfugiés syriens doit être sûr, digne et volontaire, conformément au droit international. Comme exprimé dans la déclaration conjointe des ministres des affaires étrangères du Small Group sur la Syrie du 26 septembre dernier, nous saluons les efforts remarquables des voisins de la Syrie qui accueillent sur leurs territoires la grande majorité des réfugiés syriens. Nous encourageons la communauté internationale à apporter une assistance humanitaire ainsi qu’un soutien financier à ces pays afin d’apporter une réponse collective à la crise des réfugiés syriens, jusqu’à ce que ces derniers puissent revenir volontairement dans leurs régions d’origine, dans la dignité et en sécurité. La France continuera d’œuvrer pour une solution politique crédible en Syrie, conforme à la résolution 2254 du Conseil de sécurité des Nations unies, pour que les conditions d’un tel retour soient réunies. »

    • Turquie : Expulsion de Syriens vers leur pays en dépit des dangers

      Les autorités ont menacé, détenu et parfois battu des réfugiés syriens avant de les contraindre à retourner dans leur pays.

      Les autorités turques à Istanbul et à Antakya ont arbitrairement expulsé des dizaines de réfugiés syriens ou plus vers le nord de la Syrie entre janvier et septembre 2019, en dépit des combats qui se poursuivent dans ce pays, a déclaré Human Rights Watch aujourd’hui. Les Syriens expulsés ont déclaré que les autorités turques les avaient forcés à signer des formulaires qu’ils n’étaient pas autorisés à lire, et dans certains cas les ont parfois battus ou menacés, avant de les expulser vers la Syrie.

      Fin juillet, le ministre turc de l’Intérieur, Süleyman Soylu, avait nié que la Turquie ait « déporté » des Syriens, mais avait ajouté que toute personne qui le souhaitait pouvait « volontairement » rentrer en Syrie en bénéficiant de procédures lui permettant de retourner dans des « zones de sécurité » non spécifiées. Toutefois, les recherches de Human Rights Watch indiquent que la Turquie a illégalement expulsé des Syriens vers le gouvernorat d’Idlib, l’une des régions les plus dangereuses de Syrie. Les attaques de l’alliance militaire syro-russe ont tué au moins 1 089 civils dans cette région depuis le mois d’avril, selon l’ONU, y compris au moins 20 personnes lors d’une frappe aérienne menée le 16 août.

      « Les responsables turcs affirment que tous les Syriens qui rentrent dans leur pays sont heureux de le faire, mais ceci ne correspond pas à la réalité sur le terrain », a déclaré Gerry Simpson, directeur adjoint de la division Crises et Conflits à Human Rights Watch. « La Turquie a accueilli un nombre quatre fois plus élevé de Syriens que l’Union européenne, mais ne devrait toutefois pas les renvoyer vers une zone de guerre. »

      La Turquie est un État partie au Pacte international relatif aux droits civils et politiques et à la Convention européenne des droits de l’homme, qui interdisent les arrestations ou détentions arbitraires.

      La Turquie est également tenue de respecter le droit coutumier international du non-refoulement, qui interdit l’expulsion de personnes vers un pays où elles seraient exposées au risque de persécution, de torture ou d’autres mauvais traitements, ou de menace à leur vie.

    • Réfugiés syriens : non, il n’est pas encore temps de rentrer

      Les récents combats dans la province d’Idlib ont remis un coup de projecteur sur le calvaire des civils syriens. Neuf ans après le début de la guerre, on estime à plus de 6,6 millions le nombre de personnes déplacées à l’intérieur de la Syrie et à 5,6 millions celui des réfugiés syriens dans le monde. Autant d’exilés que d’aucuns aimeraient voir retourner dans leur foyer… L’activiste syro-britannique Leila al-Shami alerte ici sur le danger de la politique du retour dans un pays où la répression et la brutalité du régime n’ont jamais cessé.

      La traversée de Méditerranée est périlleuse. Rien qu’en 2018, 2 277 personnes sont ainsi mortes en tentant de rejoindre l’Europe [2].

      Ceux qui ont survécu au voyage ont dû faire face à un accueil mitigé. D’une part, l’afflux de réfugiés et de migrants en Europe (ainsi que dans d’autres pays du monde) offre des boucs émissaires parfaits aux classes dirigeantes incapables de régler leurs problèmes internes, tout en alimentant un climat de xénophobie et des sentiments nationalistes croissants. D’autre part, il existe des élans de solidarité, qui vont de l’organisation d’un accueil effectif aux manifestations scandant « Refugees welcome ». Ces efforts vitaux méritent d’être poursuivis. Mais la solidarité qui ne commence qu’aux frontières de l’Europe a ceci de problématique qu’elle ne se penche pas sur les raisons principales qui poussent les demandeurs d’asile à fuir leur pays.
      La moitié de la population syrienne chassée de chez elle

      Depuis 2011, date à laquelle l’État syrien a commencé sa guerre contre un soulèvement pro-démocratique, plus de la moitié de la population a été chassée de chez elle. Même si d’autres acteurs du conflit, parasites djihadistes ou forces d’opposition, ont eux aussi provoqué des déplacements, la responsabilité principale revient à la violence de l’État et de ses bailleurs de fonds étrangers [Russie, Iran, Hezbollah libanais [3] ]. Le régime a eu recours à d’incessants bombardements aériens des villes et à des arrestations massives d’opposants. De nombreux observateurs évoquent le chiffre d’un demi-million de morts [4] (selon un bilan qui date de plus de deux ans). Avec 27 % des logements et deux tiers des établissements scolaires et médicaux endommagés ou détruits, le pays est un champ de ruines. L’effondrement des services publics et de l’économie, qui ont plongé près de 80 % de la population dans la pauvreté, sont d’autres causes évidentes de déplacement.

      En dépit d’un consensus mondial croissant sur le fait que la guerre semble toucher à sa fin, les Syriens continuent de s’exiler pour sauver leur vie. Depuis décembre 2019, près d’un million de personnes [80 % sont des femmes et des enfants] ont fui la province d’Idlib face aux assauts incessants du régime et de la Russie pour reprendre l’enclave rebelle. Peu de possibilités de secours leur étaient offertes, car la frontière syro-turque est fermée. Ces réfugiés s’entassent donc dans des camps insalubres ou dorment en plein air. Avec l’inexistence des soins, une éventuelle propagation du coronavirus parmi les populations déplacées pourrait avoir des conséquences dévastatrices.
      Entre « crise » et arme migratoire

      Bien qu’en Europe, on évoque sans cesse la « crise migratoire », seuls 11,6 % des déplacés syriens se sont réfugiés sur le Vieux Continent. La plupart demeurent dans la région, accueillis en premier lieu dans les pays limitrophes, où ils sont de plus en plus considérés comme un problème. En Turquie, qui accueille plus de 3,6 millions de Syriens sur son sol (plus que tout autre pays), l’incitation au renvoi des immigrés a constitué un argument-clé lors des élections municipales de 2019. Sur les médias sociaux, des campagnes de désinformation ont répandu la haine et la division, provoquant rassemblements anti-syriens et attaques contre leurs commerces. En juillet dernier, des milliers de réfugiés syriens, légaux ou illégaux, dont des enfants, ont été arrêtés dans tout le pays – à Istanbul en particulier, la rafle a été massive. Ces exilés ont été contraints de signer des formulaires de rapatriement « volontaire » puis ont été expulsés vers le nord de la Syrie.

      Ces derniers mois, la Turquie a utilisé les réfugiés comme une arme, arguant du fait que l’Union européenne (UE) n’avait pas versé l’intégralité des paiements convenus pour les maintenir sur son territoire. Les autorités ont incité des milliers de personnes [majoritairement des Afghans, mais aussi des Irakiens, des Syriens, des Somaliens, etc.] à traverser sa frontière avec la Grèce, les plaçant dans une situation d’extrême précarité puisque la frontière était bouclée du côté grec. Amassés le long des barbelés, des réfugiés ont été maltraités par les gardes-frontières grecs, aspergés par des canons à eau et des gaz lacrymogènes [5]. L’UE a multiplié les réunions d’urgence pour faire face à cette « crise » et envisager de répondre aux demandes de la Turquie. C’est la menace de voir s’échouer sur les côtes européennes des milliers de cadavres basanés qui l’a poussée à « agir » – ce que les images quotidiennes d’enfants syriens pris au piège sous les décombres de leurs maisons détruites et les cris angoissés de leurs parents n’ont jamais réussi à faire.

      Parallèlement, l’hostilité grandit envers les réfugiés au Liban, où ils constituent aujourd’hui un tiers de la population, la plupart d’entre eux se trouvant dans une situation précaire sans résidence légale. Un décret gouvernemental a donné la priorité à l’emploi aux travailleurs libanais, ce qui a conduit au licenciement de nombreux Syriens. Les incitations au racisme se sont multipliées de la part de politiciens de premier plan qui décrivent les réfugiés comme une menace existentielle pour la stabilité et la prospérité du Liban et appellent à leur retour en Syrie, arguant que le pays est désormais « sûr ». Les camps de réfugiés ont fait l’objet de rafles. Manière de pousser les Syriens à rentrer chez eux… Selon Human Rights Watch, au Liban aussi des formulaires de rapatriement « volontaire » ont été utilisés pour mener des expulsions expéditives.
      Le mensonge d’un pays sûr et stable

      L’idée que la guerre touche à sa fin et que la Syrie est désormais un endroit « sûr » est une petite musique qui monte en puissance à mesure que l’empathie pour les souffrances des Syriens s’amenuise. L’un des principaux promoteurs de ce récit est le régime lui-même. En septembre 2018, le vice-premier ministre Walid Al-Mouallem a déclaré devant l’Assemblée générale des Nations unies que la « guerre contre le terrorisme » était « presque terminée », que la Syrie était « devenue plus sûre et plus stable » et que « les portes étaient ouvertes à tous les réfugiés syriens pour qu’ils rentrent volontairement et en toute sécurité ».

      Le régime utilise la question du retour comme un levier par lequel il espère obtenir des fonds pour la reconstruction du pays. Mais cet argent sera détourné par le régime pour « financer ses atrocités, œuvrer pour son propre intérêt, réprimer ceux qui sont perçus comme des opposants et profiter à ceux qui lui sont fidèles », s’alarme Human Rights Watch. En Europe, des groupes d’extrême droite ont également relayé le récit du retour post-guerre en toute sécurité. Après leurs visites à Damas, des politiciens allemands de l’AfD et des militants de la mouvance identitaire ont appelé au rapatriement des réfugiés syriens.
      Résister aux appels au retour

      Il faut résister à ces appels au retour. D’ores et déjà, des exilés sont contraints de rentrer en raison de la précarité et de l’hostilité qu’ils rencontrent dans les pays d’accueil ; dès leur arrivée en Syrie, certains sont enlevés de force par les services de sécurité. Le Réseau syrien des droits de l’homme (SNHR) rapporte qu’entre début 2014 et août 2019, 1 916 réfugiés, dont 219 enfants, ont été arrêtés à leur retour au pays. Parmi eux, on compte 638 disparus et 15 morts sous la torture.

      Par ailleurs, la guerre fait toujours rage dans certaines parties du pays et même celles qui ne subissent plus de bombardements quotidiens sont loin d’être « sûres et stables ».

      Une autre ONG, la Syrian Association for Citizens Dignity, a examiné la situation dans les zones anciennement tenues par l’opposition, mais repassées sous le contrôle du régime après des bombardements aveugles et une guerre de siège. Des « accords de réconciliation » avaient été conclus dans la plupart des cas sous les auspices de la Russie : les personnes affiliées à l’opposition se voyaient garantir la protection de leurs droits, pendant au moins six mois, y compris contre la persécution, et étaient exemptées d’enrôlement au sein des forces du régime.

      Ces garanties n’ont pas été respectées. De nombreux jeunes ont été incorporés de force dans les milices pro-Bachar et envoyés comme chair à canon sur les lignes de front, où ils ont été amenés à se battre contre d’anciens camarades. Les réfractaires ont été arrêtés, ont disparu ou ont été tués par les services de sécurité. Dans le viseur du régime : les membres de l’opposition armée et politique et leurs familles, les media activists et les travailleurs humanitaires [6].
      S’attaquer aux causes profondes

      Si l’UE considère toujours officiellement que la Syrie reste un pays peu sûr pour le retour des réfugiés, le climat européen se fait de plus en plus délétère pour ces derniers, comme pour les autres migrants. Les pays de l’Union ont mis en place des contrôles frontaliers plus stricts et des systèmes de quotas. Ils ont mis fin à leurs opérations de sauvetage en mer et tendent à criminaliser la solidarité. Les groupes d’extrême droite gagnent en puissance, cherchant à diaboliser les migrants comme une menace existentielle pour les Européens (blancs). Il est vital de continuer à résister à ces phénomènes afin que ceux qui fuient la guerre, la persécution et la pauvreté bénéficient d’un refuge et d’un soutien pour reconstruire leur vie dès leur arrivée en Europe.

      Alors que leur nombre reste relativement faible aujourd’hui, les réfugiés servent déjà de prétexte pour restreindre la liberté d’aller et venir, construire des murs et des frontières impénétrables, accroître les dispositifs sécuritaires de l’État et exploiter des divisions fondées sur la race, la religion ou l’origine nationale. Que se passera-t-il demain lorsque les effets du changement climatique et de l’effondrement écologique provoqueront de vastes mouvements de population à travers le monde ?

      La solidarité doit aussi s’attaquer aux causes profondes. Une pression accrue doit être exercée sur le régime syrien pour qu’il mette fin aux violations systématiques des droits humains, notamment les détentions arbitraires et le bombardement permanent des populations et des infrastructures civiles. Tous ceux qui ont commis des crimes de guerre doivent être mis face à leurs responsabilités. Il faut s’opposer aux appels au rapatriement des réfugiés, à moins qu’ils ne soient vraiment volontaires, sûrs et dignes – et contrôlés par des acteurs indépendants.

      Un moyen concret de solidarité est de soutenir les organisations de la société civile syrienne, qui tentent collectivement de mettre en lumière les souffrances de ceux qui ont été déplacés de force de leurs maisons. C’est l’objectif de la campagne intitulée #HalfofSyria [7], qui documente l’expérience du déplacement et les raisons pour lesquelles les Syriens craignent toujours de rentrer chez eux. Car au bout du compte, l’équation est simple : tant que les gens ne seront pas protégés des massacres dans leur propre pays, ils continueront à chercher la sécurité à l’étranger.

  • Lebanon : Migrant Family Detained. Longtime Residents Facing Deportation, Separation

    Lebanon’s General Security has detained a Sudanese-Sri Lankan family of seven, including four children under age 18, threatening to deport the parents to different countries for lacking residency papers, the Anti-Racism Movement (ARM), Amnesty International, Human Rights Watch, and the Lebanese Center for Human Rights (CLDH) said today. General Security, the agency responsible for the entry and exit of foreigners, should free the family, pending the resolution of the family’s deportation proceedings, and should ensure that the family can remain together. If specific and compelling reasons exist to impose restrictions on the family, then General Security should take measures other than detention. In no case, however, should children be detained for migration-related purposes, as detention can be extremely harmful to them.

    The father of the family is Sudanese, the mother is from Sri Lanka, and their five children were born and have always lived in Lebanon. The family does not have a regular migration status in the country.

    The oldest child, 18, has been detained since February 14, 2019, at the General Security Directorate due to his irregular residency status. On July 3, General Security raided the family’s home in Beirut and detained the father, 57, his wife, 42, and their 5-year-old daughter, Beirut, whom they named due to their ties to the city. On July 4, the authorities also detained their three other sons, aged 11, 13, and 16, who had been left unattended when their parents were taken into custody.

    “Detaining children causes them significant harm and should never be used for migration-related purposes,” said Lama Fakih, acting Middle East director at Human Rights Watch. “General Security should release them and their parents immediately and, if necessary, use less harmful alternatives to ensure that the family appears for proceedings.”

    Amnesty International talked to the mother, currently held in a shelter run by Caritas Lebanon with her two youngest children. The mother said that her husband and three other sons are detained at a General Security facility. ARM, which provides legal and social support to migrant workers, has documented General Security’s practice of sending detained migrant women with young children to the Caritas facility.

    “By detaining these children and threatening to split up their family the Lebanese authorities have displayed a chilling disregard for their rights. Holding children in detention centers subjects them to trauma and can cause considerable harm to their physical and psychological well-being. The protection of children’s rights and the principle of family unity must be the primary consideration for General Security,” said Lynn Maalouf, Amnesty International’s Middle East research director.

    The children have no identity documents from Sudan or Sri Lanka and only possess birth certificates from a local Lebanese official stating that they were born on Lebanese territory.

    The father told ARM that he left Sudan for Lebanon in 1995 to avoid military service there, after both his brothers were killed in the civil war. He said he was deported back to Sudan in 1998 and arrested, but was released after his father paid a bribe, and returned to Lebanon in 1999.

    The mother, a Sri Lankan former domestic worker, told Amnesty International that she fled an abusive Lebanese employer almost 20 years ago, thus losing her regular migration status in Lebanon. She said that her employer beat her, confiscated her passport, and did not pay her wages for a year. Human Rights Watch, Amnesty International, and ARM routinely document credible reports of abuses against migrant domestic workers, including non-payment of wages, forced confinement, and verbal and physical abuse.

    The mother said that she fears retaliation by family members for converting to Islam and marrying a Muslim. There have been violent riots against Muslims in Kandy, Sri Lanka, her home town.

    Both parents previously tried to register their refugee claims with the United Nations Refugee Agency (UNHCR), but their claims were not granted.

    The father told ARM in July that General Security officials said the entire family would be deported and pressured him to sign a departure form indicating that he agreed to be returned to Sudan. The mother told ARM in August that General Security officials informed her that she would be deported to Sri Lanka, and that her children would be deported with her husband to Sudan.

    Children should never be detained, alone or with their families, for immigration purposes. UNHCR has found that even short-term detention with their families has a “profound and negative impact” on children, and concluded that “children should not be detained for immigration related purposes, irrespective of their legal/migratory status or that of their parents.”

    Because of “the harm inherent in any deprivation of liberty and the negative impact that immigration detention can have on children’s physical and mental health and on their development,” the UN committee that interprets the Convention on the Rights of the Child, which Lebanon ratified in 1991, has called for any deprivation of liberty based on a child’s migration status to be “prohibited by law and its abolishment ensured in policy and practice.”

    Following the principle of family unity, authorities should not separate children from their parents unless separation is clearly in the best interests of each child. If restrictions to the liberty or freedom of movement of the parents are considered necessary in immigration cases, alternatives to detention for the entire family should be provided to respect children’s rights not to be detained while also not being separated from their parents, the UN special rapporteurs on torture and on migrants’ rights have stated.

    To comply with its international human rights obligations, General Security should free the family, unless specific and compelling reasons make restrictions to the liberty of the parents necessary. In that case, alternatives to detention should be found for this family, the organizations said. Less harmful alternatives could include requirements to report to the authorities while their case is being considered. Crucially, in line with the principles of family unity and respect for the child’s best interests, the family should not be separated by being deported to different countries.

    “Deportation may mean the permanent separation of this family, with no hope of reunification,” said Farah Salka, director of ARM. “General Security should release the family and ensure that they are not split apart by being deported to opposite ends of the world.”

  • For Syrians in #Istanbul, fears rise as deportations begin

    Turkey is deporting Syrians from Istanbul to Syria, including to the volatile northwest province of #Idlib, according to people who have been the target of a campaign launched last week against migrants who lack residency papers.

    The crackdown comes at a time of rising rhetoric and political pressure on the country’s 3.6 million registered Syrian refugees to return home. Estimates place hundreds of thousands of unregistered Syrians in Turkey, many living in urban areas such as Istanbul.

    Refugee rights advocates say deportations to Syria violate customary international law, which prohibits forcing people to return to a country where they are still likely to face persecution or risk to their lives.

    Arrests reportedly began as early as 13 July, with police officers conducting spot-checks in public spaces, factories, and metro stations around Istanbul and raiding apartments by 16 July. As word spread quickly in Istanbul’s Syrian community, many people shut themselves up at home rather than risk being caught outside.

    It is not clear how many people have been deported so far, with reported numbers ranging from hundreds to a thousand.

    “Deportation of Syrians to their country, which is still in the midst of armed conflict, is a clear violation of both Turkish and international law.”

    Turkey’s Ministry of Interior has said the arrests are aimed at people living without legal status in the country’s most populous city. Istanbul authorities said in a Monday statement that only “irregular migrants entering our country illegally [will be] arrested and deported.” It added that Syrians registered outside Istanbul would be obliged to return to the provinces where they were first issued residency.

    Mayser Hadid, a Syrian lawyer who runs a law practice catering to Syrians in Istanbul, said that the “deportation of Syrians to their country, which is still in the midst of armed conflict, is a clear violation of both Turkish and international law,” including the “return of Syrians without temporary protection cards.”

    Istanbul authorities maintain that the recent detentions and deportations are within the law.

    Starting in 2014, Syrian refugees in Turkey have been registered under “temporary protection” status, which grants the equivalency of legal residency and lets holders apply for a work permit. Those with temporary protection need special permission to work or travel outside of the area where they first applied for protection.

    But last year, several cities across the country – including Istanbul – stopped registering newly-arrived Syrians.

    In the Monday statement, Istanbul authorities said that Syrians registered outside of the city must return to their original city of registration by 20 August. They did not specify the penalty for those who do not.

    Barely 24 hours after the beginning of raids last week, Muhammad, a 21-year-old from Eastern Ghouta in Syria, was arrested at home along with his Syrian flatmates in the Istanbul suburb of Esenler.

    Muhammad, who spoke by phone on the condition of anonymity for security reasons – as did all Syrian deportees and their relatives interviewed for this article – said that Turkish police officers had forced their way into the building. “They beat me,” he said. “I wasn’t even allowed to take anything with me.”

    Muhammad said that as a relatively recent arrival, he couldn’t register for temporary protection and had opted to live and work in Istanbul without papers.

    After his arrest, Muhammad said, he was handcuffed and bundled into a police van, and transferred to a detention facility on the eastern outskirts of the city.

    There, he said, he was forced to sign a document written in Turkish that he couldn’t understand and on Friday was deported to Syria’s Idlib province, via the Bab al-Hawa border crossing.
    Deportation to Idlib

    Government supporters say that Syrians have been deported only to the rebel-held areas of northern Aleppo, where the Turkish army maintains a presence alongside groups that it backs.

    A representative from Istanbul’s provincial government office did not respond to a request for comment, but Youssef Kataboglu, a pro-government commentator who is regarded as close to the government, said that “Turkey only deports Syrians to safe areas according to the law.”

    He denied that Syrians had been returned to Idlib, where a Syrian government offensive that began in late April kicked off an upsurge in fighting, killing more than 400 civilians and forcing more than 330,000 people to flee their homes. The UN said on Monday alone, 59 civilians were killed, including 39 when a market was hit by airstrikes.

    Kataboglu said that deportation to Idlib would “be impossible.”

    Mazen Alloush, a representative of the border authorities on the Syrian side of the Bab al-Hawa crossing that links Turkey with Idlib, said that more than 3,800 Syrians had entered the country via Bab al-Hawa in the past fortnight, a number he said was not a significant change from how many people usually cross the border each month.

    The crossing is controlled by rebel authorities affiliated to Tahrir a-Sham, the hardline Islamist faction that controls most of Idlib.

    “A large number of them were Syrians trying to enter Turkish territory illegally,” who were caught and forced back across, Alloush said, but also “those who committed offences in Turkey or requested to return voluntarily.”

    “We later found out that he’d been deported to Idlib.”

    He added that “if the Turkish authorities are deporting [Syrians] through informal crossings or crossings other than Bab al-Hawa, I don’t have information about it.”

    Other Syrians caught up in the crackdown, including those who did have the proper papers to live and work in Istanbul, confirmed that they had been sent to Idlib or elsewhere.

    On July 19, Umm Khaled’s son left the family’s home without taking the documents that confirm his temporary protection status, she said. He was stopped in the street by police officers.

    “They [the police] took him,” Umm Khaled, a refugee in her 50s originally from the southern Damascus suburbs, said by phone. “We later found out that he’d been deported to Idlib.”

    Rami, a 23-year-old originally from eastern Syria’s Deir Ezzor province, said he was deported from Istanbul last week. He was carrying his temporary protection status card at the time of his arrest, he added.

    "I was in the street in Esenler when the police stopped me and asked for my identity card,” he recalled in a phone conversation from inside Syria. “They checked it, and then asked me to get on a bus.”

    Several young Syrian men already on board the bus were also carrying protection documents with them, Rami said.

    “The police tied our hands together with plastic cords,” he added, describing how the men were then driven to a nearby police station and forced to give fingerprints and sign return documents.

    Rami said he was later sent to northern Aleppo province.
    Rising anti-Syrian sentiment

    The country has deported Syrians before, and Human Rights Watch and other organisations have reported that Turkish security forces regularly intercept and return Syrian refugees attempting to enter the country. As conflict rages in and around Idlib, an increasing number of people are still trying to get into Turkey.

    Turkey said late last year that more than 300,000 Syrians have returned to their home country voluntarily.

    A failed coup attempt against President Recep Tayyip Erdoğan in July 2016 led to an emergency decree that human rights groups say was used to arrest individuals whom the government perceived as opponents. Parts of that decree were later passed into law, making it easier for authorities to deport foreigners on the grounds that they are either linked to terrorist groups or pose a threat to public order.

    The newest wave of deportations after months of growing anti-Syrian sentiment in political debate and on the streets has raised more questions about how this law might be used, as well as the future of Syrian refugees in Turkey.

    In two rounds of mayoral elections that ended last month with a defeat for Erdoğan’s ruling Justice and Development Party (AKP), the winning candidate, Ekrem İmamoğlu of the Republican People’s Party (CHP), repeatedly used anti-Syrian rhetoric in his campaign, capitalising on discontent towards the faltering economy and the increasingly contentious presence of millions of Syrian refugees.

    Shortly after the elections, several incidents of mob violence against Syrian-owned businesses took place. Widespread anti-Syrian sentiment has also been evident across social media; after the mayoral election trending hashtags on Twitter reportedly included “Syrians get out”.

    As the deportations continue, the families of those sent back are wondering what they can do.

    “By God, what did he do [wrong]?” asked Umm Khaled, speaking of her son, now in war-torn Idlib.

    “His mother, father, and all his sisters are living here legally in Turkey,” she said. “What are we supposed to do now?”

      Mardi, le ministre de l’intérieur a indiqué que l’objectif de son gouvernement était d’expulser 80 000 migrants en situation irrégulière en Turquie, contre 56 000 l’an dernier.

      C’est un vaste #coup_de_filet mené sur fond de fort sentiment antimigrants. Les autorités turques ont annoncé, mercredi 24 juillet, avoir arrêté plus de 6 000 migrants en deux semaines, dont des Syriens, vivant de manière « irrégulière » à Istanbul.

      « Nous menons une opération depuis le 12 juillet (…). Nous avons attrapé 6 122 personnes à Istanbul, dont 2 600 Afghans. Une partie de ces personnes sont des Syriens », a déclaré le ministre de l’intérieur, Suleyman Soylu, dans une interview donnée à la chaîne turque NTV. Mardi, ce dernier a indiqué que l’objectif de son gouvernement était d’expulser 80 000 migrants en situation irrégulière en Turquie, contre 56 000 l’an dernier.

      M. Soylu a démenti que des Syriens étaient expulsés vers leur pays, déchiré par une guerre civile meurtrière depuis 2011, après que des ONG ont affirmé avoir recensé des cas de personnes renvoyées en Syrie. « Ces personnes, nous ne pouvons pas les expulser. (…) Lorsque nous attrapons des Syriens qui ne sont pas enregistrés, nous les envoyons dans des camps de réfugiés », a-t-il affirmé, mentionnant un camp dans la province turque de Hatay, frontalière de la Syrie. Il a toutefois assuré que certains Syriens choisissaient de rentrer de leur propre gré en Syrie.

      La Turquie accueille sur son sol plus de 3,5 millions de Syriens ayant fui la guerre, dont 547 000 sont enregistrés à Istanbul. Les autorités affirment n’avoir aucun problème avec les personnes dûment enregistrées auprès des autorités à Istanbul, mais disent lutter contre les migrants vivant dans cette ville alors qu’ils sont enregistrés dans d’autres provinces, voire dans aucune province.

      Le gouvernorat d’Istanbul a lancé lundi un ultimatum, qui expire le 20 août, enjoignant les Syriens y vivant illégalement à quitter la ville. Un groupement d’ONG syriennes a toutefois indiqué, lundi, que « plus de 600 Syriens », pour la plupart titulaires de « cartes de protection temporaires » délivrées par d’autres provinces turques, avaient été arrêtés la semaine dernière à Istanbul et renvoyés en Syrie.

      La Coalition nationale de l’opposition syrienne, basée à Istanbul, a déclaré mardi qu’elle était entrée en contact avec les autorités turques pour discuter des dernières mesures prises contre les Syriens, appelant à stopper les « expulsions ». Son président, Anas al-Abda, a appelé le gouvernement turc à accorder un délai de trois mois aux Syriens concernés pour régulariser leur situation auprès des autorités.

      Ce tour de vis contre les migrants survient après la défaite du parti du président Recep Tayyip Erdogan lors des élections municipales à Istanbul, en juin, lors desquelles l’accueil des Syriens s’était imposé comme un sujet majeur de préoccupation les électeurs.

      Pendant la campagne, le discours hostile aux Syriens s’était déchaîné sur les réseaux sociaux, avec le mot-dièse #LesSyriensDehors. D’après une étude publiée début juillet par l’université Kadir Has, située à Istanbul, la part des Turcs mécontents de la présence des Syriens est passée de 54,5 % en 2017 à 67,7 % en 2019.

    • Turkey Forcibly Returning Syrians to Danger. Authorities Detain, Coerce Syrians to Sign “Voluntary Return” Forms

      Turkish authorities are detaining and coercing Syrians into signing forms saying they want to return to Syria and then forcibly returning them there, Human Rights Watch said today. On July 24, 2019, Interior Minister Süleyman Soylu denied that Turkey had “deported” Syrians but said that Syrians “who voluntarily want to go back to Syria” can benefit from procedures allowing them to return to “safe areas.”

      Almost 10 days after the first reports of increased police spot-checks of Syrians’ registration documents in Istanbul and forced returns of Syrians from the city, the office of the provincial governor released a July 22 statement saying that Syrians registered in one of the country’s other provinces must return there by August 20, and that the Interior Ministry would send unregistered Syrians to provinces other than Istanbul for registration. The statement comes amid rising xenophobic sentiment across the political spectrum against Syrian and other refugees in Turkey.

      “Turkey claims it helps Syrians voluntarily return to their country, but threatening to lock them up until they agree to return, forcing them to sign forms, and dumping them in a war zone is neither voluntary nor legal,” said Gerry Simpson, associate Emergencies director. “Turkey should be commended for hosting record numbers of Syrian refugees, but unlawful deportations are not the way forward.”

      Turkey shelters a little over 3.6 million Syrian Refugees countrywide who have been given temporary protection, half a million of them in Istanbul. This is more refugees than any other country in the world and almost four times as many as the whole European Union (EU).

      The United Nations High Commissioner for Refugees (UNHCR) says that “the vast majority of Syrian asylum-seekers continue to … need international refugee protection” and that it “calls on states not to forcibly return Syrian nationals and former habitual residents of Syria.”

      Human Rights Watch spoke by phone with four Syrians who are in Syria after being detained and forcibly returned there.

      One of the men, who was from Ghouta, in the Damascus countryside, was detained on July 17 in Istanbul, where he had been living unregistered for over three years. He said police coerced him and other Syrian detainees into signing a form, transferred them to another detention center, and then put them on one of about 20 buses headed to Syria. They are now in northern Syria.

      Another man, from Aleppo, who had been living in Gaziantep in southeast Turkey since 2013, said he was detained there after he and his brother went to the police to complain about an attack on a shop that they ran in the city. He said the police transferred them from the Gaziantep Karşıyaka police station to the foreigners’ deportation center at Oğuzeli, holding them there for six days and forcing them to sign a deportation form without telling them what it was. On July 9, the authorities forcibly returned the men to Azaz in Syria via the Öncüpınar/Bab al Salama border gate near the Turkish town of Kilis, Human Rights Watch also spoke by phone with two men who said the Turkish coast guard and police intercepted them at checkpoints near the coast as they tried to reach Greece, detained them, and coerced them into signing and fingerprinting voluntary repatriation forms. The authorities then deported them to Idlib and northern Aleppo governorate.

      One of the men, a Syrian from Atmeh in Idlib governorate who registered in the Turkish city of Gaziantep in 2017, said the Turkish coast guard intercepted him on July 9. He said [“Guvenlik”] “security” held him with other Syrians for six days in a detention facility in the town of Aydın, in western Turkey. He said the guards verbally abused him and other detainees, punched him in the chest, and coerced him into signing voluntary repatriation papers. Verbally abusive members of Turkey’s rural gendarmerie police forces [jandarma] deported him on July 15 to Syria with about 35 other Syrians through the Öncüpınar/Bab al-Salameh border crossing.

      He said that there were others in the Aydin detention center who had been there for up to four months because they had refused to sign these forms.

      The second man said he fled Maarat al-Numan in 2014 and registered in the Turkish city of Iskenderun. On July 4, police stopped him at a checkpoint as he tried to reach the coast to take a boat to Greece and took him to the Aydin detention facility, where he said the guards beat some of the other detainees and shouted and cursed at them.

      He said the detention authorities confiscated his belongings, including his Turkish registration card, and told him to sign forms. When he refused, the official said they were not deportation forms but just “routine procedure.” When he refused again, he was told he would be detained indefinitely until he agreed to sign and provided his fingerprints. He said that the guards beat another man who had also refused, so he felt he had no choice but to sign. He was then put on a bus for 27 hours with dozens of other Syrians and deported through the Öncüpınar/Bab al-Salameh border crossing.

      In addition, journalists have spoken with a number of registered and unregistered Syrians who told them by phone from Syria that Turkish authorities detained them in the third week of July, coerced them into signing and providing a fingerprint on return documents. The authorities then deported them with dozens, and in some cases as many as 100, other Syrians to Idlib and northern Aleppo governorate through the Cilvegözü/Bab al-Hawa border crossing.

      More than 400,000 people have died because of the Syrian conflict since 2011, according to the World Bank. While the nature of the fighting in Syria has changed, with the Syrian government retaking areas previously held by anti-government groups and the battle against the Islamic State (ISIS) winding down, profound civilian suffering and loss of life persists.

      In Idlib governorate, the Syrian-Russian military alliance continues to indiscriminately bomb civilians and to use prohibited weapons, resulting in the death of at least 400 people since April, including 90 children, according to Save the Children. In other areas under the control of the Syrian government and anti-government groups, arbitrary arrests, mistreatment, and harassment are still the status quo.

      The forcible returns from Turkey indicate that the government is ready to double down on other policies that deny many Syrian asylum seekers protection. Over the past four years, Turkey has sealed off its border with Syria, while Turkish border guards have carried out mass summary pushbacks and killed and injured Syrians as they try to cross. In late 2017 and early 2018, Istanbul and nine provinces on the border with Syria suspended registration of newly arriving asylum seekers. Turkey’s travel permit system for registered Syrians prohibits unregistered Syrians from traveling from border provinces they enter to register elsewhere in the country.

      Turkey is bound by the international customary law of nonrefoulement, which prohibits the return of anyone to a place where they would face a real risk of persecution, torture or other ill-treatment, or a threat to life. This includes asylum seekers, who are entitled to have their claims fairly adjudicated and not be summarily returned to places where they fear harm. Turkey may not coerce people into returning to places where they face harm by threatening to detain them.

      Turkey should protect the basic rights of all Syrians, regardless of registration status, and register those denied registration since late 2017, in line with the Istanbul governor’s July 22 statement.

      On July 19, the European Commission announced the adoption of 1.41 billion euros in additional assistance to support refugees and local communities in Turkey, including for their protection. The European Commission, EU member states with embassies in Turkey, and the UNHCR should support Turkey in any way needed to register and protect Syrians, and should publicly call on Turkey to end its mass deportations of Syrians at the border and from cities further inland.

      “As Turkey continues to shelter more than half of registered Syrian refugees globally, the EU should be resettling Syrians from Turkey to the EU but also ensuring that its financial support protects all Syrians seeking refuge in Turkey,” Simpson said.

    • Turquie : à Istanbul, les réfugiés vivent dans la peur du racisme et de la police

      Depuis quelques semaines, le hashtag #StopDeportationsToSyria (#SuriyeyeSınırdışınaSon) circule sur les réseaux sociaux. Il s’accompagne de témoignages de Syriens qui racontent s’être fait arrêter par la police turque à Istanbul et renvoyer en Syrie. Les autorités turques ont décidé de faire la chasse aux réfugiés alors que les agressions se multiplient.

      Le 21 juillet, alors qu’il fait ses courses, le jeune Amjad Tablieh se fait arrêter par la police turque à Istanbul. Il n’a pas sa carte de protection temporaire – kimlik – sur lui et la police turque refuse d’attendre que sa famille la lui apporte : « J’ai été mis dans un bus avec d’autres syriens. On nous a emmenés au poste de police de Tuzla et les policiers on dit que nous serions envoyés à Hatay [province turque à la frontière syrienne] ». La destination finale sera finalement la Syrie.

      Étudiant et disposant d’un kimlik à Istanbul, Amjad ajoute que comme les autres syriens arrêtés ce jour-là, il a été obligé de signer un document reconnaissant qu’il rentrait volontairement en Syrie. Il tient à ajouter qu’il a « vu des personnes se faire frapper pour avoir refusé de signer ce document ». Étudiant en architecture, Hama est arrivé à Istanbul il y a quatre mois pour s’inscrire à l’université. Il a été arrêté et déporté car son kimlik a été délivré à Gaziantep, près de la frontière avec la Syrie. Amr Dabool, également enregistré dans la ville de Gaziantep, a quant à lui été expulsé en Syrie alors qu’il tentait de se rendre en Grèce.
      Pas de statut de réfugié pour les Syriens en Turquie

      Alors que des récits similaires se multiplient sur les réseaux sociaux, le 22 juillet, les autorités d’Istanbul ont annoncé que les Syriens disposant de la protection temporaire mais n’étant pas enregistrés à Istanbul avaient jusqu’au 20 août pour retourner dans les provinces où ils sont enregistrés, faute de quoi ils seront renvoyés de force dans des villes choisies par le ministère de l’Intérieur. Invité quelques jours plus tard à la télévision turque, le ministre de l’intérieur Süleyman Soylu a nié toute expulsion, précisant que certains Syriens choisissaient « de rentrer de leur propre gré en Syrie ».

      Sur les 3,5 millions de Syriens réfugiés en Turquie, ils sont plus de 500 000 à vivre à Istanbul. La grande majorité d’entre eux ont été enregistrés dans les provinces limitrophes avec la Syrie (Gaziantep ou Urfa) où ils sont d’abord passés avant d’arriver à Istanbul pour travailler, étudier ou rejoindre leur famille. Depuis quelques jours, les contrôles se renforcent pour les renvoyer là où ils sont enregistrés.

      Pour Diane al Mehdi, anthropologue et membre du Syrian Refugees Protection Network, ces refoulements existent depuis longtemps, mais ils sont aujourd’hui plus massifs. Le 24 juillet, le ministre de l’intérieur a ainsi affirmé qu’une opération visant les réfugiés et des migrants non enregistrés à Istanbul avait menée à l’arrestation, depuis le 12 juillet, de 1000 Syriens. Chaque jour, environ 200 personnes ont été expulsées vers le nord de la Syrie via le poste frontière de Bab al-Hawa, précise la chercheuse. « Ces chiffres concernent principalement des Syriens vivant à Istanbul », explique-t-elle.

      Le statut d’« invité » dont disposent les Syriens en Turquie est peu clair et extrêmement précarisant, poursuit Diane al Mehdi. « Il n’y a pas d’antécédents légaux pour un tel statut, cela participe à ce flou et permet au gouvernement de faire un peu ce qu’il veut. » Créé en 2013, ce statut s’inscrivait à l’époque dans une logique de faveur et de charité envers les Syriens, le gouvernement ne pensant alors pas que la guerre en Syrie durerait. « À l’époque, les frontières étaient complètement ouvertes, les Syriens avaient le droit d’être enregistrés en Turquie et surtout ce statut comprenait le principe de non-refoulement. Ces trois principes ont depuis longtemps été bafouées par le gouvernement turc. »

      Aujourd’hui, les 3,5 millions de Syriens réfugiés en Turquie ne disposent pas du statut de réfugié en tant que tel. Bien que signataire de la Convention de Genève, Ankara n’octroie le statut de réfugié qu’aux ressortissants des 47 pays membres du Conseil de l’Europe. La Syrie n’en faisant pas partie, les Syriens ont en Turquie un statut moins protecteur encore que la protection subsidiaire : il est temporaire et révocable.

      Si le Président Erdoğan a longtemps prôné une politique d’accueil des Syriens, le vent semble aujourd’hui avoir tourné. En février 2018, il déclarait déjà : « Nous ne sommes pas en mesure de continuer d’accueillir 3,5 millions de réfugiés pour toujours ». Et alors qu’à Istanbul la possibilité d’obtenir le kimlik a toujours été compliquée, depuis le 6 juillet 2019, Istanbul n’en délivre officiellement plus aucun selon Diane al Mehdi.

      Même si le kimlik n’offre pas aux Syriens la possibilité de travailler, depuis quelques années, les commerces aux devantures en arabe sont de plus en plus nombreux dans rues d’Istanbul et beaucoup de Syriens ont trouvé du travail dans l’économie informelle, fournissant une main-d’œuvre bon marché. Or, dans un contexte économique difficile, avec une inflation et un chômage en hausse, les travailleurs syriens entrent en concurrence avec les ressortissants turcs et cela accroît les tensions sociales.

      Au printemps dernier, alors que la campagne pour les élections municipales battait son plein, des propos hostiles accompagnés des hashtags #SuriyelilerDefoluyor (« Les Syriens dehors ») ou #UlkemdeSuriyeliIstemiyorum (« Je ne veux pas de Syriens dans mon pays ») se sont multipliés sur les réseaux sociaux. Le candidat d’opposition et aujourd’hui maire d’Istanbul Ekrem Imamoglu, étonné du nombre d’enseignes en arabe dans certains quartiers, avait lancé : « Ici, c’est la Turquie, c’est Istanbul ».

      Après la banalisation des propos anti-syriens, ce sont les actes de violence qui se sont multipliés dans les rues d’Istanbul. Fin juin, dans le quartier de Küçükçekmece, une foule d’hommes a attaqué des magasins tenus par des Syriens. Quelques jours plus tard, les autorités d’Istanbul sommaient plus de 700 commerçants syriens de turciser leurs enseignes en arabe. Publié dans la foulée, un sondage de l’université Kadir Has à Istanbul a confirmé que la part des Turcs mécontents de la présence des Syriens est passée de 54,5 % en 2017 à 67,7 % en 2019.
      Climat de peur

      Même s’ils ont un kimlik, ceux qui ne disposent pas d’un permis de travail - difficile à obtenir - risquent une amende d’environs 550 euros et leur expulsion vers la Syrie s’ils sont pris en flagrant délit. Or, la police a renforcé les contrôles d’identités dans les stations de métro, les gares routières, les quartiers à forte concentration de Syriens mais aussi sur les lieux de travail. Cette nouvelle vague d’arrestations et d’expulsions suscite un climat de peur permanente chez les Syriens d’Istanbul. Aucune des personne contactée n’a souhaité témoigner, même sous couvert d’anonymat.

      « Pas protégés par les lois internationales, les Syriens titulaires du kimlik deviennent otages de la politique turque », dénonce Syrian Refugees Protection Network. Et l’[accord signé entre l’Union européenne et Ankara au printemps 2016 pour fermer la route des Balkans n’a fait que détériorer leur situation en Turquie. Pour Diane al-Mehdi, il aurait fallu accorder un statut qui permette aux Syriens d’avoir un avenir. « Tant qu’ils n’auront pas un statut fixe qui leur permettra de travailler, d’aller à l’école, à l’université, ils partiront en Europe. » Selon elle, donner de l’argent - dont on ne sait pas clairement comment il bénéficie aux Syriens - à la Turquie pour que le pays garde les Syriens n’était pas la solution. « Évidemment, l’Europe aurait aussi dû accepter d’accueillir plus de Syriens. »

    • En Turquie, les réfugiés syriens sont devenus #indésirables

      Après avoir accueilli les réfugiés syriens à bras ouverts, la Turquie change de ton. Une façon pour le gouvernement Erdogan de réagir aux crispations qu’engendrent leur présence dans un contexte économique morose.

      Les autorités avaient donné jusqu’à mardi soir aux migrants sans statut légal pour régulariser leur situation, sous peine d’être expulsés. Mais selon plusieurs ONG, ces expulsions ont déjà commencé et plus d’un millier de réfugiés ont déjà été arrêtés. Quelque 600 personnes auraient même déjà été reconduites en Syrie.

      « Les policiers font des descentes dans les quartiers, dans les commerces, dans les maisons. Ils font des contrôles d’identité dans les transports en commun et quand ils attrapent des Syriens, ils les emmènent au bureau de l’immigration puis les expulsent », décrit Eyup Ozer, membre du collectif « We want to live together initiative ».

      Le gouvernement turc dément pour sa part ces renvois forcés. Mais cette vague d’arrestations intervient dans un climat hostile envers les 3,6 millions de réfugiés syriens installés en Turquie.

      Solidarité islamique

      Bien accueillis au début de la guerre, au nom de la solidarité islamique défendue par le président turc Recep Tayyip Erdogan dans l’idée de combattre Bachar al-Assad, ces réfugiés syriens sont aujourd’hui devenus un enjeu politique.

      Retenus à leur arrivée dans des camps, parfois dans des conditions difficiles, nombre d’entre eux ont quitté leur point de chute pour tenter leur chance dans le reste du pays et en particulier dans les villes. A Istanbul, le poumon économique de la Turquie, la présence de ces nouveaux-venus est bien visible. La plupart ont ouvert des commerces et des restaurants, et leurs devantures, en arabe, agacent, voire suscitent des jalousies.

      « L’économie turque va mal, c’est pour cette raison qu’on ressent davantage les effets de la crise syrienne », explique Lami Bertan Tokuzlu, professeur de droit à l’Université Bilgi d’Istanbul. « Les Turcs n’approuvent plus les dépenses du gouvernement en faveur des Syriens », relève ce spécialiste des migrations.
      Ressentiment croissant

      Après l’euphorie économique des années 2010, la Turquie est confrontée depuis plus d’un an à la dévaluation de sa monnaie et à un taux de chômage en hausse, à 10,9% en 2018.

      Dans ce contexte peu favorable et alors que les inégalités se creusent, la contestation s’est cristallisée autour de la question des migrants. Celle-ci expliquerait, selon certains experts, la déroute du candidat de Recep Tayyip Erdogan à la mairie d’Istanbul.

      Conscient de ce ressentiment dans la population et des conséquences potentielles pour sa popularité, le président a commencé à adapter son discours dès 2018. L’ultimatum lancé à ceux qui ont quitté une province turque où ils étaient enregistrés pour s’installer à Istanbul illustre une tension croissante.

    • Europe’s Complicity in Turkey’s Syrian-Refugee Crackdown

      Ankara is moving against Syrians in the country—and the European Union bears responsibility.

      Under the cover of night, Turkish police officers pushed Ahmed onto a large bus parked in central Istanbul. In the darkness, the Syrian man from Damascus could discern dozens of other handcuffed refugees being crammed into the vehicle. Many of them would not see the Turkish city again.

      Ahmed, who asked that his last name not be used to protect his safety, was arrested after police discovered that he was registered with the authorities not in Istanbul, but in a different district. Turkish law obliges Syrian refugees with a temporary protection status to remain in their locale of initial registration or obtain separate permission to travel, and the officers reassured him he would simply be transferred back to the right district.

      Instead, as dawn broke, the bus arrived at a detention facility in the Istanbul suburb of Pendik, where Ahmed said he was jostled into a crowded cell with 10 others and no beds, and received only one meal a day, which was always rotten. “The guards told us we Syrians are just as rotten inside,” he told me. “They kept shouting that Turkey will no longer accept us, and that we will all go back to Syria.”

      Ahmed would spend more than six weeks in the hidden world of Turkey’s so-called removal centers. His account, as well as those of more than half a dozen other Syrians I spoke to, point to the systemic abuse, the forced deportations, and, in some cases, the death of refugees caught in a recent crackdown here.

      Yet Turkey is not the only actor implicated. In a deeper sense, the backlash also exposes the long-term consequences of the European Union’s outsourcing of its refugee problem. In March 2016, the EU entered into a controversial deal with Turkey that halted much of the refugee influx to Europe in return for an aid package worth €6 billion ($6.7 billion) and various political sweeteners for Ankara. Preoccupied with its own border security, EU decision makers at the time were quick to reassure their critics that Turkey constituted a “safe third country” that respected refugee rights and was committed to the principle of non-refoulement.

      As Europe closed its doors, Turkey was left with a staggering 3.6 million registered Syrian refugees—the largest number hosted by any country in the world and nearly four times as many as all EU-member states combined. While Turkish society initially responded with impressive resilience, its long-lauded hospitality is rapidly wearing thin, prompting President Recep Tayyip Erdoğan’s government to take measures that violate the very premise of the EU-Turkey deal.

      Last month, Turkish police launched operations targeting undocumented migrants and refugees in Istanbul. Syrian refugees holding temporary protection status registered in other Turkish districts now have until October 30 to leave Istanbul, whereas those without any papers are to be transferred to temporary refugee camps in order to be registered.

      Both international and Turkish advocates of refugee rights say, however, that the operation sparked a wave of random arrests and even forced deportations. The Istanbul Bar Association, too, reported its Legal Aid Bureau dealt with 3.5 times as many deportation cases as in June, just before the operation was launched. UNHCR, the UN’s refugee agency, and the European Commission have not said whether they believe Turkey is deporting Syrians. But one senior EU official, who asked for anonymity to discuss the issue, estimated that about 2,200 people were sent to the Syrian province of Idlib, though he said it was unclear whether they were forcibly deported or chose to return. The official added that, were Turkey forcibly deporting Syrians, this would be in explicit violation of the principle of non-refoulement, on which the EU-Turkey deal is conditioned.

      The Turkish interior ministry’s migration department did not respond to questions about the allegations. In a recent interview on Turkish television, Interior Minister Süleyman Soylu said that “it is not possible for us to deport any unregistered Syrian” and insisted that returns to Syria were entirely voluntary.

      Ahmed and several other Syrian refugees I spoke to, however, experienced firsthand what voluntary can look like in practice.

      After being transferred from the facility in Pendik to a removal center in Binkılıç, northwest of Istanbul, Ahmed said he was pressured into signing a set of forms upon arrival. The female official in charge refused to explain the papers’ contents, he said. As Ahmed was about to sign and fingerprint the last document, he noticed she was deliberately using her fingers to cover the Arabic translation of the words voluntary return. When he retracted his finger, she called in the guards, who took Ahmed to a nearby bathroom with another Syrian who had refused to sign. There, he said, the two were intimidated for several hours, and he was shown images of a man who had been badly beaten and tied to a chair with plastic tape. According to Ahmed, an official told him, “If you don’t sign, you’ll end up like that.”

      The other Syrian present at the time, Hussein, offered a similar account. In a phone interview from Dubai, where he escaped to after negotiating deportation to Malaysia instead of Syria, Hussein, who asked to be identified by only his first name to protect relatives still in Turkey, detailed the abuse in the same terms as Ahmed, and added that he was personally beaten by one of the guards. When the ordeal was over, both men said, the other Syrians who had arrived with them were being taken to a bus, apparently to be deported.

      Ahmed was detained in Binkılıç for a month before being taken to another removal center in nearby Kırklareli, where he said he was made to sleep outside in a courtyard together with more than 100 other detainees. The guards kept the toilets locked throughout the day, he said, so inmates had to either wait for a single 30-minute toilet break at night or relieve themselves where they were sleeping. When Ahmed fell seriously ill, he told me, he was repeatedly denied access to a doctor.

      After nine days in Kırklareli, the nightmare suddenly ended. Ahmed was called in by the facility’s management, asked who he was, and released when it became clear he did in fact hold temporary protection status, albeit for a district other than Istanbul. The Atlantic has seen a photo of Ahmed’s identity card, as well as his release note from the removal center.

      The EU has funded many of the removal centers in which refugees like Ahmed are held. As stated in budgets from 2010 and 2015, the EU financed at least 12 such facilities as part of its pre-accession funding to Turkey. And according to a 2016 report by an EU parliamentary delegation, the removal center in Kırklareli in which Ahmed was held received 85 percent of its funding from the EU. The Binkılıç facility, where Syrians were forced to sign return papers, also received furniture and other equipment funded by Britain and, according to Ahmed, featured signs displaying the EU and Turkish flags.

      It is hard to determine the extent to which the $6.7 billion allocated to Ankara under the 2016 EU-Turkey deal has funded similar projects. While the bulk of it went to education, health care, and direct cash support for refugees, a 2018 annual report also refers to funding for “a removal center for 750 people”—language conspicuously replaced with the more neutral “facility for 750 people” in this year’s report.

      According to Kati Piri, the European Parliament’s former Turkey rapporteur, even lawmakers like her struggle to scrutinize the precise implementation of EU-brokered deals on migration, which include agreements not just with Turkey, but also with Libya, Niger, and Sudan.

      “In this way, the EU becomes co-responsible for human-rights violations,” Piri said in a telephone interview. “Violations against refugees may have decreased on European soil, but that’s because we outsourced them. It’s a sign of Europe’s moral deficit, which deprives us from our credibility in holding Turkey to account.” According to the original agreement, the EU pledged to resettle 72,000 Syrian refugees from Turkey. Three years later, it has taken in less than a third of that number.

      Many within Turkish society feel their country has simply done enough. With an economy only recently out of recession and many Turks struggling to make a living, hostility toward Syrians is on the rise. A recent poll found that those who expressed unhappiness with Syrian refugees rose to 67.7 percent this year, from 54.5 percent in 2017.

      Just as in Europe, opposition parties in Turkey are now cashing in on anti-refugee sentiment. In municipal elections this year, politicians belonging to the secularist CHP ran an explicitly anti-Syrian campaign, and have cut municipal aid for refugees or even banned Syrians’ access to beaches since being elected. In Istanbul, on the very evening the CHP candidate Ekrem İmamoğlu was elected mayor, a jubilantly racist hashtag began trending on Twitter: “Syrians are fucking off” (#SuriyelilerDefoluyor).

      In a statement to The Atlantic, a Turkish foreign-ministry spokesperson said, “Turkey has done its part” when it came to the deal with the EU. “The funds received amount to a fraction of what has been spent by Turkey,” the text noted, adding that Ankara expects “more robust support from the EU” both financially and in the form of increased resettlements of Syrian refugees from Turkey to Europe.

      Though international organizations say that more evidence of Turkey’s actions is needed, Nour al-Deen al-Showaishi argues the proof is all around him. “The bombs are falling not far from here,” he told me in a telephone interview from a village on the outskirts of Idlib, the Syrian region where he said he was sent. Showaishi said he was deported from Turkey in mid-July after being arrested in the Istanbul neighborhood of Esenyurt while having coffee with friends. Fida al-Deen, who was with him at the time, confirmed to me that Showaishi was arrested and called him from Syria two days later.

      Having arrived in Turkey in early 2018, when the governorate of Istanbul had stopped giving out identity cards to Syrians, Showaishi did not have any papers to show the police. Taken to a nearby police station, officers assured him that he would receive an identity card if he signed a couple of forms. When he asked for more detail about the forms, however, they changed tactics and forced him to comply.

      Showaishi was then sent to a removal center in Tuzla and, he said, deported to Syria the same day. He sent me videos to show he was in Idlib, the last major enclave of armed resistance against Syrian President Bashar al-Assad. According to the United Nations, the region contains 3 million people, half of them internally displaced, and faces a humanitarian disaster now that Russia and the Assad regime are stepping up an offensive to retake the territory.

      The only way out leads back into Turkey, and, determined to prevent yet another influx of refugees, Ankara has buttressed its border.

      Still, Hisham al-Steyf al-Mohammed saw no other option. The 21-year-old was deported from Turkey in mid-July despite possessing valid papers from the governorate of Istanbul, a photo of which I have seen. Desperate to return to his wife and two young children, he paid a smuggler to guide him back to Turkey, according to Mohammed Khedr Hammoud, another refugee who joined the perilous journey.

      Shortly before sunset on August 4, Hammoud said, a group of 13 refugees set off from the village of Dirriyah, a mile from the border, pausing in the mountains for the opportune moment to cross into Turkey. While they waited, Mohammed knelt down to pray, but moments later, a cloud of sand jumped up next to him. Realizing it was a bullet, the smuggler called for the group to get moving, but Mohammed lay still. “I crawled up to him and put my ear on his heart,” Hammoud told me, “but it wasn’t beating.” For more than an hour, he said, the group was targeted by bullets from Turkish territory, and only at midnight was it able to carry Mohammed’s body away.

      I obtained a photo of Mohammed’s death certificate issued by the Al-Rahma hospital in the Darkoush village in Idlib. The document, dated August 5, notes, “A bullet went through the patient’s right ear, and came out at the level of the left neck.”

      The Turkish interior ministry sent me a statement that largely reiterated an article published in Foreign Policy last week, in which an Erdoğan spokesman said Mohammed was a terror suspect who voluntarily requested his return to Syria. He offered no details on the case, though.

      Mohammed’s father, Mustafa, dismissed the spokesman’s argument, telling me in an interview in Istanbul, “If he really did something wrong, then why didn’t they send him to court?” Since Mohammed had been the household’s main breadwinner, Mustafa said he now struggled to feed his family, including Mohammed’s 3-month-old baby.

      Yet he is not the only one struck by Mohammed’s death. In an interview in his friend’s apartment in Istanbul, where he has returned but is in hiding from the authorities, Ahmed had just finished detailing his week’s long detention in Turkey’s removal centers when his phone started to buzz—photos of Mohammed’s corpse were being shared on Facebook.

      “I know him!” Ahmed screamed, clasping his friend’s arm. Mohammed, he said, had been with him in the removal center in Binkılıç. “He was so hopeful to be released, because he had a valid ID for Istanbul. But when he told me that he had been made to sign some forms, I knew it was already too late.”

      “If I signed that piece of paper,” Ahmed said, “I could have been dead next to him.”

      It is this thought that pushes Ahmed, and many young Syrians like him, to continue on to Europe. He and his friend showed me videos a smuggler had sent them of successful boat journeys, and told me they planned to leave soon.

      “As long as we are in Turkey, the Europeans can pretend that they don’t see us,” Ahmed concluded. “But once I go there, once I stand in front of them, I am sure that they will care about me.”

    #Loïc, 29 ans, membre de l’Anafé, vient d’être condamné par la cour d’appel d’Aix-en-Provence à 3 000 euros d’amende avec sursis pour « aide à l’entrée d’un étranger en France » alors même qu’il avait été relaxé par le tribunal correctionnel de Nice en première instance le 14 mars 2018.

    « L’Anafé apporte son soutien à Loïc, qui a été condamné alors qu’il a répondu à un élan de solidarité et d’humanité et dont la motivation au quotidien est la défense des droits des personnes à la frontière franco-italienne. Censée sanctionner les personnes et les organisations qui font du passage illégal des frontières un business hautement lucratif, exploitant les personnes étrangères qui souhaitent entrer sur le territoire français, cette pénalisation a une nouvelle fois été déviée de sa cible », déclare Laure Palun, co-directrice de l’Anafé.

    « Cette condamnation montre à quel point il est temps de changer d’approche sur la question des frontières. L’État français a la responsabilité d’administrer sa frontière. Pour autant, cela ne justifie pas que le seul franchissement irrégulier ou l’aide à un tel franchissement, sans contrepartie, puisse être considéré comme un délit, passible d’une peine de prison. C’est pourtant ce que prévoit la loi française. Et les effets produits sur les personnes sont disproportionnés. Ces questions sont de nature administrative. Elles devraient le rester », ajoute Jean-François Dubost, responsable du Programme protection des populations civiles à Amnesty International France.

    Le 18 janvier 2018 Loïc est arrêté lors d’un contrôle d’identité au péage de La Turbie dans le sens Italie-France. À bord de son véhicule, il y avait un ressortissant éthiopien. Ils ont tous les deux été arrêtés. Loïc a reconnu avoir aidé cette personne dans son parcours migratoire pour des motifs humanitaires. Quelques jours avant, un homme avait été retrouvé mort sur le toit du train en provenance de Vintimille – il avait été électrocuté. Le ressortissant éthiopien a été immédiatement renvoyé en Italie.

    À l’issue de sa garde à vue, Loïc a été présenté au tribunal correctionnel de Nice en comparution immédiate. L’audience a été reportée au 14 mars. Pendant cette période, il avait l’interdiction de sortir du département des Alpes-Maritimes et devait se présenter une fois par semaine au commissariat.

    Le 14 mars 2018, le tribunal correctionnel de Nice a relaxé Loïc en raison notamment de l’absence d’audition du ressortissant éthiopien dans la procédure pénale et de l’absence de procédure relative à la situation administrative de cette personne sur le territoire français. Le tribunal avait en effet estimé que « la culpabilité ne peut être retenue sur la seule base de l’auto-incrimination, le délit poursuivi n’apparaît pas suffisamment caractérisé en l’absence d’enquête sur la situation administrative de l’étranger visé à la procédure ».

    Le parquet avait alors fait appel de la décision. L’audience en appel s’est tenue le 20 mars 2019 à la cour d’appel d’Aix-en-Provence.

    • France : Un travailleur humanitaire condamné pour un #tweet. Première #condamnation de ce type en France

      La condamnation pour diffamation, le 25 septembre, d’un travailleur humanitaire pour un tweet ironique représente une dangereuse escalade dans le harcèlement officiel d’associations fournissant une aide cruciale aux migrants, a déclaré Human Rights Watch. C’est la première condamnation de ce type en France.

      Le tribunal de Boulogne-sur-Mer, dans le nord de la France, a déclaré #Loan_Torondel coupable de #diffamation pour un tweet qu’il avait publié début janvier et l’a condamné à une amende avec sursis et à verser des dommages et intérêts. Sous une photo montrant deux policiers debout au-dessus d’un jeune homme assis dans un champ, Torondel imagine que le jeune homme proteste du fait que la police lui ait confisqué son sac de couchage alors que la température extérieure est de 2 degrés Celsius, et que l’officier lui répond : « Peut-être, mais nous sommes la nation française, monsieur ».

      « Cette condamnation constitue un dangereux précédent et est symptomatique de la manière pernicieuse dont les autorités françaises cherchent à entraver le travail des personnes travaillant auprès des migrants et des demandeurs d’asile », a déclaré Bénédicte Jeannerod, Directrice France de Human Rights Watch.

      La réplique fictive de l’officier était une allusion à un discours prononcé fin décembre 2017 par le Président Emmanuel Macron dans lequel il exhortait le public à surmonter l’adversité en disant : « N’oubliez jamais que nous sommes la Nation française ». L’expression est rapidement devenue un mème moqueur, y compris parmi ceux qui s’opposaient à la façon dont étaient traités les migrants et autres sans-abri pendant l’hiver très froid.

      Loan Torondel, 21 ans, a passé deux ans au sein de l’association L’Auberge des Migrants à Calais, d’abord comme bénévole, puis en tant que coordinateur des opérations, jusqu’en juillet 2018, date à laquelle il est parti reprendre ses études.

      Le recours à des accusations de diffamation à l’encontre de travailleurs humanitaires est sans précédent en France. Dans le cas de Loan Torondel, les policiers qui apparaissaient sur la photo twittée ont déposé plainte en diffamation à la suite de quoi le Procureur a demandé l’ouverture d’une enquête.

      La diffamation est un délit pénal en France, passible d’une peine maximale de 45 000 euros d’amende. Loan Torondel a été condamné à une amende de 1 500 euros avec sursis et à verser 500 euros de dommages et intérêts et 475 euros de frais de justice. Il a fait appel de cette décision.

      Le droit international relatif aux droits humains prévoit des restrictions à la liberté d’expression pour protéger la réputation d’autrui, mais ces restrictions doivent être nécessaires et étroitement définies. Les lois pénales sur la diffamation sont une restriction inutile et disproportionnée à la liberté d’expression et créent un « effet dissuasif » qui restreint de fait autant les propos légitimes que les propos nuisibles.

      C’est pourquoi le Rapporteur spécial des Nations Unies sur la liberté d’opinion et d’expression et le Représentant pour la liberté des médias de l’Organisation pour la sécurité et la coopération en Europe (OSCE), ainsi que le Rapporteur spécial de l’Organisation des États américains pour la liberté d’expression, ont conclu que la diffamation ne constitue « pas une restriction légitime à la liberté d’expression » et ont demandé à ce que ces lois soient supprimées. Dans une autre déclaration conjointe, ces autorités et le Rapporteur spécial de la Commission africaine des droits de l’Homme et des peuples sur la liberté d’expression et l’accès à l’information ont noté que les lois pénales sur la diffamation constituent « une menace à la liberté d’expression ».

      Le Rapporteur spécial des Nations Unies sur la liberté d’opinion et d’expression a estimé que les États devraient veiller tout particulièrement à ce que les lois sur la diffamation – qu’elles relèvent du droit civil ou pénal – « ne soient jamais utilisées pour empêcher toute critique à l’égard du gouvernement » et « doivent refléter le principe que les personnalités publiques sont davantage exposées aux critiques que les citoyens privés ».

      Les travailleurs humanitaires à Calais ont régulièrement fait état de cas de harcèlement de la part de la police. Nombre d’entre eux ont rapporté à Human Rights Watch, au Défenseur des droits et aux observateurs de l’ONU que la police leur infligeait des amendes répétées pour des infractions mineures ou de stationnement et les soumettait à des contrôles d’identité de manière répétée. Des travailleurs humanitaires ont affirmé que, lorsqu’ils ont photographié ou filmé des agents de police – comme la loi française les y autorise – des policiers ont saisi temporairement leurs téléphones pour effacer ou regarder le contenu, sans autorisation. Dans certains cas, des travailleurs humanitaires ont dit que la police les avait aspergés de gaz lacrymogène, les avait forcés à se mettre à terre ou les avait bousculés.

      Entre novembre 2017 et juillet 2018, quatre associations travaillant à Calais – Help Refugees, L’Auberge des Migrants, Utopia 56 et Refugee Info Bus – ont documenté 600 cas d’intimidation policière contre leur personnel et leurs bénévoles, notamment le recours excessif aux contrôles d’identité, aux amendes de stationnement arbitraires, aux fouilles, menaces, insultes et autres injures ou à la violence physique.

      En juillet, le Conseil constitutionnel a estimé que le fait d’aider des personnes dans le besoin, y compris des migrants en situation irrégulière, était protégé par le principe constitutionnel de fraternité.

      « Cette condamnation risque d’ouvrir la porte à de futures poursuites par les autorités malgré la décision du Conseil constitutionnel », a estimé Bénédicte Jeannerod. « Plutôt que de criminaliser les travailleurs humanitaires qui apportent une assistance vitale aux migrants et aux demandeurs d’asile et dénoncent des pratiques abusives, les autorités françaises devraient mettre un terme à ces abus et sanctionner les responsables. »

    23 Activists Arrested on ‘Terrorism’ Charges

    Russia’s arrest on March 27 and 28, 2019 of 23 Crimean Tatar activists was an unprecedented move to intensify pressure on a group largely critical of Russia’s occupation of the Crimean Peninsula, Human Rights Watch said today. Russian authorities should drop the charges, release the activists, and, until they are freed, immediately give them access to their lawyers.

    The detainees, all men, are being held on suspicion of participating in a “terrorist organization,” several of their lawyers told Human Rights Watch.

    “The sweeping arrests in Crimea aim to portray politically active Crimean Tatars as terrorists as a way to silence them,” said Rachel Denber, deputy Europe and Central Asia director at Human Rights Watch. “This has been their approach for several years, and it should stop. These men should be released at once.”

  • Tunisia: Privacy Threatened by ‘Homosexuality’ Arrests

    Tunisian authorities are confiscating and searching the phones of men they suspect of being gay and pressuring them to take anal tests and to confess to homosexual activity, Human Rights Watch said today. Prosecutors then use information collected in this fashion to prosecute them for homosexual acts between consenting partners, under the country’s harsh sodomy laws.

    “The Tunisian authorities have no business meddling in people’s private sexual practices, brutalizing and humiliating them under the guise of enforcing discriminatory laws,” said Amna Guellali, Tunisia director at Human Rights Watch. “Tunisia should abolish its antiquated anti-sodomy laws and respect everyone’s right to privacy.”

    Human Rights Watch spoke with six men prosecuted in 2017 and 2018 under article 230 of the penal code, which punishes consensual same-sex conduct with up to three years in prison. One person interviewed was only 17 years old the first time he was arrested. Human Rights Watch also reviewed the judicial files in these cases and five others that resulted in prosecutions under either article 230 or article 226, which criminalizes “harming public morals.” In addition to violating privacy rights, these cases included allegations of mistreatment in police custody, forced confessions, and denial of access to legal counsel.

    Police arrested some of these men after disputes arose between them or after neighbors reported them. Two had gone to the police to report being raped.

    Some of the men spent months in prison. At least three have left Tunisia and applied for asylum in European countries.

    K.S., a 32-year-old engineer, entered a police station in Monastir in June 2018 to file a complaint of gang rape, and to get an order for a medical examination of his injuries. Instead of treating him as a victim, he said, the police ordered an anal test to determine whether K.S. was “used to practicing sodomy.” “How they treated me was insane,” K.S. told Human Rights Watch. “How is it their business to intrude into my intimate parts and check whether I am ‘used to sodomy’?”

    In another case, a 17-year-old was arrested three times on sodomy charges and was forced to undergo an anal examination, as well as months of conversion therapy at a juvenile detention center. Both harmful practices are discredited.

    Tunisian prosecutors have relied extensively in recent years on forced anal examinations to seek “evidence” of sodomy, even though the exams are highly unreliable and constitute cruel, degrading, and inhuman treatment that can rise to the level of torture.

    On September 21, 2017, during the Universal Periodic Review at the United Nations Human Rights Council, Tunisia formally accepted a recommendation to end forced anal exams. However, Tunisia’s delegation stated: “Medical examinations will be conducted based on the consent of the person and in the presence of a medical expert.” This stance is not credible because trial courts can presume that a refusal to undergo the exam signals guilt, Human Rights Watch said. Tunisia should abandon anal exams altogether.

    Prosecutions for consensual sex in private and between adults violate the rights to privacy and nondiscrimination guaranteed by the International Covenant on Civil and Political Rights, to which Tunisia is a party. The United Nations Human Rights Committee, which monitors compliance with the covenant, has stated that sexual orientation is a status protected against discrimination. The UN Working Group on Arbitrary Detention has found that arrests for same-sex conduct between consenting adults are, by definition, arbitrary.

    Tunisia’s 2014 constitution, in article 24, obliges the government to protect the rights to privacy and the inviolability of the home. Article 21 provides that “All citizens, male and female, have equal rights and duties, and are equal before the law without any discrimination.” Article 23 prohibits “mental and physical torture.”

    The Code of Criminal Procedure prohibits house searches and seizure of objects that could serve a criminal investigation without a judicial warrant, except in cases of flagrante delicto, that is when catching someone in the act.

    Article 1 of Law No. 63 on the protection of personal data stipulates that “every person is entitled to the protection of their personal data and privacy of information, viewed as a fundamental right guaranteed by the constitution. This data can only be used with transparency, loyalty and respect for the dignity of the person whose data is subject of treatment.” However, neither Law No. 63 nor any other domestic law regulates the conditions for seizing private data during a police investigation or its use.

    On June 12, the Commission on Individual Freedoms and Equality, appointed by President Beji Caid Essebsi, proposed, among other actions, to decriminalize homosexuality and to end anal testing in criminal investigations into homosexuality. It also proposed criminalizing the unlawful “interception, opening, recording, spreading, saving and deleting” of an electronic message.

    On October 11, 13 members of the Tunisian Parliament introduced draft legislation for a code on individual freedoms. It incorporated several proposals from the presidential commission including abolition of article 230.

    Parliament should move quickly on this draft legislation and abolish article 230, Human Rights Watch said. It should enact a law that effectively protects people’s privacy, through regulating the seizure and use of private data during criminal investigations, with consequences if such a law is violated.

    The Justice Ministry should meanwhile direct public prosecutors to abandon prosecutions under article 230. The Interior Ministry should investigate reports of the ill-treatment of people arrested based on their gender identity or sexual orientation.

    Human Rights Watch conducted face to face interviews with men in Tunisia and phone interviews with men who fled to European countries. Pseudonyms have been used to protect their privacy.

    Accounts by Men Prosecuted

    K.S., 32, engineer

    K.S. used to work for an international company in Tunis. He said that on June 8, he went to spend the weekend in at a friend’s house in Monastir, a coastal city. He had earlier chatted with a man from Monastir on Grindr, a social network application for gays. They made a date and they met that day in a café. The man invited K.S. to his house, but once there, the man became aggressive and showed K.S. a police badge. Two other men arrived, and they started insulting him, calling him “sick.” “One said, ‘You people of Loth [a demeaning term derived from the Biblical and Quranic story of Lot], you deserve to be killed, you are like microbes.’”

    They punched and slapped him on the face, he said. Then the man who had invited him said, “We will show you what sodomy is like.” The men then forced him to take off his clothes and bend over. Two of them held K.S. by the arms while the third inserted a baton in his anus. “It was unbearable, I felt that I will faint,” K.S. said. They finally let him leave.

    I was shivering and bleeding [when I reached my friend’s house]. The next day, I went to Fattouma Bourguiba hospital in Monastir. I just wanted to get medical treatment and to check that I did not have internal hemorrhaging.

    But, he said, the doctor refused to examine him without a police order:

    I went to the Skanes district police station in Monastir, to try to get the requisition order. I did not want to tell the police the full story, so I just said that three men had raped me. The policeman who was typing my statement left the room at some point, and that’s when I saw on the screen that he was instructing the doctor at Fatouma Bourguiba hospital to examine whether I am ‘used to practicing sodomy.’ I felt the blood freeze in my body.

    Human Rights Watch reviewed the June 9 police requisition order, in which the chief instructs the doctor to examine whether K.S. was “used to practicing sodomy” and whether he was victim of anal rape.

    K.S. said that, when the policeman returned to the office, K.S. asked if he could leave. The policeman replied: “And go where? You can’t leave before we check what kind of stuff you do.” The policeman called for a patrol car to drive K.S. to the hospital.

    The doctor told me that he has a requisition order to perform an anal test. “We want to check whether this is a habit,” he said. I was terrified. I told him that I didn’t want to do the test. But he insisted that he had to perform it. He told me to remove my pants and assume a prayer position [on hand and knees] on top of the medical bed. He put on gloves and started to examine me with his fingers. As soon as he did, I felt sick and told him I wanted to go to the toilet. I wanted to stop this humiliation. He let me go. I managed to avoid the policemen who were waiting for me in the corridor and left the hospital. Once in the parking lot, I started running until I felt safe, and then went to my friend’s house.

    K.S. said he took a flight on June 13 to Belgium, where he has filed a request for asylum.

    K. B., 41, documentary filmmaker

    K.B. spent 13 months in pretrial detention on accusation of sodomy and unlawful detention. He is married and the father of an 8-year-old girl. He told Human Rights Watch that on March 3, 2017, at around 9 p.m., he went to downtown Tunis for drinks. While he was sitting in a bar, S.Z., a young man, approached him. They chatted for a while, then K.B. invited him to his place. He said that, after having sex, he went to the kitchen to prepare some food. When he came back to the living room, he caught the man stealing money from his wallet. K.B. tried to force him out of his apartment, but the man locked himself in a bedroom, went to the balcony, and screamed for help. Policemen arrived, arrested them, and took them to the Aouina district police station.

    Police treated me with contempt. The first question the interrogator asked was whether I had sex with S.Z. I denied it categorically and told him we only had drinks together. But he said that S.Z. had confessed. The interrogator asked me: “Aren’t you ashamed of yourself?”
    K.B. said the police at the station confiscated his phone and looked at his social media history and his photo archives. They switched the phone off and did not allow him to call his family or a lawyer. They presented him with a statement to sign, but he refused. At 4 a.m., they transferred both men to Bouchoucha detention center. Later that morning, the police took the men to the Tunis first instance court, where a prosecutor ordered them to undergo an anal test. The police took them to Charles Nicole hospital, K.B. said, where he refused the test. “The idea of them intruding into my intimacy and into my body was so humiliating to me.”

    He was returned to detention and after a few weeks decided to undergo the test in the hope that negative results would prove his innocence. He said he informed the investigative judge during a hearing and the judge issued a requisition. Police officers took him again to Charles Nicole Hospital.

    It was the worst thing that ever happened to me. The doctor asked me to strip and get on the examination table. He asked me to bend over. There was one policeman in the room and one medical assistant, watching. The doctor put one finger into my anus and moved it around. I was so ashamed. It was very dehumanizing.

    K.B. said that even though the test result was negative, the investigative judge indicted him for sodomy. The order referring the case to trial said that the time elapsed between the alleged act and the test prevented the court from ruling out that K.B. was “used to the practice of sodomy.”

    In May 2018, 13 months after the court placed K.B. in pretrial detention, it acquitted and freed him.

    In the indictment, the investigative judge wrote that S.Z. had confessed to the police to “committing the crime of sodomy in exchange for money” and that he admitted that he “approached and dated men he met via Facebook.” The judge quotes the police report, which describes in crude terms the sexual intercourse between K.B. and S.Z. The judge also states that K.B has denied the accusation of sodomy, and instead stated that he and S.Z. were only having drinks at his place and did not have sex.

    The investigative judge notes that S.Z. later retracted his confession and says that he gave instructions for the forensic doctor in the Charles Nicole Hospital to administer an anal test to determine whether K.B “bore signs of the practice of homosexual activity” recently or whether he “practices sodomy in a habitual way.”

    The judge’s indictment of K. B. was based on S.Z.’s confession to the police, later repudiated, from “the circumstances of the case, which show that the two men had no other reason to go to K. B.’s house” and K. B.’s refusal to take the anal test. The judge wrote: “given that the test was performed 20 days after the reported incident, the forensic doctor was not able to find signs of anal penetration because those signs disappear five days after the act.”

    “Free” (nickname), 32, hairdresser

    Free said that on the night of April 5, 2018, he went with a female friend from Sousse to Monastir for drinks and to meet his boyfriend. When they arrived at around 9 p.m., he said, a police patrol stopped them and asked for their papers, then told the woman to accompany them to the station for further identity checks. Free waited outside the station.

    While waiting, Free received an angry message from his boyfriend asking him why he was late. Free explained where he was and snapped a photo of the station as proof. A police officer saw him and confiscated Free’s telephone, saying he had endangered state security. The officer took him to an interrogation room, where another officer handcuffed him to a chair. An officer searched the phone and finding nude photos of Free, then searched his social media activity and read the conversations he had with men on gay dating apps and his chats with his boyfriend on Facebook Messenger, some of them sexually explicit.

    Free said that the police officer turned to him and said, “I hate you, you sodomites. You will have to pay for your depravity.” Other police officers in the room insulted Free, he said. The officer interrogated him about his sexual activity, wrote a report, and told him to sign it. When Free refused, a policeman slapped him in the face and said, “Ah, now you are trying to be a man. Just sign here, you scum.” Free signed the report without reading it.

    At no point during the interrogation did the police advise Free of his right to speak to a lawyer. At around midnight, they moved him into a cell, where he spent the night. The following day, he was taken before a prosecutor, who charged him with sodomy but decided to release him provisionally pending trial. On June 6, he appeared before the first instance court in Monastir. The presiding judge closed the courtroom to the public.

    The first question he asked me was whether I am used to the practice of sodomy. I told him I was not. He asked the question again, then asked, “Then why did you confess?” I answered, “Because the police forced me to.” The judge asked, “But if you are not a sodomite, why do you dress like this, why do you look like one of them?”

    He said the judge adjourned the trial to June 14, when he convicted Free and sentenced him to a four-months sentence with probation, based on his phone conversations and his forced confession. Free has appealed.

    M. R., 26, paramedic

    M.R. worked in a hospital in Tebourba, a city 40 kilometers west of Tunis. He fled to France and applied for asylum after being charged under article 230 and granted pretrial release.

    M.R. said he had always hidden his sexual orientation because of severe social stigma. In November 2017, he chatted with a man on Facebook. The man, called A.F., sent him photos, and they decided to meet. When they did, M.R. realized that the photos were fake and told A.F. that he would not have sex with him. A few days later, on November 28, A.F. banged on his door at around 4 a.m. Fearing scandal, M.R. opened the door to find A.F. drunk and wielding a knife. A.F. slapped him on the face, ordered him to remove his clothes, and raped him, he said, threatening to cut his throat. After a few hours, A.F. told M.R. to buy A.F. cigarettes. M.R. went to the Tebourba police station and filed a rape complaint.

    When I told the police officers about the rape, they asked me how I knew the man and how we met. I dodged the questions, but they insisted. I told them that I am gay, and their behavior changed instantly. The station chief said: “Ah, so you were the one who initiated this, you are an accomplice to the crime, there is no rape here – you deserve this.” Then, he handed me a requisition order and told me to go get an anal test the following day at Charles Nicole Hospital.

    The police interrogated M.R., then accompanied him to his apartment, where they arrested A.F. The police told M.R. to undergo the anal examination, then report to the First Instance Court in Manouba. M.R. consulted the nongovernmental association Shams, which defends sexual minorities, and decided to skip the anal test. When he reported to the court, the investigative judge treated him as a criminal, not a victim. M.R. said:

    He asked questions about my sex life and when I started practicing sodomy with other men. He said that I deserved everything that had happened to me and that I should be ashamed of myself.

    M.R. said that the judge charged him with sodomy and granted him pretrial release. A.F. was kept in custody and charged with sodomy and rape.

    The indictment of M.R., prepared by the investigative judge and dated December 13, 2017, provides purported details from M.R.’s intimate life, including confessions that he is gay. The indictment also relies on the confession from A.F. and cites a condom seized at M. R.’s house as evidence.

    M.R. said that, three days after the encounter with A.F., he reported to work at the hospital. The director handed him a dismissal notice on the grounds that he was facing trial.

    I had to go back to my family’s place, as I had no salary anymore. It was like living in a prison. My father and older brother beat me many times, my father even burned me with a cigarette. They did not allow me to go out, they said they were ashamed of me.

    Having lost everything, he left Tunisia for France.

    I had no other choice, I felt rejected by everyone, my family, society, my colleagues. And I was afraid of going to prison.

    Mounir Baatour, M.R.’s lawyer, told Human Rights Watch that the case is stalled in the first instance court in Manouba, and has yet to go to trial. On May 15, 2018, indictment chamber sent the indictment to the cassation court for a legal review, which is pending.

    R. F., 42, day laborer, and M.J. 22, unemployed

    On June 12, 2018, police in Sidi Bouzaiane arrested R.F. and M.J. after R.F. went to the police to say that M.J. had refused to leave R.F.’s house.

    M.J. said that the police came to his house and took both men to the police station at around midnight. They interrogated them in the same room, asking them how they met. A police officer took R.F.’s phone and watched videos stored on it, then said to R.F., “So you are a miboun [a degrading term for gay]. M.J. said:

    One of the four officers present during interrogation slapped R.F. on the face. Then he turned toward me and asked, “So what were you both doing in the house? I’m sure you were having sex, so you too must be a miboun. You are staining this country,” he said.

    M.J. said that policemen beat him on his face, head, and back. When the police finished the interrogation at 3 a.m., they presented a written report and told M.J. to sign it. He said he asked to have a lawyer first, but they refused to let him call one and insulted him. He signed the report.

    The police report, reviewed by Human Rights Watch, states that neither man requested a lawyer. R.F.’s purported statement, as the police recorded it, describes in graphic terms how he habitually practices sodomy and has sex with men. The police report states that officers searched R.F.’s smartphone and found videos of R.F. having sex with men. The police confiscated his phone, the report says, as “evidence of the crime.”

    Two days after the arrest, M.J. said, he and R.F. appeared before a prosecutor, who asked them: “Aren’t you afraid of God’s judgment?” He ordered pretrial detention, and they were sent to the Sidi Bouzid prison. M.J. said that one of the prison guards harassed him and asked him vulgar questions such as: “How you do this? Are you getting fucked for money? Why are you fucking men? Aren’t there enough women to fuck in this country?”

    He said he was put in a cell with 100 other men, who seemed to have been informed about his “crime.” Over the following days, his cellmates insulted, beat, and sexually harassed him. He said that one night, he refused to have sex with the cell “strongman”, so the man and two others beat him. He said they held his arms, while the strongman slapped him on the face and punched him on the chin.

    After a week in detention, he appeared before an investigative judge, who asked him about his sexual behavior. M.J. said he admitted that he is gay. He said he had done nothing wrong, but the judge replied, “You are harming society.”

    The first instance court in Sidi Bouzid sentenced the two men on June 12 to three months in prison for sodomy. The appeals court upheld the sentence.

    S.C., 24 and A.B., 22

    Police arrested S.C. and A.B. in Sousse on December 8, 2016, when they were allegedly caught committing sodomy in public. They were sentenced, on March 10, 2017, to eight months in prison under article 230 of the penal code and not on charges related to public indecency. The police report describes their sexual intercourse in detail and concludes that S.C. “committed active sodomy,” while A.B. was a “passive sodomite.”

    The judgment from the first instance court in Sousse, which Human Rights Watch reviewed, states that both denied committing sodomy or being homosexuals. It states that they were both subjected to anal examinations on December 9, 2016, that turned out “negative.” The judge concluded that: “the results of the anal tests cannot exonerate the accused of the crime, especially given that the [tests] were performed sometime after the facts.” The court based the guilty verdict only on the declarations by police officers and wrote that: “it is appropriate to sentence them to eight months as an adequate and dissuasive sentence proportional to the offense that they have committed.”

    A.C., 18, student

    A.C. was arrested three times for sodomy. The first time was in August 2017, when he was 17. Police forces arrested him at his house after his two sisters denounced him as gay and took him to the Kasba police station in Tunis. He said that they interrogated him extensively about his sexual orientation and took his smart phone and searched his personal data. The next day, they took him to a forensic doctor in the Charles Nicole hospital for an anal examination. He said he did not have a lawyer and that the police did not inform him of his right to have one.

    I did not understand what was going on. The police told me that the test is mandatory. The doctor told me to go on an examination bed and to bend, and then he inserted his fingers in my insides. The doctor did not explain what the test is about.

    A.C. said he was released without charge after spending two days in the Kasba police station.

    On May 15, 2018, he went to the police station in Sijoumi, in Tunis, in response to a summons. He said police officers told him his family had filed a complaint and questioned him for almost four hours. A.C. confessed to being gay. The police took him to Bouchoucha detention center in Tunis, where he spent the night. The next day, May 16, he appeared before the Tunis first instance court in Sidi Hassine, where an investigative judge interviewed him. The judge asked him: “Why are you like this? Don’t you know that what you’re doing is haram [forbidden under Islam]?”

    I told the judge that I didn’t break any laws, that what I do is my personal business. I did not hurt anyone. This is my private life and should not be the concern of anyone else.

    He said the judge ordered his detention for two months in a juvenile rehabilitation center, as he was still a minor, and forced him to undergo “conversion therapy,” a thoroughly discredited method to change someone’s sexual orientation or gender identity. At the center, a psychiatrist visited him twice, telling him that “he should work on changing himself and his mind.” He appeared before another investigative judge, on June 25, who released him.

    A.C. said that on September 2, he was running some errands with his boyfriend when the police stopped them and asked for their identity cards. The police told A.C. that his family had filed a complaint against him. They took him to Hay Hlel police station in Tunis, where they questioned him about his sexual life, confiscated his phone, and looked at his photos and personal conversations. A prosecutor issued a warrant to detain him, and he spent eight days in the Bouchoucha detention center. On September 20, he appeared before a judge, who released him without charge.

    F.B, 28; N.A, 21 and B.K., 27, day laborers

    In Sousse, a coastal city, the police arrested three men in January 2017, after neighbors complained that they suspected the men were gay. In the indictment, which Human Rights Watch reviewed, the investigative judge states that the police went to the house where the men were staying, seized their phones, on which they found “evidence that they were sodomites,” as well as “women’s clothing,” and took the men to the police station.

    The investigative judge ruled that the men harmed public morals based on the content of the seized phones and “because they dressed up like women, used lipstick, and talked in a languid way.” The police report and the indictment, which usually would include information about a judicial warrant, did not indicate that the police had one. The three men were sentenced to two months in prison for the charge of harming public morals and served their terms.

  • “You Cry at Night but Don’t Know Why”. Sexual Violence against Women in North Korea

    Oh Jung Hee is a former trader in her forties from Ryanggang province. She sold clothes to market stalls in Hyesan city and was involved in the distribution of textiles in her province. She said that up until she left the country in 2014, guards would regularly pass by the market to demand bribes, sometimes in the form of coerced sexual acts or intercourse. She told Human Rights Watch:

    I was a victim many times … On the days they felt like it, market guards or police officials could ask me to follow them to an empty room outside the market, or some other place they’d pick. What can we do? They consider us [sex] toys … We [women] are at the mercy of men. Now, women cannot survive without having men with power near them.

    She said she had no power to resist or report these abuses. She said it never occurred to her that anything could be done to stop these assaults except trying to avoid such situations by moving away or being quiet in order to not be noticed.

    Park Young Hee, a former farmer in her forties also from Ryanggang province who left North Korea for the second time in 2011, was forced back to North Korea from China in the spring of 2010 after her first attempt to flee. She said, after being released by the secret police (bowiseong) and put under the jurisdiction of the police, the officer in charge of questioning her in the police pre-trial detention facility (kuryujang) near Musan city in North Hamgyong province touched her body underneath her clothes and penetrated her several times with his fingers. She said he asked her repeatedly about the sexual relations she had with the Chinese man to whom she had been sold to while in China. She told Human Rights Watch:

    My life was in his hands, so I did everything he wanted and told him everything he asked. How could I do anything else? … Everything we do in North Korea can be considered illegal, so everything can depend on the perception or attitude of who is looking into your life.

    Park Young Hee said she never told anybody about the abuse because she did not think it was unusual, and because she feared the authorities and did not believe anyone would help.

    The experiences of Oh Jung Hee and Park Young Hee are not isolated ones. While sexual and gender-based violence is of concern everywhere, growing evidence suggests it is endemic in North Korea.

    This report–based largely on interviews with 54 North Koreans who left the country after 2011, when the current leader, Kim Jong Un, rose to power, and 8 former North Korean officials who fled the country–focuses on sexual abuse by men in official positions of power. The perpetrators include high-ranking party officials, prison and detention facility guards and interrogators, police and secret police officials, prosecutors, and soldiers. At the time of the assaults, most of the victims were in the custody of authorities or were market traders who came across guards and other officials as they traveled to earn their livelihood.

    Interviewees told us that when a guard or police officer “picks” a woman, she has no choice but to comply with any demands he makes, whether for sex, money, or other favors. Women in custody have little choice should they attempt to refuse or complain afterward, and risk sexual violence, longer periods in detention, beatings, forced labor, or increased scrutiny while conducting market activities.

    Women not in custody risk losing their main source of income and jeopardizing their family’s survival, confiscation of goods and money, and increased scrutiny or punishment, including being sent to labor training facilities (rodong danryeondae) or ordinary-crimes prison camps (kyohwaso, literally reform through labor centers) for being involved in market activities. Other negative impacts include possibly losing access to prime trading locations, being fired or overlooked for jobs, being deprived of means of transportation or business opportunities, being deemed politically disloyal, being relocated to a remote area, and facing more physical or sexual violence.

    The North Koreans we spoke with told us that unwanted sexual contact and violence is so common that it has come to be accepted as part of ordinary life: sexual abuse by officials, and the impunity they enjoy, is linked to larger patterns of sexual abuse and impunity in the country. The precise number of women and girls who experience sexual violence in North Korea, however, is unknown. Survivors rarely report cases, and the North Korean government rarely publishes data on any aspect of life in the country.

    Our research, of necessity conducted among North Koreans who fled, does not provide a generalized sample from which to draw definitive conclusions about the prevalence of sexual abuse by officials. The diversity in age, geographic location, social class, and personal backgrounds of the survivors, combined with many consistencies in how they described their experiences, however, suggest that the patterns of sexual violence identified here are common across North Korea. Our findings also mirror those of other inquiries that have tried to discern the situation in this sealed-off authoritarian country.

    A 2014 United Nations Commission of Inquiry (UN COI) on human rights in the Democratic People’s Republic of Korea (DPRK) concluded that systematic, widespread, and gross human rights violations committed by the North Korean government constituted crimes against humanity. These included forced abortion, rape, and other sexual violence, as well as murder, imprisonment, enslavement, and torture on North Koreans in prison or detention. The UN COI stated that witnesses revealed that while “domestic violence is rife within DPRK society … violence against women is not limited to the home, and that it is common to see women being beaten and sexually assaulted in public.”

    The Korea Institute for National Unification (KINU), a South Korean government think tank that specializes in research on North Korea, conducted a survey with 1,125 North Koreans (31.29 percent men and 68.71 percent women) who re-settled in South Korea between 2010 and 2014. The survey found that 37.7 percent of the respondents said sexual harassment and rape of inmates at detention facilities was “common,” including 15.9 percent that considered it “very common.” Thirty-three women said they were raped at detention and prison facilities, 51 said they witnessed rapes in such facilities, and 25 said they heard of such cases. The assailants identified by the respondents were police agents–45.6 percent; guards–17.7 percent; secret police (bowiseong) agents –13.9 percent; and fellow detainees–1.3 percent. The 2014 KINU survey found 48.6 percent of the respondents said that rape and sexual harassment against women in North Korea was “common.”

    The North Koreans we spoke with stressed that women are socialized to feel powerless to demand accountability for sexual abuse and violence, and to feel ashamed when they are victims of abuse. They said the lack of rule of law and corresponding support systems for survivors leads most victims to remain silent–not seek justice and often not even talk about their experiences.

    While most of our interviewees left North Korea between2011 and 2016, and many of the abuses date from a year or more before their departure, all available evidence suggests that the abuses and near-total impunity enjoyed by perpetrators continue to the present.

    In July 2017, the North Korean government told the UN committee that monitors the implementation of the Convention on the Elimination of Discrimination Against Women (CEDAW) that just nine people in all of North Korea were convicted of rape in 2008, seven in 2011, and five in 2015. The government said that the numbers of male perpetrators convicted for the crime of forcing a woman who is his subordinate to have sexual intercourse was five in 2008, six in 2011, and three in 2015. While North Korean officials seem to think such ridiculously low numbers show the country to be a violence-free paradise, the numbers are a powerful indictment of their utter failure to address sexual violence in the country.

    Sexual Abuse in Prisons and Detention Facilities

    Human Rights Watch interviewed eight former detainees or prisoners who said they experienced a combination of verbal and sexual violence, harsh questioning, and humiliating treatment by investigators, detention facility personnel, or prison guards that belong to the police or the secret police (bowiseong).

    Six interviewees had experienced sexual, verbal, and physical abuse in pre-trial detention and interrogation facilities (kuryujang)–jails designed to hold detainees during their initial interrogations, run by the MSS or the police. They said secret police or police agents in charge of their personal interrogation touched their faces and their bodies, including their breasts and hips, either through their clothes or by putting their hands inside their clothes.

    Human Rights Watch also documented cases of two women who were sexually abused at a temporary holding facility (jipkyulso) while detainees were being transferred from interrogation facilities (kuryujang) to detention facilities in the detainees’ home districts.

    Sexual Abuse of Women Engaged in Trade

    Human Rights Watch interviewed four women traders who experienced sexual violence, including rape, assault, and sexual harassment, as well as verbal abuse and intimidation, by market gate-keeper officials. We also interviewed 17 women who were sexually abused or experienced unwanted sexual advances by police or other officials as they traveled for their work as traders. Although seeking income outside the command economy was illegal, women started working as traders during the mass famine of the 1990s as survival imperatives led many to ignore the strictures of North Korea’s command economy. Since many married women were not obliged to attend a government-established workplace, they became traders and soon the main breadwinners for their families. But pursuing income in public exposed them to violence.

    Traders and former government officials told us that in North Korea traders are often compelled to pay bribes to officials and market regulators, but for women the “bribes” often include sexual abuse and violence, including rape. Perpetrators of abuses against women traders include high-ranking party officials, managers at state-owned enterprises, and gate-keeper officials at the markets and on roads and check-points, such as police, bowiseong agents, prosecutors, soldiers, and railroad inspectors on trains.

    Women who had worked as traders described unwanted physical contact that included indiscriminately touching their bodies, grabbing their breasts and hips, trying to touch them underneath their skirts or pants, poking their cheeks, pulling their hair, or holding their bodies in their arms. The physical harassment was often accompanied by verbal abuse and intimidation. Women also said it was common for women to try to help protect each other by sharing information about such things, such as which house to avoid because it is rumored that the owner is a rapist or a child molester, which roads not to walk on alone at night, or which local high-ranking official most recently sexually preyed upon women.

    Our research confirms a trend already identified in the UN COI report:

    Officials are not only increasingly engaging in corruption in order to support their low or non-existent salaries, they are also exacting penalties and punishment in the form of sexual abuse and violence as there is no fear of punishment. As more women assume the responsibility for feeding their families due to the dire economic and food situation, more women are traversing through and lingering in public spaces, selling and transporting their goods.

    The UN COI further found “the male dominated state, agents who police the marketplace, inspectors on trains, and soldiers are increasingly committing acts of sexual assault on women in public spaces” and “received reports of train guards frisking women and abusing young girls onboard.” This was described as “the male dominated state preying on the increasingly female-dominated market.”

    Almost all of the women interviewed by Human Rights Watch with trading experience said the only way not to fall prey to extortion or sexual harassment while conducting market activities was to give up hopes of expanding one’s business and barely scrape by, be born to a powerful father with money and connections, marry a man with power, or become close to one.

    Lack of Remedies

    Only one of the survivors of sexual violence Human Rights Watch interviewed for this report said she had tried to report the sexual assault. The other women said they did not report it because they did not trust the police and did not believe police would be willing to take action. The women said the police do not consider sexual violence a serious crime and that it is almost inconceivable to even consider going to the police to report sexual abuse because of the possible repercussions. Family members or close friends who knew about their experience also cautioned women against going to the authorities.

    Eight former government officials, including a former police officer, told Human Rights Watch that cases of sexual abuse or assault are reported to police only when there are witnesses and, even then, the reports invariably are made by third parties and not by the women themselves. Only seven of the North Korean women and men interviewed by Human Rights Watch were aware of cases in which police had investigated sexual violence and in all such cases the victims had been severely injured or killed.

    All of the North Koreans who spoke to Human Rights Watch said the North Korean government does not provide any type of psycho-social support services for survivors of sexual violence and their families. To make matters worse, they said, the use of psychological or psychiatric services itself is highly stigmatized.

    Two former North Korean doctors and a nurse who left after 2010 said there are no protocols for medical treatment and examination of victims of sexual violence to provide therapeutic care or secure medical evidence. They said there are no training programs for medical practitioners on sexual assault and said they never saw a rape victim go to the hospital to receive treatment.

    Discrimination Against Women

    Sex discrimination and subordination of women are pervasive in North Korean. Everyone in North Korea is subjected to a socio-political classification system, known as songbun, that grouped people from its creation into “loyal,” “wavering,” or “hostile” classes. But a woman’s classification also depends, in critical respects, on that of her male relatives, specifically her father and her father’s male relations and, upon marriage, that of her husband and his male relations. A woman’s position in society is lower than a man’s, and her reputation depends largely on maintaining an image of “sexual purity” and obeying the men in her family.

    The government is dominated by men. According to statistics provided by the DPRK government to the UN, as of 2016 women made up just 20.2 percent of the deputies selected, 16.1 percent of divisional directors in government bodies, 11.9 percent of judges and lawyers, 4.9 percent of diplomats, and 16.5 per cent of the officials in the Ministry of Foreign Affairs.

    On paper, the DPRK says that it is committed to gender equality and women and girl’s rights. The Criminal Code criminalizes rape of women, trafficking in persons, having sexual relations with women in a subordinate position, and child sexual abuse. The 2010 Law on the Protection and Promotion of the Rights of Women bans domestic violence. North Korea has also ratified five international human rights treaties, including ones that address women and girl’s rights and equality, such as the Convention on the Rights of the Child (CRC) and CEDAW.

    During a meeting of a North Korean delegation with the CEDAW Committee, which reviewed North Korean compliance between 2002 and 2015, government officials argued all of the elements of CEDAW had been included in DPRK’s domestic laws. However, under questioning by the committee, the officials were unable to provide the definition of “discrimination against women” employed by the DPRK.

    Park Kwang Ho, Councilor of the Central Court in the DPRK, stated that if a woman in a subordinate position was forced to engage in sexual relations for fear of losing her job or in exchange for preferential treatment, it was her choice as to whether or not she complied. Therefore, he argued, in such a situation the punishment for the perpetrator should be lighter. He later amended his statement to say that if she did not consent to having sexual relations, and was forced to do so, the perpetrator was committing rape and would be punished accordingly.

  • Brazilian media report that police are entering university classrooms to interrogate professors

    In advance of this Sunday’s second-round presidential election between far-right politician Jair #Bolsonaro and center-left candidate Fernando Haddad, Brazilian media are reporting that Brazilian police have been staging raids, at times without warrants, in universities across the country this week. In these raids, police have been questioning professors and confiscating materials belonging to students and professors.

    The raids are part a supposed attempt to stop illegal electoral advertising. Brazilian election law prohibits electoral publicity in public spaces. However, many of the confiscated materials do not mention candidates. Among such confiscated materials are a flag for the Universidade Federal Fluminense reading “UFF School of Law - Anti-Fascist” and flyers titled “Manifest in Defense of Democracy and Public Universities.”

    For those worrying about Brazilian democracy, these raids are some of the most troubling signs yet of the problems the country faces. They indicate the extremes of Brazilian political polarization: Anti-fascist and pro-democracy speech is now interpreted as illegal advertising in favor of one candidate (Fernando Haddad) and against another (Jair Bolsonaro). In the long run, the politicization of these two terms will hurt support for the idea of democracy, and bolster support for the idea of fascism.

    In the short run, the raids have even more troublesome implications. Warrantless police raids in university classrooms to monitor professor speech have worrisome echoes of Brazil’s 1964-1985 military regime — particularly when the speech the raids are seeking to stop is not actually illegal.

    Perhaps the most concerning point of all is that these raids are happening before Bolsonaro takes office. They have often been initiated by complaints from Bolsonaro supporters. All of this suggests that if Bolsonaro wins the election — as is widely expected — and seeks to suppress the speech of his opponents, whom he has called “red [i.e., Communist] criminals,” he may have plenty of willing helpers.

      220 000 messages de haine en quatre jours contre une journaliste

      Dans une université du Pará, quatre policiers militaires sont entrés sur le campus pour interroger un professeur sur « son idéologie ». L’enseignant avait abordé la question des fake news dans un cours sur les médias numériques. Une étudiante s’en est sentie offensée, alléguant une « doctrine marxiste », et l’a dit à son père, policier militaire. Une enquête du journal la Folha de São Paulo a pourtant révélé mi-octobre que des entreprises qui soutiennent le candidat d’extrême droite avaient acheté les services d’entreprises de communication pour faire envoyer en masse des fausses nouvelles anti-Parti des travailleurs directement sur les numéros whatsapp – une plateforme de messagerie en ligne – des Brésiliens. L’auteure de l’enquête, la journaliste Patricia Campos Melo, et le quotidien de São Paulo, ont ensuite reçu 220 000 messages de haine en quatre jours ! [2] Le journal a demandé à la police fédérale de lancer une enquête.

      Mais ce sont des conférences et des débats sur la dictature militaire et le fascisme qui ont pour l’instant été interdits. C’est le cas d’un débat public intitulé « Contre la fascisme, pour la démocratie », qui devait avoir lieu à l’université fédérale de Rio Grande do Sul (la région de Porto Alegre). Devaient y participer l’ex-candidat du parti de gauche PSOL au premier tour de la présidentielle, Guilherme Boulos, un ancien ministre issu du Parti des travailleurs, des députés fédéraux du PT et du PSOL. « J’ai donné des cours et des conférences dans des universités en France, en Angleterre, au Portugal, en Espagne, en Allemagne, en Argentine, et ici, même pendant la dictature. Aujourd’hui, je suis censuré dans l’État, le Rio Grande do Sul, que j’ai moi-même gouverné. Le fascisme grandit », a réagi l’un des députés, Tarso Genro, sur twitter.

      Une banderole « moins d’armes, plus de livres » jugée illégale

      Dans le Paraíba, les agents du tribunal électoral se sont introduits dans l’université pour retirer une banderole où était simplement inscrit « moins d’armes, plus de livres ». « Cette opération de la justice électorale dans les universités du pays pour saisir du matériel en défense de la démocratie et contre le fascisme est absurde. Cela rappelle les temps sombres de la censure et de l’invasion des facultés », a écrit Guilherme Boulos, le leader du PSOL, sur twitter, ajoutant : « Le parti de la justice a formé une coalition avec le PSL », le parti de Bolsonaro. « De telles interventions à l’intérieur de campus au cours d’une campagne électorale sont inédites. Une partie de l’appareil d’État se prépare au changement de régime », a aussi alerté l’historienne française, spécialiste du Brésil, Maud Chirio, sur sa page Facebook.

      Dimanche dernier, dans une allocution filmée diffusée pour ses supporters rassemblés à São Paulo, Jair Bolsonaro a proféré des menaces claires à l’égard de ses opposants. « Ou vous partez en exil ou vous partez en prison », a-il dit, ajoutant « nous allons balayer ces bandits rouges du Brésil », et annonçant un « nettoyage jamais vu dans l’histoire de ce pays ». Il a précisé qu’il allait classer le Mouvements des paysans sans Terre (MST) et le Mouvement des travailleurs sans toit (MTST) comme des organisations terroristes, et menacé Fernando Haddad de l’envoyer « pourrir en prison aux côtés de Lula ».

      107 international academics react to social media reports that more than 20 universities in Brazil have been invaded by military police in recent days, with teaching materials confiscated on ideological grounds

      Reports have emerged on social media that more than 20 universities in Brazil have been subjected in recent days to: invasions by military police; the confiscation of teaching materials on ideological grounds; and the suppression of freedom of speech and expression, especially in relation to anti-fascist history and activism.

      As academics, researchers, graduates, students and workers at universities in the UK, Europe and further afield, we deplore this attack on freedom of expression in Brazil’s universities, which comes as a direct result of the campaign and election of far-right President Bolsonaro.

      Academic autonomy is a linchpin not only of independent and objective research, but of a functioning democracy, which should be subject to scrutiny and informed, evidence-based investigation and critique.

      We call on co-workers, colleagues and students to decry this attack on Brazil’s universities in the name of Bolsonaro’s wider militaristic, anti-progressive agenda. We will not stand by as this reactionary populist attacks the pillars of Brazil’s democracy and education system. We will campaign vigorously in whatever capacity we can with activists, educators and lawmakers in Brazil to ensure that its institutions can operate without the interference of this new – and hopefully short-lived – government.

    • Brazil Court Strikes Down Restrictions on University Speech

      Brazil´s Supreme Court issued an important decision striking down restrictions on political speech on university campuses in a unanimous ruling yesterday. Meanwhile, president-elect Jair Bolsonaro´s allies in Congress are pressing ahead with efforts to restrict what students and educators can discuss in the classroom.

      The court ruling overturned decisions by electoral court judges who recently ordered universities across the country to clamp down on what they considered illegal political campaigning. The orders were spurred by complaints from anonymous callers and, in a few cases, by members of conservative groups.

      For example, at Grande Dourados Federal University, court officials suspended a public event against fascism, according to the student group that organized it. At Campina Grande Federal University, police allegedly seized copies of a pamphlet titled “Manifesto in defense of democracy and public universities” and hard drives, said a professors´ association.

      At Rio de Janeiro State University, police ordered the removal of a banner honoring Marielle Franco, a black lesbian human rights defender and councilwoman murdered in March, despite not having a judicial order.

      The attorney general, Raquel Dodge, asked the Supreme Court to rule the electoral court judges´ decisions unconstitutional, and Supreme Court justice Cármen Lúcia Rocha issued an injunction stopping them. The full court upheld that decision on October 31.

      “The only force that must enter universities is the force of ideas,” said Rocha.

      “The excessive and illegitimate use of force by state agents … echoes somber days in Brazilian history,” said Justice Rosa Weber, referring to Brazil´s 1964 – 1985 military dictatorship.

      The ruling comes as Bolsonaro, who remains in Congress until he assumes the presidency on January 1, and his allies push a bill that would prohibit teachers from promoting their own opinions in the classroom or using the terms “gender” or “sexual orientation,” and would order that sex and religious education be framed around “family values.”

      A state representative-elect from Bolsonaro´s party has even called on students to film and report teachers who make “political-partisan or ideological statements.” Bolsonaro made a similar call in 2016. State prosecutors have filed a civil action against the representative-elect, alleging she instituted “an illegal service for the political and ideological control of teaching activities.”

      In his long career in Congress, Bolsonaro has endorsed abusive practices that undermine the rule of law, defended the dictatorship, and has been a vocal proponent of bigotry.

      More than ever, Brazil needs its judiciary to defend human rights within and outside the classroom.

Il méprise le combat pour les droits humains. Il exprime une hostilité agressive envers les femmes, les Afro-descendants, les membres de la communauté LGBT +, les peuples autochtones et les pauvres. Son programme vise à détruire les avancées politiques, économiques, sociales, environnementales et culturelles des quatre dernières décennies, ainsi que l’action menée par les mouvements sociaux et le camp progressiste pour consolider et étendre la démocratie au Brésil.

The potential victory of a far-right radical in Brazil would reinforce a dangerous international trend of extremely reactionary and anti-democratic politicians gaining state power in recent years.

      Bolsonaro explicitly defends the Brazilian military dictatorship that ruled the country from 1964-85 and praises torture and torturers. He condemns human rights efforts. He has expressed aggressive and vile hostility toward women, people of African descent, the LGBT+ community, indigenous people, and the poor. His proposed policies would effectively undo all of the political, social, economic, labor, environmental, and cultural gains of the last four decades, efforts by social movements and progressive politicians to consolidate and expand democracy in Brazil. A Bolsonaro presidency also threatens to undermine the still fragile democratic politics that people throughout Brazil have risked so much to build.

      His election would seriously hamper any ambitious international effort for environmental protection, against climate change and for the preservation of peace.

  • Sri Lanka: Government Slow to Return Land. Create Consultative Process to End Military Occupation

    The Sri Lankan government has yet to fully restore civilian ownership of land and property nearly a decade since the end of the civil war in 2009, Human Rights Watch said in a report released today. Progress, particularly since the election of a new government in 2015, has been hindered by broad military claims of national security and the lack of a transparent process.

    The 80-page report, “‘Why Can’t We Go Home?’: Military Occupation of Land in Sri Lanka,” details security force occupation of land both during and after the armed conflict. It identifies the lack of transparency and due process, failure to map occupied land, inadequate support to affected people and communities, and prolonged delays in providing appropriate reparations for decades of loss and suffering. The military has also used some confiscated lands for commercial profit rather than national security and returned damaged or destroyed property to owners without compensation.

    “All those displaced during Sri Lanka’s brutal civil war are entitled to return to their homes,” said Meenakshi Ganguly, South Asia director. “Despite repeated pledges by the authorities, the military has been frustratingly slow to restore land to its rightful owners.”

    The report is based on over 100 interviews between August 2017 to May 2018 with members of affected communities, activists, local officials, and lawyers. It looks into cases of military occupation and land release in 20 areas in six districts, primarily in Sri Lanka’s north and east.

    The three-decade civil war in Sri Lanka ended with the decisive defeat of the separatist Liberation Tigers of Tamil Eelam (LTTE) in May 2009. Large areas, including those previously held by the LTTE in the north and east, came under military control. At the end of the war, some 300,000 people ended up in a military detention camp.

    While the administration of then-President Mahinda Rajapaksa released some land to its original owners, the military retained control over large areas for military but also non-military purposes, such as agriculture, tourism, and other commercial ventures.

    The new government, led by President Maithripala Sirisena, took some steps to release civilian land held by the security forces. At the United Nations Human Rights Council in October 2015, the government promised to address conflict-related issues, including returning land to its original owners. However, the government’s response has fallen far short of its promises. On October 4, 2018, the president ordered the state to release all civilian land by December 31, 2018.

    The military has also retained control of land it previously announced it would return. For instance, in April 2017, the navy responded to protests by displaced communities from the Mullikulam area in Mannar by announcing it would release 100 acres of the land that security forces had been occupying. More than a year later, people are still waiting.

    “Now there is no war,” said Francis Crooss, a village elder. “It’s now peacetime. So why can’t we go back home?”

    State agencies have exchanged properties without releasing the land to civilians. In Pallimunai in Mannar, land belonging to residents displaced since 1990 was occupied first by the army and then the police. At war’s end, the police promised to release their land and homes, but instead, the navy took control.

    “We’ve been made refugees in our own village,” said Helena Perera, one of the residents.

    All three major ethnic communities in the country – the Sinhalese, Tamils, and Muslims – are affected by military occupation of land in the north and east. However, the vast majority of cases impact the Tamil community.

    Human Rights Watch documented a number of cases in which properties were destroyed while held by the military after the war, including Hindu temples, churches, mosques, and Buddhist shrines.

    Government authorities have also carried out land grabs since the end of the war. In July 2010, the military forcibly evicted residents of Ragamwela, Panama, in southeastern Ampara district. In November 2011, 200 soldiers arrived in Ashraf Nagar village in Ampara district and demanded that all its occupants leave. In such cases, the security forces set up military camps or used the land for other purposes, including commercial use.

    The government’s failure to establish a uniform policy on resettlement remains a critical problem, Human Rights Watch said. Some displaced families did not receive proper resettlement assistance when they returned to formerly occupied lands. The government transferred others from displacement camps, but they then entered into other forms of displacement, such as living with friends and relatives, or moving to other camps closer to their original properties, which the military still occupied. Those resettled more than once were denied full resettlement assistance when their land was eventually released.

    A 70-year-old fisherman from Myliddy said his family had moved 24 times in 27 years until the military released his property in July 2017. But without resettlement assistance, he is severely in debt. “We hope the government will at least help us restart our lives this one last time,” he said.

    Partial releases pose particular problems for returnee communities. Military control of neighboring areas hinders access to services and jobs, and heightens fears of surveillance and harassment by soldiers.

    Establishing ownership of land where multiple displacements have occurred over decades is difficult, Human Rights Watch said. But instead of leaving it exclusively to the military, the government should urgently set up a transparent and consultative process, including displaced communities, to establish land claims and restore civilian ownership.

    “The government has adopted an arbitrary, piecemeal approach to land returns, which is fomenting deep distrust among communities wary that the military is still in charge,” Ganguly said. “It should address rights violations and provide remedies to end the distress of those who have long suffered because of the military’s occupation of land.”

  • Palestinians prevent Israeli settlers’ raid of Khan al-Ahmar

    JERUSALEM (Ma’an) — A group of Palestinians prevented a group of Israeli settlers from raiding the Khan al-Ahmar village east of occupied Jerusalem City, on Friday morning.

    Locals said that Israeli settlers attempted to raid the Bedouin village, threatened with demolition that is expected to take place in less than a week, to provoke residents and activists carrying out a sit-in at the village.

    Palestinian youths prevented Israeli settlers from raiding the village and forced them to leave back to the nearby main street.

    Israeli settlers were carrying Israeli flags and repeating racist slogans.

    Locals added that the settlers also called for expelling Palestinians of Bedouin areas east of Jerusalem in favor of increasing Israeli settlements in the area.

    Earlier this week, the Israeli High Court had rejected an appeal against the demolition of the village, and ordered the evacuation of its residents in preparation for its demolition within a week.

    Khan al-Ahmar has been under threat of demolition by Israeli forces; the demolition would leave more than 35 Palestinian families displaced, as part of an Israeli plan to expand the nearby illegal Israeli settlement of Kfar Adummim.

    • Demolition of Palestinian Community Imminent. Israeli High Court Green Lights Razing of #Khan_al-Ahmar

      Residents of Khan al-Ahmar thought they had found a way around Israel’s discriminatory building permit regime in Area C of the West Bank. Since a building permit is required only for concrete structures, they built their school, which serves 160 children from five villages, using clay and 2,200 old tires.

      The plan didn’t work. The Israeli army has exclusive control over planning in Area C. It has allocated just one percent of that land for Palestinian buildings, and refuses the vast majority of Palestinian permit applications.

      Khan al-Ahmar was no exception. Over the years, Israeli authorities issued demolition orders against the school and every other structure in this small village of 180 residents, just east of Jerusalem, on the grounds that they lacked permits. On September 5, Israel’s High Court rejected several appeals, and green-lighted demolition.

      Israeli military planning documents do not recognize the community’s presence, and Israeli authorities have repeatedly confiscated its land, demolished its buildings, and expelled its Palestinian residents for building without permits.

      This isn’t the community’s first displacement. In the early 1950s, Israeli forces evicted residents from the Tel Arad district of the Negev desert. The community fled to the West Bank and built a village in the current location. They registered as Palestine refugees with the United Nations.

      In 1977, Israel established the settlement of Ma’ale Adumim, allocating it the land on which Khan al-Ahmar sits.

      International law prohibits an occupying power from destroying property, including schools, unless “absolutely necessary” for “military operations.” Transferring civilians within an occupied territory, either by direct force or indirect coercion into a place not of their choosing, is a war crime under the International Criminal Court’s statute.

      Israeli officials should know that the demolition and any resulting displacement of the population may subject them to criminal investigation.

      Other states also have a duty to ensure that the Geneva Conventions are respected, and should make clear to Israeli officials that, if the demolition goes ahead, people implicated in any criminal acts could be investigated and prosecuted by domestic authorities outside of Israel where they have jurisdiction.

      Global condemnation alone has not stopped serious war crimes during Israel’s 50-year occupation. Action and justice is long overdue.

  • Unending Repression in Thailand 4 Years After Coup. Hopes Dim for Democratic Restoration

    Four years after the Thai military seized power on May 22, 2014, Thailand is nowhere near what the ruling junta promised would be a rights-respecting, democratic country.

    The coup leader, Prime Minister Gen. Prayut Chan-ocha, wields unchecked power with total impunity. Since the coup, the ruling National Council for Peace and Order has routinely enforced censorship and blocked public discussions about the state of human rights and democracy in Thailand. Hundreds of activists and dissidents have been prosecuted on criminal charges such as sedition, computer-related crimes, and lese majeste (insulting the monarchy) for the peaceful expression of their views. Public gatherings of more than five people and pro-democracy activities are prohibited. Thousands have been summoned and pressured to stop making political comments against the junta. Military authorities continue to secretly detain people for up to seven days without charge and interrogate them without access to lawyers or safeguards against mistreatment.

    Prayut has repeatedly made, and then broken, promises about election dates and a return to civilian rule. His latest promise is to hold elections by February 2019, but there is little reason to believe that, if held, they will be free and fair. The junta has indicated that some leading politicians and political parties will be banned, while restrictive laws mean that voters and the media will have their arms twisted and their mouths gagged.

    Despite this, more and more Thais from all walks of life have come forward to challenge the military dictatorship – including by holding peaceful rallies in Bangkok and other provinces demanding that the junta lift restrictions on fundamental freedoms.

    Now more than ever, concerned governments need to press for a transition to civilian democratic rule. The United States, the European Union, Japan, and other friends of Thailand have repeatedly said that bilateral relations will only be normalized when democracy is fully restored through a free and fair election. They should publicly stress that a legitimate election requires more than an orderly election day, but a political context in which all are freely able to express their views and participate in the electoral process without fear of arrest.

    Four years after waking up to a military coup, Thais finally need to know that their country is on the path to a genuine, rights-respecting democracy.

    Le rapport de 57 pages, intitulé « ‘Our Homes Are Not for Strangers’ : Mass Evictions of Syrian Refugees by Lebanese Municipalities » (« “Nos maisons ne sont pas pour les étrangers” : Expulsions de masse de réfugiés syriens par les municipalités libanaises »), souligne l’incohérence des motifs invoqués par les municipalités pour justifier l’expulsion de Syriens, et révèle l’incapacité du gouvernement central à protéger leurs droits. Le haut commandement militaire devrait suspendre les agents impliqués dans les #abus en attendant les enquêtes et veiller à ce que tous les détenus soient traités avec humanité et remis rapidement aux gendarmes du gouvernement.

    Les enquêtes devraient inclure les décès en détention de 27 hommes et les tortures sévères à l’encontre de deux autres détenus en février, mars et avril 2018 lors de l’opération Dambe, une offensive majeure qui s’est intensifiée début 2018 dans la région de Mopti, au centre du Mali. L’armée a indiqué qu’elle enquêtait sur deux des cas signalés. Étant donné que l’armée a omis de traduire en justice des militaires impliqués dans des abus antérieurs, une enquête indépendante du ministère de la Justice sur la série actuelle d’abus est cruciale, selon Human Rights Watch.

    • Erdogan crackdown, Syria war seen fueling migrant flows to Greece

      Over the previous week, a record 1,500 migrants and asylum-seekers crossed the Evros River border, most of them Kurds from Syria and Iraq, as well as self-professed critics of the Erdogan regime. Most turn themselves into Greek authorities, waiting to be formally identified and transferred to reception centers.

      Greek officials are concerned that arrivals via Evros will rise as dry weather has resulted in lower water levels in the river.

      Another key factor, military and police sources have told Kathimerini, is that Turkish authorities appear less willing than before to stem inflows. They say that the ease with which traffickers and migrants are able to reach the Turkish side of the border – despite Erdogan’s decision to reinforce Turkey’s land border with thousands of pro-government military border guards – suggests that the authorities have either been ordered to turn a blind eye to widespread trespassing or are susceptible to bribes. Additionally, analysts say that the fact that the vast majority of migrants are Kurds from war-torn Afrin in Syria and from Iraq, whose presence in Turkey would be a headache for Erdogan, amplifies skepticism over the true motives of Turkish authorities.

      “The Turks are doing in Evros what we did in Idomeni in the beginning [of the crisis],” a source said in reference to the now-defunct border camp on Greece’s frontier with the Former Yugoslav Republic of Macedonia. “We simply facilitated the refugee flows so that they could move on to Europe through Skopje.”

      Meanwhile, sources say that the channels of communication between Greek and Turkish border guards, which in the past facilitated the arrest of migrants and smugglers before the attempted crossing, have been clogged amid deteriorating bilateral ties. The arrest of two Greek soldiers in early March after they accidentally crossed into Turkish territory has made Greek patrols more restrained in their operations.

      Greece plans to reinforce its border force with an additional 150 guards as of May 1.

    • Concern as rising numbers cross from Turkey to Greece via Evros

      Over a thousand people have crossed the Evros river, marking the land border between Turkey and Greece, since March this year. Last week over one hundred people arrived each day and 340 people arrived on Tuesday alone. This has led to concerns from authorities and NGOs that an emergency situation is unfolding.

      Many of the people crossing the border have ended up sleeping in the parks and squares of the city of Thessaloniki, waiting for a place in a camp. There are also reports of hundreds of people waiting outside police stations, to get arrested in order to gain temporary residence. The municipality has expressed concerns that the city may experience similar circumstance as the events of 2015, where thousands of people slept on the streets across Greece. Local and national migration authorities have scheduled a meeting for Saturday to discuss the situation. The Migration Policy Minister Dimitris Vitsas expressed his concerns about the increase of arrivals and announced his ministry has developed two plans to deal with the situation, which he will share privately with party leaders.

      Arrivals have also been increasing on the Aegean islands, with arrivals on Lesvos almost four times the amount of last year. Minister Vitsas said “I’m not scared about the islands because we know what we have to do. What is really worrisome is the huge increase through Evros.” A concern also raised by the Head of the International Federation of the Red Cross (IFRC) in Greece, Ruben Cano: “This is not the route most people take to reach Greece – it’s a worrying development. The summer will see river levels drop which could also lead to a further rise in people braving the journey.”

      The situation for refugees in Greece has been increasingly tense after incidents on Sunday, where a group of asylum seekers who had been occupying the central square in Mytillene, Lesvos to protest reception conditions and long asylum processing times, were attacked by over a hundred far right extremists. The attackers threw projectiles, including bricks and flares. The Mayor of Lesvos, Spyros Galinos, wrote to Minister Vitsas and the Citizen’s Protection Minister Nikos Toskas, saying, “Lack of action and poor management has resulted in nearly 10,000 asylum seekers being trapped in miserable conditions around a town of 27,000 residents and has created intense fear in the local community; a community that has lost its sense of security and after last night’s events its cohesion too.”

      The state of affairs in Turkey following the failed coup-attempt of 2016, the humanitarian impact of the war in Syria and deteriorating diplomatic ties between Greece and Turkey are cited as reasons for the increase of crossings of mainly people of Kurdish descent from Syria and Iraq and Turkish nationals.

    • Le HCR demande à la Grèce d’améliorer la situation à Evros

      Le HCR, l’Agence des Nations Unies pour les réfugiés, demande au gouvernement grec d’améliorer de toute urgence les conditions de vie et les capacités d’accueil des réfugiés dans la région d’Evros, à la suite d’une récente augmentation des arrivées via la frontière terrestre avec la Turquie. Des centaines de personnes sont actuellement maintenues dans des centres de détention de la police.

      Environ 2 900 personnes sont arrivées à Evros ce mois-ci, principalement des familles syriennes ou iraquiennes. Cela représente près de la moitié des arrivées enregistrées pour l’ensemble de l’année 2017. Selon les données recueillies par le HCR, les arrivées par voie terrestre ont dépassé le nombre d’arrivées par la mer au mois d’avril. Au moins huit personnes sont mortes depuis le début de l’année en tentant de traverser le fleuve Evros.

      Cette augmentation des nouvelles arrivées met à rude épreuve l’unique centre d’accueil et d’identification d’Evros, situé à Fylakio. Ce centre a dépassé sa capacité maximale d’accueil de 240 personnes, dont 120 enfants non accompagnés ou séparés de leur famille.

      Etant donné que le centre d’accueil et d’identification est submergé et qu’il peine à procéder à l’enregistrement et à l’identification des réfugiés, à fournir des services d’ordre médicaux, psychosociaux ou d’interprétation, les autorités ont placé des personnes, dont de nombreux enfants, dans des centres de détention de la police éparpillés dans la région et inadaptés à la situation, dans l’attente que des places se libèrent.

      Certaines personnes sont maintenues depuis plus de trois mois dans des centres de détention de la police. Les conditions de vie y sont désastreuses et les services y sont limités au strict minimum. Lors d’une visite sur place, les équipes du HCR ont découvert des familles qui dormaient à même le sol dans les couloirs à côté des cellules. Dans un autre établissement, on comptait à peine un médecin et quatre infirmières pour plus de 500 personnes. Parmi les centaines de personnes maintenues dans ces conditions, on dénombre des femmes enceintes, de très jeunes enfants et des personnes qui ont besoin de soins médicaux ou d’une aide psycho-sociale.

      Nous nous réjouissons de la décision qui a permis de libérer plus de 2 500 personnes détenues par les autorités mais nous sommes préoccupés par les conditions dans lesquelles ces libérations ont été réalisées, à savoir sans vérifier la vulnérabilité des personnes concernées et sans leur fournir suffisamment d’informations au sujet de l’asile ou de leurs autres options. Leur situation doit être examinée de toute urgence afin de leur permettre l’accès à des soins et aux procédures d’asile.

      Nous saluons les efforts menés par la police et par le centre d’accueil et d’identification de Fylakio en vue de relever les défis auxquels ils sont confrontés mais, face à des ressources de plus en plus limitées, la situation est devenue intenable.

      Le HCR suggère plusieurs mesures :

      Accroître d’urgence la capacité d’accueil du centre de réception et d’identification, en y augmentant le nombre de places disponibles et en y améliorant les conditions de vie et les services ;
      Identifier des lieux de transit ouverts, vers lesquels pourront être dirigées les personnes qui arrivent d’Evros et où l’enregistrement et l’identification pourront être réalisés ;
      Mettre en place des équipes mobiles d’enregistrement et d’identification ;
      Transférer immédiatement les familles en détention vers des abris sûrs et les guider vers les services dont elles ont besoin ;
      Améliorer les conditions de vie dans les centres de la police, y compris pour des périodes de courte durée, en y assurant l’accès à des espaces communs et à des services élémentaires, notamment et en priorité des soins de santé ;
      Augmenter les capacités d’enregistrement des autorités grecques compétentes afin de garantir l’accès aux procédures d’asile et l’enregistrement des demandes en temps opportun ;
      Transférer rapidement les enfants non accompagnés vers des lieux sûrs et procéder rapidement à une évaluation de leur situation et des liens familiaux.

      Le HCR continue de fournir son appui en matière de protection au centre d’accueil et d’identification de Fylakio, et reste en contact étroit et régulier avec le gouvernement grec afin de faire face à cette situation exceptionnelle. Le HCR continuera d’aider les autorités grecques en fournissant un soutien technique et matériel, notamment des couvertures, des vêtements, des articles d’hygiène, des lampes à énergie solaire et d’autres articles non alimentaires.

    • La rivière Evros, point de passage des clandestins entre la Turquie à la Grèce

      Les migrants multiplient les tentatives pour passer le fleuve qui marque la frontière, en dépit de la pression exercée par les polices turque et grecque.

      Rivière tumultueuse qui marque la frontière entre la Turquie et la Grèce, à 75 kilomètres de la ville d’Edirne, en Thrace orientale, l’Evros est l’une des portes d’entrée des migrants en Europe. Si les candidats au départ prennent moins souvent les bateaux pour rejoindre l’Union européenne via les îles grecques, ils optent toujours pour la traversée de la rivière Evros, réputée – à tort, car il existe des cas de noyades – moins dangereuse que celle de la mer Egée.

      Ces passages de migrants redoublent après la décrue printanière du fleuve, comme en témoignent les sacs plastique, les vêtements abandonnés et les canots pneumatiques dégonflés qui jonchent ses berges. Ces tout derniers mois, le rythme s’est encore accéléré. Les autorités grecques faisaient état d’une moyenne de 44 arrivées par jour dans la zone en 2017. Elles sont passées à 62 en janvier et février 2018, puis à 200 les mois suivants. « En avril, nous avons enregistré 2 700 arrivées pour la région d’Evros », a déploré Dimitris Vitsas, le ministre de la politique migratoire, lors d’un débat parlementaire sur les réfugiés, mardi 24 avril.

      « Chaque jour, je vois des réfugiés. Je les croise quotidiennement dans mes champs ou le long des sentiers qui mènent au village », confirme Erdogan Adali, le chef de l’administration du village d’#Akcadam, situé à 3 kilomètres du fleuve. « Ça me fend le cœur. Ils sont dans un état pitoyable, hagards, pieds nus, affamés. Je leur donnerais volontiers le gîte et le couvert, mais c’est un délit, je ne peux pas. Dès que je les vois, je suis obligé d’alerter les gendarmes qui viennent les chercher pour les ramener au centre de rétention d’Edirne », raconte l’agriculteur au visage buriné, dont les rizières et les champs de blé jouxtent le village.

    • Greece: Asylum-Seeking Women Detained with Men. Urgently End Dangerous Detention Conditions

      Greek authorities are routinely confining asylum-seeking women with unrelated men in the northern Evros region, at the land-border with Turkey, putting them at grave risk of sexual violence and harassment. Authorities should immediately stop holding asylum-seeking women and girls in closed facilities with unrelated men.

      Human Rights Watch research in Northern Greece in late May 2018 found women and girls housed with unrelated men in sites for reception and/or detention of asylum seekers. Twelve women and two girls interviewed said they had been locked in cells or enclosures for weeks, and in one case for nearly five months, with men and boys they did not know. Four said they were the sole females confined with dozens of men, in some cases with at least one male partner or relative.

      “Women and girls should not be confined with men who are complete strangers, even for a day,” said Hillary Margolis, women’s rights researcher at Human Rights Watch. “These women and girls came to Greece seeking security and protection, and instead they are living in fear.”

      Five women said they had severe psychological distress as a result, including two who had suicidal thoughts. Other women and girls said they experienced sleeplessness, anxiety, and other emotional and psychological distress, in part due to fear of confinement with unrelated men.

      The Greek government has not provided authorities in northern Greece with sufficient resources to respond to a surge in arrivals over the land border with Turkey in April. Officials who met with Human Rights Watch acknowledged that the increase led to a slowdown in reception and identification procedures, including registration of asylum claims, as well as overcrowding of and lengthier stays in reception and immigration detention facilities.

      Pending completion of reception and identification procedures, newly-arrived irregular migrants and those seeking international protection are held in border police stations in the Evros region, in the Fylakio pre-removal detention center, run by the Hellenic Police, and/or in the Fylakio reception and identification center (RIC), run by the Ministry for Migration Policy. The Ministry and the Hellenic police granted Human Rights Watch access to these sites, and authorities at the pre-removal detention center and RIC helped identify female migrants in the facilities so that Human Rights Watch could approach them for interviews.

      Eight women and one of the girls said they had been held in cells with unrelated men in Fylakio pre-removal detention center, including six women who were held with unrelated men at the time of the interviews. Five women and the two girls were housed with unrelated men in pre-fabricated containers and locked, fenced-off “sections” in the Fylakio RIC at the time of the interviews. Some said they were held with unrelated men in multiple facilities.

      Two of the women said they had been at the pre-removal center in cells with their male partners and many unknown men for at least two weeks. “Maha,” a 38-year-old woman from Iraq, was visibly shaking as she described being the sole woman in a cell with about 60 men for over two weeks. Maha said she avoided drinking water due to fear of using the shared toilet inside the cell. She said that she was living almost exclusively inside an enclosure she and her partner created by hanging blankets around their bunkbed.

      “I haven’t moved my legs for 23 days,” she said in tears, demonstrating how she cowered with her knees hugged to her chest all day. “If I had a way to kill myself, I would have.”

      According to a police registry given to Human Rights Watch researchers, at the time of the interview she and her partner were held in a cell with 32 unrelated men. Maha was released days after her interview, but her partner remained in detention.

      Some women and girls said they were housed with unrelated men at the RIC for weeks or months. “Suraya,” a woman in her twenties (nationality withheld) in the RIC with her four-year-old nephew while awaiting confirmation of their family links, spent nearly five months in a section she said housed only men and unaccompanied boys. She said a fellow asylum seeker sexually assaulted her. “He started touching me while I was sleeping,” Suraya said, adding that he left when she screamed, and she reported it to authorities. “I have asked [them] to take me to a safer place here, or to another camp, but nothing has happened,” she said.

      Authorities at the pre-removal detention center said there is a separate designated cell for women traveling alone, but they also put families in that cell “if necessary,” such as during periods of overcrowding. The facility was under capacity when Human Rights Watch visited, but two single women said they were in a cell with unrelated families. Authorities in both the pre-removal detention center and the RIC acknowledged gaps in response at the facilities, which they attribute largely to a dearth of resources.

      National and European law as well as international standards require that men and women be held separately in detention, including reception and immigration detention facilities, unless they are members of the same family and consent to being held together. They also call for separating unaccompanied children from adults, and separate accommodation for families. A 2016 order issued by the Headquarters of the Hellenic Police instructs police to separate women and children from unrelated men in closed facilities.

      Greek authorities should ensure the safety and security of all asylum seekers, including by providing single women, single men, families, and unaccompanied children with separate accommodation, toilets and bathing facilities in all immigration detention sites and other closed facilities. Authorities should urgently fit all rooms, bathrooms, and containers in RICs with locking doors to facilitate security and privacy.

      When necessary, authorities should urgently transfer single women, unaccompanied and separated children, and families including couples in immigration detention to accommodation or facilities that meet these standards. Authorities should also ensure that asylum seekers have a safe and confidential means to report sexual harassment or assault, and that such reports are promptly investigated, those responsible are appropriately punished, and immediate measures are taken to ensure victims’ safety and well-being.

      “Women and girls in these sites are overcome by fear from being locked up with men who are complete strangers,” Margolis said. “Greek authorities need to put an urgent stop to this, and grant them the security, privacy and dignity they deserve.”

      Accounts from asylum seekers in Fylakio pre-removal detention center and the reception and identification center (RIC) in Fylakio, Greece:

      Fatima (all names have been changed), 24, from Algeria, who had been at the pre-removal center with her husband for 20 days: “For 20 days I have been the only woman [in our cell]. The others are all single men. I had difficulty at the beginning. I sleep at night covered in a blanket. One night a man [in the cell] came and lifted the blanket and was looking at me. When I go to take a bath, the men come and try to look over the wall…. I am very stressed…. I feel like I have reached the bottom. I feel like I am broken.”

      Suha, 20, from Morocco, who had been in the Fylakio pre-removal detention center with her husband for two weeks. At the time of the interview, they were in a cell alone, but they had previously been in the same center for two weeks in a cell with mostly men: “There were two other girls and 60 to 70 men [in the cell] … I was fighting for myself every day … The worst time was when I would go to the toilet. All of them would follow me with their eyes, say things. Some men, when they see a woman they act like animals. They would call out to me, ‘Stand up, stop here, let us look at you, you’re beautiful.’ The toilets are mixed [for men and women.] The bath is the same. There is no lock on the door. If you sit, they can’t see you [over the wall]. But if you stand they can see you from the chest up. Imagine being a woman in those conditions.”

      Samira, 18, from Syria, who had been in the RIC with her 15-year-old sister for three weeks: “Since I’ve been here I’m unable to eat. I’m very stressed. I can’t leave my sister, I have to take care of her…. I’m constantly afraid that someone will enter our container. I don’t sleep at night – I stay awake during the day and sleep in the morning… I only shower once every two weeks because I feel like people are watching me [in the bathroom] … I wake up every morning at 3 a.m. feeling scared and nervous.”

      Nada, 16, from Syria, who had been in the RIC with her older brother and sister for nearly two months: “We’re the only family in our section, it’s all single men. The only women are me and my sister. Everyone is afraid here. There are more than 20 men [or unaccompanied boys] living in our section…. At first, we were 20 people in the [same] container, but they have all left. It was mixed men and women. We didn’t feel safe and couldn’t sleep. We stayed up all night…. We shared the toilet with strangers. I used to take my sister with me and ask her to wait at the door.”

      Nadir, 21, from Syria, who had been in the RIC for 20 days with his 6-year-old niece, Abra, whose mother became separated from them during the crossing from Turkey to Greece: “We are in the same container with two families…. The doors don’t lock…. The families staying with us are Iraqi Kurds. We can’t communicate with them – how can we feel safe? It is not a question of nationality, it is just that they are strangers. I can’t leave [Abra] alone. If she wants to go outside, I go outside; if she wants to go to the toilet, I go with her. There are single men [or unaccompanied boys]. If you come at night around 10 p.m. you will hear the noises they make [yelling] and understand why we don’t feel safe.”

      Abbas, 35, from Iran, who had arrived at the Fylakio pre-removal detention center with his wife, 36 the previous day: “When we reached here, [the police] said, ‘You have to be separated [from your wife].’ I said, ‘No, we can’t be separated, we are a couple.’ Then the police said, ‘If you don’t separate, you’ll both have to go to the room with all the men.’ My wife was shocked and started crying. She was really scared. I said, ‘Okay, let’s separate.’ I kissed her, said goodbye, and they put her in another room and me in the room with all the men.” Eventually, he said, the police brought his wife to a cell opposite his and then put them together in that cell, along with unrelated families.

      Additional Information on Combined Detention of Women and Men

      In interviews with twelve women and two girls from May 19 to 24, eight women and one girl said they had been held in cells with unrelated men in Fylakio pre-removal detention center, including six women who were held with unrelated men at the time of the interviews.

      Women at the pre-removal center said that combined toilet and bathing stalls in cells they shared with men did not have floor-to-ceiling walls, and they were harassed by male cellmates while using them. One 24-year-old woman, in a cell with her husband and 20 single men, said men attempted to watch her over the wall while she used the toilet.

      Six women and two girls told Human Rights Watch they were also housed with unrelated men at the RIC, sometimes for weeks or months, in pre-fabricated containers and “sections,” which are fenced-in, locked enclosures containing a courtyard and multiple containers housing migrants and asylum seekers. Five women and two girls were being held with unrelated men and/or boys at the time of their interviews at the Fylakio RIC.

      Assignment to sections is based primarily on nationality. Awaiting confirmation of age, placement in designated accommodation, or establishment of family links to other asylum seekers can result in lengthy stays for unaccompanied or separated children and their non-immediate family members.

      Two unrelated girls, ages 15 and 16, each said they had been in these sections in the RIC with unrelated adult men and/or boys for over three weeks; one said she and her 30-year-old sister had been the only females in a section with 20 men and/or boys for about 45 days. One 19-year-old pregnant woman who was there with her husband and in-laws said her container housed multiple unrelated families in one shared room.

      Some women and girls, as well as a man with his 6-year-old niece, said they and their family members live in rooms inside containers shared with unrelated families including men or boys. In all cases, they said they share toilets and bathing facilities with men and/or boys, and that no containers or bedrooms have locking doors.

      Detention of Migrants and Asylum Seekers in Greece

      Under Greek law, authorities may restrict the movement of new arrivals for up to 25 days at a reception and identification center (RIC) and up to a total of six months in immigration detention, including at pre-removal centers. Unaccompanied and separated children may be held longer pending resolution of their cases and reunification with family members, particularly when age or family links are in question, or pending available space in designated sites with protected areas or shelters.

      Upon arrival in the Evros region in northern Greece, where the land-border with Turkey is located, irregular migrants and those seeking international protection are held in border police stations, a pre-removal detention center, and/or a RIC, pending completion of reception and identification procedures. Following these procedures, new arrivals may be detained for processing or assessment of their asylum claim, or for deportation.

      While the increase in arrivals in April temporarily strained asylum identification, registration, and accommodation services in Northern Greece and the Evros region, authorities are responsible for ensuring the safety and security of asylum seekers throughout registration and identification processes. Increased arrivals do not justify the Greek government’s failure to protect women and girls, or to allow dangerous conditions to persist even after arrivals have decreased.

      During Human Rights Watch visits to sites in the Thessaloniki area and in Evros, authorities said that arrivals had returned to a normal range over the previous two weeks. On May 19, authorities at Fylakio pre-removal detention center said the site has a capacity of 374 and was housing only 172 people. On May 21, authorities at the RIC, which has a capacity of 240, said it was housing 196. Nevertheless, Human Rights Watch found women and girls being held with unrelated men and boys.

      On June 1, following an April ad hoc visit to Greece, the Council of Europe Committee for the Prevention of Torture and Inhuman or Degrading Treatment or Punishment reported the detention of men, women, and children together in a single cell at the Fylakio pre-removal center, consistent with the Human Rights Watch findings in May.

      Authorities said they give priority to members of “vulnerable” groups for registration, processing, and transfer to appropriate accommodation. Under Greek law this includes unaccompanied or separated children, people with disabilities, pregnant women and new mothers, single parents with minor children, and victims of sexual violence, torture or other severe psychological or physical trauma. The authorities acknowledged that unaccompanied or separated children – and sometimes their family members – may be accommodated for lengthy periods in the RIC due to limited spaces in designated “safe” facilities and lengthy processes for verifying family links.

      The Greek government’s failure to accommodate men, women, and children separately in immigration detention is a longstanding problem, including in Evros. The European Court of Human Rights and multiple other international human rights bodies have criticized inhumane and degrading conditions in Greek immigration detention facilities, including failure to separate women and children from unrelated men. Human Rights Watch has previously documented violence, insecurity, sexual harassment, and unhygienic and unsanitary conditions in facilities for registration, identification, and processing of asylum seekers on the Greek islands, or “hotspots.” Human Rights Watch has also found women traveling alone housed with unrelated men in island hotspots.

    • Greek Authorities’ Struggle to Identify Dead Evros Migrants

      The worsening humanitarian situation on Greece’s land border with Turkey, is drawing international media attention.

      As the local authorities also face the challenge of identifying the bodies they recover from the frontier river, the UN Refugee Agency (UNHCR) has already called on the Greek government to urgently improve conditions and expand reception capacity in the north east.

      This follows a recent rise in arrivals in the Evros area across the land border with Turkey.

      In one report, Britain’s BBC investigates how people fleeing from Iraq and Syria as well as other countries like Iran and Afghanistan, put themselves at risk while trying to cross the dangerous waters of the Evros.

      The BBC dispatch covers the work of local people like Professor Pavlos Pavlidis of the Alexandroupoli State Hospital. A forensic surgeon, he has built up a huge database of photos, personal items and DNA samples taken from unidentified people who have perished while crossing into Greece.

      Sometimes, his work allows for a victim to be identified: “It gives an answer, even if it is a sad answer,” he says.

    • Unprepared and overwhelmed: Greece’s resurgent river border with Turkey. When an old migration route became new again, the Evros region was caught on the back foot.

      Locals in Evros are used to new faces. People have been quietly slipping across the river that forms a natural barrier for all but 12 kilometres of the tense, militarised border between Greece and Turkey since Greece joined the European Union in 1981.

      But everyone on the Evros River was puzzled when a crush of hundreds of migrants and asylum seekers began crossing their sleepy riverine border every day in March. Six months later, arrivals have slowed but worries persist that the region is still poorly prepared for any new influx.

      At the rush’s height in April, more than 3,600 crossed the river in one month, surpassing the total number of people arriving in Greece by sea for the first time since 2012. They came across the Evros on plastic dinghies, and once on Greek soil they were picked up by smugglers in cars or continued the journey by foot. The banks of the river were littered with discarded clothes, water bottles, food and medicine packages, and flotation devices, which remain there today.

      Despite its history of migration, Evros, one of Greece’s poorest regions, was caught off guard. Hundreds of new arrivals were crammed into police stations, waiting for months to lodge their asylum claims. There were no NGOs to help out. Conditions were dismal, and services limited.

      “We are all surprised with the rise in arrivals in Evros, and the lack of Greek preparation,” said Georgia Spyropoulou, an advocacy officer with the Hellenic League for Human Rights, from her office in Athens.

      Greek officials say they were caught unawares too, with a local police commissioner telling the UN’s refugee agency, UNHCR, in June that “it is necessary to be prepared in case there is an increase in arrivals again.” Still, local police insisted they were doing the best they could with the resources available to them.

      No one is quite sure what prompted the flood of people in the first place. And plenty of of people are still making their way to Evros – 9,480 by the end of July, taking a gamble on a border that looks safe but can be deadly – 29 people have died this year during the crossing or shortly after.
      Border police and barn doors

      Before 2012, and before millions of people began landing on Europe’s beaches and drowning in the Mediterranean, Evros (known as the Meriç River in Turkish) was the main crossing point for those hoping to make it into Europe through Greece.

      Amidst mounting pressure from other EU countries to further seal its borders (Austria’s interior minister famously said Greece was “open like a barn door”), Athens launched Operation Aspida (“Shield”) in 2012, deploying 1,800 more police officers and erecting a fence on the land portion of the border, adding to a 175-strong rapid border intervention team known as RABIT – set up in 2010 with the help of Frontex, the EU border agency.

      Those who made it alive to the Greek banks of the Evros this year found a system wholly unprepared for their arrival.

      The new measures worked, and by November 2012 migrant arrivals had dwindled to none – a remarkable decrease from 6,500 in August that year.

      Athens denies reports of pushbacks of asylum seekers, but human rights watchdogs have documented collective expulsions in which people are forced back into Turkey after already crossing the river, and the UN has also raised concerns.

      Despite the crackdown, the numbers began to creep up again slowly this March. And then the spring rush came.
      Understaffed and unprepared

      Those who made it alive to the Greek banks of the Evros this year found a system wholly unprepared for their arrival.

      The procedure is supposed to be simple: new arrivals are brought to “pre-removal detention centres” run by the Hellenic police, where they wait for no more than seven days to be fingerprinted and have their asylum claims registered at the region’s one official Reception and Identification Centre (RIC) in the small village of Fylakio.

      But it proved to be anything but.

      The RIC was understaffed and overwhelmed by the numbers, causing the sorts of major delays in processing that have plagued the reception system on the Greek islands.

      In a scathing review of Evros in the springtime, UNHCR criticised the detention of new arrivals in sub-standard police facilities. Human Rights Watch also found troubling conditions in May: women and girls were being held with unrelated men. One woman told the watchdog she was sexually assaulted by a fellow asylum seeker; her requests to be transferred to another location were ignored.

      After asylum seekers’ claims are processed, they are moved to the RIC itself, which has a 240-person capacity.

      Unlike on the Greek islands and its controversial policy of containment, people in Evros are allowed to move about the country. After applying for asylum, most head to other government- or UN-run camps elsewhere in the country. Still, even the RIC facility quickly became overrun as unaccompanied minors and those likely to have their asylum claims rejected had to stay on.
      Improvements

      When IRIN visited Fylakio in July, it found the RIC camp no longer overcrowded, and newly arrived asylum seekers expressed relief at being out of the pre-removal detention centre. “That was a very bad place,” one Turkish arrival said, declining to elaborate.

      IRIN was not granted access to the nearby pre-removal detention centre. But despite Greek police releasing many migrants from police detention, a HRW report from July said conditions in Fylakio remained “inhumane”, describing “dark, dank cells, with overpowering odours in the corridors”, a lack of toilets and locked doors, and insufficient healthcare.

      There have been some improvements for those out of their first detention, and NGOs have arrived to help: ARISIS, a Greek non-governmental organisation that provides social support for minors, had recently set up a makeshift office, and Médecins Sans Frontières has now established a permanent outpost in Fylakio.

      But one RIC employee said they remain understaffed. “We have the experience and motivation to manage the situation,” but not the manpower, the employee said, asking to remain anonymous because they were not authorised to speak to the media.

      Staff work in two shifts. When IRIN visited, the centre’s director was on sick leave, and there were still no doctors on staff, and only three nurses.

      In one crowded container at the RIC centre, an Iraqi family was living alongside the body of a dog that had died the previous week – its body still hadn’t been removed, and the stench lingered. The mother was concerned for the health of her infant, who was in hospital. Because members of the family, including the mother, are minors, they are currently stuck in limbo, waiting at the RIC.

      Communication remains a constant issue. There are no official, permanent translators and the overwhelming majority of the centre’s staff only speaks English or Greek.

      “There are asylum seekers who are interpreting for other asylum seekers… [which is] completely inappropriate,” Eva Cosse, Western Europe researcher for HRW, told IRIN.
      What’s next?

      Months after the springtime surge at Evros, there is still confusion about what caused it – and if there’s any way to predict if the same thing might happen again. Everyone, it seems, has a theory.

      “The waves of migration increase in populations when there are serious issues in the country of origin,” Nikolaos Menexidis, the barrel-chested police major general of Western Thrace, told IRIN from his headquarters in the town of Kommini. “When Turkey created the latest issues in Afrin, we saw a rise in numbers.”

      It’s true that following Turkey’s assault on the Syrian Kurdish enclave of Afrin – militias supported by Ankara took control in March – the majority of those recorded crossing in the spring were Syrian Kurds and Iraqis.

      But that doesn’t explain the drop in other nationalities who have long used the river crossing, like asylum seekers from Pakistan, countered Dimitros Koros, a lawyer with the Greek Council of Refugees.

      Some people may be driven by politics – Turks who had fled and made it to the RIC in Fylakio said they had been wrongly accused of terrorist activity at home or suspected of ties to the Gulen movement, which President Recep Tayyip Erdogan blames for the 2016 attempted coup in his country. Others may have just heard there was a chance to make it to Europe at the river.

      Whatever the reason for the surge, migrants and asylum seekers people will likely continue to take their chances on the way to Greece. And Koros, the lawyer with the Greek Council for Refugees, worries that new arrivals will continue to struggle, as they move away from the squalid conditions at the border itself and into a wider region unequipped to help.

      “Evros is not just the border,” he said. “Evros is here in Thessaloniki. They are here, homeless, without any provision of service.”

    • An open secret: Refugee pushbacks across the Turkey-Greece border

      On an eastern frontier of the European Union, people are whisked back to Turkey before they can claim asylum in Greece.

      Linda, a 19-year-old Syrian and registered refugee, had just crossed from Turkey into Greece at the Evros River when men carrying guns appeared, seemingly out of nowhere. She wasn’t sure if they were police officers or soldiers, but they emerged from behind trees and wore dark uniforms that helped them blend into the night.

      It was mid-May, and several hours earlier Linda had boarded a mini-bus in Istanbul with around 35 other people, including children and a pregnant woman, eager to enter European Union territory. The trip had been organised by smugglers, and the passengers ended up in a remote area close to the northwestern Turkish city of Edirne. At around three in the morning they boarded small boats that ferried them across the river.

      Linda’s plan was to get into Greece, then make her way to Denmark, where her fiancé lives. Her crossing was part of a sharp uptick in traffic into the EU via the Evros (known as the Meriç in Turkish) this spring; 3,600 people are known to have crossed in April alone, compared to just over 1,000 in all of 2013.

      But she didn’t make it more than a few steps into EU territory before she was stopped.

      The men demanded that everyone in the group hand over their mobile phones. “Then they beat the men who were with us, put us in a boat, and sent us back to the Turkish side of the border,” Linda recalled when she spoke to IRIN recently in Istanbul.

      Pushbacks like the one Linda experienced have been going on for years, documented by both human rights watchdogs and the UN’s refugee agency, UNHCR. They are also illegal under European and international law.

      “The right to claim and enjoy asylum is a fundamental human right," Leo Dobbs, a UNHCR spokesman in Greece, told IRIN. Pushbacks at the Evros border, he added, are a “serious issue.”

      According to a report released by the Greek Council for Refugees in February, before the spring rush, pushbacks have increased to the point of being “systematic” as the number of people crossing the Evros has grown slowly in the past two years.

      The Evros River border between Turkey and Greece is one of the easternmost frontiers of the European Union. Until a fence went up on all but 12 kilometres of the Evros in 2012, it was the easiest and safest path for asylum seekers from the Middle East and elsewhere to reach Europe, and nearly 55,000 people crossed the border irregularly in 2011.

      A controversial 2016 EU-Turkey deal that paved the way for asylum seekers to be returned from the Greek Islands to Turkey (which it deems safe under the terms of that agreement), does not apply to the Evros border. Instead, there is a separate, largely ineffective bilateral readmission agreement dating from 2002 that was suspended earlier this year.

      Even under the terms of that agreement, pushbacks like the one Linda experienced violate European and international laws on refugee protection, which require states to allow asylum seekers to file for protection and prohibit sending them back to countries where they may face danger. While countries are allowed to protect their borders, they cannot legally return people who have already crossed without first evaluating their claims.

      Pushbacks may be illegal, but they are an open secret. “It’s something that everybody knows,” said Dimitris Koros, a lawyer with the Greek Council for Refugees. Now, when an asylum seeker enters Greece from the land border, “the first thing you encounter is the possibility of being pushed back,” he added.

      The Greek Ministry for Migration Policy did not respond to IRIN’s requests for comment, but the Greek government has repeatedly denied it is engaged in systematic pushbacks.

      Human rights organisations say they have raised the issue of responsibility with the Greek government multiple times without receiving a response. “It’s a difficult thing… to say that the government instructs or gives orders to the policemen to do it,” Konstantinos Tsitselikis, a human rights law professor and former director of the Hellenic League for Human Rights said, “but they have the knowledge and they tolerate it at least.”

      It’s unclear just how many people have been pushed back or who is responsible, because the area around the border is a closed military zone and there aren’t many NGOs working in the region.

      Meanwhile on the Turkish side of the river, security forces regularly apprehend people attempting to cross and transfer them to government-run detention centres. But amidst a pervasive atmosphere of fear and silence, the treatment of asylum seekers and migrants after they are pushed back and detained largely remains a mystery.
      A longstanding practice

      According to Tsitselikis, pushbacks have been happening for decades.

      “I used to do my military service in 1996-97 in the Evros border area,” he told IRIN. “Even then the Greek authorities were doing pushbacks every day.”

      Although the border is technically a military zone, these days border police patrol the frontier as well as personnel from the EU border control agency, Frontex.

      People who have been pushed back, including Linda, describe being met by security forces wearing different types of uniforms, but it’s tough to assign responsibility.

      “Since it takes place outside of the public eye, we don’t really understand who is responsible,” Koros, from the Greek Council for Refugees, said.

      When asked about the practice by IRIN, Nikolaos Menexidis, police major general of Western Thrace, the Greek region that borders Turkey, said Hellenic police always follow the proper procedures when dealing with migrants.

      Menexidis said his forces have been working with Turkish police for the past six years on what he calls “technical issues.” They primarily exchange information on stopping smugglers on both sides of the border, he said.

      After pushback

      Linda’s ordeal did not end when she was pushed back into Turkey. The smugglers who brought her group to the border were gone and so was the bus. Without phones to call for help, the group was stuck. After waiting several hours, they tried to cross again.

      This time they made it further, walking for five or six hours in Greek territory before they were stopped, taken to a detention centre, and placed in a room with people from many different countries.

      After being held for several more hours, they were driven back to the border, the men were beaten again, and they were all forced back to the Turkish side of the river. By that point, the group was exhausted and thirsty. “For two days we didn’t drink water. When we saw the river we drank from it,” Linda said. “There were people who got sick because the water was dirty.”

      A group of Turkish soldiers found them in the woods and brought them food, water, and milk for the children and pointed them in the direction of Edirne, where they arranged for taxis to bring them back to Istanbul.

      In a way, Linda was lucky. Last December, the Greek Council for Refugees documented the case of a Pakistani man who died of hypothermia after being forcibly returned to Turkey. He had fallen into the cold water on the way back.

      While the Evros is no more than a few metres wide, its current is deceptively strong and, according to records in Greece, at least 29 people this year have died while trying to cross the water or shortly after.

      Some who are forced back to Turkey face serious punishment. Since a failed military coup in 2016, the Turkish government has jailed tens of thousands of opponents, leading to an increase in the number of Turks fleeing to Greece to seek asylum – nearly 2,000 in 2017 compared to just 180 the year before. The Hellenic League for Human Rights has documented two cases of Turks being pushed back from Greece at the Evros and later being imprisoned in Turkey, including journalist Murat Çapan, who is now serving a 22.5 year sentence for “participating in a terrorist organization and attempting to overthrow the constitution”.

      Despite documentation, human rights advocates say they have struggled to bring attention to the issue of pushbacks, as EU and international policymakers focus on stemming Mediterranean crossings. There is little appetite in Europe at the moment for monitoring or changing policies that are keeping asylum seekers and migrants from entering the EU.

      “Both the European Union and the Greek government... prefer not to open this discussion, especially in this political environment,” Tsitselikis said, referring to the rise of right-wing, anti-migration politics in Europe that is shaking the foundations of the EU.
      Fear and silence

      In early June, about a 10-minute drive from Edirne, hundreds of people in the parking lot of what the Turkish government calls a “migrant removal centre” huddled under tin pavilions that offered shade from the afternoon sun. This is where those caught on the Turkish side of the river are brought.

      IRIN visited three times over the course of a week to try to gain access, but never received a response to our requests.

      The centre is surrounded by a low wall topped with a chain-link fence and spools of razor wire. Each time IRIN visited, there were hundreds of people – mostly men, but also women and small children – in the parking lot and white vans passed in and out of the metal gate depositing more people. Two large charter buses idled in the parking lot with their doors open, seemingly waiting for people to board.

      In close to a week spent at the border, there was no concrete evidence of what was happening inside the centre. There were hints and rumours, but no one wanted to speak on record – including Turkish organisations that work with asylum seekers – because of the sensitivity of the issue.

      It is simply not clear how long people are kept in the centre, or what happens to them when they are removed. The Turkish Directorate General of Migration Management responded to IRIN’s requests for comment with links to online statistics and Turkish law on removals.

      Several Syrian and Afghan asylum seekers that IRIN spoke to shared stories of being held in such centres for a period of time before being released inside Turkey and permitted to stay. Most of the people IRIN spoke to reported good treatment while inside.

      But in 2015 and 2016, Amnesty International documented cases of Syrians detained while trying to migrate to Europe and being deported to Syria, according to Anna Shea, an Amnesty researcher working on refugee and migrant rights.

      Amnesty has also recently documented a case of a Syrian asylum seeker stopped in Edirne being deported to Idlib, the rebel-held province in northwestern Syria where a ceasefire is so far holding off a government offensive but humanitarians warn conditions are still dire. It is unclear if the case is part of a larger trend.

      In recent months, Turkey has deported large numbers of Afghans and Syrians, stopped after crossing Turkey’s southern and eastern borders, back to their respective countries.

      But it is difficult to know if this practice has been extended to people who have tried to travel to Greece, given that the organisations working on migrant and refugee rights were unwilling to speak on the record, and the government declined to comment on the issue or allow access to detained migrants.

      “The total stonewalling and lack of information and complete lack of transparency is cause for concern in and of itself,” said Shea, the Amnesty researcher. “I mean, what do they have to hide?”

      Hidden practice

      At a small village outside of Edirne, a man herding goats pointed to places where people crossed the nearby river, but there was no sign of anyone during the day. Crossings happened only at night, he said. And the Turkish army prohibited people from approaching the river after 7 pm.

      The road leading from the village followed the winding course of the Evros, which was often blocked from view by thick stands of trees. The surrounding area was full of corn fields, rice paddies, and thick vegetation. Small dirt roads that shot off in the direction of the river were marked with red signs carrying a stencilled soldier – a warning that entry beyond that point was prohibited.

      Not far away, in the city centre, everyone seemed shocked to learn that so many people had crossed the border this year. It was a problem that most locals assumed was already in the past, given that most of the frontier had been lined with barbed wire and cameras for the past six years.

      But those who have tried and failed to cross the Evros know that the rural quiet harbours dangers the eye can’t see.

      Linda has given up on seeing her fiancé anytime soon – a visa is likely to take years – and she isn’t planning on trying to cross the border again. “I started being afraid because of the things I saw,” she said.

      Les corps des trois femmes avaient été découverts le 10 octobre par un agriculteur dans un champ près du fleuve Evros.

      Trois migrantes retrouvées mortes début octobre près du fleuve Evros à la frontière gréco-turque au nord de la Grèce ont été identifiées. Selon la police, il s’agit d’une mère et ses deux filles. Elles ont été égorgées après avoir été entravées.

      Le mode d’exécution pose questions aux enquêteurs, qui privilégient la piste criminelle depuis la découverte des corps en octobre dernier. « Des femmes contraintes à s’agenouiller avant d’être égorgées, pourrait évoquer une action de type djihadiste, mais dans l’immédiat, la police n’exclut ni ne privilégie aucune piste », explique une source policière.

      L’hypothèse d’une « punition » infligée par un réseau de passeurs a aussi été avancée par les médias grecs. L’affaire « est sans précédent dans les annales du pays, c’est un mystère », a relevé la même source policière.

    • Le fleuve Évros, cimetière des migrants anonymes

      Ce fleuve boueux, aux courants dangereux et à la profondeur traîtresse, tue et recrache régulièrement des corps quasi impossibles à identifier.

      Bloqué en Turquie, Mustafa a d’abord tenté d’atteindre la Bulgarie par la voie terrestre avec un groupe de migrants afghans. Mais une fois la frontière passée, la police bulgare les a interceptés avant de les renvoyer en Turquie, où ils ont été emprisonnés dans le centre de détention d’Edirne pendant trois mois. Quelques semaines après sa libération, au milieu de l’été 2014, Mustafa a demandé à sa famille restée en Afghanistan, d’envoyer de l’argent à un passeur qui avait promis de l’emmener en Bulgarie – mais cette fois-ci en passant par la Grèce.

      Les cinq jeunes hommes de son nouveau groupe ont alors dû se cotiser pour financer le bateau gonflable qui leur servirait à franchir à deux reprises l’Évros, un fleuve de 480 kilomètres de long qui marque la frontière greco-turque, mais aussi une partie de la frontière entre la Grèce et la Bulgarie.

      La route migratoire qui consiste à traverser l’Évros, fréquemment empruntée depuis les années 1990, est redevenue populaire après l’accord UE-Turquie signé en 2016 visant à limiter les arrivées de migrants dans les îles Grecques via la mer Méditerranée. Cette route a longtemps semblé préférable à emprunter la Méditerranée pour atteindre la Grèce. Mais ce fleuve boueux, aux courants dangereux et à la profondeur traîtresse, car variable, tue et recrache régulièrement des corps quasi impossibles à identifier.

      C’est dans la région grecque de l’Évros que l’on trouve le plus grand nombre de corps de migrants non identifiés en Grèce. À cela s’ajoutent les corps retrouvés du côté turc de l’Évros, et aussi en Bulgarie. À Évros, les employés de la morgue de l’hôpital d’Alexandroúpoli, aidés par le Comité International de la Croix Rouge, tentent d’identifier les corps pour aider les familles qui recherchent un proche disparu.

      Mais tout ça, Mustafa ne le sait pas. Le passeur a acheté un bateau « pour les petits bébés » et « à peine plus grand qu’un lit », se rappelle aujourd’hui Mustafa. En pleine nuit, le groupe trouve un coin où la végétation est assez dense pour les dissimuler. Puis, le passeur et les six Afghans gonflent et s’entassent sur la petite embarcation.

      « Les courants étaient trop rapides pour nager, » explique Mustafa à VICE News. « On a eu peur de mourir [...], que le bateau coule et que des poissons, comme des piranhas, nous mangent. » Le groupe traverse finalement la frontière entre la Turquie et la Grèce, en 20 minutes. « On a ensuite récupéré le bateau, car le passeur a dit qu’on en aurait encore besoin, » raconte Mustafa, sa voix douce, mais anxieuse en harmonie avec son visage triste et enfantin.

      En effet, après avoir marché environ deux jours, Mustafa se retrouve face à la même rivière, qu’il doit traverser pour atteindre la Bulgarie. Il fait noir et les branches sous l’eau percent l’embarcation de fortune. Rapidement, Mustafa se débarrasse de son sac à dos pour pouvoir nager. Il s’accroche à des branches, parvient à sortir de l’eau et retrouve le passeur et trois autres camarades. Mais deux des migrants, des jeunes qui n’avaient pas plus de 20 ans, ne sont pas là.

      « Le bateau a coulé, on n’a pas vu ce qu’il s’est passé, mais ensuite, ils avaient disparu, » raconte doucement Mustafa. « On ne les a pas retrouvés. » Après trois jours de marche et une semaine passée au camp de Hamanli, Mustafa est emprisonné dans le centre de détention de Busmantsi près de Sofia. Puis, après encore des semaines de voyage, il atteindra Paris, où il n’a toujours pas réussi à obtenir l’asile et espère faire venir sa femme et ses trois enfants.

      Les deux camarades de voyage de Mustafa ont sans doute rejoint les centaines de victimes de l’Évros, dont les corps, retenus au fond du fleuve par la boue et les branches, sont souvent retrouvés des mois, voire des années, après leur disparition.

      Selon les données communiquées par le CICR, 352 corps ont été découverts entre 2000 et 2017 dans la région de l’Évros, qui borde le fleuve du côté grec. Seuls 105 ont été identifiés. Entre janvier et mai 2017, 841 personnes ont été arrêtées à Évros en essayant de traverser la frontière (contre 1 638 pour la même période en 2016).

      « Mais peut-être qu’il y a plus de corps que nous n’avons pas encore trouvés, » dit le docteur Pavlos Pavlidis, médecin légiste à l’hôpital général de l’université d’Alexandroúpoli (Grèce). De plus, ces chiffres n’incluent pas les corps retrouvés en Turquie et en Bulgarie. « Je pense que les chiffres [pour la Turquie] sont à peu près les mêmes que du côté grec, » ajoute-t-il, lors d’une interview réalisée par le CICR.

      D’après Pavlidis, la première cause de décès des migrants dans la région, ce sont les noyades. Jusqu’en 2008, la deuxième cause de décès, c’était les mines, disséminées le long de la frontière et retirées cette année-là. Après les opérations de déminage, l’hypothermie a pris la seconde place sur la liste.

      « Quand tu sors de la rivière et que tu es mouillé, tu t’assois dans tes habits trempés, et tu commences à te sentir endormi, et tu meurs d’hypothermie, » explique Pavlidis. « Ils sombrent en fait dans un sommeil profond, ils ne souffrent pas... Ils ne se réveillent jamais. »

      Les passeurs ne laissent pas les migrants emporter leurs sacs sur les embarcations. Ils portent donc beaucoup de couches de vêtements sur eux, explique Pavlidis. Quand le bateau chavire, le poids attire les personnes vers le fond. « Il est impossible de survivre, mais en plus les corps restent sous l’eau et on ne peut pas les récupérer, » dit-il. « Nous avions un cas où la personne a été retrouvée portant quatre pantalons et sept chemises. »

      Il y a quelques années, la plupart des victimes étaient principalement des hommes seuls fuyant l’Afghanistan, le Pakistan ou le Bangladesh, d’après les observations de Pavlidis. Mais depuis la guerre en Syrie, les familles syriennes ont rejoint le groupe. « Maintenant, on va avoir des enfants, des femmes, des grands-pères. » (Selon le CICR, le nombre de familles a récemment recommencé à diminuer.)

      Les corps sont retrouvés par Frontex, la police, l’armée ou par des chasseurs et des pêcheurs, explique Pavlidis. Ils sont souvent dans un état de décomposition avancée, ou mangés par les poissons. Lorsqu’on lui ramène un corps, le médecin enregistre les habits et effets personnels. Ces objets, qu’il collecte depuis environ 15 ans, sont essentiels à la reconnaissance des corps.

      Puis son équipe procède à une autopsie. Ils prélèvent ensuite un échantillon ADN et l’envoient au laboratoire de la police à Athènes. Si l’échantillon correspond à un profil existant, ils collaborent avec la Croix Rouge Internationale. Et, si quelqu’un recherche un proche qui a traversé l’Évros à cette période, ils poursuivent le processus d’identification.

      Si aucune recherche n’est entamée, les corps quittent la morgue après trois à quatre mois, et sont enterrés dans l’un des trois cimetières musulmans des alentours. La position et le numéro de leur tombe sont archivés afin qu’ils puissent être retrouvés par des proches dans le futur.

      « Nous avons plusieurs recherches fructueuses, mais pas tant que ça, car c’est un procédé très complexe et long, » explique Jan Bikker à VICE News. En tant que médecin légiste du CICR à Athènes, son travail consiste en partie à tenter de retrouver les familles des défunts si le gouvernement grec n’a pas réussi à le faire.

      « Ce n’est pas toujours aussi simple que ça en a l’air : on retrouve des papiers d’identité, mais nous ne sommes jamais sûrs que ce soit la bonne personne, » dit-il. « En effet, les papiers peuvent être faux ou une personne peut être enregistrée sous différents noms, ou porter les papiers de quelqu’un d’autre.

      L’équipe de Bikker aide aussi les familles ayant contacté le CICR à retrouver le corps de leurs proches et à produire un échantillon d’ADN pour procéder à l’identification. Cet échantillon est nécessaire à identifier un corps en trop mauvais état.

      Ce travail est difficile pour plusieurs raisons : les familles peuvent vivre dans des zones de conflits ; être des personnes déplacées ; résider illégalement dans un pays ; ou risquer l’emprisonnement si leur gouvernent apprend que leur proche a quitté le pays.

      « Normalement, nous collectons les informations descriptives qui pourraient nous donner une première piste. Une fois que nous avons une idée et une correspondance possible avec un corps, nous tentons de travailler avec [les proches des disparus] et les autorités pour obtenir l’ADN. »

      Une fois le corps identifié, les familles décident, en fonction de leurs moyens, si elles souhaitent rapatrier le corps dans leur pays d’origine.

      « Nous espérons qu’un cadre légal sera mis en place en Grèce [...] pour la centralisation des informations descriptives dans une base de données centrale avec toutes les informations sur les personnes disparues et les corps non identifiés, » explique Bikker.

      Comme l’explique Fragkiska Megaloudi, chargée de communication au CICR à Athènes, l’identification des morts est de la responsabilité de l’État grec. Le CICR est la seule association aidant l’État grec pour le médico-légal et prend le relais pour les identifications difficiles.

      L’association se charge aussi d’instruire les gardes côtiers grecs sur la manière de gérer dignement les corps, fournit du matériel à l’équipe du docteur Pavlidis, et améliore les cimetières accueillant les migrants et réfugiés.

      « Nous aidons à améliorer et à marquer les tombes, comme ça, si nous trouvons la famille, ils peuvent revenir et trouver la tombe de la personne. Sinon ils ne peuvent pas tourner la page, » dit-elle.

      « Nous reconstruisons de petites histoires autour de ces personnes, mais nous ne savons jamais qui elles étaient, leurs noms, ce qu’elles pensaient, leurs espoirs, leurs rêves... Et elles sont juste mortes ici » dit Megaloudi, émue. « C’est le côté le plus tragique de la crise migratoire. »

    • US : Poor Medical Care, Deaths, in Immigrant Detention

      Poor medical treatment contributed to more than half the deaths reported by US Immigration and Customs Enforcement (ICE) during a 16-month period, Human Rights Watch, the American Civil Liberties Union, Detention Watch Network, and National Immigrant Justice Center said in a report released today.

      Based on the analysis of independent medical experts, the 72-page report, “Code Red: The Fatal Consequences of Dangerously Substandard Medical Care in Immigration Detention,” examines the 15 “Detainee Death Reviews” ICE released from December 2015 through April 2017. ICE has yet to publish reviews for one other death in that period. Eight of the 15 public death reviews show that inadequate medical care contributed or led to the person’s death. The physicians conducting the analysis also found evidence of substandard medical practices in all but one of the remaining reviews.

      “ICE has proven unable or unwilling to provide adequately for the health and safety of the people it detains,” said Clara Long, a senior US researcher at Human Rights Watch. “The Trump administration’s efforts to drastically expand the already-bloated immigration detention system will only put more people at risk.”

      12 people died in immigration detention in fiscal year 2017, more than any year since 2009. Since March 2010, 74 people have died in immigration detention, but #ICE has released death reviews in full or in part in only 52 of the cases.

      Based on the death reviews, the groups prepared timelines of the symptoms shown by people who died in detention and the treatment they received from medical staff, along with medical experts’ commentary on the care documented by ICE and its deviations from common medical practice. The deaths detailed in the report include:

      Moises Tino-Lopez, 23, had two seizures within nine days, each observed by staff and reported to the nurses on duty in the Hall County Correctional Center in Nebraska. He was not evaluated by a physician or sent to the hospital after the first seizure. During his second seizure, staff moved him to a mattress in a new cell, but he was not evaluated by a medical practitioner. About four hours after that seizure, he was found to be unresponsive, with his lips turning blue. He was sent to the hospital but never regained consciousness and died on September 19, 2016.
      Rafael Barcenas-Padilla, 51, had been ill with cold symptoms for six days in the Otero County Processing Center in New Mexico when his fever reached 104, and nurses recorded dangerously low levels of oxygen saturation in his blood. A doctor, consulted by phone, prescribed a medication for upper respiratory infections. The ICE detention center didn’t have the nebulizer needed to administer one of the medicines, so he did not receive it, and he showed dangerously low oxygen readings that should have prompted his hospitalization. Three days later, he was sent to the hospital, where he died from bronchopneumonia on April 7, 2016.
      Jose Azurdia, 54, became ill and started vomiting at the Adelanto Detention Facility in California. A guard told a nurse about Azurdia’s condition, but she said that “she did not want to see Azurdia because she did not want to get sick.” Within minutes, his arm was numb, he was having difficulty breathing, and he had pain in his shoulder and neck – all symptoms of a heart attack. Due to additional delays by the medical staff, two hours passed before he was sent to the hospital, with his heart by then too damaged to respond to treatment. He died in the hospital four days later, on December 23, 2015.

      “Immigrant detention centers are dangerous places where lives are at risk and people are dying,” said Silky Shah, executive director of Detention Watch Network, a national coalition that exposes the injustices of the US’ immigration detention and deportation system. “The death toll amassed by ICE is unacceptable and has proven that they cannot be trusted to care for immigrants in their custody.”

      In fiscal year 2017, ICE held a daily average of nearly 40,500 people, an increase of nearly 500 percent since 1994. The Trump administration has asked Congress to allocate $2.7 billion for fiscal year 2019 to lock up a daily average of 52,000 immigrants in immigration detention facilities, a record number that would represent a 30 percent expansion from fiscal year 2017.

      “To the extent that Congress continues to fund this system, they are complicit in its abuses,” said Heidi Altman, policy director at the National Immigrant Justice Center, a nongovernmental group dedicated to ensuring human rights protections and access to justice for all immigrants, refugees, and asylum seekers. “Congress should immediately act to decrease rather than expand detention and demand robust health, safety, and human rights standards in immigration detention.”

      The new report is an update of a 2017 Human Rights Watch report that examined deaths in detention between 2012 and 2015, as well as a 2016 report by the American Civil Liberties Union, the Detention Watch Network, and the National Immigrant Justice Center that examined deaths in detention between 2010 and 2012.

      The medical experts who analyzed the death reviews for the groups include Dr. Marc Stern, the former health services director for the Washington State Department of Corrections; Dr. Robert Cohen, the former director of Montefiore Rikers Island Health Services; and Dr. Palav Babaria, the chief administrative officer of Ambulatory Services at Alameda Health System in Oakland, California, and assistant clinical professor in Internal Medicine at the University of California, San Francisco.

      Six of the new deaths examined occurred at facilities operated by the following private companies under contract with ICE: #CoreCivic, #Emerald_Correctional_Management, the #GEO_Group, and the #Management_and_Training_Corporation (#MTC).

      “ICE puts thousands of people’s health and lives at risk by failing to provide adequate medical care to the people it detains for weeks, months, and even years,” said Victoria Lopez, senior staff attorney at the American Civil Liberties Union.

    Despite protests calling for an end to the garbage crisis, more than 150 dumps across Lebanon are openly burning trash at least once a week. Older people and children are most at risk. Doctors say the burning leads to respiratory illnesses and could increase the risk of developing cancer as a result of sustained inhalation of smoke. The government of Lebanon can and should stop the burning and manage the waste in a way that respects health and meets environmental standards.
