Israel behaves in the same way whenever its soldiers assault, abuse, or kill Palestinians.

In 2016, an Israeli military medic killed a disarmed and injured Palestinian by shooting him in the head.

At first, the military decided not to press charges against the soldier.

Then, Israeli NGO @btselem published a video of the killing, which led to condemnations around the world.

Only at that point was the soldier taken to court. He was convicted and, after 9 months, was released from prison.

Instructing tens of thousands of people to move to a place with appalling living conditions, where there is no way to provide them with basic services, when the journey itself is unsafe and where they might still get hit in Israeli bombardments - is not an effective warning. After more than 20 years of legal proceedings, Israel’s High Court of Justice ruled yesterday (May 4) that the forcible transfer of hundreds of Palestinians from their homes and the destruction of their communities – for the clear purpose of taking over their lands in the service of Jewish interests – is legal. The justices have thus proved once again that the occupied cannot expect justice from the occupier’s court.

The decision, weaving baseless legal interpretation with decontextualized facts, makes it clear that there is no crime which the high court justices will not find a way to legitimize. Employing sugarcoated language, hypocrisy, and lies, the justices once again fulfilled their role in Israel’s regime of Jewish supremacy and paved the way for the crime of forcible transfer to be committed, while reversing reality: the ruling cast Palestinian victims as the “unlawful” offenders, while portraying the apartheid regime as the victim.

The international community must prevent Israel from forcibly transferring the Masafer Yatta communities and make sure, should this crime be committed, that those responsible for it – including government ministers, the military top echelons, and the supreme court justices – will be held accountable.

Israel was quick to frame the protests as illegitimate even before they began. It made various attempts to prevent the demonstrations and declared in advance it would violently disperse the protesters. The military deployed dozens of snipers along the fence, and various officials clarified that the open-fire regulations would permit lethal fire against anyone attempting to approach the fence or damage it.Israel responded to international criticism of the casualty toll by saying it would investigate the incidents. Yet today, more than forty months after the first demonstration, it is clear that the military’s investigations in relation to the Gaza protests were never intended to ensure justice for the victims or to deter troops from similar action. These investigations – much like the investigations conducted by the military law enforcement system in other cases in which soldiers have harmed Palestinians – are part of Israel’s whitewashing mechanism, and their main purpose remains to silence external criticism, so that Israel can continue to implement its policy unchanged.

For decades, the pattern of Israeli violence toward Palestinians in the West Bank has been one of “private rampages,” the declared goal of which was to expel Palestinians from their public and private spaces, thereby gradually gaining control of yet another dunam, another spring or another cistern.

A B’Tselem report calculates how much land was closed off to Palestinians through systematic violence just by residents of five illegal outposts and one settlement in five different parts of the West Bank that were surveyed. It amounted to 28,000 dunams (7,000 acres).

Long-time settler leader Ze’ev Hever estimates that the approximately 150 outposts and individual farms have succeeded in gaining control of about 200,000 dunams across the West Bank – more than twice the built-up areas of all the settlements combined.

The sanctity of this mission is evidenced by the fact that attacks on Palestinians justify violating the religious prohibitions of Jewish holidays and Shabbat. They include cutting down and burning olive trees, torching mosques, vandalizing cars, grazing sheep in Palestinian pastures and orchards, stealing harvests, using drones to spy on Palestinians and attacking farmers and shepherds with dogs, stones and even live fire.

The helplessness of the forces of law and order in the face of this settler violence and the culture of the outposts proves that this is not just a case of bureaucratic failure. If the political and legal establishment wanted to, it could find ways to put an end to this Jewish terror. The reason for this official helplessness is simple. The B’Tselem report explains: The government and the settlers share a common goal of wresting control of as much Palestinian territory in the West Bank as possible and pushing the Palestinians into densely populated, non-contiguous enclaves.

Israel does this by fictitiously declaring areas live-fire zones or nature reserves; prohibiting Palestinian building, urban development and connections to water and electricity in Area C; destroying buildings and cisterns; and cutting off water supplies.

Many Palestinian communities continue to live on their land despite the difficult conditions that Israel has imposed on them. Armed attacks by settlers, protected by the army and granted immunity by the legal system, have succeeded where official actions have failed: Often Palestinians can no longer reach their land and even abandon their homes. The settlers are flexing their muscles more than ever.

Greater determination and a greater sense of urgency are needed both by Israelis and the international community to curb the growing number of expropriations and deportations that the settlers are undertaking in cooperation with the Israeli establishment. The indifference of Israeli civil society is tantamount to consent, and it will pay for it dearly.

A new report issued last week by B’Tselem and Kerem Navot, “This Is Ours – And This, Too: Israel’s Settlement Policy in the West Bank”, exposes the mechanisms Israel uses to encourage its citizens to move into the occupied territory. The report also reviews developments on the ground over the last decade, focusing on the spatial impact of the two large settlement blocs.

Two key aspects of Israel’s policy are examined:

First, the report details the official and unofficial ways in which Israel encourages Jews to move to settlements and develop financial ventures in and around them. Among other things, the state offers settlers housing benefits, allowing lower-income families to purchase homes. These benefits are one factor contributing to the growth in the settler population, which in 2019 numbered 441,619 people (in the West Bank, not including East Jerusalem) – an increase of 42% since 2010 and of 222% since 2000. In 2019 alone, the settler population grew by 3.2% – 68% more than the overall population growth rate for Israeli citizens and residents that year, which was just 1.9%. (...)

On 10 Sept 2020, four days after the beginning of the school year, in the early morning hours before students arrived, Civil Administration personnel came with a military and Border Police escort and a crane truck to the Palestinian community of Ras al-Tin, east of Ramallah. The forces confiscated tin panels from the school’s roof, 30 chairs and 12 classroom tables.

The students were forced to study under the scorching sun as they sat on the ground.

Just a week ago, on 3 September 2020, the Civil Administration confiscated ten tin panels, four cinder block pallets, 30 classroom chairs and 12 tables. On 31 August 2020, they confiscated building materials intended for further construction of the school.

On 3 Nov. 2019, at about 11:30 A.M., soldiers detained ‘Abd a-Razeq Idris, 13, from the Abu Jales neighborhood. They put him and a jeep, blindfolded him and drove him around. They then took him to al-Harika neighborhood, about a kilometer from his home, where they took him out of the jeep and walked him, blindfolded, through the streets. When his father arrived, the soldiers refused to turn the boy over. Instead, they drove him to a military post in the settlement of Kiryat Arba yet told the father they were taking him to the police station there, where the father searched for his son in vain. ‘Abd a-Razeq was asked about stone-throwers and sent home alone at about 2:00 P.M.

This case is no aberration, it is part of the routine violence imposed on Palestinians in Hebron by Israeli security forces and settlers, including physical attacks, threats, verbal abuse, soldiers’ incursions into homes (usually at night) – and the false arrest of minors and adults. Israel cites security to justify this conduct and the segregation it imposes on the city. The Return Protests, which Palestinians in the Gaza Strip have been holding near the fence with Israel to demand realization of the right of return and an end to the blockade on Gaza, began nearly a year ago and are still taking place. According to the World Health Organization (WHO), by the end of January 2019, a total of 27,942 people had been injured in these demonstrations, 14,768 of whom were treated in hospitals in Gaza. More than 6,300 had been injured by live fire. According to B’Tselem’s figures, by the end of February 2019, 200 protesters had been killed, including 39 minors and two women. Most of the casualties – killed or injured – had posed no danger to Israeli security forces, who were deployed on the other side of the fence.

Any healthcare system would be hard put to treat such an immense number of casualties. All the more so for the healthcare system in Gaza, which is on the verge of collapsing. Israel has kept Gaza under blockade for more than a decade, imposing restrictions on bringing in drugs, advanced medical equipment and spare parts for broken equipment, and barring doctors from travelling abroad for further training. The restriction on bringing drugs into Gaza has severely depleted local stores of vital drugs and equipment. Gaza also suffers from an intermittent supply of power, largely due to Israeli policy, and routine power cuts damage medical equipment. This has forced hospitals to cut services to a minimum, postponing non-urgent operations and releasing patients home earlier than medically advised.

Given the failing healthcare system in Gaza, injured protesters cannot receive the medical attention they need and must seek vital treatment abroad.

Tomorrow (Thursday) B’Tselem will launch a campaign entitled “Sorry Commander, I cannot shoot”. The campaign will include newspaper advertisements clarifying to soldiers that they must refuse to open fire on unarmed demonstrators. The organization is taking this unusual step following last Friday’s events, when soldiers used live fire against unarmed demonstrators. Of at least 17 Palestinians killed that day, 12 were killed at the protests. Hundreds more were injured by live gunfire.
