Les « règles rigoureuses » partiellement dévoilées dans un "livre blanc" (un résumé de 16 pages) que la NBC s’est procurée et dans lequel on apprend que la notion d’"imminence" (d’une attaque contre les Etats-Unis- justifiant un assassinat ciblé) (page 7) et celle de la priorité donnée a la capture plutôt qu’a l’assassinat (page 8) sont très relatives.

The more we learn about the Obama administration’s internal justifications for its targeted killing program, the more obvious it is that words like “imminence” or “due process” can and will be stretched beyond normal usage to accommodate whatever uses of force the president chooses.

À la page 4 du « livre blanc » non classifié de 16 pages, les avocats du ministère de la justice ont essayé de réfuter l’argument selon lequel le droit international ne soutient pas l’extension des conflits armés en dehors d’un champ de bataille. Ils ont cité comme autorité historique un discours prononcé le 28 mai 1970, par John R. Stevenson, le grand avocat du département d’Etat, après l’invasion du Cambodge par les Etats-Unis.

Depuis 1965, "le territoire du Cambodge a été utilisé par le Vietnam du Nord comme base d’opérations militaires," a-t-il déclaré au New York City Bar Association. "Cela a depuis longtemps atteint un niveau qui aurait justifié que nous prenions des mesures appropriées d’auto-défense sur le territoire du Cambodge. Toutefois, à l’exception de cas épars de ripostes à travers la frontière, nous nous sommes abstenus jusqu’à Avril de prendre de telles mesures au Cambodge. "

En fait, Nixon avait commencé son bombardement secret du Cambodge plus d’un an plus tôt. (Que cela ait été connu ou pas de M. Stevenson n’est pas clair.) Donc, les avocats de l’administration Obama ont cité une déclaration qui était manifestement fausse.

L’origine de l’expression étasunienne "mâle d’age militaire" ou MAM,

In his memoir My American Journey, Colin Powell recollects his tours in Vietnam, first as a U.S. Army captain in 1962 and 1963, and later as a major in 1968 and 1969. Due to the length of the war, Powell notes that many officers and noncommissioned officers deployed to Vietnam were wholly unprepared, leading to a “breakdown in morale, discipline, and professional judgment.”

I recall a phrase we used in the field, MAM, for military-age male. If a helo spotted a peasant in black pajamas who looked remotely suspicious, a possible MAM, the pilot would circle and fire in front of him. If he moved, his movement was judged evidence of hostile intent, and the next burst was not in front but at him. Brutal? Maybe so.
