Captain Arne Rinnan and the crew and owners of the Norwegian container ship, MV Tampa, for demonstrating courage and a unique degree of commitment to refugee protection. Capt. Rinnan was in charge of the Tampa when it rescued 438 boat people in the Indian Ocean on August 26, 2001. Despite the risk of substantial delays and a large financial loss to the company, the huge container ship - unsuitable to carry a large number of passengers - altered its course to rescue the asylum-seekers.

The phone rings in Arne Rinnan’s home, and the voice that answers it is like a quiet echo from a time long past.
Arne Rinnan’s calm, measured responses to the media in the aftermath of the Tampa affair became, in a sense, the wallpaper of the whole saga. And now, the voice is unchanged, only perhaps even a little more resistant to being pulled backinto the limelight than it already was then.
But after several minutes, the Tampa captain allows himself to reflect just a little.
This is what a refugee wrote to him: “Last night, our family prayed for you together, you old sailor from Norway, our rescuer. We remember those fatal hours, when our little wooden boat was shivering in the wind. You are a noble Viking with wisdom and humanity. My youngest son wants to put up a picture of you in his room, and my wife kisses your hands in gratitude".

For example, look at the borders of Arunachal Pradesh—an area administered by India but claimed as a section of Tibet by China (which also claims Tibet). Asylum seekers: Many children on #Christmas_Island reportedly sick and distressed, wetting the bed, having flashbacks
The Australian Human Rights Commission says it holds “grave concerns” for the welfare of asylum seekers, particularly mothers and children, on Christmas Island.
Commission president Gillian Triggs has recounted her inspection of the centre last week as part of a national inquiry into the mandatory detention of children seeking asylum in Australia.
Professor Triggs says conditions have worsened markedly since her last visit four months ago.
Almost all of the child asylum seekers inside the Christmas Island immigration detention centre are reportedly sick and distressed, with many wetting the bed and some developing severe speech impediments and having flashbacks.
There are 1,102 asylum seekers in the centre, including 174 children, and Professor Triggs says she and her team interviewed hundreds of detainees over three days.
“Almost all of them, including the adults, were coughing, were sick, were depressed, unable to communicate, were weak,” she told AM.
“Some of them [are] not leaving their cabins, are not eating.”
The inspection coincided with the first anniversary of the starting date - July 19, 2013 - of the Government’s policy not to allow asylum seekers arriving by boat to settle in Australia.

The 153 asylum seekers aboard an Australian Customs ship somewhere in the Indian Ocean are being locked up in windowless cabins, their lawyers claim.
Their case, to be processed in Australia, returns to the High Court for a directions hearing in Melbourne on Friday.
They claim because their boat was intercepted 27 kilometres from Christmas Island they were within Australian waters.
The decision not to take them to Australia did not fall within the bounds of “legal reasonableness and it was otherwise disproportionate and therefore invalid”, their statement of claims says.
It goes on to say that mothers and children had been separated from their fathers and husbands on the Customs ship, and there was no freedom of movement.
Their phones and belongings have been confiscated apart from the clothes they were wearing.
Almost all the Sri Lankan asylum seekers are unable to communicate in English and none of them have been asked why they left Sri Lanka.
Their lawyers argue their clients should not be returned to Sri Lanka or transferred to offshore immigration detention centres on Nauru or Manus Island in Papua New Guinea.
That’s because Nauru and PNG are not signatories to international law principles of non-refoulement, which forbids victims of persecution being returned to their persecutors.
The lawyers are demanding “procedural fairness” and an acknowledgement that border protection authorities acted unlawfully.
Last week the asylum seekers won a temporary reprieve that barred their return to Sri Lanka.
A day later the federal government gave an undertaking to give three days notice before moving the group.

Abstract: There has been intense debate in Australia regarding how asylum seekers who arrive by boat should be treated. Lawyer George Newhouse in dark over asylum seeker move
The lawyer representing 157 Tamil asylum seekers moved overnight on Friday to Nauru says a High Court case challenging the Australian government’s actions in detaining them on the high seas would continue.
Three planes carrying the asylum seekers, including 50 children, from the Curtin detention centre had landed at Nauru’s tiny airport, Nauruan officials said on Saturday.
Lawyer George Newhouse, who was not informed by the government that his clients had been taken from Australia, rejected allegations by Immigration Minister Scott Morrison that their refusal to meet with Indian officials was prompted by his advice.
“The allegation is false,” said Mr Newhouse. “We have always stood ready to work cooperatively.”

Le schéma paraît assez simple : on renvoie 1000 personnes dans leur pays d’origine, et on attend un an. Ensuite on demande à celles qui sont mortes de se signaler. Dans l’hypothèse où plus de 499 personnes envoient une réponse positive (et authentifiée par biométrie) indiquant qu’elles ont été tuées, alors on considère que le pays n’est pas safe et on nomme une commission qui étudie (une autre année) la question de savoir si on arrête de renvoyer les demandeurs d’asile dans ce pays-là.
Personnellement je trouve que ça ne va pas assez loin : en effet, si quelqu’un répond qu’il est mort, comment peut-on être sûr que c’est vrai ? D’ailleurs, peut-être est-il mort tout bêtement en traversant la rue ?
La formulation utilise en effet le terme de probable, mais ça n’a pas grand chose à voir avec les probabilités.
C’est totalement terrifiant comme formulation.
On passerait de la protection accordée lorsqu’il existe une « chance » de subir un risque grave (significant harm) à un refus de protection tant que la probabilité de subir un risque grave ne serait pas supérieure à la probabilité du contraire. (Je n’arrive pas à écrire de pourcentage, car ça n’a absolument aucun sens).
Le simple fait de fixer un « seuil » de déclenchement de la protection à partir de la probabilité de subir un risque est hallucinant :
– comment estimer cette « probabilité » ?
– surtout, cela signifie concrètement qu’on est certain que des personnes rejetées subiront ce risque grave (application mécanique des probabilités…)
– et ce, quel que soit le niveau du seuil, le 50% ne faisant qu’en rajouter dans l’absurde. Tant que c’est un peu moins équilibré que Pile ou Face on renvoie.

Elle doit s’estimer en fonction des caractéristiques de l’intéressé. Il ne suffit pas de demander aux morts, il faut encore faire du scoring, du genre : journaliste +5, lanceur d’alerte +10, etc.
