    From storms named after women that cause more damage because people prepare for them less to men who refuse to recycle because they think it looks girly, climate damage is riven with toxic masculinity, a new exhibition argues.

    Climate change is a man-made crisis in every sense, with male-dominated culture fuelling damaging behaviour while women and girls disproportionately pay the price, said the creative team behind the London-based art show.

    They hope to shed light on the issue with an exhibition responding to themes of gender and climate by 30 artists who are women or do not identify as male or female.

    “Climate change is sexist: it disproportionately affects women and girls precisely because they are already marginalised in our societies,” said Ashley Johnson, a member of Do The Green Thing, the environmental group which organised the show.

    “There’s gendered consequences, there’s gendered causes and there’s gendered solutions. We wanted to explore that as an idea and offer artists the chance to respond to it.”

    Experts say women and girls suffer more than men from the effects of climate change. According to the United Nations they account for 80 percent of those displaced as a result and their vulnerabilities are exposed during disasters.

    The United Nations said on Friday it will investigate allegations that survivors of a deadly cyclone in Mozambique are being forced to have sex with community leaders for food.

    More than 1,000 people died and tens of thousands were forced from their homes when Cyclone Idai hammered Mozambique before moving inland to Malawi and Zimbabwe, in one of the worst climate-related disasters to hit the southern hemisphere.

    The U.N. pledge came a day after Human Rights Watch (HRW) published accounts of female survivors who said they were abused by local leaders and as a second powerful storm, Cyclone Kenneth, pounded the impoverished southeast African nation.

    “As with any report on sexual exploitation and abuse, we are acting swiftly to follow-up on these allegations, including with the relevant authorities,” the U.N. Office for the Coordination of Humanitarian Affairs (UNOCHA) said in a statement.

    “The U.N. has a zero tolerance policy on sexual exploitation and abuse. It is not, and never will be, acceptable for any person in a position of power to abuse the most vulnerable, let alone in their time of greatest need.”

      A local community leader in the town of Tica, Nhamatanda district, told Human Rights Watch that in some cases, where access by road is impossible, local community leaders are responsible for storing the food and distributing it to families on a weekly basis. She said that, “Because the food is not enough for everyone,” some local leaders have exploited the situation by charging people to include their names on the distribution lists.

      One aid worker said that the distribution list often contains only the names of male heads of households, and excludes families headed by women. “In some of the villages, women and their children have not seen any food for weeks,” she said. “They would do anything for food, including sleeping with men in charge of the food distribution.”

      Another aid worker said that her international organization had received reports of sexual abuse of women not only in their villages, but also in camps for internally displaced people. She said they were monitoring the situation and training people to raise awareness among women and to report any cases of sexual exploitation or abuse.

    It’s hard to believe there are people in the world who deliberately recruit children into orphanages in order to make money. Yet running an orphanage can be a lucrative trade. Vulnerable ’orphans’ attract funding, donations and international volunteers.

    This phenomenon, commonly referred to as ’orphanage trafficking’ means that children are deprived of their family and exploited for profit. Some are also sexually abused or forced into labour or begging. Others are sold on for illegal adoption or servitude. Some are even used for their organs - or simply disappear.

    It comes as a shock to most people that around 80 percent of the more than eight million children in orphanages are not orphans and have at least one living parent. Most are there for reasons such as poverty, displacement, disability, or to receive an education. And some children are there because they have been trafficked.

    The largest shift in sentiment centred on the United States, it said, with a median of 45 percent of people naming U.S. power and influence as a threat in 2018, up from 25 percent in 2013, when Barack Obama was U.S. president.

    In 10 countries, including Germany, Japan and South Korea, roughly half of respondents or more saw U.S. power and influence as a major threat to their nation, up from eight in 2017 and three in 2013, the poll showed.

    In Mexico, where those concerns have spiked since the election of U.S. President Donald Trump, the percentage jumped to 64 percent, the poll showed.

    Leading aid agencies received at least 539 reports of sex abuse and harassment last year, an exclusive survey showed on Monday, a 13 percent increase on 2017 which charities said shows abuse victims are more willing to speak up.

    The reports have led to the sacking of 91 staff, with many other cases under investigation, according to the Thomson Reuters Foundation’s second annual survey of 22 leading global charities, including the United Nations (U.N.), Oxfam and CARE.

    “If we sustain momentum on this issue and keep working to ensure people feel safe coming forward to report abuse, the numbers of reported incidents will inevitably go up in the short term,” said Mike Wright, of Bond, a network for UK aid groups.

    “But as we reinforce the message that abusive behaviour will not be tolerated and continue to improve our safeguarding practices, in the long term they will fall,” he said.

    The aid industry has come under scrutiny after revelations last year that Oxfam staff used prostitutes in Haiti during an earthquake relief mission in 2010 snowballed into widespread reports of harassment and abuse in the sector.

    Uganda must cancel a beauty contest that seeks to attract more visitors by showcasing “curvy women” because it objectifies women and promotes sex tourism, campaigners said on Thursday.

    Tourism Minister Godfrey Kiwanda sparked outrage on Wednesday when he unveiled the “Miss Curvy Uganda” contest, saying the east African nation had “naturally endowed” women who should be used as “a strategy” to boost tourism.

    Women’s rights activists, politicians, church leaders and ordinary Ugandans said the contest was “state-sponsored objectification of women” and was treating women as though they were wildlife. Some are calling on Kiwanda to resign.

    More than 1,000 people have signed an online petition calling on the tourism ministry to abandon the pageant and apologise to the public.

    “In Uganda, the ministry of tourism has added ’curvy women’ on the list of ’tourism attractions’. I personally feel attacked. This is degrading women,” said Primrose Murungi, an entrepreneur and activist who started the online petition.

    Dozens of indigenous women were forcibly sterilised by Canadian health authorities, including as recently as in 2017, said the lawyer leading a class-action lawsuit against the government.

    Alisa Lombard was speaking on Thursday after appearing in Geneva at the U.N. Committee against Torture during hearings into Canada’s human rights record.

    More than 90 indigenous women in the western province of Saskatchewan contacted lawyers to join the lawsuit over forced sterilisation, said Lombard of Maurice Law, the indigenous-run firm spearheading the case.

    “This practice needs to stop,” she told the Thomson Reuters Foundation, adding that she knew of cases in 2009, 2011 and 2017.

    “If it happened then and nothing was done to prevent it, I don’t see why it wouldn’t be happening now,” Lombard said.

    A government spokeswoman said officials were still gathering information on the issue, and could not say with certainty that the practice had stopped.

    The U.N. committee will publish its findings on December 7.

  • EU leaders consider centers outside bloc to process refugees

    Draft conclusions for the European Council summit next week propose the creation of ‘disembarkation platforms.’

    European Council President Donald Tusk has proposed that EU leaders create “regional disembarkation platforms” outside the European Union, where officials could quickly differentiate between refugees in need of protection and economic migrants who would potentially face return to their countries of origin.

    The proposal is an effort to break the acute political crisis over migration and asylum that has bedeviled EU leaders since 2015 — and even threatened in recent days to topple the German government — even as the numbers of arrivals have plummeted since the peak of the crisis.

    The disembarkation platform concept — which officials said would have to be implemented in cooperation with the United Nations High Commissioner for Refugees (UNHCR) and the International Organization for Migration (IOM) — could create a formal mechanism by which the EU can bridge the divide between hard-line leaders calling for tough border controls and those insisting that EU nations obey international law and welcome refugees in need of protection.

    But the idea could also open EU leaders to criticism that they are outsourcing their political problem by creating centers for people seeking entry in countries on the periphery of the bloc. Among the potential partner nations are Tunisia and Albania, but officials say it is far too soon to speculate.

    The idea to create such facilities was suggested in 2016 by Hungarian Prime Minister Viktor Orbán, the strongest critic of the EU’s policies on migration — especially on the relocation of refugees across Europe.

    More recently, French President Emmanuel Macron has endorsed the idea, and on Sunday Italian Foreign Minister Enzo Moavero said Italy wants to officially put the idea on the table at the European Council summit.

    According to the draft guidelines, the new sites would “establish a more predictable framework for dealing with those who nevertheless set out to sea and are rescued in Search And Rescue Operations.”

    The conclusions state: “Such platforms should provide for rapid processing to distinguish between economic migrants and those in need of international protection, and reduce the incentive to embark on perilous journeys.”

      La Unión Europea estudia la idea de construir centros para el procesamiento de inmigrantes en el norte de África en un intento por disuadir a la gente de emprender viajes a través del Mediterráneo que puedan poner en riesgo su vida, según indica un documento al que ha tenido acceso The Guardian.

      El Consejo Europeo de líderes de la UE «apoya el desarrollo del concepto de plataformas de desembarque regional», según señala un borrador de conclusiones de la cumbre europea que se llevará a cabo la próxima semana.

      La UE quiere estudiar la viabilidad de instalar estos centros en el norte de África, donde comienza la mayoría de los viajes de los inmigrantes que quieren llegar a suelo europeo. «Estas plataformas podrían facilitar un procesamiento rápido que distinga entre migrantes económicos y aquellos que necesitan protección internacional, y así reducir los incentivos a embarcarse en viajes peligrosos», sostiene el documento.

      La inmigración es un tema prioritario en la agenda de la próxima cumbre de dos días que se iniciará el 28 de junio. Los líderes de la UE intentarán llegar a un consenso sobre cómo manejar la crisis de los miles de refugiados e inmigrantes que llegan a Europa cada mes.

      Los líderes de Alemania y Francia, Angela Merkel y Emmanuel Macron, se han reunido este martes cerca de Berlín para fijar una posición común respecto a la inmigración y la eurozona, en medio de los temores sobre el desmoronamiento del proyecto europeo.

      Antes de la reunión, el ministro de Hacienda francés, Bruno Le Maire, afirmó que Europa está «en proceso de desintegración». «Vemos Estados que se están cerrando, intentando encontrar soluciones nacionales a problemas que requieren soluciones europeas», señaló. Así, llamó a construir «un nuevo proyecto europeo sobre inmigración», así como sobre asuntos económicos y financieros «que consoliden a Europa en un mundo en el que Estados Unidos está a un lado, China al otro y nosotros quedamos atrapados en el medio».

      El ministro de Interior alemán, Horst Seehofer, de línea dura, está presionando a la canciller Angela Merkel para que diseñe un plan europeo para finales de mes. Alemania sigue siendo el país europeo que más solicitudes de asilo recibe. Si no hay avance a nivel europeo, Seehofer quiere que la policía de las fronteras alemanas comience a negar la entrada a los inmigrantes.

      No queda claro cómo se llevaría a la práctica la propuesta europea de «plataformas de desembarque regional», o dónde se instalarían.

      En 2016, la UE llegó a un acuerdo con Turquía que redujo drásticamente el flujo migratorio, pero al bloque le ha resultado más difícil trabajar con los gobiernos del norte de África, especialmente con Libia, punto de partida de la mayoría de las embarcaciones que intentan llegar a Europa por el Mediterráneo.

      La Comisión Europea ha rechazado la posibilidad de llegar a un acuerdo con Libia parecido al de Turquía, debido a la inestabilidad del país. Sin embargo, el anterior Gobierno de Italia pactó con las milicias y tribus libias y colaboró para reconstituir la guardia costera libia. Estas acciones han contribuido a reducir drásticamente el número de personas que intenta cruzar el Mediterráneo, pero los críticos han denunciado un aumento en las violaciones de los derechos humanos.

      Según el documento filtrado, la UE prefiere construir los centros en colaboración con ACNUR, la agencia de la ONU para los refugiados, y con la Organización Internacional para la Migración, otro organismo relacionado con la ONU que con anterioridad ha criticado la escasez de rutas legales que tienen los inmigrantes y refugiados africanos para llegar a Europa.

      Au contraire de ce que suggère le titre choisi par ce journaliste (article ci-dessous), la proposition de créer ces plateformes de débarquement n’est pas vraiment « étonnante » tant elle ressemble aux « #processings_centers » et autres « #centres_d'identification » dont les projets ressurgissent régulièrement depuis le début des années 2000. Il y a cependant des évolutions (ces centres étaient pensés pour cantonner les exilés avant qu’ils prennent la mer et pas pour débarquer les boat-people secourus en mer) et le danger se rapproche : maintenant que ces camps existent sous le nom de hotpsots dans les iles grecques, il apparaît possible de les étendre dans des pays extérieurs ayant besoin du soutien financier ou politique de l’UE.

    • Europe Pushes to Outsource Asylum, Again

      With Dublin reform stalled, European leaders began to cast around for new ideas to solve the ongoing political crisis on migration and settled on a recurring proposition: the creation of asylum processing centres beyond the (strengthened) borders of the European Union.

      What exactly is up for discussion remains unclear. The plans championed by various EU leaders are diverse, yet the details remain fuzzy. What they have in common is a near-universal focus on shifting responsibility for dealing with refugees and migrants upstream. The idea of external processing looks good on paper, particularly in demonstrating to skeptical voters that governments have control over migration flows. But leaders also hope that by reducing inflows to the European Union, they will face less pressure to compromise on sharing responsibility for asylum within the bloc.

      The devil is in the detail. Proposals to externalize the processing of asylum claims are not new, but have largely fallen flat. Previous leaders balked at the idea of such elaborate constructions, especially when confronted with their significant practical complications. But public pressure to further slow arrivals of refugee and migrant boats has mounted in many countries, and leaders feel compelled to find an agreement. The result is a debate on migration increasingly divorced from reality.

      But before sitting down to the negotiating table, EU leaders may want to reflect on the exact model they wish to pursue, and the tradeoffs involved. Critically, does the concept of “regional disembarkation platforms” set out in the draft European Council conclusions offer a potential solution?

      Key Design Questions

      From Austria’s so-called Future European Protection System, to the “centres of international protection in transit countries” suggested by Italian Prime Minister Giuseppe Conte, to an outlier idea from the Danish Prime Minister to create centres to host failed asylum seekers in “undesirable” parts of Europe —a variety of models for externalization have been floated in recent weeks.

      Several proposals also envisage the simultaneous creation of joint processing centres within the European Union, coupled with the use of reception centres that restrict residents’ freedom of movement. While it is still unclear how such a plan would unfold, this commentary focuses on the external dimension alone.

      Where Would People Be Stopped and Processed?

      The proposals differ regarding where in the journey they would stop migrants and potential asylum seekers. French President Emmanuel Macron has vaguely referred to centres in key transit countries, such as Niger, Libya, and Chad, as well as closer to regions of origin. Others have focused more squarely on the North African coast.

      Centres operating far away from the European Union would likely function as a form of resettlement, stopping people en route (or even prior to the journey), and offering selected individuals an additional channel of EU entry in hopes that this would discourage the use of smugglers. Indeed, nascent EU efforts to resettle refugees evacuated from Libya to Niger (under the Evacuation Transit Mechanism, or ETM), demonstrate how this might work. At the other extreme, the model championed by Austrian Chancellor Sebastian Kurz would see migrants and refugees returned to “safe zones” in Africa, where they would stay, even after arriving at the external EU border.

      The latter concept is problematic under current EU and international law. By returning arrivals to third countries without giving them the opportunity to submit an asylum claim, governments would be likely to run afoul of the EU Asylum Procedures Directive, as well as the European Convention on Human Rights, which prohibits signatories from the “collective expulsion of aliens.” European Court of Human Rights case law also precludes the pushback of migrants rescued by European boats while crossing the Mediterranean. Conversely, however, if migrants and potential asylum seekers are stopped before entering EU waters, and without the involvement of European-flagged vessels, then no EU Member State has formal legal responsibility.

      A framework for regional cooperation on the disembarkation of migrant boats—being developed by the UN High Commissioner for Refugees (UNHCR) —may offer a middle ground. While details are scarce, it seems likely that the proposal would focus first on the development of a system for determining who would rescue migrants crossing the Mediterranean, and where they would be landed. Absent consensus within the European Union on responsibility sharing for asylum claims, UNHCR would attempt to create a new framework for responsibility sharing with both Northern and Southern Mediterranean states on search and rescue. However, to prove palatable to partners, such a scheme would require strong EU support, not least through the creation of regional disembarkation centres across North Africa where migrants and refugees “pulled back” from their journey would be sent. This approach would sidestep the application of EU law. To be viable, the European Union would likely need to offer North African partner states some assurance of support, including resettling some of those found in need of protection (as with the Niger ETM).

      Who Would Do the Processing?

      Once asylum seekers are pulled back, there is the question of who would make determinations regarding their protection. There are three options.

      First, Member States’ own asylum agencies could adjudicate protection claims, as Macron has occasionally suggested. Aside from the logistical challenges of seconding officials outside Europe, the question quickly arises as to who would adjudicate which applications? Member States have very different asylum systems, which produce markedly different outcomes for applicants, and would need extensive coordination.

      As a result, there is growing interest in developing an EU asylum agency capable of undertaking assessments on behalf of Member States. This appears a neat solution. However, governments would have to agree joint procedures and standards for processing claims and have confidence in the decisions made by through a joint processing arrangement. This is, if anything, an option only in the long term, as it would be years before any such agency is operational.

      Should the regional disembarkation idea gain ground, the European Union would have no legal responsibility to undertake assessment. Most Member States would be likely to consider UNHCR a key partner to manage any external process. But doing so could require UNHCR to redeploy limited staff resources from existing resettlement operations or from pressing humanitarian situations elsewhere. Moreover, outsourcing to UNHCR could still raise the issue of trust and transferability of decisions. Many Member States remain reluctant to rely solely on UNHCR to select refugees for resettlement, preferring to send their own teams to do the final selection.

      What Happens Next?

      The issue of what happens to people after their protection claims are assessed remains at the crux of questions around the feasibility of external processing. Proposals here differ starkly.

      On the one hand, some proposals would allow those recognized as in need of protection to subsequently enter the European Union. This is the option that—even if the European Union has circumvented any legal responsibility—would be deemed necessary to host countries as it would give them assurance that they are not overly burdened with providing protection. But doing so would require Member States to agree on some sort of distribution system or quotas for determining who would be settled where—crashing back into a responsibility-sharing problem that has plagued the European Union.

      By contrast, proposals that would explicitly not allow entry to anyone who had attempted to travel to Europe via the Mediterranean, taking a page from Australia’s playbook, are meant to assuage fears that such centres would become magnets for new travellers. Those with protection needs brought to such centres would be settled in countries outside the bloc. The challenges with this model centre squarely on the difficulty finding a “safe” country that would allow the settlement of potentially unlimited number of protection beneficiaries. Neither is likely to be the case in any arrangements the European Union would seek to make with external countries.

      Finally, there is the troubling question of what to do with those denied status or resettlement in the European Union. While the International Organization for Migration (IOM) or another agency might be able to help facilitate voluntary return, some might not be able to return home or may have been denied resettlement but nonetheless have protection needs. They are at risk of becoming a population in limbo, with long-term implications for their well-being and for the host country.

      The European Union’s most senior migration official has admitted that no north African country has yet agreed to host migrant screening centres to process refugee claims.

      Details of an EU plan to prevent migrants drowning at sea emerged on Thursday after Italy criticised the agenda of an emergency summit for not offering enough to help it cope with arrivals.

      Dimitris Avramopoulos, the European commissioner for migration, said the EU wanted to “intensify cooperation” with Algeria, Egypt, Libya, Tunisia, Niger and Morocco, as he announced the intention to create a “regional disembarkation scheme”.

      So far no African country had agreed to host screening centres, he confirmed. “It has to be discussed with these countries, he said. “An official proposal has not been put on the table.”

      The idea for offshore migrant processing centres remains sketchy, with numerous political, practical and legal questions unanswered. It remains unclear, for example, whether migrants on a rescue ship in European waters could be returned to a north African country.

      Tahar Cherif, the Tunisian ambassador to the EU said: “The proposal was put to the head of our government a few months ago during a visit to Germany, it was also asked by Italy, and the answer is clear: no!

      “We have neither the capacity nor the means to organise these detention centres. We are already suffering a lot from what is happening in Libya, which has been the effect of European action.”

      He said his country was facing enough problems with unemployment, without wishing to add to them while Niger said its existing centres taking migrants out of detention camps in Libya are already full.

      The idea for the centres was thrown into the mix of EU migration policy before a series of crucial summits on migration in the next week.

      About 10 EU leaders will meet in Brussels on Sunday in a hastily convened emergency meeting aimed at preventing the collapse of the German coalition government.

      But the Italian government has been angered by draft conclusions for the summit, which stress the need to counter “secondary movements” – an issue that affects Germany.

      Under EU rules, a member state usually has responsibility for asylum seekers who have arrived in its territory, a regulation that has put frontline states Italy and Greece under huge pressure.

      But claimants often move to a second EU state, seeking a faster decision or to unite with family members.

      So-called “secondary movements” is the issue driving a wedge between Germany’s ruling coalition. The Bavarian CSU party has set the chancellor, Angela Merkel, a deadline of two weeks to find a solution. The interior minister, Horst Seehofer, has threatened to send away migrants at the border – a breach of EU rules that threatens to unravel the common asylum system.

      Tensions are running high after Italy’s prime minister, Giuseppe Conte, said he was not ready to discuss secondary movements “without having first tackled the emergency of ‘primary movements’ that Italy has ended up dealing with alone”.

      Italy’s far-right interior minister, Matteo Salvini, said: “If anyone in the EU thinks Italy should keep being a landing point and refugee camp, they have misunderstood.”

      The election of a populist government in Italy, combined with tensions in Germany’s ruling coalition, has created a political storm over migration despite the sharp fall in arrivals. In the first six months of this year 15,570 people crossed into Italy, a 77% drop on last year.

      The European commission president, Jean-Claude Juncker, reluctantly agreed to host the weekend summit to help Merkel, after her governing coalition came close to breaking point.

      Avramopoulos stressed that the summit would be about “consultations” to prepare the ground for decisions to be taken by all 28 EU leaders at a European council meeting next Thursday.

      Warning that the future of the EU’s border-free travel area was at stake, Avramopoulos said: “The European leadership of today will be held accountable in the eyes of future generations if we allow all these forces of populism to blow up what has been achieved”.

    • IOM-UNHCR Proposal to the European Union for a Regional Cooperative Arrangement Ensuring Predictable Disembarkation and Subsequent Processing of Persons Rescued at Sea

      Approximately 40,000 refugees and migrants have arrived in Europe via maritime routes in 2018 to date. This is almost six times less than over the same period in 2016, following a peak in arrivals by sea in 2015. According to EUROSTAT, approximately 30 per cent of those arriving on the European shores were in need of international protection; moreover, some have faced extreme hardship and abuse at the hands of unscrupulous traffickers during the journey.

      Despite the reduced arrival rates, new challenges resulting from divergent EU Member State views have revealed a need to revisit regional arrangements to relieve front line states from having the sole responsibility for the disembarkation and further processing of people rescued at sea.

      IOM and UNHCR stand ready to support a common approach, and call on all countries in the Mediterranean region to come together to implement a predictable and responsible disembarkation mechanism in a manner that prioritizes human rights and safety first, delinked from the subsequent processing of status and related follow-up responsibilities, post-disembarkation, for those rescued in international waters.

      It is increasingly recognized that disembarkation cannot be the sole responsibility of one country or regional grouping. It should be a shared responsibility across the Mediterranean Basin, with due respect for the safety and dignity of all people on the move. A comprehensive approach is required to realize effective and sustainable responses.

      People on the move to and through the Mediterranean have different migratory status, with the majority of them not qualifying for international or subsidiary protection. Addressing the drivers of forced displacement and irregular migration needs to be given renewed attention through effective conflict-prevention and crisis settlement processes, strengthening good governance, rule of law, and respect for human rights efforts, stabilization and recovery, as well as poverty reduction.

      Priority efforts need to focus on strengthening protection capacities in regions of origin, including through developing sustainable asylum systems; providing sufficient needs-based support for humanitarian operations and adopting a development-oriented approach to assistance; as well as expanding opportunities for resettlement, family reunification and safe pathways for refugees which are currently well below existing needs and pledges being made. Efforts toward opening safe and regular pathways for migrants need also to be undertaken (family reunification, labour and education opportunities, humanitarian visas for vulnerable migrants).

      Against this background, with a focus on the immediate disembarkation concerns at hand, the current proposal for a regional disembarkation mechanism aims to ensure that:

      People rescued-at-sea in international waters are quickly disembarked in a predictable manner in line with international maritime law, in conditions that uphold respect for their rights including non-refoulement, and avoid serious harm or other risks;
      Responsible post-disembarkation processing, supported – as appropriate- by IOM and UNHCR, leads to rapid and effective differentiated solutions and reduces onward movement through an effective cooperative arrangement.

      Functioning of the mechanism is premised on a set of principles and common objectives:

      The effective functioning of maritime commerce requires ships’ masters to have full confidence in prompt and predictable disembarkation;
      Efforts to reduce loss of life at sea are maximized, in line with existing international obligations and frameworks, and saving lives remains the international community’s priority;
      Strengthened efforts to build the capacity of Coast Guards in Mediterranean countries (not just in Libya) to perform effective rescue operations in their respective SAR;
      National Maritime Rescue Coordination Centres (MRCC) are able to carry out their work effectively for the purposes of search and rescue operations based on long- standing and effective practices to save lives;
      People rescued at sea in the Mediterranean are quickly disembarked in safe ports in a predictable manner in line with established rescue at sea arrangements and international maritime law, coordinated through the responsible MRCCs;
      Measures for cooperative arrangements to support States providing for disembarkation are well-established;
      The right to seek asylum is safeguarded, and the human rights of all individuals such as non-refoulement are respected, including the right not to be disembarked in or transferred to a place where there is a risk of persecution, torture, or other serious harm;
      Efforts to address human smuggling and trafficking are reinvigorated, including measures to ensure protection and/or referrals for victims of trafficking and ensuring the effective prosecution of those involved in / or facilitating human trafficking or smuggling;
      Rescue at sea capacity coordinated by effective MRCCs that operate in accordance with international law is reinforced.

      As such, the proposal does not affect existing legal norms and responsibilities applicable under international law (Note 1) Rather it seeks to facilitate their application in accordance with a regional collaborative approach and the principle of international cooperation. This proposal relies on functional arrangements for intra-EU solidarity in managing all consequences of rescue, disembarkation and processing. It also relies on operational arrangements which would need to be sought and formalised through a set of understandings among all concerned States.

Cela n’est pas encore défini, mais ce seront des installations fermées et surveillées parce que les détenus devront être « enregistrés » et les personnes non autorisées seront expulsées. Ils ne pourront pas s’enfuir.

      L’intérêt pour les camps concerne également les responsables politiques allemands. Le gouvernement allemand veut élargir le no man’s land à la frontière germano-autrichienne afin que les réfugiés puissent être arrêtés avant d’entrer officiellement en Allemagne et avoir ainsi droit à une procédure d’asile régulière. Une « fiction de non-entrée » est créée, comme le stipule précisément l’accord. Un État qui magouille. Pendant ce temps, la chancelière Angela Merkel a déclaré que personne ne sera détenu plus de quarante-huit heures, même dans le no man’s land. Il reste encore à voir si l’Autriche y accédera. Le plan est pour l’instant plus un fantasme qu’une politique réalisable, ce qui est bien pire. Bien sûr, tous ces centres fermés de rassemblement de migrants ne peuvent pas être appelés camps. Cela évoquerait des images effrayantes : les camps de concentration nazis, le système des goulags soviétiques, les camps de réfugiés palestiniens de plusieurs générations, le camp de détention de Guantánamo.

      Non, en Allemagne, ces « non-prisons » devraient être appelées « centres de transit ». Un terme amical, efficace, pratique, comme la zone de transit d’un aéroport où les voyageurs changent d’avion. Un terme inventé par les mêmes personnes qui désignent le fait d’échapper à la guerre et à la pauvreté comme du « tourisme d’asile ». Les responsables politiques de l’UE sont encore indécis quant à la terminologie de leurs camps. On a pu lire le terme de « centres de protection » mais aussi celui de « plateformes d’atterrissage et de débarquement », ce qui fait penser à une aventure et à un voyage en mer.

      Tout cela est du vernis linguistique. La réalité est que l’Europe en est maintenant à créer des camps fermés et surveillés pour des personnes qui n’ont pas commis de crime. Les camps vont devenir quelque chose qui s’inscrit dans le quotidien, quelque chose de normal. Si possible dans des endroits lointains et horribles, si nécessaire sur place. Enfermer, compter, enregistrer.

      La facilité avec laquelle tout cela est mis en œuvre est déconcertante. Deux ans seulement après que le public européen a condamné l’Australie pour ses camps brutaux de prisonniers gérés par des sociétés privées sur les îles de Nauru et Manus, dans l’océan Pacifique, nous sommes prêts à abandonner nos inhibitions. Pourquoi ne pas payer les Libyens pour intercepter et stocker des personnes ?

      Derrière le terme allemand « Lager » (« camp ») se cache un ancien mot correspondant à « liegen », qui signifie « être allongé ». Les camps sont ainsi faits pour se reposer. Aujourd’hui, le terme de « camp » implique quelque chose de temporaire : un camp n’est que pour une courte période, c’est pourquoi il peut aussi être rustique, comme un camp de vacances pour les enfants ou un dortoir. Des camps d’urgence sont mis en place après des catastrophes, des inondations, des glissements de terrain, des guerres. Ils sont là pour soulager les souffrances, mais ne doivent pas être permanents.

      Si les responsables politiques participent activement à l’internement de personnes dans des camps en l’absence de catastrophe, alors il s’agit d’autre chose. Il s’agit de contrôle, d’#ordre, de #rééducation, de #domination. Les puissances coloniales tenaient des camps, depuis les camps de barbelés des Britanniques au Kenya jusqu’aux camps de Héréros dans le Sud-Ouest africain. C’est dans des camps que les États-Unis ont enfermé des Américains d’origine japonaise pendant la Seconde Guerre mondiale. Les responsables de ces camps n’avaient pas pour préoccupation le logement, mais bien la garde et la gestion de « personnes problématiques ».

      Dans de tels camps, la #violence extrême et la #déshumanisation des détenus allaient et vont généralement de pair avec une gestion froide. Exploiter un camp nécessite de l’#organisation. La technologie de #contrôle à distance aide le personnel à commettre des atrocités et transforme des gens ordinaires en criminels. Dans son essai controversé « Le siècle des camps », le regretté sociologue #Zygmunt_Bauman qualifie le camp de symptôme de #modernité. Pour lui, l’association d’une #exclusion_brutale et d’une #efficacité dans l’ordre semblable à celle d’un jardinier est une caractéristique de notre époque.

      Que Bauman fasse des camps de concentration nazis un « distillat » d’un problème majeur et moderne pour sa thèse lui a justement valu des critiques. Il ignore la singularité de l’Holocauste. Contrairement aux camps coloniaux, les camps de concentration étaient en effet des camps d’extermination qui n’avaient plus pour fonction d’apprêter des groupes ou de les rééduquer, ni même de les dissuader. Il s’agissait de « violence pour elle-même », comme l’écrit le sociologue #Wolfgang_Sofsky, de folie de la #pureté et d’éradication des personnes #indésirables.

      L’Europe croit être à l’abri de cette folie. Pour les gouvernants allemands, le slogan « Plus jamais de camps en Allemagne » est un slogan ridicule parce qu’il évoque des images qui n’ont rien à voir avec le présent. Dans les différents camps de migrants en Europe et à l’extérieur, il n’est certes pas question d’une extermination mais « seulement » de contrôle de l’accès et de #dissuasion. C’est ce dernier objectif qui est explicitement recherché : répandre dans le monde l’idée de camps de l’horreur au lieu du paradis européen.

      Mais il n’y a pas de raison de maintenir la sérénité. L’analyse de Zygmunt Bauman parlait de la mince couche de #civilisation par-dessus la #barbarie. La leçon tirée de l’expérience des camps du XXe siècle est la suivante : « Il n’y a pas de société ordonnée sans #peur et sans #humiliation ». La #pensée_totalitaire peut à nouveau prospérer, même dans les sociétés apparemment démocratiques.

    • Record deaths at sea: will ‘regional disembarkation’ help save lives?
      ❝What is the aim of European policy on Mediterranean migration?

      Europe’s strategic ambition is clear: reduce the number of people who embark on journeys across the Mediterranean by boat. The more European countries struggle to share responsibility for those who are rescued at sea and brought to Europe, the stronger the desire to dissuade migrants from getting on a boat in the first place. Moreover, stemming the departures is said to be the only way of reducing the death toll.

      The challenge, as the European Council put it, is to ‘eliminate the incentive to embark’ on journeys across the Mediterranean. And the new migration agreement proposes a solution: setting up ‘regional disembarkation platforms’ outside the European Union. The logic is that if people rescued at sea are sent back to the coast they left, nobody will take the risk and pay the cost of getting on smugglers’ boats.
      Would this even work?

      Addressing the challenges of irregular migration is truly difficult. Still, it is baffling how the proposal for regional disembarkation platforms is embroiled in contradictions. The agreement itself is scant on specifics, but the challenges will surface as the policy makers have to make key decisions about how these platforms would work.

      First, will they be entry points for seeking asylum in Europe? The agreement suggests that the platforms might play this role. But if the platforms are entry points to the European asylum procedure, they will attract thousands of refugees who currently have no other option to apply for asylum in Europe than paying smugglers to set out to sea.

      This scenario raises a second question: what will be the possible ways of accessing the platforms? If they are reserved for refugees who have paid smugglers and are rescued at sea, access to protection will be just as reliant on smugglers as it is today. But if anyone can come knocking on the gate to the platforms, without having to be rescued first, the asylum caseload would swell. Such an outcome would be unacceptable to EU member states. As a recent EC note remarked, ‘to allow individuals to “apply” for asylum outside the EU […] is currently neither possible nor desirable.

      These two questions lay out the basic scenarios for how the regional disembarkation platforms would operate. Thinking through these scenarios it’s not clear if these platforms can ever be workable. Moreover, putting these platforms in place directly contradicts the European Council’s stated objectives:

      – dissuading smuggling journeys
      – distinguishing individual cases in full respect of international law
      – not creating a pull factor

      How does this relate to broader EU policies on migration?

      In some way, regional disembarkation platforms are a logical next step along the course the EU has been pursuing for years now. To stop refugees and other migrants from reaching its shores, the EU has been using a multi-pronged approach. On the one hand, the bloc has increased the use of aid to tackle the ‘root causes’ of migration – the logic being that if potential migrants are given other opportunities (e.g. skills training), they will be deterred from leaving. Similarly, information campaigns targeting aspiring migrants seek to deter people from setting out on dangerous journeys.

      Another major focus has been that of externalisation of border management – basically shifting border management to countries outside the EU: a key component of the EU-Turkey Deal is Turkey agreeing to take back refugees who crossed into Greece. Externalisation serves two purposes: keeping migrants physically out of Europe, but also as a deterrence measure sending potential migrants the implicit message that it won’t be easy to come to Europe.

      Regional disembarkation platforms are part of this process of externalisation. But there are key differences that make this proposal more extreme than policies pursued so far. Other externalization measures have aimed at preventing potential asylum seekers from reaching the point where they become eligible to launch a claim in Europe. The platforms will apparently serve a different role, by enabling the physical return of asylum seekers who have become Europe’s responsibility after being rescued by European ships in international waters.
      What do we know about efforts to deter irregular migration?

      The dim outlook for regional disembarkation platforms reflects more general limitations of deterrence measures in migration policy. Using decades worth of data, Michael Clemens and colleagues have shown that along the US-Mexico border greater deterrence and enforcement efforts have only reduced irregular migration when accompanied by greater legal migration pathways. Research by ODI has shown that information about deterrence measures and anti-migration messages rarely featured in migrant decision-making process. We will explore this further in our upcoming MIGNEX research project, which includes large-scale analyses of the drivers of migration in ten countries of origin and transit.
      Blocking access to asylum is not a life-saving measure

      The European Council presents regional disembarkation platforms as a strategy for ‘preventing tragic loss of life’. The irony of this argument is that these platforms will only deter sea crossings if they are dead ends where people who are rescued at sea are barred from seeking asylum in Europe. It is difficult to see how such a setup would be legally feasible, or indeed, ‘in line with our principles and values’, as the Council states.

      If the legal obstacles were overcome, there may indeed be fewer deaths at sea. But some of the deaths would simply occur out of sight instead. Refugees flee danger. Blocking access to seeking asylum puts more lives at risk and cannot be justified as a measure to save lives at sea.

      For now, the European Council glosses over the dilemmas that the regional disembarkation platforms will create. Facing the realities of the situation would not make perfect solutions appear, but it would enable an open debate in search of a defensible and effective migration policy.

    • Austrian Presidency document: “a new, better protection system under which no applications for asylum are filed on EU territory”

      A crude paper authored by the Austrian Presidency of the Council of the EU and circulated to other Member States’s security officials refers disparagingly to “regions that are characterised by patriarchal, anti-freedom and/or backward-looking religious attitudes” and calls for “a halt to illegal migration to Europe” and the “development of a new, better protection system under which no applications for asylum are filed on EU territory,” with some minor exceptions.

      More sustainable and more effective return measures as well as establishment of instruments that foster third countries’ willingness to cooperate on all relevant aspects, including the fight against people smuggling, providing protection and readmission;
      Development of a holistic concept for a forward-looking migration policy (in the spirit of a “whole of government approach“) and a future European protection system in cooperation with third countries that is supported by all and does not overburden all those involved – neither in terms of resources nor with regard to the fundamental rights and freedoms they uphold.

      2.2. By 2025

      By 2025 the following goals could be realised:

      Full control of the EU’s external borders and their comprehensive protection have been ensured.
      The new, better European protection system has been implemented across the EU in cooperation with third countries; important goals could include:
      no incentives anymore to get into boats, thus putting an end to smuggled persons dying in the Mediterranean;
      smart help and assistance for those in real need of protection, i.e. provided primarily in the respective region;
      asylum in Europe is granted only to those who respect European values and the fundamental rights and freedoms upheld in the EU;
      no overburdening of the EU Member States’ capabilities;
      lower long-term costs;
      prevention of secondary migration.
      Based on these principles, the EU Member States have returned to a consensual European border protection and asylum policy.”

      And includes the following statements, amongst others:

      “...more and more Member States are open to exploring a new approach. Under the working title “Future European Protection System” (FEPS) and based on an Austrian initiative, a complete paradigm shift in EU asylum policy has been under consideration at senior officials’ level for some time now. The findings are considered in the “Vienna Process” in the context of which the topic of external border protection is also dealt with. A number of EU Member States, the EU Commission and external experts contribute towards further reflections and deliberations on these two important topics.”

      “...ultimately, there is no effective EU external border protection in place against illegal migration and the existing EU asylum system does not enable an early distinction between those who are in need of protection and those who are not.”

      “Disembarkment following rescue at sea as a rule only takes place in EU Member States. This means that apprehensions at sea not only remain ineffective (non-refoulement, examination of applications for asylum), but are exploited in people smugglers’ business models.”

      “Due to factors related to their background as well as their poor perspectives, they [smuggled migrants] repeatedly have considerable problems with living in free societies or even reject them. Among them are a large number of barely or poorly educated young men who have travelled to Europe alone. Many of these are particularly susceptible to ideologies that are hostile to freedom and/or are prone to turning to crime.

      As a result of the prevailing weaknesses in the fields of external border protection and asylum, it is to be expected that the negative consequences of past and current policies will continue to be felt for many years to come. As experience with immigration from regions that are characterised by patriarchal, anti-freedom and/or backward-looking religious attitudes has shown, problems related to integration, safety and security may even increase significantly over several generations.”

    • Libya rejects EU plan for refugee and migrant centres

      Blow to Italy as Tripoli snubs proposal to set up processing centres in Africa

      Libya has rejected a EU plan to establish refugee and migrant processing centres in the country, adding that it would not be swayed by any financial inducements to change its decision.

      The formal rejection by the Libyan prime minister, Fayez al-Sarraj, is a blow to Italy, which is regarded as being close to his Tripoli administration.

      In June, Italy proposed reception and identification centres in Africa as a means of resolving divisions among European governments.

      The impasse came as the EU said it was willing to work as a temporary crisis centre to oversee the distribution of refugees and migrants from ships landing in Europe from Libya. Italy has said it is not willing to open its ports and may even reject those rescued by the EU Sophia search and rescue mission, a position that has infuriated other EU states.

      Speaking to the German newspaper Bild, Serraj said: “We are absolutely opposed to Europe officially wanting us to accommodate illegal immigrants the EU does not want to take in.”

      He dismissed accusations that Libya’s coastguard had shot at aid workers in ships trying to rescue people from the Mediterranean.

      “We save hundreds of people off the coast of Libya every day – our ships are constantly on the move,” he said. In practice, Libya is already running detention camps, largely as holding pens, but they are not run as EU processing centres for asylum claims.

      European foreign ministers agreed at a meeting on Monday to do more to train the Libyan coastguard by setting up the EU’s own training team inside Libya.

      The European parliament president, Antonio Tajani, said after a trip to Niger, one of the chief funnels for people into Libya, that the EU needed to plough more money into the Sahel region to reduce the need to leave the area. He said the number of people reaching Libya from Niger was collapsing.

      Tajani said: “Until 2016, 90% of irregular migrants travelled through the Niger to Libya and Europe. In just two years, Niger reduced migration flows by 95%, from over 300,000 to about 10,000 in 2018.”

      He said he would host a European conference in Brussels in October to support democratic elections in Libya scheduled for December.

      At the same time, Italy is to host a further conference in Rome in September seen as a follow-on to a conference held in May by the French president, Emmanuel Macron, that led to a commitment to hold elections this year.

    • UNHCR ed OIM discutono con la Commissione europea sulle piattaforme di sbarco, ma gli stati dicono no.

      Lunedì 30 luglio si svolgerà a Ginevra un incontro di rappresentanti dell’UNHCR e dell’OIM con la Commissione Europea per discutere sulle piattaforme di sbarco che Bruxelles vorrebbe imporre nei paesi di transito, come gli stati nordafricani, e negli stati di sbarco, soprattutto in Italia. Per selezionare rapidamente migranti economici e richiedenti asilo, e dunque procedere al respingimento immediato dei primi, senza alcuna garanzia di difesa, ed all’avvio delle procedure di asilo, per gli altri, senza alcuna garanzia di resettlement o di relocation ( ricollocazione) in un paese diverso da quello di primo ingresso. La Commissione dichiara che, soltanto dopo avere trovato un “approccio comune a livello europeo “, si rivolgeranno proposte ai paesi terzi. Gli stati nordafricani hanno però respinto in blocco questa proposta, e le autorità locali dei paesi di primo ingresso più interessati dagli sbarchi, confernano la loro opposizione a nuovi Hotspot. Le risorse previste per questa esternalizzazione delle frontiere sono ridicole. Per non parlare dei costi in termini di vite e di sfregio dei diritti umani.

      Un progetto che si salda strettamente con l’incremeno degli aiuti alla sedicente Guardia costiera “libica”, alla quale si affida già adesso, nella prassi quotidiana, un numero sempre più elevato di intercettazioni in acque internazionali, di fatto respingimenti collettivi, perchè realizzati con il coordinamento e l’assistenza di unità militari della Marina italiana che ha una base a Tripoli, nell’ambito della missione Nauras. Intanto la accresciuta assistenza italiana alla Marina ed alla Guardia costiera di Tripoli rischia di contribuire all’inasprimento del conflitto tra le diverse milizie ed allontana le probabilità di una reale pacificazione, premessa indispensabile per lo svolgimento delle elezioni. Le stesse milizie che continuano a trattenere in Libia, in condizioni disumane, centinaia di migliaia di persone.

      Dietro la realizzazione delle “piattaforme di sbarco” in Nordafrica, proposte anche dal Consiglio europeo del 28 giugno scorso, il ritiro dalle responsabilità di coordinamento dei soccorsi in acque internazionali da parte degli stati che fin qui ne sono stati responsabili in conformità al diritto internazionale generalmente riconosciuto. Per ragioni diverse, nè la Tunisia, ne la Libia, possono essere riconosciuti come “paesi terzi sicuri” con porti di sbarco che siano qualificabili come place of safety. Come avveniva fino a qualche mese fa, secondo il diritto internazionale, dopo i soccorsi in acque internazionali, i naufraghi vanno sbarcati non nel porto più vicino, na nel porto sicuro più vicino. Ma questa regola, a partire dal caso della nave Aquarius di SOS Mediterraneè, il 10 giugno scorso, è stata continuamente violata dal governo italiano e dalle autorità amministrative e militari che questo governo controlla. Molto grave, ma prevedibile, il comportamento di chiusura da parte di Malta, che continua a trattenere sotto sequstro due navi umanitarie, la Lifeline e la Seawatch. Sempre più spesso le dispute tra stati che negano a naufraghi un porto sicuro di sbarco rischiano di fare altre vittime

      La soluzione che si prospetta adesso con la nave SAROST 5,dopo gli appelli delle ONG tunisine, lo sbarco a Zarzis dei migranti soccorsi il 15 luglio, un caso eccezionale ben diverso da altri soccorsi operati in precedenza in acque internazionali, non costituisce un precedente, perchè la SAROST 5 batte bandiera tunisina. Dunque i naufraghi a bordo della nave si trovavano già in territorio tunisino subito dopo il loro recupero in mare. In futuro, quando i soccorsi in acque internazionali saranno comunque operati da imbarcazioni miitari o private ( incluse le ONG) con diversa bandiera, il problema del porto sicuro di sbarco si proporrà in termini ancora più gravi, con un ulteriore incremento delle vittime e delle sofferenze inflitte ai sopravvissuti, a fronte dei dinieghi degli stati che non rispettano il diritto internazionale ed impediscono la individuazione, nei tempi più rapidi, di un vero “place of safety”.

      Nel 2013 il caso del mercantile turco SALAMIS, che sotto cooordinamento della Centrale operativa (IMRCC) di Roma, aveva soccorso naufraghi a sud di Malta, in acque internazionali, si era concluso con lo sbarco in Italia, in conformità del diritto internazionale. Con lo sbarco dei migranti soccorsi dalla SAROST 5 nel porto di Zarzis,in Tunisia, per ragioni di emergenza sanitaria, si consuma invece una ennesima violazione del diritto internazionale, dopo i rifiuti frapposti dalle autorità italiane e maltesi. Stati che creano sofferenze, come strumento politico e di propaganda, fino al punto da costringere i comandanti delle navi a dichiarare lo stato di emergenza. Alla fine il governo tunisino, nel giorno della fiducia al governo e dell’insediamento del nuovo ministro dell’interno, ha ceduto alle pressioni internazionali, ed ha accettato per ragioni umanitarie lo sbarco di persone che da due settimane erano bloccate a bordo di un rimorchiatore di servizio ad una piattaforma petrolifera, in condizioni psico-fisiche sempre più gravi. Un trattamento inumano e degradante imposto da quelle autorità e di quegli stati che, immediatamente avvertiti dal comandante della SAROST 5 quando ancora si trovava in acque internazionali, hanno respinto la richiesta di garantire in tempi più rapidi ed umani un porto di sbarco sicuro.

      Di fronte al probabile ripetersi di altri casi di abbandono in acque internazionali, con possibili pressioni ancora più forti sulla Tunisia, è importante che l’UNHCR e l’OIM impongano agli stati membri ed all’Unione Europea il rispetto del diritto internazionale e l’obbligo di soccorso in mare, nel modo più immediato. Le prassi amministraive di “chiusura dei porti” non sono sorrette ada alcuna base legale, e neppure sono concretizzate in provvedimenti amministrativi, motivati ed impugnabili davanti ad una qualsiasi autorità giurisdizionale. Non si può continuare a governare tratendo in inganno il corpo elettorale, distorcendo persino le posizioni delle grandi organizzazioni internazionali. Fino ad un mese fa sia l’UNHCR che l’OIM avevano respinto la proposta della Commissione che voleva creare piattaforme di sbarco al di fuori dei confini europei. Una proposta che adesso viene ripresentata con vigore ancora maggiore, sotto la presidenza UE affidata all’Austria di Kurz, con la spinta di Orban e di Salvini verso la “soluzione finale” verso migranti ed ONG.

      Le Nazioni Unite conoscono bene la situazione in Libia. Occorre garantire a tutti i naufraghi soccorsi in acque internazionali un porto sicuro di sbarco, che non deve essere quello più vicino, se non offre la piena garanzia di una tutela effettiva dei diritti fondamentali e del diritto di chiedere asilo delle persone sbarcate. Non basta la presenza fisica di operatori dell’UNHCR e dell’OIM in alcuni punti di sbarco, come si sta verificando da mesi in Tripolitania, per riconoscere l’esistenza di un place of safety in paesi che anche secondo le grandi istituzioni internazionali, come per i tribunali italiani, non sono in grado di garantire place of safety in conformità alle Convenzioni internazionali.

      Se si dovesse decidere di riportare i migranti intercettati in acque internazionali e sbarcati nei paesi nordafricani, ammesso che posa succedere( anche se i migranti considerati “illegali” in Nordafrica saranno costretti a firmare una richiesta di resettlement, se non di rimpatrio volontario), magari per essere riportati indietro in un campo profughi in Niger, sarebbero violati i principi base di protezione delle persone, in quanto eseri umani, ai quali si ispirano le Convenzioni internazionali e la Costituzione italiana. La Convenzione di Ginevra non esclude il diritto dei richeidenti asilo a rivolgersi ad paese piuttosto che ad un altro. L’evacuazione dalle aree di crisi non esclude il diritto di accesso alle frontiere di un paese europeo perchè la richiesta di asilo sua valutata con le garanzie sostanziali e procedurali previste dalla normativa interna e sovranazionale.

      Se l’UNHCR e l’OIM cederanno alle pressioni dei governi, diventeranno complici degli abusi che i migranti continuano a subire nei paesi del nordafrica nei quali vengono respinti e detenuti.

      Le Organizzazioni non governative che, insieme ai naufraghi che soccorrono, continuano ad essere bersaglio di una campagna di odio che non accenna ad attenuarsi, continueranno, nei limiti dei propri mezzi a denunciare quanto accade ed a soccorrere le persone che in acque internazionali potranno raggiungere prima che facciano naufragio. La loro attività di ricerca e salvataggio appare tuttavia fortemente ridotta, anche per la illegittima “chiusura dei porti” decisa dal governo italiano, in assenza di qualsiasi provvedimento che ne fornisca una base legale, tale almeno da potere essere impugnato. Una lesione forse irreversibile dello stato di diritto (rule of law) alle frontiere marittime.Una responsabilità ancora maggiore per le autorità militari alle quali sarebbe affidato il coordinamento delle attività di ricerca e soccorso in mare (SAR). La percentuale delle vittime calcolate sul numero dei migranti che ancora riescono a fuggire dalla Libia non è mai stata tanto alta. Non si deve ridurre il valore del rispetto della vita umana alla riduzione numerica degli arrivi o dei soccorsi in mare.

      Dietro la conclamata esigenza di contrastare i trafficanti si cela una micidiale arma elettorale che sta permettendo il capovolgimento della narrazione dei fatti e la criminalizzazione della solidarietà. Il ruolo delle città dell’accoglienza e dei rappresentanti politici che ancora si oppongono a questa deriva disumana contro i migranti e le ONG, devono passare dalle parole ai fatti e dare concretezza alle dichiarazioni di solidarietà ed all’impegno di aprire i porti, ed aprire le città. Tutti i cittadini solidali sono chiamati ad esporsi in prima persona, saldando il ruolo delle autonomie locali con la capacità di autorganizzazione. Sarà una stagione lunga e dolorosa di conflitto, senza una rappresentanza polkitica capace di praticare una vera opposizione. Ma non ci sono possibilità di mediazione con chi dimostra di valutare una parte dell’umanità come “untermenschen” ( sottouomini), praticando l’abbandono in mare ed il respingimento collettivo verso luoghi di internamento e tortura, in modo da creare le premesse per una discriminazione istituzionale che nei territori si sta già traducendo in una violenza diffusa contro i più deboli. Oggi tocca ai migranti, dai naufraghi a quelli accolti nei centri in Italia, domani saranno nel mirino le componenti minoritarie dell’intera popolazione.

      Foreign Minister of the Presidential Council’s government Mohamed Sayala said Libya refuses the idea of setting up reception centres for irregular migrants on its territory, as did Tunisia, Algeria and Morocco.

      “The country’s immigrant housing centres are sheltering around 30,000 immigrants, and Libya has cooperated with the European Union to return migrants to their countries of origin, but some countries refused to receive them,” Sayala said to the Austrian newspaper Die Presse.

      “Libya has signed agreements with Chad, Niger and Sudan to enhance the security of the crossing borders in order to curb the flow of migrants,” the Foreign Minister added.

    • Refugee centers in Tunisia ’out of the question’, president says

      The Tunisian President, Beji Caid Essebsi, has said his country will not host EU refugee reception centers. He also told DW that Tunisia was a safe country, despite a terrorist attack in the capital earlier this week.

      President Essebsi made the statement in Berlin, where he attended Chancellor Angela Merkel’s African business summit. In an interview with DW’s Dima Tarhini, the 91-year-old leader said opening refugee reception centers in countries such as Tunisia was “out of the question.”

      “Tunisia has much more experience with refugees than many European countries. After the Libyan revolution, more than 1.3 million refugees from various countries streamed into Tunisia. Fortunately, most of them returned to their home countries with our help. Europe has never experienced anything comparable. And we, unlike Europe, do not have the capacities to open reception centers. Every country needs to pull its own weight on this issue.”

      The European Union wants greater cooperation on migration with North African nations Algeria, Egypt, Libya, Tunisia, Niger and Morocco. Earlier this year, the EU migration commissioner announced a plan for a “regional disembarkation scheme”. Under the proposed deal, African countries would host migrant screening centers to process refugee claims. The Tunisian government has already expressed opposition to the idea.

      Despite terrorism, a ’safe country’

      During President Essebsi’s visit to Berlin, a 30-year-old woman blew herself up with a homemade bomb in the Tunisian capital, injuring at least eight people.

      “We thought we had eradicated terrorism, but it turns out that it still exists and that it can strike in the heart of the capital,” President Essebsi said in a statement to the press.

      The suicide attack led to renewed questions about whether Tunisia should be considered a safe country of origin for asylum seekers.

      Tarhini: In Germany, in the context of repatriating asylum-seekers, it has been questioned just how safe Tunisia really is. Tunisia is considered a safe North African country. What is your opinion on this?

      Beji Caid Essebsi: "Tunisia is a safe country; that is the truth. It is much safer than many other countries. Regarding refugees and the problem that they pose for Europe and other regions: Tunisia guarantees the freedom of its citizens, no matter what their conduct. If Tunisians abroad do something wrong and are sent back, then we will take them in. But not citizens of other countries.

    • Les plateformes de débarquement pour migrants enterrées ?

      « Les Plateformes de débarquement en Afrique ne sont plus à l’ordre du jour et n’auraient jamais dû l’être », a déclaré le président de la Commission européenne Juncker, ce 26 octobre, lors d’une conférence de presse à Tunis avec le Premier ministre tunisien, Youssef Chahed .

      Etonnant ? Rembobinons la bande-son 4 mois en arrière...

      Les plateformes de débarquement sont une proposition de la Commission européenne faite, à Bruxelles, le 28 juin lors d’un Conseil européen. Son objectif était d’empêcher l’arrivée des personnes migrantes, dites irrégulières, sur le sol européen. Comment ? En les bloquant, en amont, dans des centres fermés, le temps d’examiner leur profil et demande. Et en y débarquant systématiquement les naufragés repêchés en Méditerranée. Ces plates-formes seraient situées sur les côtes africaines notamment en Tunisie et au Maroc. L’Egypte a été également évoquée.

      Cette proposition s’inscrivait dans l’approche dominante de « l’externalisation » de la gestion des frontières prônée de façon croissante par les institutions européennes et ses membres depuis une vingtaine d’années. Depuis 2015, cette approche constitue l’une des orientations majeures des politiques migratoires européennes.

      Pourquoi dès lors, la Commission fait-elle marche arrière quant à ce projet ? Plusieurs raisons peuvent être avancées.

      La première réside dans le fait que cette approche n’atteint pas ses objectifs (endiguer les départs et augmenter les expulsions des personnes en situation irrégulière). Il suffit de voir la situation dans les hotspots d’Italie et de Grèce depuis 2015. A Moria, sur l’île de Lesbos, MSF parle de crise humanitaire due au surpeuplement, aux infrastructures et conditions d’accueil déplorables, ainsi qu’à l’insécurité mettant à mal l’ensemble des droits fondamentaux des personnes, notamment ceux des femmes et des mineurs. Les plus vulnérables se retrouvent dans un cul-de-sac.
      « Moria est devenu pour beaucoup un lieu de transit prolongé le temps que leur demande d’asile soit étudiée », souligne Dimitris Vafeas, le directeur adjoint du camp de Moria. D’autres exemples sont ceux du Niger ou encore de la Libye qui laissent les personnes migrantes dans une situation « d’encampement » permanent ou d’errance circulaire sans fin, faute de voies légales de migrations.

      La seconde explication trouve sa source dans le fait que cette approche ne respecte pas le droit international. En effet, d’une part, selon la Convention de Genève, chacun a le droit de quitter son pays et de demander l’asile dans un pays où sa sécurité sera assurée. Le droit international, s’il autorise un pays à refuser l’immigration, prohibe l’instauration du délit d’émigration : la Déclaration universelle des droits de l’homme stipule ainsi en son article 13 le droit de « quitter tout pays y compris le sien ». De plus, le droit maritime prévoit que tout naufragé sauvé en mer doit être conduit vers le port proche le plus sûr, ce qui implique que les personnes rescapées au large des côtes européennes doivent y être conduite. Enfin, plusieurs pays, à commencer par la Libye, ne représentent en aucun cas des « lieux sûrs », au regard des conditions auxquelles y font face les migrants. Même au Maroc, il y a quelques semaines, le GADEM, association marocaine de défense des droits de l’homme, sortait un rapport dramatique faisant état des violences multiples qu’encourent les personnes migrantes au Maroc.

      La troisième raison est que la majorité des pays en développement ne veulent pas entendre parler de ces plates-formes. Ils accueillent déjà 85 % des personnes réfugiées alors que l’Europe n’en accueille que 6%. Les pays africains tentent donc de faire bloc afin d’installer un rapport de force face aux Européens. Ils savent qu’ils sont désormais des acteurs incontournables du dossier migratoire sur la scène internationale. Cependant, les sommes mises sur la table, tels que les budgets de l’APD, risquent à terme d’effriter ce bloc d’argile, même si ces montants doivent être mis en regard des transferts des diasporas (remittances), nettement plus importants et qui rendent donc les dirigeants des pays d’origine enclins à favoriser les migrations.

    • L’UE bat partiellement en retraite sur les hotspots en Afrique

      Le Conseil voulait débarquer les migrants sauvés en Méditerranée sur les côtes africaines. Face à l’opposition des États africains, le projet a été abandonné, mais l’UE fait toujours pression sur les pays de transit.

      Au sommet du Conseil de juin dernier, les dirigeants européens ont demandé à la Commission d’étudier la possibilité d’instaurer des « plateformes de débarquement régionales » en Afrique, afin d’y envoyer les migrants repêchés par des bateaux européens en Méditerranée.

      L’initiative a tourné court. Dans les jours qui ont suivi le sommet, le Maroc et l’Union africaine se sont mobilisés pour assurer un rejet généralisé des « hotspots » sur les territoires africains.

      Nasser Bourita, le ministre marocain aux Affaires étrangères, a accusé les dirigeants européens de réagir de manière excessive, et souligné que le nombre de migrants tentant d’entrer en Europe a largement chuté. À ce jour, ils sont 80 000 à être arrivés cette année, contre 300 000 en 2016.

      La société civile s’est aussi opposée au projet, estimant que ces camps de migrants seraient contraires aux engagements de l’UE en termes de droits de l’Homme.

      Lors d’une visite en Tunisie le 26 octobre, Jean-Claude Juncker, président de la Commission européenne, a assuré que l’UE ne tentait pas de mettre en place des camps de réfugiés dans le nord de l’Afrique. « Ce n’est plus au programme, et ça n’aurait jamais dû l’être », a-t-il indiqué lors d’une conférence de presse avec le Premier ministre tunisien, Youssef Chahed.

      Une semaine après, la porte-parole de la Commission, Natasha Bertaud, a expliqué que l’exécutif européen préférait à présent parler d’« arrangements de débarquement régionaux ». L’UE a donc commencé à préparer des accords spécifiques avec chacun des pays concernés, dont un échange de financements contre un meilleur contrôle migratoire. Le but est ainsi d’empêcher les migrants d’arriver en Europe.

      Accords en négociations

      Depuis le mois de septembre, des discussions sont en cours entre Bruxelles et le gouvernement égyptien d’Abdel Fattah al-Sissi. Un accord « cash contre migrants » devrait être finalisé avant le sommet UE-Ligue arabe qui aura lieu en février au Caire.

      S’il parait évident que l’Europe ne répétera pas son offre de 4 milliards à la Turquie, l’Égypte devrait demander une aide considérable et des prêts avantageux en échange d’un durcissement du contrôle migratoire. Des accords similaires devraient être conclus avec le Maroc, la Tunisie et la Libye.

      Le timing n’est pas dû au hasard, puisque Abdel Fattah al-Sissi succédera en janvier au Rwandais Paul Kagame à la présidence de l’Union africaine, et que le sommet de février sera centré sur l’immigration.

      Ce n’est pourtant pas parce que l’idée des « hotspots » a été abandonnée que les pays africains échappent aux pressions européennes.

      Le 1er novembre, Reuters indiquait que le ministère marocain des Affaires étrangères avait mis en place une nouvelle obligation pour les ressortissants du Congo Brazzaville, de Guinée et du Mali, qui devront à présent demander un permis de voyage quatre jours avant leur arrivée au Maroc. La plupart des migrants espérant atteindre l’Europe via le Maroc sont guinéens ou maliens.

      L’Espagne fait en effet pression sur Rabat pour réduire le nombre d’arrivées de migrants, notamment via ses enclaves de Ceuta et Melilla.

      Redéfinitions à venir

      Par ailleurs, les conditions de renvoi des migrants seront redéfinies dans le texte qui remplacera l’accord de Cotonou, mais il est clair que l’Europe ne voudra pas les rendre plus strictes. Les discussions entre l’UE et les pays d’Afrique, des Caraïbes et du Pacifique, viennent de commencer.

      L’accord, qui expire en 2020, prévoit que les États africains réintègrent les migrants qui n’obtiennent pas l’autorisation de rester en Europe, une mesure qui n’a cependant pas été mise en pratique. « Les dirigeants africains ne respecteront jamais ces articles sur la migration », indique une source proche des négociations.

      L’Union africaine n’est pas parvenue à unir ses membres pour négocier le successeur de l’accord de Cotonou sur la base d’une position commune face à l’UE, mais les avis sont plus convergents sur la question migratoire. Selon une représentante de la société civile, son plan d’action sur l’immigration est « l’un des meilleurs documents sur la migration ».

      Contrairement à l’UE, divisée entre des pays plutôt accueillants et d’autres comme la Hongrie, la Pologne ou l’Italie, qui défendent des règles extrêmement strictes, les membres de l’Union africaine sont sur la même longueur d’onde sur le sujet. « L’UE n’est pas en position de négocier sur l’immigration, mais l’Union africaine l’est », conclut cette même source.

      Pour montrer à ses citoyens qu’elle agit, l’UE pourrait donc finir par mettre en place des arrangements de contrôle migratoire fragmentés et chers.

    • EP lawyers back EU plans for migrant centres in Africa

      Lawyers working at the European Parliament on Tuesday (27 November) struggled to provide a detailed analysis of whether stalled EU plans to offload rescued migrants in north Africa were legal - but ultimately backed the controversial concept.

      “It was at least a brave attempt to piece together, sort of like bits of circumstantial evidence from a kind of a crime scene, to see what the hell this is,” British centre-left MEP Claude Moraes said of their efforts.

      Speaking at the parliament’s civil liberties committee, a lawyer from the legal service was only able to provide an oral summary of their report, citing confidentiality issues.

      But EUobserver has obtained a full copy of the 10-page confidential report, which attempted to provide a legal analysis of stalled EU plans to set up so-called ’regional disembarkation platforms’ in north Africa and controlled centres in Europe.

      The report broadly rubber stamps the legality of both concepts, but with conditions.

      It says “controlled centres and/or disembarkation platforms of a similar nature could be, in principle, lawfully established in the European Union territory.”

      It states disembarkation platforms “could lawfully be established outside of the European Union, in order to receive migrants rescued outside the territory of the Union’s member states.”

      It also says EU law does not apply to migrants rescued at high sea, even with a boat flying an EU-member state flag.

      “We can’t consider a vessel flying a flag of a member state to be an extension of a member state,” the lawyer told the MEPs.

      EU law is also not applied if the migrant is rescued in the territorial waters of an African coastal state, states the report.

      It also notes that people rescued in EU territorial waters cannot then be sent to disembarkation platforms in an non-EU state.

      Morocco and other bordering coastal states must apply the 1951 Geneva Convention and must be considered safe before allowing them to host any disembarkation platform.

      Earlier this year, the European Commission tasked the EU’s asylum support office to analyse the safety of both Morocco and Tunisia.

      But neither country has voiced any interest in hosting such platforms.

      The two countries were then presented over the summer by EU heads of state and government as a possible solution to further stem boat migrants from taking to the seas in their efforts to reach Europe.

      The concepts, initially hatched by the International Organisation for Migration (IOM) and the UN refugee agency (UNHCR), were met with disdain by north African states, who viewed them as a veiled attempt by the EU to outsource its problem back onto them.

      Furthermore, not a single EU state has expressed any interest to host a controlled centre.

      Human rights defenders have also raised alarm given the poor treatment of thousands of refugees and migrants stuck in over-crowded camps on the Greek islands.

      Attempting to replicate similar camps or centres elsewhere has only heightened those fears.

      But the EU says it is pressing ahead anyway.

      “The disembarkation arrangement, the discussion, is proceeding in the Council,” said Vincet Piket, a senior official in the EU’s foreign policy branch, the EEAS.

      Exclusive: Leaked paper shows determination to dissuade coastal states from cooperating.

      The African Union is seeking to kill off the EU’s latest blueprint for stemming migration, claiming that it would breach international law by establishing “de facto detention centres” on African soil, trampling over the rights of those being held.

      A “#common_African_position_paper” leaked to the Guardian reveals the determination of the 55-member state body, currently headed by Egypt, to dissuade any of its coastal states from cooperating with Brussels on the plan.

      The EU set plans for “regional disembarkation platforms” in motion last summer to allow migrants found in European waters to have their asylum requests processed on African soil.

      Brussels has a similar arrangement in place with Libya, where there are 800,000 migrants, 20,000 of whom are being held in government detention centres. The Libyan authorities have been accused of multiple and grave human rights abuses. A UN report recently stated that migrants in the country faced “unimaginable horrors”.

      Some northern states, including Morocco, have already rejected the EU’s proposal over the new “platforms”, but there are concerns within the African Union (AU) that other member governments could be persuaded by the offer of development funds.

      Italy’s far-right interior minister Matteo Salvini has called for the centres to be based around the Sahel region, in Niger, Chad, Mali and Sudan. An inaugural summit between the EU and the League of Arab States is being held in Sharm el-Sheikh in Egypt on Sunday and Monday, and migration is expected to be discussed.

      “When the EU wants something, it usually gets it,” said a senior AU official. “African capitals worry that this plan will see the establishment of something like modern-day slave markets, with the ‘best’ Africans being allowed into Europe and the rest tossed back – and it is not far from the truth.”

      They added: “The feelings are very, very raw about this. And it feels that this summit is about the EU trying to work on some countries to cooperate. Bilaterally, some countries will always look at the money.”

      EU officials, in turn, have been coy about the purposes of the summit, insisting that it is merely an attempt to engage on issues of joint importance.

      The leaked draft joint position of the AU notes that Brussels has yet to fully flesh out the concept of the “regional disembarkation platforms”. But it adds: “The establishment of disembarkation platforms on the African Continent for the processing of the asylum claims of Africans seeking international protection in Europe would contravene International Law, EU Law and the Legal instruments of the AU with regard to refugees and displaced persons.

      “The setup of ‘disembarkation platforms’ would be tantamount to de facto ‘detention centres’ where the fundamental rights of African migrants will be violated and the principle of solitary among AU member states greatly undermined. The collection of biometric data of citizens of AU Members by international organisations violates the sovereignty of African Countries over their citizens.”

      The AU also criticises Brussels for bypassing its structures and warns of wider repercussions. “The AU views the decision by the EU to support the concept of ‘regional disembarkation platforms’ in Africa and the ongoing bilateral consultation with AU member states, without the involvement of the AU and its relevant institutions, as undermining the significant progress achieved in the partnership frameworks and dialogues between our two unions,” the paper says.

      Confidential legal advice commissioned by the European parliament also raises concerns about the legality of establishing processing centres on African soil for those found in European waters.

      The paper, seen by the Guardian, warns that “migrants, after they have been rescued (or a fortiori after they have been brought back on to European Union territory), could not be sent to platforms outside of the European Union without being granted access to the EU asylum procedures and without being granted the possibility to wait for the complete examination of their request”.

    Niger : Europe’s Migration Laboratory

    “We share an interest in managing migration in the best possible way, for both Europe and Africa,” Mogherini said at the time.

    Since then, she has referred to Niger as the “model” for how other transit countries should manage migration and the best performer of the five African nations who signed up to the E.U. #Partnership_Framework_on_Migration – the plan that made development aid conditional on cooperation in migration control. Niger is “an initial success story that we now want to replicate at regional level,” she said in a recent speech.

    Angela Merkel became the first German chancellor to visit the country in October 2016. Her trip followed a wave of arrests under Law 36 in the Agadez region. Merkel promised money and “opportunities” for those who had previously made their living out of migration.

    One of the main recipients of E.U. funding is the International Organization for Migration (IOM), which now occupies most of one street in Plateau. In a little over two years the IOM headcount has gone from 22 to more than 300 staff.

    Giuseppe Loprete, the head of mission, says the crackdown in northern Niger is about more than Europe closing the door on African migrants. The new law was needed as networks connecting drug smuggling and militant groups were threatening the country, and the conditions in which migrants were forced to travel were criminal.

    “Libya is hell and people who go there healthy lose their minds,” Loprete says.

    A side effect of the crackdown has been a sharp increase in business for IOM, whose main activity is a voluntary returns program. Some 7,000 African migrants were sent home from Niger last year, up from 1,400 in 2014. More than 2,000 returns in the first three months of 2018 suggest another record year.

    The European Development Fund awarded $731 million to Niger for the period 2014–20. A subsequent review boosted this by a further $108 million. Among the experiments this money bankrolls are the connection of remote border posts – where there was previously no electricity – to the internet under the German aid corporation, GIZ; a massive expansion of judges to hear smuggling and trafficking cases; and hundreds of flatbed trucks, off-road vehicles, motorcycles and satellite phones for Nigerien security forces.

    At least three E.U. states – #France, Italy and Germany – have troops on the ground in Niger. Their roles range from military advisers to medics and trainers. French forces and drone bases are present as part of the overlapping Barkhane and G5 Sahel counterinsurgency operations which includes forces from Burkina Faso, Chad, Mali and Mauritania. The U.S., meanwhile, has both troops and drone bases for its own regional fight against Islamic militants, the latest of which is being built outside Agadez at a cost of more than $100 million.

    • Europe Benefits by Bankrolling an Anti-Migrant Effort. Niger Pays a Price.

      Niger has been well paid for drastically reducing the number of African migrants using the country as a conduit to Europe. But the effort has hurt parts of the economy and raised security concerns.

      The heavily armed troops are positioned around oases in Niger’s vast northern desert, where temperatures routinely climb beyond 100 degrees.

      While both Al Qaeda and the Islamic State have branches operating in the area, the mission of the government forces here is not to combat jihadism.

      Instead, these Nigerien soldiers are battling human smugglers, who transport migrants across the harsh landscape, where hundreds of miles of dunes separate solitary trees.

      The migrants are hoping to reach neighboring Libya, and from there, try a treacherous, often deadly crossing of the Mediterranean to reach Europe.

      The toll of the military engagement is high. Some smugglers are armed, militants are rife and the terrain is unforgiving: Each mission, lasting two weeks, requires 50 new truck tires to replace the ones shredded in the blistering, rocky sand.

      But the operation has had an impact: Niger has drastically reduced the number of people moving north to Libya through its territory over the past two years.

      The country is being paid handsomely for its efforts, by a Europe eager to reduce the migrant flow. The European Union announced at the end of last year it would provide Niger with one billion euros, or about $1.16 billion, in development aid through 2020, with hundreds of millions of that earmarked for anti-migration projects. Germany, France and Italy also provide aid on their own.

      It is part of a much broader European Union strategy to keep migrants from its shores, including paying billions of euros to Turkey and more than $100 million to aid agencies in Sudan.

      Italy has been accused of paying off militias in Libya to keep migrants at bay. And here in Niger, some military officials angrily contend that France financed a former rebel leader who remains a threat, prioritizing its desire to stop migration over Niger’s national security interests.

      Since passing a law against human trafficking in 2015, Niger has directed its military to arrest and jail migrant smugglers, confiscate their vehicles and bring the migrants they traffic to the police or the International Organization for Migration, or I.O.M. The migrants are then given a choice whether to continue on their journey — and risk being detained again, or worse — or given a free ride back to their home country.

      The law’s effect has been significant. At the peak in 2015, there were 5,000 to 7,000 migrants a week traveling through Niger to Libya. The criminalization of smuggling has reduced those numbers to about 1,000 people a week now, according to I.O.M. figures.

      At the same time, more migrants are leaving Libya, fleeing the rampant insecurity and racist violence targeting sub-Saharan Africans there.

      As a result, the overall flow of people has now gone into a notable reverse: For the last two years, more African migrants have been leaving Libya to return to their homelands than entering the country from Niger, according to the I.O.M.

      One of Niger’s biggest bus companies, Rimbo, used to send four migrant-filled buses each day from the country’s capital in the south, Niamey, to the northern city of Agadez, a jumping off point for the trip to the Libyan border.

      Now, the company has signed a two-year contract with the I.O.M. to carry migrants the other way, so they can be repatriated.

      On a recent breezy evening in Niamey, a convoy of four Rimbo buses rolled through the dusty streets after an arduous 20-hour drive from Agadez, carrying 400 migrants. They were headed back home to countries across West Africa, including Guinea, Ivory Coast and Nigeria.

      For leaders in Europe, this change in migrant flows is welcome news, and a testament to Niger’s dedication to shared goals.

      “Niger really became one of our best allies in the region,” said Raul Mateus Paula, the bloc’s ambassador to Niger.

      But the country’s achievement has also come with considerable costs, including on those migrants still determined to make it to Libya, who take more risks than ever before. Drivers now take routes hundreds of miles away from water points and go through mined areas to avoid military patrols. When smugglers learn the military is in the area, they often abandon migrants in the desert to escape arrest.

      This has led to dozens of deaths by dehydration over the past two years, prompting Niger’s civil protection agency and the I.O.M. to launch weekly rescue patrols.

      The agency’s head, Adam Kamassi, said his team usually rescues between 20 to 50 people every time it goes out. On those trips, it nearly always finds three or four bodies.

      The crackdown on human smuggling has also been accompanied by economic decline and security concerns for Niger.

      The government’s closure of migrant routes has caused an increase in unemployment and an uptick in other criminal activity like drug smuggling and robbery, according to a Niger military intelligence document.

      “I know of about 20 people who have become bandits for lack of work,” said Mahamadou Issouf, who has been driving migrants from Agadez to southern Libya since 2005, but who no longer has work.

      Earlier this year, the army caught him driving 31 migrants near a spot in the desert called the Puit d’Espoir, or Well of Hope. While the army released him in this case, drivers who worked for him have been imprisoned and two of his trucks impounded.

      The military intelligence document also noted that since the crackdown, towns along the migrant route are having a hard time paying for essential services like schools and health clinics, which had relied on money from migration and the industries feeding it.

      For example, the health clinic in Dirkou, once a major migrant way station in northern Niger, now has fewer paying clients because the number of migrants seeking has dwindled. Store owners who relied on the steady flow of people traveling through have gone bankrupt.

      Hassan Mohammed is another former migrant smuggler who lost his livelihood in the crackdown.

      A native of Dirkou, Mr. Mohammed, 31, began driving migrants across the desert in 2002, earning enough in the process to buy two Toyota pickup trucks. The smuggling operation grew enough that he began employing his younger brothers to drive.

      Today, Mr. Mohammed’s brothers are in prison, serving the six-month sentences convicted smuggler drivers face. His two pickup trucks are gathering dust, along with a few dozen other confiscated vehicles, on a Niger army base. With no income, Mr. Mohammed now relies on the generosity of friends to survive.

      With Europe as a primary beneficiary of the smuggling crackdown, the European Union is eager to keep the effort in place, and some of the bloc’s aid finances a project to convert former smugglers into entrepreneurs. But the project is still in its pilot stage more than two years after the migrant crackdown began.

      Ibrahim Yacouba, the former foreign minister of Niger, who resigned earlier this year, said, “There are lots of announcements of millions of euros in funding, but in the lived reality of those who are in the industry, there has been no change.”

      The crackdown has also raised security concerns, as France has taken additional steps to stop migration along the Niger-Libya border that go beyond its asylum-processing center.

      From its military base in the northern Nigerien outpost of Madama, France funded last year an ethnic Toubou militia in southern Libya, with the goal of using the group to help stop smugglers, according to Nigerien security officials.

      This rankled the Nigerien military because the militia is headed by an ex-Nigerien rebel, Barka Sidimi, who is considered a major security risk by the country’s officials. To military leaders, this was an example of a European anti-migrant policy taking precedent over Niger’s own security.

      A French military spokesperson said, “We don’t have information about the collaboration you speak of.”

      Despite the country’s progress in reducing the flow of migrants, Nigerien officials know the problem of human smugglers using the country as a conduit is not going away.

      “The fight against clandestine migration is not winnable,’’ said Mohamed Bazoum, Niger’s interior minister.

      Even as Libya has experienced a net drop in migrants, new routes have opened up: More migrants are now entering Algeria and transiting to Morocco to attempt a Mediterranean crossing there, according to Giuseppe Loprete, who recently left his post after being the I.O.M.’s director in Niger for four years.

      But despite the drawbacks that come with it, the smuggling crackdown will continue, at least for now, according to Mr. Bazoum, the interior minister. Migrant smuggling and trafficking, he said, “creates a context of a criminal economy, and we are against all forms of economic crime to preserve the stability and security of our country.”

      For Mr. Mohammed, the former smuggler, the crackdown has left him idle and dejected, with no employment prospects.

      “There’s no project for any of us here,” he said. “There’s nothing going on. I only sleep and wake up.”

      Le sytème permet d’enregistrer pour mieux sécuriser et filtrer les individus mal intentionnés, mais aussi de mieux connaître les flux pour ensuite adapter les politiques de développement sur les axes d’échange.

MIDAS (#Migration_Information_and_Data_Analysis_System) qui est un système d’information et de gestion des données migratoires développé par l’OIM en 2009 et opérationnel dans 19 pays est aujourd’hui également opérationnel au niveau du poste frontière de Makalondi.     • Niger grapples with migration and its porous borders

      Europe has been grappling with the migration problem on its side of the Mediterranean for several years now with little sign of bringing the situation under control, but there is also an African frontline, on the edges of the Sahara, and the improverished nation of Niger is one of the hotspots. The situation here is similarly out of control, and EU funds have been made available to try and persude people smugglers to give up their business. However, much of the money has gone to waste, and the situation has in some ways evolved into something worse. Euronews’ Valerie Gauriat has just returned from Niger. This is her report.

      Scores of four-wheel drives have just arrived from Libya, at the checkpoint of the city of Agadez, in central Niger, Western Africa’s gateway to the Sahara.

      Every week, convoys like these travel both ways, crossing the thousand kilometers of desert that separate the two countries.

      Travelers are exhausted after a 5-day journey.

      Many are Nigerian workers, fleeing renewed violence in Libya, but many others are migrants from other western African countries.

      “When we get to Libya, they lock us up. And when we work we don’t get paid,” said one Senegalese man.

      “What happened, we can’t describe it. We can’t talk about everything that goes on, because it’s bad, it’s so bad !” said another, from Burkina Fasso.

      Many have already tried to cross the Mediterranean to reach Europe.

      “We paid for it, but we never went. They caught us and locked us up. I want to go home to Senegal now, that’s my hope,” said another man.

      Mohamed Tchiba organised this convoy. This former Touareg rebel is a well-known figure in Agadez’s migration business, which is a long-standing, flourishing activity despite a law against irregular migration which made it illegal two years ago.

      EU-funded reconversion projects were launched to offset the losses, but Mohamed refuses to give up his livelihood.

      “I’m a smuggler, even now I’m a smuggler! Because I’ve heard that in town they are giving us something to give up this job. But they did not give me anything. And I do not know any other work than this one,” he told us.

      We head to Agadez, where we find dozens of vehicles in a car park. They were confiscated from the smugglers who were arrested by the police, and are a slowly-rusting symbol of the fight against irregular immigration.

      But that didn’t go down well with the local population. The law hit the local economy hard

      Travelers departing for Libya were once Ibrahim’s main source of revenue, but now customers for his water cans are scarce. The layoffs of workers after the closure of gold mines in the area did not help.

      “Before, we sold 400 to 500 water cans every week to migrants, and cans were also sent to the mine. But they closed the road to Libya, they closed the mines, everything is closed. And these young people stay here without working or doing anything, without food. If they get up in the morning, and they go to bed at night, without eating anything, what will prevent them one day from going to steal something?” wonders trader Oumarou Chehou.

      Friday prayers are one of the few occasions when the city comes to life.

      We go to meet with the President of the so-called Association for former migration workers.

      He takes us to meet one of the former smugglers. After stopping their activity they have benefited from an EU-funded reconversion programme.

      Abdouramane Ghali received a stock of chairs, pots, and loudspeakers, which he rents out for celebrations. We ask him how business is going.

      "It depends on God ... I used to make much more money before; I could get up to 800 euros a week; now it’s barely 30 euros a week,” he says.

      Abdouramane is still among the luckiest. Out of 7000 people involved in the migration business, less than 400 have so far benefited from the reconversion package: about 2000 euros per project. That’s not enough to get by, says the president of the Former Smugglers’ Association, Bachir Amma.

      “We respected the law, we are no longer working, we stopped, and now it’s the State of Niger and the European Union which abandoned us. People are here, they have families, they have children, and they have nothing. We eat with our savings. The money we made before, that’s what feeds us now, you see. It’s really difficult, it’s very hard for us,” he says.

      We catch up with Abdouramane the next morning. He has just delivered his equipment to one of his customers, Abba Seidou, also a former smuggler, who is now a taxi driver. Abba is celebrating the birth of his first child, a rare opportunity to forget his worries.

      “Since it’s a very wonderful day, it strengthened my heart, to go and get chairs, so that people, even if there is nothing, they can sit down if they come to your house. The times are hard for immigration, now; but with the small funds we get, people can get by. It’s going to be okay,” the proud father says. Lots of other children gather round.

      “These kids are called the” talibe “, or street kids,” reports euronews’ Valerie Gauriat. "And the celebration is a chance for them to get some food. Since the anti-smuggling law was implemented, there are more and more of them in the streets of Agadez.”

      The European Union has committed to spending more than one billion euros on development aid in a country classified as one of the poorest in the world. Niger is also one of the main beneficiaries of the European emergency fund created in 2015 to address migration issues in Africa. But for the vice-president of the region of Agadez, these funds were only a bargaining chip for the law against irregular immigration, which in his eyes, only serves the interests of Europe.

      Valerie Gauriat:

      “Niger has received significant funding from the European Union. Do you believe these funds are not used properly?”

      Vice-President of the Agadez Regional Council, Aklou Sidi Sidi:

      “First of all the funding is insufficient. When we look at it, Turkey has received huge amounts of money, a lot more than Niger. And even armed groups in Libya received much more money than Niger. Today, we are sitting here, we are the abyss of asylum seekers, refugees, migrants, displaced people. Agadez is an abyss,” he sighs.

      In the heart of the Sahel region, Niger is home to some 300,000 displaced people and refugees. They are a less and less transitory presence, which weighs on the region of Agadez. One center managed by the International Office for Migration hosts migrants who have agreed to return to their countries of origin. But the procedures sometimes take months, and the center is saturated.

      “80 percent of the migrants do not have any identification, they do not have any documents. That means that after registration we have to go through the procedure of the travel authorisation, and we have to coordinate this with the embassies and consulates of each country. That is the main issue and the challenge that we are facing every day. We have around 1000 people in this area, an area that’s supposed to receive 400 or 500 people. We have mattresses piled up because people sleep outside here because we’re over our capacity. Many people are waiting on the other side. So we need to move these people as quickly as possible so we can let others come,” says the IOM’s transit centre manager, Lincoln Gaingar.

      Returning to their country is not an option for many who transit through Niger. Among them are several hundred Sudanese, supervised by the UNHCR. Many fled the Darfur conflict, and endured hell in Libyan detention centres. Some have been waiting for months for an answer to their asylum request.

      Badererdeen Abdul Kareem dreams of completing his veterinary studies in the West.

      “Since I finished my university life I lost almost half of my life because of the wars, traveling from Sudan to Libya. I don’t want to lose my life again. So it’s time to start my life, it’s time to work, it’s time to educate. Staying in Niger for nothing or staying in Niger for a long time, for me it’s not good.”

      But the only short-term perspective for these men is to escape the promiscuity of the reception center. Faced with the influx of asylum seekers, the UNHCR has opened another site outside the city.

      We meet Ibrahim Abulaye, also Sudanese, who spent years in refugee camps in Chad, and then Libya. He is 20 years old.

      “It was really very difficult, but thank God I’m alive. What I can really say is that since we cannot go back home, we are looking for a place that is more favourable to us, where we can be safe, and have a better chance in life.”

      Hope for a better life is closer for those who have been evacuated from Libyan prisons as part of an emergency rescue plan launched last year by the UNHCR. Welcomed in Niamey, the capital of Niger, they must be resettled in third countries.

      After fleeing their country, Somalia, these women were tortured in Libyan detention centers. They are waiting for resettlement in France.

      “There are many problems in my country, and I had my own. I have severe stomach injuries. The only reason I left my country was to escape from these problems, and find a safe place where I could find hope. People like me need hope,” said one of them.

      A dozen countries, most of them European, have pledged to welcome some 2,600 refugees evacuated from Libya to Niger. But less than 400 have so far been resettled.

      “The solidarity is there. There has to be a sense of urgency also to reinstall them, to welcome them in the countries that have been offering these places. It is important to avoid a long stay in Niger, and that they continue their journey onwards,” says the UNHCR’s Alessandra Morelli in Niamey.

      The slowness of the countries offering asylum to respect their commitments has disappointed the Niger government. But what Niger’s Interior minister Mohamed Bazoum most regrets is a lack of foresight in Europe, when it comes to stemming irregular immigration.

      “I am rather in favor of more control, but I am especially in favor of seeing European countries working together to promote another relationship with African countries. A relationship based on issuing visas on the basis of the needs that can be expressed by companies. It is because this work is not done properly, that we have finally accepted that the only possible migration is illegal migration,” he complains.

      Estimated from 5 to 7,000 per week in 2015, the number of migrants leaving for Libya has fallen tenfold, according to the Niger authorities. But the traficking continues, on increasingly dangerous routes.

      The desert, it is said in Agadez, has become more deadly than the Mediterranean.

      We meet another one of the smugglers who for lack of alternatives says he has resumed his activities, even if he faces years in prison.

      “This law is as if we had been gathered together and had knives put under our throats, to slit our throats. Some of us were locked up, others fled the country, others lost everything,” he says.

      He takes us to one of the former transit areas where migrants were gathered before leaving for Libya, when it was allowed. The building has since been destroyed. Customers are rarer, and the price of crossings has tripled. In addition to the risk of being stopped by the police and army patrols, travelers have to dodge attacks by arms and drug traffickers who roam the desert.

      “Often the military are on a mission, they don’t want to waste time, so sometimes they will tell you,’we can find an arrangement, what do you offer?’ We give them money to leave. We must also avoid bandits. There are armed people everywhere in the bush. We have to take byways to get around them. We know that it’s dangerous. But for us, the most dangerous thing is not to be able to feed your family! That’s the biggest danger!”

      We entered one of the so-called ghettos outside Agadez, where candidates for the trip to Europe through Libya hide out, until smugglers pick them up. We are led to a house where a group of young people are waiting for their trip to be organized by their smuggler.

      They have all have already tried to cross the desert, but were abandoned by their drivers, fleeing army patrols, and were saved in the nick of time. Several of their fellow travelers died of thirst and exhaustion.

      Mohamed Balde is an asylum seeker from Guinea.

      “The desert is a huge risk. There are many who have died, but people are not discouraged. Why are they coming? One should just ask the question!” he says. “All the time, there are meetings between West African leaders and the leaders of the European Union, to give out money, so that the migrants don’t get through. We say that’s a crime. It is their interests that they serve, not the interests of our continent. To stop immigration, they should invest in Africa, in companies, so that young people can work.”

      Drogba Sumaru is an asylum seeker from the Ivory Coast.

      “It’s no use giving money to people, or putting soldiers in the desert, or removing all the boats on the Mediterranean, to stop immigration! It won’t help, I will keep going on. There are thousands of young people in Africa, ready to go, always. Because there is nothing. There is nothing to keep them in their countries. When they think of the suffering of their families, when they think that they have no future. They will always be ready, ready for anything. They will always be ready to risk their lives,” he concludes.

    • Europe’s « Migrant Hunters »

      The checkpoint on the way out of the Saharan town of Agadez in Niger is nothing more than a long metal chain that stretches across the road. On a Monday afternoon in March, a handful of pickup trucks and lorries loaded with migrants mostly from southern Niger waited quietly at the barrier to embark on the long journey up through the Ténéré desert. An overweight officer inspected the vehicles and then invited the drivers to show him their paperwork inside a somber-looking shack on the side of the road, where money most likely changed hands.

      Every Monday afternoon a convoy, protected by an escort of three military pickups, two mounted with machine guns, begins its arduous journey toward Dirkou, 435 miles away, on the road to the Libyan border. Protection has long been needed against highwaymen—or, as they’re called locally, coupeurs de route. These disgruntled Tuareg youths and former rebels roam the foothills of the Aïr Mountains just beyond Agadez. If a vehicle slips out of view of the escort for even a moment, the coupeurs seize the opportunity, chasing and shooting at the overloaded vehicles to relieve the passengers of their money and phones—or sometimes even to take the cars. A cautious driver sticks close behind the soldiers, even if they are pitifully slow, stopping frequently to sleep, eat, drink tea, or extract bribes from drivers trying to avoid the checkpoints.

      The first 60 miles out of Agadez—a journey of about two hours through the mountains—were the most hazardous. But then we reached the dusty Ténéré plain. As darkness fell, lighter vehicles picked up speed, making good headway during the night as the cold hardened the sand. Sleepy migrants, legs dangling over the side of the tailboard, held on to branches attached to the frame of the vehicle to keep from falling off.

      The following day, there was a stop at Puits Espoir (“Hope’s Well”), midway between Agadez and Dirkou. It was dug 15 years ago to keep those whose transport had broken down in the desert from dying of thirst. But the well’s Arabic name, Bir Tawil, which means “the Deep Well,” is perhaps more apt. The well drops nearly 200 feet, and without a long enough rope to reach the water below, migrants and drivers can perish at its edge. The escort soldiers told me that the bodies of 11 who died in this way are buried in the sand inside a nearby enclosure built from car scraps. Travelers took a nap under its shade or beside the walls around the well, which were graffitied by those who had passed through. There was “Dec 2016 from Tanzania to Libya” or “Flavio—Solo from Guinea.” After Espoir, most vehicles abandon the slow convoy and go off on their own, risking attacks by coupeurs for a quicker journey toward Libya.

      PROXY BORDER GUARDS

      Before mid-2016, there were between 100 and 200 vehicles, mostly pickups, each filled with around 30 migrants heading for Libya, that were making such a journey every week. Since mid-2016, however, under pressure from the European Union, and with promises of financial support, the Niger government began cracking down on the northward flow of sub-Saharans, arresting drivers and confiscating cars, sometimes at the Agadez checkpoint itself. Now there are only a few cars transporting passengers, most of them Nigeriens who have managed to convince soldiers at the checkpoint—often with the help of a bribe—that they do not intend to go all the way to Europe but will end their journey in Libya.

      “To close Libya’s southern border is to close Europe’s southern border,” Marco Minniti, Italy’s interior minister, said in April at a meeting in Rome with representatives of three cross-border Saharan tribes, the Tubu, Awlad Suleiman Arabs, and Tuareg. The leaders agreed to form a border force to stop migrants entering Libya from traveling to Europe, reportedly at the demand of, and under the prospect of money from, the Italian government. All three communities are interested in resolving the deadly conflicts that have beset the country since the fall of Colonel Muammar al-Qaddafi in 2011 and hope Italy will compensate them monetarily for their casualties (in tribal conflicts, a payment is needed to end a fight) as well as fund reconstruction and development of neglected southern Libya. Italy, of course, is keen on halting the flow of migrants reaching its shores and sees these Saharan groups, which have the potential to intervene before migrants even get to Libya, as plausible proxies.

      Some tribal leaders in southern Libya—mostly Tubu and Tuareg—look favorably on Italy’s and Europe’s overtures and suggested that the EU should cooperate directly with local militias to secure the border. But their tribes largely benefit from smuggling migrants, and they also made clear this business will not stop unless development aid and compensation for the smugglers is provided. “The EU wants to use us against migrants and terrorism,” a Tubu militia leader told me, off-the-record, on the side of a meeting in the European Parliament last year. “But we have our own problems. What alternative can we propose to our youth, who live off trafficking?”

      With or without the EU, some of the newly armed groups in Libya are selling themselves as migrant hunters. “We arrested more than 18,000 migrants,” a militia chief told me, with a hauteur that reminded me of the anti-immigrant sentiment spreading across Europe. “We don’t want just to please the EU, we protect our youths and our territory!”

      It seems rather reckless, however, in a largely stateless stretch of the Sahara, for Europe to empower militias as proxy border guards, some of whom are the very smugglers whose operations the EU is trying to thwart. The precedent in Sudan is not encouraging. Last year, Khartoum received funding from the EU that was intended to help it restrict outward migration. The best the government could do was redeploy at the Sudanese-Libyan border the notorious Rapid Support Forces, recruited among Darfur’s Janjaweed militias, which have wreaked havoc in the province since 2003. In due course, their leader, Brigadier General Dagalo, also known as “Hemeti,” claimed to have arrested 20,000 migrants and then threatened to reopen the border if the EU did not pay an additional sum. The EU had already given Sudan and Niger 140 million euros each in 2016. And the Libyan rival factions are catching on, understanding well that the migrant crisis gives them a chance to blackmail European leaders worried about the success of far-right anti-immigrant groups in their elections. In February, with elections looming in the Netherlands and France, the EU made a deal to keep migrants in Libya, on the model of its March 2016 agreement with Turkey, with the Tripoli-based, internationally recognized Government of National Accord, despite the fact it has little control over the country. In August, the GNA’s main rival, eastern Libya’s strongman Khalifa Haftar, claimed that blocking migrants at Libya’s southern borders would cost one billion euros a year over 20 years and asked France, his closest ally in Europe, to provide him with military equipment such as helicopters, drones, armored vehicles, and night vision goggles. Needless to say, Haftar did not get the equipment.

      THE HUB

      Dirkou became a migrant hub about 25 years ago and remains a thriving market town whose residents make a living mostly off of road transport to and from Libya. Smuggling people across Libya’s southern borders became semiofficial practice in 1992, as Qaddafi sought to circumvent the UN’s air traffic embargo. This, in turn, opened up an opportunity for ambitious facilitators who could get their hands on a vehicle, a period that came to be known locally as “the Marlboro era.” Planes and trucks, contravening the embargo, delivered cigarettes to Dirkou, where there was already an airstrip long enough for cargo planes. They then sold their contraband to Libyan smugglers, who took them north with help from Nigerien authorities.

      Smuggling was possible at the time only if the government was involved, explained Bakri, one of the drivers I met in Dirkou (and who requested his name be changed). Gradually, cigarettes were replaced by Moroccan cannabis, which was driven down from around the Algerian border through Mali and Niger. Tuareg rebels, who had been involved in sporadic insurgencies against the governments of Mali and Niger, began to attack the convoys to steal their cargoes for reselling. The traffickers eventually enlisted them to serve as their protectors, guides, or drivers.

      That process began in the 1990s and 2000s when the Niger government and Tuareg rebels held regular peace talks and struck deals that allowed former insurgents to be integrated into the Niger armed forces. Hundreds of fighters who were left to fend for themselves, however, fell back on banditry or drug trafficking, and it wasn’t long before the authorities decided that they should be encouraged to transport migrants to Libya instead. Many now own vehicles that had been captured from the army in the course of the rebellion. These were cleared through customs at half the normal fee, and the Ministry of Transport awarded a great number of them licenses. It was decided that the new fleet of migrant facilitators would take passengers at the bus station in Agadez.

      In 2011, after the NATO-backed revolution in Libya had toppled Qaddafi, newly formed Tubu militias took control of most of the country’s arms stockpiles, as well as its southern borderlands. Many young Tubu men from Libya or Niger stole or, like Bakri, who dropped out of the university to become a smuggler, bought a good pickup truck for carrying passengers. The new wave of drivers who acquired their cars during the turmoil were known in Arabic as sawag NATO, or “NATO drivers.”

      “If the number of migrants increased,” Bakri told me, “it’s mostly because NATO overthrew Qaddafi.” Qaddafi was able to regulate the flow of migrants into Europe and used it as a bargaining chip. In 2008, he signed a friendship treaty with Italy, which was then led by Silvio Berlusconi. In exchange for Libya’s help to block the migrants, “Il Cavaliere” launched the construction of a $5 billion highway in Libya. Crucially, however, Qaddafi’s regime provided paid work for hundreds of thousands of sub-Saharans, who had no need to cross the Mediterranean. Since 2011, Libya has become a much more dangerous place, especially for migrants. They are held and often tortured by smugglers on the pretext that they owe money and used for slave labor and prostitution until their families can pay off the debt.

      In May 2015, under EU pressure, Niger adopted a law that made assistance to any foreigner illegal on the grounds that it constituted migrant trafficking. Critics noted that the legislation contradicts Niger’s membership in the visa-free ECOWAS (Economic Community of West African States), from which most migrants traveling between Niger and Libya hail (they numbered 400,000 in 2016). The law was not enforced until the middle of last year, when the police began arresting drivers and “coaxers”—the regional term for all intermediaries on the human-smuggling routes up through West Africa. They jailed about 100 of them and confiscated another 100 vehicles. Three months later, the EU congratulated itself for a spectacular drop in migrant flows from Niger to Libya. But the announcement was based on International Organization for Migration (IOM) data, which the UN agency has since acknowledged to be incorrect, owing to a “technical problem” with its database.

      Saddiq, whose name has also been changed, is a coaxer in Agadez. He told me that migrants were still arriving in the town in the hope of heading north. “The police are from southern Niger and they are not familiar with the desert,” he said. “For every car arrested, 20 get through.” The cars have gotten faster. One of Saddiq’s drivers traded his old one for a Toyota Tundra, which can reach 120 miles per hour on hard sand. Meanwhile, groups of migrants have gotten smaller and are thus lighter loads. New “roads” have already been pounded out through the desert. Drivers pick up migrants as far south as the Nigerien-Nigerian border, keeping clear of towns and checkpoints. “Tubu drivers have been going up with GPS to open new roads along the Niger-Algeria border,” said Saddiq. “They meet the drug traffickers and exchange food and advice.”

      On these new roads, risks are higher for drivers and passengers. Vehicles get lost, break down, and run out of fuel. Thirst is a constant danger, and, as drivers and the IOM warned, deaths increased during the 2017 dry season, which began in May. Drivers pursued by patrols are likely to aim for a high-speed getaway, which means abandoning their passengers in the desert. “Because we couldn’t take the main road, bandits attacked us,” Aji, a Gambian migrant, told me as he recounted his failed attempt to get to Libya last December. “Only 30 kilometers from Agadez, bandits shot at us, killed two drivers and injured 17 passengers, including myself.” They took everything he owned. He was brought back to the hospital in Agadez for treatment for his wounded leg. He was broke and his spirits were low. “I no longer want to go to Libya,” he said.

      New liabilities for the smugglers drive up their prices: the fare for a ride from Agadez to Libya before the Niger government decided to curtail the northward flow was around $250. Now it is $500 or more. People with enough money travel in small, elite groups of three to five for up to $1,700 per head. Migrants without enough cash can travel on credit, but they risk falling into debt bondage once in Libya. Even with the higher fees, smugglers’ revenues have not increased. Saddiq’s has fallen from $5,000 a month to around $2,000. Costs, including lavish bribes to Niger’s security forces, have risen sharply. Still, the pace of the trade remains brisk. “I have a brand-new vehicle ready for 22 passengers,” Saddiq told me. That evening, as he loaded up his passengers with their light luggage and jerry cans of water, a motorbike went ahead of it with its headlights off to make sure that the coast was clear.

      “Many won’t give up this work, but those who continue are stuntmen,” grumbled one of Saddiq’s colleagues, a Tuareg former rebel who has been driving migrants for more than 15 years. Feeling chased by the authorities, or forced to pay them bribes twice as much as before, Tuareg and Tubu drivers are increasingly angry with the Nigerien government and what they call “the diktat of Europe.” He thought there might be better money in other activities. “What should we do? Become terrorists?” he said, somewhat provocatively. “I should go up to Libya and enlist with Daesh [the Islamic State, or ISIS]. They’re the ones who offer the best pay.”

      In late 2016, Agadez made headlines when Niger became one of the European Union (EU)’s prime partners in the fight against irregular migration. The arrest of human smugglers and the confiscation of their 4x4 trucks resulted in a decrease in the number of migrants travelling through the region.

      Le Niger est un pays de transit et de départ de l’émigration irrégulière vers l’Europe. Depuis fin 2016, les autorités tentent de lutter contre ce phénomène. Les efforts des autorités se concentrent autour de la ville d’Agadez, dans le centre du pays. Située aux portes du désert du Ténéré et classée patrimoine mondial de l’Unesco, Agadez a, pendant plusieurs années, attiré énormément de touristes amoureux du désert. Mais l’insécurité a changé la donne de cette région, qui s’est progressivement développée autour d’une économie parallèle reposant sur la migration. Aujourd’hui encore, les habitants cherchent de nouveaux débouchés.

    • Au #Sahara, voyager devient un crime

      La France s’est émue lorsque Mamadou Gassama, un Malien de 22 ans, sans papiers, a sauvé un enfant de 4 ans d’une (probable) chute fatale à Paris. Une figure de « migrant extraordinaire » comme les médias savent régulièrement en créer, mais une figure qui ne devrait pas faire oublier tous les autres, « les statistiques, les sans-nom, les numéros. » Ni tous celles et ceux qui n’ont aucune intention de venir en Europe, mais qui sont néanmoins victimes des nouvelles politiques migratoires européennes et africaines mises en œuvre à l’abri des regards, à l’intérieur même du continent africain.

      Les migrations vers et à travers le Sahara ne constituent certes pas un phénomène nouveau. Mais à partir du début des années 2000, la focalisation des médias et des pouvoirs publics sur la seule minorité d’individus qui, après avoir traversé le Sahara, traversent également la Méditerranée, a favorisé l’assimilation de l’ensemble de ces circulations intra-africaines à des migrations économiques à destination de l’Europe.

      Ce point de vue, qui repose sur des représentations partielles et partiales des faits, éloignées des réalités de terrain observées par les chercheurs, sert depuis lors de base de légitimation à la mise en œuvre de politiques migratoires restrictives en Afrique.

      Le Sahara, zone de contrôle

      L’Europe (Union européenne et certains États), des organisations internationales (notamment l’Organisation internationale pour les migrations (OIM)) et des structures ad hoc (#Frontex, #EUCAP_Sahel_Niger), avec la coopération plus ou moins volontariste des autorités nationales des pays concernés, participent ainsi au durcissement législatif mis en place dans les pays du Maghreb au cours des années 2000, puis en Afrique de l’Ouest la décennie suivante, ainsi qu’au renforcement de la surveillance et du contrôle des espaces désertiques et des populations mobiles.

      Le Sahara est ainsi transformé en une vaste « #zone-frontière » où les migrants peuvent partout et en permanence être contrôlés, catégorisés, triés, incités à faire demi-tour voire être arrêtés.

      Cette nouvelle manière de « gérer » les #circulations_migratoires dans la région pose de nombreux problèmes, y compris juridiques. Ainsi, les ressortissants des États membres de la Communauté économique des États de l’Afrique de l’Ouest (#CEDEAO), qui ont officiellement le droit de circuler librement au sein de l’#espace_communautaire, se font régulièrement arrêter lorsqu’ils se dirigent vers les frontières septentrionales du #Mali ou du #Niger.

      Le Niger, nouveau garde-frontière de l’Europe

      Dans ce pays, les migrations internationales n’étaient jusqu’à récemment pas considérées comme un problème à résoudre et ne faisaient pas l’objet d’une politique spécifique.

      Ces dernières années, tandis que le directeur général de l’OIM affirmait – sans chiffre à l’appui – qu’il y a dorénavant autant de décès de migrants au Sahara qu’en Méditerranée, l’UE continuait de mettre le gouvernement nigérien sous pression pour en finir avec « le modèle économique des passeurs ».

      Si des projets et programmes sont, depuis des années, mis en œuvre dans le pays pour y parvenir, les moyens financiers et matériels dédiés ont récemment été décuplés, à l’instar de l’ensemble des moyens destinés à lutter contre les migrations irrégulières supposées être à destination de l’Europe.

      Ainsi, le budget annuel de l’OIM a été multiplié par 7,5 en 20 ans (passant de 240 millions d’euros en 1998 à 1,8 milliard d’euros en 2018), celui de Frontex par 45 en 12 ans (passant de 6 millions d’euros en 2005 à 281 millions d’euros en 2017), celui d’EUCAP Sahel Niger par 2,5 en 5 ans (passant de moins de 10 millions d’euros en 2012 à 26 millions d’euros en 2017), tandis que depuis 2015 le Fonds fiduciaire d’urgence pour l’Afrique a été lancé par l’UE avec un budget de 2,5 milliards d’euros destinés à lutter contre les « causes profondes de la migration irrégulière » sur le continent, et notamment au Sahel.

      Ceci est particulièrement visible dans la région d’Agadez, dans le nord du pays, qui est plus que jamais considérée par les experts européens comme « le lieu où passe la plupart des flux de [migrants irréguliers] qui vont en Libye puis en Europe par la route de la Méditerranée centrale ».

      La migration criminalisée

      La mission européenne EUCAP Sahel Niger, lancée en 2012 et qui a ouvert une antenne permanente à Agadez en 2017, apparaît comme un des outils clés de la politique migratoire et sécuritaire européenne dans ce pays. Cette mission vise à « assister les autorités nigériennes locales et nationales, ainsi que les forces de sécurité, dans le développement de politiques, de techniques et de procédures permettant d’améliorer le contrôle et la lutte contre les migrations irrégulières », et d’articuler cela avec la « lutte anti-terroriste » et contre « les activités criminelles associées ».

      Outre cette imbrication officialisée des préoccupations migratoires et sécuritaires, EUCAP Sahel Niger et le nouveau Cadre de partenariat pour les migrations, mis en place par l’UE en juin 2016 en collaboration avec le gouvernement nigérien, visent directement à mettre en application la loi nigérienne n°2015-36 de mai 2015 sur le trafic de migrants, elle-même faite sur mesure pour s’accorder aux attentes européennes en la matière.

      Cette loi, qui vise à « prévenir et combattre le trafic illicite de migrants » dans le pays, définit comme trafiquant de migrants « toute personne qui, intentionnellement et pour en tirer, directement ou indirectement, un avantage financier ou un autre avantage matériel, assure l’entrée ou la sortie illégale au Niger » d’un ressortissant étranger.
      Jusqu’à 45 000 euros d’amende et 30 ans de prison

      Dans la région d’#Agadez frontalière de la Libye et de l’Algérie, les gens qui organisent les transports des passagers, tels les chauffeurs-guides en possession de véhicules pick-up tout-terrain leur permettant de transporter une trentaine de voyageurs, sont dorénavant accusés de participer à un « trafic illicite de migrants », et peuvent être arrêtés et condamnés.

      Transporter ou même simplement loger, dans le nord du Niger, des ressortissants étrangers (en situation irrégulière ou non) fait ainsi encourir des amendes allant jusqu’à 30 millions de francs CFA (45 000 euros) et des peines pouvant s’élever à 30 ans de prison.

      Et, cerise sur le gâteau de la répression aveugle, il est précisé que « la tentative des infractions prévue par la présente loi est punie des mêmes peines. » Nul besoin donc de franchir irrégulièrement une frontière internationale pour être incriminé.

      Résultat, à plusieurs centaines de kilomètres des frontières, des transporteurs, « passeurs » avérés ou supposés, requalifiés en « trafiquants », jugés sur leurs intentions et non leurs actes, peuvent dorénavant être arrêtés. Pour les autorités nationales, comme pour leurs homologues européens, il s’agit ainsi d’organiser le plus efficacement possible une lutte préventive contre « l’émigration irrégulière » à destination de l’Europe.

      Cette aberration juridique permet d’arrêter et de condamner des individus dans leur propre pays sur la seule base d’intentions supposées : c’est-à-dire sans qu’aucune infraction n’ait été commise, sur la simple supposition de l’intention d’entrer illégalement dans un autre pays.

      Cette mesure a été prise au mépris de la Charte africaine des droits de l’homme et des peuples (article 12.2) et de la Déclaration universelle des droits de l’homme (article 13.2), qui stipulent que « toute personne a le droit de quitter tout pays, y compris le sien ».

      Au mépris également du principe de présomption d’innocence, fondateur de tous les grands systèmes légaux. En somme, une suspension du droit et de la morale qui reflète toute la violence inique des logiques de lutte contre les migrations africaines supposées être à destination de l’Europe.
      Des « passeurs » sans « passages »

      La présomption de culpabilité a ainsi permis de nombreuses arrestations suivies de peines d’emprisonnement, particulièrement dans la région d’Agadez, perçue comme une région de transit pour celles et ceux qui souhaitent se rendre en Europe, tandis que les migrations vers le Sud ne font l’objet d’aucun contrôle de ce type.

      La loi de 2015 permet en effet aux forces de l’ordre et de sécurité du Niger d’arrêter des chauffeurs nigériens à l’intérieur même de leur pays, y compris lorsque leurs passagers sont en situation régulière au Niger. Cette loi a permis de créer juridiquement la catégorie de « passeur » sans qu’il y ait nécessairement passage de frontière.

      La question des migrations vers et à travers le Sahara semble ainsi dorénavant traitée par le gouvernement nigérien, et par ses partenaires internationaux, à travers des dispositifs dérivés du droit de la guerre, et particulièrement de la « guerre contre le terrorisme » et de l’institutionnalisation de lois d’exception qui va avec.

      Malgré cela, si le Niger est peu à peu devenu un pays cobaye des politiques antimigrations de l’Union européenne, nul doute pour autant qu’aucune police n’est en mesure d’empêcher totalement les gens de circuler, si ce n’est localement et temporairement – certainement pas dans la durée et à l’échelle du Sahara.

      Adapter le voyage

      Migrants et transporteurs s’adaptent et contournent désormais les principales villes et leurs #check-points, entraînant une hausse des tarifs de transport entre le Niger et l’Afrique du Nord. Ces #tarifs, qui ont toujours fortement varié selon les véhicules, les destinations et les périodes, sont passés d’environ 100 000 francs CFA (150 euros) en moyenne par personne vers 2010, à plusieurs centaines de milliers de francs CFA en 2017 (parfois plus de 500 euros). Les voyages à travers le Sahara sont ainsi plus onéreux et plus discrets, mais aussi plus difficiles et plus risqués qu’auparavant, car en prenant des routes inhabituelles, moins fréquentées, les transporteurs ne minimisent pas seulement les risques de se faire arrêter, mais aussi ceux de se faire secourir en cas de pannes ou d’attaques par des bandits.

      Comme le montre l’article Manufacturing Smugglers : From Irregular to Clandestine Mobility in the Sahara, cette « clandestinisation » (http://journals.sagepub.com/doi/full/10.1177/0002716217744529) généralisée du transport de migrants s’accompagne d’une diminution, voire d’une disparition, du contrôle social jusque-là exercé sur les différents acteurs, entre eux, mais aussi par leurs proches ou par les agents de l’État qui ponctionnaient illégalement leurs activités.

      Il était en effet aisé, jusqu’à récemment, de savoir qui était parti d’où, quel jour, avec combien de passagers, et de savoir si tous étaient arrivés à bon port. Ce qui incitait chacun à rester dans les limites morales de l’acceptable. Ces dernières années, entre les risques pris volontairement par les transporteurs et les migrants, et les abandons de passagers dans le désert, il ne serait pas étonnant que le nombre de morts sur les pistes sahariennes ait augmenté.
      Une vraie fausse réduction des flux

      Récemment, l’OIM a pu clamer une diminution des volumes des flux migratoires passant par le Niger, et des représentants de l’UE et de gouvernements sur les deux continents ont pu se féliciter de l’efficacité des mesures mises en œuvre, clamant unanimement la nécessité de poursuivre leur effort.

      Mais de l’accord même des agents de l’#OIM, seul organisme à produire des chiffres en la matière au Sahara, il ne s’agit en fait que d’une diminution du nombre de personnes passant par ses points de contrôle, ce qui ne nous dit finalement rien sur le volume global des flux à travers le pays. Or, malgré toutes les mesures sécuritaires mises en place, la toute petite partie de la population qui a décidé de voyager ainsi va sans doute continuer à le faire, quel qu’en soit le risque.

      L’externalisation de la gestion de la migration du Niger par le biais de l’OIM

      En raison de ses capacités limitées, le gouvernement du Niger s’appuie depuis 2014 largement sur l’OIM pour répondre à la situation des personnes migrantes expulsées de l’Algérie ou forcées de revenir de pays voisins tels que la Libye et le Mali. À leur arrivée dans l’un des six centres de transit de l’OIM, et sous réserve qu’ils s’engagent à leur retour, l’OIM leur offre un abri, de la nourriture, une assistance médicale et psychosociale, des documents de voyage/d’identité et le transport vers leur pays d’origine. Depuis 2015, 11 936 migrants ont été rapatriés dans leur pays d’origine dans le cadre du programme d’AVR de l’OIM, la plupart en Guinée Conakry, au Mali et au Cameroun.

      Au cours de ma visite, j’ai eu l’occasion de m’entretenir avec de nombreux hommes, femmes et enfants vivant dans les centres de transit de l’OIM à Agadez et à Niamey, inscrits au programme d’AVR. Certains d’entre eux ont indiqué qu’ils ne pouvaient plus supporter les violations des droits de l’homme (ayant été victimes de discrimination raciale, d’arrestations arbitraires, de torture, d’expulsion collective, d’exploitation sexuelle et par le travail pendant leur migration) et de la situation difficile dans les centres de transit et souhaitaient retourner dans leur pays d’origine. D’autres ont indiqué qu’ils s’étaient inscrits au programme d’AVR parce que c’était la seule assistance qui leur était offerte, et beaucoup d’entre eux m’ont dit que dès leur retour dans leur pays d’origine, ils essaieraient de migrer à nouveau.

      En effet, quand le programme d’AVR est la seule option disponible pour ceux qui ont été expulsés ou forcés de rentrer, et qu’aucune autre alternative réelle n’est proposée à ceux qui ne veulent pas s’y inscrire, y compris ceux qui se trouvent dans une situation vulnérable et qui ont été victimes de multiples violations des droits de l’homme, des questions se posent quant à la véritable nature volontaire de ces retours si l’on considère l’ensemble du parcours qu’ils ont effectué. De plus, l’inscription à un programme d’AVR ne peut pas prévaloir sur le fait que la plupart de ces migrants sont à l’origine victimes d’expulsions illégales, en violation des principes fondamentaux du droit international.

      L’absence d’évaluations individuelles efficaces et fondées sur les droits de l’homme menées auprès des migrants rapatriés, faites dans le respect du principe fondamental de non-refoulement et des garanties d’une procédure régulière, est un autre sujet de préoccupation. Un grand nombre de personnes migrantes inscrites au programme d’AVR sont victimes de multiples violations des droits de l’homme (par exemple, subies au cours de leur migration et dans les pays de transit) et ont besoin d’une protection fondée sur le droit international. Cependant, très peu de personnes sont orientées vers une demande d’asile/procédure de détermination du statut de réfugié, et les autres sont traitées en vue de leur retour. L’objectif ultime des programmes d’AVR, à savoir le retour des migrants, ne peut pas prévaloir sur les considérations en lien avec les droits de l’homme pour chaque cas. Cela soulève également des préoccupations en termes de responsabilité, d’accès à la justice et de recours pour les migrants victimes de violations des droits de l’homme.

      Rôle des bailleurs de fonds internationaux et en particulier de l’UE

      Bien que les principaux responsables gouvernementaux ont souligné que l’objectif de réduction des migrations vers le nord était principalement une décision de politique nationale, il est nécessaire de souligner le rôle et la responsabilité de la communauté internationale et des bailleurs de fond à cet égard. En effet, plusieurs sources ont déclaré que la politique nigérienne en matière de migration est fortement influencée et principalement conduite selon les demandes de l’Union européenne et de ses États membres en matière de contrôle de la migration en échange d’un soutien financier. Par exemple, le fait que le Fonds fiduciaire de l’Union européenne apporte un soutien financier à l’OIM en grande partie pour sensibiliser et renvoyer les migrants dans leur pays d’origine, même lorsque le caractère volontaire est souvent discutable, compromet son approche fondée sur les droits dans la coopération pour le développement. De plus, d’après mes échanges avec l’Union européenne, aucun soutien n’est prévu pour les migrants qui ne sont ni des réfugiés ni pour ceux qui n’ont pas accepté d’être renvoyés volontairement dans leur pays d’origine. En outre, le rôle et le soutien de l’UE dans l’adoption et la mise en œuvre de la loi sur le trafic illicite de migrants remettent en question son principe de « ne pas nuire » compte tenu des préoccupations en matière de droits de l’homme liées à la mise en œuvre et exécution de la loi.

    • African migration ’a trickle’ thanks to trafficking ban across the Sahara

      The number of migrants trying to cross the Mediterranean for Europe has been dropping and that is partly because of tougher measures introduced on the migrant routes, as Mike Thomson reports from Niger.

      In a small dusty courtyard near the centre of Agadez, a town on the fringes of the Sahara desert, Bachir Amma, eats lunch with his family.

      A line of plastic chairs, clinging to the shadow of the mud walls, are the only visible furniture.

      Mr Amma, a former people smuggler, dressed in a faded blue denim shirt and jeans, has clearly known better days.

      "I stopped trafficking migrants to the Libyan border when the new law came in.

      "It’s very, very strict. If you’re caught you get a long time in jail and they confiscate your vehicle.

      “If the law was eased I would go back to people trafficking, that’s for sure. It earned me as much as $6,000 (£4,700) a week, far more money than anything I can do now.”
      Traffickers jailed

      The law Mr Amma mentioned, which banned the transport of migrants through northern Niger, was brought in by the government in 2015 following pressure from European countries.

      Before then such work was entirely legal, as Niger is a member of the Economic Community of West African States (Ecowas) that permits the free movement of people.

      Police even provided armed escorts for the convoys involved. But since the law was passed many traffickers have been jailed and hundreds of their vehicles confiscated.

      Before 2015, the Agadez region was home to more than 6,000 people traffickers like Mr Amma, according to figures from the UN’s International Organization for Migration (IOM) .

      Collectively they transported around 340,000 Europe-bound migrants through the Sahara desert to Libya.
      Migration in reverse

      Since the clampdown this torrent has become a relative trickle.

      In fact, more African migrants, who have ended up in Niger and experienced or heard of the terrible dangers and difficulties of getting to Europe, have decided to return home.

      This year alone 16,000 have decided to accept offers from the IOM to fly them back.

      A large and boisterous IOM-run transit centre in Agadez is home to hundreds of weary, homesick migrants.

      In one large hut around 20 young men, from a variety of West African countries, attend a class on how to set up a small business when they get home.

      Among them is 27-year-old Umar Sankoh from Sierra Leone, who was dumped in the Sahara by a trafficker when he was unable to pay him more money.

      “The struggle is so hard in the desert, so difficult to find your way. You don’t have food, you don’t have nothing, even water you can’t drink. It’s so terrible,” he said.

      Now, Mr Sankoh has given up his dreams of a better life in Europe and only has one thought in mind: "I want to go home.

      "My family will be happy because it’s been a long time so they must believe I am dead.

      “If they see me now they’ll think, ’Oh my God, God is working!’”
      Coast guards intercept vessels

      Many thousands of migrants who make it to Libya are sold on by their traffickers to kidnappers who try and get thousands of dollars from their families back home.

      Those who cannot pay are often tortured, sometimes while being forced to ask relatives for money over the phone, and held in atrocious conditions for months.

      With much of the country in the grip of civil war, such gangs can operate there with impunity.

      In an effort to curb the number of migrants making for southern Europe by boat, thousands of whom have drowned on the way, coast guards trained by the European Union (EU) try and stop or intercept often flimsy vessels.

      Those on board are then taken to detention centres, where they are exposed to squalid, hugely overcrowded conditions and sometimes beatings and forced hard labour.
      Legal resettlement offers

      In November 2017, the EU funded a special programme to evacuate the most vulnerable refugees in centres like these.

      Under this scheme, which is run by the UN’s refugee agency (UNHCR), a little more than 2,200 people have since been flown to the comparative safety of neighbouring Niger.

      There, in a compound in the capital, Niamey, they wait for the chance to be resettled in a European country, including the UK, as well as Canada and the US.

      So far just under 1,000 have been resettled and 264 accepted for resettlement.

      The rest await news of their fate.

      Rien de très nouveau dans cet article, il traite des routes migratoires dans le Sahara mais ne s’intéresse qu’au cas d’Agadez.
      L’auteur qualifie les « flux » dans le Sahara de « migration in reverse ». Alors qu’avant l’adoption de la loi contre le trafic de migrants (2015), 340 000 personnes traversaient le désert du Sahara vers la Libye (sans préciser pour quelle(s) année(s)), en 2018, 16 000 personnes ont été ’retournées’ dans leur pays d’origine par l’#OIM.

      Pour autant, des ’trafiquants’ continuent leurs activités en empruntant des routes plus dangereuses pour éviter les forces de l’ordre. A ce sujet la représentante de l’UNHCR au Niger rappelle que : la communauté internationale ("we, the international Community, the UNHCR") considère que pour chaque mort en Méditerranée, il y en aurait au moins deux dans le désert". Mais toujours pas de sources concernant ces chiffres.

    • After crackdown, what do people employed in migration market do?

      Thousands in Niger were employed as middlemen until the government, aided by the EU, targeted undocumented migration.

      A group of women are squeezed into a modest room, ready to take their class in a popular district of Agadez, the largest city in central Niger.

      A blackboard hangs on the wall and Mahaman Alkassoum, chalk in hand, is ready to begin.

      A former people smuggler, he is an unusual professor.

      His round face and shy expression clash with the image of the ruthless trafficker.

      “We’re here to help you organise your savings, so that your activities will become profitable,” Alkassoum tells the women, before drawing a timeline to illustrate the different stages of starting a business.

      Until mid-2016, both he and the women in the room were employed in Agadez’s huge migration market, which offered economic opportunities for thousands of people in an immense desert region, bordering with Algeria, Libya and Chad.

      Alkassoum used to pack his pick-up truck with up to 25 migrants at once, driving them across the Sahara from Agadez to the southern Libyan city of Sebha, earning up to 1,500 euros ($1,706) a month - five times the salary of a local policeman.

      All of us suffered with the end of migration in Agadez. We’re toasting peanuts every day and thinking of new ways to earn something.

      The women, his current students, were employed as cooks in the ghettos and yards where migrants were hosted during their stay in town.

      At times, they fed 100 people a day and earned about 200 euros ($227) a month.

      For decades, the passage of western African migrants heading to Libya, and eventually to Italian shores, happened in daylight, in full view - and in most cases with the complicity of Niger security forces.

      According to a 2016 study by the International Organization for Migration (IOM), migrants in transit had injected about 100 million euros ($113.8m) into the local economy,

      But the “golden age” of migration through Agadez ended abruptly in the summer of 2016 when the government of Niger launched a crackdown on people smuggling.

      More than 300 drivers, middlemen and managers of ghettos, have been arrested since then, convincing other colleagues - like Alkassoum and his students - to abandon their activity.

      The driver’s new career as a community organiser began right after, when most locals involved in the smuggling business realised they had to somehow reinvent their lives.

      At first, a few hundred men, former drivers or managers of ghettos, decided to set up an informal association, with the idea of raising funds between members to launch small commercial activities.

      But the project didn’t really work, Alkassoum recounts. In early 2018, the leader of the group, a renowned smuggler, disappeared with some of the funds.

      Alkassoum, at the time the association’s secretary, got discouraged.

      That was the moment when their female colleagues showed up.

      Most of them were wives or sisters of smugglers, who were cooking for the migrants inside ghettos and, all of a sudden, had also seen their source of income disappear.

      Resorting to an old experience as a youth leader, Alkassoum decided to help them launch new businesses, through lessons on community participation and bookkeeping.

      As of mid-2018, more than 70 women had joined.

      “At first we met to share our common suffering after losing our jobs, but soon we realised we needed to do more,” says Fatoumata Adiguini at the end of the class.

      They decided to launch small businesses, dividing themselves into subgroups, each one developing a specific idea.

      Habi Amaloze, a thin Tuareg woman, heads one of the groups: 17 women that called themselves “banda badantchi” - meaning “no difference” in Hausa - to share their common situation.

      The banda badantchi started with the cheapest possible activity, shelling and toasting peanuts to sell on the streets.

      Other groups collected small sums to buy a sheep, chicks or a sewing machine.

      “We started with what we had, which was almost nothing, but we dream to be able one day to open up a restaurant or a small farming activity,” explains Amaloze.

      While most men left Agadez to find opportunities elsewhere, the women never stopped meeting and built relations of trust.

      Besides raising their children, they have another motivation: working with migrants has freed them from marital control, something they are not willing or ready to lose.

      According to Rhissa Feltou, the mayor of Agadez, the crackdown on northbound migration responded to European requests more than to local needs.

      Since 2015, the European Union earmarked 230 million euros ($261.7m) from its Emergency Trust Fund of Africa for projects in Niger, making it the main beneficiary of a fund created to “address the root causes of migration”.

      Among the projects, the creation of a police investigative unit, where French and Spanish policemen helped their Nigerien counterparts to track and arrest smugglers.

      Another project, known under its acronym Paiera, aimed at relieving the effect of the migration crackdown in Agadez, included a compensation scheme for smugglers who left their old job. The eight million-euro ($9.2m) fund was managed by the High Authority for the Consolidation of Peace, a state office tasked with reducing conflicts in border areas.

      After endless negotiations between local authorities, EU representatives and a committee representing smugglers, a list of 6,550 smuggling actors operating in the region of Agadez, was finalised in 2017.

      But two years after the project’s launch, only 371 of them received small sums, about 2,300 euros ($2,616) per person, to start new activities.

      The High Authority for the Consolidation of Peace told Al Jazeera that an additional eight million-euro fund is available for a second phase of the project, to be launched in March 2019, allowing at least 600 more ex-smugglers to be funded.

      But Feltou, the city’s mayor, isn’t optimistic.

      “We waited too much and it’s still unclear when and how these new provisions will be delivered,” he explains.

      Finding viable job opportunities for thousands of drivers, managers of ghettos, middlemen, cooks or water can sellers, who lost their main source of income in a country the United Nations dubbed as the last in its human development index in 2018, is not an easy task.

      For the European Union, nonetheless, this cooperation has been a success. Northbound movements registered by the IOM along the main desert trail from Agadez to the Libyan border, dropped from 298,000 people a year in 2016 to about 50,000 in 2018.

      In a January 2019 report, the EU commission described such a cooperation with Niger as “constructive and fruitful”.

      Just like other women in her group, Habi Amaloze was disregarded by Brussels-funded programmes like Paiera.

      But the crackdown changed her life dramatically.

      Her brother, who helped her after her husband died years ago, was arrested in 2017, forcing the family to leave their rented house.

      With seven children, ranging from five to 13 years old, and a sick mother, they settled in a makeshift space used to store building material. Among piles of bricks, they built two shacks out of sticks, paperboard and plastic bags, to keep them safe from sand storms.

      “This is all we have now,” Amaloze says, pointing to a few burned pots and a mat.

      In seven years of work as a cook in her brother’s ghetto, she fed tens of thousands of migrants. Now she can hardly feed her family.

      “At that time I earned at least 35,000 [West African franc] a week [about $60], now it can be as low as 2,000 [$3.4], enough to cook macaroni once a day for the kids, but no sauce,” she says, her voice breaking.

      Only one of her children still attends school.

      Her experience is familiar among the women she meets weekly. “All of us suffered with the end of migration in Agadez,” she says.

      Through their groups, they found hope and solidarity. But their future is still uncertain.

      “We’re toasting peanuts every day and thinking of new ways to earn something,” Hamaloze says with a mix of bitterness and determination. “But, like all our former colleagues, we need real opportunities otherwise migration through Agadez and the Sahara will resume, in a more violent and painful way than before.”

    “In the past two days the intensity of the rain was high and the water started coming down carrying boulders and roots which damaged the wall,” he told Reuters. “The dam wall cracked and the water escaped.”

    Colombia is working to prevent the killing of activists and tackle impunity, under mounting international pressure to stem the violence, a minister said on Thursday.

    Despite a 2016 government peace accord that ended a half a century of civil war with the Revolutionary Armed Forces of Colombia (FARC), activists in the country are still in the firing line, with one gunned down every five days.

    They are particularly at risk in regions vacated by rebel fighters following the peace accord, leaving a power vacuum that crime gangs have sought to fill, the United Nations has said.

    “The government recognizes that the signing of the peace accord is not peace in itself but a necessary and definitive step towards building a more just and equal society,” said Rodrigo Rivera, Colombia’s interior minister.

    “We are fighting against the impunity of homicides of human rights defenders,” he told the United Nations Human Rights Council in Geneva on Thursday as it reviewed the country’s right record.

    The government has set up an elite police task force and investigation unit to dismantle criminal groups and investigate killings and attacks against activists, the minister said.

    About 4,000 at-risk activists receive protection from the government, including bodyguards, bullet-proof vests and cars, Rivera said.

    The government says 144 human rights campaigners were killed in 2016 and 2017 and 103 people have been arrested.

    But local rights groups and watchdogs say the true number of dead is higher.

    South Sudan is close to another famine, aid officials said on Monday, after more than four years of civil war and failed ceasefires in the world’s youngest nation.

    Almost two-thirds of the population will need food aid this year to stave off starvation and malnutrition as aid groups prepare for the “toughest year on record”, members of a working group including South Sudanese and U.N. officials said.

    “The situation is extremely fragile, and we are close to seeing another famine. The projections are stark. If we ignore them, we’ll be faced with a growing tragedy,” said Serge Tissot, from the U.N. Food and Agriculture Organization in South Sudan.

    A total of 5.3 million people, 48 percent of the population, are already in “crisis” or “emergency” - stages three and four on a five point scale, according to a survey published by the working group.

    The Kuchi nomads number about 2.4 million and traditionally migrate in winter from eastern and central Afghanistan to graze their herds in frontier areas inside Pakistan.

    This year, Pakistan has closed its border crossings amid tensions with its neighbour. Afghanistan accused Pakistan of failing to move against the Taliban after two attacks in January that killed hundreds in the Afghan capital Kabul.
