Greece offers to send migrants directly back to Turkey via Aegean Sea

Greece’s defense minister has said he wants an agreement with neighboring Turkey that would allow the European Union’s Frontex border agency to stop and turn back - within Turkish waters - boats carrying migrants to the Greek islands.

Page 18: “In this context, the Commission underlines that the concept of safe third country as defined in the Asylum Procedures Directive39 requires that the possibility exists to receive protection in accordance with the Geneva Convention, but does not require that the safe third country has ratified that Convention without geographical reservation.”

In the communication, the European Commission stated that Turkey could be considered as a safe third country, even if the Geneva convention criteria apply for European refugees only (Turkey signed the Geneva convention with geographical limitation). Even if Syrians, Afghans, Iraqis and other non-European nationalities are not granted any refuge in Turkey, the European countries that consider Turkey as a safe third country will be able to send people back (not only ’economic migrants’ as the readmission agreement allows them to do, but everybody) to Turkey, where they won’t be able to submit any asylum application to the Turkish state and will be probably sent back to their country of origin.

With the new statement of the European Commission, the notion of safe third country becomes meaningless in terms of protection and only serves the European policies and border controls.

On Thursday 11 February 2016, NATO announced that its ships would immediately be deployed in the Aegean in order to combat irregular migration, in cooperation with the relevant authorities and with Frontex. On 23 February, NATO Secretary-General Stoltenberg stated in the European parliament: “When we rescue those people, what we agreed with Turkey at a ministerial level, we agreed that if those people came from Turkey then we can return them to Turkey.” Stoltenberg repeated this on 24 February. Is this compatible with international law?

NATO Expands Aegean Sea Migrant Patrols Into Turkish and Greek Territorial Waters – Rescued Migrants to Be Automatically Returned to Turkey

NATO announced on Sunday, 6 March, that its Aegean Sea patrols have been expanded to Greek and Turkish territorial waters. NATO patrols have been operating only in international waters. And while NATO says its ‘mission is not to stop or turn back those trying to cross into Europe’, NATO has made it clear that NATO ships will return rescued migrants directly to Turkey: ‘In case of rescue at sea of persons coming via Turkey, they will be taken back to Turkey.’ NATO’s plan to summarily return intercepted migrants is consistent with previous statements made by the British and German defence ministers who have said that the purpose of the NATO mission is to stop migrants and return them to Turkey.

Frontex et le commandement maritime de l’OTAN ont mis au point un « common understanding » (arrangement commun) qui nous permet de coordonner nos positions respectives et l’échange d’informations en temps réel. Frontex a actuellement 13 bateaux déployés dans les eaux grecques, l’OTAN a 5 bateaux dans la région et en attend d’autres.

Cette coopération entre l’OTAN et l’UE dans un domaine purement civil – l’immigration, le contrôle des frontières – est tout à fait nouvelle.
