Page 18: “In this context, the Commission underlines that the concept of safe third country as defined in the Asylum Procedures Directive39 requires that the possibility exists to receive protection in accordance with the Geneva Convention, but does not require that the safe third country has ratified that Convention without geographical reservation.”
In the communication, the European Commission stated that Turkey could be considered as a safe third country, even if the Geneva convention criteria apply for European refugees only (Turkey signed the Geneva convention with geographical limitation). Even if Syrians, Afghans, Iraqis and other non-European nationalities are not granted any refuge in Turkey, the European countries that consider Turkey as a safe third country will be able to send people back (not only ’economic migrants’ as the readmission agreement allows them to do, but everybody) to Turkey, where they won’t be able to submit any asylum application to the Turkish state and will be probably sent back to their country of origin.
With the new statement of the European Commission, the notion of safe third country becomes meaningless in terms of protection and only serves the European policies and border controls.
