Hiltzik: Who will own the genetic information held by 23andMe? - Los Angeles Times
    ▻https://www.latimes.com/business/story/2025-03-26/23andme-files-for-bankruptcy-putting-its-hoard-of-personal-health-informati

    https://ca-times.brightspotcdn.com/dims4/default/db91def/2147483647/strip/true/crop/3404x1787+0+437/resize/1200x630!/quality/75/?url=https%3A%2F%2Fcalifornia-times-brightspot.s3.amazonaws.com%2Fa1%2Fb9%2F3d37724f422a93e31ba706f57ce0%2F23andme-board-resigns-78141.jpg

So let’s take a look at the saga.

At first the company’s product was focused on giving customers information about their ancestry. Stories abounded about users’ discoveries of heretofore unknown ethnic backgrounds or even discovering unknown relatives.

It was promoted by Oprah Winfrey, and its retail DNA test was ranked first among the “Best Inventions of 2008” by Time, which named Warren Buffett, Rupert Murdoch, Ivanka Trump and Harvey Weinstein (in his pre-MeToo days) as members of its glittering customer base. Its $99 test kits became popular gifts for Christmas, Mother’s Day and Father’s Day; seasonality is still an important element of sales, the company has disclosed.

But cracks were already emerging in the company’s business plan at the time it went public. As it expanded the claims for its product from helping people suss out their ancestry to giving them information about their genetic predispositions to certain diseases, it attracted the notice of the Food and Drug Administration. In 2010, the FDA warned the company that it might be breaking the law by failing to provide evidence of “the analytical or clinical validity of its tests” to the agency for its approval.

The agency followed up in November 2013, ordering the firm to “immediately discontinue marketing” its test kit until it got FDA approval. The agency was especially concerned about a TV commercial 23andMe had been running, implying that its tests could help alert customers to their predispositions to heart disease, arthritis, gallstones and many other conditions; the agency also groused that the company had not been entirely cooperative with its regulatory review.

The company acknowledged that “we have not met the FDA’s expectations regarding timeline and communication.” Wojcicki, then the CEO, said in a blog post that 23andMe would cease offering customers “health-related” analyses until it could get right with the FDA. The agency finally approved the company’s marketing of tests to determine genetic dispositions to 10 health conditions, including Parkinson’s, Alzheimer’s and certain blood clotting disorders, in 2017.

But even then the FDA warned that “genetic risk” could be overinterpreted by lay consumers — it’s “just one piece of the bigger puzzle,” the agency said; “it does not mean they will or won’t ultimately develop a disease.”

That issue was raised by medical experts from the very beginning. “We are notoriously poor at estimating risk and communicating relative and absolute risk,” Harvard epidemiologist David Hunter told me in 2013 for my first report on 23andMe.

That’s especially true in genetics, where the effect of a single gene or mutation can be vanishingly incremental, especially when measured against environmental or behavioral factors, but the revelation that you carry it can sound like the tolling of a bell.

In certain respects the trajectory of 23andMe resembles that of another venture investor darling in the healthcare space, Theranos. The latter company collapsed among evidence of fraud in its marketing of a medical device that was pitched as a way to allow people to take charge of their own healthcare decisions. (Its founder, Elizabeth Holmes, is currently serving a nine-year prison sentence.)

To be clear, 23andMe has never been the target of fraud allegations; the products it has been selling are real enough, unlike those of Theranos. But questions about the efficacy and usefulness of its consumer products have followed it almost from the start. There was always buzz surrounding 23andMe during its heyday. The question is: Was there ever anything more than buzz?

23andMe bankruptcy could expose customers’ genetic data - Los Angeles Times

Once a promising company briefly valued at $6 billion, 23andMe popularized at-home DNA test kits and spawned a cottage industry of ancestry hunters and true crime sleuths.
But the company could not build a sustainable business and many of the 15 million people who gave their genetic information to the platform are worried about where their personal data could end up.

When Christina Snyder Monahan of Irvine first received her genetic results from 23andMe three years ago, she thought there was a mistake.

The DNA sample she had sent to the company revealed that she was nearly 50% Persian, though to her knowledge, she didn’t have any Persian relatives. More than a year later, her mother admitted to having an “encounter” with another man, who was her actual biological father and not the man who raised her.

After adjusting to the shock, Monahan embraced the news, using 23andMe to meet relatives she never knew she had, including a first cousin and four half-siblings. Her biological father died before she learned of his existence.

“I was completely blown away,” Monahan said. “The app gave me meaningful information about the region in Iran my father hailed from.”

“Genetic information is uniquely sensitive because it reveals immutable characteristics about ourselves,” said Sara Geoghegan, senior counsel at the Electronic Privacy Information Center. “I would be very concerned if I had given a swab to 23andMe. There is little we can do to control what happens to it.”

The company’s online terms of service says, “Your sample is processed in an irreversible manner and cannot be returned to you. Any information derived from your sample remains subject to rights we retain as set forth in these Terms.”

23andMe customers are protected by the terms of service, but these terms can be changed by the company or its new owner at any time, Geoghegan said. Terms of service are also often written broadly or vaguely, and “privacy policies are wholly inadequate to protect our personal information,” she said.

The 23andMe website crashed last week as customers rushed to delete their data, the Wall Street Journal reported. As concerns spread, the company issued a statement clarifying that “potential buyers must, among other requirements, agree to comply with 23andMe’s consumer privacy policy and all applicable laws with respect to the treatment of customer data.”

A company spokesperson declined to comment for this story and referred to previous statements.

In 2023, a company data breach affected nearly 7 million customers, and last year, 23andMe agreed to pay $30 million to settle a class-action lawsuit accusing the company of failing to protect its customers.

“I do think people should be worried,” he said. “There’s lots of different actors who would want this data for a lot of different purposes, far beyond what you probably thought you were consenting to when you were just interested in genealogy.”

Pharmaceutical companies, insurance companies or law enforcement might be interested in obtaining the data, Christo said. An insurance company might use genetic information to determine pre-existing health conditions and consequentially raise rates for that individual, he said.

    ▻https://www.lemonde.fr/economie/article/2025/03/27/23andme-la-faillite-chaotique-d-un-ex-fleuron-de-la-biotech_6586709_3234.htm

23andMe’s bankruptcy is a national security threat - UnHerd
    ▻https://unherd.com/newsroom/23andmes-bankruptcy-is-a-national-security-threat

    https://unherd.com/wp-content/uploads/2025/03/GettyImages-1978234813.jpg

    Our Mission
When the herd takes off in one direction, what do you do?
UnHerd is for people who dare to think for themselves.

Who wants to buy the genetic code of 14 million Westerners? DNA sequencing company 23andMe has filed for bankruptcy protection and is now up for sale. Users are now being advised to delete their accounts, though for many this advice arguably comes too late. But the real privacy concern should be the geopolitical one. In this context, the potential sale of millions of DNA sequences, most of them American, could sharpen a burgeoning debate in the US tech industry over which, if any, national loyalties Silicon Valley should espouse.

Founded in 2006 by Anne Wojcicki and two partners, 23andMe offers consumers the opportunity to send a saliva sample for sequencing, and receive a report on ancestry and health information. Despite celebrity endorsements and a valuation of $6 billion after listing in 2021, the company has never made a profit and is now seeking a buyer.

So, what will happen to its databases? 23andMe always emphasised its trustworthiness on data protection. But when it went public, privacy experts raised concerns over the increased number of shareholders with possible interests in bending the firm’s privacy rules to access its data. Last month, the undercover media outlet O’Keefe Media Group published a video conversation with a US Treasury advisor, who warned that the firm shares its data with shareholding companies, some of which are — he claims — owned by the Russian or Chinese governments.

But what if the real concern isn’t individual privacy but national security? For while we are surely well into the age of Big Data and biotech, every day also brings a new headline underlining the fact that this is occurring in tandem with a return to great-power politics. Based on where it ships, 23andMe serves, in essence, wealthy, tech-curious consumers in the West: America and her allies. It’s not hard to imagine a hostile regime acquiring its database with malicious intentions, such as bioweapon development.

In his new book The Technological Republic, Palantir CEO Alex Karp critiques what he views as a naively universalist outlook in the US tech industry, as though global peace and transnational commerce are somehow guaranteed, forever. Karp disagrees, arguing instead that the American tech industry must abandon its squeamishness about defence, and urgently refocus on the national interest.

Was 23andMe an instance of such naive universalism? Doubtless Wojcicki only ever thought of 23andMe’s dataset in commercial, win-win terms: a source of benefits all round, whether from research, customised healthcare, or personal profit. A hostile polity exploiting a database containing millions of complete American genomes to as yet unimaginable military ends would have seemed like science fiction only a few years ago. But if Karp is right, this is no longer so far-fetched. Perhaps the real questions for any potential 23andMe buyer should not concern business intentions, but national loyalties.

With 23andMe filing for bankruptcy, what happens to consumers’ genetic data?

    https://images.theconversation.com/files/658082/original/file-20250327-62-slpqe9.jpg?ixlib=rb-4.1.0&rect=0%2C1077%2C4500%2C2250&q=45&auto=format&w=1356&h=668&fit=crop

23andMe’s innovation was to use this burgeoning lust for ancestors as a way to build a new kind of direct-to-consumer database, one that looked at inherited markers for diseases afforded by the potent combination of genetic and genealogical information.

They weren’t the first to hit on this idea. deCODE Genetics in Iceland had already built a national database of braided genealogical and genetic information for the same purpose. Within 10 years, it too went bankrupt and sold its database.

    Ahead of government

23andMe’s Anne Wojcicki speaks at an event in San Francisco in 2013. (AP Photo/Jeff Chiu)
23andMe was the first to market the idea in North America when Wojcicki founded the company in 2006.

Wojcicki claimed a high mission: to liberate health information from the hands of the medical industry and put it directly into the hands of consumers. Her business model made it clear that the direct-to-consumer genetics industry was always in the business of doing an end run around government and university databases that were governed by much stricter privacy laws.

23andMe ran into trouble with the FDA in 2013 for providing medical information without any medical supervision, a wrinkle that took two years for the company to iron out. But the more lucrative end of the business was always the sale of the accumulated data to the pharmaceutical industry.

23andMe pitched its research arm as the greater good, and 80 per cent of its consumers opted in to share their information for research purposes. The database has always been monetized for secondary uses. In its profile of 23andMe in 2017, Nature quoted cardiologist Euan Ashley at Stanford University, California: “They have quietly become the largest genetic study the world has ever known.”

In addition to the 1.5 million users whose profiles were breached, hackers accessed the personal information of about 5.5 million people who opted in to 23andMe’s DNA Relatives feature.

Stolen data included customers’ names, birth years, relationship labels, percentage of DNA shared with relatives, ancestry reports and self-reported locations.

Fully a third of 23andMe’s users’ genealogical information had been scraped by the hackers. And here we see the real vulnerability in the entire industry: Anyone who has submitted a DNA sample and built family connections has exposed everyone in their family line.

This seems to be a classic case of closing the barn door after the horses have already bolted.

Like 23andMe, deCODE was a high flier in the genetics space having built a genealogical database that included almost all Icelanders, who invested heavily in the company. The company went bankrupt during the financial crisis of 2008, and it sold its database to American pharmaceutical company Amgen. Amgen in turn sold part of it to a Chinese company.

    Changing privacy

Each time a database is sold, privacy provisions are subject to change. Even though Wojcicki is promising to protect the privacy of customers currently in the database, she might not have much control in the long run.

So what should 23andMe’s customers do? Should they delete what data they can? Absolutely. Will it make much difference in the end? Probably not.

What is now manifestly apparent is that the industry of direct-to-consumer genetics has far outpaced the ability of governments to regulate the information, so consumers are suddenly nervous.

We should have paid attention at the very beginning of this dubious exercise in the privatization of personal data. Now we have to live with all that relatedness as a valuable commodity over which we have little say.

What users need to know about privacy and data after 23andMe’s bankruptcy filing
    ▻https://theconversation.com/what-users-need-to-know-about-privacy-and-data-after-23andmes-bankr

    https://images.theconversation.com/files/658174/original/file-20250327-56-yauhey.jpg?ixlib=rb-4.1.0&rect=36%2C1026%2C3989%2C1991&q=45&auto=format&w=1356&h=668&fit=crop

In 2023, hackers exploited old passwords to gain access to the personal information of 6.9 million people. While 23andMe said no genetic data was compromised, information like family trees, birth years and geographic locations were. Some of the stolen data was later put up for sale on a hacking forum.

In addition to the breach and resulting legal suits, the company has been in financial trouble since 2021. In 2024, 23andMe laid off 40 per cent of its workforce and saw all its independent directors resign unanimously in response to CEO Anne Wojcicki’s decision to take the company private. Wojcicki has since stepped down.

This means 23andMe could technically sell customer information as part and parcel of the company to ensure competitive bids. This information includes both individual-level data, such as genotypes, diseases and traits, as well as de-identified data that doesn’t include names or addresses.

    https://images.theconversation.com/files/658173/original/file-20250327-56-ewlen5.jpg?ixlib=rb-4.1.0&q=45&auto=format&w=754&h=503&fit=crop&dpr=1

23andMe is one of the first companies to provide direct-to-consumer genetic testing kits. (Shutterstock)
The company could also expand licensing agreements with pharmaceutical companies, which would allow them to use customer information for research. For instance, 23andMe’s “discovery collaboration” with GlaxoSmithKline allows consumer data to be used for research on novel drugs.

In the U.S., however, the situation is much more complicated as there continues to be a lack of a harmonized legal approach to consumer privacy. Some U.S. states have enacted laws to better protect consumer privacy, like California’s Consumer Privacy Act and the Illinois Genetic Information Privacy Act.

However, U.S. federal legislation like the Health Insurance Portability and Accountability Act, better known as HIPAA, doesn’t apply because 23andMe isn’t classified as a health-care agency or an associate of a health-care organization.

Without clear regulations, consumers are forced to rely on the word of companies. With genetic data at stake, it’s imperative that policymakers take action to protect consumer privacy in the face of uncertainty.

As a geneticist, I will not mourn 23andMe and its jumble of useless health information | Adam Rutherford | The Guardian
    ▻https://www.theguardian.com/commentisfree/2025/mar/27/geneticist-mourn-23andme-useless-health-information
    ▻https://i.guim.co.uk/img/media/7b399b22cc88685be26bd8c319c5656a08fd51f8/0_135_4000_2401/master/4000.jpg?width=1200&height=630&quality=85&auto=format&fit=crop&overlay-ali

23andMe provided information purporting to be about your personal health and ancestry. All you had to do was spit in a tube and give them some money, and in return you’d get a very glossy map of your genetic genealogy, and some info on the probability that you like the taste of coriander, or your skin flushes when you’re drunk, or whether you have sticky or wet earwax, or your eye colour – things you might have already known, if you have ever looked in a mirror, or stuck your finger in your ear. If you look carefully, they did give solid info on the science underlying the results, but who reads the small print?

Your DNA is your most private data. The billions of letters of genetic code in your cells are unique to you, and always will be, in the whole history and future of humankind, even if you are an identical twin. It contains the history of your family, of our species, and of life on Earth. It harbours the most personal conceivable information about your family, your life and health. And that is what 23andMe wanted.

The company has just filed for bankruptcy, and this does not sadden me. It didn’t invent direct-to-consumer genomics, but it made big data big business. The genius of its business model was not simply to get you to volunteer this personal data to a private company, but to persuade you to actually pay to give it to them. It then commercialised your DNA by selling it on to pharmaceutical companies, which would use it to develop drugs, ultimately for profit. It was the type of racket that a mob boss might look on and say: “And this is legal?” There was always an opportunity to opt out, but most people did not, because who reads the small print? And what did you get in exchange? A scientific trinket.

But the main interest came from people who thought they were paying to answer the nebulous question of where they came from. The trouble is: it’s an empty promise. There is no method for identifying the geographical origin of your ancestors using genetics. Your ancestors about 50 generations back are from all over the world, and besides, biology does not bestow membership to a tribe or clan or people or country. What 23andMe was actually doing was comparing your DNA to that of other paying customers, and matching up where they live today, and inferring that you have ancestors in that location. It kind of works, but is mostly meaningless. When the data lets you believe that you are 37% German, or 18% Spanish, or whatever, it might feel fun, but of course there is no way of being 37% German. White supremacists loved this type of service too because – locked into their scientifically ignorant ideology – they believed it would reveal some sort of racial purity. Even when testing uncovered previously unknown ancestry from people they deem inferior, they would often attribute the results to a Jewish conspiracy.

As for the health information it provided, the results are also of profoundly limited use, because the tests are not designed to diagnose medical conditions, and the genetic variants anaylsed as part of the service are derived from population-level statistics, which are not particularly informative to individuals. I discovered that I have a genetic variant that at a population level is associated with a slightly higher risk of developing Alzheimer’s disease. Knowing this neither bothers me nor has prompted a change in my behaviour. It does not mean that I will get Alzheimer’s, and if you don’t have that same variant it doesn’t mean you won’t.

DNA is not fate. 23andMe was trading on ignorance of how the genome actually works, and perpetuating a deterministic view of genetics that is outmoded and wrong.

    Overview

In recent C++ versions the Standard Library has added a few functions whose sole job is to supply some (specific!) point somewhere between two other points x and y: std::clamp (from C++17), and std::midpoint and std::lerp (from C++20).

Adding these function templates to the Standard Library serves two main purposes. First, it establishes common terminology (vocabulary) for these operations, that is likely to be widely recognized. Second, and particularly in the case of std::midpoint and std::lerp, it ensures the availability of high quality implementations that avoid common pitfalls.

All of these operations are constexpr, meaning that they can be used both at (...)

The style guide says in the Type Deduction (including auto) section:

Use type deduction only if it makes the code clearer to readers who aren’t familiar with the project, or if it makes the code safer. Do not use it merely to avoid the inconvenience of writing an explicit type.

Ironically, overuse of auto often leads to code becoming less clear. Over time, however, several patterns have emerged where using auto can improve code clarity and safety, such as:

In situations where specifying the type correctly can be difficult and specifying the wrong type can lead to performance or correctness issues, e.g., range-based for loops over a (...)

Tip of the Week #234: Pass by Value, by Pointer, or by Reference?

    Overview

Many programming languages, such as Java and Python, always access objects via references, and functions that accept objects get their own reference to the caller’s object. Others, such as C and Go, allow you to explicitly specify pointers to objects. C++ further allows you to choose whether to pass by value, giving the called function a copy of the argument, or to pass by reference, giving the called function access to the caller’s object. This tip will illustrate the various ways input-only function parameters are passed in C++ and provide recommendations and caveats.

When we talk about passing by value, we explicitly mean that the language ensures that the scope (...)

NARRATIVE #23 by Marc Moustacakis | Jean-Baptiste Rivoire
