    Decoding #Balkandac : Navigating the EU’s Biometric Blueprint

    This report, authored by the Border Violence Monitoring Network with support from Privacy International, investigates the development of interoperable biometric databases, akin to Eurodac, in the Western Balkans, referred to as the “Balkandac” system. It highlights a lack of transparency in current regional data-sharing systems and underscores the significant role of EU institutions in their creation.

    The report employs a comprehensive methodology, combining grassroots observations, open-source research, and Freedom of Information Requests (FOI) submissions to address human rights violations.

    This report aims to contextualise recent developments towards the digitalisation of biometric data collection in the Western Balkans into wider shifts in migration policy and data-sharing frameworks at the EU level. In order to achieve this, the report first unpacks the key regulations envisioned under the EU’s New Pact on Migration and Asylum and how these are envisioned to operate within EU Member States. Collectively, they establish a system whereby people on the move are prevented from entering the territory of Member States, subjected to expedited procedures, and returned directly to “safe third countries”. This manifests as a legalisation of the pushback process; individual claims will undergo insufficient scrutiny within compressed timeframes and procedural rights, such as access to free legal aid and the suspensive effect of appeals against inadmissabiliy decisions, are not yet guaranteed at the time of writing. These legal shifts unequivocally obstruct access to the right to asylum within the new regulatory framework.

    A key ongoing development in this line is the development of biometric data collection systems that are modelled off the EURODAC system, allowing for seamless interoperability in the future. Funding from the EU’s Instruments for Pre-Accession Assistance and bilateral agreements with Member States have supported these data systems in the Western Balkans, mirroring Eurodac. Critiques arise from increased interoperability of EU databases, which blur immigration and criminal law purposes, lack anti-discrimination safeguards, and bypass key data protection principles.

    The core issue lies in the balance between personal data protection and fundamental rights, contrasted with the use of biometric systems for mass surveillance and data analysis. The report emphasizes the merging of migration and security discourses, underscoring the potential for unjust criminalisation of migrants, making it harder for them to seek asylum and international protection.

      C’est pourtant simple, les Balkans orientaux sont restés… orientaux (et donc, orthodoxes), comme l’Empire romain dont ils faisaient partie. D’ailleurs, les grands blonds germains n’y sont pas allés…
      (du moins, après les tout premiers en 378 (Andrinople !!!), les plus… orientaux (!) sur la carte ci-dessous) heureusement, ils ont terminé à l’ouest (Toulouse puis péninsule Ibérique)

      Violence at the Hungarian border

      This winter, as temperatures dropped to 20 below zero, the level of violence at Hungary’s border with Serbia increased sharply, with many describing acts that can be only seen as torture. People of all ages, some as young as 13, were beaten, stripped naked and ordered to lie face-down in the mud, snow or water for as long as an hour. Their clothing was taken or destroyed. Water poured down their necks. Eyes pepper sprayed. Batons struck against genitals. Forced selfies with laughing officers. All this performed by people in “dark blue uniforms” – official Hungarian border police.

      Over the past two years, the Hungarian government has been running a “xenophobic scapegoating campaign" against migration, according to the Helsinki Committee. A 175 kilometer long fence has been setup along the Serbian-Hungarian border, while parallel efforts have been made to prevent the possibility of getting asylum through legal paths.

      Meanwhile in Serbia, the number of refugees significantly exceeds the country’s accommodation capacity and is still growing. During one of the harshest winters in years, up to 2000 people have had no alternative but to sleep rough outdoors – on the streets of Belgrade or in the forests of the north. Without a safe place to stay in Serbia and no legal way to travel backwards, they’ve been stuck in limbo.

      For most of them, attempting irregular crossings has become the only option. Nearly all of those who tried encountered systematic brutality and humiliation regardless of their gender, age or nationality.

      Numerous cases of beatings, dog bites and other abuses at the hands of Hungarian border police have been reported by human rights organisations and activists during the past year. From January 2016 to February 2017, Médecins Sans Frontières (Doctors Without Borders) treated over a hundred people in Belgrade alone with intentional injuries allegedly perpetrated by the Hungarian border patrols.

      Although the Hungarian authorities deny all the accusations, the enormous scale and clear pattern of violence leave no doubt: these are not just rare and isolated acts of brutality.

      The stories in this video were collected during January and February 2017. During these 2 months we’ve interviewed more than 20 victims of abuse following human rights reporting guidelines. Informally, we’ve talked with many more.

    Balkans, les nouvelles routes des migrants

    Il y a bien sûr Lampedusa, ses drames, et les milliers de migrants qui périssent en tentant de traverser la Méditerranée. Le conseil européen de ce 25 octobre est censé apporter des réponses : ce pourrait être de cadenasser un peu plus encore l’espace Schengen ! Et il y a ces autres milliers de migrants qui tentent de pénétrer la forteresse Europe en passant par les Balkans. Les drames y sont tout autant terribles, même si moins médiatisés.
