    Think anonymous reviews in crowd-sourced forums like Yelp and Glassdoor are protected by the First Amendment?

    A former employee who posted a critical review of New York oil barge operator Bouchard Transportation is about to find out.

    So far, Bouchard is winning.

    A California judge in June sided with Bouchard and ordered the job search site Glassdoor to reveal the name of the anonymous former employee who wrote in a 2015 review that the company had “no safety culture.

    Bouchard and its president, Morton Bouchard III, say they need the person’s name to pursue a defamation lawsuit. The company’s complaint states that Bouchard has “diligently worked to ensure that BTC (Bouchard Transportation Company) has a reputation for operating safely.

    But in new arguments filed in November, the former employee, known in court records as John Doe 1, claims that his comments were constitutionally protected opinion.

    Doe also claims that events over the past three years support his criticism.

    Among the events was the explosion of Bouchard’s Barge 255 off the coast of Texas in 2017, killing the vessel’s two deckhands. Testimony about Bouchard’s safety culture figured in a two-week public hearing in 2018 into the cause of the accident held by the U.S. Coast Guard.

    Bouchard was so concerned about the impact of the testimony on its reputation that the company filed a lawsuit in U.S. District Court in Houston midway through the Coast Guard inquiry seeking unsuccessfully to shut down the hearings.

    Doe’s lawyer, First Amendment lawyer Henry Kaufman of New York City, in a petition filed in November to stop Doe’s unmasking, asked the judge to consider what he called “Bouchard’s bad faith claims about their allegedly fine reputation for safety and environmental concern.

    A hearing is scheduled for Feb. 5, 2019, in the Superior Court of California in Marin County.

    With the number and popularity of online anonymous review forums growing, courts across the country increasingly are being asked to balance the public’s right to free speech under the First Amendment with the right of business to challenge statements that it claims are defamatory.

    Case law on the protection of anonymous reviewers’ identities is an evolving work in progress.

    The U.S. Supreme Court repeatedly has held that anonymous speech is protected speech.

    Under our Constitution, anonymous pamphleteering is not a pernicious, fraudulent practice, but an honorable tradition of advocacy and of dissent. Anonymity is a shield from the tyranny of the majority,” the court wrote in the 1995 case of McIntyre v. Ohio Elections Commission.

    In the modern era of online publication, internet companies rather than pamphleteers increasingly are having to fight to protect the identities of their writers.

    Glassdoor offers tips on its website on writing a review to avoid defamation.

    You are entitled to post your anonymous opinions about your company or C-suite executives on Glassdoor and your speech should be protected under the First Amendment. However, you should be aware that statements of provable facts are subject to legal claims of defamation if your company and/or executives allege your statements are false,” Glassdoor’s website states.

    A key issue is whether the reviewer posts opinions or statements of fact which can be proven true or false.

    September 6, 2018 - by Daniel Hautzinger - Last year, a pair of Chicago aldermen proposed renaming a Chicago street to honor the journalist and anti-lynching activist Ida B. Wells, and in July of this year the proposal was approved for a stretch of Congress Parkway. But Congress wasn’t the street originally considered for renaming; rather, it was Balbo Drive.

    7th Street became Balbo Drive in 1934, in recognition of Italo Balbo, a leading Italian Fascist under Benito Mussolini. There’s also Balbo Monument east of Soldier Field, a 2,000-year-old column donated by Mussolini to the city the same year. Why does Chicago have a street and monument honoring a Fascist?

    In 1933, Balbo led twenty-four seaplanes on a pioneering sixteen-day transatlantic journey from Rome to Chicago, flying over the Century of Progress World’s Fair before landing in Lake Michigan near Navy Pier. Balbo and the pilots were celebrated by Chicago’s high society over the next three days. Chief Blackhorn of the Sioux, who was participating in the World’s Fair, granted Balbo a headdress and christened him “Chief Flying Eagle;” Balbo gave the Chief a Fascist medallion in return. He and his pilots then continued on to New York City. Balbo was featured on the cover of Time magazine and had lunch with President Franklin D. Roosevelt.

    The following year, Mussolini sent the column to Chicago to commemorate Balbo’s flight, and it was installed in front of the Fair’s Italian Pavilion. 40,000 people attended its unveiling, and a speech by Balbo was broadcast by radio from Italy. After the defeat of the Fascists in World War II and the revelation of their crimes, Italy’s ambassador to the United States suggested that marks of respect on the column to Balbo and the Fascist government be removed. Despite those changes, the monument still stands, and Balbo Drive retains its name despite the proposal to change it, being a point of pride for many Italian Americans in Chicago.

    The World’s Fair was also the site of a subtle protest against fascism in Europe, when a pageant dramatizing Jewish religious history took place in Soldier Field in July of 1933. According to the Chicago Daily News, the event drew 150,000 people of various faiths, and the “spiritual kinship” and “fine fellowship” between Christians and Jews there would “carry rebuke to those who oppress the Jew” in “Hitler’s Germany.”

    Two years later, Soldier Field saw a different kind of demonstration that does not seem to have been explicitly anti-Semitic but did feature the Nazi swastika. In 1936, a “German Day” rally included a march with both the American flag and a flag bearing the swastika. But the German American community in Chicago mostly laid low during World War II, careful to conceal their ethnicity and avoid experiencing some of the anti-German sentiment they had already experienced during World War I. However, in 1939 a rally in Merrimac Park supporting the German-American Bund, an organization sympathetic to Nazism and Hitler, attracted several thousand people.

    Decades later, a tiny flare-up of support for fascism in Chicagoland attracted outsized national attention. In 1977, a small neo-Nazi group called the National Socialist Party of America sought to hold a demonstration in the northern suburb of Skokie, which had a large population of Jewish people, including some 7,000 survivors of the Holocaust. The suburb originally planned on letting the demonstration happen and moving on, but was convinced by members of its Jewish community to prevent it. (In 1966, the head of the American Nazi Party came to Chicago to march against Martin Luther King, Jr. as Dr. King protested unfair housing practices in the city.)

    After passing ordinances that would prevent the demonstration, Skokie was challenged in court by the neo-Nazis, who were supported by the legal backing of the American Civil Liberties Union. The ACLU did not support the views of the group, but rather sought to protect the First Amendment rights of freedom of speech and freedom of assembly. David Goldberger, the ACLU lawyer who led the case, was Jewish.

    30,000 members of the ACLU resigned in protest, and financial support for the organization dropped precipitately. Yet the lawyers persevered, fearing that any denial of free speech was a slippery slope. Through various courts, injunctions, and proposed legislation, the neo-Nazis eventually won the case, which even made it to the Supreme Court.

    But the neo-Nazis never demonstrated in Skokie. Instead, they staged two marches in Chicago, one downtown and one in Marquette Park. Counter-protesters vastly outnumbered the ten or twenty neo-Nazis in both cases. The leader who spearheaded the marches and garnered the media’s attention during the Skokie case was later convicted for child molestation. (The hapless National Socialist Party of America is famously satirized in the 1980 film Blues Brothers.)

    In the wake of the Skokie case, Illinois became the first state to mandate Holocaust education in schools. And in 2009, Skokie became the site of the Illinois Holocaust Museum and Education Center, an implicit rebuke to the attempted Nazi demonstrations of three decades prior.

    It seems that some critics just can’t accept the fact that an unapologetic Democratic socialist like Ocasio-Cortez – who calls for a more equal distribution of wealth and fair shake to workers – can also wear designer clothes.

    To a historian like me who writes about fashion and politics, the attention to Ocasio-Cortez’s clothing as a way to criticize her politics is an all-too-familiar line of attack.

    Ocasio-Cortez isn’t the first woman or even the first outsider to receive such treatment.

    In particular, I’m reminded of Clara Lemlich, a young radical socialist who used fashion as a form of empowerment while she fought for workers’ rights.

    Lemlich – like Ocasio-Cortez – wasn’t afraid to take on big business while wearing fancy clothes.
    ‘We like new hats’

    In 1909, when she was only 23 years old, Lemlich defied the male union leadership whom she saw as too hesitant and out of touch.

    In what would come to be known as the “Uprising of the 20,000,” Lemlich led thousands of garment workers – the majority of them young women – to walk out from their workplace and go on a strike.

    As historian Nan Enstad has shown, insisting on their right to maintain a fashionable appearance was not a frivolous pursuit of poor women living beyond their means. It was an important political strategy in strikers’ struggle to gain rights and respect as women, workers and Americans.

    When they picketed the streets wearing their best clothes, strikers challenged the image of the “deserving poor” that depicted female workers as helpless victims deserving of mercy.

    Wearing a fancy dress or a hat signaled their economic independence and their respectability as ladies. But it also spoke to their right to be taken seriously and to have their voices heard.

    Despite the criticism, Lemlich and her fellow strikers were able to win concessions from factory owners for most of their demands. They also turned Local 25 of the International Ladies Garment Workers Union into one of the most influential labor unions in the country, changing for the better the lives of millions of workers like themselves.

    But more importantly, Lemlich and her colleagues changed the perception of what politically radical women should look like. They demonstrated that socialism and labor struggles were not in opposition to fashionable appearances.

    Today, their legacy is embodied in Ocasio-Cortez’s message. In fact, if Clara Lemlich were alive today, she would probably smile at Ocasio-Cortez’s response to her critics.

    The reason some journalists “can’t help but obsess about my clothes [and] rent,” she tweeted, is because “women like me aren’t supposed to run for office – or win.”

    Ocasio-Cortez has already begun to fashion an image for women who, as her worn-out campaign shoes can attest, not only know how to “talk the talk,” but can also “walk the walk.”

    Lyft is the latest brand trying to build market share by posing as a “progressive” corporation. But the fight can’t be good corporations against bad ones — it’s working people against capitalism.
    In early 2017, liberals hit on a new strategy to resist the nascent Trump administration: #DeleteUber.

    It started when New York City’s taxi drivers refused to service JFK airport to protest Trump’s travel ban targeting Muslim-majority countries, and Uber was spotted leveraging the ensuing crisis for profit. Then Uber CEO Travis Kalanick came under fire for accepting an appointment to Trump’s economic advisory council. He announced his resignation from the council, but only weeks later a video leaked of Kalanick reprimanding a driver for his company.

    Amid various ensuing scandals, Kalanick stepped down as CEO of Uber, but by then millions of consumers had turned on the brand in protest, deleting the Uber app from their phone and opting instead for the rideshare giant’s rival Lyft.

    Lyft leaned in, eagerly branding itself as the progressive alternative to Uber by pledging a $1 million donation to the ACLU and trotting out celebrities to promote it as a company committed to “doing things for the right reasons.” Lyft, of course, operates on the same labor model as Uber — its drivers are not employees but independent contractors, and are therefore denied all the benefits and protections that workers receive under more ideal circumstances. Nevertheless, a new refrain rang out across liberaldom: “I don’t use Uber, I use Lyft.”

    What socialists understand that liberals don’t is that brands are corporate enterprises, and corporate enterprises are fundamentally motivated by the pursuit of profit — even in their ostentatious acts of charity and wokeness.

    Three surefire ways to maximize profit are: suppressing labor costs by paying workers as little as you can get away with, lobbying the state for deregulation and lower taxes, and opening new markets by finding new things to commodify and sell. Businesses will always pursue these avenues of profit maximization where they can. It’s not a matter of ethics but of market discipline: if they don’t, they run the risk of losing out to the competition and eventually capsizing.

    Sometimes corporations do things for publicity that make it seem like their interests are not fundamentally misaligned with those of the working-class majority, who rely on decent wages and well-funded public services. But those efforts are meant to sustain public confidence in a given corporation’s brand, which is occasionally necessary for keeping up profits, as Uber’s losses in 2017 demonstrate. When corporate profits come into direct conflict with active measures to improve people’s wellbeing, corporations will always select the former. Case in point: Lyft just donated $100k to the campaign against a ballot measure that would create a tax fund to house the homeless in San Francisco, where the company is based.

    Why did the progressive alternative to Uber do this? Well, because the company doesn’t want to pay higher taxes. Because high taxes imperil profits, and profits are the point. Another likely rationale is to build stronger bonds with pro-business advocacy groups in San Francisco, so that the company will have allies if the city decides to implement regulations against ride-sharing services, which is rumored to be a possibility.

    Lyft has already mastered the art of suppressing labor costs and opening new markets. Next on the wish list, low taxes and deregulation. It’s pretty formulaic when you get down to it.

    San Francisco is home to an estimated 7,500 homeless people. Proposition C would tap the large corporations that benefit from the city’s public infrastructure to double the city’s homelessness budget in an attempt to resolve the crisis. The corporations opposing Proposition C say that the move would imperil jobs. This is not an analysis, it’s a threat. What they’re saying is that if the city reaches too far into their pockets, they’ll take their business elsewhere, draining the region of jobs and revenue as punishment for government overreach. It’s a mobster’s insinuation: Nice economy, shame if something happened to it. Meanwhile thousands of people sleep in the streets, even though the money to shelter them is within the city’s borders.

    Of course, in every struggle over taxes and industry regulation there may be a few canny corporate outliers looking to ingratiate their brand to the public by bucking the trend. In the case of Proposition C, it’s Salesforce, whose CEO Marc Benioff has made a public display of support for the ballot measure. But before you rush to praise Benioff, consider that only two months ago he lauded Trump’s tax cuts for fueling “aggressive spending” and injecting life into the economy.

    You could spend your life as an engaged consumer hopping from brand to brand, as liberals often do, pledging allegiance to this one and protesting that one to the beat of the new cycle drum.     Or you could press pause, stop scrambling for some superior consumption choice to ease your conscience, and entertain the socialist notion that deep down all corporations are objectively the same. They all exist to maximize return on investment for the people who own them. They are all in competition with each other to plunder our commons most effectively, with the lowest overhead, which means compensating the least for employees’ work. And when the rubber meets the road, they will all prioritize private profits over the wellbeing of those who own no productive assets, which is the vast majority of the people on the planet. They will demonstrate these priorities on a case-by-case basis, and on a massive global scale so long as capitalism prevails.

    “We’re woke,” said Lyft CEO John Zimmerman at the height of the Uber scandal. It was horseshit — it always is. And until liberals stop believing than any brand can be truly “woke,” or can offer a genuine alternative to the predatory behavior they observe in other “unwoke” brands, they’ll be unable to mount a meaningful resistance to anything.

    Whether we want to ensure clean drinking water for the residents of Flint or to shelter the homeless of San Francisco, we have to draw clear battle lines that are up to the challenge. The fight can’t be good corporations against bad corporations. It has to be working people against capitalism.

    Lyft is the latest brand trying to build market share by posing as a “progressive” corporation. But the fight can’t be good corporations against bad ones — it’s working people against capitalism.

    In early 2017, liberals hit on a new strategy to resist the nascent Trump administration: #DeleteUber.

    It started when New York City’s taxi drivers refused to service JFK airport to protest Trump’s travel ban targeting Muslim-majority countries, and Uber was spotted leveraging the ensuing crisis for profit. Then Uber CEO Travis Kalanick came under fire for accepting an appointment to Trump’s economic advisory council. He announced his resignation from the council, but only weeks later a video leaked of Kalanick reprimanding a driver for his company.

    Amid various ensuing scandals, Kalanick stepped down as CEO of Uber, but by then millions of consumers had turned on the brand in protest, deleting the Uber app from their phone and opting instead for the rideshare giant’s rival Lyft.

    Lyft leaned in, eagerly branding itself as the progressive alternative to Uber by pledging a $1 million donation to the ACLU and trotting out celebrities to promote it as a company committed to “doing things for the right reasons.” Lyft, of course, operates on the same labor model as Uber — its drivers are not employees but independent contractors, and are therefore denied all the benefits and protections that workers receive under more ideal circumstances. Nevertheless, a new refrain rang out across liberaldom: “I don’t use Uber, I use Lyft.”

    What socialists understand that liberals don’t is that brands are corporate enterprises, and corporate enterprises are fundamentally motivated by the pursuit of profit — even in their ostentatious acts of charity and wokeness.

    Three surefire ways to maximize profit are: suppressing labor costs by paying workers as little as you can get away with, lobbying the state for deregulation and lower taxes, and opening new markets by finding new things to commodify and sell. Businesses will always pursue these avenues of profit maximization where they can. It’s not a matter of ethics but of market discipline: if they don’t, they run the risk of losing out to the competition and eventually capsizing.

    Sometimes corporations do things for publicity that make it seem like their interests are not fundamentally misaligned with those of the working-class majority, who rely on decent wages and well-funded public services. But those efforts are meant to sustain public confidence in a given corporation’s brand, which is occasionally necessary for keeping up profits, as Uber’s losses in 2017 demonstrate. When corporate profits come into direct conflict with active measures to improve people’s wellbeing, corporations will always select the former. Case in point: Lyft just donated $100k to the campaign against a ballot measure that would create a tax fund to house the homeless in San Francisco, where the company is based.

    Why did the progressive alternative to Uber do this? Well, because the company doesn’t want to pay higher taxes. Because high taxes imperil profits, and profits are the point. Another likely rationale is to build stronger bonds with pro-business advocacy groups in San Francisco, so that the company will have allies if the city decides to implement regulations against ride-sharing services, which is rumored to be a possibility.

    Lyft has already mastered the art of suppressing labor costs and opening new markets. Next on the wish list, low taxes and deregulation. It’s pretty formulaic when you get down to it.

    San Francisco is home to an estimated 7,500 homeless people. Proposition C would tap the large corporations that benefit from the city’s public infrastructure to double the city’s homelessness budget in an attempt to resolve the crisis. The corporations opposing Proposition C say that the move would imperil jobs. This is not an analysis, it’s a threat. What they’re saying is that if the city reaches too far into their pockets, they’ll take their business elsewhere, draining the region of jobs and revenue as punishment for government overreach. It’s a mobster’s insinuation: Nice economy, shame if something happened to it. Meanwhile thousands of people sleep in the streets, even though the money to shelter them is within the city’s borders.

    Of course, in every struggle over taxes and industry regulation there may be a few canny corporate outliers looking to ingratiate their brand to the public by bucking the trend. In the case of Proposition C, it’s Salesforce, whose CEO Marc Benioff has made a public display of support for the ballot measure. But before you rush to praise Benioff, consider that only two months ago he lauded Trump’s tax cuts for fueling “aggressive spending” and injecting life into the economy.

    You could spend your life as an engaged consumer hopping from brand to brand, as liberals often do, pledging allegiance to this one and protesting that one to the beat of the new cycle drum.
