    THREAD: Who was there first? The short answer is that the question is irrelevant. Claims of ancient title (“This land is ours because we were here several thousand years ago”) have no standing or validity under international law.

    For good reason, because such claims also defy elementary common sense.

    Neither I nor anyone reading this post can convincingly substantiate the geographical location of their direct ancestors ten or five or even two thousand years ago. If we could, the successful completion of the exercise would confer exactly zero property, territorial, or sovereign rights.

    As a thought experiment, let’s go back only a few centuries rather than multiple millennia. Do South Africa’s Afrikaners have the right to claim The Netherlands as their homeland, or even qualify for Dutch citizenship, on the basis of their lineage?

    Do the descendants of African-Americans who were forcibly removed from West Africa have the right to board a flight in Atlanta, Port-au-Prince, or São Paolo and reclaim their ancestral villages from the current inhabitants, who in all probability arrived only after – perhaps long after – the previous inhabitants were abducted and sold into slavery half a world away?

    Do Australians who can trace their roots to convicts who were involuntarily transported Down Under by the British government have a right to return to Britain or Ireland and repossess homes from the present inhabitants even if, with the help of court records, they can identify the exact address inhabited by their forebears? Of course not.

    In sharp contrast to, for example, Native Americans or the Maori of New Zealand, none of the above can demonstrate a living connection with the lands to which they would lay claim.

    To put it crudely, neither nostalgic attachment nor ancestry, in and of themselves, confer rights of any sort, particularly where such rights have not been asserted over the course of hundreds or thousands of years. once again be speaking Arabic.

    If they did, American English would be the predominant language in large parts of Europe, and Spain would once again be speaking Arabic.
    Nevertheless, the claim of ancient title has been and remains central to Zionist assertions of not only Jewish rights in Palestine, but of an exclusive Jewish right to Palestine.

    For the sake of argument, let’s examine it. If we put aside religious mythology, the origin of the ancient Israelites is indeed local.

    In ancient times it was not unusual for those in conflict with authority or marginalized by it to take to the more secure environment of surrounding hills or mountains, conquer existing settlements or establish new ones, and in the ultimate sign of independence adopt distinct religious practices and generate their own rulers. That the Israelites originated as indigenous Canaanite tribes rather than as fully-fledged monotheistic immigrants or conquerors is more or less the scholarly consensus, buttressed by archeological and other evidence. And buttressed by the absence of evidence for the origin stories more familiar to us.

    It is also the scholarly consensus that the Israelites established two kingdoms, Judah and Israel, the former landlocked and covering Jerusalem and regions to the south, the latter (also known as the Northern Kingdom or Samaria) encompassing points north, the Galilee, and parts of contemporary Jordan. Whether these entities were preceded by a United Kingdom that subsequently fractured remains the subject of fierce debate.

    What is certain is that the ancient Israelites were never a significant regional power, let alone the superpower of the modern imagination.

    There is a reason the great empires of the Middle East emerged in Egypt, Mesopotamia, Persia, and Anatolia – or from outside the region altogether – but never in Palestine.

    It simply lacked the population and resource base for power projection. Jerusalem may be the holiest of cities on earth, but for almost the entirety of its existence, including the period in question, it existed as a village, provincial town or small city rather than metropolis.
    Judah and Israel, like the neighboring Canaanite and Philistine entities during this period, were for most of their existence vassal states, their fealty and tribute fought over by rival empires – Egyptians, Assyrians, Babylonians, etc. – rather than extracted from others.

    Indeed, Israel was destroyed during the eighth century BCE by the Assyrians, who for good measured subordinated Judah to their authority, until it was in the sixth century BCE eliminated by the Babylonians, who had earlier overtaken the Assyrians in a regional power struggle.

    The Babylonian Exile was not a wholesale deportation, but rather affected primarily Judah’s elites and their kin. Nor was there a collective return to the homeland when the opportunity arose several decades later after Cyrus the Great defeated Babylon
    and re-established a smaller Judah as a province of the Persian Achaemenid empire. Indeed, Mesopotamia would remain a key center of Jewish religion and culture for centuries afterwards.

    Zionist claims of ancient title conveniently erase the reality that the ancient Israelites were hardly the only inhabitants of ancient Palestine, but rather shared it with Canaanites, Philistines, and others.

    The second part of the claim, that the Jewish population was forcibly expelled by the Romans and has for 2,000 years been consumed with the desire to return, is equally problematic.

    By the time the Romans conquered Jerusalem during the first century BCE, established Jewish communities were already to be found throughout the Mediterranean world and Middle East – to the extent that a number of scholars have concluded that a majority of Jews already lived in the diaspora by the time the first Roman soldier set foot in Jerusalem.

    These communities held a deep attachment to Jerusalem, its Temple, and the lands recounted in the Bible. They identified as diasporic communities, and in many cases may additionally have been able to trace their origins to this or that town or village
    in the extinguished kingdoms of Israel and Judah. But there is no indication those born and bred in the diaspora across multiple generations considered themselves to be living in temporary exile or considered the territory of the former Israelite kingdoms rather than their lands of birth and residence their natural homeland, any more than Irish-Americans today feel they properly belong in Ireland rather than the United States.
    Unlike those taken in captivity to Babylon centuries earlier there was no impediment to their relocation to or from their ancestral lands, although economic factors appear to have played an important role in the growth of the diaspora.

    By contrast, those traveling in the opposite direction appear to have done so, more often than not, for religious reasons, or to be buried in Jerusalem’s sacred soil.

    Nations and nationalism did not exist 2,000 years ago. Nor Zionist propagandists in New York, Paris, and London incessantly proclaiming that for two millennia Jews everywhere have wanted nothing more than to return their homeland, and invariably driving home rather than taking the next flight to Tel Aviv. Nor insufferably loud Americans declaring, without a hint of irony or self-awareness, the right of the Jewish people to Palestine “because they were there first”.

    Back to the Romans, about a century after their arrival a series of Jewish rebellions over the course of several decades, coupled with internecine warfare between various Jewish factions, produced devastating results.

    A large proportion of the Jewish population was killed in battle, massacred, sold into slavery, or exiled. Many towns and villages were ransacked, the Temple in Jerusalem destroyed, and Jews barred from entering the city for all but one day a year.

    Although a significant Jewish presence remained, primarily in the Galilee, the killings, associated deaths from disease and destitution, and expulsions during the Roman-Jewish wars exacted a calamitous toll.

    With the destruction of the Temple Jerusalem became an increasingly spiritual rather than physical center of Jewish life. Jews neither formed a demographic majority in Palestine, nor were the majority of Jews to be found there.

    Many of those who remained would in subsequent centuries convert to Christianity or Islam, succumb to massacres during the Crusades, or join the diaspora. On the eve of Zionist colonization locally-born Jews constituted less than five per cent of the total population.

    As for the burning desire to return to Zion, there is precious little evidence to substantiate it. There is, for example, no evidence that upon their expulsion from Spain during the late fifteenth century, the Sephardic Jewish community,
    many of whom were given refuge by the Ottoman Empire that ruled Palestine, made concerted efforts to head for Jerusalem. Rather, most opted for Istanbul and Greece.
    Similarly, during the massive migration of Jews fleeing persecution and poverty in Eastern Europe during the nineteenth century, the destinations of choice were the United States and United Kingdom.

    Even after the Zionist movement began a concerted campaign to encourage Jewish emigration to Palestine, less than five per cent took up the offer. And while the British are to this day condemned for limiting Jewish immigration to Palestine during the late 1930s, the more pertinent reality is that the vast majority of those fleeing the Nazi menace once again preferred to relocate to the US and UK, but were deprived of these havens because Washington and London firmly slammed their doors shut.

    Tellingly, the Jewish Agency for Israel in 2023 reported that of the world’s 15.7 million Jews, 7.2 million – less than half – reside in Israel and the occupied Palestinian territories.
    According to the Agency, “The Jewish population numbers refer to persons who define themselves as Jews by religion or otherwise and who do not practice another religion”.

    It further notes that if instead of religion one were to apply Israel’s Law of Return, under which any individual with one or more Jewish grandparent is entitled to Israeli citizenship, only 7.2 of 25.5 million eligible individuals (28 per cent) have opted for Zion.

    In other words, “Next Year in Jerusalem” was, and largely remains, an aspirational religious incantation rather than political program. For religious Jews, furthermore, it was to result from divine rather than human intervention.

    For this reason, many equated Zionism with blasphemy, and until quite recently most Orthodox Jews were either non-Zionist or rejected the ideology altogether.

    Returning to the irrelevant issue of ancestry, if there is one population group that can lay a viable claim of direct descent from the ancient Israelites it would be the Samaritans, who have inhabited the area around Mount Gerizim, near the West Bank city of Nablus, without interruption since ancient times.

    Palestinian Jews would be next in line, although unlike the Samaritans they interacted more regularly with both other Jewish communities and their gentile neighbors.

    Claims of Israelite descent made on behalf of Jewish diaspora communities are much more difficult to sustain. Conversions to and from Judaism, intermarriage with gentiles, absorption in multiple foreign societies, and related phenomena over the course of several thousand years make it a virtual certainty that the vast majority of Jews who arrived in Palestine during the late 19th and first half of the 20th century to reclaim their ancient homeland were in fact the first of their lineage to ever set foot in it.

    By way of an admittedly imperfect analogy, most Levantines, Egyptians, Sudanese, and North Africans identify as Arabs, yet the percentage of those who can trace their roots to the tribes of the Arabian Peninsula that conquered their lands during the seventh and eighth centuries is at best rather small.

    Ironically, a contemporary Palestinian, particularly in the West Bank and Galilee, is likely to have more Israelite ancestry than a contemporary diaspora Jew.

    The Palestinians take their name from the Philistines, one of the so-called Sea Peoples who arrived on the southern coast of Canaan from the Aegean islands, probably Crete, during the late second millennium BCE.

    They formed a number of city states, including Gaza, Ashdod, and Ashkelon. Like Judah and Israel they existed primarily as vassals of regional powers, and like them were eventually destroyed by more powerful states as well.

    With no record of their extermination or expulsion, the Philistines are presumed to have been absorbed by the Canaanites and thereafter disappear from the historical record.

    Sitting at the crossroads between Asia, Africa, and Europe, Palestine was over the centuries repeatedly conquered by empires near and far, absorbing a constant flow of human and cultural influences throughout.

    Given its religious significance pilgrims from around the globe also contributed to making the Palestinian people what they are today.

    A common myth is that the Palestinian origin story dates from the Arab-Muslim conquests of the seventh century. In point of fact the Arabs neither exterminated nor expelled the existing population, and the new rulers never formed a majority of the population.

    Rather, and over the course of several centuries, the local population was gradually Arabized, and to a large extent Islamized as well.

    So the question as to who was there first can be answered in several ways: “both” and “irrelevant” are equally correct.
    Indisputably, the Zionist movement had no right to establish a sovereign state in Palestine on the basis of claims of ancient title, which was and remains its primary justification for doing so.

    That it established an exclusivist state that not only rejected any rights for the existing Palestinian population but was from the very outset determined to displace and replace this population was and remains a historical travesty.

    That it as a matter of legislation confers automatic citizenship on millions who have no existing connection with the land but denies it to those who were born there and expelled from it, solely on the basis of their identity, would appear to be the very definition of apartheid.

    The above notwithstanding, and while the Zionist claim of exclusive Israeli sovereignty in Palestine remains illegitimate, there are today several million Israelis who cannot be simply wished away.

    A path to co-existence will need to be found, even as the genocidal nature of the Israeli state, and increasingly of Israeli society as well, makes the endeavor increasingly complicated.

    The question, thrown into sharp relief by Israel’s genocidal onslaught on the Palestinian population of the Gaza Strip, is whether co-existence with Israeli society can be achieved without first dismantling the Israeli state and its ruling institutions. END

      En 1948 et 1990 respectivement les habitants de la Palestine et de la #RDA perdaient le droit à leur propriété ou leur appartement loué si un propriétaire suivant le droit d’un état historique y réclamait ses terres, son château où sa maison.

      En Allemagne en 1990 l’état bourgeois agissait suivant la devise « restitution avant dédommagement » et obligait un nombre important d’institutions sociales et d’individus à quitter leurs locaux et habitations. Les nouveaux anciens propriétaires furent de riches capitalistes, nobles et héritiers dont beaucoup de juifs qui avaient préféré rester aux USA ou en Israël plutôt quede récupérer leurs biens après 1945/1949.

      En ce qui concerne l’Israël l’histoire est encore plus absurde et injuste car après 2000 ans il n’y a plus de cadastre ou hêritier direct pouvant réclamer un bien précis.

      L’état bourgeois allemand a suivi les revendications des associations juives de restituer les biens des familles juives éteintes à des associations juives sans autorité légale. On ne sait d’ailleurs pas bien qui a touché les sommes importantes après la vente des biens immobiliers par ces associations.

    C’estC’est une action inédite. Pour la première fois en Belgique, un #citoyen poursuit une #multinationale devant la justice pour un #contentieux_climatique.

    Mercredi 13 mars, Hugues Falys, éleveur en #agriculture_bio de #vaches allaitantes à Bois-de-Lessines, dans la province du #Hainaut, a assigné TotalEnergies devant le tribunal de l’entreprise de Tournai – l’équivalent du tribunal de commerce en France.

    L’agriculteur, qui est aussi administrateur et porte-parole de la Fédération unie de groupements d’éleveurs et d’agriculteurs (Fugea, syndicat wallon qui défend une agriculture paysanne et la transition agroécologique), estime que la multinationale, en tant qu’industriel parmi les plus émetteurs au monde, porte une responsabilité dans les événements climatiques extrêmes qu’il subit régulièrement sur sa ferme.

    « Je suis installé depuis 1993 et je consacre une grande partie de la surface de mon exploitation au pâturage et à la culture de fourrage pour le bétail, explique à Mediapart Hugues Falys. Mais j’ai été victime en 2016 d’un orage stationnaire avec de la grêle qui a entraîné des pertes de rendement. Puis, au cours des étés 2018, 2020 et 2022, ma ferme a essuyé des vagues de chaleur et des sécheresses. En conséquence, j’ai dû acheter du fourrage, puiser dans mes stocks prévus pour l’hiver et baisser d’un tiers mon cheptel. L’autonomie de ma ferme a été mise en péril. »

    La citation en justice, qu’a pu consulter Mediapart, demande au pétrolier français, « à titre de réparation des conséquences dommageables des fautes constatées », un euro provisionnel pour chacun des aléas subis par l’agriculteur et un euro provisionnel à titre de préjudice moral.

  • Mort d’#Adam et #Raihane : les incohérences de la version policière révélées

    En août 2022 à #Vénissieux, deux jeunes hommes étaient tués par des tirs policiers sur un véhicule signalé volé. Les policiers ont justifié leur usage des armes en invoquant la #légitime_défense : l’un des agents aurait tiré cinq fois alors qu’il se trouvait embarqué sur le capot du véhicule en fuite. Reconstitution 3D à l’appui, la contre-enquête d’INDEX révèle les failles de ce récit.

    Dans la nuit du 18 au 19 août 2022, une intervention de police sur le parking de l’hypermarché Carrefour à Vénissieux fait deux morts. Adam B., âgé de 20 ans, et Raihane S., âgé de 25 ans, sont tués par des tirs de pistolet semi-automatique alors qu’ils se trouvent à bord d’un véhicule Renault Mégane, signalé volé.

    L’enquête a déterminé que les deux individus ont été tués par des balles provenant de la même arme, appartenant au policier Geoffray D., chef de bord d’une patrouille de la Brigade Spécialisée de Terrain affectée à Vénissieux. Au total, onze balles ont atteint le véhicule dans lequel se trouvaient Adam et Raihane.

    Les policiers ont justifié ces tirs en invoquant la légitime défense, devant un cas de « refus d’obtempérer » qui les mettait en grave danger. Selon leur récit, le policier Geoffray D. aurait été percuté par le véhicule en fuite et aurait tiré alors qu’il se trouvait embarqué sur le capot du véhicule, affirmant qu’il n’avait « pas d’autres solutions ». L’expert balistique désigné a conclu que le scénario présenté par les policiers étaient « parfaitement cohérent » avec les constatations matérielles. Le parquet a classé l’affaire sans suite.

    INDEX a mené une contre-enquête, à partir d’une reconstitution numérique en 3D de l’incident. Celle-ci révèle le caractère très peu plausible du récit policier concernant les circonstances de la mort d’Adam B. et de Raihane S., et souligne de nombreuses zones d’ombres à ce jour ignorées par l’enquête officielle.

    Adam B. et Raihane S. sont deux des treize personnes tuées par des tirs policiers sur des véhicules en mouvement au cours de l’année 2022, dans des situations dites de « refus d’obtempérer ».

    Les partisanes de Malky Berkowitz disent qu’elles lancent une "grève du mikvé" - une forme de protestation qui s’appuie sur les rituels juifs de pureté sexuelle comme moyen de pression pour que le mari de Malky lui accorde le divorce.

    JTA – Pour aider l’une d’entre des leurs à obtenir un divorce religieux de son mari après quatre ans d’efforts, des militantes orthodoxes juives se sont engagées à ne plus avoir de relations sexuelles avec leurs maris et ont intensifié leur campagne publique.


    Les partisanes de Malky Berkowitz, 29 ans, ont entamé ce qu’elles appellent une « grève du mikvé « , une forme de protestation qui utilise les rituels juifs de pureté conjugale comme moyen de pression. La grève commence vendredi soir et pourrait se prolonger.

    Selon la loi juive traditionnelle, les femmes mariées doivent s’immerger dans un mikvé , ou bain rituel, après leurs menstruations, avant de pouvoir avoir des relations sexuelles avec leur mari – ce que beaucoup font le soir même. Certaines autorités affirment que la loi juive, ou halakha , attache une importance particulière au rapport conjugal qui suit l’immersion.

    Pour Adina Sash, qui défend les intérêts des femmes juives dont les maris séparés refusent de divorcer selon la loi rituelle, cela fait des rapports sexuels après le mikvé un moyen de protestation tout à fait indiqué.

    Depuis sept semaines, Sash – une militante féministe orthodoxe de Brooklyn connue sous le nom de Flatbush Girl sur Instagram – dirige une équipe d’activistes, d’avocats et de leaders communautaires qui travaillent tous pour aider Berkowitz à obtenir un « guet »  , ou acte de divorce juif. Le mari de Berkowitz, Volvy, refuse de lui donner le guet nécessaire pour finaliser leur divorce, ce qui en fait ce que l’on appelle une «  agouna »  , ou « femme enchaînée », et selon la loi juive, une femme qui ne peut pas se remarier.

    Sash estime que les femmes orthodoxes devraient normaliser les dispositions légales juives relatives au divorce avant de se marier, afin d’éviter de se voir un jour refuser le divorce, ce qui est généralement considéré comme une forme de maltraitance.

    « Je vous invite à nous rejoindre dans cette grève du mikvé et à ne pas avoir de relations sexuelles les nuits de mikvé ou de mitzvah , les vendredis soirs, jusqu’à ce que Malky soit libre, afin de témoigner de votre compassion pour Malky », a-t-elle déclaré en s’adressant à ses consœurs orthodoxes (la tradition juive encourage les couples mariés à avoir des relations sexuelles le shabbat, connu pour cette raison sous le nom de « nuit de mitzvah  » dans le monde orthodoxe).

    Elle a expliqué que l’objectif était d’encourager les hommes de la communauté à défendre la cause de Berkowitz.

    « Lorsque votre mari vous demandera ‘Pourquoi ?’, répondez ‘Jusqu’à ce que Malky soit libéré, la prochaine aguna  pourrait être moi’. Appelez votre rabbin et trouvez un moyen de contribuer à la libération de Malky », a-t-elle ajouté.

    Cet événement fait écho à la grève du sexe de « Lysistrata », la comédie grecque d’Aristophane dans laquelle les femmes d’Athènes s’abstiennent de coucher avec leurs maris afin de mettre fin à la guerre du Péloponnèse.

    Dans les communautés contemporaines, les grèves du sexe ont également été utilisées avec succès pour provoquer des changements, comme la fin de la guerre civile au Libéria en 2003 grâce à la participation des femmes du pays. Leymah Gdowbee, organisatrice de la grève du sexe au Liberia, a reçu le prix Nobel de la paix pour ses efforts.

    Des femmes orthodoxes auraient organisé des manifestations similaires à petite échelle dans le passé, comme au Canada il y a plusieurs décennies. Mais plus récemment, les protestations au nom des agunot ont pris la forme de manifestations publiques, de pressions sur les rabbins et, de plus en plus, de campagnes sur les réseaux sociaux telles que celles menées par Sash.

    À la question de savoir si Malky Berkowitz avait une opinion sur la grève, Sash a répondu : « Malky n’a rien dit ».

    L’ORA, l’Organisation pour la Résolution des agunot , basée à New York, a été créée en 2002 dans le but précis de faciliter les divorces juifs, et l’organisation propose également des accords prénuptiaux halakhiques qui imposent une pénalité en cas de refus tout en respectant la loi juive. Un représentant de l’ORA n’a pas répondu aux demandes de commentaires de la JTA sur la grève du sexe.

    De nombreux followers de Sash ont exprimé leur approbation de son appel à la grève, qu’elle a officiellement annoncé sur les réseaux sociaux jeudi après-midi.

    « Malky en vaut la peine », a commenté l’une d’entre elles. « Chaque aguna  avant elle en vaut la peine. Chaque femme que nous pouvons aider à éviter de devenir une aguna  en vaut la peine. »

    En réponse à un message contraire, une autre femme a indiqué : « Ce n’est pas une question de punir les femmes ». Et d’ajouter : « Une grève du sexe bien menée ferait réfléchir certains hommes de pouvoir ».

    Mais les détracteurs de la grève – y compris ceux qui conviennent que le problème du refus du guet doit être abordé – disent qu’elle pourrait interférer avec le shalom bayit , ou la paix au foyer, une valeur juive souvent citée, et pourrait perturber des relations par ailleurs saines.

    Le rabbin David Bashevkin, créateur du podcast orthodoxe populaire 18Forty, a déclaré lundi sur X : « On ne guérit pas une relation bancale en créant d’autres relations bancales. L’utilisation de l’intimité comme levier de protestation sociale est peu judicieuse et même carrément dangereuse. Ce qu’il faut, c’est d’avantage de familles saines. D’avantage de relations saines. »

    « Il s’agit d’une question communautaire qui nécessite une coordination et une implication communautaires », a-t-il ajouté.

    Certaines féministes orthodoxes qui ont fait pression au nom des agunot se disent pourtant gênées par l’idée de cette grève. Daphne Lazar Price, directrice exécutive de l’Alliance féministe juive orthodoxe, a déclaré à la JTA qu’elle s’élevait souvent contre la « militarisation de la halakha » et qu’elle considérait la grève du mikvé comme un autre exemple de cette militarisation.

    « Le contrôle coercitif fondé sur la religion est moralement répréhensible et ne devrait jamais être toléré », a-t-elle écrit dans un courriel adressé à la JTA. « Les femmes ne devraient pas avoir besoin de menacer leur mari de ne pas avoir de relations sexuelles pour attirer l’attention des hommes – ni pour convaincre les hommes de se conduire comme des alliés des femmes et du système halakhique qu’ils prétendent tant chérir. L’utilisation du sexe comme forme de coercition est également très problématique ».

    Elle suggère par ailleurs que la grève pourrait créer une opportunité pour les autorités juridiques juives de se souvenir des autres tactiques dont elles disposent pour faire pression sur les hommes qui refusent de divorcer de leur femme – et notamment celle « d’interdire aux maris récalcitrants l’accès à toutes les institutions et entreprises religieuses et communautaires juives, ainsi qu’aux domiciles privés, jusqu’à ce qu’il donne un guet« .

    Sash a attribué les réactions négatives à la grève à un double standard « misogyne » entre le refus d’une demande de divorce et le refus d’une relation sexuelle.

    « S’ils refusent de donner le guet, alors nous refuserons d’avoir des relations sexuelles », a déclaré Sash.

    « Ils nous disent : ‘Comment pouvez-vous refuser le sexe ? Vous transformez votre corps en instrument de guerre ! Comment pouvez-vous refuser le sexe ? Vous transformez l’intimité en instrument de guerre’. Mais la véritable question est ‘comment pouvez-vous refuser le divorce ?’ Vous transformez la procédure de divorce en instrument de guerre. Vous maintenez une femme dans l’incertitude ».

    Malky et Volvy Berkowitz se sont mariés en 2016. Lors de leur mariage, Malky portait un dek tichel , ou voile de mariée opaque, qu’elle a décrit dans un texte partagé avec la JTA comme un « bandeau ».

    « A part les moments où Volvy m’a donné une bague kdishen [sic] et m’a mise enceinte deux fois, nous n’avons jamais eu aucune connexion », a-t-elle écrit. « Au revoir Volvy, je ne t’ai jamais connu et je ne te connaîtrai jamais. »

    DécryptageDepuis plusieurs années, des internautes se plaignent de la qualité des réponses apportées par le moteur de recherche le plus utilisé du monde. Si la société se défend d’une dégradation de ses services, elle fait néanmoins face à de nombreuses tentatives de manipulation de ses résultats, accélérées par l’arrivée de l’intelligence artificielle.

    Ce n’est pas tous les jours que Google fait une telle annonce. Le géant du Web a présenté, mardi 5 mars, plusieurs modifications faites à son algorithme qui organise les résultats de son moteur de recherche. L’objectif : « Nous aider à réduire la quantité de contenus qui ne sont d’aucune aide et qui sont de mauvaise qualité, et à augmenter le nombre de résultats utiles », explique au Monde Elizabeth Tucker, directrice produit du moteur de recherche.

    Sans les mentionner, la firme de Mountain View semble tenter d’apporter des réponses aux critiques, qui, depuis des mois, voire des années, se demandent pourquoi les résultats proposés sont de moins en moins bons. A l’image de ce journaliste de NBC qui se demandait, le 24 février, si « quelqu’un en a eu enfin assez et a abandonné Google ».

  • #Ikea, le seigneur des forêts

    Derrière son image familiale et écolo, le géant du meuble suédois, plus gros consommateur de bois au monde, révèle des pratiques bien peu scrupuleuses. Une investigation édifiante sur cette firme à l’appétit démesuré.

    C’est une des enseignes préférées des consommateurs, qui équipe depuis des générations cuisines, salons et chambres d’enfants du monde entier. Depuis sa création en 1943 par le visionnaire mais controversé Ingvar Kamprad, et au fil des innovations – meubles en kit, vente par correspondance, magasins en self-service… –, la petite entreprise a connu une croissance fulgurante, et a accompagné l’entrée de la Suède dans l’ère de la consommation de masse. Aujourd’hui, ce fleuron commercial, qui participe pleinement au rayonnement du pays à l’international, est devenu un mastodonte en expansion continue. Les chiffres donnent le tournis : 422 magasins dans cinquante pays ; près d’un milliard de clients ; 2 000 nouveaux articles au catalogue par an… et un exemplaire de son produit phare, la bibliothèque Billy, vendu toutes les cinq secondes. Mais le modèle Ikea a un coût. Pour poursuivre son développement exponentiel et vendre toujours plus de meubles à bas prix, le géant suédois dévore chaque année 20 millions de mètres cubes de bois, soit 1 % des réserves mondiales de ce matériau… Et si la firme vante un approvisionnement responsable et une gestion durable des forêts, la réalité derrière le discours se révèle autrement plus trouble.

    Greenwashing
    Pendant plus d’un an, les journalistes d’investigation Xavier Deleu (Épidémies, l’empreinte de l’homme) et Marianne Kerfriden ont remonté la chaîne de production d’Ikea aux quatre coins du globe. Des dernières forêts boréales suédoises aux plantations brésiliennes en passant par la campagne néo-zélandaise et les grands espaces de Pologne ou de Roumanie, le documentaire dévoile les liens entre la multinationale de l’ameublement et l’exploitation intensive et incontrôlée du bois. Il révèle comment la marque au logo jaune et bleu, souvent via des fournisseurs ou sous-traitants peu scrupuleux, contribue à la destruction de la biodiversité à travers la planète et alimente le trafic de bois. Comme en Roumanie, où Ikea possède 50 000 hectares de forêts, et où des activistes se mobilisent au péril de leur vie contre une mafia du bois endémique. Derrière la réussite de l’une des firmes les plus populaires au monde, cette enquête inédite éclaire l’incroyable expansion d’un prédateur discret devenu un champion du greenwashing.

      This site has been developed by a group of people, FSC supporters and members among them, who are very concerned about the constant and serious erosion of the FSC’s reliability and thus credibility. The group includes Simon Counsell, one of the Founder Members of the FSC; Hermann Edelmann, working for a long term FSC member organisation; and Chris Lang, who has looked critically at several FSC certifications in Thailand, Laos, Brazil, USA, New Zealand, South Africa and Uganda – finding serious problems in each case.

      As with many other activists working on forests worldwide, we share the frustration that whilst the structural problems within the FSC system have been known for many years, the formal mechanisms of governance and control, including the elected Board, the General Assembly, and the Complaints Procedures have been highly ineffective in addressing these problems. The possibility of reforming – and thus ‘saving’ – the FSC through these mechanisms is, we feel, declining, as power within the FSC is increasingly captured by vested commercial interest.

      We feel that unless drastic action is taken, the FSC is doomed to failure. Part of the problem, in our analysis, is that too few FSC members are aware of the many profound problems within the organisation. The FSC Secretariat continues to pour out ‘good news stories’ about its ‘successes’, without acknowledging, for example, the numerous complaints against certificates and certifiers, the cancellation of certificates that should never have been awarded in the first place, the calls for FSC to cease certifying where there is no local agreement to do so, the walk-outs of FSC members from national processes because of their disillusionment with the role of the economic chamber, etc. etc. etc.

      There has been no honest evaluation of what is working and what is not what working in the FSC, and no open forum for discussing these issues. This website is an attempt to redress this imbalance. The site will also help people who are normally excluded from the FSC’s processes to express their views and concerns about the FSC’s activities.

      One of the reasons I am involved in this website is that I believe that many people are aware of serious problems with FSC, but don’t discuss them publicly because the alternative to FSC is even worse. The alternative, in this case is PEFC (Programme for the Endorsement of Forest Certification schemes) and all the other certification schemes (Cerflor, Certflor, the Australian Forestry Standard, the Malaysian Timber Certification Council and so on). One person has suggested that we should set up PEFC-Watch, in order “to be even-handed”.

      The trouble with this argument is that PEFC et al have no credibility. No NGOs, people’s organisations or indigenous peoples’ organisations were involved in setting them up. Why bother spending our time monitoring something that amounts to little more than a rubber stamp? I can just see the headlines: “Rubber stamp PEFC scheme rubber stamps another controversial logging operation!” Shock, horror. The Emperor is stark bollock naked, and it’s not just some little boy pointing this out – it’s plain for all to see, isn’t it?

      One way of countering all these other schemes would be to point out that FSC is better. But, if there are serious problems with FSC – which there are, and if we can see them, so can anyone else who cares to look – then the argument starts to look very shaky.

      FSC standards aren’t bad (apart from Principle 10, which really isn’t much use to anyone except the pulp and paper industry). They say lots of things we’d probably want forest management standards to say. The trouble is that the standards are not being applied in practice. Sure, campaign against PEFC, but if FSC becomes a Holy Cow which is immune to criticism (not least because all the criticism takes place behind closed doors), then we can hardly present it as an alternative, can we?…”

      By the way, anyone who thinks that PEFC and FSC are in opposition should read this interview with Heiko Liedeker (FSC’s Executive Director) and Ben Gunneberg (PEFC’s General Secretary). In particular this bit (I thought at first it must be a mix up between FSC and PEFC, or Liedeker and Gunneberg):

      Question: As a follow-up question, Heiko Liedeker, from your perspective, is there room ultimately for programs like the Australian Forestry Standard, Certfor and others to operate under the FSC umbrella?

      Heiko Liedeker: Absolutely. FSC was a scheme that was set-up to provide mutual recognition between national standard-setting initiatives. Every national initiative sets its standard. Some of them are called FSC working groups, some of them are called something else. In the UK they are called UKWAS. We’ve been in dialogue with Edwardo Morales at Certfor Chile. They are some of the FSC requirements listed for endorsement, we certainly entered into discussion. We’ve been in discussion with the Australian Forestry Standard and other standard-setting initiatives. What FSC does not do is, it has one global scheme for recognizing certification. So we do not, and that’s one of the many differences between FSC and PEFC, we do not require the development of a certification program as such. A standard-setting program is sufficient to participate in the network.

Avec près de 240 manifestants blessés, c’est l’une des plus sanglantes répressions de civils organisée en France depuis le 17 octobre 1961 (Voir en fin d’article le documentaire de Clarisse Feletin et Maïlys Khider).

      Il y a eu une commission d’enquête parlementaire aussi, je crois, qui a mollement auditionné Gérald ; pas de rapport ?

  • À Strasbourg, l’Europe intensifie discrètement le fichage des migrants

    Dans un bâtiment discret, 350 personnes travaillent à renforcer le #contrôle et le #suivi des personnes entrant dans l’#espace_Schengen. Reportage dans l’agence de l’Union européenne qui renforce le fichage des migrants.

    Dans le quartier du Neuhof à Strasbourg, un bâtiment hautement sécurisé attire l’œil. Dissimulée derrière le gymnase du Stockfeld et entourée de terrains vagues, l’#agence_européenne #eu-Lisa est protégée par deux lignes barbelées surplombées de caméras. Aux alentours du bâtiment, les agents de sécurité portent au cœur un petit drapeau bleu aux douze étoiles. Des véhicules immatriculés en France, au Luxembourg, en Belgique et en Allemagne stationnent sur le parking.

    Créée en 2011 et opérationnelle depuis 2012, l’#agence_européenne_pour_la_gestion_opérationnelle_des_systèmes_d’information à grande échelle eu-Lisa développe et fait fonctionner les #bases_de_données de l’Union européenne (UE). Ces dernières permettent d’archiver les #empreintes_digitales des demandeurs et demandeuses d’asile mais aussi les demandes de visa ou les alertes de personnes portées disparues.

    Le siège d’eu-Lisa est à Tallinn, en Estonie. Un bureau de liaison se trouve à Bruxelles et son centre opérationnel a été construit à Strasbourg. Lundi 26 février, le ministre délégué aux affaires européennes, Jean-Noël Barrot, est venu visiter l’endroit, où sont développés les nouveaux systèmes de suivi et de #filtrage des personnes migrantes et des voyageurs et voyageuses non européen·nes. Le « cœur de Schengen », selon la communication de l’agence.

    Sur les écrans de contrôle, des ingénieur·es suivent les requêtes adressées par les États membres aux différents #systèmes_d’information_opérationnels. L’un d’eux raconte que le nombre de cyberattaques subies par l’agence est colossal : 500 000 tentatives par mois environ. La quantité de données gérées est aussi impressionnante : en 2022, le système #VIS (#Visa_Information_System) a enregistré 57 millions de demandes de #visas et 52 millions d’empreintes digitales. La même année, 86,5 millions d’alertes ont été transmises au système #SIS (#Schengen_Information_System).

    Dans l’agence du Neuhof, une vingtaine de nationalités sont représentées parmi les 350 travailleurs et travailleuses. En tout, 500 mètres carrés sécurisés abritent les données confidentielles de dizaines de millions de personnes. 2 500 ordinateurs fonctionnent en permanence pour une capacité de stockage de 13 petabytes, soit 13 milliards de gigabytes. Vingt-quatre heures sur vingt-quatre et sept jours sur sept, l’eu-Lisa répond aux demandes de données des pays membres de l’espace Schengen ou de l’Union européenne.

    Traduire la politique en #technologie

    Au-delà de la salle de réunion, impossible de photographier les murs ou l’environnement de travail. L’enclave européenne est sous haute surveillance : pour entrer, les empreintes digitales sont relevées après un passage des sacs au scanner. Un badge connecté aux empreintes permet de passer un premier sas d’entrée. Au-delà, les responsables de la sécurité suivent les visiteurs de très près, au milieu d’un environnement violet et vert parsemé de plantes de toutes formes.

    Moins de six mois avant le début des Jeux olympiques et paralympiques de Paris et deux mois après l’accord européen relatif au Pacte sur la migration et l’asile, l’agence aux 260 millions d’euros de budget en 2024 travaille à mettre en place le système de contrôle des flux de personnes le plus précis, efficace et complet de l’histoire de l’espace Schengen. Le pacte prévoit, par exemple, que la demande d’asile soit uniformisée à travers l’UE et que les « migrants illégaux » soient reconduits plus vite et plus efficacement aux frontières.

    Pour accueillir le ministre, #Agnès_Diallo, directrice de l’eu-Lisa depuis 2023, diffuse une petite vidéo en anglais dans une salle de réunion immaculée. L’ancienne cadre de l’entreprise de services numériques #Atos présente une « agence discrète » au service de la justice et des affaires intérieures européennes. À l’eu-Lisa, pas de considération politique. « Notre agence a été créée par des règlements européens et nous agissons dans ce cadre, résume-t-elle. Nous remplaçons les frontières physiques par des #frontières_numériques. Nous travaillons à laisser passer dans l’espace Schengen les migrants et voyageurs qui sont légitimes et à filtrer ceux qui le sont moins. »

    L’eu-Lisa invente, améliore et fait fonctionner les sept outils informatiques utilisés en réseau par les États membres et leurs institutions. L’agence s’assure notamment que les données sont protégées. Elle forme aussi les personnes qui utiliseront les interfaces, comme les agents de #Frontex, d’#Europol ou de la #police_aux_frontières. Au Neuhof, les personnes qui travaillent n’utilisent pas les informations qu’elles stockent.

    Fichés dès l’âge de 6 ans

    L’agence eu-Lisa héberge les empreintes digitales de 7,5 millions de demandeurs et demandeuses d’asile et « migrants illégaux » dans le système appelé Eurodac. Pour le moment, les données récoltées ne sont pas liées à l’identité de la personne ni à sa photo. Mais avec l’adoption des nouvelles règles relatives au statut de réfugié·e en Europe, Eurodac est en train d’être complètement refondé pour être opérationnel en 2026.

    La réforme décidée en décembre 2023 prévoit que les demandeurs d’asile et « migrants illégaux » devront fournir d’autres informations biométriques : en plus de leurs empreintes, leur photo, leur nom, prénom et date et lieu de naissance seront enregistrés lors de leur entrée dans Schengen. La procédure vaudra pour toute personne dès l’âge de 6 ans (contre 14 avant la réforme). Les #données qui étaient conservées pour dix-huit mois pourront l’être jusqu’à cinq ans.

    La quantité d’informations stockées va donc croître exponentiellement dès 2026. « Nous aurons énormément de données pour #tracer les mouvements des migrants irréguliers et des demandeurs d’asile », se félicite #Lorenzo_Rinaldi, l’un des cadres de l’agence venant tout droit de Tallinn. Eurodac permettra à n’importe quelle autorité policière habilitée de savoir très précisément par quel pays est arrivée une personne, ainsi que son statut administratif.

    Il sera donc impossible de demander une protection internationale dans un pays, puis de s’installer dans un autre, ou de demander une seconde fois l’asile dans un pays européen. Lorenzo Rinaldi explique : « Aujourd’hui, il nous manque la grande image des mouvements de personnes entre les États membres. On pourra identifier les tendances, recouper les données et simplifier l’#identification des personnes. »

    Pour identifier les itinéraires et contrôler les mouvements de personnes dans l’espace Schengen, l’agence travaille aussi à ce que les sept systèmes d’information fonctionnent ensemble. « Nous avions des bases de données, nous aurons désormais un système complet de gestion de ces informations », se réjouit Agnès Diallo.

    L’eu-Lisa crée donc également un système de #traçage des entrées et des sorties de l’espace Schengen, sobrement appelé #Entry-Exit_System (ou #EES). Développé à l’initiative de la France dès 2017, il remplace par une #trace_numérique le tamponnage physique des passeports par les gardes-frontières. Il permet notamment de détecter les personnes qui restent dans Schengen, après que leur visa a expiré – les #overstayers, celles qui restent trop longtemps.

    Frontières et Jeux olympiques

    « Toutes nos équipes sont mobilisées pour faire fonctionner le système EES [entrées-sorties de l’espace Schengen – ndlr] d’ici à la fin de l’année 2024 », précise Agnès Diallo. Devant le Sénat en 2023, la directrice exécutive avait assuré que l’EES ne serait pas mis en place pendant les Jeux olympiques et paralympiques si son influence était négative sur l’événement, par exemple s’il ralentissait trop le travail aux frontières.

    En France et dans onze autres pays, le système EES est testé depuis janvier 2024. L’agence estime qu’il sera prêt pour juillet 2024, comme l’affirme Lorenzo Rinaldi, chef de l’unité chargé du soutien à la direction et aux relations avec les partenaires de l’eu-Lisa : « Lorsqu’une personne non européenne arrive dans Schengen, elle devra donner à deux reprises ses #données_biométriques. Donc ça sera plus long la première fois qu’elle viendra sur le territoire, mais ses données seront conservées trois ans. Les fois suivantes, lorsque ses données seront déjà connues, le passage sera rapide. »

    Ce système est prévu pour fonctionner de concert avec un autre petit nouveau, appelé #Etias, qui devrait être opérationnel d’ici au premier semestre de 2025. Les personnes qui n’ont pas d’obligation d’avoir de visa pour entrer dans 30 pays européens devront faire une demande avant de venir pour un court séjour – comme lorsqu’un·e citoyen·ne français·e demande une autorisation électronique de voyage pour entrer aux États-Unis ou au Canada. La procédure, en ligne, sera facturée 7 euros aux voyageurs et voyageuses, et l’autorisation sera valable trois ans.

    L’eu-Lisa gère enfin le #système_d’information_Schengen (le #SIS, qui gère les alertes sur les personnes et objets recherchés ou disparus), le système d’information sur les visas (#VIS), la base de données des #casiers_judiciaires (#Ecris-TCN) et le #Codex pour la #coopération_judiciaire entre États membres.

    L’agence travaille notamment à mettre en place une communication par Internet entre ces différents systèmes. Pour Agnès Diallo, cette nouveauté permettra une coordination sans précédent des agents aux frontières et des institutions judiciaires nationales et européennes dans les 27 pays de l’espace Schengen.

    « On pourra suivre les migrants, réguliers et irréguliers », se félicite Fabienne Keller, députée européenne Renew et fervente défenseuse du Pacte sur les migrations. Pour la mise en place de tous ces outils, l’agence eu-Lisa devra former les États membres mais également les transporteurs et les voyageurs et voyageuses. L’ensemble de ces systèmes devrait être opérationnel d’ici à la fin 2026.

  • The (many) costs of border control

    I have recently finished writing up a four-year study of the UK immigration detainee escorting system. This fully outsourced form of border control has not been the subject of academic inquiry before. While there is a growing body of work on deportation, few people have studied the process and its organisation in person, while sites of short-term detention have similarly been overlooked.

    The escorting contract is run as two separate businesses: ‘in-country’, known (confusingly for those more familiar with the US) as ICE, and Overseas, also referenced as OSE. ICE includes 31 sites of short-term immigration detention, many of which are in ports and airports including four in Northern France around Calais and Dunkirk, and a fleet of secure vans and vehicle bases. Overseas officers enforce removals and deportations. While staff may be cross deployed for ‘operational needs’, and some people do move from one part to another over the course of their careers, ICE and OSE are managed separately and staff in each tend to view themselves as distinct from colleagues working for the other.

    The study took many years to arrange and then was severely disrupted by the COVID-19 pandemic. It was one of the most taxing pieces of research I have ever done, and I am still recovering from it. A book about the project is currently in press and should be out later this year, with Princeton University Press. Here I explore some of the ‘costs’ of this system; in financial terms, in its impact on those employed within it, and on their communities. All these matters occur in the context of the impact of the system of those subject to it, as they are denied entry and forced to leave. As a researcher, I was also adversely affected by studying this system, but I shall leave reflections on that to a different piece.

    The current ten-year contract was awarded to Mitie, Care & Custody, in December 2017 at an estimated cost to the public of £525 million. Previous incumbents included Tascor, (part of the Capita group) and G4S. Like those competitors, Mitie holds many other contracts for a variety of public and private organisations. In their 2023 annual report, ‘Business Services’ (29%, £1172m) and ‘Technical’ Services (29% £1154m) provided the lion’s share of the company’s income, followed by ‘Central Government and Defence’ (20%, £828m). Profits generated by ‘Care & Custody’, which includes those generated by three immigration removal centres (Harmondsworth, Colnbrook and Derwentside) that are run under a different set of legal and financial arrangements, were not listed separately. Instead, they formed part of a general category of ‘Specialist Services’ made up of three other businesses areas: ‘Landscapes’, ‘Waste Management’ and, rather incongruously, ‘Spain’. Together, these four sets of contracts constituted just 10% of the company’s revenue (£411m) that year.

    The precise agreement that the Home Office signed for the services Mitie provides is hidden, like all contracts, under the veil of corporate confidentiality. But some information is available. The escorting contract, for instance, is subject to what is known as a ‘cap and collar’. This financial arrangement, which is designed to reduce exposure to financial risk for both parties, meant that during the pandemic, when the borders closed and the numbers detained in immigration removal centres dropped, that the company did not lose money. Despite detaining or deporting very few people, the collar ensured that staff continued to be paid as normal. Similarly, the cap means that Mitie is restricted in the additional costs they demand from the Home Office. The internal transportation of people under immigration act powers, for example, is paid for by ‘volume’, i.e. by the number of people moved within a daily requirement. Any additional movements that are requested that above that level generates profit for the company, but only within a set parameter.

    The cap and collar does not entirely protect Mitie from losing money. The contract includes a range of ‘service credits’, ie fines, which are applied by the Home office for cancellations, delays, injuries, and, escapes. The Home Office is also subject to small fines if they cancel a request without sufficient time for Mitie to redeploy the staff who had been assigned to the work.

    While a missed collection time (eg a person detained at a police station, who must be taken to an immigration removal centre) may incur Mitie a fine of £100, a delayed deportation would result in a fine ten times that sum, and a death ten times more again. These economic penalties form the basis of regular discussions between Mitie and the Home Office, as each side seeks to evade financial responsibility. They also shape the decisions of administrative staff who distribute detained people and the staff moving them, around the country and across the world. It is better to risk a £100 fine than a £1000 one.

    For staff, border control can also be considered in financial terms. This is not a particularly high paying job, even though salaries increased over the research period: they now hover around £30,000 for those employed to force people out of the country, and somewhat less for those who work in Short-term holding facilities. There is also, as with much UK employment, a north-south divide. A recent job ad for a post at Swinderby Residential Short-Term Holding Facility listed a salary of £26,520.54 for 42 hours a week; for two hours less work per week, a person could go to work in the nearby Vehicle base at Swinderby and earn £25,257.65. Down in Gatwick, the same kind of job in a vehicle base was advertised at £28,564.63. Both sums are well below the mean or median average salary for UK workers, which stand at £33,402 and £33,000 respectively. As a comparison, the salary for starting level prison officers, on band 3, is £32, 851, for fewer weekly hours.

    Under these conditions, it is not surprising to find that staff everywhere complained about their pay. Many struggled to make ends meet. As might be expected, there was a generational divide; unlike their older colleagues who were able to obtain a mortgage on their salary, younger people were often stuck either in the rental market or at home with their parents. Few felt they had many alternatives, not least because many of the sites of short-term holding facilities are in economically depressed areas of the UK, where good jobs are hard to come by. In any case, staff often had limited educational qualifications, with most having left school at 16.

    Border control has other kinds of costs. For those who are detained and deported, as well as their families and friends, these are likely to be highest of all, although they do not directly feature in my study since I did not speak to detained people. I could not see how interviewing people while they were being deported or detained at the border would be ethical. Yet the ethical and moral costs were plain to see. In the staff survey, for example, 12.35% of respondents reported suicidal thoughts in the past week, and 7.4% reported thoughts of self-harm over the same period. Both figures are considerably higher than the estimates for matters in the wider community.

    Finally, and this part is the springboard for my next project, there are clearly costs to the local community. When I first started visiting the short-term holding facility at Manston, near Dover, when the tents had only just gone up and the overcrowding had not yet begun, I was shocked at the size of it. A former RA base, it includes many buildings in various states of disrepair, which could have been redeveloped in any number of ways that did not include depriving people of their liberty. Perhaps it could have included affordable homes for those trapped in the rental market, as well as non-custodial accommodation for new arrivals, new schools, a hospital, perhaps some light industry or tech to employ people nearby. What would it take to work for a vision of the future which, in principle, would have room for us all?

  • Border security with drones and databases

    The EU’s borders are increasingly militarised, with hundreds of millions of euros paid to state agencies and military, security and IT companies for surveillance, patrols and apprehension and detention. This process has massive human cost, and politicians are planning to intensify it.

    Europe is ringed by steel fences topped by barbed wire; patrolled by border agents equipped with thermal vision systems, heartbeat detectors, guns and batons; and watched from the skies by drones, helicopters and planes. Anyone who enters is supposed to have their fingerprints and photograph taken for inclusion in an enormous biometric database. Constant additions to this technological arsenal are under development, backed by generous amounts of public funding. Three decades after the fall of the Berlin Wall, there are more walls than ever at Europe’s borders,[1] and those borders stretch ever further in and out of its territory. This situation is the result of long-term political and corporate efforts to toughen up border surveillance and controls.

    The implications for those travelling to the EU depend on whether they belong to the majority entering in a “regular” manner, with the necessary paperwork and permissions, or are unable to obtain that paperwork, and cross borders irregularly. Those with permission must hand over increasing amounts of personal data. The increasing automation of borders is reliant on the collection of sensitive personal data and the use of algorithms, machine learning and other forms of so-called artificial intelligence to determine whether or not an individual poses a threat.

    Those without permission to enter the EU – a category that includes almost any refugee, with the notable exception of those who hold a Ukrainian passport – are faced with technology, personnel and policies designed to make journeys increasingly difficult, and thus increasingly dangerous. The reliance on smugglers is a result of the insistence on keeping people in need out at any cost – and the cost is substantial. Thousands of people die at Europe’s borders every year, families are separated, and people suffer serious physical and psychological harm as a result of those journeys and subsequent administrative detention and social marginalisation. Yet parties of all political stripes remain committed to the same harmful and dangerous policies – many of which are being worsened through the new Pact on Migration and Asylum.[2]

    The EU’s border agency, Frontex, based in Warsaw, was first set up in 2004 with the aim of providing technical coordination between EU member states’ border guards. Its remit has been gradually expanded. Following the “migration crisis” of 2015 and 2016, extensive new powers were granted to the agency. As the Max Planck Institute has noted, the 2016 law shifted the agency from a playing “support role” to acting as “a player in its own right that fulfils a regulatory, supervisory, and operational role.”[3] New tasks granted to the agency included coordinating deportations of rejected refugees and migrants, data analysis and exchange, border surveillance, and technology research and development. A further legal upgrade in 2019 introduced even more extensive powers, in particular in relation to deportations, and cooperation with and operations in third countries.

    The uniforms, guns and batons wielded by Frontex’s border guards are self-evidently militaristic in nature, as are other aspects of its work: surveillance drones have been acquired from Israeli military companies, and the agency deploys “mobile radars and thermal cameras mounted on vehicles, as well as heartbeat detectors and CO2 monitors used to detect signs of people concealed inside vehicles.”[4] One investigation described the companies that have held lobbying meetings or attended events with Frontex as “a Who’s Who of the weapons industry,” with guests including Airbus, BAE Systems, Leonardo and Thales.[5] The information acquired from the agency’s surveillance and field operations is combined with data provided by EU and third country agencies, and fed into the European Border Surveillance System, EUROSUR. This offers a God’s-eye overview of the situation at Europe’s borders and beyond – the system also claims to provide “pre-frontier situational awareness.”

    The EU and its member states also fund research and development on these technologies. From 2014 to 2022, 49 research projects were provided with a total of almost €275 million to investigate new border technologies, including swarms of autonomous drones for border surveillance, and systems that aim to use artificial intelligence to integrate and analyse data from drones, satellites, cameras, sensors and elsewhere for “analysis of potential threats” and “detection of illegal activities.”[6] Amongst the top recipients of funding have been large research institutes – for example, Germany’s Fraunhofer Institute – but companies such as Leonardo, Smiths Detection, Engineering – Ingegneria Informatica and Veridos have also been significant beneficiaries.[7]

    This is only a tiny fraction of the funds available for strengthening the EU’s border regime. A 2022 study found that between 2015 and 2020, €7.7 billion had been spent on the EU’s borders and “the biggest parts of this budget come from European funding” – that is, the EU’s own budget. The total value of the budgets that provide funds for asylum, migration and border control between 2021-27 comes to over €113 billion[8]. Proposals for the next round of budgets from 2028 until 2035 are likely to be even larger.

    Cooperation between the EU, its member states and third countries on migration control comes in a variety of forms: diplomacy, short and long-term projects, formal agreements and operational deployments. Whatever form it takes, it is frequently extremely harmful. For example, to try to reduce the number of people arriving across the Mediterranean, member states have withdrawn national sea rescue assets (as deployed, for example, in Italy’s Mare Nostrum operation) whilst increasing aerial surveillance, such as that provided by the Israel-produced drones operated by Frontex. This makes it possible to observe refugees attempting to cross the Mediterranean, whilst outsourcing their interception to authorities from countries such as Libya, Tunisia and Egypt.

    This is part of an ongoing plan “to strengthen coordination of search and rescue capacities and border surveillance at sea and land borders” of those countries. [9] Cooperation with Tunisia includes refitting search and rescue vessels and providing vehicles and equipment to the Tunisian coastguard and navy, along with substantial amounts of funding. The agreement with Egypt appears to be structured along similar lines, and five vessels have been provided to the so-called Libyan Coast Guard in 2023.[10]

    Frontex also plays a key role in the EU’s externalised border controls. The 2016 reform allowed Frontex deployments at countries bordering the EU, and the 2019 reform allowed deployments anywhere in the world, subject to agreement with the state in question. There are now EU border guards stationed in Albania, Montenegro, Serbia, Bosnia and Herzegovina, and North Macedonia.[11] The agency is seeking agreements with Niger, Senegal and Morocco, and has recently received visits from Tunisian and Egyptian officials with a view to stepping up cooperation.[12]

    In a recent report for the organisation EuroMed Rights, Antonella Napolitano highlighted “a new element” in the EU’s externalisation strategy: “the use of EU funds – including development aid – to outsource surveillance technologies that are used to entrench political control both on people on the move and local population.” Five means of doing so have been identified: provision of equipment; training; financing operations and procurement; facilitating exports by industry; and promoting legislation that enables surveillance.[13]

    The report highlights Frontex’s extended role which, even without agreements allowing deployments on foreign territory, has seen the agency support the creation of “risk analysis cells” in a number of African states, used to gather and analyse data on migration movements. The EU has also funded intelligence training in Algeria, digital evidence capacity building in Egypt, border control initiatives in Libya, and the provision of surveillance technology to Morocco. The European Ombudsman has found that insufficient attention has been given to the potential human rights impacts of this kind of cooperation.[14]

    While the EU and its member states may provide the funds for the acquisition of new technologies, or the construction of new border control systems, information on the companies that receive the contracts is not necessarily publicly available. Funds awarded to third countries will be spent in accordance with those countries’ procurement rules, which may not be as transparent as those in the EU. Indeed, the acquisition of information on the externalisation in third countries is far from simple, as a Statewatch investigation published in March 2023 found.[15]

    While EU and member state institutions are clearly committed to continuing with plans to strengthen border controls, there is a plethora of organisations, initiatives, campaigns and projects in Europe, Africa and elsewhere that are calling for a different approach. One major opportunity to call for change in the years to come will revolve around proposals for the EU’s new budgets in the 2028-35 period. The European Commission is likely to propose pouring billions more euros into borders – but there are many alternative uses of that money that would be more positive and productive. The challenge will be in creating enough political pressure to make that happen.

    Frontex has shared locations of migrant boats with Libya’s coast guard more than 2,000 times in three years – despite watching them whip, beat and shoot at passengers

    It has long been known that European countries provide support and funding to the Libyan Coast Guard to carry out a controversial mission: intercepting Europe-bound migrants whom EU member states and agencies cannot apprehend directly without breaching international laws.

    Numerous media and NGO reports have detailed the abuse and violence practised by the Libyan Coast Guard against migrants during sea interception and inside the detention centres they are taken to after being brought back to Libya.

    Lighthouse Reports has previously established suspicious patterns of collaboration between EU border agency Frontex and the Libyan Coast Guard, including direct links between Frontex aerial assets spotting boats and their subsequent interception by the coast guard.

    Despite the reports of abuse and torture, Frontex has withheld public criticism of the Libyan Coast Guard. And until now, the extent to which Frontex has shared information with the coast guard, and its internal knowledge of the abuse migrants face after they are intercepted, was unknown.
    METHODS

    Following the publication of Lighthouse investigation Frontex and the Pirate Ship in December, the EU Committee on Civil Liberties, Justice and Home Affairs (LIBE) sent a letter to Frontex Executive Director Hans Leijtens questioning the agency’s collaboration with Libyan actors, including militia, in eastern and western Libya.

    Lighthouse Reports and Der Spiegel gained access to the director’s response to the LIBE Committee’s questions. The email included all Serious Incident Reports (SIRs) relating to the Libyan Coast Guard.
    STORYLINES

    The SIRs reveal three incidents of Frontex aerial surveillance assets witnessing Libyan Coast Guard officers beating people in overcrowded boats at sea. In a separate incident, the agency’s surveillance drone recorded a Libyan officer shooting at a wooden boat to force it to stop.

    The letter from Leitjens meanwhile reveals that Frontex gave away the location of migrant boats to the Libyan Coast Guard approximately 2,200 times, usually via email, in the last three years – despite being aware of the regular instances of violence they commit.

    When confronted with these facts by our team, Frontex said: “The decision to share information about vessels in distress with the Libyan rescue coordination centre, alongside other national centres, is taken with a heavy heart”

    The SIRs contain parts of Frontex’s human rights officer’s recommendations for the agency.     Le premier ministre a mis en scène sa volonté de durcir les règles de l’assurance-chômage, vendredi, lors d’un déplacement dans les Vosges, exprimant sa volonté de transformer « notre modèle social » pour qu’il « incite toujours davantage au #travail ».

    Gabriel Attal a retenu – au moins – une leçon de la brève période au cours de laquelle il fut ministre de l’éducation nationale, juste avant son arrivée à Matignon : la pédagogie est un art de la répétition. Vendredi 1er mars, lors d’un déplacement dans les Vosges, le chef du gouvernement a, une fois de plus, exprimé la volonté de transformer « notre modèle social » pour qu’il « incite toujours davantage au travail ». Son propos a été particulièrement musclé : « Cela nécessitera des décisions difficiles », a-t-il prévenu, sans livrer plus d’indications, mais en faisant clairement référence à la piste, évoquée à plusieurs reprises par l’exécutif depuis la fin de 2023, d’un nouveau durcissement des règles de l’assurance-chômage.

    A travers cette visite, M. Attal entendait montrer combien il est « pour une France du travail ». Il a aussi manifesté toute son attention pour les classes moyennes, « qui gagnent un peu trop pour toucher des aides, mais certainement pas assez pour être à l’aise ». Un message pour les exhorter à ne pas céder, à trois mois des élections européennes, aux « sirènes » des extrêmes : le Rassemblement national n’a pas été nommé, mais M. Attal pensait, de toute évidence, à lui – en premier lieu.
    En un peu moins de quatre heures, il s’est rendu dans trois lieux différents, distants de plusieurs kilomètres : une agence de France Travail, ex-Pôle emploi, un centre de formation de chauffeurs-routiers et une entreprise fabriquant des machines, Numalliance. Une itinérance menée tambour battant en compagnie de deux ministres, Catherine Vautrin (travail, santé et solidarités) et Roland Lescure (industrie et énergie).

    « Nous ne lâcherons rien »

    Le locataire de Matignon en a profité pour confirmer son intention de poursuivre la refonte de notre Etat-providence, avec des formules cinglantes. Le « système », selon lui, a fonctionné, durant des décennies, sur une « hypocrisie », qui consistait à « acheter la paix sociale à coups d’aides sociales ». Cela a entretenu « le chômage de masse », l’enfermement dans « l’inactivité » et le « ressentiment ». Il faut « mettre un terme » à cette situation et changer de « paradigme », a martelé le premier ministre, en soulignant que les décisions prises depuis l’élection d’Emmanuel Macron en 2017 s’inscrivaient déjà dans cette optique, notamment par le biais des réformes successives de l’#assurance-chômage qui ont durci les conditions d’indemnisation.
    Aujourd’hui, M. Attal veut aller encore plus loin, mais sans dire comment. Il s’est borné à annoncer une augmentation – spectaculaire – du nombre de #contrôles sur les demandeurs d’emploi : le but est d’en réaliser 1,5 million à la fin du quinquennat, soit environ trois fois plus qu’en 2023, tout en les ciblant sur les personnes susceptibles d’être embauchées dans les secteurs cherchant de la main-d’œuvre.

    Le chef du gouvernement réaffirme ainsi son attachement au « devoir de travailler », un principe inscrit dans le préambule de la Constitution de 1946, a-t-il rappelé, vendredi après-midi. Ce discours lui vaut d’être accusé de punir les chômeurs. Critique qu’il a réfutée, en faisant valoir qu’il se place dans une double logique d’obligations plus strictes mais aussi de droits améliorés.

    C’est au nom de cet argumentaire que M. Attal a confirmé l’extension, à partir du 1er mars, de la réforme du revenu de solidarité active. Elle prévoit de conditionner le versement de la prestation à la réalisation d’au moins quinze heures d’activité par semaine, moyennant un accompagnement renforcé de l’allocataire. Jusqu’à maintenant, la mesure était expérimentée par dix-huit conseils départementaux. Ils seront désormais quarante-sept, l’objectif étant de parvenir à une « généralisation » en 2025. « Nous ne lâcherons rien, tant que tous ceux qui peuvent revenir vers l’emploi perdureront dans le chômage », a-t-il lancé. Une pression qui, à l’en croire, s’exerce autant sur les individus que sur les pouvoirs publics.

    Son leitmotiv en faveur du « travailler plus » s’est accompagné de promesses pour « travailler mieux ». Dans son esprit, il s’agit d’abord de tirer vers le haut les rémunérations. Le premier ministre a, encore, mis en garde les représentants des branches professionnelles dont les conventions collectives contiennent des grilles salariales avec des coefficients sous le smic : s’ils ne corrigent pas ces anomalies, d’ici à juin, par le jeu de la négociation, « nous sommes prêts à toutes les options », a-t-il prétendu, en mentionnant le recours à la loi et « les sanctions ». Un « séminaire gouvernemental » sera, par ailleurs, organisé, à la mi-mars, pour réfléchir à « la question du travail », notamment à « la semaine en quatre jours ».

  • How an EU-funded security force helped Senegal crush democracy protests

    An elite EU-trained Senegalese police unit was meant to tackle cross-border crime. Instead it was used to quash a popular movement, an Al Jazeera investigation has found.

    The Senegalese government deployed a special counterterrorism unit, created, equipped, and trained with funding from the European Union, to violently suppress recent pro-democracy protests, a joint investigation between Al Jazeera and porCausa Foundation reveals.

    Since 2021, the trial of popular and controversial opposition leader #Ousmane_Sonko has led to demonstrations across the West African nation, in which dozens have been killed. Al Jazeera and porCausa obtained visual evidence, Spanish government contracts, a confidential evaluation report, and testimonies from multiple sources suggesting that the EU-funded #Rapid_Action_Surveillance_and_Intervention_Group, also known as #GAR-SI, was used to violently crush those protests.

    In one video, security personnel in the same type of armoured vehicles the EU bought for #GAR-SI_Senegal are seen firing tear gas at a protest caravan organised by Sonko last May. Al Jazeera verified that the incident happened in the southern Senegalese village of #Mampatim, about 50km (31 miles) from Kolda, in the Casamance region.

    The EU-funded elite units were instead meant to be based in Senegal’s border areas with Mali to fight cross-border crime.

    Elite unit

    #GAR-SI_Sahel was a regional project lasting between 2016 and 2023 and funded with 75 million euros ($81.3m) from the EU’s Emergency Trust Fund for Africa (#EUTF_for_Africa), a pot of development funding dedicated to addressing the root causes of migration in Africa.

    The programme was implemented by the #International_and_Ibero-American_Foundation_for_Administration_and_Public_Policies (#FIIAPP), a development agency belonging to Spain’s Ministry of Foreign Affairs. GAR-SI units were created across the region, in countries like Burkina Faso, Chad, Mali, Mauritania, Niger and Senegal, “as a prerequisite for their sustainable socio-economic development”.

    The Senegalese 300-strong unit, created in 2017, cost more than 7 million euros ($7.6m at the current exchange rate) and was aimed at creating a special intervention unit in the town of #Kidira, on the border of Mali, to protect Senegal from potential incursions by armed groups and cross-border crimes, including migrant smuggling.

    Modelled after Spanish units that fought against the separatist movement Basque Homeland and Liberty, also known by the Spanish initials ETA, GAR-SI Senegal has received technical training and mentoring from the Spanish Civil Guard as well as French, Italian and Portuguese security forces.

    After the completion of the project, at the request of all stakeholders, the EU delegation in Senegal continued with a second phase using another funding mechanism, according to one Spanish and one Senegalese police source familiar with the matter. About 4.5 million euros ($4.9m) was earmarked for a second 250-strong GAR-SI Senegal unit near the town of Saraya, close to the border with Guinea and Mali.

    A second unit was also created in Mali but for other countries, especially Chad, the project was considered to be a “failure”, according to the former Senegalese police official, who said the EU lost money by paying for equipment that was not appropriate for use.
