On peut prendre au pied de la lettre ce que disait Lawrence Lessig - un juriste américain fondateur des #Creative_Commons : « Le code est la loi ». La loi, comme le code, crée la manière dont les gens interagissent les uns avec les autres. L’ancien responsable de la communauté de Flickr disait une chose très juste : « Ce que vous tolérez indique ce que vous êtes vraiment ». Donc si votre code tolère le sexisme, vous êtes une plateforme sexiste. Si votre code tolère les suprématistes blancs, vous êtes une plateforme qui soutient le suprématisme blanc.
Je pense surtout que l’approche très libertarienne qui imprègne la #Silicon_Valley est en train de montrer ses limites. Malgré leurs promesses, toutes ces compagnies ont échoué à s’auto-réguler et c’est un terrible bilan pour l’ensemble de la communauté tech. Les entrepreneurs des nouvelles technologies avaient la liberté nécessaire pour proposer un autre modèle de société, mais il suffit de regarder l’exemple récent de Facebook et sa gestion catastrophique de l’après #Cambridge_Analityca pour se rendre compte que c’est un échec. À cause de ce scandale, les médias sociaux vont subir une nouvelle forme de régulation.

Mark Zuckerberg vient de se lancer dans une grosse campagne de communication en publiant une tribune simultanément dans plusieurs très grands journaux dont Le Monde ou le Wall Street Journal. Elle est intitulée : « Je souhaite clarifier la manière dont Facebook fonctionne. »
Il y rappelle avec raison une première vérité qui est que le métier de #Facebook n’est pas de vendre des données personnelles à des annonceurs mais de permettre à des annonceurs d’accéder à un ciblage très fin d’audience pour l’affichage de leurs publicités. La nuance est de taille et je le dis sans aucune ironie.
Mais pour le reste, comment dire...

Argh ! Désormais en Allemagne la photographie d’une oeuvre d’art constitue une nouvelle oeuvre à part entière même s’il s’agit d’une réproduction exacte de l’oeuvre originale. C’est le contraire d’un cadeau de Noël que nous fait le Bundesgerichtshof (BGH), la plus haute instance de justice d’Allemagne en dessous du tribunal constitutionnel Bundesverfassungsgericht (BVG).
Concrètement cette décision entraîne une charge de travail importante pour chacun qui publie des images. Il faudra toujours vérifier si l’auteur de la copie d’une oeuvre ancienne autorise sa publication. Une grande partie des images d’illustration disparaîtront de la toile, car après la publication de l’image d’une oeuvre ancienne on ne pourra plus être sûr de ne pas être poursuivi en justice et de perdre beaucoup d’argent.

Im Rechtsstreit um Digitalisate gemeinfreier historischer Kunstwerke auf Wikimedia Commons hat der Bundesgerichtshof heute seine lang erwartete Entscheidung verkündet. Museen können demnach den digitalen Zugang zu urheberrechtsfreien Werken beschneiden. Das Urteil ist ein Rückschlag für unsere Rechte am gemeinsamen Kulturerbe.
Das Gericht hat den klagenden Reiss-Engelhorn-Museen (rem) Recht gegeben. Damit ist zumindest für die deutsche Rechtsordnung geklärt, dass auch 1-zu-1-Reproduktionen urheberrechtsfreier Kunstwerke nicht ohne Zustimmung derjenigen gezeigt oder verbreitet werden dürfen, die diese Reproduktionen angefertigt haben. Die reproduzierten Werke mögen als Teil des Kulturerbes also schon lange Allgemeingut geworden sein, ihre Darstellung in Form von Repro-Fotos jedoch unterliegt laut BGH denselben Lichtbildrechten wie sie auch an anderen Fotografien automatisch entstehen.
Wir sind nicht mit dem Argument durchgedrungen, dass unser Kulturerbe in Zeiten digitaler Medien seiner Eigenschaft als Allgemeingut beraubt wird, wenn sich auch bei exakten Reproduktionen gemeinfreier Werke am Ende die Foto-Rechte gegenüber dem gemeinfreien Status des fotografierten Werks durchsetzen.
Der BGH führt zur Begründung aus, dass „der Fotograf Entscheidungen über eine Reihe von gestalterischen Umständen zu treffen [hat], zu denen Standort, Entfernung, Blickwinkel, Belichtung und Ausschnitt der Aufnahme zählen.“ Das sei das „erforderliche Mindestmaß an persönlicher geistiger Leistung“ für den Lichtbildschutz nach § 72 Urheberrechtsgesetz.
Auch reicht laut BGH das Foto-Verbot, das in den Reiss-Engelhorn-Museen gilt, bis ins Netz, das heißt: Wer dagegen verstößt (im aktuellen Fall war umstritten, ob vor Ort das Museums-Personal die Fotos doch erlaubt hatte), darf die Bilder auch nicht im Netz veröffentlichen.
Keine Aussage macht der BGH dazu, ob auch aus dem Eigentum an Werkstücken ein Verbot der Veröffentlichung von Fotos entstehen könnte.
Jetzt ist also der Gesetzgeber gefragt, den allzu pauschalen Paragrafen 72 des Urheberrechtsgesetzes zu reformieren. Denn ob die geistigen Schöpfungen früherer Jahrhunderte auch im Digitalen zu Allgemeingut werden, darf nicht vom guten Willen jedes einzelnen Museums abhängen. Genau das aber ist nach dem Richterspruch des BGH nun der Fall:
Wenn ein Museum die von ihm selbst erstellten Digitalisate mit Verweis auf Lichtbildrechte rechtlich unter Verschluss hält und zusätzlich auch von seinem Hausrecht Gebrauch macht und keine Fotografien durch Besucherinnen und Besucher zulässt, gibt es keinen Weg, unser aller kulturelles Erbe so frei zugänglich zu machen, wie es die Gemeinfreiheit dieser Werke rechtlich eigentlich vorsieht.
Dass dies dem öffentlichen Auftrag der Museen vollständig zuwiderläuft, haben zum Glück viele von ihnen erkannt und stellen Digitalisate von sich aus rechtlich frei. Auch wenn der Trend längst die Öffnung für digitale Möglichkeiten der Wissensvermittlung und die aktive Einbindung des Publikums ist … ob die Allgemeinheit, also wir alle und nächste Generationen wirklich das ganze kulturelle Erbe frei erfahren können oder nicht, darf nicht davon abhängen, ob die Museen ihren Auftrag richtig verstehen oder nicht.

Alfried Wieczorek, Generaldirektor der Reiss-Engelhorn-Museen in Mannheim, die im vorliegenden Fall gegen die freie Verfügbarkeit ihrer Digitalisate geklagt hatten, berief sich bei einer Diskussion 2017 vor allem darauf, “eventuelle zukünftige Einnahmemöglichkeiten” seiner Häuser schützen zu müssen. Das ist kein illegitimes Interesse, aber eine solche Rechnung blendet den gesellschaftlichen Wert des freien Zugangs zum Kulturerbe aus, den Projekte wie Wikimedia Commons ermöglichen, und widerspricht direkt dem öffentlichen Auftrag öffentlich geförderter Museen. Letztlich läuft das finanzielle Argument schlicht auf eine Art Geiselnahme hinaus:
“Liebe Allgemeinheit, weil wir viel Aufwand mit der Bewahrung und Digitalisierung deines kulturellen Erbes haben und Du uns über die öffentliche Förderung nicht genug Geld zur Verfügung stellst, behalten wir uns die Monetarisierung der digitalen Repräsentationen Deines Erbes vor.”
Es ist ein offenes Geheimnis, dass bei denjenigen Museen, die ähnlich restriktiv handeln wie die Reiss-Engelhorn-Museen in Mannheim, noch weitere Sorgen eine Rolle spielen. Sorgen wie die, durch eine Zugänglichkeit der Digitalisate im Netz am Ende als Museum irrelevant und überflüssig zu werden. Zwar gibt es zahlreiche Beispiele, die das genaue Gegenteil belegen, dass die Relevanz durch digitale Freigaben wieder zunimmt und es eher die digital versperrten Häuser sein werden, die einen Bedeutungsverlust erleiden. Doch selbst wenn die “digitalen Sorgen” berechtigt wären: Sich an ihnen zu orientieren hieße, die Institutionen über ihren Auftrag zu stellen. Es hieße, das Kulturerbe nur denjenigen zugänglich zu machen, die dafür Geld, Zeit und Mühe aufwenden können.

Dass die Kultur zu den Menschen muss, statt auf das Kommen der Menschen zur Kultur zu warten, haben eigentlich alle Museen auch verstanden. Viele versuchen, mit hauseigenen Projekten und Netzwerken auch im Netz präsent zu sein. Das ist gut und wo es funktioniert, sollten wir uns freuen. Doch zu glauben, die Museen könnten das digitale Bewussthalten des kulturellen Erbes alleine stemmen, ist vermessen. Das wahre gesellschaftliche Potenzial der Kultur entfaltet sich erst durch den Übergang der Werke ins Allgemeingut, der aus gutem Grund auch gesetzlich spätestens 70 Jahre nach Tod der Urheberin oder des Urhebers vorgesehen ist.
Wenn nun laut Bundesgerichtshof der Lichtbildschutz des Paragraphen 72 des Urheberrechtsgesetzes also dazu führt, dass sich die Gemeinfreiheit der Originale an den Digitalisaten nicht fortsetzt, muss das Gesetz in diesem Punkt nachgebessert werden. Gelegenheit dazu wird spätestens dann bestehen, wenn die bereits laufende EU-Urheberrechtsreform in deutsches Recht umgesetzt werden muss.
Wikimedia Deutschland ist dazu im Gespräch mit den zuständigen Bundesministerien und Ausschüssen des Bundestages, aber auch mit denjenigen Museen, die es ähnlich sehen wie die Kläger in diesem Rechtsstreit. Letztendlich muss es uns allen darum gehen, das kulturelle Erbe möglichst umfassend zugänglich zu machen, damit es nicht im medialen Lärm der Gegenwart untergeht und so aus dem (digitalen) Bewusstsein der Menschen verschwindet. Die Wikimedia-Projekte und ihre Communitys können und wollen hier helfen, gerade wegen der heutigen Entscheidung.

How students get the materials they need as opportunities for higher education expand but funding shrinks.
From the top down, Shadow Libraries explores the institutions that shape the provision of educational materials, from the formal sector of universities and publishers to the broadly informal ones organized by faculty, copy shops, student unions, and students themselves. It looks at the history of policy battles over access to education in the post–World War II era and at the narrower versions that have played out in relation to research and textbooks, from library policies to book subsidies to, more recently, the several “open” publication models that have emerged in the higher education sector.
From the bottom up, Shadow Libraries explores how, simply, students get the materials they need. It maps the ubiquitous practice of photocopying and what are—in many cases—the more marginal ones of buying books, visiting libraries, and downloading from unauthorized sources. It looks at the informal networks that emerge in many contexts to share materials, from face-to-face student networks to Facebook groups, and at the processes that lead to the consolidation of some of those efforts into more organized archives that circulate offline and sometimes online— the shadow libraries of the title. If Alexandra Elbakyan’s Sci-Hub is the largest of these efforts to date, the more characteristic part of her story is the prologue: the personal struggle to participate in global scientific and educational communities, and the recourse to a wide array of ad hoc strategies and networks when formal, authorized means are lacking. If Elbakyan’s story has struck a chord, it is in part because it brings this contradiction in the academic project into sharp relief—universalist in principle and unequal in practice. Shadow Libraries is a study of that tension in the digital era.

Le Metropolitan Museum of Art annonce cette semaine l’arrivée d’une licence très permissive pour 375 000 images d’œuvres d’art. Cette nouvelle licence permet à n’importe qui d’utiliser ces reproductions gratuitement et sans condition.
C’est une décision formidable pour le domaine public et on espère ardemment qu’elle fera tache d’huile dans tous les musées du monde. Mardi, le très célèbre Metropolitan Museum of Art a en effet annoncé la mise à disposition sur un site web dédié de plus de 375 000 reproductions d’œuvres d’art.
Vous voulez voir une interprétation du Couronnement de la Vierge ? Une estampe nippone de Utagawa Yoshikazu sur une Française à cheval ? A tool for discovery, collaboration and re-use, CC Search enables users to search a variety of open repositories through a single interface to find content in the commons. Developed by Creative Commons, the current CC Search tool is used by nearly 600,000 people every month. The new beta version of the project, which was released in early February, includes simple, one-click attribution making it easier to credit the source of any image. CC Search beta also provides social features, allowing users to create, share and save lists as well as adding tags and favorites to the objects in the commons.
The beta version of CC Search has recently integrated 470,00 images from Europeana into its database, which already incorporates artworks provided by cultural institutions and repositories from across the globe.

Un moteur de recherche qui va vous permettre de découvrir des milliers d’œuvres pouvant être copiées, distribuées, modifiées, remixées ou encore adaptées tout en respectant les lois sur le droit d’auteur.
CCsearch est encore en phase de test, mais se présente déjà commeun outil très convaincant qui ne demande qu’à grandir. Pour le moment CCsearch va dénicher ses images dans les collections du Rijksmuseum, la bibliothèque publique de New York, le Metropolitan ou encore des services comme Flickr ou 500px. En tout ce sont près de 10 millions d’images qui y sont référencées.
