Samedi 4 mars, un #traité de #protection_de_la_haute_mer a été signé sous l’égide de l’#ONU. Après quinze ans de négociations et alors que le #changement_climatique et la #pollution des océans deviennent toujours plus inquiétants, les représentants des grandes puissances comme ceux des #ONG y ont vu un pas en avant décisif pour la #protection_du_climat, de la #biodiversité et de la planète.
On peut évidemment douter que l’ONU protégera plus la #haute_mer, soit 60 % de la surface de la planète, qu’elle ne protège la paix et les peuples. La pollution de l’océan et son #réchauffement viennent de l’activité humaine terrestre, régie par la course au profit, face à laquelle l’ONU n’a que des phrases, et encore, à proposer.
Le traité envisage de transformer un tiers des #océans en #Aires_maritimes_protégées (#AMP), ce qui en ferait des sanctuaires de biodiversité d’où toute activité humaine serait proscrite. Or les AMP existent déjà dans des zones sous contrôle étatique et sont au mieux un affichage politique ou touristique, au pire une privatisation de l’océan. Ainsi, la mer d’Iroise, bordant le Finistère, est une zone protégée dans laquelle des algues vertes reviennent chaque année, sans qu’aucune mesure sérieuse ne soit prise. La Grande-Bretagne quant à elle a transformé en 2010 l’#archipel_des_Chagos, dans l’océan Indien, en AMP, y interdisant toute activité humaine… sauf celle de la #base_militaire américaine de #Diego_Garcia, avec ses milliers d’hommes, ses navires de guerre, ses bombardiers et jusqu’à sa prison secrète. La France a institué en 2016 une AMP de 2500 km² autour de l’#île_de_Clipperton dans le #Pacifique. Elle est entourée d’une zone de 4,5 millions de km² dédiée à la recherche de nodules polymétalliques, la zone où on peut polluer est donc près de 2 000 fois plus étendue que la zone dite protégée.
La concurrence entre les grandes puissances et les entreprises privées qu’elles représentent compte bien plus que la protection de la nature. Les fosses océaniques recèlent en effet des espèces vivantes dont la découverte donne lieu à des brevets en #chimie, #biologie et même en cosmétique. Le traité indique simplement que 1 % du profit tiré de l’#exploitation de ces #brevets, qui ne peut être le fait que de grands groupes capitalistes occidentaux, devra revenir aux pays pauvres. Quant aux #métaux_rares qui reposent au fond des mers, on commence déjà à aller les chercher. 14 tonnes de #nodules_polymétalliques ont été extraites en décembre, par plus de 4 000 mètres de fond, dans la zone de Clipperton. L’impact de cette opération sur l’#environnement est inconnu à ce jour, celui d’une éventuelle exploitation industrielle encore plus. Quoi qu’en disent les scientifiques, elle risque pourtant d’être lancée et l’#Autorité_internationale_des_fonds_marins doit en décider avant la fin de l’année. L’ONG américaine très influente #Pew_Charitable_Trusts, en pointe dans la constitution d’AMP, se contente de demander qu’un tiers des fonds soient épargnés. C’est à de telles ONG, étroitement liées au grand patronat et aux États, que seront confiées les AMP si elles voient le jour.
Tous les pays impérialistes sont aux aguets. Ainsi, le Sénat français, qui visiblement ne s’emploie pas seulement à démolir les retraites, a commandé en 2022 un rapport à ce sujet. Il conclut que l’exploitation des #fonds_marins peut rapporter gros et qu’en conséquence l’État doit prendre les mesures administratives, financières et diplomatiques permettant à la cinquantaine de sociétés françaises intéressées de ramasser le pactole. Le rapport enrobe bien sûr tout cela de considérations écologiques, mais recommande que dorénavant la #Marine_nationale soit plus présente sur les zones concernées et que ses frégates soient équipées de drones sous-marins capables de travailler en grande profondeur.
En fait de #protection de la nature, les États impérialistes préparent des Aires maritimes protégées de la #concurrence, par la force des armes s’il le faut.

Les Chagos se trouvent au cœur d’un litige vieux de cinq décennies, depuis la décision britannique de séparer en 1965 cet archipel de l’île Maurice et d’y installer une base militaire commune avec les Etats-Unis sur l’île principale de Diego Garcia.
Cinglant revers pour le Royaume-Uni. Le 22 mai 2019, à l’Assemblée générale de l’ONU, une majorité de pays lui a demandé de rétrocéder l’archipel des Chagos à l’île Maurice, d’ici au mois de novembre. L’ensemble, constitué de 55 îles, abrite une base conjointe britannique et américaine, stratégique.
Initiée par les autorités mauriciennes de Port-Louis, une résolution de rétrocession, non contraignante, mais à forte valeur politique, a été adoptée par 116 pays, six s’exprimant contre, dont le Royaume-Uni, les Etats-Unis, l’Australie et la Hongrie. Cinquante-six Etats ont choisi l’abstention. Les pays africains ont, en revanche, voté massivement en faveur de la résolution.

The International Court of Justice said the U.K. should hand back to Mauritius control of an Indian Ocean archipelago where a key U.S. naval base is located.
“The U.K.’s continued administration of the Chagos archipelago “is an unlawful act of a continuing character,” court President Abdulqawi Ahmed Yusuf said in The Hague. “Accordingly the U.K. is under an obligation to bring an end to its administration of the Chagos archipelago as rapidly as possible,” Yusuf said.
The United Nations in 2017 sought an advisory opinion from the ICJ, its principal judicial organ, on the legal status of the archipelago.
Chagos is part of the British Indian Ocean Territory, which has been administered by the U.K. since 1965, when it paid the then self-governing colony of Mauritius 3 million pounds ($3.9 million) for control of the islands. Between 1967 and 1973, hundreds of inhabitants were removed to make way for the Diego Garcia U.S. military base, which has been used to launch bomber jets for wars in Iraq and Afghanistan.
Mauritian Prime Minister Pravind Jugnauth in August obtained the backing of the African Union and about 30 other countries in his bid to have control of the archipelago returned to Mauritius. The request to the ICJ excludes Diego Garcia, he said.

The Permanent Court of Arbitration said Wednesday it will deliver an eagerly awaited ruling on July 12 in a case filed by the Philippines contesting Beijing’s sweeping claims to most of the South China Sea.
Beijing has rejected the international arbitration and says it will ignore the panel’s decision.
In an unusual move, the court announced the date of the ruling ahead of time, saying it will be sent to the countries involved July 12 and published the same day.

Former residents of the Chagos Islands who were forcibly removed from their homeland more than 40 years ago have lost their legal challenge to return.
Families left the Indian Ocean islands in the 1960s and 70s to make way for a US Air Force base on Diego Garcia, the largest of the group of islands.
An Immigration Order preventing anyone from going back was issued in 1971.
The Supreme Court - UK’s highest court - upheld a 2008 House of Lords ruling that the exiles could not return.
Olivier Bancoult, the Chagossian leader who has been fighting in the courts on behalf of the islanders, had argued that decision should be set aside.

The UK government is facing renewed pressure to make a full disclosure of its involvement in the CIA’s post-9/11 kidnap and torture programme after another leading Bush-era US official said suspects were held and interrogated on the British territory of Diego Garcia.
Lawrence Wilkerson, who was chief of staff to Colin Powell at the US state department, said the Indian Ocean atoll was used by the CIA as “a transit site where people were temporarily housed, let us say, and interrogated from time to time”.

Former airline boss and famous French author Marc Dugain argued Thursday that there had been a cover-up in the disappearance of Malaysia Airlines flight MH370, speculating that the passenger jet could have been hacked and then shot down by the US.
Dugain, a well-respected French author, argues that the Boeing 777 carrying 239 people crashed near #Diego_Garcia, a British island in the middle of the Indian Ocean used as a strategic air force and intelligence base by the US military, in the six-page article in Paris Match.
The US has always officially denied that flight MH370 came anywhere near Diego Garcia.
The latest theory into the disappearance of Malaysia Airlines flight MH370 on March 8, 2014 has all the ingredients of a spy thriller and has grabbed the French public’s attention.
The former boss of Proteus Airlines travelled to the neighbouring Maldives where residents told local media that they had seen an airliner fly in the direction of Diego Garcia. Their claims were promptly dismissed by the authorities.
“I saw a huge plane fly over us at low altitude,” a fisherman on Kudahuvadhoo island told Dugain. “I saw red and blue stripes on a white background” – the colours of Malaysia Airlines. Other witnesses confirmed the sighting.
Dugain speculates – adding to the numerous other existing hypotheses about what happened to flight MH370 – that a modern aircraft such as Malaysia Airlines’ Boeing 777 could have been hijacked by a hacker.
“In 2006, Boeing patented a remote control system using a computer placed inside or outside the aircraft,” he noted. This technology lead Dugain to the idea of a “soft” remote hijacking.
But the writer also suggests that a fire could have led the crew to deactivate electrical devices, including transmission systems.
Whatever the initial reasons for leaving its flight path, Dugain suspects that the plane then headed to Diego Garcia, where a number of scenarios may have played out – including the US Air Force shooting it down for fear of a September 11-style attack.
Dugain met the mayor of neighbouring Baarah island, who showed him pictures of a strange device found on a beach two weeks after the plane had disappeared and before the Maldives military seized it. Two aviation experts and a local military officer concluded that the object was a Boeing fire extinguisher. Dugain points out that for the extinguisher to have floated, it must have been empty, having been automatically triggered by a fire. He adds that precedent exists in which fires on board aircraft caused all passengers and crew to die of asphyxiation, while the plane’s automated systems extinguished the blaze and kept it in the air.
