• Une clinique de FIV a importé des embryons atteints d’hémophilie en Israël – enquête Renee Ghert-Zand - Time of israel

    Une enquête secrète menée conjointement pendant plusieurs mois par le ministère de la Santé et la division des fraudes de la police israélienne à Tel Aviv a révélé que le personnel soignant d’une clinique de fécondation in vitro (FIV) avait importé des ovules humains fécondés de Géorgie atteints d’une grave maladie génétique, l’hémophilie B. Les employés savaient que les embryons étaient contaminés, mais les ont implantés chez plusieurs femmes israéliennes qui suivaient un traitement de FIV.

    Selon les informations publiées lundi par le ministère de la Santé, l’affaire a commencé par une enquête interne au sein du ministère lorsque celui-ci a reçu des informations selon lesquelles des ovules de donneuses porteuses de la mutation génétique de l’hémophilie B avaient été fécondés à la clinique BIRTH en Géorgie et importés en Israël.

    L’hémophilie B, également appelée déficit en facteur IX (FIX) ou maladie de Christmas, est une maladie génétique causée par l’absence ou la déficience du facteur IX, une protéine de la coagulation. La maladie est généralement transmise génétiquement de parent à enfant, bien qu’un tiers des cas surviennent de manière spontanée.

    L’hémophilie B provoque des saignements plus longs que d’habitude. Les saignements peuvent être internes, au niveau des articulations et des muscles, ou externes, à la suite de coupures mineures, d’interventions dentaires ou de traumatismes. La quantité de FIX dans le sang d’une personne détermine si son hémophilie et ses risques de saignement sont mineurs, modérés ou graves.

    Après avoir mené son enquête, le ministère de la Santé a transmis ses conclusions à la police. L’unité de lutte contre la fraude de la police de Tel Aviv a mené une enquête sous couverture avec l’aide du Directorat des Renseignements de la police, du ministère de la Santé et du bureau de la Procureure générale de l’État.

    L’enquête a permis d’identifier deux personnes travaillant dans une clinique de FIV anonyme qui, à diverses reprises, ont importé des ovules fécondés pour les implanter chez des femmes israéliennes au cours des derniers mois. Le personnel soignant, tant en Géorgie qu’en Israël, est soupçonné d’avoir su que les embryons étaient affectés.

    Le ministère de la Santé a ordonné l’arrêt immédiat de l’importation d’ovules fécondés en provenance de la clinique de Géorgie. Il a également ordonné aux directeurs de toutes les cliniques de FIV en Israël d’identifier les femmes israéliennes pour lesquelles les embryons ont été importés et de les amener à prendre des décisions en connaissance de cause sur la suite à donner à leur grossesse.

    Les suspects devaient subir d’autres interrogatoires lundi et devaient être présentés au tribunal de Tel Aviv pour que les procureurs demandent leur maintien en détention si nécessaire.

    Cette affaire fait suite à plusieurs scandales récents concernant des Israéliens cherchant à fonder ou à agrandir leur famille par FIV, le plus notoire étant la naissance en 2022 d’une petite fille https://fr.timesofisrael.com/les-parents-biologiques-dun-bebe-ne-dune-confusion-de-fiv-identifi à des parents n’ayant aucun lien génétique avec elle.

    Cette confusion, au centre hospitalier Assuta de Rishon Lezion, a été découverte lorsqu’il a été établi que le fœtus, alors in utero , présentait des problèmes de santé et qu’il a donc été soumis à divers examens. Les résultats ont montré que ni la femme qui portait l’enfant ni son partenaire ne pouvaient être ses parents biologiques.

    Les parents biologiques du bébé ont été identifiés l’année dernière après une série de tests génétiques, a révélé le tribunal des Affaires familiales de Rishon Lezion au début du mois de mars.

    Contrairement au cas actuel de fraude présumée, l’erreur a été attribuée à la surcharge de travail du personnel et au non-respect du protocole.

En juillet 2022, Mohammad Rasoulof a de nouveau été incarcéré pour avoir signé un appel demandant aux forces de sécurité de « déposer les armes » face à la colère populaire contre « la corruption, le vol, l’incompétence et la répression ». Il a été libéré en février 2023 pour raisons de santé.

  • European Commission accused of ‘bankrolling dictators’ by MEPs after Tunisia deal

    Members of justice committee say €150m in EU funding went straight to country’s president, Kais Saied

    The European Commission has been accused of “bankrolling dictators” by senior MEPs who have claimed that the €150m it gave to Tunisia last year in a migration and development deal has ended up directly in the president’s hands.

    A group of MEPs on the human rights, justice and foreign affairs committees at the European parliament launched a scathing attack on the executive in Brussels, expressing anxiety over reports that the commission’s president, Ursula von der Leyen, was about to seal a similar deal with Egypt.

    The Greek migration minister, Dimitris Kairidis, confirmed late on Wednesday that a joint declaration between the EU and Egypt had been agreed and would be formally unveiled when von der Leyen and the leaders of Greece, Italy and Belgium visit Cairo on Sunday.

    The agreement sees Egypt receiving an aid package of €7.4bn (£6.3bn) “mostly in loans” in return for the country “committing to work harder on migration”, he told the Guardian, adding: “I have said, time and again to my colleagues, that we need to support Egypt which has been so helpful in managing migration and so important for the stability of North Africa and the wider Middle East.”

    Kairidis, who held talks with the Egyptian ambassador to Greece on Wednesday, confirmed there had been no boats leaving directly from Egypt, even if arrivals on southern Greek islands of migrants travelling through Libya had soared this year. “Egypt is not only hosting 9 million refugees, it has been very effective in controlling illegal migration,” he said.

    The MEPs have accused the commission of refusing to answer questions on the deal with Tunisia and worry that it is looking at a series of “ad hoc” deals with other African countries without regard to democracy and rule of law in those countries.

    “It seems that we are bankrolling dictators across the region. And that is not the Europe that we want to see. That is not the place which the EU should be holding in the world,” said the French MEP Mounir Satouri, a member of the parliamentary foreign affairs committee.

    At a press conference in Strasbourg, he claimed the money – pledged to Tunisia last year as part of a wider pact aimed at curbing a surge in migration to Italy and people-smuggling – had been diverted, saying that the €150m was supposed to have been invested directly in an EU-agreed project but instead had been “transferred to the president directly”.

    Fellow MEPs said there had been an “authoritarian shift” in Tunisia under its president, Kais Saied, but the commissioners had gone ahead with the deal anyway.

    A spokesperson for the EU commission said MEPs were entitled to express their views but that it was better to build partnerships to improve democracy and human rights than to “break off relations” and see the situation deteriorate.

    “What I can say is that we are absolutely convinced of the necessity to work with countries in our neighbourhood, taking into account the realities on the ground,” the spokesperson said. “We know the criticism related to human rights in those countries, and it is obvious that this is an issue and that these are issues that we take up with those countries.”

    The spokesperson added there were “specific mechanisms in place to discuss human rights with the countries in the region, including Egypt”.

    The Danish MEP Karen Melchior, coordinator of the justice committee, said parliamentarians’ concerns about the Tunisia deal were “being continually ignored” and that commissioners refused to answer their questions or take their concerns seriously.

    “How can we continue to have a memorandum of understanding, how can we give budget support without conditionality to Tunisia, when things are going from bad to worse?” she said.

    “To sign an agreement with President Saied, who is continuing to suppress opposition and democracy in Tunisia – this is not the way the EU should be acting. This is not the way that Team Europe should be doing our foreign policy.”

    The chair of the human rights committee, Udo Bullman, attacked what he said was a “hush-hush” deal that had been rushed through.

    “The commission has to explain why there was so much urgency in the agreement of last summer – why it, hush-hush, very quickly before Christmas, [said] it was of the ‘highest urgency’ and just gave the money … without any critical debate,” he said, adding this was a question for the EU’s commissioner for neighbourhood and enlargement, Olivér Várhelyi, and for von der Leyen.

    Michael Gahler, the German CDU MEP who was blocked from visiting Tunisia by the local authorities last year, said the Tunisian people should not be abandoned in the face of “Saied’s autocratic rule” and economic decline.

    “That requires us to make sure that European taxpayers’ money truly benefits the Tunisian people and the civil society … and why it has to be clear that European funding to Tunisia needs to be adequately conditioned to that end,” he said.

    The concerns are being voiced this week as the EU parliament’s five-year mandate draws to a close before elections in June, with MEPs keen to lay down red lines for any future deals the executive in Brussels intends to do.

    Sara Prestianni, the advocacy director for the NGO EuroMed Rights, said she was concerned the EU was about to make a similar “strategic and political” mistake with Cairo, pledging vast sums of money without setting conditions involving enough financial oversight or guarantees on human rights. “It would be an error, particularly if it [the Tunisia deal] is replicated with Egypt,” she said.

    Satouri, who is also the parliament’s special rapporteur for Egypt, said: “We need to ensure democratic procedures are followed before money is disbursed. These are not the private fund of Commissioner Várhelyi. These are European funds.”

  • UK strikes £1M deal with Libya to combat irregular arrivals into Europe

    The announcement comes after Britain’s home office minister concluded a visit to Tripoli with representatives from the European Union, the United Nations, France, Germany, and Malta.

    The United Kingdom will pay Libya £1 million (1.17 million euros) to stop people from entering Europe by crossing the Mediterranean Sea and instead repatriate them to their countries of origin, the German news agency dpa reported.

    The announcement comes after #Michael_Tomlinson, Britain’s home office minister, concluded a visit to Tripoli last week with representatives from the European Union, the United Nations, France, Germany, and Malta. Tomlinson is the first UK home office minister to visit the North African country in decades.

    “As well as supporting survivors of trafficking, the funding will assist migrants who choose to return to their countries of origin. These voluntary returns are one of the most fundamental tools at our disposal for driving down migration numbers globally,” Tomlinson said in a statement published on his website.

    The International Organization for Migration (IOM) defines voluntary returns as the “assisted or independent return to the country of origin, transit or another country based on the voluntary decision of the returnee.”

    Launching pad for entry to Europe

    The previous year saw record-high arrivals in Europe from North Africa, with over 150,000 migrants reaching Italy by sea. Libya, a major departure point for Mediterranean-bound migrants, saw nearly 40,000 arrivals in Europe.

    “The new funding I announced is only the latest step in our drive to bolster international efforts, building on our new deal with Frontex, the European Border and Coast Guard Agency, and agreements with other countries including Vietnam and Albania,” said Tomlinson in an article he wrote for British newspaper The Telegraph.

    Last month, the UK also announced a new working arrangement with Frontex, the European Border and Coast Guard Agency to crack down on people smuggling networks by strengthening Frontex’s border agency capabilities.

    “This isn’t just Libya or North Africa; it isn’t just Europe. It is a global challenge. And we are getting on with the job. We will do whatever it takes to secure our borders, reform our immigration system, and stop the boats,” Tomlinson concluded.

    In addition to Libya, the UK has pledged a £3 million deal with Turkey to construct a new center to coordinate joint operations between the UK and the Turkish border patrol. Tukey is reportedly the starting point for 90 percent of the small boats attempting to enter the UK by crossing the English Channel.

    Last year, UK Prime Minister Rishi Sunak penned similar bilateral agreements with Belgium, Bulgaria, and Serbia.

    Outsourcing migrant oppression

    The UK and Libya alliance comes in the wake of media reports that the humanitarian rescue group SOS Humanity 1 clashed with the Libyan coast guard while conducting a rescue mission earlier this month. SOS Humanity alleged that the Libyan Coast Guard had fired live bullets and used violence.

    Human rights groups have widely criticized Europe for outsourcing their migration policies to African countries, particularly those with a record of human rights abuses such as Libya.

    In January, Human Rights Watch released a report that revealed the dire conditions faced by migrants and asylum seekers in Libya which include torture, forced labor, and sexual assault.

    After a fact-finding mission in Libya last year, the UN Human Rights Council declared that there are “reasonable grounds to believe that crimes against humanity have been committed against Libyans and migrants throughout Libya since 2016.”

    There are an estimated 600,000 migrants stranded in Libya according to the International Organization for Migration (IOM).

    Failed state

    Libya spiraled into chaos after Muammar Gaddafi’s removal in 2011. Libya plunged into a failed state with two rival political administrations controlled by militias.

    Since then, Libya has faced persistent condemnation from human rights organizations for widespread human rights violations and unchecked actions by the government.

    • The billionaire’s guide to doing taxes

      Do you want to pay less taxes? Great. Step one, be a rich person. Then, buy a yacht. Or a sports team. Give a lot to charity. Lose some money in the stock market. Above all, make sure most of your money exists in the form of assets, not cash — stocks, real estate, a Dutch master painting, fine jewelry, or whatever else strikes your fancy.

      They say that money is a universal language, but it speaks at different volumes. When you have a fathomless bounty of wealth, money doesn’t quite register as an expense until you add a lot of zeros to the end — so spending a lot to save a lot is a no brainer. It’s why the mega-rich often hire expensive tax lawyers, wealth managers, or even set up a whole office dedicated to tax strategy. “It’s not just preparing the return,” says Paul Wieseneck, a tax accountant and director of the Fuoco Group. “There’s so much more involved in planning, in accumulating, offsetting, and trying to mitigate the taxes as best as possible.”

      For the rich, taxes aren’t a springtime affair with a quick visit to H&R Block, but a year-round endeavor.

      How much tax a wealthy person owes in a given year is a complex tapestry threaded with exemptions, deductions, credits, and obscure loopholes you’ve never heard of. The ideal is to owe zilch. If that sounds impossible to achieve, just look at the leaked tax returns of the wealthiest Americans that nonprofit news site ProPublica analyzed in 2021: Over several years, billionaires Elon Musk, Jeff Bezos, and Michael Bloomberg, among others, paid no federal income taxes at all.

      How do they do it? Here are some basic rules they live by.
      Don’t take a paycheck

      If your income is earned through wages paid to you by an employer, chances are your taxes are on the simpler side of the spectrum. Not as simple as it is for wage earners in other countries, where the government simply tells you how much you owe, but getting a paycheck from your boss means your taxes are automatically withheld each pay period. Filing your tax return might be as easy as filling out one form.

      You can pick and choose which deductions to take (like for student loan interest, or for having a home office), but the vast majority of households take the simpler standard deduction, which this year erases $14,600 from your tax bill. For tax year 2024, you’ll pay a 37 percent tax on any income you rake in over $609,350. That sounds like it would add up to a sizable amount for multimillionaires and billionaires — unless that income is just a minuscule share of their increasing wealth.

      Jeff Bezos, when he was still Amazon CEO, had a base salary of around $80,000 a year. Elon Musk doesn’t take a salary at all at Tesla. Apple CEO Tim Cook does get a $3 million salary, but it’s a small slice of the $63 million he received overall last year. Most wealthy entrepreneurs are paid in bountiful stock rewards; Musk is currently fighting to keep his record-breaking Tesla pay package, made up of a bunch of stock options and now valued at almost $56 billion. ProPublica found that, because their income fell below the threshold, at least 18 billionaires got a Covid-19 stimulus check.

      Paul Kiel, a ProPublica reporter who was an integral part of the newsroom’s billionaire tax return stories, says the income versus wealth divide was crucial in helping the public understand how differently the wealthy operate. “If you can avoid income as it’s defined in our system, and still get richer, that’s the best route,” he tells Vox.

      Stocks aren’t taxed until they’re sold — and even then, what’s taxed is the profit on the sale, called a capital gains tax. Billionaires (usually) don’t sell valuable stock. So how do they afford the daily expenses of life, whether it’s a new pleasure boat or a social media company? They borrow against their stock. This revolving door of credit allows them to buy what they want without incurring a capital gains tax. Though the “buy, borrow, die” strategy isn’t quite as sweet right now because interest rates are high, a Wall Street Journal piece from 2021 notes that those with $100 million or more could get interest rates as low as 0.87 percent at Merrill Lynch. The taxable value of a stock also resets when it’s passed on to an heir, so that if a wealthy scion chooses to sell their inherited stock, they’d only pay a tax on the increase in value since the original owner’s death.
      Plan on losing money

      If you do, regrettably, have to sell assets, fret not: just lose a lot of money, too, and pile on the offsets. “We do what’s called tax-loss harvesting,” says Wieseneck, using a simple example to illustrate. Say someone owns Pepsi stock, and it tanks. They sell at a loss, but then buy about the same amount of Coca Cola stock. The Pepsi loss can erase some (or even all, if you play your cards right) of the taxes owed on the gains made on Coca Cola stock.

      “During the year we try to accumulate losses,” says Wieseneck. “At the end of the year, if I know you have a capital gain on a sale of a property or a house or another investment, I’ll accumulate some losses for you that can offset [it].” Capital losses don’t also have to be applied in the same year — if you know you’ll be selling more assets next year, you can bank them for later.

      It’s illegal to quickly sell and then buy the same stock again — a practice called a “wash sale” — just to save on taxes, but the key word is “same.” Public companies often offer different classes of stock that essentially trade the same, and it’s not hard to trade similar-enough stocks back and forth. Exchange-traded funds (ETFs), for example, are like buckets containing a mix of stocks that can themselves be traded like a stock. A few different ETFs might perform roughly the same on the stock market; a person could sell one ETF and quickly buy another while avoiding the “do not sell and buy the same stock within 30 days” rule.
      Play tax rate arbitrage

      Another tool in the tax shrinking arsenal: leveraging the differences in tax rates, which vary based on the type of asset and how long someone owned it. Long-term gains — assets held for longer than a year — from the sale of stocks and bonds are taxed at rates as low as zero percent and as high as 25 percent. Short-term gains, meanwhile, can face a tax as high as 37 percent. Collectibles, which include art, antiques, cards, comic books, and more, have a max rate of 28 percent.

      The basic strategy here is to always get the lowest tax rate possible for your gains. A favorite tactic of billionaire investor Jeff Yass, according to reporting from ProPublica, is to place bets both for and against large companies, trying to amass a bunch of short-term losses on one end and long-term gains, which already enjoy a lower tax rate, on the other.

      Another kind of magic trick is to place high-tax income into lower-tax or no-tax wrappers, which can include things like tax-advantaged retirement accounts. One example is what’s called the private placement life insurance policy, a niche product that only the very wealthiest of the wealthy use. It can cost millions of dollars to set up, so it’s not worth it unless you’re rich, but the premiums a policyholder pays into the policy can be invested in high-growth investment options, such as hedge funds. The money you’d get back if you decide to cancel the policy isn’t taxed, but it’s not even necessary to take the money out. You can borrow money from the policy at low interest rates, and its benefits pass on tax-free to beneficiaries upon the original holder’s death. It’s insurance, says Michael Kosnitzky, co-chair of the law firm Pillsbury Winthrop Shaw Pittman’s Private Client & Family Office practice group, “but it also holds investment assets and, like any permanent insurance policy, the cash surrender value grows tax free.”

      A recent report from Sen. Ron Wyden (D-OR), the chair of the Senate Committee on Finance, laid out how big the scheme had gotten, currently sheltering at least $40 billion. The report found that the average net worth of people with such life insurance policies was over $100 million.
      Business or pleasure?

      When you’re very rich, it’s important to treat everything as a business expense. Private jets are expensive luxuries, but the cost can be fully tax deductible if the plane is mostly being used for business — and what counts as “mostly business” isn’t clear cut. Maybe you take a trip on your jet partly to take a business meeting, but also to spend a few relaxing days in a beautiful getaway spot. Private jet owners often set up LLCs and rent out their planes when they’re not personally using them to take advantage of the tax deduction, reported ProPublica.

      In fact, many expensive hobbies of the ultra-rich coincidentally turn into business expenses — yachts, racehorses, golf courses, and more. They’re often run very professionally, says Kiel, “but never quite seem to make a profit.”

      “Generally you’re not supposed to write stuff off that’s a hobby,” he continues. “But the wealthier you are, the more your hobbies appear to be businesses or are operated like businesses.”

      Despite the ubiquity of this practice, there’s risk to it, especially as the IRS ramps up audits of tax write-offs for private jets. If the wealthy are going to buy exorbitantly expensive yachts and claim it’s being used for a business, says Kosnitzky, “you’d better be on very solid ground.”
      Philanthropy pays

      Charity is a time-worn way the ultra-rich reduce their taxes — and it has the added bonus of putting a nice luster on their reputation. Many charitable organizations set up by billionaires are tax-exempt, and charitable donations are tax deductible. You can completely control when to make a donation, and of what size, depending on how much taxable income you have in a given year; it’s a nimble method of offsetting taxes.

      But the worthiness of charitable deductions can be questionable, because they’re “very, very loosely regulated,” says Kiel. The donations themselves can range from buying mosquito nets to prevent malaria to “paying for your kid’s private school.” Recall, for example, that former President Donald Trump once used money from his foundation to buy a painting of himself. Often, the wealthy can pour money into foundations and funds with philanthropic aims without actually distributing that money to anyone. One popular charitable medium today is called a donor-advised fund. Rich people put their money into these funds, and “advisers” who manage the account eventually give away the money — eventually being the key word. Even if the money hasn’t gone to a good cause yet, donors can take the tax deduction right away.

      In other cases, what raises eyebrows is whether an ostensibly charitable organization actually serves a public good. These charities get tax-exempt status because they’re supposed to have a “pro-social” purpose, says Daniel Reck, an economics professor at the University of Maryland who recently co-authored a paper analyzing tax evasion among the ultra-rich. Some billionaires claim their foundations qualify because they’re opening up a historical mansion or private art collection to the public. In fact, there are many examples of tax-exempt organizations not holding up their end of the bargain. As ProPublica reported, the historic landmark Carolands Chateau enjoys tax benefits but is open to the public just two hours per week. A private art gallery established by the late billionaire Sheldon Solow only recently became open to visitors, despite some of the art being held in a tax-exempt foundation.

      Also crucial to utilizing charity as a tax avoidance strategy is pumping up the value of your generosity. “You donate some fancy piece of fine art to a museum, you get an assessment for the art, it’s much more than you could actually ever sell it for,” explains Reck. “You get a big tax write-off.” It’s not just fine art, either — one popular form of overvaluation (until Congress passed a bill putting an end to it last year) involved inflating the value of land. Called a “syndicated conservation easement,” it took advantage of an incentive for environmental conservation, in which landowners who agree not to develop their land would get a tax break proportional to the fair market value of the land. “The game is that people just massively, ludicrously inflate these fair market values,” says Reck. In the syndicated version of this tax break, a group of investors buys land, gets an overvalued assessment on it, and shares the tax write-off between themselves. “Now there are a bunch of court cases about it,” Reck says.
      The gray area and the illegal stuff

      Some of the above tactics occupy an ambiguous, blurry zone of legality — it might be okay or not on a case-by-case basis. Some wealthy people may be alright with the risk, but Kosnitzky notes that it isn’t wise to play the “audit lottery” — there’s also reputational risk to consider. For those determined to take an “aggressive” tax position, a lot of documentation and even having their lawyer prepare a memo defending their tax strategy may be necessary. They might still end up paying a penalty and owing taxes, but exactly how much is up for negotiation.

      The paper Reck co-authored found that sophisticated tax evasion methods used by the very wealthy, including evasion through pass-through businesses or offshore accounts, often goes undetected by random audits. This suggests that current estimates of the “tax gap,” or the difference between taxes paid to the IRS and the amount it’s actually owed, is very likely an undercount.

      The difference between avoidance (legal) and evasion (illegal) is hard to untangle at times because wealthy people will dispute their audit, deploying brilliant tax lawyers to argue that the government is mistaken. These battles can take years to settle. It’s not just that the IRS needs a bigger budget to do all the audits it wants to — it did get extra funding in the Inflation Reduction Act — but that auditing a wealthy taxpayer is costlier, and much more time-consuming, than auditing a poor one. The structures of the well-off’s businesses are often extremely complex, too, which also makes auditing them more expensive.

      Reck noted that rich people dispute a greater share of the tax that the IRS says they should pay after an audit. In the middle of the income distribution, about 10 percent of the auditor’s recommended adjustment is disputed, says Reck. Among people with the highest income, however, the disputed share exceeds 50 percent. “That suggests that the taxpayer and their advisers, at least, believe that they’re either in some gray area or were allowed to do what they did.”

      “We’ve talked to a lot of former IRS agents, and they would often hear the line that for wealthy taxpayers, their tax return is like an opening offer,” says Kiel.

    Derrière son image familiale et écolo, le géant du meuble suédois, plus gros consommateur de bois au monde, révèle des pratiques bien peu scrupuleuses. Une investigation édifiante sur cette firme à l’appétit démesuré.

    C’est une des enseignes préférées des consommateurs, qui équipe depuis des générations cuisines, salons et chambres d’enfants du monde entier. Depuis sa création en 1943 par le visionnaire mais controversé Ingvar Kamprad, et au fil des innovations – meubles en kit, vente par correspondance, magasins en self-service… –, la petite entreprise a connu une croissance fulgurante, et a accompagné l’entrée de la Suède dans l’ère de la consommation de masse. Aujourd’hui, ce fleuron commercial, qui participe pleinement au rayonnement du pays à l’international, est devenu un mastodonte en expansion continue. Les chiffres donnent le tournis : 422 magasins dans cinquante pays ; près d’un milliard de clients ; 2 000 nouveaux articles au catalogue par an… et un exemplaire de son produit phare, la bibliothèque Billy, vendu toutes les cinq secondes. Mais le modèle Ikea a un coût. Pour poursuivre son développement exponentiel et vendre toujours plus de meubles à bas prix, le géant suédois dévore chaque année 20 millions de mètres cubes de bois, soit 1 % des réserves mondiales de ce matériau… Et si la firme vante un approvisionnement responsable et une gestion durable des forêts, la réalité derrière le discours se révèle autrement plus trouble.

    Greenwashing
    Pendant plus d’un an, les journalistes d’investigation Xavier Deleu (Épidémies, l’empreinte de l’homme) et Marianne Kerfriden ont remonté la chaîne de production d’Ikea aux quatre coins du globe. Des dernières forêts boréales suédoises aux plantations brésiliennes en passant par la campagne néo-zélandaise et les grands espaces de Pologne ou de Roumanie, le documentaire dévoile les liens entre la multinationale de l’ameublement et l’exploitation intensive et incontrôlée du bois. Il révèle comment la marque au logo jaune et bleu, souvent via des fournisseurs ou sous-traitants peu scrupuleux, contribue à la destruction de la biodiversité à travers la planète et alimente le trafic de bois. Comme en Roumanie, où Ikea possède 50 000 hectares de forêts, et où des activistes se mobilisent au péril de leur vie contre une mafia du bois endémique. Derrière la réussite de l’une des firmes les plus populaires au monde, cette enquête inédite éclaire l’incroyable expansion d’un prédateur discret devenu un champion du greenwashing.

      This site has been developed by a group of people, FSC supporters and members among them, who are very concerned about the constant and serious erosion of the FSC’s reliability and thus credibility. The group includes Simon Counsell, one of the Founder Members of the FSC; Hermann Edelmann, working for a long term FSC member organisation; and Chris Lang, who has looked critically at several FSC certifications in Thailand, Laos, Brazil, USA, New Zealand, South Africa and Uganda – finding serious problems in each case.

      As with many other activists working on forests worldwide, we share the frustration that whilst the structural problems within the FSC system have been known for many years, the formal mechanisms of governance and control, including the elected Board, the General Assembly, and the Complaints Procedures have been highly ineffective in addressing these problems. The possibility of reforming – and thus ‘saving’ – the FSC through these mechanisms is, we feel, declining, as power within the FSC is increasingly captured by vested commercial interest.

      We feel that unless drastic action is taken, the FSC is doomed to failure. Part of the problem, in our analysis, is that too few FSC members are aware of the many profound problems within the organisation. The FSC Secretariat continues to pour out ‘good news stories’ about its ‘successes’, without acknowledging, for example, the numerous complaints against certificates and certifiers, the cancellation of certificates that should never have been awarded in the first place, the calls for FSC to cease certifying where there is no local agreement to do so, the walk-outs of FSC members from national processes because of their disillusionment with the role of the economic chamber, etc. etc. etc.

      There has been no honest evaluation of what is working and what is not what working in the FSC, and no open forum for discussing these issues. This website is an attempt to redress this imbalance. The site will also help people who are normally excluded from the FSC’s processes to express their views and concerns about the FSC’s activities.

      One of the reasons I am involved in this website is that I believe that many people are aware of serious problems with FSC, but don’t discuss them publicly because the alternative to FSC is even worse. The alternative, in this case is PEFC (Programme for the Endorsement of Forest Certification schemes) and all the other certification schemes (Cerflor, Certflor, the Australian Forestry Standard, the Malaysian Timber Certification Council and so on). One person has suggested that we should set up PEFC-Watch, in order “to be even-handed”.

      The trouble with this argument is that PEFC et al have no credibility. No NGOs, people’s organisations or indigenous peoples’ organisations were involved in setting them up. Why bother spending our time monitoring something that amounts to little more than a rubber stamp? I can just see the headlines: “Rubber stamp PEFC scheme rubber stamps another controversial logging operation!” Shock, horror. The Emperor is stark bollock naked, and it’s not just some little boy pointing this out – it’s plain for all to see, isn’t it?

      One way of countering all these other schemes would be to point out that FSC is better. But, if there are serious problems with FSC – which there are, and if we can see them, so can anyone else who cares to look – then the argument starts to look very shaky.

      FSC standards aren’t bad (apart from Principle 10, which really isn’t much use to anyone except the pulp and paper industry). They say lots of things we’d probably want forest management standards to say. The trouble is that the standards are not being applied in practice. Sure, campaign against PEFC, but if FSC becomes a Holy Cow which is immune to criticism (not least because all the criticism takes place behind closed doors), then we can hardly present it as an alternative, can we?…”

      By the way, anyone who thinks that PEFC and FSC are in opposition should read this interview with Heiko Liedeker (FSC’s Executive Director) and Ben Gunneberg (PEFC’s General Secretary). In particular this bit (I thought at first it must be a mix up between FSC and PEFC, or Liedeker and Gunneberg):

      Question: As a follow-up question, Heiko Liedeker, from your perspective, is there room ultimately for programs like the Australian Forestry Standard, Certfor and others to operate under the FSC umbrella?

      Heiko Liedeker: Absolutely. FSC was a scheme that was set-up to provide mutual recognition between national standard-setting initiatives. Every national initiative sets its standard. Some of them are called FSC working groups, some of them are called something else. In the UK they are called UKWAS. We’ve been in dialogue with Edwardo Morales at Certfor Chile. They are some of the FSC requirements listed for endorsement, we certainly entered into discussion. We’ve been in discussion with the Australian Forestry Standard and other standard-setting initiatives. What FSC does not do is, it has one global scheme for recognizing certification. So we do not, and that’s one of the many differences between FSC and PEFC, we do not require the development of a certification program as such. A standard-setting program is sufficient to participate in the network.

  • La forêt de mademoiselle Tang

    Après « Funan », récompensé en 2018 par le Cristal du long métrage au Festival d’Annecy, Denis Do balaie dans un superbe film d’animation deux siècles de l’histoire d’une famille chinoise.

    Swatow, aujourd’hui Shantou, ville du sud de la Chine. En 1886, les Occidentaux leur ayant interdit l’accès au port, Tang Hio, menuisier, n’a pu expédier par bateau la commande qu’il avait préparée avec sa femme Tang Leng Kung pour leur communauté installée au Cambodge. Pour s’occuper les mains, il part dans la forêt, où son épouse plante de jeunes pousses d’arbres, afin d’y chercher un beau tronc dans lequel réaliser une armoire pour y entreposer ce qu’ils ont de précieux. En 1922, peu après le terrible typhon qui s’est abattu sur la région, leur fils Siao Yi, devenu père de famille, songe à partir lui aussi au Cambodge. Mais ce n’est que sous l’occupation japonaise, en 1940, que son seul fils choisit l’exil…

    Héritage culturel
    Récompensé en 2018 à Annecy pour Funan, son premier long métrage d’animation inspiré du parcours de sa mère, Denis Do, réalisateur français d’origine cambodgienne, poursuit son exploration de la mémoire, de la transmission et de l’héritage familial, culturel et environnemental. Dialogué en dialecte teochew, en usage dans la province chinoise du Guandong, son moyen métrage animé nous entraîne, sur six générations et près de deux siècles, dans une évocation elliptique des grands bouleversements qui ont marqué l’histoire de la Chine, au travers d’une fresque familiale intimiste et sensible.

    Un #référendum fou plonge la Suisse dans l’#état_d'urgence. En acceptant l’initiative « #No_Bilangue », il ne devrait plus y avoir qu’une seule langue nationale : le français. De nombreux Suisses alémaniques sont donc en crise. Dont Walter Egli, 56 ans, qui travaille pour la police fédérale et doit veiller à ce que le passage au monolinguisme se fasse correctement. Bien qu’il ne parle pratiquement pas le français lui-même, il est envoyé au #Tessin avec un partenaire romand pour découvrir un groupe de résistance tessinois qui lutte par tous les moyens contre la nouvelle loi.

  • À Strasbourg, l’Europe intensifie discrètement le fichage des migrants

    Dans un bâtiment discret, 350 personnes travaillent à renforcer le #contrôle et le #suivi des personnes entrant dans l’#espace_Schengen. Reportage dans l’agence de l’Union européenne qui renforce le fichage des migrants.

    Dans le quartier du Neuhof à Strasbourg, un bâtiment hautement sécurisé attire l’œil. Dissimulée derrière le gymnase du Stockfeld et entourée de terrains vagues, l’#agence_européenne #eu-Lisa est protégée par deux lignes barbelées surplombées de caméras. Aux alentours du bâtiment, les agents de sécurité portent au cœur un petit drapeau bleu aux douze étoiles. Des véhicules immatriculés en France, au Luxembourg, en Belgique et en Allemagne stationnent sur le parking.

    Créée en 2011 et opérationnelle depuis 2012, l’#agence_européenne_pour_la_gestion_opérationnelle_des_systèmes_d’information à grande échelle eu-Lisa développe et fait fonctionner les #bases_de_données de l’Union européenne (UE). Ces dernières permettent d’archiver les #empreintes_digitales des demandeurs et demandeuses d’asile mais aussi les demandes de visa ou les alertes de personnes portées disparues.

    Le siège d’eu-Lisa est à Tallinn, en Estonie. Un bureau de liaison se trouve à Bruxelles et son centre opérationnel a été construit à Strasbourg. Lundi 26 février, le ministre délégué aux affaires européennes, Jean-Noël Barrot, est venu visiter l’endroit, où sont développés les nouveaux systèmes de suivi et de #filtrage des personnes migrantes et des voyageurs et voyageuses non européen·nes. Le « cœur de Schengen », selon la communication de l’agence.

    Sur les écrans de contrôle, des ingénieur·es suivent les requêtes adressées par les États membres aux différents #systèmes_d’information_opérationnels. L’un d’eux raconte que le nombre de cyberattaques subies par l’agence est colossal : 500 000 tentatives par mois environ. La quantité de données gérées est aussi impressionnante : en 2022, le système #VIS (#Visa_Information_System) a enregistré 57 millions de demandes de #visas et 52 millions d’empreintes digitales. La même année, 86,5 millions d’alertes ont été transmises au système #SIS (#Schengen_Information_System).

    Dans l’agence du Neuhof, une vingtaine de nationalités sont représentées parmi les 350 travailleurs et travailleuses. En tout, 500 mètres carrés sécurisés abritent les données confidentielles de dizaines de millions de personnes. 2 500 ordinateurs fonctionnent en permanence pour une capacité de stockage de 13 petabytes, soit 13 milliards de gigabytes. Vingt-quatre heures sur vingt-quatre et sept jours sur sept, l’eu-Lisa répond aux demandes de données des pays membres de l’espace Schengen ou de l’Union européenne.

    Traduire la politique en #technologie

    Au-delà de la salle de réunion, impossible de photographier les murs ou l’environnement de travail. L’enclave européenne est sous haute surveillance : pour entrer, les empreintes digitales sont relevées après un passage des sacs au scanner. Un badge connecté aux empreintes permet de passer un premier sas d’entrée. Au-delà, les responsables de la sécurité suivent les visiteurs de très près, au milieu d’un environnement violet et vert parsemé de plantes de toutes formes.

    Moins de six mois avant le début des Jeux olympiques et paralympiques de Paris et deux mois après l’accord européen relatif au Pacte sur la migration et l’asile, l’agence aux 260 millions d’euros de budget en 2024 travaille à mettre en place le système de contrôle des flux de personnes le plus précis, efficace et complet de l’histoire de l’espace Schengen. Le pacte prévoit, par exemple, que la demande d’asile soit uniformisée à travers l’UE et que les « migrants illégaux » soient reconduits plus vite et plus efficacement aux frontières.

    Pour accueillir le ministre, #Agnès_Diallo, directrice de l’eu-Lisa depuis 2023, diffuse une petite vidéo en anglais dans une salle de réunion immaculée. L’ancienne cadre de l’entreprise de services numériques #Atos présente une « agence discrète » au service de la justice et des affaires intérieures européennes. À l’eu-Lisa, pas de considération politique. « Notre agence a été créée par des règlements européens et nous agissons dans ce cadre, résume-t-elle. Nous remplaçons les frontières physiques par des #frontières_numériques. Nous travaillons à laisser passer dans l’espace Schengen les migrants et voyageurs qui sont légitimes et à filtrer ceux qui le sont moins. »

    L’eu-Lisa invente, améliore et fait fonctionner les sept outils informatiques utilisés en réseau par les États membres et leurs institutions. L’agence s’assure notamment que les données sont protégées. Elle forme aussi les personnes qui utiliseront les interfaces, comme les agents de #Frontex, d’#Europol ou de la #police_aux_frontières. Au Neuhof, les personnes qui travaillent n’utilisent pas les informations qu’elles stockent.

    Fichés dès l’âge de 6 ans

    L’agence eu-Lisa héberge les empreintes digitales de 7,5 millions de demandeurs et demandeuses d’asile et « migrants illégaux » dans le système appelé Eurodac. Pour le moment, les données récoltées ne sont pas liées à l’identité de la personne ni à sa photo. Mais avec l’adoption des nouvelles règles relatives au statut de réfugié·e en Europe, Eurodac est en train d’être complètement refondé pour être opérationnel en 2026.

    La réforme décidée en décembre 2023 prévoit que les demandeurs d’asile et « migrants illégaux » devront fournir d’autres informations biométriques : en plus de leurs empreintes, leur photo, leur nom, prénom et date et lieu de naissance seront enregistrés lors de leur entrée dans Schengen. La procédure vaudra pour toute personne dès l’âge de 6 ans (contre 14 avant la réforme). Les #données qui étaient conservées pour dix-huit mois pourront l’être jusqu’à cinq ans.

    La quantité d’informations stockées va donc croître exponentiellement dès 2026. « Nous aurons énormément de données pour #tracer les mouvements des migrants irréguliers et des demandeurs d’asile », se félicite #Lorenzo_Rinaldi, l’un des cadres de l’agence venant tout droit de Tallinn. Eurodac permettra à n’importe quelle autorité policière habilitée de savoir très précisément par quel pays est arrivée une personne, ainsi que son statut administratif.

    Il sera donc impossible de demander une protection internationale dans un pays, puis de s’installer dans un autre, ou de demander une seconde fois l’asile dans un pays européen. Lorenzo Rinaldi explique : « Aujourd’hui, il nous manque la grande image des mouvements de personnes entre les États membres. On pourra identifier les tendances, recouper les données et simplifier l’#identification des personnes. »

    Pour identifier les itinéraires et contrôler les mouvements de personnes dans l’espace Schengen, l’agence travaille aussi à ce que les sept systèmes d’information fonctionnent ensemble. « Nous avions des bases de données, nous aurons désormais un système complet de gestion de ces informations », se réjouit Agnès Diallo.

    L’eu-Lisa crée donc également un système de #traçage des entrées et des sorties de l’espace Schengen, sobrement appelé #Entry-Exit_System (ou #EES). Développé à l’initiative de la France dès 2017, il remplace par une #trace_numérique le tamponnage physique des passeports par les gardes-frontières. Il permet notamment de détecter les personnes qui restent dans Schengen, après que leur visa a expiré – les #overstayers, celles qui restent trop longtemps.

    Frontières et Jeux olympiques

    « Toutes nos équipes sont mobilisées pour faire fonctionner le système EES [entrées-sorties de l’espace Schengen – ndlr] d’ici à la fin de l’année 2024 », précise Agnès Diallo. Devant le Sénat en 2023, la directrice exécutive avait assuré que l’EES ne serait pas mis en place pendant les Jeux olympiques et paralympiques si son influence était négative sur l’événement, par exemple s’il ralentissait trop le travail aux frontières.

    En France et dans onze autres pays, le système EES est testé depuis janvier 2024. L’agence estime qu’il sera prêt pour juillet 2024, comme l’affirme Lorenzo Rinaldi, chef de l’unité chargé du soutien à la direction et aux relations avec les partenaires de l’eu-Lisa : « Lorsqu’une personne non européenne arrive dans Schengen, elle devra donner à deux reprises ses #données_biométriques. Donc ça sera plus long la première fois qu’elle viendra sur le territoire, mais ses données seront conservées trois ans. Les fois suivantes, lorsque ses données seront déjà connues, le passage sera rapide. »

    Ce système est prévu pour fonctionner de concert avec un autre petit nouveau, appelé #Etias, qui devrait être opérationnel d’ici au premier semestre de 2025. Les personnes qui n’ont pas d’obligation d’avoir de visa pour entrer dans 30 pays européens devront faire une demande avant de venir pour un court séjour – comme lorsqu’un·e citoyen·ne français·e demande une autorisation électronique de voyage pour entrer aux États-Unis ou au Canada. La procédure, en ligne, sera facturée 7 euros aux voyageurs et voyageuses, et l’autorisation sera valable trois ans.

    L’eu-Lisa gère enfin le #système_d’information_Schengen (le #SIS, qui gère les alertes sur les personnes et objets recherchés ou disparus), le système d’information sur les visas (#VIS), la base de données des #casiers_judiciaires (#Ecris-TCN) et le #Codex pour la #coopération_judiciaire entre États membres.

    L’agence travaille notamment à mettre en place une communication par Internet entre ces différents systèmes. Pour Agnès Diallo, cette nouveauté permettra une coordination sans précédent des agents aux frontières et des institutions judiciaires nationales et européennes dans les 27 pays de l’espace Schengen.

    « On pourra suivre les migrants, réguliers et irréguliers », se félicite Fabienne Keller, députée européenne Renew et fervente défenseuse du Pacte sur les migrations. Pour la mise en place de tous ces outils, l’agence eu-Lisa devra former les États membres mais également les transporteurs et les voyageurs et voyageuses. L’ensemble de ces systèmes devrait être opérationnel d’ici à la fin 2026.

  • Faudrait vraiment que des devs d’App mobile et surtout les direct·rices·eurs des sites qui les produisent, se mettent en tête qu’ il n’y a pas que l’Apple Store et le Google Play dans la vie .
    Pour les Android-like, il faudrait systématiquement diffuser le .apk directement sur leur site (avec le hash accompagnant), ou mettre leur fichier sur des store comme F-Droid (à condition d’etre un logiciel libre ou open source, ce qui n’est pas impossible).

    Et pour finir, c’est un peu finito les App mobile. #Firefox OS avait tenté sans être suivi en 2013, mais maintenant, c’est reparti, on parle de Progressive Web App . C’est juste un site web hautement « progressive », c’est une bonne façon de faire des App (surtout si c’est pour avoir 3 boutons et 2 champs de saisie. Pas besoin de sortir #Xamarin pour si peu.)

    Je pense en particulier à tous ces sites d’état ou « officiels », genre La Poste et leur clic. Parce tu ne pourras bientôt plus aller chez le toubib sans un smartphone connecté à Google. Et si vous ne voyez pas vers quoi ca tent... ba je sais pas, lisez.

  • La filiera della lana “senza frontiere” dell’arco alpino

    La lana, che in passato era merce preziosa capace di stimolare e alimentare l’economia locale, ha perso negli ultimi decenni il suo valore a causa della concorrenza internazionale. Oltre a non essere utilizzata per produrre filato, la lana deve essere smaltita, secondo le norme europee, come rifiuto speciale. Non solo non produce benessere e ricchezza, ma è diventata nel tempo un enorme problema per i pastori.

    Per contrastare questo fenomeno è partito da pochi mesi, il progetto #Alptextiles, nel tentativo di ricostruire a livello transnazionale la filiera tessile, partendo proprio dalla lana. Promosso dall’archivio di Etnografia e Storia Sociale di Regione Lombardia con diversi partners europei quali scuole, musei e università di Italia, Svizzera, Austria, Germania, Francia e Slovenia, il progetto punta prima di tutto a mettere in relazione le diverse realtà legate alla filiera della lana.

    I fili prodotti in Italia, e in particolare in #Val_Camonica incontreranno quelli dell’Austria del #Montafon, sui telai di tessitura della #Valposchiavo, per creare un nuovo tessuto.
