• Border security with drones and databases

    The EU’s borders are increasingly militarised, with hundreds of millions of euros paid to state agencies and military, security and IT companies for surveillance, patrols and apprehension and detention. This process has massive human cost, and politicians are planning to intensify it.

    Europe is ringed by steel fences topped by barbed wire; patrolled by border agents equipped with thermal vision systems, heartbeat detectors, guns and batons; and watched from the skies by drones, helicopters and planes. Anyone who enters is supposed to have their fingerprints and photograph taken for inclusion in an enormous biometric database. Constant additions to this technological arsenal are under development, backed by generous amounts of public funding. Three decades after the fall of the Berlin Wall, there are more walls than ever at Europe’s borders,[1] and those borders stretch ever further in and out of its territory. This situation is the result of long-term political and corporate efforts to toughen up border surveillance and controls.

    The implications for those travelling to the EU depend on whether they belong to the majority entering in a “regular” manner, with the necessary paperwork and permissions, or are unable to obtain that paperwork, and cross borders irregularly. Those with permission must hand over increasing amounts of personal data. The increasing automation of borders is reliant on the collection of sensitive personal data and the use of algorithms, machine learning and other forms of so-called artificial intelligence to determine whether or not an individual poses a threat.

    Those without permission to enter the EU – a category that includes almost any refugee, with the notable exception of those who hold a Ukrainian passport – are faced with technology, personnel and policies designed to make journeys increasingly difficult, and thus increasingly dangerous. The reliance on smugglers is a result of the insistence on keeping people in need out at any cost – and the cost is substantial. Thousands of people die at Europe’s borders every year, families are separated, and people suffer serious physical and psychological harm as a result of those journeys and subsequent administrative detention and social marginalisation. Yet parties of all political stripes remain committed to the same harmful and dangerous policies – many of which are being worsened through the new Pact on Migration and Asylum.[2]

    The EU’s border agency, Frontex, based in Warsaw, was first set up in 2004 with the aim of providing technical coordination between EU member states’ border guards. Its remit has been gradually expanded. Following the “migration crisis” of 2015 and 2016, extensive new powers were granted to the agency. As the Max Planck Institute has noted, the 2016 law shifted the agency from a playing “support role” to acting as “a player in its own right that fulfils a regulatory, supervisory, and operational role.”[3] New tasks granted to the agency included coordinating deportations of rejected refugees and migrants, data analysis and exchange, border surveillance, and technology research and development. A further legal upgrade in 2019 introduced even more extensive powers, in particular in relation to deportations, and cooperation with and operations in third countries.

    The uniforms, guns and batons wielded by Frontex’s border guards are self-evidently militaristic in nature, as are other aspects of its work: surveillance drones have been acquired from Israeli military companies, and the agency deploys “mobile radars and thermal cameras mounted on vehicles, as well as heartbeat detectors and CO2 monitors used to detect signs of people concealed inside vehicles.”[4] One investigation described the companies that have held lobbying meetings or attended events with Frontex as “a Who’s Who of the weapons industry,” with guests including Airbus, BAE Systems, Leonardo and Thales.[5] The information acquired from the agency’s surveillance and field operations is combined with data provided by EU and third country agencies, and fed into the European Border Surveillance System, EUROSUR. This offers a God’s-eye overview of the situation at Europe’s borders and beyond – the system also claims to provide “pre-frontier situational awareness.”

    The EU and its member states also fund research and development on these technologies. From 2014 to 2022, 49 research projects were provided with a total of almost €275 million to investigate new border technologies, including swarms of autonomous drones for border surveillance, and systems that aim to use artificial intelligence to integrate and analyse data from drones, satellites, cameras, sensors and elsewhere for “analysis of potential threats” and “detection of illegal activities.”[6] Amongst the top recipients of funding have been large research institutes – for example, Germany’s Fraunhofer Institute – but companies such as Leonardo, Smiths Detection, Engineering – Ingegneria Informatica and Veridos have also been significant beneficiaries.[7]

    This is only a tiny fraction of the funds available for strengthening the EU’s border regime. A 2022 study found that between 2015 and 2020, €7.7 billion had been spent on the EU’s borders and “the biggest parts of this budget come from European funding” – that is, the EU’s own budget. The total value of the budgets that provide funds for asylum, migration and border control between 2021-27 comes to over €113 billion[8]. Proposals for the next round of budgets from 2028 until 2035 are likely to be even larger.

    Cooperation between the EU, its member states and third countries on migration control comes in a variety of forms: diplomacy, short and long-term projects, formal agreements and operational deployments. Whatever form it takes, it is frequently extremely harmful. For example, to try to reduce the number of people arriving across the Mediterranean, member states have withdrawn national sea rescue assets (as deployed, for example, in Italy’s Mare Nostrum operation) whilst increasing aerial surveillance, such as that provided by the Israel-produced drones operated by Frontex. This makes it possible to observe refugees attempting to cross the Mediterranean, whilst outsourcing their interception to authorities from countries such as Libya, Tunisia and Egypt.

    This is part of an ongoing plan “to strengthen coordination of search and rescue capacities and border surveillance at sea and land borders” of those countries. [9] Cooperation with Tunisia includes refitting search and rescue vessels and providing vehicles and equipment to the Tunisian coastguard and navy, along with substantial amounts of funding. The agreement with Egypt appears to be structured along similar lines, and five vessels have been provided to the so-called Libyan Coast Guard in 2023.[10]

    Frontex also plays a key role in the EU’s externalised border controls. The 2016 reform allowed Frontex deployments at countries bordering the EU, and the 2019 reform allowed deployments anywhere in the world, subject to agreement with the state in question. There are now EU border guards stationed in Albania, Montenegro, Serbia, Bosnia and Herzegovina, and North Macedonia.[11] The agency is seeking agreements with Niger, Senegal and Morocco, and has recently received visits from Tunisian and Egyptian officials with a view to stepping up cooperation.[12]

    In a recent report for the organisation EuroMed Rights, Antonella Napolitano highlighted “a new element” in the EU’s externalisation strategy: “the use of EU funds – including development aid – to outsource surveillance technologies that are used to entrench political control both on people on the move and local population.” Five means of doing so have been identified: provision of equipment; training; financing operations and procurement; facilitating exports by industry; and promoting legislation that enables surveillance.[13]

    The report highlights Frontex’s extended role which, even without agreements allowing deployments on foreign territory, has seen the agency support the creation of “risk analysis cells” in a number of African states, used to gather and analyse data on migration movements. The EU has also funded intelligence training in Algeria, digital evidence capacity building in Egypt, border control initiatives in Libya, and the provision of surveillance technology to Morocco. The European Ombudsman has found that insufficient attention has been given to the potential human rights impacts of this kind of cooperation.[14]

    While the EU and its member states may provide the funds for the acquisition of new technologies, or the construction of new border control systems, information on the companies that receive the contracts is not necessarily publicly available. Funds awarded to third countries will be spent in accordance with those countries’ procurement rules, which may not be as transparent as those in the EU. Indeed, the acquisition of information on the externalisation in third countries is far from simple, as a Statewatch investigation published in March 2023 found.[15]

    While EU and member state institutions are clearly committed to continuing with plans to strengthen border controls, there is a plethora of organisations, initiatives, campaigns and projects in Europe, Africa and elsewhere that are calling for a different approach. One major opportunity to call for change in the years to come will revolve around proposals for the EU’s new budgets in the 2028-35 period. The European Commission is likely to propose pouring billions more euros into borders – but there are many alternative uses of that money that would be more positive and productive. The challenge will be in creating enough political pressure to make that happen.

    Frontex has shared locations of migrant boats with Libya’s coast guard more than 2,000 times in three years – despite watching them whip, beat and shoot at passengers

    It has long been known that European countries provide support and funding to the Libyan Coast Guard to carry out a controversial mission: intercepting Europe-bound migrants whom EU member states and agencies cannot apprehend directly without breaching international laws.

    Numerous media and NGO reports have detailed the abuse and violence practised by the Libyan Coast Guard against migrants during sea interception and inside the detention centres they are taken to after being brought back to Libya.

    Lighthouse Reports has previously established suspicious patterns of collaboration between EU border agency Frontex and the Libyan Coast Guard, including direct links between Frontex aerial assets spotting boats and their subsequent interception by the coast guard.

    Despite the reports of abuse and torture, Frontex has withheld public criticism of the Libyan Coast Guard. And until now, the extent to which Frontex has shared information with the coast guard, and its internal knowledge of the abuse migrants face after they are intercepted, was unknown.
    METHODS

    Following the publication of Lighthouse investigation Frontex and the Pirate Ship in December, the EU Committee on Civil Liberties, Justice and Home Affairs (LIBE) sent a letter to Frontex Executive Director Hans Leijtens questioning the agency’s collaboration with Libyan actors, including militia, in eastern and western Libya.

    Lighthouse Reports and Der Spiegel gained access to the director’s response to the LIBE Committee’s questions. The email included all Serious Incident Reports (SIRs) relating to the Libyan Coast Guard.
    STORYLINES

    The SIRs reveal three incidents of Frontex aerial surveillance assets witnessing Libyan Coast Guard officers beating people in overcrowded boats at sea. In a separate incident, the agency’s surveillance drone recorded a Libyan officer shooting at a wooden boat to force it to stop.

    The letter from Leitjens meanwhile reveals that Frontex gave away the location of migrant boats to the Libyan Coast Guard approximately 2,200 times, usually via email, in the last three years – despite being aware of the regular instances of violence they commit.

    When confronted with these facts by our team, Frontex said: “The decision to share information about vessels in distress with the Libyan rescue coordination centre, alongside other national centres, is taken with a heavy heart”

    The SIRs contain parts of Frontex’s human rights officer’s recommendations for the agency. The measures proposed range from increasing the sharing of coordinates with NGO rescue ships to involving UN agencies in following the fates of those returned to Libya. Frontex did not comment on whether these recommendations were implemented.

  • How an EU-funded security force helped Senegal crush democracy protests

    An elite EU-trained Senegalese police unit was meant to tackle cross-border crime. Instead it was used to quash a popular movement, an Al Jazeera investigation has found.

    The Senegalese government deployed a special counterterrorism unit, created, equipped, and trained with funding from the European Union, to violently suppress recent pro-democracy protests, a joint investigation between Al Jazeera and porCausa Foundation reveals.

    Since 2021, the trial of popular and controversial opposition leader #Ousmane_Sonko has led to demonstrations across the West African nation, in which dozens have been killed. Al Jazeera and porCausa obtained visual evidence, Spanish government contracts, a confidential evaluation report, and testimonies from multiple sources suggesting that the EU-funded #Rapid_Action_Surveillance_and_Intervention_Group, also known as #GAR-SI, was used to violently crush those protests.

    In one video, security personnel in the same type of armoured vehicles the EU bought for #GAR-SI_Senegal are seen firing tear gas at a protest caravan organised by Sonko last May. Al Jazeera verified that the incident happened in the southern Senegalese village of #Mampatim, about 50km (31 miles) from Kolda, in the Casamance region.

    The EU-funded elite units were instead meant to be based in Senegal’s border areas with Mali to fight cross-border crime.

    Elite unit

    #GAR-SI_Sahel was a regional project lasting between 2016 and 2023 and funded with 75 million euros ($81.3m) from the EU’s Emergency Trust Fund for Africa (#EUTF_for_Africa), a pot of development funding dedicated to addressing the root causes of migration in Africa.

    The programme was implemented by the #International_and_Ibero-American_Foundation_for_Administration_and_Public_Policies (#FIIAPP), a development agency belonging to Spain’s Ministry of Foreign Affairs. GAR-SI units were created across the region, in countries like Burkina Faso, Chad, Mali, Mauritania, Niger and Senegal, “as a prerequisite for their sustainable socio-economic development”.

    The Senegalese 300-strong unit, created in 2017, cost more than 7 million euros ($7.6m at the current exchange rate) and was aimed at creating a special intervention unit in the town of #Kidira, on the border of Mali, to protect Senegal from potential incursions by armed groups and cross-border crimes, including migrant smuggling.

    Modelled after Spanish units that fought against the separatist movement Basque Homeland and Liberty, also known by the Spanish initials ETA, GAR-SI Senegal has received technical training and mentoring from the Spanish Civil Guard as well as French, Italian and Portuguese security forces.

    After the completion of the project, at the request of all stakeholders, the EU delegation in Senegal continued with a second phase using another funding mechanism, according to one Spanish and one Senegalese police source familiar with the matter. About 4.5 million euros ($4.9m) was earmarked for a second 250-strong GAR-SI Senegal unit near the town of Saraya, close to the border with Guinea and Mali.

    A second unit was also created in Mali but for other countries, especially Chad, the project was considered to be a “failure”, according to the former Senegalese police official, who said the EU lost money by paying for equipment that was not appropriate for use.

  • Comment l’UE a fermé les yeux sur le refoulement illégal de migrants par la #Bulgarie avant son adhésion à Schengen

    Des documents internes de Frontex révèlent des violations répétées. Malgré des alertes répétées, la Commission européenne salue les « résultats excellents » de la Bulgarie, qui s’apprête à rejoindre l’espace Schengen.

    Au printemps 2022, Ali, un Syrien de 16 ans, entre dans un centre d’accueil à Sofia (Bulgarie) pour demander une protection au titre de l’asile et un regroupement familial avec sa mère et ses cinq autres frères et sœurs, restés en Syrie et au Liban.

    Mais les choses ne se passent pas comme prévu. Au lieu de voir sa demande traitée, il est emmené dans un endroit qui, dit-il, « ressemble à une prison ». Pendant la nuit, comme une cinquantaine d’autres personnes, il est embarqué dans une voiture de la police des frontières et reconduit jusqu’à la frontière turque, à 300 kilomètres de là, sans recevoir la moindre information sur ses droits à l’asile.

    « Ils nous ont fait marcher jusqu’à une #clôture équipée de caméras. Après avoir franchi la clôture, il y avait comme un canal. En même temps, ils frappaient les gens, se remémore le garçon. Ils ont tout pris et m’ont frappé dans le dos, sur la tête. Après cela, ils m’ont jeté dans le canal. » Le groupe est invité à retourner en #Turquie et ne jamais revenir.

    Les refoulements, une « pratique courante »

    Les témoignages de refoulements (ou pushbacks, en anglais) comme celui d’Ali sont généralement réfutés par le gouvernement bulgare. Mais de nombreux abus ont été documentés par l’organe de surveillance des droits humains de Frontex au cours des dix-huit derniers mois, selon une série de documents internes de l’agence européenne de garde-frontières et de garde-côtes consultés par le réseau Balkan Investigative Reporting Network (BIRN) et publiés par Le Monde. Ces documents, obtenus grâce aux lois de transparence européennes, décrivent avec force détails des #brutalités commises par des agents bulgares participant aux opérations de Frontex : coups de bâton, #déshabillage de force, #vols d’effets personnels, #agressions verbales et #blessures graves infligées par des chiens, etc.

    Les documents montrent également que les preuves étayant ces pratiques illégales ont été dissimulées non seulement par les autorités bulgares, mais aussi par les hauts fonctionnaires de Frontex et de la Commission européenne. Dans le même temps, l’exécutif européen saluait les « excellents » progrès réalisés par la Bulgarie en matière de #gestion_des_frontières, facilitant l’adhésion du pays à l’espace Schengen – les contrôles aux frontières aériennes et maritimes seront levés le 31 mars, tandis que les contrôles terrestres restent en place pour l’instant.

    Les organisations non gouvernementales (ONG) de défense des droits humains locales et internationales alertent depuis de nombreuses années sur les refoulements violents en Bulgarie. Selon des données compilées par le Comité Helsinki de Bulgarie, 5 268 refoulements, touchant 87 647 personnes, auraient eu lieu au cours de la seule année 2022.

    Plusieurs experts affirment que la plupart des 325 000 entrées de migrants que le gouvernement bulgare revendique avoir « empêchées » depuis 2022 sont en fait des refoulements illégaux. « Ces personnes ont été interceptées à l’intérieur du pays. Nous ne parlons donc pas d’entrées empêchées, mais de retours », explique Iliyana Savova, directrice du programme pour les réfugiés et les migrants du Comité Helsinki de Bulgarie. « C’est un secret de Polichinelle que les gens sont repoussés. De tels ordres existent », admet, sous le couvert de l’anonymat, un haut fonctionnaire du gouvernement bulgare.

    Les preuves s’accumulent tellement que le Bureau des droits fondamentaux de Frontex (FRO) considère « établi » que les refoulements, « impliquant souvent des niveaux élevés de #violence et d’autres #traitements_inhumains_ou_dégradants », sont « une pratique régulière de la police des frontières bulgare », selon un bilan des « rapports d’incidents graves » couvrant la période 2022-2023 obtenu dans le cadre de cette enquête.

    Un lanceur d’alerte en mission discrète

    Pour l’Union européenne (UE), la situation est d’autant plus problématique que son agence des frontières collabore directement sur le terrain avec les forces de sécurité bulgares. Depuis 2022, dans le cadre de l’opération conjointe #Terra, Frontex a déployé des équipes de #gardes-frontières, des véhicules de patrouille et des #caméras_de_thermovision pour aider les autorités bulgares dans leurs activités de #surveillance aux frontières turque et serbe.

    En août 2022, un #rapport inquiétant atterrit sur le bureau de Jonas Grimheden, le chef du FRO. Il émane d’un agent de Frontex qui a mené une enquête de sa propre initiative lors d’un déploiement de six mois à la frontière avec la Turquie. Il révèle que les agents de Frontex sont tenus intentionnellement à l’écart des zones où les migrants sont généralement appréhendés et repoussés. « Lorsque des situations se produisent, le collègue local reçoit les indications pour déplacer l’équipe Frontex, en évitant certaines zones, note le lanceur d’alerte. Ils ont pour instruction d’empêcher Frontex de voir quoi que ce soit, pour éviter qu’ils rédigent un rapport officiel. »

    Pour l’eurodéputée écologiste Tineke Strik, cheffe de file d’un groupe d’eurodéputés chargé de surveiller Frontex, ces conclusions soulèvent de sérieux doutes quant à la capacité de l’agence à garantir le respect des droits humains dans le cadre de ses activités : « Il est étonnant qu’une agence de l’UE soit toujours incapable de faire respecter le droit européen après tant d’enquêtes institutionnelles, de rapports, de recommandations et d’avertissements. »

    Dans les mois qui suivent le rapport du lanceur d’alerte, Jonas Grimheden fait part de ses préoccupations croissantes concernant la conduite des agents frontaliers bulgares aux échelons supérieurs de Frontex, dont le siège se trouve à Varsovie.

    L’agence s’attache alors à restaurer sa réputation, ternie par la révélation de sa complicité dans les refoulements illégaux de migrants en Grèce. En avril 2022, son directeur, Fabrice Leggeri – qui vient de rallier le Rassemblement national en vue des élections européennes –, a été contraint de démissionner après avoir été reconnu coupable par l’Office européen de lutte antifraude d’avoir dissimulé des refoulements de bateaux de migrants en mer Egée.

    Aija Kalnaja, qui lui a succédé à la direction de Frontex pour un court intérim, semble prendre les avertissements du FRO au sérieux. En février 2023, elle exprime de « vives inquiétudes » dans une lettre adressée à Rositsa Dimitrova, alors cheffe de la direction des frontières bulgare, recommandant aux autorités du pays d’accorder au corps permanent de l’agence l’accès aux « contrôles de première ligne et aux activités de surveillance des frontières ».

    Dans sa réponse, #Rositsa_Dimitrova assure que « le respect des droits fondamentaux des ressortissants de pays tiers est une priorité absolue ». Disposée à organiser des séances d’information et des formations à l’intention de ses gardes-frontières, la responsable bulgare explique que chaque violation présumée des droits est examinée par une commission constituée par ses soins. Insuffisant, pour le FRO, qui préférerait un contrôle rigoureux par un « organisme indépendant opérant en dehors de la structure institutionnelle du ministère de l’intérieur bulgare ». Cinq agents ont été sanctionnés pour avoir violé leur code de conduite éthique au cours des dix premiers mois de 2023, précise aujourd’hui le ministère de l’intérieur bulgare.

    Une lettre jamais envoyée

    Au début de 2023, le Néerlandais Hans Leijtens est nommé à la tête de Frontex. On peut alors s’attendre à ce que ce nouveau directeur, engagé publiquement en faveur de la « responsabilité, du respect des droits fondamentaux et de la transparence », adopte une position ferme à l’égard des autorités bulgares. « Ce sont des pratiques du passé », déclare-t-il après sa nomination, en référence aux antécédents de Frontex en matière d’aide aux refoulements en Grèce.

    Soucieux de saisir l’occasion, Jonas Grimheden, à la tête du FRO, lui écrit deux jours après sa prise de fonctions, en mars 2023. Le courriel contient un projet de lettre « que vous pouvez envisager d’envoyer, en tout ou en partie », à Rositsa Dimitrova. La lettre rappelle les « allégations persistantes de retours irréguliers (appelés “refoulements”), accompagnées de graves allégations de #mauvais_traitements et d’#usage_excessif_de_la_force par la police nationale des frontières à l’encontre des migrants » et demande des enquêtes indépendantes sur les violations des droits. Ce brouillon de lettre n’a jamais quitté la boîte de réception d’Hans Leijtens.

    Quelques semaines plus tard, en mars 2023, le #FRO envoie un rapport officiel au conseil d’administration de Frontex, évoquant le « risque que l’agence soit indirectement impliquée dans des violations des droits fondamentaux sans avoir la possibilité de recueillir toutes les informations pertinentes et d’empêcher ces violations de se produire ».

    M. Leijtens a-t-il fait part aux autorités bulgares des conclusions du FRO ? Sollicité, le service de presse de Frontex explique que « les discussions directes ont été jugées plus efficaces », sans pouvoir divulguer « les détails spécifiques des discussions ».

    Une contrepartie pour Schengen ?

    Alors que ce bras de fer se joue en coulisses, sur la scène politique, la Bulgarie est érigée en élève modèle pour le programme de contrôle des migrations de la Commission européenne, et récompensée pour le durcissement de ses #contrôles_frontaliers, en contrepartie de l’avancement de sa candidature à l’entrée dans l’espace Schengen.

    En mars 2023, la présidente de la Commission européenne, Ursula von der Leyen, annonce un #projet_pilote visant à « prévenir les arrivées irrégulières » et à « renforcer la gestion des frontières et des migrations », notamment par le biais de « #procédures_d’asile_accélérées » et d’#expulsions_rapides des migrants indésirables. La Commission sélectionne deux pays « volontaires » : la #Roumanie et la Bulgarie.

    Pour mettre en œuvre le projet, la Commission accorde à la Bulgarie 69,5 millions d’euros de #fonds_européens, principalement destinés à la surveillance de sa frontière avec la Turquie. « Toutes les activités menées dans le cadre de ce projet pilote doivent l’être dans le plein respect de la législation de l’UE et des droits fondamentaux, en particulier du principe de non-refoulement », précise d’emblée la Commission.

    Pourtant, à ce moment-là, l’exécutif bruxellois est parfaitement conscient de la situation désastreuse des droits humains sur le terrain. Deux mois avant le lancement du projet, en janvier 2023, deux hauts fonctionnaires de la direction des affaires intérieures (DG Home) ont rencontré à Stockholm la patronne des gardes-frontières bulgares « pour discuter des préoccupations du FRO concernant les allégations de #violations_des_droits_fondamentaux », révèle un compte rendu de la réunion.

    Au fil de l’avancement du projet pilote, les signaux d’alerte se multiplient. En septembre 2023, Jonas Grimheden alerte une nouvelle fois le conseil d’administration de Frontex sur des « allégations répétées de (…) refoulements et d’usage excessif de la force » par les agents bulgares. Si son rapport salue la participation des agents de Frontex aux « activités de patrouille terrestre de première ligne », il rappelle que ces derniers « continuent d’être impliqués dans un nombre limité d’interceptions » de migrants.

    Au cours du projet, deux documents sur les « droits fondamentaux » aux frontières extérieures de la Bulgarie ont circulé au sein de la DG Home. La Commission européenne a refusé de les communiquer au BIRN, arguant que leur divulgation mettrait en péril la « confiance mutuelle » avec le gouvernement bulgare.

    « Les résultats sont excellents »

    La participation de la Bulgarie au projet pilote de la Commission semble avoir joué un rôle crucial pour faire avancer son projet de rejoindre Schengen – un objectif prioritaire depuis plus d’une décennie. Il coïncide en tout cas avec un changement de ton très net du côté de Bruxelles et Varsovie, qui ont dès lors largement balayé les inquiétudes concernant les mauvais traitements infligés à grande échelle aux migrants.

    « Les résultats sont excellents », annonce Ylva Johansson lors d’une conférence de presse en octobre 2023. La commissaire européenne aux affaires intérieures, chargée des migrations, salue les efforts déployés par la Bulgarie pour empêcher les migrants « irréguliers » d’entrer sur le territoire de l’UE, appelant à prendre la « décision absolument nécessaire » d’admettre la Bulgarie dans l’espace Schengen. Cette décision est alors bloquée depuis des mois par les Pays-Bas et l’Autriche, qui exigent des contrôles plus stricts à la frontière terrestre avec la Turquie. Quelques semaines auparavant, Ursula von der Leyen avait salué la Bulgarie, qui « montre la voie à suivre en mettant en avant les meilleures pratiques en matière d’asile et de retour ». « Faisons-les enfin entrer, sans plus attendre », avait réclamé la présidente de la Commission.

    Selon Diana Radoslavova, directrice du Centre pour le soutien juridique, une ONG sise à Sofia, la fermeture effective de la frontière avec la Turquie est indispensable à l’entrée de la Bulgarie dans l’espace Schengen. « [Les autorités] sont prêtes à tout pour respecter cette injonction, y compris au prix de violations extrêmes des droits de l’homme », estime l’avocate. « Tant que la Bulgarie coopère en bonne intelligence avec la protection des frontières et la mise en œuvre du projet pilote, la Commission regarde ailleurs », ajoute l’eurodéputée Tineke Strik.

    Pour défendre la candidature de Sofia à l’espace Schengen, la Commission européenne s’est appuyée sur le rapport d’une mission d’enquête rassemblant les experts de plusieurs agences de l’UE et des Etats membres, dépêchés en novembre 2023 en Bulgarie pour évaluer son état de préparation à l’adhésion. La mission n’aurait trouvé aucune preuve de violation des obligations en matière de droits humains prévues par les règles européennes, y compris en ce qui concerne « le respect du principe de non-refoulement et l’accès à la protection internationale ».

    Ce rapport n’a pas dissipé les inquiétudes de Jonas Grimheden, qui affirme que ses services font encore « régulièrement » part de leurs « préoccupations » au conseil d’administration de Frontex, « auquel participe la Commission européenne ».
    Cette enquête a été produite en collaboration avec le réseau Balkan Investigative Reporting Network (BIRN), qui a reçu un soutien financier de la Fondation Heinrich-Böll. Son contenu relève de la seule responsabilité des auteurs et ne représente pas les points de vue et les opinions de la fondation.

    La réponse de Frontex et de la Commission européenne

    Un porte-parole de Frontex déclare que l’agence prend « très au sérieux » les « préoccupations concernant les refoulements ». « Dans les cas où des violations sont signalées, la question est transmise au directeur exécutif et, si nécessaire, discutée lors des réunions du conseil d’administration avec des représentants des Etats membres. Toutefois, ces discussions ne sont pas publiques, conformément à notre politique de confidentialité visant à garantir un dialogue franc et efficace. »

    Dans une réponse écrite, la Commission européenne rappelle « l’importance de maintenir des éléments de contrôle solides tout en renforçant les actions de suivi et d’enquête ». « Les autorités bulgares, comme celles de tous les Etats membres de l’UE, doivent respecter pleinement les obligations découlant du droit d’asile et du droit international, notamment en garantissant l’accès à la procédure d’asile », explique un porte-parole.

    L’institution précise qu’« il a été convenu de renforcer davantage le mécanisme national indépendant existant pour contrôler le respect des droits fondamentaux », mais qu’« il est de la responsabilité des Etats membres d’enquêter sur toute allégation d’actes répréhensibles ».

    Le Médiateur européen enquête actuellement sur la décision de la Commission de refuser la communication aux journalistes de BIRN de deux documents de la DG Home sur les « droits fondamentaux » aux frontières extérieures de la Bulgarie. Dans l’attente de l’enquête, la Commission a refusé de dire si ces documents avaient été pris en considération lorsqu’elle a émis des évaluations positives du programme pilote et de la conformité de la Bulgarie avec les règles de Schengen.

  • Deux morts en moins de deux mois dans le même commissariat de Genève

    Vu depuis la France, on a tendance à imaginer que la Suisse serait un havre d’apaisement, relativement épargné par les violences d’État que nous connaissons. Rien n’est plus faux, comme en témoignent ces deux affaires.

    Le 3 janvier 2024 et le 22 février 2024, deux personnes ont été retrouvées mortes en cellule de #garde_à_vue dans le même commissariat de Genève, à moins de deux mois d’intervalle, alors qu’elles étaient toutes deux âgées d’une vingtaine d’années.

    La première victime est présentée comme étant « en situation irrégulière » et a été retrouvée sans vie dans sa cellule du vieil Hôtel de police, situé boulevard Carl-Vogt à Genève. La seconde, née en 2003, avait été arrêtée pour un simple vol et n’est pas ressortie vivante du même commissariat.

    Après chacun des deux décès, les autorités ont répondu avec les mêmes mots : « Malgré les efforts déployés tant par le personnel de la Brigade de sécurité et des audiences (BSA) que par le service mobile d’urgence-réanimation (SMUR), le médecin n’a pu que constater le décès. Le Ministère public a ouvert une enquête ». Celui-ci « indiquait alors que les premiers éléments de l’enquête accréditaient l’hypothèse d’un suicide ». La mort brutale d’une personne sous la surveillance de la police ne mérite pas simplement les « hypothèses » d’un magistrat dépendant du pouvoir.

    Presque deux mois après le premier décès, comment est-il possible qu’aucun rapport d’autopsie sur la cause de la mort n’ait été établi ? Ce silence complice est peut-être la cause de ce second décès. Car non, on ne meurt pas brutalement, sans raison, à 20 ans, dans la cellule d’un commissariat.

    Ce n’est d’ailleurs pas les premières affaires de ce type en Suisse. En 2017, arrêté à tort, un ressortissant gambien de 23 ans, Lamin F., avait trouvé la mort dans une cellule du centre de police de la Blécherette, à Lausanne. Le parquet Vaudois avait alors classé l’affaire. Une affaire qui s’ajoute à celles d’« Hervé, un Congolais mort en 2016 à Bex, Mike Ben Peter, un Nigérian mort en 2018 à Lausanne, et Nzoy, un Suisse d’origine sud-africaine mort en 2021 à Morges ».

    La Suisse fait face récemment à une hausse des dénonciations de violences policières. Une augmentation de 120% des plaintes a été enregistrée en 2022. Sans surprise, le taux de classement sans suite est extrêmement élevé, comme en France, et seules 10% des plaintes aboutissent à une condamnation pénale. En comparaison, en 2020-2021, ce serait 8% des personnes dépositaires de l’autorité publiques mises en cause en France pour des violences volontaires qui seraient condamnées selon les chiffres de Politis.

    La Suisse a d’ailleurs été épinglée par un rapport de l’ONU accablant sur le racisme et les violences policières. Le rapport du groupe de travail pour l’ONU rendu en octobre 2022 conclut ainsi que « Des garçons et des hommes d’origine africaine n’ayant pas fait l’objet d’une accusation pénale ou d’une suspicion individuelle ont signalé de façon systématique que la police renforçait les stéréotypes raciaux négatifs dans l’espace public. Le profilage racial, les contrôles de police, les fouilles invasives dans la rue, les fouilles à nu publiques, les fouilles anales, les insultes et “l’humour” raciste, la violence et une habitude d’impunité ont été décrits comme étant de routine ».

    Un autre fait méconnu : les policiers suisses utilisent aussi des armes dites « non-létales », tirant des balles en caoutchouc, et ont éborgné plusieurs habitants ces dernières années, comme en France. Les LBD utilisés par les policiers français ont d’ailleurs été conçus par une firme Suisse : Brügger & Thomet.

    Un rapport d’Amnesty international pointe également « l’usage disproportionnée de la force » ainsi que les pratiques violentes et discriminatoires de la police Suisse. En 2018, Mike Ben Peter, un Nigérian de 40 ans a été tué par la police suite à un plaquage ventral. Il est transporté inconscient aux urgences et décédera le lendemain.

  • Cassazione, dare i migranti ai guardiacoste di Tripoli è reato

    La consegna di migranti alla guardia costiera libica è reato perché la Libia «non è porto sicuro».

    E’ quanto sancisce una sentenza della Corte di Cassazione che ha reso definitiva la condanna del comandante del rimorchiatore #Asso_28 che il 30 luglio del 2018 soccorse 101 persone nel Mediterraneo centrale e li riportò in Libia consegnandoli alla Guardia costiera di Tripoli. Della sentenza scrive Repubblica.

    Per i supremi giudici favorire le intercettazioni dei guardiacoste di Tripoli rientra nella fattispecie illecita «dell’abbandono in stato di pericolo di persone minori o incapaci e di sbarco e abbandono arbitrario di persone». Nella sentenza viene sostanzialmente sancito che l’episodio del 2018 fu un respingimento collettivo verso un Paese non ritenuto sicuro vietato dalla Convenzione europea per i diritti umani.

    Casarini, dopo Cassazione su migranti pronti a #class_action

    "Con la sentenza della Corte di Cassazione, che ha chiarito in maniera definitiva che la cosiddetta «guardia costiera libica» non può «coordinare» nessun soccorso, perché non è in grado di garantire il rispetto dei diritti umani dei naufraghi, diventa un reato grave anche ordinarci di farlo, come succede adesso. Ora metteremo a punto non solo i ricorsi contro il decreto Piantedosi, che blocca per questo le navi del soccorso civile, ma anche una grande class action contro il governo e il ministro dell’Interno e il memorandum Italia-Libia". E’ quanto afferma Luca Casarini della ong Mediterranea Saving Humans.

    "Dovranno rispondere in tribunale delle loro azioni di finanziamento e complicità nelle catture e deportazioni che avvengono in mare ad opera di una «sedicente» guardia costiera - aggiunge Casarini -, che altro non è che una formazione militare che ha come compito quello di catturare e deportare, non di «mettere in salvo» le donne, gli uomini e i bambini che cercano aiuto. La suprema corte definisce giustamente una gravissima violazione della Convenzione di Ginevra, la deportazione in Libia di migranti e profughi che sono in mare per tentare di fuggire da quell’inferno". Casarini ricorda, inoltre, che di recente la nave Mare Jonio di Mediterranea "di recente è stata colpita dal fermo amministrativo del governo per non aver chiesto alla Libia il porto sicuro. Proporremo a migliaia di cittadini italiani, ad associazioni e ong, di sottoscrivere la «class action», e chiederemo ad un tribunale della Repubblica di portare in giudizio i responsabili politici di questi gravi crimini. Stiamo parlando di decine di migliaia di esseri umani catturati in mare e deportati in Libia, ogni anno, coordinati di fatto da Roma e dall’agenzia europea Frontex.

    E il ministro Piantedosi, proprio ieri, l’ha rivendicato testimoniando al processo a Palermo contro l’allora ministro Salvini. Lui si è costruito un alibi, con la distinzione tra centri di detenzione legali e illegali in Libia, dichiarando che «l’Italia si coordina con le istituzioni libiche che gestiscono campi di detenzione legalmente. Finalmente questo alibi, che è servito fino ad ora a coprire i crimini, è crollato grazie al pronunciamento della Cassazione. Adesso questo ministro deve essere messo sotto processo, perché ha ammesso di avere sistematicamente commesso un reato, gravissimo, che ha causato morte e sofferenze a migliaia di innocenti».

      La Libia è un paese canaglia: bocciati Minniti, Conte e Meloni. Dice la sentenza della Cassazione, è noto che in Libia i migranti subiscono vessazioni, violenze e tortura. Quindi è un reato violare la legge internazionale e il codice di navigazione che impongono di portare i naufraghi in un porto sicuro

      Il governo italiano (sia questo in carica sia quelli di centrosinistra che avevano Marco Minniti come ministro dell’interno) potrebbe addirittura finire sotto processo sulla base di una sentenza emessa dalla Corte di Cassazione.

      Dice questa sentenza che la Libia non è un porto sicuro, e che dunque non si possono consegnare alla Libia (o favorire la cattura da parte delle motovedette libiche) le persone salvate da un naufragio.

      Dice la sentenza, è noto che in Libia i migranti subiscono vessazioni, violenze e tortura. Quindi è un reato violare la legge internazionale e il codice di navigazione che impongono di portare i naufraghi in un porto sicuro.

      Che la Libia non fosse un porto sicuro era stranoto. Bastava non leggere i giornali italiani per saperlo. La novità è che questa evidente verità viene ora formalmente affermata con una sentenza della Cassazione che fa giurisprudenza. E che, come è del tutto evidente, mette in discussione gli accordi con la Libia firmati dai governi di centrosinistra e poi confermati dai governi Conte e infine dai governi di centrodestra.

      Accordi che si basarono persino sul finanziamento italiano e sulla consegna di motovedette – realizzate a spese del governo italiano – alle autorità di Tripoli. Ora quegli accordi devono essere immediatamente cancellati e in linea di principio si potrebbe persino ipotizzare l’apertura di processi (se non è scattata la prescrizione) ai responsabili di quegli accordi.

      I reati per i quali la Cassazione con questa sentenza ha confermato la condanna al comandante di una nave che nel luglio del 2018 (governo gialloverde, Salvini ministro dell’Interno) consegnò alla guardia costiera libica 101 naufraghi salvati in mezzo al Mediterraneo sono “abbandono in stato di pericolo di persone minori o incapaci, e di sbarco e abbandono arbitrario di persone”. La Cassazione ha dichiarato formalmente che la Libia non è un porto sicuro.

      Tutta la politica dei respingimenti a questo punto, se dio vuole, salta in aria. La Cassazione ha stabilito che bisogna tornare allo Stato di diritto, a scapito della propaganda politica. E saltano in aria anche i provvedimenti recentemente adottati dalle autorità italiane sulla base del decreto Spazza-naufraghi varato circa un anno fa dal governo Meloni.

      Ancora in queste ore c’è una nave della Ocean Viking che è sotto fermo amministrativo perché accusata di non aver seguito le direttive impartite dalle autorità libiche. Ovviamente dovrà immediatamente essere dissequestrata e forse c’è anche il rischio che chi ha deciso il sequestro finisca sotto processo. Inoltre bisognerà restituire la multa e probabilmente risarcire il danno.

      E quello della Ocean Viking è solo uno di numerosissimi casi. Certo, perché ciò avvenga sarebbe necessaria una assunzione di responsabilità sia da parte del Parlamento sia da parte della magistratura. E le due cose non sono probabilissime.

      Italy’s highest court, the Cassation Court, has ruled that handing over migrants to Libyan coast guards is unlawful because Libya does not represent a safe port. The sentence could have major repercussions.

      Handing over migrants rescued in the Central Mediterranean to Tripoli’s coast guards is unlawful because Libya is not a safe port and it is conduct which goes against the navigation code, the Cassation Court ruled on February 17. The decision upheld the conviction of the captain of the Italian private vessel Asso 28, which, on July 30, 2018, rescued 101 individuals in the central Mediterranean and then handed them over to the Libyan coast guards to be returned to Libya.

      The supreme court judges ruled in sentence number 4557 that facilitating the interception of migrants and refugees by the Libyan coast guards falls under the crime of “abandonment in a state of danger of minors or incapacitated people and arbitrary disembarkation and abandonment of people.” This ruling effectively characterizes the 2018 incident as collective refoulement to a country not considered safe, contravening the European Convention on Human Rights.

      NGOs announce class action lawsuit

      Beyond its political implications, the Cassation’s decision could significantly impact ongoing legal proceedings, including administrative actions. NGOs have announced a class action lawsuit against the government, the interior minister, and the Italy-Libya memorandum.

      The case, which was first examined by the tribunal of Naples, focuses on the intervention of a trawler, a support ship for a platform, to rescue 101 migrants who were on a boat that had departed from Africa’s coast.

      According to investigators, the ship’s commander was asked by personnel on the rig to take on board a Libyan citizen, described as a “Libyan customs official”, who suggested sailing to Libya and disembarking the rescued migrants.

      The supreme court judges said the defendant “omitted to immediately communicate, before starting rescue operations and after completing them, to the centres of coordination and rescue services of Tripoli and to the IMRCC (Italian Maritime Rescue Coordination Centre) of Rome, in the absence of a reply by the first,” that the migrants had been rescued and were under his charge.

      The Cassation ruled that, by operating in this way, the commander violated “procedures provided for by the International Convention for the Safety of Life at Sea (SOLAS) and by the directives of the International Maritime Organization,” thus carrying out a “collective refoulement to a port deemed unsafe like Libya.”

      Furthermore, the Cassation emphasized the commander’s obligation to ascertain whether the migrants wanted to apply for asylum and conduct necessary checks on accompanying minors.
      ’Cassation should not be interpreted ideologically on Libya’, Piantedosi

      “Italy has never coordinated and handed over to Libya migrants rescued in operations coordinated or directly carried out by Italy,” Interior Minister Matteo Piantedosi said on February 19, when asked to comment the Cassation’s ruling. “That sentence must be read well — sentences should never be interpreted in a political or ideological manner,” he said.

      Piantedosi contextualized the ruling within the circumstances prevailing in Libya at the time, citing efforts to assist Libya with EU cooperation. He highlighted the government’s adherence to principles governing repatriation activities and concluded by saying “there can be no spontaneity” and that “coordination” is essential.

  • Eight #AFIC risk analysis cells set a benchmark in Africa

    This week, Frontex together with the European Commission and representatives from eight African countries forming part of the #Africa-Frontex_Intelligence_Community (AFIC) met in Dakar, Senegal, to wrap up the European Union-funded project on “Strengthening of AFIC as an instrument to fight serious cross-border crimes affecting Africa and the EU”.

    Launched in 2017 and funded by the European Commission, the project aimed to enhance the capacity and capability of AFIC countries to work jointly on identifying key threats impacting border management in Africa.

    After years of hard work and despite the challenges caused by the COVID-19 pandemic, Frontex has completed its latest project and is proud to announce the handover of equipment to trained border police analysts who are carrying out their tasks in the risk analysis cells of eight AFIC countries: Côte d’Ivoire, The Gambia, Ghana, Mauritania, Niger, Nigeria, Senegal and Togo.

    The role of the cells, which are run by local analysts trained by Frontex, is to collect and analyse data on cross-border crime and support authorities involved in border management.

    Frontex delivered a comprehensive risk analysis solution that meets the needs of the eight African border management authorities and enhances the safety and security of borders.

    The handover of the equipment marks the end of the project and the beginning of an intensive cooperation between the AFIC countries. Frontex stays committed and ready to continue to support the RACs by organising joint activities - such as workshops, trainings, plenary meetings – together with the AFIC partner countries, aiming at further developing AFIC risk analysis capacities.

    The AFIC project in numbers:

    – Establishment of eight risk analysis cells in Niger, Ghana, Gambia, Senegal, Nigeria, Ivory Coast, Togo and Mauritania;
    - 14 training sessions for analysts from African countries;
    - 10 regional workshops in Gambia, Ghana, Italy, Niger, Senegal, Nigeria, Kenya, Poland and Ivory Coast;
    - 17 joint analytical field visits in the EU and Africa.

    About AFIC

    The Africa-Frontex Intelligence Community was launched in 2010 to promote regular exchanges on migrant smuggling and other border security threats affecting African countries and the EU. It brings together Frontex analysts with those of partner African border authorities. A central element of the network are risk analysis cells, run by local analysts trained by Frontex.   • L’UE va octroyer 87 millions d’euros à l’Égypte pour la gestion des migrations en 2024

    En 2024, l’UE fournira 87 millions d’euros ainsi que de nouveaux #équipements à l’Égypte pour un projet de gestion des migrations lancé en 2022, mis en œuvre par l’#Organisation_Internationale_pour_les_Migrations (#OIM) et l’opérateur de #coopération_technique du ministère français de l’Intérieur #Civipol, ont confirmé trois sources proches du dossier à Euractiv.

    L’enveloppe de 87 millions d’euros pourrait passer à 110 millions d’euros après la prochaine réunion du #Conseil_d’association_UE-Egypte le 23 janvier, ont confirmé deux sources à Euractiv.

    La Commission européenne mène également des #négociations parallèles avec Le Caire afin de conditionner un ensemble de financements pour d’autres projets couvrant un large éventail de secteurs, y compris les migrations, aux recommandations du #Fonds_monétaire_international (#FMI) en matière de réforme, a indiqué une source au fait des négociations.

    Les 87 millions d’euros seront consacrés au renforcement de la #capacité_opérationnelle de la #marine égyptienne et des #gardes-frontières pour la #surveillance_des_frontières ainsi que pour les opérations de recherche et de sauvetage en mer.

    Le projet de gestion des migrations UE-Égypte a débuté en 2022 avec un montant initial de 23 millions d’euros, 115 millions d’euros supplémentaires ayant été approuvés pour 2023, a confirmé l’une des trois sources.

    Les #fonds pour 2022 et 2023 ont été utilisés pour la gestion des frontières, la lutte contre la contrebande et la traite des êtres humains, les retours volontaires et les projets de réintégration.

    « Avec ces fonds de l’UE, l’OIM [l’Organisation internationale des migrations] soutient les autorités égyptiennes par le biais d’activités de renforcement des capacités qui promeuvent une #gestion_des_frontières fondée sur les droits humains et le respect du droit et des normes internationales, également en ce qui concerne les opérations de recherche et de sauvetage », a déclaré une source officielle de l’agence des Nations unies à Euractiv.

    L’opérateur français Civipol travaille sur l’appel d’offres, la production et la livraison des nouveaux #bateaux de recherche et de sauvetage pour 2024, a confirmé l’une des trois sources.

    Cependant, selon le rapport sur les migrations 2023 de l’Agence de l’Union européenne pour l’asile (AUEA), il n’y a pratiquement pas eu de départs irréguliers depuis les côtes égyptiennes depuis 2016, la plupart des migrants irréguliers égyptiens vers l’UE étant partis de Libye.

    Dans le même temps, le nombre de citoyens égyptiens demandant des visas dans les États membres de l’UE a considérablement augmenté ces dernières années, selon le rapport de l’AUEA, principalement en raison de la détérioration de la situation intérieure du pays.

    La crise s’aggrave en Égypte

    L’Égypte, partenaire stratégique de l’UE, connaît une crise économique et politique de plus en plus grave. Les 107 millions d’habitants du pays sont confrontés à une instabilité croissante et à l’absence de garanties en matière de droits humains.

    Dans une lettre adressée aux chefs d’État et aux institutions européennes en décembre dernier, l’ONG Human Rights Watch a demandé à l’UE de « veiller à ce que tout recalibrage de son #partenariat avec l’Égypte et de l’aide macrofinancière qui en découle soit l’occasion d’améliorer les droits civils, politiques et économiques du peuple égyptien ».

    « Son impact ne sera durable que s’il est lié à des progrès structurels et à des réformes visant à remédier aux abus et à l’oppression du gouvernement, qui ont étranglé les droits de la population autant que l’économie du pays », a écrit l’ONG.

    La crise des droits humains est indissociable de la crise économique, a expliqué à Euractiv Timothy E. Kaldas, directeur adjoint de l’Institut Tahrir pour les politiques au Moyen-Orient. « Les décisions et les pratiques politiques du régime jouent un rôle central dans l’état de l’économie égyptienne », a-t-il déclaré.

    « Le régime exploite l’État égyptien de manière abusive. Par exemple, il impose des contrats à des entreprises appartenant au régime pour réaliser des projets d’infrastructure extrêmement coûteux et qui ne contribuent pas nécessairement au bien public », a affirmé M. Kaldas, citant la construction de nouvelles villes ou de « nouveaux palais pour le président ».

    Alors que ces projets enrichissent les élites égyptiennes, le peuple est de plus en plus pauvre et, dans certains cas, il se voit contraint de quitter le pays, a expliqué M. Kaldas.

    Avec une inflation des produits alimentaires et des boissons dépassant 70 % en Égypte en 2023, une monnaie en proie à de multiples chocs et effondrements qui réduisent le pouvoir d’achat des Égyptiens et des investisseurs privés qui ne considèrent pas le pays nord-africain comme un bon endroit pour investir, « la situation est très morose », a résumé l’expert.

    En outre, l’indépendance du secteur privé a été pointée du doigt dans un rapport de Human Rights Watch en novembre 2018. Par exemple, les deux hommes d’affaires égyptiens de Juhayna Owners, le plus grand producteur de produits laitiers et de jus de fruits du pays, ont été détenus pendant des mois après avoir refusé de céder leurs parts dans leur entreprise à une société d’État.

    Les évènements récents au poste-frontière de Rafah à Gaza, les frictions en mer Rouge avec les rebelles houthis au Yémen et la guerre dans le pays frontalier du Soudan ont aggravé l’instabilité dans cette république.

    Relations UE-Égypte

    Lors du dernier Conseil d’association UE-Égypte en juin 2022, les deux partenaires ont dressé une liste de priorités pour « promouvoir des intérêts communs et garantir la stabilité à long terme et le développement durable de part et d’autre de la Méditerranée, ainsi que pour renforcer la coopération et à réaliser le potentiel inexploité de cette relation ».

    La liste des priorités concerne un large éventail de secteurs dans lesquels l’UE est disposée à aider l’Égypte.

    Le document qui présente les résultats de la réunion met notamment l’accent sur les transitions numérique et écologique, le commerce et l’investissement, le développement social et la justice sociale, l’énergie, la réforme du secteur public, la sécurité et le terrorisme, ainsi que la migration.

  • FROM LIBYA TO TUNISIA : HOW THE EU IS EXTENDING THE PUSH-BACK REGIME BY PROXY IN THE CENTRAL MEDITERRANEAN

    On August 21, 2023, the rescue ship Aurora from Sea Watch was detained by the Italian authorities after refusing to disembark survivors in Tunisia as ordered by the Rome MRCC (Maritime Rescue Coordination Center), a country which by no means can be considered a place of safety.

    This episode is just one example of the efforts of European states to avoid arrivals on their shores at all costs, and to evade their responsibility for reception and #Search_and_Rescue (#SAR). Already in 2018, the European Commission, with its disembarkation platform project, attempted to force sea rescue NGOs to disembark survivors in North Africa. While this project was ultimately unsuccessful as it stood, European states have endeavored to increase the number of measures aimed at reducing crossings in the central Mediterranean.

    One of the strategies employed was to set up a “push-back by proxy regime”, outsourcing interceptions at sea to the Libyan Coast guards, enabling the sending back of people on the move to a territory in which their lives are at risk, undertaken by Libyan border forces under the control of the EU authorities, in contravention of principle of non-refoulement, one of the cornerstones of international refugee law. Since 2016, the EU and its member states have equipped, financed, and trained the Libyan coastguard and supported the creation of a MRCC in Tripoli and the declaration of a Libyan SRR (search and rescue region).

    This analysis details how the European Union and its member states are attempting to replicate in Tunisia the regime of refoulement by proxy set up in Libya just a few years earlier. Four elements are considered: strengthening the capacities of the Tunisian coastguard (equipment and training), setting up a coastal surveillance system, creating a functional MRCC and declaring a Tunisian SRR.
    A. Building capacity of the Garde Nationale Maritime
    Providing equipment

    For several decades now, Tunisia has been receiving equipment to strengthen its coast guard capabilities. After the Jasmine Revolution in 2011, Italy-Tunisia cooperation deepened. Under the informal agreement of April 5, 2011, 12 boats were delivered to the Tunisian authorities. In 2017, in a joint statement by the IItalian Ministry of Foreign Affairs and its Tunisian counterpart, the two parties committed to “closer cooperation in the fight against irregular migration and border management,” with a particular focus on the maritime border. In this context, the Italian Minister declared Italy’s support for the modernization and maintenance of the patrol vessels supplied to Tunisia (worth around 12 million euros) and the supply of new equipment for maritime border control. On March 13, 2019, Italy also supplied Tunisia with vehicles for maritime border surveillance, sending 50 4-wheelers designed to monitor the coasts.

    Recently, Germany also started to support the coast guard more actively in Tunisia, providing it with equipment for a boat workshop designed to repair coast guard vessels in 2019. As revealed in an answer to a parliamentary question, in the last two years, the Federal Police also donated 12 inflatable boats and 27 boat motors. On the French side, after a visit in Tunis in June 2023, the Interior Minister Gérard Darmanin announced 25 million euros in aid enabling Tunisia to buy border policing equipment and train border guards. In August 2023, the Italian authorities also promised hastening the provision of patrol boats and other vehicles aimed at preventing sea departures.

    Apart from EU member states, Tunisia has also received equipment from the USA. Between 2012 and 2019, the Tunisian Navy was equipped with 26 US-made patrol boats. In 2019, the Tunisian national guard was also reinforced with 3 American helicopters. Primarily designed to fight against terrorism, the US equipment is also used to monitor the Tunisian coast and to track “smugglers.”

    Above all, the supply of equipment to the Tunisian coastguard is gaining more and more support by the European Union. Following the EU-Tunisia memorandum signed on July 16, 2023, for which €150 million was pledged towards the “fight against illegal migration”, in September 2023, Tunisia received a first transfer under the agreement of €67 million “to finance a coast guard vessel, spare parts and marine fuel for other vessels as well as vehicles for the Tunisian coast guard and navy, and training to operate the equipment.”

    In a letter to the European Council, leaked by Statewatch in October 2023, the European Commission president Ursula von der Leyen highlighted the provision of vessels and support to the Tunisian coast guards: “Under the Memorandum of Understanding with Tunisia, we have delivered spare parts for Tunisian coast guards that are keeping 6 boats operation and others will be repaired by the end of the year.”
    Trainings the authorities

    In addition to supplying equipment, the European countries are also organizing training courses to enhance the skills of the Tunisian coastguard. In 2019, Italy’s Interior Ministry released €11 million to Tunisia’s government for use in efforts to stem the crossing of people on the move from Tunisia, and to provide training to local security forces involved in maritime border control.

    Under the framework of Phase III of the EU-supported IBM project (Integrated Border Management), Germany is also organizing training for the Tunisian coast guards. As revealed in the answer to a parliamentary question mentioned before, the German Ministry of Interior admitted that 3.395 members of the Tunisian National Guard and border police had been trained, including within Germany. In addition, 14 training and advanced training measures were carried out for the National Guard, the border police, and the coast guard. These training sessions were also aimed at learning how to use “control boats.”

    In a document presenting the “EU Support to Border Management Institutions in Libya and Tunisia” for the year 2021, the European Commission announced the creation of a “coast guard training academy.” In Tunisia, the project consists of implementing a training plan, rehabilitating the physical training environment of the Garde Nationale Maritime, and enhancing the cooperation between Tunisian authorities and all stakeholders, including EU agencies and neighboring countries. Implemented by the German Federal Police and the International Centre for Migration Policy Development (ICMPD), the project started in January 2023 and is supposed to run until June 2026, to the sum of 13,5 million EUR.

    Although the European Commission underlines the objective that “the Training Academy Staff is fully aware and acting on the basis of human rights standards” the increase in dangerous maneuvers and attacks perpetrated by the Tunisian coast guard since the increase in European support leaves little doubt that respect for human rights is far from top priority.

    On November 17, 2023, the ICMPD announced on its Linkedin account the inauguration of the Nefta inter-agency border management training center, as a benefit to the three agencies responsible for border management in Tunisia (Directorate General Directorate of Borders and Foreigners of the Ministry of the Interior, the General Directorate of Border Guard of the National Guard and the General Directorate of Customs).
    B. Setting up a coastal surveillance system

    In addition to supplying equipment, European countries also organize training courses to enhance the skills of European coastguards in the pursuit of an “early detection” strategy, which involves spotting boats as soon as they leave the Tunisian coast in order to outsource their interception to the Tunisian coastguard. As early as 2019, Italy expressed its willingness to install radar equipment in Tunisia and to establish “a shared information system that will promptly alert the Tunisian gendarmerie and Italian coast guard when migrant boats are at sea, in order to block them while they still are in Tunisian waters.” This ambition seems to have been achieved through the implementation of the system ISMaris in Tunisia.
    An Integrated System for Maritime Surveillance (ISMaris)

    The system ISMaris, or “Integrated System for Maritime Surveillance”, was first mentioned in the “Support Programme to Integrated Border Management in Tunisia” (IBM Tunisia, launched in 2015. Funded by the EU and Switzerland and implemented by the International Centre for Migration Policy Development (ICMPD), the first phase of the program (2015-2018) supported the equipment of the Garde Nationale Maritime with this system, defined as “a maritime surveillance system that centralizes information coming from naval assets at sea and from coastal radars […] [aiming] to connect the sensors (radar, VHF, GPS position, surveillance cameras) on board of selected Tunisian Coast Guard vessels, control posts, and command centers within the Gulf of Tunis zone in order for them to better communicate between each other.”

    The implementation of this data centralization system was then taken over by the “Border Management Programme for the Maghreb Region” (BMP-Maghreb), launched in 2018 and funded by the EU Emergency Trust Fund for Africa. The Tunisia component, funded with €24,5 million is implemented by ICMPD together with the Italian Ministry of Interior and designed to “strengthen the capacity of competent Tunisian authorities in the areas of maritime surveillance and migration management, including tackling migrant smuggling, search and rescue at sea, as well as in the coast guard sphere of competence.” With the BMP programme, the Tunisian Garde Maritime Nationale was equipped with navigational radars, thermal cameras, AIS and other IT equipment related to maritime surveillance.
    Data exchange with the EU

    The action document of the BMP program clearly states that one of the purposes of ISMaris is the reinforcement of “operational cooperation in the maritime domain between Tunisia and Italy (and other EU Member States, and possibly through EUROSUR and FRONTEX).” Established in 2013, the European Border Surveillance system (EUROSUR) is a framework for information exchange and cooperation between Member States and Frontex, to prevent the so-called irregular migration at external borders. Thanks to this system, Frontex already monitors the coast regions off Tunisia using aerial service and satellites.

    What remains dubious is the connection between IS-Maris and the EU surveillance-database. In 2020, the European Commission claimed that ISMariS was still in development and not connected to any non-Tunisian entity such as Frontex, the European Border Surveillance System (EUROSUR) or the Italian border control authorities. But it is likely that in the meantime information exchange between the different entities was systematized.

    In the absence of an official agreement, the cooperation between Frontex and Tunisia is unclear. As already mentioned in Echoes#3, “so far, it has not been possible to verify if Frontex has direct contact with the Tunisian Coast Guard as it is the case with the Libyan Coast Guard. Even if most of the interceptions happen close to Tunisian shores, some are carried out by the Tunisian Navy outside of territorial waters. […] Since May 2021 Frontex has been flying a drone, in addition to its different assets, monitoring the corridor between Tunisia and Lampedusa on a daily basis. While it is clear that Frontex is sharing data with the Italian authorities and that Italian authorities are sharing info on boats which are on the way from Tunisia to Italy with the Tunisian side, the communication and data exchanges between Frontex and Tunisian authorities remain uncertain.”

    While in 2021, Frontex reported that “no direct border related activities have been carried out in Tunisia due to Tunisian authorities’ reluctance to cooperate with Frontex”, formalizing the cooperation between Tunisia and Frontex seems to remain one of the EU’s priorities. In September 2023, a delegation from Tunisia visited Frontex headquarters in Poland, with the participation of the Ministries of Interior, Foreign Affairs and Defence. During this visit, briefings were held on the cross-border surveillance system EUROSUR and where all threads from surveillance from ships, aircraft, drones and satellites come together.

    However, as emphasized by Mathias Monroy, an independent researcher working on border externalization and the expansion of surveillance systems, “Tunisia still does not want to negotiate such a deployment of Frontex personnel to its territory, so a status agreement necessary for this is a long way off. The government in Tunis is also not currently seeking a working agreement to facilitate the exchange of information with Frontex.”

    This does not prevent the EU from continuing its efforts. In September 2023, in the wake of the thousands of arrivals on the island of Lampedusa, the head of the European Commission, Ursula von der Leyen, reaffirmed, in a 10-point action plan, the need to have a “working arrangement between Tunisia and Frontex” and to “step up border surveillance at sea and aerial surveillance including through Frontex.” In a letter written by the European Commission in reply to the LIBE letter about the Tunisia deal sent on the Greens Party initiative in July 2023, the EU also openly admits that IT equipment for operations rooms, mobile radar systems and thermal imaging cameras, navigation radars and sonars have been given to Tunisia so far and that more surveillance equipment is to come.

    To be noted as well is that the EU4BorderSecurity program, which includes support to “inter-regional information sharing, utilizing tools provided by Frontex” has been extended for Tunisia until April 2025.
    C. Supporting the creation of a Tunisian MRCC and the declaration of a Search and rescue region (SRR)
    Building a MRCC in Tunisia, a top priority for the EU

    In 2021, the European Commission stated the creation of a functioning MRCC in Tunisia as a priority: “Currently there is no MRCC in Tunisia but the coordination of SAR events is conducted by Tunisian Navy Maritime Operations Centre. The official establishment of a MRCC is a necessary next step, together with the completion of the radar installations along the coast, and will contribute to implementing a Search and rescue region in Tunisia. The establishment of an MRCC would bring Tunisia’s institutional set-up in line with the requirements set in the International Convention on Maritime Search and Rescue (SAR) of 1979 (as required by the Maritime Safety Committee of the International Maritime Organisation IMO).”

    The objective of creating a functioning Tunisian MRCC is also mentioned in a European Commission document presenting the “strategy for the regional, multi-country cooperation on migration with partner countries in North Africa” for the period 2021-2027. The related project is detailed in the “Action Document for EU Support to Border Management Institutions in Libya and Tunisia (2021),” whose overall objective is to “contribute to the improvement of respective state services through the institutional development of the Maritime Rescue Coordination Centres” in the North Africa region. The EU also promotes a “regional approach to a Maritime Rescue Coordination Center,” that “would improve the coordination in the Central Mediterranean in conducting SAR operations and support the fight against migrant smuggling and trafficking in human beings networks in Libya and Tunisia.”

    The Tunisia component of the programs announces the objective to “support the establishment of a Maritime Rescue Coordination Centre, [… ] operational 24/7 in a physical structure with functional equipment and trained staff,” establishing “cooperation of the Tunisian authorities with all national stakeholders, EU agencies and neighbouring countries on SAR.”

    This project seems to be gradually taking shape. On the website of Civipol, the French Ministry of the Interior’s service and consultancy company, a new project entitled “Support for Search and Rescue Operations at Sea in Tunisia” is mentioned in a job advertisement. It states that this project, funded by the European Union, implemented together with the GIZ and starting in September 2023, aims to “support the Tunisian authorities in strengthening their operational capacities (fleet and other)” and “provide support to the Tunisian authorities in strengthening the Marine Nationale and the MRCC via functional equipment and staff training.”

    In October 2023, the German development agency GIZ also published a job offer for a project manager in Tunisia, to implement the EU-funded project “Support to border management institution (MRCC)” in Tunisia (the job offer was deleted from the website in the meantime but screenshots can be shared on demand). The objective of the project is described as such: “improvement of the Tunisia’s Search and Rescue (SAR) capacity through reinforced border management institutions to conduct SAR operations at sea and the fight against migrant smuggling and human being trafficking by supporting increased collaboration between Tunisian actors via a Maritime RescueCoordination Centre (MRCC).”

    According to Mathias Monroy, other steps have been taken in this direction: “[the Tunisian MRCC] has already received an EU-funded vessel tracking system and is to be connected to the “Seahorse Mediterranean” network. Through this, the EU states exchange information about incidents off their coasts. This year Tunisia has also sent members of its coast guards to Italy as liaison officers – apparently a first step towards the EU’s goal of “linking” MRCC’s in Libya and Tunisia with their “counterparts” in Italy and Malta.”

    The establishment of a functional MRCC represents a major challenge for the EU, with the aim to allow Tunisia to engage actively in coordination of interceptions. Another step in the recognition of the Tunisian part as a valid SAR actor by the IMO is the declaration of a search and rescue region (SRR).
    The unclear status of the current Tunisian area of responsibility

    Adopted in 1979 in Hamburg, the International Convention on Maritime Search and Rescue (SAR – Search & Rescue Convention) aimed to establish an international search and rescue plan to encourage cooperation and coordination between neighboring states in order to ensure better assistance to persons in distress at sea. The main idea of the convention is to divide seas and oceans into search and rescue zones in which states are responsible for providing adequate SAR services, by establishing rescue coordination centers and setting operating procedures to be followed in case of SAR operations.

    Whereas Tunisia acceded to the treaty in 1998, this was not followed by the delimitation of the Tunisian SAR zone of responsibilities nor by regional agreements with neighboring states. It is only in 2013 that Tunisia declared the limits of its SRR, following the approval of the Maghreb Convention in the Field of Search and Rescue in 2013 and by virtue of Decree No. 2009-3333 of November 2, 2009, setting out the intervention plans and means to assist aircraft in distress. In application of this norm, Tunisian authorities are required to intervene immediately, following the first signal of help or emergency, in the limits of the Tunisia sovereign borders (12 nautical miles). This means that under national legislation, Tunisian authorities are obliged to intervene only in territorial waters. Outside this domain, the limits of SAR interventions are not clearly defined.

    A point to underline is that the Tunisian territorial waters overlap with the Maltese SRR. The Tunisian Exclusive Economic Zone – which does not entail any specific duty connected to SAR – also overlaps with the Maltese SRR and this circumstance led in the past to attempts by the Maltese authorities to drop their SAR responsibilities claiming that distress cases were happening in this vast area. Another complex topic regards the presence, in international waters which is part of the Maltese SRR, of Tunisian oil platforms. Also, in these cases the coordination of SAR operations have been contested and were often subject to a “ping-pong” responsibility from the involved state authorities.
    Towards the declaration of a huge Tunisian SRR?

    In a research document published by the IMO Institute (International Maritime Organization), Akram Boubakri (Lieutenant Commander, Head, Maritime Affairs, Tunisian Coast Guard according to IMO Institute website) wrote that at the beginning of 2020, Tunisia officially submitted the coordinates of the Tunisian SRR to the IMO. According to this document, these new coordinates, still pending the notification of consideration by the IMO, would cover a large area, creating two overlapping areas with neighboring SAR zones – the first one with Libya, the second one with Malta* (see map below):

    As several media outlets have reported, the declaration of an official Tunisian SRR is a project supported by the European Union, which was notably put back on the table on the occasion of the signing of the Memorandum of Understanding signed in July 2023 between the EU and Tunisia.

    During the summer 2023, the Civil MRCC legal team initiated a freedom of information access request to the Tunisian authorities to clarify the current status of the Tunisian SRR. The Tunisian Ministry of Transport/the Office of the Merchant Navy and Ports replied that”[n]o legal text has yet been published defining the geographical marine limits of the search and rescue zone stipulated in the 1979 International Convention for Search and Rescue […]. We would like to inform you that the National Committee for the Law of the Sea, chaired by the Ministry of National Defence, has submitted a draft on this subject, which has been sent in 2019 to the International Maritime Organisation through the Ministry of Transport.” A recourse to the Ministry of Foreign Affairs and the Interior was sent but no reply was received yet.

    Replying in December 2023 to a freedom of information access request initiated by the Civil MRCC, the IMO stated that “Tunisia has not communicated their established search and rescue region to the IMO Secretariat.” However, on November 3, 2023, the Tunisian Ministerial Council adopted a “draft law on the regulation of search and rescue at sea in Tunisia’s area of responsibility.” A text which, according to FTDES, provides for the creation of a Tunisian SAR zone, although it has not yet been published. While the text still has to be ratified by the parliament, it is quite clear that the Tunisian authorities are currently making concrete steps to align on the IMO standards and, by doing so, on the EU agenda.
    Conclusion: A EU strategy to escape from its SAR responsibilities

    While some analysts have seen the drop in arrivals in Italy from Tunisia in recent months as a sign of the “success” of the European Union’s strategy to close its borders (in November, a drop of over 80% compared to the summer months), in reality, the evolution of these policies proves that reinforcing a border only shifts migratory routes. From autumn onwards, the Libyan route has seen an increase in traffic, with many departing from the east of the country. These analyses fail to consider the agency of people on the move, and the constant reinvention of strategies for transgressing borders.

    While condemning the generalization of a regime of refoulement by proxy in the central Mediterranean and the continued brutalization of the border regime, the Civil MRCC aims to give visibility to the autonomy of migration and non-stop solidarity struggles for freedom of movement!

  • Piéton tué par la #BRAV-M : des policiers avaient alerté sur la #dangerosité des motards

    « Devons-nous attendre un accident mortel pour réagir ? » Deux mois avant la mort d’un piéton en décembre dernier à Paris, une quinzaine de policiers de cette unité décriée avaient dénoncé, en vain, la dangerosité de leurs #motards dans des rapports accablants. Depuis plusieurs années, les blessés s’accumulent.

    À la préfecture de police de Paris, l’annonce, le 12 décembre, de la mort d’un homme de 84 ans, percuté par une moto de la brigade de répression de l’action violente motorisée (BRAV-M) alors qu’il traversait un passage piéton dans le XIXe arrondissement de Paris, n’a pas surpris tout le monde. Notamment dans les rangs des compagnies d’intervention (CI), mobilisées à tour de rôle pour grimper à l’arrière des motos au sein de ces équipages décriés pour leur violence depuis leur création, en 2019, en plein mouvement des « gilets jaunes ».

    Casque blanc à l’avant pour le pilote, noir à l’arrière pour son passager, vêtements sombres, motos de sport banalisées : les BRAV-M sont déployées au coup par coup pour des missions de maintien de l’ordre à Paris, et de « sécurisation » dans les quartiers réputés difficiles en banlieue.

    Le 7 octobre 2023, soit un peu plus de deux mois avant la mort du piéton − qui fait l’objet d’une enquête judiciaire pour « homicide involontaire » −, une quinzaine de policiers passagers des BRAV-M avaient transmis à leur hiérarchie des rapports pointant du doigt la dangerosité et l’illégalité de la conduite de leurs collègues.

    Dans ces écrits, consignés au terme d’une journée particulièrement chaotique, ils signifiaient également leur refus de continuer de monter derrière des pilotes décrits comme hors de contrôle, évoquant une accumulation d’accidents et de blessés et des alertes émises auprès de responsables de la DOPC (direction de l’ordre public et de la circulation) de la préfecture de police depuis « des mois voire des années ». Vitesse folle, prise de risques inconsidérée et injustifiée, absence de contrôle hiérarchique : le contenu de ces rapports, consultés par Mediapart, est effarant.

    Ce samedi 7 octobre, des équipages de la BRAV-M, dont la devise est « Born to ride » (« Né pour rouler », en anglais), sont affectés à plusieurs missions de sécurisation un peu partout à Paris. Certaines motos sont stationnées au stade Charléty, dans le sud de la capitale, où le Paris Football Club doit affronter l’AJ Auxerre pour un match de ligue 2. D’autres patrouillent place de la Bastille ou boulevard Magenta, près de la place de la République.

    En fin d’après-midi, une des unités voit un scooter brûler un feu rouge rue de Bagnolet, dans l’Est parisien. Les policiers tentent d’interpeller le conducteur, qui ne s’arrête pas. L’annonce de ce « refus d’obtempérer » circule sur les ondes et, sans attendre aucun ordre, des motards, même ceux du stade Charléty (à une dizaine de kilomètres de là), décident de se joindre à la course-poursuite.

    Le scooter pris en chasse s’engage sur le périphérique saturé, puis sur l’autoroute, où il finit par chuter au niveau de Bobigny, en Seine-Saint-Denis. Pendant ce temps, les motos de la BRAV-M convergent d’un peu partout dans Paris, à très grande vitesse.
    Plus de 180 kilomètres-heure

    Dans leurs rapports, les policiers passagers racontent : « Les motards ont décidé de partir à très vive allure, roulant à plus de 100 km/h en ville et slalomant entre les véhicules. Ils ont continué leur progression en interfile à 145 km/h sur un périphérique saturé. C’est inadmissible. Les motards ne sont pas conscients des risques qu’ils prennent pour leur propre vie, celles de leurs passagers, et celles des citoyens. D’autant plus que le Code de la route est complètement bafoué », écrit l’un d’entre eux, qui conclut : « Devons-nous attendre qu’il y ait un accident mortel pour réagir ? »

    Un autre relate que le pilote « a dépassé les 180 km/h [...] après avoir pris tous les risques possibles tout en étant conscient qu’à tout moment la moindre collision s’avérerait mortelle ». « Nous arrivons bien évidemment après l’intervention », ajoute-t-il. « Certains pilotes sont partis tellement vite qu’ils ont laissé leur passager sur place, avec le casque d’un passager encore attaché à la moto », précise encore le rapport.

    L’un des policiers passagers, équipé pour les opérations de maintien de l’ordre, explique s’être senti particulièrement vulnérable alors que la moto « slalomait entre les différents véhicules à vive allure ». « Après avoir fait part à un motocycliste du danger que représente la prise au vent [d’]un bouclier à de telles vitesses, celui-ci me répondra qu’à ma place il l’aurait lâché », relate-t-il. Un des fonctionnaires explique aussi avoir perdu une grenade goupillée place de la Bastille, et que le pilote aurait refusé de s’arrêter pour qu’il la ramasse…

    Plus grave encore, les policiers passagers des BRAV-M insistent sur le fait que ces comportements, à l’origine de « nombreuses blessures », ont été signalés à la hiérarchie de la DOPC à plusieurs reprises, et ce depuis des années. Sans, visiblement, que les motards aient fait l’objet d’un rappel à l’ordre.

    « Il ne se passe pas une vacation sans qu’il n’y ait une chute fortuite, et malgré de nombreuses discussions, rien ne semble changer », se plaint un fonctionnaire. « Il existe depuis de longs mois voire des années des griefs par rapport à leur conduite », explique un autre, évoquant une réunion en juin 2023 provoquée par « des accidents à répétition ». « Malgré de nombreuses blessures en service ainsi que de multiples discussions, il semblerait que les problèmes de comportement persistent et que les risques encourus ne cessent d’augmenter semaine après semaine », dit un troisième.

    Les BRAV-M, des unités uniques en France

    La première intervention officielle des BRAV-M (brigades de répression de l’action violente motorisées) dans les manifestations parisiennes date du 23 mars 2019, en plein mouvement des « gilets jaunes », sous la houlette du tout nouveau préfet de police de l’époque, Didier Lallement – remplacé par Laurent Nuñez à l’été 2022. Mais ces unités étaient déjà en gestation. Dès décembre 2018, sur décision du ministre de l’intérieur Christophe Castaner et du préfet Michel Delpuech, des binômes de policiers motorisés, interdits depuis la mort de Malik Oussekine en 1986, refont leur apparition dans les rues de Paris.

    Au départ, ce sont essentiellement des agents des brigades anticriminalité (BAC), non formés au maintien de l’ordre, qui sont mobilisés au sein de ces équipages. Car la particularité de la BRAV-M est qu’elle n’est pas une unité à proprement parler : depuis 2020, elle est composée d’agents appartenant aux compagnies d’intervention (CI) de la préfecture de police de Paris, mobilisés ponctuellement pour grimper à l’arrière des motos comme passagers. À l’avant, les motards, 150 policiers environ, appartiennent eux aussi à une compagnie d’intervention, « la 24 ».

    Déployées au coup par coup en fonction des événements prévus dans la capitale, les BRAV-M sont réparties en équipages de 18 motos organisées en trinômes. Elles sont devenues le symbole ambulant de ce que les manifestant·es reprochent aux forces de l’ordre françaises : une violence imprévisible, indiscriminée et gratuite.

    Pourquoi ces alertes et ces rapports sont-ils restés sans suite pendant des mois ? Selon nos informations, les écrits envoyés par les policiers le 7 octobre n’ont pas été enregistrés par la hiérarchie de la DOPC dans le système de courrier de la préfecture de police, baptisé « Alice », comme le veut la procédure.

    Les fonctionnaires auteurs des rapports n’ont été convoqués qu’à la mi-janvier, soit plus de trois mois après les incidents signalés, dans le cadre d’une « procédure d’enquête administrative ». Des convocations tombées, donc, quelques semaines après l’accident qui a causé la mort du piéton dans le XIXe arrondissement.

    Selon les informations de Mediapart, les procès-verbaux de convocation à ces auditions sont en effet datés du mois d’octobre, mais ne comportent aucune référence « Alice », ce qui interroge sur la réalité de la temporalité de la procédure.
    Le préfet de police pas informé

    Un autre détail pose question : l’enquête administrative chargée de faire la lumière sur les incidents du 7 octobre a été confiée à Patrick Lunel, qui n’est autre que… le responsable des motards de la BRAV-M mise en cause par leurs collègues. Patrick Lunel est par ailleurs connu pour avoir été commandant de la CSI 93, la compagnie de sécurisation et d’intervention de la Seine-Saint-Denis, quand elle s’est retrouvée au cœur d’une retentissante série de scandales.

    Une vingtaine d’enquêtes judiciaires avaient été ouvertes en 2019 et 2020 par le parquet de Bobigny pour des faits de vols, violences et faux en écriture publique. La majorité ont été classées faute de preuves, selon une source judiciaire, mais plusieurs des policiers de la CSI 93 ont été renvoyés devant la justice, et certains condamnés à de la prison ferme.

    Sollicité via la préfecture de police, Patrick Lunel n’a pas répondu à nos questions.

    Interrogée sur le contenu de ces rapports et l’absence de suites, la préfecture de police nous a indiqué que « les rapports des agents, transmis par mail un dimanche, ont été portés sans délai à la connaissance de l’ensemble de la chaîne hiérarchique, l’absence d’enregistrement par numéro ALICE n’ayant aucune incidence sur la remontée et la prise en compte d’information ».

    « Le délai de trois mois entre le déclenchement de l’enquête administrative et les premières auditions se justifie par la nécessité d’instruire l’ensemble des rapports, les contraintes opérationnelles, et la programmation de plusieurs actes s’agissant d’une affaire dans laquelle aucun blessé n’est à déplorer et alors même que le préfet de police, dès le 11 octobre, avait reçu l’ensemble de l’encadrement de la BRAV-M pour rappeler les règles de déontologie, notamment la nécessité de circuler à allure normale hors cas d’intervention d’urgence », a-t-elle justifié.

    « Le préfet de police tient à préciser que toute la lumière sera faite sur cette enquête administrative sur des faits qui se déroulaient dans le cadre initial d’un refus d’obtempérer commis par un individu finalement interpellé dans un secteur sensible de Seine-Saint-Denis où ont eu lieu de nombreuses prises à partie d’effectifs et nécessitant l’envoi de renforts dans les meilleurs délais », nous a encore précisé la préfecture.

    La hiérarchie de la DOPC a-t-elle dissimulé au préfet la colère qui montait dans les rangs des BRAV-M ? « Le préfet de police a été informé des crispations liées à la vitesse (c’est à ce titre qu’il reçoit les encadrants le 11 octobre), sans être informé précisément du fait du 7 octobre », nous a-t-on répondu.

    Autre interrogation : alors que les rapports du 7 octobre font état de « nombreux blessés en service », combien de policiers ont été blessés dans des accidents causés par les motards de la BRAV-M ? « À ce jour, la direction de l’ordre public et de la circulation recense contre les pilotes de la BRAV-M quatre cas de faute lourde de pilotage, avec blessé. Des enquêtes ont été ouvertes pour chacun des cas », indique la préfecture.

    Au moins un de ces accidents a eu des conséquences dramatiques. Selon nos informations, une jeune gardienne de la paix affectée dans une compagnie d’intervention a été grièvement blessée en juin 2022 dans un carambolage sur le périphérique parisien au niveau de la porte de la Villette alors qu’elle était passagère dans un équipage de la BRAV-M, accident dont elle conserve de graves séquelles.

    À ce sujet, la préfecture de police nous a indiqué que cet accident a fait « l’objet d’une enquête administrative, dont les conclusions ont été rendues : un conseil de discipline doit avoir lieu en mars 2024 ». « Dans l’attente, l’agent en cause a changé d’affectation et n’exerce plus sur la voie publique. L’enquête judiciaire est toujours en cours, elle est effectuée par l’IGPN [Inspection générale de la police nationale – ndlr] », a-t-elle précisé.
    « Roues arrière sur le périph’ »

    « Le grave accident dont a été victime la jeune policière aurait pourtant dû susciter un électrochoc, souffle un commissaire de la préfecture de police de Paris. Mais ça n’a rien changé, les motards de la BRAV-M continuent de faire des roues arrière sur le périph’ ! » « Ils sortent leur béquille sur l’autoroute pour faire des étincelles. Ils font les kékés, ça les amuse », renchérit un policier, lui aussi en poste à la préfecture.

    « Au fil des années, à force d’une série de petits renoncements, un laisser-aller s’est installé, poursuit ce fonctionnaire. Les motards de la BRAV-M, c’est un État dans l’État, il y a un gros sentiment d’impunité. » « Beaucoup sont jeunes, manquent de maturité. Ils sont portés aux nues par leur hiérarchie, et se sentent autorisés à tout faire », confirme le commissaire.

    Ni l’accident de la jeune policière ni les rapports du 7 octobre n’ont donc changé quoi que ce soit : le 12 décembre, à proximité de la « base » des motards, porte de la Villette, un de leurs équipages a percuté un passant. Cet homme de 84 ans a été grièvement blessé, souffrant notamment d’un traumatisme crânien. Transporté aux urgences, il est mort le lendemain. Le parquet de Paris avait précisé que l’accident avait eu lieu « vers 16 heures » et que le piéton traversait « au feu vert pour les piétons » tandis que les deux motos de la BRAV-M franchissaient un feu rouge.

    Selon les éléments recueillis par Mediapart, la particularité des BRAV-M est qu’elles peuvent décider de leur mobilisation sans consulter les autorités hiérarchiques de la direction de l’ordre public de la préfecture, dont elles dépendent, comme le démontrent les récits relatés dans les rapports du 7 octobre. Avec un objectif assumé : interpeller.

    Depuis le déploiement de cette unité unique en France, créée en 2019 pour intervenir quand les conditions habituelles du maintien de l’ordre sont dépassées − les précédentes brigades motorisées ont été interdites après le décès de Malik Oussekine en 1986 −, la BRAV-M est régulièrement décriée pour ses actions violentes.

    Ces binômes de policiers motorisés sont visés par plusieurs enquêtes judiciaires, notamment pour avoir agressé gratuitement un étudiant de 22 ans, ou encore pour avoir, pendant le mouvement contre la réforme des retraites, en mars 2023, roué de coups un jeune homme, Souleymane, 23 ans, tout en proférant des insultes racistes à son égard. Dernière affaire en date : des violences exercées sur un jeune réfugié en décembre, qui font l’objet d’une enquête administrative ouverte par le préfet de police, Laurent Nuñez.

    Dans un rapport publié en avril 2023, l’Observatoire parisien des libertés publiques (OPLP), créé à l’initiative de la Ligue des droits de l’homme (LDH) et du Syndicat des avocats de France (SAF), avait étrillé ces brigades, décrites comme « violentes et dangereuses, promptes à faire dégénérer les situations ». « La BRAV-M a développé un style qui puise dans les répertoires de la chasse, du film d’action, du virilisme et de l’intimidation », pouvait-on y lire.

    La mort du piéton en décembre et l’affaire des rapports sur la conduite « très accidentogène » des pilotes deux mois plus tôt viennent une nouvelle fois éclabousser la DOPC, chargée de la sécurisation de l’ensemble des événements et manifestations à Paris et en petite couronne. Elle sera donc sollicitée pour les cérémonies des Jeux olympiques de Paris, qui auront lieu dans six mois.

    La DOPC avait déjà été décapitée par l’affaire Benalla, qui avait emporté avec elle plusieurs des pontes de la préfecture. Jérôme Foucaud, un haut gradé sans expérience du maintien de l’ordre, avait alors été propulsé à la tête de cette direction. C’est lui qui avait été responsable du maintien de l’ordre pendant les manifestations des « gilets jaunes », et lui aussi qui avait signé le « télégramme » entérinant le dispositif de sécurisation de la finale de la Ligue des champions en mai 2022, restée dans les mémoires comme un fiasco d’ampleur internationale.

    Selon nos informations, le directeur de l’ordre public avait connaissance, depuis des mois, de la colère qui montait en interne contre les motards de la BRAV-M, sujet qui avait été évoqué au cours de plusieurs réunions. Interrogé à ce sujet via la préfecture de police, Jérôme Foucaud ne nous a pas répondu.

  • Così l’Italia ha svuotato il diritto alla trasparenza sulle frontiere

    Il Consiglio di Stato ha ribadito la inaccessibilità “assoluta” degli atti che riguardano genericamente la “gestione delle frontiere e dell’immigrazione”. Intanto le forniture milionarie del governo a Libia, Tunisia ed Egitto continuano.

    L’Italia fa un gigantesco e preoccupante passo indietro in tema di trasparenza sulle frontiere e di controllo democratico dell’esercizio del potere esecutivo. Su parte delle nostre forniture milionarie alla Libia, anche di natura militare, per bloccare le persone rischia infatti di calare un velo nero. A fine 2023 il Consiglio di Stato ha pronunciato una sentenza che riconosce come non illegittima la “assoluta” inaccessibilità di quegli atti della Pubblica amministrazione che ricadono genericamente nel settore di interesse della “gestione delle frontiere e dell’immigrazione”, svuotando così di fatto l’istituto dell’accesso civico generalizzato che è a disposizione di tutti i cittadini (e non solo dei giornalisti). Non è un passaggio banale dal momento che la conoscenza dei documenti, dei dati e delle informazioni amministrative consente, o meglio, dovrebbe consentire la partecipazione alla vita di una comunità, la vicinanza tra governanti e governati, il consapevole processo di responsabilizzazione della classe politica e dirigente del Paese. Ma la teoria traballa. E ne siamo testimoni.

    Breve riepilogo dei fatti. Il 21 ottobre 2021 l’Agenzia industrie difesa (Aid) -ente di diritto pubblico controllato dal ministero della Difesa- stipula un “Accordo di collaborazione” con la Direzione centrale dell’Immigrazione e della polizia delle frontiere in seno al ministero dell’Interno. Fu il Viminale -allora guidato dalla prefetta Luciana Lamorgese, che come capo di gabinetto ebbe l’attuale ministro, Matteo Piantedosi- a rivolgersi all’Agenzia, chiedendole “la disponibilità a fornire collaborazione per iniziative a favore dei Paesi non appartenenti all’Unione europea finalizzate al rafforzamento delle capacità nella gestione delle frontiere e dell’immigrazione e in materia di ricerca e soccorso in mare”. L’accordo dell’ottobre di tre anni fa riguardava una cooperazione “da attuarsi anche tramite la fornitura di mezzi e materiali” per dare impulso alla seconda fase del progetto “Support to integrated border and migration management in Libya”.

    Il Sibmmil è legato finanziariamente al Fondo fiduciario per l’Africa, istituito dalla Commissione europea a fine 2015 al dichiarato scopo di “affrontare le cause profonde dell’instabilità, degli spostamenti forzati e della migrazione irregolare e per contribuire a una migliore gestione della migrazione”. La prima “fase” del progetto è dotata di un budget di 46,3 milioni di euro, la seconda, quella al centro dell’accordo tra Aid e ministero dell’Interno, di 15 milioni. A beneficiare di queste forniture (navi, formazione, equipaggiamenti, tecnologie), come abbiamo ricostruito in questi anni, sono state soprattutto le milizie costiere libiche, che si sono rese responsabili di gravissime violazioni dei diritti umani. Nel 2022, pochi mesi dopo la stipula dell’accordo, abbiamo inoltrato come Altreconomia un’istanza di accesso civico alla Aid -allora guidata dall’ex senatore Nicola Latorre, sostituito dal dicembre scorso dall’accademica Fiammetta Salmoni- per avere la copia del testo e degli allegati.

    La richiesta fu negata richiamando a mo’ di “sostegno normativo” un decreto del ministero dell’Interno datato 16 marzo 2022 (ancora a guida Lamorgese). L’oggetto di quel provvedimento era l’aggiornamento della “Disciplina delle categorie di documenti sottratti al diritto di accesso ai documenti amministrativi”. Un’apparente formalità. Il Viminale, però, agì di sostanza, includendo tra i documenti ritenuti “inaccessibili per motivi attinenti alla sicurezza, alla difesa nazionale ed alle relazioni internazionali” anche quelli “relativi agli accordi intergovernativi di cooperazione e alle intese tecniche stipulati per la realizzazione di programmi militari di sviluppo, di approvvigionamento e/o supporto comune o di programmi per la collaborazione internazionale di polizia, nonché quelli relativi ad intese tecnico-operative per la cooperazione internazionale di polizia inclusa la gestione delle frontiere e dell’immigrazione”.

    Il 16 gennaio 2023 Roma e Ankara hanno firmato un memorandum per “procedure operative standard” per il distacco in Italia di “esperti della polizia nazionale turca”

    Non solo. In quel decreto si schermava poi un altro soggetto sensibile: Frontex. Vengono infatti classificati come inaccessibili anche i “documenti relativi alla cooperazione con l’Agenzia europea della guardia di frontiera e costiera (appunto Frontex, ndr), per la sorveglianza delle frontiere esterne dell’Unione europea coincidenti con quelle italiane e che non siano già sottratti all’accesso dall’applicazione di classifiche di riservatezza Ue”. Così come le “relazioni, rapporti ed ogni altro documento relativo a problemi concernenti le zone di confine […] la cui conoscenza possa pregiudicare la sicurezza, la difesa nazionale o le relazioni internazionali”.

    È per questo motivo che lo definimmo il “decreto che azzera la trasparenza sulle frontiere”, promuovendo di lì a poco un ricorso al Tar -grazie agli avvocati Giulia Crescini, Nicola Datena, Salvatore Fachile e Ginevra Maccarone dell’Associazione per gli studi giuridici sull’immigrazione e membri del progetto Sciabaca&Oruka- contro i ministeri dell’Interno, della Difesa, della Pubblicazione amministrazione, oltreché l’Agenzia industrie difesa (Aid), proprio per vedere riconosciuto il diritto all’accesso civico generalizzato. In primo grado, però, il Tar del Lazio ci ha dato torto.

    Ed eccoci arrivati al Consiglio di Stato, il cui pronunciamento, pubblicato a metà novembre 2023, ha ritenuto infondato il nostro appello, riconoscendo come “fonte di un divieto assoluto all’accesso civico generalizzato”, non sorretto perciò da alcuna motivazione, proprio quel decreto ministeriale firmato Luciana Lamorgese del marzo 2022. “All’ampliamento della platea dei soggetti che possono avvalersi dell’accesso civico generalizzato corrisponde un maggior rigore normativo nella previsione delle eccezioni poste a tutela dei contro-interessi pubblici e privati”, hanno scritto i giudici della quarta sezione.

    I legali che ci hanno accompagnato in questo percorso non la pensano allo stesso modo. “Il Consiglio di Stato ha affermato che il decreto ministeriale del 16 marzo 2022, una fonte secondaria, non legislativa, adottata in attuazione della disciplina del diverso istituto dell’accesso documentale, abbia introdotto nell’ordinamento un limite assoluto all’accesso civico, che può essere invocato dalla Pubblica amministrazione senza che questa sia tenuta a fornire alcuna motivazione in merito alla sua ricorrenza.

    Si tratta di un’evidente elusione del dettato normativo, che prevede in materia una riserva assoluta di legge”, osservano le avvocate Crescini e Maccarone. Che aggiungono: “I giudici hanno respinto anche la censura relativa all’assoluta genericità del limite introdotto con il decreto ministeriale, che non individua precisamente le categorie di atti sottratti all’accesso, ma al contrario solo il settore di interesse, cioè la gestione delle frontiere e dell’immigrazione, essendo idoneo a ricomprendere qualunque tipologia di atto, documento o dato, di fatto svuotando di contenuto l’istituto”. Questa sentenza del Consiglio di Stato rischia di rappresentare un precedente preoccupante. “L’accesso civico è uno strumento moderno che avrebbe potuto garantire la trasparenza degli atti della Pubblica amministrazione secondo canoni condivisibili che rispecchiano le esigenze che si sono cristallizzate in tutta Europa nel corso degli ultimi anni -riflettono le avvocate-. Tuttavia con questa interpretazione l’istituto viene totalmente svuotato di significato, costringendoci a fare un passo indietro di notevole importanza in tema di trasparenza, che è chiamata ad assicurare l’effettivo andamento democratico di un ordinamento giuridico”.

    I mezzi guardacoste che l’Italia si appresta a cedere quest’anno alla Guardia nazionale del ministero dell’Interno tunisino sono sei

    Le forniture italiane per ostacolare i transiti, intanto, continuano. Negli ultimi mesi la Direzione centrale dell’Immigrazione e della polizia delle frontiere del Viminale -retta da Claudio Galzerano, già a capo di Europol- ha ripreso con forza a bandire gare o pubblicare, a cose fatte, affidamenti diretti. Anche per trasferte o distacchi in Italia di “ufficiali” libici, tunisini, ivoriani o “esperti della polizia nazionale turca”. La delegazione della Libyan coast guard and port security, ad esempio, è stata portata dal 15 al 18 gennaio di quest’anno alla base navale della Guardia di Finanza a Capo Miseno (NA) per una “visita tecnica”. Nei mesi prima altre “autorità libiche” erano state formate alle basi di Gaeta (LT) o Capo Miseno. Gli ufficiali della Costa d’Avorio sono stati in missione dal 30 ottobre scorso al 20 gennaio 2024 “in materia di rimpatri”. Sono stati portati nei punti caldi di Lampedusa e Ventimiglia.

    Al dicembre 2023 risale invece la firma dell’accordo tra la Direzione centrale e il Comando generale della Gdf per la fornitura di navi, assistenza, manutenzione, supporto tecnico-logistico a beneficio di Libia, Tunisia ed Egitto. Obiettivo: il “rafforzamento delle capacità nella gestione delle frontiere e dell’immigrazione e in materia di ricerca e soccorso in mare”. Proprio alla Guardia nazionale del ministero dell’Interno di Tunisi finiranno sei guardacoste litoranei della classe “G.L. 1.400”, con servizi annessi del tipo “consulenza, assistenza e tutoraggio”, per un valore di 4,8 milioni di euro (i soldi li mette il Viminale, i mezzi e la competenza la Guardia di Finanza). Navi ma anche carburante. A inizio gennaio di quest’anno il direttore Galzerano, dietro presunta richiesta di non ben precisate “autorità tunisine”, ha approvato la spesa di “nove milioni di euro circa” (testualmente) per “il pagamento del carburante delle unità navali impegnate nella lotta all’immigrazione clandestina e nelle operazioni di ricerca e di soccorso” nelle acque tunisine. Dove hanno recuperato le risorse? Da un fondo ministeriale dedicato a “misure volte alla prevenzione e al contrasto della criminalità e al potenziamento della sicurezza nelle strutture aeroportuali e nelle principali stazioni ferroviarie anche attraverso imprescindibili misure di cooperazione internazionale”. Chissà quale sarà la prossima fermata.

  • #Frontex, Cutro è un ricordo sbiadito: sorvegliare dall’alto resta la priorità

    Un anno dopo la strage, l’Agenzia europea della guardia di frontiera investe ancora su velivoli per sorvolare il Mediterraneo. Dal 2016 a oggi la spesa supera mezzo miliardo di euro. Una strategia dagli esiti noti: più respinti e più morti

    Frontex è pronta a investire altri 158 milioni di euro per sorvegliare dall’alto il Mediterraneo. A un anno dal naufragio di Steccato di Cutro (KR), costato la vita a 94 persone, la strategia dell’Agenzia che sorveglia le frontiere esterne europee non cambia. Anzi, si affina con “occhi” sempre più efficaci per rintracciare e osservare dall’alto le imbarcazioni in difficoltà. “Si continua a pensare che Frontex sia un’innocua gregaria degli Stati, senza responsabilità -spiega Laura Salzano, docente di diritto dell’Ue presso l’Università di Barcellona-. Ma in mare, sempre di più, le sue attività hanno conseguenze dirette sulla vita delle persone”.

    Lo racconta, in parte, anche la strage di Cutro del 26 febbraio 2023. Alle 22.26 della sera prima infatti fu l’Agenzia, attraverso il velivolo “Eagle 1”, a individuare per prima la “Summer love” e a segnalarla, quand’era a circa 40 miglia delle coste crotonesi, al Frontex coordination centre. Da Varsavia le coordinate della nave furono girate alle autorità competenti: tra queste anche l’International coordination centre (ICC) di Pratica di mare (RM) in cui, allo stesso tavolo, siedono le autorità italiane e la stessa Agenzia che ha il dovere di monitorare quello che succede. “Nonostante fosse noto che c’erano persone nella ‘pancia della nave’ e il meteo stesse peggiorando, si è deciso di attivare un’operazione di polizia e non di ‘ricerca e soccorso’ -spiega Salzano-. Questa classificazione a mio avviso errata è responsabilità anche dell’Agenzia”. Un errore che potrebbe aver inciso anche sul ritardo nei soccorsi.

    Lo stabilirà la Procura di Crotone che, a metà gennaio 2024, non ha ancora chiuso le indagini sulla strage. Qualcosa di quanto successo quella sera, però, si sa già, perché il processo contro i presunti manovratori dell’imbarcazione è già in fase di dibattimento. “La prima barca della Guardia costiera -spiega Francesco Verri, avvocato di decine di familiari delle vittime- arriva sul luogo del naufragio alle 6.50, quasi tre ore dopo il naufragio: salva due persone ma recupera anche il cadavere di un bambino morto di freddo. Perché ci hanno impiegato così tanto tempo per percorrere poche miglia nautiche? Sulla spiaggia la pattuglia è arrivata un’ora e 35 minuti dopo il naufragio. Da Crotone a Cutro ci vogliono dieci minuti di macchina”. Domande a cui dovranno rispondere le autorità italiane.

    Al di là delle responsabilità penali, però, quanto successo quella notte mostra l’inadeguatezza del sistema dei soccorsi di cui la sorveglianza aerea è un tassello fondamentale su cui Frontex continua a investire. Con importi senza precedenti.

    Quando Altreconomia va in stampa, a metà gennaio, l’Agenzia sta ancora valutando le offerte arrivate per il nuovo bando da 158 milioni di euro per due servizi di monitoraggio aereo: uno a medio raggio, entro le 151 miglia nautiche dall’aeroporto di partenza (budget di 100 milioni), l’altro a lungo raggio che può superare le 401 miglia di distanza (48 milioni).

    Documenti di gara alla mano, una delle novità più rilevanti riguarda i cosiddetti “Paesi ospitanti” delle attività di monitoraggio: si prevede infatti espressamente che possano essere anche Stati non appartenenti all’Unione europea. In sostanza: il velivolo potrebbe partire da una base in Tunisia o Libia; e, addirittura, si prevede che un host country liaison officer, ovvero un agente di “contatto” delle autorità di quel Paese, possa salire a bordo dell’aeromobile. “Bisogna capire se sarà fattibile operativamente -sottolinea Salzano-. Ma non escludere questa possibilità nel bando è grave: sono Paesi che non sono tenuti a rispettare gli standard europei”.

    Mentre lavora per dispiegare la sua flotta anche sull’altra sponda del Mediterraneo, Frontex investe sulla “qualità” dei servizi richiesti. Nel bando si richiede infatti che il radar installato sopra il velivolo sia in grado di individuare (per poi poter fotografare) un oggetto di piccole dimensioni a quasi dieci chilometri di distanza e uno “medio” a quasi 19. Prendendo ad esempio il caso delle coste libiche, più la “potenza di fuoco” è elevata più il velivolo potrà essere distante dalle coste del Nordafrica ma comunque individuare le imbarcazioni appena partite.

    La distanza, in miglia nautiche, che l’ultimo bando pubblicato da Frontex nel novembre 2023 prevede tra l’aeroporto di partenza del velivolo e l’area di interesse da sorvolare è di 401 miglia. Nella prima gara riguardante questi servizi, pubblicata dall’agenzia nell’agosto 2016, la distanza massima prevista era di 200 miglia

    Frontex sa che, oltre alla componente meccanica, l’efficienza “tecnica” dei suoi droni è fondamentale. Per questo il 6 e 7 settembre 2023 ha riunito a Varsavia 16 aziende del settore per discutere delle nuove frontiere tecnologiche dei “velivoli a pilotaggio remoto”. A presentare i propri prodotti c’era anche l’italiana Leonardo Spa, leader europeo nel settore aerospaziale e militare, che già nel 2018 aveva siglato un accordo da 1,6 milioni di euro per fornire droni all’Agenzia.

    L’ex Finmeccanica è tra le 15 aziende che hanno vinto i bandi pubblicati da Frontex per la sorveglianza aerea. Se si guarda al numero di commesse aggiudicate, il trio formato da DEA Aviation (Regno Unito), CAE Aviation (Stati Uniti) ed EASP Air (Spagna) primeggia con oltre otto contratti siglati. Valutando l’importo delle singole gare, a farla da padrone sono invece due colossi del settore militare: la tedesca Airbus DS e la Elbit System, principale azienda che rifornisce l’esercito israeliano, che si sono aggiudicate in cordata due gare (2020 e 2022) per 125 milioni di euro. Dal 2016 a oggi, il totale investito per questi servizi supera i cinquecento milioni di euro.

    “La sorveglianza è una delle principali voci di spesa dell’Agenzia -spiega Ana Valdivia, professoressa all’Oxford internet institute che da anni analizza i bandi di Frontex- insieme a tutte le tecnologie che trasformano gli ‘eventi reali’ in dati”. E la cosiddetta “datificazione” ha un ruolo di primo piano anche nel Mediterraneo. “La fotografia di una barca in distress ha un duplice scopo: intercettarla ma anche avere un’evidenza digitale, una prova, che una determinata persona era a bordo -aggiunge Valdivia-. Questa è la ‘sorveglianza’: non un occhio che ci guarda giorno e notte, ma una memoria digitale capace di ricostruire in futuro la nostra vita. Anche per i migranti”. E per chi è su un’imbarcazione diretta verso l’Europa è vitale a chi finiscono le informazioni.

    Nell’ultimo bando pubblicato da Frontex, si prevede che “il contraente trasferirà i dati a sistemi situati in un Paese terzo se è garantito un livello adeguato di protezione”. “Fanno finta di non sapere che non possono farlo -aggiunge Salzano- non potendo controllare che Paesi come la Tunisia e la Libia non utilizzino quei dati, per esempio, per arrestare le persone in viaggio una volta respinte”. Quello che si sa, invece, è che quei dati -nello specifico le coordinate delle navi- vengono utilizzate per far intervenire le milizie costiere libiche. Per questo motivo i droni si avvicinano sempre di più alla Libia. Se nel 2016 l’Agenzia, nella prima gara pubblicata per questa tipologia di servizi, parlava di area operativa nelle “vicinanze” con le coste italiane e greche, fino a 200 miglia nautiche dall’aeroporto di partenza, dal 2020 in avanti questa distanza ha superato le 401 miglia.

    Lorenzo Pezzani, professore associato di Geografia all’università di Bologna, ha esaminato giorno per giorno i tracciati di “Heron”, il più importante drone della flotta di Frontex: nel 2021 l’attività di volo si è concentrata tra Zuara e Tripoli, il tratto di costa libica da cui partiva la maggior parte delle barche.

    “Il numero di respingimenti delle milizie libiche -spiega Pezzani autore dello studio “Airborne complicity” pubblicato a inizio dicembre 2022- cresce all’aumentare delle ore di volo del drone e allo stesso tempo la mortalità non diminuisce, a differenza di quanto dichiarato dall’Agenzia”. Che tramite il suo direttore Hans Leijtens, entrato in carica a pochi giorni dal naufragio di Cutro, nega di avere accordi o rapporti diretti con la Libia. “Se è così, com’è possibile che un drone voli così vicino alle coste di uno Stato sovrano?”, si chiede Salzano. Chi fornirà il “nuovo” servizio per Frontex dovrà cancellare le registrazioni video entro 72 ore. Meglio non lasciare troppe tracce in giro.

  • La #Grèce condamnée par la #Cour_européenne_des_droits_de_l’homme après les tirs de gardes-côtes sur des embarcations de migrants

    La CEDH a condamné le pays à verser 80 000 euros aux proches d’un migrant syrien mort après avoir été blessé par balle par les gardes-côtes grecs, en 2014.

    Le #22_septembre_2014, à l’aube, non loin des côtes turques et près de l’îlot grec de #Psérimos, un bateau à moteur transportant quatorze migrants est repéré par les #gardes-côtes_grecs. Le commandant du navire militaire demande au conducteur d’arrêter l’embarcation. Ce dernier refuse. Les gardes-côtes tirent alors vingt balles pour immobiliser la vedette – sept coups de semonce et treize tirs ciblés sur le moteur. Deux ressortissants syriens sont blessés. L’un d’eux, Belal Tello est touché à la tête et conduit par hélicoptère à l’hôpital de Rhodes, une île grecque voisine. En août 215, il est transféré en Suède où habitent sa femme et ses enfants (les requérants). Il est pris en charge à l’hôpital universitaire Karolinska, à Stockholm. Mais il meurt quatre mois plus tard.

    Les proches de #Belal_Tello ont attendu près de dix ans pour obtenir le verdict de la Cour européenne des droits de l’Homme (CEDH), qui a finalement condamné la Grèce à leur verser 80 000 euros. D’après la cour, Athènes n’a pas prouvé « que l’usage de la force était absolument nécessaire » pour arrêter le bateau qui s’approchait des côtes grecques. « Les treize coups de feu tirés exposaient forcément les passagers de la vedette à un risque », ont estimé les sept juges européens.

    « La condamnation concerne également l’enquête inefficace menée par les autorités grecques sur l’incident », souligne, dans un communiqué, l’ONG Refugee Support Aegean (RSA), qui représentait, avec l’association Pro Asyl, la famille de la victime. Le parquet grec avait ouvert une enquête préliminaire sur cet incident, mais la justice avait rapidement classé l’affaire en 2015. D’après la CEDH, l’enquête menée par les autorités nationales comportait « de nombreuses lacunes qui ont conduit notamment à la perte d’éléments de preuve ». « Au cours de la procédure pénale, les deux réfugiés blessés par balle n’ont jamais été appelés à témoigner. Les déclarations des témoins recueillies lors des interrogatoires préliminaires semblent identiques », souligne RSA. La CEDH s’est aussi étonnée que plusieurs mesures pouvant faire avancer l’enquête n’aient pas été prises : une expertise médico-légale sur la blessure à la tête du réfugié syrien ; un rapport balistique établissant les trajectoires des tirs…
    « Impunité généralisée »

    Ce n’est pas la première fois que les agissements des gardes-côtes grecs sont condamnés ou mis en cause. En juillet 2022, la CEDH avait accordé 330 000 euros à seize requérants dont le bateau avait coulé en mer Egée, près de l’île de Farmakonisi, en janvier 2014. Onze personnes, dont huit enfants, avaient trouvé la mort dans ce naufrage provoqué par un navire garde-côtes grec, qui aurait navigué à grande vitesse à proximité de l’embarcation, entraînant le chavirement de celle-ci.
    La CEDH avait déjà noté que les autorités grecques n’avaient pas mené une « enquête approfondie et effective permettant de faire la lumière sur les circonstances du naufrage ». L’une des avocates des requérants, Maria Papamina, du Conseil pour les réfugiés grec, avait déclaré, lors du rendu de cette décision de justice : « Nous avions l’impression que l’intention [des autorités grecques] était de clore rapidement l’affaire. »

    Et c’est justement ce que les défenseurs des droits de l’homme souhaitent éviter, que le cas d’un autre naufrage survenu il y a quelques mois, au large du Péloponnèse, à Pylos, ne soit classé, lui aussi, sans suite. Le 14 juin 2023, un chalutier, l’Adriana, parti de Libye, a coulé avec près de 750 migrants à son bord, dans les eaux territoriales grecques. Seules 104 personnes ont survécu et 82 corps ont été retrouvés.

    Les témoignages des survivants suggèrent qu’un patrouilleur garde-côtes grec a attaché une corde à l’Adriana et tiré dessus, ce qui aurait conduit à faire chavirer le bateau surchargé de migrants. D’après plusieurs enquêtes journalistiques, les opérations de sauvetage ont été également tardivement mises en place.
    Dans un rapport publié en décembre 2023, Amnesty International et Human Rights Watch déploraient, six mois après le drame, le « peu de progrès » dans les investigations menées par les autorités grecques. Selon les deux ONG, « les échecs historiques des enquêtes grecques sur les naufrages (…) et l’impunité généralisée pour les violations systémiques des droits humains à ses frontières suscitent des inquiétudes quant à l’adéquation des enquêtes judiciaires en cours sur la tragédie de Pylos ».

  • EU grants €87m to Egypt for migration management in 2024

    Over 2024, the EU will provide €87 million and new equipment to Egypt for a migration management project started in 2022, implemented by the UN migration agency and the French Interior Ministry operator Civipol, three sources close to the matter confirmed to Euractiv.

    The €87 million may increase up to €110 million after the next EU-Egypt Association Council meeting on 23 January, two sources confirmed to Euractiv.

    The European Commission is also conducting parallel negotiations with Cairo to make a raft of funding for other projects which regards a wide range of sectors, including migration, conditional under the International Monetary Fund requests for reforms, a source close to the negotiations told Euractiv.

    The €87 million will be dedicated to increasing the operation capacity of the Egyptian navy and border guards for border surveillance and search and rescue operations at sea.

    The EU-Egypt migration management project started in 2022 with an initial €23 million, with a further €115 million approved for 2023, one of the three sources confirmed to Euractiv.

    The funds for 2022 and 2023 were used for border management, anti-smuggling and anti-trafficking activities, voluntary returns and reintegration projects.

    “With these EU funds, IOM [the UN’s migration agency, the International Organisation of Migration] is supporting Egyptian authorities through capacity building activities which promote rights-based border management and the respect of international law and standards, also with regard to search and rescue operations,” an official source from IOM told Euractiv. IOM is involved in the training and capacity building of the Egyptian authorities.

    French operator Civipol is working on the tendering, producing and delivering the search new rescue boats for 2024, one of the three sources confirmed to Euractiv.

    However, according to the EU’s asylum agency’s (EUAA) 2023 migration report, there have been almost no irregular departures from the Egyptian coasts since 2016, with most Egyptian irregular migrants to the EU having departed from Libya.

    At the same time, there has been a significant increase in Egyptian citizens applying for visas in EU countries in recent years, the EUAA report said, mainly due to the deteriorating domestic situation in the country.
    Deepening crisis in Egypt

    Egypt, a strategic partner of the EU, is experiencing a deepening economic and political crisis, with the country’s population of 107 million facing increasing instability and a lack of human rights guarantees.

    In a letter to heads of state and EU institutions last December, the NGO Human Rights Watch asked the EU to “ensure that any recalibration of its partnership with Egypt and related macro-financial assistance provide[s] an opportunity to improve the civil, political, and economic rights of the Egyptian people”.

    “Its impact will only be long-lasting if linked to structural progress and reforms to address the government’s abuses and oppression, that have strangled people’s rights as much as the country’s economy,” the NGO wrote.

    The human rights crisis cannot be treated as separate from the economic crisis, Timothy E. Kaldas, deputy director of the Tahrir Institute for Middle East Policy, told Euractiv. “Political decisions and political practices of the regime play a central role in why Egypt’s economy is the way that it is,” he said.

    “The regime, in an exploitative manner, leverages the Egyptian state. For instance, it forces the making of contracts to regime-owned companies to do infrastructure projects that are extremely costly, and not necessarily contributing to the public good,” Kaldas argued, citing the construction of wholly new cities, or “new palaces for the president”.

    While such projects are making the Egyptian elites richer, the Egyptian people are increasingly poor, and in certain cases, forced to leave the country, Kaldas explained.

    With food and beverage inflation exceeding 70% in Egypt in 2023, the currency facing multiple shocks and collapses reducing Egyptians’ purchasing power and private investors not seeing the North African country as a good place to invest, “the situation is very bleak”, the expert said.

    The independence of the private sector was slammed in a report by Human Rights Watch in November 2018. In the case of Juhayna Owners, two Egyptian businessmen were detained for months after refusing to surrender their shares in their company to a state-owned business.

    Recent events at the Rafah crossing in Gaza, frictions in the Red Sea with Houthi rebels in Yemen and war in the border country of Sudan have compounded the instability.
    Past EU-Egypt relations

    During the last EU-Egypt Association Council in June 2022, the two partners outlined a list of partnership priorities “to promote joint interests, to guarantee long-term stability and sustainable development on both sides of the Mediterranean and to reinforce the cooperation and realise the untapped potential of the relationship”.

    The list of priorities regards a wide range of sectors that the EU is willing to help Egypt. Among others, the document which outlines the outcomes of the meeting, highlights the transition to digitalisation, sustainability and green economy, trade and investment, social development and social justice, energy, environment and climate action, the reform of the public sector, security and terrorism, and migration.

    • L’UE offre à l’Egypte une aide économique contre un meilleur contrôle des migrants

      Les représentants de l’Union européenne signeront dimanche au Caire un partenariat avec le gouvernement d’Abdel Fattah Al-Sissi. Il apportera un soutien de plus de 7 milliards d’euros en échange d’une plus grande surveillance des frontières.

      Après la Tunisie, l’Egypte. Trois premiers ministres européens – Giorgia Meloni, la présidente du conseil italien, Alexander De Croo et Kyriakos Mitsotakis, les premiers ministres belge et grec – et Ursula von der Leyen, la présidente de la Commission européenne, sont attendus dimanche 17 mars au Caire. Ils doivent parapher une « #déclaration_commune » avec Abdel Fattah #Al-Sissi, le président égyptien, pour la mise en place d’un #partenariat global avec l’Union européenne (UE). A la clé pour l’Egypte un chèque de 7,4 milliards d’euros, comme l’a révélé le Financial Times le 13 mars.

      Cet accord survient après l’annonce, au début de mars, d’un #prêt de 8 milliards de dollars (plus de 7,3 milliards d’euros) du #Fonds_monétaire_international à l’Egypte et, surtout, à la mi-février d’un vaste plan d’investissements de 35 milliards de dollars des #Emirats_arabes_unis. A cette aune, l’aide européenne semble plutôt chiche.

      Pour Bruxelles, l’urgence est d’éviter un écroulement de l’économie égyptienne, très dépendante de l’extérieur. Depuis le Covid-19 et la guerre en Ukraine, elle est plongée dans le marasme et les déficits budgétaires s’enchaînent. De surcroît, le pays doit faire face aux conséquences de la guerre à Gaza et, notamment, aux attaques houthistes en mer Rouge, qui ont entraîné une réduction du nombre de cargos dans le canal de Suez et fait chuter les revenus du pays. Enfin, le tourisme, qui avait atteint des records en 2023 avec plus de quinze millions de visiteurs, pourrait pâtir de la guerre aux portes du pays.

      Crainte d’une arrivée massive de Palestiniens

      Dans le détail, la Commission européenne devrait apporter 5 milliards d’euros de soutien budgétaire à l’Egypte, dont 1 milliard déboursé d’ici au mois de juin, selon une procédure d’urgence. Les 4 autres milliards suivront à plus long terme. Le ministre des finances égyptien, Mohamed Maait, a confirmé cette somme, évoquant une aide de « 5 milliards à 6 milliards de dollars » (4,5 milliards à 5,5 milliards d’euros).

  • Les féminicides ont-ils vraiment baissé de 20 % en 2023 ?

    Le 2 janvier, le garde des Sceaux Eric Dupont-Moretti a affirmé au Figaro que le nombre de #meurtres de #femmes par leur conjoint ou ex-conjoint était en baisse en 2023, et atteignait 94, contre 118 en 2022, soit une diminution de 20 %.

    « Nous savons que lutter contre ce fléau prend du temps (…). Mais l’engagement de la justice française pour endiguer les féminicides porte tout de même ses premiers fruits », a-t-il commenté. Ces chiffres ont rapidement été contestés par plusieurs associations et collectifs féministes. Qu’en est-il ?

    Premier sujet d’étonnement : en évoquant les 118 féminicides de 2022, le #garde_des_Sceaux fait référence aux chiffres de la #Délégation_aux_victimes (#DAV) du #ministère_de_l’Intérieur, « l’étude nationale sur les morts violentes au sein du couple », publiée chaque année depuis 2006. Or pour l’année 2023, la DAV n’a publié aucun chiffre et indique qu’aucun bilan provisoire ne sera disponible avant le 31 janvier 2024.

    Le chiffre avancé par Eric Dupont-Moretti correspond, selon Franceinfo, aux remontées des parquets, et pourrait être corrigé ultérieurement, même si ce sera vraisemblablement à la marge. Reste une question : pourquoi le garde des Sceaux ouvre-t-il l’année en communiquant sur le sujet au mépris du calendrier retenu par le ministère de l’Intérieur ?

    Des écarts avec les associations féministes

    Deuxième sujet d’étonnement : les associations et collectifs féministes qui ont contribué depuis plusieurs années à mettre le sujet des féminicides sur le devant de la scène obtiennent des chiffres plus élevés, à partir de la veille qu’elles font de la presse nationale et de la presse quotidienne régionale.

    Le #collectif_des_féminicides par compagnon ou ex, qui mène ce travail depuis 2016, en est ainsi à 102 féminicides conjugaux en 2023 et souligne que plusieurs enquêtes pour mort suspecte sont toujours en cours. De son côté, l’#Inter-Orga_Féminicides (#IOF), constituée en 2021, recense 134 féminicides en 2023, dont 72 % conjugaux, soit 97.

    Précisons que les écarts entre les chiffres associatifs sont aisés à expliquer : le travail est entièrement réalisé par des bénévoles et repose sur les articles de presse. Il peut donc y avoir des « trous dans la raquette ».

    A l’inverse, les chiffres du ministère de l’Intérieur reposent sur les déclarations des causes d’#homicides par les services de police et de gendarmerie, complétées par une vérification auprès des parquets afin de préciser la qualification pénale. Sachant que le #droit français ne reconnaît pas la notion de féminicide – le #meurtre d’une femme en raison de son #genre –, mais distingue le meurtre, l’#assassinat (meurtre avec préméditation) et les violences volontaires ayant entraîné la mort sans intention de la donner.

    Une #définition institutionnelle trop restreinte

    Si les chiffres avancés par le ministre font réagir, c’est aussi que la définition du féminicide retenue par les institutions françaises est très restreinte : elle ne tient compte que des #féminicides_conjugaux et laisse de côté d’autres féminicides, les meurtres de mères par leurs fils, celui de femmes par des collègues ou un inconnu, ou encore les meurtres par des clients ou d’autres personnes sur des femmes exerçant le travail du sexe.

    Si la notion de féminicide fait l’objet de discussions dans les milieux féministes depuis de longues années, c’est avec la publication en 1992 du livre des chercheuses Diana Russel et Jill Radford Femicide : the politics of women killing qu’il gagne en popularité, rappelle la journaliste Laurène Daycard dans Nos Absentes. A l’origine des féminicides (Seuil, 2023).

    Les institutions internationales retiennent elles aussi une définition plus large que celle de la France. Les #Nations_unies distinguent depuis 2012 les #féminicides_intimes, commis par des proches, qu’ils soient conjoints ou parents de la victime, des #féminicides_non_intimes, ceux commis contre les professions stigmatisées comme la #prostitution, et les #féminicides_sexuels_systémiques où il n’y a pas de lien préalable entre la victime et son meurtrier, comme les massacres de femmes parce qu’elles sont des femmes.

    D’autres typologies sont possibles. En Espagne, comme le rapporte Le Monde, cinq types de féminicides sont comptabilisés : conjugaux, familiaux, sociaux (exécuté par un inconnu, un collègue de travail, un ami), sexuels (lié à la violence ou à l’exploitation sexuelle ainsi qu’au travail du sexe, mariage forcé ou mutilation génitale), et enfin, les féminicides par procuration, soit l’assassinat d’une personne (proches, enfants) pour nuire à une femme.

    En France, si le #collectif_Féminicides_par_compagnon_ou_ex recense les féminicides conjugaux, l’Inter-Orga Féminicides retient une définition plus extensive. Elle distingue les féminicides conjugaux, familiaux (commis par un enfant ou un parent) et sociaux.

    Au-delà des féminicides ?

    Au-delà de la définition même du féminicide, d’autres phénomènes s’inscrivent dans le continuum des #violences_de_genre qui structurent encore les sociétés contemporaines et doivent être a minima pris en compte.

    C’est le cas des #suicides_forcés, reconnus dans le Code pénal depuis 2020, et définis comme des suicides ou tentatives de suicides provoquées à la suite de #harcèlement dans le cadre de #violences_conjugales.

    Certains plaident pour leur intégration dans la définition du féminicide. En 2022, les services du ministère de l’Intérieur en ont recensé 759, presque exclusivement des femmes. Cela correspond à une multiplication par 3,3 depuis 2020, qui dit aussi une meilleure appréhension du phénomène.

    A cela s’ajoutent les #tentatives_de_féminicides, qui, si elles n’aboutissent pas à la mort de la victime, ont pourtant des conséquences destructrices. Le ministère de l’Intérieur recense ainsi 366 tentatives d’homicides au sein du couple en 2022, dont 267 contre des femmes. Cela, sans compter les infanticides commis dans le cadre de violences conjugales, ou les traumatismes d’enfants survivants d’un féminicide. Bref, pas de quoi pavoiser.

    Le maire de Grenoble et des représentants EELV et PS critiquent l’#opération_de_police de ce mercredi en Isère, et au passage la loi immigration.

    Le gouvernement voudrait passer à autre chose, la gauche s’y refuse. La loi immigration est revenue à toute vitesse dans les débats en cette fin décembre, conséquence de l’#arrestation d’une dizaine de #livreurs de repas en situation irrégulière mercredi 27 en #Isère, une information rapportée par Le Dauphiné Libéré. Le maire de #Grenoble, Éric Piolle, suivi par d’autres élus de gauche, a dénoncé « une #indignité » pendant que la CGT parlait de « #rafle ».

    L’édile écologiste a directement interpellé le ministre de l’Intérieur #Gérald_Darmanin, déplorant que « ces personnes seraient donc suffisamment ’régulières’ pour attendre dans le froid de vous livrer vos repas, mais pas pour vivre dignement avec nous ».

    « Voici le vrai visage de ce gouvernement »

    Éric Piolle veut ainsi relancer les discussions autour de la #régularisation des #travailleurs_sans_papiers dans les secteurs en tension. Une mesure ardemment défendue par la gauche pendant les débats sur la loi immigration, mais qui a finalement été écartée de la version du texte adoptée par le Parlement.

    Dans le sillage du maire, le secrétaire général du PS, #Olivier_Faure, s’est également exprimé les réseaux sociaux : « Si tous les étrangers en situation régulière ou irrégulière se mettaient en grève une journée, chacun se rendrait compte qu’ils sont dans tous les métiers de la seconde ligne, livreurs, auxiliaires de vie, caristes, assistantes maternelles… loués pendant la crise Covid et puis… ».

    Autre élue EELV, la présidente du groupe écologiste à l’Assemblée #Cyrielle_Chatelain a elle aussi dénoncé l’opération de police, et entre les lignes la loi immigration adoptée définitivement le 19 décembre dernier. « Voici le vrai visage de ce gouvernement : être méchant avec tous les étrangers, même s’ils travaillent, même s’ils s’intègrent », a-t-elle fustigé, là encore sur X (anciennement Twitter).

    Et pour cause : l’opération baptisée « #Uber_Eats », menée simultanément dans plusieurs localités iséroises (Grenoble, #Voiron, #Vienne…), a conduit à l’#interpellation de nombreux livreurs. Des ressortissants algériens, burkinabés, guinéens ou tunisiens qui ont été placés en #garde_à_vue à Lyon et Grenoble après la saisie de leur vélo, et qui ont été libérés après s’être vu notifier des #obligations_de_quitter_le_territoire_français (#OQTF) et des #interdictions_de_retour_sur_le_territoire (#IRTF), comme l’a expliqué #Mohamed_Fofana, responsable CGT des livreurs du département lors d’un point presse organisé ce vendredi.

    Piolle invité à « aimer les policiers »

    « Nous dénonçons cette opération de police (...) dans une période de fêtes où les associations de défense des migrants et beaucoup d’avocats sont en congé et les recours compliqués », a insisté ce responsable. « Nous sommes des travailleurs, pas des délinquants », a-t-il ajouté, rappelant que beaucoup de livreurs travaillent dans des conditions précaires et pour des « rémunérations scandaleusement basses ». « La place Victor Hugo (à Grenoble) a été complètement fermée par des camions de police. C’était une #nasse. Cela s’appelle une rafle quand cela vise une catégorie particulière de personnes », s’est indigné de son côté un responsable de l’Union locale de la CGT, Alain Lavi.

    Le procureur de la République de Grenoble, #Éric_Vaillant, a répondu à Éric Piolle et aux critiques ayant ciblé l’opération : « Ces #contrôles ont été opérés à ma demande. Ils ont aussi permis de constater que les livreurs en situation irrégulière étaient gravement exploités par ceux qui leur sous-louaient leur #licence. Des enquêtes sont engagées », a-t-il indiqué. La préfecture de l’Isère a pour sa part souligné être garante « de l’application des lois de la République ».

    Le ministre de l’Intérieur Gérald #Darmanin, interrogé à ce propos alors qu’il présentait le dispositif de sécurité pour la Saint-Sylvestre, s’est pour sa part contenté de lancer à Éric Piolle : « J’invite le maire de Grenoble à aimer les policiers et à soutenir la loi de la République ».

  • Beyond borders, beyond boundaries. A Critical Analysis of EU Financial Support for Border Control in Tunisia and Libya

    In recent years, the European Union (EU) and its Member States have intensified their effort to prevent migrants and asylum seekers from reaching their borders. One strategy to reach this goal consists of funding programs for third countries’ coast guards and border police, as currently happens in Libya and Tunisia.

    These programs - funded by the #EUTF_for_Africa and the #NDICI-Global_Europe - allocate funding to train and equip authorities, including the delivery and maintenance of assets. NGOs, activists, and International Organizations have amassed substantial evidence implicating Libyan and Tunisian authorities in severe human rights violations.

    The Greens/EFA in the European Parliament commissioned a study carried out by Profundo, ARCI, EuroMed Rights and Action Aid, on how EU funding is linked to human rights violations in neighbouring countries, such as Tunisia and Libya.

    The study answers the following questions:

    - What is the state of EU funding for programs aimed at enhancing border control capacities in Libya and Tunisia?
    - What is the human rights impact of these initiatives?
    - What is the framework for human rights compliance?
    - How do the NDICI-Global Europe decision-making processes work?

    The report highlights that the shortcomings in human rights compliance within border control programs, coupled with the lack of proper transparency clearly contradicts EU and international law. Moreover, this results in the insufficient consideration of the risk of human rights violations when allocating funding for both ongoing and new programs.

    This is particularly concerning in the cases of Tunisia and Libya, where this report collects evidence that the ongoing strategies, regardless of achieving or not the questionable goals of reducing migration flows, have a very severe human rights impact on migrants, asylum seekers and refugees.

    Au large de la Grèce, une équipe de garde-côtes survole et capture cette scène depuis un hélicoptère. Des centaines de migrants appellent au secours depuis un chalutier.     Ce cliché du 13 juin 2023 est repris dans toute la presse internationale.     • Frontex report into Greek shipwreck suggests more deaths could have been prevented

      A Frontex report suggesting that many of the deaths caused by the shipwreck off the Greek coast near Pylos last June could have been prevented was released by the Aegean Boat Report NGO on their X feed yesterday evening (January 31).

      Investigations into what happened to the Adriana, an overcrowded fishing vessel carrying some 750 people from Libya to Italy that sank off the coast of Greece on June 13, are ongoing.

      However, a report produced by the European Border Agency Frontex — marked “sensitive” and dated December 1, 2023 — was posted to X (formerly known as Twitter) late on January 31.

      The report was posted by Aegean Boat Report, an organization working with migrants in the eastern Mediterranean.

      In their post on X, they thank freelance Brussels-based journalist Eleonora Vasques for “making it available to the public.” Frontex told InfoMigrants in an email that they had released the report via their “Transparency Office.” They added that the “release wass part of a Public Access to Documents request, an important process that allows us to share information with the public.”

      Vasques writes regularly for the European news portal Euractiv. One of her latest reports looks into what happened in the Cutro shipwreck off Italy almost a year ago. The story was also sourced back to an internal Frontex report, which concluded that more lives could have potentially been saved if the response from Frontex and the Italian coast guard had been different.

      Long and detailed report

      The 17-page Pylos report from Frontex is redacted in parts and goes into great detail about what happened and which authorities and merchant ships were involved. It also compares timelines from various authorities, NGOs and media organizations.

      In the email to InfoMigrants, Frontex continued that they “strive to make such documents available in our Public Register of Documents as promptly as possible.” The Press Spokesperson Krzysztof Borowski wrote that the “Pylos tragedy is a stark reminder of the challenges and dangers faced at sea. We at Frontex share the profound concern and sadness of the public regarding this heartbreaking event.” He finished by saying: “Our thoughts are with all those affected by this tragedy, and we remain dedicated to our mission of safeguarding lives while ensuring border security.”
      Committment to ’assess cases more thoroughly

      Although the report finds that Frontex “followed applicable procedures”, it admitted that “going forward and based on a reviewed assessment methodology ... the team … should assess similar cases more thoroughly against the need to issue a Mayday alert.”

      A Mayday alert is a radio distress signal used at sea.

      The report appears to suggest that more could have been done on the day to prevent such a huge loss of life.

      According to the Frontex report posted on X, “in the hours following the sighting of Adriana, Frontex made three attempts to follow up on the case, by suggesting additional Frontex Surveillance Aircraft (FSA) sorties.”

      Frontex writes that “no reply was received by the Greek authorities to Frontex’ repeated offers until Adriana’s shipwreck.”

      Frontex made an initial statement on June 16 expressing “shock and sadness” at the events off Pylos.
      ’Greek authorities failed to timely declare a search and rescue situation’

      Although the investigating office at Frontex underlines that it is “not in a position to conclude what caused Adriana’s capsizing and shipwreck … it appears that the Greek authorities failed to timely declare a search and rescue and to deploy a sufficient number of appropriate assets in time to rescue the migrants.”

      The report stated that Frontex “regrets the lack of information provided by the Greek authorities to its enquiry but still expects to receive updates from the national investigations in progress.”

      According to Frontex’ timeline of the incident, the agency first learned about the existence of the fishing vessel carrying migrants on June 13 at around 10:12 UTC, or around 13:12 in Greek summer time. They spotted the vessel from their aerial surveillance plane Eagle 1. About four hours later, another update was sent to the fundamental rights monitor, but according to the report, nothing “out of the ordinary” was flagged regarding the vessel at this point.

      The next paragraph jumped to June 14 at 06.19 UTC, when the fundamental rights monitor received “another update … notifying that Adriana sank overnight and a SAR [Search and Rescue] was in progress.”
      ’Serious Incident Report’ launched by Frontex on June 26

      In the following days, the Office for Fundamental Rights at Frontex monitored the aftermath of the incident, states the report.

      They studied “Frontex’ own sightings of Adriana” along with “statements by Greek officials, and initial information reported in the media.”

      Frontex launched a “Serious Incident Report (SIR) on June 26, “to clarify the role of Frontex in the incident as well as the legality and fundamental rights compliance of the assistance to the boat in distress, and the coordination and conduct of rescue operation by national authorities.”

      According to a summary of that work, the first mention of the Adriana came from the Italian control authorities in Rome at 08:01 UTC on June 13.

      At that point, Rome’s search and rescue authorities contacted Greece’s authorities and Frontex about “a fishing vessel with approximately 750 migrants on board, known to be sailing within the Greek Search and Rescue Region at 06:51 UTC.” At that point, Rome had already alerted the authorities to “reports of two dead children on board.”

      After receiving this report, Frontex wrote that it directed its plane Eagle 1, which was already in the air, to fly over the fishing vessel “even though the vessel lay outside the normal patrolling route.”

      The report said the Eagle 1 spotted the “heavily overcrowded” vessel at 09:47 UTC and informed the Greek authorities. Ten minutes later, the plane left the area due to low fuel and returned to base.
      Italian authorities report Adriana ’adrift’ long before Greek authorities do

      By 13:18, Rome’s search and rescue authorities provided an update of the situation to Greek authorities and Frontex. At that point, they said the boat was “reported adrift” and had “seven people dead on board.”

      At 14:54, Frontex reportedly received an email from the NGO Watch The Med – Alarm Phone alerting Frontex, JRCC Piraeus, the Greek Ombudsman’s Office, UNHCR and others to the new location of the fishing boat. In that email, Alarm Phone stated there were “several very sick individuals, including babies” among the approximately 750 people on board and that the boat was “not able to sail.”

      About 30 minutes later, this email was forwarded by Frontex to the Greek National Coordination Center and JRCC Piraeus, and it was sent on to the Fundamental Rights Office.

      About an hour later, Frontex contacted the Greek authorities to request an update on the situation. Frontex also offered to deploy a surveillance aircraft to check on the ship’s current position, but reports it received no reply.

      Just under two and a half hours later, the Greek authorities did request that Frontex support them “in the detection of a migrant boat within the maritime area south of Crete, as part of another SAR operation.” This turned out to be a sailing boat with about 50 people on board.
      ’No reply was received’

      Later that evening, Frontex contacted the Greek authorities twice more and said no reply was received.

      At 23:20 UTC, Frontex redirected the plane that had been helping with the fishing boat off Crete to the last known position of the fishing vessel.

      The timeline moves to June 14. At 02:46 UTC, Frontex informs the Greek authorities that its plane was headed towards the last position of the fishing vessel. It says it received no reply from the Hellenic authorities.

      Over an hour passed before the plane, this time the Heron 2, reached the “operational area” where it spotted “nine maritime assets (eight merchant vessels and one Hellenic Coast Guard patrol vessel) and two helicopters involved in a large-scale SAR operation.” At that point, states Frontex in the report “no signs of the fishing vessel were spotted.”

      At 05:31, Frontex told the Greek authorities that its plane Heron 1 was about to leave the operation, but offered Eagle 1, which was already airborne, to help with the SAR operation. The Greek authorities replied over two hours later that “no further aerial surveillance support was needed for the time being.”
      No mention of dead bodies on board in Greek timeline

      The Frontex report then includes a similar timeline from the Greek authorities. In the Greek version, there is no initial mention of dead bodies on board. They say they established contact with those on board and “no request for assistance was addressed to the Greek authorities.”

      Although the Italians reported that the vessel was already adrift around 13:18 UTC, according to the Frontex report, in the Greek version, the vessel is “still sailing with a steady course and speed” at 15:00 UTC.

      Around that same time, a Maltese flagged commercial vessel approaches the fishing boat to supply them with food and water, as requested by the Greek authorities. According to the Greek report, the people on board were repeatedly asked if they were facing “any kind of danger” or were “in need of additional support.” Their answer, according to Greece, was “they just wanted to continue sailing towards Italy.”

      30 minutes later, again according to JRCC Piraeus, via satellite phone contact, those on board said they wanted to keep sailing.

      At 18:00, the boat was approached again. According to the report, the migrants “accepted water” from the Greek-flagged commercial vessel that approached them, but “threw the rest of the supplies into the sea.” This approach and refusal of assistance carried on into the evening.
      Adriana ’still holding a steady course and speed’

      At 19:40 UTC, according to the Greek report, a Greek coast guard vessel approached the fishing vessel and “remained at a close distance in order to observe it.” It was still holding a “steady course and speed, without any indications of sailing problems.”

      It was only at 22:40 UTC, according to the Greek report, that the fishing vessel “stopped moving and informed the Greek authorities that they had an engine failure.”

      A Greek coast guard vessel then immediately approached the vessel to assess the situation. Less than an hour later — at 23:04 UTC, but 02:04 local time on June 14 — the Greek report notes that the fishing vessel “took an inclination to the right side, then a sudden inclination to the left side and again a great inclination to the right side, and eventually capsized.”

      They said "people on the external deck fell in the sea and the vessel sunk within 10-15 minutes.” At that point, the Hellenic coast guard “initiated a SAR operation.”

      The Frontex report then notes “alleged discrepancies” between the various timelines and survivor statements given to the media.

      They say that many of the survivors reported that the Greek coast guard “tied ropes onto the fishing vessel in an effort to tow it,” which allegedly caused it to destabilize and capsize.

      In the past, the Greek coast guard have tied and towed vessels successfully towards safety.

      However, while the Greek coast guard acknowledged that one rope was attached around three hours before the boat sank to ascertain passengers’ conditions, there was “no attempt to tow it.”

      The rope, say the Greeks, was removed by the migrants on board just a few minutes later and the coast guard vessel moved a distance away to continue observation.
      Was Adriana stationary prior to capsizing or not?

      The BBC and several other media outlets also reported at the time that prior to capsizing and sinking, the fishing vessel had not moved for several hours.

      This is consistent with the Frontex timeline, which mentions the Italian authorities’ warnings that the boat was adrift the day before it eventually capsized.

      Later in the report, Frontex notes that many of the “alternative and complementary timelines” put together by international NGOs and journalists are “credible” as they quote “more than one source for each statement.”

      The Frontex report looks into the question of whether or not the Adriana was drifting for several hours before sinking.

      It concludes that the Faithful Warrior, one of the merchant tankers sent to assist, was tracked between 17:00 and 20:00 and was “likely stationary or moving at extremely slow speed (less than 1 knot),” indicating that the Adriana was probably not sailing normally until shortly before it capsized as the Greek report claimed.

      The report also consulted “maritime experts to gain insight into issues pertaining to stability when a trawler of Adriana’s type is overloaded with human cargo.” Although their consultations were not precise due to a lack technical data, the experts indicated that the amount of people on board could have destabilized the boat or affected its stability.
      Testimony from survivors

      A Frontex team took testimonies from survivors after the shipwreck. They said they were told there were between 125 and 150 Syrians on board, including five women and six children.

      Around 400-425 Pakistanis were on board, the report said, most of whom were placed on the lower decks. The access ladders had been removed, making it impossible for them to exit.

      There were also between 150 and 170 Egyptians and about 10 Palestinians on board. The alleged smugglers were all said to be Egyptians and enforced discipline with pocket knives.

      Numerous fights broke out on board, particularly after food ran out a few days into sailing. At some point, the captain allegedly suffered a heart attack and the boat was “drifting without engine for extended periods of time.” On day four, June 12, six people were reported to have died, and others had resorted to drinking urine or sea water.

      On day five, June 13, some migrants said they received supplies from two vessels and “at night … were approached by a small boat that they were asked to follow.”

      They said they could not do this because of their engine malfunction. Several of the migrants also allege that attempts were made to tow the vessel — presumably by the Hellenic coast guard, they said.

      Survivors also said that at one point, a boat tied a rope to the front of the Adriana and started “making turns”. This, they said, “caused the migrants to run to one side, their vessel started rocking, and eventually capsized within 15 minutes.”

      Only people on the upper decks were able to jump into the water.
      Greek authorities leave ’detailed questions answered’

      In July, Frontex said it approached the Greek authorities with a “detailed set of questions” but most of its questions were left unanswered.

      In conclusion, the Frontex Fundamental Rights Office concluded that although Frontex “upheld” all its “applicable procedures,” in the light of the information that had already been transmitted and similar situations in which Mayday alerts had been issued, the assessment could have been different and the process for issuing Mayday alerts in the future “needs to be reviewed.”

      The report admits that “at the time of the initial sighting [of the Adriana] by Eagle 1, there was reasonable certainty that persons aboard … were threatened by grave and imminent danger and required immediate assistance.”

      They also say the “resources mobilized by the [Greek] authorities during the day … were not sufficient for the objective of rescuing the migrants.”

      Frontex adds that the Greek authorities appear to have “delayed the declaration of SAR operation until the moment of the shipwreck when it was no longer possible to rescue all the people on board.”

    Né au Portugal en 1957 et arrivé enfant en France à l’âge de 7 ans, José Vieira réalise depuis plus de trente ans des documentaires qui racontent une histoire populaire de l’immigration portugaise.

    Bien loin du mythe des Portugais·es qui se seraient « intégré·es » sans le moindre problème en France a contrario d’autres populations, José Vieira s’est attaché à démontrer comment l’#immigration_portugaise a été un #exode violent – voir notamment La Photo déchirée (2001) ou Souvenirs d’un futur radieux (2014) –, synonyme d’un impossible retour.

    Dans son nouveau documentaire, Territórios ocupados, diffusé sur Mediapart, José Vieira a posé sa caméra dans les #montagnes du #Caramulo, au centre du #Portugal, afin de déterrer une histoire oubliée de la #mémoire_collective rurale du pays. Celle de l’expropriation en 1941, par l’État salazariste, de milliers de paysans et de paysannes de leurs terres communales – #baldios en portugais.

    Cette #violence étatique a été opérée au nom d’un vaste #projet_industriel : planter des forêts pour développer économiquement ces #territoires_ruraux et, par le même geste, « civiliser » les villageois et villageoises des #montagnes, encore rétifs au #salariat et à l’ordre social réactionnaire de #Salazar. Un épisode qui résonne aujourd’hui avec les politiques libérales des États qui aident les intérêts privés à accaparer les biens communs.

    Mediapart : Comment avez-vous découvert cette histoire oubliée de l’expropriation des terres communales ou « baldios » au Portugal ?

    José Vieira : Complètement par hasard. J’étais en train de filmer Le pain que le diable a pétri (2012, Zeugma Films) sur les habitants des montagnes au Portugal qui sont partis après-guerre travailler dans les usines à Lisbonne.

    Je demandais à un vieux qui est resté au village, António, quelle était la définition d’un baldio – on voit cet extrait dans le documentaire, où il parle d’un lieu où tout le monde peut aller pour récolter du bois, faire pâturer ses bêtes, etc. Puis il me sort soudain : « Sauf que l’État a occupé tous les baldios, c’était juste avant que je parte au service militaire. »

    J’étais estomaqué, je voulais en savoir plus mais impossible, car dans la foulée, il m’a envoyé baladé en râlant : « De toute façon, je ne te supporte pas aujourd’hui. »

    Qu’avez-vous fait alors ?

    J’ai commencé à fouiller sur Internet et j’ai eu la chance de tomber sur une étude parue dans la revue de sociologie portugaise Análise Social, qui raconte comment dans les années 1940 l’État salazariste avait pour projet initial de boiser 500 000 hectares de biens communaux en expropriant les usagers de ces terres.

    Je devais ensuite trouver des éléments d’histoire locale, dans la Serra do Caramulo, dont je suis originaire. J’ai passé un temps fou le nez dans les archives du journal local, qui était bien sûr à l’époque entièrement dévoué au régime.

    Après la publication de l’avis à la population que les baldios seront expropriés au profit de la plantation de forêts, plus aucune mention des communaux n’apparaît dans la presse. Mais rapidement, des correspondants locaux et des éditorialistes vont s’apercevoir qu’il existe dans ce territoire un malaise, qu’Untel abandonne sa ferme faute de pâturage ou que d’autres partent en ville. En somme, que sans les baldios, les gens ne s’en sortent plus.

    Comment sont perçus les communaux par les tenants du salazarisme ?

    Les ingénieurs forestiers décrivent les paysans de ces territoires comme des « primitifs » qu’il faut « civiliser ». Ils se voient comme des missionnaires du progrès et dénoncent l’oisiveté de ces montagnards peu enclins au salariat.

    À Lisbonne, j’ai trouvé aussi une archive qui parle des baldios comme étant une source de perversion, de mœurs légères qui conduisent à des enfants illégitimes dans des coins où « les familles vivent presque sans travailler ». Un crime dans un régime où le travail est élevé au rang de valeur suprême.

    On retrouve tous ces différents motifs dans le fameux Portrait du colonisé d’Albert Memmi (1957). Car il y a de la part du régime un vrai discours de colonisateur vis-à-vis de ces régions montagneuses où l’État et la religion ont encore peu de prise sur les habitants.

    En somme, l’État salazariste veut faire entrer ces Portugais reculés dans la modernité.

    Il y a eu des résistances face à ces expropriations ?

    Les villageois vont être embauchés pour boiser les baldios. Sauf qu’après avoir semé les pins, il faut attendre vingt ans pour que la forêt pousse.

    Il y a eu alors quelques histoires d’arrachage clandestin d’arbres. Et je raconte dans le film comment une incartade avec un garde forestier a failli virer au drame à cause d’une balle perdue – je rappelle qu’on est alors sous la chape de plomb du salazarisme. D’autres habitants ont aussi tabassé deux gardes forestiers à la sortie d’un bar et leur ont piqué leurs flingues.

    Mais la mémoire de ces résistances a peu été transmise. Aujourd’hui, avec l’émigration, il ne reste plus rien de cette mémoire collective, la plupart des vieux et vieilles que j’ai filmés dans ce documentaire sont déjà morts.

    Comment justement avez-vous travaillé pour ce documentaire ?

    Quand António me raconte cette histoire d’expropriation des baldios par l’État, c’était en 2010 et je tournais un documentaire, Souvenirs d’un futur radieux. Puis lorsqu’en 2014 un premier incendie a calciné le paysage forestier, je me suis dit qu’il fallait que je m’y mette.

    J’ai travaillé doucement, pendant trois ans, sans savoir où j’allais réellement. J’ai filmé un village situé à 15 kilomètres de là où je suis né. J’ai fait le choix d’y suivre des gens qui subsistent encore en pratiquant une agriculture traditionnelle, avec des outils de travail séculaires, comme la roue celte. Ils ont les mêmes pratiques que dans les années 1940, et qui sont respectueuses de l’écosystème, de la ressource en eau, de la terre.

    Vous vous êtes aussi attaché à retracer tel un historien cet épisode de boisement à marche forcée...

    Cette utopie industrialiste date du XIXe siècle, des ingénieurs forestiers parlant déjà de vouloir récupérer ces « terres de personne ». Puis sous Salazar, dans les années 1930, il y a eu un débat intense au sein du régime entre agrairistes et industrialistes. Pour les premiers, boiser ne va pas être rentable et les baldios sont vitaux aux paysans. Pour les seconds, le pays a besoin de l’industrie du bois pour décoller économiquement, et il manque de bras dans les villes pour travailler dans les usines.

    Le pouvoir central a alors même créé un organisme étatique, la Junte de colonisation interne, qui va recenser les baldios et proposer d’installer des personnes en leur donnant à cultiver des terres communales – des colonies de repeuplement pour résumer.

    Finalement, l’industrie du bois et de la cellulose l’a emporté. La loi de boisement des baldios est votée en 1938 et c’est en novembre 1941 que ça va commencer à se mettre en place sur le terrain.

    Une enquête publique a été réalisée, où tout le monde localement s’est prononcé contre. Et comme pour les enquêtes aujourd’hui en France, ils se sont arrangés pour dire que les habitants étaient d’accord.

    Qu’en est-il aujourd’hui de ces forêts ? Subsiste-t-il encore des « baldios » ?

    Les pinèdes sont exploitées par des boîtes privées qui font travailler des prolos qui galèrent en bossant dur. Mais beaucoup de ces forêts ont brûlé ces dernière décennies, notamment lors de la grande vague d’incendies au Portugal de 2017, où des gens du village où je filmais ont failli périr.

    Les feux ont dévoilé les paysages de pierre qu’on voyait auparavant sur les photos d’archives du territoire, avant que des pins de 30 mètres de haut ne bouchent le paysage.

    Quant aux baldios restants, ils sont loués à des entreprises de cellulose qui y plantent de l’eucalyptus. D’autres servent à faire des parcs d’éoliennes. Toutes les lois promues par les différents gouvernements à travers l’histoire du Portugal vont dans le même sens : privatiser les baldios alors que ces gens ont géré pendant des siècles ces espaces de façon collective et très intelligente.

    J’ai fait ce film avec en tête les forêts au Brésil gérées par les peuples autochtones depuis des siècles, TotalEnergies en Ouganda qui déplace 100 000 personnes de leurs terres pour du pétrole ou encore Sainte-Soline, où l’État aide les intérêts privés à accaparer un autre bien commun : l’eau.
