    Matt Farah, 6/10/19 3:45pm - One weekend morning toward the end of 2017, I woke up at home in Venice, CA and took a walk, only to see something entirely new: people on electric scooters. And I mean lots of people on electric scooters. Literally overnight, a new company called Bird, founded just two miles away in Santa Monica, had launched an app and dumped thousands of dockless scooters all over the place. A few things happened very quickly after that:

    Bird Scooters became litter. Freelance chargers, or “Juicers” as Lime would later call their not-employees, would do their best to place the scooters in an orderly fashion, out of the way in common areas. But since people only have respect for a.) things they, themselves personally own or b.) are locked down or are being watched, kicking, destroying, throwing them in the ocean, and more turned into Venice’s favorite new sport. The other morning, I watched someone line up a dozen or more scooters neatly, get into their van, and drive off. Not 10 seconds later, someone used a shopping cart as a bowling ball, turning the whole thing into some kind of bramble.
    Everyone wanted to compete with Bird. Lime was next, with its fun, fruit-themed livery. Bird and Lime were the new disruptors, and the OG disruptors, Uber and Lyft, wanted in on that sweet, sweet last-mile dollar. So those two started dropping their own scooters all over.
    E-Mobility Scooters have absolutely decimated the bike rental industry in Venice. Enterprising bike rental shop owners began to moonlight as scooter chargers or repair facilities. Some bike rental shop owners began buying and renting out their own scooters. Now, just 18 months later, on any given weekend, well over 50 percent of the wheeled traffic on the Venice bike path is battery powered.

    There were injuries. Lots of injuries. Anecdotally, I regularly see people wiping out and getting hurt on mobility scooters. It happens enough that I have made something of a pastime watching a specific corner on the bike path near my house. Business Insider reports over 1,500 injuries serious enough to record in the U.S., in 2018 alone, plus four fatalities.

    For the record, I sympathize with local residents who resent them taking up sidewalk space in front of their home, hate them for becoming litter in a neighborhood that often has too much of that already, and who have to deal with yet another way for dumb, lost tourists to be dumb and lost.

    I’ve found scooters blocking my own front door or garage on several occasions. And folks tend to want the best of all worlds while riding one: they want the rights of a pedestrian, the rights of a bicycle, and the rights of a car, all at the same time, which is an incredibly dangerous mindset.

    Also, for the record, I have found some extremely convenient uses for the scooters when I need to get somewhere that is just out of walking range, or to “run to the store to pick up some forgotten ingredient” while a recipe is in the oven. I have used every brand of scooter at one point or another, with extremely mixed results. I will factor in previous experience into my rankings.

    The Test: My goal was to find out which mobility company provides the best motoring experience for the rider, for their money. A showdown, for which scooter is best.

    For purposes of this piece, we will not be discussing company policy, only the scooter itself, and whether or not you should get down with it when you come hang out with me on Venice Beach.

    The Circuit

    Allow me to introduce you to The Mobiliring: a 3.4-mile handling circuit featuring a variety of surface changes, corners, crags, obstacles, sand, and people.

    You begin at the Venice Beach Parking lot at 2100 Ocean Front Walk, with the densest population of scooters around. Proceeding straight across the parking lot to the bike path, you go north on the bike path over a winding way made of slatted, rough, sandy concrete, all the way to the Santa Monica border, where you turn back south because mobility scooters can’t be ridden on the bike path at all in the city of Santa Monica.

    You ride south on Speedway, basically a decaying alley full of potholes, but appropriately named, as it was LA’s first paved road. Take Speedway south to Windward Avenue, the heart of Venice, and turn right, weaving across the freestyle dance skating grounds, through the throngs of tourists, and back to the bike path where it meets the legal graffiti area. Continue south on the bike path until you get to the Venice pier, then turn left on Washington Blvd and an immediate left to go north on Speedway, taking you right back to Start/Finish.

    This course is approximately 60 percent unlimited-speed bike path and 40 percent public roads, and in order to successfully complete a lap, you must pay attention and obey all posted road signs and laws.

    (Before you ask, Yes, I bought the Mobiliring domain name. Yes, I will be inviting you to post your own lap times.)

    The Contenders: We’ve restricted our entrants to scooter-type vehicles (as opposed to e-assist bicycles) available on the street for rent in Venice, CA as of May 13, 2019. For this test, that means Bird, Lime, Lyft, Jump (Uber), and Wheels are in the game. Now let’s see how they did on our handling course.

    5th Place – Jump – DNF

    Jump, along with Lyft, uses the Segway / Ninebot ES2 scooter with 19 miles of range and a claimed top speed of 15 mph. This scooter also uses two independent braking methods: regenerative via a toggle on the handlebar, and direct friction via a pressure plate on the rear tire. But, as with shared platforms in cars, the difference is often in the fine tuning, and here, the tuning mattered a lot.

    Our test started well. I picked up a fully charged and seemingly brand-new Jump scooter a few road blocks from the Mobiliring’s Start/Finish line. On the road, it seemed reasonably well made and stable, and reached the claimed top speed of 15 mph relatively drama-free. Then, just after starting off my official lap time, I hit the bike path, and it told me “no.”

    This is important. You see, the Venice bike path is exactly what it sounds like: a dedicated path for bikes, separate from cars and pedestrians. How each of these scooters deals with the bike path, as we will learn, is a defining factor in their Mobiliring time. The bike path and some of the surrounding pedestrian areas, a few of which are on-course, are “restricted” for some scooters, but not for others.

    While each scooter company deals with the bike path its own way, Jump has elected not to deal with it at all. The scooter refused to move, the app told me to take it back off the path, and into a “parking zone,” to lock it up and end my ride.

    I pushed it back where I found it, and even though my phone knew where I was, the scooter disagreed, and I was penalized for $5 for, ultimately, parking it legally.

    4th Place – Lime S – 44 minutes - $7.60

    Lime, the second scooter brand on the scene after Bird, has just released a heavier-duty version of their scooter, called the “Gen 3.” It features an underfloor battery for better stability, improved front suspension, bigger wheels, and a 30-mile range with all-weather capability.

    Unfortunately, since California doesn’t need that as badly as, say, Boston, we don’t get those. Here in Venice, we get the original Lime S scooter, also by Ninebot, but with a 18 mile range and a top speed of 14 mph. The Lime S has the tallest handlebars of all scooters and a single, rear-wheel bike-style cable and disc brake.

    In my previous experience, I’ve found the Lime S to be the fastest of the stand-up scooters, regularly exceeding the claimed 14 mph number, but also with the twitchiest handling in part because those handlebars are so high up and with a column full of heavy batteries in the front. Allegedly the handling issues are solved in the new scooter, but I will have to wait to see on that.

    Lime has decided that an appropriate speed for the Venice bike path should be 3 mph. Now, I don’t know if you’ve ever tried to operate a two-wheeled vehicle at 3 mph, but it’s actually quite a lot of work. Three is just barely enough speed to keep a two-wheeled vehicle standing up. It’s slow enough that I was passed by old people walking.

    It’s so slow, that you really can’t keep it in a straight line, which means the ride takes that much longer because you have to cover more zig-zaggy distance, and have I mentioned you’re going three? 

    I was openly mocked, to my face. I realize how mean-spirited you need to be to mock someone to their face for doing nothing besides silently riding a scooter very slowly on the bike path, but honestly, no one has just randomly mocked me on the street really ever in my lifetime. That’s how embarrassingly slow Lime wants you to go on the bike path.

    To make matters worse, Lime’s GPS calibration is so bad that, not 20 feet away from me on the pedestrian foot path I was passed by a dozen Limes going full-tilt, weaving between pedestrians, while I was a rolling chicane on the bike path, being passed by folks going slower than my own top speed.

    3rd Place – Lyft – 31 minutes, 47 Seconds - $7.01

    As I noted earlier, both Lyft and Jump use essentially the same Ninebot ES2scooter, painted different colors. But the difference between Jump’s DNF and Lyft’s podium finish? The software.

    Jump uses a basic LED display with a speedometer, whereas Lyft just has five little lights to indicate battery status. You could say that makes Jump better, but in fact it makes Jump worse, because there is nothing worse than looking at a powered vehicle’s speedometer and seeing a number lower than where you’d set the treadmill during cool down.

    Lyft’s “Prince Purple” and black livery also features a metal cage surrounding the column-mounted auxiliary battery pack, Mad Max style. I guess they follow @BirdGraveyard.

    I actually tested the Lyft before Lime and Jump, so when I hit the bike path and got stuck with a 5 mph limiter for the first mile and a half, it was bad. I thought that was, at the time, as embarrassed as I could be on a motorized vehicle, traveling barely faster than a walk. The thumb throttle, remained fully depressed for a solid 20 minutes, and my right hand began to cramp. I suddenly realized that, if the other scooters were this bad (they were worse) the test was actually going to take all day (it did).

    In unrestricted zones, the electrons flowed like a burst dam; the combination of power delivery and incredibly cheap, low-grip tires mean that you can actually get wheelspin on the sandy stuff – man this thing is fast. Maybe Lyft doesn’t put a speedometer on the handlebars because they are hiding the fact that their scooters are massively juiced up? Maybe it’s like Japan in the 1990s where everyone says their car makes 276 horsepower, and this is the R34 Skyline actually pushing 450?

    Southbound on Speedway, there were sections where I couldn’t use full throttle because it was just way, way too fast. With these tiny wheels, and this amount of power, when you hit the pavement head first (your only option when the front wheel “pivot point” of a crash is 4” in front of your toes), your head will explode like a Gallagher watermelon.

    The regenerative braking system on these Ninebot scooters is really cool, except, like most cheap regen systems, it stops working at low speed. So you really do have to use the friction brake on the rear wheel to come to a full stop.

    Considering the speed, you do not want to be standing on your toes on your back foot, which means you have to do a mid-brake foot shuffle to get that back foot planted on the brake to stop it. It seems like a good idea, and probably adds to the range to use regen as much as possible, but in a panic, complex braking systems are not good.

    Nevertheless, the bike path clearly took a lot away from Lyft’s time here, and so if you live in a city without restricted zones, commuting on one of these could be faster than you think. Wear a helmet.

    2nd Place – Bird Zero – 20 minutes - $6.20

    Bird is the Kleenex of mobility, the Google of mobility, the iPod of mobility. They were the first on the scene and made everyone else play catch-up. The original Bird scooter was a modified Xiaomi unit (sidebar: the guy who modified it is super interesting on his own and races a very fast and aero-fied Nissan GT-R in the Global Time Attack series), which proved not to be durable enough to stand up to the abuse put forth by Americans handling items they don’t own. So they first did a stint with Ninebot before developing their own in-house scooter, the Bird Zero, which is what I rode.

    The Zero has the widest deck of any standup scooter available, making it the most comfortable and stable to ride. (EDIT: New “Bolt” Scooters in LA have wider decks, but were not online at the time of my test). The handlebars fall between Jump and Lime height, so right in the middle, and between your hands is a speedometer and battery indicator.

    Though Bird says the Zero will go 25 km/hr (15 mph), the onboard speedometer would stop at 11.5 mph, and if you actually hit 12 mph (like on a small downhill), it would kill power until you dropped down to 9 mph, an incredibly annoying bug.

    It has larger wheels than the Ninebots used by Lyft, Jump and Lime, and what appear to be grippier tires. At 11 mph and change, you feel like you’re moving along pretty good, but it’s not sketchy fast, and the combination of (slightly) larger wheels and a basic front suspension mean the cracks in the sidewalk aren’t so jarring. The only brake is a bicycle-style cable disc brake on the rear wheel. The cable is exposed, so it’s vulnerable to tampering, but it’s intuitive and effective.

    (Side note: Yes, people are constantly messing with the brakes of these scooters. I regularly find cut cables, and on a few occasions, have started riding only to find out while in motion that the cables have been cut or removed entirely. Check any scooter before riding for functional brakes.)

    I took my first lap ever around the Mobiliring on a Bird, figuring they would be the one to beat, and frankly, Bird is the gold standard for a reason. The Zero is unrestricted on the bike path, and maintained its top speed for the entire first twisty section. The handling is predictable, and there is more grip than other scooters, right up until it gets sandy. Turning southward on Speedway at the north end of the course, the Zero absorbed many of the bumps and ruts in the road better than other scooters. Because I didn’t bump up on any stupid limiters, the entire lap was quite pleasant and relaxing.

    Having tried all three generations of Bird scooter, the Zero is a vast improvement from the first two, and if you’re going to scoot on your feet, not on a seat, Bird is probably the one to ride.

    1st Place – Wheels – 15 Minutes, 16 seconds - $5.60

    “Wheels” is the newest mobility company on the scene; their miniature bicycles only appeared in Venice a few months ago. These bikes are, frankly, genius. In theory, they go up to 35 km/hr, (21.7 mph), though I never saw more than 33.5 on the display.

    Because they are the first mobility option with hot-swappable batteries, the bikes themselves never go out of service during daytime hours. Wheels “Transporters” pick random bikes from where they are left, swap the batteries, and return the bikes to “hubs,” where, in my experience, you can pretty much always find at least one.

    The fact that they are more like bicycles than Razor scooters is, itself, a major advantage. Sitting, rather than standing, means stability. It means your knees and ankles aren’t a suspension component. It has 14-inch wheels with pneumatic tires. It uses dual disc brakes from a high-end bicycle. It has a twist-grip throttle, like a motorcycle. And it has Bluetooth speakers, so you can play your music from the bike itself, freeing you from having to dangerously (and in Santa Monica, illegally) ride on the street wearing headphones.

    A Wheels has enough power that you don’t have to push-start it, real tires so you can ride confidently on sandy tarmac, and the kind of brakes you’d want on a vehicle capable of keeping up with, and passing, folks on geared bicycles, or even cars in urban traffic. The kind of bumps that would sail you headfirst into a parked car on a traditional scooter are mere inconveniences on a Wheels.

    I knew it would be faster than the scooters on specs alone, but honestly, it was also so much more fun. Every single scooter is kinda terrifying, because a crack or a bump can come up so quickly, with really bad consequences. Even while having fun, it’s virtually impossible to escape this train of thought. Especially since right when you do, that’s when you crash.

    A Wheels is like riding an electric Honda Grom. The bike path, unrestricted on a Wheels, might as well be Angeles Crest Highway. I was taking apexes, leaning it down, balancing the brakes, and leaning into the throttle on exits. You can actually look up and around, rather than four feet in front of you, because you aren’t terrified of uneven pavement anymore.

    Best of all, because it looks more like a bike than a Razor scooter, many folks are riding them in more appropriate places than sidewalks, because they no longer see themselves as pedestrians.

    And the speed, Lord, the speed. It completed the Mobiliring a full five minutes faster than Bird, in half the time of Lyft, 1/3 the time of Lime, and for less money than all of them—after all, you’re literally renting these things by the minute, not the mile. Time is money.

    Downsides? Admittedly, there are two: First are the exposed brake cables for the dual disc brakes. During the single day of this test, I found three Wheels with intentionally cut brake lines. Someone not as vigilant as myself might not notice, which, considering where they were cut, I believe was the sadistic intent.

    Secondly, 20 mph is fast enough to have a crash where you can get hurt pretty badly, and Wheels is getting awfully close to moped territory; those do require helmets. While you’re no longer worried about pavement quality, you are going fast enough to misjudge things and just, crash. I hate to say it, but helmets should probably be mandated. And if I’m nit-picking, a height-adjustable seat would be nice, although not having to pedal negates most of the negative effects of a fixed seat.

    When scooters first arrived in Venice, I rolled my eyes and said to myself, “Great, at last a substitute for walking.” And in some ways, I was right. These scooters do expose us at our most slovenly, both in how we treat them when no one is looking, and in how tourists do actually use them, right in front of me, every day: as a walk you don’t have to walk; as a bike you don’t have to pedal.

    But they also do give mobility to people who don’t otherwise have it. 30 miles in LA is a pretty long way; you could ride a Wheels from Venice to Beverly Hills and back, for less than an Uber or Lyft, and without having to be a sweaty mess when you got there. Bird scooters and their ilk are good for short trips that are just out of walking distance, as long as you don’t have to deal with restricted zones and the surface is good.

    A Wheels is good for that too, but it can also be a bicycle. And frankly, it’s safer. Wheels wins this one by a mile.

    But as I write this, some three more e-scooters are coming to Venice in the next month. I guess the Mobiliring’s work isn’t done yet.❞

    Rasmea Odeh participates in Detroit Black Lives Matter rally

    Yesterday, I wrote a critique of Emily Shire’s diatribe against the Women’s Strike Day USA protest. She especially singled out platform statements supporting Palestinian rights. Shire, a professed Zionist feminist, dismissed the criticisms of Israeli Occupation contained in the event platform as irrelevant to the issue of women’s rights. Then she launched into an attack on one of the conveners of the Strike Day, Rasmea Odeh. Shire alleges that Odeh is a convicted terrorist and former member of the Popular Front for the Liberation of Palestine (PFLP), a U.S. designated terror group.

    A comment Deir Yassin published yesterday here got me to thinking further about this issue. I researched Rasmea’s case and the torture she endured. My view is this is precisely the sort of case and individual any women’s movement should embrace. Here is a summary of the facts of the case. In 1969, a cell of the PFLP planted bombs at a Jerusalem Super-Sol. They exploded, killing two Hebrew University students.

    Afterward, security forces arrested Odeh and jailed her without charges or access to counsel. She was tortured, by her account, for 45 days. Here is how she described her treatment in testimony to a UN commission on torture in Geneva:

    …”They beat me with sticks, plastic sticks, and with a metal bar. They beat me on the head and I fainted as a result of these beatings. They woke me up several times by throwing cold water in my face and then started all over again.”

    In addition to this physical torture, Odeh also faced sexual torture. Her father, a U.S. citizen, was also arrested and beaten, “and once they brought in my father and tried to force him under blows to take off his clothes and have sexual relations with me.” Later, interrogators “tore my clothes off me while my hands were still tied behind my back. They threw me to the ground completely naked and the room was full of a dozen or so interrogators and soldiers who looked at me and laughed sarcastically as if they were looking at a comedy or a film. Obviously they started touching my body.” In her father’s presence, interrogators threatened to “violate me” and “tried to introduce a stick to break my maidenhead [hymen].” Shackled naked from the ceiling, interrogators “tied my legs, which were spread-eagled, and they started to beat me with their hands and also with cudgels.”

    Every method described in her account is known from previous descriptions of the treatment of Arab terror suspects. We know, for example, that Doron Zahavi, an IDF AMAN officer, raped Mustafa Dirani in Prison 504. The beatings and positions she describes are also previously described in testimony by the Public Committee to Prevent Torture in Israel. Therefore, it’s not just conceivable that Rasmea endured the treatment she claims, it’s almost a certainty. Especially given that two Israelis were killed in the bombing.

    In summary, the Shin Bet tried to force her father to rape her. The interrogators themselves raped her and further degraded her sexually. And her father was tortured as a means of compelling her to confess. If this isn’t a perfect portrait of a cause that all feminists should embrace, I don’t know what is. So when Shire claims that Palestine is the farthest thing from what Women’s Strike Day’s mission should be, she’s engaging in willful blindness to the plight of another woman. A woman who happens to be Palestinian.

    Rasmea was tried and convicted in an Israeli military court, which features military judges and prosecutors using rules that favor the prosecution and shackle the hands of the defense. It can rule any evidence secret and so prevent the defense from seeing it, let alone rebutting it. Such a conviction could never withstand scrutiny under U.S. criminal procedures or even Israeli civilian courts.

    Further, Shire justifies her denunciation of Odeh by noting that Israel denies torturing Rasmea. So you have an Israeli security apparatus which is well-known for lying when evidence against it is damning. And you have Rasmea’s testimony, supported by scores of accounts by other security prisoners as to their treatment under similar circumstances. It reminds me of the story of the husband who returns home to find his wife in bed with another man. The man jumps out of bed and says: “Hey, this isn’t what this looks like. Nothing happened. I swear it. Who are you going to believe? Me, or your lyin’ eyes?” Emily Shire prefers to believe the agency that lies to her with a straight face. In doing so, she shows that she is a Zionist first and foremost; and a feminist second, if at all.

    As for the citizenship application infractions which the Justice Department is exploiting in order to expel her from the U.S.: she had been tortured once by Israel. Her decision to hide her previous conviction was surely founded on a fear that she might be deported once again back to Israel or Jordan (where Israel had sent her after her release from prison). The Jordanian security apparatus collaborates closely with Israeli intelligence. The former is quite handy with torture itself. Further, the U.S. judge in her first trial prohibited her attorney from raising torture as part of her defense. Her second trial will explicitly permit such testimony. Though I’m not privy to the defense strategy, I hope it will demand that a Shabak officer who participated in her interrogation testify at trial. And if his testimony diverges from the truth, I hope there is means to document this and hold him accountable. It would be one of the first times such an agent would be held accountable legally either inside or outside Israel.

    In the attacks against Rasmea, it’s certainly reasonable to bring up her participation in an act of terrorism: as long as you also examine the entire case against her. She admitted participation in the attack. But she denied placing the bomb in the supermarket. Despite her denial, this was the crime for which she was convicted. Further, Rasmea was released after serving ten years as part of a prisoner exchange. If Israel saw fit to release her, what is the point of using her alleged past crime against her today?

    As for her membership in a terror organization, she has long since left the militant movement. Her civic activism is solely non-violent these days. Further, virtually every leader of Israel for the first few decades of its existence either participated directly in, or ordered acts of terror against either British or Palestinian targets. Why do we grant to Israel what we deny to Palestinians?

    It may be no accident that two days before Shire’s broadside against the U.S. feminist movement (and Rasmea) in the NY Times, the Chicago Tribune published another hit-piece against her. The latter was credited to a retired Chicago professor. Her bio neglected to mention that she is also a Breitbart contributor who is the local coördinator for StandWithUs. This sin of omission attests either to editorial slacking or a deliberate attempt to conceal relevant biographical details which would permit readers to judge the content of the op-ed in proper context.

    The Tribune op-ed denounces Jewish Voice for Peace’s invitation to Rasmea to address its annual conference in Chicago later this month. As I wrote in last night’s post, what truly irks the Israel Lobby is the growing sense of solidarity among feminist, Jewish, Palestinian, Black and LGBT human rights organizations. Its response is to divide by sowing fear, doubt and lies in the media. The two op-eds in the Times and Tribute are stellar examples of the genre and indicate a coordinated campaign against what they deride as intersectionality.

      The sign of the shop, hanging at upper left, displays a decapitated woman’s body above the words “Tout en est bon”, from the saying, “Une femme sans tête: tout en est bon”, meaning “A woman without a head: everything is good”. To make the message absolutely clear, the block of text encourages men to bring their difficult wives to this head doctor, where their brains will be reforged and purged of all screechy, angry, lunatic, obstinate, rebellious, willful, and lazy ways. Any woman with a mind of her own is guaranteed a graphically brutal straightening out.

      As sexist satire goes, this is dark. Even darker is the fact that, as soon as the image appeared, the head-pounding blacksmith “became all the rage” in France.2 Publishers began to churn out stand-alone broadsheets of his image in order to feed a demand for cheap copies, and versions of him in his forge spread from France to Germany and Italy.3 An entire almanac calendar for 1660 was dedicated to Lustucru.4 He was written into the latest comic plays and poems, and his image was even stamped on tokens or “jetons” (metal coins used mainly as counters in the age before calculators). In today’s terms, he went viral.

    If you were paying close attention last week, you might have spotted a pattern in the news. Peeking out from behind the breathless coverage of the Trump family’s tuxedoed trip to London was a spate of deaths of immigrants in U.S. custody: Johana Medina Léon, a 25-year-old transgender asylum seeker; an unnamed 33-year-old Salvadoran man; and a 40-year-old woman from Honduras.

    Photos from a Border Patrol processing center in El Paso showed people herded so tightly into cells that they had to stand on toilets to breathe. Memos surfaced by journalist Ken Klippenstein revealed that Immigration and Customs Enforcement’s failure to provide medical care was responsible for suicides and other deaths of detainees. These followed another report that showed that thousands of detainees are being brutally held in isolation cells just for being transgender or mentally ill.

    Also last week, the Trump administration cut funding for classes, recreation and legal aid at detention centers holding minors — which were likened to “summer camps” by a senior ICE official last year. And there was the revelation that months after being torn from their parents’ arms, 37 children were locked in vans for up to 39 hours in the parking lot of a detention center outside Port Isabel, Texas. In the last year, at least seven migrant children have died in federal custody.

    Preventing mass outrage at a system like this takes work. Certainly it helps that the news media covers these horrors intermittently rather than as snowballing proof of a racist, lawless administration. But most of all, authorities prevail when the places where people are being tortured and left to die stay hidden, misleadingly named and far from prying eyes.

    There’s a name for that kind of system. They’re called concentration camps. You might balk at my use of the term. That’s good — it’s something to be balked at.

    The goal of concentration camps has always been to be ignored. The German-Jewish political theorist Hannah Arendt, who was imprisoned by the Gestapo and interned in a French camp, wrote a few years afterward about the different levels of concentration camps. Extermination camps were the most extreme; others were just about getting “undesirable elements … out of the way.” All had one thing in common: “The human masses sealed off in them are treated as if they no longer existed, as if what happened to them were no longer of interest to anybody, as if they were already dead.”

    Euphemisms play a big role in that forgetting. The term “concentration camp” is itself a euphemism. It was invented by a Spanish official to paper over his relocation of millions of rural families into squalid garrison towns where they would starve during Cuba’s 1895 independence war. When President Franklin D. Roosevelt ordered Japanese Americans into prisons during World War II, he initially called them concentration camps. Americans ended up using more benign names, like “Manzanar Relocation Center.”

    Even the Nazis’ camps started out small, housing criminals, Communists and opponents of the regime. It took five years to begin the mass detention of Jews. It took eight, and the outbreak of a world war, for the first extermination camps to open. Even then, the Nazis had to keep lying to distract attention, claiming Jews were merely being resettled to remote work sites. That’s what the famous signs — Arbeit Macht Frei, or “Work Sets You Free” — were about.

    Subterfuge doesn’t always work. A year ago, Americans accidentally became aware that the Trump administration had adopted (and lied about) a policy of ripping families apart at the border. The flurry of attention was thanks to the viral conflation of two separate but related stories: the family-separation order and bureaucrats’ admission that they’d been unable to locate thousands of migrant children who’d been placed with sponsors after crossing the border alone.

    Trump shoved that easily down the memory hole. He dragged his heels a bit, then agreed to a new policy: throwing whole families into camps together. Political reporters posed irrelevant questions, like whether President Obama had been just as bad, and what it meant for the midterms. Then they moved on.

    It is important to note that Trump’s aides have built this system of racist terror on something that has existed for a long time. Several camps opened under Obama, and as president he deported millions of people.

    But Trump’s game is different. It certainly isn’t about negotiating immigration reform with Congress. Trump has made it clear that he wants to stifle all non-white immigration, period. His mass arrests, iceboxes and dog cages are part of an explicitly nationalist project to put the country under the control of the right kind of white people.

    As a Republican National Committee report noted in 2013: “The nation’s demographic changes add to the urgency of recognizing how precarious our position has become.” The Trump administration’s attempt to put a citizenship question on the 2020 census was also just revealed to have been a plot to disadvantage political opponents and boost “Republicans and Non-Hispanic Whites” all along.

    That’s why this isn’t just a crisis facing immigrants. When a leader puts people in camps to stay in power, history shows that he doesn’t usually stop with the first group he detains.

    There are now at least 48,000 people detained in ICE facilities, which a former official told BuzzFeed News “could swell indefinitely.” Customs and Border Protection officials apprehended more than 144,000 people on the Southwest border last month. (The New York Times dutifully reported this as evidence of a “dramatic surge in border crossings,” rather than what it was: The administration using its own surge of arrests to justify the rest of its policies.)

    If we call them what they are — a growing system of American concentration camps — we will be more likely to give them the attention they deserve. We need to know their names: Port Isabel, Dilley, Adelanto, Hutto and on and on. With constant, unrelenting attention, it is possible we might alleviate the plight of the people inside, and stop the crisis from getting worse. Maybe people won’t be able to disappear so easily into the iceboxes. Maybe it will be harder for authorities to lie about children’s deaths.

    Maybe Trump’s concentration camps will be the first thing we think of when we see him scowling on TV.

    The only other option is to leave it up to those in power to decide what’s next. That’s a calculated risk. As Andrea Pitzer, author of “One Long Night,” one of the most comprehensive books on the history of concentration camps, recently noted: “Every country has said their camps are humane and will be different. Trump is instinctively an authoritarian. He’ll take them as far as he’s allowed to.”

    • ‘Some Suburb of Hell’: America’s New Concentration Camp System

      On Monday, New York Congresswoman Alexandria Ocasio-Cortez referred to US border detention facilities as “concentration camps,” spurring a backlash in which critics accused her of demeaning the memory of those who died in the Holocaust. Debates raged over a label for what is happening along the southern border and grew louder as the week rolled on. But even this back-and-forth over naming the camps has been a recurrent feature in the mass detention of civilians ever since its inception, a history that long predates the Holocaust.

      At the heart of such policy is a question: What does a country owe desperate people whom it does not consider to be its citizens? The twentieth century posed this question to the world just as the shadow of global conflict threatened for the second time in less than three decades. The dominant response was silence, and the doctrine of absolute national sovereignty meant that what a state did to people under its control, within its borders, was nobody else’s business. After the harrowing toll of the Holocaust with the murder of millions, the world revisited its answer, deciding that perhaps something was owed to those in mortal danger. From the Fourth Geneva Convention protecting civilians in 1949 to the 1989 Convention on the Rights of the Child, the international community established humanitarian obligations toward the most vulnerable that apply, at least in theory, to all nations.

      The twenty-first century is unraveling that response. Countries are rejecting existing obligations and meeting asylum seekers with walls and fences, from detainees fleeing persecution who were sent by Australia to third-party detention in the brutal offshore camps of Manus and Nauru to razor-wire barriers blocking Syrian refugees from entering Hungary. While some nations, such as Germany, wrestle with how to integrate refugees into their labor force—more and more have become resistant to letting them in at all. The latest location of this unwinding is along the southern border of the United States.

      So far, American citizens have gotten only glimpses of the conditions in the border camps that have been opened in their name. In the month of May, Customs and Border Protection reported a total of 132,887 migrants who were apprehended or turned themselves in between ports of entry along the southwest border, an increase of 34 percent from April alone. Upon apprehension, these migrants are temporarily detained by Border Patrol, and once their claims are processed, they are either released or handed over to ICE for longer-term detention. Yet Border Patrol itself is currently holding about 15,000 people, nearly four times what government officials consider to be this enforcement arm’s detention capacity.

      On June 12, the Department of Health and Human Services announced that Fort Sill, an Army post that hosted a World War II internment camp for detainees of Japanese descent, will now be repurposed to detain migrant children. In total, HHS reports that it is currently holding some 12,000 minors. Current law limits detention of minors to twenty days, though Senator Lindsey Graham has proposed expanding the court-ordered limit to 100 days. Since the post is on federal land, it will be exempt from state child welfare inspections.

      In addition to the total of detainees held by Border Patrol, an even higher number is detained at centers around the country by the Immigration and Customs Enforcement agency: on a typical day at the beginning of this month, ICE was detaining more than 52,500 migrants. The family separation policy outraged the public in the 2018, but despite legal challenges, it never fully ended. Less publicized have been the deaths of twenty-four adults in ICE custody since the beginning of the Trump administration; in addition, six children between the ages of two and sixteen have died in federal custody over the last several months. It’s not clear whether there have been other deaths that have gone unreported.

      Conditions for detainees have not been improving. At the end of May, a Department of Homeland Security inspector general found nearly 900 migrants at a Texas shelter built for a capacity of 125 people. On June 11, a university professor spotted at least 100 men behind chain-link fences near the Paso del Norte Bridge in El Paso, Texas. Those detainees reported sitting outside for weeks in temperatures that soared above 100 degrees. Taylor Levy, an El Paso immigration lawyer, described going into one facility and finding “a suicidal four-year-old whose face was covered in bloody, self-inflicted scratches… Another young child had to be restrained by his mother because he kept running full-speed into metal lockers. He was covered in bruises.”

      If deciding what to do about the growing numbers of adults and children seeking refuge in the US relies on complex humanitarian policies and international laws, in which most Americans don’t take a deep interest, a simpler question also presents itself: What exactly are these camps that the Trump administration has opened, and where is this program of mass detention headed?

      Even with incomplete information about what’s happening along the border today and what the government plans for these camps, history points to some conclusions about their future. Mass detention without trial earned a new name and a specific identity at the end of the nineteenth century. The labels then adopted for the practice were “reconcentración” and “concentration camps”—places of forced relocation of civilians into detention on the basis of group identity.

      Other kinds of group detention had appeared much earlier in North American history. The US government drove Native Americans from their homelands into prescribed exile, with death and detention in transit camps along the way. Some Spanish mission systems in the Americas had accomplished similar ends by seizing land and pressing indigenous people into forced labor. During the 245 years when slavery was legal in the US, detention was one of its essential features.

      Concentration camps, however, don’t typically result from the theft of land, as happened with Native Americans, or owning human beings in a system of forced labor, as in the slave trade. Exile, theft, and forced labor can come later, but in the beginning, detention itself is usually the point of concentration camps. By the end of the nineteenth century, the mass production of barbed wire and machines guns made this kind of detention possible and practical in ways it never had been before.

      Under Spanish rule in 1896, the governor-general of Cuba instituted camps in order to clear rebel-held regions during an uprising, despite his predecessor’s written refusal “as the representative of a civilized nation, to be the first to give the example of cruelty and intransigence” that such detention would represent. After women and children began dying in vast numbers behind barbed wire because there had been little planning for shelter and even less for food, US President William McKinley made his call to war before Congress. He spoke against the policy of reconcentración, calling it warfare by uncivilized means. “It was extermination,” McKinley said. “The only peace it could beget was that of the wilderness and the grave.” Without full records, the Cuban death toll can only be estimated, but a consensus puts it in the neighborhood of 150,000, more than 10 percent of the island’s prewar population.

      Today, we remember the sinking of the USS Maine as the spark that ignited the Spanish-American War. But war correspondent George Kennan (cousin of the more famous diplomat) believed that “it was the suffering of the reconcentrados, more, perhaps, than any other one thing that brought about the intervention of the United States.” On April 25, 1898, Congress declared war. Two weeks later, US Marines landed at Fisherman’s Point on the windward side of the entrance to Guantánamo Bay in Cuba. After a grim, week-long fight, the Marines took the hill. It became a naval base, and the United States has never left that patch of land.

      As part of the larger victory, the US inherited the Philippines. The world’s newest imperial power also inherited a rebellion. Following a massacre of American troops at Balangiga in September 1901, during the third year of the conflict, the US established its own concentration camp system. Detainees, mostly women and children, were forced into squalid conditions that one American soldier described in a letter to a US senator as “some suburb of hell.” In the space of only four months, more than 11,000 Filipinos are believed to have died in these noxious camps.

      Meanwhile, in southern Africa in 1900, the British had opened their own camps during their battle with descendants of Dutch settlers in the second Boer War. British soldiers filled tent cities with Boer women and children, and the military authorities called them refugee camps. Future Prime Minister David Lloyd George took offense at that name, noting in Parliament: “There is no greater delusion in the mind of any man than to apply the term ‘refugee’ to these camps. They are not refugee camps. They are camps of concentration.” Contemporary observers compared them to the Cuban camps, and criticized their deliberate cruelty. The Bishop of Hereford wrote to The Times of London in 1901, asking: “Are we reduced to such a depth of impotence that our Government can do nothing to stop such a holocaust of child-life?”

      Maggoty meat rations and polluted water supplies joined outbreaks of contagious diseases amid crowded and unhealthy conditions in the Boer camps. More than 27,000 detainees are thought to have died there, nearly 80 percent of them children. The British had opened camps for black Africans as well, in which at least 14,000 detainees died—the real number is probably much higher. Aside from protests made by some missionaries, the deaths of indigenous black Africans did not inspire much public outrage. Much of the history of the suffering in these camps has been lost.

      These early experiments with concentration camps took place on the periphery of imperial power, but accounts of them nevertheless made their way into newspapers and reports in many nations. As a result, the very idea of them came to be seen as barbaric. By the end of the first decade of the twentieth century, the first camp systems had all been closed, and concentration camps had nearly vanished as an institution. Within months of the outbreak of World War I, though, they would be resurrected—this time rising not at the margins but in the centers of power. Between 1914 and 1918, camps were constructed on an unprecedented scale across six continents. In their time, these camps were commonly called concentration camps, though today they are often referred to by the more anodyne term “internment.”

      Those World War I detainees were, for the most part, foreigners—or, in legalese, aliens—and recent anti-immigration legislation in several countries had deliberately limited their rights. The Daily Mail denounced aliens left at liberty once they had registered with their local police department, demanding, “Does signing his name take the malice out of a man?” The Scottish Field was more direct, asking, “Do Germans have souls?” That these civilian detainees were no threat to Britain did not keep them from being demonized, shouted at, and spat upon as they were paraded past hostile crowds in cities like London.

      Though a small number of people were shot in riots in these camps, and hunger became a serious issue as the conflict dragged on, World War I internment would present a new, non-lethal face for the camps, normalizing detention. Even after the war, new camps sprang up from Spain to Hungary and Cuba, providing an improvised “solution” for everything from vagrancy to anxieties over the presence of Jewish foreigners.

      Some of these camps were clearly not safe for those interned. Local camps appeared in Tulsa, Oklahoma, in 1921, after a white mob burned down a black neighborhood and detained African-American survivors. In Bolshevik Russia, the first concentration camps preceded the formation of the Soviet Union in 1922 and planted seeds for the brutal Gulag system that became official near the end of the USSR’s first decade. While some kinds of camps were understood to be harsher, after World War I their proliferation did not initially disturb public opinion. They had yet to take on their worst incarnations.

      In 1933, barely more than a month after Hitler was appointed chancellor, the Nazis’ first, impromptu camp opened in the town of Nohra in central Germany to hold political opponents. Detainees at Nohra were allowed to vote at a local precinct in the elections of March 5, 1933, resulting in a surge of Communist ballots in the tiny town. Locking up groups of civilians without trial had become accepted. Only the later realization of the horrors of the Nazi death camps would break the default assumption by governments and the public that concentration camps could and should be a simple way to manage populations seen as a threat.

      However, the staggering death toll of the Nazi extermination camp system—which was created mid-war and stood almost entirely separate from the concentration camps in existence since 1933—led to another result: a strange kind of erasure. In the decades that followed World War II, the term “concentration camp” came to stand only for Auschwitz and other extermination camps. It was no longer applied to the kind of extrajudicial detention it had denoted for generations. The many earlier camps that had made the rise of Auschwitz possible largely vanished from public memory.

      It is not necessary, however, to step back a full century in American history to find camps with links to what is happening on the US border today. Detention at Guantánamo began in the 1990s, when Haitian and Cuban immigrants whom the government wanted to keep out of the United States were housed there in waves over a four-year period—years before the “war on terror” and the US policy of rendition of suspected “enemy combatants” made Camps Delta, X-Ray, and Echo notorious. Tens of thousands of Haitians fleeing instability at home were picked up at sea and diverted to the Cuban base, to limit their legal right to apply for asylum. The court cases and battles over the suffering of those detainees ended up setting the stage for what Guantánamo would become after September 11, 2001.

      In one case, a federal court ruled that it did have jurisdiction over the base, but the government agreed to release the Haitians who were part of the lawsuit in exchange for keeping that ruling off the books. A ruling in a second case would assert that the courts did not have jurisdiction. Absent the prior case, the latter stood on its own as precedent. Leaving Guantánamo in this gray area made it an ideal site for extrajudicial detention and torture after the twin towers fell.

      This process of normalization, when a bad camp becomes much more dangerous, is not unusual. Today’s border camps are a crueler reflection of long-term policies—some challenged in court—that earlier presidents had enacted. Prior administrations own a share of the responsibility for today’s harsh practices, but the policies in place today are also accompanied by a shameless willingness to publicly target a vulnerable population in increasingly dangerous ways.

      I visited Guantánamo twice in 2015, sitting in the courtroom for pretrial hearings and touring the medical facility, the library, and all the old abandoned detention sites, as well as newly built ones, open to the media—from the kennel-style cages of Camp X-Ray rotting to ruin in the damp heat to the modern jailhouse facilities of Camp 6. Seeing all this in person made clear to me how vast the architecture of detention had become, how entrenched it was, and how hard it would be to close.

      Without a significant government effort to reverse direction, conditions in every camp system tend to deteriorate over time. Governments rarely make that kind of effort on behalf of people they are willing to lock up without trial in the first place. And history shows that legislatures do not close camps against the will of an executive.

      Just a few years ago there might have been more potential for change spurred by the judicial branch of our democracy, but this Supreme Court is inclined toward deference to executive power, even, it appears, if that power is abused. It seems unlikely this Court will intervene to end the new border camp system; indeed, the justices are far more likely to institutionalize it by half-measures, as happened with Guantánamo. The Korematsu case, in which the Supreme Court upheld Japanese-American internment (a ruling only rescinded last year), relied on the suppression of evidence by the solicitor general. Americans today can have little confidence that this administration would behave any more scrupulously when defending its detention policy.

      What kind of conditions can we expect to develop in these border camps? The longer a camp system stays open, the more likely it is that vital things will go wrong: detainees will contract contagious diseases and suffer from malnutrition and mental illness. We have already seen that current detention practices have resulted in children and adults succumbing to influenza, staph infections, and sepsis. The US is now poised to inflict harm on tens of thousands more, perhaps hundreds of thousands more.

      Along with such inevitable consequences, every significant camp system has introduced new horrors of its own, crises that were unforeseen when that system was opened. We have yet to discover what those will be for these American border camps. But they will happen. Every country thinks it can do detention better when it starts these projects. But no good way to conduct mass indefinite detention has yet been devised; the system always degrades.

      When, in 1940, Margarete Buber-Neumann was transferred from the Soviet Gulag at Karaganda to the camp for women at Ravensbrück (in an exchange enabled by the Nazi–Soviet Pact), she came from near-starvation conditions in the USSR and was amazed at the cleanliness and order of the Nazi camp. New arrivals were issued clothing, bedding, and silverware, and given fresh porridge, fruit, sausage, and jam to eat. Although the Nazi camps were already punitive, order-obsessed monstrosities, the wartime overcrowding that would soon overtake them had not yet made daily life a thing of constant suffering and squalor. The death camps were still two years away.

      The United States now has a vast and growing camp system. It is starting out with gruesome overcrowding and inadequate healthcare, and because of budget restrictions, has already taken steps to cut services to juvenile detainees. The US Office of Refugee Resettlement says that the mounting number of children arriving unaccompanied is forcing it to use military bases and other sites that it prefers to avoid, and that establishing these camps is a temporary measure. But without oversight from state child welfare inspectors, the possibilities for neglect and abuse are alarming. And without any knowledge of how many asylum-seekers are coming in the future, federal administrators are likely to find themselves boxed in to managing detention on military sites permanently.

      President Trump and senior White House adviser Stephen Miller appear to have purged the Department of Homeland Security of most internal opposition to their anti-immigrant policies. In doing so, that have removed even those sympathetic to the general approach taken by the White House, such as former Chief of Staff John Kelly and former Homeland Security Secretary Kirstjen Nielsen, in order to escalate the militarization of the border and expand irregular detention in more systematic and punitive ways. This kind of power struggle or purge in the early years of a camp system is typical.

      The disbanding of the Cheka, the Soviet secret police, in February 1922 and the transfer of its commander, Felix Dzerzhinsky, to head up an agency with control over only two prisons offered a hint of an alternate future in which extrajudicial detention would not play a central role in the fledgling Soviet republic. But Dzerzhinsky managed to keep control over the “special camps” in his new position, paving the way for the emergence of a camp-centered police state. In pre-war Germany in the mid-1930s, Himmler’s struggle to consolidate power from rivals eventually led him to make camps central to Nazi strategy. When the hardliners win, as they appear to have in the US, conditions tend to worsen significantly.

      Is it possible this growth in the camp system will be temporary and the improvised border camps will soon close? In theory, yes. But the longer they remain open, the less likely they are to vanish. When I visited the camps for Rohingya Muslims a year before the large-scale campaign of ethnic cleansing began, many observers appeared to be confusing the possible and the probable. It was possible that the party of Nobel Peace Prize winner Aung San Suu Kyi would sweep into office in free elections and begin making changes. It was possible that full democracy would come to all the residents of Myanmar, even though the government had stripped the Rohingya of the last vestiges of their citizenship. These hopes proved to be misplaced. Once there are concentration camps, it is always probable that things will get worse.

      The Philippines, Japanese-American internment, Guantánamo… we can consider the fine points of how the current border camps evoke past US systems, and we can see how the arc of camp history reveals the likelihood that the suffering we’re currently inflicting will be multiplied exponentially. But we can also simply look at what we’re doing right now, shoving bodies into “dog pound”-style detention pens, “iceboxes,” and standing room-only spaces. We can look at young children in custody who have become suicidal. How much more historical awareness do we really need?

    There is a room full of soil in downtown #New_Orleans. The soil is parceled into large baggies inside plastic tubs arranged on metal shelves. It’s like a library, except instead of books there are bags of earth. This is the soil archive of Dr. Howard W. Mielke, whose lab belongs to the Environmental Signaling Laboratory at the Tulane University School of Medicine. Mielke established the archive at Xavier University of Louisiana in 1991, and moved it to Tulane in 2006. He has catalogued some 17,000 bags of soil. They come from as far away as Olduvai Gorge, Tanzania; La Oroya, Peru; and Oslo, Norway — and as close as the daycare centers and playgrounds of New Orleans. All are contaminated with lead.

  • Suffering unseen: The dark truth behind wildlife tourism

    I’ve come back to check on a baby. Just after dusk I’m in a car lumbering down a muddy road in the rain, past rows of shackled elephants, their trunks swaying. I was here five hours before, when the sun was high and hot and tourists were on elephants’ backs.

    Walking now, I can barely see the path in the glow of my phone’s flashlight. When the wooden fence post of the stall stops me short, I point my light down and follow a current of rainwater across the concrete floor until it washes up against three large, gray feet. A fourth foot hovers above the surface, tethered tightly by a short chain and choked by a ring of metal spikes. When the elephant tires and puts her foot down, the spikes press deeper into her ankle.

    Meena is four years and two months old, still a toddler as elephants go. Khammon Kongkhaw, her mahout, or caretaker, told me earlier that Meena wears the spiked chain because she tends to kick. Kongkhaw has been responsible for Meena here at Maetaman Elephant Adventure, near Chiang Mai, in northern Thailand, since she was 11 months old. He said he keeps her on the spiked shackle only during the day and takes it off at night. But it’s night now.

    I ask Jin Laoshen, the Maetaman staffer accompanying me on this nighttime visit, why her chain is still on. He says he doesn’t know.

    Maetaman is one of many animal attractions in and around tourist-swarmed Chiang Mai. People spill out of tour buses and clamber onto the trunks of elephants that, at the prodding of their mahouts’ bullhooks (long poles with a sharp metal hook), hoist them in the air while cameras snap. Visitors thrust bananas toward elephants’ trunks. They watch as mahouts goad their elephants—some of the most intelligent animals on the planet—to throw darts or kick oversize soccer balls while music blares.

    Meena is one of Maetaman’s 10 show elephants. To be precise, she’s a painter. Twice a day, in front of throngs of chattering tourists, Kongkhaw puts a paintbrush in the tip of her trunk and presses a steel nail to her face to direct her brushstrokes as she drags primary colors across paper. Often he guides her to paint a wild elephant in the savanna. Her paintings are then sold to tourists.

    Meena’s life is set to follow the same trajectory as many of the roughly 3,800 captive elephants in Thailand and thousands more throughout Southeast Asia. She’ll perform in shows until she’s about 10. After that, she’ll become a riding elephant. Tourists will sit on a bench strapped to her back, and she’ll give several rides a day. When Meena is too old or sick to give rides—maybe at 55, maybe at 75—she’ll die. If she’s lucky, she’ll get a few years of retirement. She’ll spend most of her life on a chain in a stall.

    Wildlife attractions such as Maetaman lure people from around the world to be with animals like Meena, and they make up a lucrative segment of the booming global travel industry. Twice as many trips are being taken abroad as 15 years ago, a jump driven partly by Chinese tourists, who spend far more on international travel than any other nationality.

    Wildlife tourism isn’t new, but social media is setting the industry ablaze, turning encounters with exotic animals into photo-driven bucket-list toppers. Activities once publicized mostly in guidebooks now are shared instantly with multitudes of people by selfie-taking backpackers, tour-bus travelers, and social media “influencers” through a tap on their phone screens. Nearly all millennials (23- to 38-year-olds) use social media while traveling. Their selfies—of swims with dolphins, encounters with tigers, rides on elephants, and more—are viral advertising for attractions that tout up-close experiences with animals.

    For all the visibility social media provides, it doesn’t show what happens beyond the view of the camera lens. People who feel joy and exhilaration from getting close to wild animals usually are unaware that many of the animals at such attractions live a lot like Meena, or worse.

    Photographer Kirsten Luce and I set out to look behind the curtain of the thriving wildlife tourism industry, to see how animals at various attractions—including some that emphasize their humane care of animals—are treated once the selfie-taking crowds have gone.

    After leaving Maetaman, we take a five-minute car ride up a winding hill to a property announced by a wooden plaque as “Elephant EcoValley: where elephants are in good hands.” There are no elephant rides here. No paint shows or other performances. Visitors can stroll through an open-air museum and learn about Thailand’s national animal. They can make herbal treats for the elephants and paper from elephant dung. They can watch elephants in a grassy, tree-ringed field.

    EcoValley’s guest book is filled with praise from Australians, Danes, Americans—tourists who often shun elephant camps such as Maetaman because the rides and shows make them uneasy. Here, they can see unchained elephants and leave feeling good about supporting what they believe is an ethical establishment. What many don’t know is that EcoValley’s seemingly carefree elephants are brought here for the day from nearby Maetaman—and that the two attractions are actually a single business.

    Meena was brought here once, but she tried to run into the forest. Another young elephant, Mei, comes sometimes, but today she’s at Maetaman, playing the harmonica in the shows. When she’s not doing that, or spending the day at EcoValley, she’s chained near Meena in one of Maetaman’s elephant stalls.

    Meena Kalamapijit owns Maetaman as well as EcoValley, which she opened in November 2017 to cater to Westerners. She says her 56 elephants are well cared for and that giving rides and performing allow them to have necessary exercise. And, she says, Meena the elephant’s behavior has gotten better since her mahout started using the spiked chain.

    We sit with Kalamapijit on a balcony outside her office, and she explains that when Westerners, especially Americans, stopped coming to Maetaman, she eliminated one of the daily shows to allot time for visitors to watch elephants bathe in the river that runs through the camp.

    “Westerners enjoy bathing because it looks happy and natural,” she says. “But a Chinese tour agency called me and said, ‘Why are you cutting the show? Our customers love to see it, and they don’t care about bathing at all.’ ” Providing separate options is good for business, Kalamapijit says.

    Around the world Kirsten and I watched tourists watching captive animals. In Thailand we also saw American men bear-hug tigers in Chiang Mai and Chinese brides in wedding gowns ride young elephants in the aqua surf on the island of Phuket. We watched polar bears in wire muzzles ballroom dancing across the ice under a big top in Russia and teenage boys on the Amazon River snapping selfies with baby sloths.

    Most tourists who enjoy these encounters don’t know that the adult tigers may be declawed, drugged, or both. Or that there are always cubs for tourists to snuggle with because the cats are speed bred and the cubs are taken from their mothers just days after birth. Or that the elephants give rides and perform tricks without harming people only because they’ve been “broken” as babies and taught to fear the bullhook. Or that the Amazonian sloths taken illegally from the jungle often die within weeks of being put in captivity.

    As we traveled to performance pits and holding pens on three continents and in the Hawaiian Islands, asking questions about how animals are treated and getting answers that didn’t always add up, it became clear how methodically and systematically animal suffering is concealed.

    The wildlife tourism industry caters to people’s love of animals but often seeks to maximize profits by exploiting animals from birth to death. The industry’s economy depends largely on people believing that the animals they’re paying to watch or ride or feed are having fun too.

    It succeeds partly because tourists—in unfamiliar settings and eager to have a positive experience—typically don’t consider the possibility that they’re helping to hurt animals. Social media adds to the confusion: Oblivious endorsements from friends and trendsetters legitimize attractions before a traveler ever gets near an animal.

    There has been some recognition of social media’s role in the problem. In December 2017, after a National Geographic investigative report on harmful wildlife tourism in Amazonian Brazil and Peru, Instagram introduced a feature: Users who click or search one of dozens of hashtags, such as #slothselfie and #tigercubselfie, now get a pop-up warning that the content they’re viewing may be harmful to animals.

    Everyone finds Olga Barantseva on Instagram. “Photographer from Russia. Photographing dreams,” her bio reads. She meets clients for woodland photo shoots with captive wild animals just outside Moscow.

    For her 18th birthday, Sasha Belova treated herself to a session with Barantseva—and a pack of wolves. “It was my dream,” she says as she fidgets with her hair, which had been styled that morning. “Wolves are wild and dangerous.” The wolves are kept in small cages at a petting zoo when not participating in photo shoots.

    The Kravtsov family hired Barantseva to take their first professional family photos—all five family members, shivering and smiling in the birch forest, joined by a bear named Stepan.

    Barantseva has been photographing people and wild animals together for six years. She “woke up as a star,” she says, in 2015, when a couple of international media outlets found her online. Her audience has exploded to more than 80,000 followers worldwide. “I want to show harmony between people and animals,” she says.

    On a raw fall day, under a crown of golden birch leaves on a hill that overlooks a frigid lake, two-and-a-half-year-old Alexander Levin, dressed in a hooded bumblebee sweater, timidly holds Stepan’s paw.

    The bear’s owners, Yury and Svetlana Panteleenko, ply their star with food—tuna fish mixed with oatmeal—to get him to approach the boy. Snap: It looks like a tender friendship. The owners toss grapes to Stepan to get him to open his mouth wide. Snap: The bear looks as if he’s smiling.

    The Panteleenkos constantly move Stepan, adjusting his paws, feeding him, and positioning Alexander as Barantseva, pink-haired, bundled in jeans and a parka, captures each moment. Snap: A photo goes to her Instagram feed. A boy and a bear in golden Russian woods—a picture straight out of a fairy tale. It’s a contemporary twist on a long-standing Russian tradition of exploiting bears for entertainment.

    Another day in the same forest, Kirsten and I join 12 young women who have nearly identical Instagram accounts replete with dreamy photos of models caressing owls and wolves and foxes. Armed with fancy cameras but as yet modest numbers of followers, they all want the audience Barantseva has. Each has paid the Panteleenkos $760 to take identical shots of models with the ultimate prize: a bear in the woods.

    Stepan is 26 years old, elderly for a brown bear, and can hardly walk. The Panteleenkos say they bought him from a small zoo when he was three months old. They say the bear’s work—a constant stream of photo shoots and movies—provides money to keep him fed.

    And just like that, social media takes a single instance of local animal tourism and broadcasts it to the world.

    When the documentary film Blackfish was released in 2013, it drew a swift and decisive reaction from the American public. Through the story of Tilikum, a distressed killer whale at SeaWorld in Orlando, Florida, the film detailed the miserable life orcas can face in captivity. Hundreds of thousands of outraged viewers signed petitions. Companies with partnership deals, such as Southwest Airlines, severed ties with SeaWorld. Attendance at SeaWorld’s water parks slipped; its stock nose-dived.

    James Regan says what he saw in Blackfish upset him. Regan, honeymooning in Hawaii with his wife, Katie, is from England, where the country’s last marine mammal park closed permanently in 1993. I meet him at Dolphin Quest Oahu, an upscale swim-with-dolphins business on the grounds of the beachfront Kahala Hotel & Resort, just east of Honolulu. The Regans paid $225 each to swim for 30 minutes in a small group with a bottlenose dolphin. One of two Dolphin Quest locations in Hawaii, the facility houses six dolphins.

    Bottlenose dolphins are the backbone of an industry that spans the globe. Swim-with-dolphins operations rely on captive-bred and wild-caught dolphins that live—and interact with tourists—in pools. The popularity of these photo-friendly attractions reflects the disconnect around dolphin experiences: People in the West increasingly shun shows that feature animals performing tricks, but many see swimming with captive dolphins as a vacation rite of passage.

    Katie Regan has wanted to swim with dolphins since she was a child. Her husband laughs and says of Dolphin Quest, “They paint a lovely picture. When you’re in America, everyone is smiling.” But he appreciates that the facility is at their hotel, so they can watch the dolphins being fed and cared for. He brings up Blackfish again.

    Katie protests: “Stop making my dream a horrible thing!”

    Rae Stone, president of Dolphin Quest and a marine mammal veterinarian, says the company donates money to conservation projects and educates visitors about perils that marine mammals face in the wild. By paying for this entertainment, she says, visitors are helping captive dolphins’ wild cousins.

    Stone notes that Dolphin Quest is certified “humane” by American Humane, an animal welfare nonprofit. (The Walt Disney Company, National Geographic’s majority owner, offers dolphin encounters on some vacation excursions and at an attraction in Epcot, one of its Orlando parks. Disney says it follows the animal welfare standards of the Association of Zoos & Aquariums, a nonprofit that accredits more than 230 facilities worldwide.)

    It’s a vigorous debate: whether even places with high standards, veterinarians on staff, and features such as pools filled with filtered ocean water can be truly humane for marine mammals.

    Dolphin Quest’s Stone says yes.

    Critics, including the Humane Society of the United States, which does not endorse keeping dolphins in captivity, say no. They argue that these animals have evolved to swim great distances and live in complex social groups—conditions that can’t be replicated in the confines of a pool. This helps explain why the National Aquarium, in Baltimore, announced in 2016 that its dolphins will be retired to a seaside sanctuary by 2020.

    Some U.S. attractions breed their own dolphins because the nation has restricted dolphin catching in the wild since 1972. But elsewhere, dolphins are still being taken from the wild and turned into performers.

    In China, which has no national laws on captive-animal welfare, dolphinariums with wild-caught animals are a booming business: There are now 78 marine mammal parks, and 26 more are under construction.

    To have the once-in-a-lifetime chance to see rare Black Sea dolphins, people in the landlocked town of Kaluga, a hundred miles from Moscow, don’t have to leave their city. In the parking lot of the Torgoviy Kvartal shopping mall, next to a hardware store, is a white inflatable pop-up aquarium: the Moscow Traveling Dolphinarium. It looks like a children’s bouncy castle that’s been drained of its color.

    Inside the puffy dome, parents buy their kids dolphin-shaped trinkets: fuzzy dolls and Mylar balloons, paper dolphin hats, and drinks in plastic dolphin tumblers. Families take their seats around a small pool. The venue is so intimate that even the cheapest seats, at nine dollars apiece, are within splashing distance.

    “My kids are jumping for joy,” says a woman named Anya, motioning toward her two giddy boys, bouncing in their seats.

    In the middle of the jubilant atmosphere, in water that seems much too shallow and much too murky, two dolphins swim listlessly in circles.

    Russia is one of only a few countries (Indonesia is another) where traveling oceanariums exist. Dolphins and beluga whales, which need to be immersed in water to stay alive, are put in tubs on trucks and carted from city to city in a loop that usually ends when they die. These traveling shows are aboveboard: Russia has no laws that regulate how marine mammals should be treated in captivity.

    The shows are the domestic arm of a brisk Russian global trade in dolphins and small whales. Black Sea bottlenose dolphins can’t be caught legally without a permit, but Russian fishermen can catch belugas and orcas under legal quotas in the name of science and education. Some belugas are sold legally to aquariums around the country. Russia now allows only a dozen or so orcas to be caught each year for scientific and educational purposes, and since April 2018, the government has cracked down on exporting them. But government investigators believe that Russian orcas—which can sell for millions—are being caught illegally for export to China.

    Captive orcas, which can grow to 20 feet long and more than 10,000 pounds, are too big for the traveling shows that typically feature dolphins and belugas. When I contacted the owners of the Moscow Traveling Dolphinarium and another operation, the White Whale Show, in separate telephone calls to ask where their dolphins and belugas come from, both men, Sergey Kuznetsov and Oleg Belesikov, hung up on me.

    Russia’s dozen or so traveling oceanariums are touted as a way to bring native wild animals to people who might never see the ocean.

    “Who else if not us?” says Mikhail Olyoshin, a staffer at one traveling oceanarium. And on this day in Kaluga, as the dolphins perform tricks to American pop songs and lie on platforms for several minutes for photo ops, parents and children express the same sentiment: Imagine, dolphins, up close, in my hometown. The ocean on delivery.

    Owners and operators of wildlife tourism attractions, from high-end facilities such as Dolphin Quest in Hawaii to low-end monkey shows in Thailand, say their animals live longer in captivity than wild counterparts because they’re safe from predators and environmental hazards. Show operators proudly emphasize that the animals under their care are with them for life. They’re family.

    Alla Azovtseva, a longtime dolphin trainer in Russia, shakes her head.

    “I don’t see any sense in this work. My conscience bites me. I look at my animals and want to cry,” says Azovtseva, who drives a red van with dolphins airbrushed on the side. At the moment, she’s training pilot whales to perform tricks at Moscow’s Moskvarium, one of Europe’s largest aquariums (not connected to the traveling dolphin shows). On her day off, we meet at a café near Red Square.

    She says she fell in love with dolphins in the late 1980s when she read a book by John Lilly, the American neuroscientist who broke open our understanding of the animals’ intelligence. She has spent 30 years training marine mammals to do tricks. But along the way she’s grown heartsick from forcing highly intelligent, social creatures to live isolated, barren lives in small tanks.

    “I would compare the dolphin situation with making a physicist sweep the street,” she says. “When they’re not engaged in performance or training, they just hang in the water facing down. It’s the deepest depression.”

    What people don’t know about many aquarium shows in Russia, Azovtseva says, is that the animals often die soon after being put in captivity, especially those in traveling shows. And Azovtseva—making clear she’s referring to the industry at large in Russia and not the Moskvarium—says she knows many aquariums quietly and illegally replace their animals with new ones.

    It’s been illegal to catch Black Sea dolphins in the wild for entertainment purposes since 2003, but according to Azovtseva, aquarium owners who want to increase their dolphin numbers quickly and cheaply buy dolphins poached there. Because these dolphins are acquired illegally, they’re missing the microchips that captive cetaceans in Russia are usually tagged with as a form of required identification.

    Some aquariums get around that, she says, by cutting out dead dolphins’ microchips and implanting them into replacement dolphins.

    “People are people,” Azovtseva says. “Once they see an opportunity, they exploit.” She says she can’t go on doing her work in the industry and that she’s decided to speak out because she wants people to know the truth about the origins and treatment of many of the marine mammals they love watching. We exchange a look—we both know what her words likely mean for her livelihood.

    “I don’t care if I’m fired,” she says defiantly. “When a person has nothing to lose, she becomes really brave.”

    I’m sitting on the edge of an infinity pool on the hilly Thai side of Thailand’s border with Myanmar, at a resort where rooms average more than a thousand dollars a night.

    Out past the pool, elephants roam in a lush valley. Sitting next to me is 20-year-old Stephanie van Houten. She’s Dutch and French, Tokyo born and raised, and a student at the University of Michigan. Her cosmopolitan background and pretty face make for a perfect cocktail of aspiration—she’s exactly the kind of Instagrammer who makes it as an influencer. That is, someone who has a large enough following to attract sponsors to underwrite posts and, in turn, travel, wardrobes, and bank accounts. In 2018, brands—fashion, travel, tech, and more—spent an estimated $1.6 billion on social media advertising by influencers.

    Van Houten has been here, at the Anantara Golden Triangle Elephant Camp & Resort, before. This time, in a fairly standard influencer-brand arrangement, she’ll have a picnic with elephants and post about it to her growing legion of more than 25,000 Instagram followers. In exchange, she gets hundreds of dollars off the nightly rate.

    At Anantara the fields are green, and during the day at least, many of the resort’s 22 elephants are tethered on ropes more than a hundred feet long so they can move around and socialize. Nevertheless, they’re expected to let guests touch them and do yoga beside them.

    After van Houten’s elephant picnic, I watch her edit the day’s hundreds of photos. She selects an image with her favorite elephant, Bo. She likes it, she says, because she felt a connection with Bo and thinks that will come across. She posts it at 9:30 p.m.—the time she estimates the largest number of her followers will be online. She includes a long caption, summing it up as “my love story with this incredible creature,” and the hashtag #stopelephantriding. Immediately, likes from followers stream in—more than a thousand, as well as comments with heart-eyed emoji.

    Anantara is out of reach for anyone but the wealthy—or prominent influencers. Anyone else seeking a similar experience might do a Google search for, say, “Thailand elephant sanctuary.”

    As tourist demand for ethical experiences with animals has grown, affordable establishments, often calling themselves “sanctuaries,” have cropped up purporting to offer humane, up-close elephant encounters. Bathing with elephants—tourists give them a mud bath, splash them in a river, or both—has become very popular. Many facilities portray baths as a benign alternative to elephant riding and performances. But elephants getting baths, like those that give rides and do tricks, will have been broken to some extent to make them obedient. And as long as bathing remains popular, places that offer it will need obedient elephants to keep their businesses going. 


    In Ban Ta Klang, a tiny town in eastern Thailand, modest homes dot the crimson earth. In front of each is a wide, bamboo platform for sitting, sleeping, and watching television.

    But the first thing I notice is the elephants. Some homes have one, others as many as five. Elephants stand under tarps or sheet metal roofs or trees. Some are together, mothers and babies, but most are alone. Nearly all the elephants wear ankle chains or hobbles—cuffs binding their front legs together. Dogs and chickens weave among the elephants’ legs, sending up puffs of red dust.

    Ban Ta Klang—known as Elephant Village—is ground zero in Thailand for training and trading captive elephants.

    “House elephants,” Sri Somboon says, gesturing as he turns down his TV. Next to his outdoor platform, a two-month-old baby elephant runs around his mother. Somboon points across the road to the third elephant in his charge, a three-year-old male tethered to a tree. He’s wrenching his head back and forth and thrashing his trunk around. It looks as if he’s going out of his mind.

    He’s in the middle of his training, Somboon says, and is getting good at painting. He’s already been sold, and when his training is finished, he’ll start working at a tourist camp down south.

    Ban Ta Klang and the surrounding area, part of Surin Province, claim to be the source of more than half of Thailand’s 3,800 captive elephants. Long before the flood of tourists, it was the center of the elephant trade; the animals were caught in the wild and tamed for use transporting logs. Now, every November, hundreds of elephants from here are displayed, bought, and sold in the province’s main town, Surin.

    One evening I sit with Jakkrawan Homhual and Wanchai Sala-ngam. Both 33, they’ve been best friends since childhood. About half the people in Ban Ta Klang who care for elephants, including Homhual, don’t own them. They’re paid a modest salary by a rich owner to breed and train baby elephants for entertainment. As night falls, thousands of termites swarm us, attracted to the single bulb hanging above the bamboo platform. Our conversation turns to elephant training.

    Phajaan is the traditional—and brutal—days- or weeks-long process of breaking a young elephant’s spirit. It has long been used in Thailand and throughout Southeast Asia to tame wild elephants, which still account for many of the country’s captives. Under phajaan, elephants are bound with ropes, confined in tight wooden structures, starved, and beaten repeatedly with bullhooks, nails, and hammers until their will is crushed. The extent to which phajaan persists in its harshest form is unclear. Since 2012, the government has been cracking down on the illegal import of elephants taken from the forests of neighboring Myanmar, Thailand’s main source of wild-caught animals.

    I ask the men how baby elephants born in captivity are broken and trained.

    When a baby is about two years old, they say, mahouts tie its mother to a tree and slowly drag the baby away. Once separated, the baby is confined. Using a bullhook on its ear, they teach the baby to move: left, right, turn, stop. To teach an elephant to sit, Sala-ngam says, “we tie up the front legs. One mahout will use a bullhook at the back. The other will pull a rope on the front legs.” He adds: “To train the elephant, you need to use the bullhook so the elephant will know.”

    Humans identify suffering in other humans by universal signs: People sob, wince, cry out, put voice to their hurt. Animals have no universal language for pain. Many animals don’t have tear ducts. More creatures still—prey animals, for example—instinctively mask symptoms of pain, lest they appear weak to predators. Recognizing that a nonhuman animal is in pain is difficult, often impossible.

    But we know that animals feel pain. All mammals have a similar neuroanatomy. Birds, reptiles, and amphibians all have pain receptors. As recently as a decade ago, scientists had collected more evidence that fish feel pain than they had for neonatal infants. A four-year-old human child with spikes pressing into his flesh would express pain by screaming. A four-year-old elephant just stands there in the rain, her leg jerking in the air.

    Of all the silently suffering animals I saw in pools and pens around the world, two in particular haunt me: an elephant and a tiger.

    They lived in the same facility, Samut Prakan Crocodile Farm and Zoo, about 15 miles south of Bangkok. The elephant, Gluay Hom, four years old, was kept under a stadium. The aging tiger, Khai Khem, 22, spent his days on a short chain in a photo studio. Both had irrefutable signs of suffering: The emaciated elephant had a bent, swollen leg hanging in the air and a large, bleeding sore at his temple. His eyes were rolled back in his head. The tiger had a dental abscess so severe that the infection was eating through the bottom of his jaw.

    When I contacted the owner of the facility, Uthen Youngprapakorn, to ask about these animals, he said the fact that they hadn’t died proved that the facility was caring for them properly. He then threatened a lawsuit.

    Six months after Kirsten and I returned from Thailand, we asked Ryn Jirenuwat, our Bangkok-based Thai interpreter, to check on Gluay Hom and Khai Khem. She went to Samut Prakan and watched them for hours, sending photos and video. Gluay Hom was still alive, still standing in the same stall, leg still bent at an unnatural angle. The elephants next to him were skin and bones. Khai Khem was still chained by his neck to a hook in the floor. He just stays in his dark corner, Jirenuwat texted, and when he hears people coming, he twists on his chain and turns his back to them.

    “Like he just wants to be swallowed by the wall.”

    More than three days on, little information has been provided on where the ships were when they were attacked, what sort of weapon was used, and who did it.

    Navigational data indicated at least some of the ships may have been within nine nautical miles of the shore, well within UAE territorial sea. Saudi Arabia’s energy minister has said at least one of them was further out, in the UAE’s exclusive economic zone where international law largely applies.

    Reuters and other journalists taken on a tour off the Fujairah coast saw a hole at the waterline in the hull of a Norwegian ship, with the metal torn inwards. A Saudi tanker they viewed showed no sign of major damage.

    Maritime security sources told Reuters that images suggest the damage was likely caused by limpet mines attached close to the waterline with less than 4 kg of explosives. One source said the level of coordination and use of mines were likely to rule out militant groups such as al Qaeda.

    It’s not those guys seeking publicity, it’s someone who wants to make a point without necessarily pointing in any given direction,” said Jeremy Binnie, Middle East and Africa editor for Jane’s Defence Weekly. “It’s below the threshold (for war).

    Jean-Marc Rickli, head of global risk and resilience at the Geneva Centre for Security Policy, said the attacks could be a message that Iran has means to disrupt traffic.

    Saudi state oil company Aramco said output and exports were not disrupted by the attack on the pumping stations, but it temporarily shut the East-West pipeline to evaluate its condition.

    Both attacks targeted alternative routes for oil to bypass Hormuz. Fujairah port is a terminal of the crude pipeline from Abu Dhabi’s Habshan oilfields. The Saudi East-West line takes crude from eastern fields to Yanbu port, north of Bab al-Mandeb.

    The Burning Man event is seeking a renewal of its 10-year permit to use the federally owned Black Rock Desert site managed by the Bureau of Land Management; the BLM has responded with a bizarre, overreaching Environmental Impact Statement that ignores the lavishly documented record of Burning Man’s excellent safety and stewardship record.

    For example, the new Environmental Impact Statement calls for Burning Man to hire an outside security force to replace its all-volunteer, community-based Black Rock Rangers, and to have these rent-a-cops search all belongings of all attendees: 80,000 people in 30,000 cars, in a high-wind, low-visibility environment where, in addition to the threat to privacy there is also a massive risk of huge amounts of personal belongings being whipped away by the wind and blown all over the desert.

    The EIS also ignores Burning Man’s status as the world’s largest, best-managed “leave no trace” event, where every piece of waste down to individual sequins and metal shavings are picked up and packed out by attendees. Instead, the BLM wants Burning Man to install several football-fields’ worth of dumpsters at the event’s exit, with parking for 30,000 vehicles to pull up to them. In addition to eroding the norm of stewardship and waste-management that is intrinsic to the festival, this would also deprive the nearby Pyramid Lake Paiute dump sites of the millions they take in from burners who pay to have their waste legally disposed of.

    The EIS also calls for the creation of a 19,000,000 lb concrete jersey barrier to encircle the site, replacing the trash fence (a wildlife-friendly fence that catches blown waste) and the perimeter patrols (which are hugely effective at catching people sneaking into the event). The concrete barrier would do untold habitat damage and cause scarring on the playa, as well as disrupting wildlife.

    There’s lots more — including a mandate for the festival to conduct anti-drug surveillance of attendees, volunteers and staff, which is simply out of scope of the National Environmental Policy Act.

Clocking in at nine minutes and 22 seconds, the video is a mini-epic spanning Germany history. Directed by Specter Berlin, it’s a cinematic and controversial clip that’s confusing if you’re not up on your history. We asked Dr Alexandra Lloyd, lecturer in German at the University of Oxford, to explain what the fuck is happening.

    Rammstein have just released a jaw-dropping video for new single Deutschland – but what exactly is it all about?

    Rammstein’s Deutschland takes us on a thrilling, violent, and moving journey through German history. At over nine minutes, it gives us a panorama of events and historical and mythical figures, and there are so many references and Easter eggs that fans and commentators will be poring over it for some time to come.

    The video opens in AD 16, on the ‘barbarian’ side of the limes, the border of the Roman Empire. Roman soldiers creep through the woods in the aftermath of the Battle of the Teutoburg Forest. The Romans were ambushed by an alliance of Germanic Tribes, led by a chieftain called Arminius (the original Hermann the German). Three legionary standards were captured, a loss symbolic and moral, as well as physical, and decades were spent trying to recover them. Rome never again attempted to take the lands east of the River Rhine, known as Germania.

    ‘Germania’ refers not just to a place, somewhere partly defined by where it isn’t (Rome) as well as where it is, but also to a national figurehead, traditionally representing the German people. Germania is a strong woman, usually armour-clad and battle-ready. Various symbols appear with her, among them a breastplate with an eagle, a black, red, and gold flag, and a crown. Look out for these in the video – they come up again and again – and the colours of the contemporary flag are there in every scene.

    We get our first glimpse of Germania here (played by Ruby Commey), who stands holding Till Lindemann’s severed head. Next, astronauts appear carrying a metal and glass box shaped like a coffin. In the background we see a U-boat – a German submarine, used in World Wars I and II. Then we move to a scene set at a boxing match which takes us to Weimar Germany (1918-1933), a period known for its political instability but also greater cultural liberalism. Here, Germania appears in the cabaret costume of a flapper girl, and the boxers fight with knuckle-dusters as a crowd cheers them on.

    We see the former East Germany, complete with busts of Marx and Lenin, the national emblem of East Germany, and a lookalike of the long-serving, insular, and repressive GDR leader Erich Honecker. There’s another astronaut, or rather a cosmonaut: Sigmund Jähn, the first German in space, who flew with the USSR’s space program (and who’s also a character in the 2003 film, Good Bye Lenin!). Medieval monks feast grotesquely on the supine Germania, tearing sauerkraut and sausage from Ruby Commey’s body, prison inmates are beaten by guards dressed in police and military uniforms from different historical periods.

    The most obviously shocking scene references the Holocaust and the Nazi period. Four members of the band, in the striped uniforms of camp inmates, wait at the gallows, about to be hanged. They wear the cloth emblems used to identify their ‘crimes’: a pink triangle for homosexual prisoners, a yellow star for Jewish prisoners, a red and yellow star for Jewish political prisoners.

    This sequence, teased in an earlier promo video, has already caused controversy. Have Rammstein the right to do this? Do they trivialise the suffering of Holocaust victims? How can they justify using Holocaust imagery to promote their new video? These are important questions that are part of a much bigger debate about the ethics of using the Holocaust in art and media.

    Other scenes include the band walking away from a flaming airship, referring to the 1937 Hindenburg Disaster, in which 36 people died. Rats scuttle across the floor when the monks first appear, suggesting the Pied Piper of Hamelin, a legend with origins in the 13th century.

    Germania walks towards the camera in a leather jacket, gold jewellery and a string of bullets across her chest, resembling the chariot drawn by four horses (the ‘Quadriga’) on top of the Brandenburg Gate in Berlin. The band members’ heads are shown as white marble busts, taking us to the 19th century Walhalla memorial in Bavaria, built as German Hall of Fame, its sculpted heads of German worthies on display to this day.

    In the prison, hundreds of banknotes fall from above, suggesting the devastating hyperinflation Germany suffered in the 1920s. Nazis burn books, intercut with religious fanatics burning witches. We recognise members of the Red Army Faction (also known as the Baader-Meinhof group), a militant organisation active in the 1970s in West Germany. And in a blink-or-you-miss-it exchange, we are reminded of the much-criticised relationship between the churches and the state during the Third Reich.

    Each scene captures in a moment the icons of an era, and the video cuts between them more and more frenetically as it goes on. Events bleed into each other, linked by the presence of the band members and the red laser beam that appears throughout the video, a ‘roter Faden’ (red thread or central theme), connecting each event.

    Germany engages with its history in a very particular way. Try to imagine the video about Britain, with Britannia played by Ruby Commey. What would the equivalent events be? Quite a few of the tableaux might be similar – Romans, Crusaders, monks, 18th-century soldiers, collarless shirts and bareknuckle boxing – but would it have the same impact?

    There’s no affection, and perhaps not much hope: its pessimistic tone seems to be quite an off-brand message for post-1989 Germany, which wants to acknowledge its past critically, while also looking to its future as a state at the heart of Europe. And actually, while we get a lot of medieval and twentieth-century history, the video’s tour through the past seems to stop in the late 1980s, before the fall of the Berlin Wall and Reunification of East and West Germany. Instead, we jump into the future, where the space-suited band take Germania into the unknown, travelling in that coffin-shaped glass box.

    There’s an echo of the video for Sonne, where Snow White is trapped in a glass coffin. In fact, a piano version of Sonne plays over the end credits of Deutschland. This is a useful link for understanding something of what Rammstein is doing here. In Sonne, where the band’s characters free themselves of Snow White (naturally, they’ve been her sex-slaves), only to realise that they have made a mistake and long for her return, the overwhelming feeling of Deutschland seems to be that when it comes to Germania (or Germany): you can’t love her, and you can’t live without her.

    HEBRON (Ma’an) — A Palestinian was shot and killed by Israeli forces, on Tuesday, for allegedly attempting to carry out a stabbing attack against Israeli soldiers in the Old City of Hebron, in the southern occupied West Bank.

    Locals told Ma’an that the Palestinian was shot and killed by Israeli forces for attempting to carry out a stabbing attack against Israeli soldiers situated in Hebron’s Old City.

    The Palestinian was identified as Yasser al-Shweiki.

    Fawzi al-Shweiki, Yasser’s father, confirmed to Ma’an that his son was distributing notices from the Sharia Court across Hebron City.

    Sources mentioned that Israeli forces dragged Yasser’s body and took into a building that is under the Israeli settlers’ control.

    There were no injuries reported among Israeli soldiers.
    According to Hebrew-languge news outlets, Yasser approached the Israeli soldiers with a knife in attempt to carry out a stabbing attack.

      His father, Fawzi Shweiki, said that he heard the gunshots, but did not know that it was his son, who works for the local Sharia court and was distributing notices, was the victim.

      In a new crime of excessive use of force, Israeli forces killed a Palestinian civilian while passing by al-Rajaby building, which the settlers took over several years ago, in al-Ras neighborhood, east of Hebron, and his corpse was taken to an unknown destination. He was killed under the pretext that he intended to carry out a stabbing attack, but PCHR’s investigations refuted those allegations. According to PCHR’s investigations, at approximately 12:30, Yasser Mohammad Fawzi Khaleel al-Shweiky (42), a court officer from Hebron, arrived in al-Ras area, east of the city, to hand Hebron First Instance Court’s summons for civilians living in Jaber and Wadi al-Hussien neighborhoods. Al-Shweiky stopped his work car, which has a governmental registration plate, 100 meters away from the metal detector established in front of al-Rajaby building, which the settlers took over several years ago. As al-Shweiky stepped out of the car and approached the building, a solider from the soldiers guarding the building fired a bullet at him then he fell on the ground. Minutes later, the Israeli soldiers took him to the building without providing him first aid and prevented PRCS ambulances from reaching there. Half an hour later, al-Shweiky was taken to an unknown destination. Following that, dozens of settlers gathered around al-Rajaby building and organized a protest calling for killing Arabs. Moreover, the Israeli soldiers completely closed the area and prevented civilians from moving freely in or out of the area. At approximately 18:00, Israeli authorities confiscated the car al-Shweiky was driving and took it to an unknown destination.

    In the heart of St Petersburg, on the north bank of the Neva, the spire of the Cathedral of SS Peter and Paul lances the sky like a baroque syringe. But the spire has been surpassed, for height and force, by a structure that soars slantwise some 400 metres into the air, and prods the clouds like an accusing finger.

    The building - if that is what it is - spans the river and presents to a viewer of its eastern aspect a flat, grey lattice that might be a crane or a vast gun emplacement levelled at the heavens. It soon resolves itself, however, into discrete but unified parts. The iron spine of the thing speeds out of the earth at an angle of 60 degrees. Encircling it, a double helix of the same metal, supported by vertical and diagonal struts, tapers to an oddly indeterminate apex. Inside this narrowing cage, an arrangement of three (or is it four?) huge glass geometric shapes is visible. Perhaps, as one strains now to take in the whole from a nearby bridge, there is a grinding of gears far above, and something revolves at the upper reaches of the tower, half lost in a flurry of snow.

      The fact that Philadelphia barrister Francis Alexander Malofiy, Esquire, is suing Led Zeppelin over the authorship of “Stairway to Heaven” is, by any objective measure, only the fourth most interesting thing about him. Unfortunately for the reader, and the purposes of this story, the first, second and third most interesting things about Malofiy are bound and gagged in nondisclosure agreements, those legalistic dungeons where the First Amendment goes to die. So let’s start with number four and work our way backward.

      At the risk of stating the obvious, ladies and gentlemen of the jury, let the record show that “Stairway to Heaven” is arguably the most famous song in all of rock-and-roll, perhaps in all of popular music. It’s also one of the most lucrative — it’s estimated that the song has netted north of $500 million in sales and royalties since its 1971 release. Malofiy’s lawsuit, cheekily printed in the same druidic font used for the liner notes of the album Led Zeppelin IV, alleges that Jimmy Page and Robert Plant — Zep’s elegantly wasted guitarist/producer/central songwriter and leonine, leather-lunged lead singer, respectively — stole the iconic descending acoustic-guitar arpeggios of the first two minutes of “Stairway” from “Taurus,” a song with a strikingly similar chord pattern by a long-forgotten ’60s band called Spirit. At the conclusion of a stormy, headline-grabbing trial in 2016 that peaked with testimony from Page and Plant, the jury decided in Zep’s favor.

      When the copyright infringement suit was first filed in Philadelphia by Malofiy (pronounced “MAL-uh-fee”) on behalf of the Randy Craig Wolfe Trust — which represents the estate of Randy “California” Wolfe, the now-deceased member of Spirit who wrote “Taurus” — people laughed. Mostly at Malofiy. The breathless wall-to-wall media coverage the trial garnered often painted him as a loose-cannon legal beagle, one part Charlie Sheen, one part Johnnie Cochran. “Everybody kind of dismissed me as this brash young lawyer who didn’t really understand copyright law,” he says, well into the wee hours one night back in December, sitting behind a desk stacked four feet high with legal files in the dank, subterranean bunker that is his office.

      Hidden behind an unmarked door on the basement floor of a nondescript office building in Media, the law firm of Francis Alexander LLC is a pretty punk-rock operation. The neighbors are an anger management counselor and a medical marijuana dispensary. “I think of us as pirates sinking big ships,” Malofiy, who’s 41, brags. Given the sheer number of death threats he says he’s received from apoplectic Zep fans, the fact that mysterious cars seem to follow him in the night, and his claim to have found GPS trackers stuck to the bottom of his car, the precise location of his offices remains a closely guarded secret. Failing that, he has a license to carry, and most days, he leaves the house packing a .38-caliber Smith & Wesson.

      While most lawyers are sleeping, Malofiy is working through the night to defeat them, often until sunrise, fueled by an ever-present bottle of grape-flavored Fast Twitch as he chain-chews Wrigley’s Spearmint gum and huffs a never-ending string of Marlboro menthols. We’ve been talking on the record for going on eight hours, and Malofiy shows no signs of fading; in fact, he’s just announced the arrival of his third wind.

      He has a pretty good ‘fuck you’ attitude that comes from an inner confidence. He might have had a little too much early on,” attorney Jim Beasley Jr. says of Malofiy. “If you piss the judge off with your pirate act, the judge can make it difficult for you. Sometimes you could avoid all that by not swinging your pirate sword around.

      Talk turns to the distinctly pro-Zep tenor of the media coverage of the “Stairway” trial. “I was a punch line for jokes,” he says, spitting his gum into a yellow Post-it and banking it into the trash for, like, the 42nd time. Nobody’s laughing now, least of all Page and Plant. Nor, for that matter, is Usher. Back in October, at the conclusion of a dogged seven-year legal battle marked by a bruising string of dismissals and sanctions, Malofiy won a $44 million verdict — one of the largest in Pennsylvania in 2018 — for a Philadelphia songwriter named Daniel Marino who sued his co-writers after being cut out of the songwriting credits and royalties for the song “Bad Girl” from the R&B heartthrob’s 2004 breakout album, Confessions, which sold more than 10 million copies.

      Also, in late September of last year, the U.S. Ninth Circuit Court of Appeals ruled in favor of Malofiy’s appeal of the 2016 “Stairway to Heaven” verdict and ordered a new trial on the grounds that the court “abused its discretion” when the judge refused to allow Malofiy to play a recording of “Taurus” for the jury. (Members were only allowed to hear an acoustic-guitar rendition played from sheet music.) The retrial is expected to begin in the next year, and Page and Plant, along with bassist John Paul Jones, are again anticipated to take the stand. Copyright experts say Led Zeppelin — which has a long history of ripping off the ancient riffs and carnal incantations of wizened Delta bluesmen and only giving credit when caught — should be worried.

      Malofiy, who calls Zep “the greatest cover band in all of history,” will go to trial armed with reams of expert testimony pinpointing the damning similarities between the two songs — not just the nearly identical and atypical chord pattern, but the shared melodic figurations, choice of key and distinctive voicings. He’ll also show the jury that Page and Plant had ample opportunity to hear “Taurus” when Zep opened for Spirit on their first American tour in 1968, two years before they wrote and recorded “Stairway.”

      “Most big companies rely on the concept of wearing you down, forcing you to do so much work it literally drives you broke,” says Glen Kulik, a heavy-hitter L.A.-based copyright lawyer who signed on as Malofiy’s local counsel when the Zep case was moved to federal court in California. “If you have any chance of standing up to them, it’s going to require an incredible amount of persistence, confidence, and quite a bit of skill as well, and Francis has all those things in spades.” And Kulik would know, having successfully argued a landmark copyright infringement case before the Supreme Court in 2014 that paved the way for the Zeppelin suit.

      Ultimately, Malofiy doesn’t have to prove Led Zeppelin stole Spirit’s song; he just has to convince a jury that’s what happened. Assuming the trial goes forward — and that this time, he’s allowed to play recordings of both songs for the jury — there will be blood. Because contrary to his hard-won rep as a bull in the china shop of civil litigation, Malofiy possesses a switchblade-sharp legal mind, an inexhaustible work ethic, and a relentless, rock-ribbed resolve to absorb more punches than his opponents can throw. He’s a ruthlessly effective courtroom tactician with a collection of six-, seven- and eight-figure verdicts, not to mention the scalps of opposing counsel who underestimated his prowess. “I don’t plink pigeons; I hunt lions and tigers and bears,” he says. The big game he’s targeted in the past decade include deep-pocketed transnational corporations like Volvo (an epic seven-year case that ended in an undisclosed settlement) and Hertz (against whom he won a $100,000 verdict).

      In the arena of civil litigation, where the odds are increasingly stacked against plaintiffs, Malofiy claims to have never lost a jury trial, and that appears to be true. “I have lost twice — in the Zeppelin case and a lawsuit against Volvo — but got both decisions reversed on appeals,” he says, unsheathing a fresh stick of Wrigley’s. “Now, the same people that were asking me for years why I’m doing it are asking me how I did it.”

      If Malofiy prevails in the coming “Stairway” retrial, he’ll completely shatter the Tolkien-esque legend of the song’s immaculate conception — that it was birthed nearly in toto during a mystical retreat at a remote Welsh mountain cottage called Bron-yr-aur, to which many a starry-eyed Zep disciple has made a pilgrimage once upon a midnight clear when the forests echo with laughter. It will be like proving that da Vinci didn’t paint the Mona Lisa, that Michelangelo didn’t sculpt David. Barring a last-minute settlement, many legal and copyright experts predict that Malofiy may well emerge victorious, and credit for the most famous rock song in the world will pass from the self-appointed Golden Gods of Led Zeppelin to some obscure, long-forgotten (and not even very good) West Coast psych band, along with tens of millions in royalties, effectively rewriting the sacred history of rock-and-roll. And the man who will have pulled off this fairly miraculous feat of judicial jujitsu is the enfant terrible of Philadelphia jurisprudence.

      Malofiy hates wearing a suit and tie. Outside the courtroom, he dresses like a rock star masquerading as a lawyer: a crushable black trilby perched at a jaunty angle atop a blue bandana, a collarless black and orange leather Harley jacket, and a pair of beat-to-fuck brown Wesco boots, unlaced. “I’m always in jeans and boots when I meet new clients,” he says. “I warn them up front: ‘If you want a fancy lawyer in a suit, you should go elsewhere.’”

      The barrier to entry for new clients at Francis Alexander LLC is steep, because Malofiy doesn’t take on new cases so much as he adopts new causes. A case has to register on a deeply personal level if he’s going to eat, sleep, and fight to the death for it for the next five to seven years.

      “Lawyers have an ethical responsibility to advocate zealously for their clients,” says attorney Max Kennerly, who’s worked with Malofiy on a number of cases. “But frankly, in this business, a lot of lawyers play the odds and just do a ‘good enough’ job on a bunch of cases. Sometimes they win, and sometimes they lose. Francis really throws himself into his cases.”

      After 10 years of struggle, things finally seem to be breaking Malofiy’s way. Fat checks from cases settled long ago are rolling in, alleviating some fairly crippling cash-flow issues, and big cases just keep falling out of the sky — more than his two-lawyer outfit can field. They need to staff up, stat. Malofiy wants to hire some young bucks fresh out of law school — preferably Temple — as force multipliers in his quest to hold the powerful accountable on behalf of the powerless. “Most kids in law school right now will never see the inside of a courtroom,” he says. “Law schools don’t want to teach you how to change the system; they want to load you up with debt so you have to go do grunt work for some corporate law firm that specializes in maintaining the status quo.”

      Malofiy doesn’t have a website. He doesn’t do social media. He doesn’t trawl the watering holes of the rich and powerful. He doesn’t even have a business card. Thanks to the notoriety and name recognition that came with the Zeppelin trial, new clients chase him. He just got off the phone with a Brooklyn puppet maker who wants him to sue the band Fall Out Boy for alleged misuse of two llamas — Frosty and Royal Tea — that it created. Right now, he’s on a conference call with a trio of British songwriters who want Malofiy to sue the Weeknd for allegedly lifting a key section of their song “I Need to Love” for a track called “A Lonely Night” on his 2016 Starboy album, which has sold more than three million copies to date.

      “Why are you guys calling me?” he asks.

      “We’re looking for an honest person fighting for ordinary working people,” says Billy Smith, one of the Brit songwriters in question. Malofiy clearly likes the sound of that. After thinking it over for a few moments, he tells them he’ll take their case and gives them his standard new-client spiel. “I can’t promise we’ll win, but I can promise I won’t turn yellow when things turn bad. I won’t put my tail between my legs and run,” he says. “If there is any bad news, you will hear it from me first.”

      His teeth have been bothering him for days, and near the end of the call, one of his dental caps comes loose. He spits it out, and it skitters across his desk before he traps it under his palm. Most lawyers would be mortified. Malofiy thinks it’s hilarious. “I got teeth like you people,” he says to the Brits. Everybody laughs.

      Many people mistake Malofiy’s unconventionality as a design flaw when it’s actually a feature. “I think that’s an incredibly important part of what makes him so good as an attorney,” says A.J. Fluehr, 33, Malofiy’s right-hand man, co-counsel and, though eight years his boss’s junior, voice of reason. “Because he’s so unorthodox, I believe it causes a lot of other attorneys to underestimate him and think, ‘Oh, he’s not serious; he doesn’t know what he’s doing.’ All of sudden, there’s a massively serious case against them.”

      Even some of the defense lawyers who’ve done battle with Malofiy begrudgingly acknowledge his chops. “I’ve known Francis for four years now. He is difficult to deal with but a fierce advocate for his clients and his cause,” says Rudolph “Skip” DiMassa, a partner at Duane Morris. “Calling him ‘abrasive’ would be putting it mildly. But he wears it like a badge of honor that he is not like all the other lawyers in town.”

      When I read that and similar assessments from other lawyers back to Malofiy, he chalks them up to blowback for the heresy of Robin Hooding a corrupt status quo. “I have a target on my back because I sue big corporations, politicians, big law firms. Hell, I sued DA Seth Williams,” he says one night at the Irish Pub, as he’s nursing a screwdriver he’ll chase with a root beer. “When you start stepping on toes and suing the wrong people and get a few million shifted from those who have it to those who don’t — that’s where the change happens; that’s where you make a difference. And there is a price you have to pay for that.”

      According to family lore, Francis Malofiy’s maternal grandfather was murdered by Nazis in occupied Greece; his great-grandmother had to cut the body down from a tree and carry it home on the back of a mule. Concurrently, his paternal grandfather was murdered by Nazis in Ukraine, while his father and grandmother were frog-marched to camps in Germany. Some things can never be forgotten or forgiven. That’s why Malofiy is always kicking against the pricks. A slight child, he was often bullied at school, and after a brief experiment with turning the other cheek, he started fighting back. Hard. He recalls the day that a bully was picking on a girl half his size; young Francis cold-cocked him and threw him into a closet door. The kid had to be taken out on a stretcher. After that, the bullies moved on to easier prey. “I was always fighting for the little guy, even back then,” he says.

      In the third grade, friends turned him on to Poison’s Look What the Cat Dragged In and Bon Jovi’s Slippery When Wet, indelibly imprinting the spandexed bikers-and-strippers aesthetic of ’80s hair-metal onto his psyche. He started channeling the energy he once put into beating back bullies into beating the drums. One day in the sixth grade, he came home to tell his dad about a band all the kids were into: “The Led Zeppelins.”

      “He said, ‘No, son, it’s just Led Zeppelin.’”

      “No, I’m pretty sure it’s the Led Zeppelins.”

      So his father, who’d seen the band at the Electric Factory, drove Francis to the record store at the Granite Run Mall, where the clerks set him straight. His father bought the four-cassette Zep box set that had just come out. On the way home, Malofiy heard “Whole Lotta Love” for the first time, and before the song even ended, it was official: Led Zeppelin was his favorite band. When he was in high school, his drum teacher gently broke the news that Zep didn’t exactly, um, write all their own music — that key parts of their iconic songs had been cherry-picked from old, obscure blues recordings. “I said, ‘C’mon, don’t talk shit about Jimmy Page!’” Malofiy recalls. Then his teacher played him the Willie Dixon-penned Muddy Waters track “You Need Love” — which is what “Whole Lotta Love” was called before Zep hijacked the lyrics and the riff and Frankensteined them into the gloriously scuzzy heavy-metal Viking porno movie for the ears we’ve come to know and love. It was hard for Francis to process, and even harder when he was tipped to the uncanny similarity between Spirit’s “Taurus” and “Stairway.” Still, the spell Zep cast over him remained unbroken.

      As a young teenager, he built go-karts, dirt bikes and small-block Chevys. To make spending money for guitars and records, he started buying beater cars, fixing them up, and flipping them for quadruple what he paid for them. He almost didn’t graduate from high school because he’d played hooky too many times, to go fishing or work on cars or play guitar. When he finally got his high-school diploma, he raced home from school to show his mother in his Chevy S-10 lowrider. Tearing ass on the backcountry roads of Media, he blew past a cop who immediately lit up his cherry top and gave pursuit. Soon, one cop car became two, then three, until there were five cars tailing him.

      Much to his parents’ dismay, his run-ins with the law became common. They were never for anything all that serious, just the usual teen-rebel monkeyshines: fighting, speeding, the occasional high-speed car chase. He got a big wake-up call in 1998 when his beloved Uncle Nick — a.k.a. Nicholas “The Greek” Vasiliades — was handed a life sentence for running a high-volume meth lab in a warehouse in Manayunk that supplied the drug networks of the Pagans and the Mafia, as well as for his 50-gun arsenal of illegal weaponry. Malofiy was devastated. “I was going down a bad path,” he says. “My uncle pulled me aside and said, ‘You’re smart enough to do it the right way. You need to step away.’”

      Malofiy took the warning to heart and focused on getting a college education, graduating from Penn State in 2000 with a degree in finance. After college, he went back home to Media and his true loves: cars, girls and heavy metal. With a revolving cast of musicians, he formed multiple go-nowhere suburban hard-rock bands with cringe-y names like Prada G and Sluts ’n Slayers. Unimpressed, his parents urged him to enroll in law school. Eventually he relented, forging this pact: He would go to law school if he: a) could do whatever he wanted with the unfinished basement of his parents’ home (i.e., build a high-end recording-studio-cum-man-cave tricked out with a kitchen, bedroom and bathroom); and b) nobody hassled him about having long hair, rocking out and chasing girls. Deal. Malofiy took the LSATs and scored just south of 160 — hardly off the charts, but good enough to get into Temple, where he found himself drawn to copyright law.

      He graduated from law school in December of 2007 and took the bar exam the following July. On the night of August 16, 2008, he stopped into the Liberty Bar at 22nd and Market with his then-girlfriend. It was crowded, but they found a table in the back. After ordering drinks, they started getting static from a group of three young men in ball caps and white t-shirts. “Three drunken jerkoffs, white privilege out the ass,” says Malofiy. According to Malofiy’s testimony, the trio mocked his bandana and called him “cunt,” “pussy” and a “dirty spic.” (It was summer; Malofiy was tan.) According to Malofiy, at some point the men apologized and the situation seemed defused, but then one of them grabbed Malofiy’s girlfriend’s ass. “I said, ‘That’s it. Follow me out,’ and made for the door,” Malofiy says, but he was blocked by a member of the group. As they stood chest-to-chest, Malofiy says, the man struck him twice. Finally, Malofiy, who boxed in college, unloaded with a right cross that landed squarely on the guy’s left cheekbone, shattering the glass still clenched in Malofiy’s fist.

      The man suffered a deep gash in his cheek that would require 150 stitches and reconstructive surgery. Malofiy nearly severed the tendons in his thumb. Bleeding profusely, he had his girlfriend drive him to the emergency room at Penn Presby to get stitched up and then to Central Detectives to file a criminal complaint.

      Two months later, in October, notice came in the mail that he had passed the bar. His mother was ecstatic and insisted on driving him to the Pittsburgh office of the Prothonotary of the Supreme Court of Pennsylvania immediately to obtain his law license rather than wait two weeks for the formal ceremony. When they got home the next day, Malofiy got a call from Central Detectives, who said they had a “body warrant” for his arrest on aggravated assault and related charges stemming from the Liberty Bar fight. The next day, he turned himself in and spent a night in jail awaiting a bail hearing. Had he not gone to Pittsburgh at his mother’s behest, it’s unlikely he’d have gotten his law license with a felony arrest on his record.

      Malofiy’s first case as a newly minted lawyer would involve defending a client staring down decades in prison if convicted: himself. Heeding the maxim that a man who is his own lawyer has a fool for a client, Malofiy hired Sam Stretton, one of the most respected criminal defense attorneys in the city. Malofiy took the stand and delivered an impassioned defense of his actions. “He had already hit me twice, blocked my exit-way,” he testified. “I was scared for my safety and my girlfriend’s safety, and his friends had just yelled ‘Fight!’ and came up to me with fists drawn. I thought I had no other option.” The jury found him not guilty on all charges.

      “Welcome to Hogwarts,” Malofiy jokes as he shows me around the vast oak and stained-glass room that houses the law library at the Beasley Firm, possibly the most fearsome and feared personal-injury law firm in the city, where he worked, in an of-counsel capacity, from 2012 to 2014.

      Fresh out of law school and still wet behind the ears, Malofiy showed up one day in search of mentoring. Granted an audience with Jim Beasley Jr., one of the most successful plaintiff’s attorney in the city, Malofiy ended up with a promise of rent-free office space, the phone extension 666, and a commitment to help finance some of the highly ambitious cases he was mounting — a product-liability suit against Volvo, and a breach-of-contract suit, against a marble manufacturer that had screwed his client out of an ownership share, that resulted in a $4.2 million verdict — not to mention the Usher case. “Jim was like, ‘I keep getting calls from defense lawyers saying That kid’s the fucking devil, so you must be doing something right,’” Malofiy recalls.

      During Malofiy’s tenure at Beasley, he took out a controversial full-page ad in this magazine that depicted him crashing through a courtroom in a hot rod, looking every bit James Dean in Rebel Without a Cause. Many members of Philadelphia’s uptight, buttoned-down legal community thought it was disrespectful. “Everyone was outraged, but I thought it was funny,” says Beasley. “He has a pretty good ‘fuck you’ attitude that comes from an inner confidence. He might have had a little too much of that early on, but I think he’s throttled back a bit. So many of a judge’s decisions are ties and jump-balls that are not reversible, and if you piss the judge off with your pirate act, the judge can make it difficult for you. Sometimes you could avoid all that by not swinging your pirate sword around.”

      Malofiy has learned this the hard way. In 2015, a three-judge panel voted to suspend his license to practice law in U.S. District Court in the Eastern District of Pennsylvania for improper conduct in the Usher case — despite the fact that the special prosecutor recommended what amounted to a slap on the wrist: a reprimand.

      “It’s highly unusual that they would disregard the disciplinary recommendations of the special prosecutor after he has heard the facts,” says Stretton. The matter is currently on appeal before the Third Circuit.

      At Malofiy’s insistence, I’ve been tailing him for the better part of a month: from a big-dollar NDA’d settlement in a judge’s quarters, to a Port Richmond dive bar called Chuckles, to a Bucks County gun shop where he plunked down $1,729 for a handsome Benelli shotgun (a gift for his right-hand man Fluehr), to a back-alley strip bar in Center City and the disused factory under the Commodore Barry Bridge that he’s purchased and plans to renovate into office space, living quarters and a beer garden. I watched him hide his $82,000 Land Rover from the repo man (“It’s all a misunderstanding”) and then, days later, saw a pile of white letter-size envelopes stacked on his desk, each containing what looked to be thousands in cash. What I have come to learn is this: When you write about lawyers, there is so much you can’t write about lawyers.

      Malofiy slowly, methodically and unflinchingly parceled out the most personal details of his backstory — the good, the bad and the ugly — as I incrementally earned his trust. But always on his timetable, not mine. It could be exasperating, but by the end, I discovered the method to his madness: He’d been pacing his revelations as he would a trial presentation. And now we’re reaching the crescendo of his closing argument — the big reveal.

      It’s a few clicks shy of midnight at Malofiy’s house in Media on a Sunday night shortly before Christmas. In the morning, he’s jetting off to an auction in London to bid on the Helios recording console that captured “Stairway to Heaven” for the ages. (Malofiy, true to form, won’t confirm that he won or lost the auction.) Though he’s been locked in a nasty four-year legal fight with Led Zeppelin, they’re still his favorite band.

      Malofiy called to insist that I come to his house tonight. “Why? What for?” I demanded. He said he wanted to show me something I could only see there. I begged off, explaining that this article was due in the morning and I already had more than I could use. But he insisted, promising it would be worth my while. He doesn’t disappoint. He tells me to open the freezer. There’s a bottle of Tito’s vodka, an ice tray, and half a lemon on a plate with a yellow plastic knife. “That’s the lemon Robert Plant squeezed into his tea when we deposed him in London back in 2016,” he claims. This is deeply ironic and, if you’re acquainted with the role lemons play in Plant’s legend, cosmically hilarious. One of Led Zeppelin’s most infamous tracks is “The Lemon Song,” a sultry blooze ramble from 1969’s deathless Led Zeppelin II stitched together from pieces of Howlin’ Wolf’s “Killing Floor” and Robert Johnson’s “Travelling Riverside Blues.” (Zep settled a 1972 copyright suit over the Howlin’ Wolf portion of the song.) In the fifth verse, Plant sings:

      Squeeze me baby, till the juice runs down my leg
      The way you squeeze my lemon, ah
      I’m gonna fall right out of bed

      By swiping that lemon rind at the deposition, Malofiy stole Robert Plant’s metaphoric penis the way Prometheus stole fire from the gods. Zep famously invoked the mythic “Hammer of the Gods” from Norse legend. For Jimmy Page, that hammer was his guitar, but for Plant it was his, um, mighty lemon tree.

      Incredible though it may seem, Malofiy says he’s kept the lemon on ice for the past three years and had it in his briefcase like a talisman when he gave oral arguments for what proved to be his successful appeal of the 2016 “Stairway” verdict. He has every intention of taking it to the retrial that will, barring unforeseen developments, commence in the next year.

      “Robert Plant is always going on about his lemon, and at the deposition he made a big deal out of slicing it up and squeezing it into his tea and then sucking on the rind,” he says with a cat-who-ate-the-canary grin. “Jimmy Page famously dabbled in black magic and was always going on about Aleister Crowley, and I said to myself, ‘If they are going to use black magic to try to beat me on technicalities — well, two can play at that game.’”

    Almost 200 years ago, the first person to be what we would now call a coder was, in fact, a woman: Lady Ada Lovelace. As a young mathematician in England in 1833, she met Charles Babbage, an inventor who was struggling to design what he called the Analytical Engine, which would be made of metal gears and able to execute if/then commands and store information in memory. Enthralled, Lovelace grasped the enormous potential of a device like this. A computer that could modify its own instructions and memory could be far more than a rote calculator, she realized. To prove it, Lovelace wrote what is often regarded as the first computer program in history, an algorithm with which the Analytical Engine would calculate the Bernoulli sequence of numbers. (She wasn’t shy about her accomplishments: “That brain of mine is something more than merely mortal; as time will show”, she once wrote.) But Babbage never managed to build his computer, and Lovelace, who died of cancer at 36, never saw her code executed.

    The Defense Ministry has begun the final phase of construction of a 20-foot high galvanized steel fence that will completely surround the Gaza Strip, Israeli officials said Sunday.

    The barrier will extend 65 kilometers (40 miles) miles around the enclave and sit atop the subterranean concrete wall Israel is constructing around the Gaza Strip to block terrorist groups’ attack tunnels from the coastal enclave.

    Prime Minister Benjamin Netanyahu said the barriers were needed to “prevent the infiltration of terrorists into our territory,” at the start of weekly cabinet meeting.

    The fence will connect to the barrier recently built out into the Mediterranean Sea from north of Gaza, the Defense Ministry said in a statement.

    The overall Gaza barrier project is due to be completed by the end of 2019, according to the army.

    “On Thursday, we began work on the final component of the Gaza Strip border barrier project. The obstacle is unique and specially designed to protect against the threats from the Strip and to give a superior solution to preventing infiltration into Israeli territory,” said the head of the project, Brig. Gen. (res.) Eran Ofir.

    The barrier project is expected to cost approximately NIS 3 billion ($833 million), with each kilometer of the underground portion of the barrier costing approximately NIS 41.5 million ($11.5 million). The above-ground fence is significantly cheaper, at just NIS 1.5 million ($416,000) per kilometer.

    The new fence surrounding the Gaza Strip will be constructed within Israeli territory, a few dozen meters east of the current shorter, more easily penetrable fencing. The old barrier will not be removed.

    According to the Defense Ministry, the new galvanized steel fence will weigh approximately 20,000 tons and comes equipped with a number of sensors and other “modern security components.”

    The barrier is being constructed jointly by the Israel Defense Forces-Defense Ministry Borders and Security Fence Directorate, run by Ofir, who has overseen the construction of barriers along Israel’s borders with Egypt, Jordan, Syria and Lebanon.

    In 2016, Israel began construction of the new barrier around the Strip, focusing first on the underground portion, following the 2014 Gaza war in which Hamas used subterranean attack tunnels to deadly effect against Israeli troops.

    Over the past two years, work has persisted on the underground sensor-studded concrete wall, despite regular riots and clashes along the border and occasional attacks on the construction sites.

    In addition, the Defense Ministry built a barrier extending out from Israel’s coast aimed at preventing maritime infiltration from Gaza, as occurred in the 2014 war when a team of Hamas naval commandos landed on the beach near the community of Kibbutz Zikim before they were killed by Israeli forces. Construction of the undersea wall and breakwater was completed last month.

    The new above-ground fence will begin at the Egyptian-Israeli-Gaza border, near Kerem Shalom, and will continue out to the sea barrier, according to the Defense Ministry.

    “The above-ground barrier… is another important element in the defense of the [Israeli] communities surrounding Gaza, which already includes: the sea barrier, which provides a response to terrorist infiltration from the sea to the west, and the underground barrier that surrounds the Strip and is meant to prevent the digging of terror tunnels into Israel,” the ministry said.

    The military proposed building the barrier following the 2014 Gaza war, known in Israel as Operation Protective Edge. During the fighting, Hamas made extensive use of its tunnel networks to send fighters into Israel as well as to move its terrorist operatives and munitions within the Gaza Strip.

    Hundreds of people, some Israeli and others from abroad, are involved in the project, wearing flak jackets and under guard by IDF soldiers as protection against attack from terror groups in the Strip.

    Concrete factories were built next to the Gaza Strip to speed up construction.

    To build the underground wall, the workers use a hydromill, a powerful piece of drilling equipment that cuts deep, narrow trenches into the earth, which was brought to Israel from Germany.

    In addition to opening up the ground where the barrier will be constructed, the hydromill also exposes any previously undiscovered or newly dug Hamas tunnels that enter Israeli territory. The space left behind by the hydromill — and any Hamas tunnels that get in the way — is then filled with a substance known as bentonite, a type of absorbent clay that expands when it touches water.

    This is meant to prevent the trenches from collapsing, but also has the additional benefit of indicating the presence of a tunnel, as the bentonite would quickly drain into it. Workers then pour regular concrete into the trench. Metal cages with sensors attached are then lowered into the concrete for additional support.

    #Gyumri, the city symbol of the quake that 21 years ago struck Armenia. The stories of the homeless, the #domiks, the migrants, waiting for the opening of the borders with Turkey. Reportage.

    December 7, 1988, 11.41 am – An earthquake measuring 6.9 on the Richter scale hits northern Armenia, killing 25,000 and leaving many more homeless. Mikhail Gorbachev, then General Secretary of the Communist Party of the U.S.S.R. cuts short an official visit to the United States to travel to the small South Caucasus Soviet republic as news of the catastrophe makes headlines the world over. Poverty skyrockets as a nation mourned its dead.

    Hundreds of millions of dollars flooded into the country for relief and reconstruction efforts, but two other events of as much significance soon frustrated efforts to rebuild the disaster zone. In 1991, Armenia declared independence from the former Soviet Union, and in 1993, in support of Azerbaijan during a de facto war with Armenia over the disputed territory of Nagorno Karabakh, Turkey closed the land border with its eastern neighbor.

    Meanwhile, as corruption skyrocketed, the conflict as well as two closed borders and an economic blockade by Azerbaijan and Turkey only added to Armenia’s woes. Yet, despite strong economic growth in the mid-2000s, albeit from a low base, and promises from then President Robert Kocharyan to completely rebuild Gyumri, Armenia’s second largest city and the main urban center to be hit by the earthquake, the outlook appears as bleak as ever.

    Once Gyumri had been known for its architecture, humor and cultural importance, but now it has become synonymous with the earthquake and domiks – “temporary” accommodation usually amounting to little more than metal containers or dilapidated shacks. Hot in the summer and bitterly cold in the winter, others more fortunate found refuge in abandoned buildings vacated during the economic collapse following independence.

    Vartik Ghukasyan, for example, is 71 and alone. An orphan, she never married and now struggles to survive on a pension of just 25,000 AMD (about $65) a month in a rundown former factory hostel in Gyumri. However, that might all change as more buildings are privatized or their existing owners seek to reclaim them.

    According to the 2001 census, the population of Gyumri stands at 150,000 although some claim that it has since grown to 160-170,000. Nevertheless, few local residents take such figures seriously. Pointing to low school attendance figures, they estimate the actual population might be no more than 70,000. Even so, despite the exodus, there are as many as 4-7,000 families still living in temporary shelter according to various estimates.

    Anush Babajanyan, a 26-year-old photojournalist from the Armenian capital, is one of just a few media professionals who remain concerned by their plight. Having spent the past year documenting the lives of those still waiting for proper housing, the anniversary might have been otherwise low-profile outside of Gyumri, but Babajanyan attempted to focus attention on the occasion by exhibiting her work in Yerevan.

    “When I started this project, 20 years had passed since the earthquake and there were families still living in domiks who were not receiving enough attention,” she told Osservatorio. “ The government and other organizations promised to solve the issue of their housing, but their actions were not enough. Since then I have seen very little improvement.”

    “If this issue wasn’t solved in 20 years, it probably isn’t surprising that not much has changed in just a year. However, it has been two years since Serge Sargsyan, then Armenian prime minister and now president, said that the issue of these residents will be solved by now. But, although some districts are being reconstructed, this is not enough to resolve the issue.”

    As the center of Shirak, an impoverished region that most in Armenia and its large Diaspora appear to have largely forgotten, Gyumri suffers from unemployment higher than the national average. Travel agents continue to advertise flights from the local airport to parts of Russia. As elsewhere in the region, the only hope for a better life lies outside. But, with a global economic crisis hitting the CIS hard, there are now also fewer opportunities even there.

    This year GDP per capita has already plummeted by over 14 percent nationwide, far in excess of the decline registered in Azerbaijan and Georgia, while poverty and extreme poverty - already calculated with a low yardstick - has reportedly increased from 25.6 and 3.6 percent respectively in 2008 to 28.4 and 6.9 percent today. Local civil society activists claim that the figures might be twice as high in Gyumri.

    But, some believe, the city could benefit greatly from an open border with Turkey , transforming itself into a major economic and transit hub for direct trade between the two countries. Just 8 km away lies the village of Akhurik, one of two closed border crossings. Repair work had been conducted on the railway connecting Gyumri to the Turkish city of Kars prior to last year’s World Cup qualifying match with Turkey held in Yerevan.

    With Turkish President Abdullah Gül making a historic visit to Armenia for the match, villagers were once again given hope that a border opening would be imminent. “It will be very good if it opens,” one resident told RFE/RL at the time. “We used to work in the past — 40 families benefited from work related to the railway. Now they sit idle without work or have to choose migrant work in Russia. It will be good when the line is opened.”

    But, with pressure from Azerbaijan on Turkey not to sign two protocols aimed at establishing diplomatic relations and opening the border until the Karabakh conflict is resolved, such a breakthrough appears as elusive as ever while unemployment and poverty increases. Nowhere is that more evident than the city of Ashotsk, just 30 minutes outside of Gyumri. Karine Mkrtchyan, public relations officer for the Caritas Armenia NGO says conditions are typical.

    “Everywhere you will see abandoned places, especially public spaces,” she says. “They are ruined. There are no facilities, there is a lack of drinking water, and irrigation. People are on their own to solve their problems. We had a loss of life during the earthquake and then massive migration which stopped in the late 1990s before starting again in early 2000. Now there are even more people who decide to migrate.”

    Last week, on the 21st anniversary of the earthquake, the government attempted to counter criticism of what many consider to be inaction and a lack of concern with the socioeconomic situation in Gyumri. Opening a sugar refinery owned by one of the country’s most notorious oligarchs at the same time, the Armenian president visited Gyumri and promised that 5,300 new homes would allocated to those still without by 2013.

    The $70 million construction project has been made possible through a $500 million anti-crisis loan from the Russian Federation.

    However, whether such promises come to fruition remains to be seen and government critics remain unimpressed. Indeed, they point out, even if the apartments are built and allocated on time, it would have taken a quarter of a century to do so. Moreover, for Gyumri natives such as Mkrtchyan, the need for economic investment and development in the regions of Armenia remains as urgent as ever.

    What is Crisis?

    The next time our protagonist factory goes to market, it brings twice as many steam irons, because it reckons to itself: “The other factory is bankrupt: fantastic! Now, all the people who used to buy their irons there will come to me instead. I’ll have twice as many customers, so I’ll need twice as many irons.” But what should our factory discover on arrival at the “irons-and-MORE!” marketplace? That almost nobody wants to buy irons anymore—at all. Because what happened on our street, between our factory and the other factory, also happened everywhere. In the world there are countless factories: not just those that produce irons, but also those that produce pistols. And now that many people can only go to the movies once a week, or even not at all, they don’t feel like buying irons. Instead, they buy TVs and DVD-players so they can watch movies at home. It’s not the same, but the people tell themselves “better than nothing, eh.”

    Still, some of them aren’t simply unable to go to the movies anymore—they don’t have enough to eat. And so they buy tomatoes and eggs to throw at the factory walls, because that seems like a priority. The factory, though, has no use for tomatoes, since it’s an iron factory and not so much in the business of manufacturing tomato sauce. It’s stuck with making and selling irons. As we know, it has brought twice as many irons to market as usual. Today, however, it can’t sell twice as many irons, and can only get itself into twice as much debt. Sure enough, our factory goes bankrupt as well. And it fires all the iron-making people.

    Now there’s nothing left. No factories, no machines, no sheet-metal or nails, and no iron-making people at all. But there are vast piles of irons that nobody needs. Although no terrible disaster has occurred—no earthquake, no war, no visit from the pope—all of a sudden, everyone is sitting around, bored stiff and hungry to boot. Some try to turn the irons into marmalade, but this proves mostly fruitless. “We’re in a real mess now,” the people say. “If only we hadn’t listened to that factory!” And one person adds: “You know what? It’s all these things! We make them in the first place in order for them to serve us, but then, they start getting uppity and we have to serve them. Now we’re stuck hanging out with all these damn irons!” And another one, someone really angry, adds: “I knew it! I knew it! It’s these stupid objects, it’s this god-damned ob- … ob-… objectification! I knew it!”

    So everybody sits down around the irons to have a good long think about capitalism. They conclude that the mess really is all capitalism’s fault. “Well! That certainly didn’t work out well,” they reflect. “Not only did capitalism make us all unhappy, it was, in fact, constantly going wrong.” “And another thing,” someone comments loudly, “we’ve had capitalism far too long a time—about 200-500 years—surely we’ve had enough now. It’s time for some relief. What we want is something new.” “Yes! Something new, but what?” asks somebody else. At this point there is a long silence, as the people turn it over in their minds. Each one of them would love to know the answer to this question.

    Suddenly, it comes to them. “COMMUNISM!” they exclaim. “Obviously! Since communism is the society that does away with all the evils people suffer under capitalism. Let’s go for communism!” “Oh gosh,” the people groan, “of course!” And they all slap their foreheads, as it seems so obvious now that somebody has said it. “Why didn’t we think of that?”

    The people are sure of two things. First, they know that capitalism doesn’t make them happy, and second, they know that communism does. So they decide to try communism. Alas, it’s not so simple. Since true communism has never existed in the entire history of humankind, no one has any clue what communism looks like. What the people do have is various ideas of what the communist society should look like. If communism is the society that does away with all the evils people suffer under capitalism, then the best idea of communism ought to be the one that does away with the greatest number of evils. In order to figure out the best idea of communism, the people discuss which of their ideas could do away with all the evils of capitalism—not just one-third or half of them. If we don’t try them out, after all, well then, they definitely won’t work. “We’d better all try out these ideas one by one,” the people resolve. “Then, we’ll see.” And so things proceed.
