En bref : quand il s’agit d’une citation on a le droit de publier du contenu appartenant à des tiers. Pour les images il faut faire la différence entre l’illustration où l’image sert comme information supplémentaire sur un sujet et la citation où le texte entourant l’image parle précisément de cette image.
En principe il faut que la part de contenu externe dans un billet soit assez petite pour justifier sa qualité de citation.
Ces réflexions m’agacent car je les ressens comme une partie du phénomène qu’on appelle Die Schere im Kopf , une forme d’autocensure.

Seit langem ist aber auch das große Kleinzitat, das vom Gesetzeswortlaut bis 31. Dezember 2007 nicht gedeckt war (Nr. 2: zulässig ist es, Stellen eines Werkes nach der Veröffentlichung in einem selbständigen Sprachwerk anzuführen), in der Rechtsprechung anerkannt.
Voraussetzung ist, dass das Bild nicht verändert wird und eine korrekte Quellenangabe erfolgt. Das Landgericht Berlin erließ eine einstweilige Verfügung (Beschluss, Photonews 4/2000, 12), die ein Schwarzweiß-Foto aus dem Buch Odessa betraf, das vom Tagesspiegel leicht beschnitten und blau eingefärbt worden war. Die Veröffentlichung wurde der Zeitung untersagt: Ein Zitat erfordere einen Zitatzweck und eine Auseinandersetzung mit dem Bild im Text, wobei das Bild nur unverändert und mit zutreffender Quellen- bzw. Urheberangabe veröffentlicht werden darf.
