    Derrière son image familiale et écolo, le géant du meuble suédois, plus gros consommateur de bois au monde, révèle des pratiques bien peu scrupuleuses. Une investigation édifiante sur cette firme à l’appétit démesuré.

    C’est une des enseignes préférées des consommateurs, qui équipe depuis des générations cuisines, salons et chambres d’enfants du monde entier. Depuis sa création en 1943 par le visionnaire mais controversé Ingvar Kamprad, et au fil des innovations – meubles en kit, vente par correspondance, magasins en self-service… –, la petite entreprise a connu une croissance fulgurante, et a accompagné l’entrée de la Suède dans l’ère de la consommation de masse. Aujourd’hui, ce fleuron commercial, qui participe pleinement au rayonnement du pays à l’international, est devenu un mastodonte en expansion continue. Les chiffres donnent le tournis : 422 magasins dans cinquante pays ; près d’un milliard de clients ; 2 000 nouveaux articles au catalogue par an… et un exemplaire de son produit phare, la bibliothèque Billy, vendu toutes les cinq secondes. Mais le modèle Ikea a un coût. Pour poursuivre son développement exponentiel et vendre toujours plus de meubles à bas prix, le géant suédois dévore chaque année 20 millions de mètres cubes de bois, soit 1 % des réserves mondiales de ce matériau… Et si la firme vante un approvisionnement responsable et une gestion durable des forêts, la réalité derrière le discours se révèle autrement plus trouble.

    Greenwashing
    Pendant plus d’un an, les journalistes d’investigation Xavier Deleu (Épidémies, l’empreinte de l’homme) et Marianne Kerfriden ont remonté la chaîne de production d’Ikea aux quatre coins du globe. Des dernières forêts boréales suédoises aux plantations brésiliennes en passant par la campagne néo-zélandaise et les grands espaces de Pologne ou de Roumanie, le documentaire dévoile les liens entre la multinationale de l’ameublement et l’exploitation intensive et incontrôlée du bois. Il révèle comment la marque au logo jaune et bleu, souvent via des fournisseurs ou sous-traitants peu scrupuleux, contribue à la destruction de la biodiversité à travers la planète et alimente le trafic de bois. Comme en Roumanie, où Ikea possède 50 000 hectares de forêts, et où des activistes se mobilisent au péril de leur vie contre une mafia du bois endémique. Derrière la réussite de l’une des firmes les plus populaires au monde, cette enquête inédite éclaire l’incroyable expansion d’un prédateur discret devenu un champion du greenwashing.

      This site has been developed by a group of people, FSC supporters and members among them, who are very concerned about the constant and serious erosion of the FSC’s reliability and thus credibility. The group includes Simon Counsell, one of the Founder Members of the FSC; Hermann Edelmann, working for a long term FSC member organisation; and Chris Lang, who has looked critically at several FSC certifications in Thailand, Laos, Brazil, USA, New Zealand, South Africa and Uganda – finding serious problems in each case.

      As with many other activists working on forests worldwide, we share the frustration that whilst the structural problems within the FSC system have been known for many years, the formal mechanisms of governance and control, including the elected Board, the General Assembly, and the Complaints Procedures have been highly ineffective in addressing these problems. The possibility of reforming – and thus ‘saving’ – the FSC through these mechanisms is, we feel, declining, as power within the FSC is increasingly captured by vested commercial interest.

      We feel that unless drastic action is taken, the FSC is doomed to failure. Part of the problem, in our analysis, is that too few FSC members are aware of the many profound problems within the organisation. The FSC Secretariat continues to pour out ‘good news stories’ about its ‘successes’, without acknowledging, for example, the numerous complaints against certificates and certifiers, the cancellation of certificates that should never have been awarded in the first place, the calls for FSC to cease certifying where there is no local agreement to do so, the walk-outs of FSC members from national processes because of their disillusionment with the role of the economic chamber, etc. etc. etc.

      There has been no honest evaluation of what is working and what is not what working in the FSC, and no open forum for discussing these issues. This website is an attempt to redress this imbalance. The site will also help people who are normally excluded from the FSC’s processes to express their views and concerns about the FSC’s activities.

      FSC vs PEFC: Holy cows vs the Emperor’s new clothes

      One of the reasons I am involved in this website is that I believe that many people are aware of serious problems with FSC, but don’t discuss them publicly because the alternative to FSC is even worse. The alternative, in this case is PEFC (Programme for the Endorsement of Forest Certification schemes) and all the other certification schemes (Cerflor, Certflor, the Australian Forestry Standard, the Malaysian Timber Certification Council and so on). One person has suggested that we should set up PEFC-Watch, in order “to be even-handed”.

      The trouble with this argument is that PEFC et al have no credibility. No NGOs, people’s organisations or indigenous peoples’ organisations were involved in setting them up. Why bother spending our time monitoring something that amounts to little more than a rubber stamp? I can just see the headlines: “Rubber stamp PEFC scheme rubber stamps another controversial logging operation!” Shock, horror. The Emperor is stark bollock naked, and it’s not just some little boy pointing this out – it’s plain for all to see, isn’t it?

      One way of countering all these other schemes would be to point out that FSC is better. But, if there are serious problems with FSC – which there are, and if we can see them, so can anyone else who cares to look – then the argument starts to look very shaky.

      FSC standards aren’t bad (apart from Principle 10, which really isn’t much use to anyone except the pulp and paper industry). They say lots of things we’d probably want forest management standards to say. The trouble is that the standards are not being applied in practice. Sure, campaign against PEFC, but if FSC becomes a Holy Cow which is immune to criticism (not least because all the criticism takes place behind closed doors), then we can hardly present it as an alternative, can we?…”

      By the way, anyone who thinks that PEFC and FSC are in opposition should read this interview with Heiko Liedeker (FSC’s Executive Director) and Ben Gunneberg (PEFC’s General Secretary). In particular this bit (I thought at first it must be a mix up between FSC and PEFC, or Liedeker and Gunneberg):

      Question: As a follow-up question, Heiko Liedeker, from your perspective, is there room ultimately for programs like the Australian Forestry Standard, Certfor and others to operate under the FSC umbrella?

      Heiko Liedeker: Absolutely. FSC was a scheme that was set-up to provide mutual recognition between national standard-setting initiatives. Every national initiative sets its standard. Some of them are called FSC working groups, some of them are called something else. In the UK they are called UKWAS. We’ve been in dialogue with Edwardo Morales at Certfor Chile. They are some of the FSC requirements listed for endorsement, we certainly entered into discussion. We’ve been in discussion with the Australian Forestry Standard and other standard-setting initiatives. What FSC does not do is, it has one global scheme for recognizing certification. So we do not, and that’s one of the many differences between FSC and PEFC, we do not require the development of a certification program as such. A standard-setting program is sufficient to participate in the network.

  • Un rapporto sulla frontiera tra Lettonia, Russia e Bielorussia

    Il monitoraggio della ONG “I want to help refugees”

    A ottobre 2023 la ONG lettone Gribu palīdzēt bēgļiem (Voglio aiutare i rifugiati) 2, ha pubblicato un report sulla monitoraggio delle frontiere curato da Anna E. Griķe e Ieva Raubiško 3.

    Questa pubblicazione segue il report sulla visita effettuata in Lettonia dal 10 al 20 maggio del 2022 dal Comitato europeo per la prevenzione della tortura e delle pene o trattamenti inumani o degradanti (CPT), un dossier a cui il governo lettone ha replicato in modo ambiguo e fuorviante. L’ONG lettone ha così deciso di redigere un proprio report che contesta le affermazione governative.

    Il Rapporto del Comitato europeo, infatti, forniva 21 raccomandazioni in merito alla situazione di detenzione nei confronti delle persone migranti, mentre la risposta del governo lettone considerava 18 di queste come risolte e/o ingiustificate, per cui non dovrebbero essere prese ulteriori misure, e 3 raccomandazioni presentate insieme a una potenziale azione.

    Tra le raccomandazioni, il CPT ha indicato alle autorità lettoni di garantire che le persone migranti che arrivano nella zona di frontiera o che sono presenti nel Paese non siano rimpatriate con la forza in Bielorussia. E’, invece, doveroso effettuare uno screening individuale al fine di identificare le persone bisognose di protezione, valutare tali necessità e prendere le misure appropriate. Inoltre, è essenziale che i cittadini stranieri abbiano accesso a una procedura di asilo, o altra procedura di soggiorno, che preveda una valutazione del rischio di maltrattamento in caso di espulsione della persona interessata verso il Paese di origine o un Paese terzo, sulla base di un’analisi obiettiva e indipendente della situazione dei diritti umani in quegli Stati.

    Per le autorità lettoni, attualmente, la situazione nei territori amministrativi al confine tra Lettonia e Bielorussia è considerata come un’emergenza e «non consente il flusso incontrollato di persone che attraversano il confine di Stato in luoghi non previsti», e allo stesso tempo non limita il diritto delle persone ad accedere alla procedura di asilo, poiché «il diritto di presentare una domanda al valico di frontiera previsto dalla legge sull’asilo non è limitato».

    Tuttavia, le testimonianze delle persone respinte con la forza dal confine lettone verso la Bielorussia indicano che al confine non viene effettuato un esame adeguato (ad esempio, non vengono verificati i documenti d’identità: nazionalità, età e altri dati identificativi sono sconosciuti), in violazione del divieto di espulsione collettiva dei rifugiati sancito dalla Convenzione di Ginevra, dalla Convenzione europea dei diritti dell’uomo e dalla CEDU (principio di non-refoulement). Ci sono stati casi in cui non solo le famiglie con bambini, ma anche i minori non accompagnati sono stati respinti. Inoltre, perfino il principio dell’unità familiare non sempre è rispettato.

    Altre testimonianze di persone che sono riuscite ad entrare in Lettonia e hanno presentato domanda di asilo per motivi umanitari, mostrano che né le autorità bielorusse né quelle lettoni permettono ai migranti di spostarsi verso i valichi di frontiera ufficiali, respingendo invece in Lettonia o in Bielorussia, nonostante la legislazione vigente preveda che le persone possano presentare domanda di asilo ai valichi di frontiera ufficiali (ce ne sono due a Pāternieki e Silene) e al Centro di detenzione per stranieri di Daugavpils.

    Per dissuadere le persone dall’attraversare la frontiera, le guardie ricorrono all’uso della forza fisica e mezzi speciali, nonché all’uso di cani da guardia. Il 29 agosto 2023, il governo ha ratificato gli emendamenti al “Regolamento sui tipi di mezzi speciali e sulla procedura per il loro utilizzo“, prevedendo oltre ai mezzi speciali già in uso – tra cui manganelli, taser, spray di gas cs, candelotti e granate fumogene, granate a gas, luminose e sonore – anche dispositivi sonori con effetti stordenti.

    L’uso eccessivo della forza da parte delle forze dell’ordine è illegale e per questo il CPT ha raccomandato che le forze dell’ordine vengano informate a riguardo e ricevano una formazione pratica sull’uso proporzionato della forza per l’arresto di cittadini stranieri alla frontiera.

    Le autorità lettoni ribattono di non aver fatto ricorso alla forza fisica e a mezzi speciali contro le persone migranti in quanto non si sono verificati casi in cui queste non hanno obbedito agli ordini considerati legittimi delle guardie di frontiera: le persone, infatti, vengono informate che l’attraversamento del confine di Stato è illegale e che è prevista una responsabilità penale per il suo attraversamento e vengono invitate a non attraversare il confine di Stato o, di conseguenza, a tornare in Bielorussia. Nonostante sia consentito l’uso dei taser ai funzionari, attualmente non sono utilizzati per la sorveglianza delle frontiere a causa della loro carenza numerica, del loro breve periodo di autonomia e della necessità di utilizzarli per le esigenze di altri servizi dell’SBG 4.

    Tuttavia, la risposta del governo è in contraddizione con diverse testimonianze di persone migranti raccolte da “Voglio aiutare i rifugiati” nel 2022-2023, che hanno subito violenze emotive e fisiche, tra cui insulti e minacce, percosse e folgorazioni, sia durante i respingimenti che durante la permanenza nelle tende/basi dell’SBG in territorio lettone.

    Secondo queste testimonianze, gli abusi sono stati commessi il più delle volte da membri di unità speciali non identificate che indossavano maschere. Nel report si legge che «almeno quattro denunce sull’uso eccessivo della violenza sono state presentate all’Ufficio per la sicurezza interna e uno dei denuncianti si è rivolto alla Corte europea dei diritti umani».

    Per quanto riguarda l’accoglienza dei minori non accompagnati, il Comitato vorrebbe fosse adibita una struttura specifica, mentre il governo lettone afferma che sarebbe impossibile in quanto il numero dei minori è esiguo. Per l’associazione questa risposta è fuorviante: nonostante il basso numero solo alcuni minori non accompagnati vengono accolti in modo adeguato. Nel maggio 2023 Anna E. Griķe ha incontrato una ragazza di 13 anni dell’isola di Comore ospitata nel “centro di accoglienza” per richiedenti asilo “Mucenieki“, che offriva le stesse condizioni di alloggio degli adulti e che quindi non può essere considerato un istituto di assistenza all’infanzia. Tra il 4 e il 7 luglio la minore è scomparsa.

    Oltre a strutture specifiche adeguate per l’età dei richiedenti asilo, il CPT vorrebbe assicurare ai richiedenti asilo trattenuti nei centri di Daugavpils e Mucenieki attività come lezioni di lingua, di computer, percorsi formativi ecc. Il massimo sforzo dovrebbe essere dedicato soprattutto per garantire ai bambini in età scolastica attività educative adeguate.

    Il governo lettone ha risposto che all’SBG non compete la pianificazione delle attività del tempo libero, tuttavia collabora con le ONG lettoni, come l’associazione “Voglio aiutare i rifugiati” e la Croce Rossa che, per quanto possibile, assicurano l’organizzazione di varie attività ricreative, di socializzazione e integrazione, misure di sostegno psicologico e di istruzione.

    Nonostante ciò, il report afferma che da quanto osservato nel 2023 l’unica attività garantita dalla CR è stata fornire indumenti scadenti a entrambi i centri di detenzione e che solo nell’estate del 2023 l’associazione ha organizzato attività settimanali in entrambi i centri di detenzione per bambini e famiglie e a volte per adulti: un’iniziativa basata sulla buona volontà, non una soluzione sistemica.

    In ultima istanza, il report si occupa delle problematiche relative alle cure psichiatriche e all’assistenza psicologica nei centri di detenzione. Il CPT insiste che siano presi provvedimenti a riguardo insieme a un necessario servizio di interpretariato professionale. Le autorità lettoni dichiarano che in base alla proposta avanzata dall’Ong “Medici senza frontiere“, nel periodo compreso tra luglio e il 31 dicembre 2022, i loro rappresentanti hanno visitato regolarmente l’IDC (centro di detenzione per immigrati) di Daugavpils e di Mucenieki, fornendo assistenza psicologica agli stranieri detenuti e ai richiedenti asilo ospitati nell’IDC dell’SBG.

    Da quando Medici Senza Frontiere ha cessato la sua attività in Lettonia, nel dicembre 2022 5, non è più disponibile alcun supporto psicologico per le persone detenute. Inoltre nel 2013, l’SBG e la Croce Rossa Lettone hanno firmato un accordo di cooperazione, in base al quale quest’ultima si è impegnata a fornire per le persone accolte misure di sostegno psicologico ed educativo. Secondo “Voglio aiutare i rifugiati” la Croce Rossa non ha offerto assistenza psicologica presso gli IDC anche a causa della difficoltà di organizzare gli interpreti. Sebbene le ONG possano offrire un valido supporto psicologico ai richiedenti asilo e agli stranieri detenuti nei centri di detenzione, i loro servizi non possono essere considerati una sostituzione del supporto psicologico che lo Stato dovrebbe fornire.

    “Voglio aiutare i rifugiati” ha ripreso lo slogan “Nessuno è illegale” (Neviena persona nav nelegāla!) per cercare di sensibilizzare sulla situazione al confine: «Il termine “migrante irregolare” non solo è indesiderabile (ad esempio, si veda il Glossario sulle migrazioni dell’Organizzazione internazionale per le migrazioni), ma denigra anche i diritti umani di qualsiasi migrante e non è in linea con i principi delle buone pratiche».

    La maggior parte delle persone giunte in Lettonia dalla Bielorussia sono richiedenti asilo: fino a quando non verrà presa una decisione sul loro status, da un punto di vista giuridico dovrebbero essere chiamati richiedenti asilo, nonostante abbiano attraversato il confine “illegalmente“. Da un punto di vista legale ed etico, un processo o un atto può essere etichettato come irregolare, ma non lo può essere una persona.
    Nessuna persona, infatti, è illegale!

    • BORDER MONITORING REPORT, LATVIA

      Background

      On 11 July 2023 both the “Report to the Latvian Government on the periodic visit to Latvia carried out by the European Committee for the Prevention of Torture and Inhuman or Degrading Treatment or Punishment (CPT) from 10 to 20 May 2022” (here and after – Report) and the “Response of the Latvian Government to the report of the European Committee for the Prevention of Torture and Inhuman or Degrading Treatment or Punishment (CPT) on its periodic visit to Latvia from 10 to 20 May 2022” (here and after – Response) were published. The Report provides 21 recommendations in terms of Immigration detention; Response considers 18 recommendations as in progress and/or unjustified where no additional steps should be taken, and 3
      recommendations are presented along with a potential action plan.
      Ieva Raubiško has closely followed the situation of irregular migrants at the Latvian-Belarussian border since August 2021. In October 2022, she joined the NGO “I Want to Help Refugees” as an advocacy officer. In February 2023 Anna E. Griķe began to fulfil her duties as both border monitoring expert and coordinator of
      humanitarian aid for asylum seekers. Based on prior reports, observations, and individual cases, the following border monitoring report aims to highlight misleading information within the Response. It does not cover all recommendations/responses because of the insufficient data available regarding issues such as access to
      legal aid or to health care, but it is more focused on the everyday life in detention, especially, in regard to minors. The reference to both documents includes paragraphs and page numbers.

      Key Findings

      [1] Accommodation of unaccompanied minors

      Report, par. 30, p. 17: “The Committee recommends that the Latvian authorities take the necessary measures to ensure that unaccompanied minors are accommodated in an open (or semi-open) specialised establishment for juveniles (for example, a social welfare/educational institution) where they can be provided with appropriate care and activities suitable for their age; the relevant legal provisions should be amended accordingly.”

      Response, p. 12: “There is no open (or semi-open) specialised establishment in Latvia intended specifically for a minor foreigner to be extradited or unaccompanied asylum seeker and it is not planned to create such an establishment, because the number of unaccompanied minors is small and it would not be feasible to open such an establishment. An unaccompanied minor, who is not detained, is accommodated in a child care institution based on the decision of the Orphan’s and Custody Court.”

      Indeed, the number of asylum seekers – unaccompanied minors is low, and there is no specialised establishment for their accommodation. However, the Response is misleading since only some unaccompanied minors are properly taken care of. In May 2023, Anna E. Griķe came across two of them, a 13-years old girl from Comoros island and a 14-years old boy from DRC. They both were accommodated in the Accommodation centre for asylum seekers “Mucenieki” provided the same accommodation conditions as adults (free of charge accommodation and allowance of 3 euros per day). It could be considered a childcare institution in any way, as it requires individuals to have complete autonomy in taking care of themselves on a daily basis. After the girl’s disappearance of between July 4 and 7 and ‘with serious concerns about the lack of action, relevant institutions as Ombudsman or State Police were informed about the situation.

      [2] Access to education and/or leisure activities for minors in IDCs [immigration detention center]

      Response, p. 12: “Minors accompanied by their parents are accommodated in the IDC, based on the parents’ application for accommodating children together with parents, and after evaluating the best interests of a child. Thus, children are not detained, but accommodated together with their parents, who are detained. In turn, detained unaccompanied minors are accommodated in the premises of the IDC premises, in which there is personnel and equipment to take the needs of their age into account. Minors accommodated in the premises of the IDC are provided with opportunities for acquiring education, engaging in leisure time activities, including games and recreational events corresponding to their age.” Even though there is a theoretical possibility for children from IDC to access education, it does not take place due to multiple factors. For instance, it takes one month to get the response from the Ministry of Education to be assigned to an educational institution, and as the detainees do not know the length of their detention and live in hope that it will not be lasting long, there is low interest to submit an application. Apart from a room with a limited number of toys, there are no specific opportunities considered for children/youth who experience the same limited access of movement within the detention centre as adults. For instance, outdoor space is not openly available. In the premises of the IDC, there is no opportunity for acquiring education; also, online learning is not possible due to the limited access to electronic devices which is restricted to just one hour per day. None of IDC’s personnel has the task to meet the education and or/leisure activity needs.

      [3] About access to purposeful activities for detainees

      Report, par. 35, p. 19: “The CPT recommends that the Latvian authorities take steps to ensure that foreign nationals held at Daugavpils and Mucenieki Immigration Detention Centres are offered a range of purposeful activities (for example, language classes, computer courses, crafts, etc.). The longer the period for which foreign nationals are detained, the more developed should be the activities which are offered to them. Further, every effort should be made to provide children of school age with suitable educational activities.”

      Response, p. 14-15: “The SBG ensures the security guarding of persons accommodated in the IDC, but does not get involved in planning their free time activities. Nevertheless, the SBG actively cooperates with Latvian NGOs, such as the association “I want to help refugees”, which, as far as possible, ensures the organisation of various leisure activities in the IDC of the SBG for both children and adults. […] In 2013, the SBG and the association “Latvian Red Cross” (hereinafter – LRC) signed an agreement on cooperation, based on which the LRC, among other things, undertook to organise, as far as possible, for persons accommodated in the IDC, psychological support and educational measures or other measures that would improve living conditions, as well as to provide the services of social work experts and other measures promoting socialisation and integration, including, if necessary, to organise Latvian language classes. Recommendations regarding the provision of purposeful activities (including the Latvian language classes) for foreigners in accommodation centres for asylum seekers, as well as regarding measures to reduce the language barrier between health care personnel and admitted foreign nationals, by providing translation/interpreting services, are to be supported.”

      In summer 2023, “I Want to Help Refugees” organized weekly activities in both detention centres for children and families, and – when possible, for adults, both men and women. It was based on good will, and in no terms could be perceived as a systemic solution. However, these activities created an opportunity to get a better insight of the everyday life in detention and was an attempt to meet individual or collective needs. These included provision of underwear, socks, basic footwear, additional clothing, spices for food, books, toys, and games.
      Prior to summer 2023 no regular activities were provided by any institution, NGOs or Latvian Red Cross (besides two unsuccessful episodes in December 2022 and April 2023 when a team of LRC did not manage establish contact with detainees to provide leisure time activities). From what has been observed during 2023, the sole outcome of the cooperation agreement with LRC is the provision of donated clothes to both IDCs. These are of very poor quality and do not include such basic items as underwear or socks. No psychological support, educational measures or other initiatives that would improve living conditions are being implemented in any of IDCs. Services of social work experts and other measures promoting socialization and integration, including Latvian language classes, are not provided either.

      [4] About access to outdoor exercise at the IDCs

      Report. par. 36, p. 20: “The CPT recommends that the Latvian authorities take steps to increase significantly the daily outdoor exercise period for foreign nationals held at Daugavpils Immigration Detention Centre. In the Committee’s view, detained foreign nationals should, as a rule, have ready access to an outdoor area throughout the day.

      Response, p. 15: “According to Clause 21 of Cabinet of Ministers Regulation No. 254 of 16 May 2017, the daily schedule of the accommodation premises shall include daily walk time in fresh air (outdoor exercise) – for at least two hours. In turn, Clause 18 of Cabinet of Ministers Regulation No. 254 of 16 May 2017 provides that if a detained person refuses to exercise any rights (for example, outdoor exercise), an official of the accommodation premises may request to confirm it with a written submission. Given the structure of Daugavpils IDC and Mucenieki IDC, it is not possible to ensure free access of the detained persons to the outdoor area throughout the day.” “I Want to Help Refugees” has received complaints from a number detainees at both Daugavpils and Mucenieki Detention Centres about their restricted access to outdoor areas. While no clear-cut reasons for such restriction have been provided, these complaints also indicate a lack of clear procedure as to how the access to open-air areas should be requested by the detainees and why and how the time limit outdoor activities is determined (for example, why only one hour is granted for outdoor activities, not the two-hour minimum as prescribed in the Cabinet of Ministers Regulation No. 254, Internal Rules of Procedure of Accommodation Premises for Detained Foreigners and Asylum Seekers.) As a result, inhabitants of IDCs lose the possibility to be in fresh air for sufficient time each day or, on some days, are not able to spend time outdoors at all.

      [5] About the alleged ill-treatment of detained foreign nationals (irregular migrants) by Latvian special police forces between August 2021 and March 2022 in the border area.

      Report, par. 33, p. 18: “The CPT recommends that all law enforcement agencies concerned are given a clear and firm message on a regular basis that any use of excessive force is illegal and will be punished accordingly. Further, they should be provided with further practical training relating to the proportionate use of force, including control and restraint techniques, in the context of apprehending foreign nationals at the border. As regards more specifically the use of electrical discharge weapons, reference is made to the principles listed in paragraphs 65 to 84 of the 20th General Report on the CPT’s activities.23“

      Response, p. 13: “It has not been necessary to use physical force and special means against persons, because there have been no cases when they did not obey the lawful orders of the border guards. In order to prevent crossing or attempted crossing of the state border outside official border crossing points and procedures established for legal entry, persons are informed that crossing the state border is illegal and there is criminal liability prescribed for crossing it and are invited not to cross the state border or correspondingly invited to return to Belarus. Furthermore, at that moment persons also visually see armed border guards and national guards, and their preparedness for active response in preventing the possibilities of illegal crossing of the state border. Following such actions and the provision of information, persons, as a rule, do not risk approaching Latvia or, if they have already crossed the border, they return to Belarus. The enumeration of special means of the SBG contains electric shock devices, which the officials, based on Cabinet of Ministers Regulation No.55 of 18 January 2011, are entitled to use for fulfilment of the functions assigned to them. There are no electric shock devices of any kind (including TASER) currently used for border surveillance due to the numerical shortage thereof, expiry of their useful life and the necessity to use them for the needs of other SBG services (immigration control, border inspections).”

      The government’s response contradicts several testimonies of irregular border-crossers recorded by “I Want to Help Refugees” in 2022–2023 on having experienced emotional and physical violence, including cursing and threats, beatings, and electrocution both during the pushbacks and while in tents/ SBG bases in the Latvian territory. According to these testimonies, abuse was most often committed by members of unidentified special units wearing masks. At least four complaints on the excessive use of violence have been submitted to the Internal Security Bureau, and one of the complainants has turned to the European Court of Human Rights.

      [6] About the lack of psychological assistance to the detainees at the IDCs.

      Report, par. 44, p. 57: “The CPT recommends that steps be taken at Daugavpils and Mucenieki Immigration Detention Centres to ensure adequate access to psychiatric care and psychological assistance for foreign nationals, combined with the provision of professional interpretation.”

      Response, p. 18-19: “Based on the proposal made by the international non-governmental organisation “Doctors without Borders”, during the period from July to 31 December 2022, the representatives of the international non-governmental organisation “Doctors without Borders” have been regularly visiting Daugavpils IDC and Mucenieki IDC and providing psychological support to the detained foreigners and asylum seekers accommodated in the IDC of the SBG.

      By means of the funds raised via the project from the Asylum, Migration and Integration Fund, in order to reduce the everyday psychological sufferings or struggles of the target group, it is planned to attract psychologists and cover expenses for psychologist services for the foreigners accommodated in the centres.

      Additionally, as already mentioned herein above, in 2013, the SBG and the LRC signed an agreement on cooperation, based on which the LRC, among other things, undertook to organise, as far as possible, for persons accommodated in the IDC of the SBG, psychological support and educational measures or other measures that would improve living conditions of the referred to persons…”

      While NGOs might offer valuable psychological support to asylum seekers and detained foreigners at the IDCs, their services cannot be considered a viable alternative and substitution of state-provided in-house psychological support. Since December 2022 when “Doctors without Borders” ceased its operation in Latvia, no psychological support has been available to the detainees. LRC has not been able to offer any psychological assistance at the IDCs, citing the difficulty of arranging interpreters as one of the main challenges.

      [7] About the forcible return of irregular migrants from Latvia to Belarus

      Report, par. 48, p. 57: “… the CPT recommends that the Latvian authorities take the necessary measures to ensure that irregular migrants arriving at the border or present in the territory of Latvia are not forcibly returned to Belarus prior to an individualised screening with a view to identifying persons in need of protection, assessing those needs and taking appropriate action. Further, it is essential that foreign nationals have effective access to an asylum procedure (or other residence procedure) which involves an individual assessment of the risk of ill-treatment in case of expulsion of the person concerned to the country of origin or a third country, on the basis of an objective and independent analysis of the human rights situation in the countries concerned.38 The CPT considers that the relevant provisions of the Cabinet of Ministers’ Decree No. 518 on the Declaration of a State of Emergency should be revised accordingly.”

      Response, p. 19: “Currently, the emergency situation in the administrative territories at the Latvia- Belarus border does not allow the uncontrolled flow of people across the state border in places not intended for this, and at the same time does not limit the right of persons to access the asylum procedure, because the right to lodge an application at the border crossing point provided for by the Asylum Law is not restricted. The referred to regulation was based on the internationally recognised right of countries to control the border of their country and to prevent the illegal crossing thereof (see the judgment of the ECHR of 13 February 2020 in the case of ND and NT v. Spain and the judgment of the ECHR of 5 April 2022 in the case A.A. and others v. North Macedonia).”

      Testimonies of irregular migrants forcibly returned from Latvia/ Latvian border to the territory of Belarus indicate that no proper screening of persons is performed at the border. There have been cases when not only families with children, but also unaccompanied minors have been pushed back.
      Testimonies of irregular migrants allowed to enter Latvia on humanitarian grounds and submit their claims for asylum, show that neither the Belarussian nor the Latvian authorities allow the migrants to move to the official border crossing points, instead pushing them back to either Belarus or Latvia.

      Recommendations and Action Points

      Clarify the statements in the Response with authorities in question.
      Create an action plan that identifies the gaps in the treatment of detainees in detention centres and explores for possible solutions.
      Establish an obligation and a clear procedure for a prompt investigation of all claims of violence voiced by irregular migrants and detained asylum seekers.
      Ensure presence of a psychologist/psychotherapist at both IDCs to provide psychological help to the detained when necessary (also, ensure that the regular medical staff is present).
      Ensure the possibility for detainees to spend sufficient time outdoors each day.
      Ensure transparent evaluation of migrants’ individual circumstances upon their arrival at the border; share the assessment guidelines with independent monitoring bodies and NGOs.

    JTA – En 1967, il a été demandé au ministre canadien de la Justice de retirer sa citoyenneté à un ancien nazi, condamné à mort en Union soviétique.

    Le ministre, Pierre Trudeau, avait refusé de le faire. Bien que l’URSS ait condamné le Letton pour le meurtre de Juifs pendant la Shoah, le ministre de la Justice avait fait valoir que le Canada n’avait pas commis d’erreur en lui accordant la citoyenneté lors de sa demande initiale.


    « L’obligation du demandeur est de convaincre la Cour qu’il est de bonne moralité », avait écrit Trudeau, qui deviendra plus tard Premier ministre du Canada, dans un avis juridique publié à l’époque. « Il n’est pas tenu de convaincre la Cour qu’il n’a jamais commis d’acte répréhensible dans son passé (…). D’un point de vue pratique, et même raisonnable, peu de demandeurs, voire aucun, pourraient satisfaire à une telle exigence. »

    La réponse de Trudeau a été révélée la semaine dernière lorsque le gouvernement canadien, aujourd’hui dirigé par son fils, le Premier ministre Justin Trudeau, a levé les scellés sur des documents relatifs à la réinstallation de criminels de guerre nazis dans le pays. Ces révélations surviennent quelques mois après une crise politique liée à la présence continue d’anciens nazis au Canada.

    Ces documents font partie du rapport Rodal, rédigé en 1985 et publié sous une forme fortement censurée en 1987. Ils ont été rassemblés par une historienne juive nommée Alti Rodal, née en Ukraine et fille de survivants de la Shoah. Le rapport a été compilé dans le cadre d’un effort plus large, la Commission Deschênes, pour enquêter sur les criminels de guerre nazis au Canada.

    L’année dernière, B’nai Brith Canada, un groupe de défense des intérêts juifs, a déposé une demande en vertu de la loi sur l’accès à l’information du pays pour que le reste du contenu du rapport soit rendu public. Les 15 pages qui ont été dévoilées à la suite de cette demande fournissent davantage d’informations sur la mesure dans laquelle le gouvernement canadien a été impliqué dans l’octroi de la citoyenneté à des criminels de guerre nazis.

    Le document montre que Pierre Trudeau, qui est devenu Premier ministre en 1968 et a occupé cette fonction presque sans interruption jusqu’en 1984, a mis en garde contre les dangereuses conséquences qu’entraînerait la révocation par le Canada de la citoyenneté du Letton, connu sous le nom de « sujet F ».

    Reconnu coupable par contumace en Union soviétique d’avoir dirigé un peloton d’exécution responsable de la mort de 5 128 Juifs , le sujet F avait été condamné à mort. Si Trudeau avait conseillé de révoquer sa citoyenneté canadienne, il aurait pu être déporté et exécuté.

    Trudeau avait estimé que le sujet F n’était pas contraint par la loi canadienne de divulguer ses méfaits avant de demander la citoyenneté.

    « Rien dans la loi n’indique qu’une demande de citoyenneté canadienne est de la nature d’un confessionnal obligeant le demandeur à révéler toute sa conduite antérieure, qu’elle soit publique ou privée », avait-il écrit.

    Trudeau avait reconnu « l’anxiété » des Juifs canadiens et d’autres personnes face à la présence de criminels de guerre nazis dans leur pays. Toutefois, il avait indiqué au ministère des Affaires extérieures que la révocation de la citoyenneté du sujet F et son extradition pourraient créer un précédent négatif pour d’autres citoyens canadiens.

    « Bien que je comprenne votre préoccupation pour les répercussions et l’anxiété que vous mentionnez, il me semble, d’autre part, qu’il serait très mal avisé pour le gouvernement de se lancer dans cette démarche qui consisterait à accuser publiquement un citoyen canadien d’avoir commis en Lettonie des crimes pour lesquels il a été condamné, par contumace, en Russie », avait écrit Trudeau.

    Selon le rapport Rodal, le Congrès juif canadien avait à nouveau tenté de faire expulser le sujet F, mais en vain. Le sujet F est décédé à Toronto en 1983, selon le rapport.

    La décision de Trudeau est survenue à un moment intense de la Guerre Froide, où accéder à la demande d’extradition de l’Union soviétique représentait un compromis politique.

    “They voluntary decided to take the citizenship not of Latvia but of another state,” he said. He said the test was needed because Russian authorities justified their invasion of Ukraine by the need to protect Russian nationals abroad.

    Latvian authorities have violently pushed back refugees and migrants at the country’s borders with Belarus, subjecting many to grave human rights violations, including secret detention and even torture, according to new findings published in a report by Amnesty International.

    Latvia: Return home or never leave the woods reveals the brutal treatment of migrants and refugees – including children – who have been held arbitrarily in undisclosed sites in the Latvian forest, and unlawfully and violently returned to Belarus. Many faced beatings and electric shocks with tasers, including on their genitals. Some were unlawfully forced to return ‘voluntarily’ to their home countries.

    “Latvia has given refugees and migrants a cruel ultimatum: accept to return ‘voluntarily’ to their country, or remain stranded at the border facing detention, unlawful returns and torture. In some cases, their arbitrary detention at the border may amount to enforced disappearance,” said Eve Geddie, Director of Amnesty International’s European Institutions Office.

    “The Latvian authorities have left men, women and children to fend for themselves in freezing temperatures, often stranded in forests or held in tents. They have violently pushed them back to Belarus, where they have no chance of seeking protection. These actions have nothing to do with border protection and are brazen violations of international and EU law.”

    On 10 August 2021, Latvia introduced a state of emergency following an increase in numbers of people encouraged to come to the border by Belarus. In contrast with EU and international law and the principle of non-refoulement, the emergency rules suspended the right to seek asylum in four border areas and allowed Latvian authorities to forcibly and summarily return people to Belarus.

    Latvian authorities have repeatedly extended the state of emergency, currently until November 2022, despite the decrease of movements over time, and their own admission that the number of attempted entries were the result of multiple crossings by the same people.

    Dozens of refugees and migrants have been arbitrarily held in tents at the border in unsanitary conditions, A small percentage of people were allowed into Latvia, the vast majority of whom were placed in detention centres and offered limited or no access to asylum processes, legal assistance or independent oversight.

    Amnesty’s report on Latvia follows and supplements similar reports focussing on abuses against refugees and migrants by Belarus, Poland and Lithuania.
    Violent pushbacks, arbitrary detention and possible enforced disappearances

    Under the state of emergency, Latvian border guards, in cooperation with unidentified “commandos”, the army and the police, repeatedly subjected people to summary, unlawful and violent forced returns. In response, Belarusian authorities would then systematically push people back to Latvia.

    Zaki, a man from Iraq who was stranded at the border for around three months, told Amnesty International that he had been pushed back more than 150 times, sometimes eight times in a single day.

    Hassan, another man from Iraq who spent five months at the border, said: “They forced us to be completely naked, sometimes they beat us when naked and then they forced us to cross back to Belarus, sometimes having to cross a river which was very cold. They said they would shoot us if we didn’t cross.”

    In between pushbacks, people were forced to spend prolonged periods stranded at the border or in tents set up by the authorities in isolated areas of the forest. Latvian authorities have so far denied using tents for anything other than providing “humanitarian assistance”, but Amnesty International’s findings show that tents were heavily guarded sites used to arbitrarily hold refugees and migrants and as outposts for illegal returns.

    Those not held in tents sometimes ended up stranded in the open at the border, as winter temperatures at times fell to -20C. Adil, a man from Iraq, who spent several months in the forest since August 2021, told Amnesty International: “We used to sleep in the forest on the snow. We used to light fire to get warm, there were wolves, bears.”

    At the border and in the tents, authorities confiscated people’s mobile phones to prevent any communication with the outside world. Some families searched for people who were last known to be in Latvia but could not be reached by phone. A Latvian NGO reported that between August and November 2021, they were contacted by the relatives of more than 30 refugees and migrants feared to have gone missing.

    Holding migrants and refugees in tents in undisclosed locations or leaving them stranded at the border without access to communication or safe alternatives to being continuously shuttled back and forth between Latvia and Belarus constitutes ‘secret detention’ and could amount to enforced disappearance.
    Forced returns, abuse and torture

    With no effective access to asylum under the state of emergency, Latvian officers coerced some people held at the border into agreeing to return ‘voluntarily’ to their countries of origin as the only way to be taken out of the forest.

    Others were coerced or misled into accepting voluntary returns in detention centres or police stations.

    Hassan, from Iraq, told Amnesty International that he tried to explain that his life would be in danger if he was returned: “The commando responded: ‘You can die here too’”.

    Another Iraqi, Omar, described how an officer hit him from behind and forced him to sign a return paper: “He held my hand and said you should do the signature, and then with force, he made me do the signature.”

    In some cases, the IOM representative for Latvia ignored evidence that people transferred as part of “voluntary” return procedures had not provided their genuine consent to returning.

    “Latvia, Lithuania and Poland, continue to commit grave abuses, under the pretext of being under a ‘hybrid attack’ from Belarus. As winter approaches and movements at the border have resumed, the state of emergency continues to allow Latvian authorities to unlawfully return people to Belarus. Many more could be exposed to violence, arbitrary detention and other abuses, with limited or no independent oversight,” said Eve Geddie.

    “Latvia’s shameful treatment of people arriving at its borders presents a vital test for European institutions, which must take urgent measures to ensure that Latvia ends the state of emergency and restores the right to asylum across the country for everyone seeking safety, irrespective of their origin or how they crossed the border.”
    Background

    As pushbacks at the Belarus border with Latvia, Lithuania and Poland re-intensify, the EU Council is prioritizing the adoption of a Regulation on the “instrumentalization” of migrants and asylum seekers. This would allow member states facing situations of “instrumentalization” – as experienced by Latvia – to derogate from their obligations under EU asylum and migration law. The proposal disproportionately impacts the rights of refugees and migrants and risks undermining the uniform application of EU asylum law.

    In June, the Court of Justice of the EU ruled that the Lithuanian law on asylum and migration, which limited people’s ability to make asylum applications under the state of emergency and provided for the automatic detention of asylum seekers, was incompatible with EU law.

    The Court’s analysis and conclusions should apply directly to the situation in Latvia, where, since August 2021, the state of emergency effectively prevents most people entering or attempting to enter “irregularly” from Belarus from accessing asylum.

    • Asylum seekers who claimed torture and abuse in Latvia are using the courts to fight back

      Some of the people looking to take the Latvian state to court have alleged ill-treatment including beatings, electric shocks and cigarette burns.

      Earlier this year, Sidya Sompare, 20, a Guinean man who had attempted to claim asylum in Latvia, tried to end his life in a Latvian detention centre by drinking shampoo in his toilet stall.

      Having fled Guinea in the wake of threats against his safety due to his participation in anti-government protests, Sompare arrived in Belarus in September 2021 on a quest to find a secure life in Europe, before spending six months in the forested border zone between the country and Latvia.

      There, in addition to being pushed back and forth across the border by authorities in both countries, he alleges he was severely beaten, verbally abused, and given barely any food for days on end by Latvian border guards. Sompare then spent eight months in the closed detention center after he lost his passport in the woods and his asylum efforts were denied.

      When Sompare was found on the floor of his toilet stall after his suicide attempt, detention center authorities promptly took him to a hospital.

      “I’m not sick, I’m alright,” he recalled saying to a doctor during an interview with Euronews. “Just I need to be free.”

      He was finally released from detention in April with the help of Doctors Without Borders, an NGO, and a local Latvian human rights group. But Sompare didn’t stop there — having previously filed two unsuccessful complaints against the Latvian state last year for his detention and the dehumanizing treatment he experienced in the forest along the border, he has taken his fight to the European Court of Human Rights (ECHR), where his case was formally registered on July 5.

      Beatings and electric shocks

      Sompare is not alone in turning to legal pathways to seek justice for ill-treatment by Latvian border authorities during the migrant crisis along the Belarusian border.

      As allegations of torture and ill-treatment by Latvian authorities have continued to emerge since last year, an increasing number of migrants and refugees who say they have experienced life-altering trauma at the hands of Latvian security forces have been mounting court challenges against them over the last few months, aiming to hold their former tormentors and the Latvian state accountable.

      These cases, which are mostly taking place at the national level with the exception of Sompare’s, represent some of the first legal efforts in Latvia since the start of the border crisis in 2021 that are specifically focused on the harrowing abuse that border authorities have allegedly inflicted on people crossing the border.

      “All the Latvian institutions, even the ombudsperson of Latvia, they deny that Latvia did anything illegal with those migrants,” said Nikita Matyushchenkov, a human rights lawyer at Respect, Protect, Fulfill (RPF), the legal organisation that helped Sompare file his ECHR case. “So these will be very important judgements.”

      In addition to challenging ongoing deportation procedures against him, Sompare’s ECHR case is focused on the ill-treatment he received in Latvian custody in the forests of the border area, which he and RPF claim was illegal. RPF has also filed three cases at the national level in Latvia, two in March and one in June of this year, on behalf of individuals who claim they were abused by Latvian border authorities between August 2021 and March 2022.

      But these may not be the only cases that will be brought to bear against the Latvian state — Matyushchenkov said that RPF has identified up to 100 people who were abused in one way or another by Latvian border guards while in the forest in the border area.

      Some of Matyushchenkov’s clients have told him that they were beaten with electric shock devices — claims that are consistent with findings documented in 2022 in an Amnesty International report on Latvia’s border. In another report published this month, the European Committee for the Prevention of Torture and Inhuman or Degrading Treatment or Punishment stated that it had received several claims of “severe ill-treatment” from people who were detained after crossing into Latvia, again recounting beatings and electric shocks to areas of the body “including the genitals.”

      ’I got sick physically and mentally’

      The ongoing migrant border crisis has, according to European states, been manufactured by Belarusian leader Alexander Lukashenko, whose government has incentivised people from the Middle East, Africa, and South Asia to journey to Belarus before forcing them to cross the borders of Poland, Lithuania, and Latvia illegally as a means of putting pressure on the European Union.

      After establishing a state of emergency along its border in August 2021, Latvia adopted new amendments to its border laws in June of this year that have been denounced by Amnesty International, the Council of Europe Commissioner for Human Rights, and the UNHCR as legalising internationally-condemned pushbacks. Crucially, these amendments have also enshrined into law the State Border Guard’s broadly defined use of force to prevent illegal entry into Latvia.

      Although Poland and Lithuania have both faced accusations of ill-treatment of migrants as well, Matyushchenkov said that Latvia has been much more extreme in its abuse of people crossing its border.

      In one particularly gruesome case that has previously been reported in international media, Abdulrahman Kiwan, a humanitarian worker who fled Syria following pressure from the government of Bashar al-Assad, has alleged that he not only received electric shocks from Latvian guards, but that they extinguished cigarettes in the places where he had previously been injured.

      Now, Kiwan said he is in touch with a Latvian human rights group about filing his own complaint against the Latvian state — and if it fails, he is also ready to escalate his efforts to the ECHR with the help of legal NGOs.

      “I got sick physically and mentally because of them,” Kiwan, 28, who is now based in Germany, said of the Latvian border authorities. “I want my voice to reach the world and other migrants, that the Latvian Border Guards are liars and are extremely racist.”

      A Latvian human rights group is currently working on preparing a complaint for another refugee based in Germany, Hadi, 26, from Yemen, who told Euronews that Latvian guards beat him, violently struck him in the head, and shocked him with an electric baton. In addition to seeking compensation for crimes committed against him, Hadi, who requested to use an alias due to his ongoing asylum case in Germany, also wants his experience to be a cautionary tale.

      “Legally, I want this complaint [to ensure] that no human being will be harmed after me,” he told Euronews.

      ’The government is scared of me’

      Although Matyushchenkov said the chances of success for migrant cases like these at the ECHR may be significant, the same cannot be said for complaints within the Latvian system.

      “From the way it was investigated at the national level, it seems like the authorities are not willing to investigate such complaints properly,” he said, referencing Sompare’s initial complaint procedure. “In the response to his complaint, they identified a person who allegedly beat the complainant, and they interviewed that person. That security official said he didn’t beat this person, and this was basically the end of the investigation.”

      The Latvian government, including the Latvian State Border Guard, have previously denied any claims of abuse and torture from migrants. As of the writing of this article however, the Latvian State Border Guard, together with the country’s Internal Security Bureau and Prosecution Office which handle legal complaints from people crossing the border, were unavailable for comment.

      Sompare, who is currently living in Latvia’s capital Riga, has no plans to leave Latvia anytime soon. As he fights his still ongoing deportation procedure and the traumatic abuse he suffered in the country, he can feel he is already making an impact.

      “Something is going to change in Latvia,” he said. “Right now for sure the government is scared of me.”

      Despite being severely disappointed in Europe’s capacity to help desperate people like himself, Sompare said he wants to continue his university studies after he wins his case, and hopes to find work at a human rights organization for refugees in Latvia. Until then however, he understands that he is fighting an uphill battle not only to save himself, but also many other asylum seekers who are in the same situation.

      “I want to be an example for the people [to whom] the Latvian government did something illegal,” Sompare said. “The things that I started, I will finish them in Latvia.

    Le Conseil de l’Europe a publié, jeudi, un #rapport dans lequel il dénonce le refoulement « généralisé » des migrants aux #frontières. Une pratique émaillée de « violence[s] grave[s] et systématique[s] », selon l’organisation qui demande aux États membres de mettre fin à ce qu’elle qualifie de « violations des droits humains ».

    Dans un rapport, publié jeudi 7 avril, le Conseil de l’Europe affirme que le nombre de « réfugiés, demandeurs d’asile et migrants » refoulés aux #frontières_terrestres et maritimes de l’Union européenne (UE) a augmenté ces dernières années. L’organisation, une institution indépendante qui n’appartient pas à l’UE, parle d’un phénomène devenu un « problème paneuropéen systématique ».

    Le Conseil pointe plusieurs pays en particulier : la #Croatie, l’#Italie, l’#Autriche, la #Hongrie, la #Pologne, la #Lituanie, la #Lettonie, la #Grèce, #Chypre, la #Turquie, la #Bulgarie ou encore la #France et l’#Espagne. Ces 13 États sont vivement critiqués pour avoir renvoyé, vers les pays voisins, des migrants qui tentaient d’entrer sur leur territoire, sans leur laisser la possibilité de déposer une demande de protection.

    Le document s’appuie sur des rapports d’ONG qui ont, par exemple, dénombré entre 50 et 130 procédures de refoulement par jour pendant l’été 2020, et jusqu’à 170 en octobre de la même année, entre la France et l’Italie, dans le département français des #Alpes_maritimes.

    Les autres pays ont également été visés par plusieurs enquêtes de médias ou d’associations, faisant état de « #pushbacks » systématiques à leurs frontières. La Grèce a, par exemple, été accusée à plusieurs reprises de renvoyer des migrants en mer Égée vers la Turquie, parfois sans canot, ni gilets de sauvetage. La Pologne, la Lituanie et la Lettonie ont, de leur côté, été critiqués pour leur traitement des personnes arrivant de la Biélorussie voisine, notamment lors de l’important afflux observé à l’été 2021.

    « Des violations des droits humains cruelles et contradictoires »

    Le rapport souligne aussi que dans certains pays, « l’usage de la #violence » envers les exilés est « grave et systématique ». Il fustige également la tendance de certains États à vouloir adopter des lois légalisant les mesures de refoulement, comme c’est notamment le cas en Hongrie, ou même en France.

    « La situation actuelle montre que les graves violations des droits humains, devenues un élément essentiel des méthodes de contrôle aux frontières des États membres, sont cruelles, contradictoires et contreproductives », a souligné la Commissaire du Conseil de l’Europe pour les droits de l’Homme, Dunja Mijatovic.

    Cette dernière n’a pas manqué de pointer du doigt le double standard avec l’accueil « chaleureux » réservé aux Ukrainiens fuyant la guerre : les pays européens qui leur ont ouvert les bras sont les mêmes qui repoussent hors de leurs frontières les migrants d’autres nationalités.

    Dunja Mijatovic regrette qu’en agissant ainsi, les dirigeants créent « de faux clivages » entre les différents groupes. « Les droits humains existent pour nous protéger tous de la même manière, peu importe notre origine », a-t-elle insisté.

    Le Conseil de l’Europe, vigie des droits humains sur le continent, demande donc aux États membres de mettre fin à ces refoulements et de « respecter leurs obligations légales » vis-à-vis des personnes en demande de protection en ne les renvoyant pas de l’autre côté de la frontière « sans une procédure individualisée », ni sans « droit à un recours effectif ».

    Il exige aussi que les États mettent en place « des règles de conduite » et des « procédures standardisées claires et obligatoires » pour les autorités en charge du contrôle aux frontières afin de traiter les migrants « de manière conforme aux droits humains ».

      « Face à l’ampleur et à la #normalisation des refoulements aux frontières de l’Europe, il est urgent que les gouvernements et les parlementaires mènent une action concertée », a déclaré aujourd’hui Dunja Mijatović, Commissaire aux droits de l’homme du Conseil de l’Europe, en rendant public une Recommandation aux gouvernements et aux parlementaires des États membres décrivant la multiplication des refoulements et des violations connexes des droits de l’homme observée aux frontières terrestres et maritimes des pays européens.

      « Cette Recommandation est publiée dans une période où la protection des droits de l’homme en Europe est mise à particulièrement rude épreuve » a déclaré la Commissaire. « La guerre qui fait rage en Ukraine cause des morts, des destructions et a contraint plus de quatre millions de personnes à quitter leur pays pour tenter de se mettre à l’abri ailleurs en Europe. La réponse immédiate des pays européens montre qu’il est possible de mettre la protection de la dignité humaine et le respect des obligations internationales au centre de l’action des États. »

      Un tel principe devrait aussi s’appliquer à la protection des réfugiés, des demandeurs d’asile et des migrants venant d’autres parties du monde. Malheureusement, dans de nombreux États membres du Conseil de l’Europe, depuis plusieurs années, ces personnes ont fait l’objet de refoulements. Ainsi que le souligne cette Recommandation, « ces pratiques vont à l’encontre des obligations incombant aux États membres en matière de droits de l’homme car elles sont contraires au principe de non-refoulement, fragilisent le droit d’asile, privent les personnes renvoyées des garanties fondamentales qui devraient s’appliquer, et entraînent souvent des violences, des actes de torture et d’autres mauvais traitements graves, voire portent atteinte au droit à la vie. » La Recommandation décrit la manière dont plusieurs pays ont fait du refoulement des réfugiés, des demandeurs d’asile et des migrants une politique officielle, qui est parfois même inscrite dans la législation nationale, et met en garde les États contre les tentatives visant à limiter encore la surveillance exercée sur les opérations qu’ils mènent à leurs frontières.

      Quatre principaux domaines d’action sont identifiés dans cette Recommandation pour enrayer le phénomène

      Premièrement, les gouvernements doivent mettre en œuvre de bonne foi les obligations leur incombant en matière de droits de l’homme, notamment au titre de la Convention européenne des droits de l’homme, et cesser de fuir leurs responsabilités. « Lorsque les États manquent à leurs obligations, ils fragilisent l’État de droit et les garanties durement acquises dans le domaine des droits de l’homme. Cela représente un danger pour nous tous, et pas uniquement pour les réfugiés, les demandeurs d’asile et les migrants. »

      Deuxièmement, il faut que les gouvernements augmentent la transparence et la responsabilité, notamment en renforçant les mécanismes qui permettent d’exercer un contrôle indépendant des opérations de surveillance des frontières. Ces mécanismes sont indispensables pour empêcher les refoulements, mettre au jour les violations et combattre l’impunité.

      Troisièmement, tous les États membres du Conseil de l’Europe doivent reconnaître que les refoulements sont un problème grave, de dimension paneuropéenne, dont le règlement requiert la participation de tous. Cela suppose aussi, pour un gouvernement, de dénoncer les violations des droits de l’homme et de demander des comptes à ses homologues. « Les refoulements étant une réalité indéniable en Europe, tous les États membres, y compris ceux qui ne mènent pas directement de telles opérations, doivent se sentir concernés et agir. Rester passif revient à tolérer silencieusement que des violations des droits de l’homme soient commises », a prévenu la Commissaire.

      Quatrièmement, les parlementaires doivent se mobiliser pour empêcher l’adoption de propositions législatives qui autoriseraient les refoulements et pour abolir toutes les dispositions en ce sens qui seraient déjà en vigueur. Il leur appartient aussi de demander des comptes à leur gouvernement et d’utiliser leur mandat pour attirer l’attention sur les violations des droits de l’homme qui se produisent.

  • « Ruche » de Zedelgem - Des SS lettons commémorés en Flandre

    En 1945, près de 12.000 légionnaires SS lettons furent détenus dans un camp pour prisonniers de guerre à Zedelgem.
    Dans cette commune de Flandre occidentale, depuis plus de deux ans déjà, un monument leur est dédié.
    Les expressions d’indignation et les appels à débat venant de la société civile ont été ignorés (ou presque) par le monde politique belge.
    Pourtant ces voix dénoncent une insupportable insulte à la mémoire des victimes du nazisme. Les autorités locales affirment qu’elles souhaitent seulement célébrer la « liberté » (sic).
    Un conseiller communal d’extrême-droite (Vlaams Belang) qui a joué un rôle important dans ce projet ‘’mémoriel’’, a été décoré à Riga pour son « travail exceptionnel réalisé au profit de la Lettonie. » 

    A Zedelgem, près de Bruges, sur une place dite de « la liberté », une « ruche lettonne » stylisée invite au souvenir de 12.000 de ces légionnaires des 15ème et 19ème divisions Waffen-SS qui, pendant huit mois, entre 1945 et 1946, furent détenus dans le camp pour prisonniers de guerre du Vloethemveld, situé à quelques kilomètres de là. Stupéfiant ? A l’évidence. Mais il y a pire encore : malgré les manifestations d’indignation répétées de certains citoyens, l’érection d’un tel monument n’a fait l’objet d’aucun débat politique en Belgique. Le souvenir des temps mauvais semble inexorablement s’effacer, la mémoire s’étiole. Cela contribue à la grande confusion idéologique d’une époque où l’on voit resurgir certains fantômes de jadis ; tout profit pour l’extrême-droite européenne qui n’a eu de cesse au cours des dernières décennies de réviser l’histoire, dans l’espoir de prendre sa revanche sur la démocratie.

    En marge de cette affaire éminemment politique, il y a pourtant eu des lanceurs d’alerte. De nombreuses lettres furent adressées à diverses autorités du pays par « The Belgians Remember Them », une association qui entretient la mémoire des aviateurs de la « Royal Air Force » qui tombèrent sur le sol belge pendant la guerre.


    Wilfred Burie, son président, raconte : « Durant l’automne 2020, j’ai découvert l’existence de ce monument. Il a été érigé par les autorités communales de Zedelgem en septembre 2018 et, à l’époque, d’évidence, cela est passé comme une lettre à la poste. Après avoir rassemblé de la documentation sur l’histoire de ces Lettons ayant appartenu à la SS, j’ai écrit à tous les membres du gouvernement pour leur faire part de mon indignation. Je n’ai reçu qu’une seule réponse, évasive d’un ministre, m’expliquant que cette question ne relevait pas de ses compétences. Du côté du parlement, seul le député André Flahaut (PS) s’est mobilisé. A la mi-décembre 2020, il a interpellé le ministre fédéral de la Justice, Vincent Van Quickenborne (Open-Vld). Mais cela n’a débouché sur aucune remise en question officielle de la présence d’un monument qui glorifie des Waffen-SS en Belgique. »

    Par deux fois déjà, la Commission contre le Racisme et l’Intolérance du Conseil de l’Europe a publié des rapports sur la Lettonie dans lesquels elle « condamne les commémorations des personnes qui ont combattu dans la Waffen-SS et qui ont collaboré avec les nazis ». En 2012, elle soulignait que « toute tentative de justifier le fait d’avoir combattu dans une unité de la Waffen-SS et d’avoir collaboré avec les nazis risque de renforcer le racisme, la xénophobie, l’antisémitisme et l’intolérance. »

    En 2019, évoquant une nouvelle fois la marche des ex-légionnaires SS et de leurs supporters à Riga, la même institution se déclarait « particulièrement préoccupée par le fait que des députés du parti de l’Alliance nationale, membre de la coalition au pouvoir, aient été vus à plusieurs reprises à ces cérémonies ». Et de renouveler sa « recommandation aux autorités lettones de condamner toute initiative visant à rendre hommage à des personnes ayant combattu dans une unité de la Waffen-SS. »

    En Lettonie aussi, la question des légionnaires SS fait débat. A chaque fois que ces nostalgiques défilent, des contre-manifestants cherchent à faire entendre leur désapprobation au nom du souvenir des victimes du nazisme. En 1998, le parlement letton a décidé de donner un statut officiel à cette manifestation mais, trois ans plus tard, sous la pression internationale et alors que la Lettonie allait bientôt rejoindre l’Union européenne (1er mai 2004), « la journée de la légion » a été rangée dans le rayon des événements officieux. Mieux, la ville de Riga a voulu l’interdire mais, à la suite d’un recours juridique introduit par ses organisateurs devant les tribunaux locaux, la marche des légionnaires a été maintenue.


    Les milieux nationalistes lettons avancent régulièrement des arguments qui, d’après eux, permettent de célébrer ces légionnaires. Ils soulignent qu’en octobre 1939, la Lettonie fut victime du pacte germano-soviétique qui déboucha, en 1940, sur une première occupation par l’URSS : des milliers de Lettons furent alors déportés par le régime stalinien. A partir de l’été 1941, la Lettonie fut l’objet d’une seconde occupation, lorsque les nazis attaquèrent à l’Est.

    Comment se fait-il que des milliers de Lettons en arrivèrent ensuite à endosser l’uniforme de la Waffen-SS ? Le discours officiel letton appuie l’idée qu’il ne s’est pas agi d’un acte volontaire : « L’Allemagne nazie a formé la Légion lettone en 1943, violant ainsi la Convention de La Haye de 1907 qui interdit aux puissances occupantes de recruter dans leur armée les habitants des territoires occupés. Les conscrits ont été appelés « volontaires » pour contourner la Convention. Ceux qui tentaient d’éviter la conscription dans la Légion risquaient d’être emprisonnés et condamnés à mort. La Légion lettone était une unité de première ligne, dont un tiers des soldats est mort sur le front. Aucun légionnaire n’a jamais été reconnu coupable de crimes de guerre en tant que membre de la légion. », dixit un communiqué publié en 2015 par l’ambassade de Lettonie en France.

  • Artificial intelligence : #Frontex improves its maritime surveillance

    Frontex wants to use a new platform to automatically detect and assess „risks“ on the seas of the European Union. Suspected irregular activities are to be displayed in a constantly updated „threat map“ with the help of self-learning software.

    The EU border agency has renewed a contract with Israeli company Windward for a „maritime analytics“ platform. It will put the application into regular operation. Frontex had initially procured a licence for around 800,000 Euros. For now 2.6 million Euros, the agency will receive access for four workstations. The contract can be extended three times for one year at a time.

    Windward specialises in the digital aggregation and assessment of vessel tracking and maritime surveillance data. Investors in the company, which was founded in 2011, include former US CIA director David Petraeus and former CEO’s of Thomson Reuters and British Petroleum. The former chief of staff of the Israeli military, Gabi Ashkenazi, is considered one of the advisors.

    Signature for each observed ship

    The platform is based on artificial intelligence techniques. For analysis, it uses maritime reporting systems, including position data from the AIS transponders of larger ships and weather data. These are enriched with information about the ship owners and shipping companies as well as the history of previous ship movements. For this purpose, the software queries openly accessible information from the internet.

    In this way, a „fingerprint“ is created for each observed ship, which can be used to identify suspicious activities. If the captain switches off the transponder, for example, the analysis platform can recognise this as a suspicuous event and take over further tracking based on the recorded patterns. It is also possible to integrate satellite images.

    Windward uses the register of the International Maritime Organisation (IMO) as its database, which lists about 70,000 ships. Allegedly, however, it also processes data on a total of 400,000 watercraft, including smaller fishing boats. One of the clients is therefore the UN Security Council, which uses the technology to monitor sanctions.

    Against „bad guys“ at sea

    The company advertises its applications with the slogan „Catch the bad guys at sea“. At Frontex, the application is used to combat and prevent unwanted migration and cross-border crime as well as terrorism. Subsequently, „policy makers“ and law enforcement agencies are to be informed about results. For this purpose, the „risks“ found are visualised in a „threat map“.

    Windward put such a „threat map“ online two years ago. At the time, the software rated the Black Sea as significantly more risky than the Mediterranean. Commercial shipping activity off the Crimea was interpreted as „probable sanction evasions“. Ship owners from the British Guernsey Islands as well as Romania recorded the highest proportion of ships exhibiting „risky“ behaviour. 42 vessels were classified as suspicious for drug smuggling based on their patterns.

    Frontex „early warning“ units

    The information from maritime surveillance is likely to be processed first by the „Risk Analysis Unit“ (RAU) at Frontex. It is supposed to support strategic decisions taken by the headquarters in Warsaw on issues of border control, return, prevention of cross-border crime as well as threats of a „hybrid nature“. Frontex calls the applications used there „intelligence products“ and „integrated data services“. Their results flow together in the „Common Integrated Risk Analysis Model“ (CIRAM).

    For the operational monitoring of the situation at the EU’s external borders, the agency also maintains the „Frontex Situation Centre“ (FSC). The department is supposed to provide a constantly updated picture of migration movements, if possible in real time. From these reports, Frontex produces „early warnings“ and situation reports to the border authorities of the member states as well as to the Commission and the Council in Brussels.

    More surveillance capacity in Warsaw

    According to its own information, Windward’s clients include the Italian Guardia di Finanza, which is responsible for controlling Italian territorial waters. The Ministry of the Interior in Rome is also responsible for numerous EU projects aimed at improving surveillance of the central Mediterranean. For the training and equipment of the Libyan coast guard, Italy receives around 67 million euros from EU funds in three different projects. Italian coast guard authorities are also installing a surveillance system for Tunisia’s external maritime borders.

    Frontex now wants to improve its own surveillance capacities with further tenders. Together with the fisheries agency, The agency is awarding further contracts for manned maritime surveillance. It has been operating such a „Frontex Aerial Surveillance Service“ (FASS) in the central Mediterranean since 2017 and in the Adriatic Sea since 2018. Frontex also wants to station large drones in the Mediterranean. Furthermore, it is testing Aerostats in the eastern Mediterranean for a second time. These are zeppelins attached to a 1,000-metre long line.

    • Data et nouvelles technologies, la face cachée du contrôle des mobilités

      Dans un rapport de juillet 2020, l’Agence européenne pour la gestion opérationnelle des systèmes d’information à grande échelle (#EU-Lisa) présente l’intelligence artificielle (IA) comme l’une des « technologies prioritaires » à développer. Le rapport souligne les avantages de l’IA en matière migratoire et aux frontières, grâce, entre autres, à la technologie de #reconnaissance_faciale.

      L’intelligence artificielle est de plus en plus privilégiée par les acteurs publics, les institutions de l’UE et les acteurs privés, mais aussi par le #HCR et l’#OIM. Les agences de l’UE, comme Frontex ou EU-Lisa, ont été particulièrement actives dans l’#expérimentation des nouvelles technologies, brouillant parfois la distinction entre essais et mise en oeuvre. En plus des outils traditionnels de surveillance, une panoplie de technologies est désormais déployée aux frontières de l’Europe et au-delà, qu’il s’agisse de l’ajout de nouvelles #bases_de_données, de technologies financières innovantes, ou plus simplement de la récupération par les #GAFAM des données laissées volontairement ou pas par les migrant·e·s et réfugié∙e∙s durant le parcours migratoire.

      La pandémie #Covid-19 est arrivée à point nommé pour dynamiser les orientations déjà prises, en permettant de tester ou de généraliser des technologies utilisées pour le contrôle des mobilités sans que l’ensemble des droits des exilé·e·s ne soit pris en considération. L’OIM, par exemple, a mis à disposition des Etats sa #Matrice_de_suivi_des_déplacements (#DTM) durant cette période afin de contrôler les « flux migratoires ». De nouvelles technologies au service de vieilles obsessions…

    • La #technopolice aux frontières

      Comment le #business de la #sécurité et de la #surveillance au sein de l’#Union_européenne, en plus de bafouer des #droits_fondamentaux, utilise les personnes exilées comme #laboratoire de recherche, et ce sur des #fonds_publics européens.

      On a beaucoup parlé ici ces derniers mois de surveillance des manifestations ou de surveillance de l’espace public dans nos villes, mais la technopolice est avant tout déployée aux #frontières – et notamment chez nous, aux frontières de la « forteresse Europe ». Ces #dispositifs_technopoliciers sont financés, soutenus et expérimentés par l’Union européenne pour les frontières de l’UE d’abord, et ensuite vendus. Cette surveillance des frontières représente un #marché colossal et profite grandement de l’échelle communautaire et de ses programmes de #recherche_et_développement (#R&D) comme #Horizon_2020.

      #Roborder – des essaims de #drones_autonomes aux frontières

      C’est le cas du projet Roborder – un « jeu de mots » entre robot et border, frontière en anglais. Débuté en 2017, il prévoit de surveiller les frontières par des essaims de #drones autonomes, fonctionnant et patrouillant ensemble. L’#intelligence_artificielle de ces drones leur permettrait de reconnaître les humains et de distinguer si ces derniers commettent des infractions (comme celui de passer une frontière ?) et leur dangerosité pour ensuite prévenir la #police_aux_frontières. Ces drones peuvent se mouvoir dans les airs, sous l’eau, sur l’eau et dans des engins au sol. Dotés de multiples capteurs, en plus de la détection d’activités criminelles, ces drones seraient destinés à repérer des “#radio-fréquences non fiables”, c’est-à-dire à écouter les #communications et également à mesurer la #pollution_marine.
      Pour l’instant, ces essaims de drones autonomes ne seraient pas pourvus d’armes. Roborder est actuellement expérimenté en #Grèce, au #Portugal et en #Hongrie.

      Un #financement européen pour des usages « civils »

      Ce projet est financé à hauteur de 8 millions d’euros par le programme Horizon 2020 (subventionné lui-même par la #Cordis, organe de R&D de la Commission européenne). Horizon 2020 représente 50% du financement public total pour la recherche en sécurité de l’UE. Roborder est coordonné par le centre de recherches et technologie de #Hellas (le #CERTH), en Grèce et comme le montre l’association #Homo_Digitalis le nombre de projets Horizon 2020 ne fait qu’augmenter en Grèce. En plus du CERTH grec s’ajoutent environ 25 participants venus de tous les pays de l’UE (où on retrouve les services de police d’#Irlande_du_Nord, le ministère de la défense grecque, ou encore des entreprises de drones allemandes, etc.).

      L’une des conditions pour le financement de projets de ce genre par Horizon 2020 est que les technologies développées restent dans l’utilisation civile, et ne puissent pas servir à des fins militaires. Cette affirmation pourrait ressembler à un garde-fou, mais en réalité la distinction entre usage civil et militaire est loin d’être clairement établie. Comme le montre Stephen Graham, très souvent les #technologies, à la base militaires, sont réinjectées dans la sécurité, particulièrement aux frontières où la migration est criminalisée. Et cette porosité entre la sécurité et le #militaire est induite par la nécessité de trouver des débouchés pour rentabiliser la #recherche_militaire. C’est ce qu’on peut observer avec les drones ou bien le gaz lacrymogène. Ici, il est plutôt question d’une logique inverse : potentiellement le passage d’un usage dit “civil” de la #sécurité_intérieure à une application militaire, à travers des ventes futures de ces dispositifs. Mais on peut aussi considérer la surveillance, la détection de personnes et la #répression_aux_frontières comme une matérialisation de la #militarisation de l’Europe à ses frontières. Dans ce cas-là, Roborder serait un projet à fins militaires.

      De plus, dans les faits, comme le montre The Intercept (https://theintercept.com/2019/05/11/drones-artificial-intelligence-europe-roborder), une fois le projet terminé celui-ci est vendu. Sans qu’on sache trop à qui. Et, toujours selon le journal, beaucoup sont déjà intéressés par Roborder.

      #IborderCtrl – détection d’#émotions aux frontières

      Si les essaims de drones sont impressionnants, il existe d’autres projets dans la même veine. On peut citer notamment le projet qui a pour nom IborderCtrl, testé en Grèce, Hongrie et #Lettonie.

      Il consiste notamment en de l’#analyse_d’émotions (à côté d’autres projets de #reconnaissances_biométriques) : les personnes désirant passer une frontière doivent se soumettre à des questions et voient leur #visage passer au crible d’un #algorithme qui déterminera si elles mentent ou non. Le projet prétend « accélérer le #contrôle_aux_frontières » : si le #détecteur_de_mensonges estime qu’une personne dit la vérité, un code lui est donné pour passer le contrôle facilement ; si l’algorithme considère qu’une personne ment, elle est envoyée dans une seconde file, vers des gardes-frontières qui lui feront passer un #interrogatoire. L’analyse d’émotions prétend reposer sur un examen de « 38 #micro-mouvements du visage » comme l’angle de la tête ou le mouvement des yeux. Un spectacle de gadgets pseudoscientifiques qui permet surtout de donner l’apparence de la #neutralité_technologique à des politiques d’#exclusion et de #déshumanisation.

      Ce projet a également été financé par Horizon 2020 à hauteur de 4,5 millions d’euros. S’il semble aujourd’hui avoir été arrêté, l’eurodéputé allemand Patrick Breyer a saisi la Cour de justice de l’Union Européenne pour obtenir plus d’informations sur ce projet, ce qui lui a été refusé pour… atteinte au #secret_commercial. Ici encore, on voit que le champ “civil” et non “militaire” du projet est loin de représenter un garde-fou.

      Conclusion

      Ainsi, l’Union européenne participe activement au puissant marché de la surveillance et de la répression. Ici, les frontières et les personnes exilées sont utilisées comme des ressources de laboratoire. Dans une optique de militarisation toujours plus forte des frontières de la forteresse Europe et d’une recherche de profit et de développement des entreprises et centres de recherche européens. Les frontières constituent un nouveau marché et une nouvelle manne financière de la technopolice.

      Les chiffres montrent par ailleurs l’explosion du budget de l’agence européenne #Frontex (de 137 millions d’euros en 2015 à 322 millions d’euros en 2020, chiffres de la Cour des comptes européenne) et une automatisation toujours plus grande de la surveillance des frontières. Et parallèlement, le ratio entre le nombre de personnes qui tentent de franchir la Méditerranée et le nombre de celles qui y laissent la vie ne fait qu’augmenter. Cette automatisation de la surveillance aux frontières n’est donc qu’une nouvelle façon pour les autorités européennes d’accentuer le drame qui continue de se jouer en Méditerranée, pour une “efficacité” qui finalement ne profite qu’aux industries de la surveillance.

    • Artificial Intelligence - based capabilities for European Border and Coast Guard

      In 2019, Frontex, the European Border and Coast Guard Agency, commissioned #RAND Europe to carry out an Artificial intelligence (AI) research study.

      The purpose of the study was to provide an overview of the main opportunities, challenges and requirements for the adoption of AI-based capabilities in border managament. Frontex’s intent was also to find synergies with ongoing AI studies and initiatives in the EU and contribute to a Europe-wide AI landscape by adding the border security dimension.

      Some of the analysed technologies included automated border control, object recognition to detect suspicious vehicles or cargo and the use of geospatial data analytics for operational awareness and threat detection.

      As part of the study, RAND provided Frontex in 2020 with a comprehensive report and an executive summary with conclusions and recommendations.

      The findings will support Frontex in shaping the future landscape of AI-based capabilities for Integrated Border Management, including AI-related research and innovation projects which could be initiated by Frontex (e.g. under #EU_Innovation_Hub) or recommended to be conducted under the EU Research and Innovation Programme (#Horizon_Europe).

    • Pour les réfugiés, la #biométrie tout au long du chemin

      Par-delà les murs qui poussent aux frontières du monde depuis les années 1990, les réfugiés, migrants et demandeurs d’asile sont de plus en plus confrontés à l’extension des bases de #données_biométriques. Un « #mur_virtuel » s’étend ainsi à l’extérieur, aux frontières et à l’intérieur de l’espace Schengen, construit autour de programmes et de #bases_de_données.

      Des réfugiés qui paient avec leurs #iris, des migrants identifiés par leurs #empreintes_digitales, des capteurs de #reconnaissance_faciale, mais aussi d’#émotions… Réunis sous la bannière de la « #frontière_intelligente », ces #dispositifs_technologiques, reposant sur l’#anticipation, l’#identification et l’#automatisation du franchissement de la #frontière grâce aux bases de données biométriques, ont pour but de trier les voyageurs, facilitant le parcours des uns et bloquant celui des autres.

      L’Union européenne dispose ainsi d’une batterie de bases de données qui viennent compléter les contrôles aux frontières. Depuis 2011, une agence dédiée, l’#Agence_européenne_pour_la_gestion_opérationnelle_des_systèmes_d’information_à_grande_échelle, l’#EU-Lisa, a pour but d’élaborer et de développer, en lien avec des entreprises privées, le suivi des demandeurs d’asile.

      Elle gère ainsi plusieurs bases compilant des #données_biométriques. L’une d’elles, le « #Entry_and_Exit_System » (#EES), sera déployée en 2022, pour un coût évalué à 480 millions d’euros. L’EES a pour mission de collecter jusqu’à 400 millions de données sur les personnes non européennes franchissant les frontières de l’espace Schengen, afin de contrôler en temps réel les dépassements de durée légale de #visa. En cas de séjour prolongé devenu illégal, l’alerte sera donnée à l’ensemble des polices européennes.

      Se brûler les doigts pour ne pas être enregistré

      L’EU-Lisa gère également le fichier #Eurodac, qui consigne les empreintes digitales de chacun des demandeurs d’asile de l’Union européenne. Utilisé pour appliquer le #règlement_Dublin III, selon lequel la demande d’asile est déposée et traitée dans le pays européen où le migrant a été enregistré la première fois, il entraîne des stratégies de #résistance.

      « On a vu des migrants refuser de donner leurs empreintes à leur arrivée en Grèce, ou même se brûler les doigts pour ne pas être enregistrés dans Eurodac, rappelle Damien Simonneau, chercheur à l’Institut Convergences Migrations du Collège de France. Ils savent que s’ils ont, par exemple, de la famille en Allemagne, mais qu’ils ont été enregistrés en Grèce, ils seront renvoyés en Grèce pour que leur demande y soit traitée, ce qui a des conséquences énormes sur leur vie. » La procédure d’instruction dure en effet de 12 à 18 mois en moyenne.

      La collecte de données biométriques jalonne ainsi les parcours migratoires, des pays de départs jusqu’aux déplacements au sein de l’Union européenne, dans un but de limitation et de #contrôle. Pour lutter contre « la criminalité transfrontalière » et « l’immigration clandestine », le système de surveillance des zones frontières #Eurosur permet, via un partage d’informations en temps réel, d’intercepter avant leur arrivée les personnes tentant d’atteindre l’Union européenne.

      Des contrôles dans les pays de départ

      Pour le Transnational Institute, auteur avec le think tank Stop Wapenhandel et le Centre Delàs de plusieurs études sur les frontières, l’utilisation de ces bases de données témoigne d’une stratégie claire de la part de l’Union européenne. « Un des objectifs de l’expansion des #frontières_virtuelles, écrivent-ils ainsi dans le rapport Building Walls (https://www.tni.org/files/publication-downloads/building_walls_-_full_report_-_english.pdf), paru en 2018, est d’intercepter les réfugiés et les migrants avant même qu’ils n’atteignent les frontières européennes, pour ne pas avoir à traiter avec eux. »

      Si ces techniques permettent de pré-trier les demandes pour fluidifier le passage des frontières, en accélérant les déplacements autorisés, elles peuvent également, selon Damien Simonneau, avoir des effets pervers. « L’utilisation de ces mécanismes repose sur l’idée que la #technologie est un facilitateur, et il est vrai que l’#autonomisation de certaines démarches peut faciliter les déplacements de personnes autorisées à franchir les frontières, expose-t-il. Mais les technologies sont faillibles, et peuvent produire des #discriminations. »

      Ces #techniques_virtuelles, aux conséquences bien réelles, bouleversent ainsi le rapport à la frontière et les parcours migratoires. « Le migrant est confronté à de multiples points "frontière", disséminés un peu partout, analyse Damien Simonneau. Cela crée des #obstacles supplémentaires aux parcours migratoires : le contrôle n’est quasiment plus lié au franchissement d’une frontière nationale, il est déterritorialisé et peut se produire n’importe où, en amont comme en aval de la frontière de l’État. »

      Ainsi, la « politique d’#externalisation de l’Union européenne » permet au contrôle migratoire de s’exercer dans les pays de départ. Le programme européen « #SIV » collecte par exemple dès leur formulation dans les #consulats les données biométriques liées aux #demandes_de_visas.

      Plus encore, l’Union européenne délègue une partie de la gestion de ses frontières à d’autres pays : « Dans certains États du Sahel, explique Damien Simonneau, l’aide humanitaire et de développement est conditionnée à l’amélioration des contrôles aux frontières. »

      Un programme de l’Organisation internationale pour les migrations (OIM), le programme #MIDAS, financé par l’Union européenne, est ainsi employé par 23 pays, majoritairement en Afrique, mais aussi en Asie et en Amérique. Son but est de « collecter, traiter, stocker et analyser les informations [biométriques et biographiques] des voyageurs en temps réel » pour aider les polices locales à contrôler leurs frontières. Mais selon le réseau Migreurop, ces données peuvent également être transmises aux agences policières européennes. L’UE exerce ainsi un droit de regard, via Frontex, sur le système d’information et d’analyse de données sur la migration, installé à Makalondi au Niger.

      Des réfugiés qui paient avec leurs yeux

      Un mélange des genres, entre organisations humanitaires et États, entre protection, logistique et surveillance, qui se retrouve également dans les #camps_de_réfugiés. Dans les camps jordaniens de #Zaatari et d’#Azarq, par exemple, près de la frontière syrienne, les réfugiés paient depuis 2016 leurs aliments avec leurs iris.

      L’#aide_humanitaire_alimentaire distribuée par le Programme alimentaire mondial (PAM) leur est en effet versée sur un compte relié à leurs données biométriques. Il leur suffit de passer leurs yeux dans un scanner pour régler leurs achats. Une pratique qui facilite grandement la gestion #logistique du camp par le #HCR et le PAM, en permettant la #traçabilité des échanges et en évitant les fraudes et les vols.

      Mais selon Léa Macias, anthropologue à l’EHESS, cela a aussi des inconvénients. « Si ce paiement avec les yeux peut rassurer certains réfugiés, dans la mesure où cela les protège contre les vols, développe-t-elle, le procédé est également perçu comme une #violence. Les réfugiés ont bien conscience que personne d’autre au monde, dans une situation normale, ne paie ainsi avec son #corps. »

      Le danger de la fuite de données

      La chercheuse s’inquiète également du devenir des données ainsi collectées, et se pose la question de l’intérêt des réfugiés dans ce processus. « Les humanitaires sont poussés à utiliser ces nouvelles technologies, expose-t-elle, qui sont vues comme un gage de fiabilité par les bailleurs de fonds. Mais la #technologisation n’est pas toujours dans l’intérêt des réfugiés. En cas de fuite ou de hackage des bases de données, cela les expose même à des dangers. »

      Un rapport de Human Rights Watch (HRW) (https://www.hrw.org/news/2021/06/15/un-shared-rohingya-data-without-informed-consent), publié mardi 15 juin, alerte ainsi sur des #transferts_de_données biométriques appartenant à des #Rohingyas réfugiés au Bangladesh. Ces données, collectées par le Haut-commissariat aux réfugiés (HCR) de l’ONU, ont été transmises par le gouvernement du Bangladesh à l’État birman. Si le HCR a réagi (https://www.unhcr.org/en-us/news/press/2021/6/60c85a7b4/news-comment-statement-refugee-registration-data-collection-bangladesh.html) en affirmant que les personnes concernées avaient donné leur accord à ce #transfert_de_données pour préparer un éventuel retour en Birmanie, rien ne permet cependant de garantir qu’ils seront bien reçus si leur nom « bipe » au moment de passer la frontière.

    Ce fut à Riga l’un des débats les plus vifs de l’été 2020 : comment pouvait-on sous-entendre que Tatjana Ždanoka serait des « nôtres » au même titre que les quarante-neuf autres femmes emblématiques de l’histoire lettone choisies pour figurer dans un album destiné à la jeunesse, parmi lesquelles Aspazija, la poète révolutionnaire, figure tutélaire du premier État letton indépendant, Vaira Vīķe-Freiberga, la charismatique présidente qui a réinstallé en majesté la Lettonie au sein de la « famille européenne » ou encore Elīna Garanča, la divine mezzo-soprano que s’arrachent les plus grandes scènes du monde ? Tatjana Ždanoka, cette scientifique communiste, députée au Soviet suprême de la RSS de Lettonie qui a voté en 1990 contre le rétablissement de la démocratie, la « pied rouge » soupçonnée d’accointances poutiniennes dont la présence au Parlement européen est le plus souvent perçue par l’opinion lettophone comme une infamie ? Des nôtres ? Quel message cherchait-on à faire passer par une telle provocation ?

  • Käfigfrei-Kampagne

    Noch immer ist das Thema »#Käfighaltung« nicht erledigt. Das Bundesverfassungsgericht hat schon im Jahr 1999 festgestellt, dass die Haltung von Legehennen in herkömmlichen und ausgestalteten Käfigen tierquälerisch ist und abgeschafft werden muss. Die Eier-Industrie hat daraufhin mit dem »Kleingruppen«-Käfig ein neues System geschaffen, das den Grundbedürfnissen der Hennen ebenfalls nicht gerecht wird.

    Auch wenn es mit 2025 (in Härtefällen 2028) nun ein konkretes Ausstiegsdatum für die Käfighaltung gibt, verliert unsere Initiative nicht an Bedeutung. Denn bis zum Ausstieg ist es noch ein langer Weg und die Lebensmittelindustrie importiert nach wie vor Käfigeier als Zutat. Daher werden wir unsere Arbeit fortsetzen und Unternehmen weiterhin davon überzeugen, auf Käfigeier und -eiprodukte zu verzichten.
    Nur ein erster Schritt

    Von Käfig- auf Boden-, Freiland- oder Biohaltung zu wechseln, ist nur ein erster Schritt. Leider sind die Bedingungen in diesen alternativen Haltungsformen meistens deutlich schlechter als VerbraucherInnen das erwarten. Wir nutzen deshalb die Gespräche mit der Lebensmittelwirtschaft auch, um pflanzliche Ei-Alternativen vorzustellen und diese als beste Lösung zu bewerben.

      Pauvres poulets - Une géopolitique de l’#oeuf

      Plus de 90 % des oeufs consommés en France et en Allemagne proviennent d’#élevages_intensifs. Enquête sur le marché européen de l’oeuf et du poulet, tentaculaire, opaque et parfois peu respectueux de l’animal.

      Nous consommons en moyenne 230 œufs par an. Malgré un intérêt déclaré pour le bien-être animal, un grand nombre de personnes optent pour des œufs à bas prix. Si les conditions d’élevage des #poules_pondeuses restent mal connues, plus de 90 % des œufs consommés en France et en Allemagne proviennent d’élevages intensifs, que ce soit en #cage, au #sol (dans des hangars sans accès à l’extérieur), en #plein_air ou même #bio. En France, l’#élevage_en_cage – officiellement banni depuis 2012 par Bruxelles – représente encore 69 % de la production, et les conditions d’élevage au sol, polluant et peu respectueux des gallinacés, ne sont guère plus enviables…

      Conditions indignes
      Alors que le consommateur peut choisir l’origine des œufs en coquille, celle des œufs entrant dans la composition de gâteaux du commerce ou cuisinés, à la cantine ou au restaurant, s’avère plus difficile à contrôler : souvent importés, ils proviennent d’élevages en cage.   • C’est vrai que la période est un peu particulière et les réseaux sociaux me donnent l’impression que les centres d’intérêt sont concentrés à 90 % sur le coronavirus, ce qui est légitime, on a le droit de calmer nos angoisses comme on veut y compris en ne lisant QUE sur l’épidémie.

    Je dis ça parce que pour visionscarto, nous avons beaucoup de projets en cours de préparation (et même prêts) que nous aimerions publier bien que ça n’ai rien à voir avec la période actuelle, mais plutôt le monde d’avant. Alors nous poursuivons la publication en sachant très bien que beaucoup n’ont pas « plus de temps qu’avant » mais plutôt moins vu qu’il faut s’occuper de la logistique, des kids, du rangement, du ménage, du ravitaillement, de la bouffe, de l’école... mais bon.

    Nous commençons à publier les archives photographiques, que nous avons regroupé par petites histoires, par petites expériences, à propos de lieux où d’événements insolites, géographiques ou historiques que le hasard à mis sur notre chemin au cours des trois ou quatre dernières décennies.

    L’idée est aussi de proposer une manière de garder les traces de sociétés qui s’effacent. Dans quelques années, que restera-t-il de cette mémoire quand ces structures auront été détruites ?

  • Greece to extend border fence over migration surge

    Greece will extend its fence on the border with Turkey, a government source said Sunday (8 March), amid continuing efforts by migrants to break through in a surge enabled by Ankara.

    “We have decided to immediately extend the fence in three different areas,” the government source told AFP, adding that the new sections, to the south of the area now under pressure, would cover around 36 kilometres (22 miles).

    The current stretch of fence will also be upgraded, the official added.

    Tens of thousands of asylum-seekers have been trying to break through the land border from Turkey for a week after Ankara announced it would no longer prevent people from trying to cross into the European Union.

    A police source Sunday told AFP that riot police reinforcements from around the country had been sent to the border in recent days, in addition to drones and police dogs.

    There have been numerous exchanges of tear gas and stones between Greek riot police and migrants.

    Turkey has also bombarded Greek forces with tear gas at regular intervals, and Athens has accused Turkish police of handing out wire cutters to migrants to help them break through the border fence.

    The Greek government over the weekend also released footage which it said showed a Turkish armoured vehicle assisting efforts to bring down the fence.

    “Parts of the fence have been removed, both by the (Turkish) vehicle and with wire cutters, but they are constantly being repaired,” local police unionist Elias Akidis told Skai TV.

    Turkey has accused Greek border guards of using undue force against the migrants, injuring many and killing at least five.

    The government in Athens has consistently dismissed the claim as lies.

      According to a report by daily Elftheros Typos, Greece’s Plan B aside from the fence extension is the presence of about 4,000 police officers and soldiers in parallel patrols, helicopters, unmanned aircraft, message broadcasting, cameras for audio-video.

      A Greek Army – Greek Police “joint operations center” is to be established in Nea Vryssa.

      According to the daily more than 1,000 soldiers, two commandos squads, 1,500 police and national guards are currently operating in the Evros area.

      Petsas underlined that the Greek government has changed its policy because there is a national security issue at the moment.

      He reiterated the new policy saying that “no one will cross the border.”

      Greece is strengthening ifs defense and is preparing for a possible new wave of migrants at its Evros border.       Speaking to nationalist Akit TV on Wednesday, Cavusoglu claimed that Greece used “inhumane” behavior towards the migrants who want to cross into the country.

      Also Interior Minister Suleyman Soylu had threatened that the migrants will be allowed to leave Turkey again once the pandemic was over.

      The construction of a new fence on northeastern Greece’s Evros land border with Turkey will be completed in eight months, according to Citizens’ Protection Minister Michalis Chrysochoidis, speaking in Parliament on Monday.

      The border fence project has a total budget of 62.9 million euros and has been undertaken by a consortium put together by four construction companies.

      It will have a total length of 27 kilometers and eight elevated observatories will be constructed to be used by the Hellenic Army.

      Moreover, the existing fence will be reinforced with a steel railing measuring 4.3 meters in height, instead of the current 3.5 meters.

    • In post-pandemic Europe, migrants will face digital fortress

      As the world begins to travel again, Europe is sending migrants a loud message: Stay away!

      Greek border police are firing bursts of deafening noise from an armored truck over the frontier into Turkey. Mounted on the vehicle, the long-range acoustic device, or “sound cannon,” is the size of a small TV set but can match the volume of a jet engine.

      It’s part of a vast array of physical and experimental new digital barriers being installed and tested during the quiet months of the coronavirus pandemic at the 200-kilometer (125-mile) Greek border with Turkey to stop people entering the European Union illegally.

      A new steel wall, similar to recent construction on the US-Mexico border, blocks commonly-used crossing points along the Evros River that separates the two countries.

      Nearby observation towers are being fitted with long-range cameras, night vision, and multiple sensors. The data will be sent to control centers to flag suspicious movement using artificial intelligence analysis.

      “We will have a clear ‘pre-border’ picture of what’s happening,” Police Maj. Dimonsthenis Kamargios, head of the region’s border guard authority, told the Associated Press.

      The EU has poured 3 billion euros ($3.7 billion) into security tech research following the refugee crisis in 2015-16, when more than 1 million people – many escaping wars in Syria, Iraq and Afghanistan – fled to Greece and on to other EU countries.

      The automated surveillance network being built on the Greek-Turkish border is aimed at detecting migrants early and deterring them from crossing, with river and land patrols using searchlights and long-range acoustic devices.

      Key elements of the network will be launched by the end of the year, Kamargios said. “Our task is to prevent migrants from entering the country illegally. We need modern equipment and tools to do that.”

      Researchers at universities around Europe, working with private firms, have developed futuristic surveillance and verification technology, and tested more than a dozen projects at Greek borders.

      AI-powered lie detectors and virtual border-guard interview bots have been piloted, as well as efforts to integrate satellite data with footage from drones on land, air, sea and underwater. Palm scanners record the unique vein pattern in a person’s hand to use as a biometric identifier, and the makers of live camera reconstruction technology promise to erase foliage virtually, exposing people hiding near border areas.

      Testing has also been conducted in Hungary, Latvia and elsewhere along the eastern EU perimeter.

      The more aggressive migration strategy has been advanced by European policymakers over the past five years, funding deals with Mediterranean countries outside the bloc to hold migrants back and transforming the EU border protection agency, Frontex, from a coordination mechanism to a full-fledged multinational security force.

      But regional migration deals have left the EU exposed to political pressure from neighbors.

      Earlier this month, several thousand migrants crossed from Morocco into the Spanish enclave of Ceuta in a single day, prompting Spain to deploy the army. A similar crisis unfolded on the Greek-Turkish border and lasted three weeks last year.

      Greece is pressing the EU to let Frontex patrol outside its territorial waters to stop migrants reaching Lesbos and other Greek islands, the most common route in Europe for illegal crossing in recent years.

      Armed with new tech tools, European law enforcement authorities are leaning further outside borders.

      Not all the surveillance programs being tested will be included in the new detection system, but human rights groups say the emerging technology will make it even harder for refugees fleeing wars and extreme hardship to find safety.

      Patrick Breyer, a European lawmaker from Germany, has taken an EU research authority to court, demanding that details of the AI-powered lie detection program be made public.

      “What we are seeing at the borders, and in treating foreign nationals generally, is that it’s often a testing field for technologies that are later used on Europeans as well. And that’s why everybody should care, in their own self-interest,” Breyer of the German Pirates Party told the AP.

      He urged authorities to allow broad oversight of border surveillance methods to review ethical concerns and prevent the sale of the technology through private partners to authoritarian regimes outside the EU.

      Ella Jakubowska, of the digital rights group EDRi, argued that EU officials were adopting “techno-solutionism” to sideline moral considerations in dealing with the complex issue of migration.

      “It is deeply troubling that, time and again, EU funds are poured into expensive technologies which are used in ways that criminalize, experiment with and dehumanize people on the move,” she said.

      Migration flows have slowed in many parts of Europe during the pandemic, interrupting an increase recorded over years. In Greece, for example, the number of arrivals dropped from nearly 75,000 in 2019 to 15,700 in 2020, a 78% decrease.

      But the pressure is sure to return. Between 2000 and 2020, the world’s migrant population rose by more than 80% to reach 272 million, according to United Nations data, fast outpacing international population growth.

      At the Greek border village of Poros, the breakfast discussion at a cafe was about the recent crisis on the Spanish-Moroccan border.

      Many of the houses in the area are abandoned and in a gradual state of collapse, and life is adjusting to that reality.

      Cows use the steel wall as a barrier for the wind and rest nearby.

      Panagiotis Kyrgiannis, a Poros resident, says the wall and other preventive measures have brought migrant crossings to a dead stop.

      “We are used to seeing them cross over and come through the village in groups of 80 or a 100,” he said. “We were not afraid. … They don’t want to settle here. All of this that’s happening around us is not about us.”

      On Monday, the Associated Press (AP) news agency had reported (https://apnews.com/article/middle-east-europe-migration-technology-health-c23251bec65ba45205a0851fab07e) that police in Greece plan to deploy a long-range sound cannon at the external border with Turkey in the future. The device, mounted on a police tank, makes a deafening noise with the volume of a jet engine. It is part of a system of steel walls that is being installed and tested along with drones on the 200-kilometre border with Turkey for migration defence. The vehicle, made by the Canadian manufacturer #Streit, comes from a series of seized „#Typhoons“ (https://defencereview.gr/mrap-vehicles-hellenic-police) that were to be illegally exported to Libya via Dubai (https://www.cbc.ca/news/politics/streit-libya-un-1.3711776).

      Yesterday, AP reported again on this (https://apnews.com/article/middle-east-europe-migration-government-and-politics-2cec83ae0d8544a719a885a). According to Jahnz, the Commission has „noted with concern“ the installation of the technology and is requesting information on its use. Methods used in EU member states would have to comply with European fundamental rights, including the „right to dignity“. The right to asylum and the principle of non-refoulement in states where refugees face persecution must also be respected.

      The Commission’s outrage is anything but credible. After Turkish President Recep Tayyip Erdoğan used refugees to storm the Turkish-Greek border in March 2020, Commission President Ursula von der Leyen travelled to the border river Evros before the start of a Frontex mission and declared her solidarity there. Literally, the former German Defence Minister said (https://ec.europa.eu/commission/presscorner/detail/en/statement_20_380): „I thank Greece for being our European shield“.

      Commission funds research on border surveillance

      Also yesterday, the Commission-funded #ROBORDER project (https://cordis.europa.eu/project/id/740593/de) said in a statement (https://roborder.eu/2021/06/03/new-collaboration-with-borderuas-project) that it is now cooperating with the #BorderUAS project (https://cordis.europa.eu/project/id/883272/de). Both are about the use of drones. The police in Greece are involved and the applications are to be tested there.

      The acronym ROBORDER stands for „#Autonomous_Swarm_of_Heterogeneous_Robots_for_Border_Surveillance“. It works with drones on water, on land and in the air. In Greece, for example, a drone is to be used to detect „unauthorised sea border crossing“ (https://roborder.eu/the-project/demonstrators), as well as an aircraft from the #Fraunhofer-Gesellschaft with a surveillance test platform, #radar systems and thermal imaging cameras.

      All drones in ROBORDER are supposed to be able to operate in swarms. They are controlled via a mobile control centre from the German company #Elettronica. This „#Multipurpose_Mission_Support_Vehicle“ (#MUROS) is used to collect all recorded data (https://www.elettronica.de/de/produkte/oeffentliche-sicherheit-integration). The project, which will soon come to an end, will cost around nine million euros, of which the EU Commission will pay the largest share.

      High-resolution cameras on lighter-than-air drones

      The acronym BorderUAS means „#Semi-Autonomous_Border_Surveillance_Platform_with_a_High-Resolution_Multi-Sensor_Surveillance_Payload“. Border authorities, police forces as well as companies and institutes mainly from Eastern Europe and Greece want to use it to investigate so-called lighter-than-air drones.

      These can be small zeppelins or balloons that are propelled by alternative propulsion systems and have a multitude of sensors and cameras. The participating company #HiperSfera (https://hipersfera.hr) from Croatia markets such systems for border surveillance, for example.

      The project aims to prevent migration on the so-called Eastern Mediterranean route, the Western Balkan route and across the EU’s eastern external land border. According to the project description, these account for 58 percent of all detected irregular border crossings. BorderUAS ends in 2023, and the technology will be tested by police forces in Greece, Ukraine and Belarus until then. The Commission is funding the entire budget with around seven million euros.

      Civilian and military drone research

      For border surveillance, the EU Defence Agency and the Commission are funding numerous civilian and military drone projects in Greece.     The report presents a comparative, indicator-based assessment of the refugee integration frameworks in place in 14 countries: Czechia, France, Greece, Hungary, Italy, Latvia, Lithuania, the Netherlands, Poland, Portugal, Romania, Slovenia, Spain and Sweden.

    Conclusions cover the full range of integration dimensions, such as housing, employment, education and aspects of legal integration, and refer to recognized refugees and beneficiaries of subsidiary protection.

    Legal and policy indicators are the focus of analysis, as well as indicators on mainstreaming, coordination and efforts to involve refugees and locals.

    Results are presented in terms of concrete steps that policymakers need to take in order to establish a refugee integration framework in line with the standards required by international and EU law.

    Quatre-vingt-cinq hélicoptères de l’armée de terre américaine vont transiter au cours des prochains jours par la base aérienne de Chièvres (entre Ath et Mons), avant d’aller renforcer le flanc oriental de l’Otan, ont indiqué vendredi plusieurs officiers.

    Ces hélicoptères de différents types – des AH-64E Apache d’attaque et des CH-47F Chinook, UH-60L et M Blackhawk de transport – appartiennent à la « 1 st Combat Aviation Brigade, 1 st Infantry Division » basée à Fort Riley, au Kansas.

    Ils sont arrivés par bateau à Zeebrugge le 29 janvier, où ils ont été rassemblés. Mais seuls six – deux Chinook, trois Blackhawk et un Apache – étaient arrivés vendredi à Chièvres. Ils doivent s’y rassembler avant de quitter la Belgique à destination de l’#Allemagne, la #Lettonie, la #Pologne et la #Roumanie pour un déploiement de neuf mois en Europe dans le cadre de l’opération américaine « #Atlantic_Resolve » (#AOR), visant à renforcer le flanc est de l’Otan face à une Russie considérée comme plus agressive.

    La météo hivernale a ralenti les transferts entre Zeebrugge et Chièvres, mais les militaires américains se refusent à parler de retard.

    « Nous avons pris nos précautions et tous les hélicoptères devraient avoir quitté Chièvres d’ici mercredi » prochain, a indiqué vendredi le colonel John Tiedeman, le commandant de l’une des unités transitant par la Belgique, à quelques journalistes.

    EurAsia Prospective : quelles sont les forces en présence en Lettonie pour les élections européennes de mai 2019 ? Et quels sont leurs points de désaccord ?

    La scène politique lettone est en pleine recomposition, laquelle a été actée à l’occasion des élections législatives qui se sont déroulées le 6 octobre 2018. Le parti européen de centre-droit Unité, au pouvoir depuis 2009, a éclaté quelques mois avant cette échéance et ses successeurs (Nouvelle unité et Par/Pour le développement de la Lettonie) n’ont pas réalisé des scores mirifiques (respectivement 12 et 6 % des voix soit 13 et 8 sièges sur les 100 que compte le Parlement). Le parti social-démocrate réputé russophile La Concorde est, comme lors des deux scrutins législatifs précédents, arrivé en tête (avec 19,8% des voix et 23 députés), tandis que des partis nouvellement apparus ont réalisé de très bons scores : le parti populiste KPL LV a obtenu 14,2% des voix et 16 députés, et le Nouveau parti conservateur (issu du parti nationaliste anti-russe, focalisé sur la lutte contre la corruption) – 13,6% et 16 députés également. Le nouveau Parlement est désormais composé de 7 partis.

    Le journaliste Peter Greste a appris qu’il était en détention pour avoir obtenu la citoyenneté lettone. Ses racines lettones se sont avérées fatales pour lui à cette époque. La Lettonie, en tant que membre de l’Union européenne, a joué un rôle important dans les efforts diplomatiques qui ont abouti à sa libération. Pour lui, c’était comme une nouvelle amitié avec un pays qu’il peut maintenant appeler « chez soi ».

    La Lettonie a appris à vous connaître la première fois au cours de votre emprisonnement. Je suppose que vous connaissiez auparavant vos racines en Lettonie . Quelle est la relation de votre famille avec la Lettonie ?

    Mon père est né à Liepaja. Mon grand-père était un chimiste industriel et dirigeait une usine à Liepaja. Avant l’arrivée des Russes, il rejoignit l’armée allemande. Il a dit à la famille de mon père qu’ils s’éloigneraient le plus possible des communistes, peu importe ce qui se passerait pendant la guerre. Mon grand-père a ensuite été capturé et est décédé dans une prison d’un camp de prisonniers en Belgique. Mais ma grand-mère a ensuite écouté son nom et s’est enfuie en Allemagne avec toute la famille, mais est ensuite venue en Australie en tant que réfugiée. Par conséquent, j’ai toujours eu ce lien avec la Lettonie. Mon père a toujours été actif dans la communauté de la diaspora lettone australienne. Mais je pense toujours plus à moi-même en tant qu’Australien avec un père letton, je n’ai jamais vraiment compris mes racines lettones.

    En 2012, à Noël, nous sommes allés en Lettonie. Et j’ai réalisé que mes racines lettones étaient bien plus profondes que je ne le pensais. Ce que j’ai vu ici semblait m’être familier - langue, culture, nourriture, gens. C’est comme si j’étais à la maison.

    Je voulais donc devenir citoyen de Lettonie. En 1992, j’avais déjà postulé mais je n’ai pas terminé le processus. En prison, j’ai lu le journal dans lequel on m’a présenté comme un journaliste australo-letton, cela m’a impressionné. Il s’est avéré que le gouvernement letton m’a accordé la citoyenneté lettone pendant que j’étais en prison.

    Diriez-vous que le temps passé en prison et tout ce qui s’est passé après cela vous a permis de vous sentir plus proche de la Lettonie ?

    Oui, pour plusieurs raisons. Bien sûr, j’ai senti le soutien du gouvernement letton. Mais quand je suis arrivé ici quelques mois après avoir été emprisonné pour participer à la Journée de la liberté de la presse, j’ai réalisé que j’étais soutenu par le peuple letton. Et je voulais être ici, dire merci. Depuis lors, j’ai beaucoup d’amis et de connaissances.

    Parlez-vous le letton ?

    Juste quelques mots. Je voudrais en savoir plus. Pendant un certain temps, j’étais à l’école en Lettonie, mais en général, la langue est assez difficile à apprendre.

    Suivez-vous toujours la scène politique, avez-vous entendu parler des élections ?

    J’ai pris part à l’élection - j’ai voté en Australie. J’étais très fier de ça. Le système électoral proportionnel en Lettonie est bon car il garantit la diversité des opinions au parlement, mais il crée également des gouvernements instables. Bien assis, il n’y a toujours pas de gouvernement.

    Votre expertise est la liberté de la presse. Avant les élections, nous avons également assisté à une partie d’attaques contre des politiciens. Les journalistes peuvent-ils faire quelque chose pour maintenir des relations saines avec les politiciens ? Ou bien la relation complexe entre ces deux pouvoirs est-elle inévitable ?

    Nous devons vous rappeler que la relation entre les médias et la politique ne sera jamais facile. Lorsque la presse fait son travail - elle doit être maladroite et compliquée, elle n’est jamais à l’aise. Un bon journalisme implique de défier et de questionner le gouvernement. Dans le même temps, les journalistes ont la responsabilité d’être honnêtes, de reconnaître le succès quand ils le sont et de rester sceptiques. Je pense qu’il est possible de gagner des arguments contre ceux qui qualifient les médias de fausses informations. Les journalistes doivent donc travailler davantage ensemble plutôt que de se faire concurrence.

    Que souhaitez-vous pour les 100 prochaines années de la Lettonie ?

    Je souhaite que la Lettonie continue d’être un pays fort, prospère au sein de l’Union européenne. Rien de plus ne semble être souhaitable. J’aimerais voir l’économie croître et les inégalités diminuer.

  • EU border ’lie detector’ system criticised as pseudoscience

    Technology that analyses facial expressions being trialled in Hungary, Greece and Latvia.

    The EU has been accused of promoting pseudoscience after announcing plans for a “#smart_lie-detection_system” at its busiest borders in an attempt to identify illegal migrants.

    The “#lie_detector”, to be trialled in Hungary, Greece and Latvia, involves the use of a computer animation of a border guard, personalised to the traveller’s gender, ethnicity and language, asking questions via a webcam.

    The “deception detection” system will analyse the micro-expressions of those seeking to enter EU territory to see if they are being truthful about their personal background and intentions. Those arriving at the border will be required to have uploaded pictures of their passport, visa and proof of funds.

    According to an article published by the European commission, the “unique approach to ‘deception detection’ analyses the micro-expressions of travellers to figure out if the interviewee is lying”.

    The project’s coordinator, George Boultadakis, who works for the technology supplier, European Dynamics, in Luxembourg, said: “We’re employing existing and proven technologies – as well as novel ones – to empower border agents to increase the accuracy and efficiency of border checks. The system will collect data that will move beyond biometrics and on to biomarkers of deceit.”

    Travellers who have been flagged as low risk by the #avatar, and its lie detector, will go through a short re-evaluation of their information for entry. Those judged to be of higher risk will undergo a more detailed check.

    Border officials will use a handheld device to automatically crosscheck information, comparing the facial images captured during the pre-screening stage to passports and photos taken on previous border crossings.

    When documents have been reassessed, and fingerprinting, palm-vein scanning and face matching have been carried out, the potential risk will be recalculated. A border guard will then take over from the automated system.

    The project, which has received €4.5m (£3.95m) in EU funding, has been heavily criticised by experts.

    Bruno Verschuere, a senior lecturer in forensic psychology at the University of Amsterdam, told the Dutch newspaper De Volskrant he believed the system would deliver unfair outcomes.

    “Non-verbal signals, such as micro-expressions, really do not say anything about whether someone is lying or not,” he said. “This is the embodiment of everything that can go wrong with lie detection. There is no scientific foundation for the methods that are going to be used now.

    “Once these systems are put into use, they will not go away. The public will only hear the success stories and not the stories about those who have been wrongly stopped.”

    Verschuere said there was no evidence for the assumption that liars were stressed and that this translated to into fidgeting or subtle facial movements.

    Bennett Kleinberg, an assistant professor in data science at University College London, said: “This can lead to the implementation of a pseudoscientific border control.”

    A spokesman for the project said: “The border crossing decision is not based on the single tool (ie lie detection) but on the aggregated risk estimations based on a risk-based approach and technology that has been used widely in custom procedures.

    “Therefore, the overall procedure is safe because it is not relying in the risk on one analysis (ie the lie detector) but on the correlated risks from various analysis.”

    The technology has been designed by a consortium of the Hungarian national police, Latvian customs, and Manchester Metropolitan and Leibnitz universities. Similar technology is being developed in the US, where lie detection is widely used in law enforcement, despite scepticism over its scientific utility in much of the rest of the world.

    Last month, engineers at the University of Arizona said they had developed a system that they hoped to install on the US-Mexico border known as the #Automated_Virtual_Agent_for_Truth_Assessments_in_Real-Time, or Avatar.

    • Smart lie-detection system to tighten EU’s busy borders

      An EU-funded project is developing a way to speed up traffic at the EU’s external borders and ramp up security using an automated border-control system that will put travellers to the test using lie-detecting avatars. It is introducing advanced analytics and risk-based management at border controls.

      More than 700 million people enter the EU every year – a number that is rapidly rising. The huge volume of travellers and vehicles is piling pressure on external borders, making it increasingly difficult for border staff to uphold strict security protocols – checking the travel documents and biometrics of every passenger – whilst keeping disruption to a minimum.

      To help, the EU-funded project IBORDERCTRL is developing an ‘intelligent control system’ facilitating – making faster – border procedures for bona fide and law-abiding travellers. In this sense, the project is aiming to deliver more efficient and secure land border crossings to facilitate the work of border guards in spotting illegal immigrants, and so contribute to the prevention of crime and terrorism.

      ‘We’re employing existing and proven technologies – as well as novel ones – to empower border agents to increase the accuracy and efficiency of border checks,’ says project coordinator George Boultadakis of European Dynamics in Luxembourg. ‘IBORDERCTRL’s system will collect data that will move beyond biometrics and on to biomarkers of deceit.’
      Smart ‘deception detection’

      The IBORDERCTRL system has been set up so that travellers will use an online application to upload pictures of their passport, visa and proof of funds, then use a webcam to answer questions from a computer-animated border guard, personalised to the traveller’s gender, ethnicity and language. The unique approach to ‘deception detection’ analyses the micro-expressions of travellers to figure out if the interviewee is lying.

      This pre-screening step is the first of two stages. Before arrival at the border, it also informs travellers of their rights and travel procedures, as well as providing advice and alerts to discourage illegal activity.

      The second stage takes place at the actual border. Travellers who have been flagged as low risk during the pre-screening stage will go through a short re-evaluation of their information for entry, while higher-risk passengers will undergo a more detailed check.

      Border officials will use a hand-held device to automatically cross-check information, comparing the facial images captured during the pre-screening stage to passports and photos taken on previous border crossings. After the traveller’s documents have been reassessed, and fingerprinting, palm vein scanning and face matching have been carried out, the potential risk posed by the traveller will be recalculated. Only then does a border guard take over from the automated system.

      At the start of the IBORDERCTRL project, researchers spent a lot of time learning about border crossings from border officials themselves, through interviews, workshops, site surveys, and by watching them at work.

      It is hoped that trials about to start in Hungary, Greece and Latvia will prove that the intelligent portable control system helps border guards reliably identify travellers engaging in criminal activity. The trials will start with lab testing to familiarise border guards with the system, followed by scenarios and tests in realistic conditions along the borders.
      A mounting challenge

      ‘The global maritime and border security market is growing fast in light of the alarming terror threats and increasing terror attacks taking place on European Union soil, and the migration crisis,” says Boultadakis.

      As a consequence, the partner organisations of IBORDERCTRL are likely to benefit from this growing European security market – a sector predicted to be worth USD 146 billion (EUR 128 bn) in Europe by 2020.

    • AVATAR - Automated Virtual Agent for Truth Assessments in Real-Time

      There are many circumstances, particularly in a border-crossing scenario, when credibility must be accurately assessed. At the same time, since people deceive for a variety of reasons, benign and nefarious, detecting deception and determining potential risk are extremely difficult. Using artificial intelligence and non-invasive sensor technologies, BORDERS has developed a screening system called the Automated Virtual Agent for Truth Assessments in Real-Time (AVATAR). The AVATAR is designed to flag suspicious or anomalous behavior that warrants further investigation by a trained human agent in the field. This screening technology may be useful at Land Ports of Entry, airports, detention centers, visa processing, asylum requests, and personnel screening.

      The AVATAR has the potential to greatly assist DHS by serving as a force multiplier that frees personnel to focus on other mission-critical tasks, and provides more accurate decision support and risk assessment. This can be accomplished by automating interviews and document/biometric collection, and delivering real-time multi-sensor credibility assessments in a screening environment. In previous years, we have focused on conducting the basic research on reliably analyzing human behavior for deceptive cues, better understanding the DHS operational environment, and developing and testing a prototype system.

      Financé depuis 2016 par l’UE, le projet iBorderCtrl fera bientôt l’objet d’un test qui se déroulera durant six mois sur quatre postes-frontière situés en Hongrie, en Grèce et en Lettonie. Il s’avère que chaque année, environ 700 millions de nouvelles personnes arrivent dans l’UE, et les gardes-frontières ont de plus en plus de mal à effectuer les vérifications d’usage.

      Ce projet iBorderCtrl destiné à aider les gardes-frontières n’est autre qu’un détecteur de mensonges reposant sur une intelligence artificielle. Il s’agit en somme d’une sorte de garde frontière virtuel qui, après avoir pris connaissance des documents d’un individu (passeport, visa et autres), lui fera passer un interrogatoire. Ce dernier devra donc faire face à une caméra et répondre à des questions.

      L’IA en question observera la personne et fera surtout attention aux micro-mouvements du visage, le but étant de détecter un éventuel mensonge. À la fin de l’entretien, l’individu se verra remettre un code QR qui déterminera son appartenance à une des deux files d’attente, c’est-à-dire les personnes acceptées et celles – sur lesquelles il subsiste un doute – qui feront l’objet d’un entretien plus poussé avec cette fois, des gardes-frontières humains.

      Le système iBorderCtrl qui sera bientôt testé affiche pour l’instant un taux de réussite de 74 %, mais les porteurs du projet veulent atteindre au moins les 85 %. Enfin, évoquons le fait que ce dispositif pose assez logiquement des questions éthiques, et a déjà de nombreux opposants !
