Il était gendarme, il a démissionné. Avec ces mots, publiés sur un blog de Mediapart : « Nous, policiers et gendarmes, participons à la criminalisation des classes populaires. Les collègues ne cachent pas leur xénophobie. Je pense toujours qu’il ne faut pas laisser ces métiers à des gens de droite. Mais j’ai envie de rejoindre la lutte face à ce système profondément injuste. Ce matin, le dit gendarme était avec nous. Pour nous parler de son geste, de son expérience, de ses déconvenues, de sa colère, de l’esprit de caserne qui règne, et de l’omerta qui plombe. Du regard des gendarmes sur leurs “ennemis” et leurs administrés, du “racisme latent”, de la voie hiérarchique, des démissions en cascade et en catimini.
Avant de le convoquer, on lui a demandé de montrer patte blanche. Fiches de paye, photo de lui en uniformes, il nous a tout montré. Il a quitté la maison pandore après quatre années de service. La causerie fut comme annoncée : passionnante.

À l’origine de son engagement, il y a la foi dans le service public, l’envie de se rendre utile aux autres, d’améliorer le monde à son échelle. La #gendarmerie lui paraît alors le lieu où il pourrait s’épanouir. Bien vite, il déchante. #Témoignage d’un gendarme démissionnaire.
Ex-syndicaliste, fervent défenseur des valeurs humanistes de gauche, notre futur gendarme entre à l’école la fleur au fusil, enthousiaste à l’idée de se fondre dans un collectif dédié à préserver le #bien_commun. Mais l’exaltation des débuts laisse vite place à l’inquiétude.
Fréquenter l’intolérable dès la formation
Les remarques racistes ou sexistes de certains camarades le choquent : “Très rapidement, je me suis senti un peu de côté. On m’a catégorisé comme le le gauchiste de la promotion et fait comprendre que je n’étais pas à ma place.” Outre l’#ambiance_nauséabonde, il faut ajouter les #lacunes d’une #formation qui favorisent toutes sortes d’#abus et de #falsifications dans les procédures : "Faut pas s’étonner de la qualité des #procédures_judiciaires, on nous forme pas. Chacun fait son #micmac”. Pour surmonter les doutes, il faut alors s’accrocher à l’espoir de voir les choses changer à la sortie d’école. Il n’en est rien.
“J’ai été naïf de croire que je pourrais changer les choses” : de la #désillusion à la #démission
Sur le terrain, c’est le même refrain. Non seulement les discours et réflexes problématiques prospèrent, pouvant atteindre des sommets : “un jour, [un collègue] a sorti : “Moi, vous me laissez une arme dans un quartier, je tire à vue, y a pas de souci”, mais quiconque ose les dénoncer se voit vite mis au ban de l’équipe : “Quand on essaie d’en parler avec eux, ils s’en foutent et répètent que c’est comme ça et pas autrement”. Ainsi, toute protestation se heurte au #silence d’une institution au sein de laquelle le racisme et la #violence restent des questions taboues.
Face à cette #inertie, tout ce qu’il restait d’espoir dans la droiture des forces de l’ordre s’épuise. Les positions de notre témoin se radicalisent. Désormais anarchiste, comment rester flic ? “Défendre l’État et en même temps vouloir abolir l’État, c’est un peu compliqué”. Une seule solution : la démission.

"Je m’appelle Laurent Nguyen, j’ai 44 ans, #gardien_de_la_paix et affecté en CRS depuis 12 ans. Moi, j’ai pris la décision d’entrer dans la #police quand j’avais 30 ans. J’avais des idées assez proches de l’#extrême_droite, et pour moi, la #sécurité était la première des #libertés qu’on devait garantir. On a tendance à considérer que les #manifestants sont complices des #casseurs. Et puis c’est une manière de se protéger psychologiquement, de se dire : ’De toutes façons, ils n’avaient qu’à pas être là, il y a un ordre de dispersion, il y a des casseurs. Donc, le #droit_de_manifester, bon, ça fait partie de la loi, effectivement, mais à un moment donné, on ne peut pas avoir des manifs tout le temps. Il y a des gens qui sont élus, bah si vous n’êtes pas contents, c’est comme ça’. J’étais dans ce logiciel-là, ça m’allait très bien.
J’ai été vite déçu en CRS, déjà de ne pas trouver la cohésion que j’espérais trouver. Quand vous arrivez, que vous pensez sauver la France, que vous êtes confrontés aussi au désespoir de certains collègues dans des commissariats qui travaillent dans des conditions abominables. C’est difficile à vivre en tant que policier, ce sentiment d’#impuissance.
J’ai le souvenir d’une mission à #Calais. On intervient un matin très tôt pour évacuer des migrants qui dorment dans la forêt. Et j’ai en face de moi un garçon qui a trois ans, qui a l’âge de mon fils. Et moi, je pense à mon fils, et que tu laisse ton humanité ressortir, tu te dis : ’Quelle #injustice pour cet enfant d’être là, dormir dans une forêt boueuse de #Dunkerque.' C’est pas normal qu’on en arrive là. Moi, j’en suis arrivé à vivre une très profonde #dépression. Je suis passé pas loin de me foutre en l’air. Et donc moi, après avoir vécu cette période, où je prends le choix que mon fils ait un père, bah, qu’est-ce que je peux lui transmettre ?
Au départ du mouvement des #gilets_jaunes, j’ai tout de suite éprouvé de la sympathie pour ces gens, parce que c’étaient des revendications qui semblaient tout à fait légitimes. Je pense que beaucoup de policiers ont ressenti aussi cette sympathie, cette proximité. Il y avait une gêne chez beaucoup de mes collègues, et quand on a eu les premières scènes de violence, qui ont été diffusées dans les médias, moi, j’ai eu le sentiment qu’il y avait une forme de soulagement chez certains policiers, parce que ça leur permettait de régler un petit peu ce #problème_de_conscience en désignant un #ennemi. Moi, qui avait pris parti publiquement au sein de ma compagnie en faveur des gilets jaunes, parce que je défendais leurs revendications qui selon moi étaient justes, j’ai commencé à voir des collègues qui m’ont pris à partie, en me reprochant de soutenir les gilets jaunes, parce que si tu soutiens les gilets jaunes, tu soutiens les casseurs. Vous avez des gens qui ne peuvent même plus offrir des cadeaux de Noël à leurs enfants, qui ne peuvent pas les emmener en vacances, qui perdent leur boulot, qui ne savent pas comment ils vont s’en sortir, qui n’ont plus d’espoir. Est-ce qu’on peut comprendre aussi qu’à un moment donné ils puissent péter les plombs ? Alors il y en a qui disent que #réfléchir, c’est #désobéir, ou alors qu’il ne faut pas avoir d’états d’âme. Mais moi, je ne veux pas me priver de mon #âme, je ne veux pas me priver de ma #conscience, et moi, on m’a souvent reproché d’être un #idéaliste, comme si c’était une tare. Mais aujourd’hui je le revendique. Oui, j’ai des idéaux et aujourd’hui oui, mais idéaux comptent plus que ma #carrière et comptent plus que mon avenir personnel. Si je dois perdre mon boulot, bah, je perdrai mon boulot. C’est trop précieux pour moi de m’être trouvé, d’avoir trouvé mon humanité pour courir le risque de la perdre.

#flic, formellement il ne l’est plus depuis deux ans je crois, ex syndicaliste policier, son discours est rodé de manière à présenter les policiers comme victimes de l’administration policière et de leurs supérieurs.
edit lorsque je ne savais rien de lui, j’avais trouvé son témoignage émouvant, tiens un facho dont le travail ignoble fait évoluer les vues ? là, je vois ces choses comme un marketing qui vise à humaniser la police et me souviens que ces animaux de plateaux sont occupé à faire mentir un dicton adapté au cas ( « flic suicidé à moitié pardonné », winch means : il n’y a pas de pardon qui tienne) en venant se faire aimer. leur pub, c’est un peu comme si il fallait publier du Cantat une fois par semaine. y a un moment où la prise de conscience c’est de fermer sa gueule.

Evros: the brutal face of the European border regime
A group has been stuck for over three weeks on a small islet of the Evros river. Their story includes countless distress-calls, physical attacks, sexual violence, non-assistance when immediate medical aid was needed, and the complete disregard for a European Court of Human Rights ruling, which granted the group interim measures and ordering the Greek state to provide them with assistance. It is another clear example of the brutal reality that people endure at the land border between Türkiye and Greece.
On the 21st of July 2023, a group of people reached out to Alarm Phone. The 52 people – among them several children and elderly people with severe health conditions – told us how they were stuck on a small islet near the village of Lagyna on Greek territory in the middle of the Evros river, which borders Greece and Türkiye. When reaching out to Alarm Phone and calling for help, the people informed us they had already been stuck on the islet for eight days. At 14:19 CEST of the same day, Alarm Phone alerted Greek authorities, as well as Frontex, UNHCR and various NGOs via email about the people in distress, sharing their location and their request for immediate and urgent assistance.
At this point, we did not know that this would be the start of an odyssey lasting over two weeks, with no end in sight, which would include countless emails and calls to authorities, public outcries via social media to mobilise for evacuation, an ignored decision of the European Court of Human rights and ongoing barbaric violence by Greek forces against the group.
On the day after the alert, Greek authorities informed Alarm Phone about joint efforts, together with Frontex, to search for the group, “[…]we would like to inform you that after extensive searches by the Greek Authorities and Frontex join patrols in the location indicated by the coordinates area and also more widely, no human presence was found”. This would not be the last time that Greek authorities claimed to have been unable to find the group despite conducting “extensive searches” for them.
Several days later, on July 26th, the people told us how they had heard car noises the previous day on the Greek side of the river, but that they were still waiting for urgently needed assistance. At the same time, their condition worsened with every day: they reported injuries and various health issues, as well, they told us how everyone’s mental health was rapidly deteriorating in light of the ongoing difficulties they were facing. The violent act of leaving people for days being stuck on an islet not only risks physical injuries, but is a mental torment in and of itself that traumatises people. Already by this point, the non-assistance from Greek authorities and Frontex was causing damage to the people calling for help – but the situation would continue to deteriorate over the coming days.
On July 27th, 08:18 CEST, Greek authorities again claimed to have searched for the people: “[…]we would kindly like to inform you that after extensive searches by the Greek Authorities and Frontex patrol in the location indicated by the coordinates and also more widely, no human presence was found”. This is despite the Evros region being a highly militarized border area, where the EU has invested hundreds of millions of euros into fortifying the border. The technologies deployed in the area include sensors, thermal cameras and drones – but in spite of this, the Greek authorities and Frontex state they are unable to find a group with a clearly indicated location? How embarrassing. While it is clear that their statement is a blatant lie, it is remarkable that Greek authorities and Frontex have reached a point where such obvious untruths have become implicit to their operational activities. To have reached this point, these strategies have to be widely accepted within their ranks and as such demonstrate how the brutal means of deterrence used at the borders of Greece have become normalised, from overt and brutal violence to misinformation and non-assistance. This is particularly true in the Evros region, as demonstrated over the next days in the developments we witnessed for this case.
A day later, on July 28th, the group told us again about activities on the Greek side of the river: the people had spotted a black car parked “on the Greek side” and a drone that was flying over them. Shortly after, they reported being attacked by police and what they described as “mercenaries”: “Police and mercenaries stormed us. They started to hit the world. And now we’re in the water”. They sent us several videos showing the cruel attack.

We immediately informed the authorities about the attack. It is clear: in this highly militarised and controlled border zone, no such attack could have happened without some level of coordination from the authorities – the very same authorities who had been claiming for days that they could not locate the group. After the attack, the people told us how they were shocked and devastated. However, this attack did not signal the end of their suffering. The group told us that after the attack, they were forced back to the same islet as before by Turkish authorities.
Together with the Rule39 Initiative, an application for Interim Measures at the European Court of Human Rights was handed in on August 1st. By this point, we had been in contact with the people for 11 days. Throughout this entire period, the authorities had been aware of the group and their calls for assistance. Despite this, the group’s calls for assistance remained ignored. Moreover, instead of receiving help, the people were violently attacked.

During the morning of August 2nd, the response by the European Court of Human Rights arrived: the court had granted the Interim Measures and ordered Greece to provide food, water and medical assistance. We immediately informed authorities, including Frontex and UNHCR about the decision and reiterated the urgent need of assistance for the group.

During the morning of the 3rd of August, Greek authorities sent another email, claiming once again to have searched for, but not found, the people. At the same time, the people shared videos with us showing themselves loudly screaming for help. In desperation, the group decided to cross the river themselves. This is extremely dangerous – every year dozens of people die in the Evros river, which has strong undercurrents that can drown people. Luckily, they managed to cross the river and arrived safely on the Greek riverbank, which they documented with several videos that they sent to Alarm Phone. They reported talking to two people wearing shirts with “police” written on it. This is when an incredibly violent chapter of their journey started.

Following the news that the group were talking with “police”, Alarm Phone shift teams once again called various border guard and police stations, including the ones at Soufli, Alexandroupolis and Thrace. All our calls went unanswered. In the meantime, the people reported they were put into cars and told us that they feared they would be brought back to Türkiye. The position they shared showed them near Soufli:
We continued to call the authorities, however, they either did not pick up, rejected responsibility – claiming it was outside of their jurisdiction, or refused to give any information.

Shortly after midnight on August 4th, the people reached out to Alarm Phone again. They were pushed back to Türkiye and severely beaten. A woman from the group explained what had happened to them after they were taken in the car:
She told us how, after half an hour in the car, the young men and even some women were severely beaten. The attackers stripped the women of all their clothes and forced the young men’s eyes open to look the undressed women. They then beat the men badly. The woman said the group was worried that two among the attacked men were beaten to death. The attackers even beat the elderly women and told them to return to their country. The group was, again, forced back onto the islet, and reported that there were now several people missing, among them the two men who had been heavily beaten.
The people told us how they were left severely shaken and outraged, desperate to know what happened to their friends who went missing who they fear died. They reported that amongst their group are three year old babies who are understandably extremely psychologically distressed and traumatised by the violent assault of the Greek police. “Please please can we help them. Turkey and Greece have left them in the middle. Do we know where the people who went missing are?”.

We want to know: what has happened to the missing? Who is responsible for the brutal attack and the sexual violence? And what was the role of Frontex in this whole story? How can orders of the European Court of Human Rights just be ignored? And why has help been repeated denied for people who are in urgent need of it?
Not only have the attacks subjected people to overt violence, but the continuous non-assistance has led to many medical emergencies – this includes three elderly people with diabetes in need of medical assistance, an elderly person with circulatory problems in the leg, which were purple on both sides, a pregnant woman who suffered from contractions and was bleeding, and several children who were weak, mentally distressed and badly bitten by mosquitoes. It should also be noted that the group told us how they ran out of food and water days ago and are forced to drink water from the river, which carries with it a risk of poisoning.
Unfortunately, this is not an isolated incident, but instead sees the recurrence of an all too familiar pattern. The incredible level of violence used – which can only be understood as systematized forms of torture and brutalisation– against people on the move is abhorrent. It is illustrative of the dehumanisation implicit to the racist European migration regime. Furthermore, it demonstrates an obvious dysfunctionality of European institutions, where decisions of the European Court of Human Rights are easily ignored by Greece, without consequence. Instead of being forced to take action, Greek authorities merely responded to both Alarm Phone and the ECHR that the people could not be located. And once again, we see how Frontex is involved in a situation which resulted in a brutal pushback.
On August 6th, the people were still stuck on the islet. There were also still in very distressed condition – and one that continues to deteriorate. They expressed their shock and disbelief that an ECHR decision obviously does not count in Greece. They themselves have called 112 over 50 times and written emails to Frontex and Greek authorities – but instead of receiving much needed assistance, have been subject to repeated and vicious attacks.

In the early hours of the morning on August 7th, the group reached out to us again to report another attack, telling us that “Mercenaries came upon us while we were asleep [on the islet], and we were sent back to Turkey”. They then told us how they were picked up by the Turkish army, who is forcing them back into Greece. The group was incredibly distressed, commenting that they have “become a football between Greek and Turkish army.” As the situation continues with no end in sight, and the people, who are in dire need of urgent medical assistance, are pushed back and forth across the river by Greek and Turkish forces, we again make it clear, these attacks must end and the people be given the help they so urgently need.
We, along with the group currently stranded on the islet, are shocked and outraged – even though we witness such crimes and attacks against people on the move almost daily, and with increasing intensity. We will continue to fight against the normalisation of such violence and will never forgive the ones responsible for it. While Greece tries to cover up the mass murder of Pylos, for which the Hellenic Coast Guard is responsible, the real and merciless face of the Greek border regime remains clearly visible in the Evros region, as too does the complicity of the EU.

Il ministero dell’Interno condannato a risarcire un respinto a catena in Bosnia
Il Tribunale di Roma ha accertato l’illegittimità delle “riammissioni” al confine orientale, ricostruendo il “nesso causale” tra respingimenti e trattamenti inumani. Il Viminale deve farsi carico del danno inflitto a un cittadino pakistano richiedente asilo. Decisivo il lavoro di rete tra attivisti, Ong e avvocati. Una decisione attualissima
Il ministero dell’Interno è stato condannato dal Tribunale di Roma a pagare 18.200 euro a titolo di risarcimento nei confronti di A., cittadino originario del Pakistan in fuga dal Paese, per averlo prima fermato a Trieste e poi respinto in Slovenia e a catena verso la Croazia e la Bosnia ed Erzegovina. Nonostante avesse manifestato la volontà di domandare protezione internazionale. Cento euro per ogni giorno trascorso tra la “riammissione” in Slovenia avvenuta a metà ottobre 2020 e il rientro in Italia nell’aprile 2021, come prevede la giurisprudenza comunitaria e nazionale su casi assimilabili.
La decisione della giudice Damiana Colla del 9 maggio è estremamente rilevante non soltanto perché “accerta e dichiara l’illegittimità” delle riammissioni informali attive da parte italiana ma soprattutto perché inchioda l’”evidente nesso di causalità” tra l’operato della polizia italiana e il “danno subito” da A.. “La lesione del diritto d’asilo e i trattamenti inumani -scrive infatti la giudice- sono stati la diretta conseguenza della riammissione informale del ricorrente in Slovenia da parte delle autorità di frontiera di Trieste”.
La decisione ottenuta dalle avvocate Caterina Bove e Anna Brambilla dell’Asgi, commenta la stessa Associazione per gli studi giuridici sull’immigrazione, “è stata il frutto di un lavoro di rete che ha visto coinvolti diversi soggetti attivi nel contrasto alle violenze verso le persone in movimento attivi lungo la rotta balcanica, tra i quali la rete RiVolti ai Balcani (in particolare Gianfranco Schiavone e Agostino Zanotti), la giornalista Elisa Oddone, la Ong ‘Lungo la rotta balcanica’, l’associazione Pravni center za varstvo človekovih pravic in okolja – Legal Centre for the Protection of Human Rights and the Environment (Pic, in particolare Ursa Regvar), il progetto Medea dell’Asgi, Ics Ufficio Rifugiati, Linea d’ombra, il Centro per la Pace di Zagabria, Anela Dedic e tutti gli attivisti e attiviste che agiscono per la tutela per i diritti umani in Bosnia ed Erzegovina e lungo le rotte percorse dalla persone in transito”.
Nuove ombre si allungano su una prassi che i governi europei intendono invece elevare sempre più a norma “guida” della brutale gestione delle frontiere, come dimostra l’accordo al Consiglio europeo Giustizia e Affari interni dello scorso 8 giugno sui regolamenti in tema di gestione dell’asilo e della migrazione e delle procedure.
Non si tratta di un’ordinanza che guarda a un passato ormai superato o a una pagina triste nel frattempo voltata: se è vero infatti che l’Italia ha condotto i respingimenti verso la Slovenia per tutto il 2020 e li ha sospesi nel 2021, è noto che da fine 2022 il nuovo governo abbia annunciato di volerli riprendere (con “risultati” incerti di cui abbiamo già scritto). Il tutto nonostante il precedente dell’ordinanza cautelare del Tribunale di Roma a firma della giudice Silvia Albano, emessa nel gennaio 2021 a fronte del ricorso promosso sempre dalle avvocate e socie Asgi Caterina Bove e Anna Brambilla (la vicenda è ben raccontata nel film “Trieste è bella di notte” dei registi Andrea Segre, Stefano Collizzolli e Matteo Calore).
La storia di A. ricostruita nella decisione di Roma è tanto forte quanto emblematica. La sua fuga dal Pakistan inizia nel 2018, quand’è ferito in un attacco del gruppo terroristico Tehrik-i-Taliban Pakistan. Sopravvissuto, e temendo ritorsioni da ambo le parti (estremisti ed esercito cui apparteneva), decide di scappare. Resta per un anno in Turchia e per tre volte prova a entrare in Grecia, nell’Unione europea. Al terzo tentativo riesce, attraversando poi la Macedonia del Nord, la Serbia e arrivando nell’estate 2019 in Bosnia ed Erzegovina.
Per nove volte è respinto dalle polizie croate e per tre da quelle slovene. Il primo ottobre 2020, a “riammissioni informali attive” ormai a pieno regime da parte italiana, gli riesce il “game” che lo porterà a Trieste nella mattinata del 17 ottobre. Qui però alcuni militari lo fermano quasi subito insieme ad altre quattro persone. Finiscono tutti in una stazione di polizia dove sono visitati e gli vengono fatti firmare fogli non tradotti dal contenuto oscuro. A. riferisce però agli agenti di voler chiedere asilo ma questi lo “affidano” alla polizia slovena. Non ha niente in mano: “informale” vuol dire infatti respinto senza lo straccio di un provvedimento scritto, motivato, impugnabile, cioè senza convalida dell’autorità giudiziaria, senza diritto a un ricorso effettivo. A riprova di quanto sia basso e surreale il dibattito sul garantismo in Italia.
È così che A., con l’etichetta fasulla di “cittadino extraeuropeo entrato irregolarmente” e non invece di richiedente asilo, si fa una notte in una stazione di polizia slovena e il giorno dopo si vede “consegnato alle autorità croate e da queste respinto in Bosnia con metodi violenti, comprese percosse”, sempre per citare il giudice di Roma.
Alla fine della catena lo attende la Bosnia ed Erzegovina. Nel caso di A. è l’insediamento informale di Vedro Polje, poco distante da Bihać, nel Nord-Ovest del Paese. Per via delle “degradanti condizioni di vita al campo”, come si legge nell’ordinanza che ha condannato il Viminale, A. decide di riprovarci. Lì non può rimanere. Ce la fa, di nuovo, perché “frontiere chiuse” è uno slogan vuoto, e ad aprile del 2021 torna nell’Italia che lo aveva illegalmente respinto. Tre mesi prima, come detto, la giudice Albano del Tribunale di Roma aveva già sanzionato il ministero dell’Interno per le stesse riammissioni (caso specifico diverso, naturalmente). A., memore del precedente respingimento, abbandona in fretta Trieste e raggiunge Brescia. Il 10 maggio fa quella domanda d’asilo che gli era stata negata dalla polizia italiana qualche mese prima e a tre giorni da Natale si vede riconoscere lo status di rifugiato. Ma non gli suona come un lieto fine quanto lo sprone a chieder giustizia per quel respingimento illegale subìto.
Il 31 dicembre 2021 fa perciò ricorso. Il ministero dell’Interno si costituisce in giudizio il 27 settembre 2022 sostenendo che no, non si sarebbe trattato di un’espulsione collettiva vietata dal diritto internazionale ed europeo, che l’intera procedura si sarebbe svolta nel rispetto dei diritti umani fondamentali delle persone coinvolte, che la pratica sarebbe stata pienamente legittima e che il danno subito dal ricorrente (cioè A.) non sarebbe stato dimostrato.
Il Tribunale di Roma dà però torto a Roma e ragione ad A. e alle avvocate Bove e Brambilla, facendo così squagliare la tesi difensiva del Viminale come il sole fa con la neve. “Il trattamento che il ricorrente ha descritto di aver subito da parte delle autorità di frontiera italiane al momento del suo primo ingresso a Trieste […] è stato pienamente provato in giudizio”, scrive la giudice Colla. Dalla manifestazione della volontà di chiedere protezione alla presa in consegna da parte delle autorità slovene. È documentata anche la catena: la detenzione in Slovenia al Centro per stranieri di Veliki Otok, nella Postumia (Carniola interna), e la successiva riammissione in Croazia. Fino alla Bosnia. Nessun alibi quindi per il Viminale, che della mancata prova dell’arrivo in Italia dei respinti ne ha fatto fino a oggi un leitmotiv. Questa volta non gli è riuscito nascondere la mano.
Nella “jungle” di Vedro Polje, dove si trova a inizio 2021, A. ha per fortuna incontrato la giornalista Elisa Oddone e l’operatore sociale Diego Saccora dell’associazione “Lungo la rotta balcanica” (e tra le anime della rete RiVolti ai Balcani). Oddone, che stava curando un reportage per Al Jazeera ed NPR, raccoglie la testimonianza di A. e fa da primo contatto-ponte con le avvocate Bove e Brambilla. Anche Saccora confermerà in Tribunale più incontri con A.. A Vedro Polje infatti l’operatore sociale e ricercatore sul campo portava assistenza e beni di prima necessità. Non solo: lo accompagna di persona presso uno studio notarile di Bihać “per conferire mandato agli attuali difensori al fine di esperire ricorso avverso la riammissione in Slovenia”. A dimostrazione che il supporto incisivo alle persone in transito calpestate dai governi europei alle frontiere può assumere le forme più svariate, e che l’aiuto più distante dalla solidarietà istituzionalizzata può passare persino dalla ceralacca di un notaio. Quante pagine gravi e paradossali faranno scrivere ancora le politiche europee?
Oddone e Saccora raccontano per filo e per segno al giudice le condizioni proibitive in cui si trovava all’epoca A. insieme ad altri. Riparati nei boschi, con la temperatura fino a venti gradi sotto zero di un inverno bosniaco, senz’acqua, senza accoglienza per via della chiusura dei due campi locali più grandi, praticamente senza cibo, stretti tra “ronde” di cittadini locali ostili e “possibili furti da parte di altri gruppi di richiedenti asilo, alla ricerca di quanto necessario alla sopravvivenza”.
Secondo il Tribunale di Roma la riammissione “informale” di A. da parte dell’Italia avrebbe “contraddetto” le “norme di rango primario, costituzionale e sovranazionale, le quali, evidentemente, non possono essere derogate da un accordo bilaterale intergovernativo (del 1996, ndr) non ratificato con legge”.
“La Direttiva 2008/115/CE non legittima affatto, anzi contrasta con la descritta pratica di riammissione informale posta in essere dal governo italiano -chiarisce la giudice Colla-. Infatti, sebbene tale direttiva (al suo art. 6, par. 3) consenta agli Stati membri di riammettere nello Stato confinante di provenienza senza una specifica decisione di rimpatrio, qualora sussistano accordi bilaterali tra gli Stati interessati già vigenti alla data di entrata in vigore della direttiva stessa (essendo tali accordi invece non più consentiti nella vigenza della stessa), tuttavia, nell’esecuzione dell’accordo, lo Stato italiano è comunque vincolato dalla normativa interna anche costituzionale (art 13 Cost.), nonché dal diritto sovranazionale, alla stregua del quale lo Stato ha il dovere di accertare la situazione concreta nella quale la persona riammessa verrà a trovarsi, con particolare riferimento all’eventualità di una violazione dei suoi diritti fondamentali (che si prospettava nel caso di specie secondo le informazioni largamente disponibili). Soprattutto poi, la riammissione informale non può mai essere applicata nei confronti di una persona che manifesti l’intenzione di chiedere asilo, come nella specie accaduto”.
Oltre al regolamento 604/2013 (Dublino III), l’Italia, nella foga di respingere, avrebbe persino violato lo stesso accordo bilaterale con la Slovenia. L’articolo due prevede infatti che ciascuna parte, su richiesta dell’altra, “si impegna a riammettere sul proprio territorio il cittadino di uno Stato terzo che non soddisfa le condizioni di ingresso o di soggiorno nel territorio dello Stato richiedente, non potendosi evidentemente considerare in tale situazione chi abbia espresso la volontà di chiedere protezione”. Proprio come A..
A titolo di aggravante per le autorità italiane, segnala poi il Tribunale elencando corposa bibliografia, c’è anche il fatto che queste erano “perfettamente” a conoscenza -“o almeno trovandosi nella condizione di avere perfetta conoscenza”- “delle violazioni cui i respinti sarebbero stati esposti in Slovenia”, così come in Croazia, per non parlare delle condizioni orribili in Bosnia ed Erzegovina, denunciate anche dalla commissaria per i diritti umani del Consiglio d’Europa Dunja Mijatović.
A maggior ragione dopo le tredici pagine dell’ordinanza del Tribunale di Roma nessuno potrà dire “non sapevo”. Nel buio spicca il “lavoro di rete per contrastare le violazioni”, come lo chiamano le avvocate Bove e Brambilla. “La decisione è un importante risultato non solo perché ribadisce l’illegittimità della condotta posta in essere dalle autorità italiane -concludono- ma perché valorizza, anche attraverso l’assunzione della testimonianza diretta di Saccora e Oddone, l’impegno di tante persone che si impegnano a denunciare e contrastare le violazioni dei diritti delle persone in transito”.

#Urgent! Two #Kurdish #refugees have reportedly been stranded in the buffer zone on the #Greek-#Turkish #border for three days. One of them is called Serhat Karadeniz, who communicated their situation to his family in #Turkey by phone. His father Hüseyin Karadaniz told me about the desperate situation of the two refugees. He also told me that the two refugees want to apply for asylum in #Greece, because they are fleeing political persecution in Turkey and would face political prison charges if they returned. Reportedly, the two refugees have been without food and water for three days and are experiencing health problems due to the cold. According to the last information, that the two Kurdish refugees are in the buffer zone in the Feres region, calling for urgent help from the Greek authorities and the United Nations to receive their asylum requests.

Against precariousness in higher education : 2023 is happening : Updates and Outlook
Dear Supporters,
In summer 2022 we celebrated a major success: the Swiss National Council voted in support of our demands to take steps towards a more sustainable academic system. We are eagerly awaiting the fruits of this decision, but national politics takes time. Meanwhile, a lot is happening within the different institutions of higher education. As the cantons and the universities themselves have a high autonomy in the Swiss federal political landscape, this work at the local level is extremely important. Here is a short overview on some of the local developments:
– After years of hard work, the mid-level staff association in Zurich reached a breakthrough: The UZH is creating new permanent research and teaching positions. Sustainable working conditions and stable perspectives are feasible in Swiss academia and will benefit everyone, in particular the institutions themselves. Additionally, the University will grant an increase of protected research time for PhDs. You can find more details about these developments at UZH here.
- In Fribourg, similar developments are happening. More permanent research, teaching and leading administrative positions will be created targeting members of the local mid-level staff association. Discussions on systemically strengthening its members’ voices through increased representation and votes in the university’s by-laws and meetings are currently underway and have received support from several actors involved at university level.
- In Lausanne, the mid-level staff association launched a petition (please sign if you are at UNIL!) for equal working conditions between PhDs on external funding (such as an SNSF funding) and graduate assistants (assistant-e-s diplômé-e-s). The petition aims to reduce the wage gap by doubling the current allowance that SNSF PhD students receive; to guarantee full-time contracts with 70% of protected research time for graduate assistants; and to abolish the practice of multiple successive contracts during the PhD.
- In Basel, an active group of PhD-Students and Post-Docs is pushing for change. The unionized group is working on power abuse, sexual assault and strategies for a fairer working environment. Get in contact here.
- In Geneva, we have recently connected with the Association des Assistant-e-s (ADA) of the Geneva Graduate Institute (IHEID), which, together with the Syndicat Interprofessionnel of Travailleuses et Travailleurs, is participating in the local- and national-level mobilisation against mid-level staff precarity. Great to see that the mobilizations are expanding!
- Actionuni, which is the umbrella association of all our mid-level staff associations, has already provided multiple position papers on the BFI Botschaft / Message FRI 2025-2028 to different institutional stakeholders. They are now preparing for the public consultation period, which will most likely start in June. Actionuni aims to ensure that despite looming cuts to the funding of higher education on a national level, sustainable researcher careers are possible across institutions of Swiss higher education.
We are happy to see that the work of many mid-level staff associations leads to observable change. For the year to come, we need everyone’s effort. If you can, join your local mid-level staff association, join a union or share this newsletter and the petition academia website with any new colleagues at your institute. On our website you can find arguments and resources (for example the 18 reasons for permanent positions), media coverage and our demands for better working conditions in a sustainable academic system.
And most importantly, this year for the very first time the BFI Botschaft / Message FRI – the key document that outlines the focus and funding for higher education on the national level for a four-year period (2025-2028)– will go through a public consultation process. This means that the public has three months to provide feedback on the document. We call on all mid-level staff associations to make use of this opportunity and make their voice heard by responding to it. The consultation period is planned to start in June. Relatives informed us about a group stranded on an islet on #Evros river. The position they sent shows the people on #Greek territory. On the phone, the border guard station of #Soufli promised a quick rescue. We have no direct contact with the group & hope help is on its way!

This seems to be the same islet where people were trapped on in July & August. The ministry announcement states that the coordinates of group ’do not belong to the 🇬🇷 territory’. The 🇬🇷 MoD said it’s crossed by the borderline. Again, this raises the question of non-rescue.

Εβρος : Συναγερμός για ομάδα μεταναστών σε νησίδα – Ανήκει στην τουρκική επικράτεια
Σε έλεγχο που έγινε σήμερα από τις ελληνικές αρχές, δεν εντοπίστηκαν άτομα επάνω στη νησίδα
Για την ύπαρξη περίπου δέκα μεταναστών σε νησίδα του Έβρου ειδοποιήθηκε η Ελληνική Αστυνομία από τη ΜΚΟ « Watch the Med ».
Οι ελληνικές αρχές, σε συνεργασία με την αρμόδια υπηρεσία του Γενικού Επιτελείου Στρατού, εξέτασαν τις συντεταγμένες που τους δόθηκαν και προέκυψε ότι το σημείο δεν ανήκει στην ελληνική επικράτεια.
Σύμφωνα με τη σχετική ανακοίνωση του υπουργείου Προστασίας του Πολίτη, αμέσως ενημερώθηκαν η ΜΚΟ και η Frontex, ενώ ειδοποιήθηκαν με ΝΟΤΑΜ οι τουρκικές αρχές στο τριεθνή σταθμό του Καπετάν Αντρέεβο για την περισυλλογή των μεταναστών.
Σε έλεγχο που έγινε σήμερα από τις ελληνικές αρχές, δεν εντοπίστηκαν άτομα επάνω στη νησίδα.
Δεν είναι γνωστό, πάντως, εάν έγινε περισυλλογή τους από τις τουρκικές αρχές.

« Η Ελληνική Αστυνομία ειδοποιήθηκε χθες (8/12/2022) τις πρώτες πρωινές ώρες από την ΜΚΟ « Watch the Med » για ύπαρξη παράνομων μεταναστών σε νησίδα του Έβρου. Οι ελληνικές αρχές σε συνεργασία με την αρμόδια υπηρεσία του Γενικού Επιτελείου Στρατού εξέτασαν τις συντεταγμένες που τους δόθηκαν.

“On 19 January 2023, the Court (the duty judge) decided, in the interests of the parties and the proper conduct of the proceedings before it, to indicate to the Government of #Greece, under Rule 39, that the applicants should not be removed from Greece and be provided with food, water and adequate medical care as needed until further notice.
The parties’ attention is drawn to the fact that failure of a Contracting State to comply with a measure indicated under Rule 39 may entail a breach of Article 34 of the Convention.”
The #Didymoticho border guards told us that a decision to rescue needs to come from the ministry. When the people called 112, they were told that “the mayor of the area must sign the court decision in order to be evacuated”.
