• Faut-il boycotter Amazon ?

    Ce mois-ci, la tant attendue base de données des sociétés complices de l’entreprise israélienne de colonisation illégale a été publiée par le Bureau du Haut Commissaire aux Droits Humains de l’ONU. Toutes ces sociétés doivent rendre des comptes, mais le Comité National BDS palestinien (BNC) fait remarquer que de nombreuses autres sociétés devraient être incluses dans cette liste, telles que G4S, Hewlett Packard, Caterpillar, Volvo, Heidelberg Cement et Cemex (1).

    Si l’on s’en réfère aux derniers événements, Amazon, société américaine de e-commerce, devrait également figurer sur cette liste et rendre des comptes. On peut même se demander si Amazon ne devrait pas être une nouvelle cible de la campagne internationale de BDS (Boycott, Désinvestissement et Sanctions).

    Amazon collabore depuis longtemps avec Israel Aerospace Industries, société détenue par l’État israélien, qui fabrique des avions et des armes pour l’armée israélienne, ainsi que pour l’armée du Myanmar. Amazon collabore aussi depuis longtemps avec Bank Hapoalim et Bank Leumi, deux banques israéliennes qui figurent sur la « liste de la honte » de l’ONU susmentionnée. Amazon collabore également avec Palantir, entreprise privée américaine qui participe à la déportation de migrants aux États-Unis et au profilage racial des Palestiniens par le gouvernement israélien.

    Enfin et surtout, Amazon offre la livraison gratuite de marchandises dans les colonies illégales israéliennes en Cisjordanie occupée, alors qu’elle fait payer les clients de Cisjordanie qui définissent leur pays comme « Territoires Palestiniens ». En plus de cette discrimination raciale évidente selon le droit international, Amazon ne devrait même pas être autorisée à vendre des marchandises dans des colonies illégales. Ceci équivaut à de la complicité avec un crime de guerre et, puisque aucun organisme international n’est prêt à tenir Israël pour responsable de ses crimes, il est temps pour la société civile de cesser de passer des contrats, de se fournir ou d’investir dans n’importe laquelle de ces sociétés qui sont complices de la politique de l’État d’Israël.

    À la longue liste de crimes qu’on soupçonne chez Amazon, dont la dureté des conditions de travail ou les activités anti-syndicales, on peut maintenant ajouter la complicité avec l’Apartheid israélien. En tant que syndicats du Réseau Syndical International de Solidarité et de Luttes, nous demandons à nouveau qu’Amazon se soumette au droit international et se désinvestisse d’Israël et des sociétés israéliennes.

    En tant que syndicats du Réseau Syndical International de Solidarité et de Luttes, nous sommes solidaires de nos collègues palestiniens du Syndicat Palestinien des Travailleurs du Service Postal (PPSWU) qui ont écrit au PDG d’Amazon Jeff Bezos (2), et avec tous les Palestiniens qui subissent l’occupation militaire israélienne, le blocus, la discrimination ou que l‘on empêche de retourner chez eux. Nous sommes solidaires de toute future action que la société civile palestinienne choisirait de mener, y compris la possibilité d’un large appel à un boycott international de cette honteuse société.

  • Should Amazon be boycotted?

    This month, the long-awaited UN Office of the High Commissioner for Human Rights database of companies that are complicit in Israel’s illegal settlement enterprise was published. All these companies must be held accountable, but the Palestinian BDS National Committee (BNC) points out numerous other companies that should be included in this list, such as G4S, Hewlett Packard, Caterpillar, Volvo, Heidelberg Cement, and Cemex (1).

    According to recent events, Amazon, the American e-commerce company, should also be included in this database, and held accountable. One may even wonder if Amazon should be a new target of the BDS (Boycott, Divestment and Sanctions) international campaign.

    Amazon has a long collaboration with Israel Aerospace Industries, an Israeli state owned company that makes aircraft and weapons supplying the Israeli army, as well as Myanmar’s army. Amazon has another long collaboration with Bank Hapoalim and Bank Leumi, two Israeli banks that are included in the aforementioned UN “list of shame”. Amazon also collaborates with Palantir, a private US firm which participates in the deportation of migrants in the USA, and in the racial profiling of Palestinians by the Israeli government.

    Last but not least, Amazon offers free shipping of goods to Israeli illegal settlements in the occupied West Bank, while charging customers in the West Bank who list their country as “Palestinian Territories”. In addition to this obvious racial discrimination, under international law, Amazon should not even be allowed to sell goods to illegal settlements. This amounts to complicity in a war crime, and since no international body is ready to hold Israel accountable for its crimes, it is time for civil society to stop contracting, procuring from or investing in any of the companies that are complicit with Israeli state policies.

    To the long list of crimes that Amazon is suspected of, including brutal working conditions or anti-union actions, one can now add the complicity with Israeli Apartheid. As trade unions in the International Labour Network of Solidarity and Struggles, we ask again that Amazon complies with international law and divest from Israel and Israeli companies.

    As trade unions in the International Labour Network of Solidarity and Struggles, we stand in solidarity with our Palestinian colleagues in the Palestinian Postal Service Workers Union (PPSWU) who have written to Amazon CEO Jeff Bezos (2), and with all Palestinians under Israeli military occupation, blockade, discrimination or who are prevented to return to their homes. We stand in solidarity with every future action that Palestinian civil society may choose to take, including a possible wide call for an international boycott of this shameful company.

    Update: The Al-Quds Brigades, the armed wing of the Islamic Jihad, has reported that the slain Palestinian was one of its members.

    The Brigades stated that the Palestinian has been identified as Mohammad Ali Hasan an-Na’em , 27, from Khan Younis.

    The slain Palestinian was unarmed and wasn’t even in military attire when the soldiers attacked him, along with many residents, with their bulldozer, and live rounds.

    Updated From Feb 23, 2020, at 10:58: Israeli soldiers shot and killed, on Sunday morning, a young Palestinian man, and injured four, on Palestinian lands, in Khan Younis, in the southern part of the Gaza Strip.

    An Israeli armored bulldozer was filmed repeatedly crushing the body of the slain Palestinian with its blade, then grabbing the corpse with the blade and swinging the body back and forth in the air.

    The Israeli army claimed that its soldiers observed two Palestinians approaching the perimeter fence, before placing an explosive device.

    It alleged that the soldiers then rushed to the scene and fired live ammunition at the two Palestinians, causing the explosive device to explode.

    Israeli officials frequently make outrageous claims about Palestinians they kill, which are often proven later to be false.

    Media sources in Gaza said several Palestinians tried to reach the two Palestinians to provide them with the needed medical care and move them to a hospital, but a military bulldozer sped towards them and drove over the corpse of the slain Palestinian, before scooping it using the bulldozer’s plow.       Saraya Al Quds, the military wing of the Islamic Jihad resistance movement, fired a barrage of rockets at Israel, on Sunday, in retaliation for the Israeli crime of murdering and mutilating Palestinian Muhammad Na’em in eastern Khan Younis in the southern Gaza Strip, Quds News Network (QNN) reports.

      Late Sunday, Israeli warplanes targeted a group of Palestinians, according to an army statement, striking north-west of Beit Lahia in the northern besieged Gaza Strip, with four rockets and a reconnaissance missile.

      The Palestinian Ministry of Health confirmed that four Palestinians were injured by the airstrikes and were evacuated to Ash Shifa hospital in Gaza, no further information was known at the time of reporting.

Dimanche, l’armée israélienne a également frappé ce qu’elle a déclaré être des cibles du JIP en Syrie, où deux morts ont également été confirmés.

      « La situation dégénère alors que nous parlons avec la poursuite de tirs de projectiles depuis Gaza et de frappes aériennes israéliennes en représailles », a souligné l’envoyé de l’ONU.

      « L’équipe des Nations Unies sur le terrain est en contact avec nos homologues égyptiens pour tenter de rétablir le calme. Je saisis cette occasion pour appeler à l’arrêt immédiat des tirs de roquettes et de mortiers qui risquent seulement d’entraîner Gaza dans une autre série d’hostilités sans fin en vue. Le lancement aveugle de roquettes contre des centres de population civile viole le droit international et doit cesser », a-t-il ajouté. (...)

      European Union (EU) Representative in Jerusalem, Sven Kuehn von Burgsdorff said Tuesday that the incident in which an Israeli soldier drove a bulldozer onto Palestinian territory, and dragged the body of a slain Palestinian in Gaza, on Sunday, goes counter to all principles of human dignity, Palestine News Network reported.

      “No one should be witnessing scenes like that one when a military bulldozer drags away a lifeless body. This is something that goes counter to all principles of human dignity and respect,” von Burgsdorff said.

      “The EU has consistently reiterated on numerous occasions, that the destructive cycle of violence and counter-violence has to come to an end,” he said. “De-escalation is now imperative, not least to preserve lives of the citizens of Gaza and to relieve their suffering.”

      Belal al-Naem a été effaré lorsqu’il a vu les images : un bulldozer israélien récupérant, mutilant et laissant pendre le corps d’un Palestinien dans la bande de Gaza. Puis il a découvert qu’il s’agissait du corps de son frère.

      « J’ai subi un double choc, d’abord avant de savoir qu’il s’agissait de mon frère et puis quand j’ai su que c’était lui », confie-t-il à Middle East Eye.

      Le frère de Belal, Mohammed, a été abattu dimanche par des tirs israéliens à Abasan al-Kabira, à l’est de Khan Younès.

      L’armée israélienne prétend que lui et d’autres Palestiniens tentaient de placer un engin explosif à la frontière entre l’enclave assiégée et Israël.

      Ensuite, un bulldozer de l’armée, escorté par un char, est entré en action pour récupérer le corps et ses tentatives ont été filmées.

      Les images du véhicule emportant le corps n’ont pas tardé à devenir virales.

      « Je n’ai pas pu supporter la cruauté [de la vidéo], il y avait un être humain taillé en pièces encore et encore. Cette scène était insoutenable, j’ai prié pour lui et je me suis éloigné », affirme Belal, qualifiant cet acte de « cruauté sans précédent ».

      « Ce n’est pas une façon de mourir pour un être humain, et cela s’est passé sous les yeux du monde entier », ajoute-t-il.

      « Notre famille a vu cela et c’est gravé à jamais dans nos mémoires. »(...)

    Établie en 2016, il aura donc fallu attendre quatre ans pour que l’ONU publie la liste des entreprises qui ont « directement ou indirectement, permis la construction et la croissance des colonies de peuplement, les ont facilitées et en ont profité », autrement dit des entreprises complices du « crime de colonisation », un crime reconnu par la justice française et considéré comme un crime de guerre au regard du droit international. Sa publication avait été entravée par l’administration Trump, et ce n’est sans doute pas un hasard qu’elle intervient après que le mal-nommé « deal du siècle » ait définitivement disqualifié ses auteurs sur la question de la colonisation.

    Mieux vaut tard que jamais, et nous nous réjouissons de la publication d’une telle liste qui ne fait que confirmer ce que les Palestinien..nes et les militant.es du monde entier répètent depuis des années. Montrer du doigt ces entreprises ne suffit plus, et il convient désormais de mettre fin à l’impunité, de faire cesser cette complicité, de faire respecter le droit international, et de faire pression sur ces entreprises si elles ne le respectent pas. Cette liste appelle à des mesures légales et coercitives, ainsi qu’au renforcement de la campagne de Boycott, Désinvestissement et Sanctions (BDS).

    Quelles sont ces 112 entreprises israéliennes et internationales prévenues et donc récidivistes ? Plusieurs sont déjà visées par la campagne BDS à travers le monde, en particulier des entreprises de tourisme (Airbnb, Expedia, TripAdvisor, Booking, eDreams et Opodo), la compagnie nationale israélienne d’eau Mekorot, ou Delta, le concessionnaire exclusif de Puma en Israël.

    Les seules entreprises françaises explicitement citées sont Alstom, Egis et Egis Rail, ciblées par Solidaires et de nombreuses autres organisations (citons entre autres la CGT, la CFDT, Al Haq, l’AFPS, la LDH, la FIDH ou la Campagne BDS France), pour leur implication dans le tramway de Jérusalem. Bien qu’elles se soient retirées d’appels d’offres visant l’extension de ce tramway, la présence de ces entreprises dans la liste de l’ONU prouve qu’elles sont toujours impliquées dans la maintenance du tramway et la coordination du projet, et que la campagne dans laquelle Solidaires est impliquée est plus que jamais justifiée pour faire respecter le droit international.

    La liste des Nations Unies comporte certaines imprécisions. Par exemple, si elle montre du doigt cinq banques israéliennes, elle passe sous silence que ce sont celles dans lesquelles la société d’assurance française AXA investit, et pour lesquelles une campagne de dénonciation menée par Solidaires et sensiblement les mêmes organisations se trouve là encore justifiée au plus haut niveau. De même, si elle cite Altice Europe comme une entreprise néerlandaise complice de la colonisation israélienne, elle passe sous silence qu’il s’agit en fait de la maison mère de la française SFR, ou que le groupe General Mills représente entre autres les marques Häagen-Dazs, Géant Vert ou Yoplait...

    Enfin, le comité national palestinien du BDS souligne de nombreux « oublis » de cette base de données, contre lesquelles des campagnes sont en cours, suite à des implications irréfutables dans des activités commerciales dans ou avec les colonies, citant pêle-mêle Hewlett Packard, Hyundai Heavy Industries, Volvo, Caterpillar, Heidelberg Cement, Cemex, G4S ou Elbit.

    Alors que ces entreprises s’enrichissent impunément aux dépends des Palestinien.nes, il est anormal que ce soient des citoyen.nes qui se voient poursuivi.es pour les avoir dénoncées. Le comité national palestinien du BDS appelle « toutes les institutions publiques, les conseils municipaux, les églises, les syndicats, les organisations culturelles, les universités, les fonds d’investissement et autres, de cesser d’avoir des contrats avec les compagnies sur la liste onusienne de la honte, de faire des achats de ces compagnies ou d’y investir, pour éviter toute complicité avec l’entreprise coloniale d’Israël. »

    Comme dans les années 1980, il convient que la campagne citoyenne de boycott de l’apartheid israélien soit enfin rejointe par les Nations Unies, et le comité national palestinien du BDS voit « la publication de cette base de données comme la première mesure significative et concrète par un organisme onusien pour faire rendre des comptes aux compagnies israéliennes et internationales qui rendent possibles les graves violations des droits palestiniens par Israël et en tirent profit. »

    Nous attendons des entreprises dénoncées, et en particulier françaises, qu’elles respectent la loi et qu’elles cessent immédiatement leur complicité avec le régime d’occupation militaire, de colonisation et d’apartheid israélien. Par la campagne BDS, nous voulons maintenir la pression sur ces entreprises, mais aussi sur le Haut-Commissariat des Nations unies aux droits humains pour qu’il complète et actualise la liste publiée. Solidaires, engagée dans le mouvement BDS pour les droits palestiniens, continuera sa lutte pacifique pour la liberté, la justice, l’égalité, et pour mettre fin à toute complicité avec le régime d’oppression israélien.

    De la Centrafrique à New York, une investigation sur les abus sexuels commis par les collaborateurs de l’ONU et l’impuissance de l’organisation à les combattre.

    « Tout ceci est hautement immoral et en totale contradiction avec notre mission. » En 2004, l’ONU et son secrétaire général, Kofi Annan, affrontaient un vaste scandale d’abus sexuels commis par des militaires et des employés de l’organisation en République démocratique du Congo. Dans la foulée, le conseiller Zeid Ra’ad al-Hussein présentait ses préconisations pour éradiquer le fléau et l’impunité qui l’accompagne : mise en place de cours martiales dans les pays où des casques bleus sont déployés et adoption d’une convention internationale permettant à l’ONU d’engager des poursuites pénales contre son personnel civil. Près de quinze ans plus tard, alors que les États membres s’opposent toujours au morcellement de leur compétence juridictionnelle, l’exploitation et les violences sexuelles perdurent sur les terrains d’opération, comme en Centrafrique. Malgré les mesures déployées (création d’un poste de défenseur des droits des victimes, couvre-feux pour éviter les contacts entre la population locale et les employés des Nations unies en dehors des heures de service, travail de sensibilisation et d’éducation…) et la tolérance zéro prônée par l’actuel secrétaire général, António Guterres, près de cinquante nouvelles plaintes ont été enregistrées l’année dernière.

    Victimes oubliées
    Cette enquête recueille la parole de victimes oubliées – non signalées ou abandonnées par l’organisation –, les tentatives d’explication de responsables onusiens et le témoignage effarant du Français Didier Bourguet, seul civil condamné à ce jour, pour deux viols sur mineures, alors qu’il reconnaît avoir eu des rapports sexuels avec au moins une vingtaine d’enfants. Elle pointe ainsi l’intolérable impunité qui prédomine dans la grande majorité des cas.

      The Code Blue Campaign works to end impunity for sexual abuse by un personnel.


      The UN has a longstanding crisis caused, first, by UN personnel who commit sexual offenses against members of the populations they’re intended to serve and against other UN personnel and, second, by the institution’s response—the policies, procedures, and practices that create and sustain an institutional culture of impunity.

      We have identified three root causes of the UN’s culture of impunity:

      The institution has taken the liberty to manage its crisis internally.

      UN senior managers responsible for responding to and deliberating on individual cases are all rendered non-neutral by the conflicts of interest inherent in their positions: each is simultaneously called upon to represent and defend the best interests of the UN, the rights of the Organization’s accused employees and witnesses, and the rights of claimants.

      UN immunity makes the Organization’s “words and deeds” uniquely impervious to oversight or audit, shielding its functions and functionaries from external scrutiny and effectively negating the freedom of information that is a cornerstone of due process and a necessary precondition to equal justice for all.

      The Code Blue Campaign is concerned with overhauling several UN practices now in place that allow the UN Organization to dismiss and violate claimants’ fundamental rights to due process and neutral justice before the law:

      In addressing claims of “sexual exploitation and abuse” and “sexual harassment and assault” made against UN personnel, UN officials consistently misinterpret, misrepresent, and misapply UN immunity (an important legal protection intended to protect the multilateral work of the world body) to shield individual personnel from accountability and the Organization’s officials from reputational damage.

      The license to manage its sexual abuse crisis internally has evolved in tandem with the linear, largely unplanned growth of the UN system into a sprawling bureaucracy with many dozens of semi-autonomous “entities” that operate in relative isolation with barely monitored and rarely questioned authority accorded the heads.

      This combination of rapid de-centralization and unmonitored, quasi-independence and authority has in turn given rise within the various “entities” to dozens of inharmonious, non-coherent, and often conflicting policies, procedures, and practices for addressing sexual offense claims made against the personnel of those entities.

      The result is a non-system in which claimants and accused UN personnel associated with one entity of the UN Organization are subject to policies and procedures that may bear no resemblance to those followed by other entities of the same UN Organization. The only unifying factors across the system are the root causes of the UN’s culture of impunity for sexual offenses: the internal handling of all cases including those in which crimes beyond the UN’s “jurisdiction” are alleged; the misinterpretation and misapplication of UN immunity; and the inherent conflicts of interest underlying every case.

      The Code Blue Campaign has arrived at these conclusions through years of intense research. We have exposed several cases that illustrate the injustice, the incoherence, the innate and insurmountable conflicts of interest, and the long history of rights violations and abusive treatment by the UN Organization, primarily of victims but also of the accused. We argue that unjust UN policies and practices have, over decades, resulted in a culture of impunity for sexual “misconduct” ranging from breaches of UN rules to grave crimes. This represents a contravention of the UN Charter. Member States must intervene immediately. The General Assembly could end this crisis by divesting the UN Organization of any role in cases of “sexual misconduct,” and delegating the authority instead to an appropriate entity created, staffed by and reporting directly to the Member States, and entirely independent of the Organization.

      Member States have not yet come to the realization that the day of reckoning is approaching. If they do not take the initiative to fully recognize, understand, and solve a problem that has become an attention-getting Achilles heel, the UN’s sexual abuse crisis is likely to reach a pinnacle soon that could hobble the United Nations’ ability and authority to perform any of its functions. The UN could follow in the unenviable footsteps of another enormously powerful, largely secretive global institution whose former heights of moral authority are now universally queried: the Catholic Church.

    • Taking action on sexual exploitation and abuse by peacekeepers: Report of an independent review on sexual exploitation and abuse by international peacekeeping forces in the Central African Republic

      Executive Summary

      I. Introduction

      When peacekeepers exploit the vulnerability of the people they have been sent to protect, it is a fundamental betrayal of trust. When the international community fails to care for the victims or to hold the perpetrators to account, that betrayal is compounded.

      In the spring of 2014, allegations came to light that international troops serving in a peacekeeping mission in the Central African Republic (“CAR”) had sexually abused a number of young children in exchange for food or money (the “Allegations”). The alleged perpetrators were largely from a French military force known as the Sangaris Forces, which were operating as peacekeepers under authorization of the Security Council but not under UN command.

      The manner in which UN agencies responded to the Allegations was seriously flawed. The head of the UN mission in CAR failed to take any action to follow up on the Allegations; he neither asked the Sangaris Forces to institute measures to end the abuses, nor directed that the children be removed to safe housing. He also failed to direct his staff to report the Allegations higher up within the UN. Meanwhile, both UNICEF and UN human rights staff in CAR failed to ensure that the children received adequate medical attention and humanitarian aid, or to take steps to protect other potential victims identified by the children who first raised the Allegations.

      Instead, information about the Allegations was passed from desk to desk, inbox to inbox, across multiple UN offices, with no one willing to take responsibility to address the serious human rights violations. Indeed, even when the French government became aware of the Allegations and requested the cooperation of UN staff in its investigation, these requests were met with resistance and became bogged down in formalities. Staff became overly concerned with whether the Allegations had been improperly “leaked” to French authorities, and focused on protocols rather than action. The welfare of the victims and the accountability of the perpetrators appeared to be an afterthought, if considered at all. Overall, the response of the UN was fragmented and bureaucratic, and failed to satisfy the UN’s core mandate to address human rights violations.

      By examining these failures and recommending reforms to deter future incidents of sexual violence by peacekeepers, this Report provides an opportunity for the UN to chart a new course of action and to undertake meaningful organizational change. If the Secretary-General’s zero tolerance policy is to become a reality, the UN as a whole—including troop contributing countries (“TCCs”)—must recognize that sexual abuse perpetrated by peacekeepers is not a mere disciplinary matter, but a violation of the victims’ fundamental human rights, and in many cases a violation of international humanitarian and criminal law. Regardless of whether the peacekeepers were acting under direct UN command or not, victims must be made the priority.

      In particular, the UN must recognize that sexual violence by peacekeepers triggers its human rights mandate to protect victims, investigate, report and follow up on human rights violations, and to take measures to hold perpetrators accountable. In the absence of concrete action to address wrongdoing by the very persons sent to protect vulnerable populations, the credibility of the UN and the future of peacekeeping operations are in jeopardy.

    Amazon offers free shipping to Israeli settlements in the occupied West Bank while charging customers who list their country as the Palestinian Territories, the Financial Times reported on Friday.

    Amazon’s website states the promotion applies to customers with shipping addresses in Israel on qualifying orders over $49.

    Upon running West Bank addresses listed as Israeli through Amazon’s delivery portal, the FT found that the world’s biggest online retailer offers free shipping to settlements on occupied Palestinian territory, which are deemed illegal under international law.

    Customers who select “Palestinian Territories” as their address, however, are subject to shipping and handling fees upwards of $24, the FT reported.

    Amazon spokesman Nick Caplin told the FT customers within the occupied Palestinian territories can enter their addresses and select Israel as their country to qualify for the promotion. These details are not specified on Amazon’s website.

    When contacted by The New Arab, Caplin chalked the discrepancy up to a “logistical issue” that is “not a sign of any other consideration.”

    Israel has suspended its ties with the United Nations High Commissioner for Human Rights, the Israeli Foreign Ministry (FM) announced on Wednesday, several hours after the UN body published a list of 112 companies that do business in West Bank settlements.

    FM Israel Katz’s office said he ordered the “exceptional and harsh measure” in retaliation for Michelle Bachelet’s office “serving the BDS campaign,” referring to the anti-Israel Boycott, Divestment and Sanctions Movement.

    Katz intends to protect the companies operating in Israel, his office stated.

    He claimed that by publishing the list, the Human Rights Council joined the anti-Israel boycott movement, but stressed that the database is not legally binding.

    Israeli Prime Minister Benjamin Netanyahu also slammed the council and similarly vowed to fight the database, Al Ray Palestinian Media Agency reports. (...)

    The wall-to-wall support for West Bank settlements voiced in Israel on Wednesday in response to the UN human rights office’s release of a list of businesses operating in the settlements shows that the annexation everyone is talking about these days has actually happened de facto long ago.

    Without any dramatic Knesset votes or referendums, and without the need for any favors from the Trump administration, the entire Israeli establishment stood unambiguously on the side of the settlements.

    Granted, Prime Minister Benjamin Netanyahu surprisingly restrained himself from accusing the Office of the UN High Commissioner for Human Rights of anti-Semitism. But he did announce, as is customary among countries that are becoming increasingly internationally isolated, that “If anyone boycotts us, we’ll boycott them.” Israel is already boycotting the International Criminal Court and numerous other multilateral organizations, so adding one more to the list won’t be a big deal.

    Ministers from Netanyahu’s Likud party, including Yariv Levin and Gilad Erdan, were less restrained. They jumped straight into the standard clichés – exploiting and cheapening the Holocaust by accusing the UN of anti-Semitism.

    The prize, however, goes to President Reuven Rivlin. The very president who tries so hard to project a statesmanlike, tolerant, balanced image said that the list is a “shameful initiative reminiscent of dark periods in our history.”

    In other words, publishing an international database about businesses that operate in the settlements – which is illegal according to international law and UN resolutions – is just as bad in Rivlin’s eyes as the Holocaust. It should be pointed out that this list isn’t even accompanied by any actual sanctions or boycotts, much less gas chambers.

    This is also the same president who just recently hosted an impressive phalanx of dozens of world leaders at a conference against anti-Semitism in Jerusalem, where he urged them to protect democracy. Just as the international community was able to unite after World War II to promote a shared goal, he added, it must continue working together today on the basis of shared values.

    But international law and international institutions evidently aren’t democratic enough for him – or perhaps he’s only selectively protective of democracy, when it’s convenient for him.

    The support for de facto annexation of the settlements was also glaringly apparent among members of Israel’s so-called opposition. Kahol Lavan Chairman Benny Gantz said this was “a black day for human rights. The Office of the UN High Commissioner for Human Rights has lost all connection with reality.”

    His partner in the party’s leadership, Yair Lapid, went even farther, calling the high commissioner for human rights – a woman with a long record of achievement who is internationally admired – the “UN commissioner for terrorists’ rights.” He even threated that “when we form a government, we’ll work against them with all our might, with no qualms.” When you recall how Israel actually deals with terrorists, this quote is even more troubling.

    But the most surprising condemnation came from Amir Peretz, chairman of the ostensibly left-wing Labor-Gesher-Meretz joint ticket. “We oppose boycotts, and outrageous and superfluous UN decisions,” he said – although Meretz, which is part of this ticket, has until now actually supported boycotting settlements products. “We’ll work in every forum to repeal this decision and preserve a strong Israeli economy and Israelis’ jobs,” he added, in a statement that aroused unease, to say the least, among what remains of Meretz’s voters.

    This was an official death certificate for the Zionist left in the face of the annexation that has already happened.

    Behind the scenes, official state agencies, headed by the Foreign Ministry, also gave briefings assailing the list’s publication. During these briefings, the term BDS (referring to the boycott, divestment and sanctions movement) was repeatedly thrown around.

    Anyone who still mistakenly thinks that Israel’s war against BDS is aimed against boycotts of Israel as a whole, including within the 1948 armistice lines, ought to sober up. Israel’s intention, as evident from both its legislation and in actions, is unequivocally to protect the settlements against boycotts. The state isn’t interested in the distinction between Israel’s right to exist as a country and the dispute over the settlements; rather, it seeks to blur the borders.

    This was once again made clear by the Israeli bureaucrats who mobilized on Wednesday to assail international law in the name of annexation. With an uncomfortable giggle, one briefer even recited those same accusations of anti-Semitism in his talking points. In the Israel of 2020, official state bodies use BDS and anti-Semitism as synonyms in their campaign to protect the settlement enterprise.

    In recent weeks, following the release of the Trump administration’s peace plan, there have been stormy campaigns on both the right and the left for or against officially annexing the settlements. But what happened on Wednesday proves that this is a sterile debate over mere symbolism. De facto annexation has already happened and continues to happen every day; it is only de jure annexation that’s still being fought over.

    Israel has been treating the settlements as an inseparable part of the country for a long time already. De jure annexation won’t drastically change anything of importance that isn’t already happening on the ground. Israel has already annexed everything all by itself, and doesn’t need U.S. President Donald Trump and his ambassador to Israel, David Friedman. Official recognition is just icing on the cake.

    Où l’on constate que l’intitulé des médias français (dont, évidemment, le Monde), décrivant cette liste comme celle d’entreprises « ayant des activités dans les colonies », « qui continuent de commercer illégalement avec les colonies », est un bel euphémisme : la résolution dénonce des entreprises qui « avaient, directement et indirectement, permis la construction et la croissance des colonies de peuplement, les avaient facilitées et en avaient profité ». On n’est pas dans la simple « présence », mais dans la complicité. Le texte de la résolution précise :

La résolution 31/36 dans laquelle le Conseil des droits de l’homme demandait la création d’une base de données faisait suite au rapport de la mission internationale indépendante d’établissement des faits chargée d’étudier les effets des colonies de peuplement israéliennes sur les droits civils, politiques, économiques, sociaux et culturels des Palestiniens dans le Territoire palestinien occupé, ycompris Jérusalem-Est (A/HRC/22/63). Dans ce rapport, la mission d’établissement des faits constatait que certaines entreprises avaient, directement et indirectement, permis la construction et la croissance des colonies de peuplement, les avaient facilitées et en avaient profité ; au paragraphe 96 du rapport, elle donnait la liste des activités suscitant des préoccupations particulières sur le plan des droits de l’homme (« activités énumérées »). Dans la résolution 31/36, le Conseil a défini comme suit, conformément à la liste établie dans le rapport de la mission d’évaluation, les paramètres des activités visées aux fins de la base de données :
    a) La fourniture d’équipements et de matériel facilitant la construction et l’expansion des colonies de peuplement et du mur, ainsi que des infrastructures associées ;
    b) L’installation d’équipements de surveillance et d’identification dans les colonies de peuplement, le long du mur et aux points de contrôle directement liés aux colonies de peuplement ;
    c) La fourniture d’équipements destinés à la démolition de logements et de propriétés et à la destruction de fermes agricoles, de serres, de vergers d’oliviers et de plantations ;
    d) La fourniture de services d’équipements et de matériel de sécurité à des entreprises exerçant dans les colonies de peuplement ;
    e) L’offre de services et de prestations contribuant à l’entretien et à l’existence des colonies de peuplement, y compris dans le domaine des transports ;
    f) Les opérations bancaires et financières contribuant au développement, à l’expansion et à l’entretien des colonies de peuplement et de leurs activités, y compris les prêts immobiliers destinés à la croissance des entreprises ;
    g) L’utilisation de ressources naturelles, en particulier l’eau et la terre, à des fins commerciales ;
    h) La pollution et le dépôt de déchets dans les villages palestiniens ou le transfert de tels déchets vers les villages palestiniens ;
    i) L’utilisation des profits et des réinvestissements réalisés par les entreprises appartenant en totalité ou en partie à des colons pour développer, élargir et entretenir les colonies de peuplement ;
    j) La captivité des marchés financiers et économiques palestiniens et les pratiques qui mettent les entreprises palestiniennes dans une situation défavorable, notamment les restrictions à la liberté de circulation, les restrictions administratives et les contraintes juridiques.

    L’ONU a publié, mercredi 12 février, une liste de 112 sociétés ayant des activités dans les colonies israéliennes, et considérées ainsi comme complices de l’établissement et du maintien de ces colonies, illégales au regard du droit international.

    « J’ai conscience que ce sujet a été, et continuera d’être, matière à controverse », a déclaré la haut-commissaire aux droits de l’homme de l’ONU, Michelle Bachelet, tout en soulignant que ce rapport se « basait sur des faits ».

    Cette initiative de mise à l’index est sans conséquence légale immédiate, mais vise à sanctionner symboliquement les sociétés faisant affaire avec les colonies israéliennes. Cette liste « ne constitue pas, et n’entend pas constituer, un processus judiciaire ou quasi judiciaire », précise un communiqué des Nations unies, en référence implicite aux craintes israéliennes de la voir servir de base à des boycotts.   • UN evacuates endangered refugee centre in Libya’s Tripoli

    Facility shut down as Turkish ship carrying military support for the GNA docks in Libyan capital.

    The United Nations said on Thursday it was suspending its services at a refugee centre in Libya over safety concerns and was evacuating the facility, as France revealed it had spotted a Turkish vessel delivering a military shipment to the war-torn country.

    Jean-Paul Cavelieri, head of the UN refugee agency in Libya, said his organisation had learned military and police training exercises were being held just outside the refugee facility in Tripoli.

    “We fear that the entire area could become a military target, further endangering the lives of refugees, asylum seekers and other civilians,” he said in a statement.

    Since April, eastern commander Khalifa Haftar’s self-styled Libyan National Army (LNA) has been staging an assault on the Libyan capital, which is held by the UN-recognised Government of National Accord (GNA).

    The LNA is backed by Emirati, Egyptian and Sudanese forces, as well as Russian mercenaries, and have struck refugee centres and other civilian infrastructure with air strikes and artillery. Libya is a major departure point for refugees and migrants seeking to cross the Mediterranean and reach Europe.

    Earlier this month, three mortar bombs fell close to Tripoli’s Gathering and Departure Facility (GDF), placing UN officials there on high alert.

    Dozens of refugees have begun to be moved from the centre for “protection reasons”, the UN said. Highly vulnerable, they were residing in the facility ahead of being resettled in third countries.

    The GDF has evacuated nearly 1,700 refugees since December 2018, but it has become increasingly overcrowded as hundreds more have headed to the centre, which the UN warned last year had left it unable to function properly.

    Though stalemated for months, the conflict around Tripoli has become increasingly unstable in recent weeks as the LNA makes advances.

    In response, Turkey has begun providing military aid to the GNA, including sending Syrian fighters to fight on its behalf.

    A French military source told the AFP news agency on Thursday that France’s Charles de Gaulle aircraft carrier this week spotted a Turkish frigate escorting a cargo ship delivering armoured vehicles to the Libyan capital.

    The cargo ship Bana docked in Tripoli port on Wednesday, said the source.

    Libya, however, remains under an international arms embargo, the constant violations of which was lamented by UN envoy Ghassan Salame.

    “These manoeuvres to resupply the two parties threaten to precipitate a new and much more dangerous conflagration,” he told the UN Security Council.

    “I urge the parties and their foreign sponsors to desist from reckless actions and instead renew their expressed commitment to work towards a ceasefire.”

  • Historic UN Human Rights case opens door to climate change asylum claims

    In its first ruling on a complaint by an individual seeking asylum from the effects of climate change, the UN Human Rights Committee* has stated that countries may not deport individuals who face climate change-induced conditions that violate the right to life.

    In 2015, #Ioane_Teitiota ’s asylum application in New Zealand was denied, and he was deported with his wife and children to his home country of #Kiribati. He filed a complaint to the UN Human Rights Committee, arguing that by deporting him, New Zealand had violated his right to life. Mr. Teitiota argued that the rise in sea level and other effects of climate change had rendered Kiribati uninhabitable for all its residents. Violent land disputes occurred because habitable land was becoming increasingly scarce. Environmental degradation made subsistence farming difficult, and the freshwater supply was contaminated by salt water.

    The Committee determined that in Mr. Teitiota’s specific case, New Zealand’s courts did not violate his right to life at the time of the facts, because the thorough and careful evaluation of his testimony and other available information led to the determination that, despite the serious situation in Kiribati, sufficient protection measures were put in place. “Nevertheless,” said Committee expert Yuval Shany, “this ruling sets forth new standards that could facilitate the success of future climate change-related asylum claims.”

    The Committee also clarified that individuals seeking asylum status are not required to prove that they would face imminent harm if returned to their countries. The Committee reasoned that climate change-induced harm can occur both through sudden-onset events (such as intense storms and flooding), and slow-onset processes (such as sea level rise, salinization and land degradation). Both sudden-onset events and slow-onset processes can prompt individuals to cross borders to seek protection from climate change-related harm.

    The Committee also highlighted the role that the international community must play in assisting countries adversely affected by climate change. The Committee stated that without robust national and international efforts, the effects of climate change in sending states may trigger the #non-refoulement obligations of receiving states and that – given that the risk of an entire country becoming submerged under water is such an extreme risk – the conditions of life in such a country may become incompatible with the right to life with dignity before the risk is realized.

    The ruling marks the first decision by a UN human rights treaty body on a complaint by an individual seeking asylum protection from the effects of climate change.

    Les organisations pour la défense des droits humains, palestiniennes, régionales et internationales saluent l’adoption, vendredi 12 décembre 2019, par le Comité des Nations Unies (UN) sur l’élimination de la discrimination raciale (désigné ci-après comme le CERD, ou « le Comité ») de ses Observations finales sur Israël qui mettent en lumière, pour la première fois, les politiques israéliennes et ses pratiques de ségrégation raciale et d’apartheid vis-à-vis du peuple palestinien des deux côtés de la Ligne verte. Publiées après examen d’Israël par le Comité lors de sa 100e session les 4 et 5 décembre 2019 à Genève, ces observations finales reflètent l’engagement actif des organisations de la société civile palestinienne, régionale et internationale dans le processus d’examen.

    Avant cet examen, nos organisations ont soumis plusieurs rapports au Comité, y compris un rapport commun de 60 pages soumis par Al-Haq, BADIL, le Centre palestinien pour les droits humains (PCHR), le Centre Al Mezan pour les droits humains, Addameer, la Coalition civile pour les droits palestiniens à Jérusalem (CCPRJ), l’Institut du Caire pour les Etudes sur les droits humains (CIHRS), et la Coalition Internationale de l’Habitat – Réseau pour les droits à l’habitat et à la terre (HIC-HLRN), rapport qui détaille la création par Israël d’un régime institutionalisé de domination raciale et d’oppression systématiques sur le peuple palestinien dans son ensemble, ce qui équivaut au crime de l’apartheid, en violation de l’article 3 de la Convention internationale pour l’élimination de toutes les formes de discrimination raciale (désignée ci-après comme « la Convention »).

    Dans une déclaration commune au Comité le 2 décembre 2019, les organisations ont argué que, depuis la Nakba de 1948, Israël a institué une série de lois discriminatoires, de politiques et de pratiques qui forment le fondement de son régime institutionalisé de domination raciale et d’oppression sur le peuple palestinien. En conséquence, les groupes ont pressé le CERD d’examiner la politique israélienne envers le peuple palestinien dans son ensemble, étape vers l’élimination de la fragmentation politique, juridique et géographique imposée au peuple palestinien et qui étaye le régime d’apartheid d’Israël.

    En conséquence de nos requêtes, le Comité a adopté plusieurs recommandations importantes reconnaissant les politiques et les pratiques de ségrégation raciale et d’apartheid d’Israël vis-à-vis du peuple palestinien des deux côtés de la Ligne verte, et incitant Israël à veiller à ce que ses politiques et ses pratiques « ne soient pas discriminatoires, intentionnellement ou par leurs effets, envers les citoyens palestiniens d’Israël [et] les Palestiniens des territoires palestiniens occupés » (paragraphe 3 des Observations finales). De plus, le Comité a appelé Israël à respecter ses obligations envers le peuple palestinien dans les territoires palestiniens occupés, de bonne foi et « en accord avec la lettre et l’esprit de la Convention et du droit international » (paragraphes 9-10).     Réchauffement climatique, pollution, pression démographique, extension des surfaces agricoles : partout dans le monde, la demande en eau explose et l’offre se raréfie. En 2050, une personne sur quatre vivra dans un pays affecté par des pénuries. Après l’or et le pétrole, l’"or bleu", ressource la plus convoitée de la planète, attise les appétits des géants de la #finance, qui parient sur sa valeur en hausse, source de #profits mirobolants. Aujourd’hui, des #banques et fonds de placements – Goldman Sachs, HSBC, UBS, Allianz, la Deutsche Bank ou la BNP – s’emploient à créer des #marchés porteurs dans ce secteur et à spéculer, avec, étrangement, l’appui d’ONG écologistes. Lesquelles achètent de l’eau « pour la restituer à la nature », voyant dans ce nouvel ordre libéral un moyen de protéger l’environnement.

    En Australie, continent le plus chaud de la planète, cette #marchandisation de l’eau a pourtant déjà acculé des fermiers à la faillite, au profit de l’#agriculture_industrielle, et la Californie imite ce modèle. Face à cette redoutable offensive, amorcée en Grande-Bretagne dès #Thatcher, la résistance citoyenne s’organise pour défendre le droit à l’eau pour tous et sanctuariser cette ressource vitale limitée, dont dépendront 10 milliards d’habitants sur Terre à l’horizon 2050.

    De l’Australie à l’Europe en passant par les États-Unis, cette investigation décrypte pour la première fois les menaces de la glaçante révolution en cours pour les populations et la planète. Nourri de témoignages de terrain, le film montre aussi le combat, à la fois politique, économique et environnemental, que se livrent les apôtres de la #financiarisation de l’eau douce et ceux, simples citoyens ou villes européennes, qui résistent à cette dérive, considérant son accès comme un droit universel, d’ailleurs reconnu par l’#ONU en 2010.     The International Criminal Court is coming under pressure from a group led by former ministers and professors of international law to open an investigation into possible Israeli war crimes in the Occupied Palestinian Territories.

    Known as the Rights Forum, the group founded in 2009 by former Dutch Prime Minister Andreas van Agt, will hand-deliver this demand to the ICC on 10 December on behalf of a coalition of organisations.

    Their demand will coincide with International Human Rights Day, which marks the United Nations General Assembly’s adoption and proclamation of the Universal Declaration of Human Rights (UDHR). It is also the date on which Dries van Agt founded the Rights Forum, exactly a decade ago this year.
