  • Eritrea-Ethiopia border closed amid escalating tension

    “Currently, the situation in Eritrea is reminiscent of the pre-1998 border war period when the war of words and public agitation was at its highest. Now, taking advantage of the proliferation of social media, the agitation is being escalated on a daily basis.”

    Ethio-Eritrean Border: Haphazardly Opened Erratically Closed

    A little over three months after it was haphazardly opened, the Ethiopian-Eritrean Border was closed from the Eritrean side which now requires Ethiopians to have entry permits. The decision to close the border was passed to the Eritrean border guards on Christmas Eve.

    The Eritrean side didn’t explain the change of policy and now requires permits issued by the Federal Ethiopian Government. Similarly, Ethiopian authorities stated they have no official information regarding the Eritrean decisión.

    The border remained closed since the two countries went to war between 1998-2000, a gruesome war in which over a hundred thousand people were killed. In addition, hundreds of thousands of people were displaced from their villages and some of them still live in makeshift camps.

    Until recently, the borders were guarded by soldiers who were on a shoot-to-kill order. Many Eritreans escaping the country to avoid the indefinite military service, poor employment prospects, and severe violations of human rights, were shot and killed while crossing the border.

    However, since September 10, a border crossing checkpoint at Zalambessa-Serha, in the central region, was opened following the agreement between Isaias Afwerki of Eritrea and the Ethiopian prime minister, Dr. Abiy Ahmed. People and goods were allowed to move across the border freely with no permits or visas.

    Immediately after the border was opened, thousands of Eritreans rushed to Ethiopia to take advantage of the border opening either to travel further and join family members in foreign lands, or in search of better employment and educational prospects for themselves.

    At the same time, Ethiopians crowded the streets of Eritrean cities as tourists, or to meet long-separated family members, while merchants flooded the markets that suffered from an acute shortage of different merchandise.

    Another border crossing checkpoint that was briefly opened between the Ethiopian town of Humera and the Eritrean town of Um-Hajer over the Tekezze River was closed on the beginning of August 2018.

    Still another crossing point at Bure south of the Eritrean port of Assab is either closed or open depending on unpredictable intermittent decisions by the Eritrean authorities.

    The border also has also faced problems related to Exchange rates between the currencies of the two countries since neither of the two governments had planned for it ahead of time.

    Since the border opened, over 30,000 Eritreans have crossed to Ethiopia on a one-way journey.

    The reason for the two days old decision by Eritrea is believed to have been triggered by the attempt on the life of general Sebhat’s on December 19, 2018. Dozens of colonels and other lower rank officers suspected of being part of a plot to overthrow Isaias Afwki’s government have been arrested. Their fate is still unknown.

    Over the last few days, PFDJ trolls on social media have accused the TPLF of being behind the plot to “disrupt Eritrean security” and of masterminding the attempt on general Sebhat Efrem’s life.

    Currently, the situation in Eritrea is reminiscent of the pre-1998 border war period when the war of words and public agitation was at its highest. Now, taking advantage of the proliferation of social media, the agitation is being escalated on a daily basis.

    Both the Eritrean government and the Ethiopian federal government are waging relentless media wars and exerting political pressure on the TPLF of Tigray region, which occupies most of the area between the two countries.

Il ministro degli Esteri eritreo Osman Sale è stato accolto in aeroporto dal neo premier etiopico Abiy Ahmed che, ai primi di giugno, ha sorpreso il Paese dichiarando di accettare l’Accordo di pace del 2000 che poneva fine alla guerra con l’Eritrea.

    L’Accordo, nonostante la fine dei combattimenti nel 2000, non è mai stato applicato e i rapporti tra i due Paesi sono rimasti tesi. Etiopia ed Eritrea non hanno relazioni diplomatiche e negli ultimi anni ci sono stati ripetute schermaglie militari al confine.

    • Peace Deal Alone Will Not Stem Flow of Eritrean Refugees

      The detente with Ethiopia has seen Eritrea slash indefinite military conscription. Researcher Cristiano D’Orsi argues that without a breakthrough on human rights, Eritreans will still flee.

      Ethiopia and Eritrea have signed a historic agreement to end the 20-year conflict between the two countries. The breakthrough has been widely welcomed given the devastating effects the conflict has had on both countries as well as the region.

      The tension between the two countries led to Eritrea taking steps that were to have a ripple effect across the region – and the world. One in particular, the conscription of young men, has had a particularly wide impact.

      Two years before formal cross-border conflict broke out in 1998, the Eritrean government took steps to maintain a large standing army to push back against Ethiopia’s occupation of Eritrean territories. Initially, troops were supposed to assemble and train for a period of 18 months as part of their national service. But, with the breakout of war, the service, which included both military personnel and civilians, was extended. All Eritrean men between the ages of 18–50 have to serve in the army for more than 20 years.

      This policy has been given as the reason for large numbers of Eritreans fleeing the country. The impact of the policy on individuals, and families, has been severe. For example, there have been cases of multiple family members being conscripted at the same time. This denied them the right to enjoy a stable family life. Children were the most heavily affected.

      It’s virtually impossible for Eritreans to return once they have left as refugees because the Eritrean government doesn’t look kindly on repatriated returnees. Those who are forced to return to the country face persecution and human rights abuses.

      In 2017, Eritreans represented the ninth-largest refugee population in the world with 486,200 people forcibly displaced. By May 2018, Eritreans represented 5 percent of the migrants who disembarked on the northern shores of the Mediterranean.

      Things look set to change, however. The latest batch of national service recruits have been told their enlistment will last no longer than 18 months. The announcement came in the midst of the dramatic thawing of relations between Ethiopia and Eritrea. It has raised hopes that the service could be terminated altogether.

      With that said, it remains to be seen whether the end of hostilities between the two countries will ultimately stem the flow of Eritrean refugees.

      It’s virtually impossible for Eritreans to return once they have left as refugees because the Eritrean government doesn’t look kindly on repatriated returnees. Those who are forced to return to the country face persecution and human rights abuses.

      The Eritrean government’s hardline position has led to changes in refugee policies in countries like the UK. For example, in October 2016, a U.K. appellate tribunal held that Eritreans of draft age who left the country illegally would face the risk of persecution and abuse if they were involuntarily returned to Eritrea.

      This, the tribunal said, was in direct violation of the European Convention on Human Rights. As a result, the U.K.’s Home Office amended its immigration policy to conform to the tribunal’s ruling.

      Eritrean asylum seekers haven’t been welcome everywhere. For a long time they were persona non grata in Israel on the grounds that absconding national service duty was not justification for asylum. But in September 2016, an Israeli appeals court held that Eritreans must be given the chance to explain their reasons for fleeing at individual hearings, overruling an interior ministry policy that denied asylum to deserters.

      The situation is particularly tense for Eritreans in Israel because they represent the majority of African asylum seekers in the country. In fact, in May 2018, Israel and the United Nations refugee agency began negotiating a deal to repatriate African asylum seekers in western countries, with Canada as a primary destination.

      An earlier deal had fallen through after public pressure reportedly caused Prime Minister Benjamin Netanyahu to back out of it.

      Eritreans living as refugees in Ethiopia have been welcomed in Australia where they are one among eight nationalities that have access to a resettlement scheme known as the community support program. This empowers Australian individuals, community organizations and businesses to offer Eritrean refugees jobs if they have the skills, allowing them to settle permanently in the country.

      The government has always denied that conscription has anything to do with Eritreans fleeing the country. Two years ago it made it clear that it would not shorten the length of the mandatory national service.

      At the time officials said Eritreans were leaving the country because they were being enticed by certain “pull factors.” They argued, for example, that the need for low cost manpower in the West could easily be met by giving asylum to Eritreans who needed just to complain about the National Service to obtain asylum.

      But change is on the cards. After signing the peace deal with Ethiopia, Eritrea has promised to end the current conscription regime and announcing that national service duty will last no more than 18 months.

      Even so, the national service is likely to remain in place for the foreseeable future to fulfil other parts of its mandate which are reconstructing the country, strengthening the economy, and developing a joint Eritrean identity across ethnic and religious lines.

      Eritrea is still a country facing enormous human rights violations. According to the last Freedom House report, the Eritrean government has made no recent effort to address these. The report accuses the regime of continuing to perpetrate crimes against humanity.

      If Eritrea pays more attention to upholding human rights, fewer nationals will feel the need to flee. And if change comes within Eritrean borders as fast as it did with Ethiopia, a radical shift in human rights policy could be in the works.

    • Out of Eritrea: What happens after #Badme?

      On 6 June 2018, the government of Ethiopia announced that it would abide by the Algiers Agreement and 2002 Eritrea-Ethiopian Boundary Commission decision that defined the disputed border and granted the border town of Badme to Eritrea. Over the last 20 years, Badme has been central to the dispute between the two countries, following Ethiopia’s rejection of the ruling and continued occupation of the area. Ethiopia’s recently appointed Prime Minister Abiy Ahmed acknowledged that the dispute over Badme had resulted in 20 years of tension between the two countries. To defend the border areas with Ethiopia, in 1994 the Eritrean government introduced mandatory military service for all adults over 18. Eritrean migrants and asylum seekers often give their reason for flight as the need to escape this mandatory national service.

      Since 2015, Eritreans have been the third largest group of people entering Europe through the Mediterranean, and have the second highestnumber of arrivals through the Central Mediterranean route to Italy. According to UNHCR, by the end of 2016, 459,390 Eritreans were registered refugees in various countries worldwide. Various sources estimate Eritrea’s population at 5 million people, meaning that approximately 10% of Eritrea’s population has sought refuge abroad by 2016.
      Mandatory military service – a driver of migration and displacement

      As data collection from the Mixed Migration Centre’s Mixed Migration Monitoring Mechanism Initiative (4Mi) shows, 95% of Eritrean refugees and migrants surveyed gave fear of conscription into national service as their main reason for flight out of Eritrea. Men and women from 18 to 40 years old are required by law to undertake national service for 18 months — including six months of military training followed by 12 months’ deployment either in military service or in other government entities including farms, construction sites, mines and ministries.
      In reality, national service for most conscripts extends beyond the 18 months and often indefinite. There are also reported cases of children under 18 years old being forcefully recruited. Even upon completion of national service, Eritreans under the age of 50 years may been enrolled in the Reserve Army with the duty to provide reserve military service and defend the country from external attacks or invasions.

      According to Human Rights Watch, conscripts are subject to military discipline and are harshly treated and earn a salary that often ranges between USD 43 – 48 per month. The length of service is unpredictable, the type of abuse inflicted on conscripts is at the whim of military commanders and the UN Commission of inquiry on human rights in Eritrea reported on the frequent sexual abuse of female conscripts. Eritrea has no provision for conscientious objection to national service and draft evaders and deserters if arrested are subjected to heavy punishment according to Amnesty International, including lengthy periods of detention, torture and other forms of inhuman treatment including rape for women. For those who escape, relatives are forced to pay fines of 50,000 Nakfa (USD 3,350) for each family member. Failure to pay the fine may result in the arrest and detention of a family member until the money is paid which further fuels flight from Eritrea for families who are unable to pay the fine.

      The government of Eritrea asserts that compulsory and indefinite national service is necessitated by continued occupation of its sovereign territories citing Ethiopia as the main threat. In its response to the UN Human Rights Council Report that criticised Eritrea for human rights violations including indefinite conscription, Eritrea stated that one of its main constraints to the fulfilment of its international and national obligations in promoting and protecting human rights and fundamental freedoms is the continued occupation of its territory by Ethiopia.

      In 2016, Eritrea’s minister for Information confirmed that indefinite national service would remain without fundamental changes even in the wake of increased flight from the country by citizens unwilling to undertake the service. The Minister went on to state that Eritrea would contemplate demobilization upon the removal of the ‘main threat’, in this case Eritrea’s hostile relationship with Ethiopia. Eritrea and Ethiopia have both traded accusations of supporting opposition/militia groups to undermine each other both locally and abroad. If the relations between the countries turn peaceful, this could potentially have an impact on Eritrean migration, out of the country and out of the region.

      In the absence of hostilities and perceived security threats from its neighbour, it is possible that Eritrea will amend – or at least be open to start a dialogue about amending – its national service (and military) policies from the current mandatory and indefinite status, which has been one of the major root causes of the movement of Eritreans out of their country and onwards towards Europe. Related questions are whether an improvement in the relations with Ethiopia could also bring an immediate or longer term improvement in the socio-economic problems that Eritrea faces, for example through expanded trade relations between the two countries? Will this change usher in an era of political stability and an easing of military burdens on the Eritrean population?
      A possible game changer?

      The border deal, if it materialises, could at some time also have serious implications for Eritrean asylum seekers in Europe. Eritreans applying for asylum have relatively high approval rates. The high recognition rate for Eritrean asylum seekers is based on the widely accepted presumptionthat Eritreans who evade or avoid national service are at risk of persecution. In 2016 for example, 93% of Eritreans who sought asylum in EU countries received a positive decision. This recognition rate was second to Syrians and ahead of Iraqis and Somalis; all countries that are in active conflict unlike Eritrea. If the government of Eritrea enacts positive policy changes regarding conscription, the likely effect could be a much lower recognition rate for Eritrean asylum seekers. It is unclear how this would affect those asylum seekers already in the system.

      While Eritreans on the route to Europe and in particular those arriving in Italy, remain highly visible and receive most attention, many Eritreans who leave the country end up in refugee camps or Eritrean enclaves in neighbouring countries like Sudan and Ethiopia or further away in Egypt. After they flee, most Eritreans initially apply for refugee status in Ethiopia’s and Sudan’s refugee camps. As Human Rights Watch noted in 2016, the Eritrean camp population generally remains more or less stable. While many seek onward movements out of the camps, many refugees remain in the region. With these potentially new developments in Eritrea, will the Eritreans in Sudan, Ethiopia and other neighbouring countries feel encouraged or compelled to return at some, or will they perhaps be forced to return to Eritrea?
      What’s next?

      Conservative estimates in 2001 put the cost of the war between Eritrea and Ethiopia at USD 2.9 billion in just the first three years. This has had an adverse effect on the economies of the two countries as well as human rights conditions. In 2013, Eritrea expressed its willingness to engage in dialogue with Ethiopia should it withdraw its army from the disputed territory which it further noted is occupied by 300,000 soldiers from both countries. Ethiopia has previously stated its willingness to surrender Badme, without in the end acting upon this promise. Should this latest promise be implemented and ties between two countries normalized, this might herald positive developments for both the economy and the human rights situation in both countries, with a potential significant impact on one of the major drivers of movement out of Eritrea.

      However, with the news that Ethiopia would move to define its borders in accordance with international arbitration, the possibilities for political stability and economic growth in Eritrea remain uncertain. On 21 June 2018, the President of Eritrea Isaias Aferwerki issued a statement saying that Eritrea would send a delegation to Addis Ababa to ‘gauge current developments… chart out a plan for continuous future action’. The possibility of resulting peace and economic partnership between the two countries could, although a long-term process, also result in economic growth on both sides of the border and increased livelihood opportunities for their citizens who routinely engage in unsafe and irregular migration for political, humanitarian and economic reasons.

    • Despite the peace deal with Ethiopia, Eritrean refugees are still afraid to return home

      When Samuel Berhe thinks of Eritrea, he sees the sand-colored buildings and turquoise water of Asmara’s shoreline. He sees his sister’s bar under the family home in the capital’s center that sells sweet toast and beer. He sees his father who, at 80 years old, is losing his eyesight but is still a force to be reckoned with. He thinks of his home, a place that he cannot reach.

      Berhe, like many other Eritreans, fled the country some years ago to escape mandatory national service, which the government made indefinite following the 1998-2000 border war with Ethiopia. The war cost the countries an estimated 100,000 lives, while conscription created a generation of Eritrean refugees. The UNHCR said that in 2016 there were 459,000 Eritrean exiles out of an estimated population of 5.3 million.

      So, when the leaders of Ethiopia and Eritrea signed a sudden peace deal in July 2018, citizens of the Horn of Africa nations rejoiced. Many took to the streets bearing the two flags. Others chose social media to express their happiness, and some even dialed up strangers, as phone lines between the nations were once again reinstated. It felt like a new era of harmony and prosperity had begun.

      But for Berhe, the moment was bittersweet.

      “I was happy because it is good for our people but I was also sad, because it doesn’t make any change for me,” he said from his home in Ethiopia’s capital, Addis Ababa. “I will stay as a refugee.”

      Like many other Eritrean emigrants, Berhe fled the country illegally to escape national service. He fears that if he returns, he will wind up in jail, or worse. He does not have a passport and has not left Ethiopia since he arrived on the back of a cargo truck 13 years ago. His two daughters, Sarah, 9, and Ella, 11, for whom he is an only parent, have never seen their grandparents or their father’s homeland.

      Now that there is a direct flight, Berhe is planning on sending the girls to see their relatives. But before he considers returning, he will need some sort of guarantee from Eritrea’s President Isaias Afwerki, who leads the ruling People’s Front for Democracy and Justice, that he will pardon those who left.

      “The people that illegally escaped, the government thinks that we are traitors,” he said. “There are many, many like me, all over the world, too afraid to go back.”

      Still, hundreds fought to board the first flights between the two capitals throughout July and August. Asmara’s and Addis Ababa’s airports became symbols of the reunification as hordes of people awaited their relatives with bouquets daily, some whom they hadn’t seen for more than two decades.

      “When I see the people at the airport, smiling, laughing, reuniting with their family, I wish to be like them. To be free. They are lucky,” Berhe said.

      Zala Mekonnen, 38, an Eritrean Canadian, who was one of the many waiting at arrivals in Addis Ababa, said she had completely given up on the idea that the two nations — formerly one country — would ever rekindle relations.

      Mekonnen, who is half Ethiopian, found the 20-year feud especially difficult as her family was separated in half. In July, her mother saw her uncle for the first time in 25 years.

      “We’re happy but hopefully he’s [Afwerki] going to let those young kids free [from conscription],” she said. “I’m hoping God will hear, because so many of them died while trying to escape. One full generation lost.”

      Mekonnen called the peace deal with Ethiopia a crucial step towards Eritrean democracy. But Afwerki, the 72-year-old ex-rebel leader, will also have to allow multiple political parties to exist, along with freedom of religion, freedom of speech and reopening Asmara’s public university while also giving young people opportunities outside of national service.

      “The greeting that Afwerki received here in Ethiopia [following the agreement to restore relations], he didn’t deserve it,” said Mekonnen. “He should have been hung.”

      Since the rapprochement, Ethiopia’s leader, Abiy Ahmed, has reached out to exiled opposition groups, including those in Eritrea, to open up a political dialogue. The Eritrean president has not made similar efforts. But in August, his office announced that he would visit Ethiopia for a second time to discuss the issue of rebels.

      Laura Hammond, a professor of developmental studies at the School of Oriental and African Studies in London, said that it is likely Afwerki will push for Ethiopia to send Eritrean refugees seeking asylum back to Eritrea.

      “The difficulty is that, while the two countries are normalizing relations, the political situation inside Eritrea is not changing as rapidly,” Hammond said. “There are significant fears about what will happen to those who have left the country illegally, including in some cases escaping from prison or from their national service bases. They will need to be offered amnesty if they are to feel confident about returning.”

      To voice their frustrations, thousands of exiled Eritreans gathered in protest outside the UN headquarters in Geneva on Aug. 31. Amid chants of “enough is enough” and “down, down Isaias,” attendees held up placards calling for peace and democracy. The opposition website, Harnnet, wrote that while the rapprochement with Ethiopia was welcomed, regional and global politicians were showing “undeserved sympathy” to a power that continued to violate human rights.

      Sitting in front of the TV, Berhe’s two daughters sip black tea and watch a religious parade broadcast on Eritrea’s national channel. Berhe, who has temporary refugee status in Ethiopia, admits that one thing that the peace deal has changed is that the state’s broadcaster no longer airs perpetual scenes of war. For now, he is safe in Addis Ababa with his daughters, but he is eager to obtain a sponsor in the US, Europe or Australia, so that he can resettle and provide them with a secure future. He is afraid that landlocked Ethiopia might cave to pressures from the Eritrean government to return its refugees in exchange for access to the Red Sea port.

      “Meanwhile my girls say to me, ’Why don’t we go for summer holiday in Asmara?’” he laughs. “They don’t understand my problem.”

L’Onlf, gruppo separatista fondato nel 1984, è stato etichettato come organizzazione terrorista dal governo etiope fino al luglio scorso, quando il parlamento di Addis Abeba ha ratificato la decisione del governo di rimuovere i partiti in esilio – tra cui appunto l’Onlf – dalla lista delle organizzazioni terroristiche.     • UN: No Rights Progress in Eritrea After Peace Deal With Ethiopia

      U.N. experts say Eritrea’s human rights record has not changed for the better since the government signed a peace agreement with Ethiopia last year, formally ending a two decades-long border conflict. The U.N. Human Rights Council held an interactive dialogue on the current situation in Eritrea this week.

      After a 20-year military stalemate with Ethiopia, hopes were high that the peace accord would change Eritrea’s human rights landscape for the better.

      U.N. Deputy High Commissioner for Human Rights Kate Gilmore said that has not happened. She said Eritrea has missed a historic opportunity because the government has not implemented urgently needed judicial, constitutional and economic reforms.

      She said the continued use of indefinite national service remains a major human rights concern.

      “Conscripts continue to confront open-ended duration of service, far beyond the 18 months stipulated in law and often under abusive conditions, which may include the use of torture, sexual violence and forced labor,” she said.

      Gilmore urged Eritrea to bring its national service in line with the country’s international human rights obligations.

      “The peace agreement signed with Ethiopia should provide the security that the government of Eritrea has argued it needs to discontinue this national service and help shift its focus from security to development…. In the absence of promising signs of tangible human rights progress, that flow of asylum-seekers is not expected to drop,” Gilmore said.

      Human rights groups say unlimited national service forces thousands of young men to flee Eritrea every month to seek asylum in Europe. They say many lose their lives making the perilous journey across the Sahara Desert or while crossing the Mediterranean Sea to Europe.

      The head of the Eritrean delegation to the Council, Tesfamicael Gerahtu, said his country has had to adopt certain measures to counter the negative effect of the last 20 years on peace, security and development. He insists there is no human rights crisis in his country.

      He accused the Human Rights Council of exerting undue pressure on Eritrea by monitoring his country’s human rights situation and adopting detrimental resolutions. He called the actions counterproductive.

      “The honorable and productive way forward is to terminate the confrontational approach on Eritrea that has been perpetrated in the last seven years and that has not created any dividend in the promotion of human rights. And, there is no crisis that warrants a Human Rights Council agenda or special mandate on Eritrea,” Gerahtu said.

      Daniel Eyasu , head of Cooperation and International Relations of the National Youth Union and Eritrean Students, agrees there is no human rights crisis in Eritrea. He offered a positive spin on the country’s controversial national service, calling it critical for nation building.

      Unfortunately, he said, the reports of the council’s special procedures characterizing national service as modern slavery is unwarranted, unjustified and unacceptable.

      The Founder of One Day Seyoum, Vanessa Tsehaye, said the government has not changed its stripes. She said it is as repressive today as it was before the peace accord with Ethiopia was signed.

      Tsehaye’s organization works for the release of her uncle, a journalist who has been imprisoned without a trial in Eritrea since 2001 and for all people unjustly imprisoned. She said they continue to languish in prison.

      “The standoff at the border cannot justify the fact that all capable Eritreans are enlisted into the national service indefinitely. It cannot justify the fact that the country’s constitution still has not been implemented and that the parliament still has not convened since 2002. It does not justify the fact that the only university in the country has been shut down, that the free press has still not been opened and that tens of thousands of people have been imprisoned without a trial simply for expressing their opinions, practicing their religion or attempting to leave their country,” Tsehaye said.

      But delegates at the council welcomed the peace process and expressed hope it will result in better protection for the Eritrean people. But they noted the prevailing abusive conditions are not promising.

      They urged the government to reform its military service, release all political prisoners, stop the practice of arbitrary arrests, and end torture and inhumane detention conditions.

    Ma nell’ospedale romano dove è stato ricoverato non risulta nessuno con quel nome.
    Che abbia dato generalità false per evitare di essere riconosciuto è assai probabile, ma, ovviamente
    non è certo. Per altro la presenza di Yemane era prevista in numerose iniziative in Europa
    dove il “vice-dittatore” non è comparso. Massimo Alberizzi scrive a Petros e a Yemane,

      Yemane Gebreab’s Deadly Schemes and Network of Terror

      Various media outlets have reported that Yemane Gebreab (the Eritrean President’s Advisor) was not allowed to address the Eritrean government supporters’ public seminar, in Arlington, on 8 October 2017, during his visit in the United States. He was denied entry to the seminar venue by US law enforcement officers. It seems plausible that he was in violation of a US Executive Order which listed him as a person who threatened US national security and foreign policy with regard to the Somalia situation. Human Rights Concern Eritrea (HRCE) has previously written about the danger Yemane Gebreab poses to Eritreans inside and outside Eritrea and the international community at large. In particular, Yemane Gebreab set-up an unsuccessful assassination attempt in Somalia on an Italian journalist who lived to tell the story.

      Whilst the flier which was distributed to advertise the event at which Yemane Gebreab was going to be present, alongside Eritrean Foreign Minister Osman Saleh, the official website of the Eritrean Government reported that Osman Saleh alone conducted the seminar. Since the news that Yemane Gebreab was detained spread quickly, it appears the Eritrean Government tried to cover up this embarrassing turn of events. Manufacturing after-the-fact appearances is no new thing for the Eritrean government.

      The UN conducted an inquiry into human rights violations in Eritrea and concluded in June 2016 that crimes against humanity were both widespread and systematic. The country is a one-party state, run by the top members of the People’s Front for Democracy and Justice (PFDJ), whose chairman is also the current and only president since 1991, Isaias Afewerki. His personal advisor is Yemane Gebreab, the man who proposes policies and implements them. Except that he does much more.

      Yemane Gebreab is widely known as the Presidential Advisor in Eritrea and head of Political Affairs in the PFDJ. However, these titles are nominal and only some of the roles he plays. Not only is Yemane Gebreab one of the main political minds behind the PFDJ, but his activities also range as widely in scope and depth as they do in nefariousness. He is active both at national and international level. HRCE has previously called for his arrest, and has since spoken to and received confidential testimonies from agents who in the past were deployed by Yemane Gebreab himself. They confirmed what most Eritreans already knew about him, through word of mouth or partial first-hand experience.

      On the international front, Yemane Gebreab is perhaps most infamous for masterminding and establishing the Young PFDJ (YPFDJ), a youth organisation which has parallels with the Balilla organisation which existed in Fascist Italy during the first half of the 20th century. YPFDJ even has enforcers called Eri-Blood, who intimidate anyone who expresses discontent with the Eritrean government and its practices. However, intimidation is not the only purpose of this organisation. Through the YPFDJ, whose members are not necessarily only youth, the PFDJ organises propaganda campaigns and spreads misinformation among the diaspora and other groups which interact with the Eritrean community abroad. Just as the YPFDJ meetings, often headed by Yemane Gebreab himself, spread false propaganda, they also serve as a means to fundraise and host events where money is either directly collected or obtained through sales of tickets or other items. This alone should have landed Yemane Gebreab in a US jail in the years since the standing executive order was first issued in 2010 by the then president Barack Obama.

      Most of the funds raised by the YPFDJ and PFDJ in the diaspora come from the older segments of the Eritrean community abroad. Worryingly, however, Yemane Gebreab organises these supporters to act as his informants. The former-agents whom HRCE has spoken with say that even middle-aged or elderly women, or other members of the Eritrean community abroad who might not raise suspicion, are used to spy on fellow Eritreans in the diaspora. Though many Eritreans knew this already, the testimony HRCE has received confirms the extent to which this tactic is systematic and widespread. Whilst the ordinary civilian may be used as an informant for Yemane Gebreab, trained individuals ranging from youth to middle-aged are deployed in the diaspora community.

      These youth, invariably members of the YPFDJ, but not necessarily openly so, are individuals who are carefully selected and sent to training camps inside Eritrea, often under the pretence of a vacation visit. They are trained using a program run by Yemane Gebreab which is intended to produce cadres fiercely loyal to the regime. These youth are taken around the country in a program called Zura-Hagerka, to the youth festival in Sawa Military Camp, to Nakfa (the old bastion town during the war for independence) to camps around Asmara (such as Asha Golgol) and other towns where their training is conducted. Not all of these youth are selected to become Yemane Gebreab’s agents. However, those who are selected are deployed in the diaspora and made to inform on the community, infiltrate organisations or set-up money laundering businesses, or even become part of the Eri- Blood.

      It is worrying that Eritrean youth from the diaspora willingly and voluntarily choose to partake in these criminal affairs, although the PFDJ regime has become expert at targeting the more vulnerable and disillusioned amongst the youth abroad. Unlike them, however, there are other Eritreans who also operate in the diaspora but have no choice in the matter. These are conscripts who hail from within the country and are trained in special cadre programs. These Eritreans might get brainwashed to the level of accepting the rhetoric fed them by Yemane Gebreab, although most are deeply aware that they have no choice but to obey, for it is not only their lives which are endangered; they also fear for their families. Few who manage to escape the grip of Yemane Gebreab’s network manage to share inside information. They are unambiguous about the fact that Yemane Gebreab runs these programs, participates in training and brainwashing cadres, as well as being the person who has the final word in all decision-making.

      The cadres deployed outside Eritrea by Yemane Gebreab have a slightly different job from the YPFDJ youth who are trained in the country and then sent back to their diaspora communities, although it must be kept in mind that often their roles overlap. These agents are told the country depends on them and that their training and job has been entrusted to them by the Eritrean people. They are made to believe they are the true inheritors of the legacy which led to the country’s independence and are instructed in no uncertain terms to put the country before their lives. Of course, by “country” Yemane Gebreab means the interests of himself, Isaias Afwerki and their kleptocratic clique. In fact, veneration of Isaias Afwerki is part of their training as they are assured that if it were not for Isaias Afwerki and the PFDJ, the country would be lost.

      Thus trained, involuntarily conscripted men and women from Eritrea are often sent to work in embassies, consulates or other PFDJ offices around the world. The former agents whom HRCE spoke with clarify that these cadres are assigned the job of spying and watching every move of ambassadors, consuls and other staff in these offices. The sources recall how, during their training, Yemane Gebreab would warn them to watch very closely Eritrean officials, diplomats and other leadership figures who visit from Eritrea. He would caution them that they are to monitor these diplomats’ movements as if they were a cancerous tumour. Accordingly, he instructs the agents he sends abroad to record what Eritrean diplomats and officials say in meetings and at public events, keeping an eye out for any sign of dissent or criticism. If these officials show any hint of discontent, they are to be reported and are consequently recalled back to the country.

      While abroad, the cadres deployed from Eritrea are also made to monitor and report on Eritrean-owned businesses and Eritrean individuals. They may receive orders to repatriate individuals targeted by the PFDJ and Yemane Gebreab. In practice, this translates to finding ways to undermine these individuals and business owners so that either their immigration status or licences are revoked. It may even extend to outright abduction and enforced disappearance. This practice seems to be done more in African and middle-eastern countries, where some of governments might even co-operate with the PFDJ in deporting targeted individuals. Examples of this can be found in neighbouring countries such as Sudan, where, throughout the years, abductions of Eritreans from Sudanese territory are conducted by Eritrean agents.

      Moreover, agents who answer to and co-operate with Yemane Gebreab can also be foreign nationals. Recalling the assassination attempt on the Italian journalist mentioned above, the Somalis who allowed the journalist to escape were reprimanded by Yemane Gebreab. Furthermore, part of the reason his name is the only non-Somali name on the list in the Executive Order concerning the turmoil in Somalia is due to his and his agents’ work in the region.

      However, the international activities by Yemane Gebreab form only part of the picture, as he is also deeply entrenched in the terror his activities within the country cause to the Eritrean People. As mentioned in a previous article, Yemane Gebreab admits in an interview that he and the PFDJ arrested without due legal process and detained incommunicado a group of journalists and his former colleagues and senior ministers known as the G11 in 2001. (The G11 were part of the G15, a group of senior government officials who publicly called for democracy and change, but only 11 of them were in the country at the time of arrest, and few are thought to survive to this day). Though this case is the most famous internationally, Yemane Gebreab is co-perpetrator of other persecutions and enforced disappearances within the country.

      Inside Eritrea, Yemane Gebreab is one of the main political minds behind the PFDJ, and as such, he plans and implements various repressive internal policies. He plays a crucial role in the establishment and running of youth programs, including the national service and the National Union of Eritrean Youth and Students (NUEYS), the internal equivalent of the YPFDJ and the organisation which handles all Eritrean youth affairs before they are conscripted into the military, which occurs before they even finish secondary education. This includes participation in PFDJ organised events and the release or withholding of the ID card all students must have before they are conscripted, on penalty of detention and early conscription into the military.

      Whilst Gebreab partakes in shaping such national policies to the extent that he is known as second-in-command in the country after Isaias Afewerki, the cadres he controls are put to work even inside Eritrea. The espionage network in Eritrea is as unnerving as possible, but what makes it even more fearsome for those who have to live under it is that elements like those organised and deployed by Yemane Gebreab do not fall under the control of any normal intelligence agency. They receive orders and respond solely to the president’s office and to Yemane Gebreab. For years the Eritrean population has lived in dread of accidentally offending one of these informants or any other covert agents infiltrated within the population.

      A particular terrorising effect is achieved by the agents of Yemane Gebreab inside Eritrea by the fact that they not only spy on the population but also demand that citizens inform on each other. The testimonies received by HRCE clarify that the cadres and agents trained and deployed by Yemane Gebreab are often given quotas and targets to monitor. Consequently, they follow the target in public places such as cafes, places of work, churches, mosques, etc. In such places, these agents approach the persons running the locales, businesses or places of worship and force them to inform on the targeted citizens. This creates a daily atmosphere of terror in the population, because no one can be sure if their colleague, their waiter, their church leader or their imam is watching their every move and reporting to these agents. To use a recent development within the country as a further example, it appears that the PFDJ regime is now assigning one family in each neighbourhood to act as informants on a group of surrounding families, reporting the comings and goings of each member of the assigned families they watch.

      At this point it is important to remind the reader that Eritreans live in terror of the consequences that may befall them if they appear to know anything unauthorised or do not cooperate with the demands made of them. In such ways Yemane Gebreab instils fear among Eritreans so that no one dares to speak to their neighbour openly, let alone organise to demand their rights or change the system. There is now an entire generation born and raised in such conditions of fear, and Yemane Gebreab is the main actor pulling the strings of the mechanisms that have terrorised many of the young people as well as most of the adult population for their entire lives, both inside and outside Eritrea. Gebreab has committed crimes against humanity and used people who have been forced into slavery to partake in his schemes. He is one of the main persons, perhaps only the second after Isaias Afwerki, to have illegitimately detained and directly caused the deaths of hundreds accused of dissenting against the PFDJ, of whom the most famous are amongst the G11 and journalists forcibly disappeared in September 2001.

      It baffles the mind then that Yemane Gebreab has thus far been allowed to enter Europe and the United States of America freely. European leaders and representatives of other United Nations member states should refuse to interact with such a criminal and should denounce him. The UN has recommended that those who systematically perpetrate crimes against humanity in Eritrea should face prosecution and Yemane Gebreab should be one of the most wanted men in Eritrea, detained immediately upon setting foot outside Eritrea and prosecuted at the International Criminal Court (ICC). HRCE recognises that some steps such as sanction and seizure of financial assets have been taken by the United States. However, it is feared that the seriousness of Yemane Gebreab’s crimes are grossly underestimated by the leaders of such countries and international organisations.

      HRCE appeals to all countries to deny entry to Yemane Gebreab and to refuse political and financial cooperation with him and the party he represents. It seems that Yemane Gebreab has been set free losing a major opportunity to detain him. However, if the U.S, European or other country’s authorities get another chance to put him in custody, HRCE recommends that instead of being released to perpetrate further crimes against humanity, he should be detained until he is brought before the ICC to answer for the major role he has played in terrorising and eliminating innocent Eritreans.

    • Mining Company on Trial for Human Rights Abuses Appears to Lobby at the Human Rights Council (HRC)

      Nevsun Mining Resources Ltd, based in Canada is cur rently facing a lawsuit initiated by more than 80 Eritrean plaintiffs, who contend they were victims of forced labour, human rights abuses and crimes against humanity at the company’s Bisha Mine in Eritrea. #Bisha Mine is owned 60-per-cent by Nevsun and 40-per-cent by Eritrean government.

      Forced Labour and the appalling conditions in Bisha Mine have been documented by Human Rights Watch and the UN Commission of Inquiry into Human Rights in Eritrea. Yet the Todd Romain, the Vice President of Corporate Social Responsibility of this company and his PR are at present in Geneva at the UN Human Rights Council (HRC) session where the current special rapporteur on human rights in Eritrea is due to deliver her final report, and a decision will be made regarding the renewal of the mandate.

      Nevsun also participated in side events organized by the Eritrean Mission at the HRC on 16 June 2016 (http://www.eritrea-chat.com/eritrean-mining-conference-about-human-rights-in-geneva-16-june-2016) and on 8 March 2018 , and visited many Missions in Geneva despite the fact that this court case was already ongoing.

      Human Rights Concern-Eritrea (HRCE) believes most strongly that it is inappropriate for a representative of a commercial corporation whose name has been raised in connection with human rights abuses during HRC debates and oral statements on the human rights in Eritrea, and which is currently the accused to court proceedings regarding human rights abuses, should be party to human rights side events, neither should it’s top representative give the appearance of lobbying country delegations about HRC initiatives that are directly concerned with its court case.

      Eritrea has not implemented any of the UPR recommendations from the first and second cycles. The recommendations from the Commission of Inquiries and the Special Rapporteur have so far been ignored. No improvements in human rights in Eritrea have been identified in the last decade; 10,000 or more prisoners of conscience are still in detention and the violently enforced lifelong military service which prevails unreformed. Forced/slave labour have been used in all the government owned businesses including mining projects.

      HRCE feels it important that country delegations and media are made fully aware of this issue, and advises that no further hearing should be given to any of Nevsun’s representatives pending a final court ruling on the human rights case.

      In November 2014, three Eritreans filed a lawsuit against Nevsun Resources in Vancouver, British Columbia, Canada. They allege the company was complicit in the use of forced labour by Nevsun’s local sub-contractor, Segen Construction (owned by Eritrea’s ruling party), at the Bisha mine in Eritrea. Nevsun, headquartered in Vancouver, has denied the allegations. This lawsuit is the first in Canada where claims are based directly on violations of international law.

      The plaintiffs, Gize Yebeyo Araya, Kesete Tekle Fshazion and Mihretab Yemane Tekle, claim that they worked at the Bisha mine against their will and were subject to “cruel, inhuman and degrading treatment”. They allege that they were forced to work long hours and lived in constant fear of threats of torture and intimidation. Nevsun has rejected the allegations as “unfounded” and declared that “the Bisha Mine has adhered at all times to international standards of governance, workplace conditions, and health and safety”.

      In October 2016, the Supreme Court of British Colombia rejected Nevsun’s motion to dismiss the lawsuit and ruled that the case should proceed in British Colombia as there were doubts that the plaintiffs would get a fair trial in Eritrea. Nevsun appealed the decision.

      In November 2017, the British Columbia Court of Appeal rejected Nevsun’s appeal to dismiss the suit, thereby allowing the case to proceed in Canadian courts. The court also allowed claims of crimes against humanity, slavery, forced labour, and torture to go forward against Nevsun. This decision marked the first time an appellate court in Canada permitted a mass tort claim for modern slavery.

      On 19 January 2018, Nevsun filed an application with the Canadian Supreme Court asking for permission to appeal the British Columbia ruling. There is no fixed time for the Supreme Court to decide whether to grant or deny such applications.

      When a small Vancouver mining company struck gold in a remote corner of Africa, it started with so much promise. In remote Eritrea, Nevsun built a mine that was generating $700 million in profits in its first four years of operation. But it was also generating a lot of controversy – because Nevsun was partnered with a brutal dictatorship that runs the country and controls 40% of the mine. That has led to allegations by the UN and Human Rights Watch that the regime has used conscripted military labour in the mine. The Eritrea government has also been accused of funnelling arms to the terrorist group al-Shabaab. Nevsun denies the allegations of human rights abuses and insists it is a “template for responsible international business.” What is the price of doing business with a dictator?     • Appeal court confirms slave labour lawsuit against Canadian mining company can go to trial

      British Columbia’s highest court today rejected an appeal by Vancouver-based Nevsun Resources Limited (TSX: NSU / NYSE MKT: NSU) that sought to dismiss a lawsuit brought by Eritreans who allege they were forced to work at Nevsun’s Bisha Mine.

      The ruling by the British Columbia Court of Appeal marks the first time that an appellate court in Canada has permitted a mass tort claim for modern slavery.

      The court rejected Nevsun’s position that the case should be dismissed in Canada and instead heard in Eritrea. Madam Justice Mary Newbury described the situation in Eritrea as one with “the prospects of no trial at all, or a trial in an Eritrean court, possibly presided over by a functionary with no real independence from the state … and in a legal system that would appear to be actuated largely by the wishes of the President and his military supporters…”

      The court also allowed claims of crimes against humanity, slavery, forced labour, and torture to go forward against Nevsun. It is the first time that a Canadian appellate court has recognized that a corporation can be taken to trial for alleged violations of international law norms related to human rights.

      The lawsuit, filed in November 2014, alleges that Nevsun engaged Eritrean state-run contractors and the Eritrean military to build the mine’s facilities and that the companies and military deployed forced labour under abhorrent conditions.

      “We are very pleased that the case will move to trial,” said Joe Fiorante, Q.C., of Camp Fiorante Matthews Mogerman LLP, lead counsel for the plaintiffs. “There will now be a reckoning in a Canadian court of law in which Nevsun will have to answer to the allegations that it was complicit in forced labour and grave human rights abuses at the Bisha mine.”

      Since the initial filing by three Eritrean men, which was the matter reviewed by the Court of Appeal, an additional 51 people have come forward to assert claims against Nevsun.

      “I am overjoyed that a Canadian court will hear our claims,” said plaintiff Gize Araya. “Since starting the case, we have always hoped Canada would provide justice for what we suffered at the mine.”

      The court also rejected Nevsun’s argument that the company should be immune from suit because the case might touch on actions of the Eritrean government, including allegations of severe human rights violations. Justice Newbury, looking to a recent UK case on the issue, wrote that “torture (and I would add, forced labour and slavery) is ‘contrary to both peremptory norms of international law and a fundamental value of domestic law.’”

      This latest ruling by the B.C. Court of Appeal follows one earlier this year permitting a case to go forward against Tahoe Resources for injuries suffered by protestors in Guatemala who were shot outside the company’s mine.

      “The Nevsun and Tahoe cases show that Canadian courts can properly exercise jurisdiction over Canadian companies with overseas operations,” said Amanda Ghahremani, Legal Director of the Canadian Centre for International Justice. “When there is a real risk of injustice for claimants in a foreign legal system, their cases should proceed here.”

      Nevsun Resources Ltd...advises that the British Columbia Supreme Court has refused to permit a claim against Nevsun to proceed as a common law class action. The court did permit the lawsuit by the three named plaintiffs to continue. Today’s court decision addresses only preliminary legal challenges to the action raised by Nevsun. The judgment makes no findings with respect to the plaintiffs’ allegations, including whether any of them were in fact at the Bisha Mine. The judge also emphasized that the case raises novel and complex legal questions, including on international law, which have never before been considered in Canada. Nevsun is studying the court’s decision and considering an appeal of the decision that the action can proceed at all.   • Who are Eritrea’s foreign friends ?

    You might think that a government that is held by a United Nations Commission to have been guilty crimes against humanity would not really be attractive to foreign supporters.

    The same cannot be said of a group of foreign individuals and institutions who have become what might be termed ‘friends of the Eritrean government.’ For a variety of reasons they have become its ‘cheerleaders’ abroad. They are, of course, not to be confused with friends of the Eritrean people (among whom are both authors of this article). These are supporters the government of President Isaias Afwerki, no matter how compelling the evidence of human rights violations in the nation over which he presides. This article will look briefly at these foreign ‘friends’.

    • Eritrea’s Silent Totalitarianism

      Eritrea emerged as a sovereign state in 1991, following 30 years of armed battle for independence with its neighbour Ethiopia. The nationalist movement of the Eritrean People’s Liberation Front (FPLE) was a Maoist guerilla party that led Eritrea to independence in 1993 under secretary general Isaias Afwerki. The movement’s leader then became the first Eritrean President and reshaped the movement into a single party called the Popular Front for Democracy and Justice (FPDJ).

      There is no denying that the length and the severity of the war that led to Eritrea`s accession to independence have forged a real esprit de corps among its leaders. But while that spirit may be useful in times of war, it can have devastating effects on the civil society in times of peace. Since its inception, arbitrary detentions and cases of torture, rape, and extrajudicial killings have marred the regime – as was reported by a special UN commission in June 2016. According to the report, more than 400,000 Eritreans have been enslaved in the national conscription program, where they are forced to work in the army or the bureaucracy. In addition, there are no independent newspapers left and state-run media outlets are the sole providers of news.

      Yet twenty-five years into his party`s rule, Isaias Afwerki is still the president of Eritrea. Elections were scheduled for 2001, but have yet to take place. It is no wonder that Eritrea is often nicknamed the “North Korea of Africa.”

      Censorship and Repression

      According to Reporters Without Borders’ World Press Freedom report of 2017, Eritrea is ranked 179th out of 180 countries; only North Korea ranks lower. To keep its grip on power, the repressive regime of Isaias Afwerki has used imprisonment and torture of opponents, harsh crackdowns on independent journalists, and arbitrary arrests, ultimately creating “a media climate so oppressive that even reporters for state-run news outlets live in constant fear of arrest.” In 2015, Eritrea had the third highest number of imprisoned journalists after China and Iran, all of whom have been given no trial and no criminal charges.

      But repression has not always characterized Eritrea’s attitude towards journalism. In 1996, the number of independent newspapers boomed, many of which were founded by graduates of the University of Asamara and presented pluralistic views. However, the political climate changed. Following a border conflict with Ethiopia (1998-2000), President Isawa Afewerki’s practices abruptly turned totalitarian. Using new measures to perpetuate his power, Afewerki established his position toward his opponents in the beginning of the 2000s by eliminating independent media outlets and cracking down on all dissent. Fifteen members of the People’s Front for Democracy and Justice wrote a public letter denouncing Afwerki’s “illegal and unconstitutional” actions, and were immediately jailed. Eleven of them are still incarcerated without trial, and have become known as the G-15. On the same day, 18 September 2001, Afwerki banned private newspapers and jailed eleven journalists, who remain in undisclosed locations. In addition, religious freedom in Eritrea is also curtailed, with the government allowing the practice of only four religions: the Eritrean Orthodox Church, the Evangelical Lutheran Church of Eritrea, the Roman Catholic Church and Islam.

      To be sure, satellite dishes offering BBC, CNN and Al Jazeera can be accessed throughout the country, and Internet, although very slow, appears to be unfiltered. Even so, however, according to U.N. International Telecommunication Union figures, internet service is available only when channeled through slow dial-up connections and fewer than 1.2% of the population is using the internet in 2017, the lowest number on the list of 148 countries. Similarly, only 5.6% of Eritrea’s population owns a cell phone, again the lowest figure in the world. Inside Eritrea, all mobile communications are channeled through Eritrea’s sole state-run telecommunication company, EriTel. That the regulation of mobile communications is a tool to further project Isaias’ government authority on its population is evidenced by Eritrea’s decision to cancel plans to provide mobile Internet for its citizens by fear of the spread of the Arab Spring protests. Further isolationist policies include the restrictions placed on foreign correspondents. Indeed, the last remaining accredited international reporter was expelled in 2007, and ‘‘the few outside reporters invited in occasionally to interview the president are closely monitored.”

      Today, thousands of dissident and political prisoners, from former politicians and journalists to practitioners of illegal religions, continue to be detained with no planned trial in sight. Often, they are held in underground jails in remote areas where prisoners are placed in metal containers and suffer from intolerable heat. In some cases, information regarding the state of the prisoners’ health is not disclosed to the public nor their family.

      The report from the UN commission of inquiry on human rights in Eritrea claims that state spying and surveillance leads to the constant fear of arbitrary arrest, torture, disappearance or death. Ultimately, this culture of fear has created a climate of self-censorship and mistrust that affects communities and families. Denouncement of deserters can be rewarded with benefits from local administrators, and families of the deserter legally have to pay amends (50 000 nakfas for each deserter – or 2500 euros). This structure creates incentives to denounce members of your own family or your neighbours, further consolidating the role of an authoritarian state whose actions and agents are constantly expanding and interfering in the everyday life of its citizens.

      Forced Military Service

      In 1994, a national system of military mobilization for young Eritreans legally imposed 6 months of military training and one year of service. National service was perceived as a duty for the citizens which had not participated in the war of independence. Thus, tens of thousands of men and women from 18 and 40 years of old are recruited each year.

      However, since the border dispute between Ethiopia and Eritrea that began in 1998, the period of service has been indefinitely extended. Eritreans over 18 years old are now conscripted into 18 months of military service, followed by an indefinite period of civil service that often lasts more than a decade. Since 2002, this expansion of the conscription period has become the central pillar of the national development campaign known as WofriWarsay Ykä?Lo, which aims to rebuild the country devastated by war, and to cope with the economic consequences of the decrease in trade relations with Ethiopia. The government also justifies national conscription by arguing that there is an ongoing highly militarized border dispute with its neighbor, Ethiopia.

      There seems to be little doubt, however, that this mobilization of almost all the available labor force in the country aims to set up a planned economy and to extend the reach of authoritarian control into social activities. Often referred to as forced labour, the national service is rooted in three-decade struggle for independence that gave rise to an obsession over security, evidenced by party and government policies and the consequent process of militarization of society. Anyone who defies this national program is subject to cruel torture.

      Completion of national service is a condition for full citizenship for young adults, which grants Eritreans who are required to serve indefinitely only limited rights in the choice of their studies and their professional activity, as well as restricts their freedom of movement within national borders. Freedom of enterprise and land ownership are also not allowed for conscripts, and their low wages and arbitrary leave allowances often disturb family life. But that is not all. Conditions in military training camps are dire, and conscripts must tolerate the inadequacy of food, water, hygiene facilities, accommodation and medical facilities. These camps are also sites of sexual violence perpetrated against women and girls, the purpose of which is to extract confessions, punish, and intimidate. To escape conscription, many avoid public places and hide. Today, 10 000 ‘deserters’ are imprisoned, often in metallic containers in remote cities.

      In light of the aforementioned constraints on freedom of expression and movement imposed on Eritreans, understanding why many decide to flee the country becomes less challenging. The United Nations Refugee Agency (UNHCR) reported 474, 296 Eritreans globally registered as refugees and asylum seekers at the end of 2015, which represents around 12 percent of Eritrea’s estimated population of 3.6 million.

      Constrained Liberties in the Midst of Extreme Poverty

      However, the report of the U.N commission does not escape criticism. Journalist Bronwyn Bruton argues that since the U.N commissioners were denied entry into Eritrea, they relied almost exclusively on the testimonies of about 800 Eritrean refugees that had decided to leave Eritrea and failed to interview diplomats who had recently traveled to the country: ‘‘The commissioners didn’t interview Western diplomats or U.N. staff based in Eritrea. (…) They discarded tens of thousands of testimonials from Eritreans defending the Isaias regime, claiming these were irrelevant or inauthentic.”

      While acknowledging the human rights abuses taking place in Eritrea, Bruton argues that the report does not reflect the reality on the ground. Although the report claims that Eritreans who leave the country and eventually return face arbitrary imprisonment and torture, Bruton sheds light on the reports from some Horn of Africa reporters, including Mary Harper from BBC, about the thousands of Eritreans who have returned to celebrate independence: “They have spoken freely, and on camera, with dozens of Eritreans about the political situation in the country, despite the COIE’s assertion that Eritreans exist in a climate of fear without the ability to speak their minds.”

      Further, scholars have questioned the potential causal link between socioeconomic development and democracy. Some scholars worry that, should democracy occur before a country achieves a considerable level of socioeconomic development, governments would not be capable of accommodating all the new political and economic demands. Many have continuously justified authoritarian rule as a necessary ‘stopgap’ to jump-start economic growth. In their view, authoritarian regimes can limit workers’ wages and control labor unrest to increase profit and attract external and domestic private-sector investment. [1] To diversify its economy and to convert conscript jobs to formal civil-service or private-sector positions, some have argued that the Eritrean government has no other choice but to develop its economy: ‘‘It will simply be impossible to reform Eritrea’s controversial National Service Program (…) without improving the economy. Simply releasing those people to joblessness would cause insecurity, and of course the country would completely cease functioning….’’.

      In short, Eritrea is facing the problem of development in a situation of extreme poverty.

      To lift itself out of mass poverty, it needs a quantum leap in the accumulation of capital that is required to build infrastructure and educate the population. The Eritrean regime has evidenced their aspirations to develop through their achievements in sectors like education and healthcare which are strategic to the functioning of the state. According to the Eritrea Health MDGs Report of 2014, Eritrea is one of the only countries likely to fulfill the Millenium Development Goals in health. The achievements include the reduction of infant and child mortality rates and the increase of immunisation coverage. Considering that Eritrea ranks among the poorest countries in the world, such “Concerted government programmatic and resource investment in the health sector” should be acknowledged as a successful achievement.

      In this context, conscript work is a concerted effort to impoverish the individual for the benefit of the collective. The legitimacy of the move hinges on the ability of the government to build a viable consensus on its goals without excessive coercion. If the effort is squandered in useless projects or diverted through corrupt channels, the regime will devolve into the worst type of despotism. The restrictions on human liberties implemented by Isaias’ government are excessive and not necessary to secure the capital needed for Eritrea’s development. Should, however, the regime succeed in accumulating growth for its population while renouncing its draconian measures against dissent, it could pave the way toward a sustainable development for generations of Eritreans.

    The Eritrean government continues to repress religious freedom for unregistered, and in some cases registered, religious communities. Systematic, ongoing, and egregious religious freedom violations include torture or other ill-treatment of religious prisoners, arbitrary arrests and detentions without charges, a prolonged ban on public religious activities of unregistered religious groups, and interference in the internal affairs of registered religious groups. The situation is particularly grave for Evangelical and Pentecostal Christians and Jehovah’s Witnesses. The government dominates the internal affairs of the Orthodox Church of Eritrea, the country’s largest Christian denomination, and suppresses the religious activities of Muslims, especially those opposed to the government-appointed head of the Muslim community. In light of these violations, USCIRF again recommends in 2016 that Eritrea be designated a “country of particular concern,” or CPC, under the International Religious Freedom Act (IRFA). Since 2004, USCIRF has recommended, and the State Department has designated, Eritrea as a CPC, most recently in July 2014.

As chair of the Inter-Parliamentary Union committee on the human rights of parliamentarians, I, with a number of parliamentarians from around the world, have been trying to establish the fate of the 11 Eritrean parliamentarians detained since September 2011, referred to in one of your reports. I would like to ask the Eritrean government to contact me or the IPU committee in Geneva to provide an update on the case. Over the years of captivity, many rumours have circulated in the absence of official pronouncements. The detainees’ welfare remains of paramount concern to the committee, which has asked to be able to visit them in prison. The families of the detained have also suffered enough. They need to know whether their relatives are still alive, and, if so, must be allowed to see them.

    • Concerns over Eritrea’s role in efforts by Africa and EU to manage refugees

      Early in 2019 the Eritrean government will take over the chair of the key Africa and European Union (EU) forum dealing with African migration, known as the Khartoum Process.

      The Khartoum Process was established in the Sudanese capital in 2014. It’s had little public profile, yet it’s the most important means Europe has of attempting to halt the flow of refugees and migrants from Africa. The official title says it all: The EU-Horn of Africa Migration Route Initiative. Its main role is spelled out as being:

      primarily focused on preventing and fighting migrant smuggling and trafficking in human beings.

      Chairing the Khartoum Process alternates between European and African leaders. In January it will be Africa’s turn. The steering committee has five African members – Egypt, Eritrea, Ethiopia, South Sudan and Sudan. A number of others nations, such as Kenya to Tunisia, have participating status.

      The African countries chose Eritrea to lead this critical relationship. But it’s been heavily criticised because it places refugees and asylum seekers in the hands of a regime that is notorious for its human rights abuses. Worse still, there is evidence that Eritrean officials are directly implicated in human trafficking the Khartoum Process is meant to end.

      That the European Union allowed this to happen puts in question its repeated assurances that human rights are at the heart of its foreign policies.

      The Khartoum Process

      The Khartoum Process involves a huge range of initiatives. All are designed to reduce the number of Africans crossing the Mediterranean. These include training the fragile Libyan government’s coastguards, who round up migrants at sea and return them to the brutal conditions of the Libyan prison camps.

      The programme has sometimes backfired. Some EU-funded coastguards have been accused of involvement in people trafficking themselves.

      The EU has also established a regional operational centre in Khartoum. But this has meant European officials collaborating with the security forces of a government which has regularly abused its own citizens, as well as foreigners on its soil. President Omar al-Bashir himself has been indicted for war crimes and crimes against humanity by the International Criminal Court.

      The centre requires European police and other officers to work directly with the security officials who uphold the Sudanese government. According to the head of the immigration police department,

      The planned countertrafficking coordination centre in Khartoum – staffed jointly by police officers from Sudan and several European countries, including Britain, France and Italy – will partly rely on information sourced by Sudanese National Intelligence.

      The centre also receives support from Sudan’s Rapid Support Forces, which grew out of the Janjaweed: notorious for the atrocities it committed in Darfur.

      These initiatives are all very much in line with the migration agreement signed in the Maltese capital in 2015. Its action plan detailed how European institutions would co-operate with their African partners to fight

      irregular migration, migrant smuggling and trafficking in human beings.

      Europe promised to offer training to law enforcement and judicial authorities in new methods of investigation and to assist in setting up specialised anti-trafficking and smuggling police units.

      It is this sensitive relationship that will now come under Eritrean supervision. They will be dealing with some of the most vulnerable men, women and children who have fled their own countries. It is here that the process gets really difficult, because Eritrean government officials have themselves been implicated in human trafficking. UN researchers, working for the Security Council described how this took place in 2011.

      More recently, survivors of human trafficking interviewed by a team led by Dutch professor Mirjam van Reisen, described how the Eritrean Border Surveillance Unit ferried refugees out of Eritrea, at a price.

      The danger is that implicated Eritrean officials will play a critical role in the development of the Khartoum Process.

      Europe’s commitment to human rights

      The EU has repeatedly stressed that its commitment to human rights runs through everything it does. Yet the Eritrean government, with which the EU is now collaborating so closely, has been denounced for its human rights abuses by no less than the Special Rapporteur for Eritrea to the UN Human Rights Council as recently as June 2018.

      As Mike Smith, who chaired the UN Commission Inquiry into Eritrea in 2015, put it:

      The many violations in Eritrea are of a scope and scale seldom seen anywhere else in today’s world. Basic freedoms are curtailed, from movement to expression; from religion to association. The Commission finds that crimes against humanity may have occurred with regard to torture, extrajudicial executions, forced labour and in the context of national service.

      The EU itself has remained silent. It is difficult to see how the EU can allow its key African migration work to be overseen by such a regime, without running foul of its own human rights commitments. European leaders need to reconsider their relationships with African governments implicated in gross human rights abuses if they are to uphold these values.

      The Khartoum Process may have reduced the flow of refugees and asylum seekers across the Mediterranean. But it hasn’t eliminated the need for a fresh approach to their plight.
