    Your face is no longer just your face—it’s been augmented. At a football game, your face is currency, used to buy food at the stadium. At the mall, it is a ledger, used to alert salespeople to your past purchases, both online and offline, and shopping preferences. At a protest, it is your arrest history. At the morgue, it is how authorities will identify your body.

    Facial-recognition technology stands to transform social life, tracking our every move for companies, law enforcement, and anyone else with the right tools. Lawmakers are weighing the risks versus rewards, with a recent wave of proposed regulation in Washington State, Massachusetts, Oakland, and the U.S. legislature. In May, Republicans and Democrats in the House Committee on Oversight and Reform heard hours of testimony about how unregulated facial recognition already tracks protesters, impacts the criminal-justice system, and exacerbates racial biases. Surprisingly, they agreed to work together to regulate it.

    The Microsoft president Brad Smith called for governments “to start adopting laws to regulate this technology” last year, while the Amazon Web Services CEO Andy Jassy echoed those comments in June, likening the technology to a knife. It’s a less dramatic image than the plutonium and nuclear-waste metaphors critics employ, but his message—coming from an executive at one of the world’s most powerful facial-recognition technology outfits—is clear: This stuff is dangerous.

    But crucially, Jassy and Smith seem to argue, it’s also inevitable. In calling for regulation, Microsoft and Amazon have pulled a neat trick: Instead of making the debate about whether facial recognition should be widely adopted, they’ve made it about how such adoption would work.

    Without regulation, the potential for misuse of facial-recognition technology is high, particularly for people of color. In 2016 the MIT researcher Joy Buolamwini published research showing that tech performs better on lighter-skinned men than on darker-skinned men, and performs worst on darker-skinned women. When the ACLU matched Congress members against a criminal database, Amazon’s Rekognition software misidentified black Congress members more often than white ones, despite there being far fewer black members.

    This includes House Chairman Elijah Cummings, a Baltimore native whose face was also scanned when he attended a 2015 rally in memory of Freddie Gray, the unarmed black teenager who died of a spinal-cord injury while in police custody. The Baltimore Police Department used facial recognition to identify protesters and target any with outstanding warrants. Most of the protesters were black, meaning the software used on them might have been less accurate, increasing the likelihood of misidentification. Expert witnesses at the committee hearing in May warned of a chilling effect: Protesters, wary of being identified via facial recognition and matched against criminal databases, could choose to stay home rather than exercise their freedom of assembly.

    Microsoft and Amazon both claim to have lessened the racial disparity in accuracy since the original MIT study and the ACLU’s report. But fine-tuning the technology to better recognize black faces is only part of the process: Perfectly accurate technology could still be used to support harmful policing, which affects people of color. The racial-accuracy problem is a distraction; how the technology is used matters, and that’s where policy could prevent abuse. And the solution Microsoft and Amazon propose would require auditing face recognition for racial and gender biases after they’re already in use—which might be too late.

    In early May, The Washington Post reported that police were feeding forensic sketches to their facial-recognition software. A witness described a suspect to a sketch artist, then police uploaded the sketch to Amazon’s Rekognition, looking for hits, and eventually arrested someone. Experts at the congressional hearing in May were shocked that a sketch submitted to a database could credibly qualify as enough reasonable suspicion to arrest someone.

    But Jassy, the Amazon Web Services CEO, claimed that Amazon has never received a report of police misuse. In May, Amazon shareholders voted down a proposal that would ban the sale of Rekognition to police, and halt sales to law enforcement and ICE. Jassy said that police should only rely on Rekognition results when the system is 99 percent confident in the accuracy of a match. This is a potentially critical safeguard against misidentification, but it’s just a suggestion: Amazon doesn’t require police to adhere to this threshold, or even ask. In January, Gizmodo quoted an Oregon sheriff’s official saying his department ignores thresholds completely. (“There has never been a single reported complaint from the public and no issues with the local constituency around their use of Rekognition,” a representative from Amazon said, in part, in a statement to Gizmodo.)

    The A.I.-generated “deepfake” video implicitly but unmistakably calls for Facebook to make a public statement on its content moderation polices. The platform has long been criticized for permitting the spread of disinformation and harassment, but it became particularly acute recently, when the company said that it would not remove the “Drunk Pelosi” video.

    On Thursday, the House Permanent Select Committee on Intelligence will hold an open hearing on A.I. and the potential threat of deepfake technology to Americans. Many technology researchers believe that deepfakes—realistic-looking content developed using machine learning algorithms—will herald a new era of information warfare. But as the “Drunk Pelosi” video shows, slight edits of original videos may be even more difficult to detect and debunk, creating a cascade of benefits for those willing to use these digital dirty tricks.

    The video, posted to a self-described news Facebook page with a fan base of about 35,000, depicted Nancy Pelosi slurring her words and sounding intoxicated. However, when compared with another video from the same event, it was clear even to nonexperts that it had been slowed down to produce the “drunken” effect. Call it a “cheapfake”—it was modified only very slightly. While the altered video garnered some significant views on Facebook, it was only after it was amplified by President Donald Trump and other prominent Republicans on Twitter that it became a newsworthy issue. The heightened drama surrounding this video raises interesting questions not only about platform accountability but also about how to spot disinformation in the wild.

    “Cheapfakes” rely on free software that allows manipulation through easy conventional editing techniques like speeding, slowing, and cutting, as well as nontechnical manipulations like restaging or recontextualizing existing footage that are already causing problems. Cheapfakes already call into question the methods of evidence that scientists, courts, and newsrooms traditionally use to call for accountability

    Many will never know the video was a fake, but the advantages it gave to pundits will echo into the future. It’s a recent example of what legal theorists Bobby Chesney and Danielle Citron call the liar’s dividend . Those wishing to deny the truth can create disinformation to support their lie, while those caught behaving badly can write off the evidence of bad behavior as disinformation. In a new survey from Pew Research Center, 63 percent of respondents said that they believe altered video and images are a significant source of confusion when it comes to interpreting news quality. That loss of trust works in favor of those willing to lie, defame, and harass to gain attention.

    As Daniel Kreiss and others have pointed out, people don’t just share content because they believe it. They do it for a host of reasons, not the least of which is simply because a message speaks to what users see as an implicit truth of the world even as they know it is not factually true. Researchers have found that creating and sharing hateful, false, or faked content is often rewarded on platforms like Facebook.

    The looming threat of the deepfake is worth attention—from politicians, like at the upcoming hearing; from journalists; from researchers; and especially from the public that will ultimately be the audience for these things. But make no mistake: Disinformation doesn’t have to be high tech to cause serious damage.

    In response, the House of Representatives will hold its first dedicated hearing tomorrow on deepfakes, the class of synthetic media generated by AI. In parallel, Representative Yvette Clarke will introduce a bill on the same subject. A new research report released by a nonprofit this week also highlights a strategy for coping when deepfakes and other doctored media proliferate.

    The deepfake bill
    The draft bill, a product of several months of discussion with computer scientists, disinformation experts, and human rights advocates, will include three provisions. The first would require companies and researchers who create tools that can be used to make deepfakes to automatically add watermarks to forged creations.

    The second would require social-media companies to build better manipulation detection directly into their platforms. Finally, the third provision would create sanctions, like fines or even jail time, to punish offenders for creating malicious deepfakes that harm individuals or threaten national security. In particular, it would attempt to introduce a new mechanism for legal recourse if people’s reputations are damaged by synthetic media.

    “This issue doesn’t just affect politicians,” says Mutale Nkonde, a fellow at the Data & Society Research Institute and an advisor on the bill. “Deepfake videos are much more likely to be deployed against women, minorities, people from the LGBT community, poor people. And those people aren’t going to have the resources to fight back against reputational risks.”

    But the technology has advanced at a rapid pace, and the amount of data required to fake a video has dropped dramatically. Two weeks ago, Samsung demonstrated that it was possible to create an entire video out of a single photo; this week university and industry researchers demoed a new tool that allows users to edit someone’s words by typing what they want the subject to say.

    It’s thus only a matter of time before deepfakes proliferate, says Sam Gregory, the program director of Witness. “Many of the ways that people would consider using deepfakes—to attack journalists, to imply corruption by politicians, to manipulate evidence—are clearly evolutions of existing problems, so we should expect people to try on the latest ways to do those effectively,” he says.

    The report outlines a strategy for how to prepare for such an impending future. Many of the recommendations and much of the supporting evidence also aligns with the proposals that will appear in the House bill.

    The report found that current investments by researchers and tech companies into deepfake generation far outweigh those into deepfake detection. Adobe, for example, has produced many tools to make media alterations easier, including a recent feature for removing objects in videos; it has not, however, provided a foil to them.

    The result is a mismatch between the real-world nature of media manipulation and the tools available to fight it. “If you’re creating a tool for synthesis or forgery that is seamless to the human eye or the human ear, you should be creating tools that are specifically designed to detect that forgery,” says Gregory. The question is how to get toolmakers to redress that imbalance.

  • U.S. is using unreliable dental exams to hold teen migrants in adult detention

    The young Bangladeshi sitting in the dentist’s chair last October thought he was getting checked for diseases.

    Dental staff examined his teeth, gave him a cleaning and sent him back to the juvenile facility where he had been held for months since illegally crossing the border in July.

    But a checkup wasn’t the real purpose of the dental work. The government wanted to figure out if “I.J.,” as the young migrant has been identified, really was 16, as he said, or an adult.

    The use of dental exams to help determine the age of migrants increased sharply in the last year, one aspect of the Trump administration’s crackdown on immigration and illegal border crossings.

    The accuracy of forensic testing to help determine the age of migrants is very much a subject of the debate. And with the stakes so high, the exams are becoming another legal battleground for the government.

    Federal law prohibits the government from relying exclusively on forensic testing of bones and teeth to determine age. But a review of court records shows that in at least three cases – including I.J.’s – the government did just that, causing federal judges to later order the minors released from adult detention.

    In a case last year, a Guatemalan migrant was held in adult detention for nearly a year after a dental exam showed he was likely 18, until his attorneys fought to get his birth certificate, which proved he was 17.

    For I.J., the results had serious ramifications. Based on the development of his teeth, the analysis showed an 87.70% probability that he had turned 18.

    An immigration official reported that it was apparent to the case manager that I.J. “appeared physically older than 17 years of age,” and that he and his mother had not been able to provide a second type of identification that might prove his age.

    The next month, Immigration and Customs Enforcement agents took him away in shackles and placed him in a medium-security prison that houses immigrant detainees.

    He spent about five months in adult detention and 24 of those days in segregated custody. Whenever he spoke with an officer, he would say he was a minor — unaware for more than a month that his teeth had landed him there.

    “I came to the United States with a big dream,” I.J. said. “My dream was finished.”

    But when the Arizona-based Florence Immigrant and Refugee Rights Project took I.J.’s case to federal court, a district judge found that the Office of Refugee Resettlement’s age re-determination violated federal law and the agency’s own guidelines.

    In April, the judge ordered I.J. released back into Office of Refugee Resettlement custody, a program responsible for unaccompanied migrant children. He has since reunited with his family in New York. The Florence Project also filed another case in federal court that resulted in the government voluntarily returning a Bangladeshi minor to ORR custody and rescinding his age re-determination.

    As the government grappled with an influx of the number of families and children arriving at the border in fiscal year 2018, approvals of ORR age determination exams more than doubled.

    These handful of cases where a minor was released from adult detention is almost certainly an undercount, as most migrants held in adult detention do not have legal representation and are unlikely to fight their cases.

    It is unclear how often migrants pretend to be minors and turn out to be adults. In a call with reporters earlier this year, a Customs and Border Protection official said that from April 2018 to March 25 of this year, his agents had identified more than 3,100 individuals in family units making fraudulent claims, including those who misrepresented themselves as minors.

    Unaccompanied minors are given greater protections than adults after being apprehended. The government’s standard refers migrants to adult custody if a dental exam analysis shows at least a 75% probability that they are 18 or older. But other evidence is supposed to be considered.

    Dr. David Senn, the director of the Center for Education and Research in Forensics at UT Health San Antonio, has handled more than 2,000 age cases since 1998.

    A program that Senn helped develop estimates the mean age of a person and the probability that he or she is at least 18. In addition to looking at dental X-rays, he has also looked at skeletal X-rays and analyzed bone development in the hand and wrist area.

    He handled a larger number of cases in the early 2000s, but last year he saw his caseload triple — rising to 168. There appears to be a slowdown this calendar year for Senn, one of a few dentists the government uses for these analyses.

    He said making an exact age determination is not possible.

    “We can only tell you what the statistics say,” Senn said. “I think the really important thing to note is that most people who do this work are not trying to be policemen or to be Border Patrol agents or immigration …. what we’re trying to do is help. What we’re trying to do is protect children.”

    In 2007 and again in 2008, the House Appropriations Committee called on the Department of Homeland Security to stop relying on forensic testing of bones and teeth. But it was the Trafficking Victims Protection Reauthorization Act of 2008 that declared age determinations should take into account “multiple forms of evidence, including the non-exclusive use of radiographs.”

    In a Washington state case, an X-ray analysis by Senn showed a 92.55% probability that Bilal, a Somali migrant, already had reached 18 years of age. ICE removed him from his foster home and held him in an adult detention center.

    “Not only were they trying to save themselves money, which they paid to the foster family, but they were wrecking this kid’s life,” said Matt Adams, legal director for the Northwest Immigrant Rights Project, which represented Bilal. “They were just rolling the dice.”

    In 2016, a federal judge found that the Office of Refugee Resettlement relied exclusively on the dental exam and overturned the age determination for the young Somali.

    Last year, in the case of an Eritrean migrant who said he was 17, Senn’s analysis of dental X-rays showed a 92.55% probability that he had turned 18, and provided a range of possible ages between 17.10 and 23.70.

    It was enough to prompt his removal from a juvenile facility and placement into an adult one.

    Again, a district judge found that the government had relied exclusively on the dental exam to determine his age and ordered the migrant released back into ORR custody.

    Danielle Bennett, an ICE spokeswoman, said the agency “does not track” information on such reversals.

    “We should never be used as the only method to determine age,” Senn said. “If those agencies are not following their own rules, they should have their feet held to the fire.”

    Similar concerns over medical age assessments have sprung up in other countries, including the United Kingdom and Sweden.

    The United Nations High Commissioner for Refugees’ guidance about how adolescent migrants’ ages should be analyzed says that if countries use scientific procedures to determine age, that they should allow for margins of error. Michael Bochenek, an attorney specializing in children’s rights at Human Rights Watch, said that for adolescents, the margin of error in scientific tests is “so big that it doesn’t tell you anything.”

    An influx of Bangladeshi migrants claiming to be minors has contributed to the government’s recent use of dental exams. From October through March 8, more than 150 Bangladeshis who claimed to be minors and were determined to be adults were transferred from the Office of Refugee Resettlement to ICE custody, according to the agency.

    In fiscal year 2018, Border Patrol apprehensions of Bangladeshi migrants went up 109% over the year before, rising to 1,203. Similarly, the number of Bangladeshi minors in ORR custody increased about 221% between fiscal 2017 and fiscal 2018, reaching 392.

    Ali Riaz, a professor at Illinois State University, said Bangladeshis are leaving the country for reasons including high population density, high unemployment among the young, a deteriorating political environment and the “quest for a better life.”

    In October, Myriam Hillin, an ORR federal field specialist, was told that ICE had information showing that a number of Bangladeshi migrants in their custody claiming to be underage had passports with different birth dates than on their birth certificates.

    Bochenek said it’s common for migrant children to travel with fake passports that make them appear older, because in some countries minors are more likely to be intercepted or questioned by immigration agents.

    While I.J. was able to regain status as a minor, three Bangladeshi migrants who crossed the U.S.-Mexico border illegally in the San Diego area in October 2018 are still trying to convince the government they are underage.

    Their passports didn’t match their birth certificates. Dental exams ordered by immigration officials found that each of them had about an 89% likelihood of being adults.

    “Both subjects were adamant that the passports were given to them by the ‘agent’ (smuggler), however, there is little reason to lie to any of the countries they flew into,” wrote one Border Patrol agent, describing the arrest of two of the migrants. “Also, it is extremely difficult to fake a passport, especially for no reason. I have seen [unaccompanied children] fly into each of the countries (except for Panama and Costa Rica) and pass through with no problem. This is a recent trend with Bangladeshis. They do it in order to be released from DHS custody faster.”

    During interviews, the young migrants, Shahadat, Shahriar and Tareq, told asylum officers that smugglers had given them the passports, according to records from the interviews.

    When asked why they had been given those birth dates, they said it had something to do with smugglers’ plans for their travel.

    “I don’t have that much idea,” Shahadat told an asylum officer, according to the officer’s notes in a summary-style transcript. “When I asked why, they told me that if I don’t give this [date of birth] there will be problems with travel.”

    Shahriar told the officer that the smuggler became aggressive when questioned.

    The migrants have submitted copies of birth certificates, school documents and signed statements from their parents attesting to their claimed birth dates. An online database of birth records maintained by the government of Bangladesh appears to confirm their date of birth claims.

    Shahriar also provided his parents’ birth certificates. If he were as old as immigration officials believe him to be, his mother would have been 12 years old when she had him.

    In each case, immigration officials stood by the passport dates.

    Shahadat and Shahriar are being held in Otay Mesa Detention Center. Tareq was held at the facility for months before being released on a $7,500 bond. All three are moving through the immigration system as adults, with asylum proceedings their only option to stay in the U.S..

    At least one of the migrants, Shahadat, was placed in administrative segregation, a version of solitary confinement in immigration detention, when his age came into question, according to documents provided by their attorney.

    A judge ordered him deported.

Sam Graves of Missouri, ranking member of the House Transportation and Infrastructure Committee. He added that preliminary reports about the accident “compound my concerns about quality training standards in other countries.”

    Graves was repeating the main points in a report written by two pilots at a major U.S. airline that pointed to pilot error as “the most consequential factor” in both crashes. Their report was commissioned and paid for by institutional investors with large holdings in Boeing stock.

    That case for pilot error as the major cause of the crashes seems close to a surrogate for what Boeing has only hinted at, and may be a key part of the manufacturer’s legal defense in liability lawsuits.

    Yet two flight-simulator sessions replicating the conditions on the doomed flights contradict Graves’ contention that better trained pilots would have escaped disaster. And some Western-trained pilots criticize the report as based on unverified assumptions and minimizing the intense stress Boeing’s runaway flight-control system imposed on the two flight crews.

    “I’m disappointed with those who sit in their lofty chairs of judgment and say this wouldn’t have happened to U.S. pilots,” said a veteran captain with a major U.S. airline, who asked not to be named to avoid involving his employer.

    As Democrats on the House Oversight Committee attempt to investigate soaring drug prices in the U.S., Republicans are warning the CEOs of some of America’s largest pharmaceutical companies against cooperating with the probe.

    Reps. Jim Jordan (R-Ohio) and Mark Meadows (R-N.C.), leaders of the far-right House Freedom Caucus, sent letters (pdf) to a dozen drug company CEOs “warning that information they provide to the committee could be leaked to the public by Democratic chair Elijah Cummings in an effort to tank their stock prices,” Buzzfeed reported Monday.

    Cummings, a Democrat from Maryland, launched his investigation in January with a request for “information and communications on price increases, investments in research and development, and corporate strategies to preserve market share and pricing power” from pharmaceutical giants such as Pfizer, Novartis, Johnson & Johnson, and others.

    In their letters to the same pharmaceutical companies, Jordan and Meadows suggested that Cummings is attempting to obtain information that “would likely harm the competitiveness of your company if disclosed publicly.”

    “While we cannot speculate about Chairman Cummings’s motives, we believe the committee should not pursue an investigation to ‘impact… stock prices with regard to drugs’—especially when there is bipartisan interest in real oversight of rising prescription drug prices,” the Republicans wrote in their letters, dated April 5.

    As Buzzfeed notes, Jordan and Meadows’ claims rest on an out-of-context quote from Cummings:

    The [Republicans’] letter quotes Cummings as saying of his drug team: “If you follow the headlines, we have already seen the impact they have had… on stock prices with regard to drugs. I mean, it has been astronomical.” The letter omits the rest of the sentence: “saving the taxpayers money.”

    In the edited quote, Cummings seems to be bragging about an “astronomical” impact on drug company stocks. In the context of his statements before and after, he seems to be saying the “astronomical” impact is on taxpayer savings, which justify giving his committee more resources. A minute later he says: “Whatever you all give us, we will give it back in savings by rooting out fraud, waste, and abuse.”

    In a statement to Buzzfeed, Cummings said Jordan—the ranking member of the House Oversight Committee—”is on the absolute wrong side here.”

    “He would rather protect drug company ‘stock prices’ than the interests of the American people,” Cummings added.

    Economist and University of California, Berkeley professor Robert Reich expressed agreement with Cummings, tweeting of the two Republicans, “Once again, they’re siding with Big Pharma at the expense of the American people.”

    #Customs_and_Border_Protection on Thursday ended its controversial $297 million hiring contract with Accenture, according to two senior DHS officials and an Accenture representative.
    As of December, when CBP terminated part of its contract, the company had only completed processing 58 applicants and only 22 had made it onto the payroll about a year after the company was hired.
    At the time, the 3,500 applicants that remained in the Accenture hiring pipeline were transferred to CBP’s own hiring center to complete the process.

    CBP cut ties with Accenture on processing applicants a few months ago, it retained some services, including marketing, advertising and applicant support.
    This week, the entire contract was terminated for “convenience,” government speak for agreeing to part ways without placing blame on Accenture.
    While government hiring is “slow and onerous, it’s also part of being in the government” and that’s “something we have to accept and deal with as we go forward,” said one of the officials.
    For its efforts, CBP paid Accenture around $19 million in start-up costs, and around $2 million for 58 people who got job offers, according to the officials.
    Over the last couple of months, CBP explored how to modify the contract, but ultimately decided to completely stop work and return any remaining funds to taxpayers.
    But it’s unclear how much money, if any, that will be.

    In addition, to the funds already paid to Accenture, CBP has around $39 million left to “settle and close the books” with the company, an amount which has yet to be determined.
    In November 2017, CBP awarded Accenture the contract to help meet the hiring demands of an executive order on border security that President Donald Trump signed during his first week in office. The administration directed CBP to hire an additional 7,500 agents and officers on top of its current hiring goals.
    “We were in a situation where we needed to try something new” and “break the cycle of going backwards,” said a DHS official about why the agency started the contract.

    Meanwhile, hiring remains difficult for the agency amid a surge of migrants at the southern border that is stretching CBP resources thin.
    It “continues to be a very challenging environment,” said one official about hiring efforts this year.

    In fact, one of the reasons that CBP didn’t need Accenture to process applicants, is because the agency didn’t receive as many applications as it initially planned for.
    The agency has been focused on beating attrition and has been able to recently “beat it by a modest amount,” said the official. “Ultimately we would like to beat it by a heck of a lot, but we’re not there yet.”

    • Border Profiteers

      On a recent sunny spring afternoon in Texas, a couple hundred Border Patrol agents, Homeland Security officials, and salespeople from a wide array of defense and security contractors gathered at the Bandera Gun Club about an hour northwest of San Antonio to eat barbecue and shoot each other’s guns. The techies wore flip-flops; the veterans wore combat boots. Everyone had a good time. They were letting loose, having spent the last forty-eight hours cooped up in suits and ties back at San Antonio’s Henry B. Gonzalez convention center, mingling and schmoozing, hawking their wares, and listening to immigration officials rail about how those serving in enforcement agencies are not, under any circumstances, Nazis.

      These profiteers and bureaucrats of the immigration-industrial complex were fresh from the 2019 #Border_Security_Expo —essentially a trade show for state violence, where law enforcement officers and weapons manufacturers gather, per the Expo’s marketing materials, to “identify and address new and emerging border challenges and opportunities through technology, partnership, and innovation.” The previous two days of panels, speeches, and presentations had been informative, a major in the Argentine Special Forces told me at the gun range, but boring. He was glad to be outside, where handguns popped and automatic rifles spat around us. I emptied a pistol into a target while a man in a Three Percenter militia baseball hat told me that I was a “natural-born killer.” A drone buzzed overhead until, in a demonstration of a company’s new anti-drone technology, a device that looked like a rocket launcher and fired a sort of exploding net took it down. “This is music to me,” the Argentine major said.

      Perhaps it’s not surprising the Border Security Expo attendees were so eager to blow off steam. This year’s event found many of them in a defensive posture, given the waves of bad press they’d endured since President Trump’s inauguration, and especially since the disastrous implementation of his family separation policy, officially announced by former Attorney General Jeff Sessions in April of 2018, before being rescinded by Trump two-and-a-half months later. Throughout the Expo, in public events and in background roundtable conversations with reporters, officials from the various component parts of the Department of Homeland Security rolled out a series of carefully rehearsed talking points: Immigrations and Customs Enforcement (ICE) and Customs and Border Patrol (CBP) need more money, personnel, and technology; taking migrants to hospitals distracts CBP officers from their real mission; and the 1997 Flores court settlement, which prohibits immigration enforcement agencies from detaining migrant families with children for more than twenty days, is undermining the very sovereignty of the United States. “We want a secure border, we want an immigration system that has integrity,” Ronald Vitiello, then–acting head of ICE, said in a keynote address to the hundreds of people gathered in San Antonio. “We have a generous immigration system in this country, but it has to have integrity in order for us to continue to be so generous.”

      More of a technocrat than his thuggish predecessor Thomas Homan, Vitiello also spoke at length about using the “dark web” to take down smugglers and the importance of having the most up-to-date data-management technology. But he spoke most adamantly about needing “a fix” for the Flores settlement. “If you prosecute crimes and you give people consequences, you get less of it,” he said. “With Flores, there’s no consequence, and everybody knows that,” a senior ICE official echoed to reporters during a background conversation immediately following Vitiello’s keynote remarks. “That’s why you’re seeing so many family units. We cannot apply a consequence to a family unit, because we have to release them.”

      Meanwhile, around 550 miles to the west, in El Paso, hundreds of migrants, including children and families, were being held by CBP under a bridge, reportedly forced to sleep on the ground, with inadequate medical attention. “They treated us like we are animals,” one Honduran man told Texas Monthly. “I felt what they were trying to do was to hurt us psychologically, so we would understand that this is a lesson we were being taught, that we shouldn’t have crossed.” Less than a week after the holding pen beneath the bridge closed, Vitiello’s nomination to run ICE would be pulled amid a spate of firings across DHS; President Trump wanted to go “in a tougher direction.”

      Family Values

      On the second day of the Border Security Expo, in a speech over catered lunch, Scott Luck, deputy chief of Customs and Border Protection and a career Border Patrol agent, lamented that the influx of children and families at the border meant that resources were being diverted from traditional enforcement practices. “Every day, about 150 agents spend their shifts at hospitals and medical facilities with illegal aliens receiving treatment,” he said. “The annual salary cost for agents on hospital watch is more than $11.5 million. Budget analysts estimate that 13 percent of our operational budget—the budget that we use to buy equipment, to buy vehicles for our men and women—is now used for transportation, medical expenses, diapers, food, and other necessities to care for illegal aliens in Border Patrol custody.”

      As far as Luck was concerned, every dollar spent on food and diapers is one not spent on drones and weapons, and every hour an agent spends guarding a migrant in a hospital is an hour they don’t spend on the border. “It’s not what they signed up for. The mission they signed up for is to protect the United States border, to protect the communities in which they live and serve,” he told reporters after his speech. “The influx, the volume, the clutter that this creates is frustrating.” Vitiello applied an Orwellian inversion: “We’re not helping them as fast as we want to,” he said of migrant families apprehended at the border.

      Even when discussing the intimate needs of detained migrant families, the language border officials used to describe their remit throughout the Expo was explicitly militaristic: achieving “operational control,” Luck said, requires “impedance and denial” and “situational awareness.” He referred to technology as a “vital force multiplier.” He at least stopped short of endorsing the president’s framing that what is happening on the border constitutes an invasion, instead describing it as a “deluge.”

      According to the Migration Policy Institute, a non-partisan think tank, the U.S. immigrant population has continued to grow—although at a slower rate than it did before the 2007 recession, and undocumented people appear to make up a smaller proportion of the overall population. Regardless, in fiscal year 2018, both ICE and CBP stepped up their enforcement activities, arresting, apprehending, and deporting people at significantly higher rates than the previous year. More than three times as many family members were apprehended at the border last year than in 2017, the Pew Research Center reports, and in the first six months of FY 2019 alone there were 189,584 apprehensions of “family units”: more than half of all apprehensions at the border during that time, and more than the full-year total of apprehended families for any other year on record. While the overall numbers have not yet begun to approach those of the 1980s and 1990s, when apprehensions regularly exceeded one million per year, the demographics of who is arriving at the United States southern border are changing: fewer single men from Mexico and more children and families from Guatemala, Honduras, and El Salvador—in other words, an ever-wider range of desperate victims of drug gangs and American policies that have long supported corrupt regimes.

      This change has presented people like Luck with problems they insist are merely logistical: aging Border Patrol stations, he told us at the Expo, “are not luxurious in any way, and they were never intended to handle families and children.” The solution, according to Vitiello, is “continued capital investment” in those facilities, as well as the cars and trucks necessary to patrol the border region and transport those apprehended from CBP custody to ICE detention centers, the IT necessary to sift through vast amounts of data accumulated through untold surveillance methods, and all of “the systems by which we do our work.”

      Neither Vitiello nor Luck would consider whether those systems—wherein thousands of children, ostensibly under the federal government’s care, have been sexually abused and five, from December through May of this year, have died—ought to be questioned. Both laughed off calls from migrant justice organizers, activists, and politicians to abolish ICE. “The concept of the Department of Homeland Security—and ICE as an agency within it—was designed for us to learn the lessons from 9/11,” Vitiello said. “Those needs still exist in this society. We’re gonna do our part.” DHS officials have even considered holding migrant children at Guantánamo Bay, Cuba, according to the New York Times, where a new $23 million “contingency mass migration complex” is being built. The complex, which is to be completed by the end of the year, will have a capacity of thirteen thousand.

      Violence is the Point

      The existence of ICE may be a consequence of 9/11, but the first sections of fencing along the U.S.-Mexico border—originally to contain livestock—went up in 1909 through 1911. In 1945, in response to a shift in border crossings from Texas to California, the U.S. Border Patrol and the Immigration and Naturalization Service recycled fencing wire and posts from internment camps in Crystal City, Texas, where more than a hundred thousand Japanese Americans had been imprisoned during World War II. “Although the INS could not erect a continuous line of fence along the border, they hoped that strategic placement of the fence would ‘compel persons seeking to enter the United States illegally to attempt to go around the ends of the fence,’” historian Kelly Lytle Hernández, quoting from government documents, writes in Migra! A History of the U.S. Border Patrol. “What lay at the end of the fences and canals were desert lands and mountains extremely dangerous to cross without guidance or sufficient water. The fences, therefore, discouraged illegal immigration by exposing undocumented border crossers to the dangers of daytime dehydration and nighttime hypothermia.”

      Apprehension and deportation tactics continued to escalate in the years following World War II—including Operation Wetback, the infamous (and heavily propagandized) mass-deportation campaign of 1954—but the modern, militarized border era was greatly boosted by Bill Clinton. It was during Clinton’s first administration that Border Patrol released its “Strategic Plan: 1994 and Beyond,” which introduced the idea of “prevention through deterrence,” a theory of border policing that built on the logic of the original wall and hinges upon increasing the “cost” of migration “to the point that many will consider it futile to continue to attempt illegal entry.” With the Strategic Plan, the agency was requesting more money, officers, and equipment in order to “enhance national security and safeguard our immigration heritage.”

      The plan also noted that “a strong interior enforcement posture works well for border control,” and in 1996, amid a flurry of legislation targeting people of color and the poor, Congress passed the Illegal Immigration Reform and Immigrant Responsibility Act, which empowered the federal government to deport more people more quickly and made it nearly impossible for undocumented immigrants to obtain legal status. “Before 1996, internal enforcement activities had not played a very significant role in immigration enforcement,” the sociologists Douglas Massey and Karen A. Pren wrote in 2012. “Afterward these activities rose to levels not seen since the deportation campaigns of the Great Depression.” With the passage of the Patriot Act in 2001 and the creation of the Department of Homeland Security and Immigration and Customs Enforcement in 2002, immigration was further securitized and criminalized, paving the way for an explosion in border policing technology that has further aligned the state with the defense and security industry. And at least one of Border Patrol’s “key assumptions,” explicitly stated in the 1994 strategy document, has borne out: “Violence will increase as effects of strategy are felt.”

      What this phrasing obscures, however, is that violence is the border strategy. In practice, what “prevention through deterrence” has meant is forcing migrants to cross the U.S.-Mexico border in the desert, putting already vulnerable people at even greater risk. Closing urban points of entry, for example, or making asylum-seekers wait indefinitely in Mexico while their claims are processed, pushes migrants into remote areas where there is a higher likelihood they will suffer injury and death, as in the case of seven-year-old Jakil Caal Maquin, who died of dehydration and shock after being taken into CBP custody in December. (A spokesperson for CBP, in an email response, deflected questions about whether the agency considers children dying in its custody a deterrent.) Maquin is one of many thousands who have died attempting to cross into the United States: the most conservative estimate comes from CBP itself, which has recovered the remains of 7,505 people from its southwest border sectors between 1998 and 2018. This figure accounts for neither those who die on the Mexican side of the border, nor those whose bodies remain lost to the desert.

      Draconian immigration policing causes migrants to resort to smugglers and traffickers, creating the conditions for their exploitation by cartels and other violent actors and increasing the likelihood that they will be kidnapped, coerced, or extorted. As a result, some migrants have sought the safety of collective action in the form of the “caravan” or “exodus,” which has then led the U.S. media and immigration enforcement agencies to justify further militarization of the border. Indeed, in his keynote address at the Expo, Luck described “the emerging prevalence of large groups of one hundred people or more” as “troubling and especially dangerous.” Later, a sales representative for the gun manufacturer Glock very confidently explained to me that this was because agents of al-Shabaab, the al-Qaeda affiliate in Somalia, were embedded with the caravans.

      Branding the Border

      Unsurprisingly, caravans came up frequently at the Border Security Expo. (An ICE spokesperson would later decline to explain what specific threat they pose to national security, instead citing general statistics about the terrorist watchlist, “special interest aliens,” and “suspicious travel patterns.”) During his own keynote speech, Vitiello described how ICE, and specifically its subcomponent Homeland Security Investigations, had deployed surveillance and intelligence-gathering techniques to monitor the progress of caravans toward the border. “When these caravans have come, we’ve had trained, vetted individuals on the ground in those countries reporting in real time what they were seeing: who the organizers were, how they were being funded,” he said, before going on an astonishing tangent:

      That’s the kind of capability that also does amazing things to protecting brands, property rights, economic security. Think about it. If you start a company, introduce a product that’s innovative, there are people in the world who can take that, deconstruct it, and create their own version of it and sell it as yours. All the sweat that went into whatever that product was, to build your brand, they’ll take it away and slap it on some substandard product. It’s not good for consumers, it’s not good for public safety, and it’s certainly an economic drain on the country. That’s part of the mission.

      That the then–acting director of ICE, the germ-cell of fascism in the bourgeois American state, would admit that an important part of his agency’s mission is the protection of private property is a testament to the Trump administration’s commitment to saying the quiet part out loud.

      In fact, brands and private industry had pride of place at the Border Security Expo. A memorial ceremony for men and women of Border Patrol who have been killed in the line of duty was sponsored by Sava Solutions, an IT firm that has been awarded at least $482 million in federal contracts since 2008. Sava, whose president spent twenty-four years with the DEA and whose director of business development spent twenty with the FBI, was just one of the scores of firms in attendance at the Expo, each hoping to persuade the bureaucrats in charge of acquiring new gear for border security agencies that their drones, their facial recognition technology, their “smart” fences were the best of the bunch. Corporate sponsors included familiar names like Verizon and Motorola, and other less well-known ones, like Elbit Systems of America, a subsidiary of Israel’s largest private defense contractor, as well as a handful of IT firms with aggressive slogans like “Ever Vigilant” (CACI), “Securing the Future” (ManTech), and “Securing Your Tomorrow” (Unisys).

      The presence of these firms—and indeed the very existence of the Expo—underscores an important truth that anyone attempting to understand immigration politics must reckon with: border security is big business. The “homeland security and emergency management market,” driven by “increasing terrorist threats and biohazard attacks and occurrence of unpredictable natural disasters,” is projected to grow to more than $742 billion by 2023 from $557 billion in 2018, one financial analysis has found. In the coming decades, as more people are displaced by climate catastrophe and economic crises—estimates vary between 150 million and 1 billion by 2050—the industry dedicated to policing the vulnerable stands to profit enormously. By 2013, the United States was already spending more on federal immigration enforcement than all other federal law enforcement agencies combined, including the FBI and DEA; ICE’s budget has doubled since its inception in 2003, while CBP’s has nearly tripled. Between 1993 and 2018, the number of Border Patrol agents grew from 4,139 to 19,555. And year after year, Democrats and Republicans alike have been happy to fuel an ever more high-tech deportation machine. “Congress has given us a lot of money in technology,” Luck told reporters after his keynote speech. “They’ve given us over what we’ve asked for in technology!”

      “As all of this rhetoric around security has increased, so has the impetus to give them more weapons and more tools and more gadgets,” Jacinta Gonzalez, a senior campaign organizer with Mijente, a national network of migrant justice activists, told me. “That’s also where the profiteering comes in.” She continued: “Industries understand what’s good for business and adapt themselves to what they see is happening. If they see an administration coming into power that is pro-militarization, anti-immigrant, pro-police, anti-communities of color, then that’s going to shape where they put their money.”

      By way of example, Gonzalez pointed to Silicon Valley billionaire Peter Thiel, who spent $1.25 million supporting Trump’s 2016 election campaign and followed that up last year by donating $1 million to the Club for Growth—a far-right libertarian organization founded by Heritage Foundation fellow and one-time Federal Reserve Board prospect Stephen Moore—as well as about $350,000 to the Republican National Committee and other GOP groups. ICE has awarded Palantir, the $20 billion surveillance firm founded by Thiel, several contracts worth tens of millions of dollars to manage its data streams—a partnership the agency considers “mission critical,” according to documents reviewed by The Intercept. Palantir, in turn, runs on Amazon Web Services, the cloud computing service provided by the world’s most valuable public company, which is itself a key contractor in managing the Department of Homeland Security’s $6.8 billion IT portfolio.

      Meanwhile, former DHS secretary John Kelly, who was Trump’s chief of staff when the administration enacted its “zero-tolerance” border policy, has joined the board of Caliburn International—parent organization of the only for-profit company operating shelters for migrant children. “Border enforcement and immigration policy,” Caliburn reported in an SEC filing last year, “is driving significant growth.” As Harsha Walia writes in Undoing Border Imperialism, “the state and capitalism are again in mutual alliance.”

      Triumph of the Techno-Nativists

      At one point during the Expo, between speeches, I stopped by a booth for Network Integrity Systems, a security firm that had set up a demonstration of its Sentinel™ Perimeter Intrusion Detection System. A sales representative stuck out his hand and introduced himself, eager to explain how his employer’s fiber optic motion sensors could be used at the border, or—he paused to correct himself—“any kind of perimeter.” He invited me to step inside the space that his coworkers had built, starting to say “cage” but then correcting himself, again, to say “small enclosure.” (It was literally a cage.) If I could get out, climbing over the fencing, without triggering the alarm, I would win a $500 Amazon gift card. I did not succeed.

      Overwhelmingly, the vendors in attendance at the Expo were there to promote this kind of technology: not concrete and steel, but motion sensors, high-powered cameras, and drones. Customs and Border Patrol’s chief operating officer John Sanders—whose biography on the CBP website describes him as a “seasoned entrepreneur and innovator” who has “served on the Board of Directors for several leading providers of contraband detection, geospatial intelligence, and data analytics solutions”—concluded his address by bestowing on CBP the highest compliment he could muster: declaring the agency comparable “to any start-up.” Rhetoric like Sanders’s, ubiquitous at the Expo, renders the border both bureaucratic and boring: a problem to be solved with some algorithmic mixture of brutality and Big Data. The future of border security, as shaped by the material interests that benefit from border securitization, is not a wall of the sort imagined by President Trump, but a “smart” wall.

      High-ranking Democrats—leaders in the second party of capital—and Republicans from the border region have championed this compromise. During the 2018-2019 government shutdown, House Homeland Security Committee Chairman Bennie Thompson told reporters that Democrats would appropriate $5.7 billion for “border security,” so long as that did not include a wall of Trump’s description. “Walls are primitive. What we need to do is have border security,” House Majority Whip Jim Clyburn said in January. He later expanded to CNN: “I’ve said that we ought to have a smart wall. I defined that as a wall using drones to make it too high to get over, using x-ray equipment to make it too wide to get around, and using scanners to go deep enough not to be able to tunnel under it. To me, that would be a smart thing to do.”

      Even the social democratic vision of Senator Bernie Sanders stops short at the border. “If you open the borders, my God, there’s a lot of poverty in this world, and you’re going to have people from all over the world,” he told Iowa voters in early April, “and I don’t think that’s something that we can do at this point.” Over a week later, during a Fox News town hall with Pennsylvania voters, he recommitted: “We need border security. Of course we do. Who argues with that? That goes without saying.”

      To the extent that Trump’s rhetoric, his administration’s immigration policies, and the enforcement agencies’ practices have made the “border crisis” more visible than ever before, they’ve done so on terms that most Democrats and liberals fundamentally agree with: immigration must be controlled and policed; the border must be enforced. One need look no further than the high priest of sensible centrism, Thomas Friedman, whose major complaint about Trump’s immigration politics is that he is “wasting” the crisis—an allusion to Rahm Emanuel’s now-clichéd remark that “you never want a serious crisis to go to waste.” (Frequently stripped of context, it is worth remembering that Emanuel made this comment in the throes of the 2008 financial meltdown, at the Wall Street Journal’s CEO Council, shortly following President Obama’s election.) “Regarding the border, the right place for Democrats to be is for a high wall with a big gate,” Friedman wrote in November of 2018. A few months later, a tour led by Border Patrol agents of the San Ysidro port of entry in San Diego left Friedman “more certain than ever that we have a real immigration crisis and that the solution is a high wall with a big gate—but a smart gate.”

      As reasonable as this might sound to anxious New York Times readers looking for what passes as humanitarian thinking in James Bennet’s opinion pages, the horror of Friedman’s logic eventually reveals itself when he considers who might pass through the big, smart gate in the high, high wall: “those who deserve asylum” and “a steady flow of legal, high-energy, and high-I.Q. immigrants.” Friedman’s tortured hypothetical shows us who he considers to be acceptable subjects of deportation and deprivation: the poor, the lazy, and the stupid. This is corporate-sponsored, state-sanctioned eugenics: the nativism of technocrats.

      The vision of a hermetically sealed border being sold, in different ways, by Trump and his allies, by Democrats, and by the Border Security Expo is in reality a selectively permeable one that strictly regulates the movement of migrant labor while allowing for the unimpeded flow of capital. Immigrants in the United States, regardless of their legal status, are caught between two factions of the capitalist class, each of which seek their immiseration: the citrus farmers, construction firms, and meat packing plants that benefit from an underclass of unorganized and impoverished workers, and the defense and security firms that keep them in a state of constant criminality and deportability.

      You could even argue that nobody in a position of power really wants a literal wall. Even before taking office, Trump himself knew he could only go so far. “We’re going to do a wall,” he said on the campaign trail in 2015. However: “We’re going to have a big, fat beautiful door on the wall.” In January 2019, speaking to the American Farm Bureau Association, Trump acknowledged the necessity of a mechanism allowing seasonal farmworkers from Mexico to cross the border, actually promising to loosen regulations on employers who rely on temporary migrant labor. “It’s going to be easier for them to get in than what they have to go through now,” he said, “I know a lot about the farming world.”

      At bottom, there is little material difference between this and what Friedman imagines to be the smarter, more humane approach. While establishment liberals would no doubt prefer that immigration enforcement be undertaken quietly, quickly, and efficiently, they have no categorical objection to the idea that noncitizens should enjoy fewer rights than citizens or be subject to different standards of due process (standards that are already applied in deeply inequitable fashion).

      As the smorgasbord of technologies and services so garishly on display at the Border Security Expo attests, maintaining the contradiction between citizens and noncitizens (or between the imperial core and the colonized periphery) requires an ever-expanding security apparatus, which itself becomes a source of ever-expanding profit. The border, shaped by centuries of bourgeois interests and the genocidal machinations of the settler-colonial nation-state, constantly generates fresh crises on which the immigration-industrial complex feeds. In other words, there is not a crisis at the border; the border is the crisis.

      CBP has recently allowed Anduril, a start-up founded by one of Peter Thiel’s mentees, Palmer Luckey, to begin testing its artificial intelligence-powered surveillance towers and drones in Texas and California. Sam Ecker, an Anduril engineer, expounded on the benefits of such technology at the Expo. “A tower doesn’t get tired. It doesn’t care about being in the middle of the desert or a river around the clock,” he told me. “We just let the computers do what they do best.”

    Secondo fonti ufficiali dell’Unhcr e di Al Jazeera, il centro di detenzione di Qaser Ben Gashir, è stato trasformato in una caserma di arruolamento. “Ci viene riferito – ha affermato l’inviato dell’agenzia Onu per i rifugiati, Vincent Cochetel – che ad alcuni migranti sono state fornite divise militari e gli è stati promesso la libertà in cambio dell’arruolamento”. Nel solo centro di Qaser Ben Gashir, secondo una stima dell’Unhcr, sono detenuti, per o più arbitrariamente, perlomeno 6 mila profughi tra uomini e donne, tra i quali almeno 600 bambini.

    Sempre secondo l’Unhcr, tale pratica di arruolamento pressoché forzato – è facile intuire che non si può dire facilmente no al proprio carceriere! – sarebbe stata messa in pratica perlomeno in altri tre centri di detenzione del Paese. L’avanzata delle truppe del generale Haftar ha fatto perdere la testa alle milizie fedeli al Governo di accordo nazionale guidato da Fayez al Serraj, che hanno deciso di giocarsi la carta della disperazione, mandando i migranti – che non possono certo definirsi militari sufficientemente addestrati – incontro ad una morte certa in battaglia.     I messaggi WhatsUp che arrivano dai centri di detenzione sono terrificanti e testimoniano una situazione di panico totale che ha investito tanto i carcerieri quanto gli stessi profughi. “Ci danno armi di cui non conosciamo neppure come si chiamano e come si usano – si legge su un messaggio riportato dall’Irish Time – e ci ordinano di andare a combattere”. “Ci volevano caricare in una camionetta piena di armi. Gli abbiamo detto di no, che preferivamo essere riportato in cella ma non loro non hanno voluto”.

    La situazione sta precipitando verso una strage annunciata. Nella maggioranza dei centri l’elettricità è già stata tolta da giorni. Acque e cibo non ne arrivano più. Cure mediche non ne avevano neppure prima. I richiedenti asilo sono alla disperazione. Al Jazeera porta la notizia che ad Qaser Ben Gashir, qualche giorno fa, un bambino è morto per semplice denutrizione. Quello che succede nei campi più lontani dalla capitale, lo possiamo solo immaginare. E con l’avanzare del conflitto, si riduce anche la possibilità di intervento e di denuncia dell’Unhcr o delle associazioni umanitarie che ancora resistono nel Paese come Medici Senza Frontiere.

    Proprio Craig Kenzie, il coordinatore per la Libia di Medici Senza Frontiere, lancia un appello perché i detenuti vengano immediatamente evacuati dalle zone di guerra e che le persone che fuggono e che vengono intercettate in mare non vengano riportate in quell’Inferno.     • ’We are in a fire’: Libya’s detained refugees trapped by conflict

      Detainees at detention centre on the outskirts of Tripoli live in fear amid intense clashes for control of the capital.

      Refugees and migrants trapped on the front line of fierce fighting in Libya’s capital, Tripoli, are pleading to be rescued from the war-torn country while being “surrounded by heavy weapons and militants”.

      Hit by food and water shortages, detainees at the #Qasr_bin_Ghashir detention centre on the southern outskirts of Tripoli, told Al Jazeera they were “abandoned” on Saturday by fleeing guards, who allegedly told the estimated 728 people being held at the facility to fend for themselves.

      The refugees and migrants used hidden phones to communicate and requested that their names not be published.

      “[There are] no words to describe the fear of the women and children,” an Eritrean male detainee said on Saturday.

      “We are afraid of [the] noise... fired from the air and the weapons. I feel that we are abandoned to our fate.”
      Fighting rages on Tripoli outskirts

      Tripoli’s southern outskirts have been engulfed by fighting since renegade General Khalifa Haftar’s eastern forces launched an assault on the capital earlier this month in a bid to wrestle control of the city from Libya’s internationally recognised Government of National Accord (GNA).

      The showdown threatens to further destabilise war-wracked Libya, which splintered into a patchwork of rival power bases following the overthrow of former leader Muammar Gaddafi in 2011.

      At least 121 people have been killed and 561 wounded since Haftar’s self-styled Libyan National Army (LNA) started its offensive on April 4, according to the World Health Organization (WHO).

      Both sides have repeatedly carried out air raids and accuse each other of targeting civilians.

      The United Nations Office for the Coordination of Humanitarian Affairs (UNOCHA), for its part, estimates more than 15,000 people have been displaced so far, with a “significant number” of others stuck in live conflict zones.

      Amid the fighting, refugees and migrants locked up in detention centres throughout the capital, many of whom fled war and persecution in countries including Eritrea, Somalia and Sudan, are warning that their lives are at risk.

      “We find ourselves in a fire,” a 15-year-old detainee at Qasr bin Ghashir told Al Jazeera.
      Electricity outage, water shortages

      Others held at the centre described the abject conditions they were subject to, including a week-long stint without electricity and working water pumps.

      One detainee in her 30s, who alleged the centre’s manager assaulted her, also said they had gone more than a week until Saturday with “no food, [and] no water”, adding the situation “was not good” and saying women are particularly vulnerable now.

      This is the third time since August that detainees in Qasr bin Ghashir have been in the middle of clashes, she said.

      Elsewhere in the capital, refugees and migrants held at the #Abu_Salim detention centre also said they could “hear the noise of weapons” and needed protection.

      “At this time, we want quick evacuation,” said one detainee at Abu Salim, which sits about 20km north of Qasr bin Ghashir.

      “We’ve stayed years with much torture and suffering, we don’t have any resistance for anything. We are (under) deep pressure and stressed … People are very angry and afraid.”
      ’Take us from Libya, please’

      Tripoli’s detention centres are formally under the control of the GNA’s Department for Combatting Illegal Migration (DCIM), though many are actually run by militias.

      The majority of the approximately 6,000 people held in the facilities were intercepted on the Mediterranean Sea and brought back to the North African country after trying to reach Europe as part of a two-year agreement under which which the European Union supports the Libyan coastguard with funds, ships and training, in return for carrying out interceptions and rescues.

      In a statement to Al Jazeera, an EU spokesperson said the bloc’s authorities were “closely monitoring the situation in Libya” from a “political, security and humanitarian point of view” though they could not comment on Qasr bin Ghashir specifically.

      DCIM, for its part, did not respond to a request for comment.

      The UN, however, continues to reiterate that Libya is not a safe country for refugees and migrants to return.

      Amid the ongoing conflict, the organisation’s human rights chief, Michelle Bachelet, warned last week of the need to “ensure protection of extremely vulnerable civilians”, including refugees and migrants who may be living “under significant peril”.

      Bachelet also called for authorities to ensure that prisons and detention centres are not abandoned, and for all parties to guarantee that the treatment of detainees is in line with international law.

      In an apparent move to safeguard the refugees and migrants being held near the capital, Libyan authorities attempted last week to move detainees at Qasr bin Ghashir to another detention centre in #Zintan, nearly 170km southwest of Tripoli.

      But those being held in Qasr bin Ghashir refused to leave, arguing the solution is not a move elsewhere in Libya but rather a rescue from the country altogether.

      “All Libya [is a] war zone,” an Eritrean detainee told Al Jazeera.

      “Take us from Libya, please. Where is humanity and where is human rights,” the detainee asked.

    • The humanitarian fallout from Libya’s newest war

      The Libyan capital of Tripoli is shuddering under an offensive by forces loyal to strongman Khalifa Haftar, with the city’s already precarious basic services in danger of breaking down completely and aid agencies struggling to cope with a growing emergency.

      In the worst and most sustained fighting the country has seen since the 2011 uprising that ousted Muammar Gaddafi, the Haftar-led Libyan National Army, or LNA, surged into the city – controlled by the UN-backed Government of National Accord, or GNA – on 4 April.

      Fighting continues across a string of southern suburbs, with airstrikes and rocket and artillery fire from both sides hammering front lines and civilians alike.

      “It is terrible; they use big guns at night, the children can’t sleep,” said one resident of the capital, who declined to give her name for publication. “The shots land everywhere.”

      The violence has displaced thousands of people and trapped hundreds of migrants and refugees in detention centres. Some analysts also think it has wrecked years of diplomacy, including attempts by the UN to try to build political consensus in Libya, where various militias support the two major rivals for power: the Tripoli-based GNA and the Haftar-backed House of Representatives, based in the eastern city of Tobruk.

      “Detained migrants and refugees, including women and children, are particularly vulnerable.”

      “Pandora’s box has been opened,” said Jalel Harchaoui, a research fellow at Clingendael Institute think tank in The Hague. “The military operation [to capture Tripoli] has inflicted irreversible damage upon a modus vivendi and a large set of political dialogues that has required four years of diplomatic work.”
      Civilians in the line of fire

      Media reports and eyewitnesses in the city said residents face agonising decisions about when to go out, and risk the indiscriminate fire, in search of food and other essentials from the few shops that are open.

      One resident said those in Tripoli face the dilemma of whether to stay in their homes or leave, with no clear idea of what part of the city will be targeted next.

      The fighting is reportedly most intense in the southern suburbs, which until two weeks ago included some of the most tranquil and luxurious homes in the city. Now these districts are a rubble-strewn battleground, made worse by the ever-changing positions of LNA forces and militias that support the GNA.

      This battle comes to a city already struggling with chaos and militia violence, with residents having known little peace since the NATO-backed revolt eight years ago.

      “Since 2011, Libyans have faced one issue after another: shortages of cooking gas, electricity, water, lack of medicines, infrastructure in ruin and neglect,” said one woman who lives in an eastern suburb of Tripoli. “Little is seen at community level, where money disappears into pockets [of officials]. Hospitals are unsanitary and barely function. Education is a shambles of poor schools and stressed teachers.”
      Aid agencies scrambling

      Only a handful of aid agencies have a presence in Tripoli, where local services are now badly stretched.

      The World Health Organisation reported on 14 April that the death toll was 147 and 614 people had been wounded, cautioning that the latter figure may be higher as some overworked hospitals have stopped counting the numbers treated.

      “We are still working on keeping the medical supplies going,” a WHO spokesperson said. “We are sending out additional surgical staff to support hospitals coping with large caseloads of wounded, for example anaesthetists.”

      The UN’s emergency coordination body, OCHA, said that 16,000 people had been forced to flee by the fighting, 2,000 on 13 April alone when fighting intensified across the front line with a series of eight airstrikes. OCHA says the past few years of conflict have left at least 823,000 people, including 248,000 children, “in dire need of humanitarian assistance”.

      UNICEF appealed for $4.7 million to provide emergency assistance to the half a million children and their families it estimates live in and around Tripoli.
      Migrants and refugees

      Some of the worst off are more than 1,500 migrants trapped in a string of detention centres in the capital and nearby. The UN’s refugee agency, UNHCR, said over the weekend it was trying to organise the evacuation of refugees from a migrant camp close to the front lines. “We are in contact with refugees in Qaser Ben Gashir and so far they remain safe from information received,” the agency said in a tweet.

      At least one media report said migrants and refugees at the centre felt they had been abandoned and feared for their lives.

      UNHCR estimates there are some 670,000 migrants and refugees in Libya, including more than 6,000 in detention centres.

      In its appeal, UNICEF said it was alarmed by reports that some migrant detention centres have been all but abandoned, with the migrants unable to get food and water. “The breakdown in the food supply line has resulted in a deterioration of the food security in detention centres,” the agency said. “Detained migrants and refugees, including women and children, are particularly vulnerable, especially those in detention centres located in the vicinity of the fighting.”

      Many migrants continue to hope to find a boat to Europe, but that task has been made harder by the EU’s March decision to scale down the rescue part of Operation Sophia, its Mediterranean anti-smuggling mission.

      “The breakdown in the food supply line has resulted in a deterioration of the food security in detention centres.”

      Search-and-rescue missions run by nongovernmental organisations have had to slow down and sometimes shutter their operations as European governments refuse them permission to dock. On Monday, Malta said it would not allow the crew of a ship that had been carrying 64 people rescued off the coast of Libya to disembark on its shores. The ship was stranded for two weeks as European governments argued over what to do with the migrants, who will now be split between four countries.

      Eugenio Cusumano, an international security expert specialising in migration research at Lieden University in the Netherlands, said a new surge of migrants and refugees may now be heading across the sea in a desperate attempt to escape the fighting. He said they will find few rescue craft, adding: “If the situation in Libya deteriorates there will be a need for offshore patrol assets.”
      Failed diplomacy

      Haftar’s LNA says its objective is to liberate the city from militia control, while the GNA has accused its rival of war crimes and called for prosecutions.

      International diplomatic efforts to end the fighting appear to have floundered. Haftar launched his offensive on the day that UN Secretary-General António Guterres was visiting Tripoli – a visit designed to bolster long-delayed, UN-chaired talks with the various parties in the country, which were due to be held this week.

      The UN had hoped the discussions, known as the National Conference, might pave the way for elections later this year, but they ended up being cancelled due to the upsurge in fighting.

      Guterres tried to de-escalate the situation by holding emergency talks with the GNA in Tripoli and flying east to see Haftar in Benghazi. But as foreign powers reportedly line up behind different sides, his calls for a ceasefire – along with condemnation from the UN Security Council and the EU – have so far been rebuffed.

    • Detained refugees in Libya moved to safety in second UNHCR relocation

      UNHCR, the UN Refugee Agency, today relocated another 150 refugees who were detained in the #Abu_Selim detention centre in south Tripoli to UNHCR’s #Gathering_and_Departure_Facility (#GDF) in the centre of Libya’s capital, safe from hostilities.

      The Abu Selim detention centre is one of several in Libya that has been impacted by hostilities since clashes erupted in the capital almost a fortnight ago.

      Refugees at the centre told UNHCR that they were petrified and traumatised by the fighting, fearing for their lives.

      UNHCR staff who were present and organizing the relocation today reported that clashes were around 10 kilometres away from the centre and were clearly audible.

      While UNHCR intended to relocate more refugees, due to a rapid escalation of fighting in the area this was not possible. UNHCR hopes to resume this life-saving effort as soon as conditions on the ground allow.

      “It is a race against time to move people out of harm’s way. Conflict and deteriorating security conditions hamper how much we can do,” said UNHCR’s Assistant Chief of Mission in Libya, Lucie Gagne.

      “We urgently need solutions for people trapped in Libya, including humanitarian evacuations to transfer those most vulnerable out of the country.”

      Refugees who were relocated today were among those most vulnerable and in need and included women and children. The relocation was conducted with the support of UNHCR’s partner, International Medical Corps and the Libyan Ministry of Interior.

      This relocation is the second UNHCR-organized transfer since the recent escalation of the conflict in Libya.

      Last week UNHCR relocated more than 150 refugees from the Ain Zara detention centre also in south Tripoli to the GDF, bringing the total number of refugees currently hosted at the GDF to more than 400.

      After today’s relocation, there remain more than 2,700 refugees and migrants detained and trapped in areas where clashes are ongoing. In addition to those remaining at Abu Selim, other detention centres impacted and in proximity to hostilities include the Qasr Bin Ghasheer, Al Sabaa and Tajoura centres.

      Current conditions in the country continue to underscore the fact that Libya is a dangerous place for refugees and migrants, and that those rescued and intercepted at sea should not be returned there. UNHCR has repeatedly called for an end to detention for refugees and migrants.

      L’ONU a annoncé mardi avoir évacué 150 réfugiés supplémentaires d’une centre de détention à Tripoli touché par des combats, ajoutant ne pas avoir été en mesure d’en déplacer d’autres en raison de l’intensification des affrontements.

      La Haut-commissariat aux réfugiés (HCR) a précisé avoir évacué ces réfugiés, parmi lesquels des femmes et des enfants, du centre de détention Abou Sélim, dans le sud de la capitale libyenne, vers son Centre de rassemblement et de départ dans le centre-ville.

      Cette opération a été effectuée au milieu de violents combats entre les forces du maréchal Khalifa Haftar et celles du Gouvernement d’union nationale (GNA) libyen.

      « Il nous faut d’urgence des solutions pour les gens piégés en Libye, y compris des évacuations humanitaires pour transférer les plus vulnérables hors du pays », a déclaré Mme Gagne.

    • Footage shows refugees hiding as Libyan militia attack detention centre

      At least two people reportedly killed in shooting at Qasr bin Ghashir facility near Tripoli.

      Young refugees held in a detention centre in Libya have described being shot at indiscriminately by militias advancing on Tripoli, in an attack that reportedly left at least two people dead and up to 20 injured.

      Phone footage smuggled out of the camp and passed to the Guardian highlights the deepening humanitarian crisis in the centres set up to prevent refugees and migrants from making the sea crossing from the north African coast to Europe.

      The footage shows people cowering in terror in the corners of a hangar while gunshots can be heard and others who appear to have been wounded lying on makeshift stretchers.

      The shooting on Tuesday at the Qasr bin Ghashir detention centre, 12 miles (20km) south of Tripoli, is thought to be the first time a militia has raided such a building and opened fire.

      Witnesses said men, women and children were praying together when soldiers they believe to be part of the forces of the military strongman Khalifa Haftar, which are advancing on the Libyan capital to try to bring down the UN-backed government, stormed into the detention centre and demanded people hand over their phones.

      When the occupants refused, the soldiers began shooting, according to the accounts. Phones are the only link to the outside world for many in the detention centres.

      Amnesty International has called for a war crimes investigation into the incident. “This incident demonstrates the urgent need for all refugees and migrants to be immediately released from these horrific detention centres,” said the organisation’s spokeswoman, Magdalena Mughrabi.

      Médecins Sans Frontières (MSF) said a review of the video evidence by its medical doctors had concluded the injuries were consistent with gunshot wounds. “These observations are further supported by numerous accounts from refugees and migrants who witnessed the event and reported being brutally and indiscriminately attacked with the use of firearms,” a statement said.

      The UN refugee agency, UNHCR, said it evacuated 325 people from the detention centre after the incident. A statement suggested guns were fired into air and 12 people “endured physical attacks” that required hospital treatment, but none sustained bullet wounds.

      “The dangers for refugees and migrants in Tripoli have never been greater than they are at present,” said Matthew Brook, the refugee agency’s deputy mission chief in Libya. “It is vital that refugees in danger can be released and evacuated to safety.”

      The Guardian has previously revealed there is a network of 26 Libyan detention centres where an estimated 6,000 refugees are held. Children have described being starved, beaten and abused by Libyan police and camp guards. The UK contributes funding to humanitarian assistance provided in the centres by NGOs and the International Organization for Migration.

      Qasr bin Ghashir is on the frontline of the escalating battle in Libya between rival military forces. Child refugees in the camp started sending SOS messages earlier this month, saying: “The war is started. We are in a bad situation.”

      In WhatsApp messages sent to the Guardian on Tuesday, some of the child refugees said: “Until now, no anyone came here to help us. Not any organisations. Please, please, please, a lot of blood going out from people. Please, we are in dangerous conditions, please world, please, we are in danger.”

      Many of the children and young people in the detention centres have fled persecution in Eritrea and cannot return. Many have also tried to cross the Mediterranean to reach Italy, but have been pushed back by the Libyan coastguard, which receives EU funding.

      Giulia Tranchina, an immigration solicitor in London, has been raising the alarm for months about the plight of refugees in the centres. “I have been in touch with seven refugees in Qasr Bin Gashir since last September,. Many are sick and starving,” she said.

      “All of them tried to escape across the Mediterranean to Italy, but were pushed back to the detention centre by the Libyan coastguard. Some were previously imprisoned by traffickers in Libya for one to two years. Many have been recognised by UNHCR as genuine refugees.”

      Tranchina took a statement from a man who escaped from the centre after the militia started shooting. “We were praying in the hangar. The women joined us for prayer. The guards came in and told us to hand over our phones,” he said.

      “When we refused, they started shooting. I saw gunshot wounds to the head and neck, I think that without immediate medical treatment, those people would die.

      “I’m now in a corrugated iron shack in Tripoli with a few others who escaped, including three women with young children. Many were left behind and we have heard that they have been locked in.”

      A UK government spokesperson said: “We are deeply concerned by reports of violence at the Qasr Ben Ghashir detention centre, and call on all parties to allow civilians, including refugees and migrants, to be evacuated to safety.”

      • Amnesty International, Médecins Sans Frontières and other NGOs are suing the French government to stop the donation of six boats to Libya’s navy, saying they will be used to send migrants back to detention centres. EU support to the Libyan coastguard, which is part of the navy, has enabled it to intercept migrants and asylum seekers bound for Europe. The legal action seeks a suspension on the boat donation, saying it violates an EU embargo on the supply of military equipment to Libya.

There have been reports on deaths and forced enlistment among migrants and refugees trapped in detention centres, which are overseen by the Libyan Department for Combating Illegal Migration but often run by militias.

      Amid the intense fighting the EU-backed Libyan coastguard continues to intercept and return people trying to cross the Mediteranean. According to the International Organisation for Migration (IOM) 113 people were returned to the Western part of the country this week. In a Tweet the UN Agency states: “we reiterate that Libya is not a safe port and that arbitrary detention must end.”

      Former UNHCR official, Jeff Crisp, calls it: “…extraordinary that the UN has not made a direct appeal to the EU to suspend the support it is giving to the Libyan coastguard”, and further states that: “Europe has the option of doing nothing and that is what it will most likely do.”

      UNHCR has evacuated 500 people to the Agencies Gathering and Departure Facility in Tripoli and an additional 163 to the Emergency Transit Mechanism in Niger. However, with both mechanisms “approaching full capacity” the Agency urges direct evacuations out of Libya. On April 29, 146 refugees were evacuated from Libya to Italy in a joint operation between UNHCR and Italian and Libyan authorities.

    • Le HCR et l’OIM condamnent l’attaque contre Tajoura et demandent une enquête immédiate sur les responsables

      Le nombre effroyable de blessés et de victimes, suite à l’attaque aérienne de mardi soir à l’est de Tripoli contre le centre de détention de Tajoura, fait écho aux vives préoccupations exprimées par le HCR, l’Agence des Nations Unies pour les réfugiés, et l’Organisation internationale pour les migrations (OIM), concernant la sécurité des personnes dans les centres de détention. Ce tout dernier épisode de violence rend également compte du danger évoqué par l’OIM et le HCR concernant les retours de migrants et de réfugiés en Libye après leur interception ou leur sauvetage en mer Méditerranée.

      Nos deux organisations condamnent fermement cette attaque ainsi que toute attaque contre la vie des civils. Nous demandons également que la détention des migrants et des réfugiés cesse immédiatement. Nous appelons à ce que leur protection soit garantie en Libye.

      Cette attaque mérite davantage qu’une simple condamnation. Selon le HCR et l’OIM, une enquête complète et indépendante est nécessaire pour déterminer comment cela s’est produit et qui en est responsable, ainsi que pour traduire les responsables en justice. La localisation de ces centres de détention à Tripoli est bien connue des combattants, qui savent également que les personnes détenues à Tajoura sont des civils.

      Au moins 600 réfugiés et migrants, dont des femmes et des enfants, se trouvaient au centre de détention de Tajoura. La frappe aérienne a causé des dizaines de morts et de blessés. Nous nous attendons de ce fait que le nombre final de victimes soit beaucoup plus élevé.

      Si l’on inclut les victimes de Tajoura, environ 3300 migrants et réfugiés sont toujours détenus arbitrairement à Tripoli et en périphérie de la ville dans des conditions abjectes et inhumaines. De plus, les migrants et les réfugiés sont confrontés à des risques croissants à mesure que les affrontements s’intensifient à proximité. Ces centres doivent être fermés.

      Nous faisons tout notre possible pour leur venir en aide. L’OIM et le HCR ont déployé des équipes médicales. Par ailleurs, une équipe interinstitutions plus large des Nations Unies attend l’autorisation de se rendre sur place. Nous rappelons à toutes les parties à ce conflit que les civils ne doivent pas être pris pour cible et qu’ils doivent être protégés en vertu à la fois du droit international relatif aux réfugiés et du droit international relatif aux droits de l’homme.

      Le conflit en cours dans la capitale libyenne a déjà forcé près de 100 000 Libyens à fuir leur foyer. Le HCR et ses partenaires, dont l’OIM, ont transféré plus de 1500 réfugiés depuis des centres de détention proches des zones de combat vers des zones plus sûres. Par ailleurs, des opérations de l’OIM pour le retour volontaire à titre humanitaire ont facilité le départ de plus de 5000 personnes vulnérables vers 30 pays d’origine en Afrique et en Asie.

      L’OIM et le HCR exhortent l’ensemble du système des Nations Unies à condamner cette attaque et à faire cesser le recours à la détention en Libye. De plus, nous appelons instamment la communauté internationale à mettre en place des couloirs humanitaires pour les migrants et les réfugiés qui doivent être évacués depuis la Libye. Dans l’intérêt de tous en Libye, nous espérons que les États influents redoubleront d’efforts pour coopérer afin de mettre d’urgence un terme à cet effroyable conflit.

    • Affamés, torturés, disparus : l’impitoyable piège refermé sur les migrants bloqués en Libye

      Malnutrition, enlèvements, travail forcé, torture : des ONG présentes en Libye dénoncent les conditions de détention des migrants piégés dans ce pays, conséquence selon elles de la politique migratoire des pays européens conclue avec les Libyens.

      Le point, minuscule dans l’immensité de la mer, est ballotté avec violence : mi-mai, un migrant qui tentait de quitter la Libye dans une embarcation de fortune a préféré risquer sa vie en plongeant en haute mer en voyant arriver les garde-côtes libyens, pour nager vers un navire commercial, selon une vidéo mise en ligne par l’ONG allemande Sea-Watch et tournée par son avion de recherche. L’image illustre le désespoir criant de migrants, en grande majorité originaires d’Afrique et de pays troublés comme le Soudan, l’Érythrée, la Somalie, prêts à tout pour ne pas être à nouveau enfermés arbitrairement dans un centre de détention dans ce pays livré au conflit et aux milices.

      Des vidéos insoutenables filmées notamment dans des prisons clandestines aux mains de trafiquants d’êtres humains, compilées par une journaliste irlandaise et diffusées en février par Channel 4, donnent une idée des sévices de certains tortionnaires perpétrés pour rançonner les familles des migrants. Allongé nu par terre, une arme pointée sur lui, un migrant râle de douleur alors qu’un homme lui brûle les pieds avec un chalumeau. Un autre, le tee-shirt ensanglanté, est suspendu au plafond, un pistolet braqué sur la tête. Un troisième, attaché avec des cordes, une brique de béton lui écrasant dos et bras, est fouetté sur la plante des pieds, selon ces vidéos.

      Le mauvais traitement des migrants a atteint un paroxysme dans la nuit de mardi à mercredi quand plus de 40 ont été tués et 70 blessés dans un raid aérien contre un centre pour migrants de Tajoura (près de Tripoli), attribué aux forces de Khalifa Haftar engagées dans une offensive sur la capitale libyenne. Un drame « prévisible » depuis des semaines, déplorent des acteurs humanitaires. Depuis janvier, plus de 2.300 personnes ont été ramenées et placées dans des centres de détention, selon l’ONU.

      « Plus d’un millier de personnes ont été ramenées par les gardes-côtes libyens soutenus par l’Union européenne depuis le début du conflit en avril 2019. A terre, ces personnes sont ensuite transférées dans des centres de détention comme celui de Tajoura… », a ce réagi mercredi auprès de l’AFP Julien Raickman, chef de mission de l’ONG Médecins sans frontières (MSF) en Libye. Selon les derniers chiffres de l’Organisation internationale pour les migrations (OIM), au moins 5.200 personnes sont actuellement dans des centres de détention en Libye. Aucun chiffre n’est disponible pour celles détenues dans des centres illégaux aux mains de trafiquants.

      L’UE apporte un soutien aux gardes-côtes libyens pour qu’ils freinent les arrivées sur les côtes italiennes. En 2017, elle a validé un accord conclu entre l’Italie et Tripoli pour former et équiper les garde-côtes libyens. Depuis le nombre d’arrivées en Europe via la mer Méditerranée a chuté de manière spectaculaire.
      « Les morts s’empilent »

      Fin mai, dans une prise de parole publique inédite, dix ONG internationales intervenant en Libye dans des conditions compliquées – dont Danish Refugee Council, International Rescue Committee, Mercy Corps, Première Urgence Internationale (PUI) – ont brisé le silence. Elles ont exhorté l’UE et ses Etats membres à « revoir en urgence » leurs politiques migratoires qui nourrissent selon elles un « système de criminalisation », soulignant que les migrants, « y compris les femmes et les enfants, sont sujets à des détentions arbitraires et illimitées » en Libye dans des conditions « abominables ».

      « Arrêtez de renvoyer les migrants en Libye  ! La situation est instable, elle n’est pas sous contrôle ; ils n’y sont en aucun cas protégés ni par un cadre législatif ni pour les raisons sécuritaires que l’on connaît », a réagi ce mercredi à l’AFP Benjamin Gaudin, chef de mission de l’ONG PUI en Libye. Cette ONG intervient dans six centres de détention dans lesquels elle est une des seules organisations à prodiguer des soins de santé.

      La « catastrophe ne se situe pas seulement en Méditerranée mais également sur le sol libyen ; quand ces migrants parviennent jusqu’aux côtes libyennes, ils ont déjà vécu l’enfer », a-t-il témoigné récemment auprès de l’AFP, dans une rare interview à un média. Dans certains de ces centres officiels, « les conditions sont terribles », estime M. Gaudin. « Les migrants vivent parfois entassés les uns sur les autres, dans des conditions sanitaires terribles avec de gros problèmes d’accès à l’eau – parfois il n’y a pas d’eau potable du tout. Ils ne reçoivent pas de nourriture en quantité suffisante ; dans certains centres, il n’y a absolument rien pour les protéger du froid ou de la chaleur. Certains n’ont pas de cours extérieures, les migrants n’y voient jamais la lumière du jour », décrit-il.
      Human Rights Watch, qui a eu accès à plusieurs centres de détention en 2018 et à une centaine de migrants, va plus loin dans un rapport de 2019 – qui accumule les témoignages de « traitements cruels et dégradants » : l’organisation accuse la « coopération de l’UE avec la Libye sur les migrations de contribuer à un cycle d’abus extrêmes ».

      « Les morts s’empilent dans les centres de détention libyens – emportés par une épidémie de tuberculose à Zintan, victimes d’un bombardement à Tajoura. La présence d’une poignée d’acteurs humanitaires sur place ne saurait assurer des conditions acceptables dans ces centres », a déploré M. Raickman de MSF. « Les personnes qui y sont détenues, majoritairement des réfugiés, continuent de mourir de maladies, de faim, sont victimes de violences en tout genre, de viols, soumises à l’arbitraire des milices. Elles se retrouvent prises au piège des combats en cours », a-t-il dénoncé.

      Signe d’une situation considérée comme de plus en plus critique, la Commissaire aux droits de l’Homme du Conseil de l’Europe a exhorté le 18 juin les pays européens à suspendre leur coopération avec les gardes-côtes libyens, estimant que les personnes récupérées « sont systématiquement placées en détention et en conséquence soumises à la torture, à des violences sexuelles, à des extorsions ». L’ONU elle même a dénoncé le 7 juin des conditions « épouvantables » dans ces centres. « Environ 22 personnes sont décédées des suites de la tuberculose et d’autres maladies dans le centre de détention de Zintan depuis septembre », a dénoncé Rupert Colville, un porte-parole du Haut-Commissariat de l’ONU aux droits de l’Homme.

      MSF, qui a démarré récemment des activités médicales dans les centres de Zintan et Gharyan, a décrit une « catastrophe sanitaire », soulignant que les personnes enfermées dans ces deux centres « viennent principalement d’Érythrée et de Somalie et ont survécu à des expériences terrifiantes » durant leur exil. Or, selon les ONG et le HCR, la très grande majorité des milliers de personnes détenues dans les centres sont des réfugiés, qui pourraient avoir droit à ce statut et à un accueil dans un pays développé, mais ne peuvent le faire auprès de l’Etat libyen. Ils le font auprès du HCR en Libye, dans des conditions très difficiles.
      « Enfermés depuis un an »

      « Les évacuations hors de Libye vers des pays tiers ou pays de transit sont aujourd’hui extrêmement limitées, notamment parce qu’il manque des places d’accueil dans des pays sûrs qui pourraient accorder l’asile », relève M. Raickman. « Il y a un fort sentiment de désespoir face à cette impasse ; dans des centres où nous intervenons dans la région de Misrata et Khoms, des gens sont enfermés depuis un an. » Interrogée par l’AFP, la Commission européenne défend son bilan et son « engagement » financier sur cette question, soulignant avoir « mobilisé » depuis 2014 pas moins de 338 millions d’euros dans des programmes liés à la migration en Libye.

      « Nous sommes extrêmement préoccupés par la détérioration de la situation sur le terrain », a récemment déclaré à l’AFP une porte-parole de la Commission européenne, Natasha Bertaud. « Des critiques ont été formulées sur notre engagement avec la Libye, nous en sommes conscients et nous échangeons régulièrement avec les ONG sur ce sujet », a-t-elle ajouté. « Mais si nous ne nous étions pas engagés avec l’OIM, le HCR et l’Union africaine, nous n’aurions jamais eu cet impact : ces 16 derniers mois, nous avons pu sortir 38.000 personnes hors de ces terribles centres de détention et hors de Libye, et les raccompagner chez eux avec des programmes de retour volontaire, tout cela financé par l’Union européenne », a-t-elle affirmé. « Parmi les personnes qui ont besoin de protection – originaires d’Érythrée ou du Soudan par exemple – nous avons récemment évacué environ 2.700 personnes de Libye vers le Niger (…) et organisé la réinstallation réussie dans l’UE de 1.400 personnes ayant eu besoin de protection internationale », plaide-t-elle.

      La porte-parole rappelle que la Commission a « à maintes reprises ces derniers mois exhorté ses États membres à trouver une solution sur des zones de désembarquement, ce qui mettrait fin à ce qui passe actuellement : à chaque fois qu’un bateau d’ONG secoure des gens et qu’il y a une opposition sur le sujet entre Malte et l’Italie, c’est la Commission qui doit appeler près de 28 capitales européennes pour trouver des lieux pour ces personnes puissent débarquer : ce n’est pas viable ! ».

      Pour le porte-parole de la marine libyenne, le général Ayoub Kacem, interrogé par l’AFP, ce sont « les pays européens (qui) sabotent toute solution durable à l’immigration en Méditerranée, parce qu’ils n’acceptent pas d’accueillir une partie des migrants et se sentent non concernés ». Il appelle les Européens à « plus de sérieux » et à unifier leurs positions. « Les États européens ont une scandaleuse responsabilité dans toutes ces morts et ces souffrances », dénonce M. Raickman. « Ce qu’il faut, ce sont des actes : des évacuations d’urgence des réfugiés et migrants coincés dans des conditions extrêmement dangereuses en Libye ».

    • « Mourir en mer ou sous les bombes : seule alternative pour les milliers de personnes migrantes prises au piège de l’enfer libyen ? »

      Le soir du 2 juillet, une attaque aérienne a été signalée sur le camp de détention pour migrant·e·s de #Tadjourah dans la banlieue est de la capitale libyenne. Deux jours après, le bilan s’est alourdi et fait état d’au moins 66 personnes tuées et plus de 80 blessées [1]. A une trentaine de kilomètres plus au sud de Tripoli, plusieurs migrant·e·s avaient déjà trouvé la mort fin avril dans l’attaque du camp de Qasr Bin Gashir par des groupes armés.

      Alors que les conflits font rage autour de Tripoli entre le Gouvernement d’union nationale (GNA) reconnu par l’ONU et les forces du maréchal Haftar, des milliers de personnes migrantes enfermées dans les geôles libyennes se retrouvent en première ligne : lorsqu’elles ne sont pas abandonnées à leur sort par leurs gardien·ne·s à l’approche des forces ennemies ou forcées de combattre auprès d’un camp ou de l’autre, elles sont régulièrement prises pour cibles par les combattant·e·s.

      Dans un pays où les migrant·e·s sont depuis longtemps vu·e·s comme une monnaie d’échange entre milices, et, depuis l’époque de Kadhafi, comme un levier diplomatique notamment dans le cadre de divers marchandages migratoires avec les Etats de l’Union européenne [2], les personnes migrantes constituent de fait l’un des nerfs de la guerre pour les forces en présence, bien au-delà des frontières libyennes.

      Au lendemain des bombardements du camp de Tadjourah, pendant que le GNA accusait Haftar et que les forces d’Haftar criaient au complot, les dirigeant·e·s des pays européens ont pris le parti de faire mine d’assister impuissant·e·s à ce spectacle tragique depuis l’autre bord de la Méditerranée, les un·e·s déplorant les victimes et condamnant les attaques, les autres appelant à une enquête internationale pour déterminer les coupables.

      Contre ces discours teintés d’hypocrisie, il convient de rappeler l’immense responsabilité de l’Union européenne et de ses États membres dans la situation désastreuse dans laquelle les personnes migrantes se trouvent sur le sol libyen. Lorsqu’à l’occasion de ces attaques, l’Union européenne se félicite de son rôle dans la protection des personnes migrantes en Libye et affirme la nécessité de poursuivre ses efforts [3], ne faut-il pas tout d’abord se demander si celle-ci fait autre chose qu’entériner un système de détention cruel en finançant deux organisations internationales, le HCR et l’OIM, qui accèdent pour partie à ces camps où les pires violations de droits sont commises ?

      Au-delà de son soutien implicite à ce système d’enfermement à grande échelle, l’UE n’a cessé de multiplier les stratégies pour que les personnes migrantes, tentant de fuir la Libye et ses centres de détention aux conditions inhumaines, y soient immédiatement et systématiquement renvoyées, entre le renforcement constant des capacités des garde-côtes libyens et l’organisation d’un vide humanitaire en Méditerranée par la criminalisation des ONG de secours en mer [4].

      A la date du 20 juin 2019, le HCR comptait plus de 3 000 personnes interceptées par les garde-côtes libyens depuis le début de l’année 2019, pour à peine plus de 2000 personnes arrivées en Italie [5]. Pour ces personnes interceptées et reconduites en Libye, les perspectives sont bien sombres : remises aux mains des milices, seules échapperont à la détention les heureuses élues qui sont évacuées au Niger dans l’attente d’une réinstallation hypothétique par le HCR, ou celles qui, après de fortes pressions et souvent en désespoir de cause, acceptent l’assistance au retour « volontaire » proposée par l’OIM.

      L’Union européenne a beau jeu de crier au scandale. La détention massive de migrant·e·s et la violation de leurs droits dans un pays en pleine guerre civile ne relèvent ni de la tragédie ni de la fatalité : ce sont les conséquences directes des politiques d’externalisation et de marchandages migratoires cyniques orchestrées par l’Union et ses États membres depuis de nombreuses années. Il est temps que cesse la guerre aux personnes migrantes et que la liberté de circulation soit assurée pour toutes et tous.

    • Migrants say militias in Tripoli conscripted them to clean arms

      Migrants who survived the deadly airstrike on a detention center in western Libya say they had been conscripted by a local militia to work in an adjacent weapons workshop. The detention centers are under armed groups affiliated with the Fayez al-Sarraj government in Tripoli.

      Two migrants told The Associated Press on Thursday that for months they were sent day and night to a workshop inside the Tajoura detention center, which housed hundreds of African migrants.

      A young migrant who has been held for nearly two years at Tajoura says “we clean the anti-aircraft guns. I saw a large amount of rockets and missiles too.”

      The migrants spoke on condition of anonymity for fear of reprisal.

      The release of the detainees remaining in the Tajoura detention centre, hit by a deadly attack on 2 July, is a positive step by the Libyan authorities. All refugees and migrants have to be released from detention and provided with all the necessary assistance. In this context, we have supported the creation of the Gathering and Departure Facility (GDF) in Tripoli and other safe places in order to improve the protection of those in need and to provide humane alternatives to the current detention system.

      We will continue to work with International Organisation for Migration (IOM) and UNHCR (the UN Refugee Agency) in the context of the African Union-European Union-United Nations Task Force to support and protect refugees and migrants in Libya. We call on all parties to accelerate humanitarian evacuation and resettlement from Libya to third countries. In particular, we are supporting UNHCR’s work to resettle the most vulnerable refugees with durable solutions outside Libya, with around 4,000 individuals having been evacuated so far. We are also working closely with the IOM and the African Union and its Member States to continue the Assisted Voluntary Returns, thereby adding to the more than 45,000 migrants returned to their countries of origin so far.

      The European Union is strongly committed to fighting traffickers and smugglers and to strengthening the capacity of the Libyan Coast Guard to save lives at sea. Equally, we recall the need to put in place mechanisms that guarantee the safety and dignity of those rescued by the Libyan Coast Guard, notably by ending arbitrary detention and allowing the UN agencies to carry out screening and registration and to provide direct emergency assistance and protection. Through our continuous financial support and our joined political advocacy towards the Libyan authorities, the UNHCR and IOM are now able to better monitor the situation in the disembarkation points and have regular access to most of the official detention centres.

      Libya’s current system of detaining migrants has to end and migration needs to be managed in full compliance with international standards, including when it comes to human rights. The European Union stands ready to help the Libyan authorities to develop solutions to create safe and dignified alternatives to detention in full compliance with the international humanitarian standards and in respect of human rights.

      About 45 women, 16 children and some men, for a total of approximately 80 refugees, were taken out of #TariqalSikka detention centre by the Libyan police and taken to the #UNHCR offices in #Gurji, Tripoli, yesterday. UNHCR told them there is nothing they can do to help them so...
      they are now homeless in Tripoli, destitute, starving, at risk of being shot, bombed, kidnapped, tortured, raped, sold or detained again in an even worst detention centre. Forcing African refugees out of detention centres and leaving them homeless in Tripoli is not a solution...
      It is almost a death sentence in today’s Libya. UNHCR doesn’t have capacity to offer any help or protection to homeless refugees released from detention. These women & children have now lost priority for evacuation after years waiting in detention, suffering rape, torture, hunger...

    The House of Representatives voted on Thursday to end U.S. military involvement in Yemen’s bloody civil war in a historic measure that sets the stage for a showdown between the White House and Capitol Hill over the president’s ability to wage wars without congressional approval.

    It marks the first time in history that legislation invoking the 1970s-era War Powers Resolution, aimed at reasserting Congress’s role in U.S. wars abroad, passed both the House and Senate.     Maybe Mogadishu will turn out to be the source of hope. This war-torn city was the birthplace of the most promising U.S. congresswoman today.

    Ilhan Omar is not only one of the first two female Muslim members of the House of Representatives, she may herald a dramatic change in that body. “Hamas has entered the House,” Roseanne Barr was quick to cry out; “A black day for Israel,” tweeted Donald Trump. Neither Hamas nor a black day, but a glimmer of hope on Capitol Hill.

    Maybe, for the first time in history, someone will dare tell the truth to the American people, absorbing scathing accusations of anti-Semitism, without bowing her head. The chances of this happening aren’t great; the savage engine of the Jewish lobby and of Israel’s “friends” is already doing everything it can to trample her.

    The president mentioned removing her from the Senate Foreign Relations Committee, and Congress was set to pass a resolution, the second in one month, against uttering “anti-Semitic expressions,” specifically aimed at Omar’s statements.

    When will Americans and Europeans stop running scared every time someone screams “anti-Semitism”? Until when will Israel and the Jewish establishment succeed in exploiting (the existing) anti-Semitism as a shield against criticism? When will the world dare to distinguish between legitimate criticism of an illegitimate reality and anti-Semitism?

    The gap between these two is great. There is anti-Semitism one must fight, and there is criticism of Israel and the Jewish establishment it is imperative to support. Manipulations exercised by the Israeli propaganda machine and the Jewish establishment have managed to make the two issues identical.

    This is the greatest success of the Israeli government’s hasbara: Say one critical word about Israel and you’re labeled an anti-Semite. And labeled an anti-Semite, your fate is obvious. Omar has to break this cursed cycle. Is the young representative from Minnesota up for it? Can she withstand the power centers that have already mobilized against her in full force?

    Maybe it’s important that she knows there are people in Israel crossing fingers for her?

    Her success and that of her congressional colleagues, Rashida Tlaib from Michigan and Alexandria Ocasio-Cortez from New York, could be the first swallows that herald the coming of spring. This is the spring of freely expressing opinions about Israel in America. Cortez already asked this week why isn’t bigotry aimed at other groups condemned just like statements against Israel are.

    What, after all, has Omar said? That pro-Israel activists demand “allegiance to a foreign country”; that U.S. politicians support Israel because of money they receive from the pro-Israel lobby group AIPAC, and that “Israel hypnotized the world.” What is incorrect in these statements? Why is describing reality considered anti-Semitic?

    Jews have immense power in the U.S., far beyond the relative size of their community, and the blind support given by their establishment to Israel raises legitimate questions regarding dual loyalty. Their power derives from their economic success, their organizational skills and the political pressure they exert. Omar dared to speak about this.

    Just imagine what Israelis and Jews would feel if Muslim Americans had the same political, economic and cultural power Jews have. Such power, above all the intoxication with power that has seized hold of the Jewish establishment, comes with a price. Omar and her colleagues are trying to collect on it.

    Due to the Israel lobby, the U.S. does not know the truth about what is happening here. Congress members, senators and shapers of public opinion who are flown here ad nauseam see only Israeli victimhood and Palestinian terror, which apparently emerged out of nowhere. Islamists, Qassam rockets and incendiary balloons – not a word about occupation, expropriation, refugees and military tyranny. Questions such as where the money goes and whether it serves American interests are considered heresy. When talking about Israel one must not ask questions or raise doubts.

    This cycle has to be broken as well. It’s not right and it’s not good for the Jews. Omar is now trying to introduce a new discourse to Congress and to public opinion. Thanks to her and her colleagues there is a chance for a change in America. From Israel we send her our wishes for success.

      Why attack Congresswoman Ilhan Omar, who said that Congressional support for Israel has been bought by money from the American Israel Public Affairs Committee, at a time when someone who is very familiar with the lobby attests to its tremendous power. On the online news publication The Intercept, journalist Mehdi Hassan describes a meeting between Steven Rosen, a former president of AIPAC, and journalist Jeffrey Goldberg in 2005. “You see this napkin?” asked Rosen. “In 24 hours, we could have the signatures of 70 senators on this napkin.”

      That’s corrupting power, which should cause any decent Jew to lose sleep. After all, we’re not talking about a poor country, to which policy can be dictated, whether by force or with money. We’re talking about the world’s biggest superpower. We’re also talking about 70 senators out of 100 – 70 percent of the Senate is in AIPAC’s pocket.

      So what would happen if the situation were reversed, and neo-Nazism, which according to U.S. President Donald Trump also includes good people, were to assume senior positions? Would the Jews then be blamed for all the ills of the United States?

      At the moment I feel for Congresswoman Ilhan, who thought she was living in a democratic country, and that she could report to the public about what she sees. We can assume that a few years ago Omar was able to observe Republican candidates knocking on the door of far-right mogul Sheldon Adelson, asking for his support – his monetary support, of course.

      I assume that Omar also noticed the strange phenomenon which, with the exception of Gideon Levy, almost nobody in Israel noticed: that all the senior members of the White House Middle East team are Jews, and not leftist, Peace Now Jews, God forbid, but right-wing, Habayit Hayehudi Jews. The poor Palestinians were unable to comment on that for fear of AIPAC, which is responsible for putting “anti-Semite” stickers on anyone who dares criticize Israel.

      Now President Trump is angry at Omar. “I think she should be ashamed of herself. I think it was a terrible statement,” he said. But Trump has apparently forgotten that on the eve of his election in 2015 he told the participants at a convention of the Republican Jewish Coalition: “You’re not going to support me because I don’t want your money.”

      Trump’s statement included the two most benighted elements that anti-Semites have attributed to Jews for hundreds of years: money and control. That statement, about which Chemi Shalev wrote at the time: “As though the Jews are incapable of supporting a candidate whom they can’t buy,” was met here by almost total silence. How do they say it in Arabic: “The blows of the beloved are like raisins.”

      Now Omar, after the witch hunt surrounding her, has retreated from her tweet. She will have to work hard to prove that she’s not anti-Semitic, and that what she sees is actually an illusion. The truth must be told: Her retreat is a mark of Cain on the forehead of reasonable Jews, both in Israel and the United States. After all, cleaning the stables of the ills of the Israeli right is mainly the job of reasonable Jews.

      Why impose that job on Omar? Why outsource the dirty work to the gentiles, instead of buckling down and taking action. And starting, for example, by sending tens of thousands of signatures on postcards saying: We support you, Ilhan the heroine.

      And if not, Ilhan will yet say to herself: Why do I need another headache? And retreat to her home. Whereas you, Jewish democrats, will continue to obey the orders of the insane alliance of the Israeli and American right, and continue to send your sons on terrible missions in the occupied territories. And if TV news anchor Oshrat Kotler says that it’s because of the occupation – you’ll stone her, instead of stoning the occupation. Only the occupation could produce such genius.

    The Guardian understands the home secretary thinks section 40(2) of the British Nationality Act 1981 gives him the power to strip Begum of her UK citizenship.

    He wrote to her family informing them he had made such an order, believing the fact her parents are of Bangladeshi heritage means she can apply for citizenship of that country – though Begum says she has never visited it.

    This is crucial because, while the law bars him from making a person stateless, it allows him to remove citizenship if he can show Begum has behaved “in a manner which is seriously prejudicial to the vital interests of the UK” and he has “reasonable grounds for believing that the person is able, under the law of a country or territory outside the UK, to become a national of such a country or territory”.

    • What do we know about citizenship stripping?

      The Bureau began investigating the Government’s powers to deprive individuals of their British citizenship two years ago.

      The project has involved countless hours spent in court, deep and detailed use of the freedom of information act and the input of respected academics, lawyers and politicians.

      The Counter-Terrorism Bill was presented to Parliament two weeks ago. New powers to remove passports from terror suspects and temporarily exclude suspected jihadists from the UK have focused attention on the Government’s citizenship stripping powers, which have been part of the government’s counter-terrorism tools for nearly a decade.

      A deprivation order can be made where the home secretary believes that it is ‘not conducive’ to the public good for the individual to remain in the country, or where citizenship is believed to have been obtained fraudulently. The Bureau focuses on cases based on ‘not conducive’ grounds, which are related to national security and suspected terrorist activity.

      Until earlier this year, the Government was only able to remove the citizenship of British nationals where doing so wouldn’t leave them stateless. However, in July an amendment to the British Nationality Act (BNA) came into force and powers to deprive a person of their citizenship were expanded. Foreign-born, naturalised individuals can now be stripped of their UK citizenship on national security grounds even if it renders them stateless, a practice described by a former director of public prosecutions as being “beloved of the world’s worst regimes during the 20th century”.

      So what do we know about how these powers are used?
      The numbers

      53 people have been stripped of their British citizenship since 2002 – this includes both people who were considered to have gained their citizenship fraudulently, as well as those who have lost it for national security reasons.
      48 of these were under the Coalition government.
      Since 2006, 27 people have lost their citizenship on national security grounds; 24 of these were under the current Coalition government.
      In 2013, home secretary Theresa May stripped 20 individuals of their British citizenship – more than in all the preceding years of the Coalition put together.
      The Bureau has identified 18 of the 53 cases, 17 of which were deprived of their citizenship on national security grounds.
      15 of the individuals identified by the Bureau who lost their citizenship on national security grounds were abroad at the time of the deprivation order.
      At least five of those who have lost their nationality were born in the UK.
      The previous Labour government used deprivation orders just five times in four years.
      Hilal Al-Jedda was the first individual whose deprivation of citizenship case made it to the Supreme Court. The home secretary lost her appeal as the Supreme Court justices unanimously ruled her deprivation order against Al-Jedda had made him illegally stateless. Instead of returning his passport, just three weeks later the home secretary issued a second deprivation order against him.
      This was one of two deprivation of citizenship cases to have made it to the Supreme Court, Britain’s uppermost court, to date.
      In November 2014 deprivation of citizenship case number two reached the Supreme Court, with the appellant, Minh Pham, also arguing that the deprivation order against him made him unlawfully stateless.
      Two of those stripped of their British citizenship by Theresa May in 2010, London-born Mohamed Sakr and his childhood friend Bilal al Berjawi, were later killed by US drone strikes in Somalia.
      One of the individuals identified by the Bureau, Mahdi Hashi, was the subject of rendition to the US, where he was held in secret for over a month and now faces terror charges.
      Only one individual, Iraqi-born Hilal al-Jedda, is currently known to have been stripped of his British citizenship twice.

    • ‘My British citizenship was everything to me. Now I am nobody’ – A former British citizen speaks out

      When a British man took a holiday to visit relatives in Pakistan in January 2012 he had every reason to look forward to returning home. He worked full time at the mobile phone shop beneath his flat in southeast London, he had a busy social life and preparations for his family’s visit to the UK were in full flow.

      Two years later, the man, who cannot be named for legal reasons, is stranded in Pakistan, and claims he is under threat from the Taliban and unable to find work to support his wife and three children.

      He is one of 27 British nationals since 2006 who have had their citizenship removed under secretive government orders on the grounds that their presence in the UK is ‘not conducive to the public good’. He is the first to speak publicly about his ordeal.

      ‘My British citizenship was everything to me. I could travel around the world freely,’ he told the Bureau. ‘That was my identity but now I am nobody.’

      Under current legislation, the Home Secretary, Theresa May, has the power to strip dual nationals of their British citizenship if she deems their presence in the UK ‘not conducive to the public good’, or if their nationality was gained on fraudulent grounds. May recently won a Commons vote paving the way to allow her to strip the citizenship of foreign-born or naturalised UK nationals even if it rendered them stateless. Amendments to the Immigration Bill – including the controversial Article 60 concerning statelessness – are being tabled this week in the House of Lords.

      A Bureau investigation in December 2013 revealed 20 British nationals were stripped of their citizenship last year – more than in all previous years under the Coalition combined. Twelve of these were later revealed to have been cases where an individual had gained citizenship by fraud; the remaining eight are on ‘conducive’ grounds.

      Since 2006 when the current laws entered force, 27 orders have been made on ‘conducive’ grounds, issued in practice against individuals suspected of involvement in extremist activities. The Home Secretary often makes her decision when the individual concerned is outside the UK, and, in at least one case, deliberately waited for a British national to go on holiday before revoking his citizenship.

      The only legal recourse to these decisions, which are taken without judicial approval, is for the individual affected to submit a formal appeal to the Special Immigration and Asylum Committee (Siac), where evidence can be heard in secret, within 28 days of the order being given. These appeals can take years to conclude, leaving individuals – the vast majority of whom have never been charged with an offence – stranded abroad.

      The process has been compared to ‘medieval exile’ by leading human rights lawyer Gareth Peirce.

      The man, who is referred to in court documents as E2, was born in Afghanistan and still holds Afghan citizenship. He claimed asylum in Britain in 1999 after fleeing the Taliban regime in Kabul, and was granted indefinite leave to remain. In 2009 he became a British citizen.

      While his immediate family remained in Pakistan, E2 came to London, where he worked and integrated in the local community. Although this interview was conducted in his native Pashto, E2 can speak some English.

      ‘I worked and I learned English,’ he says. ‘Even now I see myself as a British. If anyone asks me, I tell them that I am British.’

      But, as of March 28 2012, E2 is no longer a British citizen. After E2 boarded a flight to Kabul in January 2012 to visit relatives in Afghanistan and his wife and children in Pakistan, a letter containing May’s signature was sent to his southeast London address from the UK Border Agency, stating he had been deprived of his British nationality. In evidence that remains secret even from him, E2 was accused of involvement in ‘Islamist extremism’ and deemed a national security threat. He denies the allegation and says he has never participated in extremist activity.

      In the letter the Home Secretary wrote: ‘My decision has been taken in part reliance on information which, in my opinion should not be made public in the interest of national security and because disclosure would be contrary to the public interest.’

      E2 says he had no way of knowing his citizenship had been removed and that the first he heard of the decision was when he was met by a British embassy official at Dubai airport on May 25 2012, when he was on his way back to the UK and well after his appeal window shut.

      E2’s lawyer appealed anyway, and submitted to Siac that: ‘Save for written correspondence to the Appellant’s last known address in the UK expressly stating that he has 28 days to appeal, i.e. acknowledging that he was not in the UK, no steps were taken to contact the Appellant by email, telephone or in person until an official from the British Embassy met him at Dubai airport and took his passport from him.’

      The submission noted that ‘it is clear from this [decision] that the [Home Secretary] knew that the Appellant [E2] is out of the country as the deadline referred to is 28 days.’

      The Home Office disputed that E2 was unaware of the order against him, and a judge ruled that he was satisfied ‘on the balance of probabilities’ that E2 did know about the removal of his citizenship. ‘[W]e do not believe his statement,’ the judge added.

      His British passport was confiscated and, after spending 18 hours in an airport cell, E2 was made to board a flight back to Kabul. He has remained in Afghanistan and Pakistan ever since. It is from Pakistan that he agreed to speak to the Bureau last month.

      Daniel Carey, who is representing E2 in a fresh appeal to Siac, says: ‘The practice of waiting until a citizen leaves the UK before depriving them of citizenship, and then opposing them when they appeal out of time, is an intentional attack on citizens’ due process rights.

      ‘By bending an unfair system to its will the government is getting worryingly close to a system of citizenship by executive fiat.’

      While rules governing hearings at Siac mean some evidence against E2 cannot be disclosed on grounds of national security, the Bureau has been able to corroborate key aspects of E2’s version of events, including his best guess as to why his citizenship was stripped. His story revolves around an incident that occurred thousands of miles away from his London home and several years before he saw it for the last time.

      In November 2008, Afghan national Zia ul-Haq Ahadi was kidnapped as he left the home of his infirmed mother in Peshawar, Pakistan. The event might have gone unnoticed were he not the brother of Afghanistan’s then finance minister and former presidential hopeful Anwar ul-Haq Ahadi. Anwar intervened, and after 13 months of tortuous negotiations with the kidnappers, a ransom was paid and Zia was released. E2 claims to have been the man who drove a key negotiator to Zia’s kidnappers.

      While the Bureau has not yet been able to confirm whether E2 had played the role he claimed in the release, a source with detailed knowledge of the kidnapping told the Bureau he was ‘willing to give [E2] some benefit of the doubt because there are elements of truth [in his version of events].’

      The source confirmed a man matching E2’s description was involved in the negotiations.

      ‘We didn’t know officially who the group was, but they were the kidnappers. I didn’t know whether they were with the Pakistani or Afghan Taliban,’ E2 says. ‘After releasing the abducted person I came back to London.’

      E2 guesses – since not even his lawyers have seen specific evidence against him – that it was this activity that brought him to the attention of British intelligence services. After this point, he was repeatedly stopped as he travelled to and from London and Afghanistan and Pakistan to visit relatives four times between the end of 2009 and the beginning of 2012.

      ‘MI5 questioned me for three or four hours each time I came to London at Heathrow airport,’ he says. ‘They said people like me [Pashtun Afghans] go to Waziristan and from there you start fighting with British and US soldiers.

      ‘The very last time [I was questioned] was years after the [kidnapping]. I was asked to a Metropolitan Police station in London. They showed me pictures of Gulbuddin Hekmatyar [former Afghan prime minister and militant with links to the Pakistani Taliban (TTP)] along with other leaders and Taliban commanders. They said: ‘You know these guys.’

      He claims he was shown a photo of his wife – a highly intrusive action in conservative Pashtun culture – as well as one of someone he was told was Sirajuddin Haqqani, commander of the Haqqani Network, one of the most lethal TTP-allied groups.

      ‘They said I met him, that I was talking to him and I have connections with him. I said that’s wrong. I told [my interrogator] that you can call [Anwar al-Ahady] and he will explain that he sent me to Waziristan and that I found and released his brother,’ E2 says.

      ‘I don’t know Sirajuddin Haqqani and I didn’t meet him.’

      The Haqqani Network, which operates in Pakistan’s Federally Administered Tribal Areas and across the border in Afghanistan, was designated as a terrorist organisation by the United States in September 2012. It has claimed responsibility for a score of attacks against Afghan, Pakistani and NATO security forces in Afghanistan and Pakistan. The UN accuses Sirajuddin Haqqani of being ‘actively involved in the planning and execution of attacks targeting International Security Assistance Forces (ISAF), Afghan officials and civilians.’

      E2 says he has no idea whether Haqqani was involved in Zia’s kidnapping, but he believes the security services may have started investigating him when he met the imam of a mosque he visited in North Waziristan.

      ‘The imam had lunch with us and he was with me while I was waiting for my father-in-law. I didn’t take his number but I gave him mine. That imam often called me on my shop’s BT telephone line [in London]. These calls put me in trouble,’ he says.

      If E2’s version of events is accurate, it would mean he gained his British citizenship while he was negotiating Zia’s release. He lost it less than three years later.

      The Home Office offered a boilerplate response to the Bureau’s questions: ‘The Home Secretary will remove British citizenship from individuals where she feels it is conducive to the public good to do so.’

      When challenged specifically on allegations made by E2, the spokesman said the Home Office does not comment on individual cases.

      E2 says he now lives in fear for his safety in Pakistan. Since word has spread that he lost his UK nationality, locals assume he is guilty, which he says puts him at risk of attack from the Pakistani security forces. In addition, he says his family has received threats from the Taliban for his interaction with MI5.

      ‘People back in Afghanistan know that my British passport was revoked because I was accused of working with the Taliban. I can’t visit my relatives and I am an easy target to others,’ he said. ‘Without the British passport here, whether [by] the government or Taliban, we can be executed easily.’

      E2 is not alone in fearing for his life after being exiled from Britain. Two British nationals stripped of their citizenship in 2010 were killed a year later by a US drone strike in Somalia. A third Briton, Mahdi Hashi, disappeared from east Africa after having his citizenship revoked in June 2012 only to appear in a US court after being rendered from Djibouti.

      E2 says if the government was so certain of his involvement in extremism they should allow him to stand trial in a criminal court.

      ‘When somebody’s citizenship is revoked if he is criminal he should be put in jail, otherwise he should be free and should have his passport returned,’ he says.

      ‘My message [to Theresa May] is that my citizenship was revoked illegally. It’s wrong that only by sending a letter that your citizenship is revoked. What kind of democracy is it that?’

    WASHINGTON – The Senate passed a bill last week that encourages state governments across the U.S. not to sign contracts with supporters of boycotts against Israel and its settlements in the occupied West Bank. The bill has since been introduced in the House of Representatives, but Congressional sources from both parties told Haaretz in recent days they doubt it will pass the House any time soon.

    The bill in question is called the Combating BDS Act. It passed the Senate as part of a “package” of Middle East-related bills after being introduced by Republican Senator Marco Rubio. The other bills in the package deal with non-controversial, consensus issues such as military aid to Israel and Jordan, and sanctions on the Assad regime in Syria.

    Rubio and Senate Republicans added the anti-BDS bill into the package, setting the stage for an intense fight about it on Capitol Hill. The reason is that civil rights organizations such as the American Civil Liberties Union are concerned that the Combating BDS Act is unconstitutional and harms American citizens’ freedom of speech.

    The bill encourages the implementation of local legislation passed in recent years by half of the states in the U.S., putting limits on state governments’ abilities to sign contracts with supporters of boycotts against Israel or the settlements. Two such laws have been frozen by federal courts in Arizona and Kansas, following lawsuits by state contractors who said the laws harmed their freedom of speech. Similar lawsuits have recently been filed in Texas and Arkansas.

    When the package bill came up for a vote last week, 23 senators voted against it, including one Republican, Rand Paul of Kentucky. Many of those who voted against it clarified that if every aspect of the bill had been voted on separately, they probably would have supported the bills on assistance to Israel and Jordan and on sanctioning Assad, and would have only objected to the BDS bill, mainly because of concerns surrounding freedom of speech.

    Such a vote could take place in the Senate, where Republicans hold the majority, but not in the House, according to the Congressional sources who spoke with Haaretz. Democrats are convinced that the entire purpose of the Republican decision to add the anti-BDS bill into the broader Middle East package was to orchestrate an intra-Democratic fight over the issue, and force many Democrats to choose between their position on the free speech criticism of the bill, and their general opposition to BDS.

    The Democratic leadership in the House, which has a majority ever since the midterm elections, will most likely break up the package into a number of separate bills. That will allow the House to approve the non-controversial bills on security aid to Israel and sanctions on Syria, without immediately setting the stage for a new round of internal party tensions on the “constitutional right to boycott” question.

    While the other bills are probably going to see quick and easy approval, the anti-BDS bill could be up for a lengthy period of debate in the relevant House committees. There could also be an amendment process. In the Senate, for example, one Democratic senator, Gary Peters of Michigan, offered an amendment that would make it absolutely clear that the bill only refers to large companies, not to small businesses or sole proprietors. Another amendment offered to distinguish in the bill’s language between Israel proper and the settlements in the occupied West Bank.

    Lara Friedman of the Foundation for Middle East Peace, one of the most vocal opponents of the legislation, told Haaretz last week that Democrats in the House “can see what happened in the Senate and take a good guess that it will be even more controversial” in their chamber. “The only ones who benefit from seeing Democrats fight amongst themselves on this issue are the GOP and folks in the U.S. and Israel who want to see Israel turned into a weapon for partisan gain,” she added.

    AIPAC, the powerful lobby that supports the Israeli government, is urging Congress to pass the legislation. The organization wrote in its monthly publication, the Near East Report, that “Congress should take up and pass the Combating BDS Act as quickly as possible. This important bipartisan bill seeks both to protect states against claims they are preempting federal authority, and to demonstrate Congress’ strong support for state measures consistent with Congress’ historic commitment to oppose boycotts of Israel.”

    BETHLEHEM (Ma’an) — Palestinians living in the Netherlands will be allowed to register the Gaza Strip and the West Bank as their official place of birth, Dutch State Secretary Raymond Knops told the House of Representatives in The Hague.

    The Netherlands, which does not recognize Palestine as a sovereign state, currently offers Palestinians two options when specifying their birthplace at the Dutch civil registry, the two options are Israel or “unknown.”

    Knops wrote a letter to the House of Representatives, saying that he intends to add the Gaza Strip and the West Bank, including East Jerusalem to a list of official states used by the Dutch civil registry.

    The new category will be available to Palestinians born after May 15th 1948, the day the British Mandate was officially terminated and Israel became a recognized state.

    In the letter, Knops stated that the new category is in accordance with “the Dutch viewpoint that Israel has no sovereignty over these areas,” as well as the Netherlands’ refusal to recognize Palestine as a state.

    Knops added that the new category was named based on the Oslo Accords and United Nations Security Council resolutions.
    While the UN General Assembly and at least 136 countries have recognized Palestine as a sovereign state, most of the European Union has refrained from recognition until such status is established peace agreement between the Israelis and the Palestinians. (...)

    WASHINGTON – Two newly elected congresswomen may be generating a lot of headlines, but Israeli officials are most concerned about the heated Senate debate about Israel in the past month than the pro-boycott statements of Democratic Reps. Rashida Tlaib and Ilhan Omar.

    While Israeli officials are worried about the media attention Tlaib and Omar are receiving – which is seen as helping to advance their views and possibly creating more support for them – they are not perceived as having the potential to weaken or delay pro-Israel legislation in Congress. The representatives’ ability to pass laws that would harm or upset the Israeli government is seen as even more limited.

    But talking with Haaretz, Israeli officials admit greater concern that close to half of all Democratic senators voted against the anti-boycott, divestment and sanctions legislation proposed by Sen. Marco Rubio (Republican of Florida) last week.

    Almost all of the Democratic senators who are potential 2020 presidential nominees – from Elizabeth Warren, Kamala Harris and Bernie Sanders (an independent who caucuses with the Democrats) to Sherrod Brown, Cory Booker and Kirsten Gillibrand – opposed the legislation, citing concerns over freedom of speech. The senators said that although they oppose BDS, they also oppose legislation that would force state contractors to sign a declaration saying they don’t boycott Israel or its settlements in the occupied territories.

    The anti-BDS legislation being opposed by high-ranking Democratic senators and presidential hopefuls has been a flagship project of the pro-Israel lobby in the United States for the past decade. It has also received strong support and encouragement from senior officials in the Israeli government. The pushback on the Democratic side to the legislation, which is coming from the mainstream of the party, is more consequential in the long-term than the provocative statements of freshman members of the House of Representatives, according to Israeli officials.

  • Bill to allow removal of Confederate monuments dies in subcommittee

    Tension filled the room Wednesday as a House subcommittee voted to kill a bill that would have let localities decide whether to remove or modify Confederate monuments in their jurisdictions.

    House Bill 2377, which sought to change the current law that makes it illegal to disturb or interfere with war monuments. His bill would have given cities and counties authority to remove Confederate or Union monuments. This is the second year Toscano has sponsored such legislation.

    “We give localities the ability to control the cutting of weeds. But we haven’t yet given them the control over monuments that might have detrimental effects on the atmosphere and the feeling of the community,” Toscano said. “If you weren’t in Charlottesville in August of 2017, it would be hard to understand all of this.”

    He said people across Virginia want the ability to decide what to do with the monuments in their towns.

    Toscano said the monuments were erected during the “lost cause” movement, which viewed the Confederacy as heroic and the Civil War as a conflict not over slavery but over “states’ rights.”

    He addressed a subcommittee of the House Committee on Counties, Cities and Towns. The subcommittee’s chair, Del. Charles D. Poindexter, R-Franklin, gave those on each side of the debate five minutes to state their case. With a packed audience filling the small committee room, each person had little more than one minute to speak.

    Supporters of Toscano’s legislation held up blue signs with messages such as “Lose The Lost Cause” and “Local Authority for War Memorials” printed in black ink.

    Lisa Draine had tears in her eyes as she spoke of her daughter, Sophie, who was severely injured when a white supremacist, James Alex Fields Jr., drove his car into a crowd of people demonstrating against racism in Charlottesville.

    Fields, who was sentenced to life in prison last month for killing Heather Heyer, was part of the “Unite the Right” rally protesting the city’s plans to remove a statue of Confederate Gen. Robert E. Lee from a local park.

    “I couldn’t imagine that a statue had brought this to our town,” Draine said. “My daughter could have been your daughter.”

    A member of the Charlottesville City Council, Kathy Galvin, spoke in favor of the bill, citing the need for local legislators to have authority over the monuments.

    Matthew Christensen, an activist from Charlottesville, said it was an issue of “basic human decency” and the right of local governments. “They own the land, they own the statue, they should be able to decide what to do with it,” he said.

    Ed Willis, an opponent of Toscano’s bill, said it violates provisions in the Virginia Constitution prohibiting discrimination. “It’s painfully clear discrimination based on Confederate national origin is the basis of this bill,” he said.

    Like other opponents, Willis said his ancestors served in the Civil War. Some spoke of their families’ long heritage in Virginia and opposed what they felt was the attempt to sanitize or alter their history.

    Frank Earnest said he blamed the “improper actions” of the Charlottesville city government for the mayhem that took place in August 2017.

    “Just like the other socialist takeovers,” Earnest said, “it’ll be Confederate statues today, but don’t think they won’t be back next year to expand it to another war, another time in history.”

    The subcommittee voted 2-6 against the bill. Dels. John Bell and David Reid, both Democrats from Loudoun County, voted to approve the bill. Opposing that motion were Democratic Del. Steve Heretick of Portsmouth and five Republicans: Dels. Poindexter, Terry Austin of Botetourt County, Jeffrey Campbell of Smyth County, John McGuire of Henrico County, and Robert Thomas of Stafford County.

    Supporters of the bill met with Toscano in his office after the meeting. He said he knew the bill’s defeat was a “foregone conclusion.” HB 2377 was heard last in the meeting, giving little time for debate or discussion.

    People who want to remove the monuments asked Toscano, “How do we make this happen?”

    Toscano picked up a glass candy dish from his desk and placed a chocolate coin wrapped in blue foil in each person’s hand. This represented his desire for a Democratic majority in the House of Delegates, where Republicans hold 51 of the 100 seats.

    Toscano said he fought for years to get from 34 Democratic delegates to the 49 now serving. He urged the group to vote for those who share their concerns this November.

    “It’s all about the General Assembly,” he said.

  • Why a #high-tech border wall is as silly as a physical one

    Opinion: Technology is an attractive answer, but it’s no panacea for economic and geopolitical problems at the border.

    There’s a loud and growing chorus of opposition to a physical border wall. That view is shared by leaders of border cities like McAllen, Texas, by every congressman representing a district along our 2000-mile-long southern border, and by the majority of Americans (to say nothing of a long list of bygone societies stretching from the Ming Dynasty to East Germany). Tying a partial government shutdown to funding for the wall has also been deeply unpopular, and the president’s historically low approval ratings were slumping further during the shutdown.

    Out of the political jockeying during the longest partial government shutdown in American history, there’s one idea everyone seems eager to agree on: Technology can help redress serious problems at the border. It’s an attractive, almost magic-sounding solution, lending a Silicon Valley ring to a stale debate. In the rhetorical shoving match over a physical wall, it’s become the rallying cry for those seeking sensible alternatives.

    Unfortunately, border technology is not the panacea many people think. And in many of its applications it runs counter to our core values.

    Increasing border security with a force field of sensing and response technology, what many are calling a digital or virtual wall, isn’t a new idea — in fact, it’s about 50 years old and grew out of strategies and technologies first developed during the Vietnam War. And it hasn’t worked.

    Technology already in place

    There are currently about 12,000 motion and seismic sensors along the U.S. border with Mexico, along with a vast electronic perimeter of radar and high definition cameras. Predator B drones have extended the radar net in places and can pick out a snake slithering through brush a mile away. Miniature facial recognition drones, 3D mapping technology, tethered blimps first developed to guard forward operating bases in Afghanistan, tunnel-navigating ground robots used in Iraq, invisible dyes dropped from the air to mark migrants, and acoustic deterrents of various types have all been tested or deployed along the border.     Meanwhile, electronic fingerprinting has been in use by immigration enforcement officials since the 1990s to track the massive flow of people, legal and illegal, across U.S. borders. Border security agents currently have access to military-grade technology like nightscopes, suppressors, infrared and holographic sights, and a thick catalog of tactical weapons and gear.

    We’re not talking about small-scale pilot programs or testbeds, either — far from it. In the mid-2000s, the America’s Shield Initiative and Integrated Surveillance Intelligence System cost taxpayers billions. The objective was “to use the right technology at the right places for the right terrain to … have the rapid response capability to get to the points of intrusions to increase our overall apprehension rate,” CBP Commissioner Robert Bonner told the House Appropriations subcommittee on Homeland Security in 2006.

    Soon after, George W. Bush kicked off the #Secure_Border_Initiative, what he called “the most technologically advanced border security initiative in American History.” And just this past March, the latest government spending bill allocated $400 million for border technology. During what’s become a perennial state of frenzy over illegal immigration, it’s safe to say there’s been a decades-old gold rush to bring tech to the border. Rather than promoting new technology development, battle tested technology has migrated over from the defense sector. Contractors are reaping the benefits.

    And what are the results of all this technology on immigration? Well, here’s how President Trump feels: “We can’t have people pouring into our country like they have over the last 10 years.”

    Scrutinizing that assertion through the lens of reality is an exercise in confronting just how bellicose and misinformed the immigration debate has become, but the important takeaway is that a lot of people believe there’s still a big problem at the border despite the massive investment in technology. Maybe it’s time to reevaluate our faith in a digital fix. Maybe it’s also time to reevaluate the problem.

    One answer is the increasingly widespread “morality clause.” Over the past few years, Simon & Schuster, HarperCollins and Penguin Random House have added such clauses to their standard book contracts. I’ve heard that Hachette Book Group is debating putting one in its trade book contracts, though the publisher wouldn’t confirm it. These clauses release a company from the obligation to publish a book if, in the words of Penguin Random House, “past or future conduct of the author inconsistent with the author’s reputation at the time this agreement is executed comes to light and results in sustained, widespread public condemnation of the author that materially diminishes the sales potential of the work.”

    That’s reasonable, I guess. Penguin, to its credit, doesn’t ask authors to return their advances. But other publishers do, and some are even more hard-nosed.

    This past year, regular contributors to Condé Nast magazines started spotting a new paragraph in their yearly contracts. It’s a doozy. If, in the company’s “sole judgment,” the clause states, the writer “becomes the subject of public disrepute, contempt, complaints or scandals,” Condé Nast can terminate the agreement. In other words, a writer need not have done anything wrong; she need only become scandalous. In the age of the Twitter mob, that could mean simply writing or saying something that offends some group of strident tweeters.

    Agents hate morality clauses because terms like “public condemnation” are vague and open to abuse, especially if a publisher is looking for an excuse to back out of its contractual obligations. When I asked writers about morality clauses, on the other hand, most of them had no idea what I was talking about. You’d be surprised at how many don’t read the small print.

    Morality clauses may be relatively new to mainstream publishing, but they have a long history. The entertainment industry started drafting them in 1921, when the silent-movie star Fatty Arbuckle, who had just signed a then-astonishing $1 million contract with Paramount Pictures, was accused of the rape and manslaughter of a girl at a party. Mr. Arbuckle was acquitted after two mistrials, but by then the public had soured on him, and the studios wanted out.

    Today the clauses are widespread in sports, television and advertising. Religious publishers have used them for at least 15 years, which seems fair enough. You can’t condemn a Christian publisher that cancels publication of a book called “The Ridiculously Good Marriage” after the author is accused of having sexually assaulted an underage girl when he was a youth pastor. (He apologized for a “sexual incident.”) Children’s publishers have been including the clauses for a decade or more, and they, too, have a case. It would be challenging to sell a children’s book written by a pedophile.

    The problem with letting publishers back out of contracts with noncelebrity, nonreligious, non-children’s book authors on the grounds of immorality is that immorality is a slippery concept. Publishers have little incentive to clarify what they mean by it, and the public is fickle in what it takes umbrage at.

    In 1947, the concern was Communism, and morality clauses gave studios a way to blacklist the Hollywood 10, a group of directors and screenwriters who denounced the House Un-American Activities Committee as illegitimate and refused to say whether they’d ever been Communists. All 10 went to jail, and all but one, who decided to cooperate with the committee, became unemployable until the 1960s, though some continued to write under pseudonyms.

To that end, Tlaib is planning to lead a congressional delegation to the Israeli-occupied West Bank, she told The Intercept. Her planned trip is a swift rebuke of a decades-old tradition for newly elected members: a junket to Israel sponsored by the education arm of the American Israel Public Affairs Committee, known as AIPAC, the powerful pro-Israel lobby group.

    The AIPAC trips are among the lesser-known traditions for freshman members of Congress. They’re typically scheduled during the first August recess in every legislative session and feature a weeklong tour of Israel and meetings with leading Israeli figures in business, government, and the military. Both critics and proponents of the AIPAC freshmen trip say the endeavor is incredibly influential, providing House members with a distinctly pro-Israel viewpoint on complex controversies in the region.   • The Abandoned Mine Problem: Who Should Bear the Burden?

    Thousands of abandoned and orphaned mines dot the American West. They pose a danger to both public and environmental health, and responsible parties are difficult to find, differentiate, or hold accountable. Why do inactive mines continue to pose safety hazards and pollute our waterways? The laws in place simply don’t have teeth. The Gold King Mine wastewater spill in southwestern Colorado in 2015 was a good reminder of the scope of the problem of abandoned and orphaned mines and how our current regulatory framework falls short.

    There are three laws that generally govern mining law in the United States: the 1872 Mining Law, the Clean Water Act, and the Comprehensive Environmental Response, Compensation, and Liability Act (CERCLA). These laws lack concrete measures to prevent mine spills from occurring as well as reliable methods to ensure that all mines receive the necessary attention in the case of a spill (or better yet, to prevent one). In addition, these laws can create liabilities and disincentives on parties who might otherwise be willing to come in and remediate the mine on their own. However, some states are turning towards a non-traditional form of legislation: Good Samaritan laws, in which citizens, companies, and organizations would be not liable in the case they decide to take on the task of cleaning up acid mine drainage.

    The abandoned mine problem in the United States is striking. Specifically, hard rock mines (including metals like gold, silver, iron, copper, and zinc) are predominant in the West as a result of the discovery of gold and silver during the era of western expansion. Up until the 1970s, the federal government engaged in little oversight on mining across much of the West. During the mining era, there were few expectations about environmental safeguards, and as a result, historic mining operations often went largely unregulated. Before the 1970s, it was common for mining companies to abandon mine sites after mineral extraction was completed or no longer profitable. The land was often left exposed, with waste materials in piles or dumped into mine cavities and pits. At the time, mining companies had no requirement to restore mine lands to their original condition. Today, it is almost impossible to hold these mine owners financially responsible because records of original ownership have been lost and accountable individuals have long passed away. There are over 500,000 abandoned hardrock mine sites across the nation, and the cost for cleaning up these inactive mines is estimated to be between $33 and 72 billion dollars. Today, these abandoned mines are capable of polluting adjacent streams, lakes, and groundwater with high volumes of toxic waste. In doing so, contamination from spills has the potential to—and often does—harm marine ecosystems, poison local drinking water, and pose serious health risks to local communities.

    What Laws Are in Place?

    The Mining Law of 1872, or the General Mining Law, governs the transfer of rights to mine gold, silver, copper, uranium and other hardrock minerals from federal lands. Under the law, citizens may enter and explore the public domain, and if they find valuable mineral deposits, they may obtain title to the land through the Department of the Interior. The law has jurisdictional coverage over 270 million acres of publicly owned land, which is almost one-fourth of all land in the United States. In essence, mining companies are able to search for minerals without any authorization from any government agency. The law contains little to no environmental protections for using use of the land and it does not include any royalty or bonding provisions (to help fund cleanup in case of an accident). As a result, many have criticized the law for giving away public land to private companies practically for free, leaving the public to bear the burden for cleaning up the spills. Since there is no requirement to pay royalties or report extraction volume, the government does not keep track of the volume of hardrock minerals being extracted from federal public lands each year. Consequently, this aspect of mines is largely unchecked and has disparate effects.

    But the issue of abandoned mines has not entirely been overlooked. In September 2017, Senator Tom Udall (Arizona) introduced legislation to reform the General Mining Law and address many of the above-mention criticisms. If passed, the legislation would help fund clean-up activities through fees and royalties. In March 2018, the House Committee on Natural Resources held a hearing on the issue of abandoned mines.

    The Clean Water Act (CWA) is aimed at restoring and maintaining the chemical, physical, and biological integrity of the nation’s waters. The Act splits the responsibility to state agencies and some responsibility to the EPA to carry out the regulatory purposes. The Act requires would-be polluters to obtain a permit for any kind of discharge of a pollutant from a point source (such as mine waste) into the navigable waters of the United States. While the structure of the Act enforces a basic foundation for protecting water resources, one consequence of the permitting system is that parties who own or attempt to clean up mines will likely become subject to its extensive permitting requirements and face liability. This being said, when parties do attempt to clean up mines, their actions could still constitute a violation of the CWA. Under the Act, a party seeking to engage in cleanup activity would need a permit regardless of whether their actions aggravate or improve the water quality.

    CERCLA allows for the cleanup of sites that are already contaminated with hazardous substances and pollutants. It is also referred to as the “Superfund,” due to the large fund that it created for cleanup of contaminated sites. CERCLA is intended to spread the cost of cleanup among responsible parties, and allows the government to undertake cleanup of contaminated property or compel private parties to undertake the cleanup themselves. Like the CWA, CERCLA creates potential liability for parties that might attempt to clean up abandoned mines, which usually takes form of lawsuits. Under 107(a)(4)(B), private parties can recover from a potential responsible party (PRP) for the cleanup costs they “directly incur.” Under this broad liability scheme, people who own property containing hazardous substances can be held liable for enormous cleanup costs even though they were not involved in any hazardous waste disposal activities. Even with some liability defense for certain types of innocent landowners and bonafide prospective purchaser, CERCLA has in effect discouraged the purchase and reuse of properties that may be contaminated. As a result, the overwhelming costs of cleanups (and potential liability) have been the primary restraining factors for people otherwise interested in reusing and restoring contaminated properties.

    Good Samaritan Legislation

    There has been no shortage of offered fixes to the problem of abandoned and orphaned mines, but one solution that has seemed to be getting more traction recently is the idea of Good Samaritan legislation. While potential liability under the CWA and CERCLA has discouraged parties from cleaning up abandoned mines or reusing and restoring contaminated properties, Good Samaritan legislation may provide new hope for parties who want to attempt to clean up mines but do not have the resources to take on the liability that might accompany cleanup efforts. These parties may include citizens, government agencies, nongovernmental organizations, and mining companies.

    Pennsylvania implemented the Environmental Good Samaritan Act in 1999 and has completed fifty projects since. Those protected by this legislation include individuals, corporations, nonprofit organizations, and government entities. The Act protects them if they meet several requirements, including they that did not cause/create the abandoned mineral extraction land or water pollution, and that they provide equipment and/or materials for the project. The Pennsylvania Department of Environmental Protection (DEP) administers and reviews project proposals to determine project eligibility. While the Act has been used for mine reclamation in the past, DEP has also applied it to other environmental remediation projects, achieving success so far. In 2017, the Act has been applied to two oil and gas well projects, which are estimated to have saved DEP $60,000 to $85,000, in addition to administrative cost savings related to contract development and management. Three more projects are currently under review.

    Recently, members of Congress have made efforts to enact something similar at the federal level. In 2016, three members of the Colorado delegation to Congress proposed the Good Samaritan Cleanup of Orphan Mines Act of 2016 with the help of environmental groups Trout Unlimited and Earthworks. The bill, ultimately, was not successful.

    The practical reality of Good Samaritan legislation is that most parties who are interested in cleaning up the spills will not have the funds to effectuate a successful cleanup. While Good Samaritan laws appear to be a reasonable way to encourage cleanups, they are not enough to solve the multifaceted abandoned mine issue that has a variety of stakeholders- including the mining companies who are often let off the hook. This is why most environmental advocates tend to reject Good Samaritan proposals, as they distract from the bigger picture that the mining companies are causing the spills and are not taking responsibility to clean them up. While the EPA has issued guidance on Good Samaritan laws, few parties are willing to proceed with cleanup projects because the EPA has failed to engage in regulatory rulemaking and enforce law on the subject.

    This being said, Good Samaritan legislation alone will not solve the abandoned and orphaned mine issue. Conservation groups have proposed increased liability for mining companies. At the state level, conservation groups like San Juan Citizens Alliance and Conservation Colorado have supported the

  • It Takes a Village: Despite Challenges, Migrant Groups Lead Development in Senegal

    For generations, migrants have emigrated from Senegal, particularly from in and around the Senegal River Valley along the country’s borders with Mauritania and Mali. Young people from the Peul (particularly its Toucouleur subgroup) and Soninké ethnic groups first left to pursue economic opportunities around West Africa and Central Africa. Later, migration to France became a popular method for supporting families and improving social status in origin communities, and migrants today contribute a substantial amount in social and financial capital to development in Senegal. Remittances are essential to livelihoods, making up almost 14 percent of the country’s gross domestic product (GDP) in 2017—the fifth-highest share in Africa.

    Widespread Senegalese migration to France first began with temporary workers. As their stays became more permanent, they brought their families to live with them, typically in communities on the outskirts of Paris and other major cities. Once settled in their new communities, they established hometown associations (HTAs), largely to support development back in Senegal.

    Increasing barriers to free movement for current and former French colonial subjects that began in the 1970s—and further restrictions on migration more recently—have made life for West African migrants and would-be migrants more difficult. As a result, migrants and their HTAs have been forced to adapt. Meanwhile, in the face of shrinking income flows, some HTAs have begun to professionalize their operations and work more strategically, moving beyond construction projects to ones that seek to foster economic development.

    This article, based on the author’s Fulbright-funded research in Senegal in 2016-17, explores the impact of policy changes in France on Senegalese migrants and the activities of HTAs, and how these shifts influence development and quality of life in migrants’ origin communities in the Senegal River Valley. As the European Union incorporates support for development into migration partnerships with African countries, in hopes of reducing spontaneous migration to Europe, the work of HTAs holds important lessons for actors on both sides.

    From Colonial Ties to Migrant Arrivals

    France, which colonized large swaths of West Africa starting in the late 1800s, first became a destination for economic migrants from modern-day Senegal during and after the colonial period. For example, West Africans fought for France in both world wars and many remained in France afterwards. After World War II, France recruited migrants from its colonial empire to reconstruct the country and work in its factories. These pull factors, coupled with droughts in the Sahel region during the 1970s and 1980s, accelerated the number of young, low-skilled West Africans migrating to France during the mid- and late 20th century. As of mid-2017, about 120,000 Senegalese lived in France, according to United Nations estimates. France is the top destination for Senegalese migrants after The Gambia, and it is also the top origin for formal remittances arriving in Senegal.

    Economically motivated migration became an important source of income in rural eastern Senegal, with France frequently seen as the ideal destination. Even though migrants in Europe often worked in factories, construction, security, or sanitation, their salaries were substantial compared to those of family members back in Senegal, who generally worked as subsistence farmers or animal herders. As result of remittances, families were able to construct larger, more durable homes, afford healthier diets, and increase their consumption of other goods, particularly electronics such as cellphones, refrigerators, fans, and televisions.

    In addition, from the 1960s onward, Senegalese migrants in France began to form HTAs to support their origin communities. HTAs are formal or informal organizations of migrants from the same town, region, or ethnic group living outside their region or country of origin. These organizations sponsor cultural activities in destination communities, foster solidarity among migrants, and/or finance development projects in hometowns. HTA leadership or traditional authorities in the origin community then manage these funds and related projects on the ground. While migrants from many countries form HTAs, West Africans maintain particularly close social, political, and financial ties with their hometowns through these organizations.

    For West African migrants, social pressures compel HTA participation and members are also traditionally required to pay dues toward a communal fund. Once enough money has been amassed, the organization funds a public goods project in the hometown, such as the construction of a school, mosque, cemetery, health center, post office, or water system. These migrant-led development projects have been crucial to communities across the Senegal River Valley, which are often far from urban centers, markets, or infrastructure such as paved roads, and rarely receive contact from the central government or assistance from local government actors. As a result, migrant projects often fill the void by providing most of the public goods enjoyed by these communities.

    Senegalese HTAs thus contribute immensely to human development and quality of life in communities in this region. The impact of this work, as well as of household-level support provided by remittances, continued motivating young people to leave eastern Senegal for France, as well as regional destinations, during the mid-20th century.

    Policy Changes Drive Migration Shifts

    Beginning in the early 1980s, France began to enact a series of restrictive policies limiting low-skilled economic immigration and creating barriers to naturalization and family reunification. These changes have continued in recent decades, raising questions about the future of the migration and development cycle now cemented in the Senegal River Valley.

    Prior to the mid-1970s, Senegalese migrants freely circulated into and out of France as current, and eventually former, colonial subjects, following independence in 1960. France first introduced limits to Senegalese immigration in 1974 with a law requiring residence permits for all migrant workers.

    Throughout the 1980s and early 1990s, a series of laws including the Bonnet and Pasqua Laws restricted entry, family reunification, and naturalization for many immigrants. Although some of these provisions were later abolished, they led to several high-profile deportation operations targeting West Africans and laid the groundwork for future restrictive French immigration legislation.

    Several bilateral accords between France and Senegal over the years also focused on limiting economic migration and facilitating return for irregular migrants already in France. The evolution of these policies reflects a shift from promoting low-skilled economic immigration to satisfy labor shortages, to emphasizing high-skilled and temporary immigrants such as students.

    During the author’s fieldwork, interviewees cited many of these policies as having substantial effects on migration and development in their communities. The 1990s, the turn of the 21st century, and the presidency of Nicolas Sarkozy were the most common turning points identified when migration and development in eastern Senegal first began to shift (see Table 1). Participants emphasized the introduction of French visas and residence permits for Senegalese immigrants as the first major barriers to migration. Subsequent important political moments for participants included deportation operations in the 1980s and then-Interior Minister Sarkozy’s famous 2005 speech on immigration choisie, the government’s policy of carefully selecting immigrants who would best integrate and contribute to the French economy and society.

    At the same time, external political changes were not the only factors influencing these phenomena in the Senegal River Valley. Many participants also cited social and economic events in France as having negative consequences for Senegalese migrants and their development activities. The global economic crisis beginning in 2008 led to the disappearance of employment opportunities, including across Europe. This downturn thus decreased incomes and the ability of migrants to send money back to families and contribute to HTA projects.

    Participants reported that the mechanization of automobile production and other manufacturing, a source of employment for many West Africans for decades, compounded these effects. In cities such as Paris, with tight and expensive housing markets, these economic conditions created additional challenges to saving money. Individuals in eastern Senegal had traditionally seen France as a promised land offering easy income and employment opportunities to anyone who made the journey, regardless of French skills or education level. However, this view changed for many as challenges became more frequent.

    Beyond economic changes, shifts in attitudes within French society also affected the Senegalese diaspora. Participants noted an increase in Islamophobia and a growing climate of mistrust and intolerance toward migrants in recent years, which have only exacerbated difficulties for West Africans in France.

    Further, political and economic changes in Senegal also affected diaspora-led projects and migration patterns in the region. The administration of President Macky Sall, who took office in 2012, has decentralized development and other administrative responsibilities, delegating them to regional and local authorities. In addition, Sall’s national development scheme, Plan Sénégal Émergent (PSE), aims to provide alternatives to irregular migration from a country with high youth unemployment and a legacy of emigration. Participants cited these domestic shifts as significant, although many agreed it was too early to judge their influence on the quality of life in their communities.

    Migration and Development: Perceptions and Reality

    Study participants said they view these international and domestic political, economic, and social shifts as affecting migration flows and development efforts in their communities. Though views on whether emigration is rising or falling varied, many participants agreed that irregular migration was on the rise. Further, most participants predicted continued interest in migration among young people absent alternative employment options in the Senegal River Valley.

    Whether because of limits on authorized entry into France, difficulties upon arrival, or other motivations, migrants from eastern Senegal have diversified their destinations in recent years. Some migrants have eschewed traditional receiving countries throughout West and Central Africa or France in favor of destinations such as Italy, Spain, the United States, and even several South American countries including Argentina and Brazil.

    Limits on economic migration to France and elsewhere in Europe also impacted migrant-led development in Senegalese municipalities. Interviewees held diverse opinions on whether HTA activities were as frequent or as effective as they had been several years or even decades ago. Some said they observed consistent support for community-wide projects and noted innovative strategies used to combat potential lack of purchasing power or access to funding. However, many study participants who indicated a decrease in HTA support for their villages said they believed that migrants contributed less frequently to community-level projects, instead prioritizing maintaining household remittance levels.

    When asked about specific migrant-funded development activities, many cited completed and ongoing public goods initiatives led by their village’s HTA. When HTAs in this region began their work in the mid-20th century, mosques and water systems were frequent initial projects, with water access evolving from simple manual wells to electric- or solar-powered deep-drill wells connected to taps throughout the municipality. Today, many basic needs have been fulfilled thanks to years of HTA support, and some migrants have more recently turned to renovating and expanding these structures.

    Some HTAs have stagnated in recent years, while others have moved beyond a public goods focus to new innovative strategies of promoting development in their hometowns. Many interviewees cited a need for income- and job-generating projects to promote local economic growth and incentivize young people to remain in their home communities.

    Several HTAs in the author’s study sites piloted this type of project, including the construction of a bakery in one community and a carpentry training center in another. The bakery, built in early 2017 thanks to funds from migrants in France and their French donors, promised to provide the town with affordable, high-quality bread and employment for several people. Meanwhile, the carpentry center offered young men the opportunity to train with experienced carpenters on machines provided by a French donor. This model not only provided professional skills to young people, but also produced locally built furniture for the surrounding community to purchase.

    Within migrant households, participants noted that remittances continued to support consumption and home construction. Beyond the purchase of food, electronics, and health care, remittances also defrayed children’s educational costs, including school supplies and fees. Household members, particularly migrants’ wives, perceived both positive and negative impacts of migration on household-level development. On the one hand, remittances finance the purchase of tools and animals, the construction of irrigation infrastructure, or the hiring of employees to expand the scale of the household’s work and thus its earnings. However, the loss of the migrant’s labor to tend to animals or fields also hurts households without enough adolescents, adult children, or other family members to maintain these activities.

    Nonmigrant households had their own ideas about changes in migrant-led development. Though they did not receive remittances, individuals in these households largely perceived that community-wide development activities benefited them, as public structures built with HTAs’ support were accessible to everyone. However, despite receiving occasional financial gifts from migrant neighbors or friends, some nonmigrant households expressed feeling dissatisfied with or excluded from development happening around them.

    Effective HTA Adaptations and Development Strategies

    Certain HTAs and individual migrants have been able to overcome challenges due to decreased income or barriers to authorized employment in France and other host countries. Individuals in origin communities perceived strategies modifying HTA structures, funding sources, and project types as most effective in continuing development efforts.

    One particularly effective change was the professionalization of these organizations. HTAs that moved from traditional leadership hierarchies and divisions of labor to more formal, structured ones were better able to form financial and logistical partnerships and expand the scope of their projects. Associations with clearly defined goals, leadership, project plans, and project evaluation were able to attract the cooperation of French government entities such as the Program to Support Solidarity Initiatives for Development (PAISD for its French acronym) or other international donors. Thus, despite a potential decrease in income from individuals, many HTAs began supplementing member dues with larger funding sources. Formalized structures also promoted better project management, evaluation, and long-term sustainability.

    Another key HTA adaptation was the idea of becoming community or village associations, as opposed to migrant associations. The frequent use of the term association de migrants can have a top-down connotation, implying that the diaspora unilaterally provides ideas, support, and manpower for development efforts without important input about living conditions from communities in Senegal. For HTAs that started conceptualizing themselves as a unified development organization with a branch abroad and a branch in Senegal, this strategy seemed to improve communication and promote inclusion, thus responding better to current needs and giving the local community more of a stake in projects.

    A gradual trend toward more investment- and training-focused projects has also seen success. The basic human development needs of many communities have been satisfied after decades of hard work; still, conditions are not sufficient to keep the next generation from leaving. While the bakery and the carpentry center are key examples of productive initiatives, more support and focus on this type of project could bring meaningful change to local economies and markets. Many local organizations and collectives are already doing quality work in agriculture, herding, or transportation, and increased funding from HTAs could greatly expand the scale of their existing activities.

    Meanwhile, women’s associations in rural Senegal do not always receive HTA support, representing a potential area for expansion. West African HTAs are traditionally dominated by men, with male leadership at origin and abroad. In Senegal, economic activity is frequently divided by gender and women run many of their own associations, often focused on agriculture or microsavings. However, these structures do not receive much or any support from female migrants in France, who are less likely to be in the labor force than male Senegalese and thus might not be able to send money back to Senegal. Given these conditions, many well-organized and highly motivated women’s agricultural collectives would greatly benefit from increased migrant support.

    Finally, the federalization of community-level HTAs into larger regional organizations is an increasingly common strategy. This approach allows migrants to pool their resources and knowledge to tackle larger-scale development questions, despite economic or administrative challenges they may individually face in their host communities.

    The Future of Migrant-Led Development in Eastern Senegal

    Understanding the complex relationship among emigration, HTA development activities, and political, economic, and social changes in both France and at home is essential to the future of development in eastern Senegal. This study suggests that while HTA activities may be affected by political shifts domestically and abroad, economic changes on the sending and receiving sides are equally important and may be felt more immediately by the population at origin.

    Senegalese HTAs can no longer depend on traditional fundraising and project management strategies. These organizations must adapt to current and emerging economic and political conditions hindering legal employment and income accumulation among migrants in France and across Europe. Inclusive project planning that considers the needs and perspectives of the local population, as well as openness to productive investments and collaboration with outside partners are key steps to sustaining the work of HTAs.

    Current European efforts such as the European Union Emergency Trust Fund for Africa (EUTF) are incorporating development support into partnerships with countries including Senegal to try to stem migration. While the efficacy of migrant-driven projects and even state-led development activities in preventing emigration remains to be seen—particularly given the social pressures and cycle of dependence at play in this region—harnessing the power, expertise, and motivation of the diaspora is essential for the interests of actors on both continents. EU projects and dialogues that do not include African diasporas and their HTAs may not adequately address the phenomena occurring in regions such as rural Senegal. Building on migrant-led development work is a crucial step in changing conditions that contribute to emigration from this region.

    A Toronto woman has been charged with fraud and pretending to practice witchcraft after she allegedly convinced a man that he needed to sell his house and transfer the money to her account in order to get rid of evil spirits.

    York region police say the 67-year-old victim met with a psychic who used the name Evanna approximately five years ago. “Evanna” allegedly convinced the man that in order to get rid of evil spirits in his home, he had to sell the house and transfer the money to her account, where it would remain until the spirits were gone.

    Police said the money was never returned and the victim was asked for another $6,000, which the psychic said she would burn in order to ward off the evil spirits.

    The man sold his car and used his credit cards in order to meet her demands. He lost more than $600,000 in the alleged scheme, police said.

    Following a nearly year-long investigation, police have charged 27-year-old Samantha Stevenson with pretending to practice witchcraft, fraud over $5,000 and possession of property obtained by crime.

    Police say Stevenson used the alias Evanna Lopez.

    Witchcraft is among the antiquated offences that the federal government plans to remove from the Criminal Code. That legislation is currently before a House of Commons committee.
