Rapport HRW : Italie : Les renvois de migrants vers la Grèce constituent une violation de leurs droits
(Rome,le 22 janvier 2013) – L’Italie renvoie de manière sommaire des mineurs migrants non accompagnés et des demandeurs d’asile adultes vers la Grèce, où ils subissent les dysfonctionnements du système d’asile et des conditions de détention abusives, a déclaré Human Rights Watch dans un rapport publié aujourd’hui. Les passagers clandestins à bord des ferrys provenant de Grèce, parmi lesquels figurent des enfants dès 13 ans, sont renvoyés par les autorités italiennes dans les heures qui suivent leur découverte, sans prise en compte adéquate des besoins spécifiques des mineurs, ou de la volonté de ces personnes de demander l’asile.

Italy Often Turns Back Asylum Seekers Arriving Illegally From Greece, Report Says
ROME — Instead of following international standards on how to treat asylum seekers and unaccompanied migrant children who arrive illegally from Greece, the Italian authorities have been summarily returning them, according to a report by Human Rights Watch scheduled to be published Tuesday.

Xenophobic violence in Greece (HRW):
Greece has become anything but hospitable to migrants and asylum seekers over the years, as anti-immigrant sentiment and xenophobic violence spread. In July, we documented dozens of attacks on foreigners, who had been beaten, kicked, and chased down the streets of Athens by gangs of Greeks. Victims included migrants and asylum seekers, children and women, two of them pregnant.
There is also growing evidence that Golden Dawn members and sympathizers are involved in xenophobic attacks.
“They say it’s a free country but then they beat me because I’m a migrant,” Qadir Hossaini, a legal Afghan migrant, told us after a group of people attacked him in September 2011.
Hossaini, like the vast majority of the victims, has little chance to see justice done. We found that attackers are rarely arrested, and police inaction is the rule. Many victims don’t report attacks to the police because of lack of trust, but the police themselves actively discourage many victims from filing complaints. The police tell the victims it’s not worth it because they cannot recognize the assailants, that they should fight back themselves, or, in the case of undocumented migrants, that they could be detained and deported. Those who insist face a 100 Euro fee to file an official complaint.
One positive development, if slow in coming, was the establishment last month by Minister Nikos Dendias of specialized police units to address racist violence. Unfortunately the units do not have a clear mandate to investigate all hate crimes comprehensively, no matter the legal status of the victim, and there are outstanding questions about how the units will be staffed. These issues raise concerns about how effective the units will be.
There is no more excuse for vigilante violence, or for the failure of the police, the courts and government to demonstrate zero tolerance for xenophobic violence by ensuring justice for all victims.

Depuis le début de la guerre en 2011, des milliers de Syriens affluent en Europe. Un rapport de l’organisation de défense Human Rights Watch, sorti ce dimanche 23 décembre, appelle le continent à leur donner davantage de protection. En Grèce, ils sont parfois détenus « dans des conditions très difficiles », selon HRW.

Les images satellite ne peuvent pas mentir. L’ONG Human Rights Watch y recourt de plus en plus pour étayer ses enquêtes, notamment sur la Birmanie, le Sri Lanka et la Syrie
Mercredi 24 octobre en fin d’après-midi, le téléphone sonne dans les locaux genevois de Human Rights Watch (HRW). Au bout du fil, un correspondant birman de l’organisation de protection des droits de l’homme communique des informations préoccupantes : depuis quelques heures, des rumeurs d’affrontements circulent à l’ouest du pays, dans l’Etat de Rakhine. Un incendie aurait démarré, d’origine inconnue, qui ravagerait des quartiers d’habitations dans la ville côtière de Kyauk Pyu, majoritairement peuplée de musulmans rohingyas. A Genève, Peter Bouckaert, directeur des urgences chez HRW, prend l’alerte très au sérieux. Ces derniers mois, l’Etat de Rakhine a replongé dans les affrontements sectaires, dont les Rohingyas, minorité musulmane apatride et persécutée, sont les principales victimes. Depuis une première vague de violence en juin dernier, au moins 180 personnes ont péri et plus de 110 000 ont été déplacées. Le manque de volonté des autorités à endiguer les heurts opposant bouddhistes et musulmans est l’ombre la plus tenace au tableau enchanteur de la démocratisation birmane.

La conclusion du Temps est, sans doute, beaucoup trop optimiste :
« Imaginez que nous en eussions disposé, comme c’était le cas de l’armée américaine, à l’époque du siège de Srebrenica, interroge Peter Bouckaert. Le cours de l’histoire en aurait peut-être été changé. »
sachant qu’un peu plus haut dans l’article, la référence au Sri Lanka prouve explicitement le contraire :
« Dans le cas du Sri Lanka, nous disposions de centaines d’images. Nous savions exactement ce qui se passait [ndlr : au moment de l’ultime offensive armée contre les Tigres tamouls, début 2009, les deux parties se sont livrées à des exactions massives contre les civils. Le massacre se déroulait à huis clos] », explique l’analyste. Sans qu’il s’étende, on comprend que son travail est resté sous le boisseau, les instances onusiennes redoutant que la publication d’images aussi explicites ne braque Colombo, l’incitant à bloquer tout accès humanitaire à la zone des combats.
Je ne vois pas pourquoi l’ONU, impliquée en première ligne, aurait laissé publier les preuves de son absolue inefficacité, voire plus.
Mais l’optimiste est directeur chez HRW, il a forcément raison ( le chef a … ), le pessimiste est juste l’analyste qui travaille sur les photos.
En fait, ceux qui analysent vraiment bien ces docs, et les utilisent sur le terrain, ce sont les gens d’Unosat à Genève, une structure de l’Onu qui fait parti de l’Unitar. Ils servent les travailleurs humanitaires, les responsables des grosses machines logistiques qui se mettent en branle lors des désastres, des guerres, etc...
Ils ne disent pas que les images ne « mentent jamais ». Au contraire, ils sont plutôt très modeste et disent que l’interprétation de certaines images est extrêmement difficile et qu’ils ne sont jamais sur d’identifier un objet de manière sûre à 100 %.
JE reconnais que dans l’article, l’expression « le cours de l’histoire aurait été changé » n’est pas pertinent. dans de nombreux cas, on a vu que le cours de l’histoire continue comme si de rien était même si on est relativement bien indormé des situations : colonisation en Palestine, discrimination des Rohingas depuis des décennies, etc...

Chez HRW, la mission de Josh Lyons a évolué : l’interprétation va de pair avec la publication. “Les images #satellite n’ont véritablement de valeur que lorsqu’elles deviennent publiques. Ce n’est qu’ainsi que l’on peut exploiter leur potentiel“.

[JURIST] The Syrian military is using cluster munitions [HRW backgrounder] against opposition forces, Human Rights Watch (HRW) [advocacy website] reported [text] on Sunday. A Youtube video [video], posted by Syrian opposition forces, showed remnants of cluster munitions allegedly near several towns. Markings on the remnants suggest they were dropped from aircraft. The report details several instances of cluster munitions being used and being reported by civilians. HRW has called for Syria to stop using these munitions and for local media to detail the dangers of them more extensively.The use of these munitions are prohibited according to the Convention on Cluster Munitions (CCM) [text, PDF], which Syria has neither signed nor ratified, because of the potential harm they pose to civilians. The CCM bans the use, stockpiling, production and transfer of cluster bombs, weapons that break apart, releasing large numbers of smaller, self-contained explosives which spread out before detonating on impact.
This is not the first HRW report calling attention to Syria using cluster munitions. In July HRW reported evidence of Soviet-made cluster munitions being used [JURIST report] in Syria. The Convention was initially agreed upon [JURIST report] by nations in May 2008 following 10 days of negotiations at the Dublin Diplomatic Conference on Cluster Munitions [official website] while the US, Russia and China each declined to sign it. In November 2010 the former UN Deputy Secretary-General Asha-Rose Migiro [UN profile] had urged more states to join the CCM at the First Meeting of States Parties [official website]. The CCM officially went into effect in August 2010, six month after the UN’s announcement [JURIST reports], as binding international law with 107 countries having signed the treaty and 37 countries having ratified it.

The government needs to take immediate steps to end abuses against people with mental disabilities in institutions, prayer camps, and the community. The conditions in which many people with mental disabilities live in Ghana are inhuman and degrading.

People with mental disabilities suffer severe abuses in psychiatric institutions and spiritual healing centers in Ghana, Human Rights Watch said in a report released today. The Ghanaian government has done little to combat such abuse or to ensure that these people can live in the community, as is their right under international law.
The 84-page report, “‘Like a Death Sentence’: Abuses against Persons with Mental Disabilities in Ghana,”describes how thousands of people with mental disabilities are forced to live in these institutions, often against their will and with little possibility of challenging their confinement. In psychiatric hospitals, people with mental disabilities face overcrowding and unsanitary conditions. In some of the spiritual healing centers, popularly known as prayer camps, they are often chained to trees, frequently in the baking sun, and forced to fast for weeks as part of a “healing process,” while being denied access to medications.

(Almaty) – Les lois répressives et les pratiques abusives du gouvernement et de certaines compagnies pétrolières enfreignent les droits du travail de milliers d’ouvriers travaillant dans le secteur pétrolier florissant du Kazakhstan, a déclaré Human Rights Watch dans un rapport paru aujourd’hui. De violents affrontements au Kazakhstan occidental en 2011 suite à une grève prolongée des ouvriers pétroliers mettent en lumière un plus vaste problème, à savoir le non-respect des droits des travailleurs et d’autres droits humains dont les partenaires commerciaux et financiers du Kazakhstan devraient se préoccuper.
Le pétrole représente littéralement le carburant de l’économie kazakhe en plein essor, mais le gouvernement et les pétrolières enfreignent les droits fondamentaux des travailleurs qui assument la lourde tâche d’acheminer le pétrole de leur pays vers le marché, dans des conditions difficiles et souvent dangereuses. Les droits des travailleurs sont bafoués alors que ces derniers n’ont personne vers qui se tourner pour résoudre les conflits sociaux.

Reports from the US-based Human Rights Watch (HRW) and Amnesty International, and from Al Jazeera, have shed further light on the oppressive conditions facing the Rohingya Muslim population in Burma’s Rakhine state (also known as Arakan), as well as the communal violence that broke out in June.
The Rohingya are a distinct ethnic group in Burma and neighbouring Bangladesh. They have lived in the area for centuries and are believed to have descended from Arab traders. Both countries treat them as illegal immigrants, deny them citizenship and discriminate against them. In times of rising economic stress and social tension, they become convenient scapegoats for nationalist demagogues.

PARIS, June 11 (UPI) — Human Rights Watch objected to a French arms expo featuring a Russian military company thought to be a major supplier to Syrian government forces.
The Eurosatory arms show gets under way in France this week, featuring more than 1,000 exhibitors from 70 countries.
Human Rights Watch said it objected to the participation of Russian arms supplier Rosoboronexport at the event.
Jean-Marie Fardeau, French director for Human Rights Watch, said it’s duplicitous for the French government to both condemn the Syrian government for the ongoing bloodshed and host one of Syria’s largest arms suppliers.

“It’s not acceptable to do business as usual with a company arming a government engaged in atrocities against its people,” he said in a statement.
The rights organization says that providing weapons to Syria while the government there is suspected of committing crimes against humanity may by a violation of international law.
U.N. officials last week said they suspected Syria had committed atrocities against its people during a series of massacres the government in Damascus blames on terrorists.
Russia and China are among the leading critics of formal action against Syria at the U.N. Security Council.
British Foreign Secretary William Hague told Sky News he would continue to pressure Russian officials to get in line behind the peace plan brokered by former U.N. Secretary-General Kofi Annan.
“Every other solution of any kind to the Syrian crisis involves a lot more deaths,” he said.

Lies of the Free Syrian Army
Well, despite denials and deceptions, wives of the Lebanese kidnapped pilgrims recognized two members of the Free Syrian Army as their kidnappers. Responding to the story, Human Rights Watch said that they don’t have enough staff to interview the witnesses because they are busy skyping with Free Syrian Army folks to give them stories.

Selon Corinne Dufka, une chercheuse principale en Afrique de l’ouest pour ’Human Rights Watch’ (HRW), qui a conduit une mission d’enquête de 10 jours au Mali en avril, tous les témoins que son organisation a interrogés avaient déclaré avoir vu des enfants soldats dans les rangs des rebelles.
Des enfants combattants avaient été vus dans les rangs des rebelles touaregs, notamment le Mouvement national pour la libération de l’Azawaad (MNLA).
Selon un rapport de HRW intitulé « Mali - Des crimes de guerre commis par les rebelles dans le nord », publié le 30 avril « beaucoup (d’enfants) ont été décrits comme transportant des fusils d’assaut militaires et portant des tenues qui, selon certaines personnes, étaient trop grandes pour leurs corps ».

D’après un rapport de Human Rights Watch (HRW), des viols et violences sexuelles se déroulent dans les villes et les villages au nord du Mali. « Nous sommes très préoccupés par ce qui semble être une augmentation drastique dans le ciblage et l’abus sexuel des femmes et des filles par des groupes armés dans le nord », a déclaré à l’IPS, Corrine Dufka, chercheuse senior Afrique de l’Ouest à Human Rights Watch.

Both men and women are victimized by sexual violence, according to reports by Amnesty International and the United Nations, though so few people report rapes that it is impossible to know how many people have been affected. Human Rights Watch fears that the extent of these violations may be underestimated in some cases and, in other cases, exaggerated in order to encourage people to arm themselves.
However, according to a HRW researcher who did not want to be named because he is not authorized to speak on the subject, it has been confirmed that rape is being used as a method of torture against men and women in Syrian prisons. The researcher also mentioned reports of sexual assault against women when the army raids houses in search of wanted men or weapons.

Il se trouve que je m’intéresse de près aux violences sexuelles dans les conflits armés et je mets sous le coudes les infos qui s’y rapportent. The BBC has been told by doctors that Uzbekistan is running a secret programme to sterilise women - and has talked to women sterilised without their knowledge or consent.
“It’s a simple formula - less women give birth, less of them die,” said one surgeon.
The result is that this helps the country to improve its ranking in international league tables for maternal and infant mortality.
“Uzbekistan seems to be obsessed with numbers and international rankings,” says Steve Swerdlow, Central Asia director at Human Rights Watch.
“I think it’s typical of dictatorships that need to construct a narrative built on something other than the truth.”
