    The absence of a Special Envoy makes the media’s role of spotlighting outbreaks of hatred and anti-Semitism even more vital. This is why I was deeply alarmed to see the New York Times downplay and whitewash a neo-Nazi gang in a recent article [https://www.nytimes.com/2018/07/21/world/europe/ukraine-roma-attacks.html] about Ukraine.

    Over the past three years, the trajectory of far-right development in #Ukraine has gotten worse. The government has declared #Nazi collaborators guilty of slaughtering Jews to be freedom fighters; parades to these groups are a common sight in Ukraine. Often, they are accompanied by rank anti-Semitism: In January 2017, chants of “Jews out” were heard at a torchlight parade in Kiev. According to RFE, Nazi salutes were seen when 20,000 marched last October. This April, the Anti-Defamation League’s Director of European Affairs tweeted a video of Nazi salutes as hundreds of people marched in the memory of a Waffen SS unit.

    [...] And while the country’s prime minister is Jewish, Deputy Interior Minister Vadym Troyan has a long history of involvement with #neo-Nazi gangs. In 2014, Jewish groups, including Ukrainian Jewish leaders, were appalled at the idea of Troyan becoming chief of police in Kiev; today, he is one of the most powerful men in the country. And according to the Washington Post, another extremely powerful figure, Parliament Speaker Andriy Parubiy, spent over a decade running the overtly neo-Nazi Social-National Party of Ukraine. Parubiy is no longer formally affiliated with neo-Nazi organizations, but his dark past is deeply troubling, especially in a nation where gangs such as C14 act with impunity (according to Human Rights Watch, Amnesty International and the United Nations).

  • China: Crackdown on Tibetan Social Groups. New Regulations Ban Social Action Under Guise of Fighting ‘Organized Crime’

    Chinese authorities are using an ostensible anti-mafia campaign to target suspected political dissidents and suppress civil society initiatives in Tibetan areas, Human Rights Watch said in a report released today. The authorities are now treating even traditional forms of social action, including local mediation of community or family disputes by lamas or other traditional authority figures, as illegal.

    The 101-page report, “‘Illegal Organizations’: China’s Crackdown on Tibetan Social Groups,” details efforts by the Chinese Communist Party at the local level to eliminate the remaining influence of lamas and traditional leaders within Tibetan communities. The report features rare in-depth interviews, state media cartoons depicting the new restrictions, and cases of Tibetans arbitrarily detained for their involvement in community activities.

    À cause de sa politique migratoire appuyée par l’Union européenne qui bloque des milliers d’enfants demandeurs d’asile dans les îles de la mer Égée, la Grèce prive ces enfants de leur droit à l’éducation, a déclaré Human Rights Watch aujourd’hui.
    Le rapport de 51 pages, intitulé « ‘Without Education They Lose Their Future’ : Denial of Education to Child Asylum Seekers on the Greek Islands » (« ‘Déscolarisés, c’est leur avenir qui leur échappe’ : Les enfants demandeurs d’asile privés d’éducation sur les îles grecques », résumé et recommandations disponibles en français), a constaté que moins de 15 % des enfants en âge d’être scolarisés vivant dans les îles, soit plus de 3 000, étaient inscrits dans des établissements publics à la fin de l’année scolaire 2017-2018, et que dans les camps que gère l’État dans les îles, seuls une centaine, tous des élèves de maternelle, avaient accès à l’enseignement officiel. Les enfants demandeurs d’asile vivant dans les îles grecques sont exclus des opportunités d’instruction qu’ils auraient dans la partie continentale du pays. La plupart de ceux qui ont pu aller en classe l’ont fait parce qu’ils ont pu quitter les camps gérés par l’État grâce à l’aide des autorités locales ou de volontaires.

    « La Grèce devrait abandonner sa politique consistant à confiner aux îles les enfants demandeurs d’asile et leurs familles, puisque depuis deux ans, l’État s’est avéré incapable d’y scolariser les enfants », a déclaré Bill Van Esveld, chercheur senior de la division Droits des enfants à Human Rights Watch. « Abandonner ces enfants sur des îles où ils ne peuvent pas aller en classe leur fait du tort et viole les propres lois de la Grèce. »

    Human Rights Watch s’est entretenue avec 107 enfants demandeurs d’asile et migrants en âge d’être scolarisés vivant dans les îles, ainsi qu’avec des responsables du ministère de l’Éducation, de l’ONU et de groupes humanitaires locaux. Elle a également examiné la législation en vigueur.

    L’État grec applique une politique appuyée par l’UE qui consiste à maintenir dans les îles les demandeurs d’asile qui arrivent de Turquie par la mer jusqu’à ce que leurs dossiers de demande d’asile soient traités. Le gouvernement soutient que ceci est nécessaire au regard de l’accord migratoire que l’EU et la Turquie ont signé en mars 2016. Le processus de traitement est censé être rapide et les personnes appartenant aux groupes vulnérables sont censées en être exemptées. Mais Human Rights Watch a parlé à des familles qui avaient été bloquées jusqu’à 11 mois dans les camps, souvent à cause des longs délais d’attente pour être convoqué aux entretiens relatifs à leur demande d’asile, ou parce qu’elles ont fait appel du rejet de leur demande.

    Même si l’État grec a transféré plus de 10 000 demandeurs d’asile vers la Grèce continentale depuis novembre, il refuse de mettre fin à sa politique de confinement. En avril 2018, la Cour suprême grecque a invalidé cette politique pour les nouveaux arrivants. Au lieu d’appliquer ce jugement, le gouvernement a émis une décision administrative et promulgué une loi afin de rétablir la politique.

    D’après la loi grecque, la scolarité est gratuite et obligatoire pour tous les enfants de 5 à 15 ans, y compris ceux qui demandent l’asile. Le droit international garantit à tous les enfants le même droit de recevoir un enseignement primaire et secondaire, sans discrimination. Les enfants vivant en Grèce continentale, non soumis à la politique de confinement, ont pu s’inscrire dans l’enseignement officiel.

    Selon l’office humanitaire de la Commission européenne, ECHO, « l’éducation est cruciale » pour les filles et garçons touchés par des crises. Cette institution ajoute que l’éducation permet aux enfants de « retrouver un certain sens de normalité et de sécurité », d’acquérir des compétences importantes pour leur vie, et que c’est « un des meilleurs outils pour investir dans leur avenir, ainsi que dans la paix, la stabilité et la croissance économique de leur pays ».

    Une fille afghane de 12 ans, qui avait séjourné pendant six mois dans un camp géré par l’État grec dans les îles, a déclaré qu’avant de fuir la guerre, elle était allée à l’école pendant sept ans, et qu’elle voulait y retourner. « Si nous n’étudions pas, nous n’aurons pas d’avenir et nous ne pourrons pas réussir, puisque nous [ne serons pas] instruits, nous ne saurons parler aucune langue étrangère », a-t-elle déclaré.

    Plusieurs groupes non gouvernementaux prodiguent un enseignement informel aux enfants demandeurs d’asile dans les îles, mais d’après les personnes qui y travaillent, rien ne peut remplacer l’enseignement officiel. Par exemple il existe une école de ce type dans le camp de Moria géré par l’État sur l’île de Lesbos, mais elle ne dispose qu’à temps partiel d’une salle dans un préfabriqué, ce qui signifie que les enfants ne peuvent recevoir qu’une heure et demie d’enseignement par jour. « Ils font de leur mieux et nous leur en sommes reconnaissants, mais ce n’est pas une véritable école », a fait remarquer un père.

    D’autres assurent le transport vers des écoles situées à l’extérieur des camps, mais ne peuvent pas emmener les enfants qui sont trop jeunes pour s’y rendre tout seuls. Certains élèves vivant à l’extérieur des camps de l’État suivent un enseignement informel et ont également reçu l’aide de volontaires ou de groupes non gouvernementaux afin de s’inscrire dans l’enseignement public. Ainsi des volontaires ont aidé un garçon kurde de 13 ans vivant à Pipka, un site situé à l’extérieur des camps de l’île de Lesbos, désormais menacé de fermeture, à s’inscrire dans un établissement public, où il est déjà capable de suivre la classe en grec

    Des parents et des enseignants estimaient que la routine scolaire pourrait aider les enfants demandeurs d’asile à se remettre des expériences traumatisantes qu’ils ont vécues dans leurs pays d’origine et lors de leur fuite. À l’inverse, le manque d’accès à l’enseignement, combiné aux insuffisances du soutien psychologique, exacerbe le stress et l’anxiété qui découlent du fait d’être coincé pendant des mois dans des camps peu sûrs et surpeuplés. Évoquant les conditions du camp de Samos, une fille de 17 ans qui a été violée au Maroc a déclaré : « [ça] me rappelle ce que j’ai traversé. Moi, j’espérais être en sécurité. »

    Le ministère grec de la Politique d’immigration, qui est responsable de la politique de confinement et des camps des îles, n’a pas répondu aux questions que Human Rights Watch lui avait adressées au sujet de la scolarisation des enfants demandeurs d’asile et migrants vivant dans ces îles. Plusieurs professionnels de l’éducation ont déclaré qu’il existait un manque de transparence autour de l’autorité que le ministère de l’Immigration exerçait sur l’enseignement dans les îles. Une commission du ministère de l’Éducation sur la scolarisation des réfugiés a rapporté en 2017 que le ministère de l’Immigration avait fait obstacle à certains projets visant à améliorer l’enseignement dans les îles.

    Le ministère de l’Éducation a mis en place deux programmes clés pour aider les enfants demandeurs d’asile de toute la Grèce qui ne parlent pas grec et ont souvent été déscolarisés pendant des années, à intégrer l’enseignement public et à y réussir, mais l’un comme l’autre excluaient la plupart des enfants vivant dans les camps des îles gérés par l’État.

    En 2018, le ministère a ouvert des écoles maternelles dans certains camps des îles, et en mai, environ 32 enfants d’un camp géré par une municipalité de Lesbos ont pu s’inscrire dans des écoles primaires – même si l’année scolaire se terminait en juin. Le ministère a déclaré que plus de 1 100 enfants demandeurs d’asile avaient fréquenté des écoles des îles à un moment ou un autre de l’année scolaire 2017-2018, mais apparemment ils étaient nombreux à avoir quitté les îles avant la fin de l’année.

    Une loi adoptée en juin a permis de clarifier le droit à l’éducation des demandeurs d’asile et, le 9 juillet, le ministère de l’Éducation a déclaré qu’il prévoyait d’ouvrir 15 classes supplémentaires destinées aux enfants demandeurs d’asile des îles pour l’année scolaire 2018-2019. Ce serait une mesure très positive, à condition qu’elle soit appliquée à temps, contrairement aux programmes annoncés les années précédentes. Même dans ce cas, elle laisserait sur le carreau la majorité des enfants demandeurs d’asile et migrants en âge d’être scolarisés, à moins que le nombre d’enfants vivant dans les îles ne diminue.

    « La Grèce a moins de deux mois devant elle pour veiller à ce que les enfants qui ont risqué leur vie pour atteindre ses rivages puissent aller en classe lorsque l’année scolaire débutera, une échéance qu’elle n’a jamais réussi à respecter auparavant », a conclu Bill Van Esveld. « L’Union européenne devrait encourager le pays à respecter le droit de ces enfants à l’éducation en renonçant à sa politique de confinement et en autorisant les enfants demandeurs d’asile et leurs familles à quitter les îles pour qu’ils puissent accéder à l’enseignement et aux services dont ils ont besoin. »

  • By Stifling Migration, Sudan’s Feared Secret Police Aid Europe

    At Sudan’s eastern border, Lt. Samih Omar led two patrol cars slowly over the rutted desert, past a cow’s carcass, before halting on the unmarked 2,000-mile route that thousands of East Africans follow each year in trying to reach the Mediterranean, and then onward to Europe.

    His patrols along this border with Eritrea are helping Sudan crack down on one of the busiest passages on the European migration trail. Yet Lieutenant Omar is no simple border agent. He works for Sudan’s feared secret police, whose leaders are accused of war crimes — and, more recently, whose officers have been accused of torturing migrants.

    Indirectly, he is also working for the interests of the European Union.

    “Sometimes,” Lieutenant Omar said, “I feel this is Europe’s southern border.”

    Three years ago, when a historic tide of migrants poured into Europe, many leaders there reacted with open arms and high-minded idealism. But with the migration crisis having fueled angry populism and political upheaval across the Continent, the European Union is quietly getting its hands dirty, stanching the human flow, in part, by outsourcing border management to countries with dubious human rights records.

    In practical terms, the approach is working: The number of migrants arriving in Europe has more than halved since 2016. But many migration advocates say the moral cost is high.

    To shut off the sea route to Greece, the European Union is paying billions of euros to a Turkish government that is dismantling its democracy. In Libya, Italy is accused of bribing some of the same militiamen who have long profited from the European smuggling trade — many of whom are also accused of war crimes.

    In Sudan, crossed by migrants trying to reach Libya, the relationship is more opaque but rooted in mutual need: The Europeans want closed borders and the Sudanese want to end years of isolation from the West. Europe continues to enforce an arms embargo against Sudan, and many Sudanese leaders are international pariahs, accused of committing war crimes during a civil war in Darfur, a region in western Sudan.

    But the relationship is unmistakably deepening. A recent dialogue, named the Khartoum Process (in honor of Sudan’s capital) has become a platform for at least 20 international migration conferences between European Union officials and their counterparts from several African countries, including Sudan. The European Union has also agreed that Khartoum will act as a nerve center for countersmuggling collaboration.

    While no European money has been given directly to any Sudanese government body, the bloc has funneled 106 million euros — or about $131 million — into the country through independent charities and aid agencies, mainly for food, health and sanitation programs for migrants, and for training programs for local officials.

    “While we engage on some areas for the sake of the Sudanese people, we still have a sanction regime in place,” said Catherine Ray, a spokeswoman for the European Union, referring to an embargo on arms and related material.

    “We are not encouraging Sudan to curb migration, but to manage migration in a safe and dignified way,” Ms. Ray added.

    Ahmed Salim, the director of one of the nongovernmental groups that receives European funding, said the bloc was motivated by both self-interest and a desire to improve the situation in Sudan.

    “They don’t want migrants to cross the Mediterranean to Europe,” said Mr. Salim, who heads the European and African Center for Research, Training and Development.

    But, he said, the money his organization receives means better services for asylum seekers in Sudan. “You have to admit that the European countries want to do something to protect migrants here,” he said.

    Critics argue the evolving relationship means that European leaders are implicitly reliant on — and complicit in the reputational rehabilitation of — a Sudanese security apparatus whose leaders have been accused by the United Nations of committing war crimes in Darfur.

    “There is no direct money exchanging hands,” said Suliman Baldo, the author of a research paper about Europe’s migration partnership with Sudan. “But the E.U. basically legitimizes an abusive force.”

    On the border near Abu Jamal, Lieutenant Omar and several members of his patrol are from the wing of the Sudanese security forces headed by Salah Abdallah Gosh, one of several Sudanese officials accused of orchestrating attacks on civilians in Darfur.

    Elsewhere, the border is protected by the Rapid Support Forces, a division of the Sudanese military that was formed from the janjaweed militias who led attacks on civilians in the Darfur conflict. The focus of the group, known as R.S.F., is not counter-smuggling — but roughly a quarter of the people-smugglers caught in January and February this year on the Eritrean border were apprehended by the R.S.F., Lieutenant Omar said.

    European officials have direct contact only with the Sudanese immigration police, and not with the R.S.F., or the security forces that Lieutenant Omar works for, known as N.I.S.S. But their operations are not that far removed.

    The planned countertrafficking coordination center in Khartoum — staffed jointly by police officers from Sudan and several European countries, including Britain, France and Italy — will partly rely on information sourced by N.I.S.S., according to the head of the immigration police department, Gen. Awad Elneil Dhia. The regular police also get occasional support from the R.S.F. on countertrafficking operations in border areas, General Dhia said.

    “They have their presence there and they can help,” General Dhia said. “The police is not everywhere, and we cannot cover everywhere.”

    Yet the Sudanese police are operating in one unexpected place: Europe.

    In a bid to deter future migrants, at least three European countries — Belgium, France and Italy — have allowed in Sudanese police officers to hasten the deportation of Sudanese asylum seekers, General Dhia said.

    Nominally, their official role is simply to identify their citizens. But the officers have been allowed to interrogate some deportation candidates without being monitored by European officials with the language skills to understand what was being said.

    More than 50 Sudanese seeking asylum in Europe have been deported in the past 18 months from Belgium, France and Italy; The New York Times interviewed seven of them on a recent visit to Sudan.

    Four said they had been tortured on their return to Sudan — allegations denied by General Dhia. One man was a Darfuri political dissident deported in late 2017 from France to Khartoum, where he said he was detained on arrival by N.I.S.S. agents.

    Over the next 10 days, he said he was given electric shocks, punched and beaten with metal pipes. At one point the dissident, who asked that his name be withheld for his safety, lost consciousness and had to be taken to the hospital. He was later released on a form of parole.

    The dissident said that, before his deportation from France, Sudanese police officers had threatened him as French officers stood nearby. “I said to the French police: ‘They are going to kill us,’” he said. “But they didn’t understand.”

    European officials argue that establishing Khartoum as a base for collaboration on fighting human smuggling can only improve the Sudanese security forces. The Regional Operational Center in Khartoum, set to open this year, will enable delegates from several European and African countries to share intelligence and coordinate operations against smugglers across North Africa.

    But potential pitfalls are evident from past collaborations. In 2016, the British and Italian police, crediting a joint operation with their Sudanese counterparts, announced the arrest of “one of the world’s most wanted people smugglers.” They said he was an Eritrean called Medhanie Yehdego Mered, who had been captured in Sudan and extradited to Italy.

    The case is now privately acknowledged by Western diplomats to have been one of mistaken identity. The prisoner turned out to be Medhanie Tesfamariam Berhe, an Eritrean refugee with the same first name as the actual smuggler. Mr. Mered remains at large.

    Even General Dhia now admits that Sudan extradited the wrong man — albeit one who, he says, admitted while in Sudanese custody to involvement in smuggling.

    “There were two people, actually — two people with the same name,” General Dhia said.

    Mr. Berhe nevertheless remains on trial in Italy, accused of being Mr. Mered — and of being a smuggler.

    Beyond that, the Sudanese security services have long been accused of profiting from the smuggling trade. Following European pressure, the Sudanese Parliament adopted a raft of anti-smuggling legislation in 2014, and the rules have since led to the prosecution of some officials over alleged involvement in the smuggling business.

    But according to four smugglers whom I interviewed clandestinely during my trip to Sudan, the security services remain closely involved in the trade, with both N.I.S.S and R.S.F. officials receiving part of the smuggling profits on most trips to southern Libya.

    The head of the R.S.F., Brig. Mohammed Hamdan Daglo, has claimed in the past that his forces play a major role in impeding the route to Libya. But each smuggler — interviewed separately — said that the R.S.F. was often the main organizer of the trips, often supplying camouflaged vehicles to ferry migrants through the desert.

    After being handed over to Libyan militias in Kufra and Sabha, in southern Libya, many migrants are then systematically tortured and held for ransom — money that is later shared with the R.S.F., each smuggler said.

    Rights activists have previously accused Sudanese officials of complicity in trafficking. In a 2014 report, Human Rights Watch said that senior Sudanese police officials had colluded in the smuggling of Eritreans.

    A British journalist captured by the R.S.F. in Darfur in 2016 said that he had been told by his captors that they were involved in smuggling people to Libya. “I asked specifically about how it works,” said the journalist, Phil Cox, a freelance filmmaker for Channel 4. “And they said we make sure the routes are open, and we talk with whoever’s commanding the next area.”

    General Dhia said that the problem did not extend beyond a few bad apples. Sudan, he said, remains an effective partner for Europe in the battle against irregular migration.

    “We are not,” he said, “very far from your standards.”

      Lorsqu’il s’agit d’expulser des étrangers jugés indésirables, rien ne semble devoir arrêter l’Union européenne (UE) et ses États membres qui n’hésitent pas à se compromettre avec Omar el-Béchir, le chef d’État du Soudan qui fait l’objet de deux mandats d’arrêt internationaux pour génocide, crimes contre l’Humanité et crimes de guerre.

      Il y a longtemps que l’UE a fait le choix de sous-traiter à des pays tiers, sous couvert d’un partenariat inéquitable et avec des fonds issus du développement, la lutte contre l’immigration irrégulière et même la gestion de la demande d’asile. Ce processus d’externalisation, qui s’accompagne de la délocalisation de la surveillance des frontières européennes très en amont de leur matérialisation physique, a été encore renforcé à la suite de la si mal nommée « crise des réfugiés » [1].

      Ainsi, dans le cadre du Processus de Khartoum, initié par l’UE en 2014 et consolidé suite au Sommet de La Valette de fin 2015, les régimes les plus répressifs, tels que le Soudan et l’Erythrée – que des dizaines de milliers de demandeurs d’asile cherchent à fuir – bénéficient de subsides pour retenir leur population et « sécuriser » leurs frontières… sans que l’UE ne se préoccupe des atteintes dramatiques portées aux droits humains dans ces pays.

      Dans ce domaine, l’UE et les États membres agissent de concert. Ainsi, de nombreux pays européens n’hésitent pas à renvoyer vers Khartoum des ressortissants soudanais - peu importe qu’il puisse s’agir de demandeurs d’asile - et à collaborer avec les autorités locales pour faciliter ces expulsions.

      Dernièrement, c’est dans un parc bruxellois que des émissaires soudanais procédaient à l’identification de leurs nationaux en vue de leur retour forcé, semant la terreur parmi les personnes exilées qui y campaient [2].

      Si l’affaire a suscité de vives réactions, le gouvernement belge s’est retranché, pour se justifier, derrière l’exemple donné par ses voisins et continue de programmer des expulsions de ressortissants soudanais [3].
      En France, une coopération similaire existe ainsi depuis 2014 : des représentants de Khartoum auraient visité plusieurs centres de rétention pour identifier des ressortissants soudanais et faciliter leur renvoi [4]. Selon les chiffres dont disposent les associations qui interviennent dans les CRA français, 9 personnes auraient été renvoyées vers le Soudan depuis 2015 et environ 150 remises à l’Italie et exposées au risque d’un renvoi vers Khartoum depuis le territoire italien.

      Par ailleurs, des retours forcés vers le Soudan ont eu lieu depuis l’Allemagne, l’Italie et la Suède, grâce notamment à des accords de police bilatéraux, souvent publiés uniquement à la suite des pressions exercées par la société civile [5] . L’Italie, à l’avant-garde de la vision sécuritaire en matière de collaboration dans le domaine des migrations, a ainsi conclu en août 2016 un accord de coopération policière avec le Soudan, dans le cadre duquel 48 personnes, originaires du Darfour, ont été refoulées à Khartoum. Celles qui ont pu résister à leur renvoi depuis l’Italie ont demandé et obtenu une protection, tandis que cinq des personnes refoulées ont porté plainte auprès de la Cour européenne des droits de l’Homme [6].

      Ces accords et pratiques bafouent en effet toutes les obligations des pays européens en matière de respect des droits humains (droit d’asile, principe de non-refoulement, interdiction des expulsions collectives et des traitements inhumains et dégradants, droit à la vie, etc…) et révèlent le cynisme qui anime l’Union et les États-membres, prêts à tout pour refuser aux exilés l’accès au territoire européen.

      Il faut le dire et le répéter : toute forme de coopération avec les autorités soudanaises bafoue les obligations résultant du droit international et met en danger les personnes livrées par les autorités européennes au dictateur Omar el-Béchir.

      Le réseau Migreurop et ses membres demandent en conséquence l’arrêt immédiat des expulsions vers le Soudan et de toute démarche de coopération avec ce pays.

  • Italy: Court of Rome upholds appeal against transfer of Afghan national to Norway, where his application had been rejected

    On 5 June 2018, the Ordinary Court of Rome ruled in case no. 58068/2017, which concerned an appeal against the decision to transfer an Afghan asylum applicant to Norway, where his first asylum application was rejected and his removal order to Afghanistan is pending.

    First, the Court of Rome noted, as per the CJEU’s interpretation in C-578/16 C.K. and others, that Article 17 of the Dublin III Regulation is an integral part of the Dublin system, and that Article 4 of the Charter of Fundamental Rights of the European Union can be engaged even where there are no substantial grounds for believing that there are systemic flaws in the Member State responsible for examining the application for asylum.

    Second, the Court observed, based on available country of origin information with regard to Afghanistan, such as the annual report of the UN Assistance Mission in Afghanistan and a report from Human Rights Watch, that returning the applicant, who is a young male without a network of support in Afghanistan, would put him in risk of death and of violation of his fundamental rights. According to the Court, it would be contrary to Article 4 of the Charter of Fundamental Rights of the European Union to ignore the concrete risk of inhuman or degrading treatment solely based on the lack of systematic deficiencies in the Member State concerned (in casu, Norway).

    Thus, the Court concluded that sending the applicant to Norway in application of Article 23 of the Dublin III Regulation could result in risk of violation of his fundamental rights. It follows, therefore, that the national authorities must rely on the discretionary clause under Article 17 DRIII in this case.

    • Macron veut « identifier » les demandeurs d’asile au #Tchad et au Niger

      Lors d’un mini-sommet organisé à l’Élysée lundi 28 août, Paris, Berlin, Madrid et Rome ont proposé l’envoi de « missions de protection » au Niger et au Tchad dans le but d’identifier en amont les migrants éligibles à l’asile. Une initiative qui pose plus de questions qu’elle n’en résout.

      À l’issue d’un mini-sommet organisé à Paris le 28 août, les chefs d’État ou de gouvernement de sept pays européens et africains – la France, l’Allemagne, l’Espagne et l’Italie, d’un côté de la Méditerranée, le Tchad, le Niger et la Libye, de l’autre – se sont mis d’accord autour d’une « feuille de route » visant à « contrôler les flux migratoires » entre les deux continents.
      Réunis avec les présidents du Tchad, Idriss Déby, et du Niger, Mahamadou Issoufou, ainsi qu’avec le premier ministre libyen du gouvernement d’union nationale, Fayez al-Sarraj, le président français, Emmanuel Macron, la chancelière allemande, Angela Merkel, le premier ministre espagnol, Mariano Rajoy, et le président du Conseil italien, Paolo Gentiloni, ont ainsi proposé l’envoi de « missions de protection » au Niger et au Tchad, dans le but d’identifier en amont les migrants éligibles à l’asile (retrouver ici et là les déclarations conjointes).

      « Nous avons acté, je m’y étais engagé à Orléans au début de l’été, d’avoir un traitement humanitaire à la hauteur de nos exigences et de pouvoir, dans des zones identifiées, pleinement sûres, au Niger et au Tchad, sous la supervision du HCR [Haut Commissariat des Nations unies pour les réfugiés – ndlr], identifier les ressortissants qui ont le droit à l’asile, pouvoir les mettre en sécurité le plus rapidement », a expliqué le président français lors de la conférence de presse.

      Le 27 juillet, ce dernier avait créé la polémique en affirmant, en marge d’une visite dans un centre d’hébergement de réfugiés à Orléans, vouloir créer des « hot spots », ces centres chargés de trier les candidats à l’asile en France, « dès cet été », pour maîtriser l’arrivée des migrants venus de Libye et, avait-il ajouté, pour « éviter aux gens de prendre des risques fous alors qu’ils ne sont pas tous éligibles à l’asile ». Quelques heures plus tard, son entourage avait fait machine arrière en expliquant que, pour l’heure, seuls le Tchad et le Niger devraient être concernés. Après la visite, dans un discours à la préfecture du Loiret, le président avait d’ailleurs rectifié le tir en se contentant d’évoquer l’envoi de missions de l’Office français de protection des réfugiés et apatrides (Ofpra) « sur le sol africain ».

      La feuille de route du 28 août, qui substitue l’idée de « missions de protection » à celle de « hot spots », prévoit que l’identification des demandeurs d’asile se fera par le HCR, avec l’aval des autorités du pays de premier accueil et le soutien d’équipes européennes spécialistes de l’asile. Les personnes sélectionnées entreraient dans le programme dit de réinstallation du HCR « sur des listes fermées », c’est-à-dire listant les migrants d’ores et déjà identifiés par le HCR, et « selon des critères fixés en commun », non communiqués pour l’instant.

      Les migrants ne répondant pas à ces conditions devraient être reconduits « dans leur pays d’origine, dans la sécurité, l’ordre et la dignité, de préférence sur une base volontaire, en tenant compte de la législation nationale et dans le respect du droit international ».

      Sur le papier, l’idée pourrait paraître séduisante, puisqu’elle se donne comme objectif d’« ouvrir une voie légale pour les personnes ayant besoin d’une protection conformément au droit international et européen, en particulier pour les personnes les plus vulnérables selon les procédures du HCR relatives à la détermination de la qualité de réfugié, et qui sont susceptibles de migrer vers l’Europe ». Le but serait ainsi de leur éviter l’enfer libyen, où il est de notoriété publique que les migrants subissent les pires sévices, mais aussi les dangers de la traversée de la Méditerranée sur des canots pneumatiques. Depuis le début de l’année, près de 98 000 personnes sont arrivées par cette route maritime centrale, et près de 2 250 ont péri en mer, selon les chiffres de l’Organisation internationale pour les migrations.

      Mais derrière cette intention louable, se cache surtout le projet de réduire au maximum l’arrivée sur le Vieux Continent de personnes perçues par les dirigeants européens comme des « migrants économiques », pour lesquels aucun accueil n’est envisagé. L’objectif est ainsi de décourager les départs le plus en amont possible. Cette politique n’est pas nouvelle : voilà une vingtaine d’années que Bruxelles multiplie les accords avec les pays d’origine et de transit, par des campagnes d’affichage et des bureaux d’information, à coups de dizaines de millions d’euros, afin de convaincre les migrants de rester chez eux.

      Avec ces nouveaux guichets de pré-examen de la demande d’asile, il s’agit d’aller plus loin, car il est fort à parier que le nombre de personnes retenues par le HCR et in fine réinstallées en Europe sera extrêmement réduit. Dans les pays de l’UE, les demandeurs d’asile originaires d’Afrique subsaharienne obtiennent rarement le statut de réfugié. Les ONG sont donc particulièrement sceptiques à l’égard de ce genre d’initiatives, qu’elles considèrent comme une manière déguisée de sous-traiter la demande d’asile à des pays tiers, aussi éloignés que possible du continent européen. « On repousse la frontière européenne dans des pays de plus en plus lointains », a ainsi affirmé à l’AFP Eva Ottavy, de la Cimade, pour qui, « sous couvert de sauver des vies, on bloque l’accès au territoire ».

      Par ailleurs, le dispositif de réinstallation mis en place dans le monde par le HCR est décrié par ces mêmes associations de défense des droits des étrangers qui estiment que les critères mis en œuvre sont trop restrictifs et les procédures trop peu transparentes.

      Quand on sait que le système de relocalisation organisé par l’Union européenne pour répartir les réfugiés arrivés en Grèce ne fonctionne pas, alors même que ces exilés sont des ressortissants de pays susceptibles d’obtenir l’asile (Syrie, Afghanistan, Irak et Iran principalement), on peut s’interroger sur le nombre d’Africains subsahariens qui pourront effectivement bénéficier de cette « voie légale » pour arriver en Europe.

      Enfin, la décision de Paris, Berlin, Madrid et Rome d’« améliorer la coopération économique avec les communautés locales se trouvant sur les routes migratoires en Libye, afin de créer des sources de revenu alternatives, d’accroître leur résilience et de les rendre indépendantes de la traite des êtres humains » a de quoi laisser dubitatif. En effet, Reuters a récemment révélé l’existence sur les côtes libyennes, à Sabratah, principale ville de départ des migrants, d’une milice armée qui empêcherait violemment les embarcations de partir et détiendrait les candidats au passage dans des conditions dégradantes (lire notre article). Or, d’après de nombreux témoignages, il semble que ce groupe mafieux soit, en partie au moins, financé par le gouvernement d’union nationale de Tripoli, lui-même soutenu par les fonds européens.

      Les tendances et mesures amorcées dans les récentes prises de position politiques ne servent qu’à confirmer la direction prise depuis la fin des années quatre-vingt-dix et indiquent clairement une réalité politique qui accentue certains aspects : la présence policière, la surveillance des frontières et l’endiguement, au détriment des autres. D’abord, les orientations prises conjointement pour limiter l’accès aux demandeurs d’asile, aux réfugiés et aux familles des travailleurs, à travers une série de directives et de règlements (c’est-à-dire des populations ayant droit à l’accès) et le développement croissant d’une politique d’immigration sélective des travailleurs, ont contribué à créer une étape de plus dans l’externalisation. Cette étape a été franchie en 2003 et 2004 avec deux propositions, l’une émanant des Britanniques sur les “#Transit_Processing_Centres” (#TPCs) et l’autre des Italiens et des Allemands, pour mettre en place des bureaux d’immigration en Afrique du Nord.

    • Au Niger, la frontière invisible de l’Europe

      L’enquête des « Jours » sur la trace des migrants morts en mer passe par le Niger, nouveau pays de transit pour les candidats à l’exil.

      Depuis l’été 2016 et la mise en œuvre de la loi via le « #plan_Bazoum », du nom du ministre de l’Intérieur Mohamed Bazoum, toute personne transportant des étrangers dans le désert, au nord de l’axe Arlit-Dirkou (consulter notre carte des Disparus), est considéré comme étant en infraction avec la loi. D’ailleurs, à proximité de la gare de Rimbo, une pancarte affichant les logos de l’Union européenne et de l’Agence nationale de lutte contre la traite des personnes (ANLTP) du Niger le rappelle : « Transporter illégalement des migrants vous expose à une peine d’amende de 1 000 000 à 3 000 000 CFA [1 525 à 4 575 euros, ndlr]. »

      « Dans cette histoire de migration, rien n’est ni noir, ni blanc. C’est un sujet tellement complexe qu’on ne peut pas le résumer en quelques vérités », dit Kirsi Henriksson, au volant de son 4x4, dans les rues de Niamey. Kirsi Henriksson dirige Eucap Sahel au Niger, une opération civile de l’Union européenne créée en 2012, après la chute de Kadhafi, pour lutter contre le terrorisme et la criminalité organisée dans la région. Quand Henriksson a pris son poste en août 2016, le mandat de l’opération venait d’être élargi à la lutte contre l’immigration irrégulière. Le moment était parfait pour l’Union européenne : le plan Bazoum venait d’être mis en application. Désormais, des policiers et des gendarmes européens conseillent et forment leurs homologues nigériens à des techniques de contrôle et renseignement visant à intercepter les trafics de drogues et d’armes, mais aussi ceux d’êtres humains. « Nous n’avons pas de mandat exécutif, nous n’arrêtons personne. Mais nous formons les autorités nigériennes à arrêter les gens. Pour beaucoup, nous sommes les méchants de cette histoire. »

      Avant le Niger, Kirsi Henriksson a travaillé pour des missions similaires de l’Union européenne au Mali, en Libye et en Irak. Universitaire de formation, elle s’est spécialisée dans les études sur la paix et les conflits avant de partir « construire la paix dans la vraie vie ». « Je dois avouer que les résultats n’ont pas toujours été à la hauteur de l’ambition », elle sourit. En 2014, elle a été évacuée de la Libye avec le reste de la mission européenne. Les organisations internationales sont parties elles aussi. Aujourd’hui, elles sont toutes au Niger, de même que les armées étrangères. « Une industrie de la paix », comme le qualifie la cheffe de mission.
      « Le Niger est the new place to be. Tout le monde est ici : l’armée française avec l’#opération_Barkhane, l’armée allemande qui ravitaille ses troupes au Mali depuis le Niger, l’armée américaine qui construit une base de #drones à Agadez. » À la fin de l’année 2017, l’#Italie a annoncé à son tour l’envoi de troupes – une information que les autorités nigériennes ont démentie par la suite. « Tout le monde vient parce que dans la région du Sahel, le Niger assure une certaine stabilité. Et préserver cette stabilité est dans l’intérêt de toute l’Europe. »

      Mais la migration est-elle une menace pour la stabilité du Sahel ? Paradoxalement, avec l’augmentation des contrôles et la criminalisation du trafic, elle est peut-être en train de le devenir. Le #trafic_d’êtres_humains est passé des mains des transporteurs ordinaires à celles de #réseaux_criminels transfrontaliers qui gèrent aussi d’autres trafics : la #drogue – surtout du #Tramadol, un antalgique dérivé de l’#opium –, qui arrive depuis le Nigeria vers la Libye, et les #armes, qui descendent de la Libye vers le sud.

      Seulement, pour le moment, l’aide européenne promise arrive lentement et souvent sans consultation des populations concernées. Le #Fonds_fiduciaire officiellement destiné à l’aide au #développement vise en réalité à produire du contrôle, reconnaît Kirsi Henriksson. C’est également le but de l’#opération_Eucap_Sahel. La cheffe de mission trace avec son index les nouvelles routes que le contrôle renforcé a dessinées dans le désert : directement depuis #Diffa, situé à la frontière nigériane, vers #Séguédine dans le nord, en traversant le #Ténéré, de #Gao au Mali vers #Assamaka à la frontière algérienne, qu’on longera ensuite pour arriver en Libye. Ces nouvelles routes sont plus dangereuses.

    • At French Outpost in African Migrant Hub, Asylum for a Select Few

      In a bare suite of prefab offices, inside a compound off a dirt road, French bureaucrats are pushing France’s borders thousands of miles into Africa, hoping to head off would-be migrants.

      All day long, in a grassy courtyard, they interview asylum seekers, as the African reality they want to escape swirls outside — donkey carts and dust, joblessness and poverty, and, in special cases, political persecution.

      If the French answer is yes to asylum, they are given plane tickets to France and spared the risky journey through the desert and on the deadly boats across the Mediterranean that have brought millions of desperate migrants to Europe in recent years, transforming its politics and societies.

      “We’re here to stop people from dying in the Mediterranean,” said Sylvie Bergier-Diallo, the deputy chief of the French mission in Niger.

      But very few are actually approved, and so the French delegation is also there to send a message to other would-be migrants: Stay home, and do not risk a perilous journey for an asylum claim that would ultimately be denied in France.

      The French outpost is part of a new forward defense in Europe’s struggle to hold off migration from Africa; it is a small, relatively benign piece of a larger strategy that otherwise threatens to subvert Europe’s humanitarian ideals.

      After years of being buffeted by uncontrolled migration, Europe is striking out. Italy is suspected of quietly cutting deals with Libyan warlords who control the migration route. The European Union has sent delegations to African capitals, waving aid and incentives for leaders to keep their people at home. Now come the French.
      “There’s a much more active approach to see that the immigrant stays as far away as possible from Europe, and this is completely to the detriment of those concerned,” said Philippe Dam of Human Rights Watch.

      The French mission was “positive,” he said, “but it’s too late and too small.”

      It is also the flip side of a fast-toughening stance by France against migrants, as President Emmanuel Macron began his push this month for what critics say is a draconian new law aimed at sending many of those who have already arrived back home.

      Even if some of Europe’s new methods are questionable, the results have been evident: Last year, for the first time since the crisis began several years ago, the migration flow was reversed, according to Giuseppe Loprete, head of the United Nations migration agency office in Niger.

      About 100,000 would-be migrants returned through Niger from Libya, compared with 60,000 who traversed the vast and impoverished desert country heading toward Europe.

      As the hub for West African migration, Niger had long been under pressure from Europe to crack down on the migrant flow. And something has shifted.

      The bus stations in Niamey, once packed with West Africans trying to get to Agadez, the last city before Libya, are now empty. The police sternly check identity documents.

      When I visited Agadez three years ago, migrants packed what locals called “ghettos” at the edge of town, hanging out for weeks in the courtyards of unfinished villas waiting for a chance to cross the desert.
      Migration officials say there are many fewer now. The Nigerien government has impounded dozens of the pickups formerly used by smugglers at Agadez, they say.

      “Lot less, lot less than before,” said a bus agent, who declined to give his name, at the open-air Sonef station in Niamey, drowsing and empty in the late-afternoon heat. “It’s not like it was. Before it was full.”

      The tile floor was once crowded with migrants. No more. A sign outside bears the European Union flag and warns passengers not to travel without papers.

      In itself, the so-called French filtration effort here is so small that it is not responsible for the drop, nor is it expected to have much effect on the overall migration flow.

      It began well after the drop was underway. Only a handful of such missions to interview asylum seekers have embarked since Mr. Macron announced the policy last summer, staying for about a week at a time.

      Meager as it is, however, the French effort has already helped shift the process of sifting some asylum claims to Africa and out of Europe, where many of those who are denied asylum tend to stay illegally.

      For Mr. Macron, a chief aim is to defuse the political pressures at home from the far right that have escalated with the migrant crisis.
      The French hope that the greater visibility of a formal, front-end system will discourage those without credible claims of asylum from risking their lives with smugglers.

      The process is also intended to send a potentially important message: that those with legitimate claims of persecution do have a chance for safe passage.

      “Politically it’s huge,” said Mr. Loprete. “But in terms of numbers it is very low.”

      In a recent week, 85 people were interviewed by the four officials from the French refugee agency, known as Ofpra.

      The selective scale is in line with Mr. Macron’s determination to keep out economic migrants. “We can’t welcome everybody,” he said in his New Year’s speech.

      On the other hand, “we must welcome the men and women fleeing their country because they are under threat,” Mr. Macron said. They have a “right to asylum,” he said.

      Critics of the plan say that it amounts to only a token effort, and that the real goal is to keep potential migrants at arms’ length.

      “Macron’s policy is to divide migrants and refugees, but how can we do so? What is the ethical principle behind this choice?” said Mauro Armanino, an Italian priest at the cathedral in Niamey who has long worked with migrants in African nations. “It is a policy without heart.”

      Still, the French have been the first to undertake this kind of outreach, working closely with the United Nations, out of its refugee agency’s compound in Niamey.

      The United Nations International Office for Migration does a first vetting for the French in Libya, Niger’s northern neighbor, where human smuggling networks have thrived in the chaotic collapse of the country.

      In Libya, the smugglers herd the Africans together, beat them, sometimes rape them and extort money. Some are even sold into slavery before being loaded onto rickety boats for the Mediterranean crossing.

      Some of the Libyan camps are run by smugglers and their associated militias, and others by the government, such as it is. But regardless of who runs them, they are essentially concentration camps, officials say, and there is no distinction made between political refugees and migrants.

      United Nations officials are allowed to enter the government-run camps to look for potential asylum cases — principally Eritreans and Somalis, whose flight from political persecution and chaos might qualify them. From lists supplied by the United Nations, the French choose whom they will interview.

      “The idea is to protect people who might have a right to asylum,” said Pascal Brice, the head of Ofpra, the French refugee agency. “And to bypass the horrors of Libya and the Mediterranean.”

      “It is limited,” Mr. Brice acknowledged. “But the president has said he wants to cut back on the sea crossings,” he added, referring to Mr. Macron.
      Bénédicte Jeannerod, who heads the French office of Human Rights Watch, was less a critic of the program itself than of its scale. “I’ve told Pascal Brice that as long as it works, make it bigger,” he said.

      But the potential difficulties of making the program larger were evident in a day of interviews at the sweltering United Nations center in Niamey.

      One recent Saturday night, 136 Eritreans and Somalis were flown to Niamey by the United Nations, all potential candidates for asylum interviews with the French.

      The dozens of asylum seekers already there waited pensively, looking resigned as they sat on benches, betraying no sign of the import of what the French deputy chief of the mission had to offer.

      “If you are chosen, you will soon be in France,” Ms. Bergier-Diallo told them, pronouncing the words slowly and deliberately. “And we are delighted.”

      Indeed, if the refugees pass muster, the rewards are enormous: a free plane ticket to France, free housing, hassle-free residence papers and free French lessons.

      The French agents, stiff and formal in their questioning that could last well over an hour, inquired relentlessly about the refugees’ family ties, uninterested in establishing the narrative of their escape and suffering.
      The idea was to “establish the family context,” in an effort to confirm the authenticity of the refugees’ origins, said one French official, Lucie.

      (Sensitive to security, the French authorities asked that the last names of their agents and those of the refugees not be published.)

      Shewit, a diminutive, bespectacled 26-year-old Eritrean woman, was asked whether she ever phoned her family, and if so what they talked about.

      “Only about my health,” Shewit said. “I never tell them where I am.”

      Mariam, 27, told the French agent she had been raped and ostracized in her village and feared going back because “the people who raped me are still there.”

      “They could rape me again,” said Mariam, an illiterate animal herder from Somaliland.

      Even if she finds safety in France, integrating her into society will be a challenge. Mariam had never attended any school and looked bewildered when the French agent told her to remove her head scarf.

      Wearing the scarf “is not possible in the French administration, or in schools,” Emoline, the agent, said gently to Mariam in English, through an interpreter.

      Then there was Welella, an 18-year-old Eritrean girl who, before being rescued from neighboring Libya, had spent time in a refugee camp in Sudan, where she endured what she simply called “punishments.”
      Her father is a soldier, her siblings had all been drafted into Eritrea’s compulsory military service, and she risked the same.

      “Why is military service compulsory in Eritrea?” Lucie asked the girl, seated opposite her. “I don’t know,” Welella answered mechanically.

      She had long planned on fleeing. “One day I succeeded,” she said simply.

      “What could happen to you in Eritrea if you returned?” Lucie asked.

      “I suffered a lot leaving Eritrea,” Welella said slowly. “If I return, they will put me underground.”

      She was questioned over and over about the names of her siblings in Eritrea, and why one had traveled to a particular town.

      After nearly two hours of questioning, a hint of the French agent’s verdict finally came — in English. It was rote, but the message clear: France was one step away from welcoming Welella.

      “You will have the right to enter France legally,” Lucie told her. “You will be granted a residence permit, you will be given your own accommodations, you will have the right to work …”

      Welella smiled, barely.

    L’Accordo, nonostante la fine dei combattimenti nel 2000, non è mai stato applicato e i rapporti tra i due Paesi sono rimasti tesi. Etiopia ed Eritrea non hanno relazioni diplomatiche e negli ultimi anni ci sono stati ripetute schermaglie militari al confine.

    • Peace Deal Alone Will Not Stem Flow of Eritrean Refugees

      The detente with Ethiopia has seen Eritrea slash indefinite military conscription. Researcher Cristiano D’Orsi argues that without a breakthrough on human rights, Eritreans will still flee.

      Ethiopia and Eritrea have signed a historic agreement to end the 20-year conflict between the two countries. The breakthrough has been widely welcomed given the devastating effects the conflict has had on both countries as well as the region.

      The tension between the two countries led to Eritrea taking steps that were to have a ripple effect across the region – and the world. One in particular, the conscription of young men, has had a particularly wide impact.

      Two years before formal cross-border conflict broke out in 1998, the Eritrean government took steps to maintain a large standing army to push back against Ethiopia’s occupation of Eritrean territories. Initially, troops were supposed to assemble and train for a period of 18 months as part of their national service. But, with the breakout of war, the service, which included both military personnel and civilians, was extended. All Eritrean men between the ages of 18–50 have to serve in the army for more than 20 years.

      This policy has been given as the reason for large numbers of Eritreans fleeing the country. The impact of the policy on individuals, and families, has been severe. For example, there have been cases of multiple family members being conscripted at the same time. This denied them the right to enjoy a stable family life. Children were the most heavily affected.

      It’s virtually impossible for Eritreans to return once they have left as refugees because the Eritrean government doesn’t look kindly on repatriated returnees. Those who are forced to return to the country face persecution and human rights abuses.

      In 2017, Eritreans represented the ninth-largest refugee population in the world with 486,200 people forcibly displaced. By May 2018, Eritreans represented 5 percent of the migrants who disembarked on the northern shores of the Mediterranean.

      Things look set to change, however. The latest batch of national service recruits have been told their enlistment will last no longer than 18 months. The announcement came in the midst of the dramatic thawing of relations between Ethiopia and Eritrea. It has raised hopes that the service could be terminated altogether.

      With that said, it remains to be seen whether the end of hostilities between the two countries will ultimately stem the flow of Eritrean refugees.

      It’s virtually impossible for Eritreans to return once they have left as refugees because the Eritrean government doesn’t look kindly on repatriated returnees. Those who are forced to return to the country face persecution and human rights abuses.

      The Eritrean government’s hardline position has led to changes in refugee policies in countries like the UK. For example, in October 2016, a U.K. appellate tribunal held that Eritreans of draft age who left the country illegally would face the risk of persecution and abuse if they were involuntarily returned to Eritrea.

      This, the tribunal said, was in direct violation of the European Convention on Human Rights. As a result, the U.K.’s Home Office amended its immigration policy to conform to the tribunal’s ruling.

      Eritrean asylum seekers haven’t been welcome everywhere. For a long time they were persona non grata in Israel on the grounds that absconding national service duty was not justification for asylum. But in September 2016, an Israeli appeals court held that Eritreans must be given the chance to explain their reasons for fleeing at individual hearings, overruling an interior ministry policy that denied asylum to deserters.

      The situation is particularly tense for Eritreans in Israel because they represent the majority of African asylum seekers in the country. In fact, in May 2018, Israel and the United Nations refugee agency began negotiating a deal to repatriate African asylum seekers in western countries, with Canada as a primary destination.

      An earlier deal had fallen through after public pressure reportedly caused Prime Minister Benjamin Netanyahu to back out of it.

      Eritreans living as refugees in Ethiopia have been welcomed in Australia where they are one among eight nationalities that have access to a resettlement scheme known as the community support program. This empowers Australian individuals, community organizations and businesses to offer Eritrean refugees jobs if they have the skills, allowing them to settle permanently in the country.

      The government has always denied that conscription has anything to do with Eritreans fleeing the country. Two years ago it made it clear that it would not shorten the length of the mandatory national service.

      At the time officials said Eritreans were leaving the country because they were being enticed by certain “pull factors.” They argued, for example, that the need for low cost manpower in the West could easily be met by giving asylum to Eritreans who needed just to complain about the National Service to obtain asylum.

      But change is on the cards. After signing the peace deal with Ethiopia, Eritrea has promised to end the current conscription regime and announcing that national service duty will last no more than 18 months.

      Even so, the national service is likely to remain in place for the foreseeable future to fulfil other parts of its mandate which are reconstructing the country, strengthening the economy, and developing a joint Eritrean identity across ethnic and religious lines.

      Eritrea is still a country facing enormous human rights violations. According to the last Freedom House report, the Eritrean government has made no recent effort to address these. The report accuses the regime of continuing to perpetrate crimes against humanity.

      If Eritrea pays more attention to upholding human rights, fewer nationals will feel the need to flee. And if change comes within Eritrean borders as fast as it did with Ethiopia, a radical shift in human rights policy could be in the works.

    • Out of Eritrea: What happens after #Badme?

      On 6 June 2018, the government of Ethiopia announced that it would abide by the Algiers Agreement and 2002 Eritrea-Ethiopian Boundary Commission decision that defined the disputed border and granted the border town of Badme to Eritrea. Over the last 20 years, Badme has been central to the dispute between the two countries, following Ethiopia’s rejection of the ruling and continued occupation of the area. Ethiopia’s recently appointed Prime Minister Abiy Ahmed acknowledged that the dispute over Badme had resulted in 20 years of tension between the two countries. To defend the border areas with Ethiopia, in 1994 the Eritrean government introduced mandatory military service for all adults over 18. Eritrean migrants and asylum seekers often give their reason for flight as the need to escape this mandatory national service.

      Since 2015, Eritreans have been the third largest group of people entering Europe through the Mediterranean, and have the second highestnumber of arrivals through the Central Mediterranean route to Italy. According to UNHCR, by the end of 2016, 459,390 Eritreans were registered refugees in various countries worldwide. Various sources estimate Eritrea’s population at 5 million people, meaning that approximately 10% of Eritrea’s population has sought refuge abroad by 2016.
      Mandatory military service – a driver of migration and displacement

      As data collection from the Mixed Migration Centre’s Mixed Migration Monitoring Mechanism Initiative (4Mi) shows, 95% of Eritrean refugees and migrants surveyed gave fear of conscription into national service as their main reason for flight out of Eritrea. Men and women from 18 to 40 years old are required by law to undertake national service for 18 months — including six months of military training followed by 12 months’ deployment either in military service or in other government entities including farms, construction sites, mines and ministries.
      In reality, national service for most conscripts extends beyond the 18 months and often indefinite. There are also reported cases of children under 18 years old being forcefully recruited. Even upon completion of national service, Eritreans under the age of 50 years may been enrolled in the Reserve Army with the duty to provide reserve military service and defend the country from external attacks or invasions.

      According to Human Rights Watch, conscripts are subject to military discipline and are harshly treated and earn a salary that often ranges between USD 43 – 48 per month. The length of service is unpredictable, the type of abuse inflicted on conscripts is at the whim of military commanders and the UN Commission of inquiry on human rights in Eritrea reported on the frequent sexual abuse of female conscripts. Eritrea has no provision for conscientious objection to national service and draft evaders and deserters if arrested are subjected to heavy punishment according to Amnesty International, including lengthy periods of detention, torture and other forms of inhuman treatment including rape for women. For those who escape, relatives are forced to pay fines of 50,000 Nakfa (USD 3,350) for each family member. Failure to pay the fine may result in the arrest and detention of a family member until the money is paid which further fuels flight from Eritrea for families who are unable to pay the fine.

      The government of Eritrea asserts that compulsory and indefinite national service is necessitated by continued occupation of its sovereign territories citing Ethiopia as the main threat. In its response to the UN Human Rights Council Report that criticised Eritrea for human rights violations including indefinite conscription, Eritrea stated that one of its main constraints to the fulfilment of its international and national obligations in promoting and protecting human rights and fundamental freedoms is the continued occupation of its territory by Ethiopia.

      In 2016, Eritrea’s minister for Information confirmed that indefinite national service would remain without fundamental changes even in the wake of increased flight from the country by citizens unwilling to undertake the service. The Minister went on to state that Eritrea would contemplate demobilization upon the removal of the ‘main threat’, in this case Eritrea’s hostile relationship with Ethiopia. Eritrea and Ethiopia have both traded accusations of supporting opposition/militia groups to undermine each other both locally and abroad. If the relations between the countries turn peaceful, this could potentially have an impact on Eritrean migration, out of the country and out of the region.

      In the absence of hostilities and perceived security threats from its neighbour, it is possible that Eritrea will amend – or at least be open to start a dialogue about amending – its national service (and military) policies from the current mandatory and indefinite status, which has been one of the major root causes of the movement of Eritreans out of their country and onwards towards Europe. Related questions are whether an improvement in the relations with Ethiopia could also bring an immediate or longer term improvement in the socio-economic problems that Eritrea faces, for example through expanded trade relations between the two countries? Will this change usher in an era of political stability and an easing of military burdens on the Eritrean population?
      A possible game changer?

      The border deal, if it materialises, could at some time also have serious implications for Eritrean asylum seekers in Europe. Eritreans applying for asylum have relatively high approval rates. The high recognition rate for Eritrean asylum seekers is based on the widely accepted presumptionthat Eritreans who evade or avoid national service are at risk of persecution. In 2016 for example, 93% of Eritreans who sought asylum in EU countries received a positive decision. This recognition rate was second to Syrians and ahead of Iraqis and Somalis; all countries that are in active conflict unlike Eritrea. If the government of Eritrea enacts positive policy changes regarding conscription, the likely effect could be a much lower recognition rate for Eritrean asylum seekers. It is unclear how this would affect those asylum seekers already in the system.

      While Eritreans on the route to Europe and in particular those arriving in Italy, remain highly visible and receive most attention, many Eritreans who leave the country end up in refugee camps or Eritrean enclaves in neighbouring countries like Sudan and Ethiopia or further away in Egypt. After they flee, most Eritreans initially apply for refugee status in Ethiopia’s and Sudan’s refugee camps. As Human Rights Watch noted in 2016, the Eritrean camp population generally remains more or less stable. While many seek onward movements out of the camps, many refugees remain in the region. With these potentially new developments in Eritrea, will the Eritreans in Sudan, Ethiopia and other neighbouring countries feel encouraged or compelled to return at some, or will they perhaps be forced to return to Eritrea?
      What’s next?

      Conservative estimates in 2001 put the cost of the war between Eritrea and Ethiopia at USD 2.9 billion in just the first three years. This has had an adverse effect on the economies of the two countries as well as human rights conditions. In 2013, Eritrea expressed its willingness to engage in dialogue with Ethiopia should it withdraw its army from the disputed territory which it further noted is occupied by 300,000 soldiers from both countries. Ethiopia has previously stated its willingness to surrender Badme, without in the end acting upon this promise. Should this latest promise be implemented and ties between two countries normalized, this might herald positive developments for both the economy and the human rights situation in both countries, with a potential significant impact on one of the major drivers of movement out of Eritrea.

      However, with the news that Ethiopia would move to define its borders in accordance with international arbitration, the possibilities for political stability and economic growth in Eritrea remain uncertain. On 21 June 2018, the President of Eritrea Isaias Aferwerki issued a statement saying that Eritrea would send a delegation to Addis Ababa to ‘gauge current developments… chart out a plan for continuous future action’. The possibility of resulting peace and economic partnership between the two countries could, although a long-term process, also result in economic growth on both sides of the border and increased livelihood opportunities for their citizens who routinely engage in unsafe and irregular migration for political, humanitarian and economic reasons.

    • Despite the peace deal with Ethiopia, Eritrean refugees are still afraid to return home

      When Samuel Berhe thinks of Eritrea, he sees the sand-colored buildings and turquoise water of Asmara’s shoreline. He sees his sister’s bar under the family home in the capital’s center that sells sweet toast and beer. He sees his father who, at 80 years old, is losing his eyesight but is still a force to be reckoned with. He thinks of his home, a place that he cannot reach.

      Berhe, like many other Eritreans, fled the country some years ago to escape mandatory national service, which the government made indefinite following the 1998-2000 border war with Ethiopia. The war cost the countries an estimated 100,000 lives, while conscription created a generation of Eritrean refugees. The UNHCR said that in 2016 there were 459,000 Eritrean exiles out of an estimated population of 5.3 million.

      So, when the leaders of Ethiopia and Eritrea signed a sudden peace deal in July 2018, citizens of the Horn of Africa nations rejoiced. Many took to the streets bearing the two flags. Others chose social media to express their happiness, and some even dialed up strangers, as phone lines between the nations were once again reinstated. It felt like a new era of harmony and prosperity had begun.

      But for Berhe, the moment was bittersweet.

      “I was happy because it is good for our people but I was also sad, because it doesn’t make any change for me,” he said from his home in Ethiopia’s capital, Addis Ababa. “I will stay as a refugee.”

      Like many other Eritrean emigrants, Berhe fled the country illegally to escape national service. He fears that if he returns, he will wind up in jail, or worse. He does not have a passport and has not left Ethiopia since he arrived on the back of a cargo truck 13 years ago. His two daughters, Sarah, 9, and Ella, 11, for whom he is an only parent, have never seen their grandparents or their father’s homeland.

      Now that there is a direct flight, Berhe is planning on sending the girls to see their relatives. But before he considers returning, he will need some sort of guarantee from Eritrea’s President Isaias Afwerki, who leads the ruling People’s Front for Democracy and Justice, that he will pardon those who left.

      “The people that illegally escaped, the government thinks that we are traitors,” he said. “There are many, many like me, all over the world, too afraid to go back.”

      Still, hundreds fought to board the first flights between the two capitals throughout July and August. Asmara’s and Addis Ababa’s airports became symbols of the reunification as hordes of people awaited their relatives with bouquets daily, some whom they hadn’t seen for more than two decades.

      “When I see the people at the airport, smiling, laughing, reuniting with their family, I wish to be like them. To be free. They are lucky,” Berhe said.

      Zala Mekonnen, 38, an Eritrean Canadian, who was one of the many waiting at arrivals in Addis Ababa, said she had completely given up on the idea that the two nations — formerly one country — would ever rekindle relations.

      Mekonnen, who is half Ethiopian, found the 20-year feud especially difficult as her family was separated in half. In July, her mother saw her uncle for the first time in 25 years.

      “We’re happy but hopefully he’s [Afwerki] going to let those young kids free [from conscription],” she said. “I’m hoping God will hear, because so many of them died while trying to escape. One full generation lost.”

      Mekonnen called the peace deal with Ethiopia a crucial step towards Eritrean democracy. But Afwerki, the 72-year-old ex-rebel leader, will also have to allow multiple political parties to exist, along with freedom of religion, freedom of speech and reopening Asmara’s public university while also giving young people opportunities outside of national service.

      “The greeting that Afwerki received here in Ethiopia [following the agreement to restore relations], he didn’t deserve it,” said Mekonnen. “He should have been hung.”

      Since the rapprochement, Ethiopia’s leader, Abiy Ahmed, has reached out to exiled opposition groups, including those in Eritrea, to open up a political dialogue. The Eritrean president has not made similar efforts. But in August, his office announced that he would visit Ethiopia for a second time to discuss the issue of rebels.

      Laura Hammond, a professor of developmental studies at the School of Oriental and African Studies in London, said that it is likely Afwerki will push for Ethiopia to send Eritrean refugees seeking asylum back to Eritrea.

      “The difficulty is that, while the two countries are normalizing relations, the political situation inside Eritrea is not changing as rapidly,” Hammond said. “There are significant fears about what will happen to those who have left the country illegally, including in some cases escaping from prison or from their national service bases. They will need to be offered amnesty if they are to feel confident about returning.”

      To voice their frustrations, thousands of exiled Eritreans gathered in protest outside the UN headquarters in Geneva on Aug. 31. Amid chants of “enough is enough” and “down, down Isaias,” attendees held up placards calling for peace and democracy. The opposition website, Harnnet, wrote that while the rapprochement with Ethiopia was welcomed, regional and global politicians were showing “undeserved sympathy” to a power that continued to violate human rights.

      Sitting in front of the TV, Berhe’s two daughters sip black tea and watch a religious parade broadcast on Eritrea’s national channel. Berhe, who has temporary refugee status in Ethiopia, admits that one thing that the peace deal has changed is that the state’s broadcaster no longer airs perpetual scenes of war. For now, he is safe in Addis Ababa with his daughters, but he is eager to obtain a sponsor in the US, Europe or Australia, so that he can resettle and provide them with a secure future. He is afraid that landlocked Ethiopia might cave to pressures from the Eritrean government to return its refugees in exchange for access to the Red Sea port.

      “Meanwhile my girls say to me, ’Why don’t we go for summer holiday in Asmara?’” he laughs. “They don’t understand my problem.”

    • UN: No Rights Progress in Eritrea After Peace Deal With Ethiopia

      U.N. experts say Eritrea’s human rights record has not changed for the better since the government signed a peace agreement with Ethiopia last year, formally ending a two decades-long border conflict. The U.N. Human Rights Council held an interactive dialogue on the current situation in Eritrea this week.

      After a 20-year military stalemate with Ethiopia, hopes were high that the peace accord would change Eritrea’s human rights landscape for the better.

      U.N. Deputy High Commissioner for Human Rights Kate Gilmore said that has not happened. She said Eritrea has missed a historic opportunity because the government has not implemented urgently needed judicial, constitutional and economic reforms.

      She said the continued use of indefinite national service remains a major human rights concern.

      “Conscripts continue to confront open-ended duration of service, far beyond the 18 months stipulated in law and often under abusive conditions, which may include the use of torture, sexual violence and forced labor,” she said.

      Gilmore urged Eritrea to bring its national service in line with the country’s international human rights obligations.

      “The peace agreement signed with Ethiopia should provide the security that the government of Eritrea has argued it needs to discontinue this national service and help shift its focus from security to development…. In the absence of promising signs of tangible human rights progress, that flow of asylum-seekers is not expected to drop,” Gilmore said.

      Human rights groups say unlimited national service forces thousands of young men to flee Eritrea every month to seek asylum in Europe. They say many lose their lives making the perilous journey across the Sahara Desert or while crossing the Mediterranean Sea to Europe.

      The head of the Eritrean delegation to the Council, Tesfamicael Gerahtu, said his country has had to adopt certain measures to counter the negative effect of the last 20 years on peace, security and development. He insists there is no human rights crisis in his country.

      He accused the Human Rights Council of exerting undue pressure on Eritrea by monitoring his country’s human rights situation and adopting detrimental resolutions. He called the actions counterproductive.

      “The honorable and productive way forward is to terminate the confrontational approach on Eritrea that has been perpetrated in the last seven years and that has not created any dividend in the promotion of human rights. And, there is no crisis that warrants a Human Rights Council agenda or special mandate on Eritrea,” Gerahtu said.

      Daniel Eyasu , head of Cooperation and International Relations of the National Youth Union and Eritrean Students, agrees there is no human rights crisis in Eritrea. He offered a positive spin on the country’s controversial national service, calling it critical for nation building.

      Unfortunately, he said, the reports of the council’s special procedures characterizing national service as modern slavery is unwarranted, unjustified and unacceptable.

      The Founder of One Day Seyoum, Vanessa Tsehaye, said the government has not changed its stripes. She said it is as repressive today as it was before the peace accord with Ethiopia was signed.

      Tsehaye’s organization works for the release of her uncle, a journalist who has been imprisoned without a trial in Eritrea since 2001 and for all people unjustly imprisoned. She said they continue to languish in prison.

      “The standoff at the border cannot justify the fact that all capable Eritreans are enlisted into the national service indefinitely. It cannot justify the fact that the country’s constitution still has not been implemented and that the parliament still has not convened since 2002. It does not justify the fact that the only university in the country has been shut down, that the free press has still not been opened and that tens of thousands of people have been imprisoned without a trial simply for expressing their opinions, practicing their religion or attempting to leave their country,” Tsehaye said.

      But delegates at the council welcomed the peace process and expressed hope it will result in better protection for the Eritrean people. But they noted the prevailing abusive conditions are not promising.

      They urged the government to reform its military service, release all political prisoners, stop the practice of arbitrary arrests, and end torture and inhumane detention conditions.

    (New York) – Israeli forces’ repeated use of lethal force in the Gaza Strip since March 30, 2018, against Palestinian demonstrators who posed no imminent threat to life may amount to war crimes, Human Rights Watch said today. Israeli forces have killed more than 100 protesters in Gaza and wounded thousands with live ammunition.

    The United Nations General Assembly should support a resolution that calls for exploring measures to guarantee the protection of Palestinians in Gaza, and a UN inquiry mandated to investigate all violations and abuses should identify Israeli officials responsible for issuing unlawful open-fire orders. The killings also highlight the need for the International Criminal Court to open a formal investigation into the situation in Palestine. Third countries should impose targeted sanctions against officials responsible for ongoing serious human rights violations.

    “Israel’s use of lethal force when there was no imminent threat to life has taken a heavy toll in life and limb,” said Sarah Leah Whitson, Middle East director at Human Rights Watch. “The international community needs to rip up the old playbook, where Israel conducts investigations that mainly whitewash the conduct of its troops and the US blocks international accountability with its Security Council veto, and instead impose real costs for such blatant disregard for Palestinian lives.” (...)

  • Turkish court bans 9 books on terror charges

    A Turkish government has banned the sale and distribution of nine books, printed by pro-Kurdish Avesta Publications, media reported Sunday.

    The ban was imposed after the copies of the nine books were found at a place where two people were earlier detained as part of an investigation into the outlawed Kurdistan Workers’ Party (PKK) in Sirnak’s Idil district.

    “The said books are the ones which were published as doctoral dissertations at the world’s leading universities between 2003 and 2015. …Among the banned books are the the ones about Yazidis’ holy writings and Battle of Chaldiran. How on earth they are affiliated with terrorism? The other banned book is on the genocide in Iraq. This book consists of official reports of Human Rights Watch… and it is accredited with parliaments of several countries,” publisher’s editor-in-chief Abdullah Keskin told Duvar news portal.

    Saudi Arabia is detaining thousands of people for more than six months, in some cases for over a decade, without referring them to courts for criminal proceedings. Saudi Arabia’s attorney general should promptly charge or release all criminal defendants and stop holding people arbitrarily.

    Human Rights Watch analyzed data from a public online Interior Ministry database, which revealed that authorities have detained 2,305 people who are under investigation for more than six months without referring them to a judge. The number held for excessively long periods has apparently increased dramatically in recent years. A similar Human Rights Watch analysis in May 2014 revealed that only 293 people had been held under investigation for that period.

    Reports of violent encounters with Israeli forces are not exactly rare in the deeply contested Palestinian territory. But this time feels different.

    Last Friday, Israeli soldiers opened fire on a gathering of thousands near the border between Gaza and Israel, ultimately killing 18 Palestinians andreportedly wounding some 700 more. The demonstration was organized to mark “Land Day,” an annual commemoration of Palestinian civil resistance, and video evidence has since emerged indicating that at least some of the protestors gunned down from a distance on Friday were either carrying no weapons or actively fleeing—or both.

    The incident has drawn pointed criticism from NGOs like Human Rights Watch—which called them “unlawful” and “calculated”—and American politicians like Bernie Sanders, who tweeted, “The killing of Palestinian demonstrators by Israeli forces in Gaza is tragic. It is the right of all people to protest for a better future without a violent response.”

    The Israeli government has tried to assert it was acting in self defense, claiming protestors had links to Hamas and that activists were throwing molotov cocktails and stones, among other projectiles. The Foreign Affairs Director of Prime Minister Benjamin Netanyahu’s Likud Party, Eli Hazan, went so far as to assert that “all 30,000” of the protestors were “legitimate targets.” Still, even before last Friday’s protests, an officer in the Israeli military tweeted what critics suggested was a damning video in anticipation of Land Day featuring images of Israeli soldiers loading and firing sniper rifles along with Arabic captions warning Palestinians to stay away from the border.

La merde ! » Avec le langage fleuri qui le caractérise, le président philippin, Rodrigo Duterte avait annoncé au mois de février que l’île de Boracay, l’un des fleurons de l’industrie touristique de l’archipel, serait fermée pour six mois aux visiteurs à compter du 26 avril. Qualifiant ce qui fut un paradis « sable blanc-cocotiers » de « cloaque », le chef de l’Etat a pris cette décision coûteuse pour l’économie de son pays sur la recommandation de plusieurs agences gouvernementales. Ce partisan de la manière forte a ordonné le déploiement de 600 policiers pour faire évacuer l’île.

    Car, au-delà de la brutalité habituelle des décisions d’un président dont la campagne antidrogue a fait plus de 12 000 morts, selon Human Rights Watch, il y avait urgence à prendre des mesures. Les autorités locales sont accusées d’avoir été incapables de faire respecter les normes de préservation de l’environnement marin et de mettre sur pied un système efficace de collecte des ordures. Elles ont aussi permis aux promoteurs immobiliers de défigurer l’île.

    Au moins trois cents hôtels et « resorts » de luxe ont totalement ignoré les réglementations qui les obligeaient à disposer de leur propre système d’égouts et de recyclage des eaux usées. La plupart se contentent d’évacuer ces dernières dans les canaux et l’océan.

    Une telle décision, spectaculaire et sans précédent, ne fait pas l’affaire des quelque 36 000 personnes travaillant dans le secteur des loisirs de cette île qui ne vit que par le tourisme. La fermeture provisoire de Boracay devrait coûter quelque 600 millions d’euros.

      By Stifling Migration, Sudan’s Feared Secret Police Aid Europe

      At Sudan’s eastern border, Lt. Samih Omar led two patrol cars slowly over the rutted desert, past a cow’s carcass, before halting on the unmarked 2,000-mile route that thousands of East Africans follow each year in trying to reach the Mediterranean, and then onward to Europe.

      His patrols along this border with Eritrea are helping Sudan crack down on one of the busiest passages on the European migration trail. Yet Lieutenant Omar is no simple border agent. He works for Sudan’s feared secret police, whose leaders are accused of war crimes — and, more recently, whose officers have been accused of torturing migrants.

      Indirectly, he is also working for the interests of the European Union.

      “Sometimes,” Lieutenant Omar said, “I feel this is Europe’s southern border.”

      Three years ago, when a historic tide of migrants poured into Europe, many leaders there reacted with open arms and high-minded idealism. But with the migration crisis having fueled angry populism and political upheaval across the Continent, the European Union is quietly getting its hands dirty, stanching the human flow, in part, by outsourcing border management to countries with dubious human rights records.

      In practical terms, the approach is working: The number of migrants arriving in Europe has more than halved since 2016. But many migration advocates say the moral cost is high.
      To shut off the sea route to Greece, the European Union is paying billions of euros to a Turkish government that is dismantling its democracy. In Libya, Italy is accused of bribing some of the same militiamen who have long profited from the European smuggling trade — many of whom are also accused of war crimes.

      In Sudan, crossed by migrants trying to reach Libya, the relationship is more opaque but rooted in mutual need: The Europeans want closed borders and the Sudanese want to end years of isolation from the West. Europe continues to enforce an arms embargo against Sudan, and many Sudanese leaders are international pariahs, accused of committing war crimes during a civil war in Darfur, a region in western Sudan

      But the relationship is unmistakably deepening. A recent dialogue, named the Khartoum Process (in honor of Sudan’s capital) has become a platform for at least 20 international migration conferences between European Union officials and their counterparts from several African countries, including Sudan. The European Union has also agreed that Khartoum will act as a nerve center for countersmuggling collaboration.

      While no European money has been given directly to any Sudanese government body, the bloc has funneled 106 million euros — or about $131 million — into the country through independent charities and aid agencies, mainly for food, health and sanitation programs for migrants, and for training programs for local officials.

      “While we engage on some areas for the sake of the Sudanese people, we still have a sanction regime in place,” said Catherine Ray, a spokeswoman for the European Union, referring to an embargo on arms and related material.

      “We are not encouraging Sudan to curb migration, but to manage migration in a safe and dignified way,” Ms. Ray added.

      Ahmed Salim, the director of one of the nongovernmental groups that receives European funding, said the bloc was motivated by both self-interest and a desire to improve the situation in Sudan.

      “They don’t want migrants to cross the Mediterranean to Europe,” said Mr. Salim, who heads the European and African Center for Research, Training and Development.

      But, he said, the money his organization receives means better services for asylum seekers in Sudan. “You have to admit that the European countries want to do something to protect migrants here,” he said.

      Critics argue the evolving relationship means that European leaders are implicitly reliant on — and complicit in the reputational rehabilitation of — a Sudanese security apparatus whose leaders have been accused by the United Nations of committing war crimes in Darfur.

      “There is no direct money exchanging hands,” said Suliman Baldo, the author of a research paper about Europe’s migration partnership with Sudan. “But the E.U. basically legitimizes an abusive force.”

      On the border near Abu Jamal, Lieutenant Omar and several members of his patrol are from the wing of the Sudanese security forces headed by Salah Abdallah Gosh, one of several Sudanese officials accused of orchestrating attacks on civilians in Darfur.

      Elsewhere, the border is protected by the Rapid Support Forces, a division of the Sudanese military that was formed from the janjaweed militias who led attacks on civilians in the Darfur conflict. The focus of the group, known as R.S.F., is not counter-smuggling — but roughly a quarter of the people-smugglers caught in January and February this year on the Eritrean border were apprehended by the R.S.F., Lieutenant Omar said.

      European officials have direct contact only with the Sudanese immigration police, and not with the R.S.F., or the security forces that Lieutenant Omar works for, known as N.I.S.S. But their operations are not that far removed.

      The planned countertrafficking coordination center in Khartoum — staffed jointly by police officers from Sudan and several European countries, including Britain, France and Italy — will partly rely on information sourced by N.I.S.S., according to the head of the immigration police department, Gen. Awad Elneil Dhia. The regular police also get occasional support from the R.S.F. on countertrafficking operations in border areas, General Dhia said.

      “They have their presence there and they can help,” General Dhia said. “The police is not everywhere, and we cannot cover everywhere.”

      Yet the Sudanese police are operating in one unexpected place: Europe.

      In a bid to deter future migrants, at least three European countries — Belgium, France and Italy — have allowed in Sudanese police officers to hasten the deportation of Sudanese asylum seekers, General Dhia said.

      Nominally, their official role is simply to identify their citizens. But the officers have been allowed to interrogate some deportation candidates without being monitored by European officials with the language skills to understand what was being said.

      More than 50 Sudanese seeking asylum in Europe have been deported in the past 18 months from Belgium, France and Italy; The New York Times interviewed seven of them on a recent visit to Sudan.

      Four said they had been tortured on their return to Sudan — allegations denied by General Dhia. One man was a Darfuri political dissident deported in late 2017 from France to Khartoum, where he said he was detained on arrival by N.I.S.S. agents.

      Over the next 10 days, he said he was given electric shocks, punched and beaten with metal pipes. At one point the dissident, who asked that his name be withheld for his safety, lost consciousness and had to be taken to the hospital. He was later released on a form of parole.
      The dissident said that, before his deportation from France, Sudanese police officers had threatened him as French officers stood nearby. “I said to the French police: ‘They are going to kill us,’” he said. “But they didn’t understand.”

      European officials argue that establishing Khartoum as a base for collaboration on fighting human smuggling can only improve the Sudanese security forces. The Regional Operational Center in Khartoum, set to open this year, will enable delegates from several European and African countries to share intelligence and coordinate operations against smugglers across North Africa.

      But potential pitfalls are evident from past collaborations. In 2016, the British and Italian police, crediting a joint operation with their Sudanese counterparts, announced the arrest of “one of the world’s most wanted people smugglers.” They said he was an Eritrean called Medhanie Yehdego Mered, who had been captured in Sudan and extradited to Italy.

      The case is now privately acknowledged by Western diplomats to have been one of mistaken identity. The prisoner turned out to be Medhanie Tesfamariam Berhe, an Eritrean refugee with the same first name as the actual smuggler. Mr. Mered remains at large.

      Even General Dhia now admits that Sudan extradited the wrong man — albeit one who, he says, admitted while in Sudanese custody to involvement in smuggling.

      “There were two people, actually — two people with the same name,” General Dhia said.

      Mr. Berhe nevertheless remains on trial in Italy, accused of being Mr. Mered — and of being a smuggler.

      Beyond that, the Sudanese security services have long been accused of profiting from the smuggling trade. Following European pressure, the Sudanese Parliament adopted a raft of anti-smuggling legislation in 2014, and the rules have since led to the prosecution of some officials over alleged involvement in the smuggling business.

      But according to four smugglers whom I interviewed clandestinely during my trip to Sudan, the security services remain closely involved in the trade, with both N.I.S.S and R.S.F. officials receiving part of the smuggling profits on most trips to southern Libya.

      The head of the R.S.F., Brig. Mohammed Hamdan Daglo, has claimed in the past that his forces play a major role in impeding the route to Libya. But each smuggler — interviewed separately — said that the R.S.F. was often the main organizer of the trips, often supplying camouflaged vehicles to ferry migrants through the desert.

      After being handed over to Libyan militias in Kufra and Sabha, in southern Libya, many migrants are then systematically tortured and held for ransom — money that is later shared with the R.S.F., each smuggler said.

      Rights activists have previously accused Sudanese officials of complicity in trafficking. In a 2014 report, Human Rights Watch said that senior Sudanese police officials had colluded in the smuggling of Eritreans.

      A British journalist captured by the R.S.F. in Darfur in 2016 said that he had been told by his captors that they were involved in smuggling people to Libya. “I asked specifically about how it works,” said the journalist, Phil Cox, a freelance filmmaker for Channel 4. “And they said we make sure the routes are open, and we talk with whoever’s commanding the next area.”

      General Dhia said that the problem did not extend beyond a few bad apples. Sudan, he said, remains an effective partner for Europe in the battle against irregular migration.

      “We are not,” he said, “very far from your standards.”

      Un dissident politique du #Darfour, expulsé par la France fin 2017, affirme notamment avoir été électrocuté, battu et frappé avec des tuyaux en métal pendant dix jours.
      En Belgique, c’est un scandale. En France, le silence est... assourdissant. Dans une grande enquête, publiée dimanche 22 avril, le « New York Times » révèle que des demandeurs d’asile soudanais renvoyés par la France, l’Italie et la Belgique, ont été torturés à leur retour dans leur pays.

      Une enquête de Streetpress, publiée en octobre dernier, révélait déjà que la police française collaborait étroitement, et depuis 2014, avec la dictature soudanaise, et favorisait « le renvoi à Khartoum d’opposants politiques réfugiés en France ». Le titre de Streetpress parlait de lui-même : « Comment la France a livré des opposants politiques à la dictature soudanaise ».
      Le quotidien américain a de son côté retrouvé des demandeurs d’asile et a publié les témoignages de quatre d’entre eux. Ils ont été arrêtés dès leur retour puis torturés par le régime soudanais. Un dissident politique du Darfour expulsé par la France fin 2017, affirme ainsi avoir été électrocuté, battu et frappé avec des tuyaux en métal pendant dix jours. Il affirme qu’avant son expulsion, des officiers de police soudanais l’ont menacé en présence d’officiers français :

      Des policiers soudanais dans des centres de rétention

      Interrogé par le « New York Times », le régime du général Omar el-Béchir dément. Le dictateur, qui dirige depuis 28 ans le Soudan, est visé par un mandat d’arrêt en 2008 de la Cour pénale internationale pour génocide, crimes contre l’humanité et crimes de guerre, comme le rappelle « le Journal du dimanche ».

      Comme l’écrit le quotidien américain, la Belgique, la France et l’Italie ont autorisé des « officiels soudanais » à pénétrer dans leurs centres de rétention et à interroger des demandeurs d’asile soudanais. Ces « officiels » étaient en réalité des policiers soudanais. Selon le « New York Times », les entretiens dans les centres de rétention entre les « officiels » soudanais et les demandeurs d’asile se seraient faits « en l’absence de fonctionnaire capable de traduire les propos échangés ».

      En Belgique, les révélations sur les expulsions de demandeurs d’asile soudanais ont provoqué de vives tensions. En septembre dernier, le Premier ministre belge Charles Michel a reconnu devant une commission d’enquête de son Parlement que les polices de plusieurs pays européens collaboraient étroitement avec la dictature soudanaise d’Omar el-Béchir.

    Ces expulsions massives menées par des municipalités semblent discriminatoires et non conformes aux normes juridiques.
    Treize municipalités libanaises au moins ont délogé de force et expulsé au moins 3 664 réfugiés syriens, manifestement en raison de leur nationalité ou de leur religion, tandis que 42 000 autres risquent toujours d’être expulsés, a déclaré Human Rights Watch dans un rapport rendu public aujourd’hui.

    Le rapport de 57 pages, intitulé « ‘Our Homes Are Not for Strangers’ : Mass Evictions of Syrian Refugees by Lebanese Municipalities » (« “Nos maisons ne sont pas pour les étrangers” : Expulsions de masse de réfugiés syriens par les municipalités libanaises »), souligne l’incohérence des motifs invoqués par les municipalités pour justifier l’expulsion de Syriens, et révèle l’incapacité du gouvernement central à protéger leurs droits. Des responsables des Nations Unies ont identifié 3 664 expulsions de ce type depuis le début de l’année 2016 jusqu’à la fin du premier trimestre de 2018. Alors que les autorités locales libanaises font de vagues déclarations selon lesquelles les expulsions seraient fondées sur des infractions à la réglementation du logement, Human Rights Watch a déterminé que les mesures prises par ces municipalités visent exclusivement les ressortissants syriens, et non les citoyens libanais ou d’autres ressortissants étrangers.

  • Northern Ireland Rape Trial Highlights Rough Deal for Victims

    An unlikely source took a stance on respect for women: professional rugby. Two Northern Ireland players had their contracts revoked following their widely publicized rape prosecution.

    Both players, #Paddy_Jackson and #Stuart_Olding, were acquitted of rape of a woman in 2016 when she was 19, but the trial revealed several players’ text messages bragging about what they considered sexual conquests, while referring to the woman in degrading, nauseating terms. On Saturday, the Irish Rugby Football Union (IRFU) and Ulster Rugby let the players go for failure to uphold “core values of the game,” including respect and integrity.

    These sports bodies have taken an important – and sadly uncommon – step in doling out consequences for unacceptable behaviour, even if it was spurred by financial concerns.

    But in the Belfast courtroom, the woman herself seemed to be on trial. She was subjected to eight days of cross-examination by four lawyers. They critiqued everything from her grammar to the fact she didn’t scream for help. She reportedly had to withstand jurors inspecting her underwear. And though a curtain shielded her from the accused, inside was a video camera broadcasting her face to the courtroom, which was open to the public. One reporter called it “rape trial tourism” as visitors came for the spectacle. Is it any wonder the victim’s identity – sexual assault victims are guaranteed anonymity in the media – was revealed on social media?

    For my work with Human Rights Watch, I document rape and other horrific rights abuses daily. Yet the Belfast rape trial brought me to tears, repeatedly.

    Protests in Northern Ireland and the Irish Republic in the trial’s wake underscore the public’s concern about sexual violence and treatment of its victims. Leaders in Northern Ireland have promised to review and reform legal protections in sexual assault cases. But political deadlock stands in the way of forming a government and any legislative action.

    When Northern Ireland has a government, it should prioritize these reforms, in line with international guidance. This includes closing the courtroom to the public and minimizing how often victims must recount their experiences. It should also grant sexual assault victims the right to legal representation.

    Other professional sports organizations should follow the rugby teams’ lead and not excuse sexist, degrading conduct. But without legal reform, rape victims in Northern Ireland are likely to think even harder before they dare come forward to seek justice.

    (Paris) – Le projet de loi « pour une immigration maîtrisée, un droit d’asile effectif et une intégration réussie » examiné par les parlementaires français pourrait nuire à l’accès des demandeurs d’asile à une protection et devrait être amendé, a déclaré Human Rights Watch aujourd’hui. L’Assemblée nationale examinera le projet de loi pendant la semaine du 16 avril. Le Sénat le discutera en mai.

    Pékin fait appel aux nouvelles technologies pour établir des listes noires, du dissident au mauvais payeur.

    L’avocat chinois Liang Xiaojun a pris l’habitude d’être retenu avant de prendre l’avion – et parfois empêché d’embarquer. Début mars, l’avertissement « condamné pour séparatisme » est apparu sur la machine utilisée par la police pour scanner sa carte d’identité avant qu’il s’envole pour la région de Mongolie intérieure. Or, précise-t-il, « je n’ai jamais été accusé ni condamné pour séparatisme ». Peut-être est-ce en lien avec l’un de ses clients : il représente un Tibétain jugé en janvier pour incitation au séparatisme. « A moins que ce soit ce que j’écris sur la messagerie WeChat ? », s’interroge M. Liang.

    On l’a finalement laissé embarquer. Pas comme en août 2015, lorsqu’il avait été carrément empêché de s’envoler pour un semestre d’études à New York. L’ordinateur affichait : « Danger pour la sécurité nationale. » Sans doute, devine-t-il, parce qu’il était proche de certains des avocats des droits de l’homme arrêtés quelques semaines plus tôt.

    Les déboires de M. Liang sont typiques des personnes que leurs activités « sensibles » placent sur des listes noires secrètes, aux critères mystérieux. A ce titre, elles servent de cobayes à l’ambitieux système de « crédit social » que la Chine met en place depuis 2014 : celui-ci se construit pour l’instant autour d’une sanction principale, l’interdiction d’emprunter un avion ou un train.

    Mise à l’index

    Environ dix millions de passagers du transport aérien et quatre millions du ferroviaire se sont vu imposer entre 2013 et mars 2018 des restrictions partielles ou totales à l’achat de billets pour n’avoir pas exécuté la décision de justice à laquelle ils ont été condamnés après épuisement des recours. Parmi eux, 6,2 millions furent entièrement interdits d’avion.

    Cette mise à l’index des inculpés ou débiteurs défaillants par les cours de justice répond certes à un problème bien réel : la difficulté pour l’Etat chinois de faire appliquer les décisions de justice. La Cour suprême chinoise, qui supervise le dispositif, se félicite qu’il ait contraint des dizaines de millions d’individus à se conformer à leurs obligations ou à négocier un arrangement.

    C’est ce succès initial qui a poussé les autorités chinoises à étendre à d’autres domaines d’infractions l’interdiction de voler ou de prendre le train. Depuis le 19e Congrès du Parti communiste chinois en octobre 2017, les cadres sont incités à « mettre diligemment en œuvre » les instructions sur la « construction d’un système de crédit et de sanction selon lequel tout devient limité, une fois que la confiance est perdue ».

    Ainsi, à partir du 1er mai, une nouvelle série de fraudes et de manquements légaux en tous genres viendra s’ajouter au défaut d’exécution des décisions de justice. Annoncée début mars par l’Agence de planification chinoise aux côtés d’une dizaine d’entités publiques, cette nouvelle phase du système de crédit social, baptisée « action disciplinaire conjointe », va sanctionner par des restrictions sur l’achat de billets d’avion et de train toute une gamme de comportements délictueux dans les transports – du non-respect de l’interdiction de fumer à la fausse alerte à la bombe –, mais aussi dans le domaine de la fiscalité et de la gestion financière, boursière et d’entreprise : usage de faux, défaut de paiement des cotisations sociales…

    La liste doit s’étoffer. Et d’autres domaines d’interdiction pourraient voir le jour. « Se met en place un système de listes noires, qui punit par une sanction dans un domaine une mauvaise action effectuée dans un autre, explique Maya Wang, de l’ONG Human Rights Watch à Hongkong. L’ambition finale va beaucoup plus loin : il s’agit d’évaluer une multitude de comportements dans tous les domaines. »

    Le « crédit social » en question n’est pas une « notation » de chaque citoyen par un score et rien n’indique que celle-ci verra jamais le jour, rappelle sur le blog China Law Translate l’observateur de la gouvernance chinoise Jeremy Daum. Il renvoie davantage, selon lui, à « une politique ou une idéologie d’utilisation des données ». Sur le site Internet de promotion du crédit social (www.creditchina.gov.cn), on peut lire d’innombrables dissertations sur les valeurs traditionnelles chinoises. Il s’agit, annonce le site, d’établir une « culture d’honnêteté et d’intégrité ». Le système devra « être essentiellement mis en place d’ici 2020 ».

    Depuis le 1er janvier, toute personne morale est dotée d’un code de crédit social unique. Les individus, eux, restent identifiés par leur numéro de carte d’identité, dont la puce électronique stocke déjà de multiples données. L’objectif peut sembler louable : apporter une solution systémique à l’empire de la fraude qu’est la Chine, en repérant, grâce à l’intelligence artificielle et aux données numériques, les comportements délictueux au niveau des individus, des entreprises, mais aussi, en théorie, des agents publics.

    Cette ferveur disciplinaire pousse aujourd’hui les villes chinoises à une course aux équipements de détection – à commencer par les outils de reconnaissance faciale, permettant d’identifier dans une foule ou sur des photos en ligne des suspects recherchés ou des gens disparus. Le système Sky Net de caméras installé dans 16 municipalités et provinces chinoises aurait ainsi permis de confondre 2 000 fugitifs en deux ans. Et des policiers ont même testé en février dans une gare de Zhengzhou, capitale de la province du Henan, la reconnaissance faciale incorporée à des lunettes.

    « Contrôlocratie »

    Les Chinois ont pour beaucoup une attitude ambivalente face à cette profusion de gadgets de surveillance ou de contrôle. Le droit à la vie privée est fragile en Chine – en raison d’abord d’un Etat de droit déficient. En outre, l’expression yinsi (« vie privée », en chinois) évoque plus le secret et la clandestinité qu’un espace individuel sacro-saint.

    Ces avides utilisateurs de smartphones et des réseaux sociaux n’en ont pas moins appris du reste du monde à dénoncer les atteintes à la vie privée émanant d’entreprises ou de hackeurs. Les scandales ne sont pas rares : les développeurs d’une application d’agrégation de contenus, Jinri Toutiao, ont par exemple été accusés récemment d’écouter les appels téléphoniques à l’aide du micro du smartphone et de proposer des publicités en lien avec les conversations.

    En revanche, les intrusions d’origine étatique et sécuritaire dans la vie quotidienne sont surtout vues comme un progrès bienvenu pour des services de police et de justice longtemps perçus comme inefficaces et corrompus. « La première chose qui me vient à l’esprit quand je vois toutes ces caméras, tous ces contrôles de cartes d’identité, c’est que je suis en sécurité », nous dit Monica Wang, une jeune chef d’entreprise.

    Obnubilé par la défense du régime, l’Etat policier chinois met en effet moins d’ardeur à résoudre les délits de droit commun qu’à contrôler les dissidents ou censurer les réseaux sociaux. Or, ce biais, craignent les militants des droits de l’homme, ne va pas s’estomper avec la montée en gamme de la « contrôlocratie » (selon l’analyste politique norvégien Stein Ringen) de Xi Jinping. Les représailles exercées à l’encontre d’un dissident et sa famille – pressions sur l’employeur, le propriétaire ou l’école des enfants – pourraient se traduire par des sanctions « automatiques » et possiblement inamovibles et opaques, dans divers domaines.

    « Le système de crédit social n’est pas une mauvaise chose pour la Chine, il y a un vrai besoin, dit l’avocat Liang Xiaojun. Mais il risque d’être vite utilisé de manière détournée. L’appareil policier s’en sert par exemple pour mieux contrôler des personnes ciblées et non parce qu’elles enfreignent la loi. »

    Pour Maya Wang, de Human Rights Watch, se profile en Chine une moisson sans limite de données sur les citoyens à des fins de surveillance et de contrôle – dont les données biométriques (ADN, caractéristiques du visage) ou encore les échanges sur les réseaux sociaux. « C’est une violation directe du principe de protection des données personnelles. Celui-ci impose que le citoyen comprenne clairement quelles données on garde sur lui, qu’il donne son accord et que ces données restent dans un périmètre très précis, comme le médical », explique-t-elle.

    L’ONG dénonce ainsi l’expérience de « police prédictive » dont la région autonome ouïgoure du Xinjiang sert de terrain d’essai. Ses habitants musulmans sont vus avec suspicion par Pékin. Une multitude de données privées captées par la surveillance électronique ou humaine, comme l’assiduité à la prière ou le fait de contacter des personnes à l’étranger, servent à imposer à des personnes des sessions de rééducation en centre de détention. « En Chine, les lois sont vagues et l’arbitraire domine, dit Maya Wang. C’est la recette parfaite pour une vraie catastrophe. »

    Le gouvernement du Mali devrait de toute urgence mener des enquêtes crédibles sur les abus commis contre des suspects détenus par son armée lors d’une opération militaire de grande envergure menée contre des groupes islamistes armés, a déclaré Human Rights Watch aujourd’hui. Le haut commandement militaire devrait suspendre les agents impliqués dans les #abus en attendant les enquêtes et veiller à ce que tous les détenus soient traités avec humanité et remis rapidement aux gendarmes du gouvernement.

    Les enquêtes devraient inclure les décès en détention de 27 hommes et les tortures sévères à l’encontre de deux autres détenus en février, mars et avril 2018 lors de l’opération Dambe, une offensive majeure qui s’est intensifiée début 2018 dans la région de Mopti, au centre du Mali. L’armée a indiqué qu’elle enquêtait sur deux des cas signalés. Étant donné que l’armée a omis de traduire en justice des militaires impliqués dans des abus antérieurs, une enquête indépendante du ministère de la Justice sur la série actuelle d’abus est cruciale, selon Human Rights Watch.

    Selon les ONG, réunies mercredi au siège de la Fédération internationale des ligues des droits de l’homme (FIDH), l’héritier joue « un rôle majeur dans la guerre conduite au Yémen depuis trois ans par la coalition » puisqu’il est non seulement ministre de la Défense de son pays, mais également le commandant en chef de la coalition qui réunit Bahreïn, l’Égypte, la Jordanie, le Koweït, le Maroc, le Soudan et les Émirats arabes unis (EAU).
