  • First-ever private border wall built in #New_Mexico

    A private group announced Monday that it has constructed a half-mile wall along a section of the U.S.-Mexico border in New Mexico, in what it said was a first in the border debate.

    The 18-foot steel bollard wall is similar to the designs used by the Border Patrol, sealing off a part of the border that had been a striking gap in existing fencing, according to We Build the Wall, the group behind the new section.

    The section was also built faster and, organizers say, likely more cheaply than the government has been able to manage in recent years.

    Kris Kobach, a former secretary of state in Kansas and an informal immigration adviser to President Trump, says the New Mexico project has the president’s blessing, and says local Border Patrol agents are eager to have the assistance.

    “We’re closing a gap that’s been a big headache for them,” said Mr. Kobach, who is general counsel for We Build the Wall.

    • The #GoFundMe Border Wall Is the Quintessential Trump-Era Grift

      In 2012, historian Rick Perlstein wrote a piece of essential reading for understanding modern conservatism, titled “The Long Con” and published by the Baffler. It ties the right’s penchant for absurd and obvious grifts to the conservative mind’s particular vulnerability to fear and lies:

      The strategic alliance of snake-oil vendors and conservative true believers points up evidence of another successful long march, of tactics designed to corral fleeceable multitudes all in one place—and the formation of a cast of mind that makes it hard for either them or us to discern where the ideological con ended and the money con began.

      Lying, Perlstein said, is “what makes you sound the way a conservative is supposed to sound.” The lies—about abortion factories, ACORN, immigrants, etc.—fund the grifts, and the grifts prey on the psychology that makes the lies so successful.

      Perlstein’s piece is all I could think of when I saw last night’s CNN story about the border wall GoFundMe, which seemingly has actually produced Wall. According to CNN, the group We Build the Wall says it has produced a half-mile of border wall in New Mexico. CNN was invited to watch the construction, where Kris Kobach, who is general counsel for the group, spoke “over the clanking and beeping of construction equipment.”

      #Steve_Bannon, who is naturally involved with the group, told CNN that the wall connects existing fencing and had “tough terrain” that means it was left “off the government list.” The half-mile stretch of wall cost an “estimated $6 million to $8 million to build,” CNN reported.

      CNN also quoted #Jeff_Allen, who owns the property on which the fence was built, as saying: “I have fought illegals on this property for six years. I love my country and this is a step in protecting my country.” According to MSN, Allen partnered with United Constitutional Patriots to build the wall with We Build the Wall’s funding. UCP is the same militia that was seen on video detaining immigrants and misrepresenting themselves as Border Patrol; the Phoenix New Times reported on the “apparent ties” between the UCP and We Build the Wall earlier this month.

      This story is bursting at the seams with an all-star lineup of right-wing scammers. The GoFundMe itself, of course, has been rocked by scandal: After the effort raised $20 million, just $980 million short of the billion-dollar goal, GoFundMe said in January that the funds would be returned, since creator Brian Kolfage had originally pledged that “If for ANY reason we don’t reach our goal we will refund your donation.” But Kolfage quickly figured out how to keep the gravy train going, urging those who had donated to allow their donations to be redirected to a non-profit. Ultimately, $14 million of that $20 million figure was indeed rerouted by the idiots who donated it.

      That non-profit became #We_Build_The_Wall, and like all good conservative con jobs, it has the celebs of the fever swamp attached to it. Not only #Kris_Kobach, a tenacious liar who failed at proving voter fraud is a widespread problem—but also slightly washed-up figures like Bannon, Sheriff David Clarke, Curt Schilling, and Tom Tancredo. All the stars are here!

      How much sleazier could it get? Try this: the main contractor working at the site of New Wall, according to CNN, is Tommy Fisher. The Washington Post reported last week that Trump had “personally and repeatedly urged the head of the U.S. Army Corps of Engineers” to give the contract for the border wall to the company owned by Fisher, a “GOP donor and frequent guest on Fox News,” despite the fact that the Corps of Engineers previously said Fisher’s proposals didn’t meet their requirements.

      Of course, like all good schemes, the need for more money never ceases: On the Facebook page for the group, the announcement that Wall had been completed was accompanied with a plea for fans to “DONATE NOW to fund more walls! We have many more projects lined up!”

      So, what we have is: A tax-exempt non-profit raised $20 million by claiming it would be able to make the federal government build Wall by just giving it the money for it and then, when that didn’t happen, getting most of its donors to reroute that money; then it built a half-mile of wall on private land for as much as $8 million, which went to a firm of a Fox News star whom President Trump adores.

      Perlstein wrote in the aforementioned piece that it’s hard to “specify a break point where the money game ends and the ideological one begins,” since “the con selling 23-cent miracle cures for heart disease inches inexorably into the one selling miniscule marginal tax rates as the miracle cure for the nation itself.” The con job was sold through fear: “Conjuring up the most garishly insatiable monsters precisely in order to banish them from underneath the bed, they aim to put the target to sleep.”

      The Trump era is the inartful, gaudy, brazen peak of this phenomenon. This time, instead of selling fake stem cell cures using the language of Invading Liberals, the grifters are just straight-up selling—for real American dollars—the promise of building a big wall to keep the monsters out.

    • Company touted by Trump to build the wall has history of fines, violations

      President Donald Trump appears to have set his sights on a North Dakota construction firm with a checkered legal record to build portions of his signature border wall.
      The family-owned company, #Fisher_Sand_&_Gravel, claims it can build the wall cheaper and faster than competitors. It was among a handful of construction firms chosen to build prototypes of the President’s border wall in 2017 and is currently constructing portions of barrier on private land along the border in New Mexico using private donations.
      It also, however, has a history of red flags including more than $1 million in fines for environmental and tax violations. A decade ago, a former co-owner of the company pleaded guilty to tax fraud, and was sentenced to prison. The company also admitted to defrauding the federal government by impeding the IRS. The former executive, who’s a brother of the current company owner, is no longer associated with it.
      More than two years into his presidency, Trump is still fighting to build and pay for his border wall, a key campaign issue. After failing to get his requests for wall funding passed by a Republican-held Congress during his first two years in office, Trump has met resistance this year from a Democratic-controlled House. His attempt to circumvent Congress through a national emergency declaration has been challenged in the courts.
      On May 24, a federal district judge blocked the administration from using Defense Department funds to construct parts of the wall. The Trump administration has since appealed the block to the 9th US Circuit Court of Appeals and in the interim, asked the district court to allow building to continue pending appeal. The district court denied the administration’s request.
      Despite the uncertainty, construction firms have been competing to win multimillion-dollar contracts to build portions of wall, including Fisher Sand & Gravel.

      Asked by CNN to comment on the company’s history of environmental violations and legal issues, the company said in a statement: “The questions you are asking have nothing to do with the excellent product and work that Fisher is proposing with regard to protecting America’s southern border. The issues and situations in your email were resolved years ago. None of those matters are outstanding today.”
      Catching the President’s attention
      The company was founded in North Dakota in 1952 and operates in several states across the US. It’s enjoyed public support from North Dakota Republican Sen. Kevin Cramer, who as a congressman invited the company’s CEO, Tommy Fisher, to Trump’s State of the Union address in 2018. Cramer has received campaign contributions from Fisher and his wife. A photo of the event shared by Fisher in a company newsletter shows Tommy Fisher shaking Trump’s hand.
      The Washington Post first reported the President’s interest in Fisher. According to the Post, the President has “aggressively” pushed for the Army Corps of Engineers to award a wall contract to Fisher.
      The President “immediately brought up Fisher” during a May 23 meeting in the Oval Office to discuss details of the border wall with various government officials, including that he wants it to be painted black and include French-style doors, according to the Post and confirmed by CNN.
      “The Army Corps of Engineers says about 450 miles of wall will be completed by the end of next year, and the only thing President Trump is pushing, is for the wall to be finished quickly so the American people have the safety and security they deserve,” said Hogan Gidley, White House deputy press secretary.
      A US government official familiar with the meeting tells CNN that the President has repeatedly mentioned the company in discussions he’s had about the wall with the head of the Army Corps of Engineers, Lt. Gen. Todd Semonite.
      Fisher has recently made efforts to raise its public profile, both by upping its lobbying efforts and through repeated appearances on conservative media by its CEO, Tommy Fisher.

      In the past two years, for example, the company’s congressional lobbying expenditures jumped significantly — from $5,000 in 2017 to $75,000 in 2018, according to data compiled by the Center for Responsive Politics, a non-profit that tracks lobbying expenditures.

      When asked about Fisher Sand & Gravel’s lobbying, Don Larson, one of Fisher’s registered lobbyists, said: “I am working to help decision makers in Washington become familiar with the company and its outstanding capabilities.”
      Media Blitz
      As part of a media blitz on outlets including Fox News, SiriusXM Patriot and Breitbart News, Tommy Fisher has discussed his support for the border wall and pitched his company as the one to build it. In a March 5 appearance on Fox & Friends, Fisher said that his company could build 234 miles of border wall for $4.3 billion, compared to the $5.7 billion that the Trump administration has requested from Congress.
      Fisher claimed that his firm can work five-to-10 times faster than competitors as a result of its construction process.
      The President has also touted Fisher on Fox News. In an April interview in which he was asked about Fisher by Sean Hannity, Trump said the company was “recommended strongly by a great new senator, as you know, Kevin Cramer. And they’re real. But they have been bidding and so far they haven’t been meeting the bids. I thought they would.”
      Despite the President’s interest, the company has thus far been unsuccessful in obtaining a contract to build the border wall, beyond that of a prototype.

      Earlier this year, Fisher put its name in the running for border wall contracts worth nearly $1 billion. When it lost the bid to Barnard Construction Co. and SLSCO Ltd., Fisher protested the awards over claims that the process was biased. In response, the Army Corps canceled the award. But after a review of the process, the Army Corps combined the projects and granted it to a subsidiary of Barnard Construction, according to an agency spokesperson.
      It’s unclear whether the project will proceed, given the recent decision by a federal judge to block the use of Defense Department funds to build parts of the border wall and the administration’s appeal.
      Fisher, which has a pending lawsuit in the US Court of Federal Claims over the solicitation process, is listed by the Defense Department as being among firms eligible to compete for future border contracts.

      It has moved forward with a private group, We Build the Wall, that is building sections of barrier on private land in New Mexico using private money raised as part of a GoFundMe campaign. Kris Kobach, the former Kansas Secretary of State who is now general counsel for the group, said a half-mile stretch is nearly complete, at an estimated cost of $6 million to $8 million.

      In a statement, a Customs and Border Protection spokesperson said Fisher Industries has told them that the company has begun construction on private property along the border “in the approximate area of a USBP border barrier requirement that was not prioritized under current funding.”
      The spokesperson added: “It is not uncommon for vendors” to demonstrate their capabilities using “their own resources,” but the agency goes on to “encourage all interested vendors” to compete for border contracts “through established mechanisms to ensure any construction is carried out under relevant federal authorities and meets USBP operational requirements for border barrier.”
      In responses provided to CNN through Scott Sleight, an attorney working on behalf of the company, Fisher maintained that it’s “committed to working with all appropriate federal government officials and agencies to provide its expertise and experience to help secure America’s southern border.”
      The company says it has “developed a patent-pending bollard fence hanging system that [it] believes allows border fencing to be constructed faster than any contractor using common construction methods.” It also added: “Fisher has been concerned about the procurement procedures and evaluations done by the USACE to date, and hopes these issues can be remedied.”
      Relationship with Sen. Cramer
      A month after attending the 2018 State of the Union address with Cramer, Fisher and his wife, Candice each contributed the $5,400 maximum donation to Cramer’s campaign for the US Senate, Federal Election Commission records show.
      Fisher also donated to several Arizona Republicans in the 2018 election cycle, including giving the $5,400-maximum donation to Martha McSally’s campaign, records show.
      A recent video produced by Fisher Sand & Gravel demonstrating its ability to construct the wall includes a clip of Cramer at the controls of a track-hoe lifting sections of barrier wall into place, saying “this is just like XBOX, baby.” Cramer was joined at the demonstration by a handful of other Republican lawmakers from across the country.

      Cramer has been publicly critical of how the Army Corps has handled its border wall construction work, arguing that it has moved too slowly and expressing frustration over how it has dealt with Fisher. In an interview with a North Dakota TV station, Cramer said that he believes the corps “made a miscalculation in who they chose over Fisher” and that the company had been “skunked so to speak.” Cramer added that Fisher “remains a pre-qualified, high level, competitor.”

      In an interview with CNN, Cramer said that the company has come up in conversations he has had with administration officials, including the President and the head of the Army Corps, but while the senator said that he would “love if they got every inch of the project,” he added that he has “never advocated specifically for them.”
      "Every time someone comes to meet with me, whether it’s (Acting Defense Secretary) Shanahan, General Semonite, even with Donald Trump, they bring up Fisher Industries because they assume that’s my thing," Cramer said.
      “One of the things I’ve never done is said it should be Fisher,” Cramer said. “Now, I love Fisher. I’d love if they got every inch of the project. They’re my constituents, I don’t apologize for that. But my interest really is more in the bureaucratic process.”
      According to an administration official familiar with the situation, Cramer sent information about Fisher to the President’s son-in-law and White House adviser Jared Kushner, who then passed it along to the Army Corps of Engineers for their consideration. The source tells CNN that Kushner was not familiar with the company prior to getting information about them from Cramer.
      Cramer said he does recall passing along information about the company to Kushner, but that he did not know what Kushner did with the information.
      On May 24, Cramer told a North Dakota radio station that the President has asked him to examine the process of how federal border wall projects are awarded.
      “We’re going to do an entire audit,” Cramer said. “I’ve asked for the entire bid process, and all of the bid numbers.” Cramer told CNN the President said he wanted the wall built for the “lowest, best price, and it’s also quality, and that’s what any builder should want.”
      Asked about aspects of the company’s checkered legal record, Cramer said “that level of scrutiny is important, but I would hope the same scrutiny would be put on the Corps of Engineers.”
      Environmental violations
      Though its corporate headquarters are in North Dakota, Fisher has a sizable footprint in Arizona, where it operates an asphalt company as well as a drilling and blasting company. It’s there that the company has compiled an extensive track record of environmental violations.
      From 2007 to 2017, Fisher Sand & Gravel compiled more than 1,300 air-quality violations in Maricopa County, culminating in the third highest settlement ever received by the Maricopa County Air Quality Department, according to Bob Huhn, a department spokesperson. That’s a record number of violations for any air-quality settlement in the county, Huhn said. The settlement totaled more than $1 million, though the department received slightly less than that following negotiations, Huhn said.
      Most of the violations came from an asphalt plant that the company was running in south Phoenix that has since closed. While the plant was still running, the City of Phoenix filed 469 criminal charges against the company from August to October of 2009, according to a city spokesperson.
      According to a 2010 article in the Arizona Republic, Fisher reached an agreement with Phoenix officials to close the plant in 2010. As part of the deal, fines were reduced from $1.1 million to an estimated $243,000 and all criminal charges were reduced to civil charges.
      Mary Rose Wilcox was a member of the Maricopa Board of Supervisors at the time the city and county were fighting Fisher over the asphalt plant, which was located in her district. “They tried to persuade us they were good guys since they were a family-owned company. But they were spreading noxious fumes into a residential area,” Wilcox said. “We tried to work with them, but their violations were just so blatant.”
      Michael Pops, a community activist who lived in the area around the plant, remembers fighting with Fisher for six years before the plant finally shut down. “The impact they had on this community was devastating,” Pops said, adding many low-income residents living near the asphalt plant were sickened from the fumes the plant emitted.
      The company has also racked up more than 120 violations with the Arizona Department of Environmental Quality from 2004 until as recently as last summer, according to the department.
      In 2011, Fisher agreed to a Consent Judgement with ADEQ over numerous air quality violations the company had committed. As part of that settlement, Fisher agreed to pay $125,000 in civil penalties, and that it would remain in compliance with state air quality standards. Within two years Fisher was found to be in violation of that agreement and was forced to pay an additional $500,000 in fines, according to the state’s attorney general’s office.
      Legal trouble
      Internally, the company has also confronted issues.
      In 2011, Fisher Sand & Gravel agreed to pay $150,000 to settle a sexual discrimination and retaliation suit filed by the US Equal Employment Opportunity Commission. The lawsuit charged that the company violated federal anti-discrimination laws when it “subjected two women workers to egregious verbal sexual harassment by a supervisor and then fired one of them after she repeatedly asked the supervisor to stop harassing her and complained to a job superintendent.”
      The settlement required Fisher to provide anti-discrimination training to its employees in New Mexico and review its policies on sexual harassment.
      Micheal Fisher, a former co-owner of Fisher and Tommy’s brother, was sentenced to prison in 2009 for tax fraud, according to the Justice Department. Fisher pleaded guilty to “conspiracy to defraud the United States by impeding the [Internal Revenue Service], four counts of aiding in the filing of false federal tax returns for FSG and four counts of filing false individual tax returns,” according to a Justice Department release.
      The company also admitted responsibility for defrauding the US by impeding the IRS, according to the DOJ. Citing a long standing policy of not commenting on the contracting process, the Army Corps declined to comment on whether Fisher’s history factored into its decision not to award Fisher a contract.

    • Private US-Mexico border wall ordered open by gov’t, fights back and is now closed again

      The privately funded portion of the U.S.-Mexico border wall is now fully secure and closed again after one of its gates had been ordered to remain open until disputes about waterway access could be resolved.

      “Our border wall & gate are secure again and we still have not had a single breach. I want to thank the IBWC for acting swiftly and we look forward to working with you on our future projects,” triple amputee Air Force veteran Brian Kolfage posted to Twitter on Tuesday night.

      Kolfage created We Build The Wall Inc., a nonprofit that is now backed by former Trump Administration Chief Strategist Steve Bannon. The group crowd-funded more than $22 million in order to privately build a border wall and then sell it to the U.S. government for $1.

      A portion of that wall has been constructed in Texas for between $6 and $8 million. The 1-mile-long wall is located on private property near El Paso, Texas, and Sunland Park, New Mexico.

      However, the International Boundary and Water Commission (IBWC) had ordered a 33-foot gate within the private border wall to remain open – not locked and closed – over a waterway access issue, according to BuzzFeed News. The IBCW addresses waterway issues between the U.S. and Mexico.

      “This is normally done well in advance of a construction project,” IBWC spokesperson Lori Kuczmanski said. “They think they can build now and ask questions later, and that’s not how it works.”

      BuzzFeed reported that the IBWC said the gate “had blocked officials from accessing a levee and dam, and cut off public access to a historic monument known as Monument One, the first in a series of obelisks that mark the U.S.–Mexico border from El Paso to Tijuana.”

      By Tuesday night, the IBWC said the gate would remain locked at night and issued a statement.

      “The U.S. Section of the International Boundary and Water Commission (USIBWC) will lock the privately-owned gate on federal property at night effective immediately due to security concerns,” it said.

      The statement continues:

      The USIBWC is continuing to work with We Build the Wall regarding its permit request. Until this decision, the private gate was in a locked open position. We Build the Wall, a private organization, built a gate on federal land in Sunland Park, N.M., near El Paso, Texas, without authority, and then locked the gate closed on June 6, 2019. The private gate blocks a levee road owned by the U.S. Government. After repeated requests to unlock and open the private gate, the United States Section of the International Boundary and Water Commission (USIBWC), accompanied by two uniformed law enforcement officers from the Dona Ana County Sheriff’s Office, removed the private lock, opened the gate, and locked the gate open pending further discussions with We Build the Wall. The gate was also opened so that USIBWC employees can conduct maintenance and operations at American Dam.

      The USIBWC did not authorize the construction of the private gate on federal property as announced on We Build the Wall’s Twitter page. The USIBWC is not charged with securing other fences or gates as reported by We Build the Wall. The international border fences are not on USIBWC property. The USIBWC did not open any other gates in the El Paso area as erroneously reported. Other gates and the border fence are controlled by other federal agencies.

      When the proper documentation is received for the permit, USIBWC will continue to process the permit application.

    On both sides of the Atlantic, a loose network of activists and political figures on the right have spent years seeking to cast Mr. Soros not just as a well-heeled political opponent but also as the personification of all they detest. Employing barely coded anti-Semitism, they have built a warped portrayal of him as the mastermind of a “globalist” movement, a left-wing radical who would undermine the established order and a proponent of diluting the white, Christian nature of their societies through immigration.

    In the process, they have pushed their version of Mr. Soros, 88, from the dark corners of the internet and talk radio to the very center of the political debate.

    “He’s a banker, he’s Jewish, he gives to Democrats — he’s sort of a perfect storm for vilification by the right, here and in Europe,” said Michael H. Posner, a human rights lawyer and former State Department official in the Obama administration.

    Mr. Soros has given his main group, the Open Society Foundations, $32 billion for what it calls democracy-building efforts in the United States and around the world. In addition, in the United States, Mr. Soros has personally contributed more than $75 million over the years to federal candidates and committees, according to Federal Election Commission and Internal Revenue Service records.

    That qualifies him as one of the top disclosed donors to American political campaigns in the modern campaign finance era, and it does not include the many millions more he has donated to political nonprofit groups that do not disclose their donors.

    By contrast, the network of conservative donors led by the billionaire industrialist brothers Charles G. and David H. Koch, who have been similarly attacked by some on the American left, has spent about $2 billion over the past decade on political and public policy advocacy.❞

    The closing advertisement for Mr. Trump’s 2016 campaign featured Mr. Soros — as well as Janet L. Yellen, the chairwoman of the Federal Reserve at the time, and Lloyd Blankfein, the chief executive of Goldman Sachs, both of whom are Jewish — as examples of “global special interests” who enriched themselves on the backs of working Americans.

    If anything, Mr. Soros has been elevated by Mr. Trump and his allies to even greater prominence in the narrative they have constructed for the closing weeks of the 2018 midterm elections. They have projected on to him key roles in both the threat they say is posed by the Central Americans making their way toward the United States border and what they characterized as Democratic “mobs” protesting the nomination of Brett M. Kavanaugh to the Supreme Court.

    The National Republican Congressional Committee ran an ad in October in Minnesota suggesting that Mr. Soros, who is depicted sitting behind a pile of cash, “bankrolls” everything from “prima donna athletes protesting our anthem” to “left-wing mobs paid to riot in the streets.” The ad links Mr. Soros to a local congressional candidate who worked at a think tank that has received funding from the Open Society Foundations.

    Even after the authorities arrested a fervent Trump supporter and accused him of sending the pipe bombs to Mr. Soros and other critics, Republicans did not back away. The president grinned on Friday when supporters at the White House responded to his attacks on Democrats and “globalists” by chanting, “Lock ’em up,” and yelling, “George Soros.”

    India’s land is undergoing degradation or desertification. In 2011-2013, it stood at 29.3 percent of the total land, representing an increase of 0.57 percent (which is 1.87 million hectares in area) compared with 2003-2005, according to a report-cum-atlas by ISRO’s Space Applications Centre.
    Soil erosion due to water and wind, and degradation of vegetation cover were the main processes that has led to land degradation.
    Almost 90 percent of the states experienced a rise – notably Delhi and the northeastern states – in land degradation in 2011-2013 compared with 2003-2005 while four states showed slight decreases in land degradation.
    Reclaiming degraded lands will require a strict land-use policy and better watershed management initiatives, say experts.

    En 2014, 8 885 décès par suicide ont été enregistrés en France métropolitaine, soit un par heure en moyenne. Un chiffre élevé, mais en diminution de près d’un quart (– 26 %) par rapport à 2003, et qui confirme une baisse tendancielle entamée en 1985. C’est ce que révèle le rapport de la troisième édition de l’Observatoire national du suicide, publié le 5 février par le ministère de la santé et l’agence Santé publique France, à l’occasion de la Journée nationale de prévention du suicide.

    Le rapport précise que ce chiffre de 8 885 suicides est sous-évalué de 10 %, car il ne prend en compte que les décès officiellement enregistrés comme morts volontaires. En incluant ceux pour lesquels il existe une « très forte certitude », mais pas de certificat, on atteindrait quasiment 10 000 décès, soit près de trois fois le nombre de personnes tuées dans les accidents de la route (3 384) en 2014.

    Ces chiffres ne sont pas bons. Avec un taux de suicide de 14,9 pour 100 000 habitants en 2014, la France présente un des taux les plus élevés en Europe. Elle se situe au dixième rang sur trente-deux, après la Finlande, la Belgique et la plupart des pays de l’Est. Le suicide est d’ailleurs la deuxième cause de mortalité chez les 15-24 ans (16,2 % des décès de cette tranche d’âge en 2014, après les accidents de circulation). Une mauvaise place européenne que les autorités sanitaires appellent toutefois à interpréter « avec une extrême prudence »." La France a un moyen relativement précis de connaître le nombre de suicides, ce qui n’est pas le cas de tous les pays « , souligne Jean-Marc Aubert, à la tête de la direction de la recherche, des études, de l’évaluation et des statistiques,au ministère de la santé, qui copilote l’observatoire. Le relativement bon recensement des suicides jouerait donc en défaveur de la France dans les comparaisons internationales.

    Interrogé sur les raisons de cette » baisse tendancielle « du nombre de suicides dans les pays de l’Organisation de coopération et de développement économiques depuis 1990 (exceptés le Japon et la Corée), et depuis 1985 en France, M. Aubert assure que le phénomène est » complexe « , » multifactoriel « et fait l’objet de travaux de recherche. » Malgré toutes ces recherches, on ne sait pas pourquoi ça baisse « , reconnaît-il.

    Et si le nombre de suicides diminue, le profil des personnes qui se donnent la mort reste, lui, globalement similaire d’une année sur l’autre. Ce sont surtout des hommes (23,1 décès pour 100 000 habitants, contre 6,7 chez les femmes). Le taux de suicide » augmente fortement avec l’âge « , note le rapport. Autre constante : des taux de suicide plus élevés sont enregistrés dans la moitié nord du pays. La pendaison reste le mode de suicide le plus fréquent (57 % des décès), loin devant les armes à feu (12 %), les prises de médicaments et autres substances (11 %) et les sauts d’un lieu élevé (7 %).

    Numéro de secours
    L’observatoire rapporte enfin que 78 128 personnes (47 981 femmes et 30 147 hommes) ont été hospitalisées en 2015, dans des services de médecine et de chirurgie, pour tentative de suicide. Un chiffre stable depuis 2013, en baisse après un pic à 91 203 en 2010. Ce nombre de patients est sans doute bien en dessous de la réalité, car il ne prend pas en compte ceux passés aux urgences après une tentative de suicide, mais non hospitalisés, ou ceux hospitalisés en psychiatrie sans être passés auparavant par un service de médecine.

    Afin d’améliorer la prévention et de faire diminuer le nombre de décès par suicide, la ministre de la santé, Agnès Buzyn, a annoncé, le 26 janvier, lors d’un discours consacré à la psychiatrie, qu’elle allait étendre, ces deux prochaines années, le dispositif pour recontacter les » suicidants " à leur sortie des urgences ou d’hospitalisation et mettre en place un numéro de secours pour les personnes en détresse psychique extrême.

    Dans « Suicide. L’envers de notre monde », à paraître le 8 février, les sociologues Christian Baudelot et Roger Establet analysent la surprenante baisse du taux de suicides en France et dans la plupart des pays, en dehors des plus pauvres - Bonnes feuilles

    Depuis 2006, des changements importants sont intervenus dans l’évolution du suicide, dans notre pays et dans une grande partie du monde. Un rapide coup d’œil sur la courbe d’évolution du suicide en France depuis le début du XIXe siècle suffit pour constater une tendance à la baisse à partir de 1985. Depuis plus de trente ans, le mouvement est net, régulier et de grande ampleur. Le taux de suicides s’établissait au cours des années 1985 et 1986 à 22,5 pour 100 000 habitants, soit un niveau voisin des années précédant la Première Guerre mondiale, très proche du maximum jamais enregistré une seule fois dans notre pays (25 en 1908). Il est tombé en 2013 à 15,1 et à 13,8 en 2014, soit un niveau identique ou légèrement inférieur à celui que la France a connu dans les années 1950, dans l’immédiat après-guerre et au tout début des années de forte croissance : l’un des plus faibles qui ait jamais été enregistré au cours du XXe siècle, à l’exception des années de guerre. En résumé, au cours des trente dernières années, le taux de suicides est passé du niveau maximum au niveau minimum !

    Il ne s’agit pas d’un effet de structure provoqué par la fonte au cours de la période des effectifs de catégories particulièrement suicidaires, comme les agriculteurs ou les ouvriers. Ce mouvement à la baisse n’est pas non plus le fait d’une catégorie particulière de la population. Il affecte, bien qu’à des degrés divers, l’ensemble des composantes de la population, les hommes et les femmes, les jeunes et les vieux, les agriculteurs, les employés, les ouvriers et les cadres. C’est parmi les personnes âgées de plus de 60 ans que la baisse est la plus accentuée : sur les 9 715 décès par suicide enregistrés par l’Institut national de la santé et de la recherche médicale (Inserm) en 2012, la moitié (47 %) concerne des personnes de 55 ans et plus. La baisse la plus marquée du taux de suicides est observée dans les classes d’âge où les suicides sont les plus nombreux. Il en résulte une baisse importante du taux de suicides global. Une baisse du taux de suicides des jeunes ne se traduirait pas par une baisse « visible » du taux global. Le constat est clair, mais son explication n’est pas évidente.

    La forte hausse qui l’a précédée entre 1975 et 1985 était, en revanche, plus compréhensible. S’ouvre en effet à partir de la fin des années 1970, suite aux « chocs pétroliers », une nouvelle conjoncture économique qui met à mal nombre de protections et de sécurités dont jouissaient les travailleurs au cours des trente années de croissance. L’instauration d’un chômage de masse, durable et à un niveau élevé, en est le trait le plus marquant. La compétition internationale et la mondialisation des marchés conduisent les entreprises à s’adapter à la nouvelle donne : fermetures d’entreprises, délocalisations et vagues massives de licenciements d’un côté ; intensification du travail, précarisation des emplois et flexibilité croissante des rythmes de travail de l’autre. La dictature grandissante des impératifs du capital financier, de la spéculation boursière et des crises qu’elle entraîne ébranle durablement la société française dans son ensemble. Un monde nouveau est en train de naître, engendrant un surcroît d’incertitude et d’insécurité. La raideur de la pente ascendante de la courbe du suicide de 1975 à 1986 ressemble fort à celle qui a accompagné, à la fin du XIXe et au début du XXe siècle, la mutation d’une société paysanne et artisanale en une société industrielle et capitaliste.

    La baisse du suicide observée depuis 1985 étonne du fait qu’aucune des dimensions de cette nouvelle donne n’a aujourd’hui disparu. Le chômage demeure à un niveau élevé, les fermetures d’entreprise vont bon train, les salaires stagnent, des régions entières sont frappées par la désindustrialisation. Le cercle de la précarité s’est élargi, affectant désormais tous les secteurs d’activité et même la fonction publique. Et pourtant, le suicide baisse, même si, autour de la crise de 2008, une relation positive entre chômage et suicide a pu être observée chez les hommes en âge de travailler. Comment l’expliquer ?

    Répondre à cette question n’est pas simple, tant sont multiples et diverses les causes qui peuvent affecter l’évolution d’un phénomène aussi complexe que le suicide. (…) Cette tendance prononcée à la baisse n’est pas propre à la France. On l’observe dans un grand nombre d’autres pays. Le « Panorama de la santé » établi chaque année par l’OCDE en fait même état dans son édition de 2015 : « Depuis 1990, les taux de suicides ont diminué de 30 % environ dans les pays de l’OCDE et ont même été divisés par deux dans des pays comme la Hongrie et la Finlande. En Estonie, après une hausse initiale au début des -années 1990, les taux ont également fortement diminué. » Il ne s’agit donc pas d’un artefact produit par des modifications intervenues au cours de l’enregistrement statistique du phénomène en France.

    Le rôle des médecins généralistes
    À l’échelle mondiale, le taux de suicides standardisé selon l’âge, qui corrige les différences de taille et de pyramide des âges des populations dans l’espace et dans le temps, affiche de 2000 à 2012 une baisse de 26 % : 23 % chez les hommes et 32 % chez les femmes. Cette baisse affecte toutes les régions du monde à l’exception des pays pauvres d’Afrique et les hommes des pays les moins développés de la Méditerranée orientale.

    Dans les pays développés qui accusent une baisse sensible du suicide, les dates d’inflexion des courbes varient, mais se situent toutes dans les dernières des années 1980 et les premières des années 1990. Compte tenu de la diversité des situations économiques propres à tous ces pays, il est difficile d’établir une relation simple entre la baisse observée des taux de suicides et des facteurs économiques et sociaux qui seraient identiques et communs à tous ces pays. D’autant que dans aucun des pays de l’OCDE et de ceux de l’ancien bloc soviétique cette inversion des pentes du taux de suicides des années 1980 et 1990 ne correspond à une amélioration notable de la conjoncture économique.

    On est alors tenté d’aller chercher les causes de cette baisse spectaculaire ailleurs que dans les variations des conjonctures économiques, et pour commencer du côté des progrès réalisés dans le domaine médical. Existerait-il un lien entre ces baisses exceptionnelles et mondialisées du suicide et les débuts de la diffusion massive, elle aussi mondialisée, d’une nouvelle classe de médicaments, les antidépresseurs, pour soigner la dépression ? La mise au point et la diffusion de ces traitements sont récentes, les tout premiers datant des années 1960. Accueillis au départ avec scepticisme par les psychiatres, ils n’ont commencé à être utilisés à une large échelle que dans le milieu des années 1980, lorsque apparaît la classe des inhibiteurs de recapture de la sérotonine (IRS). Le plus connu d’entre eux est le Prozac, produit par le grand laboratoire américain Lily, qui devient très vite le troisième médicament le plus vendu au monde. Les facilités de son usage lui permettent d’être prescrit, dans la quasi-totalité des pays, par des médecins généralistes et pas seulement par des psychiatres.

    La consommation d’antidépresseurs a considérablement augmenté dans la plupart des pays de l’OCDE depuis le milieu des années 1980 et surtout depuis 2000. Toutefois, la consommation d’antidépresseurs est très variable d’un pays à l’autre. Leur niveau de consommation dépend de la prévalence de la dépression dans chaque pays et de la manière dont elle est diagnostiquée et traitée, mais aussi de la disponibilité d’autres thérapies, des recommandations locales et des habitudes de prescription. Avec 50 cachets pour 1 000 habitants par jour, la France se situe en dessous de la moyenne des 28 pays de ce classement (58 doses). Il n’en est pas de même pour tous nos voisins européens : au Por-tugal, par exemple, la consommation d’antidépresseurs a presque triplé entre 2000 et 2013, passant de 33 doses journalières à 88.

    En dehors des psychiatres qui affirment que, « bien prescrits, les antidépresseurs ont un effet antisuicidaire évident », un argument fort milite pour leur attribuer une part importante dans la baisse du suicide au cours des trente dernières années : cette baisse généralisée n’a pas substantiellement modifié la hiérarchie des pays. En effet, malgré la baisse notable qu’ils ont connue, les pays de l’ancien bloc de l’Est se distinguent toujours des autres par des taux de suicides très supérieurs, l’Italie et l’Espagne par des taux très inférieurs à ceux de leurs voisins européens. Elle n’a pas non plus affecté les grandes tendances observées au cours des périodes précédentes : les hommes se suicident toujours plus que les femmes, les vieux plus que les jeunes, les pauvres plus que les riches, etc. En somme, l’usage des antidépresseurs aurait agi sur le niveau du suicide en le faisant sensiblement baisser sans modifier qualitativement les facteurs sociaux qui le produisent.

    Après avoir été âprement discuté au sein de la psychiatrie, certains soulignant des risques accrus de suicide chez les jeunes provoqués par cette médication, l’effet bénéfique de l’usage des antidépresseurs sur la baisse du suicide semble aujourd’hui reconnu par tous les professionnels. Une grande enquête internationale publiée en juin 2013 analyse en détail les relations entre le taux de suicides et la consommation d’antidépresseurs. Portant sur 29 pays européens au cours d’une période étendue correspondant aux années d’inflexion de la courbe et de la baisse du suicide qui s’ensuivit (1980-2009), elle calcule dans chaque pays les corrélations entre la consommation d’antidépresseurs et le taux de suicides afin d’explorer le sens et l’ampleur des associations entre les deux phénomènes. Des régressions linéaires associées permettent ensuite de préciser la nature et l’évolution de ces relations. Les résultats sont clairs : dans tous les pays sauf un, le Portugal, le suicide diminue à mesure que s’accroît la consommation d’antidépresseurs.

    L’effet positif des antidépresseurs sur la baisse du suicide est aujourd’hui un fait avéré, mais le recours généralisé à ces médicaments n’a pas surgi du néant comme par un coup de baguette magique. Il est lui-même un effet des transformations notables intervenues en amont à la fois dans la prise en charge médicale des maladies mentales et dans la perception sociale de la dépression et du suicide. En France comme dans beaucoup de pays européens, toute une organisation sociale s’est progressivement mise en place pour prendre en charge les souffrances psychiques des individus. Les effectifs de « psys » au sens large (psychiatres, psychanalystes, psychologues, infirmières en psychiatrie) se sont étoffés et se sont répartis sur le territoire grâce à la sectorisation.

    Mutation culturelle
    Comparée à d’autres pays, l’offre de soins française en psychiatrie est de bonne qualité, notamment en termes d’équipement et de ressources humaines. Elle a aussi beaucoup innové par l’organisation pionnière, en réseau, de son offre hospitalière publique sur la base d’une sectorisation géographique originale : le « secteur psychiatrique ». Mis en place par la circulaire du ministère de la santé publique datée de mars 1960, celui-ci constitue l’unité de base de la délivrance de soins en psychiatrie publique. Il dispense et coordonne, pour une aire géo-démographique de proximité, l’ensemble des soins et services nécessaires à la couverture globale des besoins : prévention, soins, postcure et réadaptation. La prise en charge et la coordination des soins sont assurées par des équipes pluridisciplinaires. Avec 815 secteurs de psychiatrie générale, soit en moyenne un secteur pour 56 100 habitants âgés de plus de 20 ans, l’offre publique de psychiatrie représentait, en 2003, 80 % de l’activité psychiatrique réalisée par les établissements de santé. L’autorisation accordée aux généralistes de prescrire des antidépresseurs a aussi favorisé, lors des consultations, le dialogue sur les problèmes psychologiques. Parallèlement à la prise en charge médicale s’est développé, dans la plupart des pays développés, un tissu d’associations qui se sont donné pour mission la prévention du suicide.

    Toutes ces initiatives ont été rendues possibles par un changement radical intervenu dans la perception sociale des maladies mentales et du suicide. Le suicide a cessé progressivement d’être un tabou dont on ne parlait pas. La France comme la plupart des pays européens a connu depuis un demi-siècle une forte élévation de son niveau d’instruction. La part des emplois occupés par les cadres supérieurs et les professions intermédiaires s’élève à 43,1 % contre 48,4 % pour les employés et ouvriers. Or les catégories sociales les plus diplômées, davantage à l’écoute des messages de leur organisme, mieux -informées que les autres sur les possibilités de traitement, ont toujours développé un rapport aux soins qui privilégie l’anticipation. Elles consultent avant qu’il ne soit trop tard. Dans une France plus instruite où les professions supérieures sont aussi nombreuses, les maladies mentales ne sont plus associées à la folie ni perçues comme des tares irrémédiables condamnant nécessairement ses victimes à l’asile. Dans la conversation courante et dans tous les milieux, le terme de « déprime » a acquis droit de cité. C’est un mal répandu dont on mesure les risques mais dont on parle sans honte et dont on peut sortir, si on le prend à temps, et parfois en meilleure forme qu’avant. Le recours fréquent aux antidépresseurs est ainsi rendu possible et favorisé par cette mutation culturelle. La transformation médicale de la prise en charge de la déprime et du suicide ne se borne donc pas à la prescription d’antidépresseurs, même si celle-ci l’accompagne.

    Le prélèvement forfaitaire unique de 30 % sur les revenus du capital, mesure phare du programme présidentiel d’Emmanuel Macron, va coûter beaucoup plus d’argent à Bercy que le 1,5 milliard d’euros budgétisés, sans doute de l’ordre de dix fois plus. Cette faille remet fondamentalement en cause l’équilibre comptable du projet de loi de finances, et fait basculer une réforme fiscale déjà injuste vers l’iniquité la plus totale. Voici pourquoi.

    Jusqu’à présent, la fiscalité française tentait, tant bien que mal, de maintenir une certaine neutralité entre l’imposition des dividendes et celle des salaires. Une telle neutralité est essentielle au bon fonctionnement de l’impôt. Car si les revenus du capital sont moins taxés, alors tous ceux qui sont à la fois salariés et actionnaires de leur entreprise — patrons, entrepreneurs, cadres dirigeants et indépendants — ont intérêt à percevoir le fruit de leur labeur sous forme de dividendes plutôt que de revenus salariaux, siphonnant ainsi les recettes de la Sécurité Sociale et de l’Etat.

    Prenons un exemple concret, celui de Marcel, patron d’une grosse PME dont il possède 100 % du capital, et qui fait face au taux marginal supérieur de l’impôt sur le revenu. Il a le choix entre se verser un salaire, soumis aux cotisations, prélèvements sociaux et à l’impôt sur le revenu, ou à se payer sous forme de dividendes, soumis à l’impôt sur les sociétés — 25 % à l’issue du quinquennat — et à la « flat tax » Macron.

    Une faille similaire aux Etats-Unis

    Les réformes souhaitées par le nouveau pouvoir vont creuser un abîme entre ces deux options. Si Marcel choisit la voie « salaires », son taux marginal d’imposition sera, tout compris, de 65 % ; s’il choisit l’option « dividendes », il sera de 50 %. Soit une différence de 15 points, un écart considérable et sans précédent dans l’histoire de la fiscalité française.

    Faut-il s’en inquiéter ? Oui, car tous les éléments de preuve disponibles démontrent que les hauts revenus, bien conseillés par leurs gestionnaires de fortune et avocats fiscalistes, sont particulièrement sensibles à de tels écarts d’imposition.

    CETTE FAILLE REMET FONDAMENTALEMENT EN CAUSE L’ÉQUILIBRE COMPTABLE DU PROJET DE LOI DE FINANCES ET FAIT BASCULER UNE RÉFORME FISCALE DÉJÀ INJUSTE VERS L’INIQUITÉ LA PLUS TOTALE
    En 1993, la Finlande a adopté une réforme très similaire à celle aujourd’hui débattue au Parlement — impôt progressif pour les revenus du travail, « flat tax » pour les revenus du capital. Les résultats sont sans appel : la plupart de ceux qui l’ont pu ont basculé leurs revenus salariaux vers la nouvelle assiette plus avantageuse (« Income Shifting within a Dual Income Tax System : Evidence from the Finnish Tax Reform of 1993 », par Jukka Pirttilä et Håkan Selin, « The Scandinavian Journal of Economics », 2011).

    Les Etats-Unis ont une faille similaire — quoique d’ampleur beaucoup plus faible qu’en France, puisque l’écart de taux entre capital et travail n’y est que de 2,5 points (six fois moins qu’en France à l’issue du quinquennat Macron). Cet écart pourtant modéré donne lieu à des comportements d’optimisation fiscale massive.

    Des centaines de milliards de dollars déguisés en dividendes

    Une étude récente qui regarde à la loupe les millions de déclarations de revenus déposées par les hommes d’affaires outre-Atlantique montre ainsi que 54 % des dividendes que les patrons de PME, cadre dirigeants et indépendants se versent correspondent en fait à des revenus qui devraient être taxés comme du travail. Ce sont des centaines de milliards de dollars de salaires qui sont ainsi, chaque année, déguisés en dividendes dans le seul but de payer moins d’impôts (« Capitalists in the Twenty First Century », par Matthew Smith, Danny Yagan, Owen Zidar et Eric Zwick, juillet 2017, voir le lien PDF). Et cela même alors que cette manipulation est illégale, et que l’IRS, le fisc américain, n’est pas particulièrement réputé pour sa clémence ni pour son incompétence.

    En dépit de ces expériences internationales édifiantes, le projet de loi de finances fait l’hypothèse que la réforme Macron ne provoquera aucun comportement d’optimisation fiscale — d’où le faible coût budgété pour la « flat tax », 1,5 milliard seulement. Cette projection relève soit de l’incompétence pure et simple, soit de la volonté de tromper la représentation nationale et le pays.

    En réalité, si l’on fait des hypothèses prudentes, l’écart de 15 points entre taxation des salaires et des dividendes coûtera à terme 10 milliards par an. Si les Français qui le peuvent optimisent autant que leurs homologues américains, le manque à gagner pour la Sécurité sociale et le budget de l’Etat pourrait atteindre les dizaines de milliards d’euros chaque année. Un cadeau fiscal d’ampleur bien supérieure à la suppression de l’ISF, qui n’a été soumis à aucune discussion publique, qui n’est pas budgétée, et que les parlementaires de La République en marche ont déjà votée une première fois, comme un seul homme.

      Dans une tribune du Monde, l’économiste Gabriel Zucman démontre de manière limpide que la « flat tax » coûtera au moins 10 milliards d’euros à l’Etat au lieu des 1,5 avancés. En cause, l’effet d’aubaine de ce bouclier du capital pour tous ceux qui, actuellement, complètent leur revenu en salaire ou honoraires.

      Dans ce cas, les cadeaux fiscaux totaux seraient de 16,5 milliards d’euros, soit plus que la baisse globale des dépenses publiques. Le projet de loi de finances 2018 est donc un budget insincère.

      Ce coût supplémentaire nous annonce en outre des baisses de dépenses publiques dans l’année à venir pour respecter la sacro-sainte règle d’or bruxelloise.

      Décidément, en enrichissant le capital, le gouvernement va appauvrir l’Etat et la nation.

It also had the potential to carve open a portal into the world of offshore finance, a place that the global elite has spent hundreds of millions of dollars to build and defend. In the offshore archipelago, their interests are hidden behind shell companies and trusts, their anonymity guaranteed under the law, from Delaware to the Bahamas to the South Pacific. James S. Henry, a former chief economist at McKinsey, calls the offshore financial world the “economic equivalent of an astrophysical black hole,” holding at least $21 trillion of the world’s financial wealth, more than the gross domestic product of the United States.

    This darkness shields the tax-averse businessman and the criminal alike. Dictators use the offshore system to loot their own countries. Drug lords use it to launder money. As Gabriel Zucman, a University of California economist and an offshore expert, puts it: “They use the same banks, they use the same incorporation agents to create shell companies, they send money in the same ways.”

      Une atteinte à la « sécurité nationale »

      Avec, en filigrane, cette question : les Etats-Unis utilisent-ils leur droit comme une arme pour étendre leur pouvoir sur la planète, au détriment du droit international et de la souveraineté des Etats ?

      En règle générale, le droit pénal d’un Etat s’applique aux faits commis sur son territoire. Mais le législateur peut élargir les compétences pénales de ses juridictions à des faits commis à l’étranger. Les Etats-Unis, comme la France d’ailleurs, ont de longue date étendu leur autorité hors de leurs frontières pour des faits ayant des effets sur leur sol, ou commis par des nationaux à l’étranger, ou encore portant atteinte à leur « sécurité nationale ».

      Ce dernier motif est régulièrement invoqué pour voter les régimes d’embargo contre les « Etats ennemis », dans une acception qui s’est considérablement élargie avec le Patriot Act de 2001 : la loi visait aussi « le blanchiment d’argent servant […] au financement du terrorisme menaçant non seulement la sécurité des Etats-Unis, mais aussi tout le système économique et financier mondial dont dépendent la prospérité et la croissance ». De quoi rendre la compétence des juridictions américaines universelle.

      Au début des années 2000, et plus encore depuis la crise des subprimes, les autorités américaines se sont érigées en gendarme vis-à-vis d’entreprises étrangères pour des faits commis hors de leurs frontières. Elles ont durci à leur encontre l’application de lois anciennes destinées à lutter contre la corruption internationale, le blanchiment d’argent d’origine criminelle et les pratiques mafieuses.

      Un rattachement territorial de plus en plus ténu

      Pour établir leur compétence, elles ont élargi les liens de rattachement à la législation américaine : qu’il s’agisse, dans les affaires de corruption, de sociétés cotées ou émettrices à Wall Street, comme Alcatel-Lucent, Alstom, Technip et Total, poursuivis sur la sincérité de leurs comptes ; de sociétés ayant une filiale sur le sol américain, comme Alcatel-Lucent et Alstom ; ou de sociétés dont les mails mentionnant les faits incriminés ont transité par des serveurs localisés aux Etats-Unis, comme Magyar Telekom, en 2011.

      Dans les affaires de violation d’embargo, comme celle de BNP Paribas, accusé d’avoir financé depuis la Suisse des opérations avec des acteurs basés à Cuba, en Iran, au Soudan et en Libye, les autorités ont invoqué l’existence de transactions en dollars ayant transité par la chambre de compensation Swift, située sur le territoire américain.

      Ainsi le rattachement territorial apparaît-il de plus en plus ténu. Jusqu’à disparaître quand, en 2010, le Congrès vote le Fatca (Foreign Account Tax Compliant Act), qui contraint les banques étrangères dans le monde entier à livrer les informations nominatives sur leurs clients américains sans limite de territorialité.

      « Task force »

      Toutes nos données numériques étant stockées sur des serveurs américains, échapper à la loi américaine paraît difficile. D’autant que le Department of Justice (DOJ) a mis en place un dispositif de poursuites qui se révèle, avec les années, d’une redoutable efficacité. Depuis la loi Dodd-Frank de 2010, les autorités reversent aux lanceurs d’alerte entre 10 % et 30 % des sanctions.

      Et pour monter des dossiers sur les entreprises ciblées, les différentes agences ou institutions, à savoir la SEC (Securities and Exchange Commission), la Réserve fédérale, l’IRS (Internal Revenue Service), l’OFAC (Office of Foreign Assets Control), le département des services financiers de l’Etat de New York, mais aussi la CIA et la NSA, travaillent en task force et se répartissent les amendes récoltées. Les Etats-Unis auraient même mis en place en 2009 un système de suivi en temps réel des transactions en dollars dans le monde.

      Un dispositif efficace

      Surtout, le département de la justice a étendu la procédure pénale négociée à tous ces domaines où il entend faire valoir son droit, en « proposant » aux entreprises visées soit de coopérer, soit de prendre le risque dévastateur d’un procès. En clair, pour suspendre les poursuites judiciaires et pour qu’elles puissent continuer à travailler aux Etats-Unis, les entreprises visées doivent s’engager à faire réaliser à leurs frais une enquête interne approfondie sur les faits présumés, à en communiquer les résultats aux autorités, à s’acquitter d’une « amende négociée » et, enfin, le plus souvent, à accepter la nomination d’un contrôleur interne.

      Par cette « procédure négociée » qui écarte la menace administrative du retrait d’une licence bancaire ou du droit de travailler aux Etats-Unis, les entreprises renoncent à se défendre devant un juge. Ce dispositif est si efficace qu’il a permis au département de la justice de prononcer des sanctions record à l’encontre de sociétés européennes, qui se chiffrent en milliards de dollars.

      « Les différentes administrations judiciaires américaines sont devenues de véritables chasseurs de primes qui cherchent à se financer sur le résultat de leurs poursuites, dénoncent Pierre Lellouche et Karine Berger. Elles vont là où elles rencontreront le moins de résistance, et visent notamment les concurrents des entreprises américaines. »

      Depuis 2008, les entreprises européennes ont versé 6 milliards de dollars (5,4 milliards d’euros) aux Etats-Unis pour violation de la loi anticorruption ; et, depuis 2009, les banques européennes se sont acquittées de 16 milliards de pénalités pour non-respect des sanctions économiques imposées par Washington. Sans compter les sanctions pour les autres affaires… « Un véritable prélèvement sans contrepartie sur les économies européennes et le niveau de vie de leurs citoyens », dénoncent les députés.

      Le droit est devenu une arme

      Ces sanctions économiques seraient-elles l’outil alternatif d’une diplomatie qui, après les déboires en Afghanistan et en Irak, craint les interventions militaires, comme l’auraient évoqué certains diplomates devant la mission parlementaire ? En tout cas, elles légitiment la question que tout le monde se pose : l’utilisation de l’arme du droit par les Etats-Unis porte-t-elle atteinte au droit international et à la souveraineté des Etats, comme l’affirment les députés, qui relèvent le refus de coopérer des autorités judiciaires américaines avec les Etats européens ?

      Si tout le monde reconnaît que le droit est devenu une arme au même titre que l’armée et la monnaie, les juristes sont très partagés sur cette question. « En matière de corruption, les pratiques américaines s’inscrivent dans la convention de l’OCDE de 1997, qui autorise les Etats à réprimer pénalement des actes réalisés hors de leurs frontières par des personnes morales étrangères si tout ou partie de l’infraction se déroule sur leur territoire, analyse Régis Bismuth, professeur de droit international public à l’université de Poitiers. Il appartient à l’Etat de rattacher l’infraction à son territoire. En revanche, en matière de violation d’embargo, les sanctions ne s’inscrivent que dans une politique étrangère décidée unilatéralement par un Etat. Aussi devraient-elles pouvoir être portées devant l’Organisation mondiale du commerce [OMC]. »

      « Il n’y a pas de véritable extraterritorialité du droit américain, car les décisions des tribunaux des Etats-Unis ne s’appliquent que sur leur territoire, à l’encontre de personnes physiques et morales ayant un lien avec le territoire, estime, lui aussi, Serge Sur, professeur émérite à l’université Paris-II-Panthéon-Assas. Les autres Etats ne sont pas tenus de reconnaître ces décisions, et les sociétés étrangères visées ne sont pas obligées de les respecter. Il n’y a pas abus de droit à proprement parler. Même si, dans les faits, ces décisions ont bel et bien des effets extraterritoriaux, car les grandes entreprises étrangères travaillent toutes aux Etats-Unis et ne peuvent renoncer au premier marché mondial. Mais c’est une situation de fait, et non de droit, liée à la puissance américaine et à la monnaie internationale qu’est le dollar. »

      Les Etats-Unis, gendarme de la planète

      Ainsi, à l’instar de la Chine, les Etats-Unis utilisent l’accès à leur marché pour contraindre les entreprises étrangères à se soumettre à leurs règles. Comme le résume l’avocat Laurent Cohen-Tanugi, « les cas d’extraterritorialité stricto sensu du droit américain sont finalement assez rares. Le vrai problème est le choc culturel de la procédure pénale américaine, qui contraint les entreprises visées à une coopération immédiate et sans réserve avec les autorités et à la mise en place de programmes de conformité. Ce que l’on nomme l’“impérialisme juridique américain”, c’est l’obligation de se plier à la culture juridique américaine dans une économie mondialisée où l’extraterritorialité devient la norme, mais où les Etats-Unis restent le gendarme de la planète ».

      C’est donc pour conserver leurs clients américains ou ceux travaillant avec les Etats-Unis que les entreprises étrangères se soumettent aux règles des Etats-Unis. Plus que l’extraterritorialité du droit américain, c’est la puissance de l’économie américaine qui fait la force contraignante de son droit.

      Reste néanmoins une question, celle du rôle du billet vert : « Le dollar étant la monnaie internationale incontournable, il donne une compétence universelle aux autorités judiciaires américaines, estime Régis Bismuth. Le privilège exorbitant de la monnaie devient un privilège exorbitant du droit. »

      « Le vrai sujet est plutôt de savoir comment les autorités judiciaires françaises et européennes peuvent utiliser des moyens similaires, juge pour sa part Stéphane Bonifassi, avocat à Paris. La transaction pénale introduite in extremis dans la loi Sapin 2 est certes un pas dans la bonne direction. But the arms race has metastasized to federal agencies with strictly regulatory or administrative functions. The Internal Revenue Service, for example, now spends more than $1 million annually on firearms, ammunition, and military gear, double what it was spending a decade ago. Since 2006, the Department of Veterans Affairs — which has been sharply criticized for episodes of fatal incompetence in patient care — has poured nearly $11.7 million into guns and ammo. Even the Smithsonian Institution and the Social Security Administration have each devoted hundreds of thousands of dollars to weaponry.

Despite it prominent location and length, the article never mentioned Haim Saban and his ilk financially supporting Hillary Clinton, legal discrimination against Palestinian Israelis and asylum seekers within the Green Line, the occupation and the construction of an apatheid state, Kerry’s failed peace talk initiative and the end of the two state option, Martin Indiyk blaming the Israeli government for the failed peace talks, Israel’s refusal to define its own borders, many ed-op pieces in the LA Times critical of the Israeli government, J Street, JVP, local groups like LA Jews for Peace, 42 US vetoes to protect Israel from sanctions at the UN Security Council, killing of the Goldstone Report, investigations of the IRS tax exempt status for philanthropies supporting settlers and Jewish terrorists, Avidgor Lieberman’s new role as the civilian head of the Israeli Military, and the increased US military sales to Israel totally $3.5 billion, intelligence sharing, and many violations of the Leahy and US Arms Export Acts.

    A significant factor in the decline of the quality of jobs in the United States has been employers’ increasing reliance on “non-regular” employees — a growing army of freelancers, temps, contractors, part-timers, day laborers, micro-entrepreneurs, gig-preneurs, solo-preneurs, contingent labor, perma-lancers and perma-temps. It’s practically a new taxonomy for a workforce that has become segmented into a dizzying assortment of labor categories. Even many full-time, professional jobs and occupations are experiencing this precarious shift.
    This practice has given rise to the term “1099 economy,” since these employees don’t file W-2 income tax forms like any regular, permanent employee; instead, they file the 1099-MISC form for an IRS classification known as “independent contractor.”
