    Kuala Lumpur, Malaysia - Many of the approximately 150,000 (PDF) Rohingya who live in Malaysia came here hoping to be relocated to other countries through UNHCR programmes, but some of them have made Malaysia their home, despite the fact that they have no legal status and face many hardships as a result.

    Many Rohingya refugee children are born in Malaysia, and remain stateless owing to the undocumented status of their parents.

    According to Chia Wei, founder of The Berani Project, the main consequences of this undefined status and lack of identification documents is that the children are “cut off [from] the basic child’s rights to education [and] healthcare.”

    The Berani Project is a social enterprise advocating and creating opportunities for the Rohingya communities and other marginalised people in Kuala Lumpur. Wei explains that “many [children] are forced to work from a young age to help their families”.

    Aung San Suu Kyi, dirigeante de facto du Myanmar, a rejeté les appels de l’ONU pour enquêter sur la situation vécue par la soi-disante minorité ethnique Rohingya du pays. Il y a eu une éruption de violence dans la province d’Arakan en octobre 2016, lorsque des terroristes djihadistes ont attaqué un barrage de police le long de la frontière bangladaise, tuant neuf policiers.

    Cet attentat fut imputé à l’Organisation de Solidarité Rohingya (RSO, Rohingya Solidarity Organisation), une organisation terroriste djihadiste pourvue de liens avec l’Arabie Saoudite. Des groupes de défense des droits de l’homme en cheville avec le State Department US ont lancé un appel concerté à la « communauté internationale » pour qu’elle agisse afin de prévenir le « génocide » de la minorité Rohignya, après que les troupes birmanes aient déclenché une opération militaire visant à écraser l’insurrection islamiste. Le Bureau du Haut Commissaire des Nations Unies aux Réfugiés (UNHCR) a accusé le gouvernement du Myanmar de génocide, sur les bases des rapports douteux des organisations sus-mentionnées qui possèdent un historique étoffé de diffusion de mensonges et de désinformation, visant à justifier des guerres d’agression grimées en « interventions humanitaires ».

    Le gouvernement birman a nommé une commission pour investiguer les allégations de crimes d’état en province d’Arakan. Le sort des Rohingyas a reçu une couverture médiatique touffue ces dernières années. Les Rohingyas sont en réalité des Musulmans bengalis qui migrent vers l’ancienne province britannique d’Arakan depuis le 19ème siècle, lorsque l’Empire Britannique y installa des propriétaires terriens venant des « Chittagong Hill Tracts » (région montagneuse de Chittagong, au sud-est du Bangladesh) pour cultiver la terre. La province possède bien une histoire islamique glorieuse, remontant au XVème siècle ; mais la population bouddhiste n’est devenue minoritaire dans l’Arakan septentrional qu’au cours des dernières décennies.

    Des milliers de femmes bouddhistes ont été violées et assassinées par des Musulmans bengalis ; de cela, les médias occidentaux ont à peine parlé, voire pas du tout. En lieu et place, l’attention a été portée sur la diabolisation des moines nationalistes qui œuvrent à favoriser un boycott de ce qu’ils perçoivent comme une tentative, menée par les Musulmans bengalis, pour procéder au nettoyage ethnique de la province. Aucune investigation objective des violences ethniques ensanglantant la province n’a été menée par la presse occidentale. Au lieu de cela, les moines nationalistes ont été décrits comme étant « racistes », et de nombreuses vidéos mal traduites et hors de contexte ont été produites pour appuyer ce discours.

    Aung San Suu Kyi a été un atout de l’impérialisme britannique et étasunien depuis le soulèvement 8888 appuyé par la CIA de 1988, qui visait à renverser le régime nationaliste et à installer un dirigeant fantoche favorable à l’Occident à sa place. L’espoir avait toujours été qu’elle ouvre le pays riche en minéraux aux entreprises occidentales. Cependant, la « communauté internationale », c’est-à-dire les USA et leurs états vassaux, a récemment exprimé ses regrets face au rythme jugé lent des réformes économiques dans le pays, depuis qu’elle a été élue pour le diriger en 2015 : Aung San Suu Kyi devait livrer le Myanmar sur un plateau aux intérêts occidentaux, mais jusqu’ici elle n’a pas encore livré la marchandise.

    À la tête de la Ligue Nationale pour la Démocratie, Aung San Suu Kyi semble désormais défier la communauté internationale – en jouant la carte nationaliste. Avec l’Occident en déclin terminal, il est probable que Suu Kyi ait compris que les réels intérêts du pays se situent dans le rapprochement avec la Chine. Terreau de tensions ethniques, la Birmanie pourrait aussi avoir à faire face, entre autres, à une insurrection provoquée par l’État Islamique et l’Armée pour l’Indépendance Kachin. Le pays tient ses premières élections partielles depuis l’avènement d’Aung San Suu Kyi au pouvoir en 2015 et les tensions ethniques sont déjà palpables. Selon des rapports, des activistes du NLD auraient été menacés dans l’État de Shan par l’armée de l’État de Shan. L’Union du Myanmar est fragile et des puissances étrangères pourraient facilement déstabiliser le pays si le NLD choisissait de rejeter l’Occident au profit de la Chine.

    Les Rohingyas ont reçu le soutien du milliardaire des fonds spéculatifs George Soros, dont les Fondations « Open Society » promeuvent un agenda néolibéral vendu sous l’habit de « droits de l’homme » et de « démocratie ». Des défenseurs du récit des Rohingyas ont souligné que l’armée birmane entretient des liens étroits avec Israël, et que la violence à l’encontre de la minorité Rohingya a été attisée par Tel-Aviv. De fait, les militaires birmans ont des rapports étroits avec Israël et des agents israéliens attisent l’islamophobie dans le pays ; mais la Russie et la Chine ont aussi des rapports étroits avec Israël. Cela signifie-t-il que la répression chinoise contre les terroristes ouïghours soutenus par l’Occident, et la guerre en cours de la Russie contre des djihadistes au nord du Caucase font également partie d’une conspiration sioniste ? Allons donc…

    Le conflit au Myanmar est extrêmement complexe mais le récit construit par le complexe militaire/industriel/médiatique/du renseignement/humanitaire imputant tous les problèmes du pays au gouvernement ressemble aux premiers stades de la campagne terroriste appuyée par l’Occident contre la Libye, la Syrie et plusieurs autres pays. Aung San Suu Kyi travaille peut-être toujours pour le compte de ses sponsors occidentaux ou elle a pu choisir de suivre dans les pas de son père, qui avait trahi ses soutiens impérialistes japonais pour suivre une ligne nationaliste.

    Peut-être Aung San Suu Kyi a-t-elle appris une leçon importante pendant ses années sous résidence surveillée, aux mains du régime militaire : le pays ne se développera jamais s’il se vend complètement à la « communauté internationale ». Au cours du siècle chinois il n’y a qu’une ceinture, et qu’une route – One Belt, One Road.

    Plusieurs cercles élitistes d’Europe et des États-Unis appellent à la révocation du Prix Nobel d’Aung San Suu Kyi. Elle est confrontée à un choix clair : expulser toutes les ONGs étrangères et s’orienter plus près de la Chine économiquement et militairement, garantissant ainsi un avenir au pays, ou alors ployer devant la pression néocoloniale occidentale, en cédant du terrain sur le thème des Rohingyas. Si elle opte pour la première option, elle rejoindra Qaddafi et Assad dans la galerie occidentale des affreux. Mais elle peut remporter la guerre si elle campe fermement sur ses positions, et pourrait devenir une bonne candidate pour le Prix Confucius de la Paix – la médaille arborée par ceux qui sont vraiment en pointe, dans la voie de la paix et du développement.

  • A la recherche d’un refuge en Israël : questionnement sur les demandeurs d’asile venus d’Erythrée

    C’est à la lecture de ces mots, prononcés en mai 2012 par Miri Regev, ministre israélienne de la culture, que j’ai décidé d’effectuer un travail de recherche sur la situation des demandeurs d’asile africains en Israël, au sein du Centre de Recherche Français à Jérusalem (CRFJ) durant l’été 2015. En raison de ma formation académique très centrée sur les droits de l’homme, cette expression m’a choquée au premier abord, puis elle m’a donné envie de réfléchir. En effet, Israël fait face depuis une décennie à une arrivée massive de migrants venus du Soudan et des pays de la Corne de l’Afrique, principalement d’Érythrée. Il ne s’agit pas d’une immigration appuyée par le pays d’accueil pour des raisons religieuses comme cela avait pu être le cas dans les années 1980 avec les juifs éthiopiens. En effet, les opérations « Moïse » et « Salomon »[2] menées par Israël et les Etats-Unis pour les sauver de la grande famine touchant à cette époque le pays, ont été grandement motivées par des raisons religieuses et démographiques. Il s’agissait d’augmenter le nombre de juifs présents sur le territoire israélien. Ces deux « sauvetages en masse » conduiront ensuite 6 000 Ethiopiens à accomplir leur alya[3], mettant pratiquement fin à l’existence de la communauté juive d’Éthiopie, vieille de 3 000 ans.

    • Dangerous Exit: Who Controls How Syrians in Lebanon Go Home

      AS HALIMA clambered into a truck leaving Lebanon in late June, she resolved that if the men driving the vehicle were arrested at the Syrian border, she would get out and walk back to her village on her own. The 66-year-old grandmother had not seen the son and daughter she left behind in Syria for five years. Wearing an embroidered black dress and a traditional headdress, her crinkled eyes shone with determination. “I’m coming back to my land,” she said.

      Having begged her not to leave, Halima’s two daughters staying in Lebanon wept on her shoulders. “We’re afraid she won’t come back,” 42-year-old Sherifa said, as her voice cracked. Sherifa cannot follow her mother to Syria; her eldest son, who has single-handedly kept the family afloat with odd jobs because of his father’s disability, would be sent to war.

      Huddled in groups at the checkpoint in northeast Lebanon, other families also said their goodbyes. A teenage girl knelt on the dirt road, refusing to let go of her 19-year-old brother’s legs. Their mother, Nawal, held her as he left for a truck to the border. “I don’t know how he will live on his own in Syria. Only God knows what will happen to him,” Nawal said. “I didn’t think he would actually leave. It all happened very fast.”

      A few months earlier, 3,000 Syrians in the Lebanese border town of Arsal had registered their names with Syrian and Lebanese intelligence agencies to return to their villages just over the mountains in Syria’s Qalamoun region. When the first group of several hundred people was approved to leave on June 28, many families were separated, as some members either decided not to register or were not approved by Syrian authorities.

      “We need a political solution for these people to go back, but the politics doesn’t start here in Lebanon,” a Lebanese intelligence agent said, as a scuffle broke out that scorching June morning. A Syrian man lunged at Khaled Abdel Aziz, a real estate businessman who had been put in charge of signing up fellow refugees to return. Abdel Aziz sweated in his suit as he dashed between television interviews, repeating that Syrians had a country of their own to go back to. “You’re protecting the army, not protecting yourself,” the man yelled, before being pulled away.

      The TV cameras rolled as dozens of trucks and tractors piled high with timber, water tanks and chicken coops were checked off a list by Lebanese intelligence agents and headed with an army escort to the Syrian border. A line of TV reporters announced to their Lebanese viewers that these refugees were going home.

      The next day, on the other side of Arsal, a small group of refugees held a sit-in, to much less fanfare. “We’re asking for return with dignity,” one banner read, “with guarantees from the international community and the U.N.”

      “We’re not against the return, but we want conditions, guarantees,” said Khaled Raad, one of the organizers. His refugee committee has been petitioning the U.N. and sympathetic Lebanese politicians for international protection for returning Syrians for a year. “I mean, this is not like taking a cup of tea or coffee to say, after seven years, go ahead and return to your houses. It’s not an easy thing.”

      “WE NEED A POLITICAL SOLUTION FOR THESE PEOPLE TO GO BACK, BUT THE POLITICS DOESN’T START HERE IN LEBANON.”

      By then, Halima had arrived back in Syria. Apart from some tractors breaking down en route, they had no problem crossing the border. Halima went to stay with her son while she waited to hear about the situation in her hometown, the mountaintop village of Fleeta. Her granddaughters had grown up quickly while she was in Lebanon, and she loved spending time with them in the neighboring town.

      But as more of their friends and relatives returned to Fleeta, with subsequent groups departing Arsal in July, word came to the family of empty homes and little power, water or work in the Syrian village. Sherifa received messages from relatives who had returned to Fleeta but now wanted to escape again. With no easy way to come back to Lebanon legally, they planned to smuggle themselves back across the border.

      Without her mother, and with bad news from Fleeta making it less likely she would ever return to Syria, Sherifa became increasingly desperate. Her husband, who is unable to work for health reasons, sunk into depression. “By God, dying is better than living,” Sherifa said. “I seek refuge in God from this return.”

      LONGING FOR HOME, AFRAID TO RETURN
      RETURNING TO SYRIA during this eighth year of conflict is both an excruciating personal decision and a political calculation: by refugees, the government in Syria, and other nations with a stake in the war. As the government recaptures more territory from opposition groups, and fighting quells in certain areas, some refugees are considering returning, while others are terrified of the increasing pressure to go back. After Lebanon began organizing small group returns this year, including from Arsal, these dilemmas became more urgent.

      To return is to take a political gamble: Refugees must weigh the risks of staying against the risks of going. They try to figure out who can be trusted to tell them the truth. They gather snippets of information from their cities, towns and villages about what happens to people who return. They struggle to decipher the intentions of the mercurial and multi-layered Syrian authorities and their foreign allies.

      Some of the broader dangers are well-known: an estimated half a million people killed in Syria’s war, including thousands dead this year; some one million people forced to leave their homes this year alone; a third of all houses and half of all schools and hospitals damaged or destroyed; in government-controlled areas, mandatory conscription into battle for men under 43, fear of arrest and torture, and the difficulties of reintegrating into a society and economy fractured by war.

      Until now, few refugees have considered this a risk worth taking. In 2017, the U.N. said 77,300 refugees went back independently to Syria, out of 5.6 million who had fled the country. The vast majority of Syrian refugees have consistently told U.N. and independent surveys they hoped to return home one day, but do not yet feel safe to do so.

      There are also risks to staying. More than 80 percent of Syrian refugees remain in three neighboring countries: Turkey, Lebanon and Jordan. There, they face soaring poverty, years out of work or school, lack of official documents, risk of arrest and, above all, an increasing public clamoring for Syrians to be sent back.

      In Lebanon, where at least 1.5 million Syrians have sought refuge – increasing the country’s population by a quarter – the pressure to leave is the most intense. Few Syrians have legal status, even fewer can work. Many towns have imposed curfews or carried out mass evictions. At the U.N. General Assembly last year, Lebanon’s president Michel Aoun insisted Syrians must return, voluntarily or not. “The claim that they will not be safe should they return to their country is an unacceptable pretext,” he told world leaders.

    • Turkish minister: 255,300 Syrian refugees have returned home

      Turkish Interior Minister Süleyman Soylu said on Sunday that 255,300 Syrian refugees have returned home over the past two years, the state-run Anadolu news agency reported.

      “Some 160,000 of them returned to the Euphrates Shield region after Turkey brought peace there,” added Soylu, speaking to reporters in the southern province of Hatay bordering Syria.

      Turkey carried out Operation Euphrates Shield between August 2016 and March 2017 to eliminate the terrorist threat along the border in the northern Syrian regions of Jarabulus, Al-Rai, Al-Bab and Azaz with the help of the Free Syrian Army.

      Expressing concern about a possible operation in the Idlib region of Syria by regime forces, the minister underlined that Turkey would not be responsible for a wave of migration in the event of an offensive.

      Soylu also noted that an average of 6,800 irregular migrants a day used to enter Greece from western Turkey in 2015 and that now it has been reduced to 79.

    • The fate of Syrian refugees in Lebanon. Between forced displacement and forced return

      Recent news reports have surfaced on a possible United States-Russia deal to arrange for the return of refugees to Syria—reports that coincided both with the announcement that thousands of Syrians have died in regime prisons, and with one of the worst massacres in the conflict, perpetrated by ISIS in the city of Swaida. The US-Russia deal has been welcomed by Lebanese politicians, particularly those who have been scheming to repatriate Syrians for years now. But, unsurprisingly, the absence of a clear and coherent strategy for repatriation by the Lebanese government puts Syrian refugees at grave risk.

      In June, UNHCR interviewed Syrian refugees in Arsal who had expressed their willingness to go back to Syria in order to verify that they had the documentation needed for return and to ensure they were fully aware of the conditions in their home country. In response, caretaker Foreign Minister Gebran Bassil accused the agency of impeding refugees’ free return and ordered a freeze on the renewal of agency staff residency permits.

      This tug of war raises two main questions: What are the conditions in Lebanon that are pushing refugees toward returning to Syria while the conflict is ongoing and dangers persist? And what are the obstacles preventing some Syrians from returning freely to their homes?

      Conditions for Syrians in Lebanon

      Syrians began fleeing to Lebanon as early as 2011, but the Lebanese government failed to produce a single policy response until 2014, leading to ad-hoc practices by donors and host communities.

      By the end of 2014, the government began introducing policies to “reduce the number of displaced Syrians,” including closing the borders and requiring Syrians to either register with UNHCR and pledge not to work, or to secure a Lebanese sponsor to remain legally in the country and pay a $200 residency permit fee every six months. In May 2015, the government directed UNHCR to stop registering refugees. These conditions put many Syrians in a precarious position: without documentation, vulnerable to arrest and detention, and with limited mobility. Municipalities have been impeding freedom of movement as well, by imposing curfews on Syrians and even expelling them from their towns.

      In addition to the difficulties imposed by the state, Syrians face discrimination and violence on a day-to-day basis. Refugee settlements have been set on fire, Syrians have been beaten in the streets, and camps are regularly raided by the Lebanese army. All the while, Lebanese politicians foster and fuel the hatred of Syrians, blaming them for the country’s miseries and painting them as existential and security threats.

      Despite the polarization among Lebanese politicians regarding the situation in Syria, there is a consensus that the Syrian refugees are a burden that Lebanon cannot bear. Politicians across the board have been advocating for the immediate repatriation of refugees, and state officials are beginning to take action. President Michel Aoun made a statement in May declaring that Lebanon would seek a solution regarding the refugee crisis without taking into account the preferences of the UN or the European Union. This was followed by Bassil’s move, to freeze the residency permits of UNHCR staff, the leading agency (despite its many shortcomings) providing services for, and protecting the interests of, Syrian refugees. While UNHCR maintains that there are no safe zones in Syria as of yet, Lebanon’s General Security has begun facilitating the return of hundreds of refugees from Arsal and nearby towns. This process has been monitored by UNHCR to ensure that the returns are voluntary. Hezbollah has also established centers to organize the return of Syrians to their homes in collaboration with the Syrian regime.

      Syrian regime obstructing refugees’ free return

      As the situation for Syrian refugees in Lebanon becomes more and more unbearable, conditions for them back home remain troubling. Since 2012, the Syrian regime has been taking deliberate measures that would effectively make the situation for returning Syrians extremely difficult and dangerous.

      Conscription

      Syrian males aged 18 to 42 must serve in the Syrian Armed Forces. While exemptions were allowed in the past, a decree issued in 2017 bans exemptions from military service. Refusing to serve in the Syrian army results in imprisonment or an $8,000 fine, which most Syrians are unable to pay, thus risking having their assets seized by the regime.

      Property as a weapon of war

      Law No. 66 (2012) allowed for the creation of development zones in specified areas across the country. Under the pretense of redeveloping areas currently hosting informal settlements or unauthorized housing, the law is actually being used to expropriate land from residents in areas identified in the decree, which are mostly former opposition strongholds such as Daraya and Ghouta.

      Law No. 10 (2018), passed in April, speeds up the above process. This law stipulates the designation of development or reconstruction zones, requiring local authorities to request a list of property owners from public real estate authorities. Those whose have property within these zones but are not registered on the list are notified by local authorities and must present proof of property within 30 days. If they are successful in providing proof, they get shares of the redevelopment project; otherwise, ownership reverts to the local authority in the province, town, or city where the property is located. Human Rights Watch has published a detailed Q&A that explains the law and its implications.

      These laws, coupled with systematic destruction of land registries by local authorities, fully equip the regime to dispossess hundreds of thousands of Syrian families. Reports indicate that the regime has already begun reconstruction in areas south of Damascus.

      Statements by Syrian officials

      Syrian officials have made several public statements that reveal their hostility toward refugees. On August 20, 2017, at the opening ceremony of a conference held by Syria’s foreign ministry, President Bashar al-Assad gave a speech in which he said: “It’s true that we lost the best of our young men as well as our infrastructure, but in return we gained a healthier, more homogeneous society.” On another occasion, Assad stated his belief that some refugees are terrorists.

      In September 2017, a video of Issam Zahreddine, a commander in the Syrian Armed Forces, went viral. In the video, Zahreddine threatens refugees against returning, saying: “To everyone who fled Syria to other countries, please do not return. If the government forgives you, we will not. I advise you not to come back.” Zahreddine later clarified that his remarks were meant for rebels and ISIS followers, but that clarification should be taken with a grain of salt given his bloody track record in the war up until his death in October 2017. Along similar lines, leaked information from a meeting of top-ranking army officers just last month reported the following statement by the head of the Syrian Air Force Intelligence administration, General Jamil Al-Hassan: “A Syria with 10 million trustworthy people obedient to the leadership is better than a Syria with 30 million vandals.”

      Unknown fate

      Considering the unwelcoming policies in Lebanon and the treacherous conditions in Syria, what is the fate of Syrian refugees, specifically those who oppose the Assad regime? Until now, the return championed by Lebanese politicians implies return to a fascist regime that has caused the largest refugee crisis since the Second World War and unapologetically committed countless war crimes. While Lebanese politicians continue to focus on repatriation, they are failing to acknowledge the major barriers preventing Syrians from returning home: the Assad regime and ongoing mass violence.

      We cannot speak of safe, dignified, and sustainable returns without demanding justice and accountability. Regime change and trials for those who committed war crimes over the span of the last seven years are a long way off, and all evidence currently points toward the Assad regime retaining power. Any strategy must therefore prioritize the safety of Syrians who are likely to be detained, tortured, and killed for their political views upon return, or simply denied entry to Syria altogether. Lebanese policy makers must take into account that Syrians residing in Lebanon are not a homogenous entity, and some may never be able to return to their homes. Those Syrians should not be forced to choose between a brutal regime that will persecute them and a country that strips away their rights and dignity. It is time for Lebanon to adopt clear policies on asylum, resettlement, and return that ensure the right of all Syrians to lead a safe and dignified life.

      La situation en Syrie est loin d’être stabilisée. Les besoins de financement, de nourriture de matériel sont même en constante augmentation. Selon un haut fonctionnaire de l’ONU, un éventuel assaut contre la dernière enclave rebelle pourrait entraîner une « catastrophe humanitaire ». Pourtant, alors que 12 millions de Syriens, soit près de la moitié de la population syrienne avant la guerre, a fui le pays ou a été déplacée à l’intérieur, la question du retour, étape indispensable à la reconstruction, commence à se poser.

      C’est le principal message ressorti de la conférence « Supporting the Future of Syria and the Region » , qui vient de se tenir à Bruxelles. Les diplomates européens ont mis l’accent sur les difficultés de l’Europe à isoler le Président Bashar al-Assad, vainqueur de la guerre, soutenu par la Russie et l’Iran, pendant que les États-Unis retirent leurs troupes.

      L’UE a rappelé qu’un soutien à la reconstruction à long terme dépendrait du processus de paix de l’ONU pour mettre fin à une guerre responsable de la mort de centaines de milliers de personnes.

      Les Européens sont toutefois divisés sur la question de la reconstruction du pays, dans la mesure où le processus de paix de l’ONU est bloqué, que l’intervention militaire russe de 2015 s’avère décisive et que les pays arabes voisins envisagent de rétablir des liens diplomatiques.

      « Les États-Unis se retirent et les Russes n’ont pas l’argent. Voilà le contexte », a expliqué un haut fonctionnaire de l’UE, cité par Reuters. L’Allemagne, la France et les Pays-Bas défendent ouvertement l’idée de libérer les fonds de reconstruction uniquement quand le pays aura démarré sa transition politique et que Bashar-al-Assad ne sera plus au pouvoir. Aucun représentant officiel de la Syrie n’a été invité à la conférence. L’Italie, l’Autriche et la Hongrie, grands détracteurs de la politique migratoire européenne, plaident en revanche pour une négociation avec les autorités syriennes pour que les millions de réfugiés puissent rentrer chez eux.

      Mogherini craint le « ni guerre ni paix »

      La cheffe de la diplomatie européenne, Federica Mogherini, a déclaré qu’il y avait un risque que le pays se retrouve coincé dans une situation de « ni guerre ni paix ». Le Haut Commissaire des Nations Unies pour les réfugiés, Filippo Grandi, a déclaré qu’il était prévisible que 2019 soit la première année depuis le début de la guerre « où il y aura plus de Syriens (réfugiés et déplacés internes) qui rentreront chez eux que de nouveaux déplacés. S’étant rendu en Syrie la semaine dernière, le Haut Commissaire a déclaré avoir été « marqué et touché » par la résilience du peuple syrien.

      « C’est dans un contexte de grandes destructions, avec des zones encore dangereuses et un manque de produits de première nécessité (nourriture, médicaments, eau) et d’emplois que de nombreux Syriens rentrent chez eux. Les agences humanitaires font ce qu’elles peuvent, mais un très grand nombre de déplacés internes et quelques réfugiés prennent la décision difficile de rentrer chez eux, et les besoins en produits de première nécessité ne font qu’augmenter », a-t-il expliqué, ajoutant que la plupart des réfugiés voyaient leur avenir dans leur pays natal et que « nous savons que 56 000 Syriens sont rentrés chez eux via des mouvements organisés l’année dernière, mais ce chiffre est certainement plus élevé ».

      Engagements financiers

      « Je suis heureux de vous annoncer que nous collaborons notamment avec le gouvernement syrien. Et j’aimerais particulièrement remercier la Fédération de Russie pour sa coopération face aux problèmes que le retour des réfugiés syriens implique pour eux », a ajouté Filippo Grandi. Dans le cadre de l’appel de l’ONU, 3,3 milliards de dollars seraient nécessaires pour venir en aide aux déplacés internes et 5,5 milliards de dollars pour les réfugiés et les communautés d’accueil dans les pays voisins.

      Le Secrétaire général adjoint aux affaires humanitaires, Marc Lowcock, a déclaré à la presse que les engagements financiers s’élevaient « au moins à 6,5 milliards de dollars » et peut-être même à près de 7 milliards de dollars. « C’est un très bon résultat, et si nous y parvenons vraiment en fin de compte, nous serons très heureux », a-t-il déclaré. Federica Mogherini a déclaré que l’UE contribuerait à hauteur de 560 millions d’euros pour venir en aide au peuple syrien durant l’année 2019 et que le même montant serait libéré les années suivantes.

      Filippo Grandi a également exprimé son inquiétude quant à la situation en déclin de la ville d’Idlib, près de la frontière turque. Près de 90 personnes y ont été tuées par des obus et des frappes aériennes, et la moitié d’entre elles étaient des enfants.

      « La pire des catastrophes humanitaires »

      « Permettez-moi de répéter ce que nous avons déjà dit à maintes reprises. Une attaque militaire d’envergure sur la ville d’Idlib occasionnerait la pire catastrophe humanitaire du 21ème siècle. Ce serait tout simplement inacceptable », a déclaré Filippo Grandi.

      Avec l’aide d’avions russes, l’armée syrienne a attaqué des villes au mains des forces rebelles dans la région d’Idlib, dernier bastion rebelle du pays. Ce bombardement a été le plus important depuis des mois. Les forces rebelles qui se sont battues depuis 8 ans pour faire tomber le Président al-Assad sont désormais confinées dans une enclave du nord est du pays, près de la frontière turque. Près de 4 millions de Syriens y vivent aujourd’hui, dont des centaines de milliers d’opposants au régime qui ont fui d’autres régions du pays.

      La Turquie, qui a commencé à patrouiller dans la zone tampon vendredi, a condamné ce qu’elle a qualifié de provocations croissantes pour mettre fin à la trêve et a averti qu’une offensive des forces russes et syriennes causerait une crise humanitaire majeure. De nombreux résidents sont exaspérés de l’incapacité des forces turques à répondre aux bombardements. L’armée syrienne a appelé au retrait des forces turques.

      L’enclave est protégée par une zone de « désescalade », un accord négocié l’an dernier par les pays qui soutiennent Bashar al-Assad, la Russie, l’Iran ainsi que la Turquie, qui avait auparavant soutenu les forces rebelles et envoyé des troupes pour surveiller la trêve.     • Assad asks Syrian refugees to come home — then locks them up and interrogates them

      Guarantees offered by the government as part of a ’reconciliation’ process are often hollow, with returnees harassed or extorted.

      Hundreds of Syrian refugees have been arrested after returning home as the war they fled winds down — then interrogated, forced to inform on close family members and in some cases tortured, say returnees and human rights monitors.

      Many more who weathered the conflict in rebel-held territory now retaken by government forces are meeting a similar fate as President Bashar al-Assad’s regime deepens its longtime dependence on informers and surveillance.

      For Syrian refugees, going home usually requires permission from the government and a willingness to provide a full accounting of any involvement they had with the political opposition. But in many cases the guarantees offered by the government as part of this “reconciliation” process turn out to be hollow, with returnees subjected to harassment or extortion by security agencies or detention and torture to extract information about the refugees’ activities while they were away, according to the returnees and monitoring groups.

      Almost 2,000 people have been detained after returning to Syria during the past two years, according to the Syrian Network for Human Rights, while hundreds more in areas once controlled by the rebels have also been arrested.

      “If I knew then what I know now, I would never have gone back,” said a young man who returned to a government-controlled area outside Damascus. He said he has been harassed for months by members of security forces who repeatedly turn up at his home and stop him at checkpoints to search his phone.

      “People are still being taken by the secret police, and communities are living between suspicion and fear,” he said. “When they come to your door, you cannot say no. You just have to go with them.”

      Returnees interviewed for this report spoke on the condition of anonymity or on the understanding that their family names would be withheld, because of security threats.

      Since the war erupted in 2011, more than 5 million people have fled Syria and 6 million others have been displaced to another part of the country, according to the United Nations – together representing slightly more than half the Syrian population.

      In the past two years, as Assad’s forces have largely routed the rebels and recaptured much of the country, refugees have begun to trickle back. The United Nations says that at least 164,000 refugees have returned to the country since 2016. But citing a lack of access, the United Nations has not been able to document whether they have come back to government- or opposition-held areas.

      Assad has called for more homecomings, encouraging returnees in a televised address in February to “carry out their national duties.” He said forgiveness would be afforded to returnees “when they are honest.”

      According to our data, you are the exception if nothing happens to you

      A recent survey of Syrians who returned to government-held areas found that about 75 percent had been harassed at checkpoints, in government registry offices or in the street, conscripted into the military despite promises they would be exempted, or arrested.

      “According to our data, you are the exception if nothing happens to you,” said Nader Othman, a trustee with the Syrian Association for Citizens’ Dignity, which said it had interviewed 350 returnees across Syria. “One of our most important takeaways is that most of those people who came back had thought that they were cleared by the regime. They thought their lack of opposition would protect them.”

      The Syrian government did not respond to multiple requests for comment about the treatment of returnees and other Syrians now back under government control.

      Outside Syria, many refugees say they were already apprehensive about going home, with fears over a lack of personal security only growing with reports that the government is reneging on its guarantees. Aid groups say there are few signs that a large-scale return will begin anytime soon.

      And in conversations with UN representatives, senior Syrian officials have made it clear that not all returnees are equally welcome. According to two European officials who recounted the conversations, individuals with links to opposition groups, media activism or humanitarian work will be least well received.

      But pressure on the refugees to return is rising across the Middle East, with Syria’s neighbours tightening restrictions on them in part to get them to leave.

      Homs

      Hassan, 30, left his home in the western province of Homs in 2013. Before returning at the end of last year, he secured what he believed were guarantees for his safety after paying a large bribe to a high-ranking security official.

      But officers from the state security directorate met him at the airport and took him for interrogation. “They knew everything – what I’d done abroad, which cafes I’d sat in, even the time I had sat with opposition supporters during football matches,” he recalled.

      A week later, he was arrested during a visit to a government registry office and taken to a nearby police station. In a dingy room, officers took turns beating and questioning him, he said, accusing him of ferrying ammunition for an armed opposition group inside Syria in 2014.

      “I kept telling them that they knew I wasn’t in the country then,” he said. “All they did was ask me for money and tell me that it was the way to my freedom.”

      At one point, he said, the guards dragged in a young woman he had never met. “They beat her with a water pipe until she screamed, (then) told me they would do the same if I didn’t cooperate,” Hassan said.

      He said he was released at the end of January after relatives paid another bribe, this time $7,000.

      Syrians returning from abroad, like Hassan, often have to gain security approval just to re-enter the country, in some cases signing loyalty pledges and providing extensive accounts of any political activities, according to documents listing questions to be asked and statements to be signed.

    • Weighed down by economic woes, Syrian refugees head home from Jordan

      Rahaf* and Qassem lay out their plans to return to Syria as their five-year-old daughter plays with her toys in their small apartment in the Jordanian capital, Amman.

      It is early October, six years after they fled their home in Damascus, and the couple have decided it’s time to give up trying to make a life for themselves in Jordan.

      Last year, 51-year-old Qassem lost his job at a cleaning supplies factory when the facility shut down, and Rahaf’s home business as a beautician is slow.

      For months, the couple have resorted to borrowing money from friends to cover their 200 Jordanian dinar ($282) monthly rent. They are three months overdue. “There’s nobody else for us to borrow money from,” explains Rahaf.

      Weeks later, Qassem crossed the border and headed back to their old neighbourhood, joining an increasing tide of Syrian refugees who are going home, despite the dangers and a multitude of unknowns.

      According to the UN’s refugee agency, UNHCR, 34,000 registered Syrian refugees have returned from Jordan since October 2018, when a key border crossing was reopened after years of closure. It’s a fraction of the 650,000 registered Syrian refugees remaining in Jordan, but a dramatic jump from previous years, when annual returns hovered at around 7,000.

      Syrian refugees from the other main host countries – Turkey and Lebanon – are making the trip too. UNHCR has monitored more than 209,000 voluntary refugee returns to Syria since 2016, but the actual figure is likely to be significantly higher.

      Some Syrian refugees face political pressure to return and anti-refugee rhetoric, but that hasn’t taken hold in Jordan.

      Here, many refugees say they are simply fed up with years spent in a dead-end job market with a bleak economic future. The uptick appears to be driven more by the fact that Syrians who wish to go home can now – for the first time in three years – board a bus or a shared taxi from the border, which is about an hour and a half’s drive north of Amman.

      People like Rahaf and Qassem are pinning their hopes on picking up what is left of the lives they led before the war. Their Damascus house, which was damaged in the conflict, is near Qassem’s old shop, where he used to sell basic groceries and cleaning supplies.

      Qassem is staying with relatives for now. But the family had a plan: if and when he gave the green light, Rahaf and their children would join him back in Damascus.

      While she waited for his signal, Rahaf sold off what little furniture and other possessions they acquired in Jordan. “Honestly, we’ve gotten tired of this life, and we’ve lost hope,” she said.
      Money problems

      Before he lost his job, Qassem endured years of verbal abuse in the workplace, and few clients made the trip to Rahaf’s home.

      When she tried to set up a salon elsewhere, their refugee status created bureaucratic hurdles the couple couldn’t overcome. “I did go ask about paying rent for one shop, and they immediately told me no,” Qassem said. “[The owners] wanted a Jordanian renter.”

      Their story echoes those of many other refugees who say they have found peace but little opportunity in Jordan.

      Syrian refugees need a permit to work in Jordan – over 153,000 have been issued so far – but they are limited to working in a few industries in designated economic zones. Many others end up in low-paying jobs, and have long faced harsh economic conditions in Jordan.

      Thousands of urban refugees earn a meagre living either on farms or construction sites, or find informal work as day labourers.

      Abu Omran, who returned to Syria three months ago, fled Damascus with his family in 2013, and for a while was able to find occasional car mechanic jobs in Amman. Work eventually dried up, and he struggled to find ways to make money that did not require hard manual labour.

      “He spent the past three years just sitting at home, with no job,” recalled Abu Omran’s wife, Umm Omran.

      Speaking to The New Humanitarian in her Amman living room several months after her husband’s departure, she was soon joined for coffee and cigarettes by her youngest son, 19-year-old Badr. Newly married, he wore a ring on one finger.

      Times were so hard for the family that Abu Omran left Jordan before he had a chance to attend the wedding, and Badr has also been contemplating a return to Syria – the country he left as a young teenager.

      Badr works in a factory near Amman that produces cleaning products, but the pay is low. And although his older brother brings in a small salary from a pastry shop, it’s getting harder and harder for the family to pull together their rent each month.

      “I’m not returning because I think the situation in Syria is good. But you don’t enter into a difficult situation unless the one you’re currently in is even worse.”

      Entering a void

      While return may seem the best option for some, there are still more unknowns than knowns across the border in Syria.

      President Bashar al-Assad’s government forces control most of the country, but there are still airstrikes in the rebel-held northwest, and the recent Turkish invasion of the northeast has raised new questions about the country’s future.

      “I’m not returning because I think the situation in Syria is good,” said Farah, a mother of three who spoke to TNH in September – about a month before she packed up her things to leave. “But you don’t enter into a difficult situation unless the one you’re currently in is even worse.”

      In 2012, Farah and her husband left their home in the Yarmouk Palestinian refugee camp on the outskirts of Damascus for Jordan, where she gave birth to her three children.

      Her husband suffers from kidney stones, and the manual labour he has managed to pick up is just enough for them to pay for the rent of a shared house – crammed in with two other refugee families.

      The vast majority of Syrian refugees in Jordan – including Farah and Abu Omran’s families – live in urban areas like Amman, rather than in the country’s three refugee camps. They are still eligible for aid, but Farah had decided by October that she was “no longer able to bear” the poverty in Amman, even though UN food vouchers had covered some of her expenses.

      She took her three young children and crossed the border into Syria to stay with her mother, who lives in a southeastern suburb of Damascus. TNH has not been able to contact her since.

      Farah’s husband stayed behind in Jordan, fearing arrest or forced military conscription by Syrian government authorities.

      This has happened to other people who have gone back to Syria from Jordan, Turkey, Lebanon, or other host countries. Despite promises to the contrary from the government, hundreds – and possibly thousands – of returnees have reportedly been detained.

      “There are issues with what information is made available to refugees… about what is going to happen to them on the other side, in Syria.”

      Lebanese authorities have also forcibly deported thousands of Syrian refugees, and Human Rights Watch says at least three of them were detained by Syrian authorities when they got back. It isn’t clear if any Syrians have faced the same fate returning from Jordan.

      Sara Kayyali, a researcher for Human Rights Watch based in Jordan, told TNH she has yet to verify reports of disappearance, conscription, and detainment of returnees from Jordan.

      “There are issues with what information is made available to refugees… about what is going to happen to them on the other side, in Syria,” said Kayyali. “Partially because people inside are too scared to talk about the conditions in government-held areas, and partially because the restrictions applied and the behaviour of the Syrian security forces is so arbitrary that it’s difficult to predict.”

      Kayyali pointed to the 30 Jordanian citizens detained in Syria since the border opened a year ago – Amman said they entered for tourism and were arrested without reason – as a sign of what could be to come for Syrians.

      “[If those threats] apply to Jordanians, then they’re most certainly going to be applied to Syrians, potentially on an even larger scale,” said Kayyali.

      There are other obstacles to return, or challenges for people who manage to get back, including destroyed homes and lost jobs. Healthcare and water provision is scattershot in certain parts of the country, while violence and war is ongoing in others.

      Francesco Bert, a UNHCR spokesperson in Jordan, said the agency “does not facilitate returns, but offers support to refugees if they voluntarily decide to go home”.

      Asked whether it is safe for refugees to go back to Syria, Bert said the agency “considers refugees’ decisions as the main guideposts”, but gives refugees considering or planning to return “information that might inform their decision-making”, to help ensure it is truly voluntary.
      The waiting game

      Despite the obstacles, more and more people are making the trip. But families often can’t travel back together.

      For Rahaf, that meant packing her things and waiting, before finally joining her husband last weekend.

      For Umm Omran, however, that means wondering if and when she will ever see her husband again.

      The family had hoped that Abu Omran could find a job repairing cars again in Damascus, and if that didn’t work out at least he could live rent-free with his sister’s family.

      But plans for his wife and sons to join him someday, once he had found his footing, now look increasingly unlikely.

      “He hasn’t said yet if he regrets going back home,” said Umm Omran, who communicates regularly via WhatsApp with her husband and other family members who never left Syria. They live in government-controlled Damascus and don’t give away much in their chats for fear of retaliation by security forces, who they worry could be monitoring their communications.

      What Umm Omran has managed to piece together isn’t promising.

      Her husband has yet to find a job in Damascus, and is beginning to feel like a burden at his sister’s home. Their own house, where he and Umm Omran raised their sons, is bombed-out and needs extensive repairs before anyone can move back in.

      For the time-being, Umm Omran has ruled out her own potential return to Syria, fearing her two sons would insist on joining her and end up being conscripted into the armed forces. So, for now, the family remains split in two.

      “When I ask him how things are going, he just says, ‘Thank God’. He says little else,” said Umm Omran, scrolling through chats on her mobile phone. “I think he’s upset about leaving us.”

      “The Libyan man said: ‘This is our territory,’” said Axel Steier, a spokesman for the German-based charity that performed its first rescues on Tuesday.

      “After a while, they fired shots,” he said, probably into the air or sea. No one was wounded.

      Afterward two Libyans boarded the Lifeline ship to try to persuade them to hand over some 70 migrants they had just taken off a wooden boat in international waters.

      “We told them we don’t return migrants to Libya. After a while, they gave up,” Steier said. The two men spent about 15 minutes on board, he said.

      A Libyan coast guard spokesman in Tripoli declined to comment, saying he was seeking information. Italy’s coast guard, which coordinates rescues, did not respond to repeated telephone calls.

      It was the latest incident reported between the Libyan coast guard and humanitarian rescue ships operating off North Africa. Financed, trained and equipped by Italy, the Tripoli-based coastguard is intercepting a growing number of migrant boats.

    • L’Onu vuole aprire un centro di transito per i profughi in Libia

      Un contingente di 250 guardie di sicurezza nepalesi arriverà in Libia in questi giorni per garantire sicurezza alla base militare dell’Onu di Tripoli. Se tutto andrà come previsto, spiega Roberto Mignone, capomissione dell’Alto commissariato delle Nazioni Unite per i rifugiati (Unhcr), all’inizio di novembre anche il personale internazionale dell’organizzazione, che dal 2014 si è spostato a Tunisi per ragioni di sicurezza, potrebbe tornare in Libia in pianta stabile.

      Certo, resta sempre il problema dei centri di detenzione in un Paese che non ha firmato la convenzione di Ginevra, ma alcune Ong italiane stanno entrando nei centri per verificare il rispetto dei più elementari principi umanitari. Sarebbero oltre 700mila i migranti identificati in Libia tra gennaio e febbraio dall’Oim, l’Organizzazione internazionale per le migrazioni. Ma non ci sono numeri precisi (si parla di altri 300 o 400mila migranti) sparsi in Libia in condizioni anche peggiori dei centri. Per il 63% si tratta di giovani provenienti dall’Africa sub-sahariana, per il 29% da quella settentrionale e per l’8% da Medio Oriente e Asia.

      A surge in migrants and refugees intercepted at sea by the Libyan authorities has seen at least 2,600 people transferred, in the past two months alone, to squalid detention centres where they face torture and extortion, Amnesty International said today.

      The global human rights organisation accuses European governments of complicity in these abuses by actively supporting the Libyan authorities in stopping sea crossings and sending people back to detention centres in Libya.

      Bien sûr, tous ces #centres_fermés de rassemblement de migrants ne peuvent pas être appelés camps. Cela évoquerait des images effrayantes : les camps de concentration nazis, le système des goulags soviétiques, les camps de réfugiés palestiniens de plusieurs générations, le camp de détention de Guantánamo.

      Non, en Allemagne, ces « #non-prisons » devraient être appelées « #centres_de_transit ». Un terme amical, efficace, pratique, comme la zone de transit d’un aéroport où les voyageurs changent d’avion. Un terme inventé par les mêmes personnes qui désignent le fait d’échapper à la guerre et à la pauvreté comme du « #tourisme_d’asile ». Les responsables politiques de l’UE sont encore indécis quant à la terminologie de leurs camps. On a pu lire le terme de « #centres_de_protection » mais aussi celui de « #plateformes_d’atterrissage_et_de_débarquement », ce qui fait penser à une aventure et à un voyage en mer.

      Tout cela est du #vernis_linguistique. La réalité est que l’Europe en est maintenant à créer des camps fermés et surveillés pour des personnes qui n’ont pas commis de crime. Les camps vont devenir quelque chose qui s’inscrit dans le quotidien, quelque chose de normal. Si possible dans des endroits lointains et horribles, si nécessaire sur place. Enfermer, compter, enregistrer.

      A year after shocking images purporting to show human beings being bought and sold in Libya caused a global outcry, the situation for migrants and refugees in the country remains bleak and in some respects has worsened, said Amnesty International.

      Findings published by the organization today highlight how EU member states’ policies to curb migration, as well as their failure to provide sufficient resettlement places for refugees, continue to fuel a cycle of abuse by trapping thousands of migrants and refugees in appalling conditions in Libyan detention centres.

      “One year after video footage showing human beings being bought and sold like merchandise shocked the world, the situation for refugees and migrants in Libya remains bleak,” said Heba Morayef, Middle East and North Africa Director for Amnesty International.

      “Cruel policies by EU states to stop people arriving on European shores, coupled with their woefully insufficient support to help refugees reach safety through regular routes, means that thousands of men, women and children are trapped in Libya facing horrific abuses with no way out.”

      Migrants and refugees in Libyan detention centres are routinely exposed to torture, extortion and rape.

      The UN refugee agency (UNHCR) has registered 56,442 refugees and asylum seekers in Libya and has repeatedly called on European and other governments to offer resettlement to refugees stranded in Libya, including through evacuation to Niger. However, only 3,886 resettlement places have been pledged by 12 countries and in total just 1,140 refugees have been resettled from Libya and Niger so far. Italy separately evacuated 312 asylum seekers from Libya directly to Italy between December 2017 and February 2018, but no further evacuations took place until the resettlement of 44 refugees on 7 November.

      Over the past two years EU member states have put in place a series of measures to block migration across the central Mediterranean, boosting the capacity of the Libyan Coast Guard to intercept sea crossings, striking deals with militias in Libya and hampering the work of NGOs carrying out search and rescue operations.

      These policies have contributed to a nearly 80% drop in the numbers crossing the central Mediterranean and arriving in Italy, from 114,415 between January and November 2017 to just 22,232 so far in 2018. There are currently around 6,000 refugees and migrants being held in detention centres in Libya.

      With the central Mediterranean sea route almost completely shut off, and the Libyan authorities keeping refugees in unlawful detention and refusing to release them to UNHCR’s care, the only way out of Libyan detention centres is through evacuation to another country via programmes run by the UN. For refugees, who cannot return to their home country, the lack of international resettlement places on offer has left thousands stranded in Libyan detention centres.

      The opening of a long promised UNHCR processing centre in Libya that would offer safety for up to 1,000 refugees by allowing them to relocate from the abusive detention centres has been repeatedly delayed. Its opening would undoubtedly be a positive step, but it would only assist a small proportion of refugees in detention and does not offer a sustainable solution.

      “At the same time as doing their utmost to stop sea crossings and helping the Libyan Coast Guard to intercept people at sea and send them back to notorious detention centres, European governments have catastrophically failed to offer other routes out of the country for those most in need,” said Heba Morayef.

      “While Europe fails to extend the desperately needed lifeline to save those stuck in Libya and at risk of abuse, it is time that the Libyan authorities take responsibility for their atrocious policies of unlawful detention and protect the human rights of all people in their territory.”

      Armed clashes in Tripoli between August and September this year have also made the situation for refugees and migrants more dangerous. Some of those held in detention centres have been wounded by stray bullets. There have also been instances where detention centre guards have fled to escape rocket attacks leaving thousands of inmates locked up without food or water.

      The publication of Amnesty’s findings is timed to coincide with a meeting of Libyan and other world leaders in the Italian city of Palermo on 12 and 13 November. This international conference is intended to find solutions to break the political stalemate in Libya. Amnesty International is calling on all those taking part in the conference to ensure that human rights of all people in the country, including refugees and migrants, are placed at the centre of their negotiations.

      An estimated 5,400 refugees and migrants are presently held in detention centres in Libya, of whom 3,900 are of concern to UNHCR. Over the past month, UNHCR has registered 2,629 persons of concern in detention centres in and around Tripoli. So far in 2018, UNHCR conducted 1,139 visits to detention centres and distributed CRIs to 19,348 individuals. Through its partner International Medical Corps (IMC), UNHCR continues to provide medical assistance in detention centres in Libya. So far in 2018, IMC provided 20,070 primary health care consultations in detention centres and 237 medical referrals to public hospitals. In detention centres in the East, UNHCR’s partners have so far provided 1,058 primary health care consultations and distributed CRIs to 725 individuals.

    • Libia, i minori abusati e torturati nei centri di detenzione per migranti finanziati dall’Ue

      I minori bloccati nei centri di detenzione in Libia, finanziati anche dall’Unione europea tramite il Fondo per l’Africa, subiscono abusi e soffrono di malnutrizione, secondo quanto riportato dal Guardian.

      I bambini hanno raccontato di essere stati picchiati e maltrattati dalla polizia libica e dalle guardie del campo, descrivendo la loro vita come “un inferno in terra”.

      Secondo i dati analizzati dal Guardian, in Libia esistono 26 centri dei detenzione dei migranti, ma il numero dei minori detenuti non è chiaro in quanto non esistono registi affidabili.
      Nonostante ciò, si pensa che siano più di mille i bambini presenti nei campi di detenzione in Libia.Secondo l’Unhcr, almeno 5.400 rifugiati sono detenuti in territorio libico.

      Le rivelazioni dei bambini, che rischiano di essere puniti dalle guardie per aver parlato con i media, forniscono il resoconto più dettagliato della vita nei campi di detenzione.
      Le denunce delle Ong – A inizio di novembre Amnesty International aveva già denunciato le condizioni insostenibili in cui i migranti erano costretti a vivere, raccontando come la tortura e i maltrattamenti fossero all’ordine del giorno.

      “C’è un vero e proprio disprezzo da parte dell’Europa e di altri Stati per la sofferenza di coloro che si trovano nei centri di detenzione”, si legge nel rapporto di Amnesty.

      Un ragazzo di 16 anni ha raccontato al Guardian cosa vuol dire viver nei centri di detenzione in Libia: “Sono qui da quattro mesi. Ho cercato di scappare tre volte per attraversare il mare diretto in Italia ma ogni volta sono stato catturato e riportato al centro di detenzione”.

      “Stiamo morendo, ma nessuno se ne sta assumendo la responsabilità. Dobbiamo essere portati in un posto sicuro, invece siamo rinchiusi qui 24 ore al giorno. Non vediamo l’alba e non vediamo il tramonto “.

      I centri sono progettati per mantenere i richiedenti asilo in Libia ed evitare che attraversino il Mediterraneo diretti verso l’Europa.

      L’Ue ha investito decine di milioni di euro per cercare di impedire ai richiedenti asilo provenienti da zone di conflitto, come l’Eritrea e il Sudan, di entrare in Europa.

      Le testimonianze – Un rifugiato eritreo di 13 anni rinchiuso in un campo di Tripoli ha raccontato che i detenuti ricevono solo una o due piccole porzioni di pasta in bianco al giorno.

      Malattie come la tubercolosi sono diffuse e in molti possiedono solo una maglietta e un paio di pantaloncini, inadatte alle temperature nei centri.

      “Non abbiamo niente qui, niente cibo, niente vestiti, niente telefoni. Mi mancano così tanto mia madre e mio padre”, ha detto il ragazzo.

      Nei giorni precedenti un rifugiato di 24 anni ha cercato di impiccarsi nella toilette di uno dei campi e un altro si è dato fuoco nel campo di Triq al Sikka di Tripoli.

      Un ragazzo eritreo di 17 anni che è fuggito da un centro di detenzione e ha raggiunto il Regno Unito aveva 50 cicatrici sul suo corpo, a dimostrazione delle torture subite in Libia.

      “Quello che giovani, donne, bambini e neonati stanno soffrendo nei centri di detenzione in Libia è uno dei più grandi fallimenti della nostra civiltà”, ha affermato Giulia Tranchina, del Wilsons solicitors, che rappresenta il diciassettenne eritreo.

      “I governi europei, a nostro nome, con il nostro denaro stanno pagando le autorità libiche, le milizie e i generali dell’esercito per continuare a detenere e torturare i profughi per assicurarsi che non arrivino in Europa”.

      Una portavoce dell’UNHCR ha dichiarato: “Siamo incredibilmente preoccupati per la situazione dei profughi e dei migranti detenuti in Libia. Le condizioni di detenzione sono terribili”.

    • Un #rapport de l’ONU met en lumière les «horreurs inimaginables» des migrants et réfugiés en Libye et au-delà

      Les migrants et les réfugiés sont soumis à des « horreurs inimaginables » dès leur arrivée en Libye, tout au long de leur séjour dans le pays et - s’ils parviennent à ce résultat - lors de leurs tentatives de traverser la Méditerranée, selon un rapport publié jeudi, par la mission politique des Nations Unies en Libye (#MANUL) et le Bureau des droits de l’homme des Nations Unies (HCDH).

      « Il y a un échec local et international à gérer cette calamité humaine cachée qui continue de se produire en Libye », a déclaré Ghassan Salamé, qui dirige la MINUS.

      Assassinats illégaux, détention arbitraire et tortures, viols collectifs, esclavage et traite des êtres humains, le rapport couvre une période de 20 mois jusqu’en août 2018 et détaille une terrible litanie de violations et d’exactions commises par divers agents de l’État, armés contrebandiers et trafiquants contre les migrants et les réfugiés.

      Les conclusions reposent sur 1 300 témoignages de première main recueillis par le personnel des droits de l’homme des Nations Unies en Libye, ainsi que sur des migrants qui sont rentrés au Nigéria ou ont réussi à atteindre l’Italie, retraçant tout le parcours des migrants et des réfugiés de la frontière sud de la Libye, à travers le désert jusqu’à la côte nord.

      Le climat d’anarchie en Libye fournit un terrain fertile pour les activités illicites, laissant les migrants et les réfugiés « à la merci d’innombrables prédateurs qui les considèrent comme des marchandises à exploiter et à extorquer », indique le rapport, notant que « l’écrasante majorité des femmes et des adolescentes »ont déclaré avoir été« violées par des passeurs ou des trafiquants ».
      Trafic d’êtres humains

      De nombreuses personnes sont vendues par un groupe criminel à un autre et détenues dans des centres non officiels et illégaux gérés directement par des groupes armés ou des gangs criminels.

      « D’innombrables migrants et réfugiés ont perdu la vie en captivité tués par des passeurs, après avoir été abattus, torturés à mort ou tout simplement avoir été laissés mourir de faim ou de négligence médicale », indique le rapport.

      « Dans toute la Libye, des corps non identifiés de migrants et de réfugiés portant des blessures par balle, des marques de torture et des brûlures sont fréquemment découverts dans des poubelles, des lits de rivière asséchés, des fermes et le désert. »

      Ceux qui réussissent à survivre aux abus et à l’exploitation, et à tenter la traversée périlleuse de la Méditerranée, sont de plus en plus interceptés - ou « sauvés » comme certains le prétendent - par les garde-côtes libyens. Depuis le début de 2017, les quelque 29 000 migrants renvoyés en Libye par les garde-côtes ont été placés dans des centres de détention où des milliers de personnes restent indéfiniment et arbitrairement, sans procédure régulière ni accès à un avocat ou à des services consulaires.

      Des membres du personnel de l’ONU se sont rendus dans 11 centres de détention où sont détenus des milliers de migrants et de réfugiés. Ils ont constaté des cas de torture, de mauvais traitements, de travaux forcés et de viols commis par les gardes. Les migrants retenus dans les centres sont systématiquement soumis à la famine et à des passages à tabac sévères, brûlés avec des objets chauds en métal, électrocutés et soumis à d’autres formes de mauvais traitements dans le but d’extorquer de l’argent à leurs familles par le biais d’un système complexe de transferts d’argent.
      Surpeuplement des centres de détention

      Les centres de détention se caractérisent par un surpeuplement important, un manque de ventilation et d’éclairage, et des installations de lavage et des latrines insuffisantes. Outre les exactions et les actes de violence perpétrés contre les personnes détenues, beaucoup d’entre elles souffrent de malnutrition, d’infections cutanées, de diarrhée aiguë, d’infections du tractus respiratoire et d’autres affections, ainsi que de traitements médicaux inadéquats. Les enfants sont détenus avec des adultes dans les mêmes conditions sordides.

      Le rapport signale l’apparente « complicité de certains acteurs étatiques, notamment de responsables locaux, de membres de groupes armés officiellement intégrés aux institutions de l’État et de représentants des ministères de l’Intérieur et de la Défense, dans le trafic illicite ou le trafic de migrants et de réfugiés ».

      Nils Melzer, expert indépendant des droits de l’homme des Nations Unies sur la torture, estime que, compte tenu des risques de violations des droits de l’homme dans le pays, les transferts et les retours en Libye peuvent être considérés comme une violation du principe juridique international du « non-refoulement », qui protège les demandeurs d’asile et les migrants contre le retour dans des pays où ils ont des raisons de craindre la violence ou la persécution.

      « La situation est abominablement terrible », a déclaré jeudi Michelle Bachelet, Haut-Commissaire des Nations Unies aux droits de l’homme. « Combattre l’impunité généralisée non seulement mettrait fin aux souffrances de dizaines de milliers de femmes, d’hommes et d’enfants migrants et réfugiés, à la recherche d’une vie meilleure, mais saperait également l’économie parallèle et illégale fondée sur les atteintes à ces personnes et contribuerait à l’instauration de l’état de droit et des institutions nationales ».

      Le rapport appelle les États européens à reconsidérer les coûts humains de leurs politiques et à veiller à ce que leur coopération et leur assistance aux autorités libyennes soient respectueuses des droits de l’homme et conformes au droit international des droits de l’homme et du droit des réfugiés, de manière à ne pas, directement ou indirectement, aboutir à ce que des hommes, des femmes et des enfants soient enfermés dans des situations de violence avec peu d’espoir de protection et de recours.

      EU and Italy Bear Responsibility, Should Condition Cooperation

      (Brussels) – European Union policies contribute to a cycle of extreme abuse against migrants in Libya, Human Rights Watch said in a report released today. The EU and Italy’s support for the Libyan Coast Guard contributes significantly to the interception of migrants and asylum seekers and their subsequent detention in arbitrary, abusive detention in Libya.

      The 70-page report, “‘No Escape from Hell’: EU Policies Contribute to Abuse of Migrants in Libya,” documents severe overcrowding, unsanitary conditions, malnutrition, and lack of adequate health care. Human Rights Watch found violent abuse by guards in four official detention centers in western Libya, including beatings and whippings. Human Rights Watch witnessed large numbers of children, including newborns, detained in grossly unsuitable conditions in three out of the four detention centers. Almost 20 percent of those who reached Europe by sea from Libya in 2018 were children.

      “Migrants and asylum seekers detained in Libya, including children, are trapped in a nightmare, and what EU governments are doing perpetuates detention instead of getting people out of these abusive conditions,” said Judith Sunderland, associate Europe director at Human Rights Watch. “Fig-leaf efforts to improve conditions and get some people out of detention do not absolve the EU of responsibility for enabling the barbaric detention system in the first place.”

      In a letter to Human Rights Watch as the report went to print, the European Commission indicated that its dialogue with Libyan authorities has focused on respect for the human rights of migrants and refugees, that the EU’s engagement in Libya is of a humanitarian nature, and that concrete improvements have been achieved though challenges remain.

      Human Rights Watch visited the #Ain_Zara and #Tajoura detention centers in Tripoli, the al-Karareem detention center in Misrata, and the Zuwara detention center in the city of the same name in July 2018. All are under the nominal control of the Directorate to Counter Illegal Migration (DCIM) of the Government of National Accord (GNA), one of two competing authorities in Libya. Human Rights Watch spoke with over 100 detained migrants and asylum seekers, including 8 unaccompanied children, and each center’s director and senior staff. Researchers also met with the head of DCIM; senior officials of Libya’s Coast Guard, which is aligned with the GNA; and representatives of international organizations and diplomats.

      Abdul, an 18-year-old from Darfur, was intercepted by the Libyan Coast Guard in May 2018, when he attempted to reach Europe to apply for asylum. He was subsequently detained in abysmal, overcrowded, and unsanitary conditions in the al-Karareem center. He said that guards beat him on the bottom of his feet with a hose to make him confess to helping three men escape. Abdul’s experience encapsulates the struggle, dashed hopes, and suffering of so many migrants and asylum seekers in Libya today, Human Rights Watch said.

      Senior officials in EU institutions and member countries are aware of the situation. In November 2017, EU migration commissioner, Dimitri Avramopoulos, said: “We are all conscious of the appalling and degrading conditions in which some migrants are held in Libya.” Yet since 2016, the EU and particular member states have poured millions of euros into programs to beef up the Libyan Coast Guard’s capacity to intercept boats leaving Libya, fully aware that everyone is then automatically detained in indefinite, arbitrary detention without judicial review.

      Italy – the EU country where the majority of migrants departing Libya have arrived – has taken the lead in providing material and technical assistance to the Libyan Coast Guard forces and abdicated virtually all responsibility for coordinating rescue operations at sea, to limit the number of people arriving on its shores. The increase in interceptions in international waters by the Libyan Coast Guard, combined with obstruction by Italy and Malta of rescue vessels operated by nongovernmental organizations, has contributed to overcrowding and deteriorating conditions in Libyan detention centers.

      Enabling the Libyan Coast Guard to intercept people in international waters and return them to cruel, inhuman, or degrading treatment in Libya can constitute aiding or assisting in the commission of serious human rights violations, Human Rights Watch said. EU and member state support for programs for humanitarian assistance to detained migrants and asylum seekers and for evacuation and repatriation schemes have done little to address the systemic problems with immigration detention in Libya, and serve to cover up the injustice of the EU containment policy.

      Libyan authorities should end arbitrary immigration detention and institute alternatives to detention, improve conditions in detention centers, and ensure accountability for state and non-state actors who violate the rights of migrants and asylum seekers. The authorities should also sign a memorandum of understanding with UNHCR, the United Nations refugee agency, to allow it to register anyone in need of international protection, regardless of nationality, in full respect of its mandate.

      EU institutions and member states should impose clear benchmarks for improvements in the treatment of migrants and conditions in detention centers in Libya and be prepared to suspend cooperation if benchmarks are not met. The EU should also ensure and enable robust search-and-rescue operations in the central Mediterranean, including by nongovernmental groups, and significantly increase resettlement of asylum seekers and vulnerable migrants out of Libya.

      “EU leaders know how bad things are in Libya, but continue to provide political and material support to prop up a rotten system,” Sunderland said. “To avoid complicity in gross human rights abuses, Italy and its EU partners should rethink their strategy to truly press for fundamental reforms and ending automatic detention.”

      #Matteo_de_Bellis, chercheur d’Amnesty International sur les migrations, revient sur les tortures et les violences contre les réfugiés et les migrants en Libye et l’incapacité honteuse de l’Europe à y mettre fin.

      Farah, un jeune homme somalien, sa femme et leur fille qui venait de naître avaient passé 12 heures en mer quand les gardes-côtes libyens ont intercepté leur canot. Le couple avait fui la Libye après plusieurs mois de torture dans un hangar dans lequel Farah était battu et sa femme était violée par des bandes criminelles libyennes essayant d’obtenir une rançon de leurs proches.

      Lorsqu’il a réalisé qu’il allait être renvoyé en Libye, le jeune homme de 24 ans a été pris de nausées. « Je savais qu’il valait mieux mourir que retourner en Libye, mais ils nous ont menacés avec des armes. »

      Farah, sa femme et son bébé ont passé les sept mois suivants dans deux centres de détention de Tripoli. « Il n’y avait pas de nourriture ou de soins pour mon bébé. Elle est morte à huit mois. Elle s’appelait Sagal. »

      Leur histoire n’est que l’une des nombreuses histoires déchirantes de violence et de cruauté inimaginable que j’ai pu entendre le mois dernier à Médenine, une petite ville du sud de la Tunisie, qui a accueilli un nombre limité mais constant de réfugiés et de migrants franchissant la frontière pour échapper à l’enfer de la Libye.

      Ce weekend, de nouveaux témoignages faisant état de torture dans le centre de détention de Triq al Sikka ont été recueillis. D’après ces informations, plus de 20 réfugiés et migrants, dont des enfants, ont été conduits dans une cellule en sous-sol et torturés individuellement, à tour de rôle, à titre de punition pour avoir protesté contre leur détention arbitraire dans des conditions déplorables et l’absence de solution. En réponse à cette contestation, plus d’une centaine d’autres personnes détenues ont été transférées vers d’autres centres de détention, notamment celui d’#Ain_Zara, dans lequel Sagal est morte.

      Ces témoignages de violences correspondent à ce que j’ai pu entendre en Tunisie. Un autre homme somalien, Abdi, a décrit l’extorsion et les violences qu’il a subies aux mains des gardiens des centres de détention. Comme Farah, Abdi a été arrêté en mer par les gardes-côtes libyens et renvoyé en Libye où il est passé d’un centre de détention à un autre.

      Parfois, les gardes boivent et fument, puis frappent des gens. Ils demandent aussi aux gens de leur donner de l’argent en échange de leur libération, et ceux qui ne paient pas sont frappés. On voyait les gardes, tant des membres des milices que de la police, venir et frapper des gens qui n’avaient pas payé.

      La plupart des personnes actuellement détenues dans les centres de détention de Libye ont été interceptées en mer par les gardes-côtes libyens, qui ont bénéficié de tout un éventail de mesures de soutien de la part des gouvernements européens en échange de leur coopération en vue d’empêcher les réfugiés et les migrants d’atteindre les côtes européennes.

      L’argent des contribuables européens a été utilisé pour fournir des bateaux, créer une zone de recherche et sauvetage libyenne et construire des centres de coordination, entre autres mesures, en vue de renforcer les capacités de la Libye à empêcher ces personnes de fuir le pays et à les maintenir en détention illégale. Et ces aides ont été accordées sans la moindre condition associée, même si une telle coopération entraîne de graves violations des droits humains, comme des actes de torture.

      Si les États membres de l’Union européenne veulent cesser d’être complices des violences, des viols et de l’exploitation que subissent des femmes, des hommes et des enfants, ils doivent exiger la fermeture de tous les centres de détention pour migrants en Libye et la libération des quelque 5 000 personnes qui y sont actuellement détenues.

      Les gouvernements européens qui, depuis des années, prennent des mesures frénétiques, faisant adopter des politiques destinées à empêcher les arrivées en Europe quel qu’en soit le coût humain, doivent revenir à la raison, surtout maintenant que le nombre de traversées est très faible. Au-delà de mesures en vue de remédier à la crise des droits humains en Libye qui touche tant des Libyens que des ressortissants d’autres pays, la réponse doit prévoir un mécanisme rapide et fiable de débarquement en Europe des personnes en quête d’asile et des migrants secourus en Méditerranée, ainsi qu’un système équitable de partage des responsabilités en matière d’assistance entre les États membres de l’Union européenne.

      Ces mesures permettraient de contribuer à éviter les événements désastreux qui se sont enchaînés l’année dernière : des bateaux de sauvetage bloqués en mer pendant des semaines face au refus des pays de l’Union européenne d’ouvrir leurs ports et de les accueillir. Non seulement ces événements aggravent les souffrances des personnes qui viennent de fuir des traitements épouvantables, mais ils découragent également les navires marchands de porter secours à des personnes en détresse et de veiller à ce que ces personnes puissent débarquer dans un lieu sûr, où elles ne pourront pas être renvoyées en Libye.

      Emmanuel, un réfugié de 28 ans qui a fui le conflit au Cameroun, a décrit sa dérive en mer à bord d’un canot non loin d’une autre embarcation qui prenait l’eau, et sa stupéfaction lorsqu’un bateau a refusé de leur porter secours.

      Depuis le gros bateau, ils ont passé des appels, mais nous ont dit : “Désolé, nous ne pouvons pas vous accueillir, ce n’est pas de ma faute, nous avons ordre de laisser les Libyens venir vous chercher.” Pendant ce temps, je voyais les gens mourir sur l’autre bateau. Des bouts de bateau et des corps flottaient. [Quand] un petit bateau libyen est venu nous chercher... toutes les personnes à bord de l’autre canot étaient mortes. »

      Alors que des informations selon lesquelles des réfugiés de pays comme l’Érythrée retournent dans leur pays en dépit des risques bien connus pesant sur leur vie émergent, l’Europe ne peut pas se permettre d’ignorer les conséquences catastrophiques de ses politiques irresponsables destinées à freiner l’immigration en Méditerranée.

      Les départs depuis la Libye sont en déclin, c’est donc le moment d’exiger des changements, notamment la fermeture des centres de détention pour migrants en Libye, la mise en place d’un système de débarquement et de relocalisation équitable en Europe et des voies sûres et légales qui n’obligent pas les personnes qui cherchent la sécurité à passer par des traversées en mer.

      Cela permettrait à de nombreux enfants et adultes de sortir de ce calvaire et de quitter les centres de détention atroces dans lesquels ils sont actuellement détenus arbitrairement en Libye. Les gouvernements européens, qui ont fermé la route de la Méditerranée centrale et donc abandonné des milliers de personnes prises au piège en Libye, ne doivent pas perdre de temps.

    • Refugees report brutal and routine sexual violence in Libya

      Abuse often filmed and sent to victims’ relatives, Women’s Refugee Commission finds.
      Refugees and migrants trying to reach Europe from Africa are being subjected to horrific and routine sexual violence in Libyan detention centres, a survey has found.

      People arriving at the centres are “often immediately raped by guards who conduct violent anal cavity searches, which serves the dual purpose of retrieving money, as well as humiliation and subjugation”, the report by the Women’s Refugee Commission says. Many of the victims have been forcibly returned to the country by the Libyan coastguard under policies endorsed by the European Union.

      The level of psychological treatment for victims of sexual violence who reach Italy is woefully inadequate, the report adds.

      Sarah Chynoweth, the lead researcher on the report, said: “Profoundly cruel and brutal sexual violence and torture are perpetrated in official detention centers and clandestine prisons, during random stops and checkpoints, and in the context of forced labor and enslavement. The fact that refugees and migrants crossing the Mediterranean are intercepted and forced back into this violence is untenable.”

      The report, released at the Swedish mission in Geneva, is based on surveys and focus groups of people who have reached Italy. Much of the sexual violence it describes is too graphic to detail, but the authors make the broad point that “during the course of this research, almost all refugees, migrants, and key informants emphasised that sexual violence against male and female migrants along the entire central Mediterranean route was exceptionally high”.

      A UN officer estimated that 90% of male refugees and migrants being hosted in the Italian reception system had experienced sexual violence during their journey. A local government official said that, among refugee and migrant boys, “although there are no real numbers, we know that a huge number of the minors have experienced sexual violence on the journey [to Italy]”.

      The extent of sexual violence perpetrated against refugees appears in part to be contingent on their financial resources, their connections, and the year that they travelled – those traveling in recent years are seemingly more likely to have experienced sexual violence.

      In many cases, sexual violence and torture are filmed on Skype and used to try to extract ransom money from the victims’ relatives, the report by the Swedish-funded, US-based commission says.

      Refugees, migrants and informants told researchers that sexual violence was commonplace throughout the journey to Italy. “All along the journey they experienced sexual violence,” a health provider reported. “The whole journey is traumatic. Libya is just [the] icing on the cake.”

      It had been thought that the dominance of young males in the Libyan refugee trail would reduce the risk of sexual violence. It is estimated 72% of sea arrivals in Italy were men and 18% were children, mainly unaccompanied boys.

      In response to questions about sexual violence in Libya, refugees and migrants variously told the researchers that it “happened to everyone”, “is normal in Libya”, “happened to all people inside Libya” and “happened to many, many of my friends”.

      Only two refugees among those surveyed explicitly reported that they had not been exposed to sexual violence, due to their ability to pay large sums in exchange for relatively safe passage.

      A mental health provider in Italy working with refugees and migrants said that most of the men he spoke to had been raped in centres in Libya. A protection officer commented: “It is so widespread. Everyone knows when a man says”: ‘I’ve gone through Libya’ it is a euphemism for rape.”

      Among the forms of sexual violence described to researchers was anal and oral rape, forced rape of others including corpses, castration and forced incest.

      Much of the sexual violence described by research participants contained elements of profound psychological torture and cruelty.

      Violence against detainees is frequently perpetrated in front of others or recorded on mobile phones, compounding the humiliation and reinforcing the experience of subjugation, the researchers found. “Perpetrators send (or threaten to send) the video footage to detainees’ family members for extortion purposes,” the report says.

      A commonly reported torture technique involved forcing men to stand in a circle to watch the rape and sometimes murder of women; men who moved or spoke out were beaten or killed.

      Health and mental health providers who had treated male survivors frequently reported electroshock burns to the genitals. Other genital violence included beating, burning, tying and “pulling of the penis and scrotum”.


      In February 2017, Italy made a deal, backed by the EU, to spend tens of millions of euros funding the Libyan coastguard, which intercepts boats heading for Italy and returns those onboard to Libya.

      From January 2017 to September 2018, the Libyan coastguard intercepted and forcibly returned more than 29,000 people. Many ended up in detention centres or disappeared altogether.

    On June 30, the Office of the UN High Commissioner for Refugees (UNHCR) reported that nearly one-half million Syrians had returned to their homes between January and May 2017. The report expresses optimism that millions could return if “peace and stability in Syria increases.” A research mission by this author to Lebanon focusing on Syrian refugees, however, prompts much circumspection about whether or not Syrians should be returning at all, even if the pipe dream of peace becomes a reality.

      Une #opération_policière d’une grande envergure s’est déroulé hier matin à Moria, le hot-spot de Lesbos. Au moins 200 policiers ont passé au peigne fin le camp avec des contrôles d’identité systématiques afin de repérer les demandeurs d’asile déboutés dont les appels à la Commission de Recours ont été rejetés. L’opération a duré six heures et s’est conclu par l’interpellation d’une cinquantaine de personnes qui ont été amenés au commissariat de Lesbos pour contrôle d’identité. Ceux qui ont vu leur deuxième appel rejeté, seront conduits à un centre spécial pour les personnes en instance d’expulsion- une sorte de prison qui fonctionne au sein du camp de Moria-, pour être ensuite expulsés vers la Turquie.

      Plusieurs plaintes contre la police ont été déposées pour des mauvais traitements, des coups et des blessures sur des hommes déjà immobilisé voire menottés et pour des tortures pratiqués dans les commissariats. Au moins 11 parmi les 35 hommes arrêtés lors de la répression de la révolte à Moria la semaine dernière, ont déjà déposé ou sont sur le point de déposer de plaintes contre des policiers pour coups et blessures pouvant entraîner des lésions corporelles graves. Parmi eux, un Sénégalais âgé de 37 ans qui n’avait pas participé aux incidents avait reçu de coups de pied à la tête par un groupe de 4 policiers jusqu’à perdre connaissance et a dû être hospitalisé dans un état préoccupant.

      14 organisations humanitaires et défense de droit de l’homme ont faire part de leur très vive inquiétude et ont lancé un appel à la justice grecque pour qu’une enquête soit immédiatement ouverte afin de déterminer les responsables de cette violation flagrante des droits les plus élémentaires de migrants et de toute notion d’Etat de Droit.

      Au Parlement,19 députés de Syriza ont déposé une question adressée au Ministre de l’Immigration et à celui de l’Intérieur, en exigeant des explications sur cet « flagrant abus de pouvoir et sur les tortures pratiqués sur des hommes déjà arrêtés et menottés ». Ils veulent savoir qui a donné l’ordre pour ce type d’interventions policières et comment se fait-il que des hommes en civile ont été autorisés à participer à la répression brutale de la révolte.

      Un autre élément extrêmement préoccupant est le fait que les charges qui pèsent sur les 35 hommes arrêtés sont absolument identiques pour tous sans qu’aucune distinction personnalisée soit faite entre les supposés responsables de la révolte.

    • Report on Rights Violations and Resistance in Lesvos

      In the months since our last update on rights violations and resistance in Lesvos, our advocacy and campaigning resources were almost exclusively focused on the two trials for the Moria 35 and Moria 10 that took place in Chios in late April and early May 2018.

      The situation has predictably worsened in Lesvos. On the 17 April 2018, the Greek Council of State (the highest administrative court in Greece) ruled that geographic restrictions imposed by the Asylum Service for asylum seekers arriving to the Greek islands was illegal. However, within a week, new legislation was proposed, which further limits the rights of asylum seekers and continues the practice of containing asylum seekers to the Greek islands. Moria Camp is now at three times its capacity, holding approximately 7000 individuals. Between 500 and 1000 Kurdish asylum seekers are still living outside Moria in temporary shelter provided by Lesvos Solidarity – Pikpa, and Humans 4 Humanity, as they fear for their safety in Moria. Procedures are now so delayed that even individuals who are recognized as vulnerable, and whose cases should be prioritized under Article 51 of Greek Law 4375, are being scheduled for their interviews nearly a year after their arrival. This means that they are prohibited from leaving the island of Lesvos, and are denied freedom of movement during this entire time.

      In one case we are following, an eleven year old child has a serious, undiagnosed digestive condition that causes her constant pain and seizures. Because they have been unable to diagnose her illness, the hospital in Mytilene has referred her for testing and treatment in Athens. Even the Mytilene police department has recommended that geographic restrictions be temporarily lifted so that she can travel to Athens for further tests and treatment, but the Regional Asylum Office has denied this request without an appointment in the Athens hospital. Her family is now in a constant state of fear that given her critical condition, their daughter will be unable to receive emergency medical care when needed, given the lack of testing and treatment for her on the island. Already once, when she had seizures and attempted to get treatment at the hospital in Lesvos, she was not admitted because they do not have means to treat her.

      The Green Party published a report on 6 June 2018 exposing the inhumane conditions that systematically violate refugee rights in the Greek hotspots. On the 1 June 2018 the European Committee for the Prevention of Torture (CPT) also published preliminary observations of its visit to detention facilities in Greece from 10 to 19 April 2018, with damning findings.
      Treatment of Moria35 defendants highlights lack of procedural safeguards for detained asylum seekers in Lesvos

      In the last month and a half since the conclusion of the Moria 35 trial, we have been closely following the administrative process related to the detention and processing of the asylum claims of these individuals. It has become a near full time job of our Greek attorney based in Mytilene to ensure that Greek authorities comply by their own laws and respect the rights of these asylum seekers. Despite the fact that the UNHCR, the Ombudsman’s Office, and the Legal Centre have been closely monitoring their cases, there have been rampant violation of their rights at every step of their procedures. Unfortunately despite this close monitoring, two individuals were deported to Turkey on the morning of 13 June 2018. The violations we have observed in the individual cases of these 35 men highlight the lack of procedural safeguards to protect the rights of asylum seekers, particularly those who are being detained.

      Below we outline some of the observed violations of Moria 35 defendants’ rights as asylum seekers:

      Two individuals whose cases were rejected were denied the representation of a lawyer on appeal. The appeal of a rejected asylum claim is the one stage in the asylum procedure where asylum seekers have the right to a lawyer, under Article 44(3) of Law 4375. Although both requested the representation of a lawyer, the examination of their case on appeal occurred without them having been assigned an attorney.

      Another individual signed for voluntary departure, but then changed his mind and decided to continue his claim for international protection. He requested that his case be reopened. While that request was being processed, he was placed by police on the list to be deported on the 1 June 2018. It was only after advocacy from the Legal Centre that he was removed from the deportation list. He remains in detention, despite the lack of legal grounds to hold him there.

      Another individual was held for over a month in detention, after transfer to Lesvos following the trial in Chios. There was no recommendation for his continued detention either from the Regional Asylum Office, as required by Article 46(3) of Law 4375. After daily follow up from the Legal Centre, eventually the police admitted that they were holding him by mistake and he was released.

      Two additional individuals had their asylum cases rejected, but were unable to appeal because they were detained. With advocacy from UNHCR and Legal Centre lawyers, one of the individuals was able to lodge his appeal. However, he remains in detention, and it is not clear if the Appeals Committee will review his case on the merits or deny the appeal as untimely filed.

      The second individual was deported on the morning of 13 June 2018. This was despite the fact that for days he had been expressing to the police his desire to appeal the rejection of his asylum claim. Lawyers from HIAS and the Legal Centre also spoke with the Mytilene police department the day before he was deported and informed the police that they would be filing an appeal on his behalf. On the morning of 13 June 2018, he was deported to Turkey. This individual, a Guinean national, claims that he was a victim of torture, and will be subject to persecution if returned to his country. Regardless of whether his claim is credible, he has the right to appeal the rejection of his claim. Even though untimely, it is not the police who have the authority to accept or reject his appeal, but the Asylum Service. His right to appeal was clearly denied, and his deportation was illegal as police were aware that he would be appealing the denial of his claim and they proceeded with the deportation in any case.

      A second Moria 35 defendant was also deported on the 13 June 2018. His case had been rejected in the second instance. In 2017 this Ghanean national had been rejected and scheduled for deportation, but he lodged a subsequent application. It was the denial of this subsequent application that led to his deportation. While the Regional Asylum Service again scheduled for him to file a subsequent application on 14 June 2018, on 11 June 2018, we were informed that they would not accept a second subsequent application, since he had already submitted a subsequent application in 2017. However, he still had the option of appealing the denial of his claim in administrative court. Less than two days after being informed that he could not file a subsequent application, he was deported to Turkey. This individual has recently received original documents from Ghana that were not previously submitted to the Asylum Office. These documents corroborate his claim that he will be imprisoned 10-15 years if returned to Ghana. Prison conditions in Ghana according to human rights reports are “generally harsh and sometimes life threatening due to physical abuse, food shortages, overcrowding, and inadequate sanitary conditions and medical care” meaning he should be eligible for subsidiary protection, if not refugee status. Both individuals that were deported on the 13 June 2018 are also eligible for humanitarian protection as important witnesses to a serious crime that is still being investigated in Greece (the brutal police attack against the 35 arrestees on 18 July 2017). The swift move of the police to deport these individuals show that while procedures to grant protection and ensure that refugee rights are respected are constantly delayed, the State is able to mobilize and act swiftly to deny these same rights.

      The trampling of the rights of these individuals by the police has followed their brutally violent arrest, their unjust prosecution, and lengthy imprisonment in the case of the Moria 35. It is not clear if the police have targeted these individuals precisely because they were part of the Moria35 case, or if the violation of detained asylum seekers rights is systematic. What is clear is that there is a lack of sufficient transparency, oversight, and monitoring of detention and deportation practices.
      Legal Centre Successes

      Despite this hostile environment, we continue providing legal aid and individual consultation to all foreign nationals who seek our counsel. We conduct approximately 10 individual consultations daily, and through the assistance of our volunteer lawyers and interpreters, hundreds of individuals have been granted international protection in Greece, or have successfully had geographic restrictions lifted so they can legally travel to mainland Europe.

      We also continue to have success in assisting individuals in reuniting with family members in second European States under the Dublin III Regulation. In one case, a single young man from Haiti who is seriously ill was approved to be reunited with his family in France. While in Haiti, he had attempted to apply for a visa to join his parents and younger siblings in France, but was denied because he was over 18. France finally admitted, through our advocacy, that he was dependent on the care of his family, and that he should be able to join them in France. The fact that this individual was forced to take a lengthy, expensive, and dangerous journey to Europe through Turkey and the use of smugglers, only to be later admitted as an asylum seeker in France, shows that European immigration policies are broken.

      We will continue our work to assist and help navigate individuals through this broken system, and to monitor and expose the violations of these individuals’ rights when they occur.

      Un tribunal de l’île de Lesbos en mer Égée a acquitté jeudi soir une centaine de demandeurs d’asile accusés d’avoir protesté contre leurs conditions de vie.

      Ils étaient plus d’une centaine sur le banc des accusés : un groupe de demandeurs d’asile, en majorité Afghans, a été acquitté jeudi 9 mai par un tribunal de l’île de Lesbos, en Grèce. Ils avaient été accusés d’avoir occupé en avril 2018 une place publique du centre de #Mytilène, le chef-lieu de l’île, pour protester contre leurs conditions de vie dans le camp surpeuplé et insalubre de Moria. Ils avaient également été accusés d’avoir fait usage de la force physique et de résistance.

      Des chefs d’accusation “dénués de tout fondement”, a commenté dans la presse locale l’une des avocates de la défense, Me Elli Kriona-Sarantou, en se félicitant du jugement du tribunal. "Nous n’avons rien fait. Nous avons été attaqués par des extrémistes. Nous sommes innocents", a, pour sa part, déclaré à l’AFP Hadisse Hosseini, l’une des personnes acquittées.

      Cet Afghan faisait partie des quelque 200 migrants rassemblés sur la place Sappho le 22 avril 2018 pour dénoncer leurs conditions de vie après la mort d’un autre Afghan souffrant de manque de soins de santé. Leur rassemblement avait été pris à partie par environ 150 militants d’extrême droite, qui leur avaient jeté des pierres et des fusées éclairantes. Des affrontements avaient suivi, entraînant l’intervention de la police.

      "Une situation qui nourrit l’impunité"

      Me Elli Kriona-Sarantou s’est dit préoccupée du fait que les militants d’extrême droite n’aient pas encore été jugés, "une situation qui nourrit l’impunité sur l’île". Seuls 26 agresseurs ont été identifiés par la police et doivent comparaître à une date qui n’a pas encore été fixée.

      Du même avis, Vassilis Kerasiotis, le directeur de la branche grecque de l’ONG HIAS, estime que cette décision de justice “n’appelle à aucune célébration”. L’organisme a défendu plus d’une trentaine des migrants accusés. “Le simple fait que 110 participants à une manifestation pacifique aient été jugés par un tribunal, après avoir subi une attaque raciste et un recours disproportionné à la violence par la police, est extrêmement préoccupant”, a-t-il commenté sur la page Facebook de HIAS.

      La Grèce accueille actuellement plus de 70 000 réfugiés dont près de 15 000 sur les îles de la mer Égée. Avec près de 9 000 arrivées depuis le début de l’année 2019, le nombre des réfugiés a de nouveau augmenté, après avoir chuté en 2017 et 2018.

      La situation est explosive en particulier sur les îles de Lesbos et de Samos où les camps sont surpeuplés. À Lesbos, le nombre des migrants et des demandeurs d’asile s’élève à environ 7 000 personnes alors qu’il n’y a que 4 200 places disponibles pour eux dans les camps et les logements de l’île.

      Dans le camp de Samos la situation est pire : 3 175 personnes y vivent actuellement contre une capacité de 648 personnes, selon les chiffres publiés jeudi par le ministère de la Protection du citoyen.

    The week commencing 12 April 2015 saw what is believed to be the largest loss of life at sea in the recent history of the Mediterranean. On 12 April, 400 people died when an overcrowded boat capsized due to its passengers’ excitement at the sight of platform supply vessels approaching to rescue them. Less than a week later, on 18 April, a similar incident took an even greater toll in human lives, leading the deadliest single shipwreck recorded by the United Nations’ High Commissioner for Refugees (UNHCR) in the Mediterranean. Over 800 people are believed to have died when a migrants’ vessel sank after a mis-manoeuvre led it to collide with a cargo ship that had approached to rescue its passengers. More than 1,200 lives were thus lost in a single week. As Médecins Sans Frontiers (MSF) commented at the time, these figures eerily resemble those of a war zone.

    By the time Benjamin Netanyahu secured a third term as prime minister in 2013, the tensions had hardened into outright hostility. That year, Israel sealed off its border with Egypt and implemented a raft of policies aimed at making life more difficult for asylum-seekers already in Israel. Then it began secretly pressuring Eritreans and Sudanese to leave for unnamed third countries, a shadowy relocation effort in which Semene and thousands like him are now ensnared.

    Israeli officials have kept nearly everything else about this effort secret, even deflecting requests for more information from UNHCR, the U.N. refugee agency. But a year-long investigation by Foreign Policy that included interviews with multiple Eritrean and Sudanese asylum-seekers as well as people involved at various stages of the relocation process — including one person who admitted to helping coordinate illegal border crossings — reveals an opaque system of shuffling asylum-seekers from #Israel, via #Rwanda or Uganda, into third countries, where they are no longer anyone’s responsibility.

    It begins with furtive promises by Israeli authorities of asylum and work opportunities in Rwanda and Uganda. Once the Sudanese and Eritrean asylum-seekers reach Kigali or Entebbe, where Uganda’s international airport is located, they describe a remarkably similar ordeal: They meet someone who presents himself as a government agent at the airport, bypass immigration, move to a house or hotel that quickly feels like a prison, and are eventually pressured to leave the country. For the Eritreans, it is from Rwanda to Uganda. For Sudanese, it is from Uganda to South Sudan or Sudan. The process appears designed not just to discard unwanted refugees, but to shield the Israeli, Rwandan, and Ugandan governments from any political or legal accountability.

    • Market Forces: the development of the EU security-industrial complex

      While the European Union project has faltered in recent years, afflicted by the fall-out of the economic crisis, the rise of anti-EU parties and the Brexit vote, there is one area where it has not only continued apace but made significant advances: Europe’s security policies have not only gained political support from across its Member States but growing budgets and resources too.

      Transnational corporations are winning millions of euros of public research funds to develop ever more intrusive surveillance and snooping technologies, a new report by Statewatch and the Transnational Institute reveals today.

      The report, Market Forces, shows how the EU’s €1.7 billion ‘Secure societies’ research programme has been shaped by the “homeland security” industry and in the process is constructing an ever more militarised and security-focused Europe.

      The research programme, in place since 2007, has sought to combat a panoply of “threats” ranging from terrorism and organised criminality to irregular migration and petty crime through the development of new “homeland security” technologies such as automated behaviour analysis tools, enhanced video and data surveillance, and biometric identification systems.

      Key beneficiaries of this research funding have been companies: #Thales (€33.1m), #Selex (€23.2m), #Airbus (€17.8m), #Atos (€14.1m) and #Indra (€12.3m are the five biggest corporate recipients. Major applied research institutes have also received massive amounts of funding, the top five being: #Fraunhofer_Institute (€65.7 million); #TNO (€33.5 million); #Swedish_Defence_Research_Institute (€33.4 million); #Commissariat_à_l'énergie_atomique_et_aux_énergies_alternatives (€22.1 million); #Austrian_Intstitute_of_Technology (€16 million).

      Many of these organisations and their lobbies have played a significant role in designing the research programme through their participation in high-level public-private forums, European Commission advisory groups and through lobbying undertaken by industry groups such as the European Organisation for Security (#EOS).

      The report also examines EU’s €3.8 billion #Internal_Security_Fund, which provides funding to Member States to acquire new tools and technologies: border control #drones and surveillance systems, #IMSI catchers for spying on mobile phones, tools for monitoring the web and ‘pre-crime’ predictive policing systems are currently on the agenda.

      It is foreseen that the fund will eventually pay for technologies developed through the security research programme, creating a closed loop of supply and demand between private companies and state authorities.

      Despite the ongoing economic crisis, EU funding for new security tools and technologies has grown from under €4 billion to almost €8 billion in the 2014-20 period (compared to 2007-13) and the report warns that there is a risk of further empowering illiberal tendencies in EU governments that have taken unprecedented steps in recent years towards normalising emergency powers and undermining human rights protection in the name of fighting terrorism and providing “security”.

      Market Forces argues that upcoming negotiations on the next round of funding programmes (2021-27) provide a significant opportunity to reform the rationale and reasoning behind the EU’s development of new security technologies and its funding of tools and equipment for national authorities.

    • Hungry, sick and increasingly desperate, thousands of Venezuelans are pouring into Colombia

      For evidence that the Venezuelan migrant crisis is overwhelming this Colombian border city, look no further than its largest hospital.

      The emergency room designed to serve 75 patients is likely to be crammed with 125 or more. Typically, two-thirds are impoverished Venezuelans with broken bones, infections, trauma injuries — and no insurance and little cash.

      “I’m here for medicine I take every three months or I die,” said Cesar Andrade, a 51-year-old retired army sergeant from Caracas. He had come to Cucuta’s Erasmo Meoz University Hospital for anti-malaria medication he can’t get in Venezuela. “I’m starting a new life in Colombia. The crisis back home has forced me to do it.”

      The huge increase in Venezuelan migrants fleeing their country’s economic crisis, failing healthcare system and repressive government is affecting the Cucuta metropolitan area more than any other in Colombia. It’s where 80% of all exiting Venezuelans headed for Colombia enter as foreigners.

      Despite turning away Venezuelans with cancer or chronic diseases, the hospital treated 1,200 migrant emergency patients last month, up from the handful of patients, mostly traffic collision victims, in March 2015, before the Venezuelan exodus started gathering steam.

      The hospital’s red ink is rising along with its caseload. The facility has run up debts of $5 million over the last three years to accommodate Venezuelans because the Colombian government is unable to reimburse it, said Juan Agustin Ramirez, director of the 500-bed hospital.

      “The government has ordered us to attend to Venezuelan patients but is not giving us the resources to pay for them,” Ramirez said. “The truth is, we feel abandoned. The moment could arrive when we will collapse.”

      An average of 35,000 people cross the Simon Bolivar International Bridge linking the two countries every day. About half return to the Venezuelan side after making purchases, conducting business or visiting family. But the rest stay in Cucuta at least temporarily or move on to the Colombian interior or other countries.

      For many Venezuelans, the first stop after crossing is the Divine Providence Cafeteria, an open-air soup kitchen a stone’s throw from the bridge. A Roman Catholic priest, Father Leonardo Mendoza, and volunteer staff serve some 1,500 meals daily. But it’s not enough.

      One recent day, lines stretched halfway around the block with Venezuelans, desperation and hunger etched on their faces. But some didn’t have the tickets that were handed out earlier in the day and were turned away.

      “Children come up to me and say, ’Father, I’m hungry.’ It’s heartbreaking. It’s the children’s testimony that inspires the charitable actions of all of us here,” Mendoza said.

      The precise number of Venezuelan migrants who are staying in Colombia is difficult to calculate because of the porousness of the 1,400-mile border, which has seven formal crossings. But estimates range as high as 800,000 arrivals over the last two years. At least 500,000 have gone on to the U.S., Spain, Brazil and other Latin American countries, officials here say.

      “Every day 40 buses each filled with 40 or more Venezuelans leave Cucuta, cross Colombia and go directly to Ecuador,” said Huber Plaza, a local delegate of the National Disasters Risk Management Agency. “They stay there or go on to Chile, Argentina or Peru, which seems to be the preferred destination these days.”

      Many arrive broke, hungry and in need of immediate medical attention. Over the last two years, North Santander province, where Cucuta is located, has vaccinated 58,000 Venezuelans for measles, diphtheria and other infectious diseases because only half of the arriving children have had the shots, said Nohora Barreto, a nurse with the provincial health department.

      On the day Andrade, the retired army sergeant, sought treatment, gurneys left little space in the crowded ward and hospital corridors, creating an obstacle course for nurses and doctors who shouted orders, handed out forms and began examinations.

      Andrade and many other patients stood amid the gurneys because all the chairs and beds were taken. Nearby, a pregnant woman in the early stages of labor groaned as she walked haltingly among the urgent care patients, supported by a male companion.

      Dionisio Sanchez, a 20-year-old Venezuelan laborer, sat on a gurney awaiting treatment for a severe cut he suffered on his hand at a Cucuta construction site. Amid the bustle, shouting and medical staff squeezing by, he stared ahead quietly, holding his hand wrapped in gauze and resigned to a long wait.

      “I’m lucky this didn’t happen to me back home,” Sanchez said. “Everyone is suffering a lot there. I didn’t want to leave, but hunger and other circumstances forced me to make the decision.”

      Signs of stress caused by the flood of migrants are abundant elsewhere in this city of 650,000. Schools are overcrowded, charitable organizations running kitchens and shelters are overwhelmed and police who chase vagrants and illegal street vendors from public spaces are outmanned.

      “We’ll clear 30 people from the park, but as soon as we leave, 60 more come to replace them,” said a helmeted policeman on night patrol with four comrades at downtown’s Santander Plaza. He expressed sympathy for the migrants and shook his head as he described the multitudes of homeless, saying it was impossible to control the tide.

      Sitting on a park bench nearby was Jesus Mora, a 21-year-old mechanic who arrived from Venezuela in March. He avoids sleeping in the park, he said, and looks for an alleyway or “someplace in the shadows where police won’t bother me.”

      “As long as they don’t think I’m selling drugs, I’m OK,” Mora said. “Tonight, I’m here to wait for a truck that brings around free food at this hour.” Mora said he is hoping to get a work permit. Meanwhile, he is hustling as best he can, recycling bottles, plastic and cardboard he scavenges on the street and in trash cans.

      Metropolitan Cucuta’s school system is bursting at the seams with migrant kids, who are given six-month renewable passes to attend school. Eduardo Berbesi, principal of the 1,400-student Frontera Educational Institute, a public K-12 school in Villa de Rosario that’s located a short distance from the Simon Bolivar International Bridge, says he has funds to give lunches to only 60% of his students. He blames the government for not coming through with money to finance the school’s 40% growth in enrollment since the crisis began in 2015.

      “The government tells us to receive the Venezuelan students but gives us nothing to pay for them,” Berbesi said.

      Having to refuse lunches to hungry students bothers him. “And it’s me the kids and their parents blame, not the state.”


      #Cucuta

      On a recent afternoon, every street corner in Cucuta seemed occupied with vendors selling bananas, candy, coffee, even rolls of aluminum foil.

      “If I sell 40 little cups of coffee, I earn enough to buy a kilo of rice and a little meat,” said Jesus Torres, 35, a Venezuelan who arrived last month. He was toting a shoulder bag of thermoses he had filled with coffee that morning to sell in plastic cups. “The situation is complicated here but still better than in Venezuela.”

      That evening, Leonardo Albornoz, 33, begged for coins at downtown stoplight as his wife and three children, ages 6 months to 8 years, looked on. He said he had been out of work in his native Merida for months but decided to leave for Colombia in April because his kids “were going to sleep hungry every night.”

      When the light turned red, Albornoz approached cars and buses stopped at the intersection to offer lollipops in exchange for handouts. About half of the drivers responded with a smile and some change. Several bus passengers passed him coins through open windows.

      From the sidewalk, his 8-year-old son, Kleiver, watched despondently. It was 9:30 pm — he had school the next morning and should have been sleeping, but Albornoz and his wife said they had no one to watch him or their other kids at the abandoned building where they were staying.

      “My story is a sad one like many others, but the drop that made my glass overflow was when the [Venezuelan] government confiscated my little plot of land where we could grow things,” Albornoz said.

      The increase in informal Venezuelan workers has pushed Cucuta’s unemployment rate to 16% compared with the 9% rate nationwide, Mayor Cesar Rojas said in an interview at City Hall. Although Colombians generally have welcomed their neighbors, he said, signs of resentment among jobless local residents is growing.

      “The national government isn’t sending us the resources to settle the debts, and now we have this economic crisis,” Rojas said. “With the situation in Venezuela worsening, the exodus can only increase.”

      The Colombian government admits it has been caught off guard by the dimensions — and costs — of the Venezuelan exodus, one of the largest of its kind in recent history, said Felipe Muñoz, who was named Venezuelan border manager by President Juan Manuel Santos in February.

      “This is a critical, complex and massive problem,” Muñoz said. “No country could have been prepared to receive the volume of migrants that we are receiving. In Latin America, it’s unheard of. We’re dealing with 10 times more people than those who left the Middle East for Europe last year.”

      In agreement is Jozef Merkx, Colombia representative of the United Nations High Commissioner for Refugees, which is taking an active role in helping Colombia deal with the influx. Central America saw large migrant flows in the 1980s, but they were caused by armed conflicts, he said.

      “Venezuelans are leaving for different reasons, and the mixed nature of the displaced crisis is what makes it a unique exodus,” Merkx said during an interview in his Bogota office.

      Muñoz said Colombia feels a special obligation to help Venezuelans in need. In past decades, when the neighboring country’s oil-fueled economy needed more manpower than the local population could provide, hundreds of thousands of Colombians flooded in to work. Now the tables are turned.

      Colombia’s president has appealed to the international community for help. The U.S. government recently stepped up: The State Department announced Tuesday it was contributing $18.5 million “to support displaced Venezuelans in Colombia who have fled the crisis in their country.”

      Manuel Antolinez, director of the International Committee of the Red Cross’ 240-bed shelter for Venezuelans near the border in Villa de Rosario, said he expects the crisis to get worse before easing.

      “Our reading is that after the May 20 presidential election in Venezuela and the probable victory of President [Nicolas] Maduro, there will be increased dissatisfaction with the regime and more oppression against the opposition,” he said. “Living conditions will worsen.”

      Whatever its duration, the crisis is leading Ramirez, director of the Erasmo Meoz University Hospital, to stretch out payments to his suppliers from an average of 30 days to 90 days after billing. He hopes the government will come through with financial aid.

      “The collapse will happen when we can’t pay our employees,” he said. He fears that could happen soon.

    • The Venezuelan Refugee Crisis : The View from Brazil

      Shadowing the Maduro regime’s widely condemned May 20 presidential election, Venezuela’s man-made humanitarian crisis continues to metastasize, forcing hundreds of thousands of families to flee to neighboring countries. While Colombia is bearing the brunt of the mass exodus of Venezuelans, Brazil is also facing an unprecedented influx. More than 40,000 refugees, including indigenous peoples, have crossed the border into Brazil since early 2017. The majority of these refugees have crossed into and remain in Roraima, Brazil’s poorest and most isolated state. While the Brazilian government is doing what it can to address the influx of refugees and mitigate the humanitarian risks for both the Venezuelans and local residents, much more needs to be done.


      As part of its continuing focus on the Venezuelan crisis, CSIS sent two researchers on a week-long visit to Brasilia and Roraima in early May. The team met with Brazilian federal government officials, international organizations, and civil society, in addition to assessing the situation on-the-ground at the Venezuela-Brazil border.

      Le président brésilien Michel Temer a ordonné mardi soir par décret l’utilisation des forces armées pour « garantir la sécurité » dans l’Etat septentrional de Roraima, à la frontière avec le Venezuela.

      Depuis des mois, des milliers de réfugiés ont afflué dans cet Etat. « Je décrète l’envoi des forces armées pour garantir la loi et l’ordre dans l’Etat de Roraima du 29 août au 12 septembre », a annoncé le chef de l’Etat.

      Le but de la mesure est de « garantir la sécurité des citoyens mais aussi des immigrants vénézuéliens qui fuient leur pays ».
      Afflux trop important

      Plusieurs dizaines de milliers d’entre eux fuyant les troubles économiques et politiques de leur pays ont afflué ces dernières années dans l’Etat de Roraima, où les services sociaux sont submergés.

      Michel Temer a ajouté que la situation était « tragique ». Et le président brésilien de blâmer son homologue vénézuélien Nicolas Maduro : « La situation au Venezuela n’est plus un problème politique interne. C’est une menace pour l’harmonie de tout le continent », a déclaré le chef d’Etat dans un discours télévisé.

    • Crises Colliding: The Mass Influx of Venezuelans into the Dangerous Fragility of Post-Peace Agreement Colombia

      Living under the government of President Nicolás Maduro, Venezuelans face political repression, extreme shortages of food and medicine, lack of social services, and economic collapse. Three million of them – or about 10 percent of the population – have fled the country.[1] The vast majority have sought refuge in the Americas, where host states are struggling with the unprecedented influx.
      Various actors have sought to respond to this rapidly emerging crisis. The UN set up the Regional Inter-Agency Coordination Platform for Refugees and Migrants from Venezuela, introducing a new model for agency coordination across the region. This Regional Platform, co-led by the United Nations Refugee Agency (UNHCR) and the International Organization for Migration (IOM), has established a network of subsidiary National Platforms in the major host countries to coordinate the response on the ground. At the regional level, the Organization of American States (OAS) established a Working Group to Address the Regional Crisis of Venezuelan Migrants and Refugees. Latin American states have come together through the Quito Process – a series of diplomatic meetings designed to help coordinate the response of countries in the region to the crisis. Donors, including the United States, have provided bilateral assistance.

    Hundreds of people have fallen ill and a child has died of suspected food poisoning at a camp for displaced people near the Iraqi city of Mosul.
    People were said to be vomiting and suffering dehydration after an iftar meal, to break the daily Ramadan fast.
    The Hasansham U2 camp, between Mosul and Irbil, houses people displaced by an Iraqi offensive to capture Mosul from so-called Islamic State (IS).
    IS fighters are currently under heavy siege in the west of the city.
    The UN refugee agency, UNHCR, said in a statement that around 800 cases had been recorded, 200 of whom were taken to hospital.

    • Follow the Money – a critical analysis of the implementation of the EU Asylum, Migration & Integration Fund (AMIF)

      The research paper ‘Follow the Money: Assessing the use of AMIF funding at the national level’ by ECRE and UNHCR, provides a thorough and critical analysis of the €3.1 billion Asylum, Migration & Integration Fund (AMIF) established by the EC for the period of 2014-20. The AMIF aims to contribute to the efficient management of migration flows and to the implementation and development of a common European approach to asylum and migration.

      “While there are examples of good practices in the research paper, it also reveals a number of general problems and challenges related to the actual design of the AMIF as well as its implementation,” says Annabelle Roig-Granjon, UNHCR Senior Official.

      The distribution of funding through the AMIF National Programmes, accounting for 88 per cent or €2.75 billion of the AMIF budget is based on statistical information from 2011-12 and therefore not reflecting the current situation. Whilst the report identified some positive impact in the area of reception conditions and protection, the spending across priorities of integration, asylum and return is diverse across Member States and the emphasis on return in some countries disproportionate. There is a general incoherence and a lack of transparency, communication and information sharing on AMIF National Programmes at Member State level. Available public information (EC has yet to publish information) suggests slow overall implementation of AMIF National Programmes. Further, The Partnership Principle and the involvement of non-governmental partners as well as minimum levels of access to funding remain to be ensured.

      A specific problem is that the funding rules developed by certain Member States for National Programmes are functioning as barriers to participation in the AMIF for civil society organizations.

      This research paper aims to support the 2018 mid-term review of AMIF national programming, make recommendations for the better management and use of the funds during the remainder of the funding period, and to provide input to assist the European Commission, Member States and partners to develop European asylum, migration and integration funding instruments after 2020.“It is vital to use this research in a positive way, as a platform and basis for improvement as it offers a number of practical recommendations to that end,” says Annabelle Roig-Granjon.

    • Mounting evidence of crimes against migrants in Yemen

      UNHCR and Human Rights Watch have reported on the situation for African migrants and asylum seekers in Yemen this week. Many migrants are arrested, detained in inhumane conditions, abused, sent out to sea in dangerous mass deportations and in some cases executed.

      Most migrants come from the Horn of Africa – Somalia, Eritrea, Ethiopia – crossing from Djibouti to Yemen with the aim of reaching the Gulf States, particularly Saudi Arabia. However, many are caught and detained, particularly in the southern port city of Aden. Around 700 people are held there in a makeshift open air detention centre which is government run. The centre is overcrowded and lacks basic sanitation or medical care. Former detainees reported to Human Rights Watch that they suffered severe physical torture, extortion and rape at the hands of Yemeni authorities. The former head of the centre reported they work with smugglers in order to deport migrants. People are forced by smugglers onto boats off the Yemeni coast, in January of this year reportedly over 50 Somalis drowned during one of these procedures.

      Meanwhile, refugees fleeing the war in Yemen are heading the other way to refugee camps in Djibouti. Yemen has historically been a country of migration, refuge and transit for people from the Horn of Africa, but over three years of conflict has caused one of the world’s worst humanitarian crises. UNHCR reports any intervention or high level advocacy on the situation is hindered by the ongoing conflict. “With prolonged conflict and insecurity threatening state institutions and weakening the rule of law, there are growing accounts of extortion, trafficking and deportation,” said UNHCR spokesman William Spindler. Bill Frelick, refugee rights director at Human Rights Watch stated, “The crisis in Yemen provides zero justification for this cruelty and brutality, and the Yemeni government should put a stop to it and hold those responsible to account.”

      The newly appointed UN Special Envoy for Yemen, Martin Griffiths, addressed the Security Council on Tuesday saying he hoped to relaunch peace talks between a Saudi-led coalition and Houthi rebels. With a plan to put a framework for negotiations to the council within the next two months.

      Last year UNHCR launched a regional awareness campaign entitled ‘Dangerous Crossings’ to spread awareness of the perilous journey.
