L’ancienne militaire avait été renvoyée en prison le 8 mars après avoir refusé de témoigner devant un grand jury constitué pour enquêter sur Julian Assange, dénonçant une procédure “opaque” et peu démocratique.
Outil-clé de la justice américaine, les grands jurys sont mis en place dans les affaires pénales les plus sérieuses et sont chargés d’enquêter dans la plus grande confidentialité.

WASHINGTON — Ever since she was publicly identified as the source who had disclosed a huge trove of military and diplomatic documents to WikiLeaks in 2011, Chelsea Manning, the former Army intelligence analyst, has been a polarizing cultural figure — called a traitor by prosecutors, but celebrated as an icon by transparency and antiwar activists. Her life story, and her role in one of the most extraordinary leaks in American history, has been told in news articles, an Off Broadway play and even an opera. But while she spoke at her court-martial and has participated in interviews, Manning herself has not told her own story, until now. Manning is writing a memoir, which Farrar, Straus and Giroux will publish in the winter of 2020, the publisher announced Monday.
Manning was convicted in 2013 and sentenced to 35 years in prison, the longest sentence ever handed down in an American leak case. After her conviction, Manning announced that she was a transgender woman and changed her name to “Chelsea,” although the military housed her in a Fort Leavenworth prison for male inmates. She had a difficult time there, attempting suicide twice in 2016, before President Barack Obama commuted most of the remainder of her sentence shortly before he left office in January 2017. In the meantime, WikiLeaks published Democratic emails stolen by Russian hackers during the 2016 presidential campaign, transforming its image from what it had been back when Manning decided to send archives of secret files to it.
Manning reappeared in the news this year, refusing to testify before a grand jury as federal prosecutors continue to build a case against Julian Assange, the WikiLeaks founder. Assange, currently in custody in Britain, is fighting extradition to the United States for a charge that he conspired with Manning to try to crack an encoded password that would have permitted her to log onto a classified computer network under a different person’s account rather than her own, which would have helped her mask her tracks better. She was jailed for two months for contempt over her refusal to answer questions about her interactions with Assange, then freed because the grand jury expired. But she has already been served with a new subpoena prosecutors obtained from a new grand jury and is expected to be jailed again soon.
Below are edited excerpts from a conversation between Manning and Charlie Savage, a New York Times reporter who has written about her court-martial and her time in military prison.
Tell me about your book.
It’s basically my life story up until I got the commutation, from my birth to my time in school and going to the army and going to prison and the court-martial process. It’s a personal narrative of what was going on in my life surrounding that time and what led to the leaks, what led to prison, and how this whole ordeal has really shaped me and changed me. I view this book as a coming-of-age story. For instance, how my colleagues in the intelligence field really were the driving force behind my questioning of assumptions that I had come into the military with — how jaded they were, some of them having done two three four deployments previously. And then also there is a lot of stuff about how prisons are awful, and how prisoners survive and get through being in confinement.
Do you have a title yet?
There is no title yet. I am trying very hard to have some control over that, but none has been decided yet. Noreen Malone from New York magazine worked on it with me. She did a lot of the groundwork in terms of the research, and I did the storytelling, so it was a collaborative effort. I’m still going through and editing where she has taken independent sources to help refine my story, fact-check, verify things and provide a third-person perspective in shaping things.
Is it written in first-person or third-person?
It is written in first-person, but there are parts of the book that reference material that are independent of me. I’m still under obligation under the court rules and the Classified Information Procedures Act of 1980 to not disclose closed court-martial testimony or verify evidence that was put in the record. Things like that. So I can’t talk about that stuff and I’m not going to, and so I’m trying to keep this and maintain this as more of a personal story. There are parts of it that might reference reports or whatnot but I’m just going to say, “the media reported this, but I’m not confirming or denying it.”
Are you going to submit the manuscript to the government for a classified information review?
We’re trying our best to avoid the review process. There is a lot of stuff that is not going to be in the book that people would expect to be in there, but rules are rules and we can’t get around it. It’s more about personal experiences I had rather than anything specific. I’m not trying to relitigate the case, just tell my personal story.
So if it ends with you getting out of military prison, you’re not going to address your current situation with the grand jury investigating WikiLeaks?

No, we’re not planning on including that in this current stage. If there is a book that gets into the more juicy details about that stuff, then we’ll probably get around to that after going through a review process, several years down the road from now, whenever the dust settles. But I think this is more about trying to contextualize my story from my perspective rather than get into the weeds of what is in the record of trial, what is in the documents, what the investigation focused on, because we’re just not able to get into that area.
It sounds like you are a lot freer to talk about your gender identity than the WikiLeaks issue.
Yeah. This is less a book about the case and more a book about trials, tribunals, struggles, difficulties, and overcoming them and surviving. If people are expecting to learn a lot more about the court-martial and a lot more about the case, then they probably shouldn’t be interested in this book. But if they want to know more about what it’s like to be me and survive, then there are reams of information in here. It’s much more autobiographical than it is a narrative thriller or crime story or anything like that. I have always pitched this to being very similar to “Wild” by Cheryl Strayed. I’m really opening myself up to some really intimate things in this book, some really very personal moments and much more intimate points of my life that I’ve never disclosed before. You’re probably going to learn more about my love life than about the disclosures.

Good evening.
Two months ago, the federal government summoned me before a grand jury in the Eastern District of Virginia.
As a general principle, I object to grand juries.
Prosecutors run grand juries behind closed doors and in secret, without a judge present.
Therefore, I declined to cooperate or answer any questions.
Based on my refusal to answer questions, District Court Judge Hilton ordered me held in contempt until the grand jury ended.
Yesterday, the grand jury expired, and I left the Alexandria Detention Center.
Throughout this ordeal, an incredible spring of solidarity and love boiled over. I received thousands of letters, including dozens to hundreds of them a day.
This means the world to me, and keeps me going.
Jail and prisons exist as a dark stain on our society, with more people confined in the U.S. than anywhere else in the world.
During my time, I spent 28 days in solitary confinement–a traumatic experience I already endured for a year in prison before.
Only a few months before reincarceration, I recieved gender confirmation surgery.
This left my body vulnerable to injury and infection, leading to possible complications that I am now seeking treatment for.
My absence severely hampers both my public and private life.
The law requires that civil contempt only be used to coerce witnesses to testify.
As I cannot be coerced, it instead exists as an additional punishment on top of the seven years I served.
Last week, I handwrote a statement outlining the fact I will never agree to testify before this or any other grand jury.
Several of my closest family, friends and colleagues supported this fact.
Our statements were filed in court.
The government knows I can’t be coerced.
When I arrive at the courthouse this coming Thursday, what happened last time will occur again.
I will not cooperate with this or any other grand jury.
Throughout the last decade, I accepted full responsibity for my actions.
Facing jail again, this week, does not change this fact.
The prosecutors deliberately place me in an impossible situation: I either go to jail, or turn my back on my prisons.
The truth is, the government can construct no prison worse than to betray my conscience or my principles.

Alexandria, VA — Earlier today Chelsea Manning was released from the William G. Truesdale Adult Detention Center in Alexandria, VA. Chelsea’s release follows the expiration of the term of the EDVA Grand Jury that previously demanded her testimony. Chelsea was in jail for 62 days, after she was found in contempt of court for her refusal to give testimony. The following is a statement from Chelsea’s legal team:
“Today marked the expiration of the term of the grand jury, and so, after 62 days of confinement, Chelsea was released from the Alexandria Detention Center earlier today.
“Unfortunately, even prior to her release, Chelsea was served with another subpoena. This means she is expected to appear before a different grand jury, on Thursday, May 16, 2019, just one week from her release today.
“It is therefore conceivable that she will once again be held in contempt of court, and be returned to the custody of the Alexandria Detention Center, possibly as soon as next Thursday, May 16.
“Chelsea will continue to refuse to answer questions, and will use every available legal defense to prove to District Judge Trenga that she has just cause for her refusal to give testimony.”

L’asile de Julian Assange à l’ambassade d’Equateur à Londres s’est transformé en une petite boutique des horreurs. Au cours des sept derniers mois, il a été largement coupé de toute communication avec le monde extérieur. Sa nationalité équatorienne, qui lui a été accordée en tant que demandeur d’asile, est en cours de révocation. Sa santé s’est détériorée. On lui refuse l’accès à soins médicaux appropriés [ie à l’extérieur de l’ambassade – NdT]. Ses efforts pour obtenir réparation ont été paralysés par les « règles du bâillon » [« gag rules » – Une règle de bâillon est une règle qui limite ou interdit la discussion, la considération ou la discussion d’un sujet particulier par les membres d’un organe législatif ou exécutif. – NdT], y compris les ordres équatoriens lui interdisant de rendre publiques ses conditions de vie à l’intérieur de l’ambassade dans sa lutte contre la révocation de sa citoyenneté équatorienne.
Le Premier ministre australien Scott Morrison a refusé d’intercéder en faveur d’Assange, un citoyen australien, même si le nouveau gouvernement équatorien, dirigé par Lenín Moreno – qui appelle Assange un « problème hérité » et un obstacle à de meilleures relations avec Washington – rend la vie du fondateur de WikiLeaks dans cette ambassade insupportable. Presque tous les jours, l’ambassade impose des conditions plus dures à Assange, notamment en lui faisant payer ses frais médicaux, en lui imposant des règles obscures sur la façon dont il doit prendre soin de son chat et en lui demandant d’effectuer diverses tâches ménagères dégradantes.

Assange était loué et courtisé par certains des plus grands médias du monde, dont le New York Times et le Guardian, pour les informations qu’il possédait. Mais une fois que ses documents sur les crimes de guerre commis par les États-Unis, en grande partie fournis par Chelsea Manning, ont été publiés par ces médias, il fut mis à l’écart et diabolisé. Un document du Pentagone qui a fait l’objet d’une fuite et préparé par la Cyber Counterintelligence Assessments Branch (Direction du contre-espionnage cybernétique) du 8 mars 2008 a révélé une campagne de propagande visant à discréditer WikiLeaks et Assange. Le document dit que la campagne de diffamation doit chercher à détruire le « sentiment de confiance » qui est le « centre de gravité » de WikiLeaks et à salir la réputation d’Assange. Cela a largement fonctionné. Assange est particulièrement vilipendé pour avoir publié 70 000 courriels piratés appartenant au Comité national démocrate (DNC) et à de hauts responsables démocrates. Les démocrates et l’ancien directeur du FBI, James Comey, affirment que les courriels ont été copiés des comptes de John Podesta, chef de campagne de la candidate démocrate Hillary Clinton, par des pirates du gouvernement russe. Comey a dit que les messages ont probablement été transmis à WikiLeaks par un intermédiaire. Assange a dit que les e-mails n’avaient pas été fournis par des « acteurs étatiques ».
Le Parti démocrate, qui cherche à imputer sa défaite électorale à l’ » ingérence » russe plutôt qu’à la grotesque inégalité des revenus, à la trahison de la classe ouvrière, à la perte des libertés civiles, à la désindustrialisation et au coup d’Etat des entreprises que le parti a aidé à orchestrer, accuse Assange d’être un traître, bien qu’il ne soit pas un citoyen américain. Ni un espion. Et à ma connaissance, aucune loi ne lui interdit de publier les secrets du gouvernement US. Il n’a commis aucun crime. Aujourd’hui, les articles parus dans les journaux qui publiaient autrefois des articles de WikiLeaks mettent l’accent sur son comportement prétendument négligeant – ce qui n’était pas évident lors de mes visites – et sur le fait qu’il est, selon les mots du Guardian, « un invité indésirable » à l’ambassade. La question vitale des droits d’un éditeur et d’une presse libre a cédé le place à la calomnie contre la personne.
Assange a obtenu l’asile à l’ambassade en 2012 afin d’éviter l’extradition vers la Suède pour répondre à des questions sur des accusations d’infractions sexuelles qui ont finalement été abandonnées. Assange craignait qu’une fois détenu par les Suédois, il soit extradé vers les États-Unis [un accord d’extradition entre la Suède et les Etats-Unis autorise l’extradition d’une personne comme simple « témoin » – NdT]. Le gouvernement britannique a déclaré que, bien qu’il ne soit plus recherché pour interrogatoire en Suède, Assange sera arrêté et emprisonné s’il quitte l’ambassade pour avoir violé les conditions de sa libération sous caution.
WikiLeaks et Assange ont fait plus pour dénoncer les sombres machinations et crimes de l’Empire américain que toute autre organisation de presse. Assange, en plus de dénoncer les atrocités et les crimes commis par l’armée américaine dans nos guerres sans fin et de révéler les rouages internes de la campagne Clinton, a rendu publics les outils de piratage utilisés par la CIA et la NSA, leurs programmes de surveillance et leur ingérence dans les élections étrangères, notamment les élections françaises. Il a révélé le complot contre le chef du Parti travailliste britannique Jeremy Corbyn par des députés travaillistes au Parlement. Et WikiLeaks s’est rapidement mobilisé pour sauver Edward Snowden, qui a exposé la surveillance totale du public américain par le gouvernement, de l’extradition vers les États-Unis en l’aidant à fuir Hong Kong pour Moscou. Les fuites de Snowden ont également révélé, de façon inquiétante, qu’Assange était sur une « liste de cibles d’une chasse à l’homme » américaine.
Ce qui arrive à Assange devrait terrifier la presse. Et pourtant, son sort se heurte à l’indifférence et au mépris sarcastique. Une fois expulsé de l’ambassade, il sera jugé aux États-Unis pour ce qu’il a publié. Cela créera un précédent juridique nouveau et dangereux que l’administration Trump et les futures administrations utiliseront contre d’autres éditeurs, y compris ceux qui font partie de la mafia qui tentent de lyncher Assange. Même si ce sont les Russes qui ont fourni les courriels de Podesta à Assange, il a eu raison de les publier. C’est ce que j’aurais fait. Ces courriers ont révélé les pratiques de l’appareil politique Clinton qu’elle et les dirigeants démocrates cherchaient à cacher. Au cours des deux décennies où j’ai travaillé en tant que correspondant à l’étranger, des organisations et des gouvernements m’ont régulièrement divulgué des documents volés. Ma seule préoccupation était de savoir si les documents étaient authentiques ou non. S’ils étaient authentiques, je les publiais. Parmi ceux qui m’en ont transmis, il y avait les rebelles du Front de Libération Nationale Farabundo Marti (FMLN) ; l’armée salvadorienne, qui m’a un jour donné des documents du FMLN ensanglantés trouvés après une embuscade, le gouvernement sandiniste du Nicaragua ; le Mossad, le service de renseignement israélien ; le FBI ; la CIA ; le groupe rebelle du Parti des travailleurs du Kurdistan (PKK) ; l’Organisation de libération de la Palestine (OLP) ; le service de renseignement français, la Direction générale de la sécurité extérieure, ou DGSE ; et le gouvernement serbe de Slobodan Milosovic, qui a ensuite été jugé comme un criminel de guerre.
Nous avons appris par les courriels publiés par WikiLeaks que la Fondation Clinton a reçu des millions de dollars de l’Arabie saoudite et du Qatar, deux des principaux bailleurs de fonds de l’État islamique. En tant que secrétaire d’État, Hillary Clinton a remboursé ses donateurs en approuvant la vente de 80 milliards de dollars d’armes à l’Arabie saoudite, ce qui a permis au royaume de mener une guerre dévastatrice au Yémen qui a déclenché une crise humanitaire, notamment une grave pénurie alimentaire et une épidémie de choléra, et fait près de 60 000 morts. Nous avons appris que Clinton avait touché 675 000 $ pour une conférence chez Goldman Sachs, une somme si énorme qu’elle ne peut être qualifiée que comme un pot-de-vin. Nous avons appris que Mme Clinton avait dit aux élites financières, lors de ses entretiens lucratifs, qu’elle voulait » l’ouverture du commerce et des frontières » et qu’elle croyait que les dirigeants de Wall Street étaient les mieux placés pour gérer l’économie, une déclaration qui allait directement à l’encontre de ses promesses électorales. Nous avons appris que la campagne Clinton avait pour but d’influencer les primaires républicaines pour s’assurer que Donald Trump était le candidat républicain. Nous avons appris que Mme Clinton avait obtenu à l’avance les questions posées lors du débat pendant les primaires. Nous avons appris, parce que 1 700 des 33 000 courriels provenaient d’Hillary Clinton, qu’elle était l’architecte principale de la guerre en Libye. Nous avons appris qu’elle croyait que le renversement de Moammar Kadhafi lui permettrait d’améliorer ses chances en tant que candidate à la présidence. La guerre qu’elle a voulu a plongé la Libye dans le chaos, vu la montée au pouvoir des djihadistes radicaux dans ce qui est aujourd’hui un État en déliquescence, déclenché un exode massif de migrants vers l’Europe, vu les stocks d’armes libyens saisis par des milices rebelles et des radicaux islamiques dans toute la région, et fait 40 000 morts. Cette information aurait-elle dû rester cachée ? Vous pouvez dire oui, mais dans ce cas vous ne pouvez pas vous qualifier de journaliste.
« Ils sont en train de piéger mon fils pour avoir une excuse pour le livrer aux États-Unis, où il fera l’objet d’un simulacre de procès« , a averti Christine Assange. « Au cours des huit dernières années, il n’a pas eu accès à un processus juridique approprié. A chaque étape, c’est l’injustice qui a prévalu, avec un énorme déni de justice. Il n’y a aucune raison de penser qu’il en sera autrement à l’avenir. Le grand jury américain qui produit le mandat d’extradition se tient en secret, a quatre procureurs mais pas de défense ni de juge.
Le traité d’extradition entre le Royaume-Uni et les États-Unis permet au Royaume-Uni d’extrader Julian vers les États-Unis sans qu’il y ait de preuve prima facie. Une fois aux États-Unis, la National Defense Authorization Act permet la détention illimitée sans procès. Julian risque d’être emprisonné à Guantánamo Bay et torturé, d’être condamné à 45 ans de prison de haute sécurité, ou la peine de mort.«

It’s not that she doesn’t have a whole lot to say – she does, particularly about technology and how it can be used against us. Ce jeudi, Reality Winner, 26 ans, a été condamnée à cinq ans et trois mois de prison par un tribunal d’Augusta (Géorgie) pour avoir transmis à la presse un document classifié sur des tentatives de piratage à l’encontre de l’infrastructure électorale, attribuées à la Russie. Soit « la sentence la plus lourde jamais prononcée contre la source d’un média dans un tribunal fédéral », relève la Freedom of the Press Foundation.
En juin dernier, alors que Reality Winner était en détention depuis plus d’un an, son équipe de défense a négocié un accord de plaider coupable. Ce jeudi lors de l’audience, la jeune femme a dit assumer « l’entière responsabilité » de ce qu’elle a qualifié devant le juge d’« erreur incontestable ». Les procureurs, de leur côté, l’ont accusée d’avoir agi par « mépris des Etats-Unis », et ont affirmé que ses révélations avaient « causé un dommage exceptionnellement grave à la sécurité nationale ». Une assertion que les soutiens de Winner ne sont pas les seuls à réfuter. « Personne n’a été mis en danger, personne n’a vu son identité révélée, les Russes ont juste appris que lorsqu’ils s’introduisent dans nos systèmes, nous sommes capables de les repérer, ce qu’ils savaient déjà, estime un ancien avocat au département de la Justice, Robert Cattanach, cité par le New York Times. En tout état de cause, ce genre de condamnation est destiné à avoir un effet dissuasif. »
Début mai, un rapport du Sénat américain a reproché au département de la Sécurité intérieure d’avoir eu une réponse « inadéquate » face à la « menace contre l’infrastructure électorale », et relevé que les administrations des différents Etats avaient commencé à se préoccuper de la sécurité de leurs réseaux notamment suite aux articles de presse sur le sujet… « Reality Winner est une lanceuse d’alerte qui a averti le public d’une menace grave sur la sécurité des élections, déclarait jeudi soir Trevor Timm, le directeur exécutif de la Freedom of the Press Foundation. Michael Morell, the former acting director of the Central Intelligence Agency, announced on Thursday that he was resigning from a fellowship at Harvard because he couldn’t stand the thought of the school also offering an unrelated fellowship to Chelsea Manning.
This is where we tell you that this is all nonsense. Although it’s a frequently-used line of attack, the federal government has never publicly provided proof that Manning’s leaks—which were used by the most prestigious news outlets in the world and revealed, among other things, that civilian casualties in Iraq and Afghanistan were far higher than previously known—caused the deaths of any Americans.
Interestingly, there’s been loads of evidence that the CIA’s programs of indiscriminate drone strikes and brutal torture—both of which Morell has publicly and enthusiastically supported—caused a great deal of death and despair to people. But Manning is the immoral one.
Manning’s 35-year sentence was a punishment so severe that, when Barack Obama commuted it, he said it was without “historical precedent.”

Au fil de l’échange, puis des questions du public, Manning s’alarme de la militarisation de la police américaine – « de plus en plus de tactiques policières sont des copiés-collés de tactiques militaires » –, revient sur son combat de « seule personne ouvertement trans » dans la prison où elle était incarcérée, et appelle à l’engagement : « Les techniques de protestation sont efficaces, les gens ont réellement du pouvoir. Le mieux que nous puissions faire, c’est de nous manifester en nombre. »
Lorsque l’assistance lui demande si elle referait le choix de faire « fuiter » des documents confidentiels, elle dit que c’est une question sans réponse, et qu’elle n’aime pas regarder en arrière. Elle confesse s’être beaucoup nourrie, ces derniers temps, de pizzas et de tex-mex. Et lance : « Je suis juste une gosse de la rue et une codeuse, je n’ai pas signé pour être un modèle. »
Il y a, tout de même, un documentaire sur elle en cours de finalisation. Depuis sa sortie de prison, la lanceuse d’alerte a perfectionné sa façon de répondre aux trolls en ligne : avec de la positivité et beaucoup, beaucoup d’émoticônes.
Ce trop-plein de petits chats, d’arcs-en-ciel et de cœurs a le don d’énerver irrationnellement certains trolls. Ils semblent refuser à Chelsea Manning, toujours considérée comme un traître à la nation par une partie de la droite, le droit de dire ce qu’elle pense sur Twitter, et surtout le droit de le faire en noyant ses paroles dans des emoji.
Chelsea Manning a heureusement de l’humour, du recul sur elle-même et sur ce que doit être une utilisation saine de Twitter et, surtout, le don de savoir « alimenter les trolls » avec ce qui, précisément, les énerve. Elle les retweete et les réduit au silence sous une avalanche de positivité et d’emoji.
Avec 276 000 followers,@xychelsea reste un tout petit média, loin de la dimension d’un compte suivi par près de 35 millions de personnes, comme celui (au hasard) de Donald Trump (qui l’avait traité, à sa sortie de prison, de « TRAÎTRE ingrat »). Cela ne l’empêche pas d’être en position d’avoir un dialogue d’égal à égal avec lui, au moins sur Twitter.
Quand le président des Etats-Unis a annoncé, le 26 juillet, l’interdiction pour les personnes transgenres de servir dans l’armée américaine, c’est la réponse de Manning, en tant que personne transgenre ayant servi dans l’armée, qui a été la plus écoutée.
Le message et le débat dans le flux de son compte Twitter lui ont permis de signer une tribune à ce sujet sur le New York Times, avec 395 commentaires à la clé. Mais beaucoup moins d’emoji.

My own work has also taken a political and critical approach to working with biotechnology. With Stranger Visions, in 2012, I created portraits of strangers from their abandoned DNA. I began by collecting genetic artifacts I found in public: hair, cigarette butts, chewed-up gum. I learned how to extract DNA, how to sequence it, and how to analyze it to generate a portrait of what someone might look like based on an interpretation of their DNA, utilizing scientific research ranging from the established to the speculative. I 3-D printed the portraits life size, in full color, and exhibited these alongside documentation of the artifact, where and when it was collected, and what I analyzed.

The work was meant to call attention to the vulnerability of the body to new forms of surveillance and to predict the future direction of forensic DNA phenotyping—the profiling of a person’s outward characteristics from their DNA. At the time there were clear signals this research was happening, but it hadn’t been publicly discussed.
Two years later the prediction came true with the launch of Parabon Nanolabs DNA “Snapshot”, offering genomic mugshots to police around the country. The danger of offering stereotypes based primarily on sex and ancestry predictions is that a black box algorithm in the hands of the police can become a new form of racial profiling which appears to have the authority of real genetic evidence.
Most recently, I worked with Chelsea Manning. Subject to a strict policy of visitation and representation, Chelsea’s image had been suppressed since her sentencing and gender transition in 2013. She realized that DNA could give her a kind of visibility or presence that she had been stripped of for years. Chelsea didn’t want to appear too masculine in the portraits. I realized it was a perfect opportunity to highlight the reductionism of DNA phenotyping. Instead of producing one portrait to represent her, I generated two: one that was algorithmically gender “neutral” and one parameterized “female.” I presented the two portraits side by side to focus attention on the limitations of this technique even in regards to a genetic trait considered “legible.”
Just as the libertarian fraction of the cyberpunks fantasizes about the singularity putting the mind into software, biopunk-driven positivism fantasizes about DNA code being the instructions for life itself. “We have discovered the secret of life.” This was how Watson and Crick bragged about their discovery of the DNA double helix after poaching the work of their colleague Rosalind Franklin. Code is the ultimate dream.

Le président américain a commué la peine de la lanceuse d’alerte – elle sera libérée en mai. Mais la même clémence a peu de chances de s’appliquer également à Edward Snowden.
En commuant mardi 17 janvier la peine de la lanceuse d’alerte Chelsea Manning, Barack Obama a répondu au vœu de nombreux défenseurs des libertés publiques, qui l’appelaient à faire un geste avant la fin de son mandat. Les mêmes lui ont aussi demandé ces dernières semaines de pardonner à Edward Snowden, autre lanceur d’alerte emblématique. Visé par un mandat d’arrêt aux Etats-Unis, il réside depuis 2013 en Russie après avoir révélé l’ampleur du programme de surveillance de la NSA (National Security Agency) américaine.
Mais il y a peu de chances que les espoirs de ses soutiens se concrétisent, à deux jours de la fin du mandat de Barack Obama : la Maison Blanche a déjà fait savoir que pour elle les deux situations étaient radicalement différentes. Vendredi, le porte-parole de la Maison Blanche, Josh Earnest, cité par le New York Times, a développé ses arguments :
« Chelsea Manning est une personne qui a été confrontée à tout le processus de justice militaire, qui a subi un procès, qui a été jugée coupable et a été condamnée pour ses crimes, et elle a reconnu avoir mal agi. (…) M. Snowden s’est réfugié dans les bras d’un adversaire, un pays [la Russie] qui a récemment tenté de briser la confiance en notre démocratie. »
Quelques heures seulement après l’annonce de Barack Obama, la Russie a prolongé de deux ans le permis de séjour d’Edward Snowden, qui était sur le point de se terminer à la fin de l’année ; ce qui inquiétait ses soutiens. Mais cela ne suffira pas à les apaiser : Edward Snowden représente toujours une carte à jouer précieuse pour le Kremlin. Et maintenant que Donald Trump, dont les liens avec Moscou sont plus chaleureux que ceux qu’entretenaient l’administration sortante, accède à la Maison Blanche, quel sort Moscou va-t-il lui réserver ?

La lanceuse d’alerte, qui purge une peine de trente-cinq ans de prison, sera libre en mai.
Chelsea Manning, née de sexe masculin sous le nom de Bradley Manning, avait notamment été condamnée pour avoir copié, puis transmis à WikiLeaks des rapports de l’armée américaine en Afghanistan et en Irak. Des documents qui montraient notamment l’ampleur des dégâts subis par les civils irakiens durant l’occupation américaine, et qui avaient été largement couverts par la presse internationale, dont Le Monde. Elle avait également fourni à WikiLeaks la vidéo dite « Meurtre collatéral », montrant le pilote d’un hélicoptère de combat américain ouvrant le feu sur des civils désarmés dans une banlieue de Bagdad.
Dénoncée par un hackeur auprès duquel elle avait évoqué avoir transmis les documents, Chelsea Manning avait été arrêtée en juin 2010, détenue au secret, puis jugée par une cour martiale, qui l’a condamnée en 2013 à trente-cinq ans de prison. Chelsea Manning, qui a plaidé coupable, était visé par plusieurs chefs d’accusation, notamment d’espionnage et de collusion avec l’ennemi. Si le second n’a finalement pas été retenu, elle a bien été condamnée en vertu de l’Espionage Act, une loi de 1917, qui lui a valu la plus longue peine de prison jamais infligée à un lanceur d’alerte.
Détenue à l’isolement dans la prison militaire de Fort Leavenworth (Kansas), dans des conditions que ses défenseurs jugent insupportables en raison de sa fragilité psychologique, Chelsea Manning a engagé une procédure de changement de sexe, longtemps refusée par l’armée. Elle a tenté à deux reprises de se suicider depuis son incarcération, une première fois en juillet 2016, puis une seconde fois en octobre, lorsqu’elle était à l’isolement pour la punir de sa première tentative de suicide. Saisi de son dossier, le rapporteur des Nations unies sur la torture a considéré que ses conditions de détention étaient « cruelles, inhumaines et dégradantes, à la limite de la torture ».
Peu après l’annonce de la Maison blanche, WikiLeaks s’est félicité de la libération prochaine de Chelsea Manning, évoquant une « victoire ». Mais cette victoire pourrait avoir des conséquences complexes pour l’organisation : son fondateur Julian Assange, qui vit depuis plusieurs années dans l’ambassade d’Equateur à Londres pour échapper à une extradition vers la Suède dans une affaire de viol présumé, a promis ce 12 janvier que « si Obama accorde sa clémence à Manning, Assange acceptera d’être extradé vers les Etats-Unis malgré le caractère clairement anticonstitutionnel du dossier monté par le département de la justice ». Une enquête est toujours ouverte contre lui aux Etats-Unis lui pour publication de documents secret-défense.
