    n early 2016, at a campaign rally in Iowa, Donald Trump famously said, “I could stand in the middle of Fifth Avenue and shoot somebody and I wouldn’t lose voters.” Much of the rest of Trump’s campaign, and his subsequent Presidency, has seemed like a test of that declaration. He talked on tape about sexually assaulting women and won the general election. He fired the F.B.I. director, who was investigating him and his campaign for potentially criminal conduct, and Republicans yawned. He has used Twitter to escalate a standoff with a renegade nuclear state, and his supporters have defended it as a brilliant strategy. It has become a journalistic cliché to point out that Trump survives scandals and outrages that would sink other politicians.

    In Alabama itself, the Post reported on Friday, “Republican leaders mostly circled the wagons behind Moore.” One Alabama Republican compared the relationship between Moore and the fourteen-year-old girl to that of Mary and Joseph, Jesus’ parents. The Covington County G.O.P. chairman, William Blocker, was blunter, telling Daniel Dale, of the Toronto Star, “There is NO option to support Doug Jones, the Democratic nominee. When you do that, you are supporting the entire Democrat party.”

    These defenses are shocking, but they square with Trump’s when it comes to the extremes to which partisanship now pushes people. Many wonder how evangelical Christians, a core constituency for Moore in Alabama, will react. In the Trump era, Moore might have a chance at retaining support from these voters.

    The fatal collisions involving two U.S. Navy destroyers in the Seventh Fleet’s Area of Responsibility this year could have been prevented, the Navy said in a collision report released Wednesday.

    The Navy released today the 71-page report detailing the events and actions that led to the separate fatal collisions involving the Arleigh Burke-class destroyers USS Fitzgerald (DDG 62) and USS John S. McCain (DDG 56) with commercial vessels.

    Three U.S. Navy investigations concerning each of these incidents are now complete, the Navy said.

    Both of these accidents were preventable and the respective investigations found multiple failures by watch standers that contributed to the incidents,” said Chief of Naval Operations (CNO) Adm. John Richardson. “We must do better.”

    Already as a result of the collisions, the Navy has dismissed a number of high-ranking officers, including the commanders of both destroyers as well as the commander of the Seventh Fleet.

    C’est bien une avarie de barre qui provoque l’abattée sur la gauche qui aboutit à couper la route du navire marchand. On notera que le McCain est à 20 nœuds, soit au moins 2 fois plus vite que l’Alnic MC et ce dans le dispositif de séparation de trafic. Le McCain tente de corriger en jouant sur le différentiel entre ses deux lignes d’arbres d’hélice, en ralentissant babord mais conservant l’allure à tribord. Apparemment, mais il faut lire, la barre de secours n’était pas armée…

    Je ne sais pas ce que diront les tribunaux mais la responsabilité des navires marchands ne paraît pratiquement pas du tout engagée.

      The Navy’s review called for reforms that will cost between $400 and $500 million over the next five to six years, including periodic, standardized assessments of seamanship and bolstering training of navigation fundamentals.

      It also involved ensuring back-to-basics measures like ensuring sailors get enough sleep. The Navy said fatigue was a contributing factor in the Fitzgerald and John S. McCain collisions.

      Senator Roger Wicker, the chairman of the Senate Seapower Subcommittee, said the Navy needed more ships to meet the demands for operations at sea. Boosting the size of the Navy is a key objective of Republican President Donald Trump.

      We are asking too few ships to do too many things,” said Wicker, a Republican.

      At 0519, the Commanding Officer noticed the Helmsman (the watchstander steering the ship) having difficulty maintaining course while also adjusting the throttles for speed control. In response, he ordered the watch team to divide the duties of steering and throttles, maintaining course control with the Helmsman while shifting speed control to another watchstander known as the Lee Helm station, who sat directly next to the Helmsman at the panel to control these two functions, known as the Ship’s Control Console. See Figures 3 and 4. This unplanned shift caused confusion in the watch team, and inadvertently led to steering control transferring to the Lee Helm Station without the knowledge of the watch team. The CO had only ordered speed control shifted. Because he did not know that steering had been transferred to the Lee Helm, the Helmsman perceived a loss of steering.

      Steering was never physically lost. Rather, it had been shifted to a different control station and watchstanders failed to recognize this configuration. Complicating this, the steering control transfer to the Lee Helm caused the rudder to go amidships (centerline). Since the Helmsman had been steering 1-4 degrees of right rudder to maintain course before the transfer, the amidships rudder deviated the ship’s course to the left.

      Additionally, when the Helmsman reported loss of steering, the Commanding Officer slowed the ship to 10 knots and eventually to 5 knots, but the Lee Helmsman reduced only the speed of the port shaft as the throttles were not coupled together (ganged). The starboard shaft continued
      at 20 knots for another 68 seconds before the Lee Helmsman reduced its speed. The combination of the wrong rudder direction, and the two shafts working opposite to one another in this fashion caused an un-commanded turn to the left (port) into the heavily congested traffic area in close proximity to three ships, including the ALNIC. See Figure 5.

      Although JOHN S MCCAIN was now on a course to collide with ALNIC, the Commanding Officer and others on the ship’s bridge lost situational awareness. No one on the bridge clearly understood the forces acting on the ship, nor did they understand the ALNIC’s course and speed relative to JOHN S MCCAIN during the confusion.

      Approximately three minutes after the reported loss of steering, JOHN S MCCAIN regained positive steering control at another control station, known as Aft Steering, and the Lee Helm gained control of both throttles for speed and corrected the mismatch between the port and starboard shafts. These actions were too late, and at approximately 0524 JOHN S MCCAIN crossed in front of ALNIC’s bow and collided. See Figure 6.

    When does life begin? According to the anti-abortion movement, the answer is at conception. But when did that idea begin? It sounds biblical, but the notion was actually popularized by 19th-century surgeon Horatio Robinson Storer, who singlehandedly brought the American medical establishment into the fight against abortion. In fact, the laws restricting abortion that were passed at Storer’s urging were largely in place until being overturned by Roe v. Wade in 1973.
    Often considered the father of American gynecology, Storer was a Boston-born, Harvard-educated obstetrician who studied abroad in Scotland before opening his own practice in his native city in 1855. Though primarily interested early in his career in experimenting with and administering anesthetic agents during childbirth, Storer quickly turned his attention to the question we now call fetal personhood. By 1857, he had begun the “physicians’ crusade against abortion,” a national campaign, and was lobbying the American Medical Association (AMA) to advocate institutionally against the practice.
    The AMA had been formed in 1847 in order to professionalize the field of medicine and standardize its practices. But there was no mention of abortion in the group’s original Code of Ethics, and it wasn’t until Storer petitioned for the formation of the Committee on Criminal Abortion in 1857 that the organization took up the issue. The AMA made Storer chairman of that committee, and requested that he prepare a report on abortion in the U.S.

    There are other opportunities for us,” Alaska Senator Lisa Murkowski, the chairman of the Senate Energy and Natural Resources Committee, said in an interview. “There is a significant way that we can help with the budget process.

    Money from selling drilling rights and royalties from oil and gas production would be a revenue-raiser that could help offset some of the tax cuts Republicans are proposing. The House has instructed its Natural Resources Committee to find ways to generate $5 billion in revenue over the next decade. And the Senate is set to vote as soon as this week on a budget plan imposing a $1 billion target on Murkowski’s natural resources committee.

    The Polish government is demanding reparations from Germany for the war crimes committed during the Second World War. The demand is not new, but has never before been raised so persistently.

    The chairman of the governing right-wing nationalist Law and Justice Party (PiS), Jaroslav Kaczynski, breathed new life into the reparations debate in late June. Ever since, Prime Minister Beata Szydlo has issued repeated demands on the issue. She told the RNFFM radio station on September 7, “Poland has a right to reparations, and the Polish state has the right to demand them.” Polish Foreign Minister Witold Waszczykowski stated that Poland’s demand amounted to €840 billion.

    The Bureau of Research of the Polish parliament published a 40-page report on Monday justifying the Polish demand. According to this, an official 1953 statement in which the Polish government relinquished its right to claim reparations from Germany is not legally valid because it was made under pressure from the Soviet Union and only applied to the German Democratic Republic (GDR), not Germany.

  • The Israeli Right Will Bring About Justice for the Palestinians

    Perhaps the right will be the one to bring about true, egalitarian justice in Israel. Maybe it will bring about the only possible solution left. After the right proved that only it dares to evacuate settlements, maybe the next stage will come and the right will once more prove it can do so, even if unintentionally. That would be a huge irony of fate. Those who insist on not returning to the Palestinians 22 percent of their land will give them (and us) all of it, egalitarian and just, on the silver platter of both peoples.

    The road is long, of course, and even its beginning is not yet in sight. But the defeated and desperate speech by Palestinian President Mahmoud Abbas to the UN General Assembly on Wednesday proves there’s a chance this is the direction.

    Abbas spoke of one state as a possible solution and of equal rights for all inhabitants of historic Palestine. As far can be remembered, he never publicly made such a statement before. Bound by his historic way and the establishment he heads, he has not yet given up the two-state solution for good. But he also knows, like any politician who recognizes reality, that the two-state solution has expired and only the declaration of its death remains. Some Europeans and perhaps even also the Americans know this, but don’t dare admit it. President Donald Trump mumbled something about it, possibly inadvertently.

    Abandoning the two-state solution is a fateful reboot. It is not simple to do. But when Abbas and the others finally resolve to cross the Rubicon, the wildfire they ignite could spread with amazing speed.

    When the Palestinians abandon the “two states for two peoples” solution and move on to “one person, one vote,” the world will not remain indifferent. It will begin with the Palestinians, 57 percent of whom already don’t believe in the two-state solution, according to a recent Palestinian Center for Policy and Survey Research poll, and will then move on to Israeli Arabs, most of whom still hold fast to that solution.

    The easy-to-grasp message will then go out to the world. Just and familiar from another historic struggle: “One man, one vote.” Who can oppose it? And what can Israel say in its own defense? Jewish-democratic? Where? A just apartheid?

    This revolution might also blow away the smokescreen and confusion around the arbitrary and baseless division Israel has made between an “Israeli Arab” and “Palestinian” – sometimes members of the same family; between East Jerusalem and residents of the West Bank; between residents of the West Bank and Gaza; it will reunify the people that Israel maliciously cut apart. It will also eliminate the confusion around the artificial distinction between the Jewish democracy with the Arab High Court of Justice and the third largest party in the Knesset, and zero human rights for most of the other members of that people, who live under the government of that same state, in the same country. It will cancel out all discrimination and all privilege, from the Law of Return to the right of return. Can any true democrat oppose this?

    The left will not do so. It is bound by slogans of the past – two states – most of the left was never serious about anyhow. The right wing, which talks more and more about annexation and non-occupation, is taking giant steps toward this state. Of course, it doesn’t mean democracy or equal rights – what does the right have to do with that?

    But when the right gathers the courage to declare a one-state solution, the world will gain the courage to declare a war on its regime, against the new apartheid state in the 21st century. What other choice will the world have in the face of a declared apartheid? It will be a much more determined struggle than the hollow one against the establishment of the outpost in the “illegal” expansion of Mitzpeh Rehavam Gimel.

    The racist MK Bezalel Smotrich is doing more for justice and the Palestinian people than Labor Party leader Avi Gabbay. The nationalists, Education Minister Naftali Bennett and Justice Minister Ayelet Shaked, are doing immeasurably more than Yesh Atid Chairman Yair Lapid or even the peace-seeking Meretz Chairwoman Zehava Galon.

    The right is moving ahead on the only solution. We should keep our fingers crossed.

As the head of the Federal Communications Commission observed in a 1961 speech to broadcast executives, the industry’s revenue, more than $1 billion a year, was rising 9 percent annually, even in a recession. The problem, the FCC chairman told the group, was the way the business was making money: not by serving the public interest above all but by airing a lot of dumb shows and “cajoling and offending” commercials. “When television is bad, nothing is worse,” he said.

    Facebook is fundamentally not a network of ideas. It’s a network of people. And though it has two billion active users every month, you can’t just start trading insights with all of them. As Facebook advises, your Facebook friends are generally people you already know in real life. That makes it more likely, not less, to stimulate homogeneity of thought. You can encounter strangers if you join groups that interest you, but those people’s posts are not necessarily going to get much airtime in your News Feed. The News Feed is engineered to show you things you probably will want to click on. It exists to keep you happy to be on Facebook and coming back many times a day, which by its nature means it is going to favor emotional and sensational stories.

    The first step would be to acknowledge that even with the seemingly limitless competition that already exists on the Internet, Facebook has an outsize role in our society. Sixty-eight percent of all American adults use it, according to the Pew Research Center. That compares with 28 percent for Instagram (also owned by Facebook), 26 percent for Pinterest, 25 percent for LinkedIn, and 21 percent for Twitter. And none of these other sites aspire to be as many things to as many people as Facebook does.

    Why are we finally now in what’s often called a golden age of television, with culturally influential, sophisticated shows that don’t insult our intelligence? It’s not because broadcasters stopped airing schlock. It’s because the audience is more fragmented than ever—thanks to the rise of public broadcasting and cable TV and streaming services and many other challenges to big networks. It required a flourishing of choices rather than a reliance on those huge networks to become better versions of themselves. As Zuckerberg wrote in February, “History has had many moments like today.”

    The official opening of the government-convened Grenfell Tower Inquiry is an affront to the victims and survivors of the terrible inferno that swept the 24-storey tower block in west London on June 14, killing at least 80 people.

    In his 45-minute statement, Chairman Sir Martin Moore-Bick spoke of remembering those who had suffered with “humility and compassion,” “dismay,” and “sadness.”

    The cynicism of his remarks was made clear by his refusal to take questions from those in attendance. Just 200 places were available for those wanting to attend, and then on a “first come, first serve” basis. Moore-Bick stood immediately after he had finished speaking, turned his back on the audience and left the room, to cries of “rubbish.”

    Speaking before a House of Representatives Armed Services Committee hearing, John Pendleton, from the U.S. #Government_Accountability_Office (#GAO), said that a report had found that 37 percent of U.S. Navy cruisers and destroyers based out of Japan had expired warfare certifications as of June 2017. That was a five-fold increase from the number in May 2015.

    The certification is a measurement of whether a ship and its crew are well trained and ready for operations.

    The GAO report also found that a reduction in crew sizes was contributing to safety risks, with some sailors working over 100 hours a week and there was limited training because of an increased demand for operations.

    The Navy has made plans to revise operational schedules to provide dedicated training time for overseas-based ships, but this schedule has not yet been implemented,” the report said.

      On rappelle par ailleurs que depuis 2003, il n’y a plus non plus de séquence de formation initiale des futurs officiers à la navigation qu’elle soit théorique (uniquement sur CD ou DVD) ou pratique (sur le tas pendant les prochains embarquements)…

      Navy destroyers are remarkably nimble and responsive, including rapid acceleration ability, thus should certainly be able to get out of the way of almost anything approaching ‘too close,’” van Tol said in an email.

      Such close quarters situations should NEVER be allowed to develop without various watchstanders and watchteams being well aware that they are developing,” he said.

      It is unknown whether McCain had suffered any kind of casualty to its engineering or steering systems ahead of the collision that would have contributed to the disaster.

      The collision was the fourth significant safety incident of 2017 involving a U.S. 7th Fleet ship. In January, the cruiser Antietam ran aground in Tokyo Bay and in May, the cruiser Lake Champlain collided with a Korean fishing boat in the Sea of Japan.

      What caused the accident?
      The warship suffered a steering failure as the warship was beginning its approach into the Strait of Malacca, causing it to collide with a commercial tanker Monday, a US Navy official told CNN.

      L’amiral n’a pas exclu que la collision ait pu être provoquée par un facteur extérieur ou une cyberattaque. Cet accident n’est pas le premier (voir encadré) et intrigue certains spécialistes de la Défense.

      « Il y a quelque chose de plus que la simple erreur humaine car sinon cela impliquerait énormément de gens », avance par exemple Jeff Stutzman interrogé par le site McClatchyDC.

      Pour cet ancien spécialiste de la guerre de l’information et de la marine, qui travaille désormais chez Wapack Labs, une société de sécurité informatique, tout bâtiment qui s’avance dans le détroit de Singapour aura sur le pont une équipe complète de vigiles et d’opérateurs radars.

      De son côté, interrogé par le site « International Business Times », Todd Humphreys, un professeur à l’Université du Texas et spécialiste en systèmes de navigation par satellite, va plus loin dans la suspicion.

      Pour lui, cet accident semble « statistiquement très suspect ». Et il n’hésite pas à faire un parallèle avec un incident intervenu en juin en Mer noire et au cours duquel des signaux GPS auraient été trafiqués via, selon lui, « un signal qui provenait du continent russe ».

      La piste russe n’est cependant pas la seule à être soulevée. Interrogé par le site australien news.com, Itay Glick, un autre expert de cybersécurité qui a travaillé pour les services de renseignements israéliens, avance que si la Russie a les capacités d’effectuer une telle attaque, la Chine l’a également.

      « Je ne crois pas aux coïncidences », explique-t-il encore en rappelant que « l’erreur humaine » est toujours une solution de facilité pour expliquer un accident.

      À « l’expert » dont les pontifications concluent l’article, on fera remarquer que la Navy a viré tout l’état-major de l’USS Fitzgerald et on rappellera aux Échos que l’amiral Richardson met en avant une deuxième hypothèse « matérielle ».

      Certains font remarquer que les nombreuses gesticulations de la Navy dans un contexte où le nombre de bâtiments baisse pourraient avoir aboutir à une fatigue des équipements et des équipages…

      He added that even if the steering had been compromised it would be possible for the McCain to outrun the tanker, and that some degree of directionality would be possible by changing the speed of the port and starboard propellers.

      The “traffic situation” in the shipping channel at that time should be the focus of investigation, Ridzwan Rahmat, a senior defense and security analyst at Jane’s suggests.

      The signs were that the merchant ship was in compliance and the damage on the USS John S. McCain suggests that it wasn’t in compliance” of traffic rules at the time, he said.

      Sur l’incompétence des commentateurs, je remarque qu’aucun n’a fait la remarque que le navire de guerre coupe la route d’un bâtiment de commerce dans un rail…

      L’hypothèse d’une cyberattaque relève du délire. Mais peut-être que les hackers russes ou chinois dont déjà capables aujourd’hui de liquéfier les cervelles d’une équipe de quart en passerelle, après tout de quoi ne sont-ils pas capables ?

      Si le GPS est tombé en rade ou a été piraté, on dispose d’autres moyens de navigation, mille sabords, notamment en vue de terre. Bon sang, l’abordage a eu lieu à 5 miles du principal phare de la région et à 10 miles de la côte ! Si la passerelle a besoin du GPS pour naviguer, il y a lieu de s’interroger sur les compétences requises pour être officier de quart dans l’US Navy.

      Mais, de fait, on en est bien là : couper la route d’un navire dans le rail (je sais je me répète, mais ça ne passe pas !…)

Deployed Operational Employment and Risk Management (Force Employment), to include Combatant Commander mission requirements, theater security cooperation requirements, maintenance impacts, other competing priorities (fleet experimentation, concept development), and their corresponding impact to operational tempo (OPTEMPO) and fundamental mariner and seamanship proficiency;

      The bridge of each Navy destroyer is controlled by a round-the-clock shift of young officers, who must pass written and oral exams to qualify for the positions. Still, they typically are under 25 and may have little shipboard experience. Junior officers also move on to other assignments after limited tours.

      Are we shortchanging their basic training, especially as we rotate our junior officers every 18 to 24 months?” asked Admiral Crowder.

      Training for junior ship officers has changed significantly in recent years. In 2003, the Navy dropped what had been an intensive six-month training course on navigation, basic seamanship, engineering and maintenance before new officers were assigned to their first ship.

      Instead, the new officers were sent directly to a ship where they were supposed to learn on the job. Some said they got practical training on deployments, and noted that the Seventh Fleet had a reputation as being the most experienced in the Navy. But, many commanders said, crews were too busy to provide that kind of instruction.

      Navy tests of sailors on the five-and-dime schedule found lack of sleep led to blunted decision-making and reflexes that were roughly the same as those of sailors who had downed several beers.

      The Naval Postgraduate School has developed a shorter watch schedule to match circadian rhythms, which uses three hours of watch duty and nine hours off. Recognizing the benefits, submarines were ordered to move to a similar schedule in 2015.

      Mr. Cordle said adopting the schedule could result in greater safety. But the Navy has left scheduling up to individual captains, and three quarters of ships still use the five and dime.

McCain (DDG-56) collisions, the Navy is conducting investigations, relieving commanding officers, conducting safety stand downs (operational pauses), and retraining. This is a similar response to past mishaps, but this time the Navy must include true root cause analysis . Analysis after mishaps invariably uncovers human error and training deficiencies as causal factors. Some people get fired and others retrained. The Navy has begun to dig deeper with the CNO’s mandate for a fleet-wide investigation last week. I predict some of the findings of root causes will include the Navy’s approach to training and career development, surface warfare officer (SWO) culture, and high operational tempo (OpTempo) driving mission over people. 

      When a junior officer (JO) reports to a warship, he or she immediately has three jobs: standing watch under instruction, running a division, and earning qualifications (first as an officer of the deck and then as a SWO). Once qualified to be a watchstander, a JO is on the watch bill and expected to train the next batch of JOs. Depending on the number of qualified watchstanders on board, the watch rotation varies: “port and starboard” (6 hours on watch and 6 hours off); “five and dime” (5 hours on and 10 hours off watch, rotating); three or four section “chow to chow” rotating (based around mealtimes); “3 on/9 off” or “4 on/8 off” with two watches per day that do not change for a given underway. The “off” time is when a JO can accomplish day work, run the division, and work on qualifications—along with a little sleep and maybe squeeze in a run on the treadmill.

      Another root cause likely will be the alertness level of those watchstanders. Watch rotations vary greatly in the fleet, partly because of the variability in the number of qualified watchstanders and partly because of SWO culture. Many COs will direct the watches be run the way he or she experienced as a JO. The vast majority of Navy ships still use rotating watches, which is completely against human circadian rhythms. With rotating watches, everyone sleeps when they are off watch because they are in a constant state of exhaustion. Myriad sleep deprivation studies have proven that lack of sleep is cumulative. You can’t “catch up” on sleep, and decision-making is impaired just like being under the influence of alcohol or drugs. Yet the Navy has not addressed watch rotations to maximize crew rest. Instead, it perpetuates a culture where lack of sleep is a rite of passage, and the main risk assessment tool does not account for crew rest.

      The Singapore Transport Safety Investigation Bureau (TSIB) launched a marine safety investigation following the collision of the USS John S McCain and Liberian-flagged oil tanker Alnic MC on Aug 21. 

      A TSIB spokesperson said on Thursday (Aug 31) that the investigation was launched immediately after the collision, and the probe was being conducted in accordance with the International Maritime Organization’s Casualty Investigation Code in Singapore’s capacity as a coastal state.

      The US Coast Guard, on behalf of the US National Transportation Safety Board, and the Liberian Maritime Administration are participating in Singapore’s safety investigation as Substantially Interested States,” the spokesperson said. 

      To date, investigators have interviewed the crew members of the Alnic, while TSIB has been coordinating with the US Coast Guard to gather relevant information on the US guided-missile destroyer, including statements of account from its crew. 

      TISB has also obtained shipboard data from the Alnic and other ships in the vicinity at the time of the collision to support the Singapore-led safety investigation, the spokesperson said.

    Four years ago, leaflets were distributed around Upper Nazareth calling for an end to the application of the law allowing Israelis to live wherever they wanted. “Now is the time to defend our home!” the flyers declared. They were part of Upper Nazareth Mayor Shimon Gapso’s 2013 election campaign and were accompanied by billboards declaring “Upper Nazareth – Jewish forever.”
    Gapso won the election, although his term was cut short after he was jailed following a bribery conviction. His electoral pledge wasn’t the first on the subject. A year earlier, the chairman of the Yisrael Beiteinu party in city hall tried to initiate a plan that would have provided grants to Arab residents who sold their homes to Jews and then left Upper Nazareth. In fact, a decade ago, Gapso initiated a competition to choose a new name for the city so it didn’t sound like Nazareth – the Arab city in northern Israel it was established next to.
    Nevertheless, over the past decade there has been a substantial increase in the Arab population of Upper Nazareth: in 2015 the Central Bureau of Statistics said that 23.1 percent of the city’s residents were Arab. Yet there is a lack of recognition of the city’s diversity. By contrast, in Haifa – which is considered a mixed Jewish-Arab city – Arab residents comprise only 11 percent of the population.
    Haifa, though, has a different history and different customs. In the northern coastal city, there is no attempt to counter the statistics. In Upper Nazareth, there are more than 2,000 Arab schoolchildren but not a single Arab school, where Arabic would be the language of instruction. And, also unlike Haifa, there are no Christian or Muslim religious institutions - not even a cemetery.

    The bill does have an entire section on privacy, even though that didn’t make it into the title. But, as privacy advocates note, while it requires manufacturers to develop a privacy plan that spells out to consumers what is collected, used, shared and stored, and also tells them what choices they have regarding those practices, there is nothing in the bill that says who owns the data, and how owners can access or delete it.

    In response, the Electronic Privacy Information Center (EPIC) issued a statement arguing that, as they had recommended in testimony while the bill was being drafted, “consumers (should) control the personal information that is created and stored by the vehicles they operate, rent, and own”.

    Based on support for the bill, EPIC and other advocates have an uphill climb. It was reported out of committee on a unanimous (54-0) vote.

    The major focus of the bill is to create “a regulatory structure that allows for industry to safely innovate with significant government oversight,” according to committee chairman Greg Walden (R-Ore.).

    It also includes a section on cybersecurity, but the language is not terribly reassuring there either, when it comes to vehicles moving at 65mph (105kph) miles per hour or more. It requires only that manufacturers have cybersecurity practices that will guard against “reasonably foreseeable” risks. Try getting agreement on that in a courtroom.

    Besides the lack of anything explicit about who owns the data generated by the vehicle, EPIC also objected, in a letter to the committee in June, to a provision that forbids states, “from issuing any rule, regulation, or law that is not identical to a previously issued Federal Motor Vehicle Safety Standard (FMVSS) issued by NHTSA (National Highway Transportation Safety Administration), including in the areas of software and communications systems”.

      Qatar Airways aircraft can now access limited Bahraini and the UAE airspace after the nations approved a new route for the airline.

      The move follows a directive from a UN aviation body to Gulf states, telling them to honor their airspace agreements with Qatar.

      The route opening is being seen as a significant step, some two months after the introduction of punitive airspace restrictions were put into place.

      The countries made the announcement through NOTAMs (information notices for pilots). The route is effective from Aug. 7 until Nov. 6 this year.

      Only aircraft heading into Doha can use the airway, but it should make flight planning a little easier for Qatar Airways.

      The carrier must currently route all of its aircraft through very limited air corridors in and out of Doha.

      Access to Bahrain’s airspace is critical for the airline, as it actually encircles Qatar.

      Bahrain has also signaled further changes to airspace access in another NOTAM it published effective Aug. 17, but has not yet given any more details about it.

      The decision to open up the new airway comes a week after the International Civil Aviation Organization met at Qatar’s request to discuss the legality of closed air links.

      In a statement today, Qatar Civil Aviation Authority (QCAA) Chairman Abdullah bin Nasser Turki Al-Subaie said that new route was a direct result of the ICAO meeting.

      The airway is over international waters, an area which is supposed to be available to everyone, the statement added.

      However, it’s important to note that Qatar Airways aircraft are still not allowed to fly over UAE and Bahrain directly.

      Since the blockade began, Qatar Airways aircraft have been unable to fly over or into Saudi Arabia, Bahrain, Egypt and the UAE.

      He described the brutal yesterday’s notary Valentina Mehandiyska and her daughter, and on a white day in the center of Sofia as a fine, straightforward and respected citizen lawyer. So she does not think her attack is related to the profession.

      So far, there have never been complaints. I do not see how her business violated her interests in order for her daughter to be beaten in front of her eyes, the notary pointed out. But it is possible, however, in case of a refusal to commit a violation, the notary to be subjected to aggression, the lawyer added.

      The notary is not a private person who performs state functions. And every attack - is a disrespect for statehood. These attacks must be qualified because the object is not only the notary but also statehood, Dimitar Tanev commented.

      So far, the motive for crime is not clear. The police are searching for the attackers. So far, no detained.

    According to many observers, economic globalization and the liberalization of telecoms/internet policy have remade the world in the image of the United States. The dominant roles of Amazon, Apple, Facebook, and Google have also led to charges of US internet imperialism. This article, however, argues that while these internet giants dominate some of the most popular internet services, the ownership and control of core elements of the internet infrastructure—submarine cables, internet exchange points, autonomous system numbers, datacenters, and so on—are tilting increasingly toward the EU and BRICS (i.e., Brazil, Russia, India, China, and South Africa) countries and the rest of the world, complicating views of hegemonic US control of the internet and what Susan Strange calls the knowledge structure.

    This article takes a different tack. It argues that while US-based internet giants do dominate some of the middle and top layers of the internet—for example, operating systems (iOS, Windows, Android), search engines (Google), social networks (Facebook), online retailing (Amazon), over-the-top TV (Netflix), browsers (Google Chrome, Apple Safari, Microsoft Explorer), and domain names (ICANN)—they do not rule the hardware, or material infrastructure, upon which the internet and daily life, business, governments, society, and war increasingly depend. In fact, as the article shows, ownership and control of many core elements of the global internet infrastructure—for example, fiber optic submarine cables, content delivery networks (CDNs), autonomous system numbers (ASN), and internet exchange points (IXPs)—are tilting toward the rest of the world, especially Europe and the BRICS (i.e., Brazil, Russia, India, China, and South Africa). This reflects the fact that the United States’ standing in the world is slipping while an ever more multipolar world is arising.

    International internet backbone providers, internet content companies, and CDNs interconnect with local ISPs and at one or more of the nearly 2000 IXPs around the world. The largest IXPs are in New York, London, Amsterdam, Frankfurt, Seattle, Chicago, Moscow, Sao Paulo, Tokyo, and Hong Kong. They are core elements of the internet that switch traffic between all the various networks that comprise the internet system, and help to establish accessible, affordable, fast, and secure internet service.

    In developed markets, internet companies such as Google, Baidu, Facebook, Netflix, Youku, and Yandex use IXPs to interconnect with local ISPs such as Deutsche Telecoms in Germany, BT or Virgin Media in Britain, or Comcast in the United States to gain last-mile access to their customers—and vice versa, back up the chain. Indeed, 99 percent of internet traffic handled by peering arrangements among such parties occurs without any money changing hands or a formal contract.50 Where IXPs do not exist or are rare, as in Africa, or run poorly, as in India, the cost of bandwidth is far more expensive. This is a key factor that helps to explain why internet service is so expensive in areas of the world that can least afford it. It is also why the OECD and EU encourage developing countries to make IXPs a cornerstone of economic development and telecoms policy work.

    The network of networks that make up the internet constitute a sprawling, general purpose platform upon which financial markets, business, and trade, as well as diplomacy, spying, national security, and war depend. The world’s largest electronic payments system operator, the Society for Worldwide Interbank Financial Telecommunications’ (SWIFT) secure messaging network carries over 25 million messages a day involving payments that are believed to be worth over $7 trillion USD.59 Likewise, the world’s biggest foreign currency settlement system, the CLS Bank, executes upward of a million trades a day worth between $1.5 and $2.5 trillion over the global cable systems—although that is down by half from its high point in 2008.60 As Stephen Malphrus, former chief of staff to the US Federal Reserve Chairman Ben Bernanke, observed, when “communications networks go down, the financial services sector does not grind to a halt, rather it snaps to a halt.”61

    Governments and militaries also account for a significant portion of internet traffic. Indeed, 90 to 95 percent of US government traffic, including sensitive diplomatic and military orders, travels over privately owned cables to reach officials in the field.62 “A major portion of DoD data traveling on undersea cables is unmanned aerial vehicle video,” notes a study done for the Department of Homeland Security by MIT scholar Michael Sechrist.63 Indeed, the Department of Defense’s entire Global Information Grid shares space in these cables with the general public internet.64

    The 3.6 billion people as of early 2016 who use the internet to communicate, share music, ideas and knowledge, browse, upload videos, tweet, blog, organize social events and political protests, watch pornography, read sacred texts, and sell stuff are having the greatest influence on the current phase of internet infrastructure development. Video currently makes up an estimated two-thirds of all internet traffic, and is expected to grow to 80 percent in the next five years,69 with US firms leading the way. Netflix single-handedly accounts for a third of all internet traffic. YouTube is the second largest source of internet traffic on fixed and mobile networks alike the world over. Altogether, the big five internet giants account for roughly half of all “prime-time” internet traffic, a phrasing that deliberately reflects the fact that internet usage swells and peaks at the same time as the classic prime-time television period, that is, 7 p.m. to 11 p.m.

    Several things stand out from this analysis. First, in less than a decade, Google has carved out a very large place for itself through its ownership role in four of the six projects (the SJC, Faster, Unity, and Pacific Cable Light initiatives), while Facebook has stakes in two of them (APG and PLCN) and Microsoft in the PLCN project. This is a relatively new trend and one that should be watched in the years ahead.

    A preliminary view based on the publicly available information is that the US internet companies are important but subordinate players in consortia dominated by state-owned national carriers and a few relatively new competitors. Keen to wrest control of core elements of the internet infrastructure that they perceive to have been excessively dominated by United States interests in the past, Asian governments and private investors have joined forces to change things in their favor. In terms of the geopolitical economy of the internet, there is both a shift toward the Asia-Pacific region and an increased role for national governments.

    Return of the State as Regulator of Concentrated Markets

    In addition to the expanded role of the state as market builder, regulator, and information infrastructure policy maker, many regulators have also rediscovered the reality of significant market concentration in the telecom-internet and media industries. Indeed, the US government has rejected several high-profile telecoms mergers in recent years, such as AT&T’s proposal to take over T-Mobile in 2011, T-Mobile’s bid for Sprint in 2014, and Comcast’s attempt to acquire Time Warner Cable last year. Even the approval of Comcast’s blockbuster takeover of NBC Universal in 2011, and Charter Communications acquisition of Time Warner Cable last year, respectively, came with important strings attached and ongoing conduct regulation designed to constrain the companies’ ability to abuse their dominant market power.87 The FCC’s landmark 2016 ruling to reclassify broadband internet access as a common carrier further indicated that US regulators have been alert to the realities of market concentration and telecoms-internet access providers’ capacity to abuse that power, and the need to maintain a vigilant eye to ensure that their practices do not swamp people’s rights to freely express themselves, maintain control over the collection, retention, use, and disclosure of their personal information, and to access a diverse range of services over the internet.88 The 28 members of the European Union, along with Norway, India, and Chile, have adopted similar “common carriage/network neutrality/open network”89 rules to offset the reality that concentration in core elements of these industries is “astonishingly high”90 on the basis of commonly used indicators (e.g., concentration ratios and the Herfindahl–Hirschman Index).

    These developments indicate a new phase in internet governance and control. In the first phase, circa the 1990s, technical experts and organizations such as the Internet Engineers Task Force played a large role, while the state sat relatively passively on the sidelines. In the second phase, circa the early to mid-2000s, commercial forces surged to the fore, while internet governance revolved around the ICANN and the multi-stakeholder model. Finally, the revelations of mass internet surveillance by many states and ongoing disputes over the multi-stakeholder, “internet freedom” agenda on the one side, versus the national sovereignty, multilateral model where the ITU and UN system would play a larger role in internet governance all indicate that significant moves are afoot where the relationship between states and markets is now in a heightened state of flux.

    Such claims, however, are overdrawn. They rely too heavily on the same old “realist,” “struggle for control” model where conflict between nation-states has loomed large and business interests and communication technologies served mainly as “weapons of politics” and the handmaidens of national interests from the telegraph in the nineteenth century to the internet today. Yet, nation-states and private business interests, then and now, not only compete with one another but also cooperate extensively to cultivate a common global space of economic accumulation. Communication technologies and business interests, moreover, often act independent of the nation-state and via “private structures of cooperation,” that is, cartels and consortia, as the history and contemporary state of the undersea cable networks illustrate. In fact, the internet infrastructure of the twenty-first century, much like that of the industrial information infrastructure of the past 150 years, is still primarily financed, owned, and operated by many multinational consortia, although more than a few submarine communications cables are now owned by a relatively new roster of competitive players, such as Tata, Level 3, Global Cloud Xchange, and so forth. They have arisen mostly in the last 20 years and from new quarters, such as India in the case of Tata, for example.

    Some researchers share their papers before publication and let Google give suggestions, according to thousands of pages of emails obtained by the Journal in public-records requests of more than a dozen university professors. The professors don’t always reveal Google’s backing in their research, and few disclosed the financial ties in subsequent articles on the same or similar topics, the Journal found.

    In some years, Google officials in Washington compiled wish lists of academic papers that included working titles, abstracts and budgets for each proposed paper—then they searched for willing authors, according to a former employee and a former Google lobbyist.

    Google promotes the research papers to government officials, and sometimes pays travel expenses for professors to meet with congressional aides and administration officials, according to the former lobbyist. The research has been used, for instance, to deflect antitrust accusations against Google by the Federal Trade Commission in 2012, according to a letter Google attorneys sent to the FTC chairman and viewed by the Journal.

    Two weeks before Prime Minister Benjamin Netanyahu is due to join a diplomatic summit in Budapest, tension erupted between Israel and Hungary over a speech by Hungarian Prime Minister Viktor Orban in which he praised the leader of Hungary during the Holocaust, Miklos Horthy, who collaborated with the Nazis. Israel protested the remarks, but according to a senior Israeli official, Jerusalem agreed to accept a weak clarification by the Hungarian foreign minister in order to avoid damaging the upcoming summit.

    The affair began on June 21, when at a political rally of Fidesz, the party Orban heads, the prime minister said of Horthy, who was regent of the Kingdom of Hungary from 1920 to 1944: “The fact that history did not bury us after World War I was thanks to a number of extraordinary statesmen like the regent, Miklos Horthy. This fact cannot be contradicted by mentioning the unfortunate role of Hungary during World War II.”

    According to the Yad Vashem Holocaust memorial, Horthy led anti-Semitic policies, passed laws against the Jews over the years, was an ally of Adolf Hitler and collaborated with the Nazis during World War II. From 1942 to 1943, Horthy resisted German pressure to place the Jews in ghettos and deport them to extermination camps. But after Germany conquered Hungary in 1944, Horthy appointed a puppet government obedient to the Nazis and gave it full authority to act against the Jews. As a result, half a million Hungarian Jews were sent to extermination camps; most were murdered in Auschwitz.

    Orban’s remarks were made as part of an extremist nationalist and racist campaign he is conducting ahead of elections in 2018 and to prevent his party’s voters from leaving it for the extreme right-wing party Jobbik. One of Orban’s close advisers is the American political consultant Arthur Finkelstein. The latter served as campaign director for Benjamin Netanyahu’s and Likud’s campaigns in 1996 and 1999, and for Yisrael Beiteinu and its chairman, Avigdor Lieberman, in 2006. He was also deeply involved in the Likud and Yisrael Beiteinu’s joint campaign in 2013.

    Orban’s statements drew criticism from the Hungarian Jewish community and the World Jewish Congress. The United States Holocaust Memorial Museum in Washington D.C., the leading institution in Holocaust research in the United States, released an unusually harsh statement in response to Orban’s remarks: “The United States Holocaust Memorial Museum condemns any attempt to rehabilitate the reputation of Hungary’s wartime leader, Miklos Horthy, who was a vocal anti-Semite and complicit in the murder of the country’s Jewish population during the Holocaust.”

    The U.S. museum also wrote that Orban’s praise for Horthy as a statesman was “a gross distortion of historical fact and is the latest in a long series of propagandistic attempts of the Fidesz political party and the Hungarian government that Mr. Orban leads to rewrite Hungarian history.”
    Orban’s remarks placed Israel in an embarrassing position considering that Netanyahu is to meet his Hungarian counterpart at a summit in Budapest on July 18, and the next day he and Orban are to meet with the leaders of Czech Republic, Slovakia and Poland. This is Netanyahu’s first visit to Hungary since he returned to the prime minister’s office in 2009.
    Still, Orban’s remarks required a response by the government in Jerusalem and four days after the speech, Israel’s ambassador in Budapest, Yossi Amrani, issued a statement noting that Orban’s words were very disturbing and the collaboration of the Horthy regime with the Nazis must not be forgotten, as well as the race laws enacted during his time and the destruction of Hungary’s Jewish community. “Whatever the reason and national goal might be, there is no justification for such statements,” Amrani said in a public statement.
    A senior Israeli official said that Amrani also communicated through quiet channels with senior officials in the Hungarian Prime Minister’s Office and the Foreign Ministry in Budapest, demanding clarifications and saying Israel hoped Orban’s statements would not cast a pall over the upcoming summit. A few days later, when the Hungarian government had still not issued a clarification, Amrani gave an interview on a major Hungarian television station and reiterated Israel’s demand for clarification and a warning that the tension could hurt the summit.
    Quiet diplomatic contacts had been underway since Wednesday in an attempt to resolve the crisis, and on Saturday Foreign Minister Peter Szijjarto spoke by phone to Amrani to put an end to the affair. In a statement to the press released after the phone call, Szijjarto said he had made clear to the Israeli ambassador that the Hungarian government had zero tolerance for any kind of anti-Semitism.
    Szijjarto also said that he told Amrani that “the regime of Miklos Horthy had its positive times but also very negative times and we must respect the historical facts that clearly indicate this.” The foreign minister added that the positive part of Horthy’s legacy was his work to stabilize Hungary after World War I, but the very negative part was “his historical sin,” when contrary to his promises he did not protect the Jewish community, passed laws against it and that hundreds of thousands of Hungarian Jews were killed in the Holocaust. “All of these are historical sins whose seriousness cannot be diminished,” Szijjarto said.
    Although Szijjarto did not clarify Orban’s remarks, apologize or express regret for them, the Prime Minister’s Office and the Foreign Ministry in Jerusalem, with an eye on the upcoming summit, decided to act with restraint and end the affair. Foreign Ministry spokesman Emmanuel Nahshon said in response: “Israel believes that the statements by the Hungarian foreign minister to the Israeli ambassador in Budapest constitute an important clarification with regard to recognition of Horthy’s crime against the Jews of Hungary. We will always remember the 564,500 of our brothers and sisters of the Jewish community of Hungary who were murdered in the Holocaust.”
    Zionist Union Ksenia Svetlova turned to Netanyahu on the issue. “As you dared to cancel your meeting with the German foreign minister after he met with Breaking the Silence, I demand that you cancel your visit to Hungary and your meeting with Viktor Orban, who has expressed sympathy for his country’s dark past from the time of the Holocaust, and not for the first time.”
    "I expect the person who turned the ’whole world is against us’ [mantra] into a career to have the same standards against people from the extreme right in the world," she added.
    “These says I am working on an amendment to the proposed entry into Israeli law so that it prohibits the entry into Israel of declared anti-Semites, people who oddly enough have become his party’s partners, and are even invited by them to visits to Israel,” Svetlova said.
