    #Soudan : les #milices #Janjawid garde-frontières ou #passeurs ?

    Dans un communiqué, les #Forces_de_soutien_rapide (#RSF), groupe paramilitaire servant de “garde-frontières” au Soudan, ont annoncé avoir arrêté 138 migrants africains, jeudi 19 septembre. Pour le spécialiste Jérôme Tubiana, cette annonce fait partie d’une stratégie : le Soudan cherche à attirer l’attention de l’Union européenne qui a arrêté de lui verser des fonds.

    Les Forces de soutien rapide (RSF), une organisation paramilitaire soudanaise, ont annoncé avoir arrêté, jeudi 19 septembre, 138 Africains qui souhaitaient pénétrer “illégalement” en Libye. Parmi eux, se trouvaient des dizaines de Soudanais mais aussi des Tchadiens et des Éthiopiens.

    "Le 19 septembre, une patrouille des RSF a arrêté 138 personnes de différentes nationalités qui essayaient de traverser illégalement la frontière avec la Libye", précise le communiqué.

    Une partie de ces migrants ont été incarcérés dans la zone désertique de #Gouz_Abudloaa, situé environ à 100 km au nord de Khartoum, comme ont pu le constater des journalistes escortés sur place par des RSF, mercredi 25 septembre. Dans le communiqué, les RSF assurent également avoir saisi six véhicules appartenant à des passeurs libyens chargés du transit des migrants.

    Le même jour, le Soudan a décidé de fermer ses #frontières avec la Libye et la Centrafrique pour des raisons de sécurité. Dans les faits, le pays souhaite mettre fin aux départs de rebelles soudanais vers la Libye, qui sont parfois rejoints par des migrants.

    Créées en 2013 par l’ex-président soudanais, Omar el-Béchir, les RSF assurent le maintien de l’ordre dans le pays. Trois ans après leur création, elles ont été dotées d’une mission supplémentaire : empêcher les migrants et les rebelles de franchir les frontières nationales. C’est ce que montrent notamment des chercheurs dans un rapport publié par un think tank néerlandais, Clingendael, publié en septembre 2018.

    Les Forces de soutien rapide, véritables gardes-frontières du Soudan

    Si le document pointe une politique soudanaise de surveillance des frontières "en grande partie assignée aux ‘forces de soutien rapide’ (RSF)", derrière cette appellation officielle, se cache une réalité plus sombre. Connue localement sous le nom de Janjawid, cette milice fait notamment l’objet d’une enquête du Conseil militaire de transition, qui dirige le Soudan depuis la destitution, le 11 avril, du président Omar el-Béchir.

    D’après les conclusions de l’enquête, rendues publiques samedi 27 juillet, les RSF auraient frappé et tiré sur des manifestants lors d’un sit-in, le 3 juin, à Khartoum, alors qu’ils étaient venus protester contre la politique d’Omar el-Béchir. Si d’après un groupe de médecins, 127 manifestants ont été tués, le commission d’enquête compte, de son côté, 87 morts. Cette répression violente avait provoqué, dans la foulée, un levé de boucliers à l’échelle internationale.

    Un groupe armé qui a bénéficié de fonds européens

    Certains RSF sont aussi accusés d’avoir commis des exactions dans la région du Darfour, à l’ouest du Soudan. Le rapport précise pourtant que, grâce aux fonds versés par l’Union européenne, ils “sont mieux équipés, mieux financés et déployés non seulement au Darfour, mais partout au Soudan". D’après ce document, "160 millions d’euros ont été alloués au Soudan" entre 2016 et 2017. Et, une partie de cet argent a été versé par Khartoum aux RSF. Leur chef, Hemeti, est d’ailleurs officiellement le numéro 2 du Conseil militaire de transition.

    Fin juillet, l’Union européenne a toutefois annoncé le gel de ses financements au Soudan. "L’Union européenne a pris peur. Elle a considéré que cette coopération avec le Soudan était mauvaise pour son image car, depuis plusieurs années, elle finançait un régime très violent envers les migrants et les civils", explique Jérôme Tubiana, chercheur spécialiste du Soudan et co-auteur du rapport néerlandais.

    Non seulement les passeurs demandent de l’argent aux migrants mais ce ne sont pas les seuls à leur en réclamer. "La milice Janjawid taxe les migrants, elle joue à un double-jeu", dénonce sur RFI, Clotilde Warin, journaliste chercheuse et co-auteure du rapport. "Les miliciens […] qui connaissent très bien la zone frontalière entre le Soudan, le Tchad et le Niger […] deviennent eux-mêmes des passeurs, ils utilisent les voitures de l’armée soudanaise, le fuel de l’armée soudanaise. C’est un trafic très organisé."

    "Les RSF profitent de leur contrôle de la route migratoire pour vendre les migrants à des trafiquants libyens", ajoute, de son côté, Jérôme Tubiana, qui estime que ces miliciens s’enrichissent plus sur le dos des migrants qu’ils ne les arrêtent.

    Annoncer l’arrestation d’un convoi est donc un moyen, pour les RSF, de faire du chantage à l’Europe. "Ils essayent de lui dire que si elle veut moins de migrants sur son territoire, elle doit apporter son soutien aux RSF car, ils sont les seuls à connaître cette région dangereuse", précise Jérôme Tubiana, ajoutant qu’Hemeti, fragilisé, est en recherche de soutiens politiques.

    Un membre des RSF, interrogé dans le cadre de l’enquête néerlandaise, reconnaît lui-même le rôle actif de la milice dans le trafic des migrants. "De temps en temps, nous interceptons des migrants et nous les transférons à Khartoum, afin de montrer aux autorités que nous faisons le travail. Nous ne sommes pas censés prendre l’argent des migrants, [nous ne sommes pas censés] les laisser s’échapper ou les emmener en Libye… Mais la réalité est assez différente…", lit-on dans le rapport.

      EU suspends migration control projects in Sudan amid repression fears

      The EU has suspended projects targeting illegal migration in Sudan. The move comes amid fears they might have aided security forces responsible for violently repressing peaceful protests in the country, DW has learned.

      An EU spokesperson has confirmed to DW that a German-led project that organizes the provision of training and equipment to Sudanese border guards and police was “halted” in mid-March, while an EU-funded intelligence center in the capital, Khartoum, has been “on hold” since June. The EU made no public announcements at the time.

      The initiatives were paid for from a €4.5 billion ($5 billion) EU fund for measures in Africa to control migration and address its root causes, to which Germany has contributed over €160 million. Sudan is commonly part of migration routes for people aiming to reach Europe from across Africa.

      Critics had raised concerns that working with the Sudanese government on border management could embolden repressive state forces, not least the notorious Rapid Support Forces (RSF) militia, which is accused by Amnesty International of war crimes in Sudan’s Darfur region. An EU summary of the project noted that there was a risk that resources could be “diverted for repressive aims.”

      Support for police

      A wave of protest swept the country in December, with demonstrators calling for the ouster of autocratic President Omar al-Bashir. Once Bashir was deposed in April, a transitional military council, which includes the commander of the RSF as deputy leader, sought to restore order. Among various incidents of repression, the militia was blamed for a massacre on June 3 in which 128 protesters were reportedly killed.

      While the EU maintains it has provided neither funding nor equipment to the RSF, there is no dispute that Sudanese police, who also stand accused of brutally repressing the protests, received training under the programs.

      Dr. Lutz Oette, a human rights expert at the School of Oriental and African Studies (SOAS), told DW: “The suspension is the logical outcome of the change in circumstances but it exposes the flawed assumptions of the process as far as working with Sudan is concerned.”

      Oette said continuing to work with the Sudanese government would have been incompatible with the European Union’s positions on human rights, and counterproductive to the goal of tackling the root causes of migration.

      Coordination center

      The intelligence center, known as the Regional Operational Center in Khartoum (ROCK), was to allow the security forces of nine countries in the Horn of Africa to share intelligence about human trafficking and people smuggling networks.

      A spokesperson for the European Commission told DW the coordination center had been suspended since June “until the political/security situation is cleared,” with some of its staff temporarily relocated to Nairobi, Kenya. Training and some other activities under the Better Migration Management (BMM) program were suspended in mid-March “because they require the involvement of government counterparts to be carried out.” The EU declined to say whether the risk of support being provided to repressive forces had contributed to the decision.

      The spokesperson said other EU activities that provide help to vulnerable people in the country were continuing.

      An official EU document dated December 2015 noted the risk that the provision of equipment and training to security services and border guards could be “diverted for repressive aims” or subject to “criticism by NGOs and civil society for engaging with repressive governments on migration (particularly in Eritrea and Sudan).”

      ’Regular monitoring’

      The BMM program is being carried out by a coalition of EU states — France, Germany, Italy, the Netherlands, the United Kingdom — and aid agencies led by the German development agency GIZ. It includes projects in 11 African countries under the auspices of the “Khartoum process,” an international cooperation initiative targeting illegal migration.

      The ROCK intelligence center, which an EU document shows was planned to be situated within a Sudanese police training facility, was being run by the French state-owned security company Civipol.

      The EU spokesperson said, “Sudan does not benefit from any direct EU financial support. No EU funding is decentralized or channeled through the Sudanese government.”

      “All EU-funded activities in Sudan are implemented by EU member states development agencies, the UN, international organizations and NGOs, who are closely scrutinized through strict and regular monitoring during projects’ implementation,” the spokesperson added.

      A spokesperson for GIZ said: “The participant lists of BMM’s training courses are closely coordinated with the [Sudanese government] National Committee for Combating Human Trafficking (NCCHT) to prevent RSF militiamen taking part in training activities.”

      The GIZ spokesperson gave a different explanation for the suspension to that of the EU, saying the program had been stopped “in order not to jeopardize the safety of [GIZ] employees in the country.” The spokesperson added: “Activities in the field of policy harmonization and capacity building have slowly restarted.”

    By Stifling Migration, Sudan’s Feared Secret Police Aid Europe

    At Sudan’s eastern border, Lt. Samih Omar led two patrol cars slowly over the rutted desert, past a cow’s carcass, before halting on the unmarked 2,000-mile route that thousands of East Africans follow each year in trying to reach the Mediterranean, and then onward to Europe.

    His patrols along this border with Eritrea are helping Sudan crack down on one of the busiest passages on the European migration trail. Yet Lieutenant Omar is no simple border agent. He works for Sudan’s feared secret police, whose leaders are accused of war crimes — and, more recently, whose officers have been accused of torturing migrants.

    Indirectly, he is also working for the interests of the European Union.

    “Sometimes,” Lieutenant Omar said, “I feel this is Europe’s southern border.”

    Three years ago, when a historic tide of migrants poured into Europe, many leaders there reacted with open arms and high-minded idealism. But with the migration crisis having fueled angry populism and political upheaval across the Continent, the European Union is quietly getting its hands dirty, stanching the human flow, in part, by outsourcing border management to countries with dubious human rights records.

    In practical terms, the approach is working: The number of migrants arriving in Europe has more than halved since 2016. But many migration advocates say the moral cost is high.

    To shut off the sea route to Greece, the European Union is paying billions of euros to a Turkish government that is dismantling its democracy. In Libya, Italy is accused of bribing some of the same militiamen who have long profited from the European smuggling trade — many of whom are also accused of war crimes.

    In Sudan, crossed by migrants trying to reach Libya, the relationship is more opaque but rooted in mutual need: The Europeans want closed borders and the Sudanese want to end years of isolation from the West. Europe continues to enforce an arms embargo against Sudan, and many Sudanese leaders are international pariahs, accused of committing war crimes during a civil war in Darfur, a region in western Sudan.

    But the relationship is unmistakably deepening. A recent dialogue, named the Khartoum Process (in honor of Sudan’s capital) has become a platform for at least 20 international migration conferences between European Union officials and their counterparts from several African countries, including Sudan. The European Union has also agreed that Khartoum will act as a nerve center for countersmuggling collaboration.

    While no European money has been given directly to any Sudanese government body, the bloc has funneled 106 million euros — or about $131 million — into the country through independent charities and aid agencies, mainly for food, health and sanitation programs for migrants, and for training programs for local officials.

    “While we engage on some areas for the sake of the Sudanese people, we still have a sanction regime in place,” said Catherine Ray, a spokeswoman for the European Union, referring to an embargo on arms and related material.

    “We are not encouraging Sudan to curb migration, but to manage migration in a safe and dignified way,” Ms. Ray added.

    Ahmed Salim, the director of one of the nongovernmental groups that receives European funding, said the bloc was motivated by both self-interest and a desire to improve the situation in Sudan.

    “They don’t want migrants to cross the Mediterranean to Europe,” said Mr. Salim, who heads the European and African Center for Research, Training and Development.

    But, he said, the money his organization receives means better services for asylum seekers in Sudan. “You have to admit that the European countries want to do something to protect migrants here,” he said.

    Critics argue the evolving relationship means that European leaders are implicitly reliant on — and complicit in the reputational rehabilitation of — a Sudanese security apparatus whose leaders have been accused by the United Nations of committing war crimes in Darfur.

    “There is no direct money exchanging hands,” said Suliman Baldo, the author of a research paper about Europe’s migration partnership with Sudan. “But the E.U. basically legitimizes an abusive force.”

    On the border near Abu Jamal, Lieutenant Omar and several members of his patrol are from the wing of the Sudanese security forces headed by Salah Abdallah Gosh, one of several Sudanese officials accused of orchestrating attacks on civilians in Darfur.

    Elsewhere, the border is protected by the Rapid Support Forces, a division of the Sudanese military that was formed from the janjaweed militias who led attacks on civilians in the Darfur conflict. The focus of the group, known as R.S.F., is not counter-smuggling — but roughly a quarter of the people-smugglers caught in January and February this year on the Eritrean border were apprehended by the R.S.F., Lieutenant Omar said.

    European officials have direct contact only with the Sudanese immigration police, and not with the R.S.F., or the security forces that Lieutenant Omar works for, known as N.I.S.S. But their operations are not that far removed.

    The planned countertrafficking coordination center in Khartoum — staffed jointly by police officers from Sudan and several European countries, including Britain, France and Italy — will partly rely on information sourced by N.I.S.S., according to the head of the immigration police department, Gen. Awad Elneil Dhia. The regular police also get occasional support from the R.S.F. on countertrafficking operations in border areas, General Dhia said.

    “They have their presence there and they can help,” General Dhia said. “The police is not everywhere, and we cannot cover everywhere.”

    Yet the Sudanese police are operating in one unexpected place: Europe.

    In a bid to deter future migrants, at least three European countries — Belgium, France and Italy — have allowed in Sudanese police officers to hasten the deportation of Sudanese asylum seekers, General Dhia said.

    Nominally, their official role is simply to identify their citizens. But the officers have been allowed to interrogate some deportation candidates without being monitored by European officials with the language skills to understand what was being said.

    More than 50 Sudanese seeking asylum in Europe have been deported in the past 18 months from Belgium, France and Italy; The New York Times interviewed seven of them on a recent visit to Sudan.

    Four said they had been tortured on their return to Sudan — allegations denied by General Dhia. One man was a Darfuri political dissident deported in late 2017 from France to Khartoum, where he said he was detained on arrival by N.I.S.S. agents.

    Over the next 10 days, he said he was given electric shocks, punched and beaten with metal pipes. At one point the dissident, who asked that his name be withheld for his safety, lost consciousness and had to be taken to the hospital. He was later released on a form of parole.

    The dissident said that, before his deportation from France, Sudanese police officers had threatened him as French officers stood nearby. “I said to the French police: ‘They are going to kill us,’” he said. “But they didn’t understand.”

    European officials argue that establishing Khartoum as a base for collaboration on fighting human smuggling can only improve the Sudanese security forces. The Regional Operational Center in Khartoum, set to open this year, will enable delegates from several European and African countries to share intelligence and coordinate operations against smugglers across North Africa.

    But potential pitfalls are evident from past collaborations. In 2016, the British and Italian police, crediting a joint operation with their Sudanese counterparts, announced the arrest of “one of the world’s most wanted people smugglers.” They said he was an Eritrean called Medhanie Yehdego Mered, who had been captured in Sudan and extradited to Italy.

    The case is now privately acknowledged by Western diplomats to have been one of mistaken identity. The prisoner turned out to be Medhanie Tesfamariam Berhe, an Eritrean refugee with the same first name as the actual smuggler. Mr. Mered remains at large.

    Even General Dhia now admits that Sudan extradited the wrong man — albeit one who, he says, admitted while in Sudanese custody to involvement in smuggling.

    “There were two people, actually — two people with the same name,” General Dhia said.

    Mr. Berhe nevertheless remains on trial in Italy, accused of being Mr. Mered — and of being a smuggler.

    Beyond that, the Sudanese security services have long been accused of profiting from the smuggling trade. Following European pressure, the Sudanese Parliament adopted a raft of anti-smuggling legislation in 2014, and the rules have since led to the prosecution of some officials over alleged involvement in the smuggling business.

    But according to four smugglers whom I interviewed clandestinely during my trip to Sudan, the security services remain closely involved in the trade, with both N.I.S.S and R.S.F. officials receiving part of the smuggling profits on most trips to southern Libya.

    The head of the R.S.F., Brig. Mohammed Hamdan Daglo, has claimed in the past that his forces play a major role in impeding the route to Libya. But each smuggler — interviewed separately — said that the R.S.F. was often the main organizer of the trips, often supplying camouflaged vehicles to ferry migrants through the desert.

    After being handed over to Libyan militias in Kufra and Sabha, in southern Libya, many migrants are then systematically tortured and held for ransom — money that is later shared with the R.S.F., each smuggler said.

    Rights activists have previously accused Sudanese officials of complicity in trafficking. In a 2014 report, Human Rights Watch said that senior Sudanese police officials had colluded in the smuggling of Eritreans.

    A British journalist captured by the R.S.F. in Darfur in 2016 said that he had been told by his captors that they were involved in smuggling people to Libya. “I asked specifically about how it works,” said the journalist, Phil Cox, a freelance filmmaker for Channel 4. “And they said we make sure the routes are open, and we talk with whoever’s commanding the next area.”

    General Dhia said that the problem did not extend beyond a few bad apples. Sudan, he said, remains an effective partner for Europe in the battle against irregular migration.

    “We are not,” he said, “very far from your standards.”

      L’Europe collabore avec un dictateur pour mieux expulser vers le Soudan

      Lorsqu’il s’agit d’expulser des étrangers jugés indésirables, rien ne semble devoir arrêter l’Union européenne (UE) et ses États membres qui n’hésitent pas à se compromettre avec Omar el-Béchir, le chef d’État du Soudan qui fait l’objet de deux mandats d’arrêt internationaux pour génocide, crimes contre l’Humanité et crimes de guerre.

      Il y a longtemps que l’UE a fait le choix de sous-traiter à des pays tiers, sous couvert d’un partenariat inéquitable et avec des fonds issus du développement, la lutte contre l’immigration irrégulière et même la gestion de la demande d’asile. Ce processus d’externalisation, qui s’accompagne de la délocalisation de la surveillance des frontières européennes très en amont de leur matérialisation physique, a été encore renforcé à la suite de la si mal nommée « crise des réfugiés » [1].

      Ainsi, dans le cadre du Processus de Khartoum, initié par l’UE en 2014 et consolidé suite au Sommet de La Valette de fin 2015, les régimes les plus répressifs, tels que le Soudan et l’Erythrée – que des dizaines de milliers de demandeurs d’asile cherchent à fuir – bénéficient de subsides pour retenir leur population et « sécuriser » leurs frontières… sans que l’UE ne se préoccupe des atteintes dramatiques portées aux droits humains dans ces pays.

      Dans ce domaine, l’UE et les États membres agissent de concert. Ainsi, de nombreux pays européens n’hésitent pas à renvoyer vers Khartoum des ressortissants soudanais - peu importe qu’il puisse s’agir de demandeurs d’asile - et à collaborer avec les autorités locales pour faciliter ces expulsions.

      Dernièrement, c’est dans un parc bruxellois que des émissaires soudanais procédaient à l’identification de leurs nationaux en vue de leur retour forcé, semant la terreur parmi les personnes exilées qui y campaient [2].

      Si l’affaire a suscité de vives réactions, le gouvernement belge s’est retranché, pour se justifier, derrière l’exemple donné par ses voisins et continue de programmer des expulsions de ressortissants soudanais [3].
      En France, une coopération similaire existe ainsi depuis 2014 : des représentants de Khartoum auraient visité plusieurs centres de rétention pour identifier des ressortissants soudanais et faciliter leur renvoi [4]. Selon les chiffres dont disposent les associations qui interviennent dans les CRA français, 9 personnes auraient été renvoyées vers le Soudan depuis 2015 et environ 150 remises à l’Italie et exposées au risque d’un renvoi vers Khartoum depuis le territoire italien.

      Par ailleurs, des retours forcés vers le Soudan ont eu lieu depuis l’Allemagne, l’Italie et la Suède, grâce notamment à des accords de police bilatéraux, souvent publiés uniquement à la suite des pressions exercées par la société civile [5] . L’Italie, à l’avant-garde de la vision sécuritaire en matière de collaboration dans le domaine des migrations, a ainsi conclu en août 2016 un accord de coopération policière avec le Soudan, dans le cadre duquel 48 personnes, originaires du Darfour, ont été refoulées à Khartoum. Celles qui ont pu résister à leur renvoi depuis l’Italie ont demandé et obtenu une protection, tandis que cinq des personnes refoulées ont porté plainte auprès de la Cour européenne des droits de l’Homme [6].

      Ces accords et pratiques bafouent en effet toutes les obligations des pays européens en matière de respect des droits humains (droit d’asile, principe de non-refoulement, interdiction des expulsions collectives et des traitements inhumains et dégradants, droit à la vie, etc…) et révèlent le cynisme qui anime l’Union et les États-membres, prêts à tout pour refuser aux exilés l’accès au territoire européen.

      Il faut le dire et le répéter : toute forme de coopération avec les autorités soudanaises bafoue les obligations résultant du droit international et met en danger les personnes livrées par les autorités européennes au dictateur Omar el-Béchir.

      Le réseau Migreurop et ses membres demandent en conséquence l’arrêt immédiat des expulsions vers le Soudan et de toute démarche de coopération avec ce pays.

    The Khartoum Process: A sustainable response to human smuggling and trafficking?

    In the 2012-16 ‘migration crisis’, citizens from the Horn of Africa have been arriving irregularly in Europe in unprecedented numbers, whilst featuring disproportionately amongst the fatalities. This has prompted the launch of the Khartoum Process, a partnership between the 28 member states of the European Union (EU) and East and North African states, to respond to human smuggling and trafficking. This brief critically and unfavourably evaluates this framework. The Khartoum Process is not only unlikely to achieve the desired outcomes, but, more importantly, it is likely to pose a risk to the better governance and development of the Horn of Africa.

      Libya signs borders control agreement with southern neighboring countries

      Libya’s Foreign Ministry announced that Libya had signed an agreement with its southern neighboring countries Niger, Chad and Sudan to secure the joint borders against human trafficking and weapons smuggling.

      The Foreign Minister Mohammed Sayala signed on Thursday in the capital of Chad N’Djamena the agreement which will help jointly secure the borders, according to the ministry’s statement.

      “Libya is working on supporting joint relations between the four countries and is keen to support all efforts to combat terrorism, transnational organized crime, smuggling of all kinds, illegal migration, mercenaries, arms smuggling, and smuggling of all kinds of subsidized commodities and petroleum derivatives." Sayala said, according to the statement.

      Libya has lately announced the launching of a new operation to combat IS remaining militants and to fight the threats to the security and chaos caused by criminals, smugglers and human traffickers.

      Subject: Sudanese Rapid Support Forces as beneficiaries of EU funds

      The Sudanese government has deployed its militia, the #Rapid_Support_Forces (#RSF), at the borders with Libya to prohibit irregular migration and combat human trafficking. The RSF’s crimes against humanity and war crimes are well documented (i.a. by the International Criminal Court). Amnesty International reports that the Sudanese government may also have used chemical weapons against civilians in Darfur in 2016.

      The EU cooperates with the Sudanese government in the area of migration, notably through the project ‘Better Migration Management (Khartoum Process)’ and, according to the relevant Action Fiche, provides i.a. capacity building support to front-line officials. The Action Fiche lists ‘provision of equipment and trainings to sensitive national authorities diverted for repressive aims’ as a risk. However, it does not indicate any direct mitigation measure to address this.

      Profughi: barriera in Niger, tra guerra e terrorismo

      Il motivo della scelta sta nei “numeri”: l’Organizzazione Internazionale per le migrazioni (Oim) ha stimato che nel 2016 sono transitati dal Niger circa il novanta per cento dei migranti arrivati in Libia per cercare poi un imbarco verso l’Italia. E, sulla base di quanto emerge dai rapporti di varie organizzazioni umanitarie, da inchieste giornalistiche e da fonti di polizia, ce ne sarebbero a migliaia in attesa di mettersi in marcia da Agadez, la base di partenza principale delle “piste del contrabbando” che attraverso il deserto portano in Libia o in Algeria. L’idea, allora, sarebbe quella di “gestire” questi flussi in continua crescita facendo del Niger una sorta di hub di concentrazione, identificazione e smistamento dei migranti, con il supporto di campi attrezzati, magari sotto l’egida dell’Unhcr e dell’Oim, dove i profughi potrebbero eventualmente presentare domanda d’asilo e aspettare poi l’esito dell’esame, oppure soggiornare in attesa di riuscire a stabilizzarsi nello stesso Niger o in qualcuno degli Stati vicini, tanto più che, secondo i dati della Banca Mondiale, oltre il 75 per cento dei migranti subsahariani non puntano verso l’Europa ma preferiscono restare in Africa. Per molti versi, dunque, un grande hub che farebbe da “barriera selettiva”. E il Niger, rileva El Pais, diventerebbe così “il nuovo confine della ogni giorno meno salda Fortezza Europa”.

      The EU has hailed a plunge in the number of migrants crossing Niger to reach Europe as a success for its anti-trafficking strategy, even as MEPs complained that the bloc’s figures did not add up.

      EXCLUSIVE: EU migrant policy in Africa built on incorrect Niger data

      In November, IOM raised eyebrows when it reported that just 1,525 migrants had been recorded moving north towards the borders – a massive drop compared to 12,600 the month before.

      Days later, the figures had been included in a progress report on the Partnership Framework with Third Countries, an EU strategy for securing African countries’ cooperation in tackling irregular migration. A press release also cited them noting that “results in priority countries are taking shape, including first decreases in migratory flows”.

      Except the 1,525 was wrong. A “technical problem” with a database had produced the incorrect figure, according to Monica Chiriac, a spokeswoman for IOM’s Niger office. In fact, IOM had recorded nearly 11,500 migrants heading for the Libyan and Algerian borders in November, a figure that only represented a small drop compared to October.

      L’#OIM, conjointement avec les services de la Protection Civile du Niger, a réalisé une mission à la frontière Niger Libye pour l’évaluation des routes migratoires dans la partie Nord du Département de Bilma du 19 au 25 Juillet 2017. Etat des lieux de la situation dans le nord Niger sur les routes qui permettrait à l’OIM d’organiser les convois de personnes vers le camp OIM d’Agadez et à termes les « #retours_volontaires » depuis le camp. Une mission d’ « évaluation des besoins »

      Au-delà de l’état des lieux (utilisation de routes secondaires plus dangereuse, abandon des personnes dans le désert, réduction des passages dans certaines zones qui précarisent les transporteurs locaux, etc.), on y apprend deux trois choses :
      – « Opérations de recherche et de sauvetage » organisées par l’OIM dans le cadre de la mission : à #Achégour et #Deo_Timni deux opérations ont été effectuées : kit d’hygiène, transport par camion IOM pour Agadez et organiser des retours volontaires. A noter ici que l’OIM souligne que la plupart des personnes repartent des camps OIM pour retenter le passage.
      De plus, « La question de l’évacuation des dizaines de milliers de migrants bloqués dans les villes libyennes de #Sebha et #Al-Gatrun a été discutée avec les responsables Libyens du poste de Toummo. Le chef de poste a proposé d’organiser une rencontre avec ses supérieurs à Al-Gatrun, ce que le calendrier de la mission ne permettait malheureusement pas. Il a toutefois été possible de rassembler des informations parcellaires sur la situation des migrants au sud #Libye. Une prochaine mission doit être préparée dès maintenant pour explorer les options pour une #évacuation _humanitaire via le Niger des migrants
      bloqués dans le sud libyen »
      – Demande de la police Nigérienne de mettre en place une #base_de_données pour les personnes interpellées et les personnes décédées. Pour l’instant tout est fait à la main.
      – Arrestation des transporteurs mais pas ou peu de suivi judiciaire car pas de moyens, vice de procédure et faute de preuve, les personnes sont relâchées.
      En ce sens, « demande des services de police locaux ont émis le besoin d’une présence policière à Madama ou à Dao Timni , idéalement au sein de la base militaire. Un détachement d’une douzaine d’hommes pourrait y être installé et accompagner les patrouilles des militaires pour accélérer le déferrement et assurer le respect des procédures. »
      – La Direction de la surveillance des frontières (DST) de la police nationale déploiera dans quelques mois un « #poste_frontière_mobile », c’est-à-dire un camion doté de l’équipement et du personnel nécessaire pour exercer des missions de contrôle des frontières et des flux migratoires dans la région.

    L’externalisation des #contrôles_migratoires est le fait pour un État de déléguer à un État voisin la mission de contrôler la #frontière du premier sur son propre #territoire, en assumant généralement les violations des droits de l’homme qui y sont liées. Situation qu’on trouve à #Calais, mais aussi sur le littoral français, belge et néerlandais à la frontière britannique, comme en Italie à la frontière française, mais aussi suisse et autrichienne.

    L’Italie vient ainsi d’expulser quarante-huit #exilés soudanais arrêtés à #Vintimille, à la #frontière_française, vers le #Soudan.
    L’Espace #Schengen était un espace où les contrôles aux frontières entre État membres avaient était abolis, à une époque où la Convention de Schengen sur le libre circulation des personnes était un des piliers de la construction européenne. Aujourd’hui, tous les États voisins de l’Italie, sauf la Slovénie, ont rétabli des contrôles à leur frontière avec elle, voire construit un #mur à la frontière comme l’Autriche. Sauf la Slovénie parce que les exilé-e-s viennent des Balkans par la Slovénie vers l’Italie, et de là vers les autres pays. La Slovénie a construit une clôture barbelée avec la Croatie sa voisine membre de l’Union européenne.

    Cette #expulsion a laissé des traces sur des #médias_militants mais aucun média français détectable par les moteurs de recherche, alors qu’il s’agit bien de l’externalisation sur le sol italien du contrôle de la frontière française.

    Et que la France et le Royaume-uni sont des pays moteurs du #Processus_de_Khartoum, qui est le cadre général de cette expulsion, et qui vise à traiter avec les États que fuient les exilé-e-s pour les empêcher d’arriver en #Europe.

      L’accordo con il dittatore sudanese

      Il 4 agosto il Governo Italiano firmava un accordo con la dittatura sudanese alla presenza del capo della Polizia Gabrielli e dei rappresentanti del Ministero dell’Interno e degli Affari Esteri.

      Si tratta di un accordo di polizia, #memorandum_of_understanding, formula già adottata nel 2015 con il Gambia, altra dittatura africana. L’accordo è stato firmato senza essere presentato nè ratificato dalle Camere e il contenuto resta ad oggi ancora segreto, in flagrante violazione dell’articolo 80 della Costituzione che prevede che«le Camere autorizzano con legge la ratifica dei trattati internazionali che sono di natura politica…o importano oneri alle finanze…». La Costituzione è doppiamente violata, non solo perché l’accordo ha un carattere politico, ma anche perché in cambio della firma al Sudan sono stati promessi 100 milioni di euro dai Fondi istituiti alla Valletta. Varie fonti affermano che i primi fondi europei siano stati dati ai janjaweed, le milizie paramilitari sudanesi diventate famose per le atrocità commesse in Darfur. A dei sanguinari miliziani l’Europa avrebbe dunque deciso di affidare il controllo delle frontiere per impedire a eritrei, etiopi e sudanesi di avvicinarsi alla Libia per poi prendere il mare verso l’Italia. Le retate di centinaia di eritrei nella primavera di quest’anno dimostrano come la milizia abbia preso sul serio il suo ruolo di gendarme. Le autorità italiane non tardano a verificare l’operatività dell’accordo. Il 24 agosto dall’aeroporto di Torino parte un aereo con 48 migranti sudanesi che, dopo uno scalo al Cairo, atterra a Khartoum. Tra i 48 alcuni provengono dall’insanguinato Darfour. Gli espulsi, raggiunti a Khartoum, raccontano l’inganno e la violenza dell’operazione «Mi sono ritrovato con una quarantina di connazionali, ci hanno sequestrato telefoni e borse e ci hanno obbligato a dare le impronte per l’ennesima volta, percuotendo chi si opponeva. In seguito ci hanno portato alla Questura di Imperia, dove tre funzionari sudanesi ci hanno spiegato che ci avrebbero riportato a Khartoum il giorno dopo. In serata la polizia ci ha diviso in tre gruppi, ho dormito in cella e alle 5 del mattino ci hanno portato all’aeroporto di Torino, ognuno scortato da due agenti». I tentativi di difesa delle autorità italiane sono ben poco convincenti. Da un lato Alfano dichiara che i sudanesi sono stati espulsi perché non avrebbero fatto richiesta d’asilo. Il che è spiegabile visto che sono stati arrestati a Ventimiglia, dove si trovavano proprio perché volevano fare richiesta di protezione internazionale in un altro paese. Ancora più grave la difesa della polizia italiana che definisce il Sudan «un paese pienamente riconosciuto dall’Italia», nonostante sul suo presidente pesino due mandati di cattura da parte della Corte penale internazionale per crimini contro l’umanità in Darfur. Siamo al paradosso di un capo di stato che se venisse nel nostro paese, dovrebbe essere arrestato all’aeroporto dalla polizia con cui firma accordi sull’immigrazione e che lo ritiene leader di «un paese pienamente riconosciuto dall’Italia».

      Sudan il Paese che l’Italia considera sicuro

      A fine agosto 48 cittadini sudanesi sono stati rimpatriati dall’Italia. Fermati e identificati a Ventimiglia mentre cercavano di passare il confine sono stati colpiti da un decreto di espulsione che ha innescato la procedura di rimpatrio. Infatti per l’Italia il Sudan è un paese sicuro e questo rimpatrio è il primo effetto degli accordi bilaterali firmati con il paese africano a inizio agosto.
      Sudan-Italia. Italia-Sudan. Dopo la firma del Memorandum of understanding è questo il terribile doppio viaggio a cui potrebbero essere costretti i cittadini sudanesi che arrivano sulle nostre coste. Il documento firmato in Italia il 4 agosto 2016 prevede infatti “la collaborazione tra i due Paesi nella lotta al crimine, nella gestione degli effetti migratori e delle frontiere”. Un comunicato diffuso dall’Ambasciata italiana di Khartoum chiarisce che l’accordo italo-sudanese si iscrive nel piu’ ampio quadro di cooperazione tra Sudan e Unione Europea sui temi migratori, in particolare il Processo di Khartoum, lanciato in Italia nel 2014, e il Fondo fiduciario d’emergenza dell’Unione europea per la stabilita’ e la lotta contro le cause profonde della migrazione irregolare e del fenomeno degli sfollati in Africa, lanciato nel novembre 2015 al Summit de La Valletta.

      Deportazioni in Sudan, Italia alla sbarra in Europa: è la nona volta

      Li hanno bloccati a Ventimiglia nel centro accoglienza della Croce Rossa, portati a Torino dopo un accertamento sommario, caricati sotto scorta su un aereo e rimpatriati, contro al loro volontà, in Sudan, il paese da cui erano scappati per sottrarsi al regime di Omar Al Bashir, il dittatore colpito da un ordine di cattura internazionale per crimini di guerra e contro l’umanità in seguito ai massacri nella martoriata regione del Darfur. Erano in 40, quasi tutti in fuga proprio dal Darfur. Di molti di loro si sono perse le tracce dopo lo sbarco a Khartoum. Almeno cinque, però, non si sono arresi ed hanno deciso di trascinare l’Italia di fronte alla Corte Europea per i Diritti Umani. Al loro fianco si è schierato il Tavolo Nazionale Asilo, di cui fanno parte organizzazioni come il Centro Astalli, l’Asgi, la Caritas, l’Arci, la Federazione delle Chiese Evangeliche, Amnesty. Il procedimento è seguito dagli avvocati Salvatore Fachile e Dario Belluccio, che il 13 febbraio hanno depositato un esposto presso la cancelleria della Corte, a Strasburgo.

      La Corte Europea ammette i ricorsi contro l’espulsione collettiva di cittadini sudanesi. Conferenza stampa di Asgi e Arci giovedì 11 gennaio alle 11.30

      Sono stati dichiarati tutti ammissibili i ricorsi presentati dai cittadini sudanesi contro il Governo italiano per il respingimento collettivo che, il 24 agosto 2016, ha dato esecuzione all’accordo tra il Capo della Polizia italiana ed il suo omologo sudanese.

      La Corte Europea per i diritti dell’uomo e le libertà fondamentali (CEDU) ha comunicato formalmente i ricorsi al Governo italiano ed ha posto dei precisi quesiti volti a conoscere le modalità dell’espulsione e se siano stati rispettati i diritti e le garanzie previste dalla Convenzione europea.

      I ricorsi sono stati tutti depositati da avvocati dell’ASGI: i cittadini sudanesi furono oggetto di una vera e propria “retata” a Ventimiglia, alcuni furono trasportati in condizioni disumane e poi rinchiusi illegittimamente nell’ hotspot di Taranto. Quindi vi fu il tentativo di rimpatriarli tutti.

      Alcuni furono effettivamente riportati in Sudan e 5 di loro incontrarono rappresentanti di ASGI ed ARCI che, tra il 19 ed il 22 dicembre 2016, si recarono a Khartoum grazie al supporto di una delegazione di parlamentari europei del gruppo della Sinistra europea.

      Tutti coloro che non furono rimpatriati hanno ottenuto il riconoscimento della protezione internazionale in Italia, in quanto soggetti a persecuzioni e discriminazioni nel Paese da cui provenivano.

      I ricorsi hanno denunciato la violazione di diverse norme della Convenzione EDU e della Convenzione di Ginevra. Il Governo italiano, entro il 30 marzo 2018, dovrà fornire una risposta al proprio operato dinanzi alla CEDU.

      Negli ultimi mesi la collaborazione con il Governo di Al Bashir per l’espulsione di cittadini sudanesi si è rafforzata anche con altri paesi europei. A fine dicembre sono state ufficialmente richieste le dimissioni del Segretario di Stato per l’asilo e la migrazione belga dopo la diffusione di informazioni relative a torture subite da cittadini sudanesi espulsi da Bruxelles.

      L’azione giudiziaria costituisce una tra le iniziative intraprese da ASGI ed ARCI per contrastare i processi di esternalizzazione delle frontiere e del diritto di asilo attuati dal Governo italiano - che nel corso dell’ultimo anno si sono concretizzati anche nei nuovi accordi con la Libia e più recentemente col Niger, dove l’Italia invierà militari e armamenti. Un ricorso è stato presentato dall’Asgi anche contro l’uso dei fondi della cooperazione allo sviluppo per finanziare il rafforzamento della guardia costiera libica.

      I ricorsi sono strumenti finalizzati innanzitutto a tutelare le singole persone, ma sono anche rivolti a contrastare le politiche italiane ed europee volte ad accordare risorse economiche a regimi dittatoriali, come quello del Sudan o del Niger a scapito della vita e della libertà della persona.

      Tutte le iniziative e i loro esiti verranno illustrate in una conferenza stampa che si terrà l’11 gennaio presso la saletta del primo piano della Fnsi, in Corso Vittorio Emanuele 249, alle 11.30. Parteciperanno gli avvocati Salvatore Fachile e Giulia Crescini dell’Asgi, estensori di alcuni dei ricorsi; Filippo Miraglia, vicepresidente Arci, Sara Prestianni, che ha fatto parte della delegazione andata a Khartoum e coordina il progetto Externalization policies watch.

    Pubblichiamo un contributo estremamente interessante in merito ad uno degli effetti meno noti del “Processo di Khartoum” e delle politiche di esternalizzazione delle frontiere portate avanti dall’UE.     La Commission européenne a annoncé aujourd’hui le lancement de 16 actions au total, dotées de près de 300 millions d’euros, afin de remédier aux causes profondes de la migration irrégulière et des déplacements forcés et de maximaliser les effets positifs de la migration sur le #développement.

    Soldi alle polizie europee che perseguitano i profughi eritrei

    L’accordo siglato a La Valletta (Malta) per quanto fallimentare, comincia a produrre i suoi nefasti frutti. Ce ne parla Emilio Drudi, peratro fra gli esponenti di spicco del Comitato per i Nuovi Desaparecidos, in un interessante articolo pubblicato in un quotidiano locale che vale la pena di riprendere. Emilio ha anche scritto a metà dicembre di una storia che, per quanto specifica, evidenzia la assoluta incompatibilità fra le politiche europee e quanto sta avvenendo ai confini eritrei nel campo dei diritti umani. Lo ringraziamo perché la sua testimonianza ci offre lo spunto per parlare di quelle che saranno, ahinoi in futuro, in assenza di seria opposizione, le politiche europee.

    Soldi in cambio di uomini. In cambio dei migranti respinti dall’Europa e rispediti nei paesi di transito e prima sosta o da bloccare prima ancora che possano imbarcarsi, per poi rimpatriarli nei paesi d’origine. Magari di forza. E’ quanto prevedono gli accordi firmati a Malta l’11 novembre tra l’Unione Europea e una trentina di Stati africani, oltre che il trattato siglato con la Turchia il 29, sempre di novembre. Detto e fatto. Poco più di un mese dopo il vertice di La Valletta, tra i primi finanziamenti stanziati sono previsti consistenti aiuti alle polizie eritrea e sudanese per bloccare uno dei confini più porosi e battuti dai disperati in fuga dal Corno d’Africa.

    Ces derniers jours, s’est tenue à Rome la conférence ministérielle EU-Horn of Africa Migration Route Initiative, mieux connue comme Processus de Khartoum, du nom de la capitale du pays où a été organisée la première réunion de ce parcours qui a pour objectif la « gestion des routes migratoires en provenance de la Corne de l’Afrique ». La conférence a été présidée par le ministre des Affaires étrangères Gentiloni et par le ministre de l’Intérieur Alfano et elle s’est déroulée sous la présidence italienne de l’Union européenne. Le gouvernement a expliqué qu’on voulait promouvoir des projets concrets pour une gestion plus efficace des flux migratoires dans les pays de la Corne de l’Afrique et dans les pays méditerranéens de transit les plus importants (Libye, Égypte et Tunisie). À ce processus, en plus des 28 états-membres de l’Ue, ont participé la Libye, l’Égypte, le Soudan, le Sud Soudan, l’Éthiopie, l’Érythrée, Djibouti, la Somalie, le Kenya, la Tunisie, pays qui pour la plupart n’offrent aucune garantie concernant les droits de l’homme ou, comme en Érythrée ou au Soudan, sont dirigés par des dictatures sanguinaires. L’Italie a prétendu que « la gestion des flux en provenance de l’Afrique du Nord ne peut être le seul fait d’opérations humanitaires, comme Mare Nostrum, ou de contrôle aux frontières, comme l’opération Triton, gérée par l’agence européenne Frontex ». Le processus de Khartoum doit se concentrer, d’après notre gouvernement, sur un thème de grande urgence : la lutte contre le trafic des migrants (‘smuggling’) et la traite (‘trafficking’). Il pourra par la suite impliquer d’autres thèmes, en cohérence avec les priorités de l’Ue (migration régulière, migration irrégulière, migration et développement et protection internationale).

    Ministers of the 28 EU countries as well as Eritrea, Ethiopia, Somalia, South Sudan, Sudan, Djibouti, Kenya, Egypt and Tunisia, as well as the European and African Union Commissioners in charge of migration and development and the EU High Representative launched on 28 November the EU-Horn of Africa Migration Route Initiative, also known as the ‘Khartoum Process’, which aims to tackle trafficking and smuggling of migrants between the Horn of Africa and Europe.

      Concerns over Eritrea’s role in efforts by Africa and EU to manage refugees

      Early in 2019 the Eritrean government will take over the chair of the key Africa and European Union (EU) forum dealing with African migration, known as the Khartoum Process.

      The Khartoum Process was established in the Sudanese capital in 2014. It’s had little public profile, yet it’s the most important means Europe has of attempting to halt the flow of refugees and migrants from Africa. The official title says it all: The EU-Horn of Africa Migration Route Initiative. Its main role is spelled out as being:

      primarily focused on preventing and fighting migrant smuggling and trafficking in human beings.

      Chairing the Khartoum Process alternates between European and African leaders. In January it will be Africa’s turn. The steering committee has five African members – Egypt, Eritrea, Ethiopia, South Sudan and Sudan. A number of others nations, such as Kenya to Tunisia, have participating status.

      The African countries chose Eritrea to lead this critical relationship. But it’s been heavily criticised because it places refugees and asylum seekers in the hands of a regime that is notorious for its human rights abuses. Worse still, there is evidence that Eritrean officials are directly implicated in human trafficking the Khartoum Process is meant to end.

      That the European Union allowed this to happen puts in question its repeated assurances that human rights are at the heart of its foreign policies.

      The Khartoum Process

      The Khartoum Process involves a huge range of initiatives. All are designed to reduce the number of Africans crossing the Mediterranean. These include training the fragile Libyan government’s coastguards, who round up migrants at sea and return them to the brutal conditions of the Libyan prison camps.

      The programme has sometimes backfired. Some EU-funded coastguards have been accused of involvement in people trafficking themselves.

      The EU has also established a regional operational centre in Khartoum. But this has meant European officials collaborating with the security forces of a government which has regularly abused its own citizens, as well as foreigners on its soil. President Omar al-Bashir himself has been indicted for war crimes and crimes against humanity by the International Criminal Court.

      The centre requires European police and other officers to work directly with the security officials who uphold the Sudanese government. According to the head of the immigration police department,

      The planned countertrafficking coordination centre in Khartoum – staffed jointly by police officers from Sudan and several European countries, including Britain, France and Italy – will partly rely on information sourced by Sudanese National Intelligence.

      The centre also receives support from Sudan’s Rapid Support Forces, which grew out of the Janjaweed: notorious for the atrocities it committed in Darfur.

      These initiatives are all very much in line with the migration agreement signed in the Maltese capital in 2015. Its action plan detailed how European institutions would co-operate with their African partners to fight

      irregular migration, migrant smuggling and trafficking in human beings.

      Europe promised to offer training to law enforcement and judicial authorities in new methods of investigation and to assist in setting up specialised anti-trafficking and smuggling police units.

      It is this sensitive relationship that will now come under Eritrean supervision. They will be dealing with some of the most vulnerable men, women and children who have fled their own countries. It is here that the process gets really difficult, because Eritrean government officials have themselves been implicated in human trafficking. UN researchers, working for the Security Council described how this took place in 2011.

      More recently, survivors of human trafficking interviewed by a team led by Dutch professor Mirjam van Reisen, described how the Eritrean Border Surveillance Unit ferried refugees out of Eritrea, at a price.

      The danger is that implicated Eritrean officials will play a critical role in the development of the Khartoum Process.

      Europe’s commitment to human rights

      The EU has repeatedly stressed that its commitment to human rights runs through everything it does. Yet the Eritrean government, with which the EU is now collaborating so closely, has been denounced for its human rights abuses by no less than the Special Rapporteur for Eritrea to the UN Human Rights Council as recently as June 2018.

      As Mike Smith, who chaired the UN Commission Inquiry into Eritrea in 2015, put it:

      The many violations in Eritrea are of a scope and scale seldom seen anywhere else in today’s world. Basic freedoms are curtailed, from movement to expression; from religion to association. The Commission finds that crimes against humanity may have occurred with regard to torture, extrajudicial executions, forced labour and in the context of national service.

      The EU itself has remained silent. It is difficult to see how the EU can allow its key African migration work to be overseen by such a regime, without running foul of its own human rights commitments. European leaders need to reconsider their relationships with African governments implicated in gross human rights abuses if they are to uphold these values.

      The Khartoum Process may have reduced the flow of refugees and asylum seekers across the Mediterranean. But it hasn’t eliminated the need for a fresh approach to their plight.

    Salviamo i profughi, lasciamoli nel deserto

    Il governo italiano ha annunciato a Roma un’intesa per realizzare dei campi profughi nei paesi d’origine e di transito dei migranti per esaminare le richieste d’asilo sul posto. L’accordo, noto come “Processo di Khartoum”, è stato sottoscritto a fine novembre dai 28 paesi dell’Unione europea più Egitto, Eritrea, Etiopia, Gibuti, Kenya, Libia, Somalia, Sudan, Sud Sudan e Tunisia.
