This draft text, from May 2014, gives us another look into the current state of negotiations over this plurilateral trade agreement’s copyright provisions since another draft was leaked last year. And what we’re seeing isn’t pretty. The TPP still contains text on #DRM, ISP liability, copyright term lengths, and criminal enforcement measures, and introduces new provisions on trade secrets that have us worried.

Les négociations portant sur le traité de libre-échange transatlantique se déroulent dans le plus grand secret. Aussi est-il toujours intéressant de jeter un œil aux quelques éléments et arguments diffusés au grand public. Et notamment par les lobbyistes.
Comme le Transatlantic Buisness Dialogue (Dialogue économique transatlantique) qui est une belle organisation fondée en 1995 réunissant des dirigeants américains et européens, essentiellement de multinationales. Celle-ci est chargée, selon ses propres termes, de « promouvoir un marché transatlantique sans entraves contribuant à la croissance économique, l’innovation et la sécurité » et « favorisant la discussion et l’échange d’idées entre chefs d’entreprises et dirigeants gouvernementaux ».
Sur le site du TABD, un lien renvoie a une série de vidéos postée sur Youtube et intitulées « removing trade barriers » (suppression des entraves au commerce). Celles-ci proviennent en fait de la Chambre de commerce américaine en Suède. Mais elles accueillent des interviews de membres du TABD comme Hans Straberg par exemple. Elles prétendent expliquer de manière très pédagogique en quoi l’adoption du traité transatlantique serait, évidemment, une aubaine à la fois pour les Etats-Unis et pour l’Europe. Le tout est illustré par des images simples, voire simplettes, permettant de bien comprendre les arguments avancés. En premier lieu, selon ces vidéos, il existe aujourd’hui un certain nombre d’« obstacles » limitant le libre-échange entre les Etats-Unis et l’Europe. Le traité propose donc tout simplement de les supprimer.

Interestingly, one of the few institutions equipped to shed light on trade negotiations – the #media – has cut back on coverage of trade issues.
Lori Wallach, director for the past two decades of Public Citizen’s Global Trade Watch, responded by email to my inquiry about news coverage of trade:
“During NAFTA/WTO, there were trade beat reporters at every major national outlet and many of the bureaus of decent-sized regionals. But now trade is one of, say, four or five subjects assigned to a reporter at a national print outlet. The Wall Street Journal is the exception to the rule - they have a full time trade beat reporter and so do Reuters and Bloomberg.”
The diminished news coverage comes at a time when the scope of trade agreements has grown tremendously. These agreements go well beyond traditional market access issues of tariffs and quotas to become de facto industrial policies.

On Sept. 8 last year, Senator Elizabeth Warren of Massachusetts declared in a speech to the AFL-CIO:
“Why are trade deals #secret? I’ve heard people actually say that they have to be secret because if the American people knew what was going on, they would be opposed. Think about that.”
Warren is right. Trade negotiations have, in fact, become so wide in scope, with so many losers and winners, that negotiations cannot be conducted in the open.
The case of trade reflects a larger shift in the balance of power. As multinational or “stateless” capital diminishes the sovereignty of individual countries, including the United States, and strengthens the autonomy of international corporations, it weakens the already fragile economic security of millions of out-of-work Americans. Their plight appears to be unheeded in the world of “advisory committees.” One can only fear what comes next.

Today, 15 January 2014, WikiLeaks released the secret draft text for the entire TPP (Trans-Pacific Partnership) Environment Chapter and the corresponding Chairs’ Report. The TPP transnational legal regime would cover 12 countries initially and encompass 40 per cent of global GDP and one-third of world trade. The Environment Chapter has long been sought by journalists and environmental groups. The released text dates from the Chief Negotiators’ summit in Salt Lake City, Utah, on 19-24 November 2013.
The Environment Chapter covers what the Parties propose to be their positions on: environmental issues, including climate change, biodiversity and fishing stocks; and trade and investment in ’environmental’ goods and services. It also outlines how to resolve enviromental disputes arising out of the treaty’s subsequent implementation. The draft Consolidated Text was prepared by the Chairs of the Environment Working Group, at the request of TPP Ministers at the Brunei round of the negotiations.

Engagées en 2008, les discussions sur l’accord de libre-échange entre le Canada et l’Union européenne ont abouti le 18 octobre. Un bon présage pour le gouvernement américain, qui espère conclure un partenariat de ce type avec le Vieux Continent. Négocié en #secret, ce projet ardemment soutenu par les multinationales leur permettrait d’attaquer en justice tout Etat qui ne se plierait pas aux normes du libéralisme.
Sous un tel régime, les entreprises seraient en mesure de contrecarrer les politiques de santé, de protection de l’environnement ou de régulation de la finance mises en place dans tel ou tel pays en lui réclamant des dommages et intérêts devant des tribunaux extrajudiciaires. Composées de trois avocats d’affaires, ces cours spéciales répondant aux lois de la Banque mondiale et de l’Organisation des Nations unies (ONU) seraient habilitées à condamner le contribuable à de lourdes réparations dès lors que sa législation rognerait sur les « futurs profits espérés » d’une société.
Même lorsque les gouvernements gagnent leur procès, ils doivent s’acquitter de frais de justice et de commissions diverses qui atteignent en moyenne 8 millions de dollars par dossier, gaspillés au détriment du citoyen. Moyennant quoi les pouvoirs publics préfèrent souvent négocier avec le plaignant que plaider leur cause au tribunal. L’Etat canadien s’est ainsi épargné une convocation à la barre en abrogeant hâtivement l’interdiction d’un additif toxique utilisé par l’industrie pétrolière.
La ractopamine est un médicament utilisé pour gonfler la teneur en viande maigre chez les porcs et les bovins. Du fait de ses risques pour la santé des bêtes et des consommateurs, elle est bannie dans cent soixante pays, parmi lesquels les Etats membres de l’Union, la Russie et la Chine. Pour la filière porcine américaine, cette mesure de protection constitue une distorsion de la libre concurrence à laquelle l’APT doit mettre fin d’urgence.
« Les producteurs de porc américains n’accepteront pas d’autre résultat que la levée de l’interdiction européenne de la ractopamine », menace le Conseil national des producteurs de porc (National Pork Producers Council, NPPC). Pendant ce temps, de l’autre côté de l’Atlantique, les industriels regroupés au sein de BusinessEurope dénoncent les « barrières qui affectent les exportations européennes vers les Etats-Unis, comme la loi américaine sur la sécurité alimentaire ». Depuis 2011, celle-ci autorise en effet les services de contrôle à retirer du marché les produits d’importation contaminés. Là encore, les négociateurs de l’APT sont priés de faire table rase.
L’Allemagne, le Danemark et les Pays Bas ne veulent pas, contrairement à la France, rendre public le mandat de négociations confié à la Commission Européenne, en vue d’un accord de libre-échange avec les USA, après celui qui a été signé avec le Canada. Pourtant des parlementaires et des médias ont dffusé ce document.

What is in the proposed agreement?
We don’t exactly know because the negotiations are secret and the only documents that are in the public domain have been leaked. Worse still, the nine governments agreed that none of the background documents will be released until four years after the negotiations end (or collapse), so we won’t be able to hold them accountable for any tradeoffs they make until they are no longer in power.
