Oliver Bienkowski, un artiste spécialisé dans les mises en lumière a dénoncé l’espionnage des Etats-Unis en Europe en projetant dans la nuit de dimanche à lundi sur l’ambassade des Etats-Unis à Berlin le slogan « United Stasi of America », faisant allusion à la police politique de l’ex-Allemagne de l’Est.
« Très drôle. Quiconque fait ce genre de comparaison ne connaît pas grand-chose ni à la Stasi, ni à l’Amérique », a commenté le service de presse de l’ambassade des Etats-Unis, joint mardi par l’AFP.

Dans l’Allemagne de l’Est malgré quelques petits succès ils n’arrivaient pas à prendre le contrôle des activités clandestines étatiques. Au contraire les services de reinseignement et de contre-espionnage (Hauptverwaltung Aufklärung, HVA) de Markus Wolf avaient la réputation d’être très efficaces. Cette administration ne s’intéressait pas à la vie des citoyens est-allemands mais visait les activités de l’ennemi extérieur.
Après la chute du mur l’occasion se présentait pour les services nord-américains d’acquérir la base de donnés de la HVA.

The Rosenholz files are a collection of 381 CD-ROMs containing 280,000 files with information on persons who were as sources and targets or employees and helpers in the focus of the Hauptverwaltung Aufklärung (HVA), one of the intelligence agencies of the former GDR. At the beginning one thought that the files mostly contain the real names of agents who worked for the HVA in former West Germany. Later it came clear that at least 90% of the persons never worked for or with the HVA. [1]
According to the annals of the former Moscow CIA station chief Milton Bearden, the Rosenholz files were not seized on January 15, 1990, when demonstrators stormed the Ministry of State Security (GDR) in Berlin, but instead only when former US president George H. W. Bush personally contacted the chief of the Berlin CIA station.

L’administration compétente était le fruit d’un compromis entre le ministre de’intérieur (CDU) de la RDA et des représentants du mouvement populaire qui avait obtenu l’ouverture du mur. After the East German elections in March 1990, newly appointed minister of the interior Peter-Michael Diestel was charged with dissolving the Stasi structures. He subsumed all further work in this regard under the aegis of his ministry and relegated the Citizens’ Committees to a consultative function.
After public criticism of this approach, responsibility for Stasi dissolution was transferred from Diestel’s ministry to a Volkskammer (People’s Chamber) parliamentary committee headed by deputy Joachim Gauck in June 1990. This committee formulated a law, passed in August 1990, mandating the retention of Stasi files as well as investigation of their political, historical, and legal implications.

Encore en RDA la responsabilité pour les archives de la Stasi avait été remise entre les mains d’une commission qui est devenue une administration fédérale extrèmement indépendante eu peu soumise au contrôle parlementaire. Là où une ouverture démocratique aurait dû avoir lieu on an installé un organisme à l’image d’un service secret.

In view of issues discussed further below, relating to responsibility for oversight failures, special attention is given to the legal framework of the BStU, which was constituted by a law passed in December 1991 as an independent legal entity under the auspices of the BKM (which commissioned this analysis). The BStU is one of the most independent entities under administration by the German federal government. Although it is required to report to the parliamentary committee on Culture and Media at least biennially, the authors point out that the Bundestag has no real oversight over, or influence on, the activities of the BStU, which is not subordinated to direct administration by any ministry. Only the government cabinet can supervise its activities, raising constitutional issues as to public accountability.
The broad-ranging independence of the BStU is justified by the necessity to preserve its freedom from political interference; however, the authors (citing the published legal opinion of author and retired judge H. H. Klein in footnote 60) question whether the lack of parliamentary oversight can be reconciled with the Basic Law of Germany.

Oliver Bienkowski, l’auteur de la projection, est déjà connu à Berlin pour ses actions de guerilla (Guerilla-Aktionen) par exemple humanitaires. Il avait fait il y a peu une fausse campagne de pub pour des Shitstorms (littéralement « tempête de merde ») organisés, proposant contre une somme d’argent appréciable des actions de dénigrement sur le net à la commande. Il prétendait faire travailler des sans-abri. L’histoire avait indigné la presse.
En fait, il voulait attirer l’attention sur la situation des sans-abri en Allemagne. Ci-dessous Oliver Bienkowski avec le panneau « 580 000 sans-abri en Allemagne, c’est trop ! »
Il s’est marré parce qu’avec son coup monté, il a épargné 68 000 euros de pub et de campagne de marketing pour rendre visible son message !

17 million square kilometres - interesting. Lets say the NSA has files on every man,woman and child on the planet - plus every company, charity, sewing circle, religious body etc etc. Lets say this adds up to 10 billion entities. Then we’re left with 1,700 sq metres of filing cabinets for every such entity. Of course the vast majority of children esp in developing countries have a very sparse data trail as do the sewing circles, the chess clubs, the OAPs in developed countries, the babies, the small corner shops....
I filing cabinet would contain at least 5,000 A4 sheets, and occupy maybe 0.5 square metres maximum.
So what does the FSA have in data terms that would take up 17 million A4 sheets ?
For every entity on the planet, inc my neighbours 4-year old son?
or is Milton Keynes chess club really plotting to take over the world by violent means?

So we have fallen into Senator Church’s abyss. The questions now are whether he was right or wrong that there is no return from it, and whether that means that effective democracy will become impossible. A week ago, I would have found it hard to argue with pessimistic answers to those conclusions.
But with Edward Snowden having put his life on the line to get this information out, quite possibly inspiring others with similar knowledge, conscience and patriotism to show comparable civil courage – in the public, in Congress, in the executive branch itself – I see the unexpected possibility of a way up and out of the abyss.
