  • In this Bedouin town, murder wasn’t the only crime

    The murder of Yakub Abu al-Kiyan was not the only crime committed by the State of Israel against his village, Umm al-Hiran, and it may not even be the worst. Of course, killing is killing. Abu al-Kiyan, a beloved math teacher and the first Bedouin Ph.D. in chemistry, was executed by incited policemen who were too quick on the trigger, who also let him bleed to death without giving him medical assistance that could have potentially saved him.

    But anyone who thinks that wraps up Israel’s crimes against Umm al-Hiran is deluding himself. The hollow apology by Prime Minister Benjamin Netanyahu doesn’t even begin the series of apologies that Israel owes the people of that village.

    The difficult images after the killing and destruction don’t fade: Raba al-Kiyan, a thin woman in black, wandering among the ruins of her house as she remains silent, her gaze fixed on the ground. Her nephew, a medical student in Moldova, explains that this is how she repeatedly recreates her last moments with her husband.

    At the same time, in the nearby town of Hura, the second widow was mourning – Dr. Amal al-Kiyan. She had married Yakub after her husband died, as Bedouin tradition obligated her to marry his brother. By the age of 24, she was already lecturing at Kaye Academic College of Education in Be’er Sheva. When we paid a condolence call she had earned a doctorate in education from Ben-Gurion University.

    The two widows and the entire village were in shock. A gas station attendant in Hura told us how much he had admired his math teacher at Yitzhak Rabin High School. Then-Public Security Minister Gilad Erdan – don’t ever forget this – and Police Commissioner Roni Alsheich and many others were competing for who could besmirch the teacher more.

    His brother-in-law said that Yakub had put his personal computer and other items into his jeep – the one ostensibly used in the “terror” ramming attack – to save them from the demolition of his home. That’s not how a terrorist leaves his home before an attack. A few days earlier, when he saw laborers starting to work on the construction of the Jewish town of Hiran, the one that was to rise up on the ruins of his village, he told his family, “Let them do their work.” That was the despicable terrorist, as the police commissioner and the minister referred to him.

    When Alex Levac and I were in Umm al-Hiran, after the killing and the destruction, we didn’t need an investigating committee, and certainly not three years of lies and insults and Amit Segal’s tendentious reporting to know that the teacher, Yakub, was innocent of any wrongdoing and that his killing was a heinous crime. We knew back then that his vehicle had moved slowly down the dirt road from his home when they shot him. In no Jewish community would police have shot at a slow-moving car, and certainly not let its driver bleed to death in that inhumane manner reserved for bleeding Arabs.

    But none of this began at dawn on January 18, 2017. Israel had decided to destroy a community that it itself created, after rehousing residents there it had expelled from their lands in 1956, to keep them away from a kibbutz. Now they are expelling them again to build a community for religious-Zionist Jews. Justice Elyakim Rubinstein and justices before him rejected all the challenges. “The residents of Umm al-Hiran have no right to the place,” declared Rubinstein, a justice on the Supreme Court, the beacon of justice in Israel. He, too, is an accomplice.

    No one has asked where exactly do Bedouin have any rights in this land, which is also theirs. The garbage dump at Abu Dis? The polluted industrial zone at Ramat Hovav? This didn’t happen in 1948 or even 1958. The year was 2017. Without any shame, embarrassment, security excuse or Zionist prattle; pure apartheid in sovereign Israel. To “Judaize,” an abominable term; to get rid of the Bedouin and build for Jews.

    Eight months after the killing and the destruction, we returned to Umm al-Hiran. Raba, with a shy smile, came to greet us from the tent that had become home to her and her 10 children. The ruins soaked with her husband’s blood were still laying there as a monument to the crime.

    The killing of math teacher Yaqoub Abu al-Qiyan during an early 2017 raid on a Palestinian village was in many respects a typical act of violence by Israel’s colonization project. A Palestinian was left dead, others injured and homes were destroyed – starting with those belonging to Abu al-Qiyan’s family – to make way for a Jewish settlement.

    There are unique aspects to his case – he was killed in Israel, not in the occupied West Bank, for one. And thanks to the UK-based research group Forensic Architecture, a moment-by-moment breakdown of the events leading up to Abu al-Qiyan’s death and the state cover-up that followed has been made publicly available.     (...) Israel’s official narrative soon fell apart, but Forensic Architecture “wanted to understand better what had happened in the moments leading to Abu al-Qiyan’s death.”

    Mishandling of evidence

    The research group has published a new video report https://vimeo.com/337735829

    that includes more documentation contradicting Israel’s claims. That documentation includes newly available footage from body and handheld cameras operated by police officers at the scene, a “partial and incomplete” police evidence file, the full recording of the thermal aerial video, and recordings of police radio channels.

    The body cam footage recorded by one of the officers indicated that Forensic Architecture’s earlier suspicion that Abu al-Qiyan was killed by a single bullet fired at close range while his car had come to a stop – to “confirm the kill” – was unlikely.

    The research group also used reenactment at the scene of Abu al-Qiyan’s killing, as well as synchronization of audio and video documentation, 3D modeling and other methodologies, to reach its conclusions. (...)

    Netanyahu and security officials were quick to call the incident a terrorist attack, but an investigation is set to prove otherwise. Findings are ’not good for police,’ legal experts say.

    A Bedouin driver who had run over a police officer during clashes in a Negev village did not intend to carry out an attack, a probe into the incident is expected to show in the coming days.

    The January incident took place during a Bedouin demonstration against the demolition of the unrecognized Negev village of Umm al-Hiran. At the demonstration, Yakub Abu al-Kiyan ran over officer Erez Levi before being killed by police gunfire.

    The Justice Ministry’s department for the investigation of police officers’ probe should be completed within two weeks, but officials may come out sooner with a statement saying that the evidence collected indicates that Kiyan did not plan or commit a terror attack that caused Levi’s death.

    According to legal experts, the investigation findings so far are “not good for the police,” which claimed immediately after the incident that Kiyan was a terrorist who planned to run over policemen for political motives.

    According to the findings, Kiyan was driving at a low speed, never exceeding 20 kilometers per hour. Professionals who have studied this incident and others believe that someone who wished to commit a vehicular ramming attack would not have been driving so slowly when he had sufficient distance to accelerate. Also, the shooting was done from a further distance than claimed by the police officers and commanders in the field, and Kiyan’s intentions were not possible to discern.

    Testimony from the police about the location of where Kiyan began driving and the location where he was asked to stop also did not match the findings in the field. Nor did the claim that he did not have his lights on, which was refuted by the video of the incident that was publicized.

    On Tuesday, Public Security Minister Gilad Erdan said that “A difficult and regrettable incident took place in Umm al-Hiran a few weeks ago. We mustn’t let anyone try to take this particular incident − in which unfortunately both a policeman and a civilian were killed − and draw inferences from it regarding the totality of the relationship between the Bedouin population and the police.”

    Legal experts took his comments as an indication that he was reneging on his previous characterization of incident as a terror attack, noting that he aware of the investigation’s findings.(...)

    Un citoyen palestinien d’Israël a été tué mercredi, quand la police tira sur son véhicule dans le village Umm al-Hiran, dans le Negev, au Sud du pays. Un sergent fut également tué et un autre agent blessé à l’aube lors d’une opération de démolitions de plusieurs maisons dans le village bédouin.

    La police israélienne a déclaré que Yaqoub Abu al-Qiyan, 50ans, a délibérément écrasé et tué le policier de 37 ans, Erez Levi.

    Le porte-parole de la police, Micky Rosenfeld a déclaré qu’un “véhicule conduit par un terroriste du Mouvement Islamique a tenté de heurter plusieurs agents et de perpétré une attaque.”

    Le Mouvement Islamique est une organisation politique palestinienne, dont la branche Nord est interdite par Israël. Le leader de branche Nord, Sheikh Raed Salah, a été relaché par Israël mardi, après neuf mois d’incarcération. Il était présent à Umm al-Hiran mercredi.

    La police a déclaré à la presse qu’ils recherchaient des liens entre Abu al-Qiyan et l’Etat Islamique.

    “Ils disent qu’en fouillant sa maison, ils ont trouvé des journaux israéliens parlant du groupe, alors que sa famille nie toute relation avec ce mouvement, disant qu’il est juste un prof de math dans le lycée local, dans la ville bédouine de Hura,” a rapporté le journal de Tel Aviv Haaretz.

    Rosenfeld a fait d’autres déclarations sur les liens avec l’Etat Islamique sur Twitter :

      (...) Abu al-Qian’s autopsy report was also released on Friday, detailing that the teacher had been killed by two bullets that were fired at his vehicle, the first of which struck him on his right knee, and the second in a main artery in the chest area, before he was left to bleed to death.

      Israeli Channel 10 reported that Abu al-Qian’s knee injury led to the acceleration of his vehicle after his leg pressed against the gas pedal, and added that he had lost large amounts of blood which would have made it impossible to save him.

      Nevertheless, they reported that he had been left to bleed for a half and hour as ambulances were prevented from providing him first aid.

      Witnesses told Ma’an that Israeli police pulled an injured Abu al-Qian from his vehicle at the time and shot him another time to confirm his death. However, this testimony contradicts the autopsy report that stated he had bled to death.

      Meanwhile, the family of Abu al-Qian have continued to refuse conditions set by Israeli police in order to receive the slain body of Abu al-Qian.(...)

      Abu al-Qian was shot and killed by Israeli police last week under widely contested circumstances during the violent demolition raid in Umm al-Hiran that left more than a dozen Palestinian structures razed to the ground.

      While numerous eyewitnesses have insisted Abu al-Qian was posing no threat to anyone when Israeli police opened fire at his vehicle, causing him to lose control of the car and ram into officers, Israeli authorities have claimed the local math teacher was carrying out a deliberate terrorist attack in the incident that left one policeman killed.

    Hundreds of demonstrators gathered in Umm al-Hiran, where Bedouin resident Yaqoub Moussa Abu al-Qian, 47, was shot dead by Israeli police, who claimed that the math teacher was carrying out a vehicular attack which killed police officer Erez Levi, 34.

    However, a number of witnesses and Palestinian officials with Israeli citizenship have disputed Israeli security forces’ version of events, saying that police officers opened fire on Abu al-Qian despite him not representing a threat, causing him to lose control of his vehicle and fatally hit Levi.

    Knesset member Ayman Odeh, the head of the Joint List, which represents parties led by Palestinian citizens of Israel, was injured in the head and back during the raid, although witnesses and police disputed how he had been injured and by whom.

    The High Follow-Up Committee for Arab Citizens of Israel, a division of Israel’s parliament, the Knesset, declared three days of mourning in Palestinian-majority towns and villages in Israel following the deadly raid.

    The committee also called for Palestinian citizens of Israel to launch a general strike on Thursday, and for teachers to discuss the recent events in Umm al-Hiran with students.

      NGO Adalah — The Legal Center for Arab Minority Rights in Israel, who is representing Abu al-Qian’s family, released a statement Thursday demanding an investigation be opened into the circumstances of the death of Abu al-Qian, who Adalah said was 50-years-old, though earlier reports claimed he was 47-years-old.

      Israeli police claimed that the math teacher was carrying out a vehicular attack which killed police officer Erez Levi, 34, though a number of witnesses and Palestinian officials with Israeli citizenship have disputed Israeli security forces’ version of events, saying that police officers opened fire on Abu al-Qian despite him not representing a threat, causing him to lose control of his vehicle and fatally hit Levi.

      Israeli Knesset member Taleb Abu Arar said that the police killed Abu al-Qian “in cold blood," Israeli news site Ynet quoted him as saying. "The police shot him for no reason. The claims that he tried to run over police are not true.”
