    The prosecutor of the United Nations-backed court probing the 2005 assassination of former Prime Minister Rafik Hariri has failed in an appeal to keep selected witness statements from a former general imprisoned for four years in connection with the crime, the Special Tribunal for Lebanon said Friday.

    Canadian Prosecutor Daniel Bellemare, following a ruling from STL President Antonio Cassese, will now have a week to hand over testimonies to the counsel of Jamil Sayyed, as part of the latter’s ongoing legal requests to the court.

    “The Appeals Chamber ruled today that statements of certain witnesses must be provided by the prosecutor to Mr. Jamil Sayyed swiftly,” a tribunal statement said.

    Sayyed’s case hinges largely on the assertion that several individuals interviewed by the U.N.’s initial investigation into the assassination provided inaccurate or fabricated testimonies. He and his legal team argue that “false witnesses” should be investigated by the tribunal – a legal impossibility, according to an STL source.

    “The Appeals Chamber found that the tribunal has no jurisdiction over these individuals for statements they gave to a different institution (the UNIIIC) before the tribunal commenced functioning,” the source said.

    La campagne juridique de Jamil Sayyed est très intéressante, et assez nettement ignorée par les médias en dehors du Liban. C’est actuellement le principal axe d’attaque « juridique » contre la légitimité du Tribunal spécial, visant à démontrer par la pratique son manque d’objectivité (et, ici, son mépris pour les droits de la défense). Puisque, évidemment, chacun a une lecture politique de cette confrontation juridique.
