    Exclusive: Brussels officials feared disclosing Zagreb’s lack of commitment to monitoring would cause ‘scandal’

    EU officials have been accused of an “outrageous cover-up” after withholding evidence of a failure by Croatia’s government to supervise #police repeatedly accused of robbing, abusing and humiliating migrants at its borders.

    Internal European commission emails seen by the Guardian reveal officials in Brussels had been fearful of a backlash when deciding against full disclosure of Croatia’s lack of commitment to a monitoring mechanism that ministers had previously agreed to fund with EU money.

    Ahead of responding to inquiries from a senior MEP in January, a commission official had warned a colleague that the Croatian government’s failure to use money earmarked two years ago for border police “will for sure be seen as a ‘scandal’”.

    Supervision of the behaviour of border officers had been the condition set on a larger grant of EU funds to Croatia. There have been multiple allegations of violent pushbacks of migrants and refugees by Croatian police on the border with Bosnia, including an incident in which a migrant was shot.

    In response to allegations of a cover-up, an EC spokesman told the Guardian that what was known had been withheld from MEPs as the information was believed to have been “incomplete”.

    It throws a spotlight on both the Croatian government’s human rights record and the apparent willingness of the EU’s executive branch to cover for Zagreb’s failure.

    Croatia is seeking to enter the EU’s passport-free Schengen zone – a move that requires compliance with European human rights standards at borders.

    Despite heated denials by the Croatian authorities, the latest border incident has been described by aid workers as the most violent in the Balkan migration crisis. On 26 May, 11 Pakistani and five Afghan men were stopped by a group wearing black uniforms and balaclavas in the Plitvice Lakes, 16km (10 miles) into Croatia from the Bosnian border.

    “The men in uniforms tied each of the Pakistanis and Afghanis around a tree, so their wrists were bound and they had to turn their faces toward the trees,” according to a report from the Danish Refugee Council (DRC), which provides healthcare for migrants in Bosnia. “Once these people were unable to move, the men in uniforms fired several shots in the air with guns placed close to the ears of the Pakistanis and Afghanis. There were also shots fired close to their legs.’’

    “They kept shooting. They were shooting so closely that the stones under our feet were flying and being blown to pieces,” one of the men told the Guardian. “They kept saying: ‘I want to beat and kill you.’ They tortured us for three to four hours.”

    The council’s report says electro-shockers were placed on people’s necks and heads. “One of the men in uniform was cutting several victims with knives and the same person inflicted cuts on both of the palms of one person.”

    One asylum seeker said that one of the men put his knee on his neck, then cut at him with a blade. ‘‘He sliced the index finger of my left hand, and blood started spurting out like a small shower,’’ he said. “Then he smiled and cut my middle finger followed by my palm with a larger cut. The whole hand is swollen beyond recognition.”

    After a while, the men in balaclavas called other uniformed officers.

    According to the victims and a report by the DRC, “before the police arrival, one of the men in uniform made a film with his mobile phone, while others in his company were laughing, yelling and provoking”.

    Upon the arrival of police officers, the migrants were put into vans and taken to the border at Šiljkovača, a village close to Velika Kladuša. Police officers did not beat them, but ordered them into Bosnian territory.

    “All of them had bleeding wounds on their heads and numerous bruises on various parts of the body,” Nicola Bay, the DRC country director for Bosnia, told the Guardian. “Four of them had broken arms and one had a broken leg and both arms.”

    Contacted by the Guardian, the Croatian police denied the allegations and suggested that asylum seekers could have fabricated the account and that the wounds could be the result of “a confrontation among migrants” that took place ‘‘on 28 May in the vicinity of the Croatian border, near Cazin’’.

    Volunteers and charities who have treated migrants involved in the fight in Cazin, said the two incidents are unrelated and happened two days apart. Those involved in the fight in Cazin have not claimed they were attacked by the police.

    The establishment of supervisory mechanisms to ensure the humane treatment of migrants at the border had been a condition of a €6.8m (£6.1m) cash injection announced in December 2018 to strengthen Croatia’s borders with non-EU countries.

    The mechanism was publicised by the European commission as a way to “ensure that all measures applied at the EU external borders are proportionate and are in full compliance with fundamental rights and EU asylum laws”.

    Croatian ministers claimed last year that the funds had been handed over to the UN High Commission for Refugees (UNHCR) and the Croatian Law Centre to establish the supervisory mechanism.

    Both organisations deny receiving the money.

    In January this year, the commission was asked by Clare Daly, an Irish MEP in the Independents 4 Change party, to account for the discrepancy.

    A commission official responded that the UNCHR and Croatian Law Centre had established the monitoring mechanism but from “their own funds” to ensure independence from the government.

    He added: “Hopefully [this] clarifies this matter once and for all”.

    But both organisations have again denied being involved in any monitoring project, clarifying that they had only been engaged in an earlier initiative involving the examination of police files.

    Beyond the apparent inaccuracy of the response to Daly, internal emails suggest the full facts of the “underspending” – as its known to the commission – were also withheld.

    The EC failed to inform Daly that the Croatian government had decided to ring-fence only €102,000 of the €300,000 provided for the monitoring mechanism and that ultimately only €84,672 was actually spent – €17,469.87 was given to the interior ministry and €59,637.91 went to NGOs. A roundtable conference accounted for €1,703.16.

    “While we know that there has been underspending on the €300,000 … we thought that around € 240,000 were nevertheless spent in the context of the monitoring mechanism,” an EU official had written while discussing how to deal with the MEP’s questions. “Having spent only EUR 102,000, will for sure be seen as a ‘scandal’.”

    The commission did not pass on information on the spending to Daly but privately officials agreed to seek answers urgently. They also discussed in a phone and email exchange the possibility of intervening in the member state’s planned report due to the poor handling of the matter by the Croatian government.

    “Seeing how unfortunate [Croatia] is presenting this issue, [Croatia] definitively needs (your?) help in putting some ‘final touches’ to the report,” an official in the commission’s migration department wrote to a colleague. “Will [Croatia] provide you with an advance copy of the final report?”

    Daly told the Guardian: “It is outrageous – the commission appears to be colluding with the Croatian authorities in a cover-up.”

    An EC spokesperson said the EU’s executive branch was committed to the establishment of a fully independent border monitoring mechanism.

    The spokesperson said: “We would caution against drawing misleading conclusions from reading the internal email exchanges in isolation.”

    He added: “The Croatian authorities are explaining in their final implementation report how the monitoring mechanism was established, how it works in practice and outline the results.

    “Given that the report submitted by the Croatian authorities was incomplete, the commission asked the Croatian authorities for clarifications first in writing and orally regarding outstanding issues (eg factual data confirming the achievements of the project indicators relating to internal controls and trainings).”

    • Report from Centre for Peace Studies on the pushback of children

      On 29th May 2020, the Centre for Peace Studies – a key member of the Border Violence Monitoring Network (BVMN) – presented a new report alongside the Welcome! Initiative. Addressing the Croatian Government, the “Report on violent and illegal expulsions of children and unaccompanied children” is based on testimonies collected by activists through the BVMN shared database. The publication shares the story of children who sought protection from Croatia, and how Croatia answered in violence.

      “We came to the door of Prime Minister Plenković and Deputy Prime Minister and Minister of the Interior Božinović, who have been turning their backs on testimonies and accusations for years and silently pursuing a policy of flattering the European Union. Even the most vulnerable are not excluded from violence – children “, said Tea Vidović on behalf of the Welcome! Initiative.

      The report submitted to the Government by the organizations provides testimonies of children and their families and unaccompanied children on violent and illegal methods that they had to experience at the hands of police authorities. This illegal and inhuman behavior violates national laws, international law and human rights, prevents access to international protection and, most importantly, marks children’s lives. Although the Government of the Republic of Croatia and the Ministry of the Interior should take into account the special vulnerability of children, respect their rights and best interests, children experience police brutality and limitation of their freedom for hours without access to water and food.

      “While the government uses every opportunity to emphasize the importance of border protection, we wonder in which way is police protecting Croatian borders? By beating children, confiscating their personal belongings, locking children in police vans for several hours in which they are exposed to extremely high or extremely low temperatures, shooting and using electric shocks, is this how the police protect Croatian borders? ”, points out Ana Ćuća.

      The exact number of children who are victims of police brutality remains unknown. BVMN has reported 209 cases of violent and illegal expulsions of children from Croatia since 2017, while Save the Children recorded 2969 expulsions of children at the borders in the Western Balkans during the first 9 months of last year.

      Two cases are currently pending at the European Court of Human Rights against Croatia, both involving violence and pushback. The first is the case of the family of the tragically late six-year-old girl Madina Hussiny, who was killed at the Croatian-Serbian border. The second includes pushbacks, illegal detention and inhumane treatment of a 17-year-old Syrian boy by Croatian police, who was pushed back to Bosnia and Herzegovina despite seeking asylum in Croatia.

      The latest report presented is the sixth report on violent and illegal expulsions published in the last four years, and it is the collective work of the Centre for Peace Studies, the Society for Psychological Assistance, the Welcome! Initiative and the Border Violence Monitoring Network. It also brings a short graphic novel based on the story of little #Madina, a young girl killed in transit, for whose death no one has yet been held accountable.

      Therefore, the organisations ask the Government and the Ministry of the Interior to finally take responsibility and for those who sanction and carry out systematic violence. Responsible institutions are obliged to investigate those who commit violence and push back children in need of protection. All children deserve justice and protection.

      Le ministère croate de l’Intérieur a, de son côté, immédiatement démenti ces accusations, en ajoutant cependant qu’une enquête serait ouverte.

    • Croatia: Fresh evidence of police abuse and torture of migrants and asylum-seekers

      In a horrifying escalation of police human rights violations at the Croatian border with Bosnia, a group of migrants and asylum seekers was recently bound, brutally beaten and tortured by officers who mocked their injuries and smeared food on their bleeding heads to humiliate them, Amnesty International has revealed today.

      Amnesty International spoke to six men among a group of 16 Pakistani and Afghan asylum-seekers who were apprehended by the Croatian police on the night between 26 and 27 May near Lake Plitvice, as they tried to cross the country to reach Western Europe.

      Between eight and ten people wearing black uniforms and balaclavas identical to those used by Croatia’s Special Police, fired their weapons in the air, kicked and repeatedly hit the restrained men with metal sticks, batons and pistol grips. They then rubbed ketchup, mayonnaise and sugar that they found in one of the backpacks on migrants’ bleeding heads and hair and their trousers. Amnesty International also spoke to doctors who treated the men and NGOs who witnessed their injuries.

      “The European Union can no longer remain silent and wilfully ignore the violence and abuses by Croatian police on its external borders. Their silence is allowing, and even encouraging, the perpetrators of this abuse to continue without consequences. The European Commission must investigate the latest reports of horrifying police violence against migrants and asylum-seekers.” said Massimo Moratti, Deputy Director of the Europe Office, following the latest incident on the Croatian border.

      Physical and psychological abuse

      Amir from Pakistan told Amnesty: “We were pleading with them to stop and show mercy. We were already tied, unable to move and humiliated; there was no reason to keep hitting us and torturing us.” He said the armed men showed no sympathy. “They were taking photos of us with their phones, and were singing and laughing.” Amir had a broken arm and nose, stiches on the back of his head, and visible bruising all over his face and arms.

      Ten men suffered serious injuries that night. Thirty-year-old Tariq now has both of his arms and a leg in a cast, visible cuts and bruises on his head and face and is suffering from severe chest pain.

      “They did not give us a chance to say anything at all when they caught us. They just started hitting us. While I was lying on the ground, they hit my head with the back of a gun and I started bleeding. I tried to protect my head from the blows, but they started kicking me and hitting my arms with metal sticks. I was passing in and out of consciousness the rest of the night.” Tariq is now forced to use a wheelchair to move around and it will take months before he is able to move on his own again.

      The men told Amnesty International how they felt humiliated as militia rubbed mayonnaise and ketchup on to their bloody heads and faces. One masked man squirted mayonnaise on an asylum-seeker’s trousers between his legs, while others laughed and sang “Happy Birthday” around them.

      After almost five hours of continuous abuse, the migrants were handed over to the Croatian Border Police who transported them close to the border with Bosnia and Herzegovina in two vans before ordering them to walk. “They were taken aback by our condition. We were drenched in blood and very shook up. We could barely stand, much less walk for hours to Bosnia. But they told us to go. They told us to carry the guys who couldn’t walk and just go.” Faisal told Amnesty.

      Some of the men eventually reached Miral, a reception centre run by the International Organization for Migration in Velika Kladusa in Bosnia and Herzegovina, but five, who were too weak to walk, stayed behind and were eventually picked up by an NGO operating in the camp.

      An emergency doctor at the medical clinic in Velika Kladusa who treated the men told Amnesty International that they all had injuries on the back of their heads which were consistent with a blow by a blunt object and required stiches. Most had multiple fractures, joint injuries, collapsed lungs, cuts and bruises and several were traumatized. Their recovery could take months.

      Routine violent pushbacks and torture by the Croatian police remain unpunished

      While only the latest in the series, the incident points to a new level of brutality and abuse by the Croatian police. In early May, the Guardian reported about a group of men who were forced across the Croatian border after being beaten and having orange crosses spray-painted on their heads. The Croatian Ministry of Interior dismissed the allegations, but the testimonies of violence and intimidation fit the trend of unlawful pushbacks taking place not only on the Croatian, but also on other external borders of the European Union.

      Numerous reports over the past three years have revealed how the Croatian border police routinely assault men, women and teenagers trying to enter the country, destroy their belongings and smash their phones before pushing them back to Bosnia. People are sometimes stripped of their clothes and shoes, and forced to walk for hours through snow and freezing cold rivers.

      A physician in the Velika Kladusa clinic told Amnesty International that approximately 60 per cent of migrants and asylum-seekers who required medical treatment reported that their injuries were inflicted by the Croatian police, while they were trying to cross the border. “Many injuries involve fractures of long bones and joints. These bones take longer to heal and their fractures render the patient incapacitated for extended periods of time. This appears to be a deliberate strategy – to cause injuries and trauma that take time to heal and would make people more reluctant to try to cross the border again or any time soon,” the physician told Amnesty International.

      The Croatian Ministry of Interior has so far dismissed these allegations, refusing to carry out independent and effective investigations into reported abuses or hold its officers to account. In a climate of pervasive impunity, unlawful returns and violence at the border have only escalated. Amnesty International has shared the details of this incident with the Ministry of Interior, but has not received an official response.

      The EU’s failure to hold Croatia to account

      The European Commission has remained silent in the face of multiple, credible reports of gross human rights abuses at the Croatian border and repeated calls by the European Parliament to investigate the allegations. Furthermore, Croatia remains a beneficiary of nearly EURO 7 million of EU assistance for border security, the vast majority of which is spent on infrastructure, equipping border police and even paying police salaries. Even the small proportion (EURO 300,000) that the Commission had earmarked for a mechanism to monitor that the border measures comply with fundamental rights and EU asylum laws, has been no more than a fig leaf. Last year, the Commission recommended Croatia’s full accession to the Schengen Area despite human rights abuses already being commonplace there.

      “The European Commission cannot continue to turn a blind eye to blatant breaches of EU law as people are being branded with crosses on their heads or brutally tortured and humiliated by Croatian police. We expect nothing less than the condemnation of these acts and an independent investigation into reported abuses, as well as the establishment of an effective mechanism to ensure that EU funds are not used to commit torture and unlawful returns. Failing urgent action, Croatia’s inhumane migration practices will turn the EU into an accomplice in major human rights violations taking place at its doorstep,” said Massimo Moratti.

      Violent pushbacks from Croatian border have been a regular occurrence since late 2017. The Danish Refugee Council recorded close to 7,000 cases of forcible deportations and unlawful returns to Bosnia and Herzegovina in 2019, most of which were accompanied by reported violence and intimidation by Croatian police. Despite the brief respite during the lockdown due to COVID-19 pandemic, pushbacks continue with 1600 cases reported only in April. The figures are increasing daily, as the restrictions across the region are being lifted and the weather is turning milder.

      Amnesty International has interviewed over 160 people who have been pushed back or returned to Bosnia and Herzegovina since July 2018. Nearly one third reported being beaten, having their documents and telephones stolen, and verbally abused in what appears to be a deliberate policy designed to deter future attempts to enter the country.

    • Croatia, police abuse is systemic

      While the world is outraged and protests after George Floyd’s death to denounce institutionalised violence, migrants have been beaten and tortured on the Balkan route for years. A brutal practice often covered up, even by the EU itself.

      George Floyd’s death on May 25th sparked protests around the world against police violence and institutional racism. In the Balkans as elsewhere, sit-ins have been held in support of #BlackLivesMatter , followed by calls to report abuses committed locally by the police. And in the region there is no lack of such abuses. In fact, police violence is routine on the “Balkan route”, the flow of migrants and refugees that has crossed the peninsula since 2015 in the hope of reaching the European Union. The events of the past few weeks have unfortunately confirmed once again the link between police brutality and immigration, bringing us back to the Croatian-Bosnian border. It is a story of systemic abuse, both proven and covered up, which involves a member state of the EU, candidate for accession to the Schengen area and, according to the latest revelations of The Guardian, the European Commission itself.
      Torture in Croatia

      When it comes to police abuse on the Croatian-Bosnian border, one does not really know where to start. The accidents recorded in recent years are so many that we can no longer even speak of “accidents”, or unexpected events. On the contrary, violence is rather a common practice, the only news being the increase in brutality by the agents, who have gone from illegal pushbacks to outright torture.

      “We rarely use the word ’torture’ in Europe, but in this case we had to”, explains Massimo Moratti, deputy director of the Europe office of Amnesty International (AI). Last week, AI published yet another report of the mistreatment of migrants by the Croatian police along the border with Bosnia and Herzegovina. Mistreatment is an understatement. The testimonies collected no longer speak of broken mobile phones, or – as has happened more recently – destroyed with a screwdriver to prevent recharging, but instead contain “actual sadism”, as Moratti puts it.

      The case in question is that of 16 Pakistani and Afghan asylum seekers arrested by the Croatian police near the Plitvice lakes between May 26th and 27th. Their testimony is chilling. “We asked them to stop and show mercy. We were already tied up, there was no reason to continue hitting and torturing us", Amir told Amnesty International. Singing and filming on mobile phones, the agents continued to beat the 16 unfortunate men hard, finally smearing their wounds with ketchup and mayonnaise found in the backpack of one of the migrants. Eventually, the group was brought back to the border and forced to walk to Bosnia. Those who were unable to walk, because they are now in a wheelchair, had to be transported by others.

      “It is a pattern, a trend. These are the same practices that we have already seen in Hungary in 2015, 2016, and 2017. Dogs, sticks, broken bones... The goal is to intimidate and frighten so that no one tries to cross the border anymore", resumes Massimo Moratti, who adds: “the fractures we saw in the latter case will take months to heal”. The Amnesty International report and the attached photos tell the rest.
      Four years of violence

      How did we get to this? It is useful to make a brief summary of recent years to understand the evolution of violence. First, the “Balkan route” became a media phenomenon in the summer of 2015, when hundreds of thousands of Syrians, Iraqis, and Afghans began to travel up the Balkan peninsula to reach the European Union. At the beginning, the destination of the route was Hungary, then, with the closure of the Hungarian wall, it became Croatia, which leads to Slovenia and then to the Schengen area. In 2015, Croatian policemen showed themselves to be tolerant and benevolent, as reminded by this cover of Jutarnji List .

      In the spring of 2016, the agreement between the EU and Turkey led to the closure of the Balkan route and a change of pace. “The first case of pushback is registered in 2016 on the Serbo-Croatian border. In 2017, we have the first cases of violence", says Antonia Pindulić, legal advisor to the Centre for Peace Studies (CMS) in Zagreb. At the end of 2017, Madina Hussiny, 6, died hit by a train while returning from Croatia to Serbia following the tracks. Together with her family, she had been illegally pushed back by the Croatian policemen.

      In the summer of 2018, the Croatian police fired on a van that carried 29 migrants and refused to stop. Nine people were injured and two minors ended up in hospital in serious conditions. Since then, it has been a crescendo of accidents, especially on the Croatian-Bosnian border, where what remains of the Balkan route passes. Here, the testimonies collected by NGOs speak of beatings, theft, destruction of mobile phones and, as always, illegal pushbacks. Then, the situation has deteriorated up to the torture of the last few weeks. All in the silence of the authorities.
      The silence of the institutions

      How could the Zagreb government not complete an investigation in four years, address the police abuse, punish the guilty? It just didn’t. In fact, Andrej Plenković’s government has just “denied everything” for four years, while “no investigation has produced results”, as Antonia Pindulić of CMS summarises. And this despite the fact that there have been complaints from NGOs and also the actions of the institutions themselves in Croatia.

      Croatia must immediately investigate reports of excessive use of force by law enforcement personnel against migrants, including acts amounting to torture and ill-treatment, and sanction those responsible, UN human rights experts said today.

      “We are deeply concerned about the repeated and ongoing disproportionate use of force by Croatian police against migrants in pushback operations. Victims, including children, suffered physical abuse and humiliation simply because of their migration status,” Felipe González Morales, the Special Rapporteur on the human rights of migrants, and Nils Melzer, Special Rapporteur on torture and other cruel, inhuman or degrading treatment or punishment, said in a joint statement.

      They said physical violence and degrading treatment against migrants have been reported in more than 60 percent of all recorded pushback cases from Croatia between January and May 2020, and recent reports indicate the number of forced returns is rising.

      Abusive treatment of migrants has included physical beatings, the use of electric shocks, forced river crossings and stripping of clothes despite adverse weather conditions, forced stress positions, gender insensitive body searches and spray-painting the heads of migrants with crosses.

      “The violent pushback of migrants without going through any official procedure, individual assessment or other due process safeguards constitutes a violation of the prohibition of collective expulsions and the principle of non-refoulement,” González Morales said.

      “Such treatment appears specifically designed to subject migrants to torture and other cruel, inhuman or degrading treatment as prohibited under international law. Croatia must investigate all reported cases of violence against migrants, hold the perpetrators and their superiors accountable and provide compensation for victims,” Melzer added.

      The UN Special Rapporteurs are also concerned that in several cases, Croatian police officers reportedly ignored requests from migrants to seek asylum or other protection under international human rights and refugee law.

      “Croatia must ensure that all border management measures, including those aimed at addressing irregular migration, are in line with international human rights law and standards, particularly, non-discrimination, the prohibition of torture and ill-treatment, the principle of non-refoulement and the prohibition of arbitrary or collective expulsions,” they said.

      During his official visit to Bosnia and Herzegovina in September 2019, González Morales received information on violent pushback of migrants by Croatian police to Bosnia and Herzegovina. He has exchanged views with relevant Croatian authorities on this issue on several occasions. Already during his official visit to Serbia and Kosovo* in 2017, Melzer had received similar information from migrants reporting violent ill-treatment during pushback operations by the Croatian police.

  • Latest Tactic to Push Migrants From Europe ? A Private, Clandestine Fleet

    The government of Malta enlisted three privately owned fishing trawlers to intercept migrants in the Mediterranean, and force them back to a war zone, officials and a boat captain say.

    With the onset of the coronavirus, Malta announced that it was too overwhelmed to rescue migrants making the precarious crossing of the Mediterranean Sea, where the tiny island nation has been on the front line of the maritime migration route over the past decade.

    In secret, however, the Maltese authorities have worked hard to make sure no migrants actually reach the island.

    It dispatched a small fleet of private merchant vessels in April to intercept migrants at sea and return them by force to a war zone in Libya, according to information provided by the captain of one of the boats, a senior commander in the Libyan Coast Guard, and a former Maltese official involved in the episode.

    The three repurposed fishing trawlers are privately owned, but acted on the instructions of the Armed Forces of Malta, the captain and the others said.

    The clandestine operation, which some experts consider illegal under international law, is just the latest dubious measure taken by European countries in recent years to stem the migration from Africa and the Middle East that has sown political chaos in Europe and fueled a populist backlash.

    Since 2017, European states, led by Italy, have paid the Libyan government to return more migrants to Libya, hassled the private rescue organizations that try to bring them to Europe, and asked passing merchant vessels to intercept them before they enter European waters.

    But Malta’s latest tactic may be among the most egregious, maritime experts say, because it involved a designated flotilla of private vessels, based in a European port, that intercepted and expelled asylum seekers from international waters that fall within the responsibility of European coast guards.

    “Against a pattern of increased abuses against asylum seekers in recent years, this newest approach stands out,” said Itamar Mann, an expert in maritime and refugee law at the University of Haifa in Israel. “Its methods chillingly resemble organized crime, and indeed the operations of people smugglers, which European policymakers so adamantly denounce.”

    “The facts available raise serious concerns that we are seeing the emergence of a novel systematic pattern, such that may even put Maltese state officials in danger of criminal liability, at home or abroad,” Dr. Mann added.

    The Maltese government did not respond to multiple requests for comment.

    The activity was first documented on the evening of April 12, when three aging blue trawlers left the Grand Harbour in Valletta, the Maltese capital, within an hour of each other. The three boats — the Dar Al Salam 1, the Salve Regina and the Tremar — departed at the request of the Maltese authorities, according to the captain of the Tremar, Amer Abdelrazek.

    A former Maltese official, Neville Gafa, said he was enlisted by the government that same night to use his connections in Libya to ensure the safe passage of the first two boats to Libya.

    The boats did not submit paperwork to the immigration police, and switched off their satellite tracking devices soon after leaving port, maritime databases show.

    But their mission had already been determined, said Mr. Gafa, who said he had been asked by the Maltese prime minister’s chief of staff, Clyde Caruana, to help coordinate the operation. Mr. Caruana did not respond to requests for comment, but a government spokesman told The Times of Malta that Mr. Gafa had been asked to liaise with Libya on a separate matter that was unconnected to the episode.

    The trawlers were sent to intercept a migrant vessel attempting to reach Malta from Libya — and which had been issuing mayday calls for some 48 hours — and then return its passengers to Libya, Mr. Gafa said.

    The stricken migrant vessel was still in international waters, according to coordinates provided by the migrants by satellite phone to Alarm Phone, an independent hotline for shipwrecked refugees. But it had reached the area of jurisdiction of Malta’s armed forces, making it Malta’s responsibility under international maritime law to rescue its passengers and provide them with sanctuary.

    Two of the trawlers — the Dar Al Salam 1 and the Tremar — reached the migrant vessel early on April 14, guided by a Maltese military helicopter, Mr. Abdelrazek said. Several of the migrants had already drowned, according to testimony later gathered by Alarm Phone.

    The roughly 50 survivors were taken aboard the Dar Al Salam 1, Mr. Abdelrazek said.

    The Dar Al Salam 1 and the Salve Regina sailed to Tripoli on April 15, the former carrying the migrants and the latter carrying several tons of food and water, as a show of appreciation to the Libyan government, Mr. Abdelrazek and Mr. Gafa said. The Tremar waited in international waters, Mr. Abdelrazek said.

    The Maltese authorities told their Libyan counterparts that the Dar Al Salam 1 was in fact a Maltese vessel called the Maria Cristina, said Commodore Masoud Abdalsamad, who oversees international operations at the Libyan Coast Guard. To further obscure its identity, the boat’s crew had also painted over the ship’s name and flew a Maltese flag to confuse the Libyan Coast Guard.

    Though based physically in Malta and owned by a Maltese shipowner, the vessel is legally registered in Tobruk, a port in east Libya controlled by opponents of the authorities in Tripoli. The crew did not want to risk upsetting the Tripoli government by broadcasting its links to Tobruk, leading it to hide its name and home port, Mr. Abdelrazek said.

    After disembarking, the migrants were taken to a notorious detention center run by a pro-government militia, where migrants are routinely tortured, held for ransom or sold to other militias. The detention cells stand close to an arms depot, and the surrounding area was hit by shelling in December.

    Conditions at the detention center are “utterly appalling,” said Safa Msehli, a spokeswoman for the International Organization for Migration, an arm of the United Nations. “People are caged in overcrowded hangars with barely any access to food or sanitation facilities.”

    “Many tell us of the abuse they endure and the inhumane ways in which they are exploited,’’ Ms. Msehli added. ‘‘Reports of migrants being used to load weapons, and the detention center’s proximity to a military facility, raise serious concerns over the safety of people detained there arbitrarily.”

    After departing Tripoli, the Dar Al Salam 1 turned its satellite identification system back on, and the boat resurfaced off the coast of Libya on the evening of April 15, data provided by Marine Traffic, a maritime database, shows.

    The owner of the Salve Regina, Dominic Tanti, declined to comment through an intermediary, and the owner of the Tremar, Yasser Aziz, did not return a message seeking comment.

    The owner of the Dar Al Salam 1, Carmelo Grech, did not to respond to multiple requests for comment sent by text, voice message and a letter hand-delivered to his apartment. But he has confirmed his boat’s involvement to a Maltese newspaper, and several outlets have already highlighted its role, including the Italian newspaper, Avvenire, and the Maltese blogger Manuel Delia.

    Mr. Grech and his boat have colorful histories, raising questions in Malta about why the government involved them in a state-led operation.

    Mr. Grech has previously recounted how he used the boat, then known as the Mae Yemanja, to bring supplies to Libyan rebels during the Libyan revolution in 2011. In 2012, court records show it was impounded after Mr. Grech was accused, though later acquitted, of smuggling contraband cigarettes from Libya to Malta.

    In 2015, Mr. Grech was detained by a Libyan faction for several days for what he later described as a misunderstanding over his visas.

    Maltese ship records obtained by The Times show that Mr. Grech canceled his boat’s registration in Malta last February, before repainting it to show it had been re-registered in Tobruk, for undisclosed reasons.

    Mr. Abdelrazek also has a criminal history, having been convicted in 2014 of forging documents, court records show.

    After appearing briefly in Malta last week, the Dar Al Salam 1 and the Salve Regina returned again to sea on Sunday.

    Their satellite trackers were once again switched off shortly afterward.

      PM says Easter manoeuvre was a ’rescue’ not a pushback.

      Prime Minister Robert Abela has admitted commissioning a boat that returned migrants to war-torn Libya on Easter weekend but has insisted it was a rescue mission and not a pushback.

      A boat commissioned by Maltese authorities picked up a group of migrants in the search and rescue area earlier this month and returned them to the North African country.

      It is a crime under international law for states to return asylum seekers to a country where they are likely to face persecution.

      Speaking publicly about the controversy for the first time on Friday, Abela admitted the manoeuvre and defended the government’s actions.

      "There was no pushback,"he said.

      "There was a rescue of migrants. Had the Maltese government not coordinated, tens of lives would have died, because a [EU coastguard] Frontex plane just flew overhead and kept on going.

      “Malta’s ports are closed but it coordinated this rescue and ensured that the irregular migrants were taken to the port that was open.”

      The country, along with Italy, closed its ports, citing concerns about the spread of coronavirus.

      Former OPM official Neville Gafa claimed under oath this week that he had coordinated the pushback.

      Asked Gafa’s involvement, Abela said his only involvement was liaising with a contact he was claiming to have in Libya so that the rescue could be facilitated. He said Gafa was not paid or promised anything.

      Abela defended using a private boat, saying that a Search and Rescue convention stipulates the legal obligations of individual states that are not obliged to carry out the actual rescues but to coordinate such rescues.

      The obligations also state that countries can use their own assets or else send private assets to rescue boats in distress, he said.

      This week, Malta has commissioned a Captain Morgan tourist boat Europa II, to house migrants until a solution for their disembarkation is found.

      “We are ready to do anything to save lives. We have nothing to be ashamed of,” Abela said, adding that the cost for the Captain Morgan boat being used to temporarily house migrants outside Maltese waters will come from aid by the EU.

      “Malta’s position is clear and we know what our obligations are. We are going to remain firm on this. We are not a safe port and we cannot guarantee our resources for rescues.

      "We are duty bound to stick to this position. It is counterproductive to close port and airports to tourists but then open ports for irregular migrants. There are hundreds of thousands of people on the Libyan coast wanting to leave there and come to Lampedusa and Malta. We are obeying international rules,” he insisted.

      He said the migration problem should not be “Malta’s alone” and called for the EU to intervene.

      Earlier on Friday, Foreign Minister Evarist Bartolo told Times of Malta that “the EU was responsible for a huge push back of migrants to Malta”.

      He said its failure to set up an effective and fair solidarity mechanism to share the burden of welcoming irregular migrants means that Malta had borne a huge burden over the years.

      He quoted a letter from a United Nations official to him in which he admitted that Europe needed to adopt a more principled migration policy that will serve European needs, that does not penalise those seeking to cross, and that does not leave countries like Malta, which are trying to do the right thing, on their own.

      “If we continue to fail, more people, Libyans and non-Libyans, will be compelled to seek safety on the European side” because of the ongoing war and the economic consequences of Covid-19.

      Bartolo said that in the first three months of the year, 3,600 irregular migrants left the Libyan coast through the Central Mediterranean route. This is over 400 per cent more than in the same period in 2019. Some 1,200 came to Malta.

      He said Malta’s centres were “overflowing” and there is no room for more migrants.

      Le troisième chalutier, le Salve Regina, a quant à lui navigué vers Tripoli le 15 avril, transportant plusieurs tonnes de nourriture et d’eau, en guise de remerciement au gouvernement libyen, assure au quotidien américain le capitaine du Tremar, Amer Abdelrazek.

      Devant la justice maltaise, à la suite de la plainte lancée par plusieurs ONG contre le Premier ministre sur sa responsabilité dans la mort des cinq migrants, Neville Gafa a déclaré sous serment qu’il avait agi sur ordre du cabinet du Premier ministre.

      Une opération illégale

      « Dans une tendance à l’augmentation des abus contre les demandeurs d’asile ces dernières années, cette nouvelle approche se démarque », déclare au New York Times Itamar Mann, expert en droit maritime et des réfugiés à l’université de Haïfa, en Israël. « Ces méthodes ressemblent de façon effrayante au crime organisé, aux opérations de passeurs, que les décideurs européens dénoncent avec tant de fermeté », continue le chercheur pour qui cette opération est illégale eu égard au droit international.

      En effet, comme écrit le quotidien américain, une flotte de navires privées, basée dans un port européen, qui intercepte et expulse des demandeurs d’asile des eaux internationales relèvent de la responsabilité des garde-côtes européens.

      Cette opération « pourrait mettre les fonctionnaires de l’Etat maltais en danger de responsabilité pénale, dans le pays ou à l’étranger », signale encore Itamar Mann.

      Malta and Libya will be setting up units to coordinate operations against illegal migration, the government said on Thursday.

      These centres are expected to start operating within the coming weeks, however, the government provided no additional information.

      The announcement followed an unannounced trip by Prime Minister Robert Abela, Home Affairs Minister Byron Camilleri and Foreign Affairs Minister Evarist Bartolo to Tripoli, where they discussed migration with the Libyan government.

      The three met Fayez al-Sarraj who heads the UN-backed Government of National Accord as well as Mohammed Sheibani, deputy minister responsible for migration at the meeting in Tripoli.

      It was Abela’s first trip to war-torn Libya as prime minister.

      Sources said the meeting was held on the back of a new wave of Malta-Libya relations, and a change in approach.

      Discussions revolved around the need to push the EU to help Libya to train its coastguard, obtain funding for reception camps manned by the UN, as well as to build a realistic strategy to slow down the flow of migrants into Libya.

      “It was a positive meeting, though of course that doesn’t mean we’ve resolved the migration issue,” a source told Times of Malta.

      “Malta could be Libya’s bridge to the EU. We need to stop human trafficking as well as save lives at sea,” the source said.

      Valletta, diplomatic sources say, has been trying to build new bridges with the Libyan authorities to stem the tide of migrants leaving the North African coast.
      800,000 migrants in Libya

      In a statement issued later on Thursday, the government said that during the meeting Abela reiterated Malta’s position on the need to address and stop human trafficking. Malta, he added, was facing unprecedented and disproportionate flows and burdens.

      Meanwhile, al-Sarraj said that 800,000 migrants were currently in Libya and the country needed an effective long-term and holistic approach.

      Both leaders spoke about the need to strengthen cooperation to ensure that lives are not lost at sea and to combat human traffickers on the ground and at sea.

      According to Abela, the solution lies in concrete action on Libyan shores and its southern border. This would be done through addressing and stopping human trafficking, rather than focusing just on relocation of migrants to other countries.

      Signing a #memorandum_of_understanding, Malta and Libya agreed to set up a coordination unit in each country to assist in operations against illegal migration.

      The agreement also stipulates that Malta supports Libya when it comes to financial assistance through the upcoming Multiannual Financial Framework.

      Malte a signé un accord avec le gouvernement d’union nationale (GNA) libyen dans le but de renforcer « la lutte contre l’immigration illégale » en mer Méditerranée. Le texte prévoit la création de « centres de coordination » à Tripoli et La Valette qui seront opérationnels dès le mois de juillet.

      Malte tente par tous les moyens de limiter le flux de migrants qui débarquent sur ses côtes. Pour ce faire, les autorités maltaises et libyennes viennent d’acter la création de « centres de coordination » à Tripoli et à La Valette.

      Ces deux centres « offriront le soutien nécessaire à la lutte contre l’immigration illégale en Libye et dans la région méditerranéenne », selon un protocole d’accord entre Malte et le gouvernement d’union nationale (GNA) de Fayez al-Sarraj, et présenté au Parlement maltais mercredi 3 juin (https://www.independent.com.mt/file.aspx?f=206640).

      Financé par le gouvernement maltais, ces structures seront chacune dirigées par trois fonctionnaires et limiteront leur travail « au soutien et à la coordination », indique cet accord valable pour trois ans. Les centres devraient voir le jour dès le mois de juillet.

      Malte, le plus petit État de l’Union européenne (UE), de par sa taille et sa population, se plaint depuis longtemps d’être obligé d’assumer à lui seul l’arrivée des migrants en provenance de la Libye, pays en guerre.

      Actuellement, plus de 400 migrants secourus en Méditerranée sont bloqués sur quatre navires touristiques affrétés par Malte juste à la limite de ses eaux territoriales, La Valette exigeant qu’ils soient ensuite pris en charge par d’autres pays européens.

      Le ministre maltais des Affaires étrangères, Evarist Bartolo, a déclaré au Parlement mercredi que « l’UE a la responsabilité de parvenir à un accord global avec la Libye afin de limiter l’immigration clandestine ».

      « Le nombre d’immigrants arrivant à Malte est disproportionné par rapport aux autres pays européens », a insisté le ministre. Selon lui, depuis 2005 l’Europe n’a accueilli que 1 700 migrants, tandis que 22 000 sont arrivés à Malte - seuls 8% des migrants en situation irrégulière sur l’île ont été relocalisés dans d’autres pays européens.

      Selon le protocole d’accord, Malte proposera à la Commission européenne une augmentation du soutien financier pour aider le GNA à sécuriser ses frontières sud et à démanteler les réseaux de trafiquants d’êtres humains.

      La Valette proposera également le financement de « moyens maritimes supplémentaires nécessaires » pour contrôler et intercepter les passeurs de migrants en Méditerranée.

      I due Paesi daranno insieme la caccia ai migranti nel Mediterraneo, ma con nuovi fondi Ue da destinare a Tripoli.

      E’ prevista la creazione di «centri di coordinamento» nel porto di Tripoli e a La Valletta che saranno operativi da luglio. In realtà le operazioni congiunte andavano avanti da anni, ma adesso sono state ufficializzate. Le strutture congiunte «forniranno il sostegno necessario alla lotta contro l’immigrazione clandestina in Libia e nella regione del Mediterraneo», si legge. Inizialmente Malta finanzierà interamente l’attivazione delle centrali operative, ognuna delle quali sarà guidata da tre funzionari dei rispettivi governi. Fin da subito, però, il premier Abela si impegna a ottenere dall’Ue fondi aggiuntivi da destinare alla cosiddetta Guardia costiera libica, che verrà ulteriormente equipaggiata.

      Nessuna menzione si fa riguardo alla necessità di ristabilire il rispetto dei diritti umani nei campi di prigionia libici. L’unico scopo, come del resto è sempre stato in questi anni anche per Italia e Ue, è quello di trattenere i profughi in cattività, a qualunque costo. «L’UE ha la responsabilità di raggiungere un accordo globale con la Libia», c’è scritto nell’accordo che, di fatto, appalta a Malta e Libia il controllo dell’intero Canale di Sicilia, ad esclusione delle ultime 12 miglia territoriali dalla costa di Lampedusa. Malta, lo stato più piccolo dell’Unione Europea (Ue) per dimensioni e popolazione, si è lamentato da tempo di essere costretto ad assumere da solo la responsabilità dell’arrivo dei migranti dalla Libia, un paese in guerra che secondo l’Onu in alcun modo può essere ritenuto un “porto sicuro”.

      Nelle settimane scorse una nuova serie di inchieste giornalistiche internazionali ha permesso di accertare che non solo Malta ha messo in mare da tempo una flottiglia di “pescherecci fantasma” incaricati di intercettare i barconi e ricondurli in Libia, ma che spesso le Forze armate dell’isola equipaggiano i gommoni, anche con motori nuovi, affinché raggiungano le coste siciliane.

      Nei giorni scorsi il Tribunale dell’isola aveva archiviato il procedimento contro il premier laburista Robert Abela e il capo delle forze armate, accusati della morte di 12 migranti nella “strage di Pasquetta”. Forte di questa “assoluzione”, Abela si è recato a Tripoli per sigillare l’intesa con il presidente al-Sarraj. Ma proprio uno dei punti chiave utilizzati dal giudice Joe Mifsud per cestinare le accuse, ieri è stato categoricamente smentito dall’agenzia Ue Frontex che ha risposto per iscritto alle domande di Avvenire. Secondo il magistrato, infatti, il coordinamento dei soccorsi in qualche misura era attribuibile non a Malta ma a Frontex che aveva individuato con un suo aereo i barconi. Da Varsavia, rispondendo con una nota ad “Avvenire”, l’agenzia ha precisato che “è il centro di salvataggio appropriato, non Frontex, a decidere se chiedere assistenza a qualsiasi nave della zona. E Frontex non aveva navi vicino a quest’area”. La responsabilità di intervenire, dunque, era di innanzitutto di Malta che invece per giorni ha ignorato gli Sos e ha poi inviato un motopesca quando oramai 7 persone erano affogate e altre 5 sono morte di stenti durante il respingimento dalle acque maltesi verso la Libia.

      Nel fine settimana di Pasqua l’aeroobile Eagle 1, tracciato e segnalato dal giornalista Sergio Scandura di Radio Radicale “stava svolgendo - spiegano da Frontex - una missione di sorveglianza ben al di fuori dell’area operativa dell’Operazione Themis di Frontex”. Nella nota un portavoce dell’agenzia Ue precisa poi che “Frontex gestisce operazioni congiunte, nonché la sorveglianza pre-frontaliera, che veniva eseguita dall’aereo in questione”. Secondo questa ricostruzione, che avrebbe meritato maggiore puntiglio investigativo anche per accertare eventuali responsabilità esterne a Malta, “in linea con il diritto internazionale, Frontex ha avvisato i centri di soccorso competenti dell’avvistamento di una nave che riteneva necessitasse di assistenza”, si legge ancora. Parole che hanno un significato preciso e costituiscono un’accusa verso chi era stato informato e doveva prestare quell’assistenza negata per giorni. Le autorità italiane hanno apposto il segreto alle comunicazioni intercorse. Silenzio che potrebbe essere presto scardinato da indagini giudiziarie. Lo stesso per Malta, che neanche nell’atto conclusivo dell’inchiesta ha voluto rendere pubbliche le comunicazioni con Roma e con Frontex che a sua volta ribadisce ad Avvenire che “è il centro di salvataggio appropriato, non Frontex, a decidere se chiedere assistenza a qualsiasi nave della zona. Tuttavia, desidero sottolineare qui che Frontex non aveva navi vicino a quest’area”.

      Il memorandum sta creando non poco dibattito nei vertici della Marina militare italiana. A Tripoli, infatti, si trova la nave Gorgona, ufficialmente incaricata di assistere la cosiddetta guardia costiera libica per conto di Roma. E certo i marinai italiani non vogliono finire a fare gli addetti alla manutenzione delle motovedette donate dall’Italia ma che tra pochi giorni si coordineranno con Malta. «Mentre l’obiettivo dichiarato nell’accordo vi è il benessere del popolo libico e di quello maltese, il benessere delle principali vittime, cioè migranti, richiedenti asilo e rifugiati, non viene mai menzionato», ha commentato sul portale cattolico Newsbook il giudice maltese Giovanni Bonelli, già membro della Corte europea dei diritti dell’uomo. «Si potrebbe pensare - aggiunge - che questo memorandum si riferisca all’estrazione di minerali, non a degli esseri umani».Fonti delle Nazioni Unite contattate da “Avvenire” hanno reagito a caldo considerando l’intesa come una «regolamentazione di fatto dei respingimenti illegali».

      Negli anni scorsi più volte Avvenire ha documentato, anche con registrazioni audio, il collegamento diretto tra la Marina italiana e la Guardia costiera libica. Ma ora Malta si spinge oltre, ufficializzando una alleanza operativa che inoltre rischierà di causare conflitti con l’operazione navale europea Irini a guida italiana. Fonti delle Nazioni Unite contattate da Avvenire hanno reagito a caldo considerando l’intesa come una “regolamentazione di fatto dei respingimenti illegali”.

    • Malta: Illegal tactics mar another year of suffering in central Mediterranean

      The Maltese government has resorted to dangerous and illegal measures for dealing with the arrivals of refugees and migrants at sea, which are exposing countless people to appalling suffering and risking their lives, Amnesty International revealed today in a report “Waves of impunity: Malta’s violations of the rights of refugees and migrants in the Central Mediterranean”. As Amnesty is launching this new report, despair is growing aboard the Maersk Etienne, which has been denied a port to disembark for over a month, after rescuing 27 people on a request from Maltese authorities

      The Maltese government’s change in approach to arrivals in the central Mediterranean in 2020 has seen them take unlawful, and sometimes unprecedented, measures to avoid assisting refugees and migrants. This escalation of tactics included arranging unlawful pushbacks to Libya, diverting boats towards Italy rather than rescuing people in distress, illegally detaining hundreds of people on ill-equipped ferries off Malta’s waters, and signing a new agreement with Libya to prevent people from reaching Malta.

      “Malta is stooping to ever more despicable and illegal tactics to shirk their responsibilities to people in need. Shamefully, the EU and Italy have normalized cooperation with Libya on border control, but sending people back to danger in Libya is anything but normal,” said Elisa De Pieri, Regional Researcher at Amnesty International.

      “EU member states must stop assisting in the return of people to a country where they face unspeakable horrors.”

      Some of the actions taken by the Maltese authorities may have involved criminal acts being committed, resulting in avoidable deaths, prolonged arbitrary detention, and illegal returns to war-torn Libya. The authorities also used the COVID-19 pandemic as a pretext to declare that Malta was not a safe place to disembark – to discourage people from seeking safety and a decent life in Europe.

      The abusive practices by Malta are part and parcel of wider efforts by EU member states and institutions to outsource the control of the central Mediterranean to Libya, in order that EU-supported Libyan authorities might intercept refugees and migrants at sea before they reach Europe.

      People are then returned to Libya and arbitrarily detained in places where torture and other ill-treatment is highly likely. From the beginning of January to 27 August 2020 7,256 people were ‘pulled back’ to Libya by the EU-supported Libyan Coast Guard, which was often alerted of the presence of boats at sea by airplanes engaged in Frontex and other EU operations.

      The Easter Monday pushback

      The case of the “Easter Monday pushback” illustrates the desperate lengths to which the Maltese authorities are willing to go to prevent people arriving on their shores.

      On 15 April 2020, a group of 51 people, including seven women and three children, were unlawfully returned to Tripoli after being rescued in Malta’s search and rescue region by the commercial fishing boat Dar Al Salam 1.

      The boat, which had been contracted by the Maltese government, took those onboard back to Libya and handed them over to the Libyan authorities, exposing refugees and migrants – who had just survived a deadly shipwreck – to further risks to their life.

      Five people were dead when the vessel reached Libya, and the survivors reported that a further seven people were missing at sea. Survivors reported that those on board were not given medical assistance. In an official statement the Maltese authorities confirmed they had coordinated the operation.

      Lack of accountability in Malta

      While a magisterial inquiry into the case was conducted, it left many questions unanswered. It is still unknown how the 12 people died and how 51 were returned to Libya despite it being illegal to transfer people there. The magistrate conducting the inquiry did not hear the testimonies of the 51 people transferred to Libya, nor probe the chain of responsibility to contract the Dar El Salam 1 and instruct it to transfer people to Libya.

      The NGO Alarm Phone has evidence that other pushbacks by Maltese authorities may also have occurred in 2019 and 2020, which have not been investigated.

      EU and Italian cooperation with Libya

      Italy in particular has worked closely with Libya, having provided support to Libyan maritime authorities by providing vessels, training and assistance in the establishment of a Libyan SAR region to facilitate pullbacks by the Libyan coastguard.

      Despite intensifying conflict and the arrival of COVID-19 threatening the humanitarian situation of refugees and migrants in Libya, Italy has continued to implement policies to keep people in Libya. These include extending its Memorandum of Understanding on Migration with Libya aimed at boosting Libyan authorities’ resources to prevent departures, for another three years, extending its military operations in the region focusing on supporting Libya’s maritime authorities, and maintaining legislation and practices aimed at the criminalization of NGOs rescuing people in the central Mediterranean.

      The central Mediterranean is the latest border on which Amnesty International is highlighting abuses by EU member states authorities. In 2020, Amnesty International has also documented abuses on the borders between Croatia and Bosnia, and Greece and Turkey. The EU urgently needs an independent and effective human rights monitoring system at its external borders to ensure accountability for violations and abuses.

      “The European Commission must turn the page when they launch the New Pact on Migration and Asylum after the summer and ensure European border control and European migration policies uphold the rights of refugees and migrants,” said Elisa De Pieri.

      “The horrors faced by people returned to Libya must caution European leaders against cooperating with countries which don’t respect human rights. By continuing to empower abusers and to hide their heads in the sand when violations are committed, those EU leaders share responsibility for them.”

  • Paris et Rome adoptent « une position commune » sur la répartition des migrants en Europe

    Les pays de l’UE devront participer au « #mécanisme_automatique » de répartition, voulu par MM. Macron et Conte, sous peine de pénalités financières.

    Après des mois de brouille franco-italienne, le président français, Emmanuel Macron, et le chef du gouvernement italien, Giuseppe Conte, se sont déclarés d’accord, mercredi 18 septembre, pour mettre en place un « mécanisme automatique » de répartition des migrants.

    Après deux ans de dissensions sur cet épineux dossier, ils défendront désormais au sein de l’Union européenne (UE) « une position commune pour que tous les pays participent d’une façon ou d’une autre » à l’accueil « ou bien soient pénalisés financièrement », a expliqué M. Macron.
    Lors d’une conférence de presse commune, ils ont aussi réclamé une gestion « plus efficace » du renvoi dans leur pays d’origine des migrants qui n’ont pas droit à l’asile. Le dirigeant italien a souligné que l’Italie ne « laisserait pas les trafiquants décider des entrées sur le territoire », mais aussi jugé qu’il fallait « gérer ce phénomène », quand l’ancien ministre de l’intérieur Matteo Salvini, patron de la Ligue, refusait tout débarquement de migrants.
    La France solidaire

    Regrettant de son côté « l’injustice » vécue par les Italiens, Emmanuel Macron a répété que l’UE n’avait pas été suffisamment solidaire envers l’Italie. « La France est prête à évoluer sur ce point dans le cadre de la remise à plat des accords de Dublin », qui confient actuellement aux pays d’arrivée la charge du traitement des demandes d’asile, a-t-il dit. « Je ne mésestime pas ce que le peuple italien a vécu », a expliqué M. Macron, mais « la réponse au sujet migratoire n’est pas dans le repli mais dans une solution de coopération européenne efficace. »

    Plusieurs ministres de l’intérieur de l’UE (dont les ministres français, allemand et italien) doivent se réunir lundi à Malte pour discuter de ce dossier.

    Les deux dirigeants n’ont toutefois pas évoqué devant la presse certaines des demandes de l’Italie venant en complément de la future répartition automatique des migrants en Europe. Parmi ces points qui restent à éclaircir figurent la répartition non seulement des demandeurs d’asile mais aussi des migrants économiques ainsi que la rotation des ports de débarquement, qui devrait intégrer des ports français. Fermés aux ONG secourant les migrants, les ports italiens se sont entrouverts ces derniers jours en laissant notamment débarquer sur l’île de Lampedusa 82 rescapés.
    Un sommet bilatéral programmé

    La visite du président français, la première d’un dirigeant européen depuis l’arrivée au pouvoir d’une nouvelle coalition en Italie, visait d’abord à rétablir de bonnes relations entre les deux pays, après une année de tensions avec les leaders de la précédente coalition populiste au pouvoir, notamment sur la question migratoire.

    Le chef de l’Etat français n’a passé qu’une soirée dans la capitale italienne, enchaînant un court entretien avec son homologue, Sergio Mattarella, et un dîner de travail avec le premier ministre, Giuseppe Conte, récemment reconduit à la tête d’un nouvel exécutif où le Mouvement cinq étoiles (M5S) est cette fois associé au Parti démocrate (centre gauche) et non à la Ligue (extrême droite).

    Entre l’Italie et la France existe « une amitié indestructible », a assuré le président français dont le déplacement à Rome a permis de programmer, pour 2020 en Italie, un sommet bilatéral, rendez-vous annuel lancé en 1983 mais qui n’avait pas été mis à l’agenda l’an passé pour cause de tensions entre les deux pays.

      Je viens de m’entretenir à l’instant avec le Président de la République, Sergio MATTARELLA, après les entretiens que nous avons eu au printemps dernier, lors des commémorations des 500 ans de la mort de Léonard DE VINCI en France, et je suis heureux de vous retrouver ici, cher Giuseppe, à Rome dans ces responsabilités.

      Ma présence aujourd’hui, c’est d’abord la volonté marquée de travailler ensemble pour la relation bilatérale et pour le projet européen, vous l’avez parfaitement rappelé. C’est aussi un message fort et clair envoyé au peuple italien d’amitié de la part du peuple français. Votre Président l’a dit il y a quelques mois, cette amitié est indestructible. Parfois nous ne sommes pas d’accord, il se peut qu’on se dispute, il se peut qu’on ne se comprenne pas mais toujours on se retrouve. Et je crois que nous en sommes là et que la volonté du peuple français est véritablement de travailler avec le peuple italien et de réussir pleinement. Vous l’avez dit Monsieur le Président à l’instant, notre souhait est de renforcer, et nous venons de l’évoquer ensemble, la coopération bilatérale et européenne et je veux revenir simplement sur quelques sujets.

      Le premier évidemment c’est le sujet des migrations. Sur ce sujet je ne mésestime pas ce que depuis 2015 le peuple italien vit, ce que l’Italie a subi, et là aussi avec beaucoup parfois de malentendus, d’incompréhensions, d’injustices qui ont été vues, perçues, et qui ont suscité de la colère. Je crois très profondément, comme vous l’avez dit, que la réponse au sujet migratoire n’est pas dans le repli, la provocation nationaliste mais la construction de solutions et de coopérations européennes réelles et efficaces.

      D’abord, nous vivons une situation, aujourd’hui, qui n’est plus celle de 2015 parce qu’il y a eu un très gros travail qui a été mené pour prévenir avec les États d’origine, pour mieux travailler avec beaucoup de partenaires africains, la situation que nous avons pu connaître alors. Mais ce que nous voulons faire ensemble, c’est poursuivre ce travail. Nos ministres de l’Intérieur se retrouveront dans quelques jours pour travailler sur la base de notre échange. Ils élargiront leur discussion à d’autres collègues européens, je pense en particulier à leur collègue maltais et à l’ensemble des pays de la rive Sud, et ils se retrouveront précisément à Malte, et ils poursuivront ainsi le travail que nous avons pu lancer à Paris au mois de juillet dernier, incluant aussi plusieurs organisations internationales.

      Notre approche doit répondre à trois exigences auxquelles je crois pouvoir dire que nous sommes l’un et l’autre attachés. La première, c’est une exigence d’humanité. On ne peut résoudre, ce conflit, en le faisant aux dépens des vies humaines ou en acceptant des personnes bloquées en mer ou des scènes de noyade que nous avons trop souvent vécues. La deuxième, c’est la solidarité, et c’est ce qui a manqué bien trop souvent en Europe. Je l’ai dit, l’Union européenne n’a pas fait suffisamment preuve de solidarité avec les pays de première arrivée, notamment l’Italie, et la France est prête à évoluer sur ce point dans le cadre de la remise à plat des accords de Dublin. Je souhaite que nous puissions ensemble travailler à une solution nouvelle, plus forte et plus solidaire. Et puis le troisième principe, c’est celui de l’efficacité. Les désaccords politiques ont conduit à une approche qui est, au fond, très inefficace, inefficace pour prévenir les arrivées, inefficace aussi pour gérer ce qu’on appelle les mouvements secondaires, parce qu’avec notre organisation actuelle, nous avons au fond trop de non-coopération entre les États membres, et du coup une situation où beaucoup de femmes et d’hommes qui ont pris tous les risques pour quitter leur pays se retrouvent sur la rive de l’Europe, errent de pays en pays, où les responsabilités sont renvoyées des uns aux autres et où nous sommes collectivement inefficaces à bien protéger ceux qui ont le droit à l’asile et à pouvoir renvoyer au plus vite ceux qui n’y ont pas droit.

      S’agissant des sauvetages en mer et des débarquements, vous l’avez évoqué, Monsieur le Président du Conseil, je suis convaincu que nous pouvons nous mettre d’accord sur un mécanisme européen automatique de répartition de l’accueil des migrants coordonné par la Commission européenne, qui permette de garantir à l’Italie ou à Malte, avant une arrivée, que ses partenaires puissent prendre en charge rapidement toutes les personnes débarquées, et avoir une organisation beaucoup plus solidaire et efficace, comme je viens de le dire, plus largement.

      Pour être justes et efficaces, il nous faut donc partout pouvoir défendre le droit d’asile, qui fait partie, bien souvent, de nos Constitutions, c’est le cas de la France, qui fait partie de nos textes les plus fondamentaux, je pense justement au texte de la Convention européenne des droits de l’homme.Et donc protéger le droit d’asile, c’est aussi nous assurer que celles et ceux qui n’y ont pas droit sont reconduits le plus rapidement possible vers leur pays d’origine. C’est notre volonté commune d’avoir, au niveau européen, une plus grande harmonisation du droit d’asile, plus de coopération et une politique plus efficace de réadmission vers les pays d’origine lorsque les cas ne relèvent pas de l’asile. Au total, je crois que nous avons aujourd’hui une fenêtre d’opportunité pour parachever, relancer sur certains points, plus fondamentalement, le travail de remise à plat sur le plan des migrations et de l’asile en Europe aujourd’hui.

      La discussion que nous avons eue ces derniers jours et que nous venons d’avoir avec le Président du Conseil, comme la discussion que nous avons eue avec plusieurs de nos partenaires, en tout cas, me rend déterminé et volontariste sur ce sujet à vos côtés. Je crois, là aussi, que nous pourrons défendre une position commune avec la nouvelle Commission européenne pour que tous les pays participent, sous une forme ou une autre, à la solidarité européenne en la matière, ou bien soient pénalisés financièrement.

      Le deuxième sujet extrêmement important que nous avons discuté et qui est au cœur non seulement de l’agenda bilatéral mais de l’agenda européen, c’est celui de la croissance, de la création d’emplois, du contexte macroéconomique. Le Président du Conseil l’a évoqué. Nous voyons tous les chiffres en Europe, et si aujourd’hui, la croissance se tient à peu près, elle est en deçà de ce que nous avons pu connaître parce qu’il y a les incertitudes géopolitiques, parce qu’il y a la conflictualité commerciale mondiale, parce qu’il y a un ralentissement en Chine qui pèse sur plusieurs économies de la zone euro, parce qu’il y a aussi sans doute une coordination de nos politiques économiques qui n’est plus adaptée.

      Je veux, en la matière, ce soir, et le faire ici a un sens tout particulier, rendre hommage au travail de Mario DRAGHI, et tout particulièrement à ses dernières décisions. Une fois encore avec beaucoup de courage et de clairvoyance, le Président de la Banque centrale européenne a pris les décisions qui convenaient, mais il a aussi fait des déclarations qui convenaient, même si certains ne veulent pas entendre. Je le dis avec force, il a, à mes yeux, raison. La politique monétaire, depuis 2012, a fait le maximum de ce qu’elle pouvait faire pour préserver la situation européenne, éviter la déflation et nous éviter le pire. Il appartient aujourd’hui aux chefs d’État et de gouvernement de prendre leurs responsabilités en ce qui concerne leur budget propre comme en ce qui concerne les décisions que nous aurons à prendre au niveau européen, pour avoir une véritable politique de relance et de demande intérieure. Certains États membres ont des marges de manœuvre, et je salue d’ailleurs les annonces récentes à cet égard des Pays-Bas, qui ont décidé d’un plan d’investissements d’avenir dans lequel, je dois dire, je me retrouve, 50 milliards d’investissements sur les années qui viennent.

      J’attends avec impatience les décisions des autres États membres, et je pense que les décisions budgétaires que nous aurons collectivement à prendre doivent tenir compte de ce contexte macroéconomique et être au rendez-vous de l’investissement, de la relance. Nous en avons besoin parce que nous avons des défis éducatifs en matière de recherche, en matière stratégique, qui sont fondamentaux. Et je crois que nous pouvons garder le sérieux qui relève de nos traités, nous pouvons garder la politique de réformes qui relève de chaque pays, mais que nous devons conduire, et nous pouvons garder la lucidité sur le contexte macroéconomique qui est le nôtre, et refuser, en quelque sorte, que notre continent rentre dans la stagnation et plutôt s’arme pour préparer son avenir.

      Nous avons évoqué, avec le Président du Conseil, plusieurs autres sujets, évidemment la politique culturelle et les coopérations culturelles entre nos pays. Nous avons des échéances à venir extrêmement importantes : l’exposition Léonard DE VINCI, les expositions RAPHAËL qui vont être l’objet d’échanges, de partenariats entre nos deux pays et qui sont au cœur, je crois, de ce regard réciproque, de cette fierté que nous portons ensemble.

      Nous avons évoqué et nous allons travailler ce soir sur les sujets climatiques. Là aussi, nous croyons l’un et l’autre dans un agenda ambitieux sur le plan européen d’investissement, d’une banque climatique qui doit être au cœur du projet de la prochaine Commission, d’un prix du CO2 qui doit aussi prendre en compte ce défi et d’une stratégie neutralité carbone à l’horizon 2050, pour laquelle nous espérons finir de convaincre les derniers partenaires réticents. C’est cette même stratégie que nous allons défendre ensemble à New York lors du sommet climat, puis au moment où nous aurons à prendre nos engagements pour le Fonds vert dans les prochaines semaines.

      Enfin, le Président du Conseil l’a évoqué, sur plusieurs sujets internationaux, là aussi, nous avons conjugués nos efforts et nos vues. Et je crois que le sujet de la crise libyenne, qui nous a beaucoup occupé ces dernières années, fait l’objet aujourd’hui d’une vraie convergence franco-italienne, vraie convergence parce que nous avons su travailler ensemble pour passer des messages à nos partenaires. Je veux saluer la rencontre que vous avez eue avec le Président AL-SARAJ cet après-midi, et avec une conviction pleinement partagée : l’issue ne peut être trouvée que par le compromis politique et les discussions. C’est ce que nous avons d’ailleurs porté ensemble lors du G7 de Biarritz en défendant l’idée d’une conférence internationale pour la Libye incluant toutes les parties prenantes et une conférence inter-libyenne permettant cette réconciliation de toutes les parties au sein de la Libye. Vous avez rappelé ce point à l’instant. Et à ce titre, l’initiative portée par nos deux ministres des Affaires étrangères dans quelques jours à New York, rassemblant l’ensemble de leurs homologues concernés, est, à mes yeux, la mise en œuvre très concrète de cette volonté et sera, comme vous l’avez dit, une étape importante.

      Voilà sur quelques-uns des sujets importants de coopération économique, culturelle, industrielle, sur les sujets de défense dont nous allons continuer à parler dans quelques instants, sur les sujets européens, la volonté qui est la nôtre d’œuvrer ensemble. Dans quelques semaines, nous nous retrouverons autour de la table du Conseil pour parler de ces sujets et de quelques autres, et je me réjouis, Monsieur le Président du Conseil, de la perspective que vous avez ouverte d’un prochain sommet entre nos deux pays au début de l’année prochaine, qui se tiendra donc en Italie, qui nous permettra de poursuivre ce travail commun et de poursuivre aussi les travaux que nous avions lancé pour un traité du Quirinal, et donc pour parachever aussi toutes les coopérations communes entre nos deux pays.     • The “#temporary_solidarity_mechanism” on relocation of people rescued at sea - what does it say?

      Germany, France, Italy and Malta have drafted a declaration (http://www.statewatch.org/news/2019/sep/eu-temporary-voluntary-relocation-mechanism-declaration.pdf) establishing a “predictable and efficient temporary solidarity mechanism” aimed at ensuring the “dignified disembarkation” of people rescued at sea in the Mediterranean. If those rescued are eligible for international protection they will be relocated to a participating EU member state within four weeks, while ineligible persons will be subject to “effective and quick return.”

      The mechanism set out in the declaration is designed to address “the need to protect human life and provide assistance to any person in distress,” whilst preventing the emergence of any new irregular maritime routes into the EU. All signatories will be obliged to call on other EU and Schengen Member States to participate. Offers - or refusals - to do so are expected (https://www.dw.com/en/five-eu-interior-ministers-want-quotas-for-shipwrecked-refugees/a-50539788) to come at the Justice and Home Affairs Council in Luxembourg on 8 October.

      The mechanism

      Signatories to the declaration will have to ensure that persons rescued on the high seas are disembarked “in a place of safety”. Member states may also “offer an alternative place of safety on a voluntary basis”. Where rescue is carried out by a state-owned vessel, disembarkation will take place in the territory of the flag State.

      Following disembarkation, participating states should provide “swift relocation, which should not take longer than 4 weeks”, a process which will be coordinated by the European Commission - as has been the case with recent voluntary relocations (https://www.thejournal.ie/ireland-migrants-ocean-viking-4779483-Aug2019) following rescue at sea.

      The declaration requires participating states to declare pledges for relocation prior to disembarkation and “as a minimum, security and medical screening of all migrants and other relevant measures.” This should be based on “standard operating procedures, building on and improving existing practices by streamlining procedures and the full use of EURODAC,” the EU database of asylum-seekers’ fingerprints, with “support of EU Agencies, e.g. on EURODAC registration and initial interviewing.”

      It is unknown to which standard operating procedures the text refers (Statewatch has previously published those applicable in the Italian ’hotspots’ (http://statewatch.org/news/2016/may/it-hotspots-standard-operating-procedures-en.pdf)), nor what precisely “streamlining procedures” may entail for individuals seeking international protection.

      EU agencies Europol, Frontex and the European Asylum Support Office (EASO) are present in the Greek hotspots, where detainees are not provided (https://flygtning.dk/system/siden-blev-ikke-fundet?aspxerrorpath=/media/5251031/rights-at-risk_drc-policy-brief2019.pdf) with either interpreters or adequate information on removal procedures; and those in Italy, where the EU’s own Fundamental Rights Agency has identified (https://fra.europa.eu/sites/default/files/fra_uploads/fra-2019-opinion-hotspots-update-03-2019_en.pdf) a number of serious problems.

      States may cease participation in the mechanism in cases of “disproportionate migratory pressure,” to be calculated using two rather vague criteria: “limitations in reception capacities or a high number of applications for international protection.” There is no further detail on how these will be determined.

      The mechanism will be valid for no less than six months and may be renewed, although it could be terminated “in the case of misuse by third parties”, a term with no further explanation. Furthermore, if within six months the number of relocated people rises “substantially”, consultations between participating member states will begin - during which “the entire mechanism might be suspended.”

      At the same time, the text calls for “advance on the reform of the Common European Asylum System,” which should provide a binding and permanent mechanism - if the member states can ever agree on such rules.

      The announcement on the signing of the declaration by the four member states was welcomed by Amnesty International. Eva Geddie, Director of the European Institutions Office, said (https://www.amnesty.eu/news/malta-asylum-seeker-disembarkation-deal-shows-a-more-humane-approach-is-poss): “We hope this mechanism will put an end to the obscene spectacle of people left stranded on boats for weeks waiting to know where, or even if, they can disembark.” The President of the European Parliament also welcomed the news (https://www.europarl.europa.eu/news/en/press-room/20190923IPR61761/sassoli-migration-agreement-respects-fundamental-principles-of-ep-pr). The devil, however, may be in the detail.

      Return as a priority

      Return “immediately after disembarkation,” where applicable, is one of the commitments set out in paragraph 4. This seems to imply that some form of asylum assessment will take place at sea, an idea that has previously been dismissed (https://www.ecre.org/italys-proposed-idea-of-hotspots-at-sea-is-unlawful-says-asgi) as illegal and unworkable.

      Return is emphasised as a priority again in paragraph 7, which recalls the operational support role of both Frontex and the International Organisation for Migration (IOM) in “the effective and quick return of those not eligible to international protection in the EU”.

      The use of “appropriate leverages, to ensure full cooperation of countries of origin,” is encouraged. Using aid and trade policy as ’incentives’ for non-EU states to readmit their own nationals has for some years now been high on the policy agenda.

      Doublethink ahoy

      The declaration also sets out certain requirements for “all vessels engaged in rescue operations”, including “not to send light signals or any other form of communication to facilitate the departure and embarkation of vessels carrying migrants from African shores” and:

      “not to obstruct the Search and Rescue operations by official Coast Guard vessels, including the Libyan Coast Guard, and to provide for specific measures to safeguard the security of migrants and operators.”

      Whether ’rescue’ by the Libyan Coast Guard is compatible with “the security of migrants” is doubtful - return to Libya means a return to inhumane and degrading conditions and there is clear evidence (https://www.glanlaw.org/single-post/2018/05/08/Legal-action-against-Italy-over-its-coordination-of-Libyan-Coast-Guard-pull) of the Libyan Coast Guard knowingly endangering the lives of migrants in distress at sea.

      EU governments are well aware of these issues. A recent document (http://www.statewatch.org/news/2019/sep/eu-libya.htm) sent to national delegations by the Finnish Presidency of the Council highlighted that:

      Another major issue is that of migrants and refugees rescued or intercepted at sea being transferred to detention centres and the lack of traceability, transparency and accountability… The Libyan government has not taken steps to improve the situation in the centres. The government’s reluctance to address the problems raises the question of its own involvement."

      Beefing up the Libyan Coast Guard and aerial surveillance

      The increasing role of the Libyan Coast Guard - and the maritime agencies of other states such as Morocco - is being deliberately enhanced by the EU. Finance and training is being provided whilst national governments are placing increasing pressure on private rescue operations (http://www.statewatch.org/news/2019/sep/es-mo-sar.htm).

      Any member state that signs up to the declaration will be making a commitment to continue “enhancing the capacities of coast guards of southern Mediterranean third countries,” at the same time as encouraging “full respect of human rights in those countries.”

      One key means for assisting with the activities of non-EU coast guard agencies is “EU-led aerial surveillance”:

      “in order to ensure that migrant boats are detected early with a view to fight migrant smuggling networks, human trafficking and related criminal activity and minimizing the risk of loss of life at sea.”

      The EU’s Operation Sophia now has no boats and is largely relying on aerial surveillance to carry out its work. A recent internal Operation Sophia document seen by Statewatch says that:

      “Aerial assets will be used to enhance maritime situational awareness and the information collected will only be shared with the responsible regional Maritime Rescue Coordination Centres (MRCC).”

      That is likely to be the Libyan MRCC. According to a March 2019 letter (http://www.statewatch.org/analyses/no-344-Commission-and-Italy-tie-themselves-up-in-knots-over-libya.pdf) from the European Commission to Frontex’s Executive Director, the Italian MRCC also acts as a “communication relay” for its Libyan counterpart.

      Member states are urged to contribute assets to these surveillance operations. It is noteworthy that the declaration contains no call for states to provide vessels or other equipment for search and rescue operations.
