Libyan Detention Centers • A Legal Analysis
Detention of migrants in Libya is no post-2011 phenomenon. The detention centers, which are referred to by Libya as “holding centers” were established in the early 2000s, to deter migration to Libya and Europe. The modus operandi of the centers are punitive by nature. Dentention in the centres results in deprivation of freedom, devoid of proportionality and restraint.
Irregular migrants, economic migrants, refugees and asylum seekers are indistinguishable in Libyan law, and are all considered “illegal migrants”. They are vulnerable to arbitrary arrest, where they are placed in detention centers regardless of their immigration status. The detention centers themselves are described as hellish and unlivable, and an environment in which they suffer various forms of ill treatment.
The international community has turned a blind eye to Libyan migrant detention centers for more than a decade. Since the early 2000s activists and organisations, such as UNHCR, have been urging the international community, most importantly the EU and Italy, to refrain from cooperating with Libya until Libya complies with international human rights standards. Yet, the EU has strongly relied on Ghaddafi’s authoritarian regimes for their own border control.
Although detention abuse existed prior to the 2011 revolution, the civil war which ensued exacerbated the situation, leaving 500,000 Libyans displaced. In addition to this, the civil war and regional instability brought Libya’s economy to the floor, which in turn created greater animosity toward migrants. The resultant fractured government became occupied with militias, smugglers, and state and non-state actors.
Against this backdrop of chaos, the lack of border control post-2011 established Libya as a popular transit country, particularly for Sub-Saharan migrants and refugees, eventully making their way to Europe via the Mediterranean Sea. It is estimated that 700,000- 1 million migrants were inside Libya at the end of 2016, many coming into contact with detention centers.
The lack of a migration framework in the country has, effectively, given state and non-state actors control within migrant detention centers. This has left migrants with a lack of safeguards to protect their human rights. In addition, the cooperation between the EU, Libyan coastguard, and Directorate for Combatting Illegal Migration (DCIM) has enabled and normalized the abusive practices towards migrants and refugees within Libya.

The mysterious drop in the number of migrants crossing the Mediterranean
On Tuesday, the International Organization for Migration (IOM), the United Nations’ migration agency, published data on recent arrivals in Europe. The figures took experts and analysts by surprise: Compared with the 273,000 migrants who landed from January through Aug. 27, 2016, about 121,000 arrived during the same period this year. Furthermore, there was no evidence of any migrant dying in the Mediterranean since Aug. 9.

Migrant flows to islands on the rise again
From August 28 up until early on Monday, 1,092 people had arrived on the shores of the eastern Aegean islands of Lesvos, Chios, Samos, Kos and Leros, as well as other islands that lack the infrastructure to register and identify them.
To make matters worse, there have been no returns to Turkey – as part of the joint Ankara-Brussels agreement announced in March 2016 – for the last two months.

EU migration cooperation with third countries: More harm than good?
The latest Progress Report on the Partnership Framework with third countries under the European Agenda on Migration states that since the last progress report in June significant progress has been made and outlines the key actions taken since June.
According to the Commission report, key achievements include the reduction of the number of crossings on the Central Mediterranean as well as stepped up cooperation with Libya, including a new 46.3 € million project to strengthen border surveillance at the country’s sea and land border. Further, the report refers to cooperation with some Western African countries beyond the Compact countries, the Commission’s invitation to Member States to resettle people out of Libya, Niger, Sudan, Egypt and Ethiopia in 2018 in line with the 4 July Action Plan , and the stepping up of diplomatic contacts and multilateral discussion between EU, Member States and countries of transit and origin.

Migrant arrivals down 30% in 10 months - interior ministry
(ANSA) - Rome, October 31 - The number of migrants to land in Italy from January 1 up to today is 30.13% down with respect to the same period last year, the interior ministry said on Tuesday. It said a 78% drop was registered in October alone. It said arrivals from Libya were down 93% in 2017. The ministry said 111,397 migrants arrived in the first 10 months of 2017, compared to 159,427 in the same period in 2016. It said 5,984 arrived in October compared to 27,384 in the same month a year ago.
The figure for Libya was 1,917, compared to 27,384 in October 2016.

Le blocage des migrants en Libye entraîne une chute de 70% des arrivées en Italie
Selon un dernier bilan de l’Organisation internationale pour les migrations (OIM), près de 150 000 migrants sont arrivés en Europe par la Méditerranée entre janvier et octobre cette année, et au moins 2826 autres sont morts ou disparus en mer.
Si les arrivées en Espagne ont presque triplé selon l’OIM – plus de 14 000 cette année contre 5445 à la même période en 2016 –, celles enregistré en Italie ont baissé de 30% sur les 10 premiers mois de l’année : 111 000 contre près de 160 000 l’an dernier, selon les statistiques du ministère italien de l’Intérieur.
Jusqu’à fin juin, ces arrivées étaient en hausse de près de 20%, mais la tendance s’est radicalement inversée, avec une chute de 70% à partir de la mi-juillet, essentiellement du fait d’accords controversés avec les autorités, les tribus et – selon plusieurs sources libyennes que les autorités italiennes démentent – certaines milices libyennes.
A la mi-octobre, le Haut-Commissariat de l’ONU aux réfugiés (HCR) avait ainsi annoncé la découverte de plus de 14 500 migrants détenus par des trafiquants dans et autour de Sabratha, dans l’ouest du pays.
Enfermés dans des fermes, des maisons et des entrepôts, ils ont décrit « des souffrances et des abus d’une ampleur choquante », avait ajouté le HCR, estimant que 6000 autres migrants étaient encore probablement détenus dans cette zone.

I toni allarmistici del governo italiano sono stati in parte giustificati dall’aumento degli arrivi di migranti sulle coste italiane nei primi sei mesi del 2017. Da gennaio a giugno sono arrivate in Italia 83.360 persone, secondo l’Organizzazione internazionale delle migrazioni (Oim). Nello stesso periodo dell’anno precedente erano sbarcate 70.022 persone. C’è stato quindi un aumento degli arrivi del 18,7 per cento, che in numeri assoluti corrisponde a poco più di diecimila persone. Entro l’anno in Italia potrebbero arrivare più di 200mila persone, cifra già prevista dal sistema di accoglienza nazionale.

Il piano Anci ha, per ora, ha un solo dato noto agli addetti ai lavori: prevede di accogliere in un anno 200mila migranti. Cifra non poco superiore al record di 170mila immigrati sbarcati nel 2014. Ieri il consuntivo dal 1° gennaio era di 154.776 e sono attesi in queste ore altri 2mila migranti. Nel documento un’ipotesi di distribuzione prevede che i centri comunali impegnati nell’accoglienza passino da 2mila600 a 5mila200. Facendo una divisione spannometrica, con una platea di centri urbani così allargata ogni municipio avrebbe al massimo 38 migranti da ospitare, nel caso della cifra record di 200mila sbarchi in un anno.

Minniti: nuovo piano nazionale di ripartizione dei richiedenti asilo
Presidente, onorevoli deputati, il Ministero dell’interno è attualmente impegnato nell’attuazione di una pianificazione nazionale imperniata sul criterio dell’accoglienza diffusa, concordata lo scorso dicembre con l’ANCI. Tale pianificazione fissa la quota di accoglienza a 200 mila unità, parametro tuttora vigente: non vi è stata alcuna iniziativa finalizzata all’innalzamento della quota che ho indicato.

L’invasione dei migranti è una balla colossale (la nostra incapacità no)
La questione dei flussi migratori si rivela ogni giorno di più la tempesta perfetta per la fragile barca della Ue, bucherellata in pari misura dai ritardi culturali e dalle inanità politiche. In Europa si scontrano due fronti che dicono cose opposte ma fanno la stessa cosa perché, in estrema sintesi, uno non ha la testa per capire e l’altro non ha le palle per agire.

Contro i migranti una consapevole e scientifica pulizia etnica
In questo momento, sono 85mila i migranti arrivati in Italia, un dato che, a fine anno, non dovrebbe discostarsi molto da quello del 2014 (170mila) e non è affatto detto che superi quello del 2016 (181mila); ciò nonostante, da più parti si continua a parlare di record e di situazione ingestibile. E la gente ci crede, anche quella che potrebbe avere i mezzi per comprendere che è ridicolo pensare che un continente come quello europeo, con ben 28 stati membri e 503 milioni di abitanti, non sia in grado di gestire in maniera decorosa l’accoglienza di una media di 300-400 mila persone all’anno. Così come è ridicolo pensare che un Paese come l’Italia, con 60 milioni di abitanti, non sia capace di accogliere un numero così esiguo di persone, che peraltro poi si riduce drasticamente, visto che, per più della metà dei migranti, l’Italia è solo un luogo di approdo e di passaggio verso altre destinazioni.
