  • News about opening a new shelter for asylum seekers in the village of #Mala_Gorica in the vicinity of #Petrinja has been circulating for a while in the public and disturbed Petrinja’s War Veterans Initiative. The Initiative has so far launched a petition against the construction of the shelter, and recently announced the blockade of the state road to Petrinja and Sisak on the day of elections for the EU Parliament if they did not comply with their request to withdraw from the construction of the shelter. The Ministry of Internal Affairs yesterday published a press release telling the public that because of the refusal of the local community to open the shelter there, pushed them away from the idea. The funds provided for this purpose will be redirected to the reconstruction of the existing reception capacities and to the reconstruction of a number of flats owned by the Republic of Croatia for the accommodation of refugees. The script we are witnessing reminds us of the one in 2004 when the leadership of the Ministry of Internal Affairs tried to build an emplacement in the area of ​​Stubicka Slatina with the EU funds, and the citizens opposed it almost the same way as today.

  • Report to the EU Parliament on #Frontex cooperation with third countries in 2017

    A recent report by Frontex, the EU’s border agency, highlights the ongoing expansion of its activities with non-EU states.

    The report covers the agency’s cooperation with non-EU states ("third countries") in 2017, although it was only published this month.

    It notes the adoption by Frontex of an #International_Cooperation_Strategy 2018-2020, “an integral part of our multi-annual programme” which:

    “guides the Agency’s interactions with third countries and international organisations… The Strategy identified the following priority regions with which Frontex strives for closer cooperation: the Western Balkans, Turkey, North and West Africa, Sub-Saharan countries and the Horn of Africa.”

    The 2017 report on cooperation with third countries further notes that Frontex is in dialogue with Senegal, #Niger and Guinea with the aim of signing Working Agreements at some point in the future.

    The agency deployed three Frontex #Liaison_Officers in 2017 - to Niger, Serbia and Turkey - while there was also a #European_Return_Liaison_Officer deployed to #Ghana in 2018.

    The report boasts of assisting the Commission in implementing informal agreements on return (as opposed to democratically-approved readmission agreements):

    "For instance, we contributed to the development of the Standard Operating Procedures with #Bangladesh and the “Good Practices for the Implementation of Return-Related Activities with the Republic of Guinea”, all forming important elements of the EU return policy that was being developed and consolidated throughout 2017."

    At the same time:

    “The implementation of 341 Frontex coordinated and co-financed return operations by charter flights and returning 14 189 third-country nationals meant an increase in the number of return operations by 47% and increase of third-country nationals returned by 33% compared to 2016.”

    Those return operations included Frontex’s:

    “first joint return operation to #Afghanistan. The operation was organised by Hungary, with Belgium and Slovenia as participating Member States, and returned a total of 22 third country nationals to Afghanistan. In order to make this operation a success, the participating Member States and Frontex needed a coordinated support of the European Commission as well as the EU Delegation and the European Return Liaison Officers Network in Afghanistan.”

    • EP civil liberties committee against proposal to give Frontex powers to assist non-EU states with deportations

      The European Parliament’s civil liberties committee (LIBE) has agreed its position for negotiations with the Council on the new Frontex Regulation, and amongst other things it hopes to deny the border agency the possibility of assisting non-EU states with deportations.

      The position agreed by the LIBE committee removes Article 54(2) of the Commission’s proposal, which says:

      “The Agency may also launch return interventions in third countries, based on the directions set out in the multiannual strategic policy cycle, where such third country requires additional technical and operational assistance with regard to its return activities. Such intervention may consist of the deployment of return teams for the purpose of providing technical and operational assistance to return activities of the third country.”

      The report was adopted by the committee with 35 votes in favour, nine against and eight abstentions.

      When the Council reaches its position on the proposal, the two institutions will enter into secret ’trilogue’ negotiations, along with the Commission.

      Although the proposal to reinforce Frontex was only published last September, the intention is to agree a text before the European Parliament elections in May.

      The explanatory statement in the LIBE committee’s report (see below) says:

      “The Rapporteur proposes a number of amendments that should enable the Agency to better achieve its enhanced objectives. It is crucial that the Agency has the necessary border guards and equipment at its disposal whenever this is needed and especially that it is able to deploy them within a short timeframe when necessary.”

      We, the undersigned scientists, concerned citizens, innovators welcome the general structure and ambition of the proposal for an increased European Research and Innovation budget – a significant increase in a difficult situation. However, we believe that it falls short of the effort required of Europe to face the growing geopolitical challenges as well as the very high level of competition now set notably by Asian countries: gross domestic spending on R&D in the EU as percentage of GDP, which is below 2% and lags behind Korea (4.2%), Taiwan (3.3%), Japan (3.1%), USA (2.8%), China (2.1%, and constantly rising). There is a serious danger that the situation will force many promising young scientists to leave Europe, and that Europe will become less attractive for foreign scientists.

      As we are well aware, in the next decade Europe will have to rely more on its own forces to promote its values and its leadership. An cohesive Europe will need to invest in what counts for strengthening our societies, our economies, our security and our efforts in order to tackle the major global challenges of our planet. An ambitious research and innovation policy, engaging society as a whole, represents a large European added value, and will be decisive in increasing its cohesiveness.

    • ‘Secular stagnation’ meets the ‘GDP fetish’

      Tim Jackson introduces his new CUSP working paper ‘The Post-Growth Challenge’, in which he discusses the state of advanced economies ten years after the crisis. Our attempts to prop up an ailing capitalism have increased inequality, hindered ecological innovation and undermined stability, he argues.

      This week saw the launch of #System_Error a documentary #film from the prize-winning German Director #Florian_Opitz, who has made something of a reputation for himself critiquing the flaws in 21st century capitalism. The film explores our obsession with economic growth through the testimony of some of its most vociferous advocates. It’s a fascinating insight into the ‘GDP fetish’ that has dominated economic policy for over sixty years despite long-standing critiques to the contrary. Opitz’s film is a testament to the tenacity of the growth paradigm – even half a century later.

      If there’s one thing that might really throw a spanner in the works it’s that economic growth as we know it is slowly slipping away. Growth rates in advanced economies were declining already even before the crisis. The day after the film’s première in Berlin, former US treasury secretary, Larry Summers writing in the FT defended his contention (first advanced five years ago) that the growth rates expected by economists and yearned for by politicians may be a thing of the past. Sluggish growth, he has argued, is not simply the result of short-term debt overhang in the wake of the financial crisis but might just turn out to be the ‘new normal’. It’s an argument that has support, not only from other mainstream pundits, but also from national statistics: UK growth slumped to another five year low in the first quarter of 2018.

      Most reactions to the absence of growth consist in trying to get it back again as fast as possible – whatever the cost. Low interest rates, cheap money, inward investment, bank bailouts, government stimulus, land-grabs, tax havens, fiscal austerity, customs partnerships – you name it. Some of these things didn’t even make sense when put together. But at least they divert us from an inconvenient truth: that the future might look very different from the past. Were it not for a climate destabilised by carbon emissions, oceans which will soon contain more plastic than fish and a planet reeling from species loss a thousand times faster than any at time in the last 65 million years, it might not matter that they don’t add up. But is throwing good money after bad (so to speak) an effective strategy, even in its own right, when so much is still uncertain?

      How can we be sure that these increasingly desperate measures will work at all? We’ve been trying most of them for well over a decade, to very little avail. The best we’ve managed, claims Summers, is to stop things falling apart by throwing everything but the kitchen sink at monetary expansion and oscillating between stimulus and fiscal tightening (mostly the latter) as political preference dictates. The end result is a somewhat frightening sense, as the IPPR recently pointed out, that when the next crisis hits there will be neither fiscal nor monetary room for manoeuvre.

      In our latest CUSP working paper, I explore the dynamics of this emerging ‘post-growth challenge’. I believe it demands both a deeper understanding of how we got here and a wider palette of colours from which to paint the possibilities for our common future. The paper examines the underlying dynamics of secular stagnation, on both the demand and the supply side, and discusses its relationship to labour productivity growth, rising debt and resource bottlenecks.

      The toughest element in this challenge, not yet fully addressed on either the political left or the right, is the relationship between declining growth and social equity. The coordinates of inequality are now plain to see in the stagnant wage rate and declining living conditions of ordinary people. ‘Thousands upon thousands’ of people flocked to this year’s TUC march in London, making it abundantly clear that persistent inequality is threatening political stability. According to TUC general secretary Frances O’Grady ‘there is a new mood in the country; people have been very patient, but now they are demanding a new deal.’

      We have addressed the mathematics of this relationship in depth elsewhere. What we found was unexpected. The rising inequality that has haunted advanced economies in recent years wasn’t inevitable at all. Nor is it inevitable in the future. The problem lies, as I argue more specifically in this paper, not in secular stagnation itself but in our responses to it. Specifically, I suggest that rising inequality is the result of our persistent attempts to breathe new life into capitalism, in the face of underlying fundamentals that point in the opposite direction. Our growth fetish has hindered ecological innovation, reinforced inequality and exacerbated financial instability. Prosperity itself is being undone by this allegiance to growth at all costs.

      What’s clear now is that it’s time for policy-makers to take the ‘post-growth challenge’ seriously. Judging by the enthusiastic reception from the 900 or so people who attended the première of System Error in Berlin, such a strategy might have a surprising popular support.

    • Europe, It’s Time to End the Growth Dependency

      The pursuit of economic growth is not environmentally sustainable, and it is failing to reduce inequalities, foster democracy and ensure well-being of citizens. We call on the European Union, its institutions, and member states to:
      1. Constitute a special commission on Post-Growth Futures in the EU Parliament. This commission should actively debate the future of growth, devise policy alternatives for post-growth futures, and reconsider the pursuit of growth as an overarching policy goal.
      2. Prioritise social and environmental indicators. Economic policies should be evaluated in terms of their impact on human wellbeing, resource use, inequality, and the provision of decent work. These indicators should be given higher priority than GDP in decision-making.
      3. Turn the Stability and Growth Pact (SGP) into a Stability and Wellbeing Pact. The SGP is a set of rules aimed at limiting government deficits and national debt. It should be revised to ensure member states meet the basic needs of their citizens, while reducing resource use and waste emissions to a sustainable level.
      4. Establish a Ministry for Economic Transition in each member state. A new economy that focuses directly on human and ecological wellbeing could offer a much better future than one that is structurally dependent on economic growth.

    • Degrowth: A Call for Radical Abundance

      When orthodox economists first encounter the idea of degrowth, they often jump to the conclusion that the objective is to reduce GDP. And because they see GDP as equivalent to social wealth, this makes them very upset.

      Nothing could be further from the truth.

      I reject the fetishization of GDP as an objective in the existing economy, so it would make little sense for me to focus on GDP as the objective of a degrowth economy. Wanting to cut GDP is as senseless as wanting to grow it.

      The objective, rather, is to scale down the material throughput of the economy. From an ecological standpoint, that’s what matters. And indeed some orthodox economists might even agree. Where we differ is that while they persist in believing (against the evidence) that this can be done while continuing to grow GDP, I acknowledge that it is likely to result in a reduction of GDP, at least as we presently measure it. In other words, if we were to keep measuring the economy by GDP, that’s what we would see in a degrowth scenario.

      And that’s okay.

      It’s okay, because we know that human beings can thrive without extremely high levels of GDP.

      There are many pieces to this argument, but I want to focus on one here in particular. One of the core claims of degrowth economics is that by restoring public services and expanding the commons, people will be able to access the goods that they need to live well without needing high levels of income.

      Take London, for instance. Housing prices in London are astronomically high, to the point where a normal one-bedroom flat can cost upwards of $1 million. These prices are fictional; they are largely a consequence of financial speculation and quantitative easing. Now imagine if the government were to cap the price of housing at half its present level. Prices would still be outrageously high, but Londoners would suddenly be able to work and earn significantly less than they presently do without suffering any loss to their quality of life. Indeed, they would gain in terms of time they could spend with their friends and family, doing things they love, improvements to their health and mental well-being, etc.

      The fictionally high prices of housing in London require that people work unnecessarily long hours to earn unnecessary money simply in order to access decent shelter – which they were previously able to access with a fraction of the income. The consequence of this imperative is that everyone is forced to contribute unnecessarily to expanding the juggernaut of production, the output of which must in turn find an outlet in the form of ever-increasing consumption.

      This is a problem that’s as old as capitalism itself. And it has a name: enclosure.

      Ellen Wood argues that the origins of capitalism lay in the enclosure movement in England, during which wealthy elites walled off the commons and systematically forced peasants off the land in a violent, centuries-long campaign of dispossession. This period saw the abolition of the ancient “right to habitation”, once enshrined in the Charter of the Forest, which guaranteed that ordinary people should have access to the resources necessary for survival.

      Suddenly, England’s peasants found themselves subject to a new regime: in order to survive they had to compete with each other for leases on the newly privatized land. And the leases were allocated on the basis of productivity. So in order to retain their access to leases, farmers had to find ways to extract more and more from the earth, and from labor, even if it was vastly in surplus to need. If they didn’t, and if they lost their leases, they could face starvation. And of course this same force, the imperative of ever-increasing productivity, was also at work in the industrial sector.

      In other words, the birth of capitalism required the creation of scarcity. The constant creation of scarcity is the engine of the juggernaut.

      The same process unfolded around the world during European colonization. In South Africa, colonizers faced what they called “The Labour Question”: How do we get Africans to work in our mines and on our plantations for paltry wages? At the time, Africans were quite content with their subsistence lifestyles, where they had all the land and the water and the livestock they needed to thrive, and showed no inclination to do back-breaking work in European mines. The solution? Force them off their land, or make them pay taxes in European currency, which can only be acquired in exchange for labor. And if they don’t pay, punish them.

      Scarcity is the engine of capitalist expansion.

      And, crucially, the scarcity was artificially created. Created by elite accumulation, backed up by state violence. In both England and South Africa, there was no actual scarcity. The same land and forests and resources remained, just as they had always been. But they were locked up. Enclosed. In order to regain access to the means of survival, people had no choice but to participate in the juggernaut.

      Today, we feel the force of scarcity in the constant threat of unemployment. We must be ever-more productive at work or else lose our jobs to someone who will be more productive than we are. But there is a paradox: as productivity rises, less labor is needed. So workers get laid off and find themselves with no means of survival. Victims of artificial scarcity. And the state, desperate to reduce unemployment, must then find ways to grow the economy in order to create new jobs, just so that people can survive.

      And all of us workers join in the choir: Give us growth! We need jobs!

      Scarcity creates recruits to the ideology of growth.

      Even people who are concerned about ecological breakdown, which is most of us, are forced to submit to this logic: if you care about human lives, then you must call for growth. We can deal with the environment later.

      But there will be no later, because the problem of scarcity is never solved. Whenever scarcity is about to be solved, it is always quickly produced anew. Think about it: for 150 years, economists have predicted that “In the very near future our economy will be so productive and replete that we will all have to work no more than a few hours a day.” But the prediction never comes true. Because capitalism transforms even the most spectacular productivity gains not into abundance and human freedom, but into scarcity.

      It’s strange, isn’t it? The ideology of capitalism is that it is a system that generates immense abundance (so much stuff!) But in reality it is a system that relies on the constant production of scarcity.

      This conundrum was first noticed back in 1804, and became known as the Lauderdale Paradox. Lauderdale pointed out that the only way to increase “private riches” (basically, GDP) was to reduce what he called “public wealth”, or the commons. To enclose things that were once free so that people have to pay in order to access them. To illustrate, he noted that colonialists would often even burn down trees that produced nuts and fruits so that local inhabitants wouldn’t be able to live off of the natural abundance of the earth, but would be forced to work for wages in order to feed themselves.

      We see this happening today in the endless waves of privatization that have been unleashed all over the world. Education? Healthcare? Parks? Swimming pools? Social Security? Water? All social goods must be privatized – they must be made scarce. People must be made to pay in order to access them. And in order to pay, they will of course have to work, competing with each other in the labor market to be ever-more productive.

      This logic reaches its apogee in the contemporary vision of austerity. What is austerity, really? It is a desperate attempt to re-start the engines of growth by slashing public investment in social goods and social protections, chopping away at what remains of the commons so that people are cast once again at the mercy of starvation, forced to increase their productivity if they want to survive. The point of austerity is to create scarcity. Suffering – indeed, poverty – must be induced for the sake of more growth.

      It doesn’t have to be this way. We can call a halt to the madness – throw a wrench in the juggernaut. By de-enclosing social goods and restoring the commons, we can ensure that people are able to access the things that they need to live a good life without having to generate piles of income in order to do so, and without feeding the never-ending growth machine. “Private riches” may shrink, as Lauderdale pointed out, but public wealth will increase.

      In this sense, degrowth is the very opposite of austerity. While austerity calls for scarcity in order to generate growth, degrowth calls for abundance in order to render growth unnecessary.

      Degrowth, at its core, is a demand for radical abundance.

    Specifically — and it would be hard to make this up if we tried — Topple Track’s automated filter got Google to de-index this blog post by Reda, in which she details the problems in Article 13 and how it will create mandatory censorship machines, that would likely lead to massive internet censorship of perfectly legitimate content.

    Let’s repeat that so it can sink in. An automated filter helped take down an article by a Member of the EU Parliament, explaining how a (still being debated) proposal would create automated filtering systems that would take down all sorts of legitimate content.

  • The Israeli ’watergate’ scandal: The facts about Palestinian water -

    Rino Tzror is an interviewer who argues with rather than flatters his subjects. Yet last Thursday, he didn’t do his homework and let Justice Minister Tzipi Livni throw sand in the eyes of the public about everything regarding the flap over water with Martin Schulz, the president of the European Parliament.

    Livni was invited onto his Army Radio program as a sane voice who would criticize the behavior of Economy Minister Naftali Bennett and Co. toward Schulz (Bennett’s Habayit Hayehudi party stormed out of the Knesset during a speech by Schulz when he allowed himself to wonder whether indeed Israelis were allotted four times as much water as Palestinians). “I told [the EU Parliament president], ‘You are wrong, they intentionally misled you,’” she told Tzror. “‘That is not how the water is allocated. Israel gives the Palestinians more water than what we committed to in the interim agreements.’”

    The very word “gives” should have lit Tzror’s fuse. But Livni kept buttering him up in her learned tone, with her grumbles against the Palestinian position on desalinated water and the Joint Water Committee.

    So here are the facts:

    Israel doesn’t give water to the Palestinians. Rather, it sells it to them at full price.

    The Palestinians would not have been forced to buy water from Israel if it were not an occupying power which controls their natural resource, and if it were not for the Oslo II Accords, which limit the volume of water they can produce, as well as the development and maintenance of their water infrastructure.

    This 1995 interim agreement was supposed to lead to a permanent arrangement after five years. The Palestinian negotiators deluded themselves that they would gain sovereignty and thus control over their water resources.

    The Palestinians were the weak, desperate, easily tempted side and sloppy when it came to details. Therefore, in that agreement Israel imposed a scandalously uneven, humiliating and infuriating division of the water resources of the West Bank.

    The division is based on the volume of water Palestinians produced and consumed on the eve of the deal. The Palestinians were allotted 118 million cubic meters (mcm) per year from three aquifers via drilling, agricultural wells, springs and precipitation. Pay attention, Rino Tzror: the same deal allotted Israel 483 mcm annually from the same resources (and it has also exceeded this limit in some years).

    In other words, some 20 percent goes to the Palestinians living in the West Bank, and about 80 percent goes to Israelis – on both sides of the Green Line – who also enjoy resources from the rest of the country.

    Why should Palestinians agree to pay for desalinated water from Israel, which constantly robs them of the water flowing under their feet?

    The agreement’s second major scandal: Gaza’s water economy/management was condemned to be self-sufficient and made reliant on the aquifer within its borders. How can we illustrate the injustice? Let’s say the Negev residents were required to survive on aquifers in the Be’er Sheva-Arad region, without the National Water Carrier and without accounting for population growth. Overpumping in Gaza, which causes seawater and sewage to penetrate into the aquifer, has made 90 percent of the potable water undrinkable.

    Can you imagine? If Israelis had peace and justice in mind, the Oslo agreement would have developed a water infrastructure linking the Strip to the rest of the country.

    According to the deal, Israel will keep selling 27.9 mcm of water per year to the Palestinians. In its colonialist generosity, Israel agreed to recognize Palestinian future needs for an additional 80 mcm per year. It’s all detailed in the agreement with the miserly punctiliousness of a capitalist tycoon. Israel will sell some, and the Palestinians will drill for the rest, but not in the western mountain aquifer. That’s forbidden.

    But today the Palestinians produce just 87 mcm in the West Bank – 21 mcm less than Oslo allotted them. The drought, Israeli limits on development and drilling new wells, and limits on movement are the main reasons. Palestinian mismanagement is secondary. So, Israel “gives” – or rather sells – about 60 mcm per year. True. That is more than the Oslo II Accords agreed for it to sell. And the devastating conclusion: Palestinian dependence on the occupier has only increased.

    Israel retained the right of the mighty to cap infrastructure development and rehabilitation initiatives. For example, Israel has imposed on the Palestinian Authority pipes that are narrower than desired, forbids connecting communities in Area C to the water infrastructure, tarries in approving drilling, and delays replacing disintegrating pipes. Hence the 30 percent loss of water from Palestinian pipes.

    113,000 Palestinians are not connected to the water network. Hundreds of thousands of others are cut off from a regular supply during the summer months. In Area C, Israel forbids even the digging of cisterns for collecting rainwater. And that’s called giving?

    * Instead of spending time calculating whether the average Israeli household’s per-capita consumption of water is four times or “only” three times that of Palestinian consumption, open your eyes: The settlements bathed in green, and across the road Palestinian urban neighborhoods and villages are subject to a policy of water rotation. The thick pipes of Mekorot (Israel’s national water provider) are heading to the Jordan Valley settlements, and a Palestinian tractor next to them transports a rusty tank of water from afar. In the summer, the faucets run dry in Hebron and never stop flowing in Kiryat Arba and Beit Hadassah.

    All of this is intentionally misleading?

      When one mentions water in conjunction with the Middle East, there is always this “oh, yeah” reaction as people remember that this is probably the single most important issue in the region. But it is too rarely considered in political analyses. It isn’t discussed often enough in the context of the roots of the Israel-Palestine conflict, but it is absolutely fundamental to Israeli policy and Palestinian dispossession.

      The conditions described above apply only in the West Bank. In #Gaza, the situation is much worse. Gaza depends almost entirely on the coastal aquifer, which is also used by Israel and Egypt. The Palestinian Water Authority pumps more than three times the aquifer’s replenishment rate per year, and even that, due to unreliable supplies of electricity, water supply is erratic on a daily basis.

      One can expect that Israel will eventually address this issue. The siege has, from the beginning, been carefully managed by Israel to ensure the deprivation of Gaza’s population while avoiding the sort of massive death and illness that might create international outrage and force Israel to act. But the water issue, as it involves both Gaza and the West Bank, threatens to turn into something much greater.

      The subject of water is therefore a touchy one for Israel on many levels. Not only is it an issue of unequal access to this most crucial of resources, but it also illustrates the difficulties of truly separating Israel and the Palestinians. Indeed, when it comes to water, it will be impossible for Israel to end the occupation and maintain its current standard of living with regard to water. It will also be impossible for any Palestinian entity to survive without significant external investment in irrigation, water treatment, desalinization, and other methods of conserving and treating water. In other words, when it comes to water, it is highly unlikely that Israel and the Palestinians can separate from each other as the Oslo formulation of a two-state solution envisions.

    Naftali Bennett’s Habayit Hayehudi and the rest of Israel’s extreme right obviously has a new political plan: he’s in favor of Israel’s disengagement - not from the West Bank, but from the civilized world. Last week Motti Yogev from his party called the US Secretary of State Kerry an anti-Semite, and this week Bennett and his MKs storm out of the plenum in the midst of a speech by President of EU Parliament Martin Schulz. Motti Yogev, stars, once again, by shouting that Schulz is supporting someone who supports exterminating the Jews. Bennett doubles up in his Facebook page and emphasized that these words were said in German - picking up his cue from Likud MK Moshe Feiglin who said in advance that he would not attend Schulz’s speech because it would be held in German.

  • NGOs sceptical about plans of Germany’s coalition government on migration and asylum policies

    The recently agreed coalition agreement between Germany’s conservative Christian parties (Christian Democratic Union (CDU) and Christian Socialist Union (CSU)) and the centre-left Social Democratic Party (SPD) was described by ECRE Member Organisation Pro Asyl as a “general disappointment[,… promoting] migration control at EU’s borders and with only a few relaxations of asylum policies inside the country”.

    Pro Asyl criticised the reclassification of Serbia, Macedonia and Bosnia and Herzegovina as ‘safe countries of origin’. As a consequence, asylum applications lodged by persons from these countries are subjected to accelerated procedures and will be considered ‘manifestly unfounded’. Franziska Keller, Member of the EU Parliament for the Green party, has expressed concern that this will undoubtedly affect applications made by persons of Roma origin. Pro Asyl points out that in the first half of 2013 asylum seekers of Roma origin attained a 10% recognition rate in Switzerland and Belgium, demonstrating that there is still a need for international protection. “You always have to see the individual situation instead of declaring that ’certain countries are safe now’,” says Keller. Maria Böhmer, Federal Government Commissioner for Migration, Refugees and Integration, also expressed recently concerns regarding “extensive discrimination” against Roma in the Balkans.

    Contrary to the dissatisfaction voiced within the SPD and its declaration for “change in the course of European asylum policy”, referring among others to the second Lampedusa catastrophe, the coalition agreement promotes further barriers to access to EU territory. According to MEP Keller, instead of focusing on migration control, the EU needs “to create legal ways to get into Europe. But there is no mention of that in the coalition agreement". Friedo Pflüger, Director of German Jesuit Refugee Service, pointed that of the 5,000 Syrian refugees that Germany had committed to welcome in the country under the humanitarian admission programme, only 1,000 have arrived in Germany.

    Pro Asyl warns that cooperation between the EU and thus Germany with third countries, i.e. countries of origin and transit countries, on controlling irregular migration is another attempt in “using North African States as doormen to the gates of Europe by promising economic and development aid in return for keeping refugees outside of Europe”.

    Pro Asyl also criticises the missing “necessary humanitarian responses to the asylum crisis in the EU”. According to Pro Asyl, despite demands for “solidarity among EU Member States”, this is not further elaborated on within the coalition agreement.

    Pro Asyl, however, welcomes the granting of residence permits to persons who are “tolerated” on German territory (Gedulete), as they are ineligible for asylum, for many years, as long as they prove they can provide for their subsistence. This amendment would finally address the situation of almost 86,000 persons tolerated on German territory. Furthermore, processing times of asylum applications will be shortened from six to a maximum of three months for the first instance decision. Pro Asyl stresses that this expedition should not affect the quality of decisions and careful examination of individual applications. The coalition agreement also reduces the waiting period for access to the labour market to three months after the asylum application is launched rather than the previously stipulated nine months. However, the “priority rule" providing German and EU citizens prioritised access to Germany’s labour market remains applicable, which according to Pro Asyl entails a de facto prohibition of work.

    Furthermore, the coalition plans to relax restrictions on asylum seekers’ freedom of movement. Asylum seekers will be allowed to move within the state they live in, not just within the district they are registered.

    The public drafting and discussion of GPLv3 in 2006-07 was a landmark in nongovernmental transnational lawmaking. Free and open source software production communities are held together by copyright licensing, as are free cultural production communities like Wikipedia. Their efforts to improve those licenses—to increase their utility in multiple legal systems, to take account of technical and economic changes in the field, and to increase their efficiency of operation and enforcement—are among the most important examples of genuinely democratic, participatory law-making that we have experienced so far in the 21st century. In the interest of improving both the European Parliament’s access to the details of this particular process, and to assist it in self-scrutiny, with respect to its extraordinary consistency in missing its opportunities in this area, Software Freedom Law Center (SFLC) submits the records of this process, which it assisted its client, the Free Software Foundation, to design and execute.

    European Parliament president Martin Schulz has finally made a statement on the matter saying, “I don’t find it good in its current form.” This is important, because the key thing that matters in terms of getting ACTA ratified in the EU is how the EU Parliament votes.

    Of course, Schulz’s choice of words is unfortunate, because it implies (incorrectly) that ACTA is still in the negotiation process and there may be another “form.” That’s not the case. This is the final version of the document
